*”The police and legacy of hatred”*

As we commemorate this years Independence, I have taken time to reflect on the future of our men and women in uniform. The deep thoughts about their fate has left million questions in my mind.

Since the colonial days, police officers have been used as a tool of oppression. When the people were fighting for independence, police were used to crush dissidents. At one of the political rallies, one politician to a cheering audience said the following words: “Do you see those men standing behind you?” “Very soon those men will be our dogs”. ” We would just be whistling, and they will follow”. Efforts to demand retraction of the statement went unheeded. But true to the words of this official, he was arrested quite alright on this particular day.Taken to a prison abroad but, when he returned he became a very senior Government official.

He went to the same spot he once used those words and this time the crowd was even bigger. He repeated the same words, only, he was more direct, because the colonists had just handed over power to Zambians.

The agony of being a police officer in Zambia.This man despite being a Senior Government Official still harboured ill feelings towards these poor men and women in uniform. Because of this ill feeling, their conditions of service were never improved. They had just become ‘dogs’, to whom leaders continued whistling and the poor men and women in uniform just followed. Asked to jump, the only question they would ask is, how high, Sir/madam?

Despite being used to crush dissidents, they were never appreciated at all.Unfortunately, for the poor men and women in uniform the status quo continued. They would ruffle a lot of feathers for people in opposition and created enemies who never forgot what they went through at the hands of officers even after forming Government.

When I saw what happened few days ago, I could not help to imagine what would happen to these poor men and women in uniform when Chishimba Kambwili, wife and daughter with the help of Zambians, form government. Would Kambwili, wife and daughter be able to forget and forgive on what happened? Your imagination is as good as mine.

Self inflicted misery, these politicians only see the police as a tool of oppression and nothing else, when they really do not care about them. Maybe for very Senior Officers driven in very expensive cars. Some of us who have been subjected to this police brutality, during our captivity we have been courageous enough to ask them what crimes we have been committing and all they would tell you is that you are innocent and they are just following orders, can you imagine some one pointing an AK-47 on your head without a crime. Just this week UPND deputy secretary General Mr Patrick Mucheleka nareated how an AK-47 was misused to threaten him with death. Just imagine how traumatising this can be. We all have stories to tell one day at a right time.

No wonder even a police officer who became president, who vigorously campaigned against the public order Act, the moment he was sworn in. He went public praising the public order Act that it was the best piece of legislation he had ever seen. All this statement was given for one purpose only, to perpetuate the use officers as a tool of oppression and intimidation against divergent views.Mr. Sata was on several occasions tear gassed by the officers while in opposition.

One may argue that, AVIC has built them good houses. But, what profits an officer to live in a luxurious House yet never respected by even a Branch chairman/woman of the party and its Government? The legacy of hatred is indeed a bitter reality surrounding the police in Zambia and had it not been for the abject poverty our men and womem in uniform have been subjected to by our politicians, majority would have resigned along time ago for being abused.

As we celebrate this year’s independence, let us remember to give our real men and women in uniform operational independence and plan a better future for them. Allow them to be independent to implement their standard operation procedures without due interference to politicians who have never set foot in a police academy. They need our support as citizens for their independence.

On this day I want to send a message of love to all police officers who have been wronged used to persecute us. Our mission is to see you officers operate in a political free controlled environment.By so doing, we will never be able to have reason to hate these men and women in uniform in our transitioning from opposition to power.

In conclusion, Mrs Kambwili and your daughter kindly find it in your heart of hearts to forgive on what transpired at the court on that day. Remember, if only people like your dear husband stood hard against such ill pieces of registration when they were in influential oppositions, some of these happenings today wouldn’t have been affecting us.

Let us all unite and say no to police intimidation, oppression and brutality. Let’s us all turn a corner and use the police for a better good of the country. Unprecedented number of Nolle prosqui is evident enough to the abuse of this noble institution, yet we show no love for them. When as Senior official talking to our children on what not to be. We have told them to study hard or, pointing to the window, they would be like that poor police officer guarding the house.

May God bless Zambia as the struggle for a better Zambia continues.

Andrew Ntewewe calls on President Lungu to expedite the process of setting up of the commission of inquiry into privatization

The Young African Leaders Initiative (YALI) has commended President Edgar Lungu for the gesture to visit the former employees at the defunct Mansa Batteries and his commitment to pay the terminal benefits.

YALI president Andrew Ntewewe has observed that the president becomes the second President in the history of Zambia after Dr. Kenneth Kaunda to visit Mansa Batteries and its former employees in Luapula province who have been affected by the effects of privatization.

Mr. Ntewewe notes that this visit could never have come at a more opportune time than this when his organization has been demanding for the setting up of the Commission of Inquiry on Privatization.

Mr. Ntewewe has therefore called on President Lungu to expedite the process of setting up of the commission of inquiry so as to get to the truth, justice and closure to this matter which has haunted the people of Zambia for over two decades.

He said the case of Mansa Batteries makes his heart to bleed but most importantly serves as yardstick to prove to the doubters and the general citizenry that the call for setting up the commission of inquiry is not about settling political scores but genuine and aimed at confronting the evils and scars left behind by privatization.

“Just to refresh and remind our people; the former employees of the once viable Mansa Batteries have never gotten their terminal benefits since the company was privatised in the early 1990’s up to now.Out of the 174 people employed at the time of privatisation, only 81 are alive today. 93 have succumbed to the cold hand of death due to depression and other ailments,their children left in the cold without any future to talk about as they were denied an opportunity to persue secondary and tertiary education.The families left behind wallow in poverty and vulnerability” Mr Ntewewe said.

He said this is not an isolated incident as they are so many other cases in point, others probably worse off than Mansa Batteries and therefore it is time to confront this issue and deal with it once and for all considering that the souls of the departed victims, deceased patriots of our great motherland, the vulnerable widows, the deprived orphans and the poverty stricken general populous are crying out for justice.

“Even as we commend his Excellency the President for to the former workers, we wish to put it on record that this is not an isolated incident as there are so many other incidences and casualties of privatization across the whole country. They all deserve answers and to live in human dignity” he said.

Seven days ago, hon KAMPYONGO issued a statement that his ministry will instruct PIG Kanganja to announce the names of gassers on Tuesday 20th who terrorised Zambian people leading to loss of lives and properties.
In his official statement, hon Kampyongo said it had taken so long informing the nation about the people involved in gassing as the investigations were so complex because many people were involved.
He said he was confident to say that the investigations were concluded of culprits that were involved in the terror mission and that all the culprits are in police custody.

QUESTIONS TO HON KAMPYONGO

Why hasn’t the names of culprits been released up to now despite assuring the nation that names would be released on Tuesday 20th?

Why did it too so long investigating when all the culprits were under police custody according to his statement when he said all the culprits are under police custody?

Is the government going to give names only without showing their faces as that could be a ploy to give out names that do not even exist denying Zambians justice?

We have seen many incidents that had happened in the eyes of the Home Affairs Minister and have never received quickest attention of investigations such as the killing of a UPND cadre Lawrence Banda, cadres in company of police officers who blocked the road with tyres in Muchinga in an effort to block HH from accessing the magistrate to show solidarity to Mucheleka and the group. Why hasn’t there been so quick investigations like the concocted Muchinga one which has seen the opposition MP hon Kanhombe incarcerated?
Is law being applied selectively which is the case?

Why did the Home Affairs Minister hon Kampyongo lie to the nation that his ministry through the police would announce the names of terrorists?
And why the PIG Kanganja issuing a statement to that effect and not his office?

Hon KAMPYONGO you are planting a seed that you will fail to eat from with your application of law.

Police Officer Beheaded And Burnt To Ashes in Nigeria

A police officer was beheaded and burnt to ashes by suspected hoodlums during the #ENDSARS protest in Nigeria.

Spokesperson of the State Police Command, SP Haruna Mohammed, who confirmed this in a statement while giving update on the attacks by hoodlums on police formations and other government facilities in the state, said three other officers sustained various degrees of injuries.

“On the 22/10/2020 between 3:30am and 5:pm,the hoodlums in large number equally attacked Nnewi Area Command,3-3 Division,Ogbunike/ Isiuwulu, Ozubulu ,Nnobi,and Itchy Divisions as well as peoples club police post, burnt Police vehicles and set the facilities ablaze carting away exhibits kept at the Divisions,” said Mohammed.

 

“One police officer was beheaded and burnt to ashes while three others sustained various degrees of injuries.The injured police officers were rushed to the hospital for medical attention and they are responding to treatment,” he added.

The spokesman further disclosed hoodlums disguised as protesters on Wednesday, attacked Nnewi Police Station, set it ablaze and vandalised patrol vehicles and other exhibits.

“On the 21/10/2020 at about 11:30pm hoodlums in large number under the guise of “END SARS”protesters attacked Nnewi Police Station,set it ablaze and vandalized patrol vehicles and other exhibits but were prevented from assessing the armoury to cart away arm due to strong resistance placed by police men on duty.” he stated.

He said police operatives in collaboration with members of the communities comprising of youths,vigilante and Community leaders at Okpoko, CPS Awka, Oraifite,Otolo,Amichi and Oba vehemently resisted attempt by the hoodlums to attack the police Stations.

However, five persons were attacked in Onitsha and taken to the hospital for medical attention where three have been confirmed dead by the medical doctor while two others are receiving treatment.

Other government property burnt or destroyed includes High Court Ogidi,Idemili North LG Secretariat while Zik Statue at DMGS roundabout was vandalized. Arrest was equally made.

While ackowledging the contribution of the state governor, Willie Obiano, youths, community leaders and local vigilante groups for the overall successes recorded by the command, the Commissioner of Police, John Abang urged the public to sustain this level of cooperation with the Police at all times especially during this trying period in order bring lasting peace in Anambra State.

“The public are equally enjoined to report any distress through the Command emergency number 07039194332 for prompt action please.” the statement concludes.

Police Plan To Arrest Chamisa For Refusing Mnangagwa’s Job Offer “Leader Of Opposition”

The Zimbabwe Republic Police plans to arrest the MDC Alliance President Nelson Chamisa, it has emerged.

The main motive is to punish Chamisa for his refusal to accept the job offer passed to him by his own opponent Emmerson Mnangagwa.

This was first revealed in televised deliberations during the Motlanthe Commission over the 1 August killings.

During the hearings, the police general Godwin Matanga announced saying that Chamisa is guilty of inciting violence.

He then went on to say that Chamisa’s only way out of guilt is to accept the job given him by his very opposite during the 2018 elections, Emmerson Mnangagwa. The supposedly advertised job is that of Leader Of The House, an offer which Nelson Chamisa scoffs at saying it means nothing as he already holds it.

But whichever swing that is, there was drama yesterday when Mnangagwa practically ‘handed over the job’ to election loser Thokozani Khupe.

Said Matanga:

“So really up to this hour I still feel that it would be very improper for me to arrest the leader of the opposition party in the name of Nelson Chamisa because not too long ago when our State President was in New York attending some conference that he also extended some own relief where he was going to propose to his parliament to open a special office to accommodate the opposition leader.

“And I still feel today the doors are still open and it will be very improper for me to arrest him.

“But at the same time I would want to say crime does not rot like meat.”

COMMISSIONER CHIEF EMEKA ANYAOKU (To witness)
Q. Just a few questions. First is there any law that empowers the police to do something
about inciting public violence?
A. The law is there. Fortunately we had a seminar a week before the Election Day which was conducted by the Chairperson of the Zimbabwe Electoral Commission Justice
Chigumba at one of our conference rooms and it was very clear and it’s still very clear
that the Electoral Act did not allow people to incite violence.
Q. So it’s a law on which the police have never acted. Would that be right to say that?

A. Can you come again?
Q. Would it be correct to say that the police have never really acted on this law?
A. Going back to history I borrowed some facts from within the continent where by
arresting a leader of the then opposition party could have worsened the situation. I
will tell you a clue whereby queer situation where more than a 1000 people died
during the election period and to go further it is already known that the lawyer of the main opposition leader in Kenya Roila Odinga by the name Silas Jaracumba if I am not mistaken was in the country to advice our main opposition leader on how to proceed with actions which took place on the 1st of August. When I got that
information unfortunately he had left the country on the 31st of July going back to
Kenya. So really up to this hour I still feel that it would be very improper for me to
arrest the leader of the opposition party in the name of Nelson Chamisa because not too long ago when our State President was in New York attending some conference that he also extended some own relief where he was going to propose to his parliament to open a special office to accommodate the opposition leader. And I still feel today the doors are still open and it will be very improper for me to arrest him.
But at the same time I would want to say crime does not rot like meat. The records are there to tell and anytime he can be arrested if the time permits.
Q. The people who died as a result of 1st of August violence have you been able to
establish whether they all died from gunshots from the army alone or was there any
fatality to police gunshots?
A. Our investigations have not come up with the culprits involved. And for me to say
these people were shot by the army it will be very unfair because I was expecting to
get evidence in the form of cartridges or bullet heads only to read through the papers

that there are Zimbabwean citizens who do have these cartridges and through the
Commission I am appealing to them to come forward so that investigations can be
carried out.
COMMISSIONER GENERAL DAVIS MWAMUNYANGE (To witness)
Q. Based on the intelligence that you might have collected before 1st of August did you
foresee the occurrence and extent of the violence that took place on the 1st of August?
A. Unfortunately from the time of the election date and even before was announced by
the State President, people, political leaders were campaigning peacefully to include
Nelson Chamisa and his party. And I if I do recall its on record it is the first time
when the opposition party was allowed to have their main rally in the Africa Unit
Square. According to our plans which we discussed together with the opposition
convenors and I want to say and to remain on record that at the end of their rally we
did not record any mishap. So with that in mind but of course I was not seating on to
say it was peaceful but I can assure you the situation was reasonably comfortable,
peaceful up to the end of the ballot dates. So we were then expecting results from
ZEC and of course they were fishers that certain individuals wanted to announce the
results before the official board ZEC could do it which again is a serious offence. So I
want to say before the Commission the situation was very comfortable and
considering that the people had voted up to the end peacefully at some point I did not
expect the violence which took place on the 1st of August to take place.
Q. When violence erupted on the 1st of August did you make any attempt to contact the
leader of the opposition and other institutions?

Turning to the Public Order and Security Act, after the approval by the President was
there any need for the Defence Forces to operate under the regulating authority for
Harare?
A. Definitely yes. If it was on a normal operation the members of the Defence Forces
were supposed to come down to the regulating authority who was then Chief
Superintendent Ncube to be given instructions. Of course a situation which did not
take place.
Q. Does that mean there you agree with the witness who came early on the regulating
authority for Harare that that section of the law was not complied?
A. Mr Chairman this questions is coming from a specialist in the Constitution.
CHAIRMAN KGALEMA MOTLANTLE
Q. You are protected.
A. He is asking me to spit hell here. It’s now here nor there when it comes to law but
then of course it was not done but it was not done deliberately. That one I must
accept.
COMMISSIONER LOVEMORE MADHUKU (To witness)
Q. I accept that I think I took your words in here. Correct me if it is not correct. Your
language says that the normal process could not be followed because they was no time
for that process. You are saying again that regard that you couldn’t then follow those
provisions because there was no time for it?
A. That is surely Mr Chairman if the time was there this channel was going to be
followed for sure.

Commissioner you have told this Commission that when your request to get the army
to assist was granted they was no time to go back to the regulatory authority so are
you telling this gathering that it is you who said the army could go? You gave the last
word?
A. Can you come again madam so that I can answer correctly.
Q. I am saying according to procedure it was supposed to be the regulatory authority as
stated by Assistant Inspector Ncube that he was then supposed to command the army
to go. I am saying since there was no time to go to the authority was it then you who
sent the army out, who commanded rather?
A. Mr Chairman I can’t run away from the fact it’s me.
Q. What was your instruction to the Forces? What did you instruct them to go and do?
A. The deployment of the army like I already indicated was to make sure that these
demonstrators were not going to run over the Rainbow Towers which was
accommodating the Command Centre, secondly the ZANU PF National Headquarter
where in normal circumstances our Ministers are housed. The ZEC officers, the ZEC
offices themselves where Justice Chigumba and the rest were accommodated and
lastly the ZANU PF provincial headquarters along Simon Muzenda Street. Along the
way and it was very clear for me that I would not know what will happen in between
because the town was already on fire.
Q. When the town is on fire what would you specifically state to the army that goes? Did
you just tell them just go and do what you can do or they was an instruction?

