…private auditors can’t audit security wings of the state

Former Defense Minister Geoffrey Bwalya Mwamba, GBM, has charged that the government of President Hakainde Hichilema has contravened section 24(3) of The Public Audit Act which prohibits any private entity from auditing the defense and security wings of the state.

Mr. Mwamba says the act is intended to safeguard state security by limiting access to sensitive information. He says outsiders may not be expected to appreciate the strategic nature of the information they may come across if allowed access to security data.

He dismissed as grossly misleading, disappointing, and disheartening that government should defend their illegal action by saying that private auditors appointed to audit the Ministry of Defense will be restricted to food supply contracts only.

“Any military expert will tell you that food is as much a strategic element in national security matters as military hardware is”, Mr. Mwamba says. How much food a military buys and has in stock, Mr. Mwamba says could say to a significant extent what its strengths and weaknesses may be.

The aspiring candidate for the position of president in the Patriotic Front says President Hichilema is demonstrating the dangers of electing into the highest office in the land someone with no single grain of experience in government and public affairs.

Mr. Mwamba says the justification advanced by government is extremely careless while deeply troubling at the same time, adding, “these guys are toying around with the most sensitive nerves of statehood”.

As a former Defense Minister, Mr. Mwamba says he feels compelled and obliged to guide both government and the nation regarding matters of national security. Referring to Zambia’s geopolitical position, Mr. Mwamba says Zambia is located in a part of Africa that has seen political and security instability going back to the early 70s when the country hosted liberation war movements, hosting refugees, participating in peacekeeping operations and mediating in peace talks.

“We have remained largely peaceful because we have always invested well in our security apparatus which includes passing legislation that restricts who accesses sensitive information related to our security sector”, Mr. Mwamba says.

He has warned that President Hichilema risks harming the very constitution and state he swore to defend if he pursues his so-called fight against corruption without paying attention to the demands of the law. If he does not reverse this course, Mr. Mwamba has advised that the Law Association of Zambia and civil society must consider approaching the courts of law to interpret section 24(3) of The Public Audit Act.

The act reads, “despite the provisions of subsection (1) the auditor general shall not permit any authorized person, agent of specialist consultant to have access to any book, record, returns report or other document, or to enter –

(a) The premises of any component of the Defense Force, national security services or a law enforcement agency, or
(b) Premises other than those mentioned in paragraph (a) if such access of entry is likely to – (i) prejudice the security, defense of international relations of the Republic or the investigation or detection of offenses, or
(ii) involve the disclosure of any matters or deliberations of a secret or confidential nature of the cabinet or any committee of the cabinet

  1. Conflict of interest ba GBM … Kikikiki
    GBM knows he will be exposed! The Financial irregularities GBM presided over will soon be exposed!
    It’s not the Security Installations being audited but the Dubiously awarded contracts. PF has been shouting on mountain tops to get contractors paid and yet most of these Contractors are for the Senior PF leaders! The objective of the audit is to establish if the money’s being claimed by PF contractor including GBM are justified or not!
    The truth is going to come out!
    Don’t try to hide behind legislation quoted out of context!

  2. There is a blogger going by the Name of Bongobongo Brain whose insults are just getting too much. This person is a curse to civility. If these are the people the UPND has unleashed on Zambia, then the Party is completely useless just like this Bongobongo brainless.
    The more he insults , the more i hate the UPND. I have even stopped listening to the President’s Speeches or anything from the UPND. All i see in UPND are the daily insults we are subjected to.

    (1) In the performance of his duties under this Act, the Auditor-General and any public officer, agent or specialist consultant authorised by him shall have

    ( a ) access to all books, records, returns, reports and other documents relating to the accounts of any statutory corporation, public company, Department or private institution under audit examination or inspection;
    (b ) access at any reasonable time of the day to the premises of any statutory corporation, public company, Department or private institution under audit examination or inspection;

    The Auditor-General shall not authorise any agent or specialist consultant
    a ) to have access to any books, records, returns, reports or other documents, or to enter upon any premises, of any component of the Defence Force or the Zambia Security Intelligence Service;
    b) or to have access to any books, records, returns, reports or other documents, or to enter upon any premises other than those mentioned in paragraph ( a ),

    IF such access or entry is likely to
    (i) prejudice the security, defence or international relations of the Republic or the investigation or detection of offences; or
    (ii) involve the disclosure of any matters or deliberations of a secret or confidential nature of the Cabinet or any sub-committee of the Cabinet.

    Take note of the little word ‘IF.’
    The AG can authorise an agent or specialist consultant to audit the Defence Force or Zambia Security Intelligence Service IF there is no security risk. WHO determines that there is or there is no risk? It will be the defence and security wings themselves! Their Commander-in-chief is the Republican President. The President, therefore, has power to permit the AG to audit the defence and security wings just like FTJ Chiluba had power to declassify the State House tunnels.
    IT IS NOT A SECRET IF THE PRESIDENT SAYS SO!

    So, come on now, let us see the thieves who were paid under the secrecy of defence and security who never delivered even a ‘matchstick!’

    Ichipani & it’s cohorts have conveniently been “omitting” the “IF” part. The speaker was right to ask them to seek judicial redress than wasting parliament’s time.

    All plunderers must be exposed, let them oso taste the bitterness of the poverty they inflicted on us. But jail should come first….

    • There is no need to respond every barking dog. I used to think Mundubile was a renowned lawyer kanshi awe sure he is a dunderhead. Then you have abena Kafwaya jumping on the bandwagon like a real headless chicken; yet one would expect him to know better because he has a university degree
