AN OPEN LETTER TO THE PRESIDENT

SUBJECT: ABOLISH MINISTRY OF INFORMATION AND MEDIA

To describe and justify its functions and existence, the Zambian government says, “As a focal point for national information gathering and dissemination, MIBS has a major responsibility to co-ordinate and facilitate the operations of the media …”

For starters, no single ministry must be designated with the responsibility to gather information generated in every other ministry and government department. Each ministry can and does generate and disseminate information to identified audiences. This is the reason why each of them has a public relations officer with the same responsibility.

My suggestion is that disband the Ministry Information and Media and distribute the officers therein to the PR offices of other ministries. The current staff levels of normally one officer in the PR office does not reflect the importance of communication in an information age. Each ministry must be staffed with officers whose skill sets should reflect modern communication strategies that range from traditional to social media and other media arts.

Instead, the office of the Secretary to Cabinet must host the office of the Chief Government Spokesperson at the level of Permanent Secretary. Under this officer should be a staff compliment with communication and policy analytical skills that can study communication trends in the country and beyond and identify communication opportunities.

Working closely with the media team at State House and Public Relations Officers in various ministries and quasi-government bodies, the Chief Government Spokesperson can strategize effective ways of gathering and disseminating government information. Under this office shall fall the Zambia National Information Services, ZANIS, which is the technical and PR wing of government.

It is not the duty of the office of the proposed Chief Government Spokesperson to speak on policy issues that can be handled ably by line ministries. Instead, this officer will be communicating cabinet decisions and clarifying overall government policy. Alternatively, this officer could facilitate the engagement of the Secretary to Cabinet directly with the media from time to time. Otherwise, his or her task will be that of the face and voice of the Zambian government.

Under the office of the Chief Government Spokesperson should be several units that together define communication and media arts. For instance, there should be a department that deals with traditional media; social media; literary works such as books, book writers, publishing houses, along with film production, artforms such as sculpture, painting; and libraries, etc. Each of these media arts are potential forms of communicating any kind of information and message that government may desire.

Through film for instance, the government of Turkey has promoted anti-terrorism messages; through film, the government of South Africa has shared the various strategies that were employed in the struggle for freedom. Through sculpture, several countries in Europe have told the various aspects of their countries’ history. There is so much that communication is and what it can do to promote the Zambian identity and unity.

In case someone is worried about the media without a government Ministry: yes, only then shall the media achieve a self-regulatory framework. For the public broadcaster, ZNBC, the BBC model and how its board of governors is selected is a very good model to borrow. Don’t worry about the Independent Broadcasting Authority, IBA. There are sufficient examples around the globe to secure its independence and professional conduct.

Mr. President, you were elected on the promise of a new governance environment. The media space is one area you must not leave untouched. Disband the Ministry of Information and Media and end the temptation to interfere with media operations and their independence.

Kenya suspends trading license of popular bar over reports that Blacks are not allowed to mix with Whites

The Governor of Nairobi County has suspended the trading license of a popular bar pending an investigation after a viral video on social media appeared to show a Black patron being ordered to leave a queue with White and Asian customers.

Besides the racial discrimination claims against Black customers, Governor Ann Kananu also suspended the license of the Alchemist Bar because of noise pollution complaints, The Star reported.

“I have directed county executive committee member for environment to institute a multiagency task force and a comprehensive report of the same to be made in the next five days,” said Kananu.

The high-end Westlands-based club is no longer open for business. The video of the incident in question was shared by a patron who alleged White and Indian customers had been made to join a queue that was separate from Blacks. The video also appears to show a Black customer being made to leave that queue.

“We must protect our county which exercises immense respect to all social races and strongly stands against any form of discrimination and noisy pollution,” Nairobi City County Executive for Environment Larry Wambua said.

But despite the outrage after the video went viral, the club denied the racial discrimination allegations, BBC reported. The club also released a statement on Tuesday saying it had agreed to shut down to allow for an investigation into the May 20 incident. Management said it would look into whether the Black man in the video was denied entry and if customers having separate lines was club policy.

The club added that it would also ascertain if customers have experienced discrimination at the facility by taking a look at past events and analyzing interviews.

“After careful consultations with Nairobi County Government, the Alchemist has agreed to close its doors while a thorough investigation is conducted over the next few days,” the club said, per The Star.

The Alchemist Bar also rendered an apology on Monday and said it had contacted the persons who shared the video to get more details on what transpired. “To anyone that has felt aggrieved, we sincerely apologise and we look forward to sitting down together and addressing these issues head-on,” the club said.

Introduction

The events surrounding the judiciary since the set of the ‘New Dawn’ deserve a comment.

This is even when I know that my comments may not sit too well with the powers that be. However, I am comforted by the words of Desmond Tutu who warned that “if you are neutral in situations of injustice, you have chosen the side of the oppressor.” Thus, I will comment and state that “chondifika chindifike.”

Purge of judges

Since the set of the ‘New Dawn’ there have been administrative structural changes within the judiciary. One of the monumental moments was the appointment of a new Chief Justice. There was bipartisanship in support of the appointment of Justice Mumba Malila, SC as Chief Justice to fill the vacant position left by the late Ireen Mambilima. This is a score on the part of President Hakainde Hichilema for appointing a profound professional to replace another iconic figure. We supported and applaud the President for this. However, what followed is what many call the ‘purge’ of judges. In as much I do not subscribe to such thinking but the pronouncements from UPND cadres raise worry. To suggest that the judiciary was pro-PF and hence it must be disbanded is worrying. To accuse an independent judiciary and its judges of being partisan is shocking and undermines the rule of law and good governance. There is not even a shred of evidence to support the call for reforms that include disbanding specific courts because they may have ruled against the UPND whilst in opposition. To suggest that all judges appointed during the tenure of the PF and by president Edgar Lungu exercising his constitutional right to do so undermines the independence of the judiciary and is actually contemptuous. The UNPD government must rein in on its cadres and stop them from throwing malicious venoms on the judges as these are acts that undermine the rule of law. Judges must be judged by their conduct through set out mechanisms such as the Judicial Complaints Commission (JCC) and not at the altar of politics. I end here by quoting the great American Hugo Black who stated that “the layman’s constitutional view is that what he likes is constitutional and that which he doesn’t like is unconstitutional.”

Transfer of magistrates

The transfer of magistrates is in itself a normal administrative routine. Magistrates have been transferred by the Judicial Service Commission (JSC) since its creation. However, two significant events lead to many of us question the timing of the mass transfers. The first followed a protest by UPND cadres at court grounds against magistrates performing their functions. To them, the failure by the state to secure convictions of people accused of corruption was the fault of magistrates. In the small minds of these cadres acting on impulse and fueled by mob psychology, the accused persons are guilty and they expect nothing more than a guilty verdict. In essence, the party and its government is asking the courts to play politics. The party and its government is asking the courts to discard the presumption of innocence and summarily convict the accused persons without due process so that it feeds public opinion that it is fighting corruption. The fight against corruption must be supported by all. However, it must not be used to settle political scores.

The second event of worry was a statement by the JSC that the transfers were a coincidence and had nothing to do with dealing with magistrates handling high profile corruption cases. This statement is alarming and dangerous. Its half-wittedness and the amateurish way it was made raises more questions than answers. It was better to keep quiet. That coincidence could have been avoided because the reckless transfers have far-reaching unintended consequences of the judiciary and the justice system. Many cases will have to be restarted. Many accused persons will spend more time in remand. It is a total disaster. In the interest of the rule of law and the respect for constitutionalism and key institutions like the judiciary the transfers must be reversed and a more intelligent way must be employed to effect those changes. The great American John F Kennedy, whose life was cut short by the brutality of a trigger and bullet once warned, “the rights of every man are diminished when the rights of one man are threatened.”

Politicisation of the judiciary or judicialisation of politics?

The independence of the judiciary is guaranteed under the Constitution of Zambia. The supreme law of the land requires that the judiciary as an institution must have both financial and functional independence (Articles 122 and 123). This also extends to judges as a collective and judges as individuals. Thus, the judiciary as an institution, judges as a collective and judges as individuals must not be subject to the control of any person or body. This includes the President of the Republic of Zambia. This includes all institutions such as the JCC and JSC. To bring politics to the courts of law is alarming, unfortunate and dangerous. Caroline Kennedy wisely guided that “the bedrock of our democracy is the rule of law and that means that we have an independent judiciary, judges who can make decisions independent of the political winds that are blowing.”

This means that we allow magistrates and judges to apply the law as it is and not to satisfy the political agenda of a ruling political party. It is not the duty of the judges and magistrates to convict. Their job is to dispense justice regardless of the political winds and that is based on which party, being prosecution and defence, has a compelling case. The prosecution having a daunting task of presenting their case to the high threshold of “beyond reasonable doubt”. If that has not been met the judges and magistrates must acquit and acquit unapologetically. I end with the wise counsel of Nan Aaron who cautioned that “an independent judiciary is the crown jewel of our democracy” adding that “it is so vital to be used as a means of placating a political party’s base.”

Better to have a corrupt and incompetent judiciary.

It has always been the fundamental ethos of this jurisdiction that a corrupt judiciary is preferred to one that is not independent. We also believe that an incompetent judiciary is better than one that is not independent. In the case of Godfrey Miyanda v Matthew Chaila (judge of the High Court) (1985) it was held that “the public have a right to have the independence of the judiciary preserved; the absolute freedom and independence of judges is imperative and necessary for the better administration of justice.”

In his judgement, Ernest Linesi Sakala who later assumed the chair of Chief Justice opined that “it is better to take the chance of judicial incompetence, irritability, or irrelevance, than to run the risk of getting a Bench warped by apprehension of the consequences of judgments which ought to be given without fear or favour.”

Thus, all political players must allow the courts to operate independently. Both the party in government and the opposition must allow the courts to be independent as the independence of the judiciary is the only oxygen to our democracy. It is for this reason, at this defining hour and with so much promise that the UPND as a party in government must not repeat the mistakes of its predecessor parties. We must take heed to what the Burman dissident Aung San Suu Kyi said that “the judiciary must be strengthened and released from political interference.” This is so, as Andrew Jackson foretold, “all the rights secured under the Constitution are worth nothing, and a mere bubble, except guaranteed to them by an independent and virtuous judiciary.”

LUSAKA COP TURNS DOWN K12,000 BRIBE

An alert Lusaka based Police officer of Zambia Police Service Headquarters has turned down a K12,000 bribe to cover up a theft of solar panels and a submersible pump.

The Cop identified as Inspector Bornwell Hatontola on Tuesday, 24th May 2022 at around 08:36 hours, received a phone call from a Mr. Honest Mweemba asking if his Motor Vehicle was available for hire on that particular day.

Mr Mweemba asked the Cop, who also does a side ‘hustle’ as a driver, to ferry some items from Mumbwa to Lusaka’s Makeni area.

Around 19:00hrs, inspector Hatontola started off from Lusaka to Mumbwa District and met the alleged suspect who pulled two small black bags from the right side of the road in the bush and put them in Hatontola’s Toyota Regius vehicle.

“He also pulled a 25 kgs white sack which contained a big submersible pump, a black roll of cable which he suspected was a power cable for the submersible pump and a roll of Nylon rope,” the Cop narrated.

Hatontola was then asked to drive about 1.5 Kms in the west direction and was ordered to make a right turn in the bush to pack the solar panels from where they were hidden.

It was at this point that Hatontola sensed something fishy and refused to drive the vehicle in the bush around that time on account that it was not only highly risky but late.

It was at this point that out of desperation, the alleged suspect offered to give the Cop a K12,000 after being queried on where he got the items, to which he responded that he got them on some farm on the south side of the road and that there was nothing to worry about because some farm workers knew what was going on.

Upon realising that he could be dealing with an active theft case, Inspector Hatontola then drove for a few kilometres, parked the car by the road side and immediately called a Chisamba based Police Officer, constable Jimmy Sikazwe and further told him to quickly alert Kapyanga Police check point or Nangoma police post to intercept the motor vehicle which he was driving because he highly suspected that the solar panels he was about to deliver to Lusaka were stolen goods.

Shortly after speaking to constable Sikazwe, Inspector Hatontola then called sergeant Silwenga of Nangoma Police Post, made a similar request and gave him the number plate of the car he was driving.

After the alert and the alleged stolen goods were packed in his vehicle, Hatontola then sarted off driving back to Lusaka and reached Nangoma area at exactly 22:49 Hours only to be stopped by a car which blocked his lane.

