LUNGU MUST SUSPEND IMMUNITY…to fairly participate in privatisation inquiry – Changala

GOOD governance activist Brebner Changala says President Edgar Lungu must be treated as a suspect in the privatisation inquiry.

Changala has challenged Law Association of Zambia to state its position on what he termed as “this PF political scheme.”

In an interview, Changala said there is no way a participant in the process can turn around and start investigating others.

“Now, my question to Mr Edgar Chagwa Lungu must be asked this way, how can a participant in a suspicious privatisation process appoint a commission to inquire about the conduct of his opponents or indeed his own conduct? How can he do it?” he asked. “Now in this privatisation debacle, President Lungu must be treated as a suspect as well. And therefore, he cannot appoint a tribunal that will investigate him and his colleagues without declaring conflict of interest. If he doesn’t do that, that flies in the teeth of the rule of law.”

Changala asked further if President Lungu would also drop his immunity and avail himself as a witness.

He also sought clarity on the status of other participants in the process.

“And secondly, when they form the privatisation commission of inquiry, is President Lungu going to temporarily suspend his immunity as a sitting President so that questions can be put to him and he equally must answer back? It must be a two-way traffic,” he asked. “And, thirdly, I want to ask President Edgar Lungu and Edith Nawakwi, do domestic commissions of inquiry have any leverage or jurisdiction on the World Bank, a UN agency? He must answer. Those are only three questions. I’m not adding anything more.”

Changala contended that there was no way President Lungu could be left out of the inquiry when he was a full participant.

“I want to put it this way. President Lungu was one of the lawyers in the privatisation process. He’s part of the team that sold Cold Storage Board. And at the moment he’s the chairman of IDC (Industrial Development Corporation) board, which is the holding company of all parastatals. Madam Edith Nawakwi was the minister of finance and played her pivotal role in the MMD government through privatisation,” Changala said. “And before trial proceeds within the context of Article 18 of the Constitution under which he took the oath of office, a person whose conduct as a lawyer, who participated in the sale of Cold Storage Board and is the chairman of IDC, must first suspend his immunity so that he fairly participates in the commission of inquiry. If he doesn’t do so, Parliament must be called to order to remove President Lungu’s immunity so that he participates in the process of this commission of inquiry.”

Changala further asked if international bodies that participated would also be invited to give evidence.

“Thirdly, the World Bank as a UN agency, its conduct can only be inquired into by international jurists approved by the UN because this commission of inquiry, whether President Lungu likes it, whether madam Nawakwi likes it, it will not do leaving out the major player like the World Bank, the [Commonwealth Development Corporation] CDC which participated,” he said. “The United Nations participated in the privatisation of companies in Zambia through the World Bank because World Bank is an agency of the United Nations. And several individuals participated. These included businessmen, economists, lawyers and consultants wherever they were. So, there are three arms that did the privatisation effectively; that is the Zambian government as the policy maker and drivers of the agenda, then there was Zambia Privatisation Agency, and then there was the community of experts who were engaged and this is where Hakainde Hichilema falls; he’s in the third bracket – community of experts.”

And Changala reminded the Law of Zambia that keeping quiet over a serious matter was an injustice in itself.

“And this privatisation commission which they are demanding, I demand that we need a clear and unambiguous position from the Law Association of Zambia because this commission of inquiry is to divert Zambians’ attention from the prevailing economic and social challenges,” Changala said. “And Zambia has had a lot of commissions of inquiry which have benefited nobody. And this is an exercise in futility. So, the Law Association of Zambia must assist. I equally call upon the three church mother bodies to state their position on this privatisation commission of inquiry.”

Meanwhile, Changala described Forum for Democracy and Development (FDD) leader, Nawakwi as a political failure who was using the PF tag to resurrect herself.

“Only a person who is naïve can believe such a statement coming from an angry woman whose political career has reached a dead end. This is a woman who has failed to hold a convention for FDD for the last 15 years. And if she doesn’t hold a convention this year into 2021, she’ll not even be on the ballot paper. So, her last hope in hell is to join PF so that she remains politically relevant,” said Changala. “This is a woman who has never condemned the grand corruption in PF. This is a woman who never condemned the arrest of Hakainde Hichilema on treason charges which was basically trumped-up charges. This is a woman who has never condemned police brutality. This is a woman who has nothing to say about the abuse of state institutions to stifle dissent in this country. This is a woman with a venomous mouth, and one wonders as to whether there’s peace in her own house and home.”

Police, PF not above Constitution – Kalala

JACK Kalala says if UPND leader Hakainde Hichilema travels to Muchinga Province, as per ‘police’ call-out, he will be giving credence to the collusion of the Zambia Police and the PF.

During the Levy Mwanawasa’s presidency, Kalala was the special assistant to the president for policy and projects implementation and monitoring.

Around 17:30 hours on Friday, two plain-clothed police agents arrived at the UPND secretariat in Rhodes Park in Lusaka, to deliver a call-out for Hichilema.

Hichilema is wanted by Muchinga Province Police Division in the provincial capital, Chinsali.

But Kalala who called The Mast on Saturday said: “I’m urging that HH should not travel to Mpika.”

“If they (police) want to interview him, let them do a virtual interview. He did nothing wrong! We saw pictures of PF cadres with stones and blocking the road and there was even a video to that matter,” Kalala said. “So, what I’m saying is that HH should not travel to Mpika, because he did not commit any offence. I’m urging the police to be professional in their work. They are not employed by [home affairs minister Stephen] Kampyongo or by [President Edgar] Lungu.”

He said police officers were employees of Zambians, “and not employees of PF.”

“So, they should be professional and impartial in their work. We saw a video when HH was going to Kasama; he was blocked in Mpika by PF cadres and police did nothing [to protect him],” Kalala noted.

He cautioned that if the police were not careful, “they are going to put this country on fire, if they continue to take orders from Kampyongo.”

“You see, the First World War was started by an isolated incident and it engulfed the whole world. This can happen to Zambia; just one small incident can put this country on fire,” Kalala explained.

“The police should stop harassing an innocent person. We have had PF cadres attacking the [Lusaka] Central Police [Station]. What have the police done to PF cadres? Nothing! How can such a thing happen in a country of laws? Yet an innocent person is always summoned by the police! Are these PF police or they are Zambia Police?”

He emphasised that Hichilema should not travel to Chinsali.

“He shouldn’t! Otherwise he will be giving credence to this collusion of the police and PF cadres. He was being blocked throughout his way and today he should be told to go to police! How? Summoning him to go to Mpika because Kampyongo has directed police to do that!” Kalala exclaimed. “HH is a Zambian citizen who has the right to move freely to go anywhere he wants to go. He is a political leader and he has a constitutional right to mobilise for his political party.”

He added that the PF, in collaboration with the police, had no right to stop Hichilema from exercising his right of movement.

“The police are not above the Constitution [and] PF is not above the Constitution. Not even Lungu and Kampyongo are above the Constitution. No one is above the Constitution,” Kalala said.

“HH is not a prisoner! He is a taxpayer…The salary that Kampyongo and Lungu get, HH is a contributor as a citizen. So, he is their employer and let this sink in their brain. They should not harass him.”

Meanwhile, Kalala has tipped UPND cadres ‘to block’ Hichilema from travelling to Muchinga Province.

“He is being summoned by PF! UPND cadres should block HH…They should not allow him to travel to Mpika. We don’t want him intimidated. We don’t want any politician to be intimidated in this country,” noted Kalala.

PF will feel impact of policies, laws they’re promulgating – Mulusa

EVERYBODY in government today, and God bless them, will one day be out, says MDC secretary general Lucky Mulusa.

He reminded those in the government to always remember the mortification that late president Frederick Chiluba suffered when he left office.

Mulusa was an outspoken Solwezi Central MMD member of parliament from September 2011 to December 2013, when his seat was nullified.

He once served as national development planning minister under President Edgar Lungu.

Mulusa was also President Lungu’s special advisor for projects, implementation and monitoring.

At a media briefing in Lusaka last Friday, Mulusa was asked to comment on the shrinking political space in Zambia.

He said the Movement for Democratic Change (MDC) has already been subjected to the “antiquated” public order Act because it took 12 months just for the opposition party to be issued with a certificate of registration by the Registrar of Societies.

Mulusa regretted that the application of the public order Act was such that it restricted other players, “but allows the ruling party to do as they like.”

“Unfortunately, all these inconveniences are being created for us in the opposition by those that are ruling. What they don’t know is that there’s limitation of staying in government. There is tenure!” he said. “Everybody in government today, and God bless them, will one day be out there. They will be on the streets and they will feel the impact of the policies, procedures and the laws that are being promulgated today.”

He added that history had a tendency of repeating itself.

“You’ll recall what happened to president Chiluba, may his soul rest in peace. Whatever wrong things he could have done in government…When he left government, president Chiluba found himself in a prison without walls,” Mulusa explained. “He could not freely move around. Wherever he went, he was insulted, heckled, shouted at. He would try to lower the [vehicle’s] window, people would realise it’s him [and] they would insult him. He ended up staying [at] home and sadly, he left us. History repeats itself!”

He cautioned those in the government today to: “know that the conditions they are creating in this nation are the conditions they will find when they leave government.”

Mulusa also warned that the “shenanigans” going on at the Electoral Commission of Zambia (ECZ) were not helping the development of the country’s democracy.

“It will result into election of extremely bad leaders, who cannot take this country forward,” he noted.

Meanwhile, Mulusa listed some values which set the MDC apart.

They include transparency, accountability and zero-tolerance to corruption, limiting of presidential powers, uniting the nation, wealth creation and ownership, law and order, among others.

THEY PROMISED MORE MONEY IN PEOPLE’S POCKETS…but look where they have ended up, Magande sounds distress over PF governance

Former finance minister Ng’andu Magande says it’s distressing to see where the PF has ended up when they promised more money in people’s pockets.

And Magande says it is welcome that the Chinese have deferred Zambia’s debt repayments for three years, but would be interested to know what Zambia is offering in return and what the government will do with the money that was meant for debt servicing.

Speaking with Daily Revelation, Magande said he would be interested to see what President Edgar Lungu would accomplish in this his full term going up to 2021, hoping he could bring up something that would change the country’s trajectory at the 11th hour.

Magande said the PF government had proved that party manifestos meant very little in terms of how the ruling party was governing the country.

“They (manifestos) can be beautiful, more money in your pockets, but you can see where they (PF) have ended up,” he said.

Magande said it was welcome that the Chinese had allowed deferment on Zambia’s debt repayment, but very little was known on the terms of that decision.

“If indeed it happened that is good news. The only thing is we don’t know who negotiated for us. It seems the Chinese just decided on their own. I think it’s just about transparency about our dealings with the Chinese,” said Magande, adding that he would be interested to know what sort of impact the deferment will have on Zambia. “And what impact it will have on any of our plans that if we get this money then we are going to do this and this. It’s good if they have allowed us to defer. I would like to know if the minister will give a ministerial statement.”

Magande said the money that was due for China should be channeled towards productive ventures, like in the agriculture sector, where with the onset of rains, government could procure equipment to increase production.

He said investment into the production, would in turn create demand, which was needed during these dire economic stresses the country was going through.

Magande hoped the money would not be channeled into election related ventures, saying during his time as finance minister under the late Levy Mwanawasa, the country did not experience over expenditure, saying even the budget deficit went down during the period of the elections.

Zambia has been granted a Debt Service Suspension Initiative (DSSI) by the Chinese government and all concessional facilities as provided by the G20 guidelines.
Zambia has also been given a one-year grace period and suspension of three years of repayment.

China has suspended and maximum debt service repayment for 2020 and rescheduled it amounting to $225 million which was due between May to December 2020.

Debt suspension for 2021 and 2022 amounting to $426.3 million and $428 have been suspended and rescheduled. -Daily Revelation

Ruling PF officials have contradicted themselves over the conviction of Chishimba Kambwili, with Sunday Chanda saying they had no comment to make as he was their brother, but Paul Moonga suggested that Kambwili would have gotten a lighter sentence if he humbled himself before magistrate David Simusamba.

And Lusaka provincial chairperson Moonga said the imprisonment of NDC leader Kambwili should teach public officials to always do the right thing whenever they hold office.

Speaking with Daily Revelation on the conviction and 12-month imprisonment of Kambwili by Simusamba over the forgery case he was facing, PF media director Chanda said the ruling party had no comment to make over the matter as Kambwili was “our brother.”

“No comment. We are not commenting on it. He’s our brother so we are not commenting. The comment is that we are not commenting he’s our brother,” said Chanda.

But Moonga said the conviction should send a message to those holding power to be very careful as a people.

“When we get power power should not go to the head. We should always humble ourselves and whatever we do as people we must be honest because there is nobody above the law. It doesn’t matter which position you had in society,” Moonga said. “Anybody is prone to go to prison and even when you are guilty, you are found guilty, it’s not good for us as people to start fighting with the judiciary, that’s a different place. The judiciary is not a good place you can’t mess up with judges.”

On arguments that the conviction fits into President Edgar Lungu and PF’s grand scheme to eliminate opposition using state institutions, Moonga said the PF did not forge on Kambwili’s behalf.

“Did Patriotic Front forge on his behalf? Forgery is forgery…so my brother Mr Kambwili if I was him was to simply say I’m sorry, what I was doing was this and this and ABCD than want to accuse the magistrate of being what and so forth, this magistrate will be unfair to me. You must look at the reality that here I was wrong,” Moonga said. “Yes I changed these documents on behalf of ABCD. I am very sorry. Even when passing judgement the judges they will look at how remorseful you are. Our judiciary men are very good and honest. We need to be remorseful as people before the bench. Now the moment you want to show off that you are ABCD it becomes disaster to your side.”

Moonga suggested that the judiciary was very good and if one showed remorse they could be sentenced according to how they presented themselves.

He said he had seen even traffic police officers give a pass to traffic offenders who spoke to them respectfully, but they did not take nonsense from those who wanted to show off.

