“The political detainees are seeking Constitutional Bail after being held for a prolonged period of more than 70 days without due process according to the law…the prolonged detention is illegal,” SC Sakwiba Sikota, Defence Lawyer.

—
Opposition leader Brian Mundubile, vice Makebi Zulu and 16 others arrived for Constitutional Bail before Judges Charles Chibwili, Ireen Wishimanga and Derrick Mulenga, but the State sought a ‘preliminary hearing’ to delay proceedings said Defence Lawyer SC Sakwiba Sikota

Basically, the State is just trying to ‘throw dust into the air’ to deliberately frustrate and delay the hearing further beyond the already unnecessary unconstitutional delays Defence lawyers said

No Food for the Detainees ahead of Court

The brief adjournment revealed a humanitarian glitch. Defence said detainees were bussed from Mukobeko Prison in Kabwe at about 4am for the 150km trip on empty stomachs.

“Realistically the last time hon. Mundubile and fellow detainees ate food is yesterday Wednesday about 15:00 hrs because they get locked up to sleep according to prison rules by 16:00hrs,” the lawyer said.

“What this means is Mr. Mundubile and others have not had a decent meal or any meal at all for more than 20hrs up to 11am today from yesterday… you cannot keep people hungry this long without risking their health,” especially those with health problems such as diabetes.

The Defence is asking the three-judge high court panel to ‘free’ hon Mundubile Makebi and 18 others or start a speedy and transparent treason trial as the detention enters day number 71 without what lawyers are calling due process.

The judges are Justices Charles Chibwili, Derrick Mulenga and Ireen Wishimanga.

State Counsel Sakwiba Sikota is leading the Defence comprising among others, Nkula Bota, Chifumu Banda SC and Kambwa Aongola and Milner Katolo.

This is Day 4 of the most followed treason case in recent Zambia history. This is a developing story.
