Patriots for Economic Progress (PEP) President Sean Tembo – PeP says the disintegration and subsequent “death” of the opposition alliance is because UPND leader Hakainde Hichilema is a selfish and politically weak politician.

He says Mr Hichilema and his followers have been advancing that every other opposition political party must agree with them and work in concert with them, failure to which, such a political party is a surrogate of the ruling PF.

But he says such moves constitute political blackmail.

“ Mr Hichilema postulates that all opposition political parties must unite in order to remove a ruling party and that it is irresponsible and unpatriotic for us in the Patriots for Economic Progress (PeP) to seek our own identity by standing on our own, but the question that l wish to pose to Mr Hichilema is; did he, together with his UPND unite with PF in 2011 to kick out the MMD Government of the day?” he asked.

Mr Tembo has also complained that Mr Hichilema has a habit of using political partners to advance his UPND agenda adding that Mr Hichilema is a politically weak person and he knows it deep down his heart that he does not possess the mental strength and ability necessary to kick out the PF.

“Mr Hichilema is not just a weak guy, he is also a selfish guy, he is not willing to give away even a single constituency or ward in return for the support of people like myself. He wants it all to himself,” he said.

Mr Tembo has further charged that Mr Hichilema’s political career to succeed and for him to enter State House, Mr Hichilema will need the support and assistance of strong political players.

However, he says those strong political players will be unlikely to offer their support for free because of Mr Hichilema’s inborn selfishness.

The PF critic has also brought to the fore that Mr Hichilema has never helped in any way, especially on courts cases against the PF but only want support for his UPND agenda.

“Being politically weak and yet selfish and crooked, Mr Hichilema feels that he is entitled to Sean Tembo’s political support. How dare you sir! Just like Sata and his then PF fought and beat MMD, you sir need to fight and beat PF by yourself. We at PeP shall also seek to fight and beat PF by ourselves. It is each man for himself and God for us all”, he said.

The outspoken Tembo has also gone for opposition NDC leader Chishimba , describing him as a politically naïve person.

He said Mr Kambwili should be dreaming if he thinks Mr Hichilema will give him a position of running mate.

“Even politically naive people like embattled Chishimba Kambwili who think that Mr Hichilema will make him his running mate will soon bite the dust. Now, these two attributes of being politically weak and yet selfish puts Mr Hichilema in a catch 22 situation… and today, you feel that you’re entitled to our support as you seek to fight the Electoral Commission of Zambia on very flimsy matters? Well, you sir can go to hell,” Mr Tembo said.

Tembo who withdrew his party from the alliance has told off HH saying he should go to hell.He said this in an article below:

ABOUT POLITICAL BLACKMAIL: A CASE OF DEFACTO ALLIANCES

1. There is this narrative which UPND President Mr Hakainde Hichilema and his followers have been advancing; that every other opposition political must agree with them and work in concert with them, failure to which such a political party is a surrogate of the ruling Patriotic Front political party. I want to categorically state that we do not agree with such a narrative as it constitutes political blackmail by seeking to create a defacto alliance in favour of the UPND. Mr Hichilema further postulates that all opposition political parties must unite in order to remove a ruling party and that it is irresponsible and unpatriotic for us in the Patriots for Economic Progress (PeP) to seek our own identity by standing on our own. But the question that l wish to pose to Mr Hichilema is; did he, together with his UPND unite with PF in 2011 to kick out the MMD Government of the day? Or did Mr Hichilema and his UPND advance their own agenda in 2011 in the same way that PeP is seeking to advance its own agenda in 2021?

2. As Patriots for Economic Progress, we are not averse to political alliances. In fact, we strongly believe in the need for political alliances as a vehicle for growth of our party as well as for the ultimate benefit of the Zambian people. However, any alliance must be mutually beneficial to all parties. An alliance should not just benefit one political. Each party should make some sacrifices, which constitutes an investment into the alliance, in order to make an alliance work. When we joined the Opposition Alliance with 13 other political parties about 2 years ago, those were our expectations. At that time, we were willing to make certain critical sacrifices such as forfeiting to stand as a presidential candidate in 2021 so as to rally behind Mr. Hichilema’s candidature, and also work hard to push the Opposition Alliance agenda in the public domain as well as help mobilize financial resources for the Opposition Alliance project. I was both the Chairman of the Media Affairs Committee as well as the Chairman of the Finance Committee for the Opposition Alliance and l worked tirelessly in both roles. As Chairman of the Finance Committee and within a period of a week, l was instrumental in organizing the Opposition Alliance end of year Fundraising Dinner at Intercontinental Hotel in December 2018, at which we raised more than K1 million for the Alliance. As Chairman of the Media Affairs Committee, l was instrumental in galavanting from one Media house to another to advance the Opposition Alliance, all at the expense of the PeP agenda. Anyone who understands politics will tell you that Media and Finance are the backbone of any successful political movement. And l handled both of these critical roles with impeccable diligence and competence. But after investing all this effort and sacrifices, Mr Hichilema was not willing to allocate some constituencies and wards for PeP to solely contest in in 2021, as part of the Opposition Alliance package. He point blankly told us that since UPND is more popular than PeP, the best he can offer is for our candidates to contest on the UPND ticket! To us, this amounted to dissolving our party and joining the UPND, which was contrary to our understanding and expectation from the Opposition Alliance. So l told Mr Hichilema that l will be withdrawing my party from his Alliance, and so we left.

3. However, it is evident that Mr Hichilema expected myself and PeP to continue advancing the UPND agenda even though PeP was no longer in an alliance with his party. Our view is that in the absence of a political alliance, there is no compulsion by any party to advance another party’s interests. The concept that the opposition must, by default, unite to kick out a ruling party is inherently flawed and is not shared by even Mr Hakainde Hichilema himself, because he clearly did not unite with PF in 2011 to kick out the then MMD Government. To the contrary, Mr Hichilema walked away from the PF-UPND pact. Sata and his PF solely beat MMD and kicked them out of office. But since today it benefits Mr Hichilema, he wants to advance a narrative that PeP has a duty and responsibility to help him kick out PF and that if we do not do that, then we are surrogates of PF. And yet, he is not willing to sacrifice a single constituency or ward in return for our support.

