Hakainde Hichilema (HH) is a Zambian politician and businessman who was born on June 4, 1962 in Monze, Zambia. He is a father of three children (Miyanda, Habwela and Chikonka) and is married to Mutinta Hichilema. HH spent his formative years in Southern province of Zambia, where he attended local primary schools and pursued high school education at Kalomo Secondary School. Upon completion of high school education, he was admitted in the School of Humanities and Social Science at the University of Zambia where he graduated with a BA in Economics and Business Administration in 1986. He thereafter pursued an MBA in Finance and Business Strategy at the University of Birmingham in the United Kingdom.

HH had an illustrious career as a business and management expert that culminated in his rising to the position of Chief Executive Officer of Coopers and Lybrand (C&L) at the age of 26 years and later he become CEO for Grant Thornton (GT) for 12 years. Both C&L and GT are leading international professional services firms providing corporate finance, accounting, auditing, corporate recovery, management consultancy and tax advisory services to several reputable clients. These firms are member organizations of C&L International and GT International respectively which operate in more than 130 countries worldwide.

HH has been and remains one of the leading lights in business with wide experience in Zambia, Southern Africa, United Kingdom and other countries at operational and executive management levels. He served/serves on numerous boards of corporate entities including; as Chairman of the Board of Directors – Barclays Bank Zambia Plc., Sun International (Z) Ltd, Africa Trade Insurance a multilateral Pan African organization based in Kenya, Greenbelt Fertilizers Limited, Media Trust Fund and Export Development Programme II.

He was member of the Board of Directors of ; Zambia Investment Limited, Seedco Zambia Limited, African Life Financial Services, Zambezi Nickel (Bermuda) Limited, Westlake Investment Ltd. (Mauritius), Zambia Association of Chambers of Commerce and Industry (ZACCI), Zambia Business Forum, C&L’s Africa Governing board, C&L International’s Governance Committee, GT International Governance board, Zambia Consolidated Copper Mines (Smelterco) Limited and he served on boards of eight other companies.

HH has been active in the business community and has a strong high level private and public sector network locally and internationally. Over years HH has participated in community work such as building clinics, schools, livestock dip tanks, dams, boreholes and founding a cultural fund that finances the revival of cultural ceremonies in Zambia.

HH retired in 2006 to pursue community service initiatives and within a short period of retiring from the corporate world he entered active politics as a member of the opposition United Party for National Development (UPND), a liberal political party whose formation he supported as a technocrat. Following the death of the UPND founding President Anderson Kambela Mazoka, he was elected as the party’s new President. Within 50 days of becoming President of the UPND, he was elected as the flag bearer of the United Democratic Alliance, an alliance of three opposition political parties. Since entering politics HH has been arrested more than a dozen times.

He has since participated in five elections each time increasing his tally of votes. In the recent 2016 elections, he narrowly lost the Presidency to Edgar Chagwa Lungu who won the disputed elections by about 13,000 votes to garner the 50 plus one threshold.

In a move seen as effort to tighten Edgar Lungu’s grip on power, a state of emergency was declared and HH was arrested on trumped charges on suspicion of treason (over an alleged traffic offense in a convoy he was just a passenger). He spent 127 days mostly in solitary confinement at the country’s Mukobeko Maximum Prison – that house death row inmates and those serving life sentences. His treason charges were dropped through efforts of the Zambians from all walks of life, church in Zambia, former Nigerian President Olusegun Obasanjo and Baroness Patricia Scotland the Commonwealth Secretary General and politicians abroad.

HH is a focused politician, driven by his unwavering desire to see Zambia realize its full potential by harnessing its valuable resources, people and natural resources, to improve the quality of life for all its citizens. Anchored on his respect for equality of all citizens, rule of law and the democratic rights for every citizen to unconditional association and free speech, he has and continues to exhibit leadership and political maturity to navigate all political challenges thrown his way in the ever tighten political space in the country.

His fight to uplift the standards of living for all Zambians has no limits of personal sacrifice. All for the love of his fellow Zambians, that he wishes to one day experience the Zambia they all aspire to and envision.

Wealth Gain Of Political Leaders Under Scrutiny
In recent days questions about how UPND President Hakainde Hichilema accumulated his wealth and the role he played in the privatisation process have resurfaced. Edith Nawakwi is among those to accuse him of abusing the process for his own benefit.

Government has responded by saying that it is disturbed by the allegations and is studying the matter closely. However, these allegations are nothing new. In fact they are years old and appear to resurface each time Government grows concerned by its own popularity, only to fade away again when no further action is taken. Back in 2013 then President Michael Sata directed the then Director of Public Prosecution (DPP) Mutembo Nchito to establish whether Hichilema could be prosecuted for stealing his wealth.

Hichilema has also responded to the claims, calling on Nawakwi to apologise for calling him a thief and desist in making defamatory statements or face legal action.

In a letter from Hichilema’s lawyers they accuse Nawakwi of making, “false, malicious and defamatory statements (“the defamatory statements”) against our client whose aim, purpose and effect was, inter alia, to expose our client to hatred, contempt and ridicule; to embarrass him in the eyes of the general public; to lower our client’s reputation in the estimation of right thinking members of society; to cause him to be shunned and avoided; and generally to create an impression in the minds of the global community, given our client’s international repute as a businessman and politician, that our client is a thief and/or a person of miscreant behaviour who does not respect the rule of law or deserve to hold public office as President of the Republic of Zambia, for which our client aspires.” The letter goes on to set out Hichilema’s defence to the allegations made by Nawakwi.

Meanwhile, Bishop John Mambo has suggested that President Lungu should instead explain how he grew his wealth from K2.1 million to K22 million in one year of being President.

“Those that come to equity must come with clean hands. While government officials are asking HH to account for his wealth and role in the privatization process, which is honestly a fair question, those calling for accountability must be reminded that they have not themselves explained to citizens how they suddenly become rich after assuming public office as soon as 2015,” Bishop Mambo has stated.

“We do not think that it is right for government to join those throwing stones at a citizen who whose firm was hired to carry out the work as assigned to him by government,” Mambo also commented.

“Surely if this not witch-hunt against a political opponent by those in government, then what is it?” he asked.

KCM valued at $1.2billion sold for $25 million- Now that’s Privatisation That Hurts

In 2003, an unknown Indian mining and non-ferrous metals company, Vedanta Resources Limited bought Zambia’s largest copper mine.

The company pledged to pay $25million for 51% shares of the mine.

Konkola Copper Mines(KCM) had mine assets at Nchanga, Konkola, Nkana mines and the Nampundwe pyrite mine.

It also had the Nchanga, Nkana Smelters and Nkana Refinery.

World Bank had hired a London consultant firm, N.M. Rothschild to assess the value of the ZCCM assets during the failed sale to Kafue Consortium in 1996 and the subsequent sale to Anglo-America in 1998-99.

The share value of KCM was deemed at $1.2billion but with a market value of $650million owing to the persistent and prevailing low copper price.

WHY KCM WAS BEING SOLD

Shortly after the 2001 elections, Anglo-America Corporation announced that it was abandoning KCM, a mine it had just bought in October 1999 and was pulling out of Zambia.

Anglo-America through its subsidiary, Zambia Copper Investment (ZCI ) had bought an 80% stake (Nchanga, Konkola Divisions and Nampundwe) for $90million ($30m cash and $60m deferred payment to be paid 5 years later beginning 2006).

The deal also included a copper/cobalt price participation and sharing scheme to cap at $125million.

The new shareholding in the new company now called Konkola Copper Mines (KCM) was ZCI, 65%, ZCCM-IH 20% and 7.5% held by the World Bank’s International Finance Corporation (IFC).

The new owners pledged to develop and modernise the mines.

Anglo-America also pledged to invest $500m in the Konkola Deep Project, an area with vast copper/cobalt deposits which would extend the life of the mine.

At the same time Glencore and First Quantum bought Mufulira Division and Nkana Mines to form Mopani Copper Mines(MCM) and pledged an investment of $153 million.

ANGLO-AMERICA ABANDONS KCM IN 2002

But both the Anglo-America, CDC and IFC exited abruptly after the 2001 elections.

On 24 January 2002, Anglo America announced that, in view of the alleged substantial losses suffered by KCM, the weak outlook for the copper and cobalt markets and the non-availability of project finance for the Konkola Deep Mining Project, the company could not justify investing further funds in KCM over and above those committed at the time of vesting.

In September 2002 Anglo America, IFC and CDC formally withdrew as shareholders of KCM, leaving a restructured company whose main shareholders were ZCCM IH and ZCI.

ENTER VEDANTA

Vedanta Resources and its Chairman Anil Agarwal visited Zambia in 2003.

Later an announcement was made that Vedanta Resources would acquire 51% control stake of KCM.

On November 5, 2004, announced that it had completed the acquisition of a 51% interest in Konkola Copper Mines.

Veteran Businessman and Entrepreneur, Andrew Sardanis in his book; ” A Venture in Africa” discusses this unusual sale.

“The government through ZCCM-IH and ZCI (Anglo’s subsidiary) handed over 51% control of KCM by allowing Vedanta to subscribe to new capital for $25million”.

“Vedanta also paid $23.2million to ZCI (Anglo-America)”.

ZCI shares were diluted but remained with 28.4%, while ZCCM-IH held 20.6% and Vedanta held 51%!

The book reveals that instead of paying the $25million to government as committed, Vedanta instead paid only paid $16.8million!

VEDANTA MAKES PROFITS

Since Vedanta is listed in London, it is obliged to provide financial information.

After buying KCM for $25million, revenue from its businesses jumped and started making over US$3,701.8 ($3.7 billion) million in every fiscal year and by 2009 the revenue reached US$6,578.9 million($6.5billion).

CONCLUSION

Imagine that the Zambian Government was paid $25million for 51% shares in KCM while Anglo-America (Zambia Copper Investment) was paid $213m for its remaining 28.4% shares.in 2008 (in addition to the $23.2million paid in 2003)!

By 2008, Vedanta Resources now held a shareholding of 80% while ZCCM-IH held the 20%.

Now that’s the trouble with privatisation crimes or any corporate crimes!

They are complex, detailed and might be difficult to unravel as they involve lawyers, multinationals, businessmen and public officials.

The trick is simple!

It appears that state assets are obtained at cheap prices but covered by making huge investment pledges that in many cases are never fulfilled while the investor milks the assets to the bone!

We’re not going to allow HH to suffer – Central UPND

THE UPND structures in Central Province say they will not abandon party leader Hakainde Hichilema to be maligned by the PF and its sponsored voices, on the privatisation debate.

Provincial chairman Albert Chifita and Kabwe district UPND chairman Cosmas Musumpuka addressed journalists at Luchi Lodge in Kabwe on Friday.

Mumbwa Central member of parliament Credo Nanjuwa also spoke at the event, on his own behalf and that of other UPND lawmakers from Central Province.

Chifita said the privatisation topic in Zambia was about politics and that it would continue to be a subject for people with malicious mindsets

“[But] as Central Province, we are saying enough is enough. We are saying if HH is brought to Mukobeko in Kabwe, Central Province would react. We are not going to allow a situation where HH is going to suffer, when we know this is politics,” Chifita warned.

He charged that FDD president Edith Nawakwi had exposed her “shallow mindedness in the manner she continues to” link privatisation solely to Hichilema.

“We are aware as UPND that Edith Nawakwi is part of PF – she was promised a job. Now, she has to do this assignment on behalf of PF in order to make HH not to appear on the ballot paper next year. [But] that will not work! UPND is a threat to PF. Is it possible for a sane man or woman to believe that HH is responsible for most of the suffering of the people, especially on the Copperbelt? The answer is no! HH never sold a mine…” Chifita said.

“In 2017 we were watching our president being arrested [for treason]. But this time around we are not going to allow that kind of thing to happen. We are prepared to die with him, if it means dying. We are not going to leave HH alone. We can’t continue to let our president being accused of things he has not done. Let the government mention everyone who bought government assets during the privatisation programme, just like they are wrongly mentioning HH’s house. The Bible is very clear that whatever is planned in the dark will be known in the light. We are aware that they have a taskforce to probe one person and that person is HH.”

Chifita argued that Nawakwi could not today be a champion of corruption.

He told every UPND supporter in Central Province to be on their feet to observe any PF manoeuvres against Hichilema.

On his part, Musumpuka condemned Nawakwi’s attacks on Hichilema, “in the sense that we are very surprised that the privatisation talk took place two and half decades ago.”

He asked what the interest of bringing the matter today was.

“There should be a lot behind the scenes. We are surprised that Nawakwi has only cited HH in this discussion of privatisation, leaving out the chairman of the Zambia Privatisation Agency, Valentine Chitalu. Why are others left out? We challenge Nawakwi to mention the one who headed the legal team and other key members of the [Zambia] Privatisation Agency. Nawakwi was the Minister of Finance when privatisation was taking place. What did she do when she realised that our president (Hichilema) was a thieving one, as she claims? Then she is part and parcel of the thieving,” Musumpuka said, adding that successive governments never hyped the privatisation topic.

“[But] why today?”

Meanwhile, Nanjuwa said: “when we analysed the allegations against president Hakainde Hichilema, we realised that this is a campaign game.”

“We are very happy that president Hakainde has not fallen prey to a game where some are saying if he went to court, then he is vindictive. There’s no vindictiveness! The PF is playing this game through a surrogate like Edith Nawakwi, so that they divert our attention from issues which are prevailing in our country,” said Nanjuwa.

“But we have not forgotten many issues like the Auditor General’s report, the FIC report (Financial Intelligence Centre), the gassing issues, the fire tenders, the ambulances. We also know that the PF do not want to issue national registration cards to our people in Central, Lusaka, Western and Southern provinces and now they want to divert our attention from this very important process, that should have started on the 1st of September, 2020. We do not want to buy the gimmick of introducing the privatisation debate; what we are demanding as Central Province is that we want the NRC issuance to begin now. So PF and their surrogates should leave president Hakainde Hichilema alone!”

PF HAVE CLEANED HH…so thank you madam Nawakwi for having done what you did – Cornelius Mweetwa

UPND deputy spokesperson Cornelius Mweetwa says PF’s campaign trajectory is in disarray and the ruling party has instead cleaned Hakainde Hichilema way before elections in 2021.

He says there is nothing the PF will do to stop the change that is coming in 2021.

He was commenting on Hichilema’s explanation of how he purchased the Serval Road house and answers to the privatization questions helightened by FDD leader Edith Nawakwi.

Mweetwa said on Friday, the nation came to a standstill as Hichilema gave the side of the story regarding allegations by “the devil’s advocates” over privatization process.

He said Hichilema put up a five star performance which was a show stopper.

He said the whole privatisation debate as it relates to the opposition leader had been put to rest.

“Even haters, those who hate HH for various reasons known to themselves, yesterday had to take a step backwards and reflect on their malice and hate for an innocent and hard working citizen like HH,” he said.

“Yesterday HH demonstrated how he has the little he owns. He was able to demonstrate that as early as 1995, he could afford buying a house at K61 million. That was a colossal amount of money in those days, three years before he got involved in privatisation.”
Mweetwa said those that had been wanting to link Hichilema’s businesses to privatisation got their answer on Friday.

He said since Hichilema was asked to explain himself since he was vying to become President of Zambia in 2021 and he ‘satisfactorily delivered’, all others vying for the leadership of the country should explain where they got their wealth.

“Those who are in leadership today should explain the wealth they have. The ministers who are telling Zambians that K2 million is change for shopping should explain where they got their wealth such that K2 million is now change. We would like to agree with former Attorney General Musa Mwenye, who has called for a lifestyle audit and has volunteered himself as a former government worker to be the first one and has challenged those in government to volunteer but so far there is no response,” Mweetwa said.

The Choma Central lawmaker said he expected the same agility employed to the demand for Hichilema to explain to be employed over lifestyle audit.

“We would also like them all to respond to the call for lifestyle audit so that we know what they have and where they got it from,” he said.

Mweentwa said he had also seen a weak shift in goalpost by the PF over the debate, from Hichilema explaining himself to now asking why in his suit against Nawakwi he has not concentrated on the privatisation process but has just focused on the Serval Road house and Lima Bank.

“It is very simple and I am now here to respond. The lawyers for HH have got their own reasons for not including the privatisation issue. But for now and for avoidance of doubt, so that we eliminate any speculation about why privatisation was left out, it was because of the legal logic concerning the two matters,” Mweetwa, a lawyer, explained.

He explained that Nawakwi made it very clear that Hichilema was a thief, who stole in respect of the house.

“There were definite and specific defamatory remarks in respect to those transanctions of the house and Lima Bank. When it comes to the issue of privatisation vis-à-vis Southern Sun and Livingstone InterContinental, madam Nawakwi merely made speculation that HH could have had some professional misconduct. If someone accuses you of professional misconduct, I am sure in the determination of the lawyers, they wanted to just pull out a case which was solid, to go there and not to waste court’s time, not to take to court flimsy issues to be adjudicated by the courts which are already clogged with a lot of issues,” Mweetwa said.

He said at his level, Hichilema must only take to court solid arguments so that “you are not seen as merely being a busybody that is litigious in a court system which requires space to breathe”.

And Mweetwa explained the other issue requiring explanation was the one of declaration of interest.

He said going by how Hichilema explained himself, that particular issue falls off as there was no conflict of interest involved.

He noted that some people have risen saying Hichilema did not declare interest in the hotel transaction and therefore committed an offence.

He said the country must always advocate to go by the law and continue to be a government and country of laws and not of men.

“We should continue to use the law and not emotions and feelings. At the material time of the privatisation of Hotel InterContinental Livingstone, some people may wish to know that there was no law in Zambia which required declaration of interest,” Mweetwa said. “As an advocate myself, I am aware that the anti-corruption Act of 1996 for instance did not provide for declaration of interest in a particular transaction. The requirement to declare interest is a recent innovation of the law, that when a public officer is involved in a transaction where they have interest, as a matter of law, they are required to declare interest,” Mweetwa explained.

“At that time of the privatisation of Livingstone InterContinental Hotel there was no such requirement. That is number one. Number two, even if one was to assume there was such kind of requirement as it is now, HH, according to the current ACC Act would still be left outside the ambit of the requirement to declare interest because he is not a public officer and has never been. There is no time that HH has been a public officer, so people should not just imagine things, there is law which applies to you as a citizen or any person. There is also law that applies to you in a particular capacity.”

