Nkombo confirms mass by-elections after councillors got teacher jobs

I CAN confirm firmly that a number of by-elections are coming as a result of councillors from both the PF and ourselves who have got jobs as teachers, says Gary Nkombo.

The Minister of Local Government and Rural Development said insinuations from some MPs that one can be a teacher and an area councillor at the same time is confirmation that the country had cases in the previous regime where a teacher was a district chairman for a political party.

He however, said the new dawn administration is a government of laws.

Nkombo said this on Friday during the Suspension of Standing Orders 27 and 115 of the National Assembly of Zambia to enable the House to sit until all business on the Order Paper has been concluded on each sitting day.

“Madam Speaker, I heard one of the colleagues say it is time for them to go and explain that there is no money that has been allocated and used under the CDF. Very surprising. But also I am a believer in the fact that depending on where you are standing, you see the world differently. And if what you are seeing is not reality, Madam Speaker, there is an English description which is called an illusion,” he said. “And if you are living in an illusion, it is time to face reality. The reality of the matter Madam Speaker is that, as I speak to you now, as the Minister responsible for Local Government and Rural Development, I can confirm firmly that a number of by-elections are coming as a result of councillors from both the PF and ourselves who have got jobs as teachers. Isn’t that an encouragement to members of the society? Madam Speaker, someone says they can do both. It is clear that under the old regime, we had cases where a teacher was a district chairman for a political party.”

Nkombo stressed that anyone who takes a partisan position must not be in the civil service.

“We are, excuse me, we are a government that observes laws. And anybody who takes a partisan position must not be in the civil service. That is what order is all about. As we go, the sabbatical is very short. It’s about a month or so and I am urging all members to come out of the illusion. Those who are in the illusion, to go and just put a signature on the government programmes that are a life changing experience for our people,” he said. “I heard finally the issue about how we must explain the issue of the increasing prices of fuel. Again it is an illusion because this is happening in the whole world. We had, Madam Speaker, the President of Italy who sat right there where you are and he confirmed that even in Italy the prices of fuel are escalating.”

At this point, Shiwang’andu PF member of parliament Stephen Kampyongo rose on a point of order to question if Nkombo was in order to attempt interpreting the Constitution regarding the councillors in question.

“The honourable minister has decided to start touching on matters that boarder on the Constitution. When he starts talking about teachers who have been recruited, and are already elected councillors and he is intimating to the nation that we are going to have mass by-elections, he takes a different twist. Madam Speaker, these are constitutional matters and it’s not for him to interpret how the Constitution is crafted as far as those office bearers are concerned,” said Kampyongo. “Further, when we said members should be made to visit the constituency, we were not saying increases of fuel, which he is now trying to twist saying we said we are going to explain for people to know what is happening. Is the honourable minister in order to turn this motion into controversy and start interpreting the Constitution as far as the councillors are concerned and mislead the nation that we are going into mass by-elections?”

Nkombo, after the Speaker reserved the ruling, “apologised for saying the truth”.

He told MPs from the opposition that it does not take away anything to go and explain government policy to the people.

“And my encouragement to colleagues in the opposition is to go and tell the constituency the truth. Because we are now going to basically, we are products of an election. As the councillors got the jobs in the civil service, they resigned. And if they resigned, what else do you expect? But I apologise for telling the truth,” he said.

Regarding Constituency Development Fund, Nkombo said some constituencies during the previous regime would spend two years without receiving the K1.6 million.

He however, boasted that the UPND government has disbursed K6.3 million to every constituency.

Nkombo reiterated that the disbursement of the funds would be quarterly.

“This is what I meant when I said the truth has no disguise. Please just take your head out of the sand like an ostrich and tell the people the truth that this government is working. Go home, that is my final appeal. Don’t sit here in the city honourable members of parliament. Go home, no one will harm you there,” said Nkombo. “Go and have freedom in your constituency. Don’t hide in the fact that there is public order Act. This is a different government which is promoting the freedom of association, freedom of expression.”

The results announced in the early hours of today, put Mr. ZULU ahead of his two competitors; SOKWANI CHILEMBO and GREGORY GORNHILL.


And NGOSA MULENGA-SIMACHELA has scooped the position of LAZ Vice President.
Chief Justice MUMBA MALILA, who was the guest of honour at the LAZ Gala, has appealed to the new LAZ Council to ensure the issue of law reforms is taken seriously.

Here is a brief about Lungisani.

Mr. Lungisani Zulu holds a Master of Laws Degree (LLM) in International Commercial Law from the Ivy League’s Cornell University School of Law, New York and a Bachelor of Laws Degree (LLB) from the University of Zambia (UNZA) and is an Advocate of the High Court of Judicature for Zambia with audience before the Court of Appeal, Constitutional Court and Supreme Court of Zambia and is also a Commissioner for Oaths.

He is a Zambian legal practitioner with 10 years standing on the Roll of Legal Practitioners, having celebrated and rejoiced his practiced at Messrs Tembo Ngulube & Associates, as an Associate Partner while serving as a Lecturer at the University of Zambia’s School of Law Faculty and subsequently took up the role of Senior Legal Counsel at the Bank of Zambia, the country’s Central Bank, thereby acquiring vast experience in banking regulation, banking and finance, In-House Board advisory, cooperate governance and regulatory matters related to the financial sector and other cross-cutting issues.

PS EDUCATION WEIGHS IN ON THE ACCOMMODATION ISSUE OF TEACHERS

The editorial comment in the Mast yesterday relied on former Education Minister Dr. Kaingu who raised concerns regarding accommodation for the newly recruited teachers. The paper agreed with his concerns as evidence abounds that there is a general shortage of infrastructure of any kind in this country.

Yes, the President has commented on this issue before challenging the private sector to move in and fill the void. It is a viable option but easier said than done. It is possible but not as fast as recruiting teachers which has been done within months. You cannot build or find houses to accommodate 30,000 teachers in months! It is impossible.

The reality is found in what PS Education said, namely, that government has heard the concerns of the stakeholders and that government will be engaging them so that together the solution could be found. He said government was aware that when it offered free education, there will be need to recruit more teachers which naturally would demand an increase in accommodation.

In other words, government does not have immediate answers or solutions to the problem of accommodation brought about by its decision to recruit such a huge number of teachers in one swoop. The answers lie in the consultation with like-mined policy networks. So, for those of you obsessed only with the news of the recruited teachers, I have news for you: unless or until you sober up and help government find answers to the problem of teacher accommodation, the policy decision will fail.

It will fail because some teachers will not remain in their allocated geographical areas because there will be no place to live. This is one of the classic examples of why public policy fails: failure by other members of the policy network to play their respective roles. Do not drown voices of reason and caution that are alerting the powers that be to the looming threats against what is otherwise a welcome development in service delivery and fulfilment of election promises.

My challenge to the media is embark on the next phase of this story by sharing experiences from the newly recruited teachers and the communities that await them. When we know this back-end of policy delivery, relevant authorities shall be in a better position to deploy timely interventions to correct any threats to the successful implementation and delivery of public policy.

UPND Govt deliberately arresting its critics to mask its failed election campaign promises- Former Luanshya MP Steve Chungu

Former Luanshya Member of Parliament Steve Chungu has said the UPND led Government is deliberately arresting its critics in order to steal people’s attention from its failed election campaign promises that includes lowering the cost of living.

Mr. Chungu said the New Dawn Government wants people to forget about promises it made to Zambians prior to the last August elections.

The former Government Chief Whip in the PF regime said people will not stop reminding the UPND Government to lower the cost of fuel, prices of essential commodities and the cost of fertiliser as promised when in opposition.

Mr. Chungu said instead of fighting critics the government must up its game and find ways of improving the welfare of suffering majority poor Zambians.

“We are not going to stop talking. We will continue reminding them to fulfill promises made to the people of Zambia. It was their word. Not our words, not the people’s words. They are the ones that promised so we are just reminding them to fulfill promises. The simple task that we are carrying out is to remind them and I have always said that these arrests everyday are not going to take the country anywhere. These arrests are not exciting to any Zambian. I repeat these arrests are not exciting to any Zambian. We know why, you know the arrests will continue, the news of stealing will continue. It is because they want the Zambian people to forget about promises but we are not going to forget,” Mr. Chungu said.

“We will not be drifted out from those promises because we are feeling the pain of hunger. The government should be reminded that the people are not happy because of the sufferings they are going through. The government better up their game and look at how they are going to run the economy. Maybe in the way they are going to be taxing the mines they change so that we receive more money from the mines, we receive more money from our mineral resources than the way it is. We don’t have medicines in hospitals because we are not collecting money from our mineral resources. So, who is to blame? It is them to blame so we are reminding them to collect more money from our copper being mined,” he said.

Meanwhile, Mr. Chungu has charged that there is no rule of law under UPND because like the PF it is also abusing the police.

He said it was unfortunate to hear Home Affairs Minister Jack Mwimbi issuing threats against private citizens who wanted to protest in Lusaka recently over the removal of mobile money booths from the town centre by the Government.

Mr. Chungu said the Government should not view people with divergent views as enemies saying Zambia is not a one party state.

“There is no rule of law. The only thing the UPND is doing is arresting people. What else are they doing apart from arresting people. The same police that were being used by the PF are the same police that they are using and nothing has changed according to me. Citizens are being threatened by the Government. If you protest you will be arrested. You will be dealt with. This is the same way it was under Honourable Stephen Kampyongo as Minister of Home Affairs it is the same way under Honourable Jack Mwimbu. It is threats to the public and no member of the public speaking against government is being spared,” Mr. Chungu said.

“Government has to be ready to be criticized. They have to be ready to accept that each and every person has got their own opinion and that opinion must be respected. We have a constitution that gives us the right of freedom to speak and that should be respected. It doesn’t mean that when people speak against them then they are insulting them. We are just reminding them of their many failures to fulfill the promises and the Zambian is waiting to see those promises being fulfilled,” Mr. Chungu concluded.

The Chipolopolo boys will this afternoon (Sunday) battle with the mambas of Mozambique in the first round, first leg encounter of the Algeria 2023 African Nations Championship (CHAN) at the Estadio Do Zimpeto at 15:00 hours.

The Garden House Meeting- The Birth Of A New Zambia

THE GARDEN HOUSE MEETING-THE BIRTH OF A NEW ZAMBIA

From 1964 onwards Zambia was ruled by United Party for national Independence (UNIP), but by the end of the 1980s and with increased economic woes Zambians were tired and especially after sacrificing a lot in liberating southern Africa from colonial oppression, change was needed. People showed their dislike for the UNIP regime through different means including violent one like the 1986 food riots on the Copperbelts, similar riots in June 1990 and a near coup in the same month. After the near coup on June 30 1990 by a disgruntled soldier Mwamba Luchembe, Kaunda’s eyes were open to reality for change. There was need for a constructive development to prepare a pathway for this and two individuals pioneered this cause; Akashambakwa Mbikusita – Lewanika and his friend Derrick Chitala (now Mbita Chitala). They prepared anew roadmap which was to usher in a new Zambia from the old UNIP Kaunda way to a Zambia that would embrace freedom and an open market. That new Zambia which is still alive to today was born on 20 July 1990 at a meeting at Garden house hotel and that meeting was called Garden House Hotel meeting.

