HIGH COURT ORDERS STATE TO PRESENT KELVIN KAUNDA FOR BAIL HEARING ON OCTOBER 27

The Lusaka High Court has ordered the state to present Lima Constituency Member of Parliament Kelvin Kaunda before Judge Kaumbi Ndulo on October 27, 2026, for hearing of his application for bail pending trial.

Mr. Kaunda has been in detention since October 15, 2026, after being charged with assault occasioning actual bodily harm, contrary to Section 248 of the penal code.

In his application before the high court, Mr. Kaunda is challenging his continued detention without being presented before a court of competent jurisdiction, despite having been charged with the alleged offence.

He argues that the prolonged detention has left him without a definite date for his release or appearance in court, prompting him to seek the intervention of the High Court.

Mr. Kaunda has submitted that the offence is bailable and maintains that he has a fixed place of residence and is not a flight risk.

He has also indicated his readiness to provide traceable sureties, comply with any bail conditions imposed by the court and refrain from interfering with witnesses.

The application is being made under section 123 of the Criminal Procedure Code, which empowers the High Court to admit an accused person to bail pending trial.