Three male police officers, one of them armed with an AK47 assault came out of the car and ordered Inspector Hatontola to park the vehicle at the police post.

The officers then led all of the three occupants into the inquiries office and then returned to search the vehicle to check what was inside only to find the above mentioned goods.

It was at this point that the officers then ordered Inspector Hatontola to go to the next office for questioning while the other two men were put in police cells.

After the interrogations, the officers offloaded all items from the vehicle and put them in the Inquiries Office, thanked the Inspector for giving them a tip-off of the crime which was in progress and set him free to drive back to Lusaka.

Wife Dumped Me For Being Jobless – Man Cries

Andrew Chabata from KweKwe is a devastated man after his wife Petronella Ruzwidzo Bungu allegedly ditched him because he was jobless and broke.

Chabata claimed Bungu divorced him due to her status as a breadwinner.

He made the startling claims at the Bulawayo Civil Court where his ex-wife had dragged him seeking a protection order against him claiming he was verbally and emotionally abusing her.

Bungu told the court that her ex-husband was also stalking her and threatening to go to her workplace and cause a scene as a way of embarrassing her.

“I want a protection order against my ex-husband. He is harassing me through text messages, phone calls and unannounced visits at my place. Last year he physically abused me and I want the court to grant me a protection order so that he stops harassing me,” begged Bungu.

She also claimed her ex-husband was also disturbing her peace by constantly phoning and sending messages to her mother.

In response, Chabata stated that his ex-wife’s application for a restraining order was just a plot to get him out of her life for good since he was not employed.

“Though I am not opposed to her application, the accusations she stated in the application are not true. I can, however, confirm that some time we exchanged harsh words because of her infidelity.

“The issue at hand is that I am not employed and I am not able to provide for her. She is now the breadwinner and I am now a liability to her hence the reason why she wants me out of her life,” responded Chabata.

His response didn’t go down well with Bungu who claimed that when Chabata married her, he didn’t tell her that he was married.

“We got married in 2016 and it was after he lied to me that he was divorced. When I found out that he had a wife, he told me that the wife was given to him by the elders. I tried to stay in that polygamous marriage but I failed to do because of his abuse.

“He put me under a lot of pressure and during that time I was at school and pregnant. He also didn’t want me to work yet he did not have enough money to look after me.

When I gave birth, he neglected me together with the child and I had to go back to my mother’s house. He once lied that he was in Afghanistan yet he was in Kwekwe enjoying with his first wife,” she narrated.

She said her ex-husband started accusing her of infidelity after she got a job.

“He started accusing me of cheating after I got a job in Government. When I terminated the relationship, he was not taking care of me and the child. He has also been abusing me. We never had peace in our marriage.

“He once found me a place to stay in Montrose and he was now bragging saying I was from the ghetto and I was now enjoying the luxury of staying in the low-density suburb. He would also not allow me to talk to men,” said Bhungu.

In her ruling presiding magistrate Nomasiko Ndlovu ordered Chabata not to verbally and physically harass his ex-wife in any way.- B Metro

PEACE: TROUBLE ANYWHERE IS TROUBLE EVERYWHERE – HH

Thank you to His Majesty King Mswati III for the State banquet and messages of goodwill as I turned 60 years of age, today.

I am also thankful to all citizens across the globe for the messages of goodwill.

In our address during the State banquet, we stated that peace and stability is the prerequisite for economic development and that Africa and the World at large must uphold this.

We also indicated that it is high time Africans begun taking responsibility for various challenges we are faced with and that before we seek solutions elsewhere, we must first look within.

The narrative that Africa is a trouble maker and that Africans like fighting amongst themselves must be changed because trouble anywhere is trouble everywhere as we are witnessing in some parts of the World.

Fellow citizens. During our address and riding on the remarks by His Majesty King Mswati III that several of our brothers and sisters have made families in this Kingdom, we appealed to those residing herein and elsewhere (diaspora) to continue striving to be the best citizens as they are our country’s representatives.

Zambia is known to be peaceful and whilst in office, we are working hard to ensure that we can indeed add that other than peace, Zambia becomes to be known as a developed country.

Zambia is getting better and indeed will be better.

May God bless the people of Eswatini Kingdom and Zambia.

Opposition PeP leader Sean Tembo is flirting with a moment in police cells after hoisting a flag at his mansion.

According to the constitution of Zambia, it is illegal to hoist a flag in an area not designated by law.

Hoisting A National Flag Of Zambia 🇿🇲

What the Constitution states;

Section 4(3) of the National Flag and Armorial Ensigns Act Cap 8 of the laws of Zambia states that No person, other than the President or a person authorised by the President in that behalf, shall fly, display or otherwise use the Standard.

Subsection 4 stresses that Any person who contravenes the provisions of this section or who fails to comply with any of the conditions imposed. He who does so is guilty of an
offence and liable on conviction to a fine not exceeding fifteen thousand penalty units or to imprisonment for a period not exceeding twelve months, or to both.

The same Act cited further goes to guide in regulation 3 that Notwithstanding anything contained in these Regulations, the National Flag maybe flown-

(a) at buildings or premises owned or occupied by the Government;

(b) at buildings or premises owned or occupied by local government
authorities;

(c) at buildings or premises owned or occupied by any statutory board or
statutory corporation;

(d) at state-aided schools; and

(e) on any motor car, boat or ship in or by which a Minister of government is
for the time being travelling.

4. The Minister may in writing authorise any person to fly the National Flag on any premises or at such buildings and on such days or occasions as he may specify, and such permission may be given subject to any conditions which the Minister may think
expedient. ,

5. Subject to the provisions of regulations 6 and 7, the National Flag may be flown by any person-

(a) on the following public holidays, namely: Africa Freedom Day, Heroes Day, Unity Day, and Independence Day; and

(b) on such other days or occasions as the Minister may declare for this purpose.

6. (1) The National Flag shall be flown with due respect and, when flown with other flags, the National Flag shall be in a more prominent position than other flags.

Emmanuel Mwamba forced to drink his own Saliva

PF aspiring presidential candidate and former Ambassador to the African Union and Ethiopia was last night made to drink his own Saliva. Mwamba appearing on TV Bakwetu with Masheke Akashambatwa on the popular punch for punch debate was challenged on all his popular theoretical claims. Masheke made Mwamba to repeat after him including when Masheke stated that the PF made calculated errors in selling Mopani copper mines for $1. Mwamba who has in recent months embarked on a campaign to force the New Dawn government to repossess the mopani mines was made to rethink his campaigns. Masheke challenged him that the PF made a mistake and the UPND should be allowed to fix those basic errors in a civilised way. Mwamba has seemed to suggest that the sale agreement should be ripped up and have the mines returned to the people of Zambia. Masheke challenged Mwamba that the mines are not run on air but requires substantial continues capital injections which our government cannot manage.

On corruption, Mwamba was made to condemn the corrupt practices which the PF indulged in. He also added his condemnation of the cadres in bus stations.

Mr. Mwamba whose joining of the PF has remained a mystery considering that he was working for the former MMD president Chiluba who was an enemy of the then opposition leader. When PF won the 2011 elections, Mwamba was one of the provincial ministers who was appointed outside the patriotic front structure. It has not been established how close Mwamba was to both Chiluba and Michael Sata when the two leaders were never friends at the the time Chiluba died.

Mwamba has also featured on several media platforms where he has appeared to just recite his political thesis with the interviewers barely challenging him. However, for the first time, Mwamba was left with a dry mouth that he visibly licked his slips to make saliva to drink. The man was for the first time reduced to a cadre that he seemed to have lost his direction. Towards the end of the debate, Mwamba had a connection disruption which we presume allowed him to drink some water. On resuming, he claimed that he disn’t know that his phone had run out of battery. However, Mwamba, like every rich person in Lusaka has a faster broadband and uninterrupted electricity supply.

Mwamba was also reminded to appreciate the freedom of speech which PF denied the people of Zambia. Overall, the debate was mature and a new approach to democratic debates in a civilised country. Well done to both of you

He was a lovely gentleman when we first met. He performed what was expected of him and said what was expected of him. When he asked me to be his girlfriend, I was overjoyed.

He spends a lot of time on the road because he is a driver. As a result, I treasured every moment we got to spend together. I treasured those times because they weren’t something I experienced every day.

I didn’t get to pay attention to certain things because we didn’t spend a lot of time together when we were dating. There were warning indications. I simply didn’t do anything with them.

He wouldn’t answer some phone calls in my presence, for example. And the times when I got too close to his phone and he freaked out. I had no intention of reading it, but the way he held the phone against me made me suspect.

Instead of paying attention to my gut, I dismissed it. “Things are fine,” I told myself. The ghosts I see are all in my head. They can’t possibly be real.”

I was ecstatic when Kojo asked me to marry him.

We didn’t spend a lot of time together when we were dating so I didn’t get to pay attention to certain things. The signs were there. I just didn’t make anything of them. Like how he wouldn’t receive certain phone calls in my presence. And the instances where he freaks out if I went near his phone. I never had the intention of going through it but the way he guarded the phone against me made me suspicious. Instead of listening to my instinct, I brushed it off. I told myself “Things are good. The ghosts I see are in my imagination. They can’t be real.”

When Kojo asked me to marry him I was over the moon.

I took him home to my family and they endorsed him. He introduced me to his family and they welcomed me with wide-open arms. They came to see my family and performed the knocking rites. His mother and his aunt really liked me. They called to check up on me regularly and I dared to think we were friends. Anytime Kojo’s sketchiness with his phone came to my mind, I banished it immediately; “Come on, his mother loves you. He is marrying you. He loves you so what do you have to fear?”

That’s how I silenced my doubts. We got married and later signed in court. Even after marriage, I still didn’t see any change in him. He still answered certain calls away from my ears. He guarded his phone as if it held the secrets to the universe. I decided to approach things with patience.

I couldn’t touch his phone but I could see the screen sometimes. I observed that the phone calls he ignores or goes away to answer belong to one particular number. I read his body language when the calls came through. He tenses up at first but then he answers and walks away from me. Sometimes, I stood somewhere he wouldn’t see me and watched him talk on the phone. He was often relaxed and chatty with the person as though I’m the one he was talking to.

I asked myself, “Since I am here who is he talking to?” I pushed away the thought that my husband might be cheating on me. After all, our marriage was too new for him to start cheating on me. One day, we were together when that particular number called again. Before he answered the call I asked “Who is that person calling you? I’ve observed that number. It calls you too often to be ordinary.” He said, “I don’t know what you are talking about.” He then walked out to receive the call.

Who are you?” I responded, “I’m Kojo’s wife.” She didn’t believe what I said and I also didn’t believe her when she said my husband was her husband.

I said, “If you’re serious about what you’re saying then prove it.” She answered, “Don’t worry. I will send you a photo of our marriage certificate. I don’t know why you want to claim a man who is not yours.” Later, she sent me a photo of their certificate. It is true.

They are married. They’ve been married for eleven years while ours was only three weeks old. I called her again on the phone and we talked. She told me they have been trying to have kids but nothing had worked. Kojo’s family put a lot of pressure on him to take another wife but he refused to heed his family’s advice.

I was devastated. It hurt that he lied to me. It hurt more to find out that he only married me to make babies for him. He didn’t marry me out of love. He only needed someone to give him kids.

I felt foolish. I thought of how his family embraced me and asked myself, “So were they all part of the charade? I trusted them so why would they do this to me?”

I called his mother and asked her between sobs; “Why didn’t you tell me your son was already married? Why did you lie to me?” She tried to calm me but I wouldn’t hear of it. I kept asking questions after questions but she had no answer to any of them.

When Kojo came home, I rushed to him with the evidence. I asked the same questions I asked his mother. He didn’t act surprised. It looked like someone must have told him before he came home. He hasn’t said a word to dignify my questions.

I have been crying for days now. I know I shouldn’t have been too trusting of him but it’s not altogether my fault. I am not the one who married two women without telling either of them. This is not on me. I feel the urge to hurt myself but I won’t do it.

I will pick up the pieces of my life and move on. I know that I will be fine. I just feel so ashamed and betrayed right now. I don’t even know how I’m going to explain it to people without feeling stupid.

I have asked my family to return their drinks to them. Looking at what’s at hand, I don’t even think our marriage was valid in the first place. That notwithstanding, I have called for the annulment of our marriage.

