MUNDUBILE, ZULU AND 16 OTHERS TO APPEAR BEFORE THE LUSAKA HIGH COURT

Opposition leaders Brian Mundubile, Makebi Zulu and 16 others are expected  to appear before the Lusaka High Court today, hoping to secure their release after spending close to two months in custody over alleged treason, sedition and terrorism-related offences.

The 18 applicants are seeking constitutional bail, arguing that the State cannot keep them behind bars indefinitely simply because investigations are still ongoing.

They have sued Attorney General Mulilo Kabesha, the Director of Public Prosecution Gilbert Phiri, asking the court to order their release or impose reasonable bail conditions.

The application was filed on September 11, 2026, with the applicants maintaining that their continued detention without trial violates their constitutional rights.

The State has opposed the application, citing the seriousness and complexity of the charges, possible flight risks and public safety concerns.

In their latest response, the applicants argued that the State’s admission that investigations are continuing demonstrates unreasonable delay and cannot justify prolonged detention.

The matter is before the High Court for continued hearing, with the court expected to consider whether the applicants should be released on constitutional bail as they await trial.
