State reduces ex-ministers repayments to K4.2 from K4.7 million

THE state has reduced the amount of money it suggested that former Patriotic Front cabinet ministers and their deputies should pay back for illegally staying in office after their mandate had expired prior to the 2016 presidential and general elections, from the initial K4.7 million to K4.2 million.

The state has indicated that the repatriation allowances owed to the 64 ministers was K8,000 contrary to the K15,000 which they were demanding.

In this matter, Attorney General Likando Kalaluka had asked the Constitutional Court to compel the Registrar of the Constitutional Court to assesses the amount of money that the Patriotic Front ministers were required to pay back as directed by the court in a matter where the Law Association of Zambia and the UPND had petitioned Ngosa Simbyakula (left) and 63 others in the Constitutional Court in 2016 for failing to vacate office when their mandate expired prior to the elections.

The state claimed that it had challenges in both addressing the recovery of emoluments and/or
considering the question of indemnity as the exact emoluments (salaries, allowances and per diems) to be recovered have not been agreed by the parties, three years after judgment.

In a further affidavit in support of assessment of amount due pursuant to the judgment dated August 8, 2016, filed on July 16, 2020 and sworn by Fides Kalangwa, a director of policy research and standards in the office of the Accountant General at the Ministry of Finance, the state indicated that the emoluments have been duly computed by the policy research and standards for the period of May to July 2016.

“As can be seen from the said computation, the total amount recoverable from the former Cabinet ministers and former deputy ministers for the period of May to July 2016 is in the sum of K4,778,664.10,” reads the statement.

“The computation was arrived at after looking at the payslips of the former Cabinet ministers and former deputy ministers,” said Kalangwa.

However, according to a notice of non-objection to the quantum settled by the state, Simbyakula and his counterparts did not object to paying the K4.7 million proposed by the state being emoluments which they were required to pay back for staying in office illegally, but demanded K15,000 each as repatriation allowances.

“Take notice that the respondents represented by Messrs Ellis and Co, Messrs D. H. Kemp and Co and Messrs Lungu Simwanza and Company did not object to the quantum of emoluments as quantified by the first respondent(state),” read the notice.

” Save that the said respondents were not paid their repatriation allowances in the sum of K15,000 per person.”

The notice further indicated that Obius Chisala, the 31st respondent did not receive his salary and allowances for two months in June and July 2016 because his contract of employment was terminated on June 8, 2016.

But Fredson Yamba, secretary to the treasury, in an affidavit in reply to the notice of non-objection to the quantum settled by the state, said the 63 were owed K8,000 as repatriation allowances and not K15,000.

“With regards to the issue of repatriation allowances, the correct figure to be paid to the former cabinet ministers and former deputy ministers is K8,000 each. My office has duly re-computed the summary for net pays and allowances to be recovered from ministers taking into account the K8,000,” Yaba said.

“The total amount recoverable from the former cabinet ministers and their deputies for the period of May to July 2016 is in the sum of K4,266,664.10.”

Yamba said with regards to the claim by Chisala that he was not paid, the latter was paid his salary for the months of May, June and July 2016 as confirmed by his payslips.

Paramount chiefs ask ConCourt to declare Section 2 of the chiefs Act unconstitutional

THE Litunga of the Lozi speaking people of Western Province and three other paramount chiefs have asked the Constitutional Court to remove Section 2 of the chiefs Act from the statute book as it is unconstitutional and void insofar as it defines the word ‘Chief’.

The paramount chiefs say the definition of the word ‘chief’ in section 2 of the chiefs’ Act is inconsistent with Article 266 of the constitution.

This is in a matter where Lubosi Imwiko together with Kalonga Gawa Undi of the Chewa and Nsenga people of Zambia, Malawi and Mozambique, Chitimukulu of the Bemba and Mpenzeni of the Ngoni of Eastern Province have petitioned the Constitutional Court seeking a declaration that the traditional authority of the paramount chiefs to recognise, install and discipline, including dethronement of any of their subordinate chiefs in accordance with customary law, shall continue to be exercised by them.

The four, who have cited the Attorney General in the matter, are seeking a determination and declaration that the chiefly institutions of paramount chief, senior chief and other chiefs continue to exist and are guaranteed under article 165 (1) of Constitution of Zambia.

They are also challenging the decision by government to remove chiefs from their payroll.

In their final submissions, the paramount chiefs have argued that while the provision of the constitution traces the legitimacy of chieftaincy to the culture, customs and traditions of the people to whom they apply, the chiefs Act traces legitimacy to recognition by the President.

The chiefs said the definition of ‘chief’ in Article 266 of the constitution reflects the removal of the requirement for recognition of chiefs by the President or any other person.

“Article 266 has accordingly supplanted section 2 of the chiefs Act insofar as the same defines the term chief,” said the Litunga and others.

The quartet submitted that the Ministry of Chiefs and Traditional Affairs, including other state institutions, were bound by the definition of ‘chief’ in line with Article 266 of the constitution and might not withhold any privileges or benefits to chiefs on the definition in the chief’s Act.

The chiefs said on February 26, 2020, the Ministry of Chiefs and Traditional Affairs stripped off salaries for new chiefs, a position which was against the provisions of the law and African Customary law.

“It is our submission that the selection, installation, discipline and dethronement of chiefs have their source in African customary law and not in the chiefs Act or indeed any statute,” they said.

The chiefs prayed that the corporate status of chieftaincies in Zambia together with the incidence of perpetual succession were upheld.

“Having endeavoured to persuade this court of the unconstitutional conduct on the part of the state it is our prayer that the petition is upheld and the relief sought is granted as prayed,” submitted the paramount chiefs.

The Litunga and his counterparts, in their petition, said that Article 165 (1) of the Constitution Act No.2 of 2016, said the institution of chieftaincy and traditional institutions were guaranteed and shall exist in accordance with the culture, customs and traditions of the people to whom they apply.

They said that according to article 167, a chief might own property in a personal capacity and enjoy privileges and benefits bestowed on the office of chief by or under culture, custom and tradition and attached to the office of chief as prescribed.

The Litunga and his counterparts said that article one (1) and (2) provides that the constitution is the supreme law of Zambia and any other written law, customary law and customary practice that was inconsistent with its provisions was void to the extent of inconsistency.
They argued that any act or omission that contravened it was illegal.

They stated that the position taken by the Ministry of Chiefs and Traditional Affairs was different not only with the provisions of Article 165, 166 and 167 of the constitution of Zambia but also the definition of “chief” in Article 266.

“Chiefs” means a person bestowed as chief and derives allegiance from the fact of birth or descent in accordance with the customs, traditions, usage or consent of the people in a chiefdom,” the quartet said.

They said that Article 2 of the constitution says that very person has the right and duty to defend the constitution as well as resist or prevent a person from overthrowing, suspending or illegally abrogating the constitution.

The four explained that from the time Article 165 of the constitution became operational, there had been scramble for chieftainship proven by declarations of illegal chiefs now claiming that they no longer need to be recognised by senior chiefs under article 165 of the Constitution.
“It is important for government to pay necessary subsidies to chiefs to enable them discharge their functions diligently and maintaining their dignity,” they said.

In his answer to the petition, Attorney General Likando Kalaluka said the Litunga and his counterparts were entitled to the reliefs sought that the traditional authority of the paramount chiefs to recognise, install and discipline, including dethronement of any of their subordinate chiefs in accordance with customary law shall, continue to be exercised by them.

The state confirmed that Section 8 of the chiefs Act was not declared unconstitutional and void by the Constitutional Court in the case of Webby Mulubisha Vs the Attorney General therefore the four paramount chiefs are entitled to the reliefs sought.

“The petitioners are entitled to the reliefs sought save for costs as the petition raises serious Constitutional issues and the said costs should be in the cause and for the reasons that the same issues raised were canvassed in the Webby Mulubisha V Attorney General judgment,” said Kalaluka.

After his medical trips to China, Zimbabwe’s VP says senior officials can no longer fly out for treatment

The Vice-President and Health Minister of Zimbabwe, Constantino Chiwenga has said senior government officials will no longer be allowed to travel outside the country to seek medical treatment on the account of taxpayers.

Addressing the press on Monday, Chiwenga, 65, said the new directive has been implemented to maintain the national medical bill, New Zimbabwe reports.

“We will not export our patients. We will not make referrals to our patients. It is everybody, ministers. Those who have been going out it is you and me. Is it not it? Altogether but that export bill was too high and that is what we want to do away with,” he said.

“Zimbabwe has a national medical bill that is high. It is, therefore, imperative that the country develops a method of containing the import bill through health care innovations for import substitution.

“This entails inverting the import bill burden into export receipts either in part or most importantly in the whole. This will improve the funding of the national health care system.

“We will have hospitals that will specialise in different treatment services across the country. We are restructuring from the village health worker right up to the top hospital.”

The South African country’s healthcare system has been in a crisis for years with medical officials constantly laying down their tools to protest conditions of service. Access to good healthcare by average Zimbabweans is also a problem, and the situation is laid bare by senior government officials who usually opt to travel overseas on taxpayers’ funds for medical treatment and check-ups.

In 2019, Chiwenga was flown to South Africa for an emergency medical treatment for an undisclosed illness and then to China where he spent four months. He has also flown to the Asian country for check-ups several times this year and has previously been to India for treatment, New Zimbabwe reports.

Former president Robert Mugabe also spent months at a hospital in Singapore before he passed away in 2019.

But Chiwenga has promised to revamp the country’s health system and improve remuneration for striking health workers.

“We have now reviewed salaries and allowances as a way of government commitment to make the national health care system competitive. To this end and the overall increase in health-specific allowances will be effected by the government,” he said.

“We are convinced that salaries and conditions of service are bound to further improve and be more competitive in the short to medium term because of the import substitution measures that the new Ministry of Health and Child Care is now representing. Housing and vehicle loans will also form part of the improved conditions of service.

“As we move forward and face the future with courage, the expectation of government is that the work ethics and work culture within the ministry undergo deep transformation. We expect grievances to be solved amicably through discussion without endangering patients’ lives.

“Never again shall patients’ lives be used as pawns in a game of chess,” he promised.

He also said: “In the clinical services when the country manages to avoid patients’ export or patients’ referral bill, alone through treatment capability, we shall be able to make an equivalent saving. In other words, we can turn the logic around and aim for medical tourism.”

Court of Appeal denies Mwiimbu leave to renew application for Judicial Review on Bill 10

MONZE Central member of parliament Jack Mwiimbu has been denied leave by the Court of Appeal to renewe his application for leave to commence judicial review proceedings against the decision of the Speaker of the National Assembly to allow the restoration to the order paper for consideration of Constitutional (Amendment) Bill No.10 of 2029.

Court of appeal president Fulgency Chisanga, deputy president Chalwe Mchenga and judge Justin Chashi threw out Mwiimbu’s application with costs, as the proposed application for judicial review does not reveal or allege a breach or contravention of the constitution.

The court said no constitutional question has been indicated on the application warranting examination by the court and that had that been so the court’s jurisdiction would have been questioned.

“ A plethora of authorities reveal that the Speaker and the National Assembly can only be amenable to judicial review if there is a breach or contravention of the constitution in its decision making,” the court said.
“The application for judicial review is bereft of merit as the decision in question relates to internal processes and procedures which the court is excluded from checking in the absence of contravention or breach of the constitution. Leave is accordingly refused.”

The court added that there were many cases cited in the matter which should have guided Mwimbu.

It said the matter was fit in which to condemn him to costs.

“The applicant shall bear the costs of the application in this case to be taxed in default of agreement,” ordered the court.
Mwiimbu wanted to renew his application for judicial review before the Court of Appeal after High Court judge Sharon Newa threw out the same on grounds that the matter raised issues of a constitutional nature and she had no authority to determine it as it was the preserve of the Constitutional Court.

Mwiimbu wanted an order of certiorari to quash Dr Patrick Matibini’s decision to allow the deferment of the proceedings relating to controversial (Amendment) Bill No.10 of 2019 to a date yet to be advised within the fourth session of twelfth assembly.

Mwimbu was seeking an order of mandamus directing the Speaker to discontinue any or further debate or other proceedings relating to Bill No. 10.

He also wanted a declaration that Dr Matibini’s decision is invalid, null and void and of no effect and an order that all proceedings in the National Assembly relating to the Bill be stayed until after the determination of the matter or further order of the court.

Mwimbu sought reliefs on grounds that Dr Matibini’s decision was unreasonable and irrational, without justifiable reason following the the lapse of the Bill on June 4, 2020 and is not amenable to further consideration, debate or process in parliament.

But deputy Clerk of the National Assembly Cecilia Sikatele in an affidavit in opposition to Mwiimbu’s application for judicial review argued that there was no express provision in the National Assembly Standing orders of 2016 which governs the time within which a bill must be considered at any stage of enactment.

Sikatele charged that the issues raised by leader of the opposition, Mwimbu, and the subsequent reliefs sought are wrongly before the Lusaka High Court because they raised matters of a Constitutional nature and the High Court was incompetent to hear and determine the issues raised therefore the case should be dismissed for want of jurisdiction.

Sikatele stated that the standing order’s committee, which is the highest decision making body of the National Assembly, was charged with the responsibility of considering proposals for the management of procedures and practices of the National Assembly.

However, Mwiimbu argued that standing orders do not give the Standing Orders’ Committee any power to extend the life of the Bill to a date to be communicated not later than the last day of the meeting.

He said the decision by the Speaker to allow the continued consideration and deliberations on Constitutional (Amendment) Bill No.10 of 2019 was amenable to review by the Lusaka High Court.

In his affidavit in reply to the respondent’s affidavit in opposition to the affidavit verifying facts, Mwiimbu denied that the matter was in any way constitutional in nature as it was anchored purely on the established practice and procedure of the national assembly as prescribed in the internal rules and regulations of the National Assembly that govern practice and procedure.

Mwiimbu said the rules and regulations of practice and procedure were prescribed in the standing orders of 2016 and various handbooks issued by the National Assembly from time to time and not in the constitution of Zambia.

“The argument that after deliberations the Standing olOrders’ Committee resolved to extend the life of the Bill to a date to be communicated not later than the last day of the meeting, exposes the illegality of the Speaker’s decision to allow the continued consideration, debate or other proceedings relating to Constitutional (Amendment) Bill no.10 of 2019 in so far as the state confirms that the standing orders committee extended the life of the Bill on March 24,2020,” Mwiimbu said

“The standing orders do not give the Standing Orders’ Committee any power to act in the manner that it had purported to do contrary to what is deposed by the state.”

However, judge Newa in her ruling of July 2020 said that on account of exclusive cognizance given to the National Assembly by Section 34 of the National Assembly, the Speaker was protected from any court action where he exercises his powers under the internal procedure of Parliament and that he would only be amenable to such a court action if he breaches the Constitution in exercising his powers.

She said the Constitutional Court by virtue of Article 128(1) of the Constitution is the court vested with jurisdiction to deal with such matters.

” Even if I had jurisdiction to interrogate the exercise of the Speaker’s powers pursuant to the internal practuces and procedure of the National Assembly as submitted by the Attorney General, it would ultimately involve interpretation of the Constitution from which the said powers are derived. As seen I have no such jurisdiction as it is vested in the constitutional court,” said judge Newa.

THE UPND LEADERSHIP WAS IN ORDER TO INSPECT PROJECTS IN DISTRICTS CONTROLLED BY UPND IN NORTH WESTERN PROVINCE ~ Naomi Tetamashimba.