Mweetwa said declaring interest was specifically for a public officer as defined under the ACC Act.

He said even if the law was to be applied retrospectively, it would still absolve Hichilema.

“So the man has come out clean and the PF’s campaign trajectory is in disarray. The weapon they thought they would use for 2021 has collapsed. There is nothing that they are going to do to stop the change that is coming in 2021,” he said.

“I am sure when they reflect back on this issue which they had gone on anthills to chorus, they will remember this saying that sometimes what you attempt to destroy ends up destroying you. They have destroyed their own campaign and made HH stronger and even, they have cleaned him. So we thank madam Nawakwi for helping in cleaning HH. Unlike ministers under this government who go to the Anti-Corruption to be cleansed, to look clean, this is a genuine cleaning exercise, which platform was created by madam Nawakwi and on that score, I think that it’s important to thank her for having done what she did. May be it was the holy spirit working in her to invoke the debate so that HH is cleaned way before elections because if it was during elections, I am sure may be they would have gained one or two points based on misinformation and propaganda.”

Nawakwi, others accountable for privatisation, not HH – Kalala

JACK Kalala says since PF came to power in 2011 they have been peddling malicious aspersions that Hakainde Hichilema sold the mines and other state owned companies.

Kalala, former president Levy Mwanawasa’s special assistant for policy and project implementation and monitoring, said the PF maliciously allege that Hichilema greatly benefitted from the privatisation of state owned companies during the first 10 years of MMD era.

He said the allegation was a scheme intended to denigrate and demonise Hichilema in the eyes of the public so that he is considered as an evil person and who should not be considered for public office.

“In addition, they have labeled him to be tribal, satanic and belonging to the underworld movement of the freemasons without providing any proof to support their malignant claims. The truth is that HH is a bona fide Christian of the Adventist Church,” Kalala said.

He said it should be understood that privatisation was a Frederick Chiluba led MMD government programme that was intended to change the country’s economic system from a socialist command economy to a liberal market economy to better the economy and the living standard of the people.

Kalala noted apart from ending the endemic shortages of essential goods and improving the public transport sector, the programme lamentably failed in many ways as it did not achieve the intended economic development and prosperity for the nation but created more socio-economic problems.

He recalled that many companies closed leading to losses of jobs and increased unemployment in the country, a situation from which the country has not fully recovered to date.

Kalala said the cause of this dismal failure was due to inept, incompetent, corrupt and poor leadership because instead of providing leadership to develop the country for the benefit of the people, political leaders resorted to plundering national resources to enrich themselves at the expense of national development.

“As pointed out, the privatisation of state owned companies was a government programme that was backed by an Act of Parliament to effectively implement the process in a transparent manner. The Act provided for the establishment of the Zambia Privatisation Agency (ZPA) whose main function was to plan, manage, implement and control the privatisation of State owned enterprises in Zambia,” he said.

He further said being a government programme, it was the responsibility of those in government at the time to ensure its successful implementation.

Kalala said to implement the programme the lead institutions were the ZPA, the Ministry of Commerce and Industry, and the Ministry of Finance and the persons who were ministers of finance during the crucial period were Ronald Penza and Edith Nawakwi.

He said the minister of finance played a leading role in the privatisation process.

Kalala said among the key roles the minister played as provided for in the Act were to approve key stages of the privatisation, to recommend the value and sale of company to Cabinet, to manage the privatisation proceeds, recommend the sale price to Cabinet and to sign the sales agreement after approval by Cabinet.

“The Attorney General also scrutinised with an eagle’s eye any sale transaction before it was executed. Ms Edith Nawakwi practically superintended over the sale of companies that were sold during the time she served as minister of finance. If anything went wrong with any of the sales, she is the one to be held fully responsible and accountable. She should not run away from the responsibility by pointing fingers at people who were not mandated by the Act to sell State owned companies.”

Kalala further said to know the true value of the 270 companies earmarked for privatisation and draw contracts of sale, the government engaged private professional accounting companies and law firms, not individuals, to do the necessary work.

He recalled that among the many companies that were engaged to do the valuation of companies to be privatised was Coopers and Lybrand now Grand Thorton, a reputable international accounting firm, where Hichilema was an employee.

Kalala said the government did not contract the UPND leader as an individual but the company he worked for and that the money that was paid for the valuation work was paid to Coopers and Lybrand, not to Hichilema as an individual.

Kalala said it was therefore folly of the highest order and malicious wickedness to attribute the sale of the State owned companies to one individual who did not even work for government.

He lamented that it was regrettable that instead of being modest and remorseful on behalf of the government under which she served, Nawakwi should be speaking out with brazen audacity and impunity spilling out lies and claiming to be innocent of the criminal mismanagement of the privatisation process that led to closure of many companies that formed the economic base of the country and losses of people’s jobs and source of livelihoods.

Kalala said in all sincerity, Hichilema did not commit any wrongdoing, legally or morally and anyone accusing him of any wrongdoing was just being malicious and slanderous.

“The people who should be held responsible and accountable are those who served in the MMD government between 1991 and 2001. These are the people who made the decisions to privatise State owned companies. Some have since passed on while others are still alive. In addition, documents are there that were signed to sell the companies, minutes of Cabinet meetings are there and ZPA reports are there. These documents would tell the full story of what exactly happened,” he said.

He said Nawakwi’s narrative was stale and obsolete and that it was one of the malicious schemes initiated and promoted by the PF regime to tarnish Hichilema’s image and integrity, and to divert people’s attention from the many PF’s failures and crimes they have committed against the nation.

Kalala added that the PF regime also wants to divert people’s attention from the schemes they are doing at Electoral Commission of Zambia in preparation to rig the elections next year in their favour.

“What is the logic of directing attention to matters that happened three decades ago while failing to address current issues of rampant and grandiose corruption?” Kalala wondered.

He insisted that anyone who is interested in knowing what transpired during the privatisation of companies, records are there at Parliament and ZPA.

“Nowhere in these documents is HH mentioned to have misconducted himself as it is being alleged,” he said.

Kalala urged the PF regime to stop their ‘dirty’ game of victimising Hichilema, warning that they may trigger something that may go out of control.

“Instead, they should concentrate on preparing to hold transparent and fair elections next year to let people choose freely and in peace their next leaders,” said Kalala.

I AM not a crook, I don’t steal but it is coming out of political malice, says Hakainde Hichilema.

“It was not the intention of picking out Madam Nawakwi. Edith is venomous, the way she speaks, the arrogance she exhibits, not with me only but to everybody who she thinks is standing in her way. Why would she think I am standing in her way? It was not an issue – it was an issue of mentioning cabinet. Was she not a member of cabinet during the material time? Mr [Alexander] Chikwanda during the material time was a chief of staff at State House. Madam Nawakwi is malicious by and large but we accept her, that’s her character, God made her like that but I have a different character although made by God, we co-exist,” he said.

Hichilema accused Nawakwi of being a PF surrogate.

He said he had no issue with calls for a probe being championed by the PF over the privatization programme.

“The probe can be done, I have no issue if it is of value to the country,” he said. “We don’t have to be surrogates of the ruling party, as an opposition we have to be representing the masses that are not getting a service from government such as jobs. The youths from college, university, are roaming the streets without jobs. What Nawakwi and the PF are trying to do is divert our attention to such issues and drive us to issues, to things of a house in Serval Road…is that what is important? We have misplaced priority; we must not leave the topic of fire tenders, corruption. What she is doing clearly demonstrates that she is a surrogate of PF, her actions are very clear. Parroting things that are not true, a national leader must add quality, must bring a competitive atmosphere into the political arena so that government money is not stolen by those in government, so as the fire tenders. She should be talking about fire tenders with some of us in opposition. Why is she not talking about that? She is roosting for PF, she is a surrogate of PF. She is an individual who habours venom and foul mouth.”

He said her favour for Bill 10 shows that she is a surrogate because a genuine opposition just like the church does not favour the bill.

In an interview on Hot FM yesterday, Hichilema said contrary to assertions by FDD leader Edith Nawakwi that he abused his role in the privatisation process to offer himself a house belonging Lima Bank, he said he bought the said property from the National Tobacco Company.

He said the said property on Serval Road in Lusaka was not property of Lima Bank when he bought it at K61 million.

“I participated in the privatisation process, [but] I was not in charge of the privatisation programme. It was the government of the day, the MMD government. They were responsible for the privatisation programme. In terms of policy they were responsible to set the privatisation policy, it was not myself because I was not part of government,” he explained. “Legally they were responsible because they set up the privatisation Act of 1992 as the government of the MMD under the late president [Frederick] Chiluba. So they were responsible and the overall structure…I think today for us to explain these things so that all those who may be unaware can understand, those who may be mischievous, their mischief can be laid bare today.”

He said the MMD after taking office in 1991 proceeded to enact a privatisation Act in 1992 which meant that parliament made a decision to give the citizens the law of the privatisation Act.

“The structure, the way they worked was that after the law was made, there was cabinet on top chaired by the president of that time Mr Chiluba. Under the cabinet there was a committee of ministers within cabinet called committee of ministers on privitisation. HH was not there. Then there was the [Zambia] Privatization Agency, ZPA, as an institution, as a manager to implement the privatisation programme and that’s where the policy and legal power lay,” Hichilema explained.

He said the decider was cabinet chaired by the president with sub-committees such as ministries of finance, commerce and industry, mines, depending on the assets which were key.

“The manager was the Privatization Agency, which then would ask for expert advice from many people, thousands of Zambians – not just Zambians, lawyers, corporate finance guys like ourselves, real estate agents, valuators, property valuators, engineering firms, all of them from 1991, 1992 along were somehow involved, many of them and 270 companies were sold on units as it were,” Hichilema said. “Today, HH was responsible when HH was below the ZPA, asked to do his professional work like an asset verification. Yes, in terms of involvement at that level and not in terms of responsibility, in terms of legal power, in terms of policy power…I was not responsible, I was not in charge.”

Hichilema said he bought the house in Kabulonga but not from Lima Bank as alleged by Nawakwi and he displayed documents in arguing his point.

He added that Nawakwi’s claims are ambiguous and out of political malice to discredit him because he was running for political office.

“I never bought a house from Lima bank. I never stole a house. I don’t steal and here are the facts about the property. This property is called Farm 488A/40/A/3 Serval Road, that’s the name of the property, that’s the identity, that’s the legal identity of the property. I bought this house from a company called TBZ, so this house basically was advertised, open tender, public open tender through the Newspaper in 1995. Madam Nawakwi says I stole the house from Lima Bank because in her allegation I was involved in the privatisation of Lima bank in 1998. But I bought this house though a public tender in 1995,” he explained. “The timeline there does not match, someone is lying…is it me or it is her? It is her who is lying. I say Edith Nawakwi you lied, I never bought a house from Lima bank in 1998 or thereafter but 1995.”

The UPND leader said he responded to a newspaper advert in May 1995 and after his response he was awarded as he was the highest bidder at K61 million.

He said as a business person he was already at the time able to tender for the house at K61 million.

Hichilema said he did not make money from the privatisation programme but that he was already in the position spend such an amount “as God was kind enough” through his businesses at only 26 years old.

“The firm in Ndola called TP Chibwe advertised the house (displaying the copies) who were valuation surveyors and state agents who had been engaged to sell the property. For the avoidance of doubt, I myself just made an offer, the advert had many other houses and I singled out this one and to be specific my offer went in on 26th of April 1995 and I was offered the house. Who owned the house,” Hichilema asked as he displayed evidence from Ministry of Lands.

He said a Chileshe was the owner of the house and later sold it to the Tobacco Board of Zambia in July 1987.

Hichilema showed that after TBZ borrowed money from Finance Bank and could not pay it back, the house was repossessed and passed on to TP Chibwe to advertise for sale.

He said the money he used to buy the house was not from privatisation as alleged but from his other business ventures as a partner, shareholder of a couple of businesses.

Hichilema went on to explain that he paid for the house through his lawyer Michael Musonda, the current deputy Chief Justice – who paid off the mortgage.

“The mortgage plus interest was at K10 million as at 27th September 1990 and the money I paid them they went and cleared the mortgage… Then they were able now on 7 July 1995, they discharged the mortgage, that’s the money and then the house was offered to me by National Tobacco Company through the real estate agent. I bought it, registered it on 7 July 1995 and became the owner of the house 14/3A, in short we call it Serval Road Kabulonga,” he said. “It was never a Lima Bank house. Lima Bank came up for privatisation in 1998, I bought the house in 1995. Edith Nawakwi, you are a liar.”

And Hichilema clarified that he did not have the power to sell mines.

He said he was a service provider contracted in the privatisation and was paid for it as that was his job.

Hichilema said he never privatised RAMCOZ or any other mine in the country.

He recalled that RAMCOZ was privatised in 1997 and he was not involved, stressing that those who care to know the truth would find records at the Zambia Development Agency.

Asked why Nawakwi mentioned his name, Hichilema said, “Malice, she is confusing things. She is claiming that I was the receiver; it is wrong and highly malicious. Neither did I privatise RAMCOZ nor was I the receiver. I was none. I am not a thief. I have never stolen anything.”

Hichilema said Nawakwi has been misleading not only herself but the public as well.

He said he is shocked that a former minister of finance could fail to understand basic facts adding that such pointed to only one thing, which is malice.

“Political malice to get HH at all costs even if he is not a criminal,” he said.

Meanwhile, Hichilema said if there is an asset that delivered more than expectation in the privatisation process was the Livingstone project, the Mosi-O-Tunya InterContinental Hotel.

He said the project was a world class asset, competitive internationally and was delivered meticulously to the standards that were set in the privatisation programme.

Hichilema recalled that the policy of privatisation set an agenda, objectives and what needed to be achieved and the law allowed it to happen.

“If I was not Hakainde Hichilema and I was not seeking public office, if I was not born in particular area I would be praised everyday about the way that transaction was handled. Completely first class in accordance to the set objectives of the privatisation agenda, the broader programme. There is an allegation that I was a shareholder when the bids came through…” he noted.

He said the bids for the hotel were received through ZPA and then the organisation decided whom they thought would help them to structure the transaction in accordance to the set objectives and that was time they engaged people like him.

Hichilema said he was not alone in the process.

He clarified that he was not a shareholder of Sun International for him to declare conflict of interest when he was asked to assist the MMD government through the cabinet and ZPA.

“I was never shareholder in Sun International. I invite any citizen to go to the Registrar of Companies then, go to PACRA now, and see if HH was a shareholder because that what Nawakwi, Madam Nawakwi alleged that I was shareholder and therefore gave myself Sun International, she is wrong. I was never a shareholder,” Hichilema said.

He said there was no asset that he bought from ZPA stating that what he has, like the one on Serval road, were acquired from owners who were not part of government or ZPA.

He said some people alleging that he bought assets through privatisation were in fact the ones that did directly from government.

Hichilema challenged those with evidence that he bought assets from the privatisation process to bring evidence.

He said in Zambia there was a perception that those who make the loudest noise are clever and, or right but that in most cases they’re never the most intelligent.

“We have made mistakes in our country to reward noise makers, we must reward facts, intelligence, substance and hard work. I have never wanted to reach this level, I just wanted to explain but this matter keeps coming up,” Hichilema said. “We have addressed your concerns of how we became owners of what we have. Now, let’s ask someone to explain something about… 48 houses, $42 million worth of fire tenders, mukula cartel, allegations from Rwanda, billions stolen as reported in successive FIC reports….”

Instisting on arresting HH after a well executed interview over privatisation would be a fatal mistake

UPND President Hakainde Hichilema’s interview was reminiscent of the old soccer days when Zambia played her archrivals like Zaire (Zayiii, in the accent of iconic football commentator late Dennis Liwewe), the Magreb which comprised teams like Morocco, Egypt and Algeria(Alugeria).

Instead of listening in the privacy of my home, I decided to take a two pronged approach, by driving around the city of Lusaka, while listening to the program from my ear phones, and making random stops at bus stations, markets, shopping malls or simply by road sides, specifically to see the mood of the people.

What I saw was staggering. Taxi and minibus drivers, marketeers, roadside metal fabricators, mobile money stall dealers, saloons and barbershop operators and ordinary shoppers appear to have all been synchronised in one spirit and pregnant with indescribable expectation of what Hichilema would say.

 

A visitor that just arrived from abroad wouldn’t be blamed to think the nation was about to turn into a pillar of salt. I agree, I would have heard a pin drop from Jupiter. The nation was on a stand still. What was also evident was that people wanted this age old matter dealt once and for all.

One young man told me;
“Today is a very big opportunity for HH to shut these people up. We are tired of them. He should not politicize the program, let him do his best to explain as directly as possible his role as a consultant because he’s being accused as a consultant and not as UPND President. He must tell them who was involved in the mines, possibly mention names like Francis Kaunda, Norman Mbazima, Elias Chipimo, Valentine Chitalu and Edgar Lungu himself. On how he got rich, if possible, let him draw up his investment path. Last time he explained how he bought 6 Heifers which multiplied into resourceful herds.”

 

What was also clear was that people were amazed how a matter that happened more than a quarter of century ago and passed through four successive governments whose economies recorded epic performances, was proving to be a thorn in the flesh of only the current government, remarkably and incidentally an administration accused of unbridled corruption and blamed for abysmal failure in the running of public affairs.

 

The landfall of Tropical storm ‘Hurricane Edith’ was a disaster, not for Hichilema as hoped by the PF, but for Edith Nawakwi herself, President Edgar Lungu and the Patriotic Front. The tornado crystallized a 25 year old privatisation myth into a two hour alluring vindication that many described as convincing and mesmerising.

After Hichilema’s blistering radio interview performance concluded, cheers rang out across Lusaka and I believe right across the Republic. I heard quite a number of long car honks, yes It was as though the Zambia National team had scored the critical goal. There was indeed a sigh of great relief among many citizens and the people want to now move on.

 

MMD President Nevers Mumba wrote on his Facebook account;
“This is the healing moment Zambia has been waiting for. Now Zambians can demand that the same question asked to Hakainde Hichilema be asked to the current crop of leaders in the PF government. How did they get rich on a government salary? We shall finally get all the answers we have been waiting for. Who took the extra $750,000 from each of the 42 fire engines? What have we done with the over $15 billion debt contracted? To clean up our society, Zambians have to put aside the divisive political affiliations, the segmentation of society along tribal or racial lines and face this opportunity as one people”.