His mother and his aunt are telling me not to be hasty in my decision to leave their son. Kojo himself hasn’t said anything to me. I hate the fact that he manipulated me with his lies so there is no way I am staying with him. I will heal and then I will give myself another chance to love again.

I have difficulty appreciating why the former Attorney General Likando Kalaluka is being maligned for stating that he can’t remember what happened with the purchase of the Minstry of Infrastructure building unless he is availed the documentation.

Fairness demands that Mr Kalaluka should have been availed the document to refresh his memory. Its not easy for anyone who deals with hundreds of correspondence to remember every document he or she signed years ago.

What I know is that the job of any Attorney General, even the current one, is to advise Government and not private persons. If Attorney General Kalalula advised the Ministry of Infrastructure on the contract of sale and on variations of the special conditions, I don’t see how that would be wrong if Government took up the burden to pay Property Transfer Tax for purposes of reducing the cost of the purchase price of the building during negotiations.

However, Governement must be encouraged to inquire into the purchase of the building but beginning to crucify people in a court of public opinion without availing them the information to reflect and give an informed position is unjust on its own.

Am as shocked as everyone that Government has incurred interest of $25 million due to contractual breaches on payments. This is where I support President Hichilema who frowned upon contracts which had punitive clauses that have robbed the country of millions of money in interests. This culture has to come to an end.

One contractor once told me the reason why Governement purchases things like paper which costs K90 at K250 is because Govt does not pay on time. So usually a business would have to factor in the profits that would have been made due to delays in Government paying. This is understandable and makes business sense.

However, am against the idea of contracts where government is penalised for delayed payments of down payments. Inflated purchase price is draining the treasury of much needed resources. Already the story of the chartered plan at an inflated cost by the Ministry of Youth, this is how Government loses money. The Ministry of Youth and Sport has not learnt anything at all from the past

We are so much disappointed with Mr Chanda Charles the President of UPPZ whose video with accusations content on innocent people has gone viral.

The Bible is very clear that our almighty God detests a man who rushes to accuse a neighbor as stated in Hebrews and Proverbs. The Germans say “to claim is not to prove”.

We say so because to date the operations at black mountain have not recorded any death and as UPND we have made sure that safety is priority at the black mountain. Further as a rulling party we have not stoped any media house from covering any story from the black mountain as Mr Chanda claims. However, we have seen some accidents which have been some kilometers away from the black mountain as a result of some people climbing loaded trucks some of which are not from the black mountain. The trend of people stealing from loaded moving trucks is not new in KITWE and dates back before the black mountain and it’s unfair for some sections of the opposition to say it’s because of the black mountain.

To this end we engaged the Consortium and Zambia Police to control the situation so that we avoid further accidents as a City because every life is valuable. We will further continue engaging other stakeholders including communities around to find the lasting solution to the climbing of loaded trucks.

Therefore the unfounded claims by Mr Chanda that there have been deaths recorded at the black mountain are meant to tarnish the image of the President and our Mines Minister. We want to warn Mr Chanda to have boundaries in his politicking because inciting residents of Kitwe and Zambians against the leaders out of falsehood and politicking is a crime and can easily be prosecuted in our Courts.

Mr Chanda should limit his excitement of the freedom of expression which President Hakainde Hichilema and the UPND Government have restored. It’s very irresponsible for Mr Chanda to call other Citizens Satanists and this kind of politics will not be entertained on the Copperbelt.

As Copperbelt Youths we are monitoring Mr Chanda’s moves and if he continues on this path he will soon be treated with political measures he is calling for himself. Copperbelt Youths will not tolerate politicking empowerment programs for our Youths, Women and the Communities.

We further advice Mr Chanda to stay away from our leaders for his own benefits especially the Head of State and Cabinet Ministers.

Congolese Citizens Hold protest against Paul Kagame and the Rwandan govt

The tiff between D.R.C and Rwanda has stirred unrest in Kinshasa as scores of masses went into the capital streets to denounce Paul Kagame and the Rwandan government. President Kagame is being implicated by the D.R.C government for sponsoring rebel activities in the North Kivu region. The protests come just a day after the African Union Chairperson Senegalese President Macky Sall had a tele-conversation with the warring leaders, imploring them to negotiate for a peaceful resolution of the ongoing crisis.

The anti-Rwanda protest is said to have been initiated by a Congolese nationalist civil society group NDSCI. Hundreds of people who participated in the protest were seen waving placards and fliers with nationalist messages and pro-D.R.C slogans. Some of them had castigatory inscriptions against President Kagame and the Rwandan Ambassador to the Democratic Republic of Congo. It is understood that the demonstrators are against the Rwandan ‘political and military’ influence in Congo. One of the banners was branded “Congo is our country… not a single centimeter will go to Rwanda.”

The demonstrators held candles and shouted slogans against Rwandan President Paul Kagame. Some members of the Union for Democracy and Social Progress party, the oldest and ruling party in the D.R.C have pledged to back the government and FARDC (the Congolese army) in the armed struggle against the M23 rebels. The youths in particular are ready to do military service to defend the country, said Pasi Nkoyi a UDPS party official.

Relations between the two countries soured since the mass arrival in the eastern Democratic Republic of Congo of Rwandan Hutus accused of slaughtering Tutsis during the 1994 Rwanda genocide. Relations began to thaw after DRC President Felix Tshisekedi took office in 2019 but the recent resurgence of M23 violence has reignited tensions, exacerbated by the detention of two Rwandan soldiers in Congo.

The recent armed confrontation between the Congolese army and the M23 rebels who are believed to the linked to ISIL has been an ongoing warfare. At least 73 thousand civilians have been displaced, some seeking refuge in the neighbouring countries Rwanda and Uganda. Meanwhile, Kinshasa has made repeated allegations that Rwanda was backing the M23 – a primarily Congolese Tutsi group after clashes between its fighters and the Congolese army broke out last week in the North Kivu province, which borders Rwanda.

In the latest rebel attack the Red Cross record that 16 people were killed, seven wounded and vehicles were torched during a night raid in the volatile east. One of those killed is reported to be a humanitarian Red Cross worker. He was shot as he was trying to flee the war zone. The cancer of rebel groups in the eastern part of D.R.C has insisted for a winding period spurning over a decade. The D.R.C eastern region is very infamous for inhabiting scores of hostile rebels that sporadically initiate uprisings against the government of the day.

The M23 revolt peaked in 2012 and 2013 when it captured large parts of North Kivu province in eastern DRC. In this rebellious venture, the M23 briefly seized Goma before being defeated and driven out of the country by Congolese troops backed by UN peacekeepers (MONUSCO). Following its defeat, the M23 signed an agreement with Kinshasa that included provisions for its fighters’ reintegration into civilian society. However, the group has accused the government of breaching the agreement once more, and fighting has resumed.

WATER development minister Mike Mphosha says if former president Edgar Lungu wants to shun state functions he must do so without maligning the government.

Mposha noted that Lungu did not attend both the Africa Day commemoration and commissioning of the Kenneth Kaunda Wing of the Mulungushi International Conference Centre (MICC) built by China.

He said the former president had a right to exercise his freedom of association and assembly “or not” but that he should not make false claims that the government had organised cadres to embarrass him at the two events.

“Edgar Lungu must heal. Time has passed. The train has passed. There is another team now to clean up the mess that PF created. They don’t have to justify the shunning of the event. If they want to shun state functions, let them do it. I think these are their freedoms. We all have a freedom to associate or not to but don’t go out and try to dissuade, mislead, maligning government by saying they are hiring people,” he said. “President HH [Hakainde Hichilema] is too busy to play that kind of politics. This country has moved away from petty politics. This country has moved to the politics through which people can better their lives socially and economically. That is our focus. Let them not draw us into petty politics. We want to change how people will perceive Zambia in the next five years and beyond.”

Mposha said the UPND had no business in embarrassing Lungu because the Zambians who are the masters already embarrassed him on August 2021.

“I don’t have a problem if he shuns state functions but to go and issue statements even challenging the state to show proof that he was invited and to issue a statement that people mobilised to try and embarrass him! UPND has no business in embarrassing any PF member or the former president. What I know is that the former president Lungu was already embarrassed by Zambians on August 12 who made a decision to vote him out. He must not blame everybody. The Zambians are the masters who employ political leaders,” he said.

“I know it takes time to heal but look at RB (Rupiah Banda). Let him learn from him. RB lost elections in 2011. He was taken to court by PF but he still attended state functions. When Zambia won the Africa Cup in 2012, [then vice-president Dr] Guy Scott and Rupiah Banda were sent to receive the trophy. He represented the government and came with the trophy and we think that as UPND we have no time for ‘co cise’ (baseless) type of politics. We are busy cleaning up the mess which they left.”

Mposha, who is also Munali UPND member of parliament, said the reference to President Hichilema’s refusal to attend state functions when he was in opposition was unnecessary.

“They are also reminding us of how President Hakainde Hichilema shunned State functions when he was in the opposition. First of all, the debate is very unnecessary considering the fact that the projects we are talking about were contracted out of tax payer’s money. These projects were built out of tax payer’s money, and when you look at the conference facility it was a gift from China. Now that gift came about because of the good relationship that exits between the Republic of China and the Republic of Zambia. Nothing personal or nothing to do with PF or Edgar Lungu or when the project started because Zambia has been there from 1964. The relationship that Zambia enjoys with China came in long before Edgar Lungu. Long before he even thought of being in leadership or before anyone thought of forming PF. We owe our appreciations to the founding fathers,” he said.

“HH owes Lungu no apology. Between the two, it is actually HH who should have been apologised to for what he was made to go through. HH has created an unprecedented style of leadership where when we meet our colleagues in PF regalia there is no fight. We wave and greet each other and that is what we want and this is an environment which when Edgar Lungu was given chance to rule the country failed to provide. There were places that you could not step in if you were a known UPND member or wearing any red colour. Now we don’t have to remind Edgar Lungu about all these things. Sometimes it is important to take off one’s pride and face reality as it is. HH shunned events because he was being blocked from even attending funerals. He was being blocked from landing at the airport.”

Mposha warned that the end of PF would be very disastrous because of the style of leadership of “listening only to themselves”.

“Edgar Lungu’s attitude of playing to the gallery, to the cadres, is not helping PF. Yes, Zambians understand that it is not UPND alone, we are in a multiparty dispensation but at the rate he is going the PF will remain totally irrelevant. Look at the rate at which people are resigning from PF! If you saw at the funeral of Alexander Chikwanda, I was part of the delegation of the Vice-President [Mutale Nalumango] and they went all out to politicise that funeral. They shout ‘alebwelelapo! (he’s coming back to power)! Now if that is representative of the feelings of Zambians, he would not be where he is today,” said Mposha. “If the money that they borrowed to build infrastructure was properly accounted for, Zambians would have been very happy and PF would have still been relevant to the discourse of this country. But because of political violence, the tribal politics they had created, the corruption which was going on, all these things displeased Zambians and they decided that we wanted another political party. So anyone who wants us to be clapping for PF for the construction of that conference facility or any other project is missing the point.”

” It is a perfectly legitimate and fair comment to say that Hakainde Hichilema is an antiChrist, in Zambia, a country which has declared itself a Christian nation.”

It is impossible for Jesus Christ to be happy with magistrate Chrispine Hampungani for jailing Andsen Zulu for 12 months, for saying that Hakainde Hichilema is an antichrist, a non-believer in Christ.

Such an assertion is perfectly logical, especially in a country that has declared itself to be a Christian nation. In the Holy Bible Jesus Christ categorically says it is easier for a camel to go through the eye of a needle than for a rich person, such as Hakainde Hichilema, to enter the kingdom of God.

Therefore, it is a perfectly rational belief to assert that Hakainde Hichilema is an antichrist, an unbeliever in Jesus Christ.

Intimidated by being arrested and detained by the police, bullied and overcome with fear by finding himself in court accused of having defamed a popular president, representing himself, Andsen Zulu foolishly perhaps, hoped that not wasting the court’s time and quickly admitting to the charge would see him reprimanded at the most, and lightly punished, for his comments.

It is in such cases where magistrates and judges and all judicial officers are expected to be extremely careful, they do not permit a suspect to unwittingly incriminate themselves, when in fact the facts before the court do not amount to a crime! But magistrate Chrispine Hampungani was having none of this caution: the poor man was swiftly jailed for an incredible 12 months!

