DEATH OF A ASPIRING CANDIDATE FOR MANDEVU CONSTITUENCY: IMPLICATIONS ON THE AUGUST 12, 2021 GENERAL ELECTION

ZAMBIA goes to the poll on August 12 to hold three elections namely: Presidential, Parliamentary and Local government.

In the death of any candidate for any of these Election attracts postponement or new nominations.

“Art.52 (6) call ECZ to cancel the particular constituency election and invite fresh nominations”

Zambians United for Sustainable Development aspiring candidate for Mandevu Constituency, Melody Musutu died affecting the holding of Mandevu parliamentary elections in August 12, 2021.

Mrs. Musutu died at the University Teaching Hospital (UTH) after a short illness. This entails that only Mandevu parliamentary Constituency will be affected while the others proceed.

Article 52(6) states that *where a candidate dies, resigns or becomes disqualified in accordance with Article 70,100 or 153, or a court disqualifies a candidate for corruption or malpractice*, after the close of nominations and before the election date, the Electoral Commission of Zambia shall cancel the election and require the filing of fresh nominations by eligible candidates and elections shall be held within 30 days of the filing of fresh nominations*

Now that the Elections are more than 30 days away from this death and that ECZ has not yet printed ballot papers, it is just right that ECZ conducts the fresh nominations for the party affected so that the Mandevu parliamentary Constituency Election are held together with the rest on August 12 General Election.