 

There’s a general agreement that the PF are being vindictive of the UPND President, and by and large, a great number of Zambians believe the theory, that they would want to harm him if given the slightest opportunity to detain him. Hichilema himself has raised these concerns and citizens across the board believe him. The clap trap that HH’s support base is regional is a far fetched myth. The reaction that could come from the news of his arrest and detention would therefore be spontaneous and on a national scale. Don’t we have enough on our plate already to having to deal with such riots and the threat to national security that HH’s arrest would bring?

We have been reliably informed by well placed security sources within PF government of their fresh plans to arrest UPND president Hakainde Hichilema any time any day.

This desperation by the PF government to insist on going ahead with their plans to arrest UPND president Hakainde Hichilema, following Edith Nawakwi’s privatization rantings will have more complicated problems if PF goes ahead.

Unless Mr. Lungu and PF government are planning to shed innocent blood of citizens, then they should go ahead. Because citizens will not watch seeing their leader being persecuted again.

We know PF want to create a volatile environment and find reasons to persecute their opponent.

Our new intelligence information of the PF government wanting to go on and arrest HH is still based on the privatization propaganda which we believe the opposition leader dealt with within two hours during a radio interview at his residence on Friday, this previous week.

But to our surprise, PF still want to go on and arrest Mr. Hakainde Hichelema. We understand that PF’s main objective is to have physical access to his body and possibly harm him by poisoning.

Arresting the opposition leader based on Nawakwi’s rumbling will be the biggest ever mistake which will trigger more troubles than what PF wants to achieve selfishly.

The opposition leader Mr. Hakainde Hichilema, last week took time to clear the air over the privatization allegations with documents to validate his innocence, but it’s clear now that arresting HH based on baseless accusations of selling mines is the only last option PF is trying to find ways to convict or harm HH before 2021.

We want to again remind the PF government that we are very much aware of the intensified plans to arrest the opposition leader. And all we can do is remind them to stop this agenda.

PF should read the political mood in the country before making this grave mistake that will be very difficult to undo.

We urge all citizens to be very much alert, because PF government is determined to imprison HH and compromise his health and make sure he doest feature on the ballot box next year. We urge all meaningful citizens to take this information very serious.

Zambian politics has descended into gutter politics without any decency or shame under the current government. A serving minister of Defence and former minister of Finance describe a citizen as a ‘criminal’ to the media yet this citizen has neither been tried nor convicted of a criminal offence, ever heard of that? Isn’t this promoting lawlessness to the extreme? How can a citizen be criminal before any judicial process? Doesn’t this define the authors as unfit for public office let alone office of minister?

Yet it is an offence to take the law into your own hands and we are all persuaded to not resort to self help regardless of circumstances. Only in a few exceptions does the law permit self defence, defence of property and defence of others and in this case in accordance with strictly defined circumstances. If a citizen resorts to self help against another, they can be prosecuted and imprisoned for it.

Defence Minister Davis Chama and former Finance Minister Edith Nawakwi took turns this week lambasting opposition leader Hakainde Hichilema as a ‘criminal’ over his role in the privatisation of the public economy some thirty years ago. Could it be that it is because they are criminals themselves which is why they easily can recognise a criminal when they see one? How do we explain senior government officials so easily using the word ‘criminal’ against the grain of the law if they are not?

And what is this in terms of teaching our children how to behave in leadership, or does it not matter? In these days of social media, children are not only watching leaders behaving like toddlers calling others their political opponents ‘criminals’ and shouting bring it on, bring it on referring to court contempt threats and you are a minister or former minister?

In the week, Edith Nawakwi fed the media with serious allegations against Hakainde Hichilema regarding his role during the privation process. Though she purports to be opposition herself, she was intent on defaming her colleague to the worst possible degree and shifted all the blame to him as if he was the minister responsible for finance while she was mere consultant. Among other things, she accused him of undervaluing assets of Ramcoz, selling to himself and buying the Lima Bank house in Kabulonga using his position as chairman of the privatisation committee and failing to declare interest during negotiations for the sell of the Mosiotunya hotel in Livingstone.

Before Hakainde could respond, including KBM, Sean Tembo, YALI jumped into the bandwagon and found Hichilema guilty of the charges. KBM said Hichilema failed to disclose interest in the Mosiotunya hotel negotiations but suggested he should not be arrested to avoid chaos in the country. Sean Tembo who pretended to ‘sit as a court in the matter’ while ‘acquitting Hichilema on Ramcoz and Lima bank house, found him ‘guilty’ of failing to declare interest in the Mosiotunya hotel negotiations and sell. Interestingly he never found Edith to have defamed Hichilema in the Ramcoz and Lima bank affairs despite finding Hichilema on firmer grounds on the two issues? YALI which has always been on the side of the ruling party the Patriotic Front even described the privation process of the hotel as ‘theft’ by Hichilema whom they accused him of selling the hotel to himself.

Yet all these comments from other opposition leaders came before Hichilema laid out his case. This raises serious questions regarding the calibre and character of our politics? These are people aspiring to lead us. They can’t even as much pose so as to hear from the other side before venturing their verdicts. And as it turned out unfortunately for them, Hichilema’s response in both the letter of demand to Ms Nawakwi and in the statement of claim he filed in court demonstrated that the accusations were a cocktail of lies and using dates and names of the people involved in those transactions and the period involved, detailed the lie on each.

Of course coordinating this tapestry of lies is president Edgar Lungu, the main beneficiary of the lies. Most people do not know Edgar Lungu, those who support and who oppose him, both sides do not know him. Edgar is a complicated figure. Remember, starting from his party, his ascendancy to lead the party was controversial. There were two conventions his came after the first convention which he just ignored and organised his. Following that he ordered some judges to affirm his leadership and the rest is history. In 2016 when Hichilema dared complain against the election in which he was controversially declared loser, Edgar simply banned the Constitutional Court from hearing Hichilema’s complaints. With this history in mind, it is quite clear most of those who jumped the bandwagon and made remarks finding Hichilema guilty as charged by Edith Nawakwi did so as Edgar’s surrogates, a suggestion Hichilema made.

How do we address this problem? It is simple. Action should be taken against those who defame others. Hakainde Hichilema must sue all those that have written things and made statements defaming him. Sue YALI, sue opposition and other politicians and other leaders who have made unbalanced comments and statements against him. This is the best way to promote values in society. Sue them and if they run foul of the law lock them up for contempt, no empathy. Clean them up of all their money, let them toil for years paying court costs arising from their irresponsible careless conduct. If you use empathy and forgive them, you are promoting impunity and bad leadership will continue. You are imparting bad values on our children that lying is Ok and there is nothing wrong with defaming others. So, I am calling on Hakainde to clean them all up with hefty bills arising from court processes. Let them walk naked and turn to streets to beg food. This way, politics will move towards decency and politicking become value based.

Your excellency sir, this I speak as a true citizen of this country and its my belief that I represent millions of fellow citizens who’re rotting in silence out there.

Your excellency sir, your coming is a sign of relief to citizens but here I represent to you a Million dollars problem, foreigners have taken our country from grass routs to the top leaving “we” the citizens with no option but to die in abject poverty some running in diaspora to seek for breaths.

Your excellency sir, I believe you’ve seen what Tanzanian government has done the past few months to radicalize it’s independence by owning the largest business sector (small scale businesses) of their country. In Africa your excellency it’s not a secret that small scale businesses are the backbone of our economies and Zambia isn’t spared either.

Your excellency sir, I’ve sampled types of businesses which I believe must be legally given to indigenous Zambians and all foreigners in this sector must be sent back to their countries where they can be responsible citizens too.

It’s not a secret that our major cities belong to Chinese and not Zambians. This is because our system was designed to favour foreigners leaving Zambians out of the system. Your excellency, this has been as a result of Corruption and poor governance for the past 52 years of democracy. It’s my wish that land laws are revisited giving opportunities only to Zambians to buy land and foreign investors must be renting the land and not buying as it has been.

Your excellency, there is nothing that the Chinese People does in Zambia that we can’t do.

Your excellency, I describe poverty as being without an income to afford basics effectively for 12 months, this means millions of Zambians have no income while foreigners find it easy way in and succeed us, what wrong did we do to our country to fail?

In conclusion, your excellency sir, it’s my wish that the bill that passed in 2017 as moved in parliament by then Hon Mutati of Ministry of Finance to have 70% of government contracts awarded to indigenous Zambians be put to practice this coming budget. Your excellency, the Chenes who have been enjoying our budgets aren’t angels, they stock everything using our very same budgets and look like they’re more competent than us Zambians. There is no company that can refuse to offer one a contract having evidence that someone is supplying to government. This means even us Zambians can stock from overseas if given government contracts without hustles.

Your excellency, it’s time to give Zambians what they deserve, the people who vote in millions can’t be too poor to afford businesses in their own country.

…as thousands of UPND youths hold solidarity march in support of HH amidst attacks from Nawakwi & PF

THOUSANDS of United Party for National Development (UPND) youths this afternoon held a solidarity march to president Hakainde Hichilema’s Lusaka residence in New Kasama where they assured him of uninterrupted support in the wake of numerous verbal attacks from defunct Forum for Democracy and Development (FDD) leader, Edith Nawakwi and the ruling Patriotic Front (PF).

Leading the youths that were drawn from the seven constituencies in Lusaka, Mr Anderson Banda who is leader of the youths in the Lusaka told Mr Hichilema that the collusion between Ms Nawakwi and the PF to remove him from the 2021 ballot had prompted them to march in solidarity with him as a way of sending a signal to the PF and its surrogate political parties that the youths would not allow any aggression against Mr Hichilema.

Mr Banda charged that it was now evident that after failing through various means to disadvantage and lessen Mr Hichilema’s chances of being a presidential candidate for 2021 such as the failed Bill Number 10 of 2019, the PF had resorted to using its hired guns such as Nawakwi to discredit him, a situation he said would not deter Mr Hichilema from being ushered into State House in 2021.

“We shall stand by you, president HH until you are ushered into State House come August 2021. You are not alone in this fight and we shall not allow the PF Government to touch you again. We are aware of schemes by the PF to cook charges against you after realizing that they have failed to remove you from the ballot using Bill 10, we shall not allow that,” said Mr Banda.

Mr Banda also stated that the youths had resolved to stand by Mr Hichilema and that they’d stand by him and his family to ensure nothing bad happens to them.

He also stated that the country’s youths were eagerly waiting for him to become president of Zambia so that he could help in ending the numerous economic hardships that the country’s youths were going through.

“Mr President, we know that you mean well for this country; and we admire your business skills, as such, we pray that you rule this country so that we the youths can tap into your wisdom for a better Zambia. We are waiting for your leadership so that those who have stolen from the poor through the tenders, ambulances and 48 houses can account; so that FIC report findings are adequately addressed and the perpetrators are dealt with accordingly as well as how the Eurobond was used and the findings of terrorism and money laundering in the FIC report,” he said.

Mr Banda called on youths across the country to take keen interest in the way the Electoral Commission of Zambia (ECZ) was conducting itself ahead of the 2021 tripartite elections.

“Mr President, we wish to call upon the youths across the country to remain vigilant and monitor the ECZ ahead of the 2021 general elections,” he said.

And Hichilema, who was accompanied by his wife, Mutinta, expressed gratitude to the youths for the solidarity and support, stating that he was also there for the youths of the country.

“Thank you for coming to support us especially at a time that PF and its surrogates have continued to attack us. We need a new leadership that will provide business opportunities to the people of Zambia. We need a leadership that will take care of the people of Zambia,” he said.

Mr Hichilema also laughed off insinuations by Ms Nawakwi that he stole a house for Lima Bank during privatization, stating that the house was purchased from TBZ in 1995 while the privatization took place in 1999.

“Thank you to all of you for coming. Sometimes we think that we are alone but when you come, we know we have support. You must also know that you are not alone, Bally is always with you. It is darkest before dawn. We have walked a long way and we are not stopping,” he said.

Yesterday we spent the afternoon in the company of the UPND President Mr. Hakainde Hichilema to reflect on some of the core issues Zambians want us to focus on.

1. We cannot go into government with the same culture of excess and extravagance that has disadvantaged millions of Zambians, much to and for the benefit of only a small group of individuals

2. We have to focus on creating and expanding opportunities for education, empowerment, employment, business for all Zambians; and break all undertones of political affiliation and nepotism as prerequisites for opportunity

3. We must and we will decisively deal with and address the issues affecting civil servants, among them teachers, the police, nurses and doctors

(a) Salaries, PAYE and other conditions of services

Note: The UPND has already proposed personal tax reforms which are expected to deliver wages rises ranging from 7% – 29%, with an average of 14%. This will arise from the expected PAYE tax reforms windfall of $1.5bn to $2bbn for the initial 5 year period.

(b) Pensions and retirement requirements

Note: The UPND has already proposed public pensions reforms which will see contributors into public pensions enjoy periodic, capped access to their pensions contributions for purposes of raising capital and other collateral requirements without resorting to expensive debt. This will enhance value for pensions money.

The UPND is also looking to transition civil servants away from institutional housing and much towards personal home ownership by leveraging opportunities within public pensions.

* Retirement requirements still under firm review

(c) Promotion and progression requirements.

Note: We cannot have people serving in acting positions in perpetuity. But this must be addressed as part of retirement reforms

(d) Overbearing deductions on civil servants payroll

– Higher education loan

Note: The UPND has already indicated that these deductions will be suspended, while attention will be refocused towards rebuilding the economy and expanding earning opportunities for our people

– National Health Insurance Scheme

Note: While the UPND remains committed to the idea of quality healthcare for all, we do not believe that a public health super structure, anchored on mandatory contributions, is the solution. The economy is currently too small and ailing. Our focus, therefore, will and shall be on growing the economy and realigning public expenditure towards key sectors such as health and education in the short to medium term.

– Newly introduced taxable allowances which were previously excluded from tax

Note: The obsession with taxing citizens has arisen out of the culture of excess and wastage by government. The UPND continues to emphasize a prudent culture of managing and applying public resources as a primary tax relief mechanism for all citizens.

*We also must update our tax legislation, such that all allowances incidental to the welfare of employees, and related to their able to do their work, must be reviewed for tax exemption.

4. We must win the war on government corruption. This costs Zambians an amount in excess of $2bn per annum

Note: The UPND has already made proposals for:

– Unexplained Wealth Orders (UWOs) where Law Enforcement Agencies have verifiable and current evidence of corruption, money laundering activities by individuals

– Enhancing the funding and functional independence of frontline gatekeeping institutions such as the ACC and FIC for improved performance. We remain committed to legislative reforms that will make these institutions answerable NOT to the President but to the public.

– Instituting new guidelines for politicians, their families and entities in which politicians have a vested interest doing business with government. This has been the source of public procurement processes’ abuse by politicians.

‘Even witches have resurfaced to fight HH’

NATIONAL Restoration Party Mporokoso Constituency 2021 aspiring candidate Maybin Kabwe has charged that witches have resurfaced and regrouped to fight opposition UPND leader Hakainde Hichilema’s candidature as Zambia draws closer to the 2021 polls.

Reacting to the current debate on Zambia’s privatisation of national parastatals that occurred more than two decades ago, Kabwe said the target was to deter Hichilema from his presidential bid.

He wondered why FDD leader Edith Nawakwi had to wait this long to complain on the transaction she spearheaded.

“I wish to express my disappointment at what Nawakwi has decided to start. Why bring such issues of privatisation now and just targeting an individual? Where has she been all along? The architect of privatisation, some are dead who can answer all the questions. Why didn’t she start the same crusade after [president Frederick] Chiluba chased her from her ministerial position unceremoniously?” Kabwe asked. “We have a lot of unanswered questions such as gassing, the burning of city market, fire tenders, the mysterious 48 houses and Lungu’s sudden riches. What is more shocking is that even indoshi [witches] have resurfaced just to fight an innocent person in HH.”

He said Zambia had more problems to work on than individual agendas to fix one person.

Kabwe said the PF and Nawakwi should concentrate on making the lives of citizens better.

“Our currency is weak to the extent that even doing business with our Tanzanian counterparts is now a nightmare. Can we concentrate on the current problems and find the way out,” urged Kabwe.

But the Freedom Fighters Association in Kapiri Mposhi said the privatisation of state owned enterprises did not benefit the common man but ended up enriching some people entrusted to manage the process on behalf of Zambians.

The association has welcomed calls for the institution of a commission of inquiry into the privatisation of state owned enterprises.

Kapiri Mposhi Freedom Fighters Association secretary Gregory Mpembamoto, 82, said an inquiry into the privatisation of state enterprises was long overdue considering the heightened debate it raises especially as the country nears elections.

In a statement, Mpembamoto noted that the inquiry would give an opportunity to be heard for those accused of mismanaging the privatisation process to enrich themselves.

“It is clear privatisation did not benefit a common man, that’s why if there are people who were entrusted to sell government assets and they sold these assets to themselves, the commission of inquiry is the only way to find out and they have an opportunity to exonerate themselves from these allegations,” Mpembamoto said.

He urged Zambians not to view a commission of inquiry as a witch-hunt for anyone involved in the selling of state enterprises on behalf of the country but as an opportunity for those that presided over the process to be heard and their names cleared.

“For once let us unite and close this chapter on who sold what to himself or who stole what from privatisation. It has taken us over 25 years and we are still delving into accusations, let’s have a commission to settle this matter once and for all,” Mpembamoto said.

He observed that the privatisation of state owned enterprises, especially the mines on the Copperbelt, negatively affected many people through widespread loss of employment.

“For some of us, privatisation is a personal issue because of the misery it brought through employment loss. It changed our lives completely for the worse. A commission of inquiry is a relief for us to get answers,” said Mpembamoto.

Opposition FDD leader Edith Nawakwi says she wants to unmask the myth that Hakainde Hichilema is a rich man.

Reacting to the UPND leader Hichilema’s appearance on radio yesterday where he defended himself against her allegations regarding his role in the privatisation process, Nawakwi told Daily Revelation that she was ready to face Hichilema in court.

