DEMOCRATS PLAN DAY ONE AI BAN WITH 20-YEAR PRISON TERMS AS CHINA RACES AHEAD
Arizona Rep. Yassamin Ansari wants a full stop on advanced artificial intelligence the moment Democrats take control of Congress in January. In a post on X the day after the midterms she declared: “Top of the Democratic agenda on day 1 needs to be a pause on advanced AI development, regulation of this out of control industry, and a ban on artificial superintelligence.”
The vehicle is the Ban Artificial Superintelligence Act, introduced in September by Sen. Bernie Sanders and Rep. Greg Casar. Ansari is one of the House co-sponsors. The bill permanently bans any system that exceeds human cognitive performance across most domains or that could destroy or disempower humanity. It also freezes training, modification, or deployment of “advanced” models—those trained on 10^25 or more operations—until a brand-new cabinet-level Department of Artificial Intelligence is fully staffed, writes rules, and stands up a model-review process.
Violators face the nuclear-weapons treatment. Individuals can get up to 20 years in prison. Companies face what the sponsors call the “corporate death penalty.” The new agency would monitor frontier models in real time and order the removal of capabilities it deems dangerous, including the ability to ignore shutdown commands.
Sanders has been blunt: “Scientists have been clear: AI is an existential threat to humanity. It must be treated as such.” Casar adds that the measure is needed because “Donald Trump says he wants to encourage it.” Ansari has repeated the same line for months: “Ban artificial superintelligence and immediately pause any further development.”
An NBC News exit poll found that AI and data centers were a “crucial or major factor” for 56 percent of voters. Democrats are treating that as a mandate to hand the next generation of computing to Beijing. While American labs would be forced to wait for a new bureaucracy and risk prison for pushing the frontier, Chinese labs face no such restraint.
The bill remains in committee. With Trump still in the White House for two more years, any version that reaches his desk faces a veto. Still, the message from the incoming Democratic majority is clear: the priority is not American leadership or economic growth. It is a government veto over the most powerful technology on the planet, enforced by a new cabinet department and two-decade prison sentences.
