“I’ve trained for forty years as a soldier and as a commander,” Hertling said on MS Now. “And when you’re an officer in the United States Army, you’re loyal to a couple of things. You’re primarily loyal to the Constitution. You are also loyal to your superiors if they give, as you said, lawful orders.”
If Trump proceeds with his threat to bomb civilian infrastructure like power plants and bridges or follows through on his pronouncement that “a whole civilization will die tonight,” they would constitute the most unlawful orders imaginable. If, as he seems to be implying, Trump launches a nuclear strike on Iran, it would be the greatest crime in human history. The entire U.S. military would be honor-bound to reject the orders.
“When they start giving unlawful orders, you find a way to push back on them and to make sure they adjust their approach,” said Hertling. “But you also are loyal to the soldiers that are under your command. So those three loyalties sometimes are conflicting.”
“So I’m sure there’s a lot of military commanders right now, a lot of senior officers who are saying to themselves, ‘I can’t obey an unlawful order,'” said Hertling. “I can’t do things that I know are absolutely wrong.”
It’s worth noting that Hertling is no minor figure. He previously served as the Commanding General of the United States Army Europe and the Seventh Army. His distinguished career speaks for itself and lends a profound gravity to his assessments.
“But they also feel like they have to provide support for their soldiers who don’t just get to quit,” he continued. “They have to stay in the military and potentially see an uprising in all of these things. So the senior military officials are in a real quandary one this one because they know they can’t do some of the things that the president is asking them to do.”
“They have a Secretary of Defense who has continually said lethality is better than legality or words to that effect,” said Hertling. “So it’s really causing some dynamics within those who are thinking soldiers, saying ‘How do I continue to serve my Constitution and live by the rules that are in law and still conduct these kinds of actions which are horribly immoral and illegal.”

Woman Killed While Preparing for Husband’s Funeral in Eastern Cape
A devastating tragedy has struck a grieving family in South Africa’s Eastern Cape, where a 46-year-old woman was brutally murdered while preparing for her husband’s funeral.
The deceased, identified as Thabisa Mnqwazana, was allegedly shot and killed by three armed robbers in Egcuwe village. According to reports, the suspects forced their way into the family home, where they tied up occupants before taking Ms. Mnqwazana into a separate room.
It is alleged that the assailants stole money and bank cards before fatally shooting her. The suspects fled the scene and, as of now, no arrests have been made.
This heartbreaking incident has deepened the pain of a family that was already mourning the loss of a loved one, leaving them with the unimaginable burden of preparing yet another burial.

The Patriotic Front has appealed the Judgement delivered by Lusaka high court Judge, Justice Conceptor Chinyanwa Zulu which ruled that Miles Sampa’s Extra-Ordinary Conference held on 24th October 2023, was justified and valid as the Patriotic Front Party allegedly had no Central Committee at the time of the Conference.
By this Judgement, the Party was given to the defendants: Miles Sampa, Morgan Ng’ona and Robert Chabinga.
But Patriotic Front Secretary General, Raphael Nakacinda, has filed a Notice of Appeal and Affidavits objecting strongly to the Judgement.
Nakacinda has sworn in the affidavit that the Learned Trial Judge erred in law and in facts in making a false finding finding that the Central Committee of the Patriotic Front Party had ceased to exist at the material time, and that the members present did not constitute a Central Committe, thereby disregarding the Party Constitution relating to continuity of office, internal control mechanisms, and the fillingof vacancies.
Nakacinda also sworn that the Judge failed to consider the totality of the evidence on record supported the Appellant’s case, including the material admission by Miles Sampa’s own admissions, particularly the admission that the meeting of 24th October 2023 did not constitute a General Conference.
He has stated that if the Judgement was allowed to reign, it would cause a miscarriage of Justice.