“We are waiting for the summons and really we are eager to unmask, to demystify the myth that Hakainde is a rich man, that in fact there is a lot of private fraud which is being undertaken especially in the area of pension fund. And look there are many questions which must be answered, for example the pensions from Anglo-American. The workers are still unpaid..and from BP Zambia,” Nawakwi said, adding that Hichilema could not continue “hiding under the veil of subjudice whenever questions were asked of him. “It’s in the same spirit that he’s threatening to file summons (filed already) in this particular matter of us asking as to how he became chairperson of Southern Sun. It is simply for him to say you can’t discuss it, it’s subjudice.”

Asked on Hichilema’s argument that he had responded to her allegations of dishonesty over the privatisation, and now was the time for his opponents to respond to matters such as the controversial procurement of fire tenders, ambulances and the 48 houses, among others, Nawakwi claimed that she had already spoken out forcefully and unambiguously over some of those matters, charging that Hichilema should not duck the questions against him.

“He’s like a cut and mouse you know. The issues before him he can’t say neo mwenzemwanipeza nili pabwalo pa museo so namuzanga naeve ni ule ankale pa museo (he can’t say don’t just focus on me, without providing answers just because the next person has committed a wrong). The questions are specific to him. We have talked about the mukulas, we have talked about the fire tenders,” Nawakwi said. “And for me this matter is him, he is the one who started. Who provoked him to start talking about me? Presenting me that I am not worthy of national leadership because I sleep on duty. He is the one who was trying to discount me so you wanikata nitole weo. Mwambile buti biyo musa (you started the fight)…this kind of discussion is like chikunye…that insect in the field that eats itself until it dies.”

Nawakwi said the allegations she had raised against Hichilema were specific, and that she was very ready to meet him in court.

“We really want to unveil the myth that he’s a rich man. So that’s why he says he has clarified. No he can only clarify when we give him evidence in court. We exonerate him in court that he’s a rich man. You cannot take take pensions from Anglo-American employees and not pay it and go to court and say it’s subjudice,” Nawakwi said. “And BP workers, money that was given to the fund. You can’t have the same person managing the fund and being a scheme manager and being actually themselves the assessor.”

Nawakwi, mentioning the several companies Hichilema had interest in, said there must be morality in the manner he handled matters.

“Africa Life Finance Services if you get a print out of that, the shareholders are Rabson Machila, Hakainde Hichilema, Muna Hantuba and Valentine Chitalu…Menel Management you see they have been masking their shares. When you go to Africa Life Financial Services, PACRA, yourself…the shareholders are Botswana Insurance Fund Management and Menel Management Services,” Nawakwi said. “Now Menel Management Services at PACRA, date of Registration, November 2003…Menel Management Services shareholders clearly shows Hakainde Hichilema and his friends. Now Africa Life Financial Services administers the pensions fund at Saturna Regna Fund.”

Nawakwi continued.

“Who is Saturna Regna Fund? Who are the managers for Saturna Regna Fund? It’s called Benefit Consulting Services. Who are are the share holders? Menel Management Services and Botswana Insurance company. The same people are fund managers and the fund administrators and therefore when the workers at BP are saying that BP sent the money to Saturna Regna Fund and they haven’t paid,” Nawakwi said. “The court says you people go and find an independent assessor, they find an assessor called Benefit Consulting Services. Who are the shareholders of Benefit Consulting Services? Menel Management? And who are the shareholders of Menel Management? You have the list.”

Nawakwi said Hichilema and his friends could not be independent assessors of the fund they were managing. She argued that she was simply raising issues, which Hichilema needed to respond to, and should therefore not be accused of being a liar or even a stooge of the ruling PF.

“I have requested that we go in court so that these become part of the court record so I prove my case. Actually I don’t need to prove the case, I want to unveil the mask, the myth that one Hakainde S Hichilema the shareholder in Menel, Saturna Regna and all these is a hardworking person,” Nawakwi said. “Anglo-American at their departure they transferred money to Africa Life Services, up to this day the people involved have not been paid. Have they been sleeping? And this is my president to be. He can create a chain of companies and I’m scared, I am scared. You can talk about fire tenders, you can point at that one, that one you were naming them by names, you.”

Nawakwi accused Hichilema of being astute at “creating and masking companies.”

“I am just waiting for summons today. I am at home, and he knows where we made him president of UDA. That’s where I am, he should send his lawyers to deliver the summons. Because I have even moved away from Southern Sun, now I am dealing with the case of BP pensioners and Anglo-American pensioners,” Nawakwi said. “The challenge is has he got permission from his friends…he thinks we don’t research because we are trusting, we are sleeping. It’s simple. When you tell people that they are sleeping they wake up.”

Nawakwi said a record could not be changed, saying being a shareholder and manager was an anomaly in this country.

“So it’s Africa Life Financial Services date of registration 23rd April 1996. Shareholder; Botswana Insurance Fund Management, Menel Management, you are interested in Menel Management…and then you have Tiyende Pamodzi Consortium which you have seen in some documents, the shareholders are Menel Management Services, and you know who the owners of Menel Management Services are,” said Nawakwi.

Efforts to get a comment from Hichilema failed as his mobile phone went unanswered.

But Hichilema has sued Nawakwi for accusing him of selling Lima bank and a house belonging to the bank situated in Kabulonga.

Hichilema has since asked the Lusaka High Court to order Nawakwi to pay him damages for libel arising from the defamatory words which she caused to be broadcast and published on a radio programme entitled “ The Hot Seat” which was broadcast on the Hot FM and Kwintu FM on August 27, 2020.

Hichilema is demanding aggravated and exemplary damages, an order directing Nawakwi to retract the defamatory words; and an injunction restraining her whether by herself, her servants or agents or otherwise from further publishing or causing to be publishd or broadcast the defamatory words or any words similarly defamatory of him.

He further wants the court to order Nawakwi to reimburse the sums expended by the plaintiff in mitigating the effect of the defendants’ conduct towards him and arising from the publication of the defamatory words.

In addition, the plaintiff wants the court to order Nawakwi to pay interest on any sum found due to him, costs and any other relief the court might deem fit.

According to a statement of claim, filed in the Lusaka High Court principal registry, Hichilema stated that on August 27, 2020 during the course of a programme hosted by Zachariah Chavula on Hot FM and Kwanthu FM respectively caused to be broadcast and published by radio, by live internet streaming and by digital broadcast, words defamatory of him in relation to acquisition of a property in Kabulonga.

“I am saying that he got the house in serval road without declaring that he was doing a misdemeanor. If he has not been arrested by the law or if he has not been visited, he should continue to say “mwalikwisa.” Now you can not say that I have stolen because the owners are sleeping and go boasting around. I think that is unacceptable,” read the statement in part.

Hichilima stated that in their natural and ordinary meaning, the defamatory words meant and were meant to mean that he was a thief, a corrupt a person of questionable character and that he was guilty of numerous offences relating to the dissolution of Lima bank and sale of its assets, when in fact not.

He said aside from being defamatory of the plaintiff, the defamatory words were false and published maliciously.

Hichilema submitted that contrary to Nawakwi’s allegations, he had never acted as receiver, manager or liquidator of Lima bank as alleged or at all.

He stated that the house alleged by Nawakwi at Serval Road in Kabulonga had never belonged to Lima bank prior to him acquiring it.

Zambians now Understand the strenght of ability which HH has exibited with mature political Intellect, he now posses a merit grade of perfect leadership quality and excellence ,his ideas are internationally associated to the global professional governance sysytem, the hopes of the zambian people are not to admire from other countries but to have a leader like HH who can implement these dynamics using innovative skills, discipline is what HH brings in his theory of private practice, the cheracter of excellence is represented regionally and international, this exposure has the capacity to transform our great country, we may not know what more is great about this true son of this country ,i recall when he was invited just to present a proposal on the economic program of action when he becomes president of this country, $28.5 billion was pledged for direct investment to our great county, this is the confidence we want from foreign corporating partners, we have endured with a govt that is abscessed with foreign loans, that have not been invested in productive sectors to create employment and generate wealth for the country, these loans have ended up being corruptly looted using the projects as a source of wealth for our leaders in govt, and today they still want to talk about privatisation, when it is in a clear form of how they have plundered state resources, this is a reality in the faces of zambians, we are told to celebrate development using unmanageable debt, are we that foolish not to know the implications of such govt decisions that has no vision to mitigate the effects they have caused on the people and the country?.

When the Economy started showing poor indicators, they rose to say HH is the causer, when president Lungu was commissioning the 385 Km road which was paged at a theft cost of $1.2 billion, HH advised the sicial economic impact on the nation, they said he was bitter and the chinese were good partners in development and yet it is a theft agenda, we have witnessed a number of accusations on HH, every Election that comes people are paid and used like toilet paper to talk about privitisation, accusing HH of being the beneficiary becaise he is rich and favoured by the people to become the 7th republican president, the privatisation exercise involved more than six hundred people including entities, how could just one person get away with everything from the entire MMD govt which had the most intelligent cabinet, PF should for once be logical and stop this street politics that has no substance, these tricks have expired, they have been used time over and again, PF must undersand they are not governing dull zambians, otherwise it is the opposite.

Chadwick Boseman secretly married months before his death. Here’s what we know

Chadwick Boseman had tied the knot with his longtime girlfriend Taylor Simone Ledward before he died of cancer on Friday. Though they never publicly announced their marriage, a statement posted by his team on social media following his death said the Black Panther star died “with his wife and family by his side.”

The People reports that the couple were first spotted together in 2015 before getting engaged in October 2019.

The last time they were seen together during the 2020 All-Star Game six months ago, Ledward was wearing an engagement ring.

But what more do we know about Ledward?

Ledward, a Japanese and Black, is a singer. She graduated with a degree in Music Industry Studies from California State Polytechnic University Pomona in 2014. She was the lead singer of the school’s jazz band and once auditioned to be on the X-Factor, according to reports.

After dating Boseman for four years, she is believed to have married the Marvel superhero in a private ceremony before his health deteriorated.

With Boseman gaining fame due to his sterling performances in films, particularly, the Black Panther, the couple were pictured at various award ceremonies and red carpet events.

In 2019, they made their first red carpet appearance together at the Screen Actors Guild Awards and then later at the 50th NAACP Image awards later that year.

ABOUT PRIVATIZATION: THE MOSIOTUNYA HOTEL MATTER

1. Yesterday morning l was very happy when l heard that the UPND Party President, Mr Hakainde Hichilema was going to be featuring live on a special Hot FM program to provide further explanations to allay the allegations that had been leveled against him by Honorable Edith Nawakwi, the Party President for FDD, who at the time of privatization was the Minister of Finance under the FTJ Government. Like l have always said, these allegations of misconduct against Mr Hichilema are very serious, especially given his position as an aspiring President of this Republic. That is why l was not agreeable with Mr Hichilema’s initial approach of seeking to downplay these allegations by responding to them using Facebook and Twitter memes. I have always insisted that Mr Hichilema needed to explain himself in the same detailed manner that Honorable Nawakwi made her allegations. And am sure that l am not the only citizen that demanded for him to explain himself in detail. You see, the assets which Mr Hichilema is alleged to have misappropriated are national assets, and as a bonafide citizen of this Republic, that makes them my assets too. So l have every right to pursue this matter to its logical conclusion. The fact that l am a practicing Statutory Auditor, Chartered Accountant and Insolvency Practioner, gives me a privileged position to better understand the issues of corporate governance that are at play here. I would be failing in my duties as a citizen of the Republic if l did not use my privileged position of being qualified and experienced to actually help in explaining this national matter to my fellow citizens who might have the knowledge to understand it by themselves. That is the reason why l have written two articles on this matter since it arose last week, and this one is a third of such an article.

2. When l wrote my last article a few days ago, Mr Hakainde Hichilema’s lawyers had just written a demand letter to Honorable Edith Nawakwi. In that demand letter, they also sought to explain, on behalf of their client, three specific allegations. The first allegation was that Mr Hichilema had bought his Kabulonga house from Lima Bank which he was liquidating, the second was that he had undervalued RAMCOZ assets during privatization and the third was that during the sale of Mosiotunya Intercontinental Hotel, as Negotiating Chairman, he had ignored higher bids of $26m, $20m and $10 and instead sold the hotel to a lower bidder Sun International Zambia at $6.5m, which lower bidder he was a director in and has remained a director in. Like I indicated in my previous article, based on the explanations that Mr Hakainde’s lawyers had proffered on his behalf in the demand letter to Honorable Nawakwi, my view was that Mr Hichilema had reasonably been exonerated on the first and second issue, but not the third issue involving the sale of Intercontinental hotel. And so, during his Hot FM program yesterday, my attention was specifically directed on what his explanations would be on the last issue, and not necessarily the first and second issues.

3. Although the interview started a bit later than scheduled, l made sure that l remained glued to my two-band radio. I was happy to note that Mr Hichilema was very prepared for the interview. He did not only provide detailed and specific explanations, but he also backed up his assertions with documents, which was very commendable. However, this was only with regard to the Kabulonga House and RAMCOZ issues. On his sale of the intercontinental Livingstone hotel, Mr Hichilema failed to explain himself for the second time.

4. Mr Hichilema’s argument regarding his sale of Intercontinental Hotel is that he was not a SHAREHOLDER of Sun International Zambia, which bought the hotel. However, the allegations are not that he was a shareholder but that he was a DIRECTOR in Sun International Zambia at the time that him as Negotiating Chairman for the Zambia Privatization Agency decided to sale Mosiotunya Intercontinental Hotel to Sun International Zambia at a lower purchase consideration of $6.5 million when they were other higher bids including $26 million, $20 million and $10 million. During his entire protracted interview on Hot FM, Mr Hakainde Hichilema did not at any given time deny that he was the ZPA Negotiating Chairman in the sale of Mosiotunya Intercontinental Hotel in Livingstone. Neither did he deny that he sold the hotel to a lower bidder of $6.5 million when they were higher bids of up to $26 million. During the entire interview, Mr Hichilema did not deny the allegation that he was a Director in Sun International Zambia Limited which is a subsidiary of Sun International South Africa, and which was incorporated in Zambia on 18th November 1997. Neither did he deny the allegation that the process to sale the hotel started as early as July 1997, no that the sale was only concluded around March 1998.

5. The summary of the timeline of the allegations that were leveled against Mr Hichilema regarding the sale of the hotel, which Mr Hichilema failed to refute yesterday are that he was appointed as ZPA Negotiating Chairman for the sale of the hotel around July 1997 and that while he was ZPA Negotiating Chairman, he incorporated Sun International Zambia Limited on 18th November 1997 and in March 1998, he sold the hotel to a company that he had incorporated and in which he was a Director. My view is that these are very serious allegations regarding his conduct in the sale of the hotel, which Mr Hichilema failed to categorically deny yesterday. He would do well if he answered them at his earliest opportunity. The people of Zambia would like to know; was he the ZPA Negotiating Chairman in the sale of the hotel? Did the sale of the hotel commence around July 1997? Did he incorporate a company called Sun International (Zambia) Limited on 18th November 1997? Did he, as ZPA Negotiating Chairman sale the hotel in March 1998 to a company called Sun International (Zambia) Limited which he had incorporated a few months earlier, for a lower price of $6.5 million when they were higher offers as high as $26 million?

6. Now, let me address Mr Hichilema’s arguments regarding his role in the sale of the hotel. His first argument is that the Sun International offer came with a $50 million dollar investment promise. However, we are told that the Sun International offer was not the only offer that came with a promise of reinvestment. All the other offers came with comparable reinvestment promises, so there was nothing unique about the Sun International reinvestment promise. Mr Hichilema’s other argument is that the sale of the hotel to Sun International (Zambia) Limited is one of the few privatization success stories because it had remained operational up to now. Well, firstly there are plenty of the privatized companies which are operational and robust today, including Zambian Breweries, Zambia Sugar, ZANACO etc., and secondly the fact that a privatized company is robust and operational today does not excuse the illegality that might have taken place in its privatization process. The third argument that Mr Hichilema puts forward is that he was not a Shareholder in Sun International (Zambia) Limited. Like l earlier said, l have been very keenly following this privatization issue since it caught momentum last week and l don’t know of anyone who has accused Mr Hichilema to have been a shareholder in Sun International (Zambia) Limited, but a Director. So the quest by Mr Hichilema to answer an allegation which was not leveled against him and instead ignore one which was, is akin to that student who walks into an exam room and finds that none of the things that they had studied have come in the exam. So in order to show the examiner that they at least know something, they just begin to answer questions that have not been asked in the exam, simply because that’s all they can manage to do.

7. Allow me to now address the issue of whether the fact that Mr Hichilema was not a shareholder of Sun International (Zambia) Limited but only it’s Director would still mean there was a conflict of interest or not. The answer is a definite YES. There was a conflict of interest. The only question is whether Mr Hichilema declared interest or not. My take is that he most likely did not, because if he had, he would have been gleefully waving the declaration in front of the camera during his interview yesterday, in the same manner and fashion that he was waving his title deed for the Kabulonga house. The next question is whether such apparent conflict of interest would amount to a criminal offense or whether it is just an ethical and moral issue? Well, section 11 of the Zambia Privatization Act Cap 386 of the Laws of Zambia states “if any person is present at a meeting of the Agency or any committee of the Agency at which any matter is the subject of consideration and in which matter that person or his immediate family or his professoinal and business partners, is directly or indirectly interested in a private or professional capacity, he shall, as soon as is practicable after commencement of the meeting disclose such interest and shall not, unless the Agency or the committee otherwise directs, take part in any consideration or discussion of or vote on, any question touching on such matter”.

8. Indeed, section 11 of the Zambia Privatization Act, Cap 386 of the Laws of Zambia above is very clear.

Therefore, if Mr Hichilema did not declare interest, which l doubt he did, then he possibly committed a criminal offense. If indeed he committed a criminal offense in the sale of Mosiotunya Intercontinental Hotel in Livingstone, the next question is what are the penalties?

Well, this question is answered by section 48 of the same Act, which states “a person who knowingly falsifies any information or KNOWINGLY DOES NOT DISCLOSE ANY MATERIAL FACTS or solicits for his own use or as agent of any other person any confidential information relating to the privatization of a State Owned enterprise shall be guilty of an offense and shall be liable on conviction to a fine not exceeding fifty thousand penalty units or to imprisonment for a term not exceeding five years, or to both”. There you have it.