United Party For National Development UPND North Western Province Vice Vice Chairlady in charge of Mobilization Ms Naomi Tetamashimba has charged that her Party Leadership was in order to inspect projects funded using locally generated income/funds because they are UPND initiatives.
The project inspections by our Leadership was to familiarize themselves with the happenings in the Districts controlled by the UPND and to appreciate the Local Leadership on how they are Prudently utilizing locally generated income/funds, she stated.

Naomi Tetamashimba was responding to a Press Statement released by Kalumbila Town Council on 8th September, 2020 claiming that it was unethical and unprofessional for the UPND Leadership to to conduct an inspection on projects that are locally funded without the the hand of Central Government.

Ms Tetamashimba has advised the Patriotic Front to accept the fact that Local Government in North Western Province is controlled by UPND and must appreciate her party for providing Leadership and ensuring that the people receive the much needed development using locally generated income/funds despite PF through Central Government deciding to punish the people of North Western Province.

Ms Tetamashimba stated that it was laughable that the Patriotic Front can continue to threaten Civil Servants from Local Authorities for allowing Her party to conduct a peaceful project inspections and familiarization tour of UPND controlled Districts to check on the progress of a number of projects such as Schools, Clinics, Community Halls, Bridges, Roads, Markets etc with emphasis on good Leadership.
The decision by the PF to threaten Council workers with suspensions and transfers was out of desperation and kicks of a dying horse, she said.

Ms Tetamashimba explained that Her Party and the people of Kalumbila and Solwezi Districts are aware that the projects being undertaken using locally generated income/funds is attributed to UPND Leadership that is making sure that Civic Leaders work in line with Her Party Manifesto by bringing development closer to the people.

She further added that Her Party Leadership called on all UPND MPs, Mayor/Council Chairpersons and Councillors in Councils Controlled by UPND to be innovative and be able to depend on local resources to generate income/funds and not to depend on Central Government funds because PF promised never to take development to areas controlled by UPND.

The people of North Western never associate the projects being undertaken by the Local Authorities such as Kalumbila and Solwezi to the Patriotic Front but the UPND Local Leadership (Mayor/Council Chairpersons, Councillors) that are working tirelessly to ensure that locally generated income/funds are well utilized to benefit the people despite being neglected by PF through Central Government, she said.

She categorically stated that the inspection of projects did not require the Blessings of the Council or PF but the Blessings came from the people who gave UPND the mandate to look at their Affairs and called on people to ignore the Press Statement that was generated out of threats from the failed PF Leadership.

ZAMBIANS LIVING IN STATE OF FEAR..JUDGE PHILIP MUSONDA

ZAMBIANS now live in a fear State and not a free State, according to justice Phillip Musonda.

He observes that there is diminished freedom of expression currently.

Meanwhile, the retired Supreme Court of Zambia judge notes that upon realising that the PF government had lost legitimacy, President Edgar Lungu shrunk the political space and undermined the Constitution “by constitutional means” by introducing Bill 10, which seeks to destroy the basic structure of the Constitution.

Dr Musonda’s views are contained in an academic 15-page paper titled ‘Lawfare: Undermining constitutional democracy, the rule of law and human rights in the post-colonial State.’

The paper is for Master of Laws students at the University of Zambia (UNZA).

Dr Musonda is a senior lecturer in law at Cavendish University (Zambia) in Lusaka.

He is a lecturer to Master of Laws students in comparative constitutionalism in Africa.

Dr Musonda is also a member of the Court of Appeal in the Kingdom of Lesotho but he indicates in the academic paper that the views therein do not represent those of that Court of Appeal.

“Under the PF regime, Zambians have experienced profound economic deterioration. [There is] diminished freedom of expression. Zambians now live in a fear State and not a free State. There is currently unresolved gassing of citizens’ homes, which cause breathing problems, which is a terrorist act,” Dr Musonda writes. “Two senior police officers have been implicated – one being the officer commanding [in] Chingola and the head of criminal investigations in the same district and a ruling party official, suggesting it is State-sponsored terror, to pave the way to implicate the opposition and use lawfare to eliminate them from the political scene.”

He says lawfare takes an exponential curve when a regime loses legitimacy and its chances of retaining power are dim.

He observes that lawfare is an evolving concept and defines it as a form of war consisting of the use of the legal system against an enemy, like damaging or delegitimising them, tying up their time or winning a public relations victory.

Dr Musonda indicates that there is correlation between economic deterioration and lawfare.

“A regime becomes brutal when it has failed to improve the economy and is under intense pressure. It is apt to state here that there is correlation between repression and economic deterioration. In 2011 when the Rupiah Banda led Movement for Multiparty Democracy (MMD) government lost the presidential election to Michael Chilufya Sata led Patriotic Front (PF), Zambia’s economy was growing at a healthy 6.5 per cent per annum, average, debt stood at 21 per cent of GDP, debt service [was] stable and inflation [was in] single digits. Rupiah Banda left 12 months reserves to cover imports,” he explains.

Dr Musonda says in Zambia, the only president who did not incarcerate his ardent critics is Rupiah Banda.

He recalls that Banda presided over the memorial service of Frederick Chiluba, “a man who incarcerated him on trumped-up charges of treason during the Black Mamba saga.”

“He restrained the police from arresting his fiercest critic, Michael Sata, for obstructing his motorcade [in Ndola] and yet the same Sata arrested him (Banda) on trumped-up charges, but he was acquitted,” Dr Musonda notes.

“This paper is at no moment suggesting that those who raid public treasuries and are corrupt should not face justice. All [that] is being said is that don’t use the law to victimise your political enemies.”

He adds that lawfare is propelled by the citizens’ complicit, when they are induced to vote into office political leaders who bribe them.

He says negative lawfare obscures a crucial underlying reality of eliminating political opponents from the political scene.

“The prosecution of opposing political party members for unlawful assembly in the Zambian case, for which no ruling political party member has even been charged despite committing the offence so-called frequently than opposition party members, is not a happenstance; it is a calculated scheme to instill fear in the opposition supporters,” Dr Musonda says. “There must be strong and independent institutions to counter actions of a democratically elected government when it decides to go rogue. In Zambia and most developing countries, such institutions are absent.”

Dr Musonda points out that the post-colonial State is one governed by law, not one governed by the rule of law.

“When negative lawfare becomes a way of life for the ruling elite, over the course of time, they create a legal system and institutions that authorise it and a moral code that glorifies it. That is the tragedy over motherland Zambia and other post-colonial States,” he says. “When Chiluba came to power in 1991, he ordered Kaunda’s detention on Christmas Day at Mukobeko Maximum Prison. Whatever grounds existed to warrant such detention is unclear as the former president of Tanzania intervened and Kaunda was released. For all what we know, this may have been vindictive. Kaunda fell victim of his authoritarian style of using the law to eliminate his political opponents, negative lawfare rubber-stamped or green-lighted by an executive-minded judiciary.”

He further indicates that when Levy Mwanawasa came to power in 2002, fearing that Chiluba would overshadow him, he asked for lifting of his immunity by Parliament.

Dr Musonda recalls that the Mwanawasa administration accused Chiluba of having stolen US $43 million, only to be charged with stealing $500,000.

“Admittedly, the allegations were roving and exploratory, as Mwanawasa admitted in his address to the National Assembly that the allegations had not been thoroughly investigated,” Dr Musonda says.

“Mwanawasa incarcerated Sata on a charge of theft of a motor vehicle. After Mwanawasa’s death, Rupiah Banda become president. There was evident good governance, he was tolerant and broad-minded and a good economic manager. He forgave Chiluba who incarcerated him (Banda) on trumped-up charges of treason and organised a memorial lecture and service for him.”

He notes that Banda’s democratic credentials can be likened to those of Nelson Mandela.

“He (Banda) lost an election to a populist demagogue Sata, and he peacefully handed [over] power. Sata deceived the unsuspecting citizens that he was going revitalise the economy, build new houses in 10 days, and put more money in people’s pockets,” Dr Musonda says. “He raided the reserves left by Rupiah Banda and bankrupted the treasury. His successor Edgar Lungu, realising that PF had lost legitimacy, shrunk the political space, undermined the Constitution by constitutional means by placing Bill 10 constitutional amendment, which destroyed the basic structure of the Constitution by intending to increase his powers.”

Dr Musonda further says the dictatorial tendencies of African leaders and the corruption they preside over make them intolerant.

He also remembers that President Lungu enacted Constitution Amendment Act No 2 of 2016, “which attempted to rebalance power.”

“However, in 2019, realising that he had ceded a lot of power, conceived Bill 10, with the objective of arrogating more power to the Executive, tampered with the efficacy of the electoral process, undermining the doctrine of separation of powers, which amounts to destroying the basic structure,” explains Dr Musonda.

“The destruction of the basic structure anchor on the propelling of lawfare, as the President is reposed with extraordinary powers.”

Every nations strength is determined by how independent its judicial system is.The judiciary of any nation is constitutionally mandated to bring to book any one found wanting irrespective of ones position, as long as they act against the law the judiciary is expected to act accordingly.

The case of Zambia is politically stressful. Because, criminals are heroes now in our nation. Gangsters are in charge of key institutions that should have saved the integrity of our nation and what can one expect if not this disaster we are witnessing.

The consequence of issuing NRCs to kids by the PF government.

NRCs should not be used as a tool for winning an election.Few weeks ago I published a trail of how some senior office bearers from the ministry of home affairs are engaging in registering foreigners as voters.

And today we are seeing videos and NRCs being issued to foreigners from neighbouring countries like Congo and Malawi. That’s how desperate PF government has become.

NRCs should not be a tool for winning election. The worst thing is seeing our children being abused by people who should have protected them from any possible abuse. What these gangsters are forgetting is that these are peoples children.

What is the effect of giving these NRCs to kids. There are so many effects of what the PF government is doing towards our kids;

1.It has altered their age. Look at it this way if these boys were girls, they could be defiled and a suspect can never be convicted of that crime. All he would need to do is, just get hold of this NRC show the child was of or above the age 16 years and no court will touch him.

2. Employment, these kids can be employed under the age but, because of this document labour officers can never protect them.
So, no matter how we look at it. This is a violation of child’s rights and these kids are prone to abuse all in the name 2021 elections PF must win at all costs. What a pity!

Mr. Edgar Lungu do you really think this is the right pay back to the people of Zambia? this is unacceptable and disheartening. I look forward to human rights defenders to summon the ministry of home affairs and ECZ over this matter.

On the other hand, there are serious consequences of registering adult foreigners as voters which is also being engineered by PF leaders.

This alone threatens our national security. Most of these people accepting to get NRCs are hardcore criminals in their nations, and PF government doesn’t care at all as long as they have the figures to insert in the Electoral Commission of Zambia (ECZ) register and cook them using these foreigners.

I have seen and heard PF leaders and their members singing so much about Zambia being a sovereign state, but what is sovereignty when outsiders will come and make a decision for Zambians through these people they are registering? Right now there are so many private meetings PF leaders are holding with questionable characters.

The other group as Zambians we need to watch closely is the Electoral Commission of Zambia. The ECZ has been captured and they will be one of the catalyst to confusion in this country. The commission has no idea of what is supposed to be correctly done because they fear these criminals controlling these public institutions.

We have been warning for a long time now that 2021 elections will be the most useless general elections ever held in the political history of Zambia unless we citizens rise up and say no to this injustice before it is too late.
As Sean Conery rightly put it in a film called “The Rock”, Patriotism is the virtue of the vicious. Therefore, as Zambians we must be patriotic enough to protect our sovereignty or we shall lose a country we call home. All for a party that lost election in 2016 and now they know Chavula won’t be in the server room to alter figures. They want to make up by registering our babies and foreigners. Nooooo!

Dear Hakainde Hichilema,

I’m writing this with sorrow, pity and fear for our country. Its extremely evident our current govt has failed, in short Edgar Lungu and His PF. The only hope we have is an opposition leader because none of the PF’s can liberate us from the chains we tied ourselves with when we blindly voted for the song despite You and many others warning us.

They say history repeats itself in 2011 the same things were happening and Sata tried his best until his untimely death and Edgar Lungu brought the people we fought out of govt and now there are back stealing like its their last day, destroying everything they touch, they are greed and will do anything possible to make sure they stay in power.

They keep telling us that you’ll divide the country, Ala mwandini Tata bufi teti Tufwe, we know how a song can destroy and blind us. We are never failing for that and Hakainde Hichilema For President 2021 is our everyday slogan until we see them out.

Lukashya a bedrock of PF, I’ve 80% chance – Chisanga

LUKASHYA PF candidate George Chisanga says the September 17 by-election is a family feud in which he has 80 per cent chance of emerging victorious.

The by-election was occasioned by the death of independent member of parliament Mwenya Munkonge in August.

The UPND have fielded Davies Mulenga, who was left out of PF nominations and he defected to the opposition party. Other candidates are People’s Alliance for Change’s Michael Chimponda, MMD’s Christopher Kabwe, Leadership Movement’s Brown Sinyangwe, and United Party for a Prosperous and Peaceful Zambia’s Samuel Kabungo.

In an interview from Lukashya, Chisanga said he has been a politician, a lawyer, and a leader.

“This is the distinction that many people are failing to draw. All of us are politicians and some of the politicians are basically leaders. My quest here is basically to try and see if I can help Lukashya Constituency,” he said.

Chisanga said he has been very passionate about the constituency from 2010 when he walked through Lukashya.

“Of course, I entered Lukashya through the structures of the PF. You have been a journalist who has been aware of my political movements. I have been part of PF from 2006 on my return from…in fact I had intended to join PF in 2002 but effectively I joined PF in 2006 when I came back from abroad (Kenya) and basically I have been helping out the party for as long as that time,” he explained.

Chisanga said being picked to represent the ruling party in the by-election was not an easy undertaking.

He said when he assessed what Munkonge had done in the constituency, he established that he towed the ruling party line.

Chisanga said it would be easy for him to take over from where Munkonge left off.

“Getting this nomination for me was not very difficult because the party knows how passionate I have been in this constituency. The party also knows how passionate I have been, in being a member of this grouping. So yes, we competed, there was fierce competition definitely from all other members; many credible members; I think we had thought about the same thing that we need somebody with credibility to come into Luakshya Constituency and take over from where Mwenya left,” he said.

Chisanga said he did not write-off any of his competitors as all of them were very good candidates.

“Unfortunately, people are writing off the PF because of the frenzy and the social media publicity we have that this party is going into self-destruction. But if you saw the calibre of the people that applied for Luakshya Constituency, it would tell you they are people that have a passion to keep this party going,” he said.

Chisanga said he considered himself privileged and blessed for being picked among others.

He said he was in the campaign mode now.

“One thing that I have tried as much as possible is to have a campaign that is free of violence. I have spoken about it; I have been on Diamond TV, everywhere else, even here I have been on Lutanda Radio and I think our people are following what we have guided,” Chisanga explained. “We are peaceful, we have tried as much as possible to be peaceful and because of how ECZ (Electoral Commission of Zambia) created the campaign timetable, it has helped us to run a peaceful election campaign. As much as possible, no two parties are within one ward at the same time. One party would be in one ward then the other one will be in another ward.”

Chisanga said in Lukashya, the ruling party rolled out development projects despite it being under an independent member of parliament.

He said even with challenges in the economy, there were projects already being rolled out in the constituency.

