JUDICIARY NOT RESPONSIBLE FOR PROLONGED DETENTION OF SUSPECTS
Chief Justice Dr Mumba Malila has clarified that the Judiciary is not responsible for the prolonged detention of suspects in police custody.
Speaking to Hot FM News, Dr Malila said the Judiciary’s responsibility begins once a matter enters the judicial system.
He said members of the public have continued to blame the Judiciary for the prolonged detention of suspects in police cells, even when such detention occurs before a matter is brought before the courts.
Dr Malila has explained that the Judiciary only becomes involved after the Director of Public Prosecutions (DPP) decides to prosecute and the matter is formally brought before the court.
