NAKACHINDA FOUND WITH CASE TO ANSWER, TO OPEN DEFENCE ON SEPTEMBER 14
Lusaka | August 10, 2026 – The Lusaka Magistrates’ Court has found Mr. Raphael Nakachinda with a case to answer in a matter where he faces charges of expressing hatred, ridicule and contempt based on tribe and place of origin, contrary to the Penal Code.
Magistrate Hon. Sinvula delivered the ruling this morning, holding that the prosecution had established a prima facie case sufficient to place the accused on his defence.
It is alleged that in April 2022, Mr. Nakachinda uttered remarks to the effect that Zambians had picked “the most ignorant person from Bweengwa” and taken him to State House. He denies the charge.
At this stage, the court is not deciding guilt. It is determining whether the State has led sufficient evidence that, if unchallenged, could sustain a conviction. Had the evidence been insufficient, the accused would have been acquitted immediately.
Having found it sufficient, the court has now placed Mr. Nakachinda on his defence.
When defence opens on September 14, 2026, Mr. Nakachinda has three options:
· Remain silent;
· Give an unsworn statement from the dock; or
· Give evidence on oath and call witnesses.
Depending on however he chooses to defend himself, the court will then weigh all the evidence to determine whether the charge has been proved beyond a reasonable doubt.
The matter has been adjourned to September 14, 2026 for commencement of defence.

By the time this chap Nakachinda comes out of incarceration, the world around him will have changed. He will realise that his PF has been completely dismantled. Members of his defunct party will be running in all directions like fumigated rats.
