AFRIFORUM EXPLAINS WHY IT BELIEVES JULIUS MALEMA SHOULD GO TO JAIL IF HE IS FOUND GUILTY OF IGNORING A COURT ORDER
AfriForum says its legal action against EFF leader Julius Malema is about ensuring that court orders are respected and enforced equally, regardless of who is involved.
The organisation argues that Malema has continued to make statements and support actions related to land occupation despite a 2017 court interdict that prohibited him and the EFF from encouraging unlawful land invasions. AfriForum has therefore approached the court, asking it to determine whether Malema is in contempt of that order.
According to AfriForum, if the court finds that Malema deliberately ignored the interdict, he should face the legal consequences available under South African law, which can include a fine or imprisonment in serious contempt of court cases.
Malema and the EFF have maintained that their position is to advocate for lawful land reform and have opposed AfriForum’s legal action. The matter is now before the courts, which will decide whether there has been any breach of the court order and whether any penalty is justified.
The case forms part of the wider national debate over land reform, property rights and the rule of law in South Africa.