4. My view is that Mr Hichilema is a politically weak guy and he knows it deep down his heart that he does not posses the mental strength and prowess necessary to kick out a shrewd and brutal ruling party like PF. He knows that he needs the support of people like myself. But Mr Hichilema is not just a weak guy, he is also a selfish guy. He is not willing to give away even a single constituency or ward in return for the support of people like myself. He wants it all to himself. He wants us to rally behind him for free and escort him to State House. Even politically naive people like embattled Chishimba Kambwili who think that Mr Hichilema will make him his running mate will soon bite the dust. Now, these two attributes of being politically weak and yet selfish puts Mr Hichilema in a catch 22 situation. For his political career to succeed and for him to enter State House, Mr Hichilema will need the support and assistance of strong political players. However, those strong political players will be unlikely to offer their support pro bono. They will want some form of power sharing of sorts, which Mr Hichilema, by virtue of his inherent selfishness will be unable to grant. Just like he was unwilling to allow any alliance member to contest even a single seat in 2021, and wanted everyone to be under the umbrella of his faltering UPND party.

5. But being politically weak and selfish and not the only handicap for Mr. Hichilema. He also has an inflated sense of being smart. He falsely believes that he can outwit his political allies. But his attempts to outwit his political allies are so shallow that they usually border on crookedness.

For example, in 2016, Mr Hichilema allegedly entered into an alliance with three other political parties. The leaders of these three political parties were allegedly requested not to file as presidential candidates and in return, Mr Hichilema and his UPND would support the candidature of their MPs in selected constituencies. For sure, these three political leaders kept their end of the bargain and did not file as presidential candidates. They in fact are said to have gone on the presidential campaign trail with Mr Hichilema. However, when time came for Mr Hichilema to keep his end of the bargain, he decided to allow his party to file candidates in all constituencies including those he had allegedly promised to reserve for his allies. His then allies told me that Mr Hichilema’s excuse was that he had been overruled by his party, the UPND and that there was nothing he could do about it. In my view, such alleged conduct on the part of Mr. Hichilema does not amount to outsmarting his political allies, but amounts to being crooked.

6. And today, despite being politically weak and yet selfish and crooked, Mr Hichilema feels that he is entitled to Sean Tembo’s political support. How dare you sir! Just like Sata and his then PF fought and beat MMD, you sir need to fight and beat PF by yourself. We at PeP shall also seek to fight and beat PF by ourselves. It is each man for himself and God for us all. In fact, you sir and your UPND have never supported us in any way, shape or form in our fight against the PF. We have challenged the PF and it’s Government in four cases in court (all of which we won by the way) and you sir never allocated us any of your lawyers among your large army of lawyers, and neither did you contribute a single Ngwee for our legal fees. We undertook 13 successful protests against the $42 million fire tender scandal and you sir never sent a single one of your UPND members to come and give us solidarity. While we were being attacked by Paul Moonga and his thugs along Cairo Road, you sir were lying on your couch at your home busy tweeting.

WHO BEWITCHED AFRICAN LEADERS?

We had our share from our President, Frederick Titus Jacob Chiluba, when in his early days in power yawned in a State House swivel chair how “sweet power” was. He said this in a State House televised Press Conference. We thought he was joking but he meant it as we witnessed years later.

As years advanced he pushed for a Third Term in office and all of us were surprised. He organized it as being the work of the Party ( MMD) as he remained in the background. There was a gentleman in the forefront actively helping out in the name of Michael Chilufya Sata, as National Secretary of the MMD. He mobilized aggressively and we were only saved by the belt which missed a notch in his dynamism.

The climax of the war was when my former Commander, Lt Gen Christon Tembo, then as VEEP of the Republic joined ranks with the Anti Third Term elements. FTJ was a civilian and Christon was a soldier who studied and applied the famous Ten principles of War in Military Studies and he won.

From this stand point Zambians know and understand the political concept of a Third Term. So when the PF talks about and pursues this Third Term concept Zambians know the direction.

Recently another soldier Gen Muhammadu Buhari, President of Nigeria warned his West African leaders to stick to their constitutional term limits. This was in the wake of the bids by the Ivorian President Alassane Ouattra and that of Alpha Conde of Guinea. Both of these guys were due this time around to go but because “ power is sweet” they want to extend their stay. Both are advanced in age and in their 80s. Buhari too studied the famous Ten principles of War and soon these guys will remember him.

What therefore is the reason to go beyond the constitutional term limits? A friend asked me why this was so common amongst the African leadership. He cited Yoweri Kaguta Museveni’s recent change of the Constitution just to ensure he stands.

In reply I suggested that it could be that through that” power is sweet concept “some leaders abused power excessively and dipped deep into the national treasury. They saw prison if they went out and therefore thought that the best was to stay in power till death. Secondly it appears this is another DNA in built mechanism for Africans.

One would think that ECL, as a lawyer is well placed not to pursue such dreams through the eyes of Bill 10. Legal experts have said that under the current constitution, he does not qualify because he has held office twice. It appears many would jump in to challenge his application lodged somewhere in July 2021.

It would appear that the Zambians are ready to change guards around this time next year. They are looking at the new platoon commander to take charge by 13 August 2021. In 1991 the people were fed up with Kaunda and UNIP. In 2001 it’s was FTJ people didn’t want as President. In 2011 it was the MMD that people didn’t want but could have tolerated RB if he had won.

Today both the PF and its leader(s) are not wanted. It doesn’t matter how much money will be on display, or the number of voters to be registered and to vote. The pain caused and passed through is unbearable. Some people feel the pain just by mentioning the word PF or whenever they hear that “ Dununa Reverse song”.
Time to reflect is now and the people’s anger is written on every face even amongst the so called PF cadres.

USING STATE HOUSE GROUNDS TO FIGHT A POLITICAL OPPONENT

Yesterday, Patriotic Front (PF) cadres, disguised as students, youths and leaders of civil society organisations, matched to State House, without Zambia Police hindrances, to present a petition to President Edgar Lungu for him to appoint a commission of inquiry into the privatization of state-owned companies in the 1990s.

In response, Mr Lungu said he would soon appoint the said inquiry to put the privatization matter to rest and subject those who allegedly abused the process to justice.

He added that it was clear that some people allegedly took advantage of the process to loot, plunder and enrich themselves.

Was I surprised by yesterday’s charade?

No, I wasn’t.

I had already read the entire script.

Yesterday’s petition came just days after Mr Lungu had told a PF campaign rally in Luapula Province that he might consider heeding the demands of the “Zambian people” to appoint a commission of inquiry to probe the privatization process.

I had found Mr Lungu’s statement very interesting.

The only question I have for him is: Which people?

Yes, which people have asked him to appoint a commission of inquiry targeted at his arch political opponent Hakainde Hichilema?

To the politically naïve, it is, indeed, the Zambian people pressuring Mr Lungu to appoint a probe team to put to rest unanswered questions about the privatization process.

Chief government spokesperson Dora Siliya recently told us that government was closely following “the reaction by the citizens” to allegations that Mr Hichilema allegedly never declared interest in the sale of some public assets.

Who are these “citizens” and what do they stand for?

