A Chelstone Local Court has dismissed a businessman’s claim for compensation against a mobile money agent he accused of having an affair with his wife, after the court found no evidence that the pair had actually had sex and heard the wife say she had pursued the relationship to revenge her husband’s alleged infidelity.
The case, heard before Magistrates Charity Milambo and Elizabeth Zulu, took an extraordinary turn when the court heard detailed accounts of alleged romantic encounters, including a visit to the accused man’s home, a hug and kiss, and plans for sexual intercourse that were allegedly interrupted when the woman said she was not feeling well.
The complainant, Elliot Kangulu, 30, a businessman from Obama, had taken 25-year-old mobile money agent Obrien Mudenda to court, seeking compensation over what he described as the breakdown of his marriage to 27-year-old Edina Banda.
Kangulu told the court that he discovered the alleged affair after finding messages between his wife and Mudenda on her phone.
He said the messages, which he discovered on August 6, showed that the two had been communicating for some time.
According to Kangulu, Mudenda had on July 30 asked his wife to wash his clothes. She collected the clothes, washed them at the matrimonial home and, after they had dried, gave them to a maid to return to him.