“Roads are being done, we are planning to do bridges to basically connect the constituency. Because if you came to Lukashya, and I hope I can come with a journalist from The Mast next time I come here, and we show you the kind of constituency we are dealing with. It’s an agrarian constituency; it has potential to be the food basket not only in Kasama but the Northern Province and even beyond,” he said. “But the very fact that it is not connected very well by road network is what poses the greatest challenge.”

Chisanga said despite some challenges, the determination on people’s faces was visible, that all they need is someone to help.

“So you present yourself as someone who wants to help. Of course, I won’t do a lot. That doesn’t mean we don’t have a vision, I won’t do a lot, look at the time I have, I actually have seven months in Parliament and Parliament will dissolve but in that seven months I am prepared to come down to the ground, get to the lowest part of the constituency and pick up information about what people would want us to do and draw up a programme. I am a leader, I don’t dream answers. I got to the people and pick up what they would like us to do and then provide solutions to that challenge,” Chinsaga explained.

The former Law Association of Zambia president said although he was running against five others, “this is a battle between two guys.”

“If you are aware, the gentleman who is standing on the UPND ticket is basically a Patriotic Front member, so it’s a family feud if you want to put it that way. I can’t question why UPND decided to make this move but everybody has taken that decision which, I think they find it very unjustifiable,” he said.

Chisanga said the people and groups he has spoken to were very angry that the UPND could pick their member and pit him against PF.

He said he does not see that as a problem but an opportunity where the opposition party was seeking an opportunity to enter the constituency.

“But people would understand why the Patriotic Front would not want to pick a gentleman like him. I don’t like going into politics of personalities…but since it is a competition, you put it between PF and UPND but in terms of what we have done so far, PF has far outsmarted the UPND. Look, the reality is that, for instance, there would have been violence by now but I go everywhere talk to them these are your brothers, your sisters, you don’t have to get to a stage where you fight each other for you to propel the candidature of Mr Chisanga or propel the candidature of Mr Davies Mulenga. You don’t have to do it; talk to each other, let Davies tell you what he is going to tell you and let Mr Chisanga tell you what he is going to do. At the end of the day you assess those two people and make a decision on who are going to support,” he said. “And they are warming up into it.”

Chisanga hoped non-violence campaigns would remain the operating mode going into the by-election.

Asked about his chances, Chinsaga said, “believe it or not, I am getting more than 80 per cent”.

He said Lukashya was the bedrock of the PF and the people know what the ruling party had done and know him and Mulenga.

He said the people should not find it difficult to decide between him and Mulenga.

Chisanga said in 2016 when people were told that Elfridah Kansembe was going to recontest the seat, the district and constituency leaderships floated his name and that an adoption certificate was given but revoked after some considerations.

He said he had no problem with that development.

“For me one thing that defines me is loyalty. I am a loyal member of this party. If the party says you can’t I will sit back and let someone else,” said Chisanga.

KBF curtails witness testimony in Chimese case

FORMER Zambia Air Force commander Eric Chimese’s defence lawyer Kelvin Fube Bwalya has prevented a witness from disclosing the amount of money that the former accrued from the time he assumed office as ZAF Commander until he was fired.

Bwalya said salaries, pension benefits and emoluments relating to service chiefs cannot be disclosed without authority from the President, as it is considered classified information therefore disclosing the same would amount to an illegality.

This is in a matter where Lt Gen Chimese is facing charges of abuse of authority and is jointly charged with Chita Lodge proprietor James Chungu for money laundering.

Testifying before Lusaka magistrate Nsunge Chanda yesterday, Colonel Bernard Chileshe, a director in charge of salaries and pensions at the Zambia Air Force, under the finance department said in May 2019, after officers from the Drug Enforcement Commission (DEC) visited ZAF, he was assigned by the command to compute personal emoluments and benefits accrued by Lt Gen Chimese for the period he served as commander from 2011 to 2018.

“I got the information from the pension fund relating to payments made to NAPSA, gratuity, leave days, three months salary notice and repatriation for General Chimese, for the salaries, I got the information from the payroll for the period 2011 to 2018 when he retired,” Chileshe said.

He further explained that he also collected information relating to Lt Gen Chimese’s foreign travel allowances and compiled the said information for the DEC.

Chileshe mentioned an amount but before he could disclose further information relating to what Lt Gen Chimese accrued from the pension benefits, salaries and travel allowances between 2011 to 2018, Bwalya nipped his testimony in the bud as the evidence bordered on State security.

Bwalya said the law relating to classified information is very clear that communication of protected information by any person apart from an authorised person, there must be a specific waiver by way of authority.

“The salary, allowances and benefits of the ZAF commander are well known as classified information and disclosure of classified information without authority from the President may land the witness and others who give such information without authority into trouble,” Bwalya said.

“A person who gives such information without a waiver will commit an offence and may be liable to a conviction of a term not less than 15 years and not exceeding 25 years. My instructions are to inform this court that a commander’s earnings are classified as secret and confidential.”

He said the conditions of service for all service chiefs are given directly to them by the Secretary to the Cabinet in the name of the President and that conditions of service for service chiefs cannot be discussed without authorisation from the Commander-In-Chief of the Armed Forces.

Bwalya cautioned Chileshe against being found on the wrong side of the law, and restrained him from further disclosing what Lt Gen Chimese had obtained during the period he served as ZAF commander until he was retired in national interest, without being permitted by President Edgar Lungu.

Bwalya refered to a case where late president Michael Sata wrote a waiver to a Mr Sichinga who was the Permanent Secretary at the Ministry of Works and Supply for him to testify against former president Rupiah Band who was facing criminal charges in the Lusaka Magistrates’ Court.

He said senior officers such as Chileshe and other government officials were under oath not to disclose classified information even after 25 years of leaving office.

“The rationale is found in the preamble of the state security to protect the state and its officers. In the absence of the colonel producing a letter from the Commander-In-Chief of the armed forces that he has been authorised to disclose classified information, such borders on illegality,” Bwalya submitted. “Even us as the defence we may need to get instructions from accused number one (Chimese) to cross-examine the colonel which will border in us receiving classified information which again may be illegal. This witness is incompetent to go beyond what he has told the court without committing an offence.”

In his response, Chief State Advocate at National Prosecutions Authority Gamaliel Zimba said the defence had alleged that the testimony by Chileshe was classified information and the state could only respond if the defence presents documentation to the cases they cited and those relating to classified information.

At this point, Bwalya requested that the parties and the court resolve the matter in Chambers before the court could render its ruling.

When the matter resumed a few minutes later, Zimba said there had been an agreement by both the State and defence that the matter be adjourned to September 10.

The story of MaFishi continues to be interesting. I want to look at it from longevity and legacy and I believe that’s why the passing away of MaFishi remains fascinating. It is believed that the lifespan of animals given ideal conditions is far much longer than humans . Ideal conditions in this respect might be favourable climatic conditions, clean and safe environmental conditions, abundant and less competitive food chain and I think absence of human contact which reduces environmental degradation and filth. Let me cut the chase, am sure if MaFishi’s water and food was controlled MaFishi would have lived longer and larger. Sorry CBU guys but your love might have killed MaFishi. Ma leftovers yaku dining of nsima, na buns, mahewu given with good intentions might have given MaFishi cholesterol, high blood pressure, diabetes or depression.
But 27 years still Nipa tali. MaFishi witnessed and heard a lot of things at CBU

So back to age, most of the longest living animals are those found in water . In fact the closest relative to MaFishi the Koi fish has been recorded to live up to 200 years . I initially thought MaFishi was Koi and I have organized a few Koi Fish to be on standby for CBU.

State House, Home Affairs Turn Mutati’s Life Into Living Hell

State House has made life a living hell for former finance minister Felix Mutati, whose attempts to find a vehicle to kickstart his political life is being frustrated at every point.

Well placed sources have told Daily Revelation that after Mutati lost the MMD presidency to Dr Nevers Mumba, he was desperate to kickstart his political party by trying to find another political party vehicle. However, sources said attempts by his supporters to register a political party named Movement for Democratic Change (MDC), where frustrated by the Registrar of Societies, following instructions from State House and the Ministry of Home Affairs.

The sources say State House fears that Mutati, would draw support from the ruling, though not much but significant enough to tilt the 2021 elections, which President Lungu narrowly won after defeating opposition UPND leader Hakainde Hichilema.

“The position from State House is that they don’t want new parties coming up, especially those that have some alignment with the PF, especially that we are only a few months before the next election. There is also a fear that drawing away support from the ruling party, no matter how little will be strengthening the opposition,” the sources said.

The sources revealed that noticing lack of movement with the registration of a new political party, Mutati and his supporters entered into talks with officials from late Mike Mulongoti’s People’s Party, and just when they thought they had concretised the deal, there was a sudden uprising from some members in the PP against the alliance, effectively killing the talks.

The sources said thereafter, Mutati and his former faction members in the MMD attempted to get into a merger with Highvie Hamudu’s party, and just when they thought they were making progress there was a sudden change on the part of Hamududu, and no progress was made on that score.

“We told him that that us we already have a membership, therefore let’s merge. But we have word that everything failed after State House got involved,” the sources said.

The sources said the same happened with the talks involving Jackson Silavwe’s Golden Party, who after initially agreeing to join hands with Mutati, State House’s hand proved too generous to deny.

“We only received word of him telling us, after we had made progress that you can join but you must work under me,” the sources told Daily Revelation.

Contacted for comment, Emmanuel Kalasa, Lusaka Province chairperson for the unregistered party, refused to address himself to the matters, saying he was not privy to the discussions.

However, Kalasa added that no human being could stop that which God had destined.
Efforts to talk to Mutati have proved futile, as during the last time he picked his call he indicated that he would call back, but he has not picked followup phone calls that have been made to him. –Daily Revelation

We’re not fools, HH warns PF

WE are not fools and PF will be very mistaken to imagine even for a second that the people of Zambia are fools, warns Hakainde Hichilema.

Hichilema, the UPND leader, has encouraged eligible Zambians to be assertive and shout that: “‘I need an NRC’” because that is their national identity document.

The second phase of national registration cards (NRCs) was scheduled to begin in Central, Muchinga, Southern, Lusaka and Western provinces on September 1, 2020.

But home affairs minister and Shiwang’andu PF member of parliament Stephen Kampyongo announced a postponement of the process, two days before its start.

Voter registration, according to the Electoral Commission of Zambia (ECZ), is set to start on October 19, 2020.

Commenting on the delayed NRC issuance process in the named provinces, Hichilema said Zambians should not allow the government to waver on a serious process.

“In this regard, we are telling this government [to] allow the second phase of NRC issuance to start. What sensible explanation have they attached to the postponement of the second phase of NRCs in Central, Muchinga, Southern, Lusaka and Western provinces?” Hichilema asked. “PF should not continue taking us for granted. We are closely monitoring everything they are doing and I say to them, start the issuance of NRCs in these provinces.”

He told the Ministry of Home Affairs, responsible for NRC issuance, that: “you can’t be murmuring and toying with a serious process such as this one.”

“We are not fools and PF will be very mistaken to imagine even for a second that the people of Zambia are fools. An NRC is a national document and it cannot be that before issuing it to a deserving citizen, you start strategising of how to deny that citizen of it, because of perceived political inclination,” Hichilema noted. “How does this PF mischief and phobia not qualify for a crime? It’s indecent to be shilly-shallying on a process whose timing is relative to seasons. We are talking about the rainy season here…”

He stressed that Zambians ought to be issued with NRCs as a matter of urgency and in a very decent and transparent manner.

“PF has no option but to do the right thing on NRCs and consequently the entire electoral process, otherwise they are under our surveillance and the people of Zambia must not allow to be short-changed by an immoral group, whose sole purpose of being in government is personal wealth accumulation using crooked means. Let’s not allow it!” Hichilema charged. “And to the people of Zambia, if you qualify to be issued with an NRC don’t whisper to demand what is due to you. Be assertive and shout that ‘I need an NRC’ because that’s your identity as a citizen of Zambia.”

He cautioned the population against starting to play around: “by rehearsing the malicious statements of PF and those others they have rented to dent the UPND.”

“Be on your feet, get your NRCs, then your voter’s cards and vote out PF. That’s the only way you will have secured your future and that of posterity,” he said.

Meanwhile, Hichilema pointed out that many Zambians out there were low-spirited and that the reasons were many.

“They can’t afford three meals every day, they can’t send their children to school and so many other daily hardships both in towns and in rural parts of Zambia,” said Hichilema. “But Hope and Help is on the way. Actually, that Hope and Help is 11 months away from now. But HH and UPND cannot usher themselves into government; that’s why we are saying in August 2021 go out and massively vote for HH and UPND. But again, the people of Zambia will not be able to massively vote for us without getting national registration cards and later on voter’s cards. That’s how it works!”

Amdala a Edgar gwilani ma cadre yanu, urges Kapoche headman

A TRADITIONAL leader in Kapoche Constituency, who was assaulted by PF cadres, has urged President Edgar Lungu to tame his party cadres.

In a press statement, headman Kapandula Elias Tembo of Mwangaila ward, said if cadres could have the guts to beat up a traditional leader, “what more a common citizen?”

He feared for intense violence in next year’s elections if the party cadres are not disciplined.

“Amdala a Edgar gwilani ma cadre yanu (Mr Edgar tame your cadres); they are making you look violent, yet you are not. We are people like them but if your cadres start beating traditional leaders, what more common citizen? Please, cage them for your name to receive honour and respect. I request you ba Edgar to discipline your children,” he stated.

Tembo stated that there was no need for other people to be disadvantaged in terms of holding meetings when others were holding political meetings peacefully.

He suggested that everyone should have access to people regardless of the party or status.

“Everyone should do a meeting. Mwaiwanu (Luckson Lungu, who is aspiring for the Kapoche seat on the PF ticket) should hold a meeting, Hakainde should hold a meeting and if they (PF cadres) disturb them (aspirants), I will ban them from holding meetings in my area,” Tembo stated.

He stated that it still hurts him being beaten by PF youths who are supposed to be his children.

“They didn’t do a good thing to beat me, a headman for that matter. I am not happy at all. We are the eyes of the chieftainess and whoever harasses us, harasses our chieftainess. Sanganicite so baja ma cadres nikusoba ulemu manje (they can’t do that to me, it’s lacking discipline),” he stated.

Tembo revealed that the cadre, Nelson Banda, who assaulted him went to his house on Monday morning to apologise with a K5.

“They shouldn’t be doing like that. He can’t give me a K5 for apology, afunika kupeleka ndalama yowoneka. What is K5 olo mapilisi yukwana lini (it’s not even enough for painkiller tablets),” Tembo stated.

He advised political parties to realise and learn that traditional leaders welcome everyone hence they should not be dragged into politics.

“As a headman, I receive everyone as I don’t have a political side. Him, Charles [Banda] he is holding meetings but [for] his colleagues to hold meeting, they [PF cadres] bring war…next year’s elections should be peaceful, without violence. This violence should end before next year,” advised Tembo.

PF cadres who were deployed to disrupt a meeting that was supposed to be convened by a rival camp beat up Tembo when he advised them to throw away the sticks they carried.

PRESIDENT LUNGU AND THE 500, 000 JOBS

In 2015, President Edgar Lungu launched an ambitious National Youth Policy and Action Plan on Youth Empowerment and Employment targeting the creation of more than 500,000 jobs for the youth through the implementation of the national apprenticeship and internship schemes.

