ACC CASE AGAINST LUSAMBO FAILS TO TAKE OFF AS DPP IS YET TO GIVE CONSENT TO THE MATTER

THE case in which former Lusaka Province Minister Bowman Lusambo is charged with five counts of being in possession of properties suspected to be proceeds of crime has failed to take off.

This is because instructions from the office of the Director for Public Prosecution (DPP) are not ready.

Mr Lusambo appeared for mention before Magistrate Hamaundu this morning.

Magistrate Hamaundu adjourned the matter to March, 9 this year.

She said Lusambo will continue to appear for mentions until the DPP gives instructions regarding the matter.

Particulars of the offence in count One are that on dates unkown but between May 1, 2015 and 31st December 2021, at Ndola, Lusambo unlawfully acquired property number l / 3976 / m in the name of frontier management services Ltd which property was later transferred to jignesh Prafulchandra Soni at a considerarion of K880,000 his own benefit.

In count Two, Mr. Lusambo is charged with corrupt acquisition of public property contrary to section 34 (1) (a) as read with section 41 of Anti-Corruption act No. 3 of 2015.

It is alleged that Lusambo on dates between 1 January 2017 and 31 December 2018 at Masaiti in the District of the Copperbelt Province of the Republic of Zambia did unlawfully acquire certificate of title in respect of stand number MASAI/LN_1003028/218 in his name thereby obtaining an exemption from paying the sum of K250,000 plot premium land which property was later conveyed to MBACHI NKWAZI at a consideration of K150,000 on act prejudicial to the rights and interests of Masaiti Council.

In count Three, Lusambo is charged with possession of property suspected to be proceeds of crime contrary to section 71 of the forfeiture of proceeds of Crime Act No. 19 of 2010.

It is alleged that Lusambo on dates between 1 September 2021 and 31 October 2021 at Chongwe in the Chongwe District in Lusaka Province of the Republic of Zambia, jointly and whilst acting together with another person did conceal property number HN 284 situated in Silverest Gardens valued at $60,000 in the names of Nancy Natasha Manase property reasonably suspected of being proceeds of crime.

In count Four, Lusambo is accused of possession of property to be proceeds of crime contrary to section 71 of the forfeiture of proceeds of crime Act No. 19 of 2010.

It is alleged that Lusambo on dates between 1 September 2021 and 31 October 2021 at Chongwe in Chongwe District in the Lusaka Province of the Republic of Zambia, jointly and whilst acting together with another person did conceal property number HN 282 situate at Silverest Gardens valued at $128,000 in the names of Nancy Natasha Manase property reasonably suspected of being proceeds of crime.

And count Five Lusambo has been charged with possession of property suspected to be proceeds of crime contrary to section 71 of the Forteiture of proceeds of Crime Act No. 19 of 2010.

It is alleged that Lusambo on dates between 1 September 2021 and 31 October 2021 at Chongwe District in the Lusaka Province of the Republic of Zambia, jointly while acting together with another person did conceal property number HN 249 situate at Silverest Gardens valued at $60,000 in the names Nancy Natasha Manase property reasonably suspected of being proceeds of crime.