New Hope MMD President, Dr. Nevers Mumba says the intention of the current debate on privatization is meant to audit the nation and a call to accountability.

Dr. Mumba feels this debate has initiated a cleansing process for the country and that the responsibility on UPND Leader, Hakainde Hichilema’s shoulders is to rest the allegations raised against him by FDD leader Edith Nawakwi.

He has explained that the MMD’s intention and policy during the privatization era was to restructure the economy by privatizing the loss making parastatals and that the exercise was not without difficulties as mismanagement and corruption characterized most transactions.

Dr. Mumba states that until Zambia conclusively deal with this matter, it will not learn from the mistakes of the past.

He adds that the issue of privatization is only a trigger to bring all leaders to account and review the strength and integrity of institutions saying if this problem is not fixed now, Zambia will fail to fix the problem of tomorrow, when the pf leaves government.

God has remembered Zambia. The intention of the current debate on privatization is meant to audit the nation. It is a call to accountability on both sides of the aisle.

The MMD’s intention and policy was to restructure the economy by privatizing the loss making parastatals. This singular move created a new private driven economy and raised the economic profile of our nation. The exercise was not without difficulties. Mismanagement and corruption characterized most transactions.

Until we conclusively deal with this matter, Zambia will not learn from the mistakes of the past. Today God has remembered Zambia by bringing back this subject in order to bring closure and audit ourselves as a nation.

The issue of privatization is only a trigger to bring all leaders to account and review the strength and integrity of our institutions. If we don’t fix the problem of yesterday, we shall fail to fix the problem of tomorrow, when the PF leaves government. Privatization revealed the weaknesses of our system. The overpriced infrastructure contracts of today can only be fairly prosecuted if we identify the problems arising from the privatization exercise. We should therefore not be shaken when any one of us seeking the trust of the people is asked to account for anything we are suspected to have done.

This is not the first time we have been accused, arrested and thrown in jail. It is the right of both the State or any individual to ask us any question. Our role is to provide answers in an honest manner. The PF in 2011 decided to accuse me of misappropriation of funds in Canada during my service as High Commissioner. My job was to clear myself. It took seven long years to clear name from the allegations. So we are not intimidated to stand in any court and prove our innocence. We now have an opportunity to get the same levels of accountability from our colleagues in government.

This is the healing moment Zambia has been waiting for. Now Zambians can demand that the same question asked to Hakainde Hichilema be asked to the current crop of leaders in the PF government. How did they get rich on a government salary? We shall finally get all the answers we have been waiting for. Who took the extra $750,000.00 from each of the 42 fire engines? What have we done with the over $15 billion debt contracted.

To clean up of our society, Zambians have to put aside the divisive political affiliations, the segmentation of society along tribal or racial lines and face this opportunity as one people. We must march to State House together and stay there for as long as it takes until we get all the answers we have been waiting for. Anything less than such an approach will be a futile exercise. This is the revolution we have been waiting for. The revolution for truth and accountability.

For this reason, we welcome the questions being asked by Hon Nawakwi or anyone else as long as they are asked in good faith and in the interest of the nation. We expect that Mr Hichilema shall answer these questions. That’s what we do as presidential candidates. We answer questions so that the voter is clear when making a decision to cast the vote. But we also must demand that the leaders in government answer questions about their source of wealth individually.
This is a great day for Zambia.

My fellow Zambians, our nation cannot survive another five year cycle without a deep cleansing of the system of governance. Whatever the intention of this debate is, God has initiated a cleansing process for the country. The responsibility on Mr Hichilema’s shoulders is to look into the camera and lay to rest the allegations as raised by Hon Edith Nawakwi. This will give an opportunity to Zambians to demand the same from the ruling PF. Going by the recent history of the PF, we expect them to refuse to account for their activities in office. It is at this point that we are calling on Zambians from all corners to march together to demand for answers from our leaders. This movement is irreversible.

2021 should give Zambia a new package of clean and accountable leadership which will take advantage of a new sanitized system of government. We must start afresh beyond 2021.

This planned march dubbed MARCH ON LUSAKA shall signal the rebirth of our country in as far as accountability is concerned.
I call on all Zambians not to lose this opportunity to correct the wrongs that have long impeded the growth of our economy.

NGO leader flees Luangwa on PF death threats

LUANGWA Child Development Agency chief executive officer Danford Makayi has fled the district together with his family after he allegedly received death threats from the ruling Patriotic Front cadres for accommodating UPND members at his lodge on nominations day for the Mandombe ward by-elections slated for September 17.

The Luangwa Child Development Agency is a non-governmental organisation that has partnered with Child Fund International to alleviate poverty among the vulnerable communities in the district.

Dr Makayi, a public health specialist, has, through his NGO, spearheaded developments in education, health and several other activities that go to uplift poor people’s livelihoods.

But according to government sources in Luangwa, Dr Makayi has fled the district and locked his offices following threats on his life by suspected PF cadres as a result of his popularity due to his massive development works through his NGO.

Sources said Dr Makayi’s situation has not been helped by the fact the opposition UPND candidate in the same by-election, Titus Muhandu, also hails from North-Western Province as Dr Makayi which has led the PF to draw conclusions about the latter’s political inclination.

“As we speak to you, a very innocent man has fled away, he has been evacuated by a family member because since Sunday, he has been receiving death threats from the PF guys who came from Lusaka. The problems started during nomination because UPND people who were in the company of Sylvia Masebo who came here to escort their candidate booked Makayi’s lodge. Then because of his popularity, you know in this rural set-up, so, he has been helping a lot of vulnerable communities, building schools, and doing many other activities with money from his partners overseas. So he is very popular among villagers and we know as government officials on the ground that this man is not a politician but the guys (PF) have misinterpreted his popularity to be political,” the sources explained.

The sources said Makayi had on several occasions declined political invitations saying he has had no political ambitions whatsoever.

“The problem again, they are saying he is also from North-Western [Province] so they are the same and that’s why he allowed UPND to stay at his lodge. But we asked him and we spoke to him about it, he said lodging was purely business and even if it was the PF that reached to him first, he could have accommodated them under normal charges like the UPND or any grouping that goes to book the place. We feel for him because he shared with some of us and fled when threats on his life and family heightened, he fled to an unknown place in the night. We are told a family member came to sneak him out of Luangwa in the night. If you want ask the DC, he spoke to him because we all know him. His NGO’s work has been complimenting government efforts here very much, but there is nothing we can do, we are too junior. He is being unfairly treated,” another source added.

Makayi, who is believed to be in hiding, had his phone switched off by press time.

When contacted, Luangwa district commissioner Julius Sikasote gave the phone to an unidentified female person after this reporter introduced himself.

“From The Mast newspaper ah…I am currently tied up, leave the message to the DAO [district administrative officer]”

The female voice also asked to pass on the message to Sikasote when the topic of discussion was put to her saying he was attending meetings.

Dr. Dre’s divorce could cost him millions.

The hip-hop mogul’s estranged wife Nicole Young has filed for temporary spousal support. According to legal documents, obtained by The Blast, she wants nearly $2 million a month in temporary spousal support. This is in addition to $5 million in lawyer fees.

In the docs, Nicole also claims that Dre had “abusive control” over her during their 24-year marriage, and kicked her out of their family home while extremely intoxicated. She describes an alleged argument that occurred April 1, 2020 that ultimately led to their divorce.

“Andre, who was intoxicated, told me that he wanted me to leave our [Brentwood] residence. He started yelling at me, ‘F**k you. F**k you. Get the f**k out. Get the f**k out. Go to Malibu,’” says Nicole.

After moving to the Malibu beach house, she claims Dre “was still angry at me” and sent text messages including “Do no spend one more cent…Period…You can’t be mean and disrespectful and spend my hard-earned money. F**k that!!!”

She also brings up Dre’s history of violence. “While talented, Andre’s personal life was turbulent and violent and was marred by encounters with law enforcement, incarceration, and physical and emotional abuse against women,” she adds.

Nicole says Dre later agreed to attend couples therapy and stop drinking. “However, it was not long before he showed he could not keep these promises,” she says.

Dre plans to push back on the $2 million spousal support demand. He argues that Nicole doesn’t need close to that amount since her lifestyle hasn’t changed, but she claims she needs the temporary support since Dre was paying the bills.

Nicole has reportedly demanded an upfront $1 million payment while they work through their issues and is requesting financial documents from Dre’s business team from the past 10 years. “If you allow [your attorneys] to disrespect me, dig into my personal business, that means War!!! And there’s no coming back from that,” he reportedly told her.

The couple, who announced their separation in June, is also in the middle of a dispute over the prenuptial agreement. Nicole claims that she unwillingly signed a prenup in 1996 after being forced by Dre. Two years into the marriage, Nicole says Dre destroyed the prenup and claimed it null.

Dre, whose net worth is estimated at $800 million, denies he tore up the prenup, and says Nicole signed it willingly. The couple, who wed on May 25, 1996, have two adult children together, a son named Truice and a daughter named Truly.

We know very well that HH is being persecuted in this whole saga just like they have been throwing him in and out of prisons without cases to answer all simply because of politics.

If Edgar Lungu, can order police to detain a fellow citizen in the name of HH and confine him in a small police cells without toilets where there are faeces on the floor, what more do we Zambians wants to know about how wicked Edgar Lungu and his PF government are? The great thing about all this is that, God is above wicked people like Edgar Lungu and his minions.

God will bring them down nor sooner than later. They will not continue holding our nation hostage as though it is their homes.

Yes, today and just like before, HH has proven beyond reasonable doubts that he bought his properties in a clear and transparent manner, but how many of you PF government officials and all the surrogates trying to smear faeces on HH will be able to account for all the riches you have acquired overnight when your time come?

ZITUKULE Consortium executive director Nicolas Phiri says the PF administration has shown no appetite to fight graft in the past 10 years and has completely undermined state institutions created to fight graft.

And former minister William Harrington says anyone who knowingly conceals a crime is guilty of an offence and should be arrested and prosecuted accordingly.

Phiri said it was absolutely mischievous and insulting to the people’s collective intelligence for the government to insinuate that it has received Edith Nawakwi’s revelations “with great indignation”.

He said he was deeply dismayed and taken aback by the Zambian government’s position on the debate about the sale of public companies and assets which the government willingly pursued as part of the broader economic reforms to save the economy from total collapse in the early 1990s.

“Recently, FDD president Edith Nawakwi, after taking years of political self-quarantine, has come back to the political limelight by alleging that leader of the opposition UPND Hakainde Hichilema benefited illegally from the government-led and initiated privatisation programme. We wonder why Madam Nawakwi, having had that information for more than two decades remained mute until now,” Phiri said. “It is absolutely mischievous and insulting to our collective intelligence for the government to insinuate that it has received Ms Nawakwi’s revelations ‘with great indignation’. The PF administration has shown no appetite to fight graft in the past 10 years and has completely undermined state institutions created to fight graft. What is so special about Ms Nawakwi’s revelations that could make government so unsettled? How can a serious regime get surprised about a programme which was initiated, controlled and supervised by the state through the Zambia Privatization Agency under Ministry of Finance?”

He said the government’s response to the matter implies that an individual in Nawakwi had more information on a government programme than all the institutions and systems of government created to carry out government business in general and the privatisation process in particular.

Phiri said that admission by the government was shameful as it exposes the malice and ill intentions by those in government against dissenting voices.

“We saw similar machinations when the gassing syndicate engulfed the country,” he said.

Phiri said it was hypocrisy of the highest order by the Zambian government to suggest that reports of alleged abuse of the privatisation process which took place more than two decades ago have unsettled a government which has entertained corruption and turned a blind eye to daylight robbery of national resources ranging from mukula, gold to financial assets.

Phiri said there was documented evidence of mukula logs leaving the country undetected, even when the law does not allow the export of logs.

“Further, there are glaring discrepancies in the export-import which government has not bothered to reconcile and clarify. It is also well documented that Zambia losses close to 7.1 million dollars per annum in bribes to facilitate the illegal trade of Mukula. How about the 48 miracle houses whose owner still remains anonymous? How about the fire trucks bought at a cost of 48 million dollars and insured for far less than the market value? What about the chemical gassing which claimed more than 50 lives to mob justice? Why isn’t this government bothered by all these scandals?” asked Phiri. “We call on government to desist from taking citizens for granted and focus on providing solutions to the challenges faced by our people. There is so much pain and anguish in this country which those in power must spend time on as opposed to witch-hunt of those challenging the status quo.”

And Harrington said Zambians expect the law enforcement agencies to move in and take decisive action and arrest anyone who has concealed any crime so that they can assist with investigations.

“My former cabinet colleague in the [Frederick] Chiluba administration Edith Nawakwi who served as finance minister at one stage has and continues to insist that she is aware of certain ‘crimes’ committed by UPND leader in his role as consultant in the privatisation of some state-owned companies. It is grossly unfair and immoral to accuse some of a criminal offence he or she may have committed twenty five years ago. Interestingly, Hakainde Hichilema has publicly challenged anyone with incriminating evidence against him in the privatisation exercise to report him to the police and have him arrested. He has even offered to give away his house in Kabulonga but no one has come forth to take up the challenge, not even Nawakwi herself,” said Harrington.

HH politically persecuted – Kashishi

HAKAINDE Hichilema poses the greatest risk to the PF’s continued stay in power hence the privatisation mudslinging campaign using Edith Nawakwi, says Mufulira senior citizen Pepino Kashishi.

Kashishi, a retired employee of ZCCM, has questioned how a single individual could circumvent an elaborate system in the privatisation process to personally give recommendations directly to a minister.

He wondered why and how a minister (Nawakwi) allowed such a procedural lapse to occur.

Kashishi has expressed disgust at attempts by the public media institutions to systematically condemn Hichilema without giving him the platform to give his side of the story.

An avid reader, writer and social commentator, Kashishi has questioned where the entire cabinet in which Nawakwi was finance minister was when Hichilema did what he has been accused of doing in the privatisation process.

“I wish to comment on the renewed allegations of impropriety in the sale of state enterprises against UPND leader Hakainde Hichilema and especially those by Edith Nawakwi, FDD president. On the TVZ [ZNBC] Sunday Interview programme on 30 August, 2020, neither the host, Grevazio Zulu nor the guest, Edith Nawakwi, made any reference to the role of the Zambia Privatisation Agency (ZPA) in the sale of state companies. If they did it was done fleetingly and I missed it. The host should have asked more probing questions especially in this regard. As it was, the picture painted by Nawakwi was that HH acted alone as consultant and chair of some unnamed committee charged to sale the Livingstone InterContinental Hotel and that he made misleading recommendations in person to her as then minister of finance that resulted in selling this entity in a fraudulent manner and HH made personal gain from this transaction,” he said. “How did the minister accept any recommendations directly from a consultant against the implementation guidelines under the Zambia Privatisation Act No.386 of the Laws of Zambia?”

Kashishi explained that the ZPA Act provides for the privatisation and commercialisation of state owned enterprises and established the Zambia Privatisation Agency to “plan, manage, implement and control of the privatisation of state owned enterprises in Zambia.”

He said established under the same law are a board and a management team to deal with the day-to-day running of the agency.

He further said the cabinet and not the minister of finance, was given the final authority over the privatisation programme.

Kashishi said even the list of enterprises to be privatised and the order in which this was to be done had to be approved by cabinet.

He said ZPA advised on the mode of sale in each case but that cabinet gave the final approval.

Kashishi also stressed that the procedure, except for ZCCM which had its own negotiation team, all other state enterprises had a ZPA negotiation team consisting of ZPA staff, business analysts and consultants.

“These teams prepared tender packages on each entity to be sold and on which bids were made by potential buyers. These were public bids and evaluated by the same ZPA negotiation teams. The teams then made recommendations to the members of the ZPA board who then shortlisted the bids for further negotiations before a final decision was made,” he said. “Price consideration had to be matched against the potential of the bidder to improve the enterprise to be sold based on their record. But the Sunday Interview attempted to cast this in a dark manner. Among the members of the board were the permanent secretary for finance, permanent secretary for commerce and industry and the Attorney General, among many other representatives from various organisations appointed by the President. How then did HH manage to circumvent such an elaborate system to personally give recommendations to the minister and why and how did the minister herself allow such a serious procedural lapse to occur? And where was the whole cabinet in all of this? Admittedly, rules and procedures are usually broken or circumvented when under the table deals are made. But the picture painted in the Sunday Interview was that it was standard procedure for a consultant to give his own recommendations directly to the minister of finance on the sale of state enterprises they were tasked to sale without necessarily involving ZPA.”

Kashishi said Hichilema as a Zambian has suffered a lot at the hands of the ruling party and was once placed under filthy detention on a serious charge of treason for a traffic offence in Mongu.

He also wondered why Hichilema has not been prosecuted by successive regimes if, indeed, he committed any crimes.

“It is my considered view that these allegations against HH are just a sustained way by the Lungu PF administration to paint black Hakainde Hichilema with the purpose of pulling him down because he poses the greatest risk to their continued stay in power,” he said. “It is not the purpose of my statement to judge HH as innocent or otherwise. But I am disgusted at this systematic attempt to condemn HH without giving him the necessary platform to give his side of the story. It has always been a one sided stream of accusations on ZNBC and other tax payers’ funded public media. Taking everything into the right perspective why hasn’t HH been prosecuted for this by the current and previous regimes? This Zambian has been arrested, gassed and detained on very flimsy grounds such as merely impeding the flow of a presidential motorcade for which he was charged with a very serious crime of treason and had to spend months in filthy detention. In case we have forgotten, Francis Kaunda, the last chairman and CEO of ZCCM who later headed the GRZ/ZCCM negotiation team by a presidential appointment, was jailed in 2008 for two years with hard labour. He was imprisoned for abuse of office and (with the then Access Financial Services director, Faustin Kabwe) for conspiracy to defraud. This was for offering Ndola Primary School for sale to Ndola Trust School. The crime was a misdemeanour but Judge Edward Musona who presided over the case noted the seriousness under which the crime was committed as it was against the privatisation guidelines and thus prejudicial to the interests of the government. However, both were later acquitted on appeal by the High Court on account that ‘they had no mandate for such an act’, i.e. selling the primary school.”