“TAKE NOTICE that the APPELLANT being dissatisfied with the decision of the Honourable Justice C. Chinyama Zulu delivered in the High Court of Zambia, on the 27th day of March,2026, Under Cause No.2025/HP/0577 intends to appeal to the Court of Appeal against the Judgment of the Court.”
The Learned Trial Judge in the court below erred in law and in fact in holding that the Appellant failed to prove his claims, when the totality of the evidence on record supported the Appellant’s case, including the material admission by the Respondents, particularly the admission by the 1st Respondent that the meeting of 24th October 2023 did not constitute a General Conference.
2. The Learned Trial Judge erred in law and in facts in finding that the Central Committee of the Patriotic Front Party had ceased to exist at the material time, and that the members present did not constitute a Central Committe, thereby disregarding the Party Constitution relating to continuity of office, internal control mechanisms, and the filling of vacancies.
3. The Learned Trial Judge erred in law and in facts by misapplying and failing to apply the relevant provisions of the Patriotic Front Party Constitution governing the convening of an Extraordinary General Conference, including by:
(a) Restricting her determination to Regulation 67 to the exclusion of other applicable provisions;
(b) Erroneously holding_ that the Constitution did not provide for circumstances where both the President and Secretary General resign; and
(c) Failing to find that the 1st Respondent lacked locus standi and authority to unilaterally convene an Extraordinary General Conference.
4. The Learned Trial Judge erred in law and in fact in finding that an Extraordinary General Conference was held on 24th October 2023 and that it was properly constituted, in the absence of credible evidence, including proof of delegates or attendance registers, misplacing the burden of proof upon the Plaintiffs (Appellant) despite admissions by the 1st Respondent and improperly restricting the issues for determination solely to whether the Conference was duly convened, thereby occasioning a miscarriage of justice

This morning, the Patriotic Front appealed the decision of the Judgment of the Lusaka High Court Judge, Justice Conceptor Chinyanwa Zulu in the case of Brian Mundubile, Raphael Nakacinda Vs Miles Sampa, Morgan Ngona and Robert Chabinga that recognised the defendants as holders of the party of the case; Matero MP, Miles Sampa, Mafinga MP and Morgan Ngona.
The purpose of the appeal is to preserve the wishes of the late President, Dr. Edgar Chagwa Lungu who came back to active politics to restore the Patriotic Front, and to protect democracy.
We have noted the details and pronouncements made by Hon. Miles Sampa inclusing his purported decision to dissolve the Central Committee and provincial leadership.
He has done this before and this latest antics falls in this line which we ignored and should be treated as such and ignored.
His remarks should be regarded as a reconciled person who has chosen to abandon the process and has gone to his original default position where he participated in an aggressive the plot to steal, kill and destroy the Patriotic Front.
We have been aware for many days of an evil plot to rob the victory of Hon. Makebi Zulu as leader of the Party.
We are aware that this plot is a highly funded process designed to factionalise and disintegrate the Patriotic Front as the country heads to the 2026 General Elections
Our action to appeal against the Judgment that recognised Miles Sampa, Robert Chabinga and Morgan as owners of the Patriotic Front is rejected and the decsion to appeal against this case is fully justified and worth pursuing to honour the wishes and memories of the President Edgar Lungu and to recognises the sacrifices that have been made by ordinary members of the PF since 2021.
It must be reiterated that the leader of the Party founded and led by President Michael Chilufya Sata, succeeded by Edgar Lungu and was shepherded by Acting President Given Lubinda in the last five years, is Hon. Makebi Zulu. He was popularly elected by an election organised by the Party.
We wish Hon Sampa well in his endeavours as we continue to fight for the PF and for the Country.