Here is another unanswered question.

Where did this privatization debate emanate from?
Did it really begin with Forum for Democracy and Development president Edith Nawakwi?

Let’s go down memory lane to check how this game has been unfolding.

President Lungu’s spokesperson Amos Chanda begins the debate by calling for a judge-led inquiry into the privatization of state owned companies.

“Unlike Mr Hichilema who sold the companies to friends or relatives and himself, President Lungu’s participation was confined to being chairman in the sale of Zambia Cold Storage Limited to foreigners.

“President Lungu did not sell the Keembe storage to himself, relatives or friends.”

“Government is, therefore, studying the matter and is following closely the reaction by the citizens who are the true owners of the property in question.

“The nation will at an appropriate time be informed on the steps that government will take should it become necessary to act on behalf of the citizens of Zambia.”

PF-aligned students and youths match to State House to present a petition to PF and Zambian President Lungu to appoint a commission of inquiry into the privatization programme.

Mr Lungu says he will appoint the commission of inquiry as he has already received numerous representations from “people” across all walks of life.

Now, you can see the “people” Mr Lungu has been referring to; user-friendly characters with the sole aim of ensuring that Hichilema does not appear on the ballot next year.

In essence, it is not the “people” but Mr Lungu and his PF party who are victimizing Mr Hichilema.

Why should we be wasting our very meagre resources on a compromised commission of inquiry with a pre-determined outcome?

Are we a serious country?

Just look at our priorities. When it is not privatization, it is Bill 10.

When it is not Bill 10, it is something that does not help our country in any way.

Really?

Is this all that we deserved from Mr Lungu?

Why is he so scared of Mr Hichilema that he can go all the way to find ways of forcing a conviction and prevent him from running for the presidency of this country?

Do genuine Zambian citizens conduct themselves in the manner Mr Lungu is doing?

Yesterday, he even bragged that the Inquiries Act gives him the latitude to appoint a commission of inquiry without consulting anyone.

Why should he abuse the Zambian law to fight his political opponents?

In the past, Mr Lungu has used the law to fix people he has had differences with.

This is what retired Supreme Court for Zambia judge Philip Musonda refers to as lawfare.

In an academic paper titled “Lawfare: Undermining constitutional democracy, the rule of law and human rights in the post-colonial state”, Dr Musonda defines lawfare as “a form of war consisting of the legal system against an enemy, like damaging or delegitimizing them, tying up their time or winning a public relations victory”.

Dr Musonda adds: “Don’t use the law to victimize your political enemies and “eliminate the opposition from the political scene”.

Mr Lungu has had the notoriety of using lawfare to fight people he perceives as his enemies.

Let me demonstrate.

When President Michael Sata died in October 2014, The Post newspaper made it clear they were not going to support Mr Lungu’s candidature for either PF presidential candidate or, indeed, Zambian president.

Mr Lungu had learnt a lesson.

Come the 2016 elections, Mr Lungu made it a point to have The Post newspaper closed before the country went to vote lest they swayed the thinking of the electorate.

How did he do it?

He used a state institution, the Zambia Revenue Authority (ZRA), to settle his political scores with Post Newspapers proprietor Fred M’membe over unpaid taxes.

Even after M’membe had taken the matter to the Tax Tribunal which ruled that The Post continue to run and pay the debt in installments, the ZRA ignored the ruling and went ahead to close the newspaper in accordance with Mr Lungu’s wish.

That was not the only matter in which Mr Lungu had used a state institution to fight personal battles.

In 2015, Mr Lungu had had personal issues with Director of Public Prosecutions Mutembo Nchito and wanted him dismissed.

Since Nchito had security of tenure, Mr Lungu had to use lawfare to get rid of his enemy.

He appointed a tribunal to probe and establish a case against Nchito so that he could dismiss him.

The tribunal comprised three former chief justices led by Justice Annel Silungwe.

But two of the former chief justices on the tribunal- Ernest Sakala and Mathew Ngulube- were conflicted.

When Nchito asked Sakala and Ngulube to recuse themselves as they had had personal differences with him, they refused to do so.

In the end, they delivered a report in accordance with Mr Lungu’s wish which recommended Nchito’s dismissal.

How differently will Mr Lungu’s commission of inquiry against Mr Hichilema be?

State House should be an honourable place that belongs to all of us and not one for fixing perceived enemies or blocking political opponents from seeking public office.

“AS long as we follow the laid down procedure, it is our constitutional right to assemble and protest against anyone who wants to disturb the peace Zambia has been enjoying since independence,” United Party for National Development Deputy National Youth Chairman Gilbert Liswaniso has told the Zambia Police Command.

Reacting to Deputy Inspector General of Police in charge of Operations Bonny Kapeso’s intimation that police are reluctant to allow the planned countrywide protests, Mr Liswaniso said it is every Zambian’s responsibility to safeguard prevailing peace in the country by stopping those scheming to disenfranchise citizens from voting.

This was at a consultative meeting called by the Zambia Police as a follow-up to the UPND and the National Democratic Congress notice to the Inspector General of Police Kakoma Kanganja on the planned countrywide protests against Electoral Commission of Zambia Chairperson Judge Essau Chulu and his Chief Electoral Officer Patrick Nshindano.

Mr Kapeso’s suggestion that the petition be taken to the two named individuals was also shotdown by Mr Liswaniso and NDC’s National Youth Chairman who noted that it was not the police’s role to suggest how the opposition should engage other stakeholders in the electoral process.

Mr Kapeso told the two youth leaders that the Zambia Police wanted to be impartial by being servants of the people as the country heads to the presidential and general elections next year.

He said the police command was willing to engage all stakeholders to clear any misunderstandings.

However, Mr Kapeso sought to arm twist the youth leaders by warning that police would unleash their newly acquired arsenal as a last resort if the two parties do not come to an agreement on the way forward.

Mr Liswaniso, however, told the command that the newly acquired war equipment by the police will not deter the Zambian youths in standing up for their birth and constitutional rights.

“We are pleading with our youths to follow the laid down procedures but they are willing to go on the streets without involving you. We see youths from the ruling party protesting on the streets without notifying the police and they have now started storming the police stations and beating our officers there. It is important we reach an equitable agreement the youths will understand, otherwise they will see us as sale outs,” said Mr Liswaniso.

Mr Kabwita said the youths of Zambia want to safeguard the peace the country has enjoyed since independence hence their decision to stand up against Judge Chulu and Mr Nshindano’s maneuvers to disenfranchise citizens in taking part in the electoral process of the country.

And UPND Lusaka District Youth Chairman Archritius Mwanakayaya earlier today delivered a police notification on the planned protests in Lusaka.