Perched right on top of the preamble of our Constitution, is the declaration that Zambia is a Christian nation: “WE, THE PEOPLE OF ZAMBIA: ACKNOWLEDGE the supremacy of God Almighty; DECLARE the Republic a Christian Nation while upholding a person’s right to freedom of conscience, belief or religion.”

It is God Almighty, and not money, we acknowledge to be supreme. And yet Andsen Zulu, precisely because he has no money, could not buy an experienced and clever lawyer to argue his case against Hakainde Hichilema, who is a rich man and the President of Zambia, has been swiftly dispatched to prison, obviously to also frighten all poor people without money not to say anything presumed negative or defamatory, against Hakainde Hichilema.

Leviticus 19:15, clearly says “You shall do no injustice in court. You shall not be partial to the poor or defer to the great, but in righteousness shall you judge your neighbour.”

Magistrate Chrispine Hampungani has gone down in our history books as a magistrate who sent a poor worker to jail for saying something perfectly rational and defensible, against Hakainde Hichilema.

This magistrate has sent shivers down the spines of all those who may wish to express, on any platform including social media and newspapers, any criticism against Hakainde Hichilema.

By this one totally unchristian treatment and judgement of Andsen Zulu, magistrate Chrispine Hampungani has struck a lethal blow upon a most sacred of all rights, the right to free expression, a corollary of the right to free conscience and free thought; the very essence of the right to life.

We are alive because we think. We prove that we think by expressing our thoughts. To murder free speech is therefore to threaten human life itself. Why did the magistrate ignore the Bible by which our laws and dispensation of justice must also be tempered?

For the avoidance of doubt, the Holy Bible is rich with evidence which supports the assertion that it is impossible to be a Christian and a rich person at the same time.

Other systems of faith, morality and humane ideologies have also come to the same conclusion – that it is impossible to serve two masters at the same time, for either you will hate the one and love the other, or you will be devoted to the one and despise the other. The Holy Bible is more explicit and it bluntly says: “You cannot serve God and money”.

Andsen Zulu was not only well within his constitutional rights in a self-declared Christian nation to assert that Hakainde Hichilema who is rich, is an antichrist, but, as I must assume he himself is a Christian, it is also his duty to alert others to this fact, the fact of a rich president who certainly is headed for hell, unless he sells all that he has, and gives it all to the poor, because only then shall he have wealth in heaven; and then of course he can follow Jesus!

The law of defamation of the President is an ugly piece of our colonial legacy which every opposition leader since Kenneth Kaunda has promised to repeal when in opposition and quickly ignored this promise when in power; for it is a great lethal law to shield the President from criticism and exposure of weaknesses.

It also helps perpetuate our backward attitude to politicians who only yesterday were begging for votes and upon being elected, suddenly become removed from their origins as vote beggars and thence must be treated like loyalty in a republican democracy.

This obnoxious law facilitates the perpetuation of ignorance, fear and impotence (taken together mistaken for respect of the President) among the public of a person they have made President of the country through the ballot. It promotes sycophancy, fawning and ingratiating fake adulation of the President by his followers who are usually parasitic on this person, and it is clearly unconstitutional as it is not a law of general application and it kills democracy. It stunts the development of a vibrant democratic culture of a freely thinking and talking citizenry. In this day and age of social media, it is a useless piece of legislation incapable of consistent enforcement. It must be removed from our statutes.

This law itself, reads, “Any person who, with intent to bring the President into hatred, ridicule or contempt, publishes any defamatory or insulting matter, whether by writing, print, word of mouth or in any other manner, is guilty of an offence and is liable on conviction to imprisonment for a period not exceeding three years.” That is all. There are no definitions of the key words: intent, hatred, ridicule, contempt, defamatory or insulting. Obviously, there are English judgements a clever defence lawyer can use to argue in court; Andsen Zulu, a mere driver, had absolutely no way of knowing this.

This law is a powerful weapon for any president against real and imaginary opponents and critics, for the choirs of a reigning president, and for the police and magistrates and judges wanting to catch the eye of a reigning president: any criticism of the president can be presumed to have been uttered or published with the intent to bring the President into hatred, ridicule or contempt.
Has magistrate Chrispine Hampungani opened wide prison doors for any expression of negative thoughts about Hakainde Hichilema? Maybe not. Has Hampungani emboldened Hakainde’s zealots and choirs in and outside the police to harass anyone expressing a negative opinion against Hakainde Hichilema? Yes. Andsen Zulu could not have been a more perfect gift to these enemies of free speech and democracy.

Barely a year in office, Hakainde Hichilema and his UPND choir are fast resurrecting and inventing new ways of protecting and shielding Hakainde Hichilema from negative commentary and perfectly well-earned criticism.

The police have already defended the practice of being summoned in some remote part of Zambia, away from one’s location, to answer charges and attend court sessions. Almost a year in office, Hakainde Hichilema and his government have not produced a road map to deliver on their promises to deal with aspects of the Constitution and laws abhorrent to our Republic and its fledgling democracy. Hakainde’s government though, has not wasted time signing a Staff Level Agreement with the IMF (a very complex epoch defining matter which should have been transparent and involved the whole country, and whose full details are still a secret), amending tax for rich miners, removing VAT exemptions from newspapers and cooking oil, removing fuel and electricity subsidies, removing export duty from several food stuffs, removing import duty from agricultural equipment and machinery and creating conditions for the re-entry into Zambia by Anglo American Corporation, among other things favourable to himself and his friends both in Zambia and abroad.

It is a perfectly legitimate and fair comment to say that Hakainde Hichilema is an antiChrist, in Zambia, a country which has declared itself a Christian nation. Zambia has fast slid into a country whose future now begins to look darker than the Patriotic Front days. It is time to defend our human and constitutional rights, from the fast-creeping anti-democratic, prefeudal practices, now on full display every day.
Free Andsen Zulu from jail, he is an innocent worker! He is blessed because he is poor and his is the true kingdom of God, so says the Bible.

Arbitration Clauses

A Zambian company was sub-contracted by an international firm to do some works in Zambia. The two signed contracts in which they agreed to refer any disputes to arbitration to be held in Spain before the Spanish Court of Arbitration. Few months into contract, a dispute arose over payment and works done at the site in Zambia.

The Zambian company sued in the High Court for Zambia demanding that the case be held in Zambia because it was a Zambian dispute as well as all witnesses were in Zambia. So the convenient forum for the parties was Zambia. It further argued that the Court should approve the appointment of a Zambian Arbitrator and that it will be cheaper.

On the other hand, the international company opposed the application and emphasized that once arbitration clauses have been signed by the parties, they cannot be altered by the Courts. In other ways, arbitration clauses are binding on the parties and must be followed to the later! In this case, it was vehemently argued that Parties must adhere to the terms and refer the case to Spain.

High Court Judge Wilson Mweemba had to decide this case based on the principles of arbitration law and forum convenience.

“I agree with Mr. (Dickson) Jere’s argument that although the dispute arose in Zambia, the Parties are in Zambia and the witnesses are in Zambia, the arbitration will be held in Spain…,” said Judge Mweemba in his Ruling.

“Courts lack jurisdiction to alter arbitration agreement agreed upon and signed by the Parties,” he further said and referred the case to the Spanish Court of Arbitration.

On forum convenience being Zambia, this is what the Judge said:
“The legal doctrine of forum conveniens does not apply to arbitration since the parties choose the arbitrators to adjudicate their disputes,” Judge Mweemba said.

Always read through the arbitration clauses before signing the contract or indeed seek counsel from lawyers. Most international companies come with standard contracts whereby arbitration clauses refer the dispute to the country of origin. Pay attention – the devil is in the detail.

Corby Mayor Carried Around In Traditional Celebrations

By Dr Masimba Mavaza | Midlands Corby UK | Again history was made today when Corby town celebrated the Corby Poll Fair marking the Queens Platinum Jubilee. The sun is shining, the crowds were up with the larks and the Corby Pole Fair got under way without a hitch at 6am sharp.

The bells of St John the Baptist Church in Corby Old Village had been ringing since 5am to signal the start of the 2022 Corby Pole Fair.Hundreds of locals turned out to hear the first Charter Reading by the Parliament Stone outside the church. Rev Paul Frost – as is tradition – was given the honour of reading the Charter granted to the village in 1585 by Queen Elizabeth I.


Afterwards, Rev Frost, Zimbabwean born mayor Tafadwa Chikoto and the village’s oldest resident June Thomson were lifted aloft and carried through the streets of the village where the charter was again read outside the White Hart and in The Jamb.

The Pole Fair is a major community celebration, which took place today Friday 3rd June 2022. This date links the original granting of the Royal Charter to Corby by Queen Elizabeth I in 1585 with the Platinum Jubilee bank holiday weekend, created to celebrate the long years of service by Queen Elizabeth II.

This unique tradition comes around only every 20 years, attracting large crowds to enjoy outdoor attractions, entertainment and of course, the reading of the Royal Charter at the three entrances to the village at dawn.
There are lots of historical stories associated with the Pole Fair, from its evolution as a small Viking settlement, to the right to hold fairs granted by King Henry III in 1226, and the story of why Elizabeth I granted the Corby Charter after an accident in a bog. This year’s event was telling these stories through a variety of engaging activities, including a pageant, a living history encampment as well as Open Days at Corby Heritage Centre for visitors to explore Pole Fair archives dating back to 1902.

There are numerous other traditions that take place at every fair, including floral gateways to the old village area of Corby, a greasy pole competition and a roast ox. Previous fairs have also included markets, performances, historical re-enactments and a large fun fair.

All visitors to Corby village are also expected to pay a small toll to enter the fair on the day, or risk ending up in the village stocks! The fair was being organised by a steering group of local volunteers and cultural organisations.
The Corby Pole Fair celebrates the granting of Corby’s Royal Charter in 1585 by Queen Elizabeth I as well as celebrating Queen Elizabeth II’s Platinum Jubilee. There was a community breakfast, a picnic, music, dance, walkabout performers, a carnival parade, funfair and lots lots more!
Mayor Chikoto carried the Zimbabwean flag high as he was carried by four brave men around the Corby village to wild cheers and celebratory claps from the people.
As part of entertainment the
Academy students put on a spectacular pageant bringing to life the story of Corby’s charter.

The pupils told the tale of how Elizabeth I had an accident in woodland near Corby and was rescued by villagers. She later granted a charter to the village.

The play is from an original script by Elspeth Robb, written in 1947.

Corby is proud to have a diversity of leadership in its council.

Hon. Given Lubinda, the acting President of the main opposition party in Zambia PF has described President Hakainde Hichilema’s first nine months in office as “shambolic” in a live Round Table Interview.

Hon. Lubinda said in politics, the reason pundits judge a new government on a 90-day clock is because it is the gestation period a party worth its salt can flex its muscle and show that it is “up to the task” of governing and not job on training.

“When we assumed office in 2011 as PF under President Michael Sata we increased salaries and reduced taxes for public workers within 90 days because we knew what we were doing, the New Doom government has failed to employ people, according to its promises in ten months,” Mr. Lubinda said.

The former Justice Minister lamented that Zambians were duped by a “fast-talking” and over promising opposition that said manna would rain from heaven but has so far delivered air, the narrative must change now, as the cost-of-living skyrockets beyond the means of many ordinary Zambians that bought President Hichilema’s lie of manna from heaven.

“We recorded major strides in agriculture with a harvest of 3.5 million MT of maize as we left office but that has dropped to 2.5 million MT under the New Doom government,” said Hon. Lubinda.

While the PF left fertilizer prices at $700 per ton, Hon. Lubinda said it is sad that the same quantity now costs $1,500 supplied by a friend of the President and the party without a tender at Alpha Commodities.

“Our weakness and main failure as PF were to watch President Hichilema tell several lies and make several fake promises hoping Zambians could tell a lie from the truth but they didn’t,” Hon Lubinda said.

The long serving Kabwata legislator cautioned Zambians not to fall for a political yarn from Mr. Hichilema in future and instead listen to logic and not emotion.

Hon Lubinda warned Zambians to brace for even harder times ahead coupled with ever increasing fuel prices and the cost of basic food needs that shall not be afforded by the very Zambians that voted Mr. Hichilema in office.

“President Hichilema gave a long speech praising the late President Kenneth Kaunda and Chairman Mao Zedong over a conference center that was successfully negotiated by predecessor Edgar Lungu,” Hon. Lubinda said, “can you imagine if he was in the same room and got ignored like that the same way he was booed at the Heroes Stadium when he humbly and smoothly handed over power? Ms. Kasanda was not humane in calling the former President bitter because even I was invited but di not attend just like Mr. Hichilema snubbed national functions several times.”