Garden House Hotel meeting was convened by Akashambatwa Mbikusita-Lewanika and Mbita Chitala. The gathering included various groups: academia, trade unions, Law Association of Zambia (LAZ), student bodies, civil society and disgruntled former UNIP leaders. The movement’s first task was to fight for the re-introduction of multiparty politics after 18 years of UNIP’s one-party rule. Arthur Wina was chosen as the interim president for the new party to be born: MMD. He lost to trade unionist Fredrick Chiluba at the party’s convention. Chiluba went on to become Zambia’s second republican president.

The movement became a political party following the repeal in 1990 of Article 4 of the Republican Constitution to allow for the formation of parties other than UNIP. Growing opposition to UNIP’s monopoly on power, due in part to economic problems, led to the formation of the MMD. The liberal democratic wave that swept through Africa after the collapse of the USSR and communist regimes in eastern Europe spelled an end to several one-party states and military governments on the continent.

Prof Momba writes that, “More simply, however, it might seem that most people wanted a change after 27 years of UNIP government, and MMD leaders won public support by exploiting both this ‘voter fatigue’ and the global shift away from one-party systems.”
After registration on 4 January 1991, MMD’s focus shifted to ending UNIP’s 27-year rule. Multi-party general elections were held on 31 October 1991, which saw the MMD sweep to power in a massive landslide. Chiluba was elected president with 76% of the vote to Kaunda’s 24%, whilst the MMD won 125 of the 150 elected seats in the National Assembly.

Local Government Service Commission Audit Reveal 41 Ghost Senior Management Workers At The Lusaka City Council

LOCAL GOVERNMENT SERVICE COMMISSION AUDIT REVEAL 41 GHOST SENIOR MANAGEMENT WORKERS AT THE LUSAKA CITY COUNCIL.

LUSAKA – JULY 23, 2022

LOCAL Government Service Commission chairperson Ackson Sejani says there are 731 Lusaka City Council employees who were irregularly employed.

Updating journalists on the staff audit conducted at the Lusaka City Council earlier this year, Mr Sejani said the council, in total, employs 1, 224 people in division one to three categories out of which 331 were illegally employed while 400 have either wrong academic qualifications or facing disciplinary charges.

Mr Sejani said there were 53 audited officers who did not have full Grade 12 certificates with 46 of them in middle and senior management positons.

According to Mr Sejani, of the 731 council officers who are not in good standing with the Local Government Service Commission (LGSC), 300 division three officers were illegally employed as cashiers and revenue collectors.

“The recruitment of division one to three officers in our councils is the responsibility of the Commission. However, in Lusaka, over 300 cashiers and revenue collectors were engaged through the backdoor,” Mr Sejani said.

“The council uses division four general workers as cashiers and revenue collectors. This seriously undermines the work of the Commission.”

He said over 100 employees at Lusaka City Council have not been confirmed far beyond the stipulated period of probation with some going for more than 17 years when the legal probation period is three to six months.

He added that 46 members of staff at the council are on study leave and that 40 of those did so without the authority of the LGSC while 18 members of staff are on suspension for various offences.

Mr Sejani disclosed that a staff audit also revealed that there are 20 vacant positions and that those positions would be filled up, in due course, through an advert by the LGSC.

He further said the LGSC toured selected markets in Lusaka city where they found “the real rot of bloated labour forces and discovered workers who are paid monthly salaries despite their contracts having expired many years ago.

“The large body of general workers who are irregularly and illegally engaged as cashiers and revenue collectors are seriously ill-qualified to do this job for which they were not trained. They lack the know-how as well as the ethics necessary for their jobs. There is also a large number of general workers who are unpaid for up to 17 months but getting pay-slips every month,” Mr Sejani explained, adding that local authorities around the country need to be cleaned up.

“This state of affairs is largely responsible for the massive revenue leakages dogging the Lusaka City Council. Many councils sit on gold, if financial loopholes are sealed. Councils are crying out because there is leakage of revenue and there is need to digitalise revenue collection.”

Mr Sejani disclosed that if one added division four workers (general workers), the Lusaka City Council has over 4, 000 employees.

On the way forward, regarding the highlighted findings at the Lusaka City Council, Mr Sejani said employees who are holding inadequate Grade 12 certificates must immediately upgrade themselves or face removal from their positions.

“This country must take qualifications very seriously. The Zambia Qualifications Authority and the Examinations Council of Zambia must be part of the escalation of the audit. Many of the qualifications being waved before our eyes need serious authentication. This goes for both locally and foreign obtained qualifications,” said Mr Sejani.

Susan Mutami repeats allegation that Mnangagwa sexually abused her when she was 15

Controversial Australia based philanthropist Susan Mutami has repeated her claims that she was sexually abused by President Emmerson Mnangagwa inside a Jeep vehicle in 2005 when she was only 15 years old.

Mutami made the allegations yesterday (Friday) while addressing a Twitter space that was attended by more than 12 000 people.

She claims Mnangagwa who was only a Cabinet Minister at the time, forced her to suck his manhood while they were inside green jeep vehicle that looked like a military issue.

She even proceeded to describe how the President has light skin from the area of his knees up to his groin area, presumably seeing this because his trousers were down.

Attempts to report the abuse to Mnangagwa’s wife Auxillia were in vain as she claims the now First Lady accused her of being a prostitute.

Mutami went further to explosively allege that she had an affair with the late Foreign Affairs Minister Sibusiso Moyo and that Mnangagwa clashed several times with Moyo over her.

She claims she has a child with Moyo who in November 2017 showed up on State TV, the ZBC, to announce the military coup that toppled the late President Robert Mugabe.

She claimed that during the years before the coup, Mnangagwa launched an espionage campaign to monitor her affair with Moyo.

According to Mutami, Mnangagwa through his personal assistant of more than 30 years, Magna Muganhiri, wanted to expose the affair to Moyo’s wife Justice Loice Matanda-Moyo, the current chair of the Zimbabwe Anti-Corruption Commission (ZACC).

Because of this Mutami claims she and Moyo avoided meeting in Zimbabwe.

Mutami cited that Mnangagwa wanted her so much that he was prepared to do anything to disqualify Moyo from the game, even politically.

She claims Moyo also assigned his nephew Hermish Moyo to act as her husband and the father of their child in order to cover up for his reputation.

She fleshed out the allegations with detail that was graphic, explosive and, in parts.

“He told me to stop telling people about this child because it would mess up his career. He said we should meet in a third country citing ‘these people (Mnangagwa and his PA) are telling Matanda-Moyo (wife) a lot of things.

“We used to meet in Addis Ababa,” she said.

About the child, Mutami said DNA tests were done and it was confirmed it was Moyo’s child. She said the papers were with her lawyer in Harare.

Commenting on the allegations by Mutami, Zanu PF Director of Information Tafadzwa Mugwadi blamed opposition Citizens Coalition for Change (CCC) leader Nelson Chamisa for sponsoring the expose. (See Tweet below).

CHIEF Justice Mumba Malila says some lawyers have got large appetite for material wealth even if it means being accessories to crimes.
And Dr Malila has described corruption as a public enemy and killer.


Opening the Law Association of Zambia’s annual law conference at Avani Hotel yesterday, Dr Malila challenged lawyers to uphold professional ethics and help fight corruption.


“It is an embarrassment to the legal profession, is it not, that there are some lawyers who do not take the ideals of this noble profession seriously and only think of ways of fleecing the country or their clients of their resources. Some lawyers, I grieve to say, will stop at nothing to satisfy their large appetite for material wealth, sometimes using incongruous ways to make money and more money, even if this means being accessories to crimes, especially those involving corruption,” he told delegates. “To put it crudely, some of your members, Mr president [Abyudi Shonga], must work at addressing the deficit in them of good fiscal morals and professional ethics. Is it not a matter of serious regret that we see lawyers, in dramatically increasing numbers, standing up at forums away from the courts, not to fight corruption, but to root for corruption instead?”


He said some lawyers seemed not to have respect for their oath of office and conscience.
“…Some of our lawyers appear to have neither respect for their oath of office and calling nor reverence for good conscience. In keeping with the best traditions of the legal profession, lawyers should not skirt the edges of legal ethics when it comes to representing suspects. What the lawyer accepts to do and how he does it should not, in my humble view, be determined merely by how much power or influence the person being represented holds or how much money he or she is willing to pay for legal services,” Dr Malila continued. “What is self-evident today is that some lawyers, probably labouring under the erroneous view that they are rather ‘hot stuff’, become culprits in the calculated or systemic delays in concluding corruption cases, employing what can fairly be described as ‘Fabian tactics’ designed to derail what should otherwise be straight forward proceedings. They choose to bring about an intricate mesh of tactical manoeuvres under which the substantive merits of the cases before the courts become blurred or buried, using all the while, due process considerations to turn proceedings into highly legalistic and costly affairs. For the courts concerned, this invariably strikes at their autonomy and leadership in judicial proceedings and, while litigation winds its laborious ways through the procedural maze and the delay that ensues, institutional paralysis of sorts is sometimes experienced.”
Dr Malila cited how certain lawyers have done wrong things against society.
He specifically cited the Financial Intelligence Reports where some law firms have been mentioned in money laundering activities.
“Have we not heard fairly disturbing reports of lawyers being party to wrong doing in the course of performing what are supposedly fiduciary duties on behalf of their clients, especially corporate ones, commingling financial accounts and creating highly disconcerting conflict of interest situations? We have heard, have we not, stories of lawyers being cited in the Trends Reports by the Financial Intelligence Centre for being possible architects or accomplices in corruption and money laundering activities,” he asked. “We have equally heard of lawyers being convicted of fraudulent conduct, and even then, continuing in their odious ways of deceiving
innocent consumers of legal services while on bail pending appeal. And, in some cases, we have unfortunately heard of lawyers seemingly colluding with adjudicators and court support staff, either directly or through third parties, and sometimes with opposing counsel, to defeat the course of justice.”


Dr Malila also gave an example of judicial officers who have been involved in pecuniary demands.
He said there could be no hope of winning the fight against corruption if lawyers were involved in perpetuating the vice.
“More grievously, we have also heard of lawyers who are adjudicators exerting wrongful pressure or making inappropriate pecuniary demands on litigants. We cannot hope to win the fight against corruption if some of our legal experts maintain this kind of mindset towards the scourge of corruption. I think, Mr president, that it’s high time that lawyers who have progressively cast themselves in the role of antagonists in the fight against corruption must be made to recognise their own responsibility to temper the demands of their financial interests with proper considerations for the collective economic well-being of our country and its people, recognising always that they too, must take a broader view of the Zambian society’s aspirations and general good than the legalistic,” Dr Malila said. “Pyrrhic victories, which will vindicate what is legal but not necessarily what is ‘right’ in the context of the larger society’s aspirations, may be won in the courtroom but that should not be the endgame. Lawyers, especially good ones, must realise that there is greater injustice to the Zambian people when they play for time or employ Fabian tactics in legal proceedings, all in the quest to frustrate justice or to get richer at the expense of real justice for the majority poor. After all, the Holy Book proclaims that a good name is better than riches. We should all, as players in the justice sector be rightly concerned with the poverty of our people brought about by corruption.”