“You ask somebody do you know who I am azakufaka muma cells. So if you humble yourself you find in your judgment even the people who are judging you (they will say) ‘this man has been very cooperative, yes he did this. They might even give you suspended sentence depending on how you have been presenting yourself,” Moonga said. “Now if you want to become a champion in court as if you are in parliament that’s not parliament. That is court. In parliament even parliament as well there are rules you can be removed from parliament.”

Moonga said the conviction should be a lesson starting from himself and those in public office that they were not immune from prosecution.

“All of us any time we should check our steps and do right things at the right time. But if you make a mistake you must be able to say here I erred. So I am very sad for my young brother Chishimba Kambwili that he now finds himself in the jukes. All I hope and pray is that he will remain healthy and strong and that also it becomes a turning point,” Moonga said. “The prison can reform people so I hope when you go in prison you come out a reformed person. That’s another issue.”

Asked if Kambwili’s imprisonment meant one opponent sorted out, Moonga dismissed Kambwili as a serious opponent to the ruling party.

“Chishimba Kambwili has never been an opponent to PF, he has never been an opponent he’s just a noise maker. How can you call Chishimba Kambwili an opponent? And it’s sad we are not celebrating. I feel so sorry for his family, his wife and children that their bread winner is

Mr Mpundu said that it’s not fair that all the Bemba prominent figures who dare to aspire for leadership are eliminated on political grounds that Dr CK must come out in good health if not Edgar Chagwa Lungu will have to answer to the Bembas.

Mr Mpundu said the coming out of CK to work with the UPND leader Mr Hakahinde Hichilema to work together and better the lives of the people has made Edgar Chagwa Lungu so afraid hence the gimmicks to block, jail, and eliminate his political opponents, he went on to say that Kalaba is also on target just because he is aspiring.

Mr Bernard Mpundu was speaking this in Nsumbu ward yesterday in Chilubi island of Northern province at a rally in drumming up support to the UPND candidate Mr Risto Mushembe saying that the Bembas will rise if anything happens to Dr Chishimba Kambwili.

“Dating back to Simon Mwansakapwepwe, Micheal Chilufya Sata and now Dr Chishimba Kambwili enough of our people being subjected to torture of this manner. When Edgar Lungu comes to Chilubi ask him what crime Chishimba Kambwili has committed to be sentenced to prison that he (Edgar Lungu) has not, Chishimba Kambwili is your son of this Bembaland being a political rival does not mean one has to be eliminated from the race, Edgar Lungu does not want any Bembas to be a leader in this country, he has vowed to keep rulling even if he has no capacity to rule this country, this place Nsumbu ward a child has never seen a car in his or her life, others don’t even know how a hospital or school looks like, Edgar Lungu comes here flying with a chopper instead of making a bridge for this place to connect Chilubi island, Santa Maria and this place but he managed to commission a multi million bridge in Western province because you people here do not matter even if they bring nothing during any election like this it’s better to bring K20 and make you in the queue you will still vote for them” Mpundu charged.

He said Mucheleka Patrick, Elias Mubanga, Samuel Ngwira and Kalusha Bwalya of Kasama and so many more where jailed and are still suffering to go on and on in courts over frivolous charges.

“Right now the UPND President Mr Hakahinde Hichilema has been summoned in Chinsali simply because he cared about your own to go and visit them in prison in Kasama it’s now HH to go and get arrested in Muchinga province” said Mr Mpundu.

And UPND candidate Mr Risto Mushembe said that he will be a thorn on PFs throat once he wins so that they will have no choice but to deliver development to Chilubi instead of taking advantage of the people just corrupting them during the elections, Mr Mushembe said that failure to have sensible representation Chilubi will remain in abject poverty because until UPND representatives gets there there will be no one to speak for Chilubi.

And Chilubi island Campaign manager Mr Edward Roy Makayi told the gathering that he saw PF giving huge money in queues such as K300 and above to every person they find yet still lost but why do they have to be giving you a K20 and that’s it to be a determining factor for elections that they care. Makayi said voting for Risto Mushembe will mean adding a voice in the PF government for the people of Chilubi otherwise they will keep on doing the samething of not considering Chilubi because all that matters is the K20 by Dr Chitalu Chilufya.

“The minister has no shame Chilubi needs quality medical facilities, good clinics and hospitals with well motivated staffs both nurses and doctors, right now how many people can access Chilubi island clinic for medical attention from here Mwanakasabi which took us with a speed boat 4 hours at a high cost in booking the boat?, why can’t Dr Chitalu Chilufya tell the government to construct a clinic or hospital here instead of dishing out K20’s for a by-election ” Makayi wondered.

He urged the people of chilubi island to teach PF a lesson get the K20’s because it’s there’s Dr Chitalu Chilufya stole and went to corrupt electorates but on 22 of October they should turn up in numbers and vote for UPND candidate Mr Risto Mushembe when that is done and next year no matter what PF brings they should all vote for UPND candidates beginning with councillors, Risto Mushembe again as a mayor and Hakahinde Hichilema as the Republican president then the much and long awaited dream bridge will be construed by the UPND government. STOP TREATING HH AS A CRIMINAL; CRIMINALS AND CROOKS ARE IN PF

When criminals in PF openly declared that Muchinga Province is a no go area for HH and later attacked a radio station, the PF leadership and the Police saw nothing wrong. The attack on HH and his entourage was meant to fulfill these criminal intentions. We thank God that HH and his entourage are all alive; remember it was in Muchinga Province where PF criminals almost brought down the helicopter carrying HH. How come you are now pursuing HH leaving out those who have been calling for his blood? Surely, PF must deal with its criminals first. We are very disappointed by this selective application of the law. First arrest all PF criminals who killed innocent people like the late Lawrence Banda (MHSRIP).

The fear of losing the 2021 general elections and its aftermath is making PF spend sleepless nights. Look at the thunderous welcome HH received in Luapula and Northern Provinces. You are very much aware that the campaigns you are carrying out are just de campaigning you. The only option left to you is to arrest HH on any flimsy grounds. But these are deadly mistakes that all dictators make; the end result is that such dictators are kicked out unceremoniously.

You have realized that you can no longer cheat people with your hate speech and tribalism; instead you are now going round the Country bribing people with all sorts of things, including village chickens. Surely this kind of desperation is driving you crazy. Worse still people are just receiving your bribes. If such schemes were paying off, there should have been nothing to worry about HH and the UPND. But you know as much as we do that Zambians have made up their minds and are just waiting to teach you a lesson of your life time.

It’s very easy to distinguish a thief from an honest person. A thief is ever jittery and has fear for the unknown. Zambia today is under siege from criminals who want to cling to power at all costs. This time you will not have it easy to arrest HH. We are sick and tired of being threatened every day. Threats are synonymous with bad and dictatorial leadership.

The recent developments in the country’s political spectrum; jailing of NDC leader, Chishimba Kambwili, and the summoning of UPND president Hakainde Hichilema by police, have stirred more questions than answers for some.

Meanwhile, chief among them being ‘can a cockroach ever gets a fair trial in a court of guinea fowls?’ Others would put it this way.

While the government has categorically declared that the events are motivated by the need to let justice take its course and public interest.

Others have still questioned; ‘Can a hyena be trusted with the interests of goats?’

For some whether it is a case of prosecution or persecution is the debate for another day.

Apparently, the UPND says the summoning of their leader, Hichilema, by police to Mpika for questioning is a welcome development, as it would give him the chance to clear his name.

However, the party says this time around, HH will not be going alone, as a thousand cars from all over the country will join him, and as they drive along, more and more cars and buses will follow them.

“We have had enough of this nonsense and abuse of one man by Edgar Lungu, and the one sided law enforcement by Zambia Police of only one section of the population, while leaving the PF supporters and cadres enjoy unfettered protection of being above the law.

“IG Kanganja must therefore arrest the thugs that closed HH’s route with rocks and tyres and further, discipline the Police officers that abetted such a criminal act in a public road and in full public view,” says the party, adding that the pictures are in the public domain.

“We call upon those that will not make it to Mpika to hold peaceful protests in their Townships and villages and all Provincial capitals and districts.

“We further call upon our brothers and sisters in the diaspora to hold peaceful protests at Zambian foreign missions and send a clear signal to the International community that if they don’t intervene timely, the once peaceful nation of Zambia is headed for troubled waters,” added the party.

In a statement issued by the party’s youth wing, UPND said the police call out of HH is not by the Police, but an order made by and under the instigation of President Edgar Lungu.

“How much more can one human being spew so much hate and bitterness against another human being like Lungu is doing to HH.

“What sin has Hakainde Hichilema committed to be persistently abused, persecuted and humiliated? Is the death of HH what will finally make Mr Lungu happy? Is it a sin to aspire for public office for HH in a so called democracy?

“We are aware that the PF want to detain HH to harm him so that he dies before the 2021 elections,” added the party.

UPND also alleges that Lungu has made statements against their leader which should not be taken lightly.

“Mr Lungu himself has maintained that HH will not enter State House. Isn’t that a declaration of a death sentence? We won’t allow that!

“We will also not allow this injustice to continue because Zambia doesn’t only belong to the PF and their supporters.

“We therefore warn them to desist from always making people angry in the midst of such poverty and hunger.

“People are suffering because everything under the PF has collapsed, and instead of fixing the mess they are subjecting our citizens to, they are always seeking for ways to make us angry. What sort of people are these?” the party added.

“We will meet in Mpika and please Kampyongo and Kanganja, don’t forget to bring along your newly acquired huge armoured vehicles and big guns, let’s hope they will be enough to go round in all Townships villages and Districts in the Republic. Creditors to vote on Zambia’s debt request

The holders of Zambia’s $3 billion of Eurobonds will vote next week on the country’s request for a six-month interest-payment delay.

While, a core group of creditors have already rejected the proposal, prompting Zambia to say it won’t be able to service its commercial debts including the bonds unless it gets the relief, the country is now pinning hopes on the pending polls.

According to Bwalya Ng’andu, Zambia’s finance minister, the government failed to make a $42.5 million interest payment yesterday, though it has a 30-day grace period before it becomes a default event allowing bondholders to demand immediate repayment of the principal.

Meanwhile, President Edgar Lungu has expressed worry over the country’s debt position, saying it is giving him sleepless nights.

Lungu said it is a very tight situation for the country, though expressed hope that a solution would be found.

Zambia’s trick situation was also highlighted by some economic analysts world over.

“Zambia is between a rock and a hard place with the IMF demanding transparency on Chinese loans and the political economy going into the elections,” said Ron Raychaudhuri, an emerging-market fund manager at APG Asset Management in Amsterdam.

“Some Chinese lenders also seem to be reluctant to allow a moratorium until arrears are dealt with.”

The Group of 20 agreed Wednesday to renew a debt-relief initiative for the poorest countries through the first half of 2021.

The group said in a statement it was “disappointed by the absence of progress of private creditors’ participation” in its Debt Service Suspension Initiative.

Eurobond holders want Zambia to sign up for an economic program with the International Monetary Fund before tackling its commercial debt.
But the country’s debt levels are significantly above the Washington-based lender’s thresholds, and a general election in 10 months makes deep spending cuts less likely.
There are also questions about transparency around borrowing from China, which accounts for as much as a third of the nation’s $12 billion of external debt.

Zambia already gained some relief from the Paris Club group of bilateral lenders, and said it wants all commercial and bilateral creditors, including bondholders, to commit to similar measures.

Skipping the Eurobond interest payment was part of that process and done at the urging of Zambia’s debt advisers, including Lazard Freres and White & Case, Ng’andu told lawmakers Thursday.

“They were of the strong view and opinion that if we pay we were going to create a very hostile environment within which to negotiate with other creditors, because we would have departed from the principal of pari passu,” Ng’andu said.

“Based on that, we didn’t make the payment that was due yesterday. Not because we didn’t have the money to pay, but because the issue of treating all the creditors equitably is a very important part of the process that we are going through.”

Zambia’s Eurobonds slumped for a third day on Thursday, and are trading at less than half their face value.

Notes due 2024 fell 5.5% to 41.7 cents on the dollar by 3:07 p.m. in London, the lowest on a closing basis since May.

The securities have lost 14% of their face value since Monday.

While the pandemic has contributed to Zambia’s debt woes, the IMF warned more than two years ago that the nation was already at high risk of debt distress after a borrowing binge.

Still, a rebound this year in copper prices which Zambia relies on for about 70% of export earnings means that the government could probably stay current on Eurobond coupons if it chose to.

The government should focus on extending maturities of the notes, according to Richard Briggs, a fund manager at GAM Holding AG in London, which holds Zambian bonds.

“I think at these levels, Zambia is worth holding as recovery values, even if the negotiations might last beyond the elections, should in the case of Zambia be generous versus current trading levels,” he said.

THE Law Association of Zambia says no eligible voter should be disenfranchised on account of processes involved.

And LAZ has proposed that political parties that foment violence be banned from participating in elections.

There has been a growing public outcry on the Electoral Commission of Zambia’s decision to introduce online voter pre-registration as well as completely discarding the old Voters’ Register.

In a statement, LAZ said it felt that everyone should be accommodated.

“LAZ reiterates the need for ECZ to ensure that no eligible voter is disenfranchised from voting on account of processes, and that everyone must be carried along, including prisoners, subject to the guidance offered to ECZ by LAZ,” the statement signed by honourary secretary Sokwani Chilembo reads in part.

It called on ECZ to ensure that the will of the people prevailed in the electoral process.

“LAZ also calls upon the ECZ to ensure that free and fair elections are delivered, and that the will of the people should always prevail, as enshrined in the Constitution of the Republic of Zambia, and all enabling subsidiary legislation. In order to achieve this, the process leading up to voting is sacrosanct, as any form of electoral violence makes the process flawed,” LAZ said.

And LAZ has expressed concern at the continued countrywide electoral violence.

The association has since condemned the act, describing it as an assault on human rights and freedoms.

