Mundubile, Makebi seek constitutional bail

…Opposition leader, his running mate and 16 others ask High Court to order their release on grounds that their continued detention without trial violates their constitutional rights

By EMV REPORTER

Leading opposition leader Brian Mundubile, his running mate Makebi Zulu and 16 others have applied to the High Court for constitutional bail.
Mundubile, Zulu and 16 others are seeking their release from custody pending the hearing and determination of proceedings.

The 18 applicants have asked the court to order their release either unconditionally or on reasonable conditions it considers appropriate to ensure their attendance at trial or any preliminary proceedings.

In their application, filed through Ellis & Co Legal Practitioners and Milner and Paul Legal Practitioners, the applicants are seeking relief under Articles 13(3) and 18(1) of the Constitution of Zambia, Chapter One of the Laws of Zambia.

They want the court to declare that their continued detention, taking into account the period they have spent in custody without trial, constitutes a violation of their rights under Article 13(3) of the Constitution.

The applicants have also asked the court to grant any other relief it considers just and appropriate, with the costs of the application to be in the cause.
The summons for admission to constitutional bail is scheduled to be heard before High Court Judge Derick Mulenga in Chambers on October 19, 2026, at 09:00 hours, or as soon thereafter as their lawyers may be heard.

The application is dated October 14, 2026.

The applicants are represented by Ellis & Co Legal Practitioners and Milner and Paul Legal Practitioners.