Unfortunately through the Chair it’s like I am going through a jungle. I will not be
too sure whether one will encounter an elephant, a lion or whatever but only to say
please try to be careful the situation is not favourable. Just what I said to the
commander of the army.
Q. So in other words there was an open instruction for them to use their discretion within
their training abilities?
A. I wouldn’t say an open instruction because in day to day training program there is
what they call military aid to civil power. And there are trained to quail out
disturbances of that nature which took place on the 1st of August. And to say it was
an open instruction I would not take that. No.
Q, The reason why I am asking is because we heard all the witnesses coming but it looks
like the public want to know who gave instruction, who said what, when the shootings
happened who had said go and shoot. That’s why I am trying to ask?
A. Through the Chair, right now I cannot even tell you who were part of the 5000, 4000
demonstrators who were in town. So for me to say they were going to do this at cnr
Chitepo and Simon Muzenda Street it was going to be very difficult for me. But as
trained officer I would and even right now I would still feel that that was not a
situation which they would not be able to quail.
Q. But in your own assessment was the power or the force used commensurate to the
events that were happening?
A. Depending on what corner we are looking at this situation from. From a civilian point
of view for those who were viewing it on television and for those who were going on
to the actual ground the assessment will be different but without maybe provoking the

bereaved families I still believe that minimum force was used because I know that our
Defence Forces are armed with AKs. If those arms were carelessly used I can assure
you we could have counted 1000 bodies in Harare central.
COMMISSIONER RODNEY THOMAS DICKSON (To witness)
Q. Commissioner General I just need you to clarify this point because I thought I heard
you saying loud and clear that there was no space for discussion because of the
urgency of the situation. That meant that you couldn’t place the Defence Forces that
were coming in under your command? They maintained a separate command under
the Defence Forces. Am I wrong in that understanding?
A. As I have already said, when authority was granted for me to invite the Forces mostly
all the Forces were on the ground and these colleagues of ours also did come to assist
us and to say there was this possibility of them meeting to discuss on how to go
forward I would lie to the Commission, there was no time for that. Like I have already
indicated these demonstrators were not on one place they were all over town and if I
remember my officers also were very much in danger the same as maybe those who
lost their lives.
Q. So to be clear there you did receive command of both your Forces and the Defence
Forces that joined them on the ground.
A. I did because I was getting information from individual offices who were at different corners of the town. So to say I did not I will be lying. I was on top of the situation.
Q. When you take command as my fellow Commissioner asked you you gave orders as to how they should conduct the operations in quailing the demonstrators is that what happened?

Is there any possibility from your investigations so far that individual soldiers acted
outside of the law for framework that you have now told us about? They acted as
individuals unlawfully is there any possibility of that?
A. I was told that some members of the ZDF appear on social media in some kneeling
position but that is not enough for me to say this is the person who killed that
particular person. I am not in that position until investigation is completed.
Q. I asked about that particular question because we saw the videos of the person
kneeling, what we also saw is what appeared to be a commander appearing to be
telling the person by hitting on the shoulder to stop shooting. That’s why I was asking
the question whether there is more information at this stage?
A. Unfortunately Mr Chairman for that commander to get to that position of restraining
his colleague definitely I would want to leave that one to that particular officer
otherwise I would say something wrong on his behalf.
Q. We appreciate the investigations are going on, can you clarify whether or not it’s the

difference of jurisdiction?
A. Whilst I don’t want to talk on behalf of the ZDF I know there is a department they call
Military Police I want to believe that they could be carrying out their own

Mnangagwa Versus Chiwenga, Chiwenga Heavily Downed At Politburo Meeting As Mnangagwa Strengthens Grip On Power

BELEAGUERED Vice-President Constantino Chiwenga made spirited but futile efforts to save his allies from the Zanu PF political guillotine during Wednesday’s tense politburo meeting in which a titanic battle among senior party officials exploded into the open.

The most high-profile casualty from Wednesday’s meeting was Mashonaland East provincial affairs minister Aplonia Munzverengwi, who was demoted from the women’s league national political commissar position to become deputy secretary for lands in the influential wing.

Mashonaland West provincial vice-chairperson Dexter Nduna — also Chegutu West legislator — was demoted to a mere card-carrying member, prevented from holding any position in the party for a year, while Matabeleland North provincial youth chair Tamuka Nyoni suffered a similar fate.

They are all believed to be Chiwenga’s allies.

As reported by the Zimbabwe Independent in the past three years, there is a simmering power struggle between President Mnangagwa, who is also Zanu PF’s president and first secretary, and Chiwenga since the two men conspired to overthrow the late former president Robert Mugabe in a military coup in November 2017.

Chiwenga is widely seen as leader of a faction in Zanu PF and is reportedly itching to take over from the 78-year-old incumbent, who is planning to seek a second term in 2023. Zanu PF has roundly endorsed Mnangagwa as the party’s presidential candidate in the 2023 election.

Since the November 2017 coup, Mnangagwa’s camp has been working to decimate Chiwenga’s power base by weakening his influence on the military and other state departments. Mnangagwa has been making sweeping changes in the military and reassigning those perceived to be loyal to the Vice-President.

However, the former Zimbabwe Defence Forces commander, who orchestrated the coup, remains influential in the military and in Zanu PF.

Tension between the two has escalated dramatically over the past few months amid intense jostling for positions during the ongoing restructuring exercises, particularly the upcoming District Coordinating Committee (DCC) elections.

Having dealt Chiwenga a decisive blow by neutralising his military influence, sources said, Mnangagwa has now firmly set his eyes on decimating his political power base and this explains the decision during the Wednesday’s politburo meeting to purge Chiwenga’s political allies.

The Independent’s politburo sources said Chiwenga personally tried in vain to save both Munzverengwi and Nduna from facing stiffer penalties but successfully managed to convince the politburo to rescind the national disciplinary committee (NDC)’s decision to expel Nduna from the party.

Nduna was accused of attempting to use his influence as provincial deputy chair to impose candidates for various DCC positions, against the provincial executive’s resolution.

Sources however alleged he was punished for frequently clashing with his superior, the provincial chairman Ziyambi Ziyambi, who is also Justice minister.

Ziyambi is widely considered to be Mnangagwa’s right hand man.

A politburo member said during a discussion on his issue, Zanu PF secretary for security Lovemore Matuke suggested that Nduna must be suspended from the party for five years and forced to enroll in the Chitepo School of Ideology.

Chiwenga, sources said, quickly shot down the proposal saying the sanction would be too harsh.

“The province (Mashonaland West) had recommended that he should be suspended for five years and when the matter came up for discussion, Matuke suggested he should also be enrolled at the Chitepo School of Ideology. However, the vice president quickly dismissed the suggestion saying it would be an abuse of the facility. He declared that there was no way Nduna would be sent to the ideological school and in the end it was agreed that he should be suspended from holding a leadership position in the party for just one year,” the politburo member said.

Insiders further said the issue of Munzverengwi took much more time as some of the politburo members sympathetic to Chiwenga felt she was being treated unfairly.

According to the NDC report presented by Zanu Pf national chair Oppah Muchinguri-Kashiri, Munzverengwi was accused of bringing the name of the party into disrepute after a nude picture of her went viral on social media last year.

However, it emerged during the deliberations some politburo members reportedly rubbished the allegation saying she was actually being victimised by women’s league boss Marble Chinomona, with whom she has had bad blood since early 2019, well before the picture was circulated.

Munzverengwi comes from Wedza district, a stone’s throw from Chiwenga’s rural homestead. She is also a former senior assistant commissioner in the police and is perceived to be one of Chiwenga’s most ardent supporters having made several appearances at his private functions in Wedza.

“The general feeling in the meeting was that she was being treated unfairly. Again it was Chiwenga who leapt to her defence first. He clearly stated that there was nothing immoral about the photograph, which only showed her body from the chest upward. He actually left the meeting in stitches when he suggested that there were some very senior party members who had done much worse things and no such punishment had been imposed on them,” a source who attended the meeting said.

“So basically, it was agreed that since she had accepted her demotion during the hearing, it should not be altered,” the source added.

Nyoni was punished for attending meetings organised by shadowy pressure group, #tajamuka and receiving payments ahead of the thwarted July 31 protests.

“On being quizzed by the NDC, he said he had been sent by the provincial chair Richard Moyo to infiltrate and spy on the pressure group and give information back to the party. However, Moyo denied the allegation, leaving us with no option but to recommend that he should be demoted to being a card-carrying member,” another source said.

According to inside sources, the party bigwigs also viciously clashed when debating the fate of former Zanu PF secretary for youth affairs Kudzi Chipanga who had applied to rejoin the party from which he was jettisoned at the height of the 2017 military coup.

While those in the Mnangagwa camp like July Moyo and Matuke reportedly wanted him to be readmitted as a card-carrying member ineligible to occupy any leadership position for five years, Chiwenga and party secretary for finance Patrick Chinamasa came out guns blazing saying there was no way he could be allowed back into the party since he was the chief instigator of their woes during Mugabe’s last days in power.

Chipanga traversed the length and breadth of the country rallying youths against Mnangagwa and his then Team Lacoste faction and promoting his bitterest rival at the time, former first lady Grace Mugabe against whom he fought for the right to succeed Mugabe.

As further punishment, Chipanga will lose his farm in Rusape, again at the instigation of Chiwenga and Chinamasa.

“Basically, Chiwenga and Chinamasa argued that readmitting Chipanga would be a mistake as it would imply tolerance for G40 and there was a likelihood that he could be their conduit,” a senior politburo member said.

“On the issue of the farm, July Moyo had actually said he preferred the issue to be referred to the ministry of lands since it was not a party issue but an administrative issue to be best addressed through government. But Chinamasa and Chiwenga sharply disagreed saying the politburo had the right to make a determination on the case and in the end it was resolved that he should be asked to vacate the property,” the politburo member said.

Sources further said the politburo referred the cases of other G40 acolytes Tapiwa Matangaidze and Makhosini Hlongwane back to the Midlands provincial coordinating committee after strong objections from Sibusiso Moyo, Joram Gumbo, July Moyo, Tsitsi Muzenda and Simbarashe Mbengegwi, who argued that their applications had not been deliberated on at provincial level.

“The five, who are the most senior members from the Midlands province, accused secretary for legal affairs Paul Mangwana of misrepresenting to the politburo that their case had been deliberated on by the provincial PCC. The five then said they did not remember any such PCC meeting being converged and this resulted in the meeting referring the case back to the provincial structures,” a source said.

VICE-PRESIDENT Constantino Chiwenga is now staying at the Golden Peacock Villa Hotel in Harare owned by Anjin – a joint venture between the Ministry of Defence and a Chinese investor – after he abandoned his matrimonial Borrowdale Brooke mansion that he says holds “sentimental value” to him amid a nasty fallout
with his ex-wife Marry Mubaiwa.

Chiwenga’s new home is located along Kingsmead Road in Borrowdale in Harare. Even though he managed to evict Marry, with the help of the army, Chiwenga still moved out. Some people initially said he was staying in Chisipite, yet others speculated he was at the National Defence University, but this week The NewsHawks established Chiwenga now resides at the Kingsmead villa for security and personal reasons.

This reinforced the view that he is close to the Chinese who saved his life when he looked terminally ill before being flown to Beijing for treatment last year. It is not the first time for Chiwenga to abandon the Borrowdale Brooke mansion which is perched on a hill with a panoramic view inside Zimbabwe’s prime housing estate on 614 Nick Price Road.

With a screaming inscription C&M (Constantino & Marry), the house stands majestically on a hill facing an 18-hole golf course designed by South African architect Peter Makovitch.

The estate was developed by Zimbabwe’s famous golf legend Nick Price, once Number 1 in the world’s golf rankings.
Initially Chiwenga left the Borrowdale Brooke house, where used to live with his other former wife Jocelyn, in April 2010 to stay with Marry on 11 Rosary Close in Greystone Park suburb also under Borrowdale area.

This time around he went to the Anjin villa. Anjin Investments (Pvt) Ltd is a joint venture between Chinese company Anhui Foreign Economic Construction (Group) Co. Ltd and a Zimbabwean entity Matt Bronze Enterprises (Pvt) Ltd, owned by the military, founded on December 2009.

The latest move came after Chiwenga evicted his estranged wife Marry with the assistance of the army. Just like in 2014 when he divorced Jocelyn, Chiwenga used armed soldiers to deny Marry access to the mansion, before the
courts granted him the right to occupy the house.

Marry lost control of the house after Chiwenga got her arrested on allegations of attempted murder,
fraud and money laundering in December last year.

She was granted bail on 6 January and told to stay at her matrimonial home, but was denied access to the house by armed soldiers. Chiwenga later challenged the court ruling which gave Marry access to the house on the grounds that the former model was dishonest and did not deserve bail as she had surrendered only one of her three passports to the court, a material fact which the vice-president’s lawyers said had not been disclosed when the judgment was made.

In any case, the lawyers argued, she could not stay with Chiwenga in the same house as he was the
complainant. Chiwenga further said Marry found him staying at the residence in question when they married and
thus she no longer had a legal right to be there following the termination of their customary union.

“Number 614 Nick Price Drive Borrowdale Brooke is my house of sentimental value awarded to me by the High Court in a former divorce matter by the late Justice Andrew Mutema,” Chiwenga said.

“I have no other home.” Locals in the Chinese villa’s vicinity said security has been beefed up since Chiwenga’s moved in. The villa is now fortified. In addition to private security, there are also soldiers guarding the hotel.
Informed sources say Chiwenga is locked in a fierce power struggle with President Emmerson Mnangagwa over Zanu PF’s unresolved leadership question. This has been variously confirmed with many credible sources.

LUNGU A PURE DICTATOR…rules by decrees, not afraid of disregarding law – Sejani

ACKSON Sejani says President Edgar Lungu can be and can even claim to be anything but never a democrat.

Sejani served as local government minister in Frederick Chiluba’s MMD administration.

He told The Mast that in the PF today, one can do anything to President Lungu, and get away with it.

“You can steal as much as you want and you will not hear a word from Mr Lungu. However, the moment you show even the faintest desire to contest the PF presidency against Mr Lungu, you will just feel a tonne of bricks dropping on you,” Sejani said, adding that such is what happened to Chishimba Kambwili and Kelvin Fube Bwalya (KBF).

Sejani described President Lungu as: “a pure dictator who rules by decrees and is not afraid of disregarding the law, if that law is an obstacle to his enjoyment of power.”

He noted that the “hypocritical Lungu” is now unleashing his new set of friends to fight sitting PF members of parliament in their constituencies.

“He (President Lungu) says people must not be afraid of competition in a democracy. This is a good statement on its own because nobody should indeed be afraid of competition in a democracy. However, I have serious issues with the person making this pronouncement because he does not believe in it,” Sejani said. “Mr Lungu can be anything and can claim to be anything but he can never be a democrat or believe in democracy. His actions on this speak louder than his words.”

Sejani wondered who the President is trying to fool by claiming that he is not afraid of political competition.

He further asked: “how has he himself behaved towards competition both within his party and outside of his party?”

Sejani noted that the best people to answer that question were people like KBF and Kambwili.

“These people and others were expelled or ostracised for merely showing interest to contest the PF presidency. In PF today you can do anything to Mr Lungu; you can steal as much as you want and you will not hear a word from Mr Lungu,” Sejani said. “[But] aspiring for PF presidency is an unpardonable sin in the eyes of this dictator. The example he gives of himself not fearing competition from the likes of Harry Kalaba, Felix Mutati and others is a wrong example. Firstly, this competition is not within PF but outside.”

He advised President Lungu to instead be saying: “‘look at me; I am allowing KBF to contest the PF presidency and so you also allow your internal competitors in your constituencies.’”

Sejani stressed that President Lungu does not even allow competition from other parties, “genuine opposition parties.”

“Look at what he is doing now to ensure that he remains in power! Mr Lungu is fighting on multiple fronts to secure his stay in power. He has unleashed mayhem in the NRC and voter registration exercises to advantage himself,” Sejani explained. “As if this is not enough, he is proceeding with schemes aimed at eliminating his opponents from the ballot box in next year’s elections. Fictitious cases will be manufactured against his opponents and orchestrate their convictions.”