He reminded delegates about how shameful it is that some countries poorer than Zambia have maintained their corruption levels at a low.
“Is it not a shame, that we witness some of our neighbouring countries which are far less endowed with natural resources than we are, but which have succeeded in keeping corruption levels low, scoring tremendous economic development while we regress economically,” he said. “Whether they be adjudicators or transaction advisors or defence counsel or prosecutors, or what not, corrupt lawyers are uniquely unsuited for any responsibility or leadership role in the legal firmament and outside it, whether in this season or beyond it. They inflict enormous reputational carnage to your profession. In its vetting responsibility in appointments to critical legal positions, your Association should make it a practice to doubly check that it is not
only the prescribed qualifications that should count when people are to be entrusted with public engagements, a background of immaculate morality, irreproachable integrity, pure intentions and grounded patriotism must be confirmed too. You ought as an Association of learned men and women to know how to separate the wheat from the chaff in the profession.”
He implored lawyers to be agents of social change.
“It is my humble submission, Mr president, that as the good agents of social change which they must be, lawyers should be in the frontline in the reorientation of the mind-set of the Zambian people in the renewed fight against corruption and the social and economic renaissance generally. They must all, individually and collectively, commit to the creation of a clean legal system which is a sine qua non to defeating corruption,” Dr Malila said. “As a clean legal system must come from unblemished characters, corruption within the legal profession, grand or petty, must be eradicated first. We need credible transaction legal advisors; we need credible prosecutors; credible defence counsel and credible adjudicators too, if the law is to be truly advanced as an instrument for economic growth, social order and justice in this country.”
And Dr Malila asked lawyers to view corruption as a public enemy.


“We must all view corruption as a ‘public enemy’ for corruption is not just a character problem or one of misadventure or merely wrong behaviour which affects only a handful of members of the society; it is an economic crime that affects us or our own directly. It is not just money and opportunity unjustly lost or stolen; corruption is also a killer,” said Dr Malila. “Think, for example, about the patient who dies from substandard medication corruptly procured in lieu of genuine, efficacious medication. …The reassuring news, Mr. President, is that by far the majority of your members and our adjudicators are decent men and women who have the craving to combat corruption and create a clean legal environment. These lawyers must be encouraged to stand up and fold their sleeves to do battle with graft. On the other side of the spectrum, those few of your members with an inclination for fueling sleaze must be encouraged to deliberately purge themselves of their dishonest tendencies and, wherever possible, they must be roped into the fight against corruption.”
And LAZ president Abyudi Shonga called for the fight against sexual harassment or sexual extortion amongst lawyers.

He noted that this may be an uncouth topic to discuss but that it must be discarded.

The former Deputy Senate President Ike Ekweremadu and his wife, Beatrice, are accused of conspiring with a Nigerian doctor named Obinna Obeta to get a kidney donor into the UK for their daughter.

Obeta, 50, was charged under the Modern Slavery Act with organising the trip of a 21-year-old male in order for him to be exploited between August of last year and this May when he appeared before the Bexley Magistrate court on Thursday, July 13.

In a second accusation, it is claimed that he plotted with the previous Senate President to arrange or aid the man’s travel with the intention of using him for organ harvesting.

It was earlier reported that the Ekweremadus are being tried in the UK on charges of organ harvesting after a 21-year-old man, David Ukpo, they brought to the UK approached the police with claims of being treated as a slave and also claiming that he was ”15” years old. The Nigerian politician and his wife were arrested in the UK on June 21 after flying into Heathrow from Turkey.

It was later discovered that David lied about his age as the biodata on his Nigerian bank accounts and the National Identity Management Commission NIMC indicated he was 21 years old.

Obeta was on Thursday charged with arranging or facilitating the travel of another person with a view to exploitation and conspiring together with Ike Ekweremadu.

Prosecutor Tim Probert-Wood had previously told the court that the case involved ‘exploitation and the harvesting of an organ.’ The Prosecuting counsel told the court that the Ekweremadus had planned to have David’s kidney removed so it could be given to their daughter.

”The case began on 5 May 2022 when the complainant presented himself at Staines Police Station and claimed he had been transported to this country for the purpose of his kidney being removed.

He arrived on 20th February 2022 and was taken to Royal Free Hospital where tests were conducted. For the purpose he was there he did not consent to the taking of his kidney.

He returned to the house he was staying and his treatment changed dramatically. He described being treated effectively as a slave.” Probert-Wood said

However, counsel to Mr. Ekweremadu, Martin Hicks, QC, insisted that the former Senate President and his wife did no wrong

‘We deny that there was any exploitation or any intent to do so. The argument will be factual denial.’

All three defendants, who are in custody, are due to appear at the Old Bailey on August 4.

Former President Edgar Lungu Is Not Being Persecuted, He However Needs Help- Thabo Kawana

FORMER PRESIDENT EDGAR LUNGU IS NOT BEING PERSECUTED, HE HOWEVER NEEDS HELP.

I have noticed how some people are championing an agenda to show as though Former President Edgar Lungu is being persecuted by this Govt when in fact not.

The fact that those perceived to be close to him or in his perceived inner circle are being asked by Law Enforcement Agencies to account for their newly found wealth which they acquired mainly whilst they where in public office does not amount to persecution, it doesn’t even amount to prosecution but merely inquiry as is the case for any person or indeed any entity in our country and within boundaries of the Law, especially those Laws around corruption and money laundering including procedures as they relate to the Financial Management Act (FMA) when it comes to utilization of public resources.

The country will recall that when someone (a private individual) brought into the country a Bugatti car, DEC impounded the vehicle and the owner was made to account for the source of his funds. He did so and after investigations, the vehicle was handed back to him.

Recently, the Workers Compensation Fund Control Board (WCFCB) a Govt entity had it’s newly acquired motor vehicles seized by DEC and the Board made to account for not only the funds used to purchase the said motor vehicles but, procedures to do so as well. After investigations, the vehicles were handed back to them.

The country may also recall how Former First Lady Mama Thandiwe Banda was summoned for questioning by Law Enforcement Agencies over the Mpundu Trust flats on Leopards Hill Rd and some other property in Tanzania believed/suspected to be hers where acquired and source of funds. Mrs Banda demonstrated how she got a Bank Loan to build the Mpundu Trust flats and how she had no knowledge of the property in Tanzania. After investigations, the Mpundu Trust flats were handed back to her.

There is therefore, nothing strange or outside the Law in summoning the Former First Lady Mama Esther Lungu over the 15 luxurious apartments believed/suspected to be hers in State Lodge area and the source of funds used to put up the same. All she needs to do (if they are hers) is to account for them and the source of funds, simple.

Just as no one is special before the Law, so is no one above the Law including our Former First Family.

The same has to happen to Hon Tasila Lungu and Mr Dalitso Lungu (children of Former President Lungu). They too like any other citizen ought to account for their perceived wealth and source of funds. Nothing sinister or outside the dictates of Law. No persecution here perceived or otherwise.

But I say Former President Lungu needs help because I notice that his utterances over the perceived persecution of his family members and close associates leave much to be desired and are uncouth to say the least.

I say so because his recent outbursts of referring to the Sovereign British Government’s debacle stating that the leader of that country lied his way to office leaves a bitter taste coming from a man of his stature and hinges on a possible strain of relations enjoyed by our country and that of the Brits in as far as diplomatic etiquette is concerned.

Such utterances don’t come from people of his stature and he of all people should know that.

Former President Lungu requires urgent help of actualization of the Office of the Sixth Republican President and a Spokesperson appointment like yesterday. A Spokesperson in that Office will communicate the thoughts and feelings of the Former President void of emotions and uncouth outbursts.

Former President Kaunda had the likes of Muhabi Lungu as Spokesperson and he did a good job, Former President Chiluba had the likes of Emmanuel Mwamba and he too did a good job. Just recently, Former President Banda had Kennedy Limwanya and later Chibeza Mfune and they both did a good job.

Who is Former President Lungu’s Spokesperson?

Considering that the Former President lost terribly to the current President and clearly never thought he would lose hence declaring publicly and with audacity that he would firstly, hand over power to himself and secondly, arrest the current President after elections, one would be expecting too much to think the man would speak publicly without emotional outbursts (Ku loser ma elections ku baba bane).

Hence the urgent need for high caliber men and women to be attached to the Office of the Sixth Republican President to quickly help the Former President to transition into becoming a States Man and not a political grouping leader.

Here I am talking about Senior seasoned men like the great Mikatazo Wakumelo who specialize in settling in Former Presidents.

Let us quickly find the right people to work in the Office of the Sixth Republican President and put this whole episode of hangovers from electoral defeat and foul cry of persecution behind all of us.

Former President Lungu is not being persecuted or indeed prosecuted, he needs help.

Zambia has never been a socialist country; it has always been a capitalist country.

At independence in 1964, to protect their wealth and investments in Zambia, the departing racist and colonial British government hoisted onto the newly independent Zambia a liberal capitalist constitution in which private property was held sacred. Kenneth Kaunda’s nationalisations were not a seizure of economic and political power by the Zambian working class and the poor rural peasant farmers, the only route through which socialism can occur; it was an effort at establishing state capitalism to fast track the material and cultural development of the Zambian native whom the racist, colonial and capitalist British left in a most deplorable state.

Kaunda’s one-party state was a pragmatic political response to the threats Zambia faced mainly from the racist, colonial and apartheid Rhodesia and South Africa, the appetite to eliminate his internal political opponents and of course the urgent need to attend to the social development of the mass of poor Zambians, we must concede. None of these measures were socialist, rather, they were all versions of capitalism – the system of private and state ownership of wealth and the means of production.

Socialism occurs when the working class, in combination with the poorest sections of the peasants, violently overthrow their oppressors, tormentors and exploiters – the private property owners – the capitalist class – and begin to construct a totally new civilisation and genuine democracy based on securing and advancing the interests of the vast majority; the working class and poor peasants. The change from capitalism to socialism is violent precisely because the oppressors, the capitalist class, inevitably use violence, state and private, to sustain themselves in power and to resist change: to overthrow them, the working class must overcome this violence with their revolutionary violence. Of course, after successfully seizing power, the working class must suppress the capitalist class by whatever means necessary, if they are to accomplish the destruction of a system of organising society based on oppressing, suppressing, dominating and exploiting the majority by a tiny minority – the capitalist class.

No such socialist revolution has ever occurred in Zambia, to the best of my knowledge. Genuine socialism cannot be created by pronouncement, decree, or mere constitutional changes: it is the violent overthrow of the exploiting capitalist class by the working class in alliance with all progressed sections of society, and in our case, in alliance with the poor rural peasants. Socialism is the seizure of societal power by the working class and poor peasants from the capitalist, and the establishment of a society dominated by these classes.

Of course, “socialism” like the words “Christianity” and “Islam” and many others, is easy to abuse: any charlatan wanting to lure the working class and poor peasants into their lair as voting folder are free to call themselves “socialists”. The rich capitalists wanting to demobilise the working class and tame them are free to call themselves “socialists” especially if they release some of the loot they steal from the working class at the point of production and hand it over to the working class as “free education”, “free housing”, “free health services” and so forth. Concealed in all these fake “free” gifts is the fact that the money which creates them is stolen from the working class at the point of production by the capitalists, and through taxes by the capitalist government.