The opposition political parties plan to demonstrate what they termed as the “undemocratic and illegal decision by ECZ to discard the 2016 Voter’s register in preference for a completely new one.

The demonstration is also aimed at pushing for the resignation of the ECZ Judge Chulu as well as Chief Electoral Officer Patrick Nshindano for incompetence.

Addressing the media, Mr Mwanakayaya said Mr Chulu and Mr Nshindano are a danger to the country’s peace and its survival and wondered what mechanism the two hope to use to capture the targetted 9 million voters when the registration of the voters for 2011, 2015 and 2016 took a number of months to capture.

Mumbi Phiri Denies Using ‘surrogates’ To Actualise Inquiry Into Privatisation

Ruling PF deputy secretary general Mumbi Phiri has not taken kindly assertions that the ruling PF used ‘surrogate organisations’ to call for the institution of a commission of inquiry into the privatisation process which happened over two decades ago.

Forum for Development and Democracy (FDD) leader Edith Nawakwi, under whose wings the privatisation process was carried out as finance minister, has been accusing Hichilema of having benefited himself during the process, allegations the government has bought into, and yesterday YALI presented a petition to President Lungu, which he used to announce the institution of a commission of inquiry to look into the matter.

Speaking with Daily Revelation in a recent interview, Phiri said she would not give a position on the matter, claiming the PF was not behind the move.

“Already you have heard some people are claiming that Edith Nawakwi was given something or whatever, they are claiming she has been paid for her to start speaking like that. But I haven’t heard anybody tell us how much Mr Hichilema was paid by the same PF for him to start talking about Nawakwi, because it’s him who started,” Phiri said. “He went to a TV programme which was hosted by pastor Chiluba, it’s pastor Chiluba who asked him, that’s where Mr Hakainde Hichilema said Nawakwi was sleeping. What Honourable Nawakwi said on Hot FM was simply responding to what Mr Hakainde Hichilema said. So how can anybody claim that PF paid Edith Nawakwi when she was busy responding?”

Phiri claimed that it was the people who were calling for the inquiry.

“Have you heard anybody because even from the government spokesperson she hasn’t called for that. It’s the people. Is YALI part of government? In fact they are the ones who have even petitioned. Is YALI part of PF?” she asked.

But asked on charges that the organisations pushing for the move were mere ‘surrogates’ the party was using to seemingly legitimise their action as a non-partisan undertaking, Phiri responded: “Is Linda Kasonde UPND surrogate? Is Laura Miti, she is surrogate of UPND? Those are NGOs. Is McDonald Chipenzi a surrogate of UPND?”

Phiri continued.

“I am asking, has YALI agreed that they are our surrogates? YALI was in existence even before PF came to power. Asked on ruling PF member Colonel Panji Kaunda’s statement questioning why President Lungu is revisiting a matter that happened decades ago, when there is a fresh criminal case committed by his own daughter, Tasila, as confirmed by the Ministry of Lands and Environmental Protection, Phiri refused to be drawn into commenting specifically on the matter, instead diverting to questioning Col Panji’s membership in the party.

“And where did Colonel Panji Kaunda resign to become a PF member? I am asking you when did he resign from UNIP to become a PF member. Where did Bob Sichinga resign from UPND to become member? Did you see him reign to join us?” Phiri asked, but was reminded that these were people who campaigned for the PF prior to winning power and served in the PF government as ministers. “Look me I am PF, I am a known PF member, if I don’t come out to resign publicly, because everybody knows that I am PF, if I am given a job, let’s say if ZRP or any other party wins…that doesn’t make me a ZRP member. Yes.”

Phiri said the procedure in politics was that if one had decided to support a political party, they should first announce their resignation from the previous party.

“It’s not PF which is pushing for that, it’s the citizens of the Republic of Zambia, is Green Party president also being called our surrogate? HAKAINDE Hichilema says the Electoral Commission of Zambia is exhibiting draconian behaviour with regard to the voter registration process.

And NDC leader Chishimba Kambwili says one does not need to be a rocket scientist to realise that the current group of ECZ commissioners are arrogant and not fit to run the commission.

Meanwhile, Green Party president Peter Sinkamba has said the ECZ commissioners should be removed as they will cause anarchy if left unchecked.

But PeP leader Sean Tembo said, “The conduct of individuals such as UPND’s Hakainde Hichilema, NDC’s Chishimba Kambwili and MMD’s Nevers Mumba of late has the potential to bring out anarchy and jeopardise the continuity of this Republic. It is therefore our appeal to these gentlemen that they stop practicing a scorched earth policy in their politics failure to which they need to be able to bear the consequences of their actions”.

Tembo, who says Hichilema’s political fortunes have dwindled, urges the ECZ to ignore the noise that “embattled politicians like HH and CK are making, and just focus on doing their job. Those guys are simply making advance excuses for their potential loss next year…the system that we have created for ourselves as the Zambian people we must not allow a few embattled politicians whose shelf life has long expired to usurp this system”.

Speaking on Diamond Television special live discussion regarding the various aspects of the voter registration exercise, UPND leader Hichilema said the ECZ will create a constitutional crisis because it is operating outside the law by its insistence on doing away with the current voters’ register, among other things.

He insisted that Zambians should not allow some people rig next year’s elections.

“We must call things by their right names, it’s inappropriate to call it that we are crying…nobody is crying. We are demanding our rights as citizens that any electoral process, any elections must be free and fair. And an election is not an event, it’s not a day’s activity. An election is a process and what we are experiencing here is a process which is flawed and its evidently so, starting with the issuance of the National Registration Cards. You can see, you can hear the flaws that are there,” Hichilema said. “Citizens are complaining over this document which is a constitutional right, which confers evidence that they are citizens of Zambia and allows them to participate fully as citizens of this country. Not just voting but indeed other rights: drivers licence, education, jobs, and loans. You need title deeds, you need the NRC.”

Hichilema wondered why it was a problem to give Zambians their identity cards which is constitutional.

He further said the NRC is the one that allows a Zambian to exercise their right to vote, thus one cannot describe their demand as crying foul.

“You have the voter registration process which is clearly flawed. Here we are talking about what qualifies the 2021 elections free and fair and indeed credible and all of us must be concerned about these issues so indeed it cannot be defined as crying foul. We are not crybabies. We are asking for the conferment of citizens constitutional rights and a process that will not favour any player,” Hichilema said. “Any participant must actually be respected and if the institution that we mandate to look after the elections on our behalf is acting or behaving in a manner that suggests some bias, we must talk about those issues. Citizens must talk about those issues without fear and favour. I have a number of issues I want raised but having already said, there are flaws in the all electoral process and we cannot standby and wait for 2021. It means we would have been basically participants in the rigging of the elections.”