Kashishi said he was making a reference to “this to illustrate how the allegations against HH, which in my view are more serious than the Kaunda/Kabwe cases, should have been treated if there was evidence as is being claimed”. “HH himself has even offered to be prosecuted and has placed some bounty on the evidence that could be produced on the allegations. But nothing, so far, has happened. Why?” he wondered.

He said if an integrity test was to be conducted on Hichilema as it was being suggested by some quarters, it must be extended to both President Edgar Lungu and Nawakwi herself before next year’s elections.

“And if ZNBC are truly a professional national broadcaster, let them accord HH the same platform now as they gave to Nawakwi so that we hear his side of the story. The story about UPND president Hakainde Hichilema’s involvement in the privatisation of state companies in the 1990s has been trending on all forms of mass media platforms – both online and offline and social and mainstream media.

The story came about after FDD president Edith Nawakwi, a former minister during the time, ‘revealed’ what she alleged as foul play on Hichilema’s part in the process. Opinions are divided on the issue. Conspiracy theories abound. One school of thought is that the story always surfaces just before elections, simply for political mileage, but dies down again post-elections due to lack of credibility.

If winning public opinion and voters is what is at stake here, the questions is how effective is the strategy? In this era of interactive media, where media audiences have a say, I decided to dedicate this article to gauging the readers’ views on the matter.

To do that I viewed readers’ comments to a News Diggers online (Facebook) story titled, “Govt might act on Nawakwi’s allegations against HH – Dora”. The story’s intro reads, “CHIEF Government Spokesperson Dora Siliya says government will soon inform citizens should it decide to act on former finance minister Edith Nawakwi’s allegations against UPND leader Hakainde Hichilema.”

News Diggers is regarded as a credible media outfit on almost all fronts, hence my pick. This story carried 403 comments and 13 shares as at 06:00 hrs on Wednesday, September 2, 2020. Due to lack of space I have published the first 35 comments, unedited, and in the order that they appear on the site. The names of the authors are also provided as published. I have been approached by one prominent Patriotic Front (PF) member who has warned that Zambians should not underestimate President Lungu’s intentions to hold on to power and cause trouble and bloodshed next year. The man just hopes on God’s divine intervention to stop Lungu. That’s how serious.

The individual who requested for his identity to be withheld complained that Lungu is very serious about his actions ahead of 2021 unless Zambians stand together and stop him now.

“Yes I’m PF,that fact you know very sir, but I have children and Zambia is bigger than PF, people are suffering, and why should I not tell you the truth sir!”, the source narrated. “What I’m telling you please publish it and withhold my ID. My leaders in PF want to cause trouble next year because they know that we have lost the ground due to economic hardships and corruption being attributed to senior officials officials”.

“I have been compelled to pass this information to you sir! Because my worry is what happens when the country gets into trouble, there will be nothing like I’m PF or opposition, we shall all suffer the source said. So I want Zambians to be aware of what is going on”.

“If you are to look at ba Edgar Lungu this man is a different one and this is what I want the people of Zambia to be very careful with in understanding him and what we are likely to face if we don’t unit as citizens”.

“Why has he failed to address the nation on the procuring of military weapons?” The source asked, “you Mr Sikaile, you write and they read everything you write so, ask him what those guns are meant for if not for we citizens”.

“Let us be serious about the future of Zambia. Because we are all going to lose at the end of the day, and these guys since they have got so much money, they will escape and seek asylum outside Zambia the source continued warning.

There is wind of change that is very true and everyone in PF we know it including service chiefs, even those they have hired now, they know very well that president Edgar Lungu can’t win next year’s elections, but he wants to return to office by any means that he and others deems fit for them”, the source concluded”.

Our comment, fellow citizens, we are grateful that we have been vindicated. We have been warning about PF government evil plans, but here we are today, some people who love Zambia within PF are coming out to alert us of what is going on behind the camera.

Levy Mwanawasa Opted Not To Prosecute HH To Gain Support In Southern Province – Dr Katele Kalumba

Former finance minister Dr Katele Kalumba has revealed that late president Levy Mwanawasa decided not to prosecute UPND leader Hakainde Hichilema for personally benefiting from the privatisation programme in an attempt to get political support from Southern Province.

“Politics is a game of chance, as MMD with our leadership being president Levy Mwanawasa, he took a stance that he should not fight against any Southerner in order to get support from Southern Province,” Dr Kalumba revealed during Hot FM’s What’s Hot in the News programme today when asked to comment on the ongoing privatisation debate which has seen FDD leader Edith Nawakwi accusing Mr Hichilema of amassing ill gotten wealth.

He said the issue at stake was a question of whether or not there were any vested interests that were not declared by individuals involved in the privatization of public assets and that Mr Hichilema, therefore, needed to answer the question as to whether he declared interest or not.

“The simple issue at stake here is a question whether there are any vested interests that were not declared by individuals involved in the privatization of public assets. For instance, did Mr Hichilema have any interest at all in those that were buying state assets. And that did he or did he not declare those interests? That’s all, yes or no. simple question. I personally been through that process were Zambians required me to account. Say, did you steal a BMW from the office of the President? And I accounted and the courts of Law said no you didn’t. Did you spend 8,400 lavishly without responsibility, without accountability, and I have argued in the courts of Law. That 8,400 you are talking about got Zambians US$78million from the British government. The cocktail parties, the dinners that I was hosting for the British government, we got US$78million to repair Nkana smelter,” he said, and wondered why Mr Hichilema was having difficulties to explain the issues at hand.

Meanwhile, the former minister says privatization of national assets which happened in the MMD era was not just a good thing but was necessary and essential for Zambia to survive.

Dr Kalumba said the then government felt it was vital to liberalize the economy through privatization considering the fact that the country was economically going down and going down badly.

He said the country recorded progressive results following the privatization process.

CHIEF MUKUNI WARNS PF…we’ll not allow HH humiliation

I AM fully aware of the PF machinations to arrest Hakainde Hichilema over the issue of Intercontinental Hotel, whose transaction was transparent and above board, says senior chief Mukuni.

Mukuni warned the PF government that, “We will not allow this…I am sending a categorical warning to the PF that the battle lines have been drawn, and my war shofar has been sounded.”

On Tuesday, chief government spokesperson Dora Siliya said the government had received with great indignation reports that Hichilema, the former chairman for the Zambia Privatisation Agency (ZPA) negotiating team was one of the key perpetrators of extensive abuse of the privatisation process.

Nawakwi has since last week been accusing Hichilema of impropriety in the privatisation process.

Many Zambians, however, have branded her a PF hired gun.

Siliya said the government was disturbed by revelations made by Nawakwi, a former minister of finance in the MMD government of Frederick Chiluba that implemented the privatisation of State-owned enterprises, that Hichilema, as chairman of the Privatisation Negotiation Team for the sale of Musi-o-Tunya Intercontinental Hotel, Rainbow Lodge and National Heritage Park, literally sold the entity to himself.

“Hon. Nawakwi, through her various media engagements, has categorically stated that Mr Hichilema failed to declare interest while presiding on the sale of public assets in which he had personal interest,” she stated. “Government finds Mr Hichilema’s conduct, if true, to be a clear case of corrupt practices, bordering on non-declaration of interest, in winning a bid. Government is, therefore, studying the matter and is following closely the reaction by the citizens who are the true owners of the property in question.”

But Mukuni, in a statement, says the main purpose of wanting to arrest Hichilema is very clear.

“It is to offer them an opportunity to detain him and compromise his health, by poisoning him, so that they completely eliminate him from the ballot box in 2021. We will not allow this!” he charged. “The whole scheme is nothing more than Hon. Edith Nawakwi’s Judas style agreement to betray Hakainde Hichilema as a sacrifice for their visionless party. Hakainde Hichilema is a Zambian citizen first, but he is also my subject. Arising from the two preceding factors, his welfare, and most importantly his safety and health are my concerns should they detain him. Therefore, I am sending a categorical warning to the PF that the battle lines have been drawn, and my war shofar has been sounded. We will defend Hakainde Hichilema with all our strength, and we will not allow this humiliation and this abuse of an innocent citizen go further than this. Why can’t you leave Hakainde enjoy his freedoms just like any other Zambian? Why can’t the PF concentrate on massive levels of corruption, the high cost of living and the runaway kwacha, and an economy that is in the ICU than direct their energies on one individual whose only offence is to aspire for public office? This kind of injustice must end and we will not allow it.”

Mukuni went on to invoke Thomas Jefferson’s words, “All men are created equal, that they are endowed by their Creator with certain inalienable Rights, that among these are Life, Liberty and the pursuit of Happiness”.

‘HH Lawyers Respond To Nawakwi’s Allegations.’
Lawyers for opposition leader Hakainde Hichilema have responded to allegations that the UPND president enriched himself through state privatisation deals in the 1990s.

Representatives from Malambo and Company law firm have written to former finance minister Edith Nawakwi, accusing her of defamation of character for levelling false accusations of corruption against Mr Hichilema.

RE: DEFAMATION OF CHARACTER – YOURSELF AGAINST MR. HAKAINDE HICHILEMA

The captioned matter refers. We, together with the law firms copied here, act on behalf of Mr. Hakainde Hichilema (“our client”) and have been instructed to write to you as we do below on his behalf. Kindly note our interest in that regard.

Background

On 27th August 2020, you featured on a radio program entitled “the Hot Seat” hosted by Zachariah Chavula on Hot FM Radio Station which was also broadcast on Kwithu FM Radio Station (“the program”).

It is our understanding that the above mentioned radio stations enjoy immense and widespread coverage in Zambia and beyond, not only by reason of the radio broadcasts they transmit, but also because of the internet and other platforms via which their signal and broadcasts can be monitored from anywhere in the world.

Our instructions are that during the program, and subsequently thereafter on other forms of media including Zambia National Broadcasting Corporation Television, you made false, malicious and defamatory statements (“the defamatory statements”) against our client whose aim, purpose and effect was, inter alia, to expose our client to hatred, contempt and ridicule; to embarrass him in the eyes of the general public; to lower our client’s reputation in the estimation of right thinking members of society; to cause him to be shunned and avoided; and generally to create an impression in the minds of the global community, given our client’s international repute as a businessman and politician, that our client is a thief and/or a person of miscreant behaviour who does not respect the rule of law or deserve to hold public office as President of the Republic of Zambia, for which our client aspires.
Consequently, our client has suffered irreparable damage to his reputation, severe embarrassment, harassment, hatred and ridicule in respect of which our client has instructed us to seek reparation from you as we do here below.
Particulars of defamatory statements

Without limiting the generality of the foregoing, and whilst our client’s right to make any or any further claim against you, in relation to your recent conduct towards him remains fully reserved, our clients instructions are that the defamatory statements were to the effect that:

Our client is or was at the material time a criminal;
Our client involved himself in theft and corruption by alienating a house located on Serval Road in Kabulonga, Lusaka (which you purport belonged to Lima Bank) to himself as liquidator of that institution;

Our client involved himself in undisclosed illegality regarding the receivership of RAMCOZ; and
Our client abused the privatization process in general and in particular with regard to the transaction for the sale of the assets of Mosi O Tunya Intercontinental Hotel in Livingstone and related assets which you allege that our client “sold to himself”.

As alluded to above, the allegations contained in the defamatory statements are devoid of any truth. They are malicious and aimed at damaging our client’s hard earned reputation as an astute businessman, as a person worthy of holding office as President of the Republic of Zambia and as a law abiding and God fearing citizen of Zambia, and the world at large, quite aside from being a clear violation of his guaranteed human rights.

The defamatory statements were made without due regard for the true factual position regarding the subject matter thereof and in contumelious disregard for the law.
The allegation that our client is a common criminal
As you are aware, our client does not have any criminal record nor has he involved himself in any criminal activity. Should you fail to meet our client’s demands below and should this matter proceed for determination by a Court of competent jurisdiction, you will be put to strict proof on that allegation. Allegations relating to acquisition of property on Serval road in Kabulonga

Contrary to your false and malicious allegations, our client has never been a liquidator of Lima Bank nor has he ever purchased any property from Lima Bank in liquidation or otherwise.

Had you cared to take keen interest in events as they truly transpired, it would have come to your knowledge that while the Lima Bank liquidation commenced in 1997, the property in issue was acquired by our client in 1995 a good two years prior to the commencement of the liquidation process. Cleary your allegations are false and malicious in that regard.
Your allegation to the effect that our client involved himself in theft and corruption is therefore baseless and a purely malicious falsehood.

In any event, it is trite that any citizen is entitled to buy leasehold property in Zambia together with any unexhausted improvements thereon. Our client is no exception.
Had you exercised even the barest precaution in discharging your duty of care towards our client, you would have conducted a search at the lands and deeds registry to ascertain the true position before uttering the defamatory statements.

You may be aware of the age old principle that he who alleges must prove.
Allegations relating to the Receivership of RAMCOZ
You are aware, and the records will show, that our client was never involved in the privatization of RAMCOZ which was sold by Government to the Binani Group of India in 1997 for a consideration of
Subsequently, upon failing to meet its financial obligations to ZANACO, RAMCOZ was placed under receivership in 2000. The appointed receiver manager was Mr Christopher Mulenga and not our client.

The receivership process was undertaken in accordance with the law and reports rendered to the appropriate stakeholders. Our client is not aware of any criminal complaint having been made against the receiver manager, Mr Christopher Mulenga, in relation to the receivership.

Allegations relating to abuse of the privatisation process
All records relating to the sale of the assets of Mosi O Tunya Intercontinental Hotel in Livingstone and related assets are a matter of public record and will show that, in so far as our client played any role in that process, he did so within the confines of the law.
Moreover, we are aware that the Zambia Privatization Agency (“ZPA”), and ultimately Government, like any other seller in a transaction for the sale and purchase of assets, is obligated to, and did, conduct a due diligence exercise on all potential buyers of privatization assets.

The foregoing therefore entails that at all stages of the transaction for the sale and purchase of the privatization assets, the ZPA was fully informed on all material particulars of potential buyers, especially such material particulars as were already in the public domain.

You may also wish to note that the sale of Mosi O Tunya Intercontinental Hotel and related assets to the successful bidder has greatly benefited the people of Zambia as it is one of the few success stories of the privatization exercise, contrary to the innuendo created by you in the defamatory statements.

Your allegations of improper conduct on the part of our client (to the alleged detriment of the people of Zambia) are, despite their malicious venom, therefore baseless both in law and in fact.

Particulars of harm caused to our client (inter alia)
Irreparable damage to our client’s reputation given that you purported to make the defamatory statements from an informed position in your capacity as a former Minister of Finance worthy of being believed on that score.
Aggravated damage to our client’s reputation owing to the malice and venom with which the defamatory statements were made and published to a global audience of several million people.

Mental distress, anguish and torture.

A stain on our client’s candidature for President of the Republic of Zambia in so far as the defamatory statements cast aspersions against our client to the effect that he is not a fit and proper person to hold the highest public office of the land.

Harassment at the hands of overzealous state operatives that have declared their intention to maliciously prosecute our client on the back of your defamatory allegations as evidenced by the press statement recently issued by the Chief Government Spokesperson to that effect.

Our client’s demands

Our instructions are therefore to demand the following:
A detailed and unreserved retraction and apology from you to be published in like manner and with equal prominence to the defamatory statements, the text of such retraction and apology to be approved by us;

That you undertake in writing to desist from making the defamatory statements or any similar statements going forward.
While our client recognizes that your actions have caused him irreparable harm that cannot be atoned for in monetary terms, you will note that he has been put to great expense and inconvenience on account of your conduct.

This entails that our client has incurred and continues to incur great expense both locally and internationally in order to mitigate the harm that you have caused to him. Our client places the cost of the foregoing, which includes legal costs incurred thus far, at the conservative sum of which our client hereby demands from you. Our client is amenable to, receiving reasonable proposals as to how you intend to settle the said sum.
31. Our client’s rights however remain fully reserved.

Save as stated in paragraph 30 of this letter, our client further demands, in view of the pressing nature of this matter, that you address his demands within 24 hours hereof, that is to say by no later than Thursday 3 rd September 2020, failing which our client will be constrained to take out proceedings before an appropriate forum so as to protect his interests.

IMF BAILOUT IS THE ONLY CURE TO PREVENT ZAMBIA’S TOTAL ECONOMIC COLLAPSE

The IMF as an institution exists to help developing countries by giving them sound advice and financing to grow the economy and improve the living standards of their people.

The IMF came to Zambia 4 years ago, they predicted this economic crash. The signs were there for all to see that there was bad times ahead.

The key indicators were ;

1: Excessive debt being contracted irresponsibly and on bad terms from China by the PF government of President Edgar Lungu.

2: The loans were used for consumption rather than for income generating activities, this meant that these loans would have to be repaid directly by the Zambian taxpayer. Taxpayer funds used to pay loans means less medicines in hospitals and poorly equipped schools and government institutions.

3: Incompetence, President Lungu appointed incompetent people to key government institutions. He appointed a traffic officer to be minister of Infrastructure, a teacher to be mines minister, a katondo dealer as home affairs minister etc. These people would go on to make a series of bad decisions that have crippled the economy.

4: Corruption, alot of the borrowed money was stolen, it was not used for its intended purpose.

5:Loadshedding has had a terrible impact on production and the national GDP. Production of goods has gone down over 30% leading to job losses and increased costs of production.

The results of these bad policies, incompetence, corruption and excessive borrowing is now manifesting itself in the economy through job losses, sky rocketing cost of goods, rampant inflation, expensive fuel and electricity and a weak kwacha.

The IMF gave President Edgar Lungu a choice 3 years ago, he refused to take the offer because the IMF was demanding an end to corruption and was demanding fiscal responsibility in exchange for a bailout package.

The IMF has made it categorically clear that as long as the PF and President Edgar Lungu are in government, they will not render any aid to Zambia which means the economy will be in free fall until Zambia becomes like Zimbabwe or Venezuela.

So Zambians have a very simple choice to make, the only way we will access the funds from the IMF is by getting rid of President Edgar Lungu and the PF from government. If Lungu comes back to power you will suffer immensely for 5 years, this country will be completely destroyed. So the only choice we have is to get rid of the PF in 2021 so we can access the IMF funds.

