LESA Kasoma, the wife to National Restoration Party (NAREP) president Stephen Nyirenda has asked the Lusaka High Court to dismiss a case in which her husband sued her for fraudulently adding her name to a title deed.

Nyirenda last month dragged his wife to court for forging his signature and fraudulently adding her name to a title deed for his farm in Roma Township.

He is seeking an order for cancellation of the certificate of title for Subdivision A of Subdivision No 175 of Farm No 44a situate in Roma.

Nyirenda further wants the court to compel the Ministry of Lands to re-issue the certificate of title in his name as it appeared prior to the fraudulent deed of moiety lodged on June 19, 2019 by Lesa.

But Lesa, the proprietor of Komboni Radio Station, has filed an affidavit, seeking to set aside the case for irregularity.

She stated that she was shocked to have received the court summons when she was never served with any letter of demand setting out claims and circumstances surrounding the claim in detail.

Lesa stated that before being served with the writ and statement of claim, she just read a story pertaining to the matter on social media, including Mwebantu who published the story on October 18, 2021.

She stated that through a search conducted by her lawyers on October 20, 2021, it was discovered that Nyirenda through his lawyers filed writ of summons, statement of claim, list of witnesses and documents and also a demand letter indicating service upon the Ministry of Justice.

Lesa stated that the demand letter was served on the Ministry of Justice and not on her or her lawyers.

She added that there was no attempt to serve her the demand letter and therefore, the matter should be dismissed for irregularity.