This Memorandum of Political Understanding (“MOU”) is made this ________ day of March 2026.
BETWEEN MILES BWALYA SAMPA, of Lusaka, Republic of Zambia (hereinafter referred to as “MBS”) AND MAKEBI ZULU, of Lusaka, Republic of Zambia (hereinafter referred to as “MZ”). ECL refer to the late form Republican President Edgar Chagwa Lungu. ECZ refers to the Electoral Commision of Zambia.
MBS and MZ are hereinafter collectively referred to as “the Parties”.
1. BACKGROUND1.1 The Parties are senior political actors within the Patriotic Front Party (hereinafter referred to as “The Party”) & Pamodzi Alliance )”Alliance”
1.2 The Parties acknowledge ongoing internal processes relating to party leadership and the forthcoming Party PF leadership Judgement on the 27th March 2027 and consequent PF extra ordinary conference thereafter but before filling in of general elections Presidential and MP candidates.
1.3 The Parties further acknowledge the strategic importance of unity, structured transition, resource mobilization, and coordinated leadership in preparation for the August 2026 General Election.
1.4 This MOU records the mutual political understanding reached between the Parties in furtherance of those objectives.
2. NATURE AND STATUS OF THIS MOU 2.1 This MOU reflects political intentions and good faith commitments.
2.2 Except for Clauses relating to confidentiality and documented expense reimbursement, this MOU does not constitute a legally enforceable commercial contract.
2.3 All undertakings herein are expressly subject to: 2.3.1 The Constitution of the Republic of Zambia;
2.3.2 The Electoral Process Act and applicable electoral regulations;
2.3.3 The Party Constitution and lawful internal processes;
2.3.4 Any binding court orders. The 3. LEADERSHIP TRANSITION FRAMEWORK 3.1 In the event that pending court proceedings concerning party leadership are resolved in favour of MBS, MBS expresses willingness, in the broader interest of party unity and electoral viability, to facilitate an orderly, legal and dignified leadership transition to MZ.
3.2 Such transition shall be conducted in accordance with: 3.2.1 The Party Constitution; 3.2.2 Applicable legal requirements; 3.2.3 Public order considerations; 3.2.4 The strategic interests of the Party.
3.3 The Parties affirm that unity and electoral competitiveness remain paramount objectives.
3.4 In the event that the ruling is against MBS, he undertakes to MZ that he will not Apeal the matters but expeditiously facilitate the process of legalizing MZ as the PF & Alliance Presidential candidate for the August 2026 general elections.
3.5 MZ undertakes to meet all costs and all legal fees dues of the March 27th, 2026 High Court Judgement on the PF leadership regardless of which side its falls that is towards MBS or the late ECL as President of the party.
4. CENTRAL COMMITTEE CONTINUITY 4.1 The Parties acknowledge prior political understandings with ECL concerning composition of the Central Committee members to reflect and include MBS loyalists. MZ will pick 55% and MBS 45% in the reconstituted Central Committee.
4.2 The Parties agree to have a revised list of office bearers at the Registrar of Societies to reflect 55% as recommended by MZ and 45% by MBS.
4.3 MZ undertakes to immediately maintain and make MBS as the PF and Alliance Secretary General.
4.4 MZ undertakes to make MBS either his Runnigmate into the elections or Minister of Finance once MZ wins the August general elections and becomes the Republican President.