The IMF funds will enable us to ;

1: Repay debts to China and other unethical lenders.

2: It will allow us to now pay the IMF loan at low interest rates.

3: The debt repayments will be spread out over a longer period of time so that we can have funds to spend on social service delivery.

4: It will infuse dollars into the economy which will strengthen the kwacha and result in a lower exchange rate, cheap fuel and cheap groceries,cheap air tickets, economic expansion and job creation etc.

So the choice is very clear to make for all Zambians.

Vote for Lungu and continue suffering, or vote for the opposition and enjoy economic recovery.

Govt has set up taskforce at ACC against HH

UPND deputy spokesperson Cornelius Mweetwa says the PF in its continued onslaught against Hakainde Hichileme has set up a taskforce at Anti-Corruption Commission to probe the opposition leader with possible arrest over his role in the privatisation process.

He alleges that the PF government also wants to grab Hichilema’s assets in a manner like they did with Post Newspapers Limited (in liquidation) to incapacitate him.

Mweetwa briefed the press in Choma yesterday over continued attacks on Hichilema heightened by FDD president Edith Nawakwi.

He said the issue was not a Nawakwi Vs Hichilema fight but about the PF fighting Hichilema in a desperate attempt to shift national debate from current national problems.

“So people like madam Edith Nawakwi should be understood in context. Number one, this is someone whose political career as someone aspiring to become the head of state under FDD has come to a dead-end and she has come to accept it because she can no longer command national support and she also can no longer command sponsorship,” he said. “Madam Nawakwi runs FDD as an NGO to promote women participation in politics. She was receiving sponsorship from the Nordic countries as an NGO operating as a political party. And that is why she was able, ahead of 2016 elections, to be going round donating chickens to women groups.”

Mweetwa alleged that from the same money Nawakwi managed to hire some employees as her image builders for FDD to look like a political party.

He said in 2016, Nawakwi lost miserably getting less than 50 per cent of votes he got in Choma.

He claimed her sponsors knew Nawakwi was misleading them that she had nationwide support and they immediately withdrew their support.

“That is why even those employees of hers masquerading as supporters left and trekked to PF. She is the last one therefore to join the choir members who are singing for President Edgar Lungu and PF,” Mweetwa said. “How come Nawakwi can now begin to speak the way she is speaking against HH? This is hypocrisy of the highest order. Thirteen years ago in 2006, Edith Nawakwi went to bed with HH under UDA (United Democratic Alliance) in a similar style of being HH’s running mate. How can she summersault now to say that HH misconducted himself during privatisation?”

Mweetwa wondered how Nawakwi found it convenient to go to bed with Hichilema in 2006 but demonise him today.

“She is now behaving like a prostitute who goes for the highest bidder. Why did she go to bed with HH if HH conducted mischief through privatisation? It is these kinds of leaders Zambians should begin to say no to – those who take the position of convenient to themselves. When it was convenient, HH was her darling,” he said.

Mweetwa said the whole scheme was one of the stages that PF had lined up for debate in their desperation.

He said after 2016, PF slapped Hichilema with treason, which ended in a nullity.

“They went ahead now to try and link HH to the burning of Soweto market, city market, Chisokone and other places. They even went to the extent of sending their agents to knock down Zesco poles in some places of this country and allege that it’s HH’s people knocking those poles down as acts of economic sabotage, the same way they said the burning of markets was work of the opposition. They went on a heavy tribal crusade, they have realised that the tribal chorus has become a tired song, people are no longer interested in listening to it, it is at the level of dununa reverse song,” he said. “From there they graduated and brought in the issue of Satanism, that HH is a Satanist, he is a free mason. Hadn’t it been for Seer 1 who exposed them for the rings and things they got from him relating to supernatural power, they would still be insisting that HH is a Satanist. Now Seer 1 exposed them. From the time Seer 1 exposed them, they kept quiet on Satanism. The next thing they did was that two months ago, I know, on the Copperbelt, they gathered the clergy and told them that ‘as Christians begin to demand that HH should begin to speak against Seer 1’ who appears to be endorsing HH and demonising President Lungu. They lined up the clergy and gave them money. Some of the people they go to address are our people and they get surprised.”

Mweetwa said the PF went ahead to link Hichilema to gassing but that too boomeranged in their face.

“As things stand, as somebody who has worked as an anti-corruption crusader for a while, I am fully briefed and we know that right now this government has set up a taskforce under the Anti-Corruption Commission. Let them deny that they have set up a taskforce to begin to manufacture issues that should present a good case of probing and investigating HH with a possible arrest over privatisation, that he abused his position,” Mweetwa said.

He said the PF know very well that no reasonable court, properly constituting itself could convict Hichilema on trumped up charges they want to prefer on him.

“This is the scheme, let them deny that they have set up a taskforce at the Anti-Corruption Commission. We are aware that they are using a two-pronged attack against HH, attacking him left, right and centre. They are even looking at a window to grab some of the assets of HH so that they incapacitate him in the like manner they did with the Post Newspapers and sold to themselves. Can they tell us who bought the courier trucks of Post newspaper if it is not they themselves at the apex of the PF leadership. Can they deny? Let them tell us who bought those trucks if not those connected to the same powers that today want to claim to be faithful,” he said.

Mweetwa said the PF were trying to strip Hichilema of his assets he had worked for without stepping foot into a government office or looking for a contract from a government official.

He said Hichilema worked in the private sector.

He wondered at what stage Hichilema abused his position.

“According to the anti-corruption Act, you only abuse your office or authority of office when you are a public officer, using your public office, authority for private advantage. HH has never been a public officer. If they are talking about him being a consultant of a company which government had contracted to advise them, I mean, even a grade 1 or grade 4 could understand that it was not even HH, it was the firm that was contracted, HH was just a consultant. And the job of a consultant is not to make a decision, the job of a consultant is to advise you and the advice is simply to inform you and not make a decision on your behalf,” Mweetwa said.

He said the PF government have tried all tricks on the ground, including violence but have realised that the tide of change could not be stopped.

Mweetwa said the PF have even used ministers to declare no go areas for Hichilema but UPND shows strength on the Copperbelt.

“The next day President goes to the Copperbelt and he is booed in a province they are talking of no go area. They are seeing what is going on in Lukashya right now. They are seeing what is happening in Mwansabombwe. This tide of change is not about HH, it’s about the people of Zambia. This is the most important election in Zambia after 1991,” he said.

Mweetwa said the PF want to paint Hichilema black and leave thieves alone in their government positions after cleaning them at Anti-corruption Commission and at court.

He said now the PF has begun dishing out money in compounds like Chawama where entrepreneurs were being given K1,600 each.

“Where is this money coming from? Let them deny that they, this PF government, demanded that Bank of Zambia gives them K1 billion and they demanded that this K1 billion be taken to the Presidential Empowerment Scheme and Bank of Zambia told them that ‘we do not have such kind of money, we have run out of actual cash. And the only money we have in our reserves is K900 million’,” he said. “That is the money that they are dishing around. Let them deny that they have since asked Bank of Zambia to give them K4 billion so that they sweep to presidential empowerment scheme for them to continue this handout scheme. This K4 billion and the K1 billion are part of the reason why the Bank of Zambia governor was fired. I want them to deny it.”

Mweetwa urged all surrogate and vuvuzelas paraded on cameras to talk about Hichilema to reason.

He said if people want to talk about corruption, they should point to the US $42 million fire tenders, $273 million digital migration, $250 million obsolete hammer mills, 48 houses that have got no owner, and the social cash transfer, which were plaguing the nation.

Mweetwa also challenged the PF to tell the nation why three years ago they sent teachers to Eden University to upgrade their qualifications but the government is failing to pay Eden University to graduate them.

He said Zambians were still interested in hearing more about the Carlington Maize scandal which implicated Nawakwi.

“Nawakwi’s trip to Canada as minister of finance, when they went to negotiate issues of privatisation. Can she tell us the discussion, the circumstances under which she met Ari Ben-Menashe, an Israeli, to discuss issues to do with privatisation? And what other things happened, where did they meet? There is more we know which is why we say let the sleeping dogs lie,” said Mweetwa. “Can she also dispute, we would like her to clarify whether Francis Kaunda did not come from those talks of privatisation and complained that the person who had messed up our talks is Edith Nawakwi.”

HH, Kambwili Must Lead Opposition Alliance Into 2021 Elections – Panji Kaunda

Chishimba Kambwili must be Hakainde Hichilema’s running mate in the 2021 general elections, says ruling PF member Colonel Panji Kaunda.

Speaking with Daily Revelation, Col Panji, who has vowed to remain a PF member while at the same time vowing to de-campaign President Edgar Lungu because of what he observes as rampant corruption and impunity that is happening under his watch, urged opposition parties in the alliance to stop beating about the bush, by coming out to declare that UPND leader Hichilema will be the presidential candidate with NDC leader Kambwili as his running mate.

He said it was clear to everyone that Hichilema and Kambwili were the most popular leaders in the opposition alliance, and should therefore lead the alliance.

“My appeal on behalf of most Zambians is for HH and Kambwili to be the lead horses. When you are farming there is a stronger oxen and a weaker oxen to plough. The stronger one is HH and the weaker one is NDC. The longer they go on as individuals the weaker they will become,” Col Panji said. “Kambwili and HH should be the lead horses. We are wasting time, the longer they wait the more destruction. My appeal is HH and Kambwili should come together quickly, give us a platform to work from.”

Col Panji said the earlier they came together, the quicker it will be to set in motion things like the alliance name, programmes as well as put in place strategies on how to protect the vote from being stolen.

“Let’s look at Malawi the MCP (where newly elected President Dr (Lazarus Chakwera) where obviously the bigger party. In Zambia’s case it’s obvious the UPND is the biggest. Let’s have a name for the alliance which they shall run on,” he said, urging the other opposition parties who were not part of the alliance to join in.

Col Panji said despite the merits and demerits of the allegations against Hichilema over privatisation, he believed there was a sinister motive on the part of the PF and its surrogates to disturbilise opposition figures by confining them to the courts.

“Attacks on HH show that they are picking these guys one by one before elections. Kambwili is in court, (ADD leader) Charles Milupi allegedly over CEC. They want Hichilema to start doing the same. So they (PF) are cleverly destructing,” said Col Panji.

PF MULLS ON DEMOTING GIVEN LUBINDA

Justice Minister Given Lubinda seems to have lost favour from President Edgar as plans to drop him from his current portfolio, hot up. It is believed Lungu wants to replace him with Lukasya parliamentary candidate and former Law Association of Zambia President George Chisanga, should the latter win the by election. PF insiders hint that Lungu is deeply unhappy with Lubinda’s alleged bungling of Bill 10.

The fact that he doesn’t hold a law degree has suddenly come into the limelight, an element the President earlier rubbished as unnecessary, against the advice of the Zambian legal fraternity and civil society groups.

During a crucial stage of bill 10 in Parliament, Lubinda sought leave of absence from the National Assembly and travelled abroad, a matter sources say Lungu viewed as gross insubordination. The same sources further say that the President has never really trusted his Justice Minister and suspect him to be a secret Hakainde sympathiser, as well as harbouring his own Presidential ambitions to replace him within the PF.

President Lungu will summon his late predecessor Michael Sata’s narrative that Lubinda is treacherous and dangerous and should be kept away as far as possible from the PF power pool.

On the other hand, lawyer George Chisanga is viewed as a veteran and a top flight lawyer who would bring the controversial and monstrous Bill 10 back on track. The Bill is viewed by many citizens as a last ditch effort by the President to prevent his archrival Hakainde Hichilema from standing as President.

The PF have fronted all kind of methods that have all fallen by the way side to try and prevent Hakainde from appearing on the ballot for the 2021 elections. Gassing of citizens that resulted in hundreds of deaths across the country and privatisation are some of the arsenals that the PF and President Edgar Lungu have tried to way lay the UPND President.

It remains to be seen if George Chisanga an astute lawyer, will rejuvenate the unpopular Bill should he win the hotly contested parliamentary seat in Kasama’s Lukasya constituency, and should Lungu go ahead with his plans to appoint him Justice Minister.

THE ruling Patriotic Front (PF) has charged that the opposition UPND/NDC alliance is a sign of fear and cowardice.

The National Democratic Congress has decided to support its alliance partner, the UPND in the upcoming Lukashya and Mansabombwe parliamentary by-elections.

But Lusaka Province PF secretary Kennedy Kamba says the two opposition parties are behaving like petrified rats.

“They have no solid campaign message in the forthcoming by-elections other than their usual chorus of imaginary corruption allegations which don’t even make sense,” Kamba said.

He further accused them of not having a serious campaign message apart from the desire to occupy State House.

“Zambians want politicians to have a people-driven agenda of development, and not the selfishness and desperation for power that Hakainde Hichilema and his newly found ally Chishimba Kambwili exhibit. The NDC and the UPND are behaving like petrified rats as they have come together ahead of the Lukashya and Mwansabombwe by-elections because they fear the impending defeat,” he said, in a statement. “These two political parties are scared of the ruling Patriotic Front (PF), hence their desperate move to forge a marriage of convenience which will still not even save them. The two opposition political parties know that they stand no chance to win the two by-elections, neither in their individual capacities nor as a united opposition, hence the desperation.”

Kamba asserted that the ruling party would win both seats with ease.

“They have no solid campaign message in the forthcoming by-elections other than their usual chorus of imaginary corruption allegations which don’t even make sense. The PF is in pole position to retain the seats because it practices issue-based politics, we have delivered and still delivering development to all Zambians,” Kamba said. “It is clear in the eyes of well-meaning Zambians that the alliance between the UPND leader Hakainde Hichilema and Chishimba Kambwili of the National Democratic Congress is valueless as it has no basis of any shared progressive political ideology but a mere ‘marriage of convenience’ to try and lure the citizenry when they have nothing to offer but only pushing their personal political interests.”

He accused Kambwili of being a bitter person from the time President Edgar Lungu dropped him from Cabinet.

Kamba accused both Kambwili and Hichilema of exhibiting high levels of hatred for President Lungu.

“… Kambwili has been a bitter man since he was dropped from the government and consequently expelled from the party for being in conflict with both the law and the party constitution. It is sad and very unfortunate that the only thing bringing the two together is their shared hatred for President Lungu and the PF,” said Kamba. “Zambians cannot give power to frustrated and bitter individuals. Zambians are able to see what is happening. They are feeling the heat and that is why they have decided to work together. But even then, they have no capacity to wrestle those two seats from us. Our campaigns are hinged on delivering development across the country…

Their hatred for President Edgar Lungu is too much that even electorates can see that. Their alliance is not going anywhere because the UPND is known for riding on other political parties to try and win elections. But this will never happen. President Lungu is loved by majority Zambians.”

HH Demands Retraction Of Edith Nawakwi’s Remarks And Demands $3m For Defamation Of Character

HH demands US$3m from Nawakwi for defamation

UPND leader Hakainde Hichilema is demanding US$3 million from FDD leader Edith Nawakwi as damages for defamation of character for alleging that he illegally benefitted from the privatisation exercise through shareholding in Sun Hotels International that purchased Mosi O Tunya Intercontinental Hotel in Livingstone.

Nawakwi accused Hichilema, who was then a transactional advisor to the MMD government during the privatisation process, of stealing public assets as he dubiously acquired Sun Hotels International, and a house in Kabulonga belonging to Lima Bank.

Hichilema is however demanding a retraction and an apology from Nawakwi to be issued with equal prominence in the manner the defamatory statements were issued.

According to a demand letter addressed to Nawakwi by Hichilema’s lawyers Malambo and company, the latter wants the former to put it in writing that she will not issue defamatory statements against him.

Nawakwi has since been given a one day ultimatum in which to address Hichilema’s demands failure to which a law suit would be commenced against her.

Nawakwi on August 27, 2020 on Hot FM radio breakfast show dubbed the hot seat and Kwithu FM radio station on a programme called “The program” and other media platforms with intent to bring Hichilema into hatred, contempt and ridicule made false, malicious and defamatory statements against him alleging that he is a thief who does not respect the rule of law or deserve to hold public office as president of Zambia, which he aspires for.

“Consequently, our client has suffered irreparable damage to his reputation, severe embarrassment, harassment, hatred and ridicule in respect of which our client has instructed us to seek reparation from you,” reads the demand letter.

“Without limiting the generality of the foregoing and whilst our client’s right to make any or any further claim against you, in relation to your conduct towards him remains fully reserved, our client’s instructions are that the defamatory statements were to the effect that: our client was at all time a criminal, involved himself in theft and corruption by alienating a house located on Serval Road in Kabulonga (which you purport belonged to Lima Bank) to himself as liquidator of that institution; our client involved himself in undisclosed illegality regarding the receivership of RAMCOZ and that he abused the privatisation process with regard to the transaction of the sale of assets of Mosi O Tunya Intercontinental hotel in Livingstone and related assets which you allege that our client ‘sold to himself’.”

Hichilema’s lawyers say the alleged defamatory statements by Nawakwi lacked truth as they are malicious and aimed at damaging the former’s hard earned reputation as a businessman, a person worthy of holding office as a president of Zambia and as a law abiding and God fearing citizen of the country any the word at large.

They said apart from being a violation of his (Hichilema) rights, the defamatory statements were made without due regard to the factual position in relation to the privatisation process and were in contumelious disregard of the law.

Hichilema’s lawyers say the latter had no criminal record neither has he engaged himself in any criminal activity.

They said that Nawakwi will be put to strict proof when the matter proceeds to court.

The advocates said that when the Lima Bank liquidation commenced in 1997, the property in issue was acquired by their client in 1995 two years prior to the commencement of the liquidation process.

“You are aware that records will show that our client was never involved in the privatization of RAMCOZ which was sold to the Binani Group of India in 1997 for a consideration of US$35,000,000. Subsequently upon failing to meet its financial obligations to ZANACO, RAMCOZ was placed under receivership in 2000 and the receiver manager was Mr Christopher Mulenga and not our client,” they stated.

“The receivership process was undertaken in accordance with the law and reports rendered to the appropriate stakeholders. Our client is not aware of any criminal complaint having been made against the receiver manager Mr Christopher Mulenga in relation to the receivership.”

Hichilema’s lawyers said with regards to the sale of the assets of Mosi O Tunya Intercontinental Hotel in so far as the former was involved, he did so in conformity with the law.

