Lusaka- Tuesday,7th April 2026

The Patriotic Front has appealed the Judgement delivered by Lusaka high court Judge, Justice Conceptor Chinyanwa Zulu which ruled that Miles Sampa’s Extra-Ordinary Conference held on 24th October 2023, was justified and valid as the Patriotic Front Party allegedly had no Central Committee at the time of the Conference.



By this Judgement, the Party was given to the defendants: Miles Sampa, Morgan Ng’ona and Robert Chabinga.

But Patriotic Front Secretary General, Raphael Nakacinda, has filed a Notice of Appeal and Affidavits objecting strongly to the Judgement.



Nakacinda has sworn in the affidavit that the Learned Trial Judge erred in law and in facts in making a false finding finding that the Central Committee of the Patriotic Front Party had ceased to exist at the material time, and that the members present did not constitute a Central Committe, thereby disregarding the Party Constitution relating to continuity of office, internal control mechanisms, and the fillingof vacancies.



Nakacinda also sworn that the Judge failed to consider the totality of the evidence on record supported the Appellant’s case, including the material admission by Miles Sampa’s own admissions, particularly the admission that the meeting of 24th October 2023 did not constitute a General Conference.



He has stated that if the Judgement was allowed to reign, it would cause a miscarriage of Justice.

“TAKE NOTICE that the APPELLANT being dissatisfied with the decision of the Honourable
Justice C. Chinyama Zulu delivered in the High Court of Zambia, on the 27th day of March,2026, Under Cause No.2025/HP/0577 intends to appeal to the Court of Appeal against the Judgment of the Court.”



The Learned Trial Judge in the court below erred in law and in fact in holding that the Appellant failed to prove his claims, when the totality of the evidence on record supported the Appellant’s case, including the material admission by the Respondents, particularly the admission by the 1st Respondent that the meeting of 24th October 2023 did not constitute a General Conference.

The Learned Trial Judge erred in law and in facts in finding that the Central Committee of the Patriotic Front Party had ceased to exist at the material time, and that the members present did not constitute a Central Committe, thereby disregarding the Party Constitution relating to continuity of office, internal control mechanisms, and the filling of vacancies.



3. The Learned Trial Judge erred in law and in facts by misapplying and failing to apply the
relevant provisions of the Patriotic Front Party Constitution governing the convening of an Extraordinary General Conference, including by:



(a) Restricting her determination to Regulation 67 to the exclusion of other applicable provisions;

(b) Erroneously holding_ that the Constitution did not provide for circumstances where
both the President and Secretary General resign; and



(c) Failing to find that the 1st Respondent lacked locus standi and authority to unilaterally convene an Extraordinary General Conference.



4. The Learned Trial Judge erred in law and in fact in finding that an Extraordinary General Conference was held on 24th October 2023 and that it was properly constituted, in the absence of credible evidence, including proof of delegates or attendance registers, misplacing the burden of proof upon the Plaintiffs (Appellant) despite admissions by the 1st Respondent and improperly restricting the issues for determination solely to whether the Conference was duly convened, thereby occasioning a miscarriage of justice