4.5 MZ undertakes that once wins as Republican President, he will Nominate 2 names as MPs to be recommended by MBS.
4.5 MZ undertakes that once wins as Republican President, he will appoint 20% of Ministers as recommended by MBS & in advance undertaking to make Hon John Kufuna as Defense Minister and Hazel Kapata as Minister of Information (or Foregn Affairs). 4.6 MZ agrees and undertakes to receive from MBS 45% of names and include all in the final party List to be submitted to the ECZ for proportional representation of the Youths, Women and Diabled.
5. PRESIDENTIAL CAMPAIGN STRUCTURE 5.1 Once MZ is ratified through all due processes as the Party and Alliance Presidential candidate for the August 2026 General Election:
(a) MBS shall assume the role of Campaign Manager or Co-Campaign Manager.
(b) MBS shall participate at the highest strategic level of campaign decision-making.
5.2 A separate Campaign Governance Framework shall define: • Operational authority; • Reporting lines; • Financial oversight; • Compliance safeguards.
6. RUNNING MATE CONSULTATION If as stated in item 4.4 of this document that MBS is not the Runningmate, MZ undertakes to engage MBS in meaningful and substantive consultation regarding the selection of a Vice Presidential running mate so as to mutually pick on one that would ensure MZ, PF & the Alliance win majority votes at all levels of the August 2026 general election from the office President, MP, Mayor, Council Chairpersons to Councillor.
7. RESOURCE MOBILIZATION MZ undertakes to mobilize adequate financial and logistical resources necessary to: • Secure a Win at the Party & Alliance intra party elections or ratifications. • Sustain Party & Secreatariat operations; • Conduct a competitive Presidential campaign by mobilizing Resources for land and air transport vessels, branded Tshirts, Chitenge, Hoods, Caps etc to cover all the 10 Provinces of Zambia
8. FUTURE EXECUTIVE CONSIDERATIONI 8.1 In the event when MZ is elected President of the Republic of Zambia, he expresses his political intention to appointment MBS for appointment to a senior executive portfolio of strategic national importance namely the Ministry responsible for Finance which is in line to competencies of MBS.
8.2 The Parties acknowledge that: • Ministerial appointments are governed exclusively by constitutional processes; • Any such appointment remains subject to parliamentary ratification where applicable; • This clause does not create a legally enforceable entitlement. 9. LITIGATION COSTS9.1 In recognition of the strategic importance of pending legal proceedings concerning party leadership legitimacy, MZ undertakes to reimburse reasonable and documented legal costs incurred by MBS in that process, in the event of a successful outcome. 9.2 Reimbursement shall be limited to verified and properly invoiced legal expenses. 9.3 This clause may be implemented through a separate private funding instrument if required.
10. CONFIDENTIALITY 10.1 This MOU is strictly confidential.
10.2 Neither Party shall disclose its existence or contents without the prior written consent of the other.
10.3 Unauthorized disclosure shall constitute a material breach of political trust.
11. TERMINATION 11.1 MOU shall lapse automatically upon: • Failure of MZ to secure nomination & presidency for the PF & or Alliance. • Mutual written termination • Material breach by either Party.
12. GOOD FAITH 12.1 The Parties undertake to implement this MOU in utmost good faith and in pursuit of National, Public and Party interests.
12.2 This MOU is entered voluntarily and without coercion.