They said Zambia Privatization Agency was fully informed of all the stages of the transaction for the sale and purchase of the privatisation assets and ZPA was aware on all material particulars of potential buyers and were in public domain.

“The sale of Mosi O Tunya Intercontinental Hotel and related assets to the successful bidder has greatly benefited the people of Zambia as it is one of the few success stories of the privatization exercise, contrary to the innuendo created by you (Nawakwi) in the defamatory statements,” the lawyers said.

They said the allegations despite of their malicious venom were baseless in law and fact.

The lawyers say the defamatory statements had caused irreparable damage to Hichilema’s reputation as Nawakwi made the said allegations from an informed position as former minister of finance worthy of being believed on the score.

They said the words were published to the global audience of millions of people and have caused Hichilema mental distress, anguish and torture.

“A stain on our client’s candidature for president of Zambia in so far as the defamatory statements cast aspersions against our client to the effect that he is not a fit and proper person to hold the highest public office in the land,” the lawyers said.

They added that Hichilema was being harassed by overzealous state operatives that have declared their intentions to maliciously prosecute him based on Nawakwi’s allegations as evidenced by the press statement recently issued by chief government spokesperson Dora Siliya.

“Our client has incurred and continues to incur great expenses both locally and internationally in order to mitigate the harm that you have caused to him. Our client places the cost of the foregoing which includes legal costs incurred thus far at the conservative sum of US$3,000,000 which our client hereby demands from you. Our client is amenable to receiving reasonable proposals as to how you intend to settle the said sum,” the letter read further.

“Our client further demands, in view of the pressing nature of this matter, that you address his demands within 24 hours not later than September 3, 2020 failure to which our client will be unconstrained to take out proceedings before an appropriate forum so as to protect his interests.”

OPEN LETTER TO THE ZAMBIAN ARMED FORCES

To the Zambian Armed Forces,

I write to remind you of your solemn duty to the people and the Republic of Zambia as we move closer to the year of elections.

As the armed forces, you have legitimate and constitutional roles, clearly spelt out, that you are supposed to carry out effectively, and with accountability, within a framework of democratic civilian control, rule of law and respect for human rights.

Next year, this country is going to the polls. This is a national process pivotal to the quality of our country’s governance, one that can either greatly advance or set back our country’s long-term democratic development.

As forces mandated to ensure internal and external peace, it is your duty to ensure that no internal or external force, either before or during the elections, is allowed to destabilise the most fundamental principle defining credible elections: that of having the free expression of the will of the people.

It is possible for some elements in society to employ certain electoral malpractices that could undermine our electoral integrity for selfish reasons and to destabilise national security.

As the armed forces, you have professional skills, equipment, training and the management capacity to discern such elements hell-bent to destabilise internal peace by undermining electoral transparency, inclusivity, and accountability.

I do not need to remind you that it is your mission to maintain peace without becoming a danger to the electorate or to the state.

In the past, as the armed forces, you played a broader role, not only protecting our national territory from invasion, but also potentially conducting offensive warfare in the context of military alliances. However, as you are aware, in contemporary international affairs offensive warfare has become increasingly rare, and acts of aggression are illegal under international law.

As a result of these trends, as well as of changes in the relationship between the armed forces and society, you, the armed forces, are now supposed to focus on national defence.

It is your mission as the armed forces to provide internal security and stability.

Before and during elections anything is possible. We saw, not long ago, how the ruling party gassed and killed people as a strategy to destabilise the country to make it easier for them to hold onto their power.

What will stop the same elements from doing so again before or during the elections?

As citizens, we expect the armed forces to respond professionally to pre-electoral and electoral machinations that have the potential to trigger violent internal threats to the state or public, as we have witnessed in other countries including Malawi.

Fear of losing power could persuade politicians to engage in practices that could jeopardise internal security.

As a professional military that is aware of the changing role of the armed forces in society today, you are expected to supplement this primarily civilian operation decisively to allow for free and fair elections.

It goes without saying that it is your mission to assist in law-enforcement before and during elections by enhancing public order operations, border control, and intelligence gathering as a way of promoting civil defence.

As the armed forces, you should be able to respond conclusively to national emergencies threatening internal security.

Never, under your watch, should some elements in society cause internal security threats, such as violence against innocent citizens or political competitors, or in acts of organised crime against the state.

Pre-election time and during the elections are the moments when you can prove your new roles, responsibilities, and relevance to the state by extending your military competencies to maintain internal peace.

As the armed forces you should always be adequately prepared to uphold internal peace.

Keep an eye on the culture of the abuse of state power, including the militarisation of political cadres who have hijacked not only your military fatigues but your titles and the application of military force on citizens.

As professional armed forces you have to be ready at all times for this internal national defence mission.

Praise for the armed forces who stand ready to help in keeping peace in our land.

PF DEAD SERIOUS ON ARRESTING HH

It’s no longer a matter of ‘perhaps’ but rather when the PF will arrest UPND President Hakainde Hichilema for a bizarre allegation of corruption in the privitization of quasi government companies a quarter of a century ago. President Edgar Lungu is pushing hard for the prosecution of the opposition leader by hook or by crook, in what State House and the governing party (PF) insiders say is a well funded project, to ensure HH is precluded from the election process in the 2021 general election.

Remarkably, legal experts believe the case can never stand credible legal inquisition and that it would not be more worthy than the court paper it would be written on me.

“Once again, the desperation of the PF to fix Hakainde Hichilema has brought about the most laughable and preposterous privatisation allegations which have no ‘legal legs’ to stand on. The statement of the Minister of Information is equally riddled with errors of fact”, mused constitutional lawyer John Sangwa State Counsel, on his tweeter account.

But not so for President Edgar Lungu who is determined to stay in power after 2021, and who sees Hichilema as the only obstacle that must be cleared by whatever means necessary, including, according to some security sources, death.

Impeccable sources reveal the President will pressure the Chief Justice to allocate the case to a PF ‘sympathetic’ and surrogate Judge who it is believed will be paid huge amounts of money to conduct a shoddy and phoney court process that he will drag for months to keep HH locked onto the undertaking.

“This is not about privatisation. This is not about alleged criminality. This is not about corruption. They are simply preparing your psyche using these actions as the pretext. The truth is that what they want is access to my physical body so that they can eliminate me. Their plan is to arrest and then kill me. But do I have to die for anyone to be in power?”, wrote Hichilema on his Facebook page.

The past one week has seen the PF and their agents bombard mainstream and social media with screaming headlines of HH’s alleged criminality in the privatisation process of over 25 years ago. They unanimously demand for his arrest and prosecution. They claim Hichilema is no different from PF Cabinet Ministers who have been prosecuted for corruption in the recent past and subsequently handed suspicions express acquittals by the courts of law, and that HH would also be cleared if he were found innocent. The PF have whipped people’s emotions for the final onslaught but public opinion appears to be against them.

Social media has been inundated with the public objections of Hichilema’s accusations by the PF with signals of unrest registered in various ways. Unlike the Malawian revolution where the people had an extraordinary romantic relationship with the armed forces, the Zambian situation will only rely on the ballot in a very hostile environment that promises sparks and electoral disputes.

President Edgar Lungu has not been left behind in preparing the ground for a possible crackdown on the opposition. He told a carefully vetted team of Adventist pastors that paid a ‘courtesy’ call on him at State House, ‘to pray for those that might cause trouble when they lose elections in 2021’. The President was obviously talking about the opposition, but ostensibly and ironically perhaps, a prophecy about himself.

Hunt for Successor 23: The Rise and Fall of Edith Nawakwi

Although unsuccessful, the Mwamba Luchembe coup rattled the nerves of the indomitable KK and gave fresh impetus to advocates of multi-party politics, among them, the virtually unknown 32 year-old Edith Nawakwi.

Nawakwi, is a self-made leader who by sheer boorishness and discourtesy, has proved that there is a kernel of leadership for opportunists and all.

Nawakwi’s swift rise to political stardom was paved by KK on December 5, 1986. It is on this day that he devalued the Zambian Kwacha and increased the price of mealie-meal by 120 percent to meet the demands of the structural adjustment program. Many economic analysts believe it was perhaps KK’s major step to his downfall.

No one had heard of Nawakwi. She was not part of the political and economic discourse. Crudely put, she was insignificant—an absolute nonentity.

It was in 1990 that she fell from the skies. Like all of us, she knew that food riots were taking a heavy toll on KK; that he was losing his grip. She was further encouraged when UNIP back-benchers as well as people from the business community supported ZCTU’s idea of multiparty politics.

An economist, she knew the Harvard boys were winning the war against KK and the Soviet Union. Their strategy led to perestroika (restructuring) or the wind of change in the Soviet Union which saw for the first time previously dreaded and impervious Communist leaders being questioned and held accountable. The wind spread fast. In 1990, it was blowing in many parts of Africa, including Zambia.

In Zambia, the incessant food riots forced KK to announce a referendum on multi-party democracy in May 1990. Nawakwi saw an opportunity and joined Aka, Chitala and others. On July 20, 1990, she became one of the founders of a social movement called Movement for Multiparty Democracy (MMD) whose main objective was to campaign for a “yes” vote” in the referendum.

Aka was royalty while Chitala was simply a tenacious revolutionist with a bad attitude. Nawakwi, the daughter of the chief of Nawaitwika village rallied behind Chitala and became a courageous bull-whacker.
*For the first time we saw a young woman show total disrespect for KK. In a manner unprecedented she poured scorn, disdain, derision, ridicule, disparagement, sneer, and mockery at Gilgamesh*. We applauded and described her as a learned, intelligent, and fearless amazon. Anything to disorient KK was welcome.

Nawakwi’s tough-talk was her defensive mechanism. She knew she was playing with fire.

Nawakwi was saved by Luchembe. After the coup attempt KK was no longer the intimidating leader we had known for 27 years. He seemed overwhelmed by what was going on around him. Facing the worst crisis of his presidency, he, in November 1990, balked and repealed Article 4 of the constitution to allow for multiparty politics to the delight of Nawakwi and her cohorts.

As a result, the MMD was transformed into a political party in March 1991, and in the November elections FTJ was voted president of Zambia. Nawakwi became Member of Parliament in a historic life-changing election, and in the county’s first cabinet, she was appointed Deputy Minister of Energy.

Riding high on cloud nine, Nawakwi continued to behave like a man. A spinster, she dressed in minis and flirtatiously challenged men on the floor (at parliament house) where she would change from irresistible to rude. In a typical masculine style she snatched a married man and used her power and customary law to betroth him.

Nawakwi had no time for women movements and feminist garblers. If anything she chose them as her target and referred to them as “those women.” While men were intrigued, women, the most critical demographic in Zambian elections, distanced themselves from her. It is here that her cocky ego stoked her own political fire and her downfall was a matter of time.

There was no celebration from women when Nawakwi became a fully-fledged cabinet minister of her ministry and later Minister of Agriculture, Food & Fisheries. She was later implicated in the Carlington Maize scandal in which Zambia lost more than $4,000,000 for maize that was never delivered. She continues to deny she did anything wrong.

When Ronald Penza was fired for corruption and later assassinated, Nawakwi succeeded him as Minister of Finance, the first Zambian woman to hold the post of the most “intellectual” of the ministries. Again there was no ululation or accolades from the Zambian women because she was still behaving like a misogynist.

It is often said that when a Zambian president wants to “finish” a minister, he shunts him or her to the Ministry of Finance that’s where the electric chair is kept. The daring energy economist Edith Nawakwi sat on it and some of us applauded her. But Nawakwi was taking the chair at a time when FTJ had seen the personal benefits of befriending IMF and was holding a yard sale of our national assets, including the mines.

As minister, Nawakwi presided over the transfer of millions of dollars from her ministry to the Zamtrop account at the Zambia National Commercial Bank in London. According to the FTJ London trial documents $52,000,000 raised from the FTJ auction was banked between 1995 and 2001. The money has not been recovered to date.

When Nawakwi got into battles with IMF and the WB, the Harvard boys found her rhetoric green and jaundiced and felt she was not ripe enough in pose and negotiation. They made this clear to FTJ. It is believed that FTJ demoted Nawakwi following a poor performance at the annual consultative group meeting of Zambia’s principal donors. When she was moved to the Ministry of Labor and Social Security, many women quietly ululated.

In 2001, Nawakwi hit back. She refused to support FTJ’s third term bid. She and 19 others were fired. They formed the Forum for Democracy and Development in which she emerged as vice president and MP for Munali. In 2005, men of FDD chose to make her their leader and in 2011 she filed her papers to become the first female president of Zambia.

The women of Zambia and thousands of her male critics had been dying to see Nawakwi stripped of power and in the desperate position she finds herself today. When the September elections were held they shunned her. The result was a pantry 6,833 votes raked from her constituency and from members of her party, their relatives and a few reluctant friends.

It was clear the likes of Chifumu Banda, and Luciano Mbewe had made a bad choice. Edith Nawakwi has fallen into the political abyss, never to recover. Between 1999 and 2011 she should have crossed over from men to women and present herself as their hope in the male-dominated social and political strata. She refused to listen. Up to this day, she hasn’t the strength of character or humility to request help from Zambian women who represent 60 percent of the electorate and many men who find her controlling and self-centered.

The downfall of Edith Nawakwi is purely her own making. Her foolish bravado is responsible for her own routing. No doubt she is smart, but her intellect and intellectual stamina do not go beyond her ego. She lacks the ability to know when she is wrong and the humility to accept and apologize.

It is therefore safe to conclude that as at now, Nawakwi has obliterated her political soul. The depth required of a president is missing. I wish her success in augmenting the FDD cause, but I think she should give other distinguished men and women in her party a chance to challenge the incumbent. FDD should know that Edith Nawakwi has gone to Rio.

Privatisation a brainchild of MMD of the Nawakwis

Ever since Hakainde Hichilema (HH) took the plunge into the murky waters of Zambian politics, he has had an albatross tied to his neck, threatening to drown him completely save for his boldness, courage and determination.

Perhaps this is the reason why he stands out as a successful businessman and accomplished farmer amongst his peers. You gotta admire the man!

Going by the sentiments of many an electorate ‘pa ground’ disenchanted with the current state of affairs, the gates to plot 1 Independence Avenue seem to be wide open for the opposition. Shushushus (intelligence officers), tell the President the truth…or maybe you’ve already done so, hence the sudden desperation on the part of those in leadership.

Anyway, of the whole pack of individuals jostling to have a feel of the inside of State House, including Edith Nawakwi herself, HH stands a better chance of dislodging Edgar Lungu from power. But instead of marketing herself to the electorate, Nawakwi elected to go to sleep. But now that the sweet aroma of State House is around the corner, Nawakwi suddenly staggers out of slumber and sleepwalks into a popular radio station and goes to town smearing the character of the UPND leader.

In the recent past, politicians of different hues and shades have taken turns to assassinate and impugn the character of HH – preaching to the gullible ones that he stole from government… nay, sold the mines!

Nawakwi should be the last person to apportion the blame on HH for the botched privatisation exercise. Privatisation was a brainchild of MMD government where Nawakwi served as a senior cabinet minister – ascending to the portfolio of minister of finance at one point. They are the ones that stripped our nation of her prized possessions. As Francis Kaunda aptly puts it; they gave away ‘the family silver’ due to selfishness and greed on their part. A great man once said, “If you want to hide something from black people, put it in a book.”

I have just concluded reading ‘A Venture in Africa’ by Andrew Sardanis of the famed Chaminuka Lodge. The book candidly offers a rare glimpse of the shenanigans that panned out during the privatisation programme. The name of HH doesn’t popup anywhere. You can even go to Chaminuka and ask Sardanis if you want, HH had a very limited role to play in privatisation. And now the likes of Nawakwi want to take advantage of the fact that many Zambians have no time reading books and mislead the people for political expediency. Don’t you have any sense of guilt or shame, madam?

On page 228 of his book under the chapter “Ten Wasted Years”, Sardanis reveals that one of late president Frederick Chiluba’s tactics was to bypass the Zambia Privatisation Agency by appointing, in March 1997, a new team named ‘the GRZ/ZCCM Privatisation Negotiating Team (PNP); under the chairmanship of Francis Kaunda (the erstwhile ZCCM chairman whom he had unceremoniously dismissed in 1991, before he even took the oath of office). Was HH a member of PNP? Nawakwi, answer this question!

The book further goes on to disclose that by the end of 1997, Luanshya/Baluba mine was put under the hammer. Now this is where the plot thickens.
Bids for Luanshya/Baluba mine had been received and evaluated, and the Zambia Privatisation Agency had started detailed negotiations with First Quantum before the so called PNP came on the scene. It’s clear even to a fool that PNP had ulterior motives. It demanded revised bids, as a result of which Luanshya was dubiously awarded to the Roan Antelope Mining Corporation of Zambia (RAMCOZ), a new Zambian company owned by an Indian metal trader, Gokul Binani.

Fellow citizens, you ought to read and read and read to grasp the depth of crookedness of these former MMD leaders. Someone had somehow tipped Binani about the contents of the favourite bidders, First Quantum. Binani simply made adjustments to the First Quantum’s winning bid – this is how they presented it (with First Quantum’s bid in brackets): cash US$35 ($34) million, new equity investment US$21.7 (US$20) million, commitment for new investment US$69 (US$70.4) million, contingent investment US$103 (US$26.3) million, ZCCM participation 15percent (17.5%).

This proved to be a ‘neck to neck’ outcome, except for the very nebulous US$103 million ‘contingent investment’ that Binani stuck to the tail of his offer. First Quantum was furious and threatened to sue the Zambian government. This was to be the genesis of woes for Luanshya mine.

The liquid problems at Luanshya surfaced soon after the RAMCOZ take over, amid rumours that the copper proceeds were not being received regularly. But the government bent over backwards to keep it going, ordering Zanaco to grant additional facilities, ignoring huge arrears. At one stage the government even contemplated diverting a World Bank facility intended for mineworkers’ retrenchment to RAMCOZ.

In the end Zanaco decided that enough was enough and appointed a receiver, which in this case happened to be Grant Thornton. Unfortunately, it was too late for this intervention. RAMCOZ was already looted to the core and what was left of it was a mere shell that no serious investor worth their salt would be interested in.