Usually, intellectuals, academics, professionals such as engineers, doctors, teachers, lawyers and others, pastors, priests, mullahs, semi rich peasants, artists, musicians, writers, and so on, who are slightly well off than an average gumboot worker dream of a capitalist society freed of the ugly things necessary and essential for capitalism to exist such as low wages, brutalities in factories and all places of work, unemployment, poverty, hunger, inequalities, domestic and gender violence, drug abuse, racism, tribalism, climate change, global warming, pollution and so on – these do-gooders usually collectively called “the middle class” – are also free to call their utopias “socialism”.

Zambia is a class society. We have just about 1,000 US dollar millionaires in a country with slightly over 19 million people, by UN estimates for this year. It is from this tiny class that Zambia’s “private sector” comes. It is this class which stands to benefit the most from everything HH and Musokotwane, now clearly being cheered on by Nevers Mumba, are doing. The IMF and all the macro and micro economic policies and the punishing debt restructuring processes are designed to protect the wealth and money of this tiny class of rich people, in the clearly dubious illusory lie that when this class gets richer, Zambia’s working class and poor rural peasants’ lives improve! Low inflation, stability in the exchange rate, foreign money and the six key economic sectors HH and the UPND are pursuing are all aimed at facilitating the wealth accumulation of our tiny millionaire’s club.

The majority of Zambians survive by either working for themselves or selling themselves to a capitalist who has use for their labour; who wants to make profits from their power to work. The dominant form of economic activity in Zambia is private ownership of the means by which wealth is produced; even in rural areas, families “own” their patch of earth upon which they grow crops and raise animals for consumption and selling. In the urban areas, individuals and companies own the means by which wealth is produced, and they produce things by employing labourers: educated and uneducated, skilled and unskilled. Unfortunately, the majority of workers cannot find work. Zambia is, therefore, a capitalist country, a very poor, backward, low wage capitalist country. It is suffering mass hunger, unemployment and extreme inequalities – all normal features of capitalist neo-colonies.

Being born and growing up in capitalist Zambia means that the most dominant ideas and ways of seeing life are capitalist: from birth to death, we are all surrounded and saturated by lies, corruption, private greed, selfishness, desire to win alone, a voracious appetite for money even if it is stolen or immorally acquired, ruthless competition for just about everything; and above all, we are groomed to either grow up and get a job, or creating our own economic opportunities. To be rich we are lied to, is the main purpose of life; for only then can we be happy and find love. It has been like this since independence, to date! Kaunda tried to teach us otherwise, he failed lamentably because without societal power transferring to the producers of wealth, the working class and rural peasants, no “moral system” is sustainable!

Hichilema, Musokotwane and Nevers are our self-ordained Zambian High Priests of capitalism, the defenders of private property, and therefore the champions of foreign private money into Zambia. It is important to understand and appreciate that these priests do believe in the power of private greed to liberate Zambia from its current malaise. The poor and the working class must wait for the profits of the rich to grow (economic growth) for them to have any respite from their suffering. This myth is so deep rooted among us and strong that the working class and the poor uncritically believe it. No “economic growth” is good for all social classes in society. Profits, for example, can only grow if the capitalists exploit the working class more!

The world working class is fast working up to the fact that capitalism is not just oppression, suppression, domination and exploitation of the working class and rural poor peasants, it is also global warming, climate change, pollution of soils, rivers, lakes, oceans and seas. Capitalism is gender oppression as it promotes male labour above female labour. Capitalism is guns, mass killings, wars and all kinds of violence as the rules of competition are broken by the powerful. Capitalism is today pandemics.

Capitalism has its origins in slavery, it grew up in colonialism and it has matured as imperialism, a decayed and dying imperialism, today. Capitalism, in its war in Ukraine, is now threatening to burn the earth with nuclear war. The world working class, conscious of their historic mission to end all oppression and exploitation, know that “national socialism” is a lie; only a global uprising of the working class can clean the world of the effluvia of capitalism and imperialism. Hakainde, Situmbeko and Mumba must be careful what they are sowing; they will reap the harvest.

Zambia’s CSO announces single-digit inflation. Fools rejoice. The wise frown. No citizen smiles. All economic experts remain askance.

Then the Bank of Zambia steps in. It comes to say, explaining, that the single-digit recorded, the 9.7 percent, is the rate at which prices continued to rise over a given, measured period. The BOZ does NOT deny that prices are rising. Without a word, it acknowledges that the cost of living in Zambia is now reaching a breaking point. Some of its own workers are grumbling.

Every day, the people in the compounds feel the negative impact of the rising prices, they groan. And with the rising prices, the people’s anger also continues to rise, their BPs now causing splitting headaches. How high the people’s anger will rise no one really knows.

But what is certain, if we continue on this path, is that a socioeconomic storm will soon hit Zambia. Something will happen. The dam of anger will burst. Something gotta give. The clouds are gathering. The birds have all flown away, and an eerie calm now obtains. Salaries have remained stagnant in Zambia. They are not predictable anymore. The cost of production is daily going up. Prices are rising. Consumer purchase power continues to erode. The level of credit in the economy has fallen.

Copper prices are plummeting, from a high of USD 11000 per ton to about USD 7000 now. The government has given Zambia’s money away to mining companies through tax holidays. The Federal Reserve Bank of America will again soon increase its interest rates. Zambia’s debt will also soon increase. The fiscal space will shrink further. Over time, Zambia’s gross national income will gradually continue to fall.

And as all this happens, the expenditure side of Zambia’s budget continues to grow. Come on, Denny, watch that Imports-Cover carefully now! The clouds are gathering. An eerie calm obtains. Global winds of economic and political change are blowing.

Any worthy expert will tell you that Zambia is presently veritably in a state of STAGFLATION, a state of chronic high inflation in the midst of high unemployment rates and stagnant and falling consumer demand. This is a precarious economic situation, a clear prelude to a socioeconomic volcanic eruption. Debt cancellation and government economic stimuli are now recommended. Barring these, companies will be hurt, jobs will be lost, incomes will further fall, further hurting consumer spending which will further hurt companies, which will further hurt… A vicious cycle. See?

And then collapse. You see when one borrows one must pay it back. That is a sacrosanct law of business. When this law is flouted it hurts everyone involved. If an entity repeatedly borrows and repeatedly fails to pay back and, such an entity is repeatedly saved through debt cancellation, that then, my dear friends, is the very definition of idiocy.

See? Corporate/entity cognitive lameness. Zambia has all it needs to survive and prosper as a sovereign nation.
Everything, except something.

What then is required?

The enlightenment of its people. The realisation by Zambians that, through resource security and fair trade, Zambians themselves must collectively exploit their God-given resources for their own communal well-being. An aware people, a people confident in themselves than as a sovereign, that is the only way to live. A people accommodating to strangers but wary of them. But then the impending collapse of the US Dollar as a reserve currency might just be the divine intervention that will change the whole game.

BRICS plus. Zambia keep your gold! For now, the clouds continue to gather. The ground is shaking. The rocks are moving. The smell of sulphur is in the air. The socioeconomic volcano is about to erupt. There is trouble ahead. Serious trouble. Terrible times. Terrible. We pray.

HH is a strategist, genius!

HH is a strategist, genius!

Love him or loathe him, this villager from Bweengwa who grew up herding cattle, one Hakainde Hichilema, the current President of the Republic of Zambia, is a strategist…nay a genius!

Following the demise of Anderson Kambela Mazoka, the founding leader of the United Party for National Development (UPND) in 2006, a scintillating battle for the top slot would ensue albeit threatening to tear down the party. A hitherto little-known name in political circles but then a very successful businessman and cattle rancher would step out of the shadows to square it off with the acting party president Sakwiba Sikota, alongside another prominent entrepreneur James Ndambo. Readers would still remember Ndambo for capturing the imagination of the public with his record-breaking philanthropy exploits in the nation, recently.

Speaking in an interview with Amos Malupenga, managing editor of the then influential newspaper, The Post prior to the intra-party elections, Hakainde declared, “The request came from all over – the party members and people from all walks of life; the business community and my fellow village people. By the way, I do a lot of community work. Over the last fifteen years, we have done schools, clinics, deep tanks and we assist a lot in the areas where we have farms. I pay school fees for children numbering fifty who are not mine.”

HH would subsequently fend off competition and claim sweet victory. However, this would not sit well with some senior party stalwarts and would result in the exodus of the likes of Bob Sichinga, Patrick Chisanga, Henry Mtonga and of course, the vanquished Sakwiba Sikota. That same year, HH would go on to challenge the ruling party-sponsored candidate Levy Mwanawasa and end up eating humble pie.

Just when many political pundits started preparing obituaries for UPND and HH; in a matter of time, he would demonstrate that he was a tough nut to crack! For the next 15 years, he would thus commence navigating the rough terrain of Zambian politics by dodging bullets and teargas, stomaching smear campaigns and slander, escaping from violent cadres through rickety roofs, and constantly enduring detentions, of course the harshest being solitary confinement for a prolonged period of time at the notorious Mukobeko Maximum Prison for the laughable charge of treason over a traffic offense! Under ordinary circumstances, many would have easily crumbled like a cookie and thrown in the towel. Yet, HH remained resolute, even when he had to dig deep into his pockets and bankroll the party he loves, almost single-handedly. How many politicians would have had the stamina to withstand the torture, calumny and bearing the financial responsibility of keeping a party intact for so many donkey years?

In the past, we have witnessed a plethora of individuals – the rich, decorated army generals, top class lawyers, fiery clergymen, successful farmers and even intellectuals attempting to form their own political parties. We shall cite a few examples:

Some of the country’s affluent individuals such as Enock Kavindele, Ben Mwila and Humphrey Mulemba once flirted with the idea of running their own parties. After failing to wrestle UNIP from the grips of Dr Kenneth Kaunda at the Mulungushi Rock of Authority in Kabwe in 1991, Kavindele left in frustration to form his own United Democratic Party. It would put up a lackluster performance in the elections that followed, only managing to scoop a few council seats, particularly in North-Western Province where he hails from. Before long, he would abandon his own party to join the promising MMD where he ended up being rewarded with a senior portfolio as vice-presidency.

And as the cracks began to appear in MMD barely after two years in office due to allegations of corruption, a group of MPs led by Humphrey Mulemba would resign from the party in protest and form the National Party. The new party would retain the five of the by-elections forced by their resignations from the MMD. Unfortunately, National Party would suffer a natural death after the death of Mulemba in 1998.

Meanwhile, as the drama continued to unravel in MMD, in the early 2000s, Ben Mwila who was said to be then President Frederick Chiluba’s uncle would ditch the party after his colleagues criticised him for considering a presidential run. He would form the Zambia Republican Party and go on to put up one of the most expensive campaigns, trudging every corner of the nation, holding rallies and distributing party regalia.

After his resignation from MMD in 1993, respected lawyer, Dr Roger Chongwe would come up with the Liberal Progress Front. Alas, this was a stillborn baby that would never see the light of the day! The same applies to Sakwiba Sikota’s pet project, the United Liberal Party which was only best known for churning out articles in The Post and hosting press briefings at the plush hotels in Lusaka. As for the Dr Ludwig Sondashi-led Forum for Democratic Alternatives which he formed in 2014, there’s nothing much to write home about. He would best be remembered for promising to roll out his Sondashi 2000 formula for free once elected as president, as if every potential voter was HIV positive!