BRIAN MUNDUBILE ‘ALMOST ABDUCTED’ BY PLAIN CLOTHED OFFICERS DURING EASTER WEEKEND – GEORGE CHISANGA.

The Tonse Alliance has called upon the government to allow its president Hon Brian Mundubile to freely engage citizens ahead of the August 13, 2026 general elections.
Speaking to the media in Lusaka today, BM8 Presidential Spokesperson Hon Geroge Chisanga said any attempt to arrest Hon Mundubile outside due process is highly undesirable and may just lead to unnecessary unbridled chaos.
His remarks comes after a recent attempt to arrest Hon Mundubile in an alleged abduction style operation by plain clothed officers during the Easter weekend.
Hon Chisanga said any charges against Mr Mundubile must be pursued in strict accordance with the law.
He added that Hon Mundubile has since instructed his lawyers to formally write to law enforcement agencies, outlining his grievances and demanding that any future action be conducted fully within the law.
“Towards the Easter weekend, the Tonse had lined up a number of activities to engage stakeholders in Lusaka, Eastern and Copperbelt. The team received information of a plot to have president Mundubile arrested on site, in an abduction style based on yet another complaint filed against him by a UPND official. Even in the light of this precautionary measure, President Mundubile was almost abducted closer to home by plain clothed officers,” he said.
Hon Chisanga said the Tonse Alliance and FDD remain is therefore disturbed by the continued mistreatment of Hon Mundubile.
“The known genesis of this was when Minister of Information and Media Hon Mweetwa who expressed his displeasure at the lack of action by the Law Enforcement Agencies against Hon Mundubile even after Hon Kambwili had made incriminating statement against Hon Mundubile. Immediately after Mweetwa’s screams which included instructions to the police to take action against Hon Mundubile, he was prevented from traveling out of the country by authorities.
He was subjected to interrogations that boarder on unsubstantiated claims and allegations of terrorism and treason. In these interrogation, various names of important people who have had no business or dealings with Hon Mundubile were suggested to him as his collaborators. He was then deposited in custody in a manner that violated the law in a manner that violated bothe the law and due process.
The police then released him on dubious charges of Aiding and abetting in the Commission of the crime. Within the course of the week, after it was established that Hon Mundubile would be travelling around the country, to Canvas mobilisation among his supporters, he was again summoned to ACC to answer to matters that had already been previously investigated and cleared. When the LEA saw the growing concerns blackout the treatment of Hon Mundubilie on the number of people who went to show solidarity, they released him without charge,” he said.
TONSE Alliance President Brian Mundubile has dismissed calls for him to join the ruling United Party for National Development (UPND), describing the party as a failed administration that has not delivered meaningful change to Zambians. His remarks come in response to UPND Lusaka Province Chairperson Obvious Mwaliteta, who suggested that Mundubile should align himself with the ruling party if he hopes to gain power.
Mundubile, who is also Patriotic Front (PF) Member of Parliament for Mporokoso, said he has no intentions of working with the UPND, arguing that the party’s performance since assuming office in 2021 has been disappointing. He stated that the Tonse Alliance offers a distinct vision that prioritizes the needs of ordinary citizens over what he termed as unfulfilled promises by the current administration.
He emphasized that many Zambians are facing serious economic challenges, citing rising poverty levels, unemployment, and the high cost of living as clear indicators of government failure. According to Mundubile, the UPND has lost touch with the realities on the ground, leaving citizens to struggle without adequate support or opportunities.
Positioning himself ahead of the 2026 general elections, Mundubile declared his readiness to lead the opposition and provide an alternative leadership for the country. He urged citizens to remain engaged in national affairs and to hold leaders accountable, stressing that the upcoming elections will be crucial in determining Zambia’s future direction.
Mundubile further criticized the government for failing to deliver on key promises, particularly in sectors such as infrastructure, healthcare, and job creation. He said that despite commitments made during the campaign period, many communities, especially in rural areas, remain underdeveloped and trapped in poverty.
In outlining his vision, he pledged to implement reforms in education and healthcare aimed at improving access and quality of services for all Zambians. He said his leadership would focus on putting Zambia first and ensuring that citizens benefit from national resources and development programs.
Meanwhile, Mundubile took a swipe at Mwaliteta, advising him to focus on self-improvement rather than making statements he described as misleading. He reiterated his call for Zambians to reject the UPND in the next elections, insisting that the country needs leadership that is responsive, accountable, and committed to addressing the real challenges facing the people.

A dramatic political fallout has erupted within the Patriotic Front (PF) as the Miles Sampa-led faction officially withdraws from the Pamodzi Alliance associated with Makebi Zulu, accusing the camp of betrayal and hidden agendas aimed at destroying the former ruling party.
Speaking during a tense media briefing where he also announced the appointment of Mundolo to the MCC Sampa launched a fierce attack, questioning the sincerity of Zulu’s camp. He charged that their decision to take PF matters to court exposes their true intentions.
“If they genuinely wanted PF to survive, they would not have taken the party to court,” Sampa declared.
He further alleged that the Zulu camp is comfortable with the collapse of PF, claiming they lack the historical connection and sacrifices made by long-standing party members. “They are okay with seeing PF dead because they never suffered for this party,” he said.
MINISTER OF HEALTH REVOKES BOARD APPOINTMENT AND SUSPENDS KEY OFFICIALS AT ZAMMSA