5 years down the line, not only has the President achieved his goal but he has in fact surpassed his target.

Since we only deal with FACTS and not MANYENGWE, let me give you the breakdowns:

1. SYNOPSIS

a) JOB CREATION: The job of the Government is not necessarily to create jobs but more so to create an enabling environment for the private sector to thrive.

b) GOVERNMENT JOBS: The world over government jobs are never enough. Why? Because Government jobs are LIMITED to the public sector or/and the civil service. That’s all.

c) REASON: The more the Government employees the more burden it puts on the treasury, creating an economic imbalance. For instance, currently Zambia is spending over 50% of its budget on salaries and emoluments leaving little money for us to invest in other socio-economic sectors to spur growth and raise people’s standards of living.

So to ensure sustainable growth and job creation, the key is to have a thriving private sector. Chapwa!

2. WHERE DO WE STAND:

According to the Labour Survey of 2019, the PF Government has created hundreds of thousands of jobs, both permanent and temporal ones.

Currently the job figures are as follows:

¡) We have over 1.1 million Zambians in formal employment

¡¡) Over 1.2 million Zambians in the informal sector

¡¡¡) And over 900,000 employed in the domestic sector.

Curremtly Government is running over six major youth empowerment initiatives.

These programmes are: Youth Development fund, Women empowerment fund under Development Bank of Zambia, Skills and entrepreneurship project through the creation of industrial parks under African development Bank, The $29million Zambia aquaculture enterprise development project under African development fund, Cassava Value Chain Programme under the Citizen Economic Empowerment Commission (CEEC), Aquaculture Value Chain Initiative under CEEC.

Just last month Government dished out:

¡) 6 million dollars to youths for aqua- culture

¡¡) K470 million for multi sectoral youth empowerment projects

¡¡¡) K30 million for artists.

Over 3800 small and medium scale businesses have benefited through CEEC.

So when it comes to the 500,000 jobs, President Edgar Lungu has delivered on his promise.

In fact he has gone beyond.

Statistics from the CEEC, Zambia Development Agency, Central Statistics Office as well as the Ministry are AVAILABLE for all to see.

Teachers, Nurses And Other Civil Servants Must Lower Their Standards In Society

TEACHERS, NURSES AND OTHER CIVIL SERVANTS MUST LOWER THEIR STANDARDS IN SOCIETY
The Zambian Times is convinced that the kind of life teachers and other civil servants are leading does not suit their new status. They must down grade their life style to fit their income. No offence intended, civil servants must start living like maids and garden boys if they want to avoid thinking about suicide.

Are you aware that civil servants borrow every month inorder for them to get to the next pay date? It is hell. And since The Zambian Times loves you, we are here to give you very free advise.

For a start you need to understand that your salary is not as big as it looks. The K4,000 plus you get if you dont have a loan is worthless. For you to understand how useless it has become, let us convert your current salary into US dollars.

Today the Dollar is at K20. If we convert K4,500 to dollars, you are getting US225 as your salary. When Sata gave you that increament in 2013, you were getting about K4,200. The Dollar was at K4.80 meaning in 2013 you were getting USD 875. If you multiply that amount to the current rate, you realise that in 2020, that is worth K17,500.

That is why you were able to do alot then using your salary. As we speak now, your salary is a quoter(1/4) of what you used to get.

Now the problem with our civil servants is that they are trying to use a quota of their salary to live the way they used to live in 2013. As a result they end up borrowing 3/4 of the balance so that they lead the old life.

The Zambian Times advises all civil servants to accept that they can no longer live in luxury. They must do the following:
1. Remove their children from expensive private schools meant for real rich people.
2. Sell Dstv explorer and buy gotv.
3.Shift into small houses costing about K500 which are close to their places of work if they dont have their own houses.
4. Stop driving. Consider buying a bicycle.
5. Stop having girl friends.
6. Buy gas stoves and invest in good solar systems.
7. Fire maids
8. Consider going to live in rural areas.
9. Only buy the most basic food.
10. Stop further studies if they have big families.
11. Find alternative income which is not easy to come by.
12. Buy mtn phones.
13. Buy salaula. Stay away from botuques.

All those who will not do this have a high probality of dying before retirement because of endless pressure.

PF TRIBALISM SHOCKS CiSCA, CHALLENGES PRESIDENT LUNGU TO ACT DECISIVELY

The Civil Society Constitution Agenda (CISCA) has noted, with great concern, the continued tribal sentiments attributed to senior members of the Patriotic Front (PF).

Considering that these sentiments have been expressed openly and publicly without any censure or rebuke from both party and government leadership, CISCA has no doubt that those spewing such vitriol are sanctioned by the PF leadership, with the full blessings of the Republican President, Edgar Chagwa Lungu.

CiSCA has since called on President Lungu to prove to the nation that he is not in support of the tribal statements being perpetuated by his members.

“President Lungu should categorically, unequivocally denounce his senior leaders for their tribal utterances and accordingly sanction them to deter others from this vice. We doubt he will. If he is unsure how to do this, we encourage President Lungu to seek counsel from our former first President, Dr Kenneth Kaunda who worked hard to erase the tribal lines which Lungu and his cronies are shamelessly working hard to bring back,” said Judith Mulenga who is CiSCA vice chairperson.

Mulenga says the PF presently holds the dubious record as the most divisive party the country has had since independence.

“The Zambian people have worked hard over the years to live up to the ‘One Zambia, One Nation’ motto as manifested in the integration across tribes. Any utterances that promote tribalism go against the national values espoused in Article 8(d) of the Constitution, and undermines the national unity and harmony as contained in Article 43(d),” said.

Mulenga explained that the PF has failed to live up to their campaign rhetoric of improving the lives of the millions of Zambians living in poverty and have resorted to divisive, tribal tactics to try and hang on to power.

“We note that the tribal attacks are perpetuated mainly by a few misguided individuals from one ethnic group, the Bemba. Sadly, the traditional leaders have remained mute suggesting that they too agree with this misrepresentation of the many Bemba speaking people who are not vile tribalists like the few PF leaders. This week, President Lungu will be speaking in Parliament and will probably re-echo the rhetoric on national unity, while he is doing nothing about his party’s agenda of polarization of this country on tribal lines.

The President must demonstrate leadership by condemning the utterances of his senior party members and removing these members from positions they hold. We have little faith in the Secretary General of the Party in dealing with this. President Lungu must prove that he is intolerant of tribalism as it is under his watch that we have seen an upsurge of tribal divisions and he needs to deal with this convincingly and decisively. Zambians will not take kindly to his usual glossing over of important national issues and continued politicking for the sake of staying in power.”

Mulenga says her consortium is also disappointed by the ineptitude of the Electoral Commission of Zambia (ECZ) in decisively dealing with the continued use of tribal remarks during election campaigns.

She says the Commission puts the country at risk by their continued failure to deal with such behavior which has now become a permanent feature of the PF campaigns.

“We know that had the utterances attributed to Chanda Nyela in a recent video been made by any other tribe or opposition leader, the Home Affairs Minister would have already swung into action. Expecting any action from him is pointless and so we will simply point out his ineptitude in this regard for posterity’s sake so that Zambians can see for themselves the kind of leaders they have. Nyela, in his recent utterances, confirms something we have always suspected: that the ‘other tribes’ can never be considered for leadership. The singling out of only specific individuals from these tribes is merely a rouge to mask their deep-rooted tribalism that sees other tribes as not worthy of holding leadership roles in the country. If the PF cannot preside over a united country and can only survive in a toxic, divided environment, we remind them that Zambians are above this and deserve better from those in leadership or those aspiring for leadership. and must say no emphatically to such misrule.”

NASON MSONI DESCRIBES ISSUANCE OF NRC’S TO UNDER AGE KIDS SHAMELESS

All People’s Congress (APC) leader Nason Msoni says it is absolutely criminal for anyone to anchor his political ambition on electoral malpractices and the circumvention of the constitution.

Commenting on pictures circulating on social media depicting under aged children being issued with NRCs in Luapula Province, Msoni says the PF has taken a self-destructive trajectory by using under aged children to return power next year at all cost.

He observes with sadness that the recruitment of toddlers as voters is the worst form of child abuse and predatory exploitation of vulnerable children by shameless men and women.

“We think that running out of options is not a plausible excuse for anyone to resort to enticing small children to illegally vote for any group of desperate politicians who are fearing to be held accountable for their actions in the event of losing elections.

The idea of exploiting and taking advantage of the children as voters is in essence a confirmation that a political party has lost the argument for remaining in government.”

Msoni notes that this is a classic case of child labour being perpetuated by those who ordinarily ought to protect the rights of the children.

He says there is no excuse whatsoever for anyone to resort to using children as voters.This action is outrightly illegal and the perpetrators should be apprehended.

“Political mandate can only legitimately be derived from those who are eligible voters. We urge the electoral commission of Zambia to take keen interest in ensuring that it only registers eligible voters to avoid creating unnecessary political skirmishes,” he said.

Msoni fears that with the abuse exhibited so far on NRCs issuance, the online voter registration process will undoubtedly be abused by those who wish to take advantage of the system to recruit ineligible voters.

 

 

 

 

 

 

 

 

 

 

 

 

 

The behavior by NRC Office to do illegal things by registering minors is a serious indictment on our demicracy – UPND

UNLAWFUL ISSUANCE OF NRCs TO MINORS .

It has come to our attention that the government through the Department of National Registration is issuing National Registration Cards to under age children. This is illegal as the law stipulates that only people above 16 years of age can be issued with an NRC.
We have noted that in its desperation to manipulate the 2021 presidential and general election, the PF government is issuing NRCs to minors below the age of 16 by exaggerating their ages with the intention to register them as voters.

This malpractice is particularly being undertaken by
the Ministry of Home Affairs in places perceived to be PF strongholds.

The Ministry of Home Affairs has also been systematically denying those places perceived to be opposition strong holds access to registration materials.

We note that the illegal trend by government has gotten to registering minors who do not qualify at law.

Sadly , parents of the said children are not realizing that as a consequence of this illegal registration, their children will be sent to early retirement as they will be over-age,or fail to access educational facilities such as governed bursaries as they will be over-age.

Further, the said minors will be denied so many privileges available for other children.

As a Party, we wish to warn all those parents sending their children that are not qualified to obtain NRCs that we shall ensure those minors are dealt with accordingly during voting.

Zambia is a signatory to the international convention on children’s rights and registering minors is a serious crime.

The behavior by NRC Office to do illegal things by registering minors is a serious indictment on our demicracy.

We wish to put it on record that UPND leadership will prosecute all those involved once we assume leadership.

Arresting HH over privatisation a dangerous undertaking

ON August 30, a contact with well-placed sources within government reached out to us and urged us to take FDD leader Edith Nawakwi’s privatisation allegations against UPND president Hakainde Hichilema very seriously, no matter how useless they sounded. The contact informed us that government was going to use those allegations she made on Hot FM to arrest the opposition leader. According to this source, the PF government was planning to harm Hakainde Hichilema, but they had been struggling to have access to his body.

“The PF have been looking for potential cases on which they can arrest Mr Hakainde Hichilema. Unfortunately, they found nothing after a long search. The ruling leadership then hatched a plan to arrest Mr Hichilema for his role in the privatisation of State companies during the era of president Frederick Chiluba. Madam Nawakwi’s allegations are useful for this purpose. The PF thinks that Zambians, many of whom were either not born or too young at the time, are likely to believe whatever she says because she was Minister of Finance at the time of privatisation. The primary motive behind the impending arrest is to have access to his physical body, not to convict Mr Hichilema since any trial would expose the bogus nature of the charges and the serious weaknesses in the prosecution’s case. Once they have Mr Hichilema in police custody, the plan is to eliminate him. However, some people in power are of the view that killing him can set the country on fire. Instead, they are proposing that it’s better to find a pliant judge who would be willing to convict Mr Hichilema and disqualify him from running for the Presidency,” reported the informant, adding: “It is like they regret not killing him when he was in remand prison for treason.”

We are not too much into conspiracy theories, and so we gave very little attention to this intel, which sounded quite unthinkable to us. In our view, we stated to the informer that this was too far-fetched. We argued that the PF may have gotten away with the bogus treason charge in 2017 without creating a crisis, but arresting the biggest opposition leader months before a contentious election, let alone eliminating him, would turn this country upside down. “The PF leadership would have to be completely out of their minds to adopt such a foolish strategy, and only a mad person in government would authorise a dangerous scheme of that nature,” we stated.

To our shock, even before the statement from the Chief Government Spokesperson, Dora Siliya, could circulate to the public on Tuesday, the contact reached out to us again showing us the same document and saying: “This is what I was warning you about. Like I told you, they want to use madam Nawakwi’s allegations to arrest Mr Hichilema so that they can have access to his body. This is very sad. How can a nation be led or rather misled to self-destruction this way?”

In her statement, Honourable Siliya stated as follows: “Nawakwi, through her various media engagements, has categorically stated that Mr Hichilema failed to declare interest, while presiding over the sale of public assets in which he had personal interest. Government finds Mr Hichilema’s conduct, if true, to be a clear case of corrupt practices, bordering on non-declaration of interest, in winning a bid. Government is, therefore, studying the matter and is following closely the reaction by the citizens who are the true owners of the property in question. The nation will be informed of the steps that the government will take, should it become necessary to act on behalf of the citizens of Zambia.”

The statement from the Minister also tallies well with the political analysis given by UNZA lecturer Dr Sishuwa Sishuwa who also stated as follows:

“PF are creating the pretext on which they may move to arrest Hichilema soon for being in possession of property suspected to be proceeds of corruption. I heard Nawakwi the other day saying that Hichilema dubiously acquired a house in Lusaka and inviting State investigative wings to arrest him. What Nawakwi is doing, however, is to push to the front the privatisation issue because Hichilema is gaining momentum. She is doing so in a way that suggests that the PF are building a profile for his arrest on a bogus charge of corruption. And who knows what they may do to Hichilema when he is in detention?”

We still don’t pay too much attention to outrageous conspiracy theories, but this does not look like a baseless conspiracy theory anymore. Reading the strange statement from the Minister, one would not help but imagine it being fake news. It’s hard to believe that government officials at the level of Cabinet Minister sat down to write such a statement. The statement is not only embarrassing, but it also signals unprecedented levels of desperation to stop an opposition leader from participating in an election.

Why is the PF so desperate to arrest Mr Hichilema? What do they want to do to him? Is it true that they want access to his body so that they harm him, or kill him? Is this what the humble, God-fearing President has resorted to? Is this a charge that a reasonable government can rely on to arrest an opposition leader or anyone else for that matter? What kind of reasoning is this? To the Honourable Minister who issued that statement and any other government official, including the President, if he is part of the scheme to arrest and harm Mr Hichilema, we make a simple, earnest appeal: please, do not set the country on fire! There already exists a huge heap of pent-up frustrations and cumulative anger among Zambians for different reasons that all have to do with the failure of the State to meet their yearnings and aspirations. Do not light or set this heap ablaze. The consequences of the explosion might be too horrific to ever imagine.

I’m More Tonga Than HH – Bizwell Mutale

I’m more Tonga than Hakainde Hichilema, PF national mobilization committee member Bizwell Mutale has said.

Speaking in Livingstone, Southern Province, where he met PF party officials, Muutale said there’s somebody who thinks he is more Tonga than anybody else and he is a messiah of the Tongas.

