Elon Musk Forced China to Rewrite Its Laws So Tesla Could Own Its Factory
Elon Musk loves China. He calls it inspiring. But when Chinese officials demanded that Tesla hand over control of its Shanghai plant, he told them no. Repeatedly. For years.
At the 2026 Baron Investment Conference, Musk recounted how Chinese officials insisted Tesla “marry” a local partner and surrender majority ownership. Standard practice in China limited foreign firms to 49 percent. Tesla was so valuable that Beijing eventually waived the rule and let the company own 100 percent of Gigafactory Shanghai. Musk explained what it took to get there.
“Some of the people in the government actually literally yelled at me, like spit-flying type of thing, that we had to get sort of, you know, married to a Chinese partner,” Musk said. “And I’m like, well, we’re just a baby company and I don’t think babies should get married, you know, because that would look funny going down the aisle with a baby. And they’re like, you’re not a baby! And I’m like, no, we’re a baby. And, you know, babies should just, you know, not get married, it’s too young.”
The officials kept pressing. Musk kept refusing. Full ownership mattered because speed mattered. “Mostly it was like, we just need to be able to move fast, you know, and make decisions. And if you’ve got to always ask someone else for permission to do the decisions, then how are you going to, you know, it’s difficult to innovate if you don’t actually…”
Eventually Beijing relented. “So, eventually they said, okay, fine, we’ll change the law and then you can own the factory.”
The result is the highest-volume Tesla plant in the world, producing more than half of the company’s global output. China wanted Tesla’s technology and investment badly enough to rewrite the rules. Musk wanted control badly enough to withstand the yelling and walk away from any deal that diluted ownership. That is how a “baby company” forced a major power to change its law.