Hon. Lubinda warned the praise singers of UPND that are openly gloating over the arrests, right or wrong, of PF former officials that a precedent is being set where they could dance to the same tune by another party in future once they lose power, as nothing lasts forever.

He said leadership requires forgiving like Nelson Mandela did after incarceration for 27 years and uniting his country South Africa without retribution.

“It’s now romantic for UPND to cheer when they hear a PF official has been harassed, they must know what goes around comes around,” said Hon. Lubinda.

Instead of targeting perceived political enemies, Hon Lubinda urged President Hichilema’s “New Doom” government to fix the economy, the CDF, and the “shambolic” economy dependent on “promissory notes” from the IMF.

As a short-term measure, Hon. Lubinda urged Mr. Hichilema to place the economic growth plan of Zambia into Zambian hands and not his foreign cronies, especially in the mining sector that earn Zambia little or nothing.

At K9000 per month on basic food needs for a family of six, Hon Lubinda joined the long que of those saying the “lying government” of President Hichilema shall add nothing but more suffering to many ordinary Zambians.

Clinical Officer Tells Court He Had Two Consentual Rounds With Student Nurse

Ezekiel Malambo, the clinical officer accused of raping a student nurse, has informed the court he had ‘two consentual rounds’.

Chete FM’s Christabel Chulu who is closely following the case, reports that the victim has however, told Presiding Resident Magistrate Webster Milumbe that Malambo allegedly dragged her into his bedroom where he forced himself on her.

The 19-year-old lady narrated that she was on her way to her aunt’s place from the boarding house when she recieved a call from the accused who offered a ride.

She added that Malambo asked if could drive back to his house to pick something he forgot before proceeding to her aunt.

The alleged ordeal would later take place in the house.

She explained that he later dropped her off few meters from her aunt’s place where she did not share any details of what happened earlier that day, last month.

She however, shared with colleague at the hospital the following day during attachments.

She was advised to inform the supervisor to told her to report to the police.

But Malambo, 30, argued there was no way they could have had “two rounds” if there was no consent.

During cross examination he asked the alleged victim why she didn’t shout for help while in his house or after dropping her off.

He quizzed her why she didn’t tell her aunt when she reached home or any other close relative and why she didn’t report to police since this was a serious matter.

In response, the lady who claimed to have been traumatized said her aunt has high blood pressure and had no talk time to call other relatives.

More questions and answers were coming at this point as Malambo asked why the final medical report was signed in her absence.

She said she was present when doctor took note of details on a plain paper before transferring the information on to the final document which was witnessed by her friend.

Malambo insisted she agreed to have a second round in which he didn’t use a condom although he ejaculated outside.

Trial continues on June 20 and 21, 2022 as more witnesses testify.

THE ministry of sport is frantically organising a plane to carry the Zambia national team players back home immediately after their game against Ivory Coast tonight.
This was after charterer, a Dr Belemu of Mahogany Airline went mute after being paid a full US $275,000 a couple of days before the day of departure, a service that he failed to provide.

The 120 seater plane was to carry sports minister Elvis Nkandu, his permanent secretary Kangwa Chileshe, director of sport John Zulu, FAZ general secretary Adrian Kashala, a number of government officials and supporters and journalists to Yamoussoukro where Zambia dates Cote d’ Ivoire in the AfCON qualifier match which kicks off at 21:00 hours and return immediately after the match in good time for a second match against the Comoros billed for Heroes stadium in Lusaka on Tuesday.


The plane was scheduled to depart Kenneth Kaunda International Airport on Wednesday at 20:00 hours but times kept changing until Belemu’s phone could no longer be reached from midnight till Thursday morning, leaving the travelling party in suspense and resulting in all of them spending a night in the freezing Kenneth Kaunda International Airport premises.


The visibly annoyed Nkandu and Chileshe were making all sorts of maneuvers to try and resolve the situation and were joined by President Hakainde Hichilema’s political advisor Levy Ngoma and Kashala. Later, they managed to engange Dr Belemu in a meeting at Cresta Golf View Hotel where the latter disclosed that the anticipated plane had a fault and was being worked on.


However, it was a proposal that Nkandu and his entourage outrightly rejected and asked Belemu to either refund the money or look for another plane, to which he also agreed.


Nkandu and Chileshe then took the matter into their own hands as time was desperately running out on them and made contacts and finally managed to find a much bigger 250-seater plane through Proflight which was costing only US $70,000.
Dr Belemu’s 120-seater plane was even more expensive by $180,000.


And this did not sit well with Nkandu and Chileshe who tried hard to serve the situation.
However, the government found it difficult to secure new passage for the new charter which was to be paid for using other government funds as the duo figured out that waiting for a refund or onward transmission of funds from Belemu’s to a new charterer would take longer than necessary.


On the sidelines, anger was building among Chipolopolo supporters who demanded to be fed as some of them had travelled from the Copperbelt and other areas.


Nkandu obliged and organised meals and a place for them to freshen up as the minister and his team continued engaging several charter companies and airlines, including the ZAF command to help with the passage of the team.
By 18:30 hours, it became evident that the almost six-hour trip was no longer possible and people started to disperse one by one.
“We did everything. We paid all the money at once because we didn’t want to leave gaps in the team’s preparations. We sent our officers from Cabinet Office to Ivory Coast to organise hotels, vehicles and secure the team and we wanted the team to be comfortable; to enjoy so that they don’t have pressure. And we wanted everybody including our supporters to be happy, but look at what we got from our own fellow Zambian!” complained Chileshe.


“We gave the money to the ticketing office way ahead of time.”
Chileshe said it was going to another issue if his office had not released the money.
And Nkandu said he was not happy that Belemu was not being sincere with the matter.
“You know, he should have told the truth from the beginning, and not leave us in suspense and switching off the phone; that was not good at all. And look at the price difference, this is something the President talks about every time. Anyway, I am disappointed but this is an eye-opener; this delay has revealed something and we will use the lessons going forward,” said Nkandu who did not shy away from facing supporters to explain issues at every interval during the whole debacle.


Around 19:15 hours Nkandu and his officials were still at the hotel sorting out the dilemma with alternative funding, hoping to pursue a refund next week.
Dr Beene had already left the place by press time and could not be reached for comment.

A 45-YEAR-old woman is to return to her Cassava-growing town of Mpika empty-handed after the Lusaka Boma Local Court ruled that her 22-year stay with a man she believed was her husband was a mere sleepover.

This came to light during a court hearing in which Kazhima Mafula aged 46 of Kabanana township in Lusaka had sued Mercy Machimba for divorce.

Mafula had run to the court to complain that his wife of 22 years had been preventing him from scoring in the crucial nightly fixtures of labour ward qualifiers and therefore wanted her disqualified from the institution of marriage.

Besides denying him entry in her tunnel of sweetness, Mafula also cried to the court that Mercy was also disrespectful and did not perform her wifely duties of washing for him.

However, in explaining away Mafula’s reason of dragging her to court for divorce, Mercy testified that he had only done so because she had reported him to Police after he failed to pay for the household goods which had mysteriously vanished from their matrimonial home while she was visiting her family in Mpika.

Mercy told the court she was forced to report her husband to the police because he was no longer supporting the family financially as he had married a woman in Lundazi were he would go and stay for months forgetting about her and the two children.

She said despite, complaining to his family about his behavior, her concerns went unattended to.

But acting as Video Assistance Referee (VAR) in the matter, Magistrate Bertha Zulu ruled Mafula’s attempts of securing his conjugal rights offside as he had not forked out tournament participation fee which was supposed to be paid in form dowry.

The court ruled that the couple’s union and bedroom enjoyment which resulted in the birth of two children aged 20 and 14 respectively could not be classified as marriage because Mafula had not committed to it in form dowry payment.

Magistrate Zulu dismissed the case saying the couple was merely cohabiting and therefore could go their separate ways without the court being involved.

Yul, on the other hand, said he married Judy as a second wife because he couldn’t let her go after the influence she had on his life in a nine-minute video titled, ‘Why I married a second wife,’ which he shared to his Instagram account.

According to him, he was previously of the school of thought that no man can love two women at the same time until he fell into the same circumstance and found out that it is possible.

He said;

I am one of those people who believed it before. I know alot of people believe it as well that a man cannot love two women. I used to believe it as well until it happened to me. European football governing body, UEFA has apologised to Liverpool and Real Madrid fans after they were caught up in events that happened during the Champions League final

According to Liverpool fans, they experienced heavy-handed policing, organisational chaos and overcrowding at last Saturday’s showpiece game in Paris.

French authorities and UEFA had blamed late arrivals and fake tickets for chaotic scenes outside the Stade de France, which caused the match to be delayed by more than half an hour.

While Police used tear gas and pepper spray on some fans it also emerged that supporters were targeted by local gangs.

“No football fan should be put in that situation, and it must not happen again,” said a Uefa statement on Friday, June 3

“Uefa wishes to sincerely apologise to all spectators who had to experience or witness frightening and distressing events in the build-up to the Uefa Champions League final at the Stade de France on 28 May 2022 in Paris, on a night which should have been a celebration of European club football.”

French president, Emmanuel Macron said ticket holders who were blocked from entering the stadium by security staff must be reimbursed “as fast as possible”.

Macron said: “I have a thought for the families who have been pushed around, who have not been able to access the seats they had paid for.

“I have asked the government to clarify what happened, to determine the responsibilities and to explain them in detail to our compatriots, the British and the Spanish.

Liverpool legend Sir Kenny Dalglish said the apology was “a start” but added: “There is still a long way to go.

“This apology doesn’t cover the false message about the late kick off, events at the fan park, or what happened in the aftermath.”

Earlier on Friday, Real Madrid has issued a statement asking for answers about “unfortunate events” which occured at the game, which the Spanish team won 1-0.

The club also asked why the Stade de France was chosen for the game and who was “responsible for leaving the fans abandoned and defenceless”.

“Football has transmitted an image to the world which is far away from the values and goals which it should pursue,” said the statement.

Real Madrid cited “unfortunate events” which took place “in the surroundings of and at access points to the Stade de France, and even inside the stadium itself” and added their fans “fell victim to said events”.

They added: “We would like to know the reasons which led to this venue being chosen to host the final and the criteria used, taking into account the experiences of the day.

“Furthermore, we call for answers and explanations in order to determine those responsible for leaving the fans abandoned and defenceless. Fans who in general terms showed exemplary conduct at all times.

The report recently done by Prof. Oliver Saasa and Shebo Nalishebo entitled ‘Evaluation of Economic Impact of Planned First Quantum Minerals Investments in Zambia’, takes a wide-angled view to examine the macro-economic effects of two of First Quantum Minerals’ (FQM’s) newly-announced investments: a $1.25 billion investment into the expansion of Kansanshi mine’s operations, and a $100 million investment to bring the miner’s $250 million Enterprise nickel project online in Kalumbila.

FQM runs Kansanshi Copper Mine in Solwezi and Kalumbila( Sentinel Copper Mine) in Kalumbila District.

Reading the Report, gives you an impression that this is material for public relations and not an analytical and independent evaluation of the planned investment.

I think this is so because this was commissioned by First Quantum Minerals!

Look at previous good, objective and fair analytical reports that have been done on the issue.

“For Whom the Wind falls-Winners and Losers in the Privatisation of Zambia’s Copper Mine” is a good example.

This Report examined in a wholesome manner the lack of adequate regulation, the unfair and exploitative Mining Agreements, the pension poverty, the casualisation of workers, the exploitative, the lack of both business and social benefits to the community and local economy.

The report also revealed deep-seated fraudulent tax schemes that mine houses engage in, the unnecessary expatriate staff and new money and new profits for the owners.

But Prof. Saasa’s Report discusses no negatives or critical matter but hypes up the proposed investment and benefits that will allegedly accrue to government and the community.

FQM intends to embark on two projects; Kansanshi Expansion Project and Kansanshi Nickel Project.

Kansanshi Expansion Project is designed to extend the life of the mine and boost production from 200,000 tonnes per year to 335,000 tonnes.

The project will also increase Gold production from the current 125,000 ounces a year to 160,000 by 2030.

On the other hand, the Enterprise Nickle Project is projected to produce 36,000 metric tonnes of nickel per year.