He said while Lungu was who he is, “PF MPs are dying for and spending sleepless nights thinking about how they will help him secure a third term, through Bill 10.”

“We do not know what will make these sleepy PF MPs to wake up and smell the coffee,” Sejani said.

“I do not need to be a prophet to predict that more than three quarters of these MPs will be crying come May next year when Mr Lungu will have put his newly acquired friends in their constituencies. Unfortunately, at that time, nobody will be listening to their cries.”

He further pointed out that in unleashing his new friends, “Mr Lungu has also undermined his hapless secretary general [Davies Mwila].”

“‘No more circulars’, bellowed the dictator! ‘What I have decreed is the law and its final because I am the Alpha and Omega in this party and by extension therefore I am also the Alpha and Omega in this country called Zambia.’ Let Mr Lungu talk about his democratic credentials to people who live on planet Mars and not this earth,” said Sejani.

“Lower the Age of Consent to between 12 to 16 years”

The National Aids Council (NAC)has called for government to implement legal and regulatory amendments to lower the age of consent.

Director of Programmes, Dr. John Mwale, said reproductive health services should be given to children and adolescents aged between 12 years to 16 years.

He said children and adolescents even as young as 10 years of age must be given access to reproductive health services without parental consent.

Reproductive health services include; access and prevention of abortions, the management of the consequences of abortions, providing family planning and counseling, pre-natal care, safe delivery and post-natal care, prevention and appropriate treatment of infertility, and the treatment of reproductive tracts.

Dr. Mwale said government health facilities should not turn away children seeking reproductive health services without parental consent.

“What we are saying is we can have young people access these services without necessarily getting parental consent because right now, we have also noted that in terms of new infections, they have gone up, HIV new infections have gone up every year and in 2019.”

“As National Aids Council, we are reporting higher figures: 51,000 new infections and when you look at the age brackets that are actually more affected, its the young people whom we are not providing these services.” He said.

“Young people should actually be free to access these services including those aged 12, 13, 14 and 15 years” he said.

“Now the age of consent in Zambia is at 16 years, this means that if you are 16 years of age and below, you cannot access most services without parental consent”. He said

“If you are below the age of 16 and you want to access condoms, or have an HIV test and many other services, you are supposed to go with your parents or guardian. If you as a young person you do a self-test and you link yourself to care, it would require parental consent. So young people are shunning these services.” He said.

He said the Demographic Surveys of 2007 and 2018 showed that teen pregnancies had risen from 27% to 29%.

He said Ministry of Education statistics showed that about 16,000 teenagers fall out of school because of pregnancies, and could be attributed to guidelines such as the Age of Consent.

However the Church, parents and Traditional Authorities have spoken against Sexual Reproductive Health and Services (SRH&R) and Comprehensive Sexual Education (CSE) as key programmes sexualising children and promoting the use of contraceptives and abortions among children and adolescents.

They also condemned the two programmes for actively excluding parents in the provision of sexual information and reproductive health services as they are designed as rights-based programmes.

They have called for the promoters of the two programmes to instead, invest in existing and effective programmes encouraging sexual abstinence among children and adolescents, and strengthening traditional, family and religious values that build moral responsibilities in young people than promoting harmful practices.

The Church has stated that promoters have falsely presented the two programmes as solution to the rise in teen pregnancies and STDs, sexual abuse, and child marriages.

ZNBC’s coverage of Bizwel Mutale exemplifies abuse of public resources

ON 10th October, 2020, and repeated at 05:00 hours on 11th October, the Zambia National Broadcasting Corporation (ZNBC) aired an exclusive 10-minute documentary featuring one Bizwell Mutale, a member of the Patriotic Front (PF) mobilisation committee, during his recent mobilisation tour of the Southern Province.

The documentary featured on the Saturday Tonga Programme titled: Kantuunya Kamunsabata, presented by Wellington Mooyo and Charles Mucholo. The close to one-hour programme features news and development programmes in Tonga. On the material day, it featured three programmes: a school feeding programme in Mumbwa, early child learning, and an agri-business programme.

Within the course of the same week, Mutale was reported by the same ZNBC making partisan campaign and mobilisation statements from Livingstone and later in Dundumwezi, and I guess a few other places. This means he had an entire crew of TV and radio staff from ZNBC to himself for the whole period.

You will be excused to ask who Bizwell Mutale is. The fact that many of you don’t even know him is in itself part of the problem. It justifies my argument in this article that we have a case of a purely private citizen literary abusing public (our) resource, the ZNBC and its staff, staff time and equipment for a private (PF party) affair. The brief I know about Mutale is that he hails from the Southern Province. Until 28th July 2019, and during all my time in South Africa, Mutale was a member or at least sympathiser of the UPND South Africa branch. He defected to the PF soon after the departure of Geoffrey Bwalya Mwamba (GBM) from the party. Like GBM, Mutale was immediately coopted into PF’s mobilisation committee. He seems to be specifically assigned to mobilise PF and to dismantle the UPND in Southern Province.

Look, who Mutale is and what sort of businesses he was involved in down South is not your and my business; that’s his personal life. What is and should be your and my business is what he does with ZNBC, our heritage institution. Mutale is not a government official to be carrying around a ZNBC radio and TV crew to himself. Whoever was responsible for making such decisions at ZNBC must know that one day, when politicians are gone as it naturally happens, s/he will be alone to account for the reckless actions.

They say memories of Zambians are quite short. I would argue that some amongst us have shorter memories than the rest of us. We are not a homogenous lot. Otherwise, how else can we describe an individual at ZNBC who can forget that Chanda Chimba III (or Chimbwi, according to Michael Sata), was convicted for the ‘Stand Up for Zambia’ programme because it was deemed to have been a private programme abusing public resources. Minister Shikapwasha and PS Sam Phiri were prosecuted, albeit not convicted, for abuse of office.

From start to finish, Mutale’s programme in question was purely PF party mobilisation and campaigns for 2021. Nothing in it was developmental. Hence, it opened with Mutale pleading for the people of Southern Province, and Pemba in particular, to switch to the ruling party and vote for President Edgar Lungu next year. He said he had decided to consult them where the people of the province and the ruling party were at odds and to try to bridge the gap. He paraded three headmen, all clad in PF regalia, who claimed to have ‘repented’ and were asking for forgiveness from the ruling PF for ‘voting wrongly’. One of the headmen was literary on his knees begging for forgiveness from the Head of State and ruling party.

Although a representative of the Kusiya Ward in Pemba, a Londson Munkombwe, made a plea for help from government especially on water and farm inputs, the closing remarks by both the presenter and Mutale were, however, clear about the primary purpose of Mutale’s tour. He said, “Now I am happy with what has happened. What has happened today in Pemba is that these are headmen leading people in various villages. These headmen are tired. They are tired of waiting (and hoping) that one day they will receive development. Today they have arrived. Today we have visited them. We have been asking through radio that please give chance to PF. President Edgar Lungu has sent a lot of development to Southern Province. The massive developments are visible. Where is the misunderstanding? President Edgar Lungu has sent a lot of development. Now he is asking that we extend the partnership for our partnership. Let’s extend our partnership to headmen and people of Pemba. Now, we want the headmen to choose their own MP and they will choose councilors. Now, what we want here is partnership with the ruling party.”

Again, what Mutale and others do for PF and against their competitors is not our business. What is our business is abuse of our ZNBC, an institution that is constitutionally mandated to cover everybody fairly and to distribute the resources we endow into it equitably and in an accountable manner. The ZNBC’s coverage of Mutale’s mobilisation tour is not in isolation. It follows other one-sided broadcasts featuring other senior PF members.

Just over a month ago, for instance, the broadcaster sent a crew to Northern and Luapula provinces to accompany Davies Mwila, the PF secretary general and Mumbi Phiri during the Lukashya and Mwansabombwe by-elections. For instance, August 6, 2020, while on a tour with Mwila, Paul Shalala, a ZNBC staffer, filed a story titled, “Mwila calls for civility in politics”. The story said, “Mwila said this when he paid a courtesy call on the Paramount Chief. And Paramount Chief Chitimukulu has advised the ruling Patriotic Front to adopt a candidate for Lukashya Constituency who the grassroots will endorse. He said the Patriotic Front has a good experience in adoptions and it must listen to its lower structures when the adoption starts. He said the Patriotic Front has done a lot in Lukashya Constituency despite the deceased former member of parliament being an independent lawmaker.”

These are but just a few examples and incidences of such biased coverage, which is bound to increase as we head closer to the 2021 general elections. I therefore adopt the recent editorials of our two independent and credible newspapers – The Mast and News Diggers – as my own. In its editorial titled “Public media must start giving equal electoral coverage now” dated 18th October 2020, News Diggers Editor wrote, “As we head towards the 2021 general elections, there is need for media houses, especially those that are funded by taxpayers to provide equal coverage to all political players. It has become a norm in Zambia today that public media is a mouthpiece of government officials; it has become a norm that public media is for the party in power; it has become a norm that the opposition can only get coverage from private media. This is wrong.”

Likewise, The Mast editorial also dated 18th October 2020, under the title “Level political playing field” reads, “An uneven playing field is a central, yet underappreciated, component of contemporary authoritarianism. Today in Zambia, democratic competition is undermined by restrictions on opposition political parties to mobilise public support, unequal access to public news media outlets and state institutions. When opposition are denied permits to hold rallies and other public meetings, access to public news media outlets, their ability to compete in elections is impaired.”

The problem about ZNBC’s coverage of political players is three-fold: prioritization, status of political parties (whether they are private or public), lack of adherence to fairness and other journalistic ethos. Let’s take prioritisation; for years ZNBC has been complaining about insufficient resources and equipment to cover (especially) development news. So how did they suddenly have enough of these to assign teams to PF party officials at the expense of other political players and development issues?

Again on prioritisation, surely, if ZNBC has one production crew available for politicians outside government, who deserves it between say, Hakainde Hichilema the leader of the official opposition and who is running over 45 councils in parts of the country on behalf of the Zambian people, and Mutale, a mere PF mobilisation committee member? And what about the other opposition leaders, especially those with representation in parliament?

Second, as argued by the two media houses, ZNBC, as the sole-called public service broadcaster (PSB), is mandated to be fair and an ‘equal opportunity’ platform for all political players and other groups in the country. As I have written before, both journalism in general and the status of being the ‘public service broadcaster’, which ZNBC claims to be, have principles (just short of being called laws). For a refresher, the key principles of journalism are: objectivity, fairness, truthfulness, accuracy, balance, truthfulness, impartiality and factual.

It is these values that tough-tested journalism professionals swear to protect and defend, even when so-doing means going to jail or losing a job for. The News Manual describes ‘fairness’ as “avoiding bias, treating people equally and allowing people to have equal chances to do things or express themselves.” Two of the eight PSB principles, are: providing “space for free expression and open debate” and providing “objective and impartial information and news.” The ZNBC Act also espouses the principle of fairness and equal coverage to various groups in our society.

In terms of legal status for political parties, for starters, they are private entities, whether ruling or in opposition. That’s why they run their internal affairs without interference. Days of the amalgamation of the party and government or PIG (as we called it during UNIP) are long gone. Welcome to democracy!

Following is an example of separation of powers from next door. In September this year the African National Congress (ANC) of South Africa organised a trip to Zimbabwe to meet with the leadership of that country over the political and economic upheavals there. They used a jet belonging to the South African Air Force. Upon returning to South Africa, the ANC was forced to pay the state for use of the jet after it emerged that the trip was a purely party affair between the ANC and its ‘sister’ ZANU-PF. This happened, thanks to pressure from the opposition parties and civil society. “We travelled in an unusual manner and profusely humble ourselves where we went wrong during the lockdown,” the ANC said in a statement. It added that it “will reimburse the government for the costs incurred on behalf of our delegation”.

The rallying point and lesson from this experience is that we as a society need to arise to begin to hold our ruling parties more accountable on use of public resources. It’s not that they don’t understand the principle of separation of powers between state and party; it is because they know we care less. No wonder former president Frederick Chiluba once said that he could rule Zambia forever. Never mind what later befell him and his third term bid.

This govt will not last forever

Lucky Mulusa says everybody in government today will one day be out. It’s unavoidable. As Dr Fred M’membe recently observed, ” Everything is in motion. Nothing remains the same. Everything is changing ceaselessly. Nothing remains the same forever…”

Nobody is capable of being in power forever. This government will certainly go. It’s just a matter of time.

But those in government today are behaving as if they will be in government until eternity.

“Unfortunately, all these inconveniences are being created for us in the opposition by those that are ruling. What they don’t know is that there’s limitation of staying in government. There is tenure. Everybody in government today, and God bless them, will one day be out there. They will be on the streets and they will feel the impact of the policies, procedures and the laws that are being promulgated today. You’ll recall what happened to president Fredrick Chiluba, may his soul rest in peace. Whatever wrong things he could have done in government…When he left government, president Chiluba found himself in a prison without walls. He could not freely move around. Wherever he went, he was insulted, heckled, shouted at. He would try to lower the [vehicle’s] window, people would realise it’s him [and] they would insult him. He ended up staying [at] home and sadly, he left us. They know that the conditions they are creating in this nation are the conditions they will find when they leave government,” says Mulusa.

Those in power today should not forget the golden rule: do unto others as you would like them to do unto you.

The Golden Rule is the principle of treating others as you want to be treated. It is a maxim that is found in most religions and cultures. It can be considered an ethic of reciprocity in some religions, although different religions treat it differently.

The maxim may appear as a positive or negative injunction governing conduct: treat others as you would like others to treat you – positive or directive form; do not treat others in ways that you would not like to be treated – negative or prohibitive form; what you wish upon others, you wish upon yourself – empathetic or responsive form.

No government lasts forever. Those in opposition should just wait and keep the pot boiling. They shouldn’t give up. Change will come! It’s just a matter of time.

Sata never compromised on his values, says Kennedy Kamba

KENNEDY Kamba has described late president Michael Sata as a man who never compromised on his values.

Sata died on October 28, 2014 in London’s King Edward VII Hospital, and this month marks exactly six years since his demise.

Remembering the PF founder, Kamba, the Lusaka Province PF secretary, passionately said he learnt a lot from the man.

“He was very clear in his language and a very courageous politician who used to call a spade, a spade. President Sata never compromised on his self-worth, his values and principles. So I knew him even before I met him personally,” he said. “This was a simple man when you meet him personally, very down to earth and hard working. All he wanted was a better Zambia for everyone. He is a person who had Zambia at heart and wanted to see this country developed. He grew up in the village so whenever we interacted with him, he always talked about the poor Zambians.”

Kamba explained some of the projects Sata would remind all PF members about once they formed government.

“He used to say our priority should be the interest of the majority Zambians, especially those in rural areas. So we were always coming up with pro-poor policies. Our manifesto as the PF is tailored in such a manner that the priority is the poor,” Kamba said. “I remember in the MMD days, he would leave his office whenever he heard that street vendors were being harassed by the council ‘police’ officers. And he used to yell at these council officers, telling them to leave the poor vendors alone. That’s the kind of president Sata we all knew; a man with a big heart.”

Kamba said “president Sata was a courageous, very brave man who stood for what he believed in.”

“He wanted to see a clean and prosperous Zambia. He was a focused politician who never gave up on his dreams. This is what we learnt from him as a human being. Even personal character, president Sata taught us humility as we serve humanity. If you have pride issues, egocentric character, you cannot be a friend of president Sata,” he explained. “The man loved this country to the core. He wanted to be president to demonstrate to each one of us what good governance is. And indeed when he became president, he worked hard to the best of his abilities. Today, Zambia is a huge construction site with development taking place in all sectors of governance because of president Sata’s robust programme of transforming Zambia into a prosperous nation.”

Kamba explained how much he still misses Sata and his love for humanity.

“The first thing is that we miss him and we love him even in death. He imparted values that we will never depart from. He taught us what real love for humanity is. President Sata above all was a committed Catholic Christian who loved God,” he said. “He taught us the importance of embracing God in all that we do and we loved him for that. If I had an opportunity to meet him again, I can tell him that, thank you for what he did for this country and its great people. I will tell him that his legacy lives on. I will tell him that President Edgar Lungu is doing everything possible to serve this country with diligence while embracing and honouring the values and principles that the late president and founding father of our party left us with.”

Kamba explained his first encounter with Sata when he was recruited into the Patriotic Front party.

