HIGH COURT HAS NOT LIFTED SAMPA’S SUSPENSION
Am constantly getting inquiries on what this exparte order signed by the High Court means and its implications. As you may see, am avoiding partisan politics but this being an issue that concerns democracy, here is a simple issue:
There is no mention that the Court has lifted the suspension of Hon Miles Sampa. The suspension of Mr Sampa is subject to determination by the Court in the main matter and could not be lifted by an exparte court order.
His lawyers crafted the court order to stop the party from suspending or expelling Mr Sampa who has already been suspended. Nothing is mentioned about lifting the suspension that was already slapped on him and remains in effect.
The Party acting President and Acting Secretary General have also temporarily been restrained from acting as such until the matter is heard on 16th February, 2023.
That being the case, the PF National Chairman, by the party rules, can convene the Central Committee meeting even before 16th Feb to discuss any other matter apart from matters they have been restrained from acting on.
Since his suspension has not been lifted by the Court, he may not actually attend such a meeting until his suspension is lifted or set aside by the Court.
That being said, I am not privy as to the merits and demerits of why Hon Sampa was suspended. That is a matter for them as a political party and for Miles.