The UPND leader said the ECZ should not dictate what it wants to happen in the electoral process.

He reminded viewers that the ECZ was a creation of the people of Zambia but lamented that what has been witnessed in the commission was a “draconian behaviour” where they want to decide what should happen in the electoral process.

Hichilema added that the people wanted ECZ to manage the elections and electoral process in a free and fair manner and within the law.

“ECZ works for the people of Zambia and that message must go and sink in the minds of those that are running the ECZ. They (ECZ) must act within the laws and remain impartial. They must not be biased and appear to be favouring one or more of the competitors,” he said.

Hichilema said it is wrong for ECZ to start having or addressing joint press briefings with the ruling PF but must instead do it with all stakeholders in the electoral process.

Hichilema said the ECZ must be reminded that they work for the people of Zambia and their behaviour of acting like it’s the citizens that work for the commission must cease.

“In the years he [Patriots for Economic Progress leader Sean Tembo] talked about, the history of new voter registration cannot apply, and the law does not work in retrospect. The electoral process in 2016 was devised to deal with the ills of the past. Ills of the past included always starting a new voters’ register…we should not do that because it wastes scarce resources, it creates this pressure point all the time and that is why there is a provision for a continuous voter registration. It was not there before in the years he is talking about. Sean Tembo my brother, please understand that, don’t mislead the people of Zambia. It’s very important that we as leaders don’t mislead the people of Zambia and those that claim to be leaders,” Hichilema said.

He recalled that there was a change in the law as the country used to have a presidential by-election but that Zambians decided that it was too expensive and therefore changed the law to provide for a running mate.

Hichilema said the ECZ was attempting to disenfranchise citizens without recourse.

“In a draconian way they want to remove us who registered as voters between 2011 and now, yet we registered under the law and willy-nilly because they are acting on behalf of the competitor. They now must remove citizens including those who live outside the country who cannot afford to come here to register,” Hichilema said.

He noted that even if one registers online now, they will still be required to physically verify the new records.

“Let me remind citizens and indeed the ECZ, if chaos arises in this country because you are mismanaging the electoral process, you will be held accountable. Today (Wednesday) you called for an emergency meeting. All of us geared to attend the meeting but because a sidekick decision was made so that citizens don’t air their views about the flaws in the electoral process and registration, including NRC insurance which is a function that leads to being a voter, you cancel the meeting because an instruction has come,” said Hichilema. “This is rigging the elections and I want to appeal to the people of Zambia that do not sit and watch people rigging the election and therefore that’s where the constitutional crisis will come from. It will be on the heads of ECZ and those in government.”

On his part, Kambwili said Zambians won’t accept people abrogating their own provisions, saying as long as the law says there will be continuous voter registration, no institution or individual has the power to disfranchise any citizen.

He insisted that people who were on the voters’register from the time the Constitution was signed in 2015 must continue being on the roll and then additional people may be added.

Kambwili said to wait until there was a crisis as suggested by Tembo was poor leadership and management.

“Today they issued a statement that the voters’ roll was suggested by political parties; where did they meet the political parties? Why did they call a meeting with stakeholders who are political parties if they had already made the decision? They were claiming that they met political parties, the stakeholders who suggested that we need a new voters’ roll, so what is more important between stakeholders telling you what to do against the law or you following the law?” he asked. “We have made it very clear here that the calls for continuous voter registration… How you remove the dead people people from the roll is an issue of ECZ. They must find a way of removing the dead people, they are not going to remove the people who are still living on the pretext of removing the dead ones. Like president HH said, we have registered voters who live outside the borders of this country. Surely are they going to find the money and time to leave their jobs to be coming for registering every after five years?” Kambwili said having voter registration every time there is an election is retrogressive.

He noted that in 2001 and before 2011 the population was smaller and the target the ECZ wanted to register was equally smaller, yet the time frame for registering was three months.

“You must be out of your mind to think that a programme that was taking three months to register a few people can now take one month to register more people,” he said.

Kambwili said it was an insult to hear someone who doesn’t take part in elections say “these people’s electability” is dwindling.

“In this country there are two types of politicians: there are some of us who want to elect and participate in elections in this country and there are those who are just armchair critics and claim that they win elections by never participating in any election – not even a ward election or constituency election,” he said. “So it is painful for someone who doesn’t participate in elections and is always an armchair critic to be telling you that you cannot be elected when we have representation in parliament, he doesn’t even have a councillor. So when we are talking, let’s have respect for one another.”

Kambwili wondered why the ECZ wants to spend more money printing new cards and paying wages to personnel when the country’s financial position was dire.

He said those in leadership were insisting on the new voters’ roll because they wanted to give contracts to their friends to print new cards when there was absolutely no need for the exercise.

Kambwili said his arguments together with other like minds was based on the law and that those wanting to do away with the current voters’ register were doing it outside the law.

“And for once, respect those that want to follow the law. If you think you can do things with impunity and not follow the law, then Zambia is not your place,” said Kambwili. “What we are asking is within our rights as Zambians. What is difficult with ECZ giving Zambians three months to register? Let them give the normal period they have always given which is three months and let people go to the registration centre, leave the existing register without tampering with it.”

Green Party president Sinkamba wondered where the ECZ had gotten power to nullify existing the voters’ register and voter’s cards.

He said to be registered as a voter was not at the pleasure of the commission but a right enshrined in Article 46 of the Constitution, to be enjoyed by a citizen who is 18 years old and above.

Sinkamba said the Constitution did not provide for a registered voter to be deregistered, unless one was no longer a citizen of Zambia.

“ECZ appears to be in total disarray on what to do. There are almost six million people existing in the register now and another three million who are eligible to register and they are telling us that they can do it in 30 days which is total nonsense. It can’t happen,” he argued. “We are getting worried that time is running very fast before we can have the next election which is August next year. Like I said earlier, if we continue with this kind of group which does not seem to understand what it’s doing and don’t know their limitations of power, this group is likely to cause acrimony in this country. We can have bloodshed when we are not supposed to do that.”

Sinkamba maintained that Zambia already has an existing register which by the electoral process Act indicates that it must be a continuous register.

He said to say the existing register is invalid and will not be used in the next election and voter’s cards would not be valid without any power to do so shows that there is a problem.

But stressing his argument yesterday, in a write up, Tembo said the explanations advanced by the ECZ on both the online voter pre-registration as well as on the issue of a new voters roll, are sound and valid to any reasonable person.

