DISCLOSE DETAILS OF CONSENT JUDGEMENT THAT HAS ALLOWED MINES NOT TO PAY NEW TARRIF RATES SINCE 2015

ZESCO and ERB must disclose how much ZESCO will lose in the Consent Judgement recently entered between the entities and the seven mines.

In 2015, SEVEN mining companies sued ERB for allegedly unlawfully allowing Zesco and the Copperbelt Energy Company (CEC) to increase tariffs.

ERB, ZESCO and CEC have entered into a Consent Judgement woth the seven mines and the mines don’t have to pay the billions owed since 2015!

If Lumwana alone doesn’t have to pay $228million, what about the other six mines?

Further, ERB and ZESCO have to explain if the tarrifs will reverse to the ridiculous charge of 3 cents per Kilo Watts from the 10.5% prescribed in 2015, and 2016.

Publish the details of this Consent Judgement.

  1. Why should they?. Did your party publish anything of any agreements entered into? The Eurobonds were full details published? And when I hey we’re due you failed to start paying back. Shame on you.! If only laws would be reversed so that the party that was in power then pays for all those past debts mwebantu, no party in power in future would ever be careless. So balekeni ba UPND to do as they see fit. We trust them and hope they continue with strategies to heal this economy.

  2. Details of the consent judgment are available to the public as a matter of a court record in addition to filings mandated by the SEC.
    Secondly, the reversals via credit notes do not constitute losses because the revised tariffs were ultra vires, illegal, and with no reasonable basis.
    If an intoxicated landlord suddenly increases rent by 1000% only to revoke the increase the next morning once sober, that could never be construed as a lost income to the landlord. Unless of course that landlord is someone like Muamba.
    Similarly, if the stinking Mopani $ 1.5bn deal is reversed, that could never be deemed as a lost income to the corrupt Glencore enterprise.
    Politicizing everything, including commercial transactions, is proof that the PF have run out of ideas and are now graspping at straws.