“Today I refuse – the gloves are out. We will not be deprived. We are here in Southern Province and I’m not leaving. If Hakainde thinks Southern Province belongs to him, I’m more Tonga than he is. Ndi mwana a chief Monze mebo (I’m a child of chief Monze). What he (Hichilema) can do, I can do it 10 times than he does it. If he can come and tell us he is going to do the borehole, I’m gonna do the borehole now. We have the President; he comes here in Southern Province…You saw what happened in Monze? What an embarrassment
And the so-called MPs, the comments they were passing… They were voted [for] by some of you to be in Parliament. 25 years…They gonna go 30 years, what will change? No change will come out of Southern Province and I’m assuring you now. We can bet,” Mr Muutale said.

Muutale said change was coming to Southern Province.

“Change is coming to Southern Province [because] His Excellency President Edgar Chagwa Lungu is looking into Southern. Nothing will remain the same. We are here now; he (Lungu) has sent us to move as one nation and re-build our country. Kweendelenya ambubaamba ba chairman (like the chairman [Lawrence Evans] has said, UNIP was here, I had free education in UNIP. MMD came; we drank coffee for the first time in Zambia, PF came, he says eat your pie. We have seen the toll gates in South Africa [and] we pay. But okuno (here) we are refusing. The President has brought development – look at the roads. We are hitting 200 [kilometres per hour],” he said.

And Mr Muutale said they were sent by President Edgar Lungu to work in Southern Province.

“We’ve been sent by His Excellency President Edgar Chagwa Lungu to work here in Southern Province. The people in Southern Province say ‘PF has neglected us.’ The PF government is saying the people of Southern Province have rejected us. We have had so many discussions but you would understand. It’s like the chief expressed that it’s like there is a snake and a person. The snake is scared of biting a person and the person is scared of killing snake. Who is wrong? But we are now going to change this. Most of all, we are not going to be a tribe [but] we are going to be Zambians. One Zambia, One Nation. When you cross Kafue coming here (in Southern Province,) everything is wrong. I’m going to speak openly and blunt, because so many lies have caused the way we are today in Southern Province,” he said.

Mr Muutale said Southern Province is in Zambia.

“There is no Tonga who is another province, a Bemba in another province that is called another country. We have one President whom we look up to. Bakwimikizya bakapokola abukali maningi (when you are flagged down by traffic officers, you even fume), because the roads are nice. Wasika biyo (the moment you reach) mbozwiida mu Monze kuya ku Mazabuka ma tyre ayide kudubuka (the moment you leave Monze driving towards Mazabuka, your car tyres start bursting). God Has Used Nawakwi to Expose Hichilema’s True Character – Mumbi Phiri

Patriotic Front (PF) Deputy Secretary General Hon Mumbi Phiri says God is using former Finance Minister Edith Nawakwi to expose UPND leader Hakainde Hichilema’s real character to open up the eyes of Zambians ahead of the 2021 general elections.

Speaking on Kasama Radio on Tuesday evening, Mrs Phiri described Ms Nawakwi as a blessing to Zambia.

She said Mr. Hichilema is a wrong man to aspire for Presidency because of the manner he allegedly mishandled the transaction role that was placed on him by Government during the sale of Sun International Hotel in Livinsgtone and other national assets like RAMCOZ in Luanshya.

Mrs Phiri said the UPND leader, who turned out to be one of the shareholders of Sun Hotel after the conclusion of the the sale, should have declared interest in the matter in accordance with the principles of good corporate governance as opposed to what he did.

“Ms Nawakwi is being used by God to expose Mr. Hakainde Hichilema. God loves this country,” said Mrs Phiri.

She challenged Mr. Hichilema to give a comprehensive explaination to the Zambians the role he played during the sale of RAMCOZ and why he never declared interest during the sale of Sun Hotel instead of rushing to court to sue Ms Nawakwi for defamation of character before clearing his name over the Issues at hana which begs honest answers.

Mrs Phiri said there is nothing political for Zambians to demand answers from Mr. Hichilema, who is aspiring to lead Zambia, on matters of national interest.

She wondered why Mr. Hichilema has remained mute over people’s calls on him to explain why he never disclosed to Government that he was an interested party in Sun Hotel which he and his business partners bought cheaply.

Mrs Phiri said Zambians deserve to know the truth about all the issues surrounding Mr Hichilema’s source of his massive wealth and his dealings during privatisation.

She said Zambians deserve honest answers from all those aspiring for Presidency ahead of next year’s general elections.

The PF Deputy Secretary General wondered shy the UPND leader always gets emotional whenever he is asked about the source of his wealth by the media.

Mrs Phiri cautioned the people of Lukashya and Zambians in general to be wary of such leaders who always get angry when asked to account for their wealth as well as the role they played during privatisation.

“Vote for Mr. George Chisanga for continued Development,” she said.

Mrs Phiri is also disappointed that Mr. Hichilema has failed to tame his supporters who have gone on rampage insulting Ms Nawakwi and calling her Jezebel for merely expressing her disappointment with the manner Mr. Hichilema handled his role as transaction advisor to Government.

“UPND supporters are insulting a well-respected woman (Ms Nawakwi) and their leader is quiet. Hakainde has no respect for women. The issue of privatisation will not die.”

Mrs Phiri has since urged Mr Hichilema to brace himself for another defeat in next year’s elections and that those planning to set Zambia on fire when he loses will not succeed because Zambians are peaceful. -SMART EAGLES

KAMPYONGO’S HEAD IS TOO BIG FOR NOTHING; WHY DISENFRANCHISE OTHER REGIONS?– Sikaile Sikaile

Home affairs minister Steven Kampyongo, wants to speak like he is a holy demon when we know all the details of his ministry and the PF government at large their plans ahead of 2021 general elections. His thinking capacity is too low for home affairs ministerial position.
Only Edgar Lungu can give such key positions to thugs like Kampyongo. Ministry like home affairs needs people with a sober mind.

We know how PF government has induced the Electoral Commission of Zambia ( ECZ), turning it into a PF organisation. Because everything the Electoral commission is doing does not reflect the interest of Zambians, but that of PF and its surrogates.
We blame Edgar Lungu who has no vision for hiring people of low calibre like Kampyongo, Bownman Lusambo, Davis Chama, Davis Mwila,Sunday Chanda and many others to be deliberating on national issues. These cadres in public institutions have ruined the future of our nation.

From planning to arrest their opponent HH, gassing, burning markets, to registering foreigners as voters and now trying to disenfranchise regions perceived to be opposition strongholds by delaying and suspending the issuance of NRCs deliberately. If Kampyongo thinks we don’t know what they’re doing, then he’s lying to himself and soon they will all be made answerable for these criminal actions.

We know all their tricks, but let them know that they are riding a dangerous horse.It is criminal for Kampyongo and the PF government to deny other regions from exercising their democratic rights by denying them NRCs.

I’m warning Kampyongo and the Electoral Commission of Zambia to make their heads work accordingly by doing the right thing. Allow the issuance of NRCs in all the ten provinces to be conducted fairly before it is too late. Esau Chulu, we know what you are planning and next year you will not be allowed to announce fake results again. My advice to you is that resign now.

If you people decides to continue with this nonsense! of discriminating other regions regarding the issuance of NRCs, you will all soon pay heavily as the law visits you.
Kampyongo, should remember that there is life after politics. For PF, this is not the time for ARROGANCE, this is time to reflect on how you have conducted yourselves the last nine years of being in office. And in your case Kampyongo, you have a bad record and it’s high time you ask for forgiveness from Zambians than sending empty threats as though you are addressing little kids in your house because of those guns you procured.

May I also remind you that your name has been already cited to the international community and human rights watch groups for terrorism acts and funding political violence against your political opponents and critics in Zambia.

If the threats on the life of Mr.Hakainde Hichilema, continues we will have no option again but to notify international communities again as stakeholders to raise alarms just like we did earlier this year over the killing of opposition members and critics all sponsored by President Edgar Lungu and PF government.

Furthermore, the PF government should tell the people of Zambia why they have procured a lot of guns and military weapons. Do we have a security threat?

It will be unfortunate if all these guns PF government has bought are meant to fight poor citizens ahead of 2021 general elections. PF will not succeed at all in bringing trouble in our nation.

Today dissent is taken to be enemy of the Country. Men and Women who expects the best for the Country are being stripped of their rights by foolish Policing by the Zambia Police on Partisan lines. Today Police Force does not belong to the people of Zambia, but it is an extension of PF.

Today dissent denies you the benefit of enjoying the fruits of our Country. You have to agree to even with the most foolish things for you to be appointed or keep your job. Today dissent makes you an alien. A refugee in your Country with no rights whatsoever . Today you can’t have bussiness with Government because you are against the many ills of PF. Today all Zambians should behave like idiots and look the other way when their Country is degenerating.

Today your tribe is a prescription of discrimination. Today their tribe is a means by which they claim all the wealth and positions in this Country. Do we really have to be unpatriotic and allow our Country to its knees to be called Zambians? What happened to call of “Unity in diversity” which brought us together when we fought the One Party State?.Zambia will and has to raise above this mediocrity.

We will fight for the second independence from our local colonialist. Yes the Day Has Come for every Zambian to be recognized and enjoy the fruits of our independence, the fruits of multiparty democracy. Let us not be down troden by little dictators who want their evil will to divide this Country to be the order of the day. They are very little scared people. To them the use of force shows strength. HH being wrong doesn’t make you right, address pertinent issues, Lungu told

President Edgar Lungu has been urged to call for a national economic indaba immediately in order to find ways of coming out of the current economic quagmire that our country is faced with, and not find pleasure in the privatisation saga, involving his arch rival.

The Zitukule Consortium says it is deeply disturbed and concerned that some government officials have continued to push the privatization narrative in public discourse at the expense of current the challenges facing the country including poverty, low productivity and free fall of the Kwacha.

“It is totally unacceptable that government officials, elected to promote and protect the well-being of citizens could be spending time discussing the Opposition UPND leader Hakainde Hichilema when the nation is bleeding economically and majority citizens are becoming more and more impoverished. This should not be allowed to continue,” says the Consortium.

The Zitukule Consortium says this continued narrative by government officials is a well calculated ploy to shield their own failures and to divert citizens’ attention.

“It is our considered view that the sustained campaign by government officials on privatization and calls for a commission of inquiry focusing on one individual could be a deliberate and well calculated scheme meant to not only divert citizens attention from real issues affecting the nation, but also to justify and lay grounds for a possible arrest and harm to the UPND leader,” says the Consortium.

The organization adds that it must be noted that as things stand in the country today, any move by government to arrest and or harm the UPND leader may not be received well by the citizenry.

“For those calling for a commission of inquiry on privatization, have you forgotten how tax payer’s money has wasted on numerous politically motivated commissions of inquiries in the past 8 years with no tangible outcome. What has the nation benefited from the commission of inquiry on voting patterns and political violence when the status quo remains the same or even becoming worse?

“We wish to advise government to direct resources and energy on resolving the numerous challenges facing our people today including long hours of electricity blackouts, the ever-depreciating local currency, procurement corruption and debt management among other things.

“Arresting or planning to harm Hakainde Hichilema won’t launder the image of those in power today ahead of the 2021 general election.

“Unlike in 2016, arresting the leader of the biggest opposition party 10 months before the election on flimsy grounds would destabilize national peace and unity and put the country in big trouble,” adds the Consortium in a statement, issued by its Executive Director, Nicholas Phiri.

HH EXPLAINS HIS ROLE IN THE PRIVATISATION PROCESS

( IN RECENT WEEKS, ACCUSATIONS HAVE BEEN MADE AGAINST UPND LEADER , HAKAINDE HICHILEMA THAT HE STOLE FROM PRIVATIZATION. LAST WEEK, HH HAD AN INTERVIEW TO CLEAR THE AIR. THE UPND MEDIA TEAM BRINGS YOU A VERBATIM REPORT OF THE INTERVIEW ON HOT FM, DIAMOND TV AND OTHER STATIONS.)

INTERVIEWER: As Hakainde Hichilema, did you participate in the privatization process? Were you in charge of the process?

HH : It’s very important that we clarify at some point who was responsible for the privatization program but to insinuate that I made money because of the privatization process only is far from the truth because I started business at a very early age of 26 and was able to buy a property at K 61 million in 1995 before I was involved in any privatization program. So it’s not true that we made our money through privatization. We are business people.

The answer is that I participated in the privatization program but I was not in charge of the process. Who was in charge? It was the government of the day and which one was the government of the day? It was the MMD who were responsible for the privatization program in terms of policy not myself because I was not part of the Government.Legally,they were responsible because they set up the Privatization Act of 1992 as a Government under the late Frederick Chiluba MHSRIP.And the overall structure ( today is our day to explain these things so that those who might not be aware might know,those who may be mischievious,their mischief can be laid bare) The MMD government came into office in 1991 and in 1992,they enacted the Privatisation Act which was a legal document, meaning that parliament at that time made a decision and gave the citizens a law,the privatization law.

The way the structure was made was there was a cabinet on top chaired by the President of the Republic of Zambia.Under Cabinet,there was a Committee of Ministers from within Cabinet called Committee of Ministers of Privatisation,HH was not there.Then there was the Zambia Privatisation Agency,ZPA as an institution and manager to implement the privatization process.That is where the policy and legal power lay.The Committee of Ministers comprised Finance,Commerce,Mines and Tourism depending on the assets.The ZPA would then ask for expert advice from many,many people.

Thousands of Zambian lawyers,corporate finance guys like ourselves,real estate agents,property valuators,engineering firms from 1992 along the way were somehow involved. 270 companies or units were sold and today HH was responsible.HH sat below the privatization agency,asked to do his professional work. So the answer is yes in terms of involvement at that level as I have explained and No in terms of responsibility, in terms of legal power and in terms of policy power,I was not involved.

INTERVIEWER: Madam Edith Nawakwi has brought out three key issues which include the Kabulonga property,the sale of RAMCZ and the sale of Mosio-tunya Hotel in Livingestone.Let us start with the Serval Road property in Kabulonga,when did you acquire that property?

HH: Its fair to state that Madam Nawakwi on HOT FM alleged that I stole a house from Lima Bank and she mentioned the house as the one on Serval Road in Kabulonga.That I stole the house from Lima Bank.I abused my role in the privatization programme, got that house from Lima Bank dubiously. She actually called me a crook.I’m not a crook.That house never belonged to Lima Bank as she alleges.I bought the house but not from the said bank.

INTERVIEWER: Is there proof to show that you didn’t acquire this house from Lima bank?
HH: There is yes.