The report sends the reader in wild speculation on how this investment, largely capital investment in machinery and equipment will yield community benefits in job creation of about 500-800 and “multiplier effect” that may benefit upto 10,000 people.

FQM prides itself as the largest single tax payer in the country and says it contributed $1.258 billion in public ontributions in 2021.

This amount is made up of taxes ($368m in income taxes) royalties ($386m), duties and fees paid to national and local government, dividends to ZCCM-IH as well as the company’s social and infrastructure expenditure in North-Western Province.

Prof. Oliver Saasa’s Report also raised issues of Conflict of Interest as he was announced as leading an economic advisory unit to President Hakainde Hichilema.

On 15th December 2021 President Hakainde Hichilema announced that he had appointed renowned economist and commentator, Prof. Oliver Saasa as new Chairperson of a new advisory council.

“As part of our vision for growth in Zambia we have asked the eminent Professor Oliver Saasa to chair a New Advisory Council, which will help us to systematically break down the barriers to doing business in our country.” President Hichilema announced.

But in his letter responding to charges of conflict of interest to the Transparency International-Zambia, Prof. Saasa says such a Council doesn’t exist and he has not been appointed to any economic or government unit.

He also said he is not aware of any person appointed to such a steering committee.

This debacle exposes State House as President Hichilema appointed and announced a Chairperson to a non-existent entity as seen by the details of Prof Saasa’s robust response. This has made the Advisory Council a fictitious creation.

On Mining, clearly the current model doesn’t benefit Zambia, as the country benefits little or nothing from such an important sector. Even the numbers announced by FQM may need lose scrutiny.

We require a more fundamental, more beneficial or deeper policy on mining.

I Never Earned My Wealth Through a Ministerial Position-Joe Malanji

Former Foreign Affairs Minister Joseph Malanji has said he never earned his wealth through a ministerial position.

Mr. Malanji has further declared that he was still a Kwacha Member of Parliament.

He is currently battling corruption and money laundering cases after being arrested by the Drug Enforcement Commission (DEC).

Late last year, Mr. Malanji was charged for alleged corruption activities which happened between January 1st, 2021, and August 31, 2021.

DEC in March, 2022, further arrested Mr. Malanji for money laundering activities involving K10 million and US 700,000 Dollars.

Speaking during the burial of Patriotic Front (PF) Kitwe District Secretary Lungo Kawaya in Kitwe on Thursday, Mr. Malanji said he has been doing business for many years.

He revealed that before becoming minister he had $4,000,000 turnover through his companies.

Mr. Malanji started his remarks by paying tribute to Mr. Kawaya before highlighting his cases.

“I have lost a friend. I have lost a brother. I have lost a cousin. I have lost all relationships that you would consider valid in this person we are burying today. It will be very painful today to go and rub his number in my phone. He is somebody I spoke to everyday. My wife at times would even ask namulanda na ba Lungo? I religiously spoke to him every evening. He displayed courage. He displayed courage as he rendered that service to the people. He is somebody who had organisational ability, you give him an hour to organize the programme he would do that. So he meritoriously rose to the portfolio that he was serving until his death. What I would urge those that have remained behind, the family members, the friends is now to look at what we are going to do with those that he has left. He saluted people that have been sending him solidarity messages.

Mr. Malanji further assured the people of Kwacha Constituency that he will one day return to work with them like before.

Mr Malanji is challenging High Court judge Kazimbe Chenda’s decision to annul his election on grounds that he does not have a Grade 12 certificate.

Losing Kwacha parliamentary candidate Charles Mulenga has asked the Constitutional Court to dismiss incumbent Mr. Malanji’s appeal against the High Court’s decision to nullify his election because the plea allegedly lacks merit.

Court rejects Lusambo’s quest to cite Anderson Banda for contempt

THE Economic and Financial Crimes Court has thrown out an application by Kabushi PF member of parliament Bowman Lusambo to cite Lusaka Province UPND national youth chairperson Anderson Banda for contempt of court for making threats against his life and that of his wife.
Magistrate Faidess Hamaundu declined to commit Banda to prison for allegedly interfering with proceedings on the basis that the alleged contempt was not made in the face of the court.


This is in a matter where Lusambo is facing 10 corruption-related charges; among them one count of corrupt acquisition of public property, five counts of possessing property suspected to be proceeds of crime, three counts of tax evasion, and one count of conspiracy to defraud.
He is jointly charged with his wife Nancy Manase for possessing four houses in Silverest Gardens, Chongwe which were suspected to be proceeds of crime.


At the last sitting, Lusambo’s lawyer Makebi Zulu submitted that on May 20 Banda who led a horde of UPND cadres planned to attack the accused and his colleague Raphael Nakacinda.


He claimed that individuals who had accompanied Lusambo were victimised and the accused eluded the cadres using the subway leading to the holding cells, and was later whisked away by police officers using anti-riot vehicles.
ACC prosecutors Martin Mayembe and Daniel Ngwira said the alleged contempt was made outside the face of the court and that such type of contempt could not be dealt with as it did not require summary proceedings.
In her ruling, magistrate Hamaundu said it was the duty of the court to protect accused persons and officers of the court from any harm or interferences.


She said contempt was divided into acts; contempt committed in the face of the court itself in facial curia, and acts committed outside court ex-facial curia and that they were all considered as unseemingly behaviour.
“There are two ways in which contempt of court can be dealt with; by instituting summary procedure where the court considers the matter as part of the proceedings in which the contempt occurred or by way of complaint and charge before another magistrate,” magistrate Hamaundu said. “Summary proceedings of contempt of court can be instituted if the contempt was conducted in face of the court which is not the case in this matter.”
She ruled that the summary procedure applied for by Zulu could not be applied by the court as the alleged contempt was not committed in her presence.
“At common law, every charge of the court of record has power to immediately commit the contempt committed in its presence but the power of an inferior court to commit the contempt committed out of court, a Magistrate’s Court being the court of record has its inherent jurisdiction to punish a contemnor for contempt committed in the face of the court,” she said. “In view of the fact that the said contempt was not committed in the face of the court to attract summary proceedings, the only procedure available to the accused is by way of a complaint and a charge and trial before another magistrate.”


Magistrate Hamaundu said where a complaint and a charge of contempt proceedings was instituted, she had no jurisdiction to determine such a case unless it had been allocated to her by the chief resident magistrate.
“The application to cite Banda for contempt is therefore denied,” said magistrate Hamaundu.
The State further opposed an application by Lusambo’s lawyer Nkhula Botha to raise a preliminary issue relating to housekeeping at the next sitting.


Ngwira and Mayembe said under special courts matters were not driven by lawyers but by the courts.
They submitted that the defence was deliberately making applications to frustrate the court, which was an abuse of court proceedings as the court guided that the defence raised their issues at once.


“The other application they intended to make was abandoned. It is shocking for the defence to state that they want to make another application. We shall not dance to the tune of the defence to allow any frivolous application,” said Mayembe. “If they intend to make an application, the time is now. We have brought witnesses on different dates at a cost and public funds have been spent. Without courtesy of informing us that they intend to make an application so that we do not bring witnesses, we were caught by surprise with their application. The defence slept on their rights to make their application.”
Botha later suggested that the parties proceed to agree on trial dates.
Trial commences on July 12.

Is Cornelius Mweetwa saying that his personal friends and relatives are missing on the list therefore it should be recalled?- Antonio Mwanza

QUESTION…

Southern Provincial Minister, Cornelius Mweetwa says his list is not part of those being recruited as teachers and health workers and he suspects the people shortlisted are not “local”. He says his Administration did NOT participate in the recruitment process and wants the list recalled and process to start afresh.

I have some questions for Comrade Mweetwa;

The people who applied to be recruited as teachers were not asked to submit PROOF OF RESIDENCE to prove that they were indeed residents/locals residing in the places they applied from, so how does Hon Cornelius Mweetwa know that the list of those who have been shortlisted are not residents or locals of Southern Province in the absence of proof of residence to show and prove that indeed they reside in Southern Province?

Was he using tribe or surnames to identify who is a local or not?

Does he realise that Zambians of all tribes and names are residents or locals everywhere and not just in the provinces they originally come from?

What is Mweetwa really trying to say, that only people with surnames from his Province must be recruited in his Province?

What really makes one to be called a local, is it because they reside in that particular locality or it is because they bear a surname or belong to a tribe from that particular province?

Where was Comrade Mweetwa all this time to bring the issue today when the names of the successful candidates are about to be published?

Is this a gimmick to delay the recruitment process or what?

Whose job is it to recruit teachers, is it the Minister or the Teaching Service Commission?

Why is the Minister, a politician with no authority to deal with teacher recruitment being the one to choose who should and who should not be recruited?

Is the Minister saying that his personal friends and relatives are missing on the list therefore it should be recalled?

Forbes’ Chase Peterson-Withorn reported on Thursday, June 2, that James’ net worth surpassed the $1 billion mark after he earned $121.2 million in 2021.

According to Forbes, James is the highest-paid active player in the NBA, having earned more than $385 million in total salary from the Cleveland Cavaliers, Miami Heat, and Los Angeles Lakers. The bulk of his worth comes via endorsements and business ventures totaling more than $900 million, including a lifetime deal with Nike that pays him tens of millions per year.

The four-time NBA champion was the second-highest paid athlete in 2021 behind soccer star Lionel Messi, earning $41.2 million from the Lakers and $80 million in off-the-court ventures.

Harry Kalaba, the former Minister of Foreign Affairs has expressed shock at hateful remarks Information Minister Chushi Kasanda has made referring to the former President of Zambia H.E Edgar Lungu as a “bitter” man.


Kasanda, notorious for making “ill-informed bad taste public statements” blurted the “bitter” words in a local newspaper following the absence of President Lungu at the launch of the Kenneth Kaunda Wing adjacent to the Mulungushi International Conference Centre built by the People´s Republic of China under the supervision of President Lungu.
The “bitter remarks” have sparked a sour reaction from scores of Zambians of diverse backgrounds that feel President Lungu is being spited maliciously by the President Hakainde Hichilema administration.


Mr Kalaba, a former legislator, Minister and now opposition leader advised Kasanda to remember that “President Edgar Lungu showed a rare kind of magnanimity when he handed over power and he must be respected for that instead of being called bitter its wrong.”
Mr Kalaba said, “the ones that are bitter in this case are the UPND and its Lumbani Madoda (praise singers) who keep referring to President Lungu. Give Mr Lungu a break, he handed over power gracefully.”


Mr Kalaba also frowned upon the Hichilema administrations insatiable appetite to be “praised and worshipped” when they have done nothing worth being praised for.
He said President Lungu reserved a right to choose what function to attend or not.

LGBTQ TAKE BY HARRY KALABA

Mr Kalaba took a swipe at the Scandinavian countries, Sweden and Finland that recently breached the Vienna Convention by flying LGBTQ flags at their embassies in show of support for gay rights that are illegal in Zambia.
Mr Kalaba expressed disappointment that the Ministry of Foreign Affairs of Zambia up to now has failed to respond to a query from his party that sought an official response regarding the obvious breach of diplomatic etiquette.


Mr Kalaba also challenged the Hichilema government to publish the MoU it signed with the US government to establish an AFRICOM office on Zambia because Hichilema´s loud silence on the MoU just fuels speculation.


Ms Kasanda has now earned an infamous tag of putting her foot in her mouth every time she opens it, with the latest gaffe being when she disrespected President Lungu and disrespectfully called him bitter.

POLICE IN KABWE HAVE CHARGED AND ARRESTED TEN SUSPECTS FOR THE OFFENCES OF MURDER, BURGLARY AND THEFT

Police in Kabwe have formally Charged and Arrested Ten Suspects for the offences of two counts of Murder, Five Counts of Burglary and theft, Six counts of Aggravated Robbery and Twenty two counts of Breaking into a Building and committing a felony there in.

This was after police on May 13, 2022 at Bwacha Police received a report of Murder and Aggravated Robbery from M/Leonard Mwanamuke, aged 49 of House number C1150, Bwacha in Kabwe who reported that M/James Kamukwamba, aged 72, a Security Guard of Nakoli Compound was found murdered at Tedcas Shopping Complex in Bwacha. He further reported that five Bonanza Machines were stolen and later abandoned at a nearby Stadium.

