NKANDU LUO STOPPED BY THE COURTS FROM SEIZING PROPERTIES

A JUDGE has granted an ex parte (one-sided) interim injunction preventing former Minister of Livestock and Fisheries Nkandu Luo from seizing property belonging to Robust Trailers and Bodies Limited.

Should the order be disobeyed, Lusaka High Court judge Mwaka Mikalile warned that Professor Luo and other respondents in the matter risk being cited for contempt of court.Judge Mikalile granted the application for an interim injunction in favour of Robust Trailers and Bodies Limited managing director Christmas Ngoma, who has sued Prof Luo.“It is hereby ordered that an order of interim injunction be and is hereby granted,” Judge Mikalile said in her order dated October 2 this year.

This is in a case Robust Trailers and Bodies Limited has sued Prof Luo in her capacity as Tasinta Programme board chairperson, for seizing its property on disputed rental arrears amounting to K113,700.Mr Ngoma said on December 1, 2011, the company and Prof Luo signed a lease agreement relating to stand 1638/2716 on Malambo Road, Lusaka.

The lease was at an agreed rent of K15,000 per month, payable three-months in advance and for a five-years period.Mr Ngoma said on October 14 last year, Prof Luo wrote a letter indicating that Tasinta was signing up new tenants.He said some time in November last year, the workshop was flooded because part of the roof was ripped but was not fixed despite Prof Luo being allegedly aware.“Intimation was made to Prof Luo that the premises were not ideal for the company’s business operation and amenable to the exorbitant increase in monthly rent of K25,000 from K15,000,” Mr Ngoma says.

He said on January 11 this year, K67,500 was paid through a bank transfer but before the monthend, Prof Luo allegedly issued a vacation notice, indicating that Robust Trailers owed her an outstanding K113,700. Mr Ngoma said on July 1 this year, a further payment of K67,500 was paid through a bank transfer.

“On September 8, 2021, Tasinta, through its advocates Messrs Simeza Sangwa and Associates, demanded payment for the outstanding K113,700 and ordered that Robust Trailers vacates the premises with immediate effect, and to its shock, on September 21, 2021, a warrant of distress was issued,” Mr Ngoma said.

He contends that money being claimed by Tasinta is incorrect, arguing that the balance is K46,000.