“Given the fact that the online voter pre-registration process is not final and it is also optional, the arguments that have been advanced by some of the opposition leaders that citizens in rural areas will be disenfranchised because they do not have smartphones nor internet, do not carry any water. That is because even if a citizen does not do the online voter pre-registration, they will still be able to register as a voter without any qualms,” he said. “On the issue of developing a new voters’ roll as opposed to updating the 2010 voters roll, we share the views of the Electoral Commission of Zambia that a fresh voters’ roll that is done from scratch is likely to be more accurate than updating the existing voters’ roll. That is because the existing voters’ roll is approximately 10 years old now and a significant number of the voters that were registered in 2010 might have died while others have since moved to other parts of the country. Therefore, updating the 2010 voters’ roll will present two fundamental problems; firstly we will have a significant number of dead people on the voters’ roll, especially given the fact that we have a manual and predominantly inaccurate records system for the deceased in Zambia, and secondly we are likely to have several duplicates for people that would have registered in 2010 but have relocated to other parts of the country and decide to register afresh even though they are already on the voters’ roll.”

Tembo said that would be a cumbersome and expensive process to clean up and validate the updated voters’ roll.

He said those problems would not arise if “we do a totally fresh voters roll”.

“…we have further noted with regret that some opposition leaders including UPND’s Hakainde Hichilema, NDC’s Chishimba Kambwili and MMD’s Nevers Mumba, have been conducting themselves in an unreasonable manner by seeking to create a narrative that everything about ECZ is wrong. These leaders have been condemning all the commissioners at ECZ, they have been condemning the Chief Electoral Officer, they have been condemning each and every activity undertaken by the Commission,” Tembo said. “To them, nothing and no one is good at ECZ. Everything is bad. These leaders have issued various statements to the effect that the electoral process is rigged and that the outcome of next year’s elections should not be relied upon.”

He said PeP are cognizant of the fact that the ECZ must be held accountable in the manner that they undertake the electoral process.

“However, even as we hold ECZ accountable, we ought to be wary of two things. Firstly, we must always endeavour to be reasonable in our criticism of the Commission. For example, there is nothing worth criticizing the Commission about with regard to either the online voter pre-registration process or the plan for a new voters’ roll, because the explanations that have been consistently and continuously put forward by the Commission are perfectly reasonable,” he argued. “Secondly, even as we criticise the Electoral Commission of Zambia, we need to resist the temptation to usurp the powers of the Commission. The Constitution of Zambia only gives one body the power to organise and manage elections in Zambia. And that body is not UPND, nor NDC nor MMD. Indeed, the only body entrusted with managing elections in this country is the Electoral Commission of Zambia. That is the system that we have created for ourselves as the Zambian people, and we must not allow a few embattled politicians, whose shelf life has long expired, to usurp this system.”

Tembo noted that political parties were stakeholders to the electoral process.

“But every stakeholder must know their boundaries. Being a stakeholder does not mean that you are the owner of the process. You are merely a concerned party whose opinions must be heard and considered. Favourably or otherwise,” Tembo said. “As Patriots for Economic Progress, it is our considered view that some of these opposition political party leaders including UPND’s Hakainde Hichilema, NDC’s Chishimba Kambwili and MMD’s Nevers Mumba, are hell-bent on causing confusion and anarchy ahead of next year’s general elections, so that they can create advance excuses to give to their supporters for their likely poor performance in next year’s elections. However, labeling the electoral process as rigged without any evidence or fact is dangerous to the peace and security of this country, as some less probing citizens will take the words of their leaders as gospel truth and proceed to cause anarchy. Therefore, our view is that any opposition leader who labels the electoral process as rigged must be put to strict proof, failure to which they must be prosecuted to the fullest extent of the law for alarming the nation.”

He said the political process in the country has been ongoing since the 1950s.

Tembo said some political leaders made it and became Republican presidents while others did not and went down in history as such.

“However, the Republic of Zambia has always been there and should always be there regardless of the happenings in the political process of this country,” said Tembo. “Therefore, any individual politician, regardless of how popular they feel they are should conduct their politics within the parameters of preserving the continuity of this Republic.”

UPND, State agree to adjourn voter registration case sine die

THE Lusaka High Court has indefinitely adjourned the matter in which the UPND has sued the Electoral Commission of Zambia and the State over ECZ’s decision to launch and host the online voter registration as a “test run” on its website eczovr.org.

Judge Mwila Chitabo has directed that since there were similar cases by different parties seeking the same reliefs before different courts, the matter before him would be adjourned indefinitely with liberty to restore pending an order by the Constitutional Court in a matter where Chapter One Foundation has petitioned ECZ and the state over the electoral body’s decision to limit the voter registration exercise to one month.

This follows a consent entered by the state, the ECZ and UPND to have the matter adjourned pending determination of the matter before the Constitutional Court.

When the matter came up for continued hearing of the substantive application for judicial review, Solicitor General Abraham Mwansa indicated that the parties had sight of the ruling by Justice Gertrude Chawatama in the matter where musicians and youths sought judicial review against ECZ’s proposal to get rid of the old voter register and register voters afresh in one month on a limited budget and that the parties were equally aware of a matter before the Constitutional Court under cause number 2020/ccz/0010 between Chapter One foundation, ECZ and the Attorney General.

The Solicitor General said the parties appreciated the reliefs before the Constitutional Court and were aware of the application by Chapter One Foundation to amend its petition before a single judge of the ConCourt and the ruling was yet to be delivered.

“The parties before you are of the view that unless and until there is certainty in terms of the reliefs the petitioners seek before the Constitutional Court, there may be a duplication of the same reliefs before this court. The parties have by consent agreed to have the matter before you adjourned sine die with liberty to restore,” said Mwansa.

Lawyer representing the UPND Milner Katolo affirmed that the submissions by the Solicitor General were indeed the position of the parties to avoid a situation where the administration of justice would be brought into disrepute.

And another UPND lawyer Marshal Muchende said the said agreement was to prevent a possibility of two courts rendering conflicting judgments with regards to the same issues, which would bring about grave embarrassment to the judicial department of the state to which all legal personnel belong.

“Our fundamental duty as officers of the court is to preserve the integrity of the court and that duty supersedes our duty to our client and colleagues,” said Muchende.

In his ruling, judge Chitabo said, “This is indeed as it should be, a demonstration of professional etiquette and ethical conduct at the bar. The matter stands adjourned sine die with liberty to restore as we await pronouncements from the superior court of the Constitutional Court. The justice of the case is that I make no order to costs.”

In this matter, the UPND wants the court to quash the decision by ECZ to limit the voter registration exercise to 30 days, which was scheduled to commence on October 28, 2020.

The party is seeking a declaration that the prescribed protocols for voter registration on the ECZ website were ultra vires section 8 (2)(3), section 15 and section 125 of the Electoral Process Act number 35 of 2016 as read with regulations 11 and 12 on the Electoral (registration of voters) regulations of 1973 amended by statutory instrument number 62 of 2005.

