APPOINTMENT OF FINANCE MINISTER TAKEN TO CONCOURT

Solicitor General Marshal Muchende has asked the Constitutional Court to throw away the petition filed by a governance activist Isaac Mwanza who is asking the court to give an interpretation of whether or not a Member of Parliament can be sworn in as Minister without taking parliamentary oath.

In this matter, Mr Mwanza wants the court to give an interpretation in terms of whether or not a person appointed to the office of the Minister can perform Ministerial functions before taking oath in parliament as the case with Minister of Finance Situmbeko Musokotwane.

However, when the matter came up yesterday, the Solicitor General told the Court that Mr Mwanza has moved the court wrongly on many issues against the court’s guidance and as such, he has asked the court to dismiss the matter and that Mr Mwanza should bear the costs.