INTERVIEWER: Would you care to show us?
HH: Madam Nawakwi made these allegations that I stole the house,I responded that I never stole the house,I don’t steal.Here are the facts Gary.This property is called farm 488a/40/a/3 Serval Road.Thats the name of the plot.I bought this house from a company called National Tobacco Board of Zambia.This house was advertised through an open tender through the Newspaper in 1995.Madam Nawakwi says I stole the house from Lima Bank because in her allegations,I was involved in the privatization of the bank in 1998, but I bought this house through a public tender in 1995.The timeline there does not match.Someone is lying,is it me or it is her.I say Edith Nawakwi you lied.Here is a summary of the house having been bought from National Tobacco Company and not Lima Bank .(displays the house documents). I responded to a Newspaper advert in April 1995 and then after I responded and I was awarded after emerging as the highest bidder.Thats the point I was making earlier on.Without being involved in Privatisation,I was already as a businessman able to tender for this property at K 61 Million.Now who advertised the house? A firm in Ndola called T.P. Chibwe and company who were valuation surveyors and estate agents who had been engaged to sell the property.To be specific my offer went in on 26th of April 1995,then the valuation was done,how they did it I don’t know,that was not my job.Then I was offered the house.Who owned the house from the very beginning.Here are the records from Lands Ministry showing who owned the house. (displays Ministry of Lands documents). Mr.Chileshe was the owner of the house who sold it to the Tobacco Company of Zambia in 1967 and then TBZ got a mortgage from Zambia National Building Society of K 15,000 in 1971 and then TBZ changed its name in 1989 to National Tobacco Company of Zambia and all these entries are there in the Ministry of Lands documents.Then the National Tobacco Company borrowed money from Finance bank in December 1989.The money was not paid according to these documents and the bank moved in to repossess the house according to the security that was provided and passed it over to TP Chibwe of Ndola to advertise the sale.I won the tender like I said K 61 million,no income from Privatisation but from other businesses as a partner,as a shareholder and a couple of other businesses at an early age.No privatization at that age.I then paid the Real Estate Agent through my lawyer,one Michael Musonda,the current Deputy Chief Justice of Zambia and is still alive.Then they went and paid off the mortgage.The mortgage and interest was at ten million kwacha as at 27th September 1990 and the money I paid in was used to clear the mortgage and they were able to discharge the mortgage on 7th July 1995.Then the house was offered to me by the National Tobacco Company and became mine.Then I registered an assignment which is a document used to change ownership on 7th July 1995.That house was never ever a Lima Bank house.The bank came up for privatization in 1998,I bought the house in 1995.Clearly Madam Nawakwi you are a liar.

INTERVIEWER: Okay,that clears one of the particulars of the defamatory statements.So..
HH: She will have a chance in court to prove whether she has a different record of this.She has a chance in court.That is why we have gone to court so that we can stop shouting at each other.

 

INTERVIEWER : We now move to the second issue which is on RAMCOZ.What role did you play in that transaction whether remotely or closely because she raised this.

HH : First,there is this allegation that this young guy called HH was responsible for privatizing the mines and that he and he alone had the power.I think I have explained that I didn’t have the power because I was merely a service provider contracted and at the time appointed through a public tender either as an individual or firm with agreed fees.I got paid because that is my job and business.I think today I must clear that.There is an allegation that I privatized a mine called RAMCOZ.I never privatized any mine in this country.I made this point clear.

This mine was privatized around 1997.I was not there.The records are there at ZPA and Zambia Development Agency today and I can assure you that you will not find HH’s name there.RAMCOZ was sold by the MMD government through the structure I earlier gave you.I was not involved.INTERVIEWER : Why do you think she mentions HH?

HH : Malice.She is confusing things.She is claiming that I was the Receiver as you can see in our demand letter.In her insinuations,she says this young guy called HH had the power to privatize mines and its assets but that is wrong.It is actually malicious,completely malicious and again she will have the time to prove herself in court.Neither did I privatize RAMCZ nor was I its receiver. I was none.On her program on Hot FM,she alleged that I stole 10 million dollars from RAMCOZ.How I stole it,I don’t know.She will prove that in court.I’m not a thief and I didn’t steal any money from RAMCOZ.

RAMCOZ was privatized in 1997. Thereafter they borrowed money in 2000 or thereafter as a private company from ZANACO bank which they failed to pay.And ZANACO appointed a receiver to recover the money they were owed by RAMCOZ which was then a private company. Completely misleading herself and the public.And I’m shocked that a former Minister of Finance can fail to understand basic facts.It can only prove one thing,political malice.Get HH at all cost even if he is not a criminal. Complete malicious because the facts are there.How do I know that the facts are there? When you are appointed Receiver under the Insolvency Act, you have to register your receivership deed at PACRA,that time it was called Company Registrar.You also go to court and register that receivership Deed and you are appointed as a receiver as an individual,the law is very clear.I can invite Zambians who might be doubting on what is going on to say go to PACRA or go to court and see the Receivership Deed on who was appointed receiver only to recover the money for ZANACO and not to privatize RAMCOZ because it was already privatized 3-4 years earlier.I think my colleagues who did the receivership for ZANACO did a very good job as they recovered the money which was a very difficult thing to do to recover.The rest is detail for court.We shall see what she says in court.

INTERVIEWER: The third of the issues raised by Madam Nawakwi concerns Mosio-tunya Hotel in Livingstone that you sold yourself the shares after evaluation and all that.Give us a picture of this transaction and concerns raised by Madam Nawakwi.

HH : In the privatization process,if there is an asset that delivered more than expected,it was that project in Livingstone.World class asset,competitive product internationally,delivered meticulously in accordance with the objectives that were set in the privatization program.If I was not Hakainde Hichilema and was not seeking public office,I would have been praised every day on the way that transaction was handled.Completely first class in accordance with the set objectives.There was an allegation that I was shareholder when the bids came through,they never came to me but to ZPA.

The bids under the program were received by ZPA and then decides who they think can help them to structure the transaction in accordance with the set objectives and the agency would call people like us,not just me but there were other people there.But the way everything is being made to look like there is this troublesome chap called HH seeking Presidency who is not allowed to be Republican President of this country.He must just be a citizen of Zambia.I aspire to be President.

The bids went to ZPA and the insinuation is that I was shareholder of Sun International and when I was appointed to assist in putting this transaction together,I had vested interest in Sun International and therefore awarded the assets to the bidder.The material question is did I have shareholding in Sun hotel to be able to declare conflict of interest when I was asked to assist by the MMD Government through Cabinet and ZPA,the answer is NO.I was never a shareholder and I invite Zambians to go to the registry at PACRA and see if HH was a shareholder because that’s what Nawakwi said that I was a shareholder and therefore gave myself Sun International,she is wrong,I was not a shareholder

For The First Time In A Long Time, A Nation Is United In Grief….over A Fish

Mafishi was an elegant aquatic giant that loved to gyrate gracefully and with much aplomb especially when he noticed an attentive audience of admiring students converging on his pond. His exact age is unknown but estimated to be between 6 to 12 years.

Over the years, Mafishi quickly adopted the myth of Nyami Nyami known as the Zambezi River God of the Tonga speaking people of Zambia, Zimbabwe and Mozambique. Nyami Nyami is still believed to protect the Tonga and give them sustenance in difficult times. The current recurring of ZESCO power problems is attributed to the Tonga god’s unquenchable anger over the abuse of the Zambezi river and some Tonga traditionalists have demanded that sacrifices be carried inorder to appease and pacify the angry creature believed submerged on the river bed.

The interspecies relationship between Mafishi and the students was unique and was based on the concept of mutualism, where two individuals from different species exist in a relationship where each benefits from the activity of the other. Students regarded Mafishi as a comforter in times of distress and a befitting partner in happy times. We will never know the benefits Mafishi derived from his human species.

The passionate interest and solidarity by the University student community on the welfare of Mafishi, over the years would have one think that the Copperbelt University has a department of Ichthyology, a branch of zoology devoted to the study of fish. The revered fish died two days ago and the amount of grief and solidarity by the students and ordinary citizens is stunning.

It was the first time that Zambia’s political archrivals shared common views as both paid tribute to a legend and a University hero. UPND President Hakainde Hichilema was the first to offer condolences to the Copperbelt University on his Facebook page. “We stand with the CBU student community, past and present over the death of their iconic pet Mafishi”.

President Edgar Lungu posted on his Facebook; “The greatness of a nation and its moral progress can be judged by the way its animals”.

Lungu’s post however drew several criticisms with some bloggers accusing him of caring more for a dead fish than the dead Kwacha that was trading at K20 to one US$. Others aimed sling shots at him reminding the President how a University of Zambia student Vespers Shimuzhila was killed by Police without government taking action against the culprits. And yet others called him a hypocrite for talking about a bream but unwilling to tell the nation who was behind the gassing and ritual killings where hundreds of Zambians lost their lives.

Whatever fallouts or accolades that have followed after the death of Mafishi, one thing that is certain is that Zambians have been united in mourning of a fish. Mafishi has been canonized and has been placed on a fast track course to sainthood. May his fins rest in peace.

Jay Jay Banda dismisses party charges, suspension

SUSPENDED Eastern Province PF youth chairperson Emmanuel Jay Banda says some senior party leaders who are condemning him have fallen prey to tactics of the enemy.

Banda says PF’s enemies are not sleeping to unseat the ruling party.

He has told party secretary general Davies Mwila that, “… I do not stand guilty of any of those charges. The charge in court is unlawful assembly while in the letter of suspension you have indicated that the police have charged me with unlawful/illegal procession. Further, article 75, regulation 29(c) and (f) quoted in my suspension letter does not exist in the PF constitution.”

Banda is currently facing a charge of aggravated assault before the Lusaka Magistrates Court and another charge of unlawful assembly in the Chipata Magistrates Court.

Arising from those charges PF secretary general, Mwila suspended Banda from his position and gave him 14 days to exculpate himself.

In his four-page exculpatory letter dated August 25, 2020, Banda said the allegations that were leveled against him were still under judicial proceedings.

“In response to the allegations contained in your letter, your good office will note that, the subject matter is under police investigation, according to media reports and possible judicial proceedings. If the same is brought before a competent court of law, I intend to plead not guilty,” he stated.

Banda stated that the PF does not only uphold the values, principles and rights enshrined in the constitution but is led by one of the best legal brains in the country President Edgar Lungu.

“Our President’s fatherly leadership of both the party and the country conforms to the tenets and principles that support the rule of law, no matter the pressure from the court of public opinion whose aim is to falsely paint our party as one that tolerate lawlessness – may exert on him. I therefore take refuge in Article 18(2)(a) of the Constitution which enacts and I quote ‘every person who is charged with a criminal offence shall be presumed to be innocent until he is proved or has pleaded guilty’,” he stated.

Banda stated that his exculpation on the subject matter might prejudice an ongoing investigation and potential outcome of the court case.

“I therefore beseech your office to understand my reluctance to delve into the merits or demerits thereof, but plead innocence. What saddens my heart, as a loyal member of the party, is that some of our senior leaders in the party who have issued various statements to condemn me, against my innocence have fallen prey to tactics of enemies both within and outside who want to portray as if President Lungu is leading a party of wrongdoers in a bid to make him unpopular ahead of 2021,” he stated. “On my own behalf, I shall not relent to continue proclaiming my undying loyalty to President Edgar Lungu despite these machinations by these enemies to pour mud on my good repute, in a bid to deter me from campaigning and proclaiming the good works of President Lungu ahead of 2021 general elections and to the resounding victory of our humble leader. I remain steadfast to ensure that I spread the good news about our leader far and wide.”

And Banda claimed that the party’s enemies were doing everything possible to unseat the ruling party.

“Sir, our enemies are not sleeping in their efforts to unseat our mighty party – what is the best way to do that, discredit the youth leadership, peddle falsehoods against the mobilisers and foot soldiers. Why, because they know that the youth are the lifeblood of any political organisation. And a mobiliser of the youths must be ready for attacks like the one I am experiencing now,” he stated.

Banda also referred Mwila to the party constitution regarding his suspension.

“In an event that your letter decides to stand and in view of the fact that you are the authority to which all members must appeal against any disciplinary proceedings instituted against them, I draw your attention to Article 74, Regulations 27 and 28 of our party constitution which reads; 27… ‘The sanctions shall only be decided and applied by the party committees or organ to which the member in question belongs or by superior organs or committees. 28. A member shall have a right of appeal to a high organ against any decision as provided in regulation 41 and 42 of these regulation’,” he stated. “The question is, if I can be suspended by the office of the secretary general, a member of our party’s central committee on allegations that are subject to an ongoing investigation and not tested based on evidence, to whom shall I appeal without being seen to undermine your good office?”

Banda stated that rules of natural justice should be allowed before any decision was made against him.

“The allegation before me can only stand after a competent court has heard and determine charges levelled against me. Otherwise, I do not stand guilty of any of those charges. The charge in court is unlawful assembly while in the letter of suspension you have indicated that the police have charged me with unlawful/illegal procession. Further, article 75, regulation 29(c) and (f) quoted in my suspension letter does not exist in the PF constitution,” stated Banda./LM

WHY SHOULD I NOT BE HH’S RUNNING MATE …if that is what Zambians want – Kambwili

Why should I not be Hakainde Hichilema’s running mate if that is what the Zambian people want, says National Democratic Congress (NDC) leader Chishimba Kambwili.

And Kambwili said Kennedy Kamba’s statement that he was fired by President Edgar Lungu following advice from the Anti-Corruption Commission (ACC), said something about the President’s leadership.

Speaking with Daily Revelation over ruling PF member Colonel Panji Kaunda’s suggestion that opposition UPND leader Hakainde Hichilema must lead the alliance and have Kambwili as his running mate, Kambwili said he respected Colonel’s opinion.

“All I can say is I respect his opinion and if that is what the people of Zambia want why not? If that is what the people of Zambia want why not?” he said, while explaining the delay to announce progress on alliance candidates for the 2021 elections. “When you are going into an alliance you have to look at all avenues and all angles, so that what you create would not be broken by anybody. And right now what we are working on with UPND is look at all avenues so that what we are going to agree will never be broken.”

Kambwili said discussions had reached an advanced stage, and it would be wrong for him to divulge details without the permission of other alliance partners.

“We assure you that we have reached an advanced stage,” he said.

Asked on information that his party had proposed that they should be allowed to field candidates on the Copperbelt and parts of Luapula, Northern and Muchinga provinces, Kambwili insisted that it was not for him to comment on issues that have not been agreed and tabled before the alliance.

“We have reached an advanced stage and at an appropriate time we shall announce. I am a very organised person I only speak when time is ripe. I cannot kind of disappoint my alliance partners by divulging information that is still under discussion without the authority of the others,” he said.

Asked to comment on observations that the other opposition leaders had objected to joining the alliance on account of the weaknesses they had observed in both himself and Hichilema, Kambwili argued that life was about using other people’s weaknesses and turning them ones strength.

“It’s like going into a marriage, you are all coming from different backgrounds and angles and what is important is to understand ones dos and dons and respect his dos and dons. Agree to disagree so that you come up with one common agenda. And the agenda which is common in this race is to improve the living standards of our people,” Kambwili said. “So whatever differences that we have must be put aside. What is important is that we must do the right thing and change living stands of our people, industrialise the country, improve jobs.”

Kambwili said what destroyed leaders at the top was that they felt they had the monopoly of wisdom, saying he was viewed as an enemy when as minister he raised the issue of incorporating youths into the national service trainings, the same thing President Lungu was pushing for now.

He said he was saddened that President Lungu was embracing the issue now when he was “almost leaving office”, when it could have been implemented a long time ago.

“And some of us were fired from PF because of the strong stance on certain issues. There are a lot of things I didn’t agree (with) but was taken as if I opposed the President,” Kambwili said.

He wondered why President Lungu fired him without verifying information he was given by the ACC, as recently revealed by ruling PF provincial chairperson Kamba.

“What is Kamba telling us about the leadership qualities of President Lungu, that he can just be told by somebody, fire that person and he fires. Because as a leader you are supposed to analyse everything that you are given. President Lungu knew that I was a business man of high standing,” Kambwili said. “Surely to be accused of having about K6 million in my account will be something that I can fail to have when the business itself that I was doing was earning more than K6 million a month…mining on behalf of mining companies gives you more than K6 million a month.”

