CONCOURT DECLARES SHAKAFUSWA & KANG ’OMBE DULY ELECTED MPs
The Constitutional Court has upheld the election of CHRISTOPHER SHAKAFUSWA and CHRISTOPHER KANG’OMBE as the duly elected Members of Parliament for Mandevu and Kamfinsa Constituencies respectively.
Constitutional Court Judge MUNGENI MULENGA in a judgment read by Master of the Court, MABLE MWABA said losing UPND candidate AARON MULOPE in Mandevu Constituency failed to prove the allegations of corruption and violence.
The Court therefore could not fault the findings of High Court Judge DERRICK MULENGA who dismissed Mr. MULOPE’S petition and upheld Mr. SHAKAFUSWA’s election.
The Court stated that nine out of 10 groups of appeal raised by Mr. MULOPE lack merit and dismissed the appeal.
And reading the Judgment in the appeal against Mr. KANG’OMBE’s election, Judge JUDY MULONGOTI said the grounds of appeal by UPND Losing Candidate SUBETA MUTELO lacked merit.
She said the appeal is dismissed as the appellant failed to provide evidence to the required standard of the fairly high degree of convincing clarity.
