GRANNY PUNCHES: MAN 83 IN COURT FOR ASSAULTING FELLOW 91
AN 83-year-old senior citizen of Mapanza Chiefdom has appeared before the Choma Magistrate court for assaulting a 91-year old man by punching and twisting his arm over a land dispute.
Byta FM Court Beat Journalist reports that this is in a matter where Samson Simusa is charged with one count of Assault Occasioning Actual Bodily Harm, contrary to the laws of Zambia.
Details of the offense are that the defendant on 10th November, 2022, did assault Andrew Muleya.
During trial, Muleya told the Court that Simusa did not only punch him with his feast on the left cheek, but also twisted his arm, causing him severe pain.
And in cross-examination, the defendant asked Muleya what he was doing on the land in question when the Chief gave an order that he should not be there.
Muleya however responded that the restraining order was only by word of mouth and not in written, hence he cannot abide by it.
Meanwhile, grandson to the plaintiff, Jacob Mwaanga, told the Court that the defendant hit his grandfather on the chest and not the cheek.
When put on his defense, Simusa stated that he is actually the victim in the matter because Muleya was the one who hit him on his left shoulder with his feast.
Magistrate Ethel Phiri has since adjourned the matter to 28th February, 2023 for judgment.
