KASONDE MWENDA CALLS FOR RESPECT FOR COURT ORDERS AND THE RULE OF LAW IN THE MUKANDILA CASE

Economic Freedom Fighters-EFF President Kasonde Mwenda has raised concerns over the continued detention of Tonse-Pamodzi Alliance Secretary General Celestine Mukandila.

Mr. Mwenda alleges that Mr. Mukandila was taken to the University Teaching Hospital, UTH, for a medical procedure aimed at determining his age.

He has questioned the legality and necessity of the procedure, arguing that it infringes on Mr. Mukandila’s constitutional rights.

Mr. Mwenda has also cited the 25th September 2026 High Court judgment in the matter involving Mr. Mukandila, saying the court addressed concerns surrounding his prolonged detention and the transfer of the matter between government institutions.

According to Mr. Mwenda, Mr. Mukandila has remained in detention for more than 40 days despite the court granting bail

The EFF President has consequently called on the government to respect court orders and uphold the rule of law.

Mr. Mwenda further expressed concern that continued disputes over constitutional and legal protections could affect investor confidence in the country.

The allegations made by the EFF President have not been independently verified, and the position of the relevant government authorities has not been included in the statement.

He writes:

UPND govt found GUILTY of abusing the LAW Again😢 and Celestine Mukandila dragged to UTH for age  operation by DPP

It is regrettable that UPND’s govt DPP Gilbert Phiri dragged Mr. Celestine Mukandila to UTH (University Teaching Hospital) and conducted a medical operation to determine his age 😢, this is an affront on his constitutional rights. This medical procedure is predominantly used to ascertain age of defilement victims and hence should not be abused to target political opponents for humiliation.
This has unsettled his family who feel traumatized and abused by the State.

Secondly, the High Court Judgement of 25 September 2026 has found the UPND Govt guilty of breaking the Law in the case involving the prolonged detention of Mr. Celestine Mukandila Tonse-Pamodzi Alliance SG. This is in the matter where the state  Illegally transferred Mr. Celestine Mukandila from one government body to another as it held him in perpetual detention. Bail has again been granted as the earlier one was ignored by the state, however Mr. Celestine Mukandila still remains detained for over 40 days now.

As Economic Freedom Fighters-EFF we are saddened by the continued disregard for the Courts and the Rule of Law by Mr. Hakainde Hichilema’s government. We demand for the rule of law to be respected because Zambia is a constitutional Democracy where laws govern not individuals. Zambia is unfortunately descending into an autocracy and this will cost us investments and our economy will continue falling for lack of Investor Confidence in our legal system.

Wherever we want to go our feet will take us there.

Kasonde Mwenda C
Economic Freedom Fighters-EFF President,
Member of the Tonse-Pamodzi Alliance Council of Presidents.

  1. Medical determination of someone’s age does not require an “operation”. The process includes a combination of simple physical examination (his hair is already turning grey and white) and a few xrays to see which bone ossification centres have calcified and if there is evidence of age related bone disease such as osteoarthritis. There is no invasive procedure or cutting open of any body parts. This Mwenda buffoon is just trying to milk public sympathy by playing the victim. And telling blatant lies.

If the State has reason to doubt the suspected Congolese lied about his age on official identity documents, the State has every right to seek medical estimation of the same. And if the Congolese didn’t lie about his age, he has nothing to fear.

Please stop demonising the State as it carries out it’s duty to protect genuine Zambian citizens. This is work carried out by security wings, not the UPND as a political party.

  2. Mwenda lied about the delays to Alick Banda from detention yesterday. Yet the onous was on the detained person meeting the bail conditions. Is this his version of “checks and balances?”
Checks and balances ia not spreading lies. Misinforming the nation. Misleading the masses just to push a particular narrative. Of what value are lies to the lives of Zambians? Day in day out we read naratives yet those naratives have little or nothing to do with uplifting the lives of vulnerable Zambians. It has everything to do with political personalities and persons. Its about them and their egos. Their limelight. Where is the service to Zambians?
Lets have maturity in our politics. Enough of self centered egomatics who want to project that without them. We dont have the right to live. Without their access to the treasury. We are not free. Without them being in power Zambia is at a stand still. Their only reason they speak is to be employed. Voted into office. While they do nothing but leeche off the state like parasites.