Kambwili said President Lungu must have analysed things, particularly that politics was riddled with jealousy and wanting to fix each other.

“President Sata would call you and verify with you, I have received this information, what are you saying about it? And he usually used to tell people can I have a report on this allegation. Sometimes he would call the accuser and accused come you say what you were saying,” said Kambwili. “But to hear that I was fired just because the Anti-Corruption Commission they ask people…what has come out is that I was fired innocently.”

Kamba recently said the ACC was being used by politicians to fix each other. He said the commission advised President Lungu to fire Kambwili, and turned him into an opposition figure. – Daily Revelation

In Kwaju-Abetifi, this title was conferred on a Chinese man, and some Ghanaians are not so enthused over the development.

Per custom, Sun Qiang, following his enstoolment, was given a traditional stool name — Barima Kofi Ayeboafo. The name Ayeboafo in Ghana literally means “one who has done something to benefit others”.

A grand durbar was held at the Kwawu-Abetifi Palace on Saturday to officially unveil Sun Qiang as the newly enstooled Nkosuohene of the traditional area.

Photos sighted on social media show Sun Qian being carried shoulder-high by some young men of Abetifi.

The Nkosuohene title was created in 1985 by the late Asantehene, Otumfuo Opoku Ware II, “as a catalyst for development in Kumase [capital of Ghana’s Ashanti Region] and beyond,” according to George M. Bob-Milliar in the academic paper, Chieftaincy, Diaspora, and Development: The Institution of Nkosuohene in Ghana.

Milliar adds that “since the 1990s, hundreds of African Americans and some white Westerners have been honoured with various royal titles.”

Basically, this is not the first time a foreigner has been given such a title, however, the selection of a Chinese man still comes with mixed feelings for several people as the Chinese have been accused of slowly taking over the continent.

China describes itself as a friend of Africa as it strategically offers a helping hand in the infrastructural development of the continent while it positions itself as a global superpower.

The Asian country has won the hearts of many African leaders and continental bodies with its several generous projects that have raised eyebrows among the international community and cynics who claim China’s interest in the continent is to overburden countries with debts to enable neo-colonization.

Among others, China built the $200 million African Union headquarters in Addis Ababa, Ethiopia in 2012 at no cost to the continental body.

China recently offered $6 million to Ethiopia to launch its first satellite into space in September 2019. It will also provide training before the launch of the satellite which will be done from China.

Senegal opened the world’s largest museum of black civilization on December 6 in the capital, Dakar, after 52 years of waiting due to lack of funding. China donated $34.6 million for the dream of the country’s first president, Leopold Sedar Senghor, to come into fruition.

In recent years, China has made huge investments in Kenya, such as the new railway linking Kenya’s capital, Nairobi, to the coast.

The story of HH having “sold mines” which was started by PF founder Michael Sata, has finally been ended by PF under Chagwa! God indeed works in mysterious ways!

Katele Kalumba, a former Finance Minister, clearly explained, of all TV networks, on ZNBC on how all the mining subsidiaries were sold and HH was not involved even remotely on all of them. The mines in Chililabombwe ( Konkala mine), the mine in Chingola ( Nchanga mine) and Nampundwe mine were sold to Anglo American on a cheap by government itself through ZPA to Anglo- American company without any HH or private individual involvement. Infact he explained that there was absolutely no willing buyer for these subsidiaries and he had to appeal to the ” moral side” of Anglo American executives and not “busines” reasoning for them to buy the assets.

Next the Nkana Mines in Kitwe ( Mindolo north and South Shafts) and Central shaft (in Wusakile) as was the Mufulira mine were sold to Glencore ( Mopani) thru ZPA. So HH was never involved in the sale of any mine in Chingola, Kitwe, Ndola, Mufulira, Chililabombwe towns. All these mines, as clearly documented were sold by Chiluba, Katele and co with no HH involvement. Not even remotely!!

In Luanshya, the mine was one of the earliest to be sold. It was sold in 1998 to RAMCOZ, an Indian company. Again, government thru ZPA sold the mine to the Indians and HH, who was 35 years old then, was never involved in its sale in 1998! Not even remotely. But the Indians failed to run it. After RAMCOZ that had borrowed money from a Zambian Bank, ZANACO ( It will be interesting to know how Indians borrowed money from a Zambian Bank, to buy a Zambian mine. Maybe Katele and Nawakwi will tell us), grabbed the mine and put it under receivership in order to recover it’s money. A Chris Mulenga acted on behalf of ZANACO as the receiver and sold the mine to J&W/ Enya in 2003. Enya failed to run the mine and RB sold it to the Chinese CNMC in 2009 who are the current owners. HH again was not involved at all. Even a cheap, desk research without even going to PACRA or ZPA now ZDA, would have given any one who is fair minded or really seeks the truth these answers. Even Grevazio Zulu and Mutale Mwanza and her HOT FM cronies can easily access this information if they honestly needed answers.

Let’s move to the house story. The Serval Road house. The story is that one day in early April of1995, way before his involvement in privatisation, HH came home from work tired, he removed his jacket and tie, threw himself in the sofa and asked his wife Mutinta for a glass of some cold Chibwantu and a copy of the Zambia Daily Mail which was delivered to his house. Mutinta lovingly obliged and brought the husband a glass of Chibwantu and a copy of the Daily Mail. While sipping the Chibwantu, HH perused through the Daily Mail and saw an advert by a Mr Chibwe of Ndola, seeking for bids for various properties including a house in Serval Road. HH responded to this advert in a government newspaper and put in a bid for the Serval Road house. Mr Chibwe in Ndola opened the bids and chose the HH bid which was the highest, as the winner and sold him the house a month later. HH’s childhood friend, and his UNZA room mate, Micheal Musonda, the current Deputy Chief Justice of Zambia, who was running a budding Law firm then did the conveyance for his house. Yes! HH gave some business to his UNZA friend to help him with the legal requirements. No story here.

Let’s now move to the Sun International story!! First of all, let’s agree that Sun International is not a Kapyopyo company. For starters, they own the Sun City resorts. Obama spent a night at the Cabanas Sun City resort as President when he visited SA. Oprah Winfrey spent a month at the ‘The Maslow’ Sun Hotel for a month. All those tuma Kora awards and other important events are held at Sun City resort centres. So Sun International is not a company like those lodges Chitalu Chilufya runs in Mansa built with stolen funds. They are a respected global brand.

So is a HH a shareholder?! Even a Grevazio Zulu or Zach Chavula and Mutale Mwanza led search at PACRA would reveal that HH is not a shareholder. The shareholders are Joanne Elizabeth a Canadian, Richard Ceasar a South African. So is there any conflict interest? Simple answer is that how can there be a conflict of interest when public documents, PACRA documents show that he was not and has never been a shareholder?? Remember, Sun International bought the hotel in 1997 when HH was just 34 years old!! Before then Livingston was dead. HH rekindled it through just one investment! A well packaged investment.

As Zambians, we should desist from this tendency of tarnishing and maligning good people and prop up known conmen. -ZWD

southerners

He says southerners should reject politics of tribe and should not look at Mr Hichilema as their only messiah or as being more Tonga than others.

Speaking in Livingstone when he held a meeting with party officials, Mr Mutale vowed that time has now come for southern province to deliver PF Members of parliament by rejecting tribal politics but embrace development oriented type of politics.

“President Edgar Lungu is ready and has consistently looked forward to bring change to Southern Province.We are equally ready and nothing will remain the same because this province is a ‘special case’ because we are here now” he said and encouraged for a spirit of one Zambia one Nation.

Mr Mutale wondered why Southern province, no matter how much development has taken place still remains unshaken but thanked President Lungu for his inclusive approach when it comes to taking development to all parts of the country despite the voting patterns.

“There is something different when you just cross Kafue” he observed but declared that not even social media lies and propaganda will distract his goal to ensure the province is liberated through a dedicated leadership under President Lungu.

Mr Mutale further said having worked with the UPND and personally with Mr Hichilema for a long time,fully understands that the opposition does not have any agenda for Zambia going by lack of a clear vision adding that time has now come for people to adopt an approach that encourages participatory governance devoid of tribalism or regionalism.

And Mr Mutale has castigated Mr Hichilema for his failure to play credible politics that instill confidence.

He wondered why the opposition leader has never commended the PF but always condemn despite the success which is visible to see in many sectors.

“You need to accept to be led by others if you wish to be supported when you become a leader”he said and called for an end to put tribe as a basis for someone to ascend to power.

MILLING AROUND WITH AN AXE TO GRIND – Sunday Chanda

Reference is made to a recent article “Zambia’s Zimbabwe Redux” wherein the writer gave his two cents regarding South Africa’s Finance Minister Tito Mboweni’s snide remarks on the appointment of a new Bank of Zambia Governor. This was before UPND leader Hakainde Hichilema brought privatization fires on himself – maybe its by God’s providence that this matter is being interrogated by Zambians, both young and old, today.

Coming to the issue for this piece, and never mind that Mboweni has since been severely reprimanded by his own Head of State -President Cyril Ramaphosa – for meddling in the affairs of a sovereign nation. The piece attributed to Greg Mills of the BrentHurst Foundation and published in sections of international media is at best simplistic and at worst morbidly disingenuous.

Simplistic for its disregard of Zambian statutory provisions for the appointment of a Central Bank Governor; disingenuous, because it is part of a poorly concealed scheme to trigger an erosion of confidence in Zambia’s Central Bank and the country’s economy as a whole.

It is part of elaborate regime change agenda that has been hatched to prop-up the political interests of Greg Mill’s “anointed candidate” Hakainde Hichilema, who just so happens to be defacto Life president of Zambia’s main opposition party –the United Party for National Development (UPND). Mill’s political interests arising out of common interests known between his foundation and the Zambian opposition leader explains his ad hominem attacks on the Zambian political leadership of the country’s ruling party and the newly appointed Central Bank Governor even as he awaits ratification by Parliament. His remarks have nothing to do with corporate governance.

On the other hand, they have everything to do with cheap attempts to lay a basis for op-eds with anti-Zambian sentiments across the regional and western media landscape, in which the country can be used as a bad case of “erosion of independence” of Central Banks in the Region.

RUNNING A MILL FOR REGIME CHANGE AT ALL COSTS

Is it a coincidence that Africa Confidential Volume 55 no. 23 in article, entitled “Foreign boost for opposition” claimed that some dignitaries and “South African businessmen” are bent on galvanising Zambia’s fractious opposition by uniting them against Zambia’s ruling party- the Patriotic Front (PF)?

The piece by the London based investigative journal outlines an alleged conspiracy linked to Brent Hurst Foundation – an institution headed by Greg Mills – to agitate regime change and facilitate the installation of Hakainde Hichilema as President of Zambia.

It alleges that Hichilema – perhaps Africa’s longest serving opposition leader with a highly questionable “rags to riches” story is being funded and supported by some South African mining interests that are apparently motivated to install him, having mobilised themselves to oust President Edgar Chagwa Lungu and Patriotic Front, whom they view as a major impediment to their schemes.

Mills and his South African mining interests are reportedly and allegedly bent on installing a “user friendly” Zambian President that would ostensibly be used as a proxy in their bid to take over Zambia’s state assets and resources.

Going by the Africa Confidential report, the blind prejudice of Greg Mills’ should come as no surprise. It is in fact par for the course.

BACKGROUND: THE MAZOKA, HICHILEMA, UPND & GREG MILLS CONNECTION

Before he retired and joined active politics in the year 2000, UPND founding President the late Anderson Mazoka worked for Anglo American Corporation (AAC) as its Chief Executive in Zambia.

AAC managed the Konkola Copper Mines (KCM) Nchanga Open Pit Mine and the Chililabombwe mine in Zambia’s Copperbelt Province, until 2001 when Mazoka lost Presidential elections to the Late Levy Mwanawasa. Is it a coincidence that after their erstwhile employee and business partner lost the 2001 Presidential election, AAC hurriedly packed its bags and left Zambia reportedly leaving thousands of mine workers in a lurch?

Fast forward, after the death of Mazoka, in 2006 a hitherto politically unknown Hakainde Hichilema controversially took over the reins of UPND in what was widely seen as an intra-party coup d’état inspired by tribalism, regionalism and nepotism.

Considering Hichilema’s rather curious campaign promise of 2015 that he would “bring back Anglo American Corporation to KCM if elected into office” coupled with Greg Mill’s alleged interests in Anglo American Corporation, would Mills be expected to be anything other than uncomplimentary about Zambia?

Court Case Impedes Jay Jay From Exculpating Himself

SUSPENDED Eastern Province PF youth chairperson Emmanuel Jay Banda says it is difficult for him to exculpate himself because his case is before judicial proceedings.

Mr Banda is facing an aggravated assault case in Lusaka and unlawful assembly charge in Chipata.

Arising from those charges, PF secretary general Davies Mwila suspended Banda from his position and gave him 14 days to exculpate himself.

In his exculpatory letter dated August 25, 2020 and received by the PF secretariat on September 4, 2020, Banda stated that his matter was still under judicial proceedings.

“In response to the allegations contained in your letter, your good office will note that, the subject matter is under police investigation, according to media reports and possible judicial proceedings. If the same is brought before a competent court of law, I intend to plead not guilty,” he stated.

Banda stated that the PF does not only uphold the values, principles and rights enshrined in the Constitution but is led by one of the best legal brains in the country, President Edgar Lungu.

“Our President’s fatherly leadership of both the party and the country conforms to the tenets and principles that support the rule of law, no matter the pressure from the court of public opinion whose aim is to falsely paint our party as one that tolerate lawlessness-may exert on him. I therefore take refuge in Article 18(2)(a) of the constitution which enacts and I quote ‘every person who is charged with a criminal offence shall be presumed to be innocent until he is proved or has pleaded guilty’,” he stated.

Banda stated that his exculpation on the subject matter might prejudice an ongoing investigation and potential outcome of the court case.

“I therefore beseech your office to understand my reluctance to delve into the merits or demerits thereof, but plead innocence. What suddens my heart, as a loyal member of the party, is that some of our senior leaders in the party who have issued various statements to condemn me, against my innocence have fallen prey to tactics of enemies both within and outside who want to portray as if President Lungu is leading a party of wrongdoers in a bid to make him unpopular ahead of 2021,” he stated.

Banda pleaded that he shall not relent in proclaiming his undying loyalty to President Lungu.

“On my own behalf, I shall not relent to continue proclaiming my undying loyalty to President Edgar Lungu despite these machinations by these enemies to pour mud on my good repute, in a bid to deter me from campaigning and proclaiming the good works of President Lungu ahead of 2021 general elections and to the resounding victory of our humble leader. I remain steadfast to ensure that I spread the good news about our leader far and wide,” he stated.
And Banda claimed that the party’s enemies were doing everything possible to unseat the ruling party.
“Sir, our enemies are not sleeping in their efforts to unseat our mighty party- what is the best way to do that, discredit the youth leadership, peddle falsehoods against the mobilisers and foot soldiers, why, because they know that the youth are the lifeblood of any political organization. And a mobiliser of the youths must be ready for attacks like the one I am experiencing now,” he stated.
Banda also referred Mwila to the party constitution regarding his suspension.
“In an event that your letter decides to stand and in view of the fact that you are the authority to which all members must appeal against any disciplinary proceedings instituted against them, I draw your attention to Article 74, Regulations 27 and 28 of our party constitution which reads; 27. The sanctions shall only be decided and applied by the part committees or organ to which the member in question belongs or by superior organs or committees. 28. A member shall have a right of appeal to a high organ against any decision as provided in regulation 41 and 42 of these regulation. The question is, if I can be suspended by the office of the secretary general, a member of our party’s central committee on allegations that are subject to an ongoing investigation and not tested based on evidence, to whom shall I appeal without being seen to undermine your good office?” he asked.

