THE KITWE High Court has declared Christopher Kang’ombe as the duly elected Member of Parliament for Kamfinsa Constituency.

This is after the High Court dismissed the petition by losing United Party for National Development (UPND)Kamfinsa Parliamentary candidate Subeta Mutelo against the election of Christopher Kang’ombe as Member of Parliament for Kamfinsa Constituency in the August general elections.

And in giving the ruling, High Court Judge Abba Patel said the petitioner did not prove her allegations of massive electoral violence and abrogation of the electoral rules.

Justice Patel also said the petitioner did not prove to the court how her allegations against Mr. Kang’ombe of donating mealie meal, money and meat influenced the voting pattern in Kamfinsa Constituency.

She added that despite several witnesses alleging that they received money from Mr. Kang’ombe, they all voted freely on polling day and no one forced them to choose a candidate.

Meanwhile Kanfinsa Member of parliament has thanked the Judiciary for bringing the petition to an end.

Mr. Kango’mbe said the many weeks he has spent at court affected his work in the constituency and he is now hopeful of getting back to work in various communities.

  1. Judge Patel, that is not the issue.

The issue is engaging in illegal behavior expressly prohibited under the electoral act as it has potential to influence voting

You are writing your own rules now

  2. Are we setting a new precedent where there is vote buying and we insist that the petitioner did not prove to the court how her allegations against Mr. Kang’ombe of donating mealie meal, money, and meat influenced the voting pattern in Kamfinsa Constituency?

Justice Patel , do you know the level of poverty in Zambia and how it can influence vote outcome?
It is obvious you have been bought.

  3. This was the worst judgement ever. Its very important to find out how each judge was engaged. Was it through patronage? What would you say if you look at pictures where Kangombe is seen in the same offices with Justice Patel? Doesn’t this show that they knew each other long time ago? It is sad.