“Going forward, LAZ is of the view that the ECZ has sufficient powers to punish offenders, and must accordingly act when faced with electoral violence, regardless of the political party involved,” said LAZ. “We wish to echo what the Constitutional Court said to the ECZ in the aforementioned case, which was followed by a directive to hand over a copy of the judgment to the ECZ by the Court, as follows: …’We therefore, strongly urge the Electoral Commission of Zambia (ECZ) to take necessary steps to curb the worrying culture of electoral violence in the country. We take judicial notice that the ECZ has wide powers under the law to punish perpetrators of electoral violence which include but not limited to disqualification of a political party in breach of the electoral code of conduct from taking part in an election. It’s time that such powers are invoked so as to preserve life, property, democratic values and principles…’’’

LAZ also committed to use, to the full extent, all legal tools at its disposal against perpetrators of political violence.

Chingola District Commissioner Agness Tonga accompanied by several police officers this morning stormed a live Church service at Life Gospel Cathedral, that was being presided by Bishop Joseph Kazhila. The shocked congregation watched as the equally startled Bishop led the high powered delegation to his office.

Earlier in the service that was broadcast live on Radio and TV, Bishop Kazhila had vehemently opposed the tradition of the national day of prayer that compels people to pray and fast on the 18th of October every year. In his sermon Bishop Kazhila argued that government had no moral obligation to force anyone when to pray or not to pray.

“The Bishop said prayer was a personal matter and that it was not correct for a government that thrived on injustice, corruption and violence to force people to pray and then after prayers return to their evil ways. The Bishop insisted that prayer should be an every day matter and not on any one day and that those involved in undesirable vices must not be the ones to force people to pray” , said the source.

The message appeared to have angered the District Commissioner who scrambled a team of Police officers to the Church.

“In the Bishop’s office, the District Commissioner ordered the Bishop to preach the power point message that had been authorised by the government under the Ministry of Religious affairs. Upon his return to the auditorium, the Bishop walked to the pulpit and announced that he would rather fear God than man and that as a matter of fact politicians ought to fear him than him fearing politicians”, said the impeccable source.

The District Commissioner’s entourage left the Cathedral after the service. Early last year Bishop Kazhila was arrested by police after accusing them of being behind the gassing and ritual killing in the small Copperbelt mining town of Chingola. He was charged for alarming the public but was however acquitted of the charge by the courts.

It is yet to be seen if the Police will charge Bishop Joseph Kazhila for preaching a contrary message to that of government on the national day of prayer and fasting. -Zambia Eagle

Simataa who has boycotted and rubbished today’s National Prayer Day as a circus, a day for political pharisees and religious hypocrites, was speaking in reference to Police Inspector General Kakoma Kanganja whom he says has shot himself in the foot by summoning UPND party President Hakainde Hichilema and his Sesheke MP Romeo Kangombe to appear before PF cadres in Mpika this Tuesday.

Kanganja has given the UPND and it’s sympathizers an opportunity to have the greatest and longest political roadshow the world has ever seen as thousands of Zambians escort their next President Hakainde Hichilema from Lusaka to Mpika and back, and we’ll maximize on this opportunity.

“Every Zambian knows that from a professional point of view, Kanganja is a failed policeman, he’s a letdown and a disgrace to the ZP uniform. But his failures go beyond failed policing duties. Kanganja is also a failed cadre, he is failing his political appointing authority President Lungu, he’s making HH more popular, and Lungu extremely unpopular, and his actions are proving to be very politically beneficial for the UPND…it’s as if he’s secretly working with UPND to dismantle the PF government by making it extremely unpopular.”

“If he’s doing it consciously, then the man is a far better genius of politics than policing, and I wish to thank him for giving us a free-pass to Mpika” says Simataa, adding that if UPND had used normal channels to request for a police permit to hold a road show from Lusaka to Mpika in the Northern regions perceived to be a no-go-area and PF bedroom, the same Kanganja would have never allowed it for fear of being fired.

“As I’m speaking to you, we have over 10,000 Zambian drivers who’ve volunteered their cars, buses and trucks with full tanks and food supplies to escort HH all the way to Mpika and back, and the beauty of it all is that Kanganja called for this rally, and there’s no law and no way to stop anybody from driving to Mpika because if Kanganja stops and asks ‘where are you going?’ just tell him you’re going to order Nakonde rice and fish in the North.

Simataa says the roadshow will be streamed live on Facebook because it promises to be very colourful and spectacular. “I wish to encourage all Zambians to line up the route from Lusaka to Mpika because the police will also come out in numbers never seen before, to showcase the newly acquired military anti-riot vehicles, tanks, water cannons and body armour – it will be like watching a movie, like a repeat of Sarafina in a reality show”.

Simataa has since appealed to the IG Kanganja not to cancel HH’s summon because a lot of well-wishers have pumped in a lot of money, food, fuel and vehicles to ensure the roadshow is a success.

This PF government is responsible for the deaths of our fellow citizens.
Mapenzi Chibulo, Grazier Matapa, Frank Mugala, Lawrence Banda are dead because of this evil government that launders itself on a day like this one, under a misguided belief that when our people see the calling for prayers, they are good people. But these are real wolves in sheep’s clothing. After prayer they start beating, assaulting, stealing and all sorts of detestable things

This is regime that has presided over unprecedented corruption the country has ever witnessed and has led us to an economic meltdown.

This is a government that had our President Hakainde Hichilema incarcerated at Mukobeko Maximum Prison over a trumped up charge. This is a government that kept Patrick Mucheleka, Elias Mubanga, Samuel Ngwira and two others at Milima Prison just so they can instill fear in citizens with divergent views. This is a government that has just issued police call- outs to Hakainde Hichilema so that they imprison him again.

In Matthew 5:23-24, the Bible says “so if you are offering your gift at the altar and there remember that your brother has something against you, leave your gift there before the altar and go. First be reconciled to your brother, and then come and offer your gift.

We challenge President Edgar Lungu to confess and apologise to these people if he means well with his Day of National Prayer for the Bible, in the Book of Proverbs 28:13, says “Whoever conceals his transgressions will not prosper, but he who confesses and forsakes them will obtain mercy.” But this group in government has not shown us any signs of being repentent at all; they have continued with their evil acts of brutality and inflicting terror daily.

The PF Government is using this day to keep Zambians sleeping so that they continue stealing public resources. What else can we say when year-in, year-out, innocent citizens are being attacked for merely exercising their freedom of assembly and movement, opposition political party members are sent to prison for being good campaigners, and many other bad vices are the order of the day. All these things are being done to instil fear in the citizens.

This government has been asking citizens to pray so that when they close their eyes, they have an opportunity to steal and continue with plunder.

Today, I am asking you my fellow citizens “please as you pray with these thieves who are not ashamed of themselves, leave one eye open”.

In the Book of Proverbs 6:16-19, the Bible tells us “There are six things that the Lord hates, seven that are an abomination to him: haughty eyes, a lying tongue, and hands that shed innocent blood, a heart that devises wicked plans, feet that make haste to run to evil, a false witness who breathes out lies, and one who sows discord among brothers.

Fellow citizens, be wary when these shameless thieves come to you with hand-outs and ask to pray.

I ask you to “Keep Cool and Your Eyes Open” as you pray with them and vote like your whole world depended on Bally in 2021. Bally will definitely fix it!

Down with visionless leaders. They are NOW hoping China will takeover ZESCO, ZNBC, KKIA and the MINES because of debt defaulting.

As UPND, we believe in not mocking our God. Yes, it is only prudent that we embrace God through prayers, fasting and meditation on God’s word. Therefore, let’s continue praying and taking God seriously in our every day lives.

As a responsible party, we are looking forward to a day when all citizens will have the basic needs, which include food before calling them for a day of prayer and fasting.

Places of worship should also be built to avoid gatherings in schools and other places not designated for prayers. This can only be possible if the government of the day facilitates some form of resources.

When UPND comes into power in 2021, our government will ensure to work together with the three church mother bodies to establish a financial institution like a Christian Bank.

Our objective is to help churches access loans, among other products at affordable rates as they are not profit-making entities and should be treated as such. The proposed bank will be based on the principles of Christianity. It’s an idea we are promoting and shall take priority just like any other sphere of our economy that needs urgent attention like job creation for our youths.

LOBENGULA’S GRAVE IS NOT IN MATABELELAND. ITS IN NGONILAND!
There has been a long standing FIB that King Lobengula of the Ndebele empire died and was buried in Matabeleland. This distortion of truth conjured and fronted by the Muzungu (white man) has been there for a long time and told BLATANTLY to the world.

Am not a Ndebele historian, thus in my own opinion, the truth should have been revealed by a someone of Ndebele roots. But since, it seems Ngonis (my tribe) have a traditional relationship with the Ndebeles, I have felt compelled to expose to the readers the TRUE accounts of King Lobengula’s fate.

You see, after the battle of Shangani in October 1893, which led to overwhelming losses for the Ndebeles, Lobengula escaped from Ndebele territory fearing arrest if not possible execution by the British forces. But where did the Ndebele King escape to and what happened to him afterwards?

Ngoniland! Yes, this is the kingdom which Lobengula deemed safe to escape to. Mpezeni and Lobengula had a terrific relationship, the latter even named his son and heir after Mpezeni. The boy (Mpezeni Khumalo) was born in 1880 in Bulawayo but died whilst still a teenager at Somerset Hospital on 9 December 1899 of pleurisy. Now back to Lobengula, it was a long journey for the then 60 plus year old Ndebele leader.

He started the journey in late 1893 but only arrived in Mpezeni’s Ngoni area in early 1894. His Ndebele contingent included a colored man (am still researching on this Ndebele coloured man, but it seems he was son of a British man and a Ndebele woman of majestic legacy).

Now, when Lobengula and his party arrived in NgoniLand, he discovered that his cousin, King Mpezeni had shifted his capital from Mtengeluni to the Luangeni area. Lobengula could have set up his base anywhere in this part of the country but he strategically chose the principal military area of Luangeni.
Lobengula knew that there was no place in Mpezeni’s NgoniLand which was as guarded as the capital where Mpezeni was. Lobengula knew very well that the area had tens of thousands of the finest ngoni warriors.

He thus set up a village close to his cousin’s royal town as the royal residence offered protection and safety to the Ndebele king and his entourage. This Ndebele settlement is still recognizable today and its is referred to as Mashanga, a corruption of Mahlanga; the people however can no longer converse in Ndebele but speak the language of the natives.

Lobengula did not live long in Luangeni area and died three years after; perhaps the long trek from the Zambezi River may have had an effect on the health of the king after all. However, what is critical is not the year of his death or what killed him but the fact that he did get there and lived there but soon died and his remains were interred in the land of the Ngoni.

The Ngoni knew the burial practices of the Ndebele. If they did not, the surviving members of the royal party would have advised them accordingly.Now according to the tradition regarding royal burials among the Ndebele (I must emphasize again that am not Ndebele and this may have changed over time), the soil must never touch the remains of a Ndebele king. As a result, the king was to be buried in a cave so that rock boulders would cover him. Indeed, if one visits Mpezeni’s NgoniLand and asks where Lobengula’s remains are, one would will notice something interesting.

Much of Mpezeni’s Ngoni Land or indeed Chipata as a whole is a craggy place. They are lot of hills and caves in the area where Lobengula is/was buried. But, in the beginning of the line of these hills, most of them could not have qualified to be Lobengula’s grave due to the traditional Ndebele burial customs that a King’s remains must not touch the soil. There, at the end, there is one rocky hill which is larger than the rest.

That’s it! This is the cave that housed the remains of Lobengula. As if to signify the prestige of the person that lay in this hill or even guard the tomb, some white birds known in the local language as ‘nkundas’ were always present at this hill; the others rarely had these types of birds.

When Ngoniland finally fell at the hands of the British, a white family got attracted to this hill due to these peculiar white birds; they wanted to domesticate the birds and also wanted to start mining on this same particular hill. This attention may have compelled the Ngonis and the surviving Ndebeles in the area to move the remains of Lobengula to a SECRET location, but within Mpezeni’s Ngoniland. Since his arrival in early 1894, Lobengula or indeed any of the people that he came with never LEFT Ngoniland alive neither did their remains.

Lt-Colonel Poole, the high-ranking British soldier who executed Prince Nsingo Jere, the heir of the Mpezeni empire, knew very well that Lobengula was hiding in Ngoniland but he seemed to never have bothered to alert the BSA officials in now present-day Bulawayo. Perhaps, his promotion as the Petauke District Commissioner may have distracted him.

Why Madagascans have long tongue-twisting names

In 2014 when newly elected president of Madagascar Hery Rajaonarimampianina made it into the record books as the head of state with the longest family name, it sparked renewed interest in why the island country has a history of long names. And not just names of people, but also names of places are quite long to the extent that they are difficult to pronounce.

Unless you speak Malagasy, you might struggle to remember the name above, after all, Madagascans themselves have trouble with such names. And if you thought Rajaonarimampianina was such an incredibly long name, what about Andrianampoinimerinatompokoindrindra?

To date, it remains the longest name that has ever existed in the island country in the Indian Ocean. Formed of 36 characters, the name belonged to the King of Imerina who reigned from 1787 to 1810. Otherwise known as Andrianampoinimerina the Wise, he is recognized as the father of the Madagascan people. Andrianampoinimerinatompokoindrindra means “the prince who was given birth by Imerina and who is my real lord.”

In fact, since time immemorial, particularly the 17th century, kings and princes from the Imerina Kingdom had long names. Andriantsimitoviaminandriandehibe, one of such names, meant “the noble without equal among great nobles,” while his brother was Andriantsimitoviaminandriandrazaka, meaning “the noble without equal among his brothers.”

In 1896 when French colonization began, names like these, which will not fit into a passport, were reduced. Yet, when you visit Madagascar today, you would still find tongue-twisting names, and even some of the shortest names have a minimum of 12 characters — Rakotonirina, Andrianjafy, and Rakotoarisoa.

So why the long names?

It is because each part has meaning and traditionally there used to be only one name. Historians say that traditionally, separate first names and family names do not exist for people in Madagascar. An individual is given a single name which is a mixture of both, and that name more often than not reflects their history. Usually, the more prestigious the individual, the longer their names as evident in Razafindrandriatsimaniry, a 24 letter name that means “the grandson of the prince or nobleman who is envious of no one.”

