JAY JAY BANDA CONTINUES TO CALL ON SOLDIERS TO REJECT HH

Jay Jay Banda has continued, through his livestreams, calling on soldiers not to allow Hakainde Hichilema to become President, claiming the 2026 tripartite elections were not free and fair. He has also called one donors not to fund the Government.
This is serious because Section 48 of Zambia’s Penal Code criminalises inciting members of the Defence Force to commit mutiny or abandon their allegiance to the President, with the offence carrying a potential life imprisonment sentence.
The Government should investigate his statements and, if they amount to an offence, take appropriate legal action.
It should also pursue the lawful review or cancellation of any asylum or refugee protection he enjoys abroad, through the competent authorities. Article 1F of the 1951 Refugee Convention provides grounds for exclusion from refugee protection in certain serious circumstances, subject to due process.
If there are outstanding cybercrime or other criminal allegations supported by evidence, Zambia should use the proper legal and diplomatic channels to seek his lawful return to face the courts.