The Minister of Health, Dr Alex Katakwe, has taken decisive administrative action aimed at restoring integrity, transparency, and public confidence in the operations of the Zambia Medicines and Medical Supplies Agency.
In a move described as both lawful and necessary, the Minister has with immediate effect revoked the appointment of Keegan Mwape Pharmaceutical Society of Zambia President as a Board Member, citing his mandate to ensure efficiency and accountability within the institution.
The action comes amid growing concerns surrounding governance and procurement practices at the agency responsible for the supply of essential medicines and medical supplies in Zambia.
To further strengthen oversight and allow for thorough investigations, several senior officials within ZAMMSA have also been suspended with immediate effect.
These include Acting Director of Procurement Justin Milimo, Acting Manager for Medicines Diana Musa, Senior Procurement Officer Brian Munoka, and Acting Director of Planning Rachel Msimuko.
The suspensions are intended to pave way for unhindered investigations into the operations of the agency.
Dr Katakwe has since called upon investigative bodies, including the Drug Enforcement Commission and the Anti-Corruption Commission, to probe the matter and ensure that any wrongdoing is addressed in line with the law.
The Minister says that upholding accountability and reinforcing efficiency within ZAMMSA remains critical to safeguarding the country’s health system.
TRADITIONAL leaders in Luapula Province have commended President Hakainde Hichilema and his administration for increasing their salaries and allowances.
They expressed their happiness about the increased salaries and allowances when Vice-President Mutale Nalumango paid a courtesy call on them in Mwense District.
Speaking through a representative, Roy Lombe, the chiefs said it is commendable that President Hichilema has fulfilled his pledge to adjust upwards salaries and allowances for traditional leaders in the country.
They said they are grateful to the New Dawn administration under the leadership of Mr Hichilema.
They also called for the speedy construction of chiefs’ palaces in the district, and appealed to Government to improve the road network in Mwense.
And Mrs Nalumango said Government is committed to working with traditional leaders to foster national development. Mrs Nalumango said she took note of all the concerns raised by the chiefs and that they would be presented to President Hichilema so that solutions can be found.

Aspiring Lusaka mayor Simon Mulenga Mwila has challenged the notion that politics is inherently dirty, urging well-meaning citizens to actively participate in shaping the country’s future.
Mr. Mwila said it is a common perception among some people that politics is a “dirty game” that should be avoided by decent individuals.
However, he noted that stepping away from politics does not purify the system but instead creates a leadership vacuum.
He explained that such a vacuum does not remain unoccupied, as it is often filled by individuals who may not have the country’s best interests at heart.
Mr. Mwila warned that these individuals may exploit the opportunity for personal gain rather than serve the nation.
Mr. Mwila further stated that the critical issue is not whether politics is dirty, but rather who is left to occupy the political space when responsible citizens withdraw.
He emphasized that the future of any nation is determined by those who choose to step forward and participate, not by those who remain on the sidelines.
Mr. Mwila added that meaningful change can only be achieved when good people make the deliberate decision to get involved in politics and contribute to national development.

Two previously detained French nationals Cécile Kohler and Jacques Paris have been allowed to leave Iran.

I asked the US State Department if the post was a threat of genocide, to which a spokesperson said: “That is not what the president said and you should go read his statement again. President Trump was clear: 47 years of extortion, corruption, and death, will finally end.”
Trump’s post says if Iran doesn’t do a deal, “a whole civilization will die tonight, never to be brought back again”, before going on to say he hopes it won’t happen, but it “probably will”.
His rhetoric could be seen as a negotiating tactic, with some arguing previously it shouldn’t necessarily be taken literally.
The administration has repeatedly said his objective is to prevent Iran’s leadership developing a nuclear weapon, an issue over which Trump has abandoned diplomacy in favour of military force several times.
But even if it’s a bluff, the rhetoric will raise even more concerns about the potential erosion of international norms on warfare, as we’ve written about here.
Russia and China have vetoed a Gulf draft resolution at the UN Security Council that strongly encouraged defensive, co-ordinated efforts to secure the Strait of Hormuz.
Eleven countries voted in favour and two council members abstained (Pakistan and Colombia).
After weeks of negotiations, the draft was watered down from initially being under Chapter VII (authorising military force) to removing Chapter VII but “authorizing states to use all defensive means necessary” to finally strongly encouraging defensive efforts.
Bahrain’s Foreign Minister Dr Abdullatif bin Rashid Al Zayani chaired the meeting.
Speaking before the vote, he told council members that the draft didn’t create a new reality, but was a serious response to a pattern of recurring hostile Iranian behaviour that must cease.
He said failure by the Security Council to respond to the weaponising of the vital waterway for leverage would have grave consequences for the world and could be replicated in other straits and waterways, transforming the world in to a jungle.

