CHITAMBALA MWEWA IS NOT FOLLOWING THE LAW, HE MIGHT BE SUED SAYS KAMANGA.

Former Lusaka Mayor and Permanent Secretary Elias Kamanga says Mayor-elect Chitambala Mwewa is not following the law in his efforts to remove street vendors from undesignated trading areas.

Mr. Kamanga says Mr. Mwewa is acting prematurely because he has not yet been formally installed as Mayor of Lusaka.

He argues that, until the new mayor and councillors are officially installed, Mr. Mwewa does not have the legal authority to make decisions on behalf of the Lusaka City Council.

Mr. Kamanga has warned that actions taken before the formal installation could trigger legal battles, particularly where decisions involve the use of council resources, the relocation of traders and coordination with law-enforcement agencies.

He, however, says he supports the objective of Mr. Mwewa’s Operation Clear Path, which seeks to restore order and improve the cleanliness and functionality of Lusaka.

Mr. Kamanga argues that because the newly elected councils and mayors have not yet been formally installed, questions arise over whether major decisions affecting thousands of traders and council operations have followed the required legal and administrative procedures.

He says council decisions should ordinarily be properly considered, resolved and recorded to ensure that they can withstand any potential legal challenge.

His comments come as the Lusaka City Council moves into Phase Two of Operation Clear Path, targeting Katondo Street, unauthorised bus operations, wheelbarrow traders and other activities taking place in undesignated areas

The council maintains that traders should operate from recognised markets and says enforcement of the city’s regulations will continue.

  1. Chitambala is doing what idiots like you failed to do. Where is the harm in giving him the credit ?? Very evil minded people. You are also a beneficiary of Chitambala’s efforts, but here you are shamelessly wishing him ill.

As for suing him, let them go ahead. And you can join them if you wish. Street vending is illegal under local government by-laws. As a former Mayor you should know this. Those wishing to sue are basically entitled criminals. We have allowed the abnormal to prevail for so long that wrongdoers even think they have the right to continue selling us vegetables and fruits laced with their sh!t containing cholera bacteria because there are no toilets, no running water to secure the cleanliness and hygiene of what is being sold. Very backward thinking.
No wonder Donald Trump call us SH!THOLE COUNTRIES. The sh!t starts in our heads, our type of mindset, before reaching the other end.

  2. 1. Does the Council need to make a decision to remove street vendors?
    2. Did the vendors apply to the Council and obtain a decision for them to conduct business on the streets?
3.Do all the functions of the Council cease to operate when it’s political office bearers vacate office?
    4. Does the power of a Mayor originate from an election or from the ceremonial installation? Can a Major who has not been ceremonially installed exercise any powers of that office?

  3. Who is this chap anyway? I have never heard of him. Just give us a clean city. We will talk about the process later when decency and cleanliness becomes culture. For now take your legal knowledge to the markets. We don’t want you on our streets.