Police immediately instituted intelligence led investigations and apprehended two suspects. Upon interviewing the two suspects, they admitted having committed the offences. They later led the Police to eight other suspects making the total number of suspects to be ten namely:
1. Maxwell Chimwasu aged 34 unmarked, house number Mine Compound Kabwe.
2. Teddy Kafula aged 21 of Nakoli Compound Kabwe.
3. A Male Juvenile aged 17 of Nakoli Compound Kabwe.
4. A Male Juvenile aged 17 of Nakoli Compound Kabwe.
5. lnnocent Mabeza aged 32 of Kawama Compound Kabwe.
6. Crispin Mwango aged 37 of Lilanda Compound Lusaka.
7. Kegan Mwape aged 22 of Chinanimani Kabwe.
8. Timothy Cheelo aged 21 of Overspill Kabwe.
9. Asan Sampa aged 22 of Mukobeko area Kabwe.
10. Leonard Lungu aged 20 of Nakoli kabwe.
After further interviews, the ten suspects admitted having committed the following crimes:

UPND Members do not look happy despite winning the 2021 General Elections- Davies Mwila

Former Patriotic Front (PF) Secretary General Davies Mwila has said members of ruling United Party for National Development (UPND) do not look happy despite winning the 2021 General Elections.

Mr. Mwila said it is the vanquished PF members who appear happy and united despite losing elections.

The former Chipili Member of Parliament said PF members have even become fat after the election loss.

Mr. Mwila was speaking during the burial of PF Kitwe District Secretary Lungo Kawaya at the Kitwe Memorial Park on Thursday afternoon.

Mr. Kawaya, 44, died on 29th May, 2022 at Kitwe Teaching Hospital after an illness.

In his remarks during burial, Mr Mwila paid tribute to Mr. Kawaya, a staunch PF official.

Present during burial was Mr. Kawaya’s close friend Thabo Kawana, the Ministry of Information and Media – Director.

Mr. Mwila told PF members to support the bereaved wife and children.

“Fwebali close kuli Lungo let us help the family. In any way possible let us help Lungo’s family. Once Lungo’s family is helped people will appreciate that belonging to PF is a good thing. Ififine nga twashika Lungo bonse tupasangane tubutuke abantu they will not appreciate us. This young man was good. I used to call him Lungo Malanji because he was close to Malanji. Ba Malanji nabo baleaba abati no ni Lungo Mwila so twalelwishanya but naishibe ati ni Lungo Malanji.Let us do something for this young man as a party. Elyo twalisashika Mwanga Sata, elyo twashika Chile One, nomba twaiisashika na umwaice wesu Lungo,” Mr. Mwila said.

Mr. Mwila said in his dreams he wonders why the UPND do not look happy after forming government.

He said PF members appear as if they are the ones governing.

PF you look united as if you are the ones ruling. Sometimes when I am asleep I tell myself that maybe they stole our votes because the winners (UPND) do not appear happy. Other mourners included former Foreign Affairs Minister Joseph Malanji, PF Copperbelt Provincial Chairman Nathan Chanda, former Nkana MP Alexander Chiteme, PF National Women Chairperso Kampamba Mulenga, PF National Youth Chairman Christopher Kang’ombe, Chishimba Kambwili and former Kwacha MP Boniface Mutale.

Meanwhile, Mr. Kawana paid a moving tribute to Mr.Kawaya earlier during Church service.

“The good die young indeed. Over the years, we rode together, played together, worshipped together and shared moments together. We cried, argued, laughed and went through our high and low moments together. No matter what life threw at me, I always knew I had a friend and brother to turn to and to share my high and low moments with.Politically, we always stood on different stand views. He was PF all his political life, he believed and held strong in PF in opposition, in office and in opposition again. This never affected our bond at all, infact, it strengthened our bond as we could argue and laugh at our leaders and political views we held different as it where. Rest in peace my dear friend and brother Lungo Kawaya (Bashi Muzo). Go well until we meet again, you have run your race well and you have been good and faithful through it all,” wrote in his earlier tribute.

HoneyBee Court Case kicks Boiling Point As the State seeks an order for Refund of whatever Ngwee was paid to Honeybee

Honeybee contract was procured through fraud, corruption – State

THE State has charged that the contract entered into between Honeybee Pharmacy Limited and the PF regime was procured through fraud, incompetence, illegality, corruption and abuse of office.

It said the parties entered into the purported contract on November 22, 2019 and yet Honeybee Pharmacy was only incorporated on April 2, 2020.

The office of the Attorney General further indicated that the pharmaceutical company is not entitled to the US$17 million it is demanding as the goods it supplied were expired and it was communicated to, to fetch the goods from the warehouse after they were rejected.

Honeybee Pharmacy Limited has sued the State in the Lusaka High Court, demanding payment of $17,958,150 for the ‘defective’ drugs, condoms and gloves which it supplied to the Ministry of Health two years ago.

Honeybee wants the court to compel government to pay it $4,998,375 for the 500 medical kits it supplied under contract No. MOH/SP/032/19-02 and in the alternative for specific performance of the same contract.

In its statement of claim, Honeybee said in November 2019 it entered into a written agreement with the Ministry of Health for the supply of 22,500 health center kits under contract No. MOH/SP/032/19-02 which was approved by government and endorsed by Honeybee and the Ministry of Health on behalf of Zambians.

It said the contract was worth $17,958,150 for the supply of various medical kits and related products as requested by the State through the Ministry of Health

Honeybee said between August 2019 and December 2020, it supplied the State with 500 medical kits out of the required number and they were all subjected to examination, inspection and verification and a certificate of acceptance of goods under various invoices were issued and various delivery notes valued at $3,990,700 at the time of delivery.

“It was an express term of contract that payment shall be made promptly and expeditiously or shall not exceed 60 days from the date of submission of an invoice or claim by the plaintiff,” Honeybee said.
“Despite the contract providing for part payment of the sums due, the plaintiff used their own funds to supply the kits and are now seeking full payment.”

Honeybee said several reminders have been made by its lawyers Tutwa Ngulube and Company to the Ministry of Health but they have been ignored without advancing a reason for failure to pay as there was an express term of the contract which provided for interest on the delayed payment.

And according to its intended defence sworn by Josiah Simachela, a chief State advocate in the Attorney General’s chambers, the State said the goods supplied were not salable.

“The supplied medicines were not in accordance with the technical specifications and standards prescribed by the contract,” Simachela said.

In its intended counter claim, the State said it discovered that the plaintiff had no capacity to enter into the contract in issue purportedly signed on November 22, 2019 as the plainiff was not yet incorporated at the time.

“By Section 89( 1)(a) of the Public Procurement Act No. 8 of 2020, a bidder is eligible to participate in a procurement if the bidder has the legal capacity to enter into a contract. Contrary to the provisions of the law, the plainiff entered into the purported contract on November 22, 2019 and yet the plainiff was only incorporated in April 2, 2020,” he said.
“By Section 90(4) of the Public Procurement Act, No. 8 of 2020, qualification of a bidder shall be assessed by examining whether the bidder meets the qualifications criteria.
The Ministry of Health in collusion with the procurement entity ignored the assessment and proceeded to award a non-existing entity at the time with a contract.”

Simachela said the contracting of Honeybee was fraudulent and it has been reported to the Drug Enforcement Commission and the Anti-Corruption Commission.

The State wants the court to nullify the contract of November 22, 2019 it entered into with Honeybee and the purported agreement for payment of the pre-clearance fee.

It is also seeking an order for reimbursement of whatever sum or any paid, received by Honeybee in respect of the impuned contract.

It’s hypocritical and outright childish for Hon. Chushi Kasanda to accuse Dr Lungu of being bitter for shunning the commissioning of the Kenneth Kaunda Wing of Mulungushi International Conference Centre by President Hakainde Hichilema on Tuesday.


The PF is aware of the motive of inviting Dr Lungu to the event. The government and the horde of political cadres it had mobilised wanted to embarrass the former President as they have done in the past, but he was smarter than them.
We know that President Hichilema would have read his whole speech without mentioning the man who had travelled to China and clinched the project on behalf of the people of Zambia.


President Lungu would have just been sitting there as a nobody without being acknowledged as was the case during the funeral of former President Rupiah Bwezani Banda recently.


It would have been very embarrassing for President Lungu to sit there while President Hichilema delivered a tirade accusing his administration of corruption and being a clique of thieves.


It would also have been inappropriate for Dr Lungu to attend the highly politicised function only to hear that Investigative wings had raised the home of one of the members of his family or of of his former aides the next day.


We would like to remind our flamboyant Minister of Information and Media that she is the chief spokesperson for the government of the Republic of Zambia, and not for the United Party for National Development (UPND). Her statements should therefore be sober and measured. She is behaving like a ward level cadre.


It’s laughable for her to claim that the PF did nothing when her own President went to commission a project the former ruling party initiated and left at near-completion level.


The minister should refrain from competing with the UPND secretariate in issuing demeaning and offensive statements targeting the former President and his administration.


President Lungu will not stoop low by allowing himself to be embarrassed in public by those who do not even have the shame to proudly commission the projects he initiated without mentioning his name.


Chushi Kasanda should tame her excitement because Zambians have not forgotten how President Hichilema shunned all the national functions officiated by Dr Lungu when he was in the opposition.


They have also not forgotten how President Hichilema refused to acknowledge and respect President Lungu, whom he disrespectfully called Mr Lungu for his whole five-year term of office.


But Dr Lungu called Mr Hichilema “Mr President” after the latter had won the Presidential election even before he was sworn in.
Let her and her president leave our former President alone and concentrate on defending the lies they told Zambians during campaign s towards the August 2022 general elections.

STATEMENT ON THE OFFICIAL VISIT TO THE KINGDOM OF ESWATINI BY MR. HAKAINDE HICHILEMA, PRESIDENT OF THE REPUBLIC OF ZAMBIA

The Ministry of Foreign Affairs and International Cooperation wishes to inform the Nation that Mr. Hakainde Hichilema, President of the Republic of Zambia will undertake an Official Visit to the Kingdom of Eswatini, at the invitation of His Majesty King Mswati III, from 3rd to 5th June, 2022.

President Hichilema and King Mswati III are scheduled to hold bilateral talks where discussions will focus on matters of mutual interest at bilateral, regional and international levels.

During the visit, the two leaders are expected to preside over the signing of the joint Memoranda of Understanding (MoUs) in the area of Tourism as well as the Establishment of a Political Consultation Mechanism between Zambia and Eswatini. The MoUs will further strengthen cooperation and contribute to the development of various sectors of the economies in the two countries.

Zambia and Eswatini share cordial bilateral relations anchored on historical ties and mutual respect. The two countries have continued to strengthen bilateral relations through the exchange of high-level visits as well as the establishment of the Joint Permanent Commission of Cooperation.

President Hichilema has emphasized the importance of promoting intra African trade and collaboration for beneficial economic and social development among countries on the continent. Zambia remains committed to fulfilling the agenda of common development aspirations by maintaining open and cordial relations through pragmatic cooperation with Eswatini, for mutual benefit.

The Kingdom of Eswatini presents itself as a viable partner in various fields of economic and social interests such as Tourism, Culture, Trade and Agriculture. This visit by the President will, therefore, provide an opportunity to share best practices in areas earmarked for progress, and it is in line with the Government’s approach to placing great value on working openly and collaboratively with a range of partners to unlock new opportunities for the country and its citizens.

UNITED Party for National Development (UPND) deputy national chairperson Andrew Banda has defended President Hakainde Hichilema against attacks from Socialist Party leader Fred M’membe, who has accused the head of State of being a puppet of the West.
Mr. Banda, who served in the foreign mission under late presidents Frederick Chiluba, Levy Mwanawasa and Rupiah Banda, says Dr M’membe has a history of disparaging Zambian presidents as well as the UPND, starting with its founding leader Anderson Mazoka
“I will not go into details about Rupiah Banda for reasons best known,” he said. “[But] it is not that Zambians don’t know. You see, the problem with my brother [Fred M’membe] is that in 1991, he President Kaunda – you could have been young then – a tin pot dictator, and then came in Chiluba, whom he campaigned for at first and was close friends with, but [he] turned around and called him something else [a thief].

