I thought my husband’s friend gave me K700 out of good will
…as Monze man demands over K2, 000 compensation in accumulated interest.
A man of Monze’s Chikwala area has lost his claim of interest over the money he lent his friend’s wife after the woman told the Urban Local Court that she thought he gave her the money out of good will.
Byta FM Monze Court Journalists reports that Mutinta Mulenga of Manungu Compound denied knowing the K700 that Lawrence Michelo he gave her in May 2021 attracted a monthly interest charge of 25-percent.
Michelo admits in the Monze Urban Local Court Mulenga repaid the K700, but he is demanding K2, 700 Compensation which he says is interest that has accumulated over time.
He testifies that Mulenga came to his home asking to borrow a K700, which he gave her on an oral agreement that she pays a monthly interest at 25 percent.
But Mulenga says Michelo – whom she refers to as ‘Ba Scorpion’, did not inform her that the money accumulates interest.
She says Scorpion gave her the money out of goodwill, as he is her husband’s friend, questioning why he wants more money when he was paid in full.
Senior Local Magistrates Pauline Shawa & Hellen Moonga dismissed the case on premise that local courts only have jurisdiction to hear matters of principle and not of interest payments.
They observe that Mulenga paid Michelo’s principle in full, leaving him with no justified claim.
