CONCEPTOR ZULU’S JUDGEMENT COULD VALIDATE BANDA’S LEADERSHIP TAKEOVER CLAIM AS UPND PRESIDENT
The Whistle Blower has released an archive photo showing that Patrick Tembo Banda, the man at the centre of the UPND leadership wrangle is actually a party insider.
Mr. Banda is seen seated next to the current first lady, Mutinta Hichilema, during an event where Mr. Hakainde Hichilema was being unveiled as party President, taking over from the late Anderson Kambela Mazoka.
Mr. Banda and his colleague Charles Longwe have thrown the ruling party into a leadership dispute claiming that the current office holders are in office illegally as their mandate expired in February, 2026.
Pundits argue that Banda, who has purported to have taken over as interim UPND President, could be on legal firm ground going by the recent Highcourt judgement by Justice Conceptor Chinyanwa Zulu in Miles Sampa case where she ruled that in the absence of the Central Committee, a member of the Party can take over as President.
Banda has since appointed Longwe as Secretary General of the UPND.

Then he moved to PF in all Bye Elections for his Candidates to stand against themselves…from Petauke Council Chairpersons elections, to Kabwata, Kabushi and Kwacha Parliamentary Bye Elections. Arrests of Hon Nixon Chilangwa and Hon Ronald Chitotela.
Then the blatant abuse of Democratic Institutions of Governance to deciminate the Patriotic Front.

Sampa judgment was fact‑specific and party‑constitution‑specific. It did not create a universal rule. Instead, it created a precedent that may be cited, but only becomes relevant if:
(1) The party constitution is similar,
(2) The leadership vacuum is real, and
(3) The court agrees the circumstances match.
Mr Banda is a very serious joker, who thinks he can remain a trusty for ever. Polical parties are just like business entities.The political parties grow if they are managed well and office bearers come and go.If he has been a trusty all along which I doubt doesn’t make him an executive to dictate and run the party automatically.The office bearers are currently available and the process of changing is about to happen if or where possible when the date is announced.An old timer can not just rise and make appointments single handedly and suddenly.That is lawlessness.Who are you trying to imitate to cause confusion?The path you are trying to use is not near normal.And it can’t be tolarated by any one.There is no precedency to relate to here.

The BRIAN MUNDUBILE and OTHERS V MILES SAMPA is a Court Precedent, passed by our Courts in Zambia.
It’s now part of our LAWS of Zambia.
In the absence of valid Structures in a Political party, a member of that party can assume Leadership, bundle the Chama Americas and FBI type of delegates to Mulungushi Conference Center, organize a Convention, under State Police Protection, and become a LEGITIMATE President.
This is LAW in Hakainde’s Zambia.
The mandate of the UPND Leadership, the President, Secretary General and NMC expired in February 2026.
Mr Patrick Tembo Banda, a TRUSTEE and founding Member of the UPND, saw a Vacuum, and installed himself as INTERIM President, to oversee the activities of the Party till a Convention is held.

The Mundubile Vs Sampa case is different from the UPND issue.Remember that late ECL was firstly reported to have resigned.Big Lubinda was left to run the party, later positions were advertised and some hopefuls applied and paid money.Time passed and the convention was never held.The money that was paid by hopefuls has not been payed back.Sampa with his initiative held a convention on independence day and that is the one considered to be normal.Mr Banda has not held a convention but he is trying to assume responsibility because of being a founder member a “trustee for many years”.He has even appointed his own friend as Secretary General of the party.His action is different from what Sampa did.The UPND has not taken so long to hold the convention and if any thing it shall be held in few days time.The UPND has not collected money from any body.The PF did collect the money and failed to hold the convention there after.The Judge could have seen some sense in Sampa’s action because the vacancies remained open for too long unnecessarily.Mr Banda is just doing some drama to make the UPND to do the needful quickly.He is having interest.The one thing that needs to be done is to expel disrespectful characters and must not attend the coming convention.We need order in the country.Lawlessness breeds anarchy.
If UPND lacks a Central Committee, the Sampa judgment may provide a legal argument for Banda’s position. If UPND has a functioning Central Committee, the judgment does not support that claim.