Now, with European influence, the idea of having separate names has been adopted by some of the Malagasy population even though there are still some long names especially among people originating from the central region.

What is more, most names in Madagascar are now a particular mix of foreign names (mainly Christian, French, or British but sometimes Muslim) and Malagasy names, according to a study by Denis Regnier, Naming and name changing in post colonial Madagascar. Building on a study by Gueunier (2012), Regnier writes that the spread of the Christian faith in the nineteenth century gave rise to people being given names from the Bible.

“These biblical names were often modified to follow the phonological and morphological rules of the Malagasy language (e.g., John becomes Jaonina or Jaona), and often the honorific particle Ra-, the word andriana (lord), or both were added to them (e.g., Rajaonina and Randrianarijaona),” he writes.

He adds that even though most Malagasy people traditionally still had only one name at the start of Christian evangelization, gradually the most common structure of names became “binomial.”

“In this case, a Christian name (or other foreign name) is often juxtaposed to a Malagasy name, although sometimes both names are of Malagasy origin or, more rarely, both names are foreign.”

The binomial structure of names is probably the most widespread today, according to Regnier. He, however, admits that there are still people who have only one name or others who have more than two names.

With informality being the order of the day to facilitate daily discussions and operations, giving nicknames to people is a common practice in Madagascar. Its long names of places such as Antsohimbondrona have also been shortened, including its capital Antananarivo, which is now simply referred to as Tana, the shorter version of its French version, ‘Tananarive’.

 

Diddy launches Black political party: “The number one priority is to get Trump out of office”

Sean “Diddy” Combs is launching his own political party.

With less than three weeks until the election, the rap mogul has created Our Black Party, whose mission is to “power the Black agenda and elect bold representatives” who represent their communities and address the needs of Black people.

“I’m launching one of the boldest things I’ve ever launched,” Diddy announced on Twitter. “I’m launching a Black political party with some young Black elected officials and activists. It’s called @OurBlackParty, it doesn’t matter if you are Republican or Democrat…

He said his first priority is to get Donald Trump out of the White House. “The NUMBER ONE priority is to get Trump out of office. HE HAS TO GO. We can’t allow this man to continue to try and DIVIDE US. The people that have the most responsibility and should be SCARED TO DEATH of this man are white people. WE ARE ON THE VERGE OF A RACE WAR.”

 

Diddy, who previously said he was holding the “Black vote hostage,” also shared his endorsement of Joe Biden. “We need to get Biden in and hold him accountable. Trump has taken things too far,” he tweeted. “As Black people, we aren’t even a topic of real discussion. We can no longer stand for doing the same thing over and over expecting different results. That’s insanity! It’s time we unify.”

He added, “Things have got too serious. It would be irresponsible of me to have us hold our vote hostage. But it would also be irresponsible of me to let this moment go by and not make sure going forward we are doing what it takes to own our politics.”

Speaking with Charlamagne Tha God, Diddy reiterated the dangers of Trump. “White men like Trump need to be banished. That way of thinking is real dangerous,” he said. “This man literally threatened the lives of us and our families about going to vote.”

If Trump is reelected, he fears grim consequences. “If Trump gets elected, I really do believe in my heart, there will be a race war,” he said. “This man is really trying to turn us against each other and put us in a situation. America messed up.”

Man Hangs Himself Few Hours Before Wedding

A sad story has emerged from the Mpohor district in the Western region of Ghana, where a young man who was set to get married was seen hanged in his room, few hours before he could exchange the vows with his wife to be.

The Young man whose name has only been given as Joe Red, resides in Benso, a community in the Mpohor Constituency and works with the Benso Oil Palm Plantation (BOPP).

His wife to be, whose name was also given as Sister Yaa, is also a trader in the same community but hails from Mpohor, the capital of the district.

The two have been staying together unofficially for some years and they are blessed with four children. The two agreed to make their marriage official on Saturday October 10 2020, at the family house of Sister Yaa.
Reports are that, family members had gathered on Saturday morning to give their blessing and support to the marriage. The bride had already finished dressing up for her special day waiting for her husband to arrive and put the ring on her finger.

“They waited for hours at the family home of the lady but the man was not showing up. Bothe his family members and that of the lady were all ready. They called his number severally but he was not answering his phone. He lives at Banso which is a little far from Mpohor where the lady stays.

The matter was getting scary for all the family members who had gathered there. A call was later placed to someone in the community to go and check if he was at home, only for the family to be told that, he has hanged himself”. A reporter of Takoradi based Skyy Power FM, Osomafo narrated to Mpimpimhene Nana Gyetuah.

The lifeless body of Joe Red was found in the room hanging on a rope tied to the ceiling. The reason for taking away his life has since remained a mystery to family members and other relatives. The wife, Sister Yaa, who could not stand the shock collapsed after hearing the news, and was sent to the hospital for treatment.

The young man according to reports hails from Mankessim in the Central Region, but has been living at Banso in Mpohor where he works. The reason behind his death is still unknown. He left behind a wife and four children.

KNOW MONGU TOWN

Mongu the capital city of Barotseland unlike other towns which benefitted from the colonial legacy, Mongu has largely been developed by local people.

POPULATION

 

Mongu has a population of 191,845, of which 55,635 are urban and 136,210 are rural (2010 census).
About 14.8 of the district’s urban road network is tarred, while the 16.2km Mongu-Limulunga road which is still under construction.
The contractor, Avic International, had already mobilised on site but has not started work because Government only released K6 million from the required K20 million down payment required to start the work.
Other roads earmarked for rehabilitation include the 1km Libonda Road and the 1.9km Lyambai Road.
The construction of the Mongu-Limulunga road will ease communication between the two districts, while trade and mobility will improve greatly.
Mongu boasts of a cathedral and a number of upcoming hotels, though still at lodge level.

HOTELS

Its hospitality sector boasts of one hotel (Ngulu), 12 lodges, four motels and 26 guest houses, including council-owned Sir Mwanawina III Motel located in the Winela area, west of Mongu town, off the Limulunga Road.

Mongu municipal council notes that the construction of hotels, lodges and guest houses is on the rise due to the rising demand for bed space in the district.
To facilitate the growth of the hospitality sector, Mongu is expected to host the Barotse Expo to showcase the investment potential of the Region in general and Mongu in particular.

HEALTH

Mongu has one general hospital-Lewanika General Hospital- offering first-level referral services while Mongu District Hospital is also in place.

 

EDUCATION

The district has 11 secondary schools and seven tertiary institutions, which include one private university, the Barotse University, while a public university, King Lewanika is not yet under construction. The Zambian Government has abandoned the project.

FINANCIAL INSTITUTIONS

 

Mongu has nine banks namely Zanaco, Barclays Bank, Indo-Zambia Bank, National Savings and Credit Bank (Natsave), Investrust, Standard Charterd Bank, Atlas Mara, and Zambia National Building Society (ZNBS).

SHOPPING MALL

The district has one shopping mall – the Barotse Mall -comprising the anchor store Shoprite and attendant shops such as Hungry Lion and 15 others.

PROPERTIES

Mongu has 3,000 properties with rateable value of K2.5 million.

WATER AND SANITATION

The district is serviced by 12 boreholes drilled along the plain edge north of Mongu hilltop while two boreholes are situated at Wenela water works.
Currently, there is a project under design funded by the African Development Bank (AfDB) to tap water from the Zambezi River in order to enhance water supply.

GROWTH POINT

The local authority, which has been squatting from the district administration for some time now, intends to build a civic centre in Kasima where land has been set aside for the project.
Mr Akayombokwa says the civic centre will be built from internally generated resources, 20 percent from the equalisation fund and well-wishers.
Mongu is strategically located in the centre of Barotse kingdom and has comparative advantage for trade and administrative purposes.
It has a growing market, especially from the growing middle class, with potential for production and marketing of fish.
Currently, Mongu has a growing number of value-addition industries such as APG Milling, Zambeef, Mongu Cashew Company, Mongu Joinery, Country Aqua, Country Milling Company, HMM Milling Limited, and Kasima Water Company.

“Overall, Mongu’s economy providing employment comprises the primary industries of agriculture, fishing, forestry and hunting (about 81 percent) followed by commercial activities in whosale, retail, restaurant and hotels (11.6 percent), followed by manufacturing (three percent) and the construction industry (2.1 percent).
Other economic activities in the district include transport and storage (1.5 percent), information and communication (0.2 percent) and mining/quarrying (0.1) percent.

Inside Look At The Commissioners At The Electoral Commission

INSIDE LOOK AT THE COMMISSIONERS AT THE ELECTORAL COMMISSION.

The Electoral commission 0f Zambia (Amendment) Act No. 5 of 2019 spells out the qualifications for one to be a member of the Commission which is an improvement to the principal Act No. 25 of 2016 which did not have specified qualifications for members of the Commission.

Under the amended Act, “a person is qualified for appointment as a member [of the Commission] if a) [that person] has a school certificate or its equivalent, b) holds a degree or its equivalent…, c) has knowledge and experience in ( i) election administration and management (ii) finance (iii) governance (iv) public Administration (v) law.

The five (5) commiszioners might have all the qualifications except (c) and (c)(i) which talks about “knowledge and experience in election administration and management”.

This is so, because, other than Commissioner Ali Simwinga, who could have gained this knowledge and experience in “election administration and management” by default as former Town Clerk for Kitwe, the position which gave him the position of District Electoral Officer, in addition to his law qualifications, the rest seem to be remotely from this requirement of possessing “experience and knowledge in election administration and management” and consequently the Electoral Process.

It could have been a job on training on electoral matters at entry point for almost all the Commissioners save for the above mebtioned and those who have been there at the Commission long enough, have gained this knowledge and experience in election management and administration.

Being a crucial year as elections are in less than 12 months, the appointing authority, in this case the president, should have ensured that the appointees had relevant experience and knowledge in election administration and management in addition to their academic and professional qualifications, to avoid spending time doing job on training and applying the “trial and error” methods

The two (2) newly ratified and appointed Commissioners may also be in the similar position of the “job on training”.

I read one of the appointees is a former military person while the other is a former civil servant in the Ministry of Home Affairs, perhaps both must have knowledge and experience in public Administration since military training is not part of the qualifications for them to fit in the requirements for one to be a member of the Commission.

It is important that parliament, when considering the scrutinisation of such presidential appointments, involve, at least, witnesses with knowledge and experience in election administration and management.

I doubt if the two new Commissioners have ever monitored or observed any election either locally or and international or and exposed to the Electoral Process to appreciate the administration and management of elections in Zambia or elsewhere in the world.

This will, in turn, compel ECZ to spend more money flying the two unexposed commissioners to expose them to the Electoral Process within and outside, electoral systems and electoral activities when they are supposed to invest such monies to enhance the Commission operations.

THERE is no time to sit quietly as traits of dictatorship continue to grow, says All Nations Church General Overseer Bishop Timothy Chisala.

Bishop Chisala said the conviction of NDC leader Chishimba Kambwili is out of vengeance to silence divergent views.

Reflecting on Kambwili’s imprisonment for one year by Lusaka Magistrates’ Court, Bishop Chisala said political persecution will continue to grow as the country nears 2021.

“There is a fear of losing power. This fear is imminent. So those on the other side should expect more of this. Today it is Chishimba Kambwili, who is next? There is a danger in trying to remain in power by any means,” he warns.

Bishop Chisala said political persecution under the current government is well planned.

“While you think, they are acting. We saw this where it started from. Trying to remain in power, those in authority will do anything,” he said. “It started with the closure of The Post, then came closure of Prime Television. Key voices for the people closed. Now it has come to individuals. So Kambwili is fixed! Who is next? It can be Fred M’membe, it can be Harry Kalaba, it can be Hakainde Hichilema, it can be Felix Mutati with his new party. Anything is possible. That is what the mission of political persecution does to remain in power.”

Bishop Chisala said this was the time the Church should stand firm and speak out on political injustices.

“Yes, people should be taken to court when they are in conflict with the law. But to take people to court just to fix them is the worst form of abuse and injustice,” he said.

Bishop Chisala said power is temporary and it always comes to an end.

“There is no perpetuity in leadership. It will surely come to an end one day. You can never be a leader forever, especially these elective positions. Surely, one day you will be out. Even in the Church, we are also removed as leaders at a point,” he said.

Bishop Chisala said it was wrong to pretend before God in prayer when minds are so evil.

“So what are we going to pray for on October 18? What should God do to us when our minds are so evil, simply because we want to remain in power! Treat your friends well, the same way you would want to be treated. Remember our days are numbered in everything we do,” said Bishop Chisala.

Antonio Mwanza sues Chella Tukuta for defamation

PATRIOTIC Front deputy media director Antonio Mwanza had sued photographer Chella Tukuta in the Lusaka High Court demanding K500,000 as damages for defamation for alleging that he has an affair with FDD leader Edith Nawakwi for his financial and political gain.

Mwanza is seeking an injunction to restrain the defendant whether by himself, his servants, agents or otherwise from further publishing or causing to be published further defamatory statements against him.

In his statement of claim, Mwanza said on August 27, 2020, Tukuta caused to be published defamatory words against him on his Facebook page entitled christened chella Tukuta photography defamatory.

Mwanza said Tukuta posted defamatory words saying “is it true that Edith Nawakwi goes out with Antonio Mwanza? Is it true she is his sugar mommy? Is it true that she sent him to PF to prepare her way to the running mate position? Let her answer these before attacking my Bally.”

Mwanza contended that in their natural and ordinary meaning, the words contained in the said publication meant and were understood to mean that he engages in immoral behaviour with a married woman for financial and political gain.

“The words contained in the publication were false, and published maliciously and were calculated to cause and did in fact cause pecuniary damage to the plaintiff’s character,” Mwanza said.

He said particulars of falsity were that Tukuta alleged that Nawakwi goes out with him (Mwanza), she is his sugar mommy and that Mwanza is Nawakwi’s political stooge in PF.

Mwanza said the statement made and published by Tukuta was libelous and to the detriment of his reputation and character.