“The first time I met Michael Sata was at his house at Number 3 Omelo Mumba [road, Rhodes Park]. I was taken there by his former driver Watson Phiri in the year 2005…When I decided to join the PF, Watson took me straight to Mr Sata’s house in Omelo Mumba here in Lusaka,” Kamba explained.

“… And so he asked Watson in the Bemba ‘Nga uyu waisa nao ni nani (Who is this person you have come with?).’ And that’s how Watson introduced me to late president Sata that his name is Kennedy Kamba. Immediately Mr Sata recognised me and he went like ‘You are the son to Amford Kamba right?’ Because Mr Sata knew people and indeed he knew my father because they worked together.”

Picking some lessons from Sata’s life, Kamba said “today we are reminded of a true patriot who loved Zambia and its people.”

“He loved this country to his last breath. We are reminded of a statesman who also embraced humility and high levels of tolerance…He was a rare breed of a politician,” said Kamba. “He was God-given to Zambia. His political career was out of passion and his desire to serve. And that’s what should drive all of us in politics regardless of political affiliation.”

A year ago, a 49-year-old city s3x worker has decided to retire from the trade.

Sarah Mutero pulled the curtain to a trade she thrived in for many years.

After calling it quits, Mutero received a parcel of land worth Sh120,000 in Makuyu, Murang’a County. Some well-wishers have also promised to pool funds to build her a house after she ditched the trade.

Stanley Ngara aka King of Condoms of LVCT- and who is spearheading a programme to retire s3x workers in a humane way said s3x workers have played an important role in the fight against HIV/Aids.

“Men will seek s3x in all ways, but when it comes to s3x workers it is a different game. They don’t accept intercourse without condoms however much men insist to pay more for unprotected s3x. Society has a negative perception of s3x workers but in reality, they are in the front line in prevention of s3xually transmitted diseases,” said Ngara.

He added; “Their clients are men in other relationships and from surveys, seven out of 10 clients ask for unprotected s3x. Out of these seven, five are willing to pay handsomely. If they accept such deals you can imagine how HIV/Aids can spread. We must appreciate them with a retirement package”.

For 23 years Mutero had been a s3x worker, having serviced hundreds of men at her hometown of Embu, Nairobi city centre and in Majengo area.

She claimed she would service 20 or more men in a day in her younger years. But as age set in, hard economic times and stiff competition she could manage four customers daily. This means an average of 100 per month and for 23 years she took care of over 28,000 men.

“It is not an easy thing to satisfying such a big number of men, some being ruthless, yet we end up poor. We earn peanuts that we can’t even save. Everything I have earned in servicing needy men went to clothes, shelter and food for my children as well as education,” she said.

In s3x business, pricing is determined by standards and location. In villages, Majengo and places like that, a session popularly called “shot” goes for Sh100. In the city centre it costs Sh200 and higher in upmarket areas.

In Majengo, s3x workers rent the mud houses for Sh4,500 per month and have to close business at 11pm. She was among sellers who spent the night there while others with young children or those whose husbands are not aware what they do for living go home early.

In the s3x business, she said, some morals are thrown out of the window if one is to make good money.

“If a shot is Sh100 how many men do you have to sleep with to make ends meet? Many. That is why we don’t disregard customers as far as they can pay and are above 18 years. Though I am old, young men prefer me because we treat them well, and if they are beginners we show them how to put on condoms and do enjoyable s3x. My clients are aged between 18 and 35 years,” she revealed.

Mutero was among the old s3x workers in the city and decided to retire and set a precedent for her workmates, some in their 60s.

“Young women are taking over. I also find it weird when some customers we meet tell me I served them five or ten years ago. They wonder how I am still alive and in the business. I have turned down many asking to marry me, especially after I give them delightful s3x,” she said.

She added; “I want to retire and settle down quietly. I am not addicted to a point I will retreat to the streets. No, I just want quiet life with my children and I am not interested in getting a husband.”

The mother of two sons said that her children “respect me and I suspect they know I am a s3x worker. They have prayed that I shift from what I am doing. I wish my children do not get into this business or seek s3x from prostitutes.”

Days come days go and an element of good governance called democracy has been wilting, shrinking, and dying at alarming rates.

Our democracy has been attacked by a pack of wolves from the PF cartel. Our democratic elements like freedom of speech, freedom of expression, freedom of assembly under the ruling party has become crippled, it’s a helpless and hopeless child seated on a wheelchair.

Last month it was UPND deputy SG Mr mucheleka and two others, last week it was our alliance partner president kambwili, followed by his wife and daughter and honourable Don Mwenda. Yesterday it was sesheke MP honourable Romeo kangombe, today its Mubita C.Nawa. is it a coincidence that only those with different schools of thoughts with the intention of providing checks and balances are being summoned, detained and arrested? No

It’s simply calculated and well timed moves by the PF, they are abusing government machinery to pounce and instill fear to those who have distinguished themselves as the voices of the voiceless and whose primary motive is to offer checks and balances for a more transparent and accountable Zambia.

What then must we do to end this assault on the democracy that our forefathers died for? We must not only desire, we must be strong and act in unison.
We must fight for our democratic independence and it’s a pity that our own countrymen and women have conquered us.
We need to fight for that which our forefathers died for during their quest for independence.

Our young, energetic and vibrant young people must join hands and take the lead in denouncing the diabolical acts of the ruling party if they are to secure their future and the future of those yet to be born. Each time we ignore the unfair treatment of our zambian brothers and sisters we forget that one day these oppressors will come after us and our loved ones and any society whose people are in constant slumber as their future is getting ripped apart will never realize her potential.

Genuine clergy men, leaders from different CSOs and other organisations must strongly condemn the current unfairness and the perpetrators.
The same way the men of God appear for the hypocritical day of national prayer that’s the way the must turn up in numbers to correct ECL. The same way politically biased CSOs turn up to petition ECL on backdoor staged petitions, that’s the same way they should come forth to speak strongly against unjust behaviour of PF.

Zambia must come together to demand for the full restoration of our dying democracy and this should serve as a lesson to all those who were dribbled to think that PF meant well.

Let us vote wisely in 2021 and endorse HH as president because he is the strong, knowledgeable and visionary package Zambia deserves to achieve greatness.

I HAVE BEEN SUMMONED BY ZAMBIA POLICE

I have been called to report to the police for investigations.

As I prepare to go, I thought I should communicate with you. I have spent the last ten months of my life on a journey to fight for freedom of speech, freedom of movement and freedom to be proud of Zambia once again.

Two weeks ago I witnessed the humiliation of Honerable Mucheleka and others who spent a month in jail. Two days ago Mrs. Caroline Kambwili and Chanda Kambwili were humiliated and undressed for wanting to stand with their father and husband. Yesterday Sesheke Member of Parliament Romeo Kangombe and Munali Constituency Vice Chairman Obert Shibeenzu were arrested and driven 826 Kilometres to Chinsali and are detained at Nambuluma Police Station.

I have thought of Christone Tembo, Ronald Penza and I have thought of Lenshina and Mushala. I have thought of my family in general and my children in particular. I say it is well.

Our struggle is a national struggle to bring justice for all in spite of our own suffering in Zambia.

Like Nelson Mandela said, “I have dedicated my life to this struggle. I have fought against white domination and black domination. I have cherished the idea of a free South Africa. It is an idea for which I am prepared to live for. But if need be, it is an idea for which I am prepared to die.”

Zambia is going through dark times. We can all liberate Zambia if we collectively speak and not hide.

🇳🇬 Nigeria is going through it’s own challenges of social and geopolitical emancipation. But in Nigeria, everyone is speaking. May God give everyone of us the courage to speak and hopefully to act.

Zambia 🇿🇲 is a very rich country with gold, copper, water and uncountable resources. The only poverty in Zambia is poor leadership and bad priorities.

We do not need to be caging one another when our economy is in bad shape and needs urgent attention. We do not need to be pretending to be humble when we know deep down our hearts that we are scared of our enemies. Democracy must not be a word we use when begging for aid yet in the other hand we hold a leash to silence the voices of our perceived enemies.

Rupiah Banda was called ‘Nyama Soya’. He never paid attention. Rupiah Banda was so psychologically strong that even when a monkey 🙊urinated on him at state house 🏠 he found humor in it (kanitundila akakantu). Mwanawasa was called a ‘cabbage’. He never minded nor silenced anyone. He strove to unite Zambia so much that even when Michael Sata fell ill, Mwanawasa flew ✈️ Mr. Sata to South 🇿🇦 Africa for emergency cardiac 🚨 treatment. A matter Mr. Sata would cherish forever.

Times have changed though. We now have professional boot lickers. We have citizens walking freely after shooting and beating police officers at central police. We have acquittals and Nolle Prosequi for many and convictions for others. Cadres are now decision makers and economists. A livelihood of carderism is destroying the fabric of our nation. It is well Zambia.

George Wilhelm Friedrich Hegel put it better when he said, “The only thing we learn from history is that we learn nothing from history.”

Let us unite as a nation to bring real peace and prosperity for all. Let us fight to make sure criminals do not govern us and that real law and order is restored to our beloved nation for all not just the connected few. Let us silence the biased voices of those enjoying brown envelopes. Let us uplift and care for one another.

I am sure this will pass and you will hear from me soon. Very soon I know. But if you do not hear from me, at least I have informed you.

May God bless this nation. May God heal this nation. May God grant us all wisdom and eyes to see.

WHY KAMBWILI’S BAIL APPLICATION WAS SHOCKING AND DENIED: READ UP TO THE END*

Magistrate Simusamba denied Kambwili bail pending appeal on grounds that he did not comply with sections 321 and 323 of the Crinimal Procedural Code (CPC).

He said he was not going to entertain any application for bail pending appeal until such a time as the appeal procedure enshrined in the said CPC is fully complied with.

Magistrate Simusamba further ordered that Kambwili will continue serving his sentence until his further order or completion of the sentence.

He also observed that Kambwili’s Notice of Appeal was filed into court way before he could finish pronouncing both his judgment and sentence in the case contrary to the demands of sections 321 and 323 of the CPC, saying this made it irregular.

He said since the notice of Appeal was irregular, he would hold that, there was no Notice of Appeal at all.

He said Kambwili cannot invoke section 332 of the CPC by applying for bail pending appeal without complying with sections section 321and 323 of the CPC.

“My interpretation of these unusual facts is that the notice of appeal was filed into court way before I could finish pronouncing both my judgement and sentence in the case contrary to the demands of sections 321 and 323 of the CPC and therefore, irregular. The notice of appeal being irregular, I therefore, hold here that there was no notice of appeal at all, ” magistrate Simusamba ruled.

“Consequently, the convict cannot invoke section 332 of the CPC by applying for bail pending appeal without complying with sections 321 and 323 of the CPC. I shall therefore, not entertain any application for bail pending appeal until such a time as the appeal procedure enshrined in the said CPC is fully complied with. The convict will continue serving his sentence until further order of court or completion of the sentence.”

Magistrate Simusamba said the procedure to follow under sections 321 and 323 of the penal code in simple language was that after the court had delivered its last order in the case and adjourned the matter, either party to the case, the convict or Director of Public Prosecutions (DPP) could file a notice of appeal on any lawful grounds stated under section 321.

He said it was only after a notice of appeal had been successfully filed that section 332 of the penal code-bail pending appeal could be invoked.

“In the present case the Notice of Appeal was clearly filed before I could conclude the delivery of judgement and sentence. A position which is contrary to the demands of section 321 of the CPC. Evidence of this fact can be seen in both the grounds of appeal in the Notice of Appeal and the affidavit in support of summons for admission to bail pending appeal both filed on October 14, 2020,” he said

He said in the grounds of Appeal, the convict stated at ground six that more grounds to follow upon perusal of judgement.

Magistrate Simusamba said the above meant that at the time Kambwili was making the grounds of Appeal, he had not perused the judgement or he was simply not paying attention when it was being read out to him.

He added that it was a requirement that the appellant signs the Notice of Appeal.

“One wonders at what point he signed the appeal for it purports to have been signed by him when he clearly had no such opportunity as he was listening to his judgement from the dock,” he said.

Magistrate Simusamba said what was even more shocking was the evidence in the affidavit in support of summons for admission to bail pending appeal, at paragraph 3, where Kambwili stated that “on October 12, 2020, I was convicted by this honourable court of the offences of forgery; uttering false documents; and giving false information to a public officer. And I’m currently in detention at Lusaka Central correctional facility”.

He said any person who has been following these proceedings and reading the foregoing would most definitely be gripped with shock.

“Firstly, the date cited in that affidavit is October 12, 2020, which is the date that was initially set for judgement and later postponed to October 14. Secondly and perhaps most shocking is that the convict has appealed against his acquittal on the charge of giving false information to a public officer. Despite having denied the charge at the time he took plea and through out his trial. This is quite unprecedented in my 13 years of experience on the bench and I have equally never come across literature to that effect,” magistrate Simusamba said.

He said Kambwili in his affidavit purports to have to been detained at Lusaka Central facility when he was in fact in court on that day and not yet been committed to the said facility.

AU Chair Condemns Violence In Nigeria, Urges Buhari’s Administration To Open Investigation

The Chairperson of the African Union, AU, Commission Moussa Faki Mahamat has in very strong terms condemned the violence that erupted on 20 October 2020 during anti SARS protests in Lagos, Nigeria.

In a press statement earlier this week, Moussa Faki Mahamat called on the administration of President Muhammadu Buhari to open up an investigation into the protest that has resulted in multiple deaths and injuries.

While extending his condolences to the families of those who lost their lives during the protest that pushed for the discontinuation of the country’s special anti-robbery squad (Sars), the chairperson urged for the adoption of conflict de-escalation technics in a bid to proffering a solution to the crisis that has crippled economic activities in most states across the country.

“The Chairperson appeals to all political and social actors to reject the use of violence and respect human rights and the rule of law. He further urges all parties to privilege dialogue in order to de-escalate the situation and find concrete and durable reforms,” a section of the release read.
he also went ahead to welcome the decision by the federal government to disband the Special Anti-Robbery Squad (SARS) describing it as an important step in this direction.

Reiterating the African Union’s commitment to accompany the government and people of Nigeria in support of a peaceful solution, the AU chair pushed for the Nigerian authorities to conduct an impartial investigation to ensure the perpetrators of acts of violence are held to account.

US Democratic presidential nominee, Joe Biden, the UK foreign secretary, Dominic Raab, and the archbishop of Canterbury, Justin Welby, also joined in the condemnation of the killings and violent protest in Nigeria “The Nigerian government must urgently investigate reports of brutality at the hands of the security forces,” Raab said, adding that he was “alarmed by widespread reports of civilian deaths”.

Several international actors have taken to social media to condemn the repressive measures of the Nigerian government stating that the #endsars protest would not have gotten here if not for the state forces violent clamp down on demonstrators.

In his address Thursday night, Buhari dismissed the international condemnation as hasty insisting that “the international community should seek to know all the facts available before taking a position or rushing to judgment and making hasty pronouncements”, he said.

Twenty-four-hour curfews have been announced in 10 Nigerian states hence shutting down many protests across the country.

LUSAKA – While commenting on a Zambian lawyer’s explanation of the difference between a presidential pardon and parole, prominent Zambian Media commentator Kasebamashila Kaseba has wondered why many Zambians, particularly the legal fraternity, have remained mute on a glaring error that happened last year in which a Minister of Home Affairs reportedly cancelled and reversed a presidential pardon of Barotseland campaigner, Afumba Mombotwa, several hours after the political prisoner was publicly and formally announced to have been pardoned by the Republican President.

To this day, Mr Afumba Mombotwa’s name is still listed on President Edgar Lungu’s verified Facebook profile as having been pardoned unconditionally by the President from his 15-year prison sentence, while he remains in jail for treason under the laws of Zambia.

And Kasebamashila has wondered why lawyers like Dickson Jere have decided to remain mute and not explain whether a presidential pardon could be reversed or cancelled by a minister after it had already been pronounced.

In explaining the difference between a presidential pardon and parole, lawyer Dickson Jere stated that once pardoned under the president’s prerogative of mercy, the pardoned individual is considered never to have committed the crime as long as the pardon was unconditional.

However, Mr Jere explained that parole was different in that it was done by the Parole Board and could be reversed if the conditions of release were violated.

But Mr Kasebamashila has wondered why the Zambian legal fraternity has remained quiet on the apparent legal confusion that surrounded the announced pardon and consequent reversal of Afumba’s pardon in 2019.

