MALANJI, LUSAMBO WERE NEVER DISQUALIFIED BY THE CONCOURT

Electoral Commission of Zambia says it will not accept nominations from any candidate who caused a vacancy in the National Assembly.

This is illegal. Article 72 (4) (h) says if the vacancy is caused by the decision of the Constitutional Court.

The Constitutional Court has not rendered such a decision.

Let us be clear, the two election petitions were nullified by the High Court and upheld by Constitutional Court. But the candidates were NEVER DISQUALIFIED. There is no such decision rendered by the High Court or the Constitutional Court.

In both the High Court and Constitutional Court Judgements of the two candidates were never disqualified although their elections were nullified.

ECZ must stop these political games.

Article 72 (4) (h) due to results of (h) a decision of the Constitutional Court.

Article 72 of the Zambian Constitution 2016 amended.

4) A person who causes a vacancy in the National Assembly due to the reasons specified under clause (2) (a), (b), (c), (d), (g) and (h) shall not, during the term of that Parliament— (a) be eligible to contest an election; or (b) hold public office.