He then turned to Levy, who he ended up calling a cabbage, and as Zambians we all know what great job Levy eventually did in the fight against corruption and [revamping the economy]” Mr. Banda has taken great exception to Dr. M’membe calling President Hichilema a puppet of the West. “President Hakainde Hichilema is not a puppet as he was voted into power by Zambians, even though others may not believe that he is republican President,” he said. “President Hichilema was voted into power by some 2.8 million people and they must be respected by those in opposition and those who may hate this man. “Others have said this man is a dealer and is a puppet, and if he is a puppet, then who is a leader? Is Fred himself a leader? And if HH is a puppet, who is Fred, a puppet of himself?” The Mast recently quoted Dr. M’membe, who has taken umbrage to the United States Africa Command opening up an office of security operation at the US Embassy, saying imperialists are planting puppets all over and are very much alive in Zambia. He said Zambia is under the imperialists’ onslaught who are after the country’s resources. Dr. M’membe said: “Leaders today who are more satisfied with just getting commissions and a few shares in the deals they strike with the Oppenheimers, thinking they are leaders when they are nothing but puppets who are not even good for their own Bantustans.” But Mr Banda said Dr. M’membe’s record is there to show how he has behaved towards the country’s leaders as well as the late Mr. Mazoka, whom he tormented throughout his ill health and unfortunate death.

He said Dr. M’membe has now moved to attacking President Hichilema, whom, even while in opposition, he tormented with many labels and accusations. “If indeed President Hichilema is a puppet, a tribalist and not a leader, if President Hichilema is all those things, why did Zambians vote for him?” he asked. “It is clear that Dr. M’membe believes nobody should be there [in power] except himself [Dr. M’membe]. “The way forward for me is: criticise this government on the issues of the economy with facts and reasonable fairness. If they don’t give hope, say so. These are the real checks and balances. But to get persistently personal is not right, and actually reflects low calibre on those who are attacking and it is not good for our country.“ If Dr. M’membe becomes President in 2086 or thereafter, then Zambians will also accord him the respect deserving a head of state. “The new dawn administration is going through a difficult period because the coffers were found empty as a result of the previous people who were in government, but the evidence of the upright approach to governance of the country, including focus on the poor, is there, particularly when you see the CDF policy direction which has taken financial resources to the doorsteps of all citizens in all corners of the country.” Mr. Banda said stating that Mr. Hichilema is not a leader is an insult to the 2.8 million Zambians who voted for him. “It means they voted for a puppet,” he said. “The unfortunate part is that those who don’t like Hakainde, like Fred M’membe, will live with him for five years. The contact between Zambians [and President Hichilema] is five years, whether they like it or not. “It has taken 23 years for the UPND to come into power and 15 years for Mr Hichilema to become President.” To judge our leader in nine months at this negative rate and speed is a bit unfair.

Mr. Banda said Dr. M’membe should stop misleading young people with the “failed” ideology of socialism. He says many young people never lived under socialism and may not appreciate its negative effects. “The ideology of socialism Fred M’membe’s party is propagating failed lamentably in USSR, let alone in Zambia and Zimbabwe. How does he expect the same system of government to work now 30 years after its demise?” he asked. “Even China, the second biggest economy in the world, has discarded socialism with a mixed economy, [then] Zambia should experiment with failed ideologies?”“

American singer, Keke Wyatt, 40, has added another child to her ever-expanding brood.

Bill Cosby accused of sexually assaulting teen in 1970s as civil trial begins in California

Bill Cosby’s latest sex assault civil trial kicked off on Wednesday, June 1, following a Los Angeles woman’s 2014 lawsuit claiming the comedian molested her when she was a teenager in the 1970s.

Judy Huth, 64, sued Cosby alleging that the former actor brought her to the Playboy Mansion and forced her to perform a sex act around 1975, when she was 16.

She is seeking unspecified damages for sexual battery and emotional distress.

In her lawsuit, Huth said she and a friend met Cosby at a film set at a park. She said Cosby invited the girls to meet him the following week, when he made Huth drink beer and molested her on a bed at the Los Angeles mansion.

The former actor will not attend the Santa Monica trial. Cosby’s attorney, Jennifer Bonjean, said, ‘We are confident that the evidence will discredit Plaintiff´s 50-year-old allegation.’

Another lawyer for Cosby confirmed he would not be present on Wednesday. His representatives say glaucoma has left him blind and made travel too difficult.

Gloria Allred, who represents Huth and has also handled several Jeffrey Epstein’s victims, said her client will not comment on the case.

Cosby, 84, is best known for his role as the lovable husband and father in the 1980s television comedy series ‘The Cosby Show,’ earning him the nickname ‘America’s Dad.’

His reputation was damaged after more than 50 women accused him of multiple sexual assaults over nearly five decades.

The trial is one of the last cases Cosby faces after a Pennsylvania appeals court threw out his criminal sexual assault conviction and freed him from prison 11 months ago. Several other lawsuits alleging sexual misconduct were settled by his insurer against his will.

Cosby will not testify after the judge ruled that he could assert his Fifth Amendment privilege against self-incrimination. And he has no plans to leave his Pennsylvania home to attend the trial.

Huth says she suffered ‘psychological damage and mental anguish’ as a result of the alleged assault. She is one of the dozens of women who have said they suffered sexual assault at Cosby’s hands.

Huth claims she met Cosby on the set for the movie ‘Let’s Do It Again’ in San Marino, California, and days later was invited to his tennis club, along with her friend Donna Samuelson.

There, she says, he gave her alcohol and took her and her friend to the Playboy Mansion, where he forced her to perform a sex act.

The original complaint in the case accuses Cosby of ‘putting his hand down [Huth’s] pants, and then taking her hand in his hand and performing a sex act on himself without consent.’

According to court documents, Huth alleges that Cosby told her and her friend to say that they were 19 if asked by staff at the mansion.

Cosby has denied her version of events. His defense team jumped upon the fact that Huth’s original version of events said that the assault occurred in 1974. Later, Huth said it occurred in 1975.

The judge in the case allowed Cosby’s legal team to depose Huth and Samuelson for a second time on May 23.

Andrew Wyatt, a spokesman for Cosby, has accused Huth of ‘inconsistent statements since the inception of filing this civil suit against Mr. Cosby.’

The state of California passed a new law in 2020 that extended the statute of limitations in civil court for victims of sexual assault.

This lawsuit is one of the last remaining open suits against Cosby. The star of ‘The Cosby Show’ has settled many of the claims against him.

Victoria Valentino, who claims that Cosby raped her in 1969, said of Huth’s lawsuit: ‘I think that Judy’s trial may be our last stand for justice and seeing accountability come to fruition in our stand against Bill Cosby,’ The New York Times reported.

Cosby team will establish Cosby’s whereabouts in 1974, around the time when Huth said that she met Cosby, and not 1975.

Huth and her friend do not appear in the Playboy Mansion’s logs in 1974, according to The New York Times.

While the judge in the lawsuit has ordered Playboy to produce lists of employees from that time period in order to see if any could back up either side’s contentions. The New York Post reports that Playboy has complied with the judge’s orders.

The comedian’s team says that Cosby doesn’t deny having met Huth, there is photo evidence showing the two together. They maintain that Cosby didn’t know that she was underage.

The trial is expected to last around two weeks.

With all the many policy issues that require clarifications, the Chief Government Spokes Person could only accuse President LUNGU of bitterness.

Now, that is really shallow. I am sorry to say.

Look, there is a lot of bitterness in the country right now. I have no doubt in my mind.

But obviously the bitter ones are those YOUTHS and other ZAMBIANS who were promised JOBS, LOWER COST OF FOOD AND BUSINESS OPPORTUNITIES but are getting the complete opposite. That is no jobs, higher cost of food and no business opportunities.

Look Hon Kasanda. Launching a Government project by a sitting head of state is not a NATIONAL EVENT. It is a routine, day to day operation of the president.

Meaning that inviting a former head of state to a day to day work work of the current head of state is what should be enquired into.

What is the motive?

If indeed the state invited President Lungu, he did the state a favor by not attending. How can the state elevate commissioning a project so as to make it a national event?

Be serious my dear Hon Chushi Kasanda. Your role is an important one.

If I were in your shoes, I could be talking about Governance issues. These might include:

(1) Clarifying CDF bottlenecks.
(2) Clarifying non employment of trained teachers who are above 45 years.
(3) Clarifying perceived UPND support for gay rights.
(4) Failure to reduce the cost of fuel and foodstuffs but increasing them.
(5) Clarifying free education.
(6) Clarifying the emerging perception of replacing market and bus stop cadres with blue and white collar cadres in line with one MPs proclamation that 98% of public workers are Pf cadres and should be removed.

I think you have a lot of work.

In fact President Lungu’s fantastic relationship with China gave birth to that project which was being launched in what the state thought was a national event. Recognize him for that. It would be civil to do so.

I am disappointed. But since UPND is disappointing in fronts, I guess I need to unfortunately get used.

To illustrate your humility, I remember as we traversed the country in a helicopter, lobbying citizens for their permission to lead them, with Chakawa sharing buns for energy, you told me about the uselessness/redundancy of owning three or four pairs of shoes at a time, as you explained the Law of Diminishing Returns to me.
Retain that spirit, my man. Remain humble.

This spirit within you is the required instrument for your addressing the debilitating income inequalities in Zambia’s communities today.
The King, you see, ought to be the most humble in his kingdom.

Wash the feet of your followers, Hakainde.
Jesus did.

Be careful with the West.
For years, they have been a danger to our sovereignty, survival and prosperity.
In cold blood, they brutally killed some of our forefathers.

I saw you in church the other day as you paid your last respects to Attorney KABESHA’s wife.
You spoke befittingly well in defence of citizens, our culture and identity, your country.

But the West was not pleased, they didn’t like it at all.
I can still hear them secretly grumbling, squirming. They are watching you.

Avoid shouldering such responsibilities alone.
Let citizens carry such burdens with you.

It is NOT your decision.
It is theirs.

Your personal thoughts on the LGBTQI communities are not important.
It is the collective consensus of citizens that is your cushion.

Trust me, that promise you made that fertiliser will sell at K250 maximum will never ever happen in the life of your presidency. Though it’s late now, you might sell the jet.
Learn from your mistakes, my man. Make new mistakes each day, never repeat old ones.

Do not lie.
Invest in the truth always.

The truth not only liberates but it is also a sacrosanct building block of sound societies.
Seek refuge within it.

Learn who your true allies are. History will help you.
I see that your attitude towards Russia has improved. Trust me, Russia isn’t the horned Devil as is presently being cast/portrayed.

I remember, over a decade ago, telling you that you would be Republican President someday.
Perhaps I should have also tipped you on how to govern as well.

My omission, my fault.
Forgive me.

Nonetheless, it doesn’t matter now.
What matters is that you must listen to the people, their voices.

Secure their lives and that is the secret to securing your own.
Give comfort and comfort you will have.

Never take that which belongs to the community.
If you do, you too will be taken away from the community.

I am happy that you had a conversation with Xi JINPING, the President of China.
Talk to him again, again and again.

It is wise.
Everyone does, including Joe BIDEN and Vladimir PUTIN.

America owes Xi JINPING over USD 1 trillion, you see.
You, as Republican President, only owes USD 5.6 billion, loose change by Chinese standards. Trust me. You just might get lucky.

China never colonised a single African country, you see.
Anyone that tells you that China is deliberately placing African countries in a DEBT TRAP for purposes of colonising them is not your friend, is only envious and is only selling you a red herring.

As you commemorate your birthday, never forget that you are a black man, Hakainde; educated by UNZA, an institution owned by blacks.
Never forget that. It matters for you are governing a blacks’ country, a country referred to as a shit-hole by some foreigners.

These blacks, Hakainde, are still slaves today, you see.
They have tears in their eyes, tears occasioned by never-ending colonialisms.

These black people may not have the degrees that you have, may not even know much, transfer-pricing, quantitative easing, liquidation or stuff like that.
But this country belongs to them, it is theirs, warts and all.

Address the cost of living, my man.
For it may cost you your presidency.

The cost of living is hurting them badly.
Vavuta vinthu, they say,, their eyes devoid of hope.

UNZA today celebrates you as one of its graduates, once a poor, rustic lad.
And by dint of this, the people expect, Zambia ought to be in safe hands with you as its Republican President.

They are looking to you for their liberation.
That is why they educated you, ended your own indigence, armed you with knowledge. For their own emancipation.

The people of Zambia are worried that some of these people you are now associating with mockingly sold them items from windows on their own land. Denigrating, the called them boys.
They know your birthday, and are praying for you this June, hoping that you will not turn your back on them.

Regret nothing, my man.
Harbour no grudges.

As you commemorate your birthday, never forget the reason behind your wanting to lead.
Leave vengeance to God.

Your legacy should be the reason why citizens ought to be grateful to your parents.