He said particulars of malice were that he is engaged in an immoral relationship with a married woman for financial and political gain.

“The plaintiff will also aver that before the publication, the defendant did not at all approach the plaintiff before proceeding to recklessly publishing the statement defamatory of the plaintiff,” Mwanza said. “The plaintiff will also aver that his reputation has been lowered in the estimation of the right thinking members of the global society. As a result of the defendant’s action, he incurred costs and expenses in an effort to mitigate the effects of his reputation in the sum of K500,000.”

Mwanza said he asked Tukuta to retract the said words and render an unreserved apology to him but he has failed, neglected and or refused to do so.

He lamented that as a result of Tukuta’s defamatory words he has suffered damage, hatred, ridicule and embarrassment.

Mwanza is now claiming K500,000 from Tukuta as damages for libel.

He also wants an order directing Tukuta to retract the defamatory words, costs and any other relief the court considers fit.

What Does It Mean To Default?

Let’s start by understanding what it means for an individual or a company to default.

Let’s assume you want to buy a house and decide to borrow money from a bank. The bank issues you the required loan which needs to be repaid back periodically within 20 years. It is worth noting that the legal agreements, including terms and conditions of the loan will be dependent on your credit worthiness and how likely you are to pay the money back. For instance, the bank might require you to pay a portion of the loan along with the interest back to the bank on monthly basis.

Now, assume you pay the payments as per the agreement for first 6 months and then you miss out on the payments due to your bad economical situation.

What Happens Next?

The bank will start chasing you for the money

You might get a letter from the bank, followed up by phone calls leading to visits from the enforcement agencies and finally your property will be repossessed. Once the property is sold, you might also be required to declare bankruptcy. Subsequently, the next time you borrow loan, banks might charge you higher interest due to your poor credit quality.

On the other hand, if a company defaults on its loans then its stock value goes down along with its ratings. Additionally its assets (laptops, offices etc.) might be sold to pay off loan and it will be harder for the company to conduct new business in the future.

So far, everything makes sense. Now let’s move on to country defaulting

Understanding Sovereign Default

Countries (sovereigns) have a complicated economical structure. Their economy is exposed to a wide range of factors; from political risk (corruption index level, autocratic leadership), legal risks (how reliable their legal system is) to economic growth cycles (how dependent their growth on a service or export is and how productive their revenue system is).

Governments require money to pay existing debts and to perform pension and social service commitments. Country’s government has a treasury department which maintains its capital and ensures the country has enough money available.

Believe it or not, some investors prefer to invest in non-democratic countries because their policies are stable and predictable.

Governments can raise capital in various ways; such as from increasing revenue, taxing its people and services, issuing treasury bonds or to borrow money from foreign countries.

Money borrowed from foreign countries is in foreign currency

Let’s Move On To Treasury Bonds And Foreign Debt

Think of governments issuing treasury bonds as borrowing loans from public. Governments pay money back periodically to the bond holder. The money borrowed by issuing bonds is known as local country debt because the bonds are issued in local (domestic) currency. If the government is unstable then you can expect the government to pay higher interest on the treasury bonds.

When countries borrow money from foreign countries, it is known as foreign country debt. If the government has poor rating and is already in high debt then the foreign countries will charge higher interest rate on the borrowed loans.

When countries are unable to pay back on their loans to their creditors then they declare bankruptcy and are then considered defaulted. Most of the sovereign defaults are foreign currency defaults.

Next Steps — What Happens When A Country Defaults?

This section highlights the core of this article. In this section, I will outline the top ten potential consequences of a country defaulting:

  1. First and foremost, currency of the country can be devalued. This can make it expensive to import products. Additionally, export businesses might suffer due to selling products and services cheaper in short term. For exporters, currency devaluation is a double edge sword; when services and products get cheaper, it increases their demand. Exports become attractive and raises competition in market. As exports are cheaper for foreign countries, they tend to buy more from the defaulted country. Additionally domestic service providers might benefit due to foreign investments and tourism boosts due to foreigners visiting more frequently as it happened after pound devalued in 2016. Hence default has positive effects for the country too.
  2. Secondly, debt can be restructured such as by extending the loan payment date or by reducing the loan amount or by further devaluing the currency.
  3. Austerity measures might be followed which includes spending cuts and tax increase.
  4. Living standards of people can also be impacted. It might start with riots on the streets leading to banking crises. The core reason for banking crises can be that the people might attempt to take all of their money out of the banks due to uncertainty and confusion. The chances of banking crises might increase, as an instance by up to 10% and the government may close down its banks to avoid money withdraw. Occasionally, withdrawal is permitted but capital controls are imposed.
  5. Countries defaulting on foreign currency debt might also end up defaulting on local currency debt. This means that if you bought treasury bonds and the country defaults on foreign currency debt then you might not receive your bond periodic payments.
  6. Unlike business or individual bankruptcies, assets of a country are not repossessed. However occasionally military actions are followed when countries default. As an instance, Britain attempted to occupy Egypt when it defaulted in 1880s.
  7. Turmoil can be experienced in stock market. This can be due to uncertainty in market. No one might willing to buy anything. Many investors might even decide not to do business with the country until the situation is stable.
  8. Governments may refuse to pay any money or reduce the borrowed money as it happened in Argentina in 2001.
  9. The country can face loss of reputation, its rating might decline which makes it harder to borrow money in the future.
  10. GDP can slow down by up to 2% however it is usually for short term only (1–2 years). Cost to borrow money might even increase up to 1%. Due to higher export demands, current account deficit can decrease and this in turn ends up increasing economic growth. Again, there are some positive side effects.

Defaults can be avoided by restructuring debt agreements and to seek help from a guarantor (IMF)

Countries That Have Defaulted In The Past

It is probably worth mentioning that many countries have defaulted in the past.

Furthermore, it is not surprising for a country to default.

This is a list of famous sovereign defaults:

  • Venezuela: 2017
  • Greece: 2015
  • Ecuador: 2008
  • Argentina: 2001
  • Russia: 1998
  • Mexico: 1994
  • France: 1958
  • Egypt: 1880s
  • Spain: 15+ times by 1939

Why Can’t Countries Reprint More Local Currency?

Someone asked me this question recently. They were wondering why a country simply doesn’t print local currency to pay off local currency debt.

Here’s my take of it. Although there is more to it but this is one side of the coin:

Printing more money might lead to inflation. This is mainly as supply of money increases, costs of products can end up increasing due to their increase in demand. As a consequence, currency can also be devalued which can be often worse than defaulting. Additionally gold standard and the concept of shared currency prevents countries to print money as and when they want — although gold standards and shared currency is not applicable to all countries.

Currency devaluation can help exporters and makes it cheaper for foreign countries to buy its products and services. It then helps its economy to grow as current account deficit declines. The Truth About Zambia’s Debt

Zambian social media platforms, especially WhatsApp groups, were very active yesterday sharing and discussing the publication of the World Bank’s latest International Debt Statistics Handbook. I’ve lost count of the number of friends on WhatsApp who sent me the hyperlink to the download page of the book. Ordinarily, the publication of the Debt Statistics Handbook goes without notice in much of the world and especially in Zambia. So why all this interest this time around?

Well, in the last couple of weeks, “Zambia and its debt” has been a topical issue with prominent coverage in the Financial Times and Bloomberg among other international outlets. The latest round of interest comes on the heels of an official request from the Zambian government for a payment holiday on upcoming debt service obligations. So this week’s publication of the World Bank’s International Debt Statistics Handbook (hereafter IDSH) fell into this milieu of strong emotions around Zambia and its debt.
So why all the fuss? Well, all the commentary on WhatsApp, Twitter and Facebook on the the IDSH zeroed in one single statistic reported at the top of page 150: Zambia’s external debt at the end of 2019 was $27 billion dollars! This is certainly a huge number and would suggest that the country’s external debt was almost equal to the size of the country’s GDP. And for many of yesterday’s commentators, this number was evidence that the Zambian government was understating the true nature of its external debt. For example, Finance Minister Bwalya Ng’andu recently told parliament that external public debt was $11.97 billion dollars, a number that is about $15 billion lower than the World Bank’s number.

So what is going on here? The confusion stems from the conflation of Total External Public Debt with Total External Debt. The two aren’t the same thing even though they seem like they are.

Total External Public Debt (the first one) refers to all foreign denominated debts that are owed by the Zambian government. This includes external debt directly owed by the government and debt guaranteed by the government but contracted by government or quasi-government entities. For example, Total External Public Debt would include the (in)famous Eurobonds and/or any guarantees issued by the government in favour of, for example, the Zambia Electricity Supply Corporation (ZESCO).
Total External Debt, on the other hand, is the sum total of all the external debt owed by entities domiciled in Zambia. This includes debt owed by the Zambian government (as defined above) and that is owed by Zambia’s private sector. Total External Debt would include external debt owed by the government plus external debt owed to foreign creditors by, for example, the privately-run mining industry.

By definition, and given the above, Total External Public Debt can never exceed Total External Debt. The two can be equal which would imply that all external debt is government debt. In practice, Total External Public Debt tends to be lower than Total External Debt primarily because the private sector also borrows from foreign creditors.
So what does all this mean for the publication of the IDSH and the commentary that followed? Well, the first thing is that the World Bank and the Zambian government are saying the same thing. The fourth line item on page 150 of the IDSH says that Total External Public Debt at the end of 2019 was $11.1 billion [1]. Minister Ng’andu told Parliament on 25th September 2020 that “[total] external public debt stock increased to US$11.97 billion as at end-June 2020 from US$11.48 billion at the close of 2019…”. As one can see, these numbers are pretty much around the same ballpark.

The June 2020 number, as reported by the Minister, is slightly greater than the 2019 numbers (from the government itself and the World Bank) because of the likely accrual of additional external public debt in the first 6 months of 2020. The 2019 numbers by the World Bank and from the government are slightly different from each other because of likely accounting/reconciliation issues. Interestingly, government’s number for end 2019 is greater by about $300million. This might be the result of one public guarantee or the other that was not captured by World Bank statisticians.

So in many ways the World Bank’s IDSH is telling us nothing new beyond what the government has already told us regarding the country’s external public debt.
As to whether the $11 billion number (from both the World Bank and the government) is to be believed is a different question altogether. I have good reason to believe that the “true” external public debt is around this figure. Margaret Mwanakatwe, Ng’andu’s immediate predecessor at Finance, instituted a debt reconciliation drive about two years ago and committed the Ministry of Finance to issuing quarterly debt briefings (although the frequency of the briefings has reduced lately). This was in response to heavy domestic and foreign criticism that the Zambian government did not know the true extent of its debt obligations. It appears the Ministry of Finance has gotten on top of this issue and, for example, recent IMF statements on the country are no longer broaching the subject of debt reconciliation as they did a couple of years ago. Economist Trevor Simumba, however, believes the true extent of external public debt might be higher owing to the opacity around debt contraction from China. He might very well be right.

Before concluding, I want to briefly talk about one aspect that struck me from the IDSH that few talked about yesterday and that I had been unaware of. According to page 150 of the IDSH, Zambia’s private sector owes a whopping $14.7 billion to foreign creditors! In other words, private multinational corporations, private companies and private individuals all domiciled in Zambia collectively owe about 54% of Zambia’s Total External Debt (recall the definition of this from above). This implies that Zambia’s private sector is just as indebted to foreign creditors as the Zambian government is. In actual fact, the private sector owes much more.

As a country, we have not debated and thought about private sector debt as much as we should. It’s worth engaging with this issue because, for one thing, economic crises can result from the unsustainable buildup of external debt by the private sector (see the Asian Financial Crisis) just as much as they can from unsustainable buildup of public debt. Second, pressure on the domestic currency (the Kwacha) can also arise from the demand for foreign currency by the private sector to meet its external debt obligations just as it can from demand by the government. So in a nutshell, any talks about devising a strategy for Zambia’s external debt should include discussions about external debt held by the private sector.

WE ARE ORGANISING A THOUSAND CAR CONVOY TO MPIKA TO BACK HH

We wish to heartily welcome the invitation by the Zambia Police to summon President Hakainde Hichilema to Mpika for questioning and as usual, over a matter he has no hand on. This time around however, HH is not going alone, a thousand cars from all over the country will join him and as we drive along, more and more cars and buses will follow us.

We have had enough of this nonsense and abuse of one man by Edgar Lungu, and the one sided law enforcement by Zambia Police of only one section of the population, while leaving the PF supporters and cadres enjoy unfettered protection of being above the law. IG Kanganja must therefore arrest the thugs that closed HH’s route with rocks and tyres and further, discipline the Police officers that abetted such a criminal act in a public road and in full public view. The pictures are in the public domain.

We call upon those that will not make it to Mpika to hold peaceful protests in their Townships and villages and all Pronvicial capitals and districts. We further call upon our brothers and sisters in the diaspora to hold peaceful protests at Zambian foreign missions and send a clear signal to the International community that if they don’t intervene timely, the once peaceful nation of Zambia is headed for troubled waters.

The police call out of HH is not by the Police, but is under the instigation of Mr Edgar Lungu. How much more can one human being spew so much hate and bitterness against another human being like Lungu is doing to HH. What sin has Hakainde Hichilema committed to be persistently abused, persecuted and humiliated? Is the death of HH what will finally make Mr Lungu happy? Is it a sin to aspire for public office for HH in a so called democracy?

We are aware that the PF want to detain HH to harm him so that he dies before the 2021 elections. Mr Lungu himself has maintained that HH will not enter State House. Isn’t that a declaration of a death sentence? We won’t allow that!

We will also not allow this injustice to continue because Zambia doesn’t only belong to the PF and their supporters. We therefore warn them to desist from always making people angry in the midst of such poverty and hunger. Kambwili still in the race for 2021 – Akafumba

NATIONAL Democratic Congress vice-president Josephs Akafumba says Chishimba Kambwili is still in the 2021 race.

And UPND leader Hakainde Hichilema says only a lunatic can celebrate the NDC leader’s incarceration.