Never to be left out, intellectual giants such as bo Akashambatwa Mbikusita Lewanika would equally craft his own Agenda for Zambia party, along with his beloved sister princess Inonge Mbikusita Lewanika. The party would end up claiming two parliamentary seats in Western Province in the 1996 elections. Another intellectual, Dr Gwendoline Konie would follow suit in 2000 and quickly relocate back home from abroad to come and contest the elections under the banner of her brainchild, the Social Democratic Party. And seemingly taking advantage of the respect that citizens have for farmers for the nshima they supply to our homes, commercial farmers Ben Kapita and Guy Scott saw an opportunity to try the Lima Party in 1996. However, it failed to attract the much-anticipated support from the public. Some of the country’s admired army generals such as Christon Tembo and Godfrey Miyanda equally tried their luck raiding our political landscape with their own political parties – Forum for Democracy and Development (FDD) and Heritage Party, respectively.

Perhaps taking advantage of Zambia as a Christian nation, in 1998, popular Televangelist Pastor Nevers Mumba would give birth to the National Citizens Coalition (NCC). If he thought the gullible public would immediately greet him with ‘icimwela,’ he was a very disappointed individual. NCC even failed to produce a single MP! Where are all these political parties today? They are either dead or only exist on paper.

SOCIALIST Party president Fred M’membe says there is need for the country to think big to understand what is happening to the world economy.

Dr M’membe said economies that dominate the world have theories, theoreticians and media to disseminate which the country can do by having its own theoreticians among the ranks of the intellectuals like economists with a political sense, not economists to serve the transnational corporations.

“Time for narrow mindedness and pettiness is over. We have to think big and broadly. It’s very important for us to understand what is happening to the world economy and not just narrowly focus on our bantustan economy. Today the trade frictions we are witnessing in the world all centre around the manufacturing sector. Over the past five years, the trade war between China and the US has intensified and will continue to escalate further. A historical analysis of events shows that the bedrock of US political hegemony was a strong manufacturing sector. In recent decades, US manufacturing has shown an irreversible decline, despite government efforts to revive it. This decline has become one of the important sources for today’s global political and economic tensions,” he said in a statement. “While it is very important to understand how competitive weakness has contributed to the decline of US manufacturing, a deeper understanding of the rules that govern production in the age of imperialism is needed. Since the mid-1990s, with the dominance of finance capital’s drive to maximise profits, US imperialism accelerated the move of their industrial base overseas, especially to the Global South and to China in particular. In parallel, there were other factors at play: productivity gains eliminated many jobs in the US and the lack of manufacturing investment resulted from finance capital investing where profits were greatest.”

Dr M’membe said today, economists must be political economists adding that politicians should be with the maximum knowledge.

“We cannot encourage communalism or narrow mindedness, for no nation can be great whose people are narrow in thought or in action. Those who dominate us, those who dominate the world economy have their theories, their theoreticians and the media to disseminate them. We must also have our theoreticians among the ranks of the intellectuals. First of all, economists – those with a political sense, not economists to serve the transnational corporations. Economists must develop ideas based on profoundly scientific foundations and human experience and convey them to their people,” he said. “Today, economists of the people must be political economists; and politicians must be politicians with if it is possible a maximum of knowledge. Today that is really the basis on which the fate of humanity depends, the basis on which our struggles are being carried out. And the politicians who do not understand, or do not want to understand, or who do not strive to understand economics, are not worthy of exercising their duty.”

Dr M’membe said the country needs to economically understand fully what is happening to the world economy, especially to the American and Chinese economies.

He noted that American military and political leaders quickly learned the importance of having a strong manufacturing sector that could supply strategic materials and manufactured goods because of America’s inability to manufacture basic necessities during the Independence War from Great Britain.

Dr M’membe said the American production system was born, first developed by the military, and then introduced into the American industrial sector where it continued to develop.

“The American system has two connotations: the first refers to 19th century US economic protectionist ideas and policy practices against British free trade, known as the ‘Institutional American system’; the second refers to the rise of the 19th century US manufacturing system of mass production. Mechanisation of mass production – a standardised production system based on interchangeable parts and modules – is one of the main characteristics in the evolution of US manufacturing. The military and political hegemony achieved by the US after World War II became, over time, a paradox for US manufacturing. To maintain their political hegemony, the US was forced to make economic concessions to its allies, opening up its domestic market to the allies’ manufactured goods. As a result, foreign competitors gained greater market share and this contributed to the decline in such industries as auto, steel, and machine tools,” he said. “The US, however, maintained its innovative and long-term leadership in the military, aerospace, and electronic information industries, which generated high profit margins by leveraging the large amount of accumulated knowledge capital. For the US government, the problems of unemployment, the loss of skilled workers, a lack of self-sufficiency in defence-strategic goods, and the deterioration of regional economies brought about by the decline of domestic manufacturing. Since the 1980s, the US has been waging trade wars, first against its allies and then against emerging developing powers. The economic contradictions within the US, represent an important reason why the world political and economic order has entered an era of conflict and turmoil, which US hegemonic power is unable to resolve.”

And Dr M’membe said China’s domestic economic development is confronting many challenges with the world economy currently facing downward pressure.

He said it is necessary to understand the characteristics of China’s new economic development in the first two decades of the 21st century and what changes are expected for the following two.

“The first phase of China’s new economy’s development was from 2000 to 2019 and was characterised by less state regulation of capital, meaning the state supported rapid economic growth and capital grew with the expanded economic scale; however, investment in research and development grew relatively slowly. The new digital economy was driven less by technology and more by maximising the external benefits created by the socialist state, such as the increase in people’s disposable income, the improvement in logistics and transportation, and the expansion of the digital information infrastructure. The state had to absorb all the societal negative social impacts, including the widening income gap,” noted Dr M’membe. “Starting in 2020, the new economy has been characterised by significantly greater state regulation of capital, meaning that both the investment industry and business owners of the new economy should follow the state-defined principles of promoting ‘quality development’ and the ‘inclusive society’. Investments in this new period are expected to focus on three main priorities: 1) smart optimisation of the supply chain, 2) import substitution of foreign-made technologies, especially in areas like industry-specific chip manufacturing, and 3) sustainable development, especially in those technologies facilitating the use of green energy. The Chinese investment industry are expected not to blindly pursue the finance-driven game in the new economy. They are expected to pay attention to the qualitative development of the economy, based on a deeper understanding of the entire supply chain. Business owners, and especially the investment decision makers, are expected to closely align the benefits of their investment returns with the interests of the country and the well-being of the people and contribute to the sound development of the socialist market economy.”

Woman resubmits fresh sexual assault and defamation claims against Snoop Dogg months after withdrawing allegations

Rapper and record label executive, Snoop Dogg is once again facing a lawsuit from a woman who claims he sexually assaulted her, attaching fresh accusations, months after she withdrew lawsuits against the rapper.

The alleged victim (identified only as Jane Doe) sued snoop Dogg in February, claiming he forced her to perform oral sex on him at his recording studio in 2013. The lawsuit, which Snoop’s team dismissed as “meritless” and “extortive,” was voluntarily dismissed in April.

But in another turn of events, the woman and her legal team resubmitted the lawsuit at a California district court on Wednesday, July 20, according to Rolling Stone. It includes the original sexual assault and sexual battery allegations, as well as fresh defamation claims.

The woman claims Snoop Dogg (real name Calvin Broadus Jr.) intended to “threaten, intimidate and coerce [her] into not exercising her constitutional rights to engage in a mediation” via a thinly-veiled Instagram post addressing the original lawsuit.

“Gold digger season is here be careful Nefews keep ya guards up,” he wrote in the post.

The revived lawsuit also claims Snoop threatened to “pursue a malicious prosecution action” against the woman for “tens of millions of dollars” in retaliation. Further “scaring” and “intimidating” her, he allegedly gave his spokesperson permission to reveal her identity in a statement issued after the initial filing.

The woman’s sexual assault lawsuit stems from an encounter with Snoop Dogg and his associate Bishop Don “Magic” Juan following the rapper’s show in Anaheim, California in 2013. The woman claims Juan gave her a ride home from the concert and forced his penis into her mouth when she awoke on his couch.

She claimed that Juan then took her to Snoop’s studio to audition to be one of the “weather girls” for his GGN YouTube series. When the woman went to the bathroom, Snoop walked in, “standing with his crotch in Plaintiff’s face, while Plaintiff was defecating on the toilet” and allegedly forced her to give him oral sex.

In March, the 50-year-old rapper and his legal team filed a motion to dismiss the lawsuit, arguing the woman failed to state a legitimate claim against him under federal rules of civil procedure and provided “virtually no supporting facts.”

Prince Harry wins latest court fight against Home Office over security arrangements

Prince Harry has won the latest stage of his court fight against the Home Office in the High Court.

The Duke of Sussex began a legal battle against the Home Office in February after it refused to allow him to pay for his own protection while visiting the UK.

The ruling in his favour on Friday, July 22, at the High Court means he will now be able to take the case for a judicial review, Dailystar reports.

He and his team had argued that his US-based entourage do not have sufficient jurisdiction in Britain to be able to protect him properly.

They further argued his hiring of police officers during the duration of his trips would come at no cost to the taxpayer.

But the Executive Committee for the Protection of Royalty and Public Figures (Ravec), which falls under the remit of the Home Office, ruled last June that he could no longer be entitled to the “same degree” of security as he is now a private citizen.

Harry’s lawyers said in an appeal last month that the decision had been made with “procedural unfairness” as he had not been able to make “informed representations” before his application was denied.

In the first stage of the case earlier this month, the duke’s lawyers asked Mr Justice Swift to grant permission for a full hearing to have a judge review the Home Office’s decision.

In a judgment on Friday, the High Court judge said the case could proceed, granting permission for part of Harry’s claim to have a judicial review.

Mr Justice Swift said: “The application for permission to apply for judicial review is allowed in part and refused in part.”

A written argument from Shaeed Fatima QC had earlier stated that the decision had been “materially prejudiced” because “among other things, his offer to pay (for security) was not conveyed to Ravec before the decision was made”.

However, lawyers for the Home Office say Ravec was entitled to reach the decision it did, which is that Harry’s security arrangements will be considered on a “case by case” basis, and argue that permission for a full judicial review should be refused.

Sir James Eadie QC, representing the Home Office, said in written arguments that any tensions between Harry and Royal Household officials are “irrelevant” to his change in status.

‘I don’t want to say the election is over’ – Trump refuses to say he lost in outtakes of January 7 speech shared at committee hearing

The January 6 House select committee investigating the events of Jan. 6, 2021, revealed at Thursday’s primetime hearing unseen raw footage of President Donald Trump on the day of, and day after, the deadly attack on the U.S. Capitol.

Trump recorded and released a video message from the White House Rose Garden while the riot was underway on Capitol Hill, urging the mob to disperse and telling his supporters, “We love you. You’re very special.”

The hearing was held to find out what Trump did and didn’t do in the 187 minutes before he finally called off the attack, after hours of pleas from his inner circle.

“I know your pain, I know you’re hurt,” Trump said in the footage that was eventually released. “But you have to go home now, we have to have peace. We have to have law and order, we have to respect our great people in law and order.”

