Jay Jay applies for habeas corpus before Lusaka High Court

FORMER Petauke Central Member of Parliament Emmanuel Jay Jay Banda has applied for a writ of habeas corpus before the Lusaka High court through his mother, Grace Banda, stating that the family has not had access to him since his apprehension in Mozambique on October 14, 2026.

In an affidavit in support of the application, Mrs. Banda says she has made several attempts to establish her son’s whereabouts, including visiting various police stations, but has been unsuccessful.

She states that on October 16, 2026, she visited several police stations in an attempt to see her son but was informed by police officers that they were not ready to allow her access to him.

Mrs. Banda further says she instructed her lawyers to write to Inspector General of Police Graphel Musamba, requesting his intervention to facilitate access to her son, but the request has not been granted.

She adds that her son is being held at an undisclosed location and has not been formally charged with any offence since his apprehension, while neither she nor any member of the family has been furnished with particulars of any alleged offence, warrant of arrest or detention order.

The applicant’s mother argues that her son’s continued detention under the circumstances is unlawful, arbitrary and unconstitutional, and has consequently asked the court to compel whoever has custody of him to produce him before the court and explain the legal basis for his continued detention.

Through the application where Attorney General Mulilo Kabesha is the respondent, Mr. Banda is seeking the court’s intervention to safeguard his fundamental right to personal liberty and ensure that his detention is subjected to judicial scrutiny.
