3 Concourt Judges lose High Court Petition
The Lusaka High Court has thrown out three ConCourt judges’ application for judicial review following their suspension by President Hakainde Hichilema claiming that it had no jurisdiction to review the decision of the President or Judicial Complaints Commission.
The court has also lifted its injunction against the disciplinary hearing that was scheduled for 30th September 2024 which the court stayed.
The 3 panel judges claims it has no jurisdiction.
President Hichilema suspended three Constitutional Court judges; Justice Anne Sitali, Justice Mungeni Mulenga and Justice Palan Mulonda following recommendations from the JCC.
These Lungu stooges will dance “pelete” and “ndendeule” once they get jettisoned. Palan behaved as a Lungu proxy just like his father EZ Mulonda was Roy Miti’s stooge at ZESCO. Who didn’t know his father’s bulldog-like loyalty in the 70s and 80s??? Like father like son I guess.
Surely they have the appeal option to the Court of Appeal and even the Supreme Court itself. The senior-most judges should always have the last word on this matter.
What is the latin word for legal jursidation? And these Judges didnt see this coming? And they interpretate the law?
Maawee…
The three Judges should seize the opportunity to appear before the JCC and exculpate themselves, if indeed they were just performing their duties, when they delivered their RULING.
That is just buying time baba. The Judgement in this case will make interesting reading. The Judge must be on firm ground in his/her ruling on the matter.
Besides while the appeal is being heard. Will the 3 Judges hear matters? What will the perception on their rulings? In the interest if the institution. They sit around but the dye seems to have been cast.
If they have any respect for the institution respect the ruling and face the JCC. If they have a leg to stand on in JCC; we will see them back on the bench.