“In spite of the above (Dickson Jere’s explanation on the difference between pardon and parole), I am reminded of Minister Kampyongo mixing the two by cancelling or reversing a presidential pardon, not parole, of one Barotseland activist Afumba Mombotwa publicly released at the pleasure of the president without consulting the minister or needing his advice,” remarked Kasebamashila in response to the Lusaka based lawyer’s Facebook posting on the subject, further asking why the legal fraternity has been silent on this matter of violation of Mombotwa’s rights.

“Further, as above, there is no constitutional provision for reversal or cancellation of a pardon, the nation and legal fraternity has been silent on this matter of violation of Mombotwa’s rights. In fact, where there is a mistake one should even benefit of (from) the mistake.” continued Mr Kasebamashila.

Meanwhile, a human rights officer at United Nations Mission in South Sudan (UNMISS) has stated that Mr Afumba’s case was a clear violation of his rights and advised that Mr Afumba or his agents must seek judicial review of his case.

Mr Alfred Zulu, while commenting on the same Facebook note said, “Kasebamashila Kaseba – you are absolutely correct. Once a presidential pardon has been granted it cannot be reversed. It is irreversible. The only way to vary this misnomer (mistake by the president) is by an act of parliament. The granting of a presidential absolute pardon is akin to bestowing dignity and human rights on an individual or ex-prisoner. Presidential absolute pardon is a permanent and irrevocable act of mercy. Only God can dissolve it (if God ever existed). Akafumba [Afumba] Mambotwa [Mombotwa] must or his agents must commence judicial proceedings in the Constitutional Court to reclaim these rights.”

The current debate on pardon and parole seems to have been provoked by the recent release of a prominent Zambian female prisoner who was serving a life sentence for the murder of another prominent female Monica Chabwela Phiri years back after the former accused the latter of interfering in her marriage.

However, the debate seems to have solidified the controversial but popular view that Barotse people are often treated to different legal standards in Zambia as the abuse of their rights by the state or its agents are often ignored by many Zambians as though they were second class Zambians.

The notion stems from the fact that while the Zambian public stands vocal on apparent injustices committed against fellow Zambians, they conspicuously go very quiet when similar or worse injustices are meted out by the state on peaceful Barotseland campaigners, which leaves Barotse people to often suffer unabated state instigated injustices and repression.

NDC leader Chishimba Kambwili’s wife Carol has emotionally narrated how she and her daughter Chanda were physically abused and brutalised by police officers at the Lusaka Magistrates’ Court on Tuesday.
Carol, who could not hold back tears, said police behaviour was appalling.

She called on all women to condemn and say no to such kind of brutality at the hands of men and women in uniform.

Carol dismissed what she called police lies that she and her daughter assaulted the officers.

“That behaviour by the police is appalling; I have never seen such behaviour in my entire life. They abused me physically, talk of the brutality. We were kicked, hit with gun buts and all sorts of things including stripping us,” Carol complained.

She wondered how it was possible for two defenceless women to assault a battalion of armed police officers.

Carol said contrary to police lies, it was her and Chanda who were kicked, stripped and assaulted in all manner of ruthlessness.

“My daughter was also kicked, slapped and bundled in a police van like a common criminal. She is so ill today, she has got a swollen knee, swollen shoulder where she was kicked. I was the one who was assaulted together with my daughter, not the other way round. That behaviour is totally unacceptable and I don’t think police officers are allowed to treat people like that – people who are defenceless. We were two defenceless women against a battalion of police, what could we do? Could we even assault an armed police officer?” Carol asked.

She said it was shameful that the police have been lying that she and her daughter assaulted one of the officers.

“The lying is also appalling. I thought police was a safe haven for citizens but I am afraid it is not because their behaviour is out of this world. Whoever gave those instructions to do that to us, to this family as if what they have done already [jailing her husband] is not enough is got a heart full of hate and is a coward. He is a coward that he can descend on defenceless women, direct those police officers to descend on defenceless women…anyway he has got nothing to give but hate,” she said between sobs.

Carol said if such brutality could be done to her, an aggrieving mother and wife, it could be done to any woman.

“And if a leader has got a heart like that, he is not worth to be called a leader and this is unacceptable. I am appealing to all women in this country, all well meaning and good women to say no to such brutality at the hands of the police. That was police officers strangling us, and we could not breath. And if they can do that to us, our family, they can do it to anyone. If we don’t stand up as women and say no to that kind of abuse and police brutality against women, this Zambia will be in chaos,” she said.

Carol wondered what kind of leaders the country had stating that those in leadership were not worth their salt.

She wondered how a Christian nation would entertain such brutality just a few days after commemorating the day of prayer and reconciliation.

“What happened to me and my daughter amounts to indecent assault and if we are calling this nation as a Christian nation where they undress a woman in public, a woman who is aggrieved, a woman who is just going to court to stand with the family, to support her children and her husband then she is assaulted like that, then I don’t think we are worth to be called a Christian nation,” Carol said. “You pray on October 18 and claim that you are praying for peace and unity but you are doing something contrary! I cannot even understand how a person can say I am Christian but doing the opposite. I can’t understand. Assaulting women. And a leader who can encourage those police officers to do what they did to us is not worth being in leadership. And this should be the last time, they should never do such a thing to any woman or any child. It is unacceptable.”

Meanwhile, the NGOCC says it has cause to worry how the Zambia Police is preparing to handle the 2021 general elections if what Carol and her daughter went through was the kind of police action that Zambia’s democracy shall now be exposed to.

And the Zambia National Women’s Lobby (ZNWL) has called on the Inspector General of the Police Kakoma Kanganja to ensure police brutality is restrained as such conduct may trigger retaliation from the public and plunge the nation into discord and lawlessness.

NGOCC executive director Engwase Mwale said the Republican Constitution guarantees citizens right to dignity and against all forms of inhuman and torturous treatment.

She said to undress a woman in the manner the police did to Kambwili’s wife was not only an assault on her dignity but a collective assault on all Zambian women.

“Regardless of the crime one is accused of committing, they are presumed to be innocent until proven guilty by a competent court. Therefore, the brutality and heavy-handedness by the overzealous police officers against the defenseless and unarmed women is totally unacceptable. To torture and dehumanise Mrs Kambwili and the daughter in that manner is criminal. Clearly, from the video that has gone viral the behavior of the police is devoid of any civility and professionalism expected of the Police Service,” she said.

“We, therefore, demand an apology from the Inspector General of Police, Mr Kakoma Kanganja, and the immediate prosecution of the officers that behaved in a barbaric manner as captured in the videos which are circulating on online platforms.”

Mwale said the conduct of the officers was far short of the set principles of public service and specifically the Police Code of Conduct.

Mwale said NGOCC expects the police to act according to their call of service in ensuring law and order and resolve to maintain civility when dealing with citizens.

“If this is the kind of police action that our democracy shall now be exposed to, NGOCC has cause to worry how the Zambia Police is preparing to handle the 2021 general elections. The Police Service has a lot of work to do in order to enhance the professional conduct of our women and men in uniform,” she said.

“The examples shown so far in many aspects leave majority citizens concerned. Just recently we witnessed videos of cadres of a named political party damaging a motor vehicle of one opposition political party in full view of the police.”

She said the duty of the Zambia Police was to protect citizens and ensure that at every point the human rights and indeed women’s rights of all Zambians were upheld.

ZNWL executive director Juliet Chibuta condemned the brutal conduct of the police officers who apprehended Carol and Chanda.

“Mrs Kambwili and her daughter were physically harassed and almost undressed as they were forced into a police vehicle for alleged assault and disorderly conduct. We note that Mrs Kambwili and her daughter may have committed an offence, however the force unleashed by police when apprehending them was excessive and uncalled for,” said Chibuta.

“It was sad to see women being dehumanised, and undressed at the hands of the police who ideally should guarantee their safety. While we note that police have a duty to uphold law and order, this must be done in the most professional manner possible. Police are supposed to protect citizens and not inflict harm. We therefore call on the Inspector General of the Police Mr Kakoma Kanganja to ensure police brutality is restrained as such conduct may trigger retaliation from the public and further plunge the nation into discord and lawlessness.”

Late Monica Chabwera’s Family Cry Foul Over Release Of Her Killer Beatrice Hangwende

The family of late Monica Chabwera Phiri who was murdered in 2007 has expressed shock over the decision by the Zambia Correctional Service to free her murderer, Beatrice Hangwende, who killed her.

The Parole Board of the Zambia Correctional Service has freed murder convict Beatrice Hangwende who killed the husband’s lover, Monica Chabwera in 2007, sighting good behavior as the reason for parole.

But late Monica’s sister, Mercy Phiri has told Phoenix News that the family is disheartened by the authority’s decision and has since demanded for an explanation as to why Beatrice Hagweende’s life imprisonment sentence has been cut short.

Ms. Phiri says the family will not accept the release of her sister’s murderer saying the move is an injustice to her late sister whose life will never be brought back.

The sequence of events culminating in the murder and the attempted murder of her driver Benny Banda were so strange and dramatic that they could be scripted into a movie. The events paint a sordid picture of uncontained emotions and blatant disregard for human life. They unfolded like a melodrama of a fusion and explosion of love and hatred; a tale of naivety, deception, sweet talk and betrayal, but also as a story of phenomenal advances in communication technology and its impact on crime investigation in Zambia.

Monica Chabwera Phiri, a business woman suspected to have been in an illicit affair with Beatrice Hangwende’s husband, was, together with her driver, Ben Banda, abducted in tragicomic circumstances on 22nd April, 2007 around 18:30 hours. The setting: Flat NO.1,Weevel Court, Rhodes Park, Lusaka, the residence of the Beatrice Hangwende estranged husband.

Together with her driver, the deceased was bundled into her own Mercedez Benz saloon car, by three male adults and driven away to her death. They were trailed by an unregistered backup car driven by a male adult and carrying at least two female adults, as they were conveyed through the Great East Road and off it to some inconspicuous point in the Chisamba area. There, the deceased was shot three times in cold blood by one of the abductors on the orders of one of the women from the trailing backup car. The deceased’s lifeless body was left lying in a pool of blood in the bush, and her Mercedez Benz car was abandoned some twenty-one kilometers away from the scene, near a farm in Chisamba. An attempt to shoot Benny Banda was miraculously unsuccessful as he bravely wrestled and fought his way out of the assailants’ grip, amid a blazing gun, and ran away from the assailants into the bush, climbing in the process, a tree for safety.

Using a Bemba proverb “munshebwa aile namafi kubuko”, Colonel Panji Kaunda said President Edgar Lungu needs to surround himself with people who will tell him the truth that ‘sir you have feaces on your back’.

And Col Panji said government must remove the floor price on maize in order to encourage more production of the commodity, which will in a way curtail on smuggling the government was always complaining about.

Speaking with Daily Revelation, Col Panji said what the ruling party needed was a party that was strong, democratic and corrupt free. He pointed to some of the projects that have been carried out by government, which were now quickly wearing out despite huge public investment, like the Ndola road.

He said the road that was built in 2016 was almost completely finished now, and very soon the government would be calling for new tenders to redo the roads, which would again attract more corruption.

Col Panji said things in the country were not well, including in the ruling party where the new comers were new like Lusaka Province minister Bowman Lusambo, were now trying to run roughshod calling themselves bulldozers.

He said in times such as this, the President needed to surround himself with people who will tell him truth to his face and not the self proclaimed bootlickers.

“Munshebwa aile namafi kubuko. He needs people who will tell him ‘sir you have feaces on your back’. But a bootlicker will not tell him. Let’s have leaders who say ‘this cannot be done’,” Col Panji said.

And Col Panji said the government needs to set priorities right in the agriculture sector to curb the smuggling of maize, saying it was not every farmer that relied on the FISP programme.

“But at the end of the day we want to determine how much we must pay them without taking into consideration the cost. At border areas the price is high…if you control price at the expense of the farmer you are forcing farmers to break the law,” Col Panji said. “We have capacity of producing 20 million tonnes per year, but we only have 3 million. But if we opened the market up I’m sure production will treble. Three farmers were shot dead to stop smuggling recently. It’s a policy we must change.”

Col Panji said the country had been trying to subsidise consumers since his father Dr Kenneth Kaunda’s time in office, thus affecting producers in the process.

He urged President Lungu’s administration to bite the bullet now, as that is what leadership entailed, saying the move would be risky in the short term, but will in the long run spur more production and subsequently reduce the price of maize.

“We must find other ways of protecting the consumer and not punishing the producer,” said Col Panji.

Asked if his own father would support what he was suggesting, both now and if he were still president, Col Panj said: “He (Dr Kaunda) was once asked what is it he regrets the most. He said we subsidised maize for too long. Leadership is not about taking the easy way out.” -Daily Revelation

Prophet Bushiri remains in custody as supporters protest at court: ‘Weaponisation of criminal justice system’

South Africa-based Malawian prophet Shepherd Bushiri’s followers had to wait for eight hours as lawyers tussled in court, eager to convince the Judge to grant the Enlightened Christian Gathering (ECG) church leader and wife, Prophetess Mary Bushiri, a bail on fresh on money laundering charges.

Bushiri, 37, and his wife Mary, 39, appeared in the Pretoria Magistrate’s Court on charges of fraud and money laundering worth R102-million (about K4.8 billion) on Wednesday after they were arrested by the Hawks the previous day.

The wait didn’t materialize as the State stood in the way, requesting the Court to postpone the bail hearing application while, also, resisting bail.

Bushiri’s lawyers vehemently opposed the State’s stance to the effect that they demonstrated their readiness by submitting bail applications affidavit.

Advocate Anneline van Den Heever, on behalf of the accused, told the court that they were ready to proceed and that the State was not entitled to have the matter postponed.

“When you arrest, you must be ready to proceed. One expects that when one applies for a warrant of arrest in a matter that has been investigated for a prolonged period., the State and investigations team should have their house in order,” she argued before the court.

After a careful examination of the arguments, the Court rolled tha matter over to Friday, 23rd October, 2020 and, also, possibly the bail hearing.

In a statement, Bushiri spokesperson Ephraim Nyondo said they are unhappy with what hey feel is a weaponisation of the criminal justice system.

“The state reserves the right to arrest and prosecute but surely they cannot always arrest and then claim they are not ready to proceed,” he said.

He added that Prophet Bushiri and Prophetess Mary Bushiri have always vehemently stood by their innocence and are resolute in their stance that they are innocent .

Outside the court, Bushiri’s supporters cheered in support to the controversial “prophet”, whom they call “Major One” or “Papa”.

“We are here to support our prophet, major one, who is the only prophet in the whole world. He is a man of God and I believe and I trust that he is not guilty, he is the victim of the plot of the so-called devil,” one of his supporters told eNCA TV.

“There is no way they can take him down because our God is alive and kicking and we are not afraid.”

Bushiri has been referred to as one of the richest religious leaders on the continent, worth an estimated $150-million, and is often pictured with his private jet or luxury vehicles. ECG operates in multiple African countries, with 110 branches and a million worshippers in South Africa, Bushiri said in recent court papers.

Bushiri’s Sandton-based company Shepherd Bushiri Investments (SBI)has interests in mining, real estate, and an airline.

In 2018, Bushiri launched the sprawling Sparkling Waters Hotel and Spa in Ranstenburg.

According to Bushiri, he ventured into business “to support his family as he does not believe the church must support his family.”

The Hawks said Willah Mudolo and Zethu Mudolo were also arrested on Saturday, 17 October in the same case.

Willah Mudolo is the founder of the African Development Funding Group and according to his LinkedInand personal website is a major supporter of former first lady Tobeka Zuma’s foundation. He also leads property development company Rising Estates.

Video clips of Bushiri telling congregants he foresaw that 2020 would be a “great year” have been widely circulated on social media. But the year has been dogged with a lot of battles for Bushiri his rival evangelical pastor Mboro Motsoeneng is accusing the Malawian prophet of swindling church members.

EndSARS demonstration has cost Nigeria’s economy $1.8bn in the last 12 days

The demonstrations in Nigeria over police brutalities are having a negative effect on the country’s economy. According to the Lagos Chamber of Commerce and Industry (LCCI), nationwide protests have cost the nation’s economy $1.8 billion over the last 12 days.