It also wants a declaration that ECZ acted unreasonably, irrationally and /or with a hidden ulterior motive at the behest of an invisible hand in announcing the 30 days cut off time for the voter registration exercise scheduled to commence on October 28, 2020.

It’s nonsensical for newly weds to use contraception – Chilufya Tayali

IT’S nonsensical for people who have just gotten married to talk about contraception, Chilufya Tayali has said.

The Economic and Equity Party (EEP) president says immediately after marriage, couples should be talking of boosters in terms of “bedroom jobs and fertility.”

Commenting on pictures of President Edgar Lungu’s daughter Tasila and husband Patrick interacting with animals apparently on their honeymoon, Tayali said “honeymoon is not just about playing with animals.”

“It’s time to get busy and strengthen the marriage, the two families of the man and woman, grow wealth and secure the future generations,” Tayali added.

He said if his party came into power, it would ban contraceptive advertisements running in the media, because Zambia’s population was too small for the “big and rich Country we have.”

“Look at me, when I got my first wife, from Rwanda, I wasted no time to cause her crave for fresh fish and our first born is now 17 years doing University. I allowed her to breathe for her body to get back in shape and I brought in the second one. Had we continued with our marriage, we would have been counting 5 by now,” he said.

“I am now with Tsega and we are just over a year of our marriage and Kiya is 4 months. We will allow her to grow and let my wife get back in shape as she gets a job, because she is a full time qualified accountant, then…..you can guess,” Tayali added.

He said much as he was separated from his first wife, their relationship will last forever, because of children.

“Diplomatic ties with Rwanda are also naturally sealed, especially when I will be President. No matter how my wife may not like Zambia because it is under developed, she has no choice to renounce the Country or me, because her first born child is Zambian,” he said.

“Our diplomatic relationship with Ethiopia is naturally stronger and we will work with them to realise my United States of Africa which was started by great leaders like Col. Gaddafi, killed by the Westerners who are killing our unborn children using contraceptives and abortions, then Kwame Nkhruma the great Panafricanist,” he added.

Tayali said when he comes to rule, it will not be business as usual.

“Getting back to Patrick and Tasila, as well as other new couples, don’t waste time playing, that is for those who are not married. When you get married it is time to make babies. Of course I am aware of those who may not be able to have children (biologically) in their marriage, but that is because they are selfish otherwise they would still have children. They are so many orphans why should you stay alone in the pretext that you can’t conceive. Go get children from the orphanages and be parents,” he said.

Tayali said for Zambia to develop, “we need numbers.”

“Zambia’s economy will not grow exponentially, unless our population increases. There is no big economic without people to grow it, which is why EEP starts with fundamentals of “FAMILY MUST COME FIRST!”.

He said under his administration, families and reproduction will be highly encouraged but those who adopt children will get more incentives, because he did not want children to be without parents as that was not African.

“So, Patrick and Tasila, those lions should turn into children sooner than later,” Tayali demanded.

NDC/ UPND YOUTH NATIONAL LEADERSHIP HOLDS MEETING WITH DEPUTY IG – OPERATIONS

Yesterday 2nd October 2020, the National Democratic Congress (NDC) and their Alliance partners the United Party for National Development (UPND) National Youth leadership hold a meeting with Mr Bonny Kapeso the Deputy Inspector General Of Police Operations.

The meeting was held at Police Service Headquarters in Lusaka which lasted for over three hours.

This followed the notification by both parties to the police on the intentions to hold a peaceful demonstration in regards to the Online Voter Registration.

The UPND was represented by Gilbert Liswaniso UPND National Youth Chairperson and Dean Mwanaga their Media Team member. The NDC was represented by Charles Kabwita NDC National Youth Chairperson, Nachama Shimulinda NDC Lusaka Provincial Youth Chairperson, Christopher Kangwa Dr Chishimba Kambwili’s ADC and Kirby Kaoma Musonda NDC Deputy Media Director. Present from the police was Mr Bonny Kapeso DIG, Miss Banda and a Mr Lwanga.

The meeting was chaired by Mr Bonny Kapeso who called for it.

Mr Kapeso explained to the team that he was instructed by the Inspector General of Police Mr Kakoma Kankanja to call the two political parties Youth representatives so that he could have a meeting with them before police could respond to the letter officially.

Mr Kapeso mentioned that the tone in the letter created a different scenario hence he had to call for this meeting to get clarity. He further said the call for two most powerful opposition political parties in Zambia the NDC and UPND protesting the whole country was too strong.

The DIG also raised concerns to why the two political parties had to copy the embassy’s when writing their letters which he called as internal matter and it was not necessary at that time to involve the International community.

Mr Kapeso thanked representatives from both parties for turning up for the meeting and said, it’s good today you have come and this is what we want as the police, we thank you and let’s continue this dialogue as we approach the 2021 general elections.

Mr Kapeso who further said we as the police we are servants of the public and we cannot be 100% perfect, Just the same as you politicians we don’t expect you to be the same as you have different kind of people and personality, our God almighty has made each person different.

Mr Kapeso who expressed concerns to why the two parties had to write directly to the Inspector General of Police whom he said he was not the controlling Officer of the police, but there were people in the police were the letter could have been directed to.

The DIG reminded both parties on the new equipment bought for the police, to which he said that equipment was bought to be used on law breakers and should be used as a last option hence we first need to dialogue as one people.

Mr Kapeso further said National Demonstrations if allowed are a sign of failed government hence his office could not agree to grant such permission to hold demonstrations country wide. But the police were open to negotiations on how best the concerns of the two parties can be heard.

Mr Kapeso further said his office is not Incharge of the Electoral Commission of Zambia as he was pointing to one of the reasons the two parties wrote the letter to have Mr Esau Chulu, Patrick Nshindano and Emerlyn Sikazwe resign. Mr Kapeso further advised that his office can only work as intermediate between the two. He said the call by the two parties for the trio to resign shouldn’t take the whole country to demonstrate but just engage the ECZ as an institution.

The DIG was however disappointed with ECZ as he saw a meeting which was called by the ECZ to dialogue over Online Voter registration with opposition political parties called off. He further advised the ECZ to call on the political players in the country to dialogue when ever issues arises as lack of dialogue only builds up unnecessarily tensions in the country.

The NDC National Youth Chairperson responded to Mr Kapeso and said, our letter to you is not in any way to undermine your office and the letter sent to the Inspector General of Police Mr Kakoma Kankanja was just to let him know what the two parties intentions were, but the two parties had already written letters to various police commands country wide.

