DEFILED GIRL’S MOTHER OPTS FOR 2 FAT COWS AS OPPOSED TO SENDING DEFILER TO PRISON
A Lusaka mother of a girl who was defiled and impregnated has opted to be compensated with her two fat cows as opposed to having the defiler prosecuted for the sexual offence.
This is in a case before the Matero Local Court involving a 15-year-old girl alleged to have been defiled on different occasions.
According to the Zambia Daily Mail, the mother, alias Mary, wants Davy Kayula to compensate her with two fat animals and not to go prison for having carnal knowledge of her daughter which resulted in a pregnancy.
However, before the court could hear Mary’s statement, magistrate Lewis Mumba summoned the victim to stand before him.
The girl told the court that Kayula had carnal knowledge of her on three occasions at different places, including his kantemba and an unfinished building.
“He is my boyfriend. We had sex three times and after each encounter he would give me K50. I am now three months pregnant and he is responsible,” said the girl, who cannot be identified because she is a minor.
According to the girl’s mother, Kayula denied being responsible for the pregnancy.
She said after summoning him three times, Kayula continued to deny responsibility, prompting her to sue him.
“I want this man to just compensate me with two fat cows for impregnating my daughter and also buy things in preparation for the baby’s delivery,” she said.
In his defence, Kayula admitted having sex with the minor.
“It is true I had sex with her in my shop, but I used protection and was shocked when she started giving false information that I was responsible for her pregnancy,” he said.
However, Kayula later contradicted himself, telling the court that he was responsible for the pregnancy and that the victim’s family had attempted to have her abort it.
In his judgment, local court magistrate Mumba noted that the girl came from a family which sells kachasu and that her guardians were mostly drunk, including those who were before the court.
He also noted that the matter involved defilement and questioned why the victim’s mother had decided to sue the suspect for compensation.
Local court magistrate Mumba ordered Kayula to compensate the complainant with K15,000, to be paid in monthly instalments of K500, with the first instalment of K2,000 due at the end of September.