In a statement, the President of the Chamber of Commerce, Toki Mabogunje, said the LCCI appreciates the value of citizens’ engagement and the demand for accountability which the EndSARS protest essentially represents.

“Over the past twelve days, economic activities have been crippled in most parts of the country and has been particularly profound in the urban areas, she said. “The Nigerian economy has suffered an estimated N700 billion ($1.8 billion) loss in the past twelve days.”

Mabogunje said the demonstrations had been impactful and profound, adding that the protest has achieved some significant outcomes given the reawakening that it has generated in reforming the shortcomings in Nigeria’s political governance and the fact that some of the demands of the protesters have been met.

Nigeria is still reeling from the shocks of the pandemic and struggling to recover from its devastating effects. For the first time in more than a decade, Nigeria’s economy is in recession. The oil industry is the country’s main economic stay.

On Tuesday, Nigerian security forces reportedly opened fire on demonstrators at a protest site in the commercial capital Lagos hours after the state imposed a curfew amid rallies against police brutality in Nigeria. Witnesses told Reuters that the soldiers fired at the protesters in the Lekki district of the capital on Tuesday.

“They started firing ammunition toward the crowd. They were firing into the crowd,” said Alfred Ononugbo, a security officer. “I saw the bullet hit one or two persons,” he said.

The Cable reports that at least three people have died in the shooting. Amnesty International has said in a statement it had received “credible but disturbing evidence of excessive use of force occasioning deaths of protesters at Lekki toll gate in Lagos.” It said it was investigating “the killings”.

Footage seen on social media show scores of people demonstrating while other Nigerians are calling for an end to the reported shootings. The Nigerian army in a post on Twitter denied deploying soldiers to attack #EndSARS protesters who assembled at the Lekki Toll Plaza.

Lagos state governor Babajide Sanwo-Olu in a series of tweets said 25 people had been wounded. The governor of the largest city in Africa also described the shooting incident on Tuesday night as among the “darkest hours from our history as a people.”

“As the Governor of our state, I recognise the buck stops at my table and I will work with the FG (federal government) to get to the root of this unfortunate incident and stabilise all security operations to protect the lives of our residents,” Sanwo-Olu added.

Lagos, including four other states in Nigeria, has announced an indefinite curfew after claiming criminals have hijacked the protest. For two weeks now, thousands of people have been taking to the streets of Abuja and Lagos demanding an end to police violence. The protesters first demanded the shutdown of a notorious police unit, the Special Anti-Robbery Squad (SARS), which has long been accused of extortion, torture and extrajudicial killings.

Following days of widespread protest, the authorities disbanded SARS and reassigned personnel to other units.

The 24-year-old University of Zambia student is aspiring to one day become a paediatric neurosurgeon and continued to be top of class as a medical student.

Ms Chiluba is a Zambian young lady, a University of Zambia best medical student who has remained undefeated for 5 years. She shares her inspiration with Girl Empowerment Alliance for Change to inspire many other girls across the globe.

Besides her family and friends, Ms Chiluba holds few other things in high regard than her passion for the medical Profession. Her first love in the medical field is paediatric neurosurgery which she intends to specialize in. Many of her colleagues colloquially refer her as a nerd yet there is so much more to her than meets the eyes, which begs the question:
who is Songiwe Chiluba?

Born and bred in Lusaka, Ms Chiluba is a second born in a family of two. She lost her parents at a young age and thus raised separate from her only sibling. She was raised by her grandparents, her grandfather always saw something special in her and encouraged her to work hard.

She always has had love for science since her early days of academia and served as Junior Engineers, Technicians and Scientists (JETS) Club president, on the way collecting regional and national prizes. This was exemplified by her impressive performance at the University of Zambia (UNZA), where she has been top of her class since her first year. Not forgetting other various academic accolades such as best student in human anatomy and pediatrics and child health.

Research is the foundation of all science, hence she developed love for science. The sixth year of medical school provides a chance to understand research better and this set a platform for her to explore her interest further. Seeing how research plays a cardinal role in the development of medicine and how she can apply this in her practice, this has prompted her to venture more into research beyond the confines of her syllabus. Because of this she was able to participate in the recent National health research conference, under the young emerging scientists (YES) Zambia, during which she scoped two prizes; one for her case report on a postnatally diagnosed omphalocele and another was her sixth-year research study on knowledge, attitudes and perceptions of pregnant women towards caesarean section and anaesthesia.

It would be easy to assume that her life has always been a success but Songiwe has had her fair share of struggles. She was not always the best and struggled greatly to find her footing at University, especially being from a school not so popular for producing outstanding students. And after failing her first physics test, her confidence was tested, doubting whether she would ever attain her goals. When she eventually made it to the school of medicine, she thought the hard patch had passed but more challenges lay ahead. Her journey through medical school has so far has had many ups and downs and thoughts of self doubt, but what has helped her stay afloat is the mentorship from her brother.

Aside from academia, she also had financial challenges, coming from a humble background, she knew that the only way she could get through university was with a 100% bursary, anything else would mean goodbye to university. So when she was initially denied sponsorship, she thought all hope was lost, but eventually she was considered for a second selection. It has not been smooth sailing from there but she is determined to work hard making no excuses.

S&P LOWERS ZAMBIA’S RATING TO SELECTIVE DEFAULT

Credit rating agency Standards and Poor’s has lowered Africa’s second largest copper producer’s credit assessment to Selective Default – SD from ‘CCC-‘. This is S&Ps third rating adjustment of the copper producer this year and the second in the second half of the year. Barely a week after Zambia’s solicitation request to dollar bond holders on coupon payment freeze from 14 October 2020 to 14 April 2021, S&P ebbed the red metals credit rating to ‘CCC-‘ from ‘CCC’ with negative outlook after Fitch rating agency the same week slid the Southern African nation deeper into junk at ‘C’ from ‘CC’ aligning to Moodys ‘Ca’ rating levels a notch above default.

A selective default rating is one assigned when a counterpart has or is likely to default on specific class of policies yet continues to meet its obligations with other classes. It includes the completion of a distressed debt restructuring.

IN THE LABYRINTH OF FISCAL FRAGILITIES

The copper producer is in the labyrinth of fiscal fragilities following amplification of already existing balance sheet vulnerabilities in disease pandemic period. According to a press release shared on the London Stock Exchange, Zambia is in arrears with Chinese creditors while simultaneously in talks with bondholders for 6 months coupon reprieve which was pushed back for lack of transparency in overall creditor engagement. The red metal producer got a life line recently with the voting date by bond holders pushed to 13 November coinciding with the grace period for payment of its coupon interest on a 2024 bond for $42.5million.

NO FISCAL SPACE STANCE BY MINFIN

The MinFin in a note signed by the Secretary to the Treasury Fredson Yamba said they had no fiscal space and would not be paying any of the existing creditors should the stand off not be successful. Zambia in June hired the best investment banker for restructures, Lazard Frere’s to help with restructure of its liabilities. Zambia in June commenced talks with the Washington based lender IMF for a bailout package whose discussions will only proceed after successful debt restructure. MinFin head Dr. Bwalya Ng’andu told investors on 29 September that the copper producers debt to GDP ratio had ballooned to 104% and that external debt stock stood at $11.97billion.

Other rating agencies are expected to follow suit in the week. As at 10.46pm yields on Zambia’s 2022 were 60.853%/56.239%, 2024 – 41.171%/38.561% and 2027 – 29.965%/27.921% in bid/ask.

WISE UP, don’t play casino with national security, senior chief Mukuni advises the PF government.

And chief Mukuni says traditional leaders desire to ensure politics in Zambia does not sink to evil that could destroy the nation.

In a statement, Mukuni thanked traditional leaders around the country, especially from Muchinga, Northern and Eastern provinces who contacted him to express their readiness to join UPND president Hakainde Hichilema’s convoy to Mpika if police summon him (HH) there.

“My humble advice to government is to wise up and hold the nation with two hands and not play casino with national security. Police Inspector General Kakoma Kanganja must strive to be impartial and prudent in the way he superintendents over his officers. It’s only through prudence, trust and goodwill of law enforcement officers, by ordinary citizens that he can manage to police 18 million Zambians. Should the police lose that goodwill because of biasness and professional misconduct, national security will be compromised and no one will be spared with the chaos that may follow,” Mukuni cautioned.

He added that the traditional leaders’ solidarity for Hichilema underpinned their quest for peace and their cherished desire for liberties and basic freedoms for all their subjects regardless of their political affiliations or origins.

Mukuni emphasised that this also shows that Hichilema’s matter was no longer just a political issue that could only relate to a political party, but that it was of national interest to everyone.

“Their Royal Highnesses’ show of solidarity speaks loudly of their desire to ensure politics in our country does not sink to an evil that if left unchecked could destroy our nation. It also testifies to their commitment that Zambian politics is not soiled with dishonest practices,” he said.

He further indicated that in due course, he would inform the traditional leaders of the next course of action depending on circumstances.

Chief Mukuni said both mainstream and social media had been inundated with shocking images of attacks on Hichilma’s convoy by known political cadres that were clearly embedded in the rank and file of law enforcement officers.

“This appendage of violent political cadres within law enforcement cordons apparently with the tacit approval of the police is a new phenomenon that is greatly troubling. Images of cadres blocking public roads with tyres and rocks in order to prevent the passage of Hakainde Hichilema while armed police watched nearby are perplexing. This behaviour confirms to the world that we can no longer count on the police to protect our people,” he said.

“This also highlights citizens’ long held suspicions that there are ruling party militias under the unfettered protection of the police, although home affairs want to point fingers at other interests, but after this well documented incident, no one must believe them. Equally perplexing is the action by the police to summon the victim for questioning by the same police that turned a blind eye on political militias that mounted illegal roadblocks to trap their intended victim. How would HH trust them if they failed to arrest the political cadres that were throwing stones at his vehicle?”

THE DP says those in the PF will be blown off by the wind of change they are downplaying.

On Sunday afternoon, DP officials in party president Harry Kalaba, spokesperson Judith Kabemba, finance secretary Justine Nkonge and Central Province chairman Stephen Kabwe featured on KNC radio in Kabwe.

Kalaba said people have realised that time to change the government has come.

“People have seen that this is time for the DP to be voted for. The DP does not entertain political violence and tribalism and that’s exactly what Zambians despise,” he said. “Today most families in this country cannot manage to have three meals in a day. Some have failed to send their children to school. Why? They don’t have jobs.”

Kalaba also explained the mobilisation strategy for the Democratic Party.

“I was in Kapatu last Sunday. Kapatu is in Lunte district in Northern Province. Then we went to Kasama, Mpika and everywhere. As I speak here, our teams are mobilising. Winning elections is not on the polling day but now,” noted Kalaba.

On his part, Nkonge said “come what may”, the PF would be kicked out of power in August next year.
He indicated that no political party had mobilised its members throughout the country, since 2018, like the DP.

“We have been to all the provinces. We have not rested and we’ll not rest in terms of mobilisation. Those who are saying there is no wind of change next year, let them stay still. They will be blown off by the same wind,” Nkonge said. “Both rural and urban voters have woken up to the trickery of the PF. They have now known that PF leaders niba kalembe kafyuke (cheats). Even villagers have now known that the PF is gone. Let them continue comforting themselves that there is no wind of change. It’s because they are eating. But come next year, we’ll get off the sausages off their mouths.”

He mocked PF officials for going round, chanting about infrastructural development.

“But ask them at what cost? These roads they have been putting up are disposable. The DP has pillars which it will rely on to turn around the economy so that wealthy can be equitably shared, unlike the situation now,” Nkonge noted. “How many are benefiting now? We can’t tolerate a situation where every election year, people come to lie to us about what they will do about Mulungushi.”

He explained that a DP government would see to it that agricultural produce was processed within Zambia, to create jobs.

Nkonge added that at the moment, young Zambians were only employed in AirtelMoney and MTNMoney booths.

Meanwhike, Kabemba lamented that there were no industries where young people could get employed, no wonder: “our youths are always roaming the streets.”

“They have been lying that they will fully operationalise Mulungushi Textiles and employ thousands of people. Have they employed anyone? It was a political lie, as usual,” she said. “Who have these people even empowered? Obviously only those who are selected to go and sing for the President at the airport are empowered. But even then, the handouts they are given are not sustainable. So, the issue of empowerment is just a political strategy.”

She added that the DP meticulously thought through issues.

“We analyse and say ‘this thing we are about to do, how is it benefiting the people?’ That’s how we concluded that holding by-elections is a loss to the national treasury,” said Kabemba. “Look at the huge amounts of public money that is spent on by-elections! Yet there are no basic medicines even here at Kabwe Central Hospital! Those by-elections just breed division and political violence. Simusamba to determine Kambwili’s bail application tomorrow

LUSAKA principal resident magistrate David Simusamba says he will state his position on Chishimba Kambwili’s bail application, pending appeal to the High Court on October 22.

Magistrate Simusamba said it was irregular for Kambwili’s lawyers to file a notice of appeal to challenge his judgment before he could conclude reading it.

He said he would indicate in his ruling tomorrow why he could not hear the bail application yesterday.

On October 14, 2020, Kambwili was convicted and sentenced to 12 months imprisonment with hard labour for forgery and uttering a false documentrelating to the registration of his company Mwamona Engineering and Technical Services.

Before magistrate Simusamba could rise, state counsel Musa Mwenye and Keith Mweemba said Kambwili had lodged an application for bail pending appeal to the High Court as the outcome of the judgement was anticipated.

Magistrate Simusamba wondered what time the notice of Appeal to the High Court against his judgment had been filed when he had just delivered it.

He directed that the application for bail pending appeal be determined on October 20.

When the matter came up for hearing of the bail application yesterday, Kambwili’s lawyer Eddie Mwitwa of Mwenye and Mwitwa advocates informed the court that the defence filed amended documents relating to the bail application and the notice of appeal in the court registry.

Magistrate Simusamba said he was before court to hear the admission of the summons for bail pending appeal and that he did not make any directions for amendments.

Mwitwa said there were minor mistakes on the documents that were filed on October 14, as there were some inaccurate particulars such as the date of conviction.

Magistrate Simusamba said the notice of appeal was filed before the matter was adjourned which was contrary to the rules of practice and procedure as he had not concluded to render his judgment, neither had he risen when the said notice was filed.

“How did the accused know that he was going to be convicted? Why is it that I was presented with a notice of appeal before I could finish delivering judgment, at the time I had not yet risen?” magistrate Simusamba questioned. “Can you show cause why this was filed before I could even rise?”

In response, Mwitwa explained that he was not before court on the material day and requested to address the court in chambers as the bail application was supposed to be a chamber matter.

After recess, Mwitwa asked agistrate Simusamba to consider the bail application.

In his ruling, magistrate Simusamba said ” “since you deviated from my guidance, I will deliver my ruling on Thursday on whether or not the application for bail is competent before me or defective and whether or not I will proceed to hear it. I will give a reason why I could not go ahead to hear it today in my ruling on Thursday.”

Kambwili was not before court for his bail hearing as the prison authority did not have documents indicating that he was supposed to appear before court.

According to the notice of appeal, Kambwili wants to challenge his conviction and sentencing on grounds that magistrate Simusamba erred in law and fact when he declined to recuse himself and proceeded to hear the matter and convicted him notwithstanding the existence of [conditions] affecting independence and impartiality.

In his five summarised grounds of appeal, Kambwili contends that magistrate Simusamba erred in law and fact when he declined to refer his forgery case to the High Court for determination on whether or not his right to a fair trial before an independent and impartial court had been, was being and going to be infringed.

He said the court gravely misdirected itself in law and fact when it convicted him against the weight of the evidence on record.

The NDC leader contends that magistrate Simusamba erred in law and fact when he prematurely curtailed his continued defense in the forgery case and ordered the immediate closure of the defense when he (Kambwili) had applied for an adjournment.

Kambwili further stated that magistrate Simusamba erred in law and fact when he conducted trial in contumelious disregard and violation of Article 18 of the Constitution as regards the tenets of fair hearing, impartiality and adequate time and facilities for preparation of defence.

It’s wrong to classify Chimese’s earnings as confidential, rules magistrate Chanda

LUSAKA magistrate Nsunge Chanda says the disclosure of earnings of former Zambia Air Force commander Lieutenant General Eric Chimese cannot threaten state security in any way therefore it is wrong to classify his emoluments as confidential.