The next day he recorded another video from inside the White House. Outtakes of both videos were shown during the hearing on Thursday.

“The staff that remained at the White House on Jan. 7 knew the president needed to address the nation again and they had a speech prepared for him that morning. But he refused for hours to give it,” Rep. Elaine Luria, a Virginia Democrat and former Navy officer who sits on the Jan. 6 panel, said at Thursday’s hearing.

Luria said the committee heard testimony that Trump was finally convinced to deliver the message later in the evening of Jan. 7 by advisors who warned of “concerns he might be removed from power under the 25th Amendment or by impeachment.”

The outtakes, Luria said, were taken more than 24 hours after the video filmed in the White House Rose Garden.

After a few takes, Trump is seen saying, “This election is now over. Congress has certified the results,” before stopping himself and saying on camera, “I don’t want to say the election is over. I just want to say Congress has certified the results without saying the election is over, okay?”

His daughter and former senior advisor, Ivanka Trump, can be heard off camera coaching the president on the precise words to say in the video.

In a later moment of footage, Trump stumbles over the word “yesterday” and asks for it to be taken out of the prepared remarks.

In another video shown during the hearing, he smacks the presidential podium while repeating the line: “My only goal was to secure the integrity of the vote.”

Thursday marked the last in a series of televised hearings the committee scheduled this summer.

Former US first lady Melania Trump has denied being aware of the January 6 2021 insurrection as it happened days before her husband, Donald Trump was to give way for the swearing in of then president elect Joe Biden.

Melania said in a new interview with Fox that she was “unaware” of the ongoing capitol hill riot, because she was too busy photographing a rug in the White House.

“On January 6, 2021, I was fulfilling one of my duties as First Lady of the United States of America, and accordingly, I was unaware of what was simultaneously transpiring at the US Capitol Building,” she said.

Melania said it was her “duty” as first lady to archive the contents of the White House.

“As with all first ladies who preceded me, it was my obligation to record the contents of the White House’s historic rooms, including taking archival photographs of all the renovations. Several months in advance, I organized a qualified team of photographers, archivists, and designers to work with me in the White House to ensure perfect execution,” she continued. “As required, we scheduled January 6, 2021, to complete the work on behalf of our Nation.”

Trump’s response comes several weeks after Stephanie Grisham, her former chief of staff, revealed a text message exchange in which the former first lady responded to a tweet Grisham had drafted calling for the violence on Capitol Hill to stop as it was happening.

The then-first lady responded with the word, “no,” declining to send a statement condemning the insurrection.

In the interview with Fox, Melania Trump claimed she was in the dark about what was happening that day even though it was all over social media.

Trump said Grisham “failed to provide insight and information” that day.
“Had I been fully informed of all the details, naturally, I would have immediately denounced the violence that occurred at the Capitol Building,”
Trump said.

“And while Ms. Grisham’s behavior is disappointing, it is not surprising or an isolated incident.”

A court in Turkey has heard how a British holidaymaker pushed her boyfriend to his death from their hotel balcony after a furious row.

According to Mail Online, father-of-one Reece Pegram, 21, died instantly when he fell 100 feet onto a concrete yard from the five-star hotel in Side, Antalya, where he was staying with Mary Meyers Kayley, on the night of March 12.

The court in Manavgat heard earlier this week that when police investigated the death they found bloodstains all over the couple’s room.

Hotel staff reported the pair had been drinking heavily hours before the incident.

Scottish-born Kayley, 31, was said to be so drunk she had to be taken to her room by hotel staff, while court reports stated Pegram went to the hotel lobby around 8pm for booze but was refused service as he was already inebriated.

Traces of cocaine were also reportedly found in Pegram’s body during the post-mortem examination.

Prosecutors told the trial that the couple had rowed furiously in the moments leading up to Pegram’s death. But Kayley, who is facing 24 years behind bars for murder denied killing her boyfriend when questioned by police in the wake of the incident.

She claimed bloodstains in the room were from accidentally cutting her thumb while getting into the shower, while insisting bloodstains in the bed were from a sex session.

She had initially admitted to having an argument with Pegram after finding out he had cheated on her with an ex-girlfriend. But later changed her claims, saying the cut on her hand was caused by a broken glass and that they had argued about drug use instead.

Kayley told the court how she went to the bathroom following the blazing row, but when she reemerged, her boyfriend was no longer there. She said she then went to bed, with police arriving on the scene while she was asleep.

Hayley told prosecutors that Pegram was a drug kingpin back in Britain in an apparent attempt to discredit him.

Explaining that they went to get tattoos and play backgammon at the tattoo parlour, Kayley told the court: ‘Reece is one of the important drug dealers in England. He asked if there was any place to buy drugs here.’

She also claimed that, on the day before his death, he had threatened to throw himself off the balcony but she had managed to talk him out of it.

‘[Reece] wanted to commit suicide because he had psychological problems. I was in the shower at this time, I accidentally cut only my right thumb when I got into the shower,’ Kayley said in a statement.

‘When I got out of the shower, I saw the person laughing evilly to himself on the balcony and said he wanted to commit suicide, I blocked him. Meanwhile, the blood on my right thumb spattered the floor and walls of the room.’

It was also gathered that she tried to get judges to throw out her original police statement on the grounds that her official interpreter had been unable to understand her Scottish accent.

But the court rejected the claim, pointing out that she was using the same interpreter at the hearing, and ordered her to undergo a mental health assessment.

Prosecutors believe Kayley killed her boyfriend out of jealousy and are requesting a life sentence.

In Turkey, the minimum non-parole term for a life prisoner is 24 years.
It is unclear when the second hearing will take place.

English Rugby reveal plans to ban transgender women from playing in women’s games

The Rugby Football Union has recommended a ban on transgender women playing in women’s matches.

The decision has come following a two-year review, and the change in policy could be introduced ahead of the 2022-23 season if approved by the RFU Council.

A statement read: ‘The RFU council will vote on a recommendation for a policy change for contact rugby to only permit players in the female category whose sex recorded at birth was female.

‘This is a complex and difficult decision and the recommendation has not been made lightly or without thorough and full research and consultation.

‘The RFU has contacted registered trans female players, on whom the policy will have a direct impact to offer its support in continuing to encourage them to participate in the sport.’

The current policy had seen the English governing body allow some transgender women to play women’s rugby on a case-by-case basis.

However, English rugby has now changed its mind, saying research provides evidence of ‘physical differences’ and ‘advantages in strength, stamina, and physique’ due to male puberty.

They, therefore, said the decision came because ‘the inclusion of trans people assigned male at birth in female contact rugby cannot be balanced against considerations of safety and fairness.’

The decision on transgender players sees the RFU align with World.

The statement read ‘Transgender women may not currently play women’s rugby… because of the size, force- and power-producing advantages conferred by testosterone during puberty and adolescence, and the resultant player welfare risks this creates.’

Girls and boys will remain unaffected by the decision and can play in their respective current teams until they turn 12.

Should the decision be approved professionally, however, rugby union would follow in the footsteps of triathlon, which last month became the first British sport to ban all transgender women from competing in female events at an elite and grassroots level.

International swimming federation FINA have also banned athletes who have been through any part of male puberty from elite women’s competition.

Ex-Trump advisor Steve Bannon convicted of contempt charges in Jan. 6 capitol riot case

Steve Bannon, an ally of former U.S. President, Donald Trump was convicted Friday, July 22 of contempt charges for defying a congressional subpoena from the House committee investigating the Jan. 6 insurrection at the U.S. Capitol.

Bannon was found guilty after a trial that lasted for five days in federal court in Washington on two counts: one for refusing to appear for a deposition and the other for refusing to provide documents in response to the committee’s subpoena.

As at the time of the insurrection on Jan. 6, 2021, Bannon was serving in an unofficial capacity to Trump. The committee, which held a prime time hearing Thursday that included Bannon comments of Trump’s post-election strategy, wanted to speak with Bannon because it had information that he was actively involved in planning, logistics and fundraising for Trump’s efforts to overturn the 2020 election using the Capitol Riot and stop Congress from certifying Joe Biden’s victory.

The panel’s subpoena demanded any documents or communications relating to Trump and others in his possession, including lawyer Rudy Giuliani.

The jury of eight men and four women deliberated for just under three hours before returning the verdict.

Evan Corcoran, Bannon’s lawyer, argued that the charges against him were politically motivated and that Bannon had been engaged in good-faith negotiations with the congressional committee over his concerns about testifying. “No one ignored the subpoena,” Corcoran told the jury.

Corcoran tried to establish that the deadline for Bannon to appear before the House committee was flexible, as long as the two sides were negotiating over the timing. He said testimony from the House panel’s chief lawyer, Kristin Amerling, made it clear “that the dates were in flux.”

Corcoran said that “no reasonable juror could conclude that Mr. Bannon refused to comply.”

Bannon’s team told the judge that Bannon saw no point in testifying at his trial since Nichols’ previous rulings had gutted his avenues of defense. His lawyer also said that Bannon’s team was barred from calling as witnesses House Speaker Nancy Pelosi or members of the House panel.

Another Bannon lawyer, David Schoen, said Bannon “understands that he would be barred from telling the true facts.”

Bannon was indicted in November on two counts of criminal contempt of Congress, one month after the Justice Department received the House panel’s referral.

Assistant U.S. Attorney Amanda Vaughn told jurors that the subpoena issued to Bannon “wasn’t optional. It wasn’t a request, and it wasn’t an invitation. It was mandatory.” She added: “The defendant’s failure to comply was deliberate. It wasn’t an accident, it wasn’t a mistake. It was a choice.”

Ukraine and Russia sign United Nations-backed deal to restart grain exports to solve global food crisis

Russia and Ukraine have agreed to restart shipments of blockaded grain, in a step toward easing a global crisis that has exposed tens of millions of people, especially in Africa and the Middle East, to the threat of acute hunger, the U.N. secretary general announced on Friday, July 22.

Before Russia’s invasion of Ukraine in late February, the two countries were among the world’s top producers and exporters of grain, cooking oil and fertilizers. Last year, Ukraine accounted for 10 percent of global wheat exports, according to the United Nations. More than 20 million tons of grain have been stuck in Ukraine’s Black Sea ports, causing worldwide shortages and fears of worsening hardship to come.

In a sign of the sensitivities weighing on the deal, representatives from Russia and Ukraine did not sit down together at the Istanbul ceremony, which was presided over by U.N. Secretary General António Guterres and Turkish President Recep Tayyip Erdogan.

“We did not reach this point in an instant,” said Erdogan, whose government maintains close ties with both Ukraine and Russia. He called the negotiations to reach an agreement “intense and arduous.”

One of the two agreements signed Friday in Istanbul, brokered by the United Nations and aided by Turkey, guarantees the safe passage of commercial ships from the Ukrainian port of Odessa and two other ports, which are currently cut off by a Russian naval blockade. A similar agreement is supposed to facilitate Russian grain and fertilizer exports worldwide, they said.

As part of the deal, grain ships will be able to navigate through a safe corridor in the Black Sea then pass through the Bosphorus in order to reach global markets, the official said.

The vessels will be monitored by a Joint Coordination Centre (JCC), which will be established immediately in Istanbul and include representatives from Ukraine, Russia, Turkey and the UN.