Principal resident magistrate David Simusamba on Wednesday sentenced Kambwili to one-year imprisonment each, for forgery and uttering a false document.

The two sentences will run concurrently, meaning Kambwili will only serve a year.

Speaking at a UPND-NDC Alliance briefing in Lusaka yesterday, Akafumba who is a lawyer said the Magistrates’ Court was not the final arbiter.

Akafumba also said he is not shocked by magistrate Simusamba’s judgment.

“We know that the PF have done this because they want to block president Kambwili from achieving his political aspirations. We saw yesterday (Wednesday) on their platforms where they were saying president Kambwili is gone and dusted and will never stand again because he is a convict…,” he said. “Let me make this very clear, the exclusion clauses in the Constitution are only two. Number one is when you are serving a prison sentence and by implication it means you are in prison; you cannot go out and campaign. And the second one is when you have served a term of three years. So, to us we have to fight to ensure that CK comes out of jail. So, to me those don’t apply to CK. And if again this is what they wanted to achieve, mwailasha (you are doomed) again. We are ready for it but time for them will come.”

Akafumba complained about magistrate Simusamba’s behaviour during trial and judgment.

“What happened at court is very saddening, but we expected it because the route of journey the trial for president CK took is out of the preamble for any justice system. If you recall or are not aware, first of all, CK reported magistrate Simusamba’s bad conduct to the Chief Justice,’’ Akafumba said. “He went further to report magistrate Simusamba to the Anti-Corruption Commission and has also sued Simusamba in the High Court of Zambia. In all court systems the magistrate must always have water in the mouth but Simusamba chose to swallow the water and jumped to the arena and that’s why this judgment is in the manner it is. I am not shocked by that, but Simusamba is not the final court as we are going to appeal all the way to the Supreme Court.”

He said all the aforementioned matters were alive and active, and that it was the same magistrate who went ahead to hear and determine the matter of the NDC leader.

He charged that Simusamba had scores to settle with Kambwili from inception.

“We did go as far as the Chief Justice to air the complaints that Simusamba was not the right magistrate to determine this matter. So even when he was reading out his judgment, it became very clear that what he was settling was the perceived conduct of Kambwili in his eyes,” said Akafumba. “And then he went ahead to say that because of what happened, because of him not coming to court with the alleged attempt to delay the court and therefore was going to punish him. I don’t think this is the way it should have been done or should be.”

And Hichilema said Zambia had an autocratic and brutal regime.

He encouraged the Kambwili family to be strong, stating further that what was happening was a passing phase.

“I said to the family that this should never be viewed as a case of criminality. This is the time to be united; this is not the time to start polarising yourselves over issues that are of no consequence. This is the time to bond, and we expect you to be strong and then we the alliance can add more glue to that bondage,” Hichilema said. “Ifi fyonse fikapwa, all of this will come to an end but we have to remain strong as a nation, as a people. We must also remove fear because what is happening to CK is because most of us are afraid to stand up for our rights. Be strong, mukose. It’s darkest before dawn. And a lunatic was celebrating the incarceration of CK. We are losing basic values of care for each other.

When leadership is rotten, it cascades downwards. This is what is happening in Zambia.”

He said every time Zambians worked in unity against evil, the nation succeeded.

Hichilema said while the forefathers fought for independence, Kambwili is “fighting for new independence”.

“2021, there is another call to duty. On the left is the PF, the bad, and its surrogates. The other side, is what is right, it’s where the people are,” said Hichilema.

DR FRED M’membe says there was no fair trial in the Chishimba Kambwili forgery case.

The Socialist Party president warns that given Kambwili’s very dangerous levels of hypertension, “If Mr Kambwili was to die in prison under these circumstances his death would be very difficult for this government to explain to our people”.

Magistrate David Simusamba on Wednesday sentenced Kambwili, leader of the opposition National Democratic Congress, to one-year imprisonment for forgery and another year for uttering a false document. The two sentences will run concurrently, meaning the NDC leader will only serve a year.

Reflecting on the conviction and imprisonment of Kambwili, Dr M’membe said he was not surprised that Kambwili has been convicted and sent to jail.

“Mr Kambwili had made very serious allegations of soliciting a bribe against the trial magistrate [David Simusamba]. The logical thing would have been to remove this magistrate from hearing Mr Kambwili’s case to ensure that a fair trial is not only guaranteed but it is also seen to be assured,” he said. “I don’t think Mr Kambwili received what can pass or be seen as a fair trial. Without delving into the merits or demerits of the case, very few can say Mr Kambwili has been convicted and sent to jail by an impartial magistrate. There was no fair trial in this case.”

Dr M’membe said it’s very important for every accused person to have a fair trial.

“It’s actually impossible to overstate how important the right to a fair trial is. Honestly. Fair trials are the only way to prevent miscarriages of justice and are an essential part of a just, fair and humane society. Every person accused of a crime should have their guilt or innocence determined by a fair and effective legal process,” he said.

“But it’s not just about protecting suspects and defendants. It also makes our nation safer and stronger. Without fair trials, victims can have no confidence that justice will be done. Without fair trials, trust in government and the rule of law collapses.”

Dr M’membe said the right to a fair trial has long been recognised by the international community as a basic human right.

“Despite this, it’s a right that is increasingly being abused in this country to settle political and other scores with devastating human and social consequences,” he noted.

“Despite the importance of fair trials being recognised by the international community, this basic human right is being abused day-in day-out in this country. We must put an end to these abuses. Let’s build a criminal justice system in which every person’s right to a fair trial is respected.”

Dr M’membe noted that building such a system won’t happen overnight.

“But with each step we take towards a criminal justice system in which every person’s right to a fair trial is respected, we are protecting our people against miscarriages of justice and building fair and effective criminal justice systems that benefit everyone,” said Dr M’membe.

“Lastly, my great fear is Mr Kambwili’s state of health. He has very dangerous levels of hypertension. If Mr Kambwili was to die in prison under these circumstances his death would be very difficult for this government to explain to our people. This may fuel very serious political mistrust, tension and instability.”

On Wednesday, magistrate Simusamba said he was giving a punitive sentence to Kambwili to deter would be offenders who thought that they could disrespect institutions of justice.

Kambwili was charged with three counts of forgery, uttering a false document and giving false information to a public officer, in relation to the registration of Mwamona Engineering and Technical Services Limited.

According to a complainant from Economic and Equity party leader Chilufya Tayali, the registration of Mwamona had anomalies.

The court, however, acquitted Kambwili on a charge of giving false information to a public officer as there was no evidence.

In his judgment, magistrate Simusamba said during the proceedings Kambwili lacked courtesy towards the court.

“I have considered the mitigation and the evidence on record and the fact that the convict is a first offender. I noticed the conduct of the convict and come to the conclusion that he has no regard to the institution of justice. During my career I have dealt with high profile cases such as that of Dr Nevers Mumba whose status is like that of the convict, an honourable person,” said magistrate Simusamba. “But none of his peers conducted themselves in the manner the convict did. They conducted themselves in a dignified manner, even though I convicted them; that’s how an honourable man should conduct himself. I will give a punitive sentence to the convict in order to deter would be offenders who think they can disrespect the institutions of justice. I sentence him accordingly. Count one, 12 months imprisonment with hard labour; count two, 12 months’ imprisonment with hard labour to run concurrently.”

At this point defence lawyers Musa Mwenye and Keith Mweemba said Kambwili had lodged an application for bail pending appeal to the High Court as the outcome of the judgement was anticipated.

But magistrate Simusamba rejected the application, wondering what time it had been filed when he had just delivered his judgement.

He said the application for bail pending appeal will be determined on Tuesday next week.

The stressed-looking Kambwili composed himself afterwards and urged his daughter Chanda not to cry as the outcome of the judgement was anticipated.

US desires level playing field in Zambian politics – US Envoy

UNITED States Embassy Charge d’Affaires David Young says his government is interested in seeing a level playing field for all political players in Zambia ahead of the 2021 general elections.

And USAID Zambia mission director Sheryl Stumbras says a programme is being designed to establish an independent media landscape in Zambia.

In a virtual meeting to explain the US government’s K39 billion grant to Zambia that was announced on Wednesday, Young said although Washington would never take sides in Zambia’s elections, it would strive to promote equal opportunities for all participants.

Part of the programmes involved in the five-year, US $1.9 billion development strategy for Zambia, include establishment of an independent media landscape and the promotion of transparency in public finance management.

“When you look at our government and Zambia, we are democracies. So, democracy is a powerful foundation between us. You have had peaceful transfer of power between political parties and that is a powerful thing,” said Young. “We want a level playing field where all candidates will campaign on a level platform. We will support freedom of speech, freedom of the media. We don’t want to see political party cadres invading radio stations. I meet with a lot of political party leaders. I meet with the PF, the UPND and other political party leaders, including President [Edgar] Lungu. And I tell them that we want a level playing field. We don’t take sides as the US government because our interest is ensuring that democracy flourishes in Zambia where the Zambian people can make independent choices.”

Young said he also met Electoral Commission of Zambia officials on Wednesday to discuss issues to do with elections.

And Stumbras explained further on the purpose of the grant that was announced at a meeting with finance minister Bwalya Ng’andu on Wednesday

“The programme is a five-year strategy that looks at various fields of development. We’re looking to increase economic development, good public finance management and transparency. We also want to establish an independent media landscape, and we want to expand the role of the private sector in Zambia,” said Stumbras. “We are in the process of designing a programme to strengthen the media. We want community radio stations to be empowered, online media, etc. We realise the challenges that the media face, so we also want to see what kind of programmes can support community radio stations.”

The Zambia Police command is under pressure from the PF Secretariat to have the UPND President Hakainde Hichilema and some of his MPs arrested over the successful trip to Kasama where they received very good reception.

Some meetings held late last evening at State House deliberated what they thought could be an appropriate charge they could slap the UPND President Mr. Hichilema to keep him out of circulation from political scenes for sometime, especially after the great reception he has been receiving on the Copperbelt and Northern Provinces

State House sources think there is some wind of opportunity to access Mr. Hichilema’s body by PF state apparatus, and harm him while in police custody.

“I can almost bet with you that Mr. Hichilema or at least some of his MPs, especially those who escorted him to Kasama will be summoned latest by Friday or early next week. They want to implicate them into fake charges which are still being determined by the PF. The idea is to access his body and that of his MPs especially with Bill 10 coming up now”, sources close to the meeting disclosed.

Sources said Home Affairs Minister Stephen Kampyongo is the masterminder of this scheme to have HH and some of his MPs arrested, especially after what they considered a successful mission in having the NDC President Chishimba Kambwili thrown behind bars.

“Of course some people in the meeting had very serious reservations about going ahead with such evil schemes of arresting political leaders at a time emotions in the country are running very high. Some also thought arresting HH or even his MPs and subject them to be appearing in Kasama court will give them a huge platform for campaigns in that region like it has just happened with the arrest of Patrick Mucheleka and others”, said the sources close to the operations.

Other insiders in the meeting revealed that President Edgar Lungu and his despotic regime has been put under the spotlight by the international community with most Western nations already considering targeted sanctions against him and some of his close associates in the PF.

“President Lungu has been specifically warned against any more repressive actions against his opponents especially with all the bad news coming out of Zambia, about the likely debt default which the PF are trying to avoid ahead of the elections,” sources revealed.

I AM happy with the conviction of Chishimba Kambwili over the crimes he committed but I expected him to have been given more years, Chilufya Tayali has said.

Meanwhile, Mr Tayali who is Equity and Economic Party (EEP) president said the UPND president, Hakainde Hichilema should not be allowed to be republican President because he has caused a lot of suffering to Zambians through privatization.

He said this at a media briefing in Lusaka yesterday in reaction to the jailing of NDC leader Chishimba Kambwili, who yesterday started serving his 12 months with hard labour. Mr Tayali who welcomed the conviction said he expected Kambwili to have been jailed for more years.

“I am happy with the way Lusaka Principal Resident Magistrate David Simusamba handled the case. But I was expecting more years on ba Kambwili not the 12 months jail sentence,” Mr Tayali said.

Mr Tayali had reported Kambwili to police for registering Mwamona Engineering Company using a fake name.

He observed that if the convict was remorseful, he might not have been jailed, but allegedly continued intimidating and insulting people for his personal aggrandizement.

He warned that he could get even three years if he would appeal a straightforward matter that had concrete evidence against him.

“Kambwili will not succeed with his appeal. The case is straight forward. It is water tight. Even if HH was a judge, he would not have ac-quitted Kambwili because the evidence was very solid,” he said.

Mr Tayali clarified that he was not sponsored by the ruling party to take Kambwili to court, but that he did it to fight corruption after get-ting a tip from the people the convict was threatening.He said the ruling party had nothing to do with Kambwili’s case and added that: “Peo-ple should actually congratulate me for exposing Kambwili’s wrongs with evidence.”

“I started this case when he was in Government but no progress was made till he was fired. This has been my legal battle to make leaders accountable and I will continue. In fact, there are two ministers on my list of those currently serving, I will pounce on them whenever they will be out, especially when I will be President,” he said.

Meanwhile, Mr Tayali said Mr Hichilema was a wrong person and should not be allowed to go to State House because of his involvement in the sale of State assets.

“HH is another wrong guy to go to State House. He should prove that he is clean before he even thinks of going to State House. That’s why this Commission of Inquiry into Privatization is very important and those found wanting should be made to account,” he said. -Daily Nation

ABOUT THE CONVICTION OF KAMBWILI: A MORAL, LEGAL AND ETHICAL PERSPECTIVE

Part 1 of 3

1. The recent conviction of the Party President for the National Democratic Congress (NDC), who is also former Information and Broadcasting Minister in the PF Government, Honorable Chishimba Kambwili, has raised a lot of controversy across the entire country. Was it right to convict and send to prison such a high profile political figure? Was he truly guilty of the alleged offenses or the trial Magistrate was inherently biased against him from the beginning. Did the trial Magistrate really solicit a bribe in return for an acquittal, as alleged by Kambwili, or was he merely trying to muddy the waters because he knew from the word “go” that he was guilty of the offense as charged? Was Kambwili’s arrest, prosecution and subsequent conviction, politically motivated by President Edgar Lungu, as punishment against Kambwili for his several insults against the Head of State, ever since he left the PF and formed his own political party? Or was Kambwili taken out of the political platform in order to weaken the opposition and potentially deprive the opposition UPND and Opposition Alliance of a potential running mate?

