Kafwaya seeks court order over continued detention

Former Lunte Member of Parliament Mutotwe Kafwaya has asked the Lusaka High Court for permission to commence habeas corpus proceedings challenging his continued detention.



Lusaka, 19 August – The application has been filed by his wife, Dinis Ng’andu Kafwaya, who says her husband remains in custody and, to the best of her knowledge, has not been brought before a court of competent jurisdiction.



Mrs Kafwaya is asking the High Court to grant leave for the habeas corpus application and accompanying documents to be filed during the current Michaelmas vacation.



In the application, she argues that the matter is urgent and that any delay could further prejudice Mr Kafwaya and undermine his constitutional right to personal liberty.



Habeas corpus proceedings are intended to require authorities holding a person in custody to justify the legality of that detention before a court.



The former Lunte lawmaker’s continued detention has therefore become the subject of a court challenge, with his wife seeking judicial intervention to establish the legal basis for his custody.

  1. Didn’t someone ask why there was no photograph of his blood after being shot twice in the chest? Has the truth finally come out? I honestly do not know.

  2. Lies have very short legs. Caught lying again. Thought he was shot as disclosed. Same mouth that said he won through the sure PVT.

    It is good the family now knows where their beloved one is. The suspense of not knowing is very bad.

    Some leaders need to tone down. What was all that drama of saying some one was killed when he knew it was a lie. How many more lies to go.

We thank Jehovah God that this man is alive,we were deeply worried because of the information provided by Mr Mundubile and Emmanuel Mwamba.These two men said that Mr Kafwaya had been “shot at,twice” “Had been shot twice” Information provided by Brian Mundubile and Emmanuel Mwamba respectively.