Magistrate Chanda has however directed that she will hear the evidence of Colonel Bernard Chileshe, a director in charge of salaries and pension at ZAF under finance department, in chambers.

This is in a matter where Lt Gen Chimese is facing charges of abuse of authority and is jointly charged with Chita Lodge proprietor James Chungu for money laundering.

Last month, Lt Gen Chimese’s defence lawyer Kelvin Fube Bwalya prevented Col Chileshe from disclosing the amount of money that his client accrued from the time he assumed office as ZAF Commander until he was fired.

Bwalya said salaries, pension benefits and emoluments relating to service chiefs could not be disclosed without authority from the President as it was considered classified information.
He said disclosing the same would amount to an illegality.

This was after Col Chileshe told magistrate Chanda that in May 2019, after officers from the Drug Enforcement Commission visited ZAF, he was assigned by the command to compute personal emoluments and benefits accrued to Lt Gen Chimese for the period he served as commander from 2011 to 2018.

“I got the information from the pension fund relating to payments made to NAPSA, gratuity, leave days, three months salary notice and repatriation for General Chimese. For the salaries, I got the information from the payroll for the period 2011 to 2018 when he retired,” Col Chileshe said.

He further explained that he also collected information relating to Lt Gen Chimese’s foreign travel allowances and compiled the said information for the DEC.

Col Chileshe said Lt Gen Chimese’s emoluments were approximately K11.7 million but before he could disclose further information relating to what the accused accrued from pension benefits, salaries and travel allowances between 2011 to 2018, Bwalya curtailed his testimony arguing the evidence bordered on State security.

Bwalya said the law relating to classified information was very clear on communication of protected information by any person apart from an authorised person.

He said there must be a specific waiver by way of authority.

“The salary, allowances and benefits of the ZAF commander are well known as classified information and disclosure of classified information without authority from the President may land the witness and others who give such information without authority into trouble,” Bwalya said.

“A person who gives such information without a waiver will commit an offence and may be liable to a conviction of a term not less than 15 years and not exceeding 25 years. My instructions are to inform this court that a commander’s earnings are classified as secret and confidential.”

He said the conditions of service for all service chiefs were given directly to them by the Secretary to the Cabinet in the name of the President and that conditions of service for service chiefs could not be discussed without authorisation from the Commander-In-Chief of the Armed Forces.

Bwalya cautioned Col Chileshe against being found on the wrong side of the law, and restrained him from further disclosing what Lt Gen Chimese had obtained during the period he served as ZAF commander until he was retired in national interest, without being permitted by President Edgar Lungu.

He said senior officers such as Col Chileshe and other government officials were under oath not to disclose classified information even after 25 years of leaving office.

“The rationale is found in the preamble of the state security to protect the state and its officers. In the absence of the colonel producing a letter from the Commander-In-Chief of the armed forces that he has been authorised to disclose classified information, such borders on illegality,” Bwalya submitted. “Even us as the defence we may need to get instructions from accused number one (Chimese) to cross-examine the colonel which will border in us receiving classified information which again may be illegal. This witness is incompetent to go beyond what he has told the court without committing an offence.”

In his response, Chief State Advocate at National Prosecutions Authority Gamariel Zimba said the defence had alleged that the testimony by Col Chileshe was classified information and the State could only respond if the defence presents documentation to the cases they cited and those relating to classified information.

At this point, Bwalya requested that the parties and the court resolve the matter in Chambers before the court could render its ruling.

Zimba submitted that Lt Gen Chimese’s emoluments do not fall under confidential information which could threaten State security.

He argued that section four of the State Security Act which the defence relied on in their objection was cited out of context.

“ Accused number one’s personal emoluments cannot be said to be a code, a password, personal sketch or other documents for use at a protected place,” Zimba said.

He submitted that in line with the Presidential emoluments Act, the Head of State’s emoluments were in public domain.

“How then would we argue that the personal emoluments of another public officer who is subordinate to the Commander-in-chief of the armed forces becomes classified information?” Zimba asked.

He said Lt Gen Chimese’s personal emoluments were not closer to what the State Security Act seeks to protect.

But in her ruling, magistrate Chanda said a ZAF commander’s emoluments were partially classified information under the State Security Act and that exposing the same would not compromise State Security.

She said that Lt Gen Chimese was a public servant paid by a department under the Ministry of Finance and in the interest of justice, it was wrong to classify his earnings as confidential information.

“This is not the first time an Air Force commander is being tried and their emoluments disclosed. There is no suggestion under the State Security Act that emoluments for an Air Force commander was classified information,” magistrate Chanda said. “I have carefully considered the law that can help me, the authorities cited by the defence falls off. I find that the general’s emoluments are not classified matters as the legislator would have stated it clearly.”

Magistrate Chanda said that she would proceed to hear the evidence of Col Chileshe in chambers to enable him to adduce all the evidence needed in the matter.

She further directed that the State would be prejudiced if the information was disclosed.

Beatrice Hangwende – When Marriage Turns Around To Eat You Alive. Who Is Protecting Jonathan From Prosecution

Two wrongs don’t make a right and being a lifer (one serving a life imprisonment) does not mean one loses his/her fundamental rights as a human being. It is also inhuman for anyone to take advantage of a person in prison.

I, for one, stand against these things, politics or no politics. I will spend my last to help anyone being taken advantage of regardless of the person involved and what they could have done in the past.

One of the things I do, away from politics, is visit Prisoners. For the past few months, I have been visiting Beatrice Hangwende, among others.

Beatrice is familiar to many people who could read and follow issues just before Levy Mwanawasa died, when she hired the killing of her husband’s suspected lover, Monica Chabwera Phiri.

When you meet Beatrice today, you would feel sad how her magnificent life has just changed from a successful businesswoman owning two successful businesses, K.T.M Diesel Centre and Jasmine Beauty Parlor.

Beatrice owned 6 properties in total, among which is a farm number L2338/M/C in New Kasama. The farm was worth several millions of Kwacha which included flats.

Unfortunately, Beatrice is at the verge of losing everything because her love of her life, Mr. Jonathan Mwala, has taken advantage of all that she worked for.

Beatrice is serving a life sentence for a crime that should not have been, had she met a more responsible man who would support her and supplement her hard-work, as a husband.

Beatrice used to work for Toyota Zambia before going to London for further studies. It was whilst there, that she met Jonathan who had just gone to London for a holiday, from Russia where he had done for school, as well.

Meeting Beatrice was like a “Jack-pot”, that Jonathan even abandoned his school in Russia to become a husband to Beatrice. Beatrice says that, she was in love and showered whatever Jonathan he wanted.

They later came back to Zambia where Beatrice continued as a businesswoman. Unfortunately, marital issues crimped in as Jonathan was allegedly unfaithful and irresponsible, living off the wife.

Beatrice could not bear the pain of seeing the man she had hoped to be a husband and a father to her 3 children, going about with other woman, which led her to pouncing on one of the suspected lover of Jonathan.

Beatrice regrets and tenders an apology to the family of Monica, the Govt and the general public for the crime she committed out of emotional out-burst.

In jail, she helps other women in counseling. A few other women in prison speak well of her, especially her generosity, in spite of having nothing herself.

Unfortunately, Jonathan, divorced her in absentia, as she was in jail and married another woman whom he is living with.

Without Beatrice, Jonathan has been selling some properties they co-owned as a couple including the farm mentioned above.

The farm was demarcated into 15 plots and sold for over K3 million which money Beatrice has been pursuing from Jonathan in court using Maureen Mwanawasa as her lawyer. Ms Mwanawasa has taken up the case as a way of supporting disadvantaged women.

However, Beatrice wants half of the plot, which was sold illegally to, Pinalo Chifwanakeni, a Professor at Lusaka University, back for her 3 children whom she speaks of so fondly.

She has never seen her children ever since she went to prison and desperately wishes to see them. When she went in prison the youngest child was only 2 years, while the others were in grade 4 and 6 respectively. She wishes that the husband would be gracious to allow the children visit her.

Jonathan seems to be enjoying some favors from his connections, to the effect that, he is supposed to be taken to court, but the police seem to be lingering around albeit having arrested Janathan and bonded him.

Apparently Jonathan even managed to have the Inspector of Police Mr. Kakoma Kanganja intervening in his case. Police officers had to write reports to the IG for putting Jonathan in custody. This is why, I have reservation for this Kanganja, it is not that I hate him, but his works, are far below par.

On the other hand, the Prison Service, under Percy Chato, are doing very well, because they have facilitated for Beatrice to pursue this case, because it is her right, yet the police seem to be frustrating the case.

The Home affairs was also brought in the picture, but when I spoke to him, he assured me that, he will not be involved, though I am still wondering why the case is not coming up in court.

How long do the investigation take because this case was reported to the police in February 2016. What is going on, is it the IG protecting Jonathan?

The other case is in the civil court for the properties which were sold with Beatrice’s consent but no money was given to her. At the moment Beatrice is in desperate need of money because she has a chronic illness which requires her to be on a diet and sleep on an orthopedic bed.

It is sad how people’s lives get messed up through marriages when marriage is supposed to be a blessing. Beatrice does not deserve to be going through all this, if only Jonathan Mwala had a heart that cares for others. It seems Jonathan just used Beatrice and brought her problems which are now eating her alive in jail.

On my part, I will keep on pursuing the rights of Beatrice and other vulnerable. This is what I ever wanted to do in my life. Politics is just one way I think I can help better, because people like Kanganja would not block justice when they are supposed enforce the law.

I hope her children can read this article and find it in their hearts to go and visit their mum. The woman loves her children and I feel for her.

NGOCC CONDEMNS POLICE BRUTALITY AGAINST MRS. KAMBWILI

The Non-governmental Gender Organisations’ Coordinating Council (NGOCC) condemns in the strongest terms the unprofessional and brutal behavior by the Zambia Police against National Democratic Congress (NDC) leader, Dr. Chishimba Kambwili’s wife and daughter at the Magistrate Courts on Tuesday, 20th October 2020.

The Republican Constitution guarantees citizen’s right to dignity and against all forms of inhuman and torturous treatment. To undress a woman in the manner the police did to Mrs. Kambwili is not only an assault on her dignity but a collective assault on all Zambian women. Regardless of the crime one is accused of committing, they are presumed to be innocent until proven guilty by a competent court. Therefore the brutality and heavy-handedness by the overzealous police officers against the defenseless and unarmed women is totally unacceptable. To torture and dehumanize Mrs. Kambwili and the daughter in that manner is criminal. Clearly, from the video that has gone viral the behavior of the police is devoid of any civility and professionalism expected of the Police Service.

We therefore demand an apology from the Inspector General of Police, Mr. Kakoma Kanganja, and the immediate prosecution of the officers that behaved in a barbaric manner as captured in the videos which are circulating on online platforms. The conduct of the officers is far short of the set principles of public service and specifically the Police Code of Conduct. It is NGOCC’s expectation that the Police must act according to their call of service in providing law and order and resolve to maintain civility when dealing with citizens.

If this is the kind of police action that our democracy shall now be exposed to, NGOCC has cause to worry how the Zambia Police is preparing to handle the 2021 General Elections. The Police Service has a lot of work to do in order to enhance the professional conduct of our women and men in uniform. The examples shown so far in many aspects leave majority citizens concerned. Just recently we witnessed videos of cadres of a named political party damaging a motor vehicle of one opposition political party in full view of the police.

Once again, the duty of the Zambia Police is to protect citizens and ensure that at every point the human rights and indeed women’s rights of all Zambians are upheld.

POLICE SHOULD HAVE TREATED MRS CAROL CHANSA KAMBWILI IN A HUMAN WAY-HUMAN RIGHTS COMMISSION

The Human Rights Commission wishes to put it on record that the Zambia Police Service treated the National Democratic Congress (NDC) President, Dr. Chishimba Kambwili’s wife in a cruel, inhuman and degrading manner when they were apprehending her at the Lusaka Magistrate Court premises in Lusaka on 20th October 2020.

Acts of cruel, inhuman or degrading treatment or punishment of individuals or suspects are absolutely prohibited under Article 15 of the Constitution of Zambia, Chapter 1 of the Laws of Zambia and under International Human Rights Law.

Therefore, the State violated Mrs. Kambwili’s right to protection from inhuman or any form of ill-treatment regardless of the alleged offence she may have committed. Further, the Commission considers the Police action against Mrs. Kambwili to have been excessive and disproportionate to her alleged action. Police action was not only unlawful and a violation of human rights but unnecessary, unreasonable and unjustifiable in a democratic state such as Zambia in which human rights are supposed to be respected and protected.

There are no circumstances under which acts of cruel, inhuman or degrading treatment or punishment of suspects are justifiable. Such acts are universally absolutely prohibited and Zambia should not be seen to be among Pariah States where respect for human rights is concerned.

The Commission wishes to make it abundantly clear that it is not in any way against the maintenance of law and order as that is a constitutional mandate of the Zambia Police Service, which is also central to the promotion and protection of human rights and freedoms. The Commission’s point of departure is when the police engages in acts of human rights violations.

The Police can still be firm and effective in executing their mandate without being brutal against suspects, particularly unarmed, defenseless and vulnerable individuals such as women and children.

It is regrettable that acts of police brutality against individuals continue unabated and are somewhat increasingly becoming the new normal of police operations during crowd management. Such impunity has resulted in numerous cases of gross violation of human rights, including the right to life through extra-judicial killings of citizens at the hands of police officers.

The Commission calls upon the Government, which has the trio primary obligation of respecting, protecting and fulfilling human rights, to demonstrate leadership towards ending acts of police brutality which are giving a wrong impression that Zambia is steadily becoming a police state.

The Commission wishes to take this opportunity to remind both the State and Non-State Actors that under no circumstances are acts of torture and other cruel, inhuman or degrading treatment or punishment permissible under both national and international human rights laws. Therefore, such acts reflect the extent to which the rule of law, constitutionalism and human rights are being violated.

Zambia is a party to the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. The Government, therefore has an obligation to prevent such acts and/or punish perpetrators of such acts to end impunity, and also take remedial measures in protection of victims.

Kambwili’s jailing is govt persecution – Musenge

MWENYA Musenge says it is without doubt that what is happening to National Democratic Congress leader Chishimba Kambwili has inflections of government persecution.

Kambwili was last week sentenced to one-year imprisonment for forgery.

In an interview, Musenge said whatever is happening to Kambwili now is not different with what was happening when the two Copperbelt based PF founder members formed the NDC.

“I want to urge my friend and brother Chishimba Kambwili to be strong as he goes through this trying moment. I know it is not easy at all but I know that he is man enough and strong indeed. It is my prayer that all these things will come to pass,” Musenge said.

He said many of the cases mushrooming now had intonations of government persecution.

“And it is so unfortunate that such things can be happening in a democratic country like Zambia. It is a well-known fact that when you are in opposition, you become an enemy of government and that you are watched day and night, investigated and persecuted in the manner Kambwili is being oppressed,” the former Copperbelt minister said.

Musenge said others have also suffered a similar fate.

He advised President Edgar Lungu to seriously consider creating an enabling political environment where the government and opposition parties co-exist.

“We agreed as a nation to go multipartism and it entails that at any given time there will be so many political parties, there will be one party in government and these other political parties were to be there to offer checks and balances,” Musenge said. “But if the PF in government cannot accept multipartism, let them advocate for the one party so that we know that the system we have cannot work with our colleagues because whatever these other political parties in opposition are doing is within the law. If anything, what we need is try and refine the system.”

He said politics are supposed to be issue based and not focused on character assassination and insults.

“That is what is required and this can only be achieved when all political parties put their heads together, including the party in government,” he said.

Musenge said the violence and incarceration of political opponents being witnessed is not necessary.

He recalled that not long ago UPND leader Hakainde Hichilema was incarcerated and people who condemned the act like him were expelled from the PF.

“Even now I don’t think it is right. If you follow the way the Kambwili matter was handled, I don’t think it could have gone this far. Even when you try to analyse the whole case from inception to its conclusion…I think this is total persecution and we say it’s not right,” Musenge said. “Today it’s Kambwili and tomorrow it will be Edgar Lungu because he will not be in State House forever and all those who are surrounding him and supporting whatever is happening should know that there is night and day. Today it might be night for Kambwili but tomorrow it will be day for him.”

He said it was important that Zambians, politicians and especially those in government, know that what is being done is not right.

Musenge recalled that he worked with PF founder Michael Sata they advocated change upon forming government.