2. In this article, l will seek to offer my opinion on the above questions as well as many other inherent questions that have arisen ever since the NDC President was convicted of two charges of forgery and uttering a false document about two days ago, and subsequently sentenced to one year for each count, which will run concurrently which means that he will effectively only serve one year. However, I want to declare from the onset that even though l will make my beat effort to be sincere and objective in this article, l am unable to runaway from the fact that am inherently conflicted. On one hand, Kambwili is a fellow opposition leader with whom a shared a platform on several occasions and what is happening to him could very well happen to myself tomorrow. On the other hand, l have always been nonchalant about Kambwili’s type of politics which has been empty of substantive issues and merely focused on disparaging others. That said, let me proceed and delve into the meat of this discussion.

3. It is always important to start from the beginning. Kambwili was arrested following a complaint that was filed with the Zambia Police Service that he had forged the signature of his son in a “No Change” Annual Company Return that was filed at PACRA in 2013. The complaint was made by the Party President for the Economic and Equity Party (EEP), Mr. Chilufya Tayali. There are several issues that arise here. Firstly, Kambwili is said to have forged the signature of his son, not of some unrelated third party, but his own son. To me, this means that the forgery was done merely for administrative convenience only and without any criminal intent. I am sure that if the son was available, he would have signed for himself, but the son was probably not available and Kambwili needed to file the PACRA return urgently, possibly in order to meet the requirements of a tender or something to that effect. I must say that it is not uncommon for most people that l know to sign on behalf of their children or spouses, especially on documents for a family-owned company. So in this context, there is nothing unusual or blatantly criminal about Kambwili’s forgery of his son’s signature on a PACRA return.

4. The other issue that arises from the above genesis of events is the fact that the complaint, Mr Chilufya Tayali is a political player and was not directly involved with the matter. Additionally, Kambwili’s forgery of his son’s signature is not a matter of public interest as it does not result in the deprivation of any public resources. Here, we are not saying that a political player or any unrelated third party cannot file a criminal complaint with the Police, of course they can, but only in a public interest matter. Otherwise they would have no standing or locus to be a complainant. Additionally, several questions arise about Mr Tayali’s role as a complainant. How did he know that somewhere in the archives of PACRA, there is a “No Change” annual return that had been filed by Kambwili 7 years ago in which he had forged his son’s signature? Is Mr Tayali psychic? Did he have a dream or visions about Kambwili’s forgery in order to know that it existed or was he passing around Longacres area and he smelt the forged annual returns deep in the PACRA archives? It really does not make sense to me how Mr Tayali could have genuinely and innocently come across the existence of this illegality. If the complainant was a PACRA official, then it would have made sense because such a person is expected to have first hand knowledge of annual returns that are filed at PACRA by different entities.

5. The only plausible explanation of how Mr Tayali came across the existence of this illegality that was buried deep in the archives of PACRA for 7 good years is that someone was digging dirt on Kambwili and decided to go through all of Kambwili’s financial and commercial documents with a fine tooth comb and subsequently came across the said illegality. And that someone is definitely not Mr Tayali because a third party cannot go to PACRA and request for a copy of an annual return that was filed 7 years ago for a company that they do not have a direct stake in. You can request for a print out which shows details of the company such as date of incorporation, directors, shareholders etc., but not a copy of the annual return that was filed by a company director or secretary. This means that the only possible person or persons who could have been going through Kambwili’s records with a fine tooth comb are State Agents. The Police, DEC, ACC, Intelligence etc. And if State Agents were sent to dig dirt on Kambwili, it means that they themselves could not proceed to file a complaint against him, otherwise a lot of eyebrows will be raised. Their approach would be to find a gun for hire which they could use, and Mr Tayali would have suited that role perfectly. He is confident, intelligent and has a good understanding of legal processes. Someone who cannot break under heated cross examination in court. By the way, if you dig deep enough, you can be rest assured of finding some dirt on each and everyone of us. Enough dirt to send any of us to prison. Provided you are a human being of adult age, you must have committed an offense somewhere somehow. It just requires someone to search with a fine tooth comb.

6. So if State Agents dug dirt on Kambwili and passed it on to Mr Tayali for him to file a complaint with the police, the question is; who could have sent them and for what purpose? My view is that such a high profile operation could not have been sanctioned by anyone else other than the Head of State; His Excellency Mr Edgar Chagwa Lungu, for the sole purpose of taking out Kambwili from the political scene. If this was indeed the sequence of events, then President Lungu is using State institutions to fix his political opponents. This would amount to a gross abuse of authority on the part of the President. In part 2 and 3 of this series of articles, l will look at Kambwili’s trial itself and the drama that was inherent therein as well as the subsequent conviction and sentence.

Former PF Kasempa district Information and Publicity Secretary Enoch Kalele says it takes a mad man to remain and survive in the Patriotic Front hence his decision to join the UPND.

And UPND Kamakechi ward councillor, Morgan Mabamba who was recently lured with a K20, 000 support towards his education and made to resign as area councillor Morgan Mabamba has rescinded his decision describing the PF as a bunch of liars and evil schemers.

Councilor Mabamba who announced his decision to rescind at a media briefing this afternoon in Lusaka said the PF promised to give him the remaining K20,000 towards his education at Mukinge school of nursing where he is doing his second year if he is to resign from his position as a Councillor.

He cited deputy Provincial permanent Secretary Evans Chihili and a Kasempa District Administrative officer as the people behind his purpoted resignation and gave him K10,000 while being made to sign an already drafted resignation letter.

The Civic leader who thanked the UPND leadership for quickly rescuing him from a named lodge in Solwezi where he was to stay during the 39 days grace period under the care of Mr Chihili said he was happy to be back among the people who appreciate people’s suffering and have a nationwide development agenda.

He bemoaned the discrimination in the distribution of the youth empowerment funds in the district with a bias towards PF aligned youth organisations and groups.

And former PF IPS Enoch Kalele said he was happy to be a part of the team that has dedicated it’s efforts towards the achievement of a just and equitable society unlike the PF which believes in personal glory and riches as he bemoaned the high number of politically induced by-elections.

He said citizens were slowly losing interest in the electoral process and governance system as evidenced by the apathy being witnessed in most Elections.

And UPND Kasempa District Secretary, Shamano Sondashi called for sanity in the political arena and urged lawmakers from across the political divide to reject and vote against constitutional amendment Bill number 10 of 2019.

SANGWA DIVORCES …Court grants couple divorce

THE Lusaka High court has dissolved a marriage of State Counsel John Sangwa to Vivien Nsingo Sangwa.

Judge Nicole Sharpe-Phiri said in her judgment that on the totality of the evidence before her, she was satisfied that the marriage solemnised on June 6 1993, at the University of Zambia chapel in Lusaka between the two had broken down irretriev-ably in terms of section 8 and 9 (1) (d) of the Matrimonial Causes Act no. 20 of 2007.

“ I accordingly decree that the said marriage be dissolved and a decree nisi is hereby granted dissolving the marriage,” Ms Justice Phiri said.
She however said that the decree is to be made absolute within six weeks of the date hereof, unless sufficient cause be shown to the court, why it should not be so made.

Mr Sangwa in his evidence contended that they had lived apart for a period of two years immediately preceding the presentation of the petition and that their marriage had broken down irretrievably on that account.

The petition by Mr Sangwa was uncontested and Ms Nsingo provided her consent to the divorce.
Mr Sangwa on February 6, 2020 filed for the dissolution of his 26 year old marriage to Ms Nsingo.

He stated that after the celebration of the marriage, the couple lived together as husband and wife at Sub Division 1 of Sub -Division ‘U’ of farm no 215a, Lusaka West.

He stated that they were both legal practitioners by profession and had three children.

Mr Sangwa stated that to the best of his knowledge there were no other children now living that have been born to the petitioner during the substance of the marriage and they have been no previous proceedings in any court in Zambia or elsewhere with reference to the marriage or between the petitioner and the respondent with reference to any property of either or both of them.

He further stated that there were no proceedings continuing in any court outside Zambia, which are in respect of the mar-riage or which are capable of affecting its validity.

He stated that there was an arrangement between him and Ms Nsingo for the maintenance of the children of the family.

“The said marriage has broken down irretrievably by reason of the fact that the petitioner and the respondent have lived apart for a continuous period of more than five (5) years immediately preceding the presentation of this petition : from December 2014 to date,” Mr Sangwa stated.

Lone gunman gunned down: 10 hostages, 14-hour stand-off with cops

John Sithole, the gunman, believed to be between 22 and 25 years old, is suspected to hail from Chipinge.

He was also known as Kedha.

Police had been pursuing him for a number of armed robberies in Beitbridge suburbs and along the major highways leading to Harare and Bulawayo. He also committed crimes at the Limpopo River.

He holed up at a house in Beitbridge’s Dulivhadzimu suburb and was eventually killed in a shootout when he tried to dash for freedom.

Kedha allegedly started a diversionary fire in the house and tried to get away using the smokescreen.

Chronicle gathered that he masterminded his operations from Musina in South Africa and would most of the time skip the border via the Limpopo River.

It took a Police Special Tactics Team (PSTT), an arm of the Support Unit, to subdue the heavily armed Kedha.

During the fracas, Kedha allegedly shot and wounded a detective on the arm.

The town was at a standstill for more than eight hours with cars and residents filling the nearby streets to witness the shootout, albeit from a safe distance behind a police cordon.

Literally hundreds of people were held spellbound by the rare hostage situation.

According to neighbours, Kedha had been staying at the house for two weeks.

“I was terrified to hear the sound of heavy gunfire in the middle of the night behind my house. When I went out to investigate I saw police armed to the teeth in my yard and there were already some spent cartridges.

“The police calmed people’s nerves when they told us they were pursuing a dangerous armed robber next door,” said Ms Rumbedzani Ribombo.

The police moved civilians out of the way and tried to engage Kedha who allegedly threatened to shoot his hostages if they tried to storm the house.

National police spokesperson, Assistant Commissioner Paul Nyathi said it was unfortunate that someone had died and advised suspects to always avoid shootouts or avoid engaging in life-threatening violence when the police try to arrest them in a civil manner.

“It is sad that the suspect died. We wanted to question him to clear a number of armed robbery cases,” said Asst Comm Nyathi.

“Initially the suspect evaded arrest at the Limpopo River and hid at his rented house in Dulivhadzimu where he was found by our detectives.

“Since he was armed, they ordered him to surrender but he turned violent and held 10 people from the house hostage and opened fire at the police. They tried all the civil ways available to make him surrender but he was not relenting and kept firing until reinforcements were called from our special tactics unit.”

He said the PSTT “amicably” freed the 10 hostages including Kedha’s wife and niece, but he remained in combat mode. Asst Comm Nyathi said Kedha set fire on the house and sought refuge in another room at the same time exchanging gunfire with the police.

He said the team managed to kill him later in the afternoon during a heavy exchange of gunfire and the body had been taken to the district hospital’s mortuary.

“As the police, we continue to implore suspects or people to always comply with our officers as we enforce the law.

They must not take advantage of other people by holding them hostage to evade arrest,” said Asst Comm Nyathi.

He said further investigations were underway.

According to one of the hostages, Mr Innocent Makuvasine who stays at the house, he was awakened by gunshots.

“When the police arrived, they ordered everyone to put their hands on the back of their heads and get out without switching off the lights.

“That’s when the man (Kedha) started shooting at the police. We failed to get out until the next morning when the police instructed us to cover our faces with wet towels as they were launching smoke canisters,” he said.

Continued Mr Makuvasine: “However, through the night there was constant shooting between the man and the police, until his wife pleaded with him to let her and the child leave the house. Everyone got out leaving him alone in the house. The man is a new tenant. I had never met him.”

A distraught property owner, Mr Godfrey Muzvidziwa, said he was at a loss for words.

“I only saw this guy once, according to his wife, he was based in South Africa where he was employed. This is a great loss. I built this house in 2000 and it will take me a very long time to fix the damage resulting from the shoot out and the tenant burning my house,” he said in a very low voice.

The incident comes a few weeks after the country’s most wanted armed robber, Taj Abdul was arrested in the same town as he planned a hit on a cross border trader with the aid of a serving policeman. The Chronicle

The prime-minister of Barotseland, Ngambela, sope, Minyoi RT Mukela Manyando is facing rebellion from the entire BRE Kuta.

According to the sources within the Kuta, they have disclosed that Ngambela mukela manyando has completely failed to man up and show leadership in Barotseland.

A group of Indunas has since called for his dismissal or his resignation from the Kuta with immediate effect.

Indunas have disclosed that, Mukela has failed to advise his majesty the Litunga Lubosi imwiko II on many serious issues. The issues of protecting the land, Chiefs , projects, BA1964 and the unity in the kingdom. Further more Indunas have said mukela is too weak to lead the highest authority in the land, because he lacks courage and determination. Mukela manyando is so afraid of his majesty and he can not advice or tell him the truth, what he does it’s only yes sir yes sir, disclosed Indunas.

However, Ngambela mukela manyando is reported to have travelled outside Barotseland. Mukela has also been accused of serving Zambian government’s interest at the Kuta instead of the people of Barotseland.

If you happens to compare between Mukela and immediately former Ngambela nyambe mwenda you will find that there is a big difference. Mwenda was a man who has Barotseland’s interests first , he was so proud and he maintain the status quo and defended the kingdom well despite his crookness. Mwenda used to tell the Litunga the truth and before anything he could convey a meeting of Indunas and deliberate hot issues and then take them to the Litunga. The reason you used to see that there was pressure from Zambian government.

Since his departure the issue of Barotseland agreement of 1964 talks and negotiations left with him because mukela is a coward who is scared to even command the permanent secretary to the Kuta. We don’t have leadership at the Kuta currently.

