Ezekiel Malambo, the clinical officer accused of raping a student nurse, has informed the court he had ‘two consentual rounds’.
Chete FM’s Christabel Chulu who is closely following the case, reports that the victim has however, told Presiding Resident Magistrate Webster Milumbe that Malambo allegedly dragged her into his bedroom where he forced himself on her.
The 19-year-old lady narrated that she was on her way to her aunt’s place from the boarding house when she recieved a call from the accused who offered a ride.
She added that Malambo asked if could drive back to his house to pick something he forgot before proceeding to her aunt.
The alleged ordeal would later take place in the house.
She explained that he later dropped her off few meters from her aunt’s place where she did not share any details of what happened earlier that day, last month.
She however, shared with colleague at the hospital the following day during attachments.
She was advised to inform the supervisor to told her to report to the police.
But Malambo, 30, argued there was no way they could have had “two rounds” if there was no consent.
During cross examination he asked the alleged victim why she didn’t shout for help while in his house or after dropping her off.
He quizzed her why she didn’t tell her aunt when she reached home or any other close relative and why she didn’t report to police since this was a serious matter.
In response, the lady who claimed to have been traumatized said her aunt has high blood pressure and had no talk time to call other relatives.
More questions and answers were coming at this point as Malambo asked why the final medical report was signed in her absence.
She said she was present when doctor took note of details on a plain paper before transferring the information on to the final document which was witnessed by her friend.
Malambo insisted she agreed to have a second round in which he didn’t use a condom although he ejaculated outside.
Trial continues on June 20 and 21, 2022 as more witnesses testify.