“But when you ask yourselves, you who are in government, how many things have you changed to create a more enabling environment? We spoke about the public order Act, that when we form government, it will be worked on. But you have maintained it and are now using it to persecute others. It is unfortunate that our colleagues do not know whatever they are doing and it’s not helping our country at all,” he said.

Musenge added that all political players should come up with a system that will create a better Zambia and know that whatever they are doing is for the benefit of all citizens.

“My sincere appeal, Ba Kambwili, I know that it’s unfortunate that you are there but my dear brother, Lesa alemona fyonse ifilecitika. Be strong and God will see you through,” said Musenge.

FDD leader Edith Nawakwi has argued that UPND president Hakainde Hichilema has made reference to several media platforms indicating that she defamed him but he has not produced particulars of defamatory words.

Nawakwi wants the Lusaka High Court to compel Hichilema to give her better particulars because, according to her, his statement of claim is deficient.

This is in a matter where Hichilema has sued Nawakwi for defamation of character demanding US $3 million as damages for libel.

Nawakwi on several media platforms alleged that Hichilema illegally benefited from the privatisation exercise by dubiously acquiring a house belonging to Lima Bank.

Hichilema wants Nawakwi to reward him $3 million which he has spent in mitigating the effects of her conduct towards him which emanate from the publication of her defamatory utterances.

He also wants an injunction restraining Nawakwi, whether by herself, servants or agents, or otherwise from further publishing or causing to be published or broadcast the defamatory words or similar.

Nawakwi had earlier asked for better particulars from Hichilema in order for her to defend herself, claiming Hichilema’s defamation case lacked sufficient particulars to warrant her to file defence.

But Hichilema, in an affidavit in opposition to summons for further and better particulars sworn by his lawyer Mulambo Haimbe, said Nawakwi was not entitled to the further and better particulars requested for as the demand letter was concise and segmented under clear headings which detailed each of the distinct heads of claim.

However, Nawakwi in her skeleton arguments in reply, said she had never been personally served with a copy of the demand letter.

She insisted that Hichilema had not adduced any evidence that she acknowledged receiving the demand letter.

Nawakwi said apart from making reference to various public media platforms such as Hot FM Radio, ZNBC there was no evidence of an interview with Diamond TV and that the interview with Zambia Daily Mail newspaper did not show receipt of the letter of demand.

“The defendant reiterates that the plaintiff’s claim endorsed on the writ of summons and the particulars in the statement of claim are deficient, and this is a fit and proper case for this court to order further and better particulars. The plaintiff avers third party publications, Internet streaming and digital broadcast. The plaintiff is legally obliged to plead the publishes [published statements],” she submitted.

Nawakwi said Hichilema referred to an interview on Hot FM and alleged that she had continued to make defamatory statements against him on ZNBC and other media outlets but did not produce any particulars at all.

She stated that the demand letter must be filled in its own right, and the acknowledgement of receipt or affidavit of service were subsequent requirements after the plaintiff had effected proper service of the demand letter on her.

Nawakwi further indicated that a demand letter was an integral part of the original process and a very cardinal document in Hichilema’s bundle of pleadings.

“The proper service of the letter of demand is a requisite condition prior to the filing of the letter of demand. Mere knowledge of the existence and contents of a letter of demand are not sufficient,” submitted Nawakwi. “The global pleading of alleged defamatory words render the particulars of the statement of claim deficient. The plaintiff is obliged at law when one avails that the defamation was by way of Internet or digital broadcasting without furnishing the particulars of the publishes.”

Magistrate Simusamba had sentenced Dr. Kambwili to two years imprisonment for forgery last week on Thursday. After the judgement was passed, Dr. Kambwili’s lawyer Musa Mwenya S.C applied for bail hearing to Magistrate Simusamba. He declined the hearing and moved it to this week on Tuesday. Today, when the matter came up for hearing, moved the hearing to Thursday.

It was also during the Court session that Dr. Kambwili’s daughter Chanda and his wife were arrested and taken to Kabwata Police Station.

Commenting on the postponment of bail application, New Hope Movement for Multi-party Democracy (MMD) President said what happened to Dr. Kambwili happened to him 2 years ago before the same magistrate.

“We as the New Hope MMD are shocked with the unfair conduct of Magistrate Simusamba to Dr. Kambwili. When he passed judgement last week, I hoped that he would hear the bail application and pass judgement today. But what transpired is very unfortunate as it reminded me of what he did to me two years ago. He avoided my bail application for over two weeks which led me to spend two weeks at Mwembashi state prison”, Dr. Mumba lamented.

Dr. Mumba further said that Magistrate Simusamba shouldn’t be serving on the bench.

“As you maybe aware, after his avoidance to attend to my bail application, I complained to the Judicial Complaints Commission which responded to me recently and recommended that Magistrate Simusamba should be removed as a Judge. So we expected him to do the honorable thing by resigning or rescuing himself”, Dr. Mumba said.

Dr. Mumba then called upon the Zambia Police Service to show leniency and act professionally when dealing with the Public.

“Lastly but not the least, What happened today was very unfortunate of where the state police beat up my niece Chanda Kambwili with batons whilst she was not armed. The Zambia Police Service should show leniency when dealing with the Public especially when dealing with sensitive matters like was the case of Chanda Kambwili. No father would want to see his child and Wife being beaten simply because of trying to attend their court case”, Dr. Mumba said.

We’re ready for elections, UPND are not – Davies Mwila

WE have agreed with Electoral Commission of Zambia for them to register nine million people in 30 days, says ruling PF secretary general Davies Mwila.

He also says he is not aware that the current application of the public order Act disadvantages the opposition.

Mwila featured on ZNBC TV’s Sunday Interview programme, hosted by Grevazio Zulu.

He started by talking about the ‘exceptional’ performance of the PF government.

“UNIP was in power for 27 years, the MMD were in power for 20 years and the PF for nine years. If you look at the performance of all the three political parties, I can mention that PF has performed extremely well,” Mwila boasted.

He catalogued the PF government’s ‘achievements’ in the education, health sectors, as well as the development of infrastructure across the country.

Reminded by the interviewer that there was a public view that the concentration on infrastructure development was due to kickbacks gotten by some corrupt elements in the system, Mwila could not buy that.

“No! No! No! Development is about bringing infrastructure. That’s how you develop! Without infrastructure, there is no development. That’s the more reason Patriotic Front has concentrated on improving infrastructure,” Mwila said.

He also claimed that President Edgar Lungu and PF: “we are very committed in the fight against corruption. And we’ve not spared anyone who is involved in corruption.”

On whether or not the acquittals of government ministers accused of corruption were stage-managed, Mwila answered: “the courts are independent – they make decisions.”

“Chishimba Kambwili was jailed; it’s decision of the court. We’ll not interfere,” he said.

Asked if Kambwili would have been jailed if he were a minister, Mwila said he did not know.

“That’s the decision of the court,” he said, further detaching the PF from Kambwili’s case. “Any [PF] individual who was celebrating because Honourable Kambwili has been jailed, that is up to that individual. But us as a party, we are not interested in Kambwili’s case. And we are not interested in anyone to be kicked out from the race. We want everyone to stay on [and] come next year, they will be defeated by PF.”

On why him and PF president Edgar Lungu were tightlipped at the last party presidents’ summit at Mulungushi International Conference Centre, Mwila explained that they were quiet because the Electoral Commission of Zambia (ECZ) had been engaging all the political players.

“From the onset, ECZ has been engaging us… We’ve been agreeing on issues that ECZ were bringing on the table. One of them is on the nomination fees. We saw that nomination fees were high; we engaged Electoral Commission of Zambia and that’s the more reason ECZ had to listen to all the political players,” he explained.

“So, on all the issues that they’ve brought…But I think as the party in government, we are very comfortable.”

Mwila stressed that it is possible for the ECZ to register nine million voters in 30 days.

“When we are voting, we just vote for a day – four million [people] vote in a day. When it comes to voter registration, you are talking about 30 days. You are going to have 8,999 polling stations,” he said. “Each polling station can register 33 people in a day and we are going to reach nine million. That’s the more reason we have agreed with Electoral Commission of Zambia for them to register nine million people in 30 days. Us as the party which is in government, we are very much ready to go and sensitise our people, our members, so that they can register [as voters]. We are geared, come 28 October.”

Under the same breath, Mwila claimed the ECZ was autonomous.

“We don’t control ECZ but what we are saying is that in 30 days they can manage to register nine million people,” Mwila declared. “We are ready for elections [but] UPND are not ready. That’s why they are crybabies…”

On incessant power outages around the country, Mwila said the government had invested a lot of money in the energy sector.

“Within next year, by March, 750 megawatts will come on board and we expect load-shedding to come to an end. By March [2021], we don’t expect any load-shedding,” he promised. “As we go for elections, there will be no load-shedding.”

On the application of the public order Act, Mwila pointed out that it was not the PF that administers the Act.

“It is in public domain; we have told our colleagues that let’s support Bill 10, we amend the public order Act. There is no arm-twisting [but] it’s about the political players coming on the table and say ‘okay, let’s agree on this and we should not agree on this’,’” Mwila said. “So, on the public order Act, I’m emphasising, there is need for them to support Bill 10, for us to amend the public order Act.”

Meanwhile, asked if he was aware that opposition parties were not being allowed by the police to hold rallies the way PF is doing, Mwila responded: “I’m not aware!”

“I just heard that they (UPND and NDC) want to hold a protest, which was supposed to be held last week…[But] I don’t want to concentrate on UPND because I don’t apply [police] permits for them. I apply for my party!” said Mwila.

We would like to inform the nation that following the unjustified conviction of NDC president Dr Chishimba Kambwili last week and the attempted assassination of another opposition leader of the UPND president Hakainde Hichilema, in Mpika on 17th October 2020 , all coordinated by both PF leaders and some police officers, we again issued an alert to the international community regarding this gross repressions.

The Mpika security saga and the illegal summoning of the political violence victims HH and Romeo Kangombe, which yesterday Zambia Police made a U-turned on by claiming that they did not summon the opposition leader. This matter was highlighted in our recent report. We copied the letter to the following: State House, All traditional leaders, Church mother bodies, Catholic Church
,All diplomatic missions accredited to Zambia, SADC, UN, AU, EU and civil society organisations, High commission for human rights,Amnesty International and commonwealth secretary. We are still circulating this statement to ensure that it reaches all intended recipient.

We are very delighted with Amnesty International North American department for the acknowlegement of receipt of our second complaint of human rights violations in Zambia. Amnesty International as an international network member has passed on the message to other stakeholders who are responsible for defending humanity.

We challenge president Edgar Chagwa Lungu to rescind all his decisions of sponsoring violence next year and manipulating the outcome of the elections. No matter what happens, his mismanagement of both state and Economic affairs can no longer be hidden even if all the voices were silenced.

We call upon all the people of Zambia to be on heightened alert for the PF government sponsored brutality against Zambians and their intentions to cause more trouble next year.

Kindly note that three weeks ago we submitted another report to the UN Secretary General and Amnesty International highliting how the PF government under President Edgar Lungu are planning war against Zambians ahead of the general elections next year.

Jeffrey Toobin steps away from CNN, suspended by the New Yorker for Masturbating on Zoom Call

The New Yorker has suspended reporter Jeffrey Toobin for masturbating on a Zoom video chat between members of the New Yorker and WNYC radio last week. Toobin says he did not realize his video was on.

“I made an embarrassingly stupid mistake, believing I was off-camera. I apologize to my wife, family, friends and co-workers,” Toobin told Motherboard.

“I believed I was not visible on Zoom. I thought no one on the Zoom call could see me. I thought I had muted the Zoom video,” he added.

Two people who were on the call told VICE separately that the call was an election simulation featuring many of the New Yorker’s biggest stars: Jane Mayer was playing establishment Republicans; Evan Osnos was Joe Biden, Jelani Cobb was establishment Democrats, Masha Gessen played Donald Trump, Andrew Marantz was the far right, Sue Halpern was left wing democrats, Dexter Filkins was the military, and Jeffrey Toobin playing the courts. There were also a handful of other producers on the call from the New Yorker and WNYC.

Both people, who spoke on the condition of anonymity in order to speak freely, noted that it was unclear how much each person saw, but both said that they saw Toobin jerking off. The two sources described a juncture in the election simulation when there was a strategy session, and the Democrats and Republicans went into their respective break out rooms for about 10 minutes. At this point, they said, it seemed like Toobin was on a second video call. The sources said that when the groups returned from their break out rooms, Toobin lowered the camera. The people on the call said they could see Toobin touching his penis. Toobin then left the call. Moments later, he called back in, seemingly unaware of what his colleagues had been able to see, and the simulation continued.

New Yorker spokesperson Natalie Raabe said: “Jeffrey Toobin has been suspended while we investigate the matter.”

Toobin’s Conde Nast email has been disabled and he has not tweeted since October 13. He did, however, appear on CNN, where he is the network’s chief legal analyst, on Saturday. “Jeff Toobin has asked for some time off while he deals with a personal issue, which we have granted,” CNN said in a statement.

The New Yorker editor David Remnick wrote in an email to all New Yorker staffers: “Dear All, As you may have read in various news reports today, one of our writers, Jeff Toobin, was suspended after an incident on a Zoom call last week. Please be assured that we take such matters seriously and that we are looking into it. Best, David.”

Doubleday, an imprint of Random House, which published Toobin’s latest book did not respond to emails. Neither did Toobin’s literary agent Kristine Dahl nor Greater Talent Network, which represents Toobin. WNYC did not respond to a request for comment. -VICE

It’s not the end for me, Kambwili tells Kalaba

I’M picking lessons from my imprisonment, Chishimba Kambwili has told Democratic Party president Harry Kalaba.

Kambwili, the opposition National Democratic Congress (NDC) president, was on Wednesday, October 15, 2020 given a 12 months imprisonment.

Kambwili was convicted and sentenced by Lusaka principal resident magistrate David Simusamba.

Kalaba visited Kambwili at Kamwala Remand Correctional Facility today.

He arrived at 15:54 hours and only came out at 16:23 hours.

“He’s from telling me that ‘you know I’m encouraged by people like Nelson Mandela who was jailed for 27 years’. He was saying even people like ba Sata was here and that it’s not the end for him,” Kalaba exclusively shared with The Mast his chat with Kambwili.

“He was telling me that I’m picking lessons from my imprisonment and I agreed with him. He is not broken.”

Kalaba then told The Mast and Diamond TV journalists that it was important for him visit Kambwili.

Kambwili’s wife, Carol, also visited her husband today at 16:05 hours.

She said: “he is fine.”

“He is strong as ever. It’s heart-breaking for me, the family and the children, because as far as we are concerned he has not done anything wrong. It is just government persecution,” Carol said.

Asked about the message from Kambwili to his followers, Carol said his message to his followers is that they should stay strong and keep the faith.

“We look forward for justice to be served tomorrow, as he goes for bail application,” said Carol.

NDC spokesperson Saboi Imboela, who accompanied Carol, said: “a good leader is seen when he is not there.”

“The fact that our president is in prison does not mean that the party has crumbled. His good leadership can be seen now when he is not there and [yet] we are able to stand together,” noted Imboela.

The Wife to the National Democratic Congress (NDC) party President Dr Chishimba Kambwili arrived from the United Kingdom yesterday in the country.

This follows the incarceration of the husband last week on the 14th October 2020 by principal magistrate David Simusamba.

This afternoon Carol Kambwili in company of NDC Spokesperson Saboi Imboela, NDC Chairperson Incharge of mobilisation Christopher Mutale and NDC National Youth Chairperson Charles Kabwita visited Dr Kambwili at Kamwala Remand Prison.

Upon the visitation Carol Kambwili spoke to the media.

Madam Kambwili told the media that Dr Kambwili was doing fine as ever and he was in high spirit.

Thought as a wife it’s so hurt breaking, returning from the UK only to find my husband in prison, me, my children and family it’s so hurt breaking Carol said.

Carol further said as far as they are concerned as a family Dr Kambwili never committed any crime to be landed in prison.

The incarceration of my husband is purely political and a government doing. This kind of unreasonable in this country should come to an end.

Mrs Kambwili further said Dr Kambwili’s message to his supporters out there was to stay strong and keep the faith as we all look forward for justice to prevail as the NDC leader appears tomorrow for his bail application.