Once they give him a brown envelope from usually government visitors he forgets about the Kuta’s role.

For the past few months, some of the BRE Indunas have not had access to met his majesty the Litunga.

Sources further said, it’s disheartening to see that some districts Kutas have empowered themselves and Indunas are getting monthly salaries and yet here at the headquarters “Namuso” there is completely nothing like that. Indunas do not get paid only once in a while and it’s pecks. Imagine the Kuta has no any project that is bringing revenue. And right now we hearing that all these mambeti are planning to resign and look for new life since they are not looked well by the Kuta despite so many monies that are coming from many different venture that the Litunga is pocketing with few individuals.

Indunas from Mwandi Kuta of his Royal Highness senior chief Inyambo Yeta who is in charge of Mwandi, Sesheke and Mulobezi are empowered, have projects that are bring in enough revenue and everyone is on s monthly salary including watchmen. Another is Kaanja Kuta of senior chief Lukama who come on the throne just two years ago he has reformed and put every Induna on salaries, he is currently bringing new projects for the Kuta to empower the people. Chief Lukama Mukiti sekeli is in charge of Sioma and shangombo districts. Even in libonda Kuta , the African parks are paying the Indunas and mambeti very well.

Indunas have revealed that, the trend of allowing only one person and few of his subordinates to be benefiting should come to an end and let everyone have a share.

Indunas further discloses the deals that the Litunga has blocked such as councils and zambeef taxes that he chews alone. Liuwa national park, markets , Zambian pipe money , etc

Ngambela mukela manyando was the first Ngambela for Litunga lubosi imwiko II since 2000 until 11th October 2006 when he was forced to resign by the BRE Kuta over land scandal. He was brought back at the Kuta again as Ngambela on the 17th January 2019.

Funerals ceremonies are generally meant to give a loved one proper send-off into the spiritual world. Different communities have different ways in which they conduct their funeral rituals.

In this article, we are going to review some of the most bizarre rituals that some communities do, which prove to be scary.

Note that some of these rituals have been long abandoned.

Eating the dead

 

The ancient Melanesians of Papua New Guinea and the Wari people of Brazil literally feast on their dead relatives. Otherwise known as endocannibalism.

According to their repulsing ritual, eating a dead relatives was a gesture of honor to the departed.

It also signified expelling of fear and mystery that surrounds the concept of death.

Some of these communities still practice the ritual to date.

Body exhumation for a dance

The people of Malagasy tribe in the island of Madagascar found in the Indian Ocean exhume their dead relatives every after 7 years in a ceremony called “Famadihana” which means the turning of the ancestors’ bones.

During the peculiar event, relatives of the dead would exhume the remains, wrap them in new and clean clothes, and dance with them around the grave before re-entombing them.

Sleeping with the dead

The Toraja people form an ethnic group indigenous to the mountainous Pangala region of Indonesia’s South Sulawesi, about 800 km northeast of Bali.

The group, which mainly consists of Christian – mostly protestant, but also Catholic treat the dead as merely sick and not actually dead.

To them, they accept death as part of life’s journey, and when a family member passes away, in accordance with their traditional religion called “Aluk To Dolo” which means “a way of the ancestors”, they treat them as if they are sick “toma kula”.

Food, water and even cigarettes are offered to the dead on a daily basis, because it is believed the spirit remains near the body.

This ritual would go on until the funeral is scheduled, which may take several years to come if not decades.

Their burial ceremonies are always expensive. Perhaps that is why they take decades sourcing funds.

Finger amputation

The Dani people of Papua New Guinea amputated their women and children’s fingers whenever a relative died.

According to their uncanny ritual, doing so was a way of driving away evil spirits.

Thankfully, the practice is now officially banned!

Burying the dead in sited positions.

The Abashuu clan which forms part of the Akabarasi subtribe of Luhya community from Western Kenya used to bury their people in a sited posture.

When a prominent member in the clan like an elder or a chief died, their body would be buried in a grass-thatched shanty specifically erected for the dead man in his compound, or even buried in their family houses.

During this burial, the body was placed in a shallow grave in a sitting posture and covered with soil up to the neck leaving the head sticking out in the open.

The head would then be covered with a special hat in the shape of a pot.

The widow, or a medicine man in the clan would occasionally lift the hat and anoint the head with special herbs meant to kill the stench.

This would go on until the entire body decomposed.

Feasting the dead on scavengers

Natives of Tibet and Chinese provinces cast their dead relatives in the open to allow scavengers like vultures to feast on them in what is known as sky burials.

Sometimes the bodies are cut into pieces and left on a hill for the scavengers.

The National Democratic Congress (NDC) Party this morning held a press briefing at the NDC President Dr Chishimba Kambwili’s residence in Woodlands . The meeting was attended by the United Party for National Development (UPND) leader, Hakahinde Hichilema who was accompanied by Sylvia Masebo. The meeting was chaired by NDC Vice President Rikki Josephs Akafumba.

Others who attended the meeting was Bridget Attanga NDC Secretary General and her Deputy, Fr Charles Luonde NDC National Chairperson , Edward Mumbi Dr Kambwili’ spokesperson , Lombani Msichili NDC Chairperson Incharge of finance, Roan member of parliament Honourable Joseph Chishala, Christopher Mutale NDC Chairperson Incharge of mobilisation, Charles Kabwita NDC National Youth Chairperson, Saboi Imboela NDC Party Spokesperson among others

NDC National Chairperson Fr Luonde opened the meeting with a prayer and explained that the Briefing was called to discuss the sentencing of NDC leader Chishimba Kambwili by principal magistrate David Simusamba.

Upon taking the floor NDC Vice President Akafumba said, A true friend is identified when one is in trouble.

The UPND has proved that by abandoning all their activities to attending a briefing, this was a sign of true friendship.

Akafumba said the National Democratic Congress (NDC) described the trial its leader Dr. Chishimba Kambwili as a discourage of justice.
and he further told the media houses present that the judgement Magistrate Simusamba David delivered against Kambwili was the fastest in the history he spent as magistrate.

He said despite being a convict, Kambwili will remain the president of the NDC. He said from the judgement Simusamba categorically said the complaint by Chilufya Tayali made was first reported to Amos Chanda who was at the time special assistance to President Edgar Lungu.

By implication the prosecution of Kambwili was the PF project that have everything to win from the arrest of Kambwili.
He said the whole episode from the report of the case to the arrest, charge and conviction of Kambwili was and is a PF project.

The NDC Veep said the PF tried hard to take Kambwili to where he is now but will not weaken his spirit.

Akafumba disclosed that the lawyers applied for bail but the magistrate refused to entertain the application.

Instead the magistrate put 20th October as the date when the bail application pending the outcome of the appeal.

The NDC Vice President regretted that the PF have taken many people to court but only members of the the ruling PF get acquitted and some get nolle prosequi.

He said the NDC will fight for Kambwili and this time around, the opposition will put more volume for the government to hear the demand loudly.

He said the party will mobilise the people country wide to fight for the freedom of the Kambwili.

Akafumba mocked the PF for celebrating that the conviction is the end of Kambwili’s political career.

He pointed out the exclusion from the taking party in political activities can only apply when when one is serving a sentence which unfortunately this does not apply to Kambwili.

He also disclosed that the NDC is aware of the PF schemes, which it was doing to unsettled the NDC and UPND alliance.

He said the conviction of kambwili has strengthened the alliance stronger than before.

He further said the conviction of kambwili can be compared to the alliance being baptized by fire by the PF to which Jesus Christ normally baptised people with the Holy Spirit.

He said the PF tried to break Hichilema by keeping him in prison where he spent 127 days and failed.

He said the PF also tried to get at Hichilema using the gassing issue but failed to yield any meaningful results.

Akafumba has since appealed to the NDC structures country wide to change gear and organize the party and not to listen to the PF.

And speaking at the same briefing Hichilema consoled the NDC family and urged them not to break.

Hichilema said many Zambians are hurting by the unjustified arrest and conviction of Kambwili.

He accused the government of taking away the rights of the people which are supposed to be enjoyed.

He said the situation of Kambwili does not merit to be called a crime to be in prison.

He said the arrest of Kambwili is as a result of failed brutal regime bent on taking away the rights of the people.

Hichilema further said the PF regime is taking away even what they promised to the people during the election campaign.

He said the government is creating situation which will lead the people to react and cause anarch.

He observed that only a small group of the people in the ruling PF that want to hold on to the power is behind the anarchy which the people are experiencing.

He asked the people not only to be strong but also get united as the alliance is working on the modeloties to free them from the yokes of slavery.

He said it is toughest before down and urged the people to remove the fear which is the reason why they are still suffering .

He said what is happening to Kambwili is because the people are scared to claim their rights.

Hichilema said every time the people work together against evil, the people succeeded. This time around would not be an exception.

When there is a divide between the good and bad, the bad loses. Kambwili belong to the good where the Victors belong.

The PF will start approaching the youths from NDC to defect. Hichilema has since advised them not to accept because where they are now is where there is life, and asked the youths to be strong and stay firm.

The UPND leader explained his experience While in prison, and said, one day is like one month. But each day is a day closer to coming out of the prison.

Hichilema has since asked the people to be strong.

NEVERS Mumba has called on Zambians to continue praying for National Democratic Congress leader Chishimba Kambwili.

Following Kambwili’s conviction and sentencing to two years on two charges, to run concurrently, Mumba who is Movement for Multiparty Democracy president urged the public to continue fighting for justice.

He expressed shock that Lusaka Magistrates’ Court principal resident magistrate David Simusamba who presided over Kambwili’s forgery case, was still around and serving in the judiciary.

“Having said that, we are praying for the family, the Kambwili family, we are praying for the NDC. We are praying that God may give them strength during this time, and to know that things come and go; even this thing will go. All we ask for is equity in justice. We hope that there will be no hindrance in getting bail,” he said. “Second of all, I am surprised that Magistrate Simusamba is still here. I didn’t know that he’s still here because I’ve a letter from the Judicial [Complaints] Commission in which they have proposed that he steps down, based on some of the issues that have happened to certain cases, including mine. Let’s keep fighting for the justice in our country and for better governance, moving forward.”

Mumba narrated his own ordeal under magistrate Simusamba two years ago.

He said Kambwili’s case was part of a test on the country’s judiciary.

“When I was sent to prison by the same magistrate (Simusamba), when my lawyers went to apply for bail, he was nowhere to be seen. So, I hope this time he’s going to be available in order to deal with this matter equitably; that’s all I can say. But we are praying for the Kambwili family and the NDC,” Mumba said. “First of all, we must accept that God is the only God of justice, before we talk about the…of this case. However, we only hope that the lawyers are going to get the bail for him now because it’s his constitutional right. All these things are part of proving whether our justice system works. And, therefore, we really expect that they’re going to treat him fairly, and there will be no political undertones to this matter.”

Asked if it was a political matter, Mumba responded: “In the court case we are going to consider it as a legal process. Internationally and to many Zambians, it’s political victimisation because honourable Kambwili was minister in this government. These cases are from before. They should have brought these cases when he was minister.”

He called for a justice system that would be free from political interference.

“And that’s why I’m insisting that even the ministers that are in government today, I do not want us to wait until they leave government to deal with…matter; it becomes political persecution. If honourable Kambwili was not asked questions when he was in government, why is he being asked now?” Mumba asked. “All I’m saying is that let’s be equitable in the manner that we deal with all of us so that we don’t give a perception of injustice. The justice roll is being written about the PF. And it is important what chapters they constitute because this book will be read for many years to come on how they dispensed justice to all of us. So, we pray again for the family of the Kambwilis and also for the leadership and the membership of NDC. It’s a season that has come, but it’s also a season that’s going to pass.”

Earlier upon arrival at court, Mumba said he was there to witness the writing of the country’s justice book.

“Well, we are here to support our brother, and today the judgment is being read out. We are really here to show solidarity and to let the Zambian people know that when it comes to justice, we would like justice to be equally distributed to all citizens,” said Mumba. “There should not be others that are going to be free and others to be intimidated. So, we think that we need to witness this because the book for justice is being written for Zambia, and we wanna make sure we can watch it as it is being written.”

Reflections on the conviction and imprisonment of Mr Chishimba Kambwili

I am not surprised that Mr Chishimba Kambwili has been convicted and sent to jail.

Mr Kambwili had made very serious allegations of soliciting a bribe against the trial magistrate. The logical thing would have been to remove this magistrate from hearing Mr Kambwili’s case to ensure that a fair trial is not only guaranteed but it is also seen to be assured.

I don’t think Mr Kambwili received what can pass or be seen as a fair trial.

Without delving into the merits or demerits of the case, very few can say Mr Kambwili has been convicted and sent to jail by an impartial magistrate. There was no fair trial in this case. It’s very important for every accused person to have a fair trial.
It’s actually impossible to overstate how important the right to a fair trial is. Honestly.

Fair trials are the only way to prevent miscarriages of justice and are an essential part of a just, fair and humane society. Every person accused of a crime should have their guilt or innocence determined by a fair and effective legal process. But its not just about protecting suspects and defendants. It also makes our nation safer and stronger. Without fair trials, victims can have no confidence that justice will be done. Without fair trials, trust in government and the rule of law collapses.

The right to a fair trial has long been recognised by the international community as a basic human right. Despite this, it’s a right that is increasingly being abused in this country to settle political and other scores with devastating human and social consequences.

Despite the importance of fair trials being recognised by the international community, this basic human right is being abused day-in-day-out in this country. We must put an end to these abuses. Let’s build a criminal justice system in which every person’s right to a fair trial is respected. We won’t get there overnight. But with each step we take towards a criminal justice system in which every person’s right to a fair trial is respected, we are protecting our people against miscarriages of justice and building fair and effective criminal justice systems that benefit everyone.

Lastly, my great fear is Mr Kambwili’s state of health. He has very dangerous levels of hypertension. If Mr Kambwili was to die in prison under these circumstances his death would be very difficult for this government to explain to our people. This may fuel very serious political mistrust, tension and instability in our country.