Vessels would be inspected before they arrive in Ukraine by Russian, Ukrainian, Turkish and UN officials are to ensure they are not carrying weapons from the West.

Ukraine and Russia have agreed not to attack any ship identified as part of this initiative that is passing through the established channels. In case of an incident, the JCC will intervene to resolve any possible issues.

It may take several weeks before vessels start moving so that all logistical details of the deal can properly be implemented and inspection teams can be established.

Nonetheless, the process has to start quickly so that Ukraine’s silos can be emptied for the new harvest, a UN official said to Reuters on Friday.

The deal is valid for 120 days from the date of signing and can be extended for the same period unless one of the parties has announced their intention to terminate it, said Ukrainian minister Oleksandr Kubrakov, who signed the deal.

THERE IS A REAL THREAT THAT ZAMBIA MAY SLUMP INTO AN ECONOMIC RECESSION

A country’s economiy is driven by the following factors:

  1. Consumer spending
  2. Government spending
  3. Business spending/ investment
  4. Net Exports

Consumer spending is important because private consumption constitutes two thirds of all economic activity in most countries and Zambia is no exception.

But in Zambia’s case we have seen that , historically, Government expenditure plays a catalytic role in driving consumer spending, even though it may only account for 25- 30% of total economic activity .

It is evident ( anecdotally and statistically) that the current levels of consumer and government spending in our country are pretty low and that is worrying ( to put it mildly) and something has to happen to introduce stimulus into the economy.

It is not clear why both Government and consumers are not spending although there are various hypothesis out there including assertions that Government coffers are empty. The other assertion is that consumer confidence is low because of the uncertainty in government policy direction as those who are able to spend become less certain about their financial prospects and safety of assets. Not to mention the much publicized fight against corruption , which may have put fear in some people’s spending habits and the threat of life style audits. It could also be simply that consumers have no money to spend because of the erosion in purchasing power over the last few years,not helped by the pandemic. But it is evident that even though retail sales in shopping malls may have improved slightly , we are still in a depressed state.

The problem with the lack of or decline in consumer and government spending is that it puts pressure on businesses because they are also unable to increase production or stock up on goods necessary to keep the economic engine running.

It would seem that the only silver lining in Zambia’s case is the high copper prices, which , in theory, should lead to higher export earnings. But how much of that advantage feeds into the local economy through tax and other Govt revenue collections is open for debate . The other debate is on whether the rise in copper prices has resulted in increased job creation as well as increase in income to mine suppliers . Anecdotal evidence suggests that not to be the case.

WHERE TO FROM HERE THEN?

I think Government has no option but to introduce some level of stimulus into the economy via their own spending and various public private partnerships.

We have heard about Govt releasing circa K23 billion ( although one doesn’t know what release really means) in the first quarter , through payment to suppliers, pensioners and other Govt services but that, in truth, is not being felt on the ground- so it would seem. We have also heard that CDF funds have been released to the constituencies but once again , there is very little evidence that anybody has received these funds and therefore helped to spur local business or consumer spending. Govt tenders which , traditionally, spur business activity also seem to have dried up. We have heard that Govt is conducting audits on suppliers before payment to suppliers and presumably then new tenders will be put out thereafter.

The nation is also waiting for what happens with the much talked about IMF package and how that will drive economic growth if at all.

The message is clear though : The lack of expenditure by key drivers of an economy may lead to a RECESSION. I would argue that Govt needs to accelerate their processes in order to introduce liquidity into the economy and hopefully that will then lead to consumer and business confidence to spur the economy further.

Time is of the essence . Waiting for all the stars to line up before taking remedial action is a dangerous game ,in my view.

Shiwang’andu Member of Parliament Stephen Kampyongo has called on the New Dawn Administration to give former president Edgar Lungu the respect he deserves.

Hon Kampyongo said despite Lungu being a statesman, government should not expect him to be quite even when they are dragging his wife out of the bedroom.

He said that the former Head of State still can give an opinion on matters of national importance.

Commenting on the ZESCO issue, Kampyongo said the country no longer experienced load shedding but the current administration fails to recognize president Lungu for his efforts.

The lawmaker said this when he and other PF MPs addressed the media at Parliament today.

“We are happy that we saw the President at Kafue Gorge officiating at that very momentous occasion for ZESCO. And it doesn’t cost much Mr President because your predecessor was there to launch that project you were commissioning,” he said.

“So why should it be a problem just to recognize that simple effort of your predecessor? Because the dividends that are coming from there were planted by someone. So you can’t just appreciate the harvest without acknowledging those that planted. And this brings me to the point that we heard from the Managing Director for ZESCO……. that Zambia has got a surplus.”

He reminded members of the public that not too long ago Zambia had a deficit in terms of power.

“We had to import power at a higher cost. So if now we have a surplus, how are the Zambian people now benefiting from the surplus? What are the tariffs that Zambians are paying for this power they are supposing to be benefiting from? So we want the current government to appreciate the effort of our former president because it calls for effort,” he said.

“Today there is no load shedding. No one is speaking about it. They are talking about surplus, how did that come about? And some of this debt being talked about its what government contracted to ensure that we dealt with the energy sector.”

And Kampyongo stressed the need for the former Head of State to be left alone as he has taken leave.

“So today you can call for the removal of the immunity, people are aware of his services. He has taken leave he has gone but they want to drag him. Let’s give him the respect that he deserves,” he said.

“But that does not mean he will remain quite. Even when you enter his bedroom and drag his wife out he should remain quiet and say no if I come out they will say we will remove your immunity. Those are constitutional matters. Let us not gag him because even when he says he is a statesman; he will have opinions to give.”

THE incompetent UPND government should stop hiding behind global economic forces for the astronomical prices of essential commodities and harsh living conditions it is subjecting Zambians to.


We are reminding the regime that Zambians are not interested in hollow economic theories such as those reeled by UPND member Noel Nkhoma on a radio programme yesterday. They are intelligent enough to know when an incompetent regime is trying to lie its way out of its responsibilities and is trying to shift the blame elsewhere.


It is the responsibility of the government to provide solutions and cushion vulnerable citizens from the high cost of living. And one of the ways of doing this is the provision of subsidies until they have the capacity to fend for themselves.
The social cash transfer the failed regime is trying to use for hollow propaganda has a limited reach, catering for only a fraction of the vulnerable citizens.


The vast majority of citizens are suffocating from the high cost of living and no amount of public relations will give them relief.
It is hypocritical and grossly immoral for Mr Nkhoma and the UPND to stand on a hill screaming that the war in Ukraine and other global factors are the cause of the high prices of fuel, transport and basic foods.
Are these people serious?


When the PF government cited the negative impact of the pandemic, partial shutdown of the global aviation industry and shipping on which Zambia’s exports and imports depend, the partial drought and flash floods the same hypocrites dismissed the explanation saying it was poor leadership to blame.


We therefore urge Mr Nkhoma and his party to stop insulting Zambians with text book economic theories which will not make food, fuel and transport affordable.


Zambians are fully aware of where the instructions to remove subsidies from fuel and electricity have been coming from.
We have a government that is only good at rubber-stamping decisions and policies made by its foreign masters who are now running the country.


For once the New Dawn regime must own up and boldly tell Zambians that it does not have answers to their suffering because of poor leadership.


Only UPND cadres and sympathisers are seeing the imaginary improvement in the economy.
Stop boring citizens with the irritating song about global economic fundamentals and admit your failure. Running from one radio station to another to parrot text book theories is only annoying the hungry Zambians and struggling commuters more.
Provide solutions.

MANY people were expecting that former president Edgar Lungu should have been behind bars, says UPND spokesperson Cornelius Mweetwa.


Featuring on Radio Phoenix’s ‘Let the People Talk Programme’ on Tuesday, he said Lungu was still free and there was no talk of lifting his immunity because of President Hakainde Hichilema’s magnanimity.


Mweetwa, who is also Southern Province minister, said currently there was no conversation to lift the immunity of the former president.
“The issue of removal of former president Lungu’s immunity, I am not aware of. And I am speaking as an insider, both as a party spokesperson of the UPND and also as a minister. I sit where the highest decisions for the country are made. There has never been, anywhere, where a motion has been passed either at party level or at Cabinet level to say let us lift the humanity of president Lungu. So we are not privy to such kind of position,” Mweetwa said.

“What I am aware though is that arising from the comments he made, our youths reacted. They reacted rather emotionally because they thought that after how Lungu mistreated HH as leader of the opposition that he could not be allowed to fly in this country, he was told ‘if you fly we will bring down your plane, you have no authority’…When he [HH] arrived in Chipata, he was stopped in town. He had to beg police for two, three hours. He had to escape through the roof at Sun FM in Ndola. That he had to be incarcerated for four months, charged with treason. That he had to be incarcerated in Livingstone for six days charged with murder both of which are non bailable and 14 times arrested and abused like no other before told that by mere of your tribe you can never lead this country. You are not worthy. ‘Oh ok another Tonga can be but not this one’. That is where we are coming from. This (Hichilema) is a President who has a big heart. Many people thought president Lungu by now should have been behind bars.”
He recalled Lungu vowing to arrest Hichilema after the August 12, 2021 elections.


“Contrary to his own proclamations when he said ‘when I hand over power to myself in the next four days I will arrest HH and this time, he is not coming out’. And his henchman Antonio Mwanza said when he gets HH in ‘he will not come back alive, he will die in prison’. This is where we are coming from and these are the realities of the matter,” said Mweetwa. “But we have a President with a big heart. He has decided, let me focus my attention on what matters more to my people. Let freedoms reign supreme. Let those who want to insult me, insult me because there is a law to take care of them and when they are arrested give them bond and don’t arrest them before you investigate them.”

The Ndola Magistrate courts has heard a chilling testimony of how a 30-year-old Ndola housewife allegedly defiled her son’s-eight-year-old friend, who is a grade one pupil at a named school in Ndola.

According to a report published by Mwebantu, Sandra Mwale is believed to have persuaded the boy to her bedroom on five occasions and had sex with him when he went to her house to play with her son.

Mwale is charged with defilement of a boy under the age of 16 which occured in June this year.

When the matter came up before Magistrate Veronica Sikwangala, Mwale pleaded not guilty to having had carnal knowledge of the boy.

According to one of the witnesses who is the victims aunt, she told court that on the fateful day, her nephew who is a grade one pupil at named school instead of knocking off from school at 12:00 hours, he went back home at 16:00 hours.

She narrated to court that she found him sitted outside the veranda of their house at 17:00 hours and that when she asked him what he was doing at school up till that hour, he told her that he was playing at the school grounds.

She told court further told court that at around 18:00 hours, her nephew asked for food as he was hungry, but that she told him that she could only give him the meal after he stated where he had gone to.

“I then got a whip to ask where he went ,but he still did not tell me. Around 19:00 hours while I was cooking, my then called me and informed me that the child wanted to tell me something. He then narrated to is that he had gone to his friends place and whilist there, his friends mother called him to her bedroom, undressed him and told him to play with his penis. Thereafter, she inserted it in her private parts,” she told court.

She narrated to the court that when she asked her nephew if it was the first time Mwale was doing such a thing to him, he told her that it was the fifth time.

She further told court that when she checked her nephew’s private parts, she discovered that his foreskin was pulled backwards and that his penis appeared redish.