Let’s read the UPND constitution and contrast it against the last elective general assembly of February 14, 2021.
Chapter IV, Article 75 reads, “The President of the Party shall be elected by the General Assembly every five years”.
Since the five years expired exactly February 14, 2026, does this mean the office is vacant?
We need to look to the definition of “every five years”.
Typically, “every five years” doesn’t mean the automatic creation of vacancy or removal from office of the office holder.
It simply refers to a time limit when elections must take place. This was the case with the Republican Constitution until it was amended to provide for a specific date for elections.
The UPND constitution doesn’t provide for a specific date.
In any case, the UPND constitution provides for a vacancy and the actions to be taken.
Article 77 of Chapter IV reads, “In the case of any vacancy in the office of the President, the NMC (National Management Committee) shall appoint anyone of the four deputy Presidents to act for a period not exceeding 90days”.
The article further reads, “The extraordinary General assembly shall be called to elect a president within 90 days if the NMC felt the office shall be vacant for more than 90days”.
Right now, the ruling party is within the 90day time frame. No violation of the constitution has taken place to justify the actions taken by Patrick Tembo Banda.
And, yes, UPND would be within its legal rights to sue Mr. Banda.

The Movement for National Renewal (MNR) has formally raised serious constitutiona concerns regarding the requirements imposed by the Registrar of Societies in relation to its application for registration submitted on 23 March 2026.
This follows the recent judgment of the Constitutional Court delivered on 2 April 2026 in The Legal Resources Foundation Limited v The Attorney General (2025/CCZ/0020), in which the Court directed that the Societies Act must be read and applied in conformity with Article 60 of the Constitution.
Despite this binding directive, the Registrar has continued to impose a series of requirementson MNR that include:
(a) Police clearance and fingerprint certification of office bearers; Approval and endorsement from the Zambia Police Service and local authorities;
(c) Recommendation and symbol approval from the Electoral Commission of Zambia; (d) Detailed vetting of leadership, including curriculum vitae and traceable references.
MNR contends that these requirements collectively amount to a multi-layered system of prior State approval, effectively transforming a registration process into a licensing regime. Such a regime, the Movement submits, has no constitutional basis, is neither reasonable nor proportionate, and constitutes an unjustified interference with the right of citizens to freely form and participate in political organisations The Movement further notes that the continued insistence on hese requirements is inconsistent with the binding directive of the Constitutional Court, and therefore represents a failure by a State organ to comply with the Constitution. Threat to Democratic Participation The urgency of the matter is heightened by the forthcoming general elections, with candidate nominations scheduled between 18 and 22 May 2026.
Unless the application is determined promptly, MNR will be effectively excluded from participating in the electoral process. In addition, the uncertainty surrounding the registration process has already impaired the Movement’s ability to: (a) Mobilise supporters; (b) Organise its structures; and (c) Raise funds through voluntary public contributions.
This situation places MNR at a serious and unjust disadvantage in the democratic process.
MNR’s Demands
MNR has formally called on the Registrar of Societies to:
a)Withdraw the unconstitutional requirements immediately;
(b) Reconsider the application in light of the Constitutional Court judgment
c) Apply the Societies Act strictly in conformity with Article 60; and
d)Proceed to determine the application without imposing extraneous conditions.
The Movement has given the Registrar 48 hours to comply and communicate a decision.
Next Steps
MNR has made it clear that, in the event opf non-compliance, it will take all necessary legal steps to enforce compliance with the Constitution and the authority of the Constitutional Court.
This may include proceedings to ensure adherence to the Court’s directive and to safeguard constitutional rights.