The UPND Provincial leadership led by its Chairperson Mr Elisha Matambo have thanked the Lufwanyama residents for their natural love towards HH.

Mr Matambo who is on the tour of all the Six wards affected by the artificial by elections in two districts namely Lufwanyama and Mpongwe.

5 of the ward by elections are in Lufwanyama where his office has so far toured three.

Mr Matambo told the people of Lufwanyama that the UPND government through its president Mr Hakainde Hichilema will continue with Late Mwanawasa’s fertilizer program and improve on it. He said that HH comes from the rural background and he understands the farming setup and how important it is in a country like Zambia. He said Lufwanyama is dominated by farming as the main economic hub and thus the UPND under the leadership of HH will assist with all the necessary supports.
He also said that HH is who he is today because of free education he received from the UNIP government and that’s what he wants to give as well when in power.

Mr Matambo told the people of Lufwanyama in all the 3 wards he visited that the bridge to HH winning 2021 is to retain all the councillors unconditionally without fail so because there is nothing that the PF have done in Lufwanyama to come and lie.

And Copperbelt Provincial Chairlady Mrs Lillian Musonda said that as a party it’s unfortunate for the PF to subject the people of Lufwanyama to unnecessary by elections at the expense of them being productive with this bad economy caused by the uncaring government.

Lufwanyama Mayor His worship Hon Kiyuka told the residents that they should never trade their kids future for a K20 or a bag of meali meal that whatever PF brings they should get but on 17th September the vote must be for all the UPND candidates because those are the people representing HH.

Lufwanyama UPND member of Parliament Hon Lernard Fungulwe said that this is the last time the people of Lufwanyama are being subjected to this because when HH gets to state house there won’t be councillors resigning like it is now.

The Copperbelt UPND has divided all its District leadership into wards with a solid mission of retaining all the seats.

Woman marries self, this is how much the wedding cost

A single woman who grew tired of being asked when she was getting married has made the extraordinary decision to tie the knot to herself.

Oxford student Lulu Jemimah, 32, was fed-up of her family lecturing her on the importance of settling down with the right man.

But marriage is the last thing on her mind as she studies a masters in creative writing at the prestigious university.

So, in a bid to get her parents off her back, she decided to stage a mock wedding and sent formal invites out to her nearest and dearest.

She hired a dress, walked through the venue to the traditional wedding march and even gave a speech to her guests explaining the lack of a groom.

The entire day cost just £2 – for her taxi to the pub venue – as she managed to get the rest of her big day for free or as gifts from friends.Proud singleton Lulu said: ‘I have a strong passion in life and I am committed to achieving my goals at becoming an academic.

‘But all my family wanted to ask me was when I planned to get married – which is very important back in Uganda – followed by when I would be having children and starting a family.

‘My father wrote my wedding speech when I turned 16. Every birthday my mother prayed for me and in recent years this has included a plea for a good husband.The blushing bride on her wedding day. Lulu admits her Ugandan parents are baffled by her decision – but said she feels it was the perfect commitment to herself and her studies

‘One of my closest friends Karin reminded me that I had a lot to celebrate this year like getting into Oxford and I joked that I would show up in a wedding dress,’ she said.

‘We had been talking about this marriage pressure and she loved the idea so much that she offered to get me the wedding gown.

‘Then I decided, you know what weddings seem so important here – I will marry myself.’

‘It’s shocking the price of wedding gowns in Uganda but when I told them I was marrying myself they offered to find me their cheapest dress.

‘I did feel a bit crazy trying on the dress and explaining that I was marrying myself. There was a kind of dismissive tolerance from the girls in the bridal shop.

‘I had to leave an ID card behind and when they saw my Oxford university card they screamed and were so impressed. I tried a few on and I almost cried.

‘It really is a special moment and I understood more than I had the excitement around weddings.’

Oxford student Lulu is currently crowdfunding to help pay for her tuition. She explained: ‘I constantly tried to look for scholarships, grants and [have]even contacted embassies and government bodies’

A friend did Lulu’s makeup in the loos at the venue, and the bar owner – also a friend – played the wedding march as she exited the toilets and walked into the venue.

‘I then spent a few minutes talking to friends and awkwardly explaining that there was no groom – most of them knew by this point,’ she said.

Another friend played the roll of the vicar as Lulu staged a mock exchanging of vows with herself in front of around 30 guests.

‘I was extremely happy,’ she said. ‘So many friends showed up, as well as international and local journalists, film directors and feminist entrepreneurs.

‘Marriage is an expression of love and commitment, however for many people back home, it is still considered the only way to guarantee a woman’s financial security.’

‘I had worried about coming off as stupid but to have such a strong intellectual group of friends behind the idea, that was all the validation I needed for the choices I have made.’

Her parents didn’t attend the big day but she did go and see her mother to explain her choice.

‘I considered taking out a loan but was told, as an international student, I was not eligible.

‘From the generosity of 279 people (many friends, most strangers), I managed to secure the first year’s tuition. I am now crowdfunding to pay for my full second-year tuition.’-Daily Mail

Had Mugabe been still ruling Zimbabwe, “I don’t think it (life) would be like this,” said the woman, in her late 20s, waiting to receive a portion of cooked beans and white maize meal in the working-class town of Chitungwiza, 30 kilometres south-east of Harare.

“He was far much better,” said the unemployed Mandimutsa, who was born after Mugabe was already a decade in power.

Another woman in the queue echoed her sentiments.

“Ever since the new president took power, I have not seen anything positive,” said Diana Nhemachena, also in her 20s, bemoaning the high cost of living in the country where official inflation is more than 800 percent.

Mugabe died aged 95 on September 6 last year in a Singapore hospital, two years after he was ousted in a 2017 military coup, and after 37 years in power.

Zimbabweans thronged the streets celebrating his ouster.

His successor Emmerson Mnangagwa came in with promises to fight corruption, revive the moribund economy and reduce poverty.

But many Zimbabweans say they are worse off than they were under Mugabe despite his creating an authoritarian regime which savagely repressed opponents.

He is also remembered for implementing controversial land reforms 20 years ago that resulted in economic collapse.

But far from being the expected messiah, Mugabe’s former deputy Mnangagwa has also become known for brutally crushing his opponents.

A month ago, he threatened to “flush out” critics, describing them as “bad apples” and “dark forces” two weeks after opposition politician Jacob Ngarivhume and journalist Hopewell Chin’ono were arrested on charges of incitement to commit public violence.

Ngarivhume’s crime was calling for non-violent protests on July 31 against state corruption and Chin’ono tweeted in support of the planned demonstrations.

They were released on bail on Wednesday after 43 days in detention.

Other critics, including Zengeza West MP Jacob Sikhala, are still being held.

In January last year, soldiers shot dead 17 people following protests sparked by the doubling of fuel prices.

Political analyst Cyprian Ndawana said many people are struggling more now than they were under Mugabe.

“The citizenry is roundly impoverished, reduced to a lifestyle of ferreting for basic sustenance,” Ndawana said. “It is now a headache to be alive. Life is a grind. It is now a mammoth task for households to score the minimum goal of putting food on the table.”

Zimbabwe’s economy improved during a power-sharing government between Mugabe and the main opposition Movement for Democratic Change, but since the deal crumbled in 2013, the economy has been on a downturn.

Last week the government unexpectedly announced plans to give some land back to white farmers.

The announcement created confusion and forced the government to re-issue statements clarifying the plans.

It later emerged that only 37 of more than 4,000 farmers who were evicted would be eligible for the reinstitution of title to their land. They are a special group of foreign farmers who enjoyed protection under an international investment deal.

For Harare-based independent economist Gift Mugano, while “Mugabe was not good … the current government has gone further than Mugabe.”

“Nothing has changed apart from the fact that the current government has gained more experience in killing the economy,” Mugano said.

Zimbabwe set to return land to white farmers after $3.5 Billion compensation

The government of Zimbabwe has in recent times locked itself in a critical position by taking an unpopular move that’s generating a lot of criticisms from both locals and people across the world.

Ex-President Mugabe initiated the lands reform program decades ago to address issues surrounding the forceful colonial-era land captures by the powers in Zimbabwe; the initiative saw the seizure of lands from white farmers and the resettlement of black farmers in the country. This attracted series of sanctions from the many western countries thus crippled the economy of Zimbabwe.

However, the current administration is taking measures to an extent, reverse this policy. Initially, the government was gravely criticized over the decision to compensate white farmers with a sum total of $3.5 Billion for the value they have added to the lands that were retrieved from them during the implementation of the reform program under the Mugabe’s regime.

The current development is the government’s decision to return lands to foreign farmers protected under Bilateral Investment Promotion and Protection Agreements (BIPPAs), signed between Zimbabwe and their ancestral countries. The announcement which was made on Monday indicated that white farmers who lost their farms under the country’s ex-president Mugabe can now apply to retrieve them.

In a joint statement, the Finance Minister Mthuli Ncube and Lands and Agriculture Minister Anxious Masuka revealed that Government would “revoke the offer letters of resettled [Black] farmers currently occupying those pieces of land and offer them alternative land elsewhere”, the statement said.

They further added that “Where the situation presently obtaining on the ground makes it impractical to restore land in this category to its former owners, government will offer the former farm owners alternative land elsewhere as restitution where such land is available.”

A spokesperson of the government, Nick Mangwana clarified that the planned restitution will not cover all the white farmers. “Some of the previous owners had already been compensated from the previous government. For example, the Dutch farmers were being paid over the years. They may get that land or replacement land elsewhere instead of compensation.” He said on Twitter.

The decision however divided public opinion; to some Zimbabweans, it is unfair to compensate the white farmers, talk less of the thought of retrieving lands from the locals and giving such to foreigners looking at the fact that, black farmers were not compensated when the lands were grabbed during colonialism. The other divide of the opinion pool posited that the government is implementing these measures to mend relationships with the West and get the sanctions reversed. I AM VERY UPSET WITH EDGAR TODAY-

It is my policy not to discuss politics on a day like this, rather I talk good about the pushing Bill 10 to go back to parliament that have been waited for so long or motivational issues. However, people make rules and not vice versa. Where it is NECESSARY you have to adjust the rules for the good of society.

I want to warn myself that I have not yet declared support for His Excellency President Edgar Chagwa Lungu. I also want to review to you that I have hard a close relationship with the PF but I am not a PF member for the simple reason that I want to retain my freedom to speak out freely when the PF or any political party mess up like Edgar have done to the Zambian Kwacha.

I also want to add that, what I am going to say is not about inconsistency on my part but inconsistency in circumstances. When things change, I should not be the same. I believe in a saying that, a wise man changes his mind.

Firstly I want to sympathize with Edgar because I am convinced he means well with other things but not where leadership concerns and he is not good to lead Zambia beyond 2021. However, I feel he is being too hard and over confidence about certain people around him and in cabinet.

I doubt Edgar will read this, but just in case, I want to tell him that he might cry 2021 if he continues being flocking with people who have openly shown him to support Hakainde Hichilema in approaching issues such of Privatization. HE NEEDS TO BE MORE DECISIVE AND CLINICAL in the way he handles issues and people. He has to time to play mediocrity. Politics is about numbers and every voter counts, losing one person is getting closer to losing power.

Yes, Edgar may look for money, which he (ECL) and PF don’t have for now to support him for Aug 2021 Elections. I believe HH has more money than PF. So if you think it is money I want, trust me I know where I can get it.

What are my issues which has made me unhappy with Edgar today, tomorrow is another day you never know? Believe it or not, I hate lies. You lie to me or other people, my confidence in you drops rapidly like ice on a hot pan. A number of PF senior members lie that they bought me a Car so that I can support ECL in writing articles for Times Of Zambia and I am speaking from many complaints I have received from the grassroots and my own experience. So if one day I mention names in public don’t take it personal you have to prove it yourself.

The other issue is selfishness, a lot of PF members are complaining that only a few are eating in PF while the majority who have worked for the party have benefited nothing. Even new comers have by-passed them to sit on the dinner table with the President while they remain on the fence peeping to HH like squirrels .

Don’t kid yourselves that politics is about service in a poor Country like Zambia with high unemployment. Imagine the miners who lost jobs are getting nothing out of PF, how do you think they would survive. This is why people want jobs so that they would have a living. Think of those who are not employed but they are you cadres, how are they surviving?

The other thing is respect for others. A lot of PF senior members especially those in Government behave like they are angels of small gods and they have lost respect for those outside who need their help and attention.

Patriotic Front (PF) Deputy Secretary General Mumbi Phiri has advised youths in Lukashya Constituency in Kasama district not to allow any blood-thirsty UPND leader to use them to spill blood in the Bembaland over politics.

Speaking on Radio Mano today, Mrs Phiri said the named political party has a well-documented record of fueling confusion during elections.

” We don’t want to lose the lives of youths in Lukashya over politics. As a parent, l want to advise our youths not to allow any politician to give them money to spill blood. We need to show the rest of the country that we are peaceful in PF strongholds. There is no need of spilling blood of anyone,” Mrs Phiri said.

She urged all registered voters in Lukashya Constituency to turn out in large numbers to vote for Mr. Chisanga in next Thursday’s parliamentary by-election to avoid voter apathy.

Mrs Phiri, who has clocked four years in her position, said time has come for the people of Lukashya to work closely with the PF in developing the area through its robust development programme.

” l am appealing to the people of Lukashya to vote for Mr. George Chisanga. He is a very hard working and loyal member of PF. Big Mule (Davies Mulenga), who has gone to UPND, found Mr. Chisanga in PF.

” We know that Mr. George Chisanga is winning on September 17 but we need to vote in big numbers. It is important for us the people of Northern, Muchinga and Luapula provinces, including our brothers and sisters in Eastern Province, to take the issue of voting seriously, like the people of Southern Province,” she said.

Mrs Phiri said voter apathy is retrogressive and should not continue in PF strongholds ahead of the 2021 general elections and all by-elections.

Meanwhile, Mrs Phiri has commended former Finance Minister Edith Nawakwi for opening up the eyes of the Zambian people over the manner UPND leader Hakainde Hichilema mismanaged the sale of Sun International Hotel in Livingstone during privatisation.

“Hon. Nawakwi has set the bar. She is a woman of integrity. The question is..where is the ACC to deal with the issues Ms Nawakwi has raised? These are the issues ACC should be dealing with. What are they waiting for?

” Privatisation has really affected our lives. We suffered because of privatisation. There are many people who have died because of the same privatisation. We had companies like National Milling which were privatised but the people who bought houses were not employees of National Milling,” Mrs Phiri said.

She said time has come for Zambians to know the truth about Mr. Hichilema’s source of wealth and how he ended up being party of a company he was engaged to sale on behalf of Government when he served as transaction advisor.

Mrs Phiri said former RAMCOZ workers in Luanshya are still suffering because of the selfishness of some people who mishandled the privatisation process.

She said the privatisation issue will not die until those who enriched themselves are held accountable.