“He then told me that he was feeling pain when urinating and that was when I reported the matter to the police and my nephew was taken to Arthur Davidson’s Children’s Hospital where he was given medication,” she said.

ABOUT PROLONGED DETENTION WITHOUT TRIAL: A CASE OF MUMBI PHIRI & MANY OTHERS

1. It has been more than 5 months since Mumbi Phiri was detained on 18th February 2022 and subsequently charged with an alleged offense of murder on 24th February 2022. The alleged murder in question is that of a United Party for National Development (UPND) cadre; Lawrence Banda who was allegedly shot dead on Sunday, 6th October 2019 during the Kaoma Council Chairman by-election. This was when the Patriotic Front administration was still in office and Mumbi Phiri was the then Deputy Secretary General of the Patriotic Front. The shooting of Lawrence Banda happened when a PF campaign convoy crashed with a UPND campaign convoy and violence erupted thereafter. Suffice to mention that such scenes of extreme violence were very common at that time and were instigated by both PF and UPND almost in equal measure. As to who, between the PF and UPND instigated the violent crash that resulted in Lawrence Banda’s death, it is for the police to investigate and tell us during trial. Apart from Mumbi Phiri, Shelby Chilekwa has also been charged with murder in this same case.

2. There are three key issues that arise with regard to Mumbi Phiri’s arrest and subsequent prolonged incarceration without trial. The first issue is that this is evidently a politically motivated case, given the fact that Mumbi Phiri as Deputy SG of the PF, was a major critic of the current President Hakainde Hichilema, during his time in opposition. The second key issue is that the publicly known circumstances of the murder in question make it difficult for one to comprehend how two people; Shelby Chilekwa and Mumbi Phiri could both be involved in shooting a person who is reported to have only been shot once. The third key issue is the heavy-handed manner that the State has dealt with this case starting from the initial arrest of Shelby Chilekwa who is said to have been taken to an unknown location for more than a week and had no access to his lawyers and when he subsequently appeared, had visible marks of torture and he also testified to his lawyers that he had been brutally tortured by the police.

3. It is also common cause that the lawyers for Mumbi Phiri had applied for a preliminary inquiry at the Magistrates Court, which we understand was granted by the Court but was never undertaken. The state has since kept Mumbi Phiri and Shelby Chilekwa away from court ever since. Such a preliminary inquiry compels the State to present the evidence that they have against the accused persons, and the Court would make a ruling on whether the evidence presented is sufficient to warrant going to trial. Given the reluctance of the State for 5 months now, to take Mumbi Phiri and her co-accused to Court so that the Court can undertake the said preliminary inquiry, it is quite apparent that the State may not have sufficient evidence to sustain a murder charge against the duo. But they want to punish Mumbi Phiri and her co-accused as much as possible before they can be released. In other words, they want to exact extrajudicial punishment.

4. This has been the basis of our advocacy for Mumbi Phiri and her co-accused to either be taken to court or released immediately. Our advocacy has been directed to President Hakainde Hichilema for two particular reasons. Firstly, he is the Head of State and therefore the buck stops with him. He is the one who appointed Mumba Malila as Chief Justice, whose subjects prepare the cause list for court appearance, he is also the one who appointed Lemmy Kajoba whose police officers are responsible for transporting Mumbi Phiri and her co-accused to Court, as well as appointing Frederick Chilukutu, the Zambia Correctional Services Director General whose charges are keeping Mumbi Phiri in Mongu Central Prison.

5. Secondly, Hakainde Hichilema made a very unfortunate statement during his last press conference at State House in which he said if it was up to him, he would change the law so that those accused of corruption can be detained for up to 90 days before being taken to court. Clearly the President appears to have very little understanding on how the rule of law should work. To him, a person is guilty simply because they have been accused of committing an offense, even if they have not been subjected to any trial. He sees a trial as an unnecessary inconvenience. For a person who wields so much power as Republican President, that is a very dangerous mindset to have. Indeed, in Hakainde Hichilema we have a President who is either extremely naive or who has an extreme appetite for dictatorship or both. Either way, if we relent in holding him accountable, this country will take so many backward strides as far as the rule of law is concerned.

6. Our advice to Hakainde Hichilema is that he should use the power which the Zambian people bestowed on him on 12th August 2021, to do good for the people. Let him use his Presidential power to lift people out of poverty, reduce the cost of living, grow the economy, create jobs, enhance the rule of law and constitutionalism and just make Zambia a better place than he found it when he ascended to office. It is common cause that Hakainde Hichilema was mistreated and persecuted by the previous regime during his time in opposition, but he must aspire to be a better person than those who persecuted him. He must set better standards, for it is on the basis of the standards that he sets today, that he will be treated when he leaves office. He must be continuously conscious of the bed that he makes today, for he shall one day be required to lie in it. Take Mumbi Phiri to court or release her from prison.

On 19//07//2022 I went to Sinda in eastern province because my young brother was sick so we went to pick him up.We arrived in Sinda around 17:00hrs and reached back in Lusaka at 01:00hrs I only slept for 2 hours and started preparing to walk.I had made arrangements to move with a friend but when I called him he stopped picking up calls when it was time to start off.I had to brave it alone because I have always believed that as a leader you should be prepared to walk alone.

When I started off on 20//07//2022 at around 05:00hrs it was all rosy until I reached katuba toll plaza,my feet developed blisters which made me start limping.I felt so tired and due to fatigue I developed fever and headache,I rushed to a pharmacy as soon as I reached chibombo and bought Domadol a pain killer but I was also worried because I was in Mpika two weeks ago burying my grandmother so the signs were also pointing to malaria because of late I had actually lost appetite and the entire first day of my walk I only drunk coca-cola and water.For that reason I had to self prescribe and started taking coartem.I had to put myself on antibiotic cover ciprofloxacin aswel because I knew due to the fatigue if I had any other infection it was going to surface.

As I was in chibombo I was offered free accommodation by people happy with the walk that’s how I spent a night there.I remember at some point thinking of quiting especially that people were calling my parents telling them that I had gone mad because I lost my job.I had to reassure my parents that it was for the right cause and they understood.

My biggest disappointment came from friends I have had in the past,who knew me so well and how I stand on facts.One of them called me and my first impression was that he wanted to encourage me especially that at that time I was now moving from John to prospect while limping.To my surprise he called to ask if I was ok and that one day all shall be well he urgently needed to meet me and that I didn’t know what I was doing.I felt insulted but I only told him,”I will call you later.”

Then I received a call from another friend who was being asked whether I had gone mad or something.My greatest support was the strangers who kept calling me and comforting me each and every time.The media also helped me believe that someone was watching what I stood for.The people I met on the road were also very encouraging such that some of them actually escorted me when i reached bushy places.

I finally arrived in kabwe on 21//07//2022 around 18:00hrs and people were happy to meet me.Its when now the same people who were condemning and doubting my mental status started calling to congratulate me.I wish to appreciate my family for standing up against all the negativity people brought towards them as I moved.

GOOD governance activist Brebner Changala says the Anti-Corruption Commission and Drug Enforcement Commission (DEC) will not act on UPND corruption as they will be waiting for the party to first lose power.


In an interview with The Mast, Changala wondered where the law enforcement agencies were when crimes they are now investigating in the previous administration were being committed.


He stresses that Zambia “must change the way ACC runs. The way DEC runs and we must operationalise the Public Protector. We need to start arresting serving ministers. We need to start arresting sitting first ladies”.


“The previous ministers, permanent secretaries and those who served under the Patriotic Front are being summoned one by one to the Anti-Corruption Commission, we are having this mantra of persecution. The reason is very simple, these Anti-Corruption Commission officers, the DEC officers, the police, where were they when these people were committing these offences?” he asked. “These are people who have just left government and the ACC and the DEC is energised to investigate these matters. The question is, can they search the investigators themselves, the ACC and the DEC? Can they search themselves to own up! It is very critical, let them own up and clearly state that we could not investigate these matters although we were aware because of political interference.”


Changala emphasised that “these are crimes committed a long time ago”, which should have been probed then.
“These were cases that were not committed yesterday under the UPND. These were cases that were committed under the Patriotic Front and it is the Patriotic Front which has come to account today. And the same officers who were there under the Patriotic Front they never resigned because they were told not to investigate. Now they have risen. In short, this same Anti-Corruption Commission and DEC, they are not going to act on the corruption of the UPND. They have to wait for the UPND to leave power. That is where I have a problem,” Changala said. “You know, when you arrest a serving minister, it is easy to energise the public confidence. But when you arrest a former minister, it is easy to claim persecution. Very easy. We must change the way ACC runs. The way DEC runs and we must operationalise the Public Protector. We need to start arresting serving ministers. We need to start arresting sitting first ladies. We need to start arresting serving directors.”
Changala has since called on law enforcement officers to resign on moral grounds if they are stopped from investigating a certain case.
He said there was need to bring new officers in the law enforcement agencies.


“We need to be up to date with the crime index. What we are seeing when PF came into power, all MMD ministers were called and there was a lot of drama with the same ACC and DEC. A lot of drama. And they only secured one conviction. That of Maxwell Mwale. When it came to the former first lady Thandiwe Banda, Thandiwe Banda was arrested over Mphundu Trust. Later on, the matter went under the water. Mphundu Trust is still open by the former first lady,” he explained. “But check the drama we were subjected to! Because there is a political hand, there is no professionalism and our colleagues at ACC when they are told ‘don’t investigate’ they are supposed to resign on moral grounds… Because, if you know there is a case, you must pursue that case. If you are told ‘don’t’, say I am also going away because this is a good case, I must pursue it. Now when all criminal cases of ACC, DEC are politically inspired, people are going to claim persecution. So, we need ACC and DEC to account. Where were they when these crimes where being committed? This is why we need a commission of enquiry, or else we need DEC, all the staff out, ACC all the staff out and start afresh because you cannot launch an investigation that is politically inspired. That is injustice.”


Meanwhile, Changala has called for a commission of enquiry on the performance of the PF administration.
He has also called on former president Edgar Lungu to tell the nation who else advised him against giving up power other than Antonio Mwanza.


“Difficult times place many human beings under stress. The revelation by our former president Edgar Lungu that he made a right decision and he did the right decision, now for them who were begging him not to concede defeat, hang on to power and put the country in total chaos are guilty. They are guilty in the sense that they were trying to overturn the people’s democratic choice to change government and bring in a new administration. And one individual cited by the former president, Mr Anthonio Mwanza, there could be many but we can discuss only one individual because he was mentioned by the former president,” said Changala. “It is very unfortunate that a young man with full education but for the sake of self-preservation can engage himself in treasonous acts. At that point when Mr Edgar Chagwa Lungu lost power, he still enjoyed State power. He was still commander-in-chief of the armed forces, and head of state as the law stipulates until another person is declared winner and sworn in. So, there was a cavalier of Patriotic Front members who wanted to subject the elections of the 2021, and allow the former president to use state institutions and state power to do something that was illegal. So, to Mr Edgar Chagwa Lungu I say thumbs up! And if he can tell us more on those people of Antonio Mwanzas plus who were telling him not to hand over power or indeed not to concede defeat. I know they have started a new angle, they are telling this country that the one million excess came from three provinces only, how possible is it?”