Mr Kabwita further said as NDC and UPND are law abiding citizens that is why they took the route to inform the police and follow the laid down procedures of the public order act. But wondered why the colleagues in the Patriotic Front don’t inform the police when having demonstrations and go ahead any time they want. Mr Kabwita expressed disappointed why we should have two sets of laws in the country for the ruling and the opposition political parties.

Mr Kabwita further told the DIG that it was not up to the police to tell the two political parties on how to handle the issue with ECZ but their job as police was just to provide law and order in the country. Our demands to have the dual removed from ECZ are not meant to undermine the organization but a call for genuine Zambians to run the affairs at ECZ.

If you see from 2016 general elections we have been requesting meetings with ECZ with an example with the recent meeting which was called off by ECZ. The ECZ are too stubborn and their stubbornness if left unchecked will only put this country on fire which even the police will fail to control as youths out their are upset on how the affairs at ECZ are being conducted, said Kabwita.

Mr Kabwita in his concluding remarks said the two parties will not take no as an answer as their youths country wide were more than ready for these demonstrations.

UPND National Youth Chairperson Gilbert Liswaniso said, we respect you so much as police and we understand how you are intimidated by the PF, as the UPND and NDC Youths we are very peaceful hence our coming to this office as we regard this office as a public office. The PF are on record to have beaten up police officers on several occasions and even stagged robberys at police stations and as we form government next year we want this trend to stop, our men and women in uniform must be respected.

Gilbert further told the DIG that the youths in UPND and NDC country wide can never listen to the police but to their leaders only, hence Gilbert’s call to the police to let the both parties leadership handle them.

Mr Gilbert mentioned on the issue of copying Embassy’s in the letter and said this was done because in the past as opposition political parties we have been humiliated a lot by the ruling hence involving the international community. As the opposition our only aim is to make things right in this country hence our call for the trio to resign. Why should Zambians be denied the right to acquire a voters card this is their right. And why does the ECZ want to get rid of the old voters register this is suspicious, Gilbert said.

Gilbert further said the PF and ruling Party aligned are being allowed to hold demonstrations with an example with the Youth lead by Ntewewe who recently took a petition to state house and the President addressed them, but why are the oppositions not being allowed when ever they apply and follow the procedures.

The UPND National Youth Chairperson has since appealed to Mr Kapeso to allow them speak to their youths and leadership on concerns raised by the police in regards to the country wide demonstrations and are ready to come back for another meeting on Monday 5th October 2020. Before the Police could respond back officially.

The UPND Media Team member Dean Mwanaga said If the police could allow even the opposition political parties to hold peaceful demonstrations it will only send a signal out that Zambia was a democratic country, but if the police deny the opposition a chance to demonstrate like their colleagues in the PF are doing even President Edgar Lungu will differ with the police as yesterday he allowed the PF youths lead by Ntewewe to present a petition at state house and President Lungu was a President for all Zambians and we are sure he calls for fair play amongst all Zambians.

The NDC Lusaka Provincial Youth Chairperson Nachama Shimulinda mentioned to the DIG that our friends in the ruling are untouchable, but as the opposition political parties is to protect the country from this corrupt regime and also protect the women and men in uniform. And us youths we want to do it in a sober manner hence our approach to your office.

The NDC Christopher Kangwa said the only problem with ECZ is that they like doing things without consulting stakeholders. ECZ was put in place by an act of parliament and are here on behalf of the people of Zambia so why should they do things alone when they use tax payers monies.

All we want is the ECZ is to dialogue with all players in the elections, Kangwa said.

WHO PAID FOR BOWMAN LUSAMBO’S DRIVEWAY? ASKS MITI

Civil society activist and Alliance for Community Action (ACA) Director Laura Miti has asked whether Lusaka Province Minister Bowman Lusambo used his own money to tar his driveway. If he did, Miti has questioned how he acquired such wealth.

“The long driveway to Minister of Lusaka Bowman Lusambo’s house is nicely tarred. Here is the question – did he use his own money for what is no mean expense or he got the company doing roads in the area to use public money, equipment and time on it?” Miti writes.

“If he did it himself, he is super wealthy. Where did he get that kind of money? How much tax has he paid on his millions?” she continues.

“If he used public money – well that is not only criminal but highly immoral, in a country in which millions of rural people cry for a simple grader on their roads. That tar to Mr Lusambo’s mansion could change millions of lives cut off by impassable roads every year. So, let us hope Mr Lusambo’s miraculous personal millions paid for that driveway,” Miti concludes

Lusambo’s wealth has previously come under scrutiny by civil society in relation to various cash and food donations, as well as his lifestyle. The minister has claimed that there’s no money for him to steal in his office and that he started driving a Benz before his political career.

Transparency International Zambia (TIZ) has previously urged the ACC to take interest in significant donations being made by government officials despite the economic crisis.

Reacting to the call Lusambo was quoted as stating, “Why should they investigate me for giving nshima to people? Is that a crime? They should come and ask me, they know where my office is. I am government representative number one in Lusaka Province and I have a fixed aboard. If TIZ wants to ask me, let them come and ask me from my office. When you go into the newspaper to start parroting and making noise, that is being a coward! I don’t like dealing with cowards. If they want to find out something from me, let them come. Why should they go to a newspaper? Why are they scared to face me and speaking from their armpits? When I was donating millions of kwacha in Kabushi constituency, they were quiet. Now that I am in a government office, then I can’t do what I am supposed to do? That is not fair! I have donated millions before I was a member of parliament, before I was a minister, not these K2 you are seeing. I expected TIZ to come and ask me then, not these nonsense they are trying to say. Let them man up and come and ask me.”

“They want ACC to start investigating people, who are donating mealie meal and relish and ask where it is coming from? That is cheap! Don’t bring the office of ACC and other investigating wings into disrepute. Let us respect those offices. And if you are saying, ‘ACC should investigate’ they should investigate all Zambians. You have seen taxi drivers, civil servants, managing directors in parastatal companies; you have seen journalists driving and building houses. Are you telling me you want ACC to investigate the entire country? Are you telling me that because I am a minister in government I am not supposed to do any extra activities because I am a minister in government?” he continued.

ABOUT POLITICAL BLACKMAIL BY HH: A CASE OF DEFACTO ALLIANCES

1. There is this narrative which UPND President Mr Hakainde Hichilema and his followers have been advancing; that every other opposition political must agree with them and work in concert with them, failure to which such a political party is a surrogate of the ruling Patriotic Front political party. I want to categorically state that we do not agree with such a narrative as it constitutes political blackmail by seeking to create a defacto alliance in favour of the UPND. Mr Hichilema further postulates that all opposition political parties must unite in order to remove a ruling party and that it is irresponsible and unpatriotic for us in the Patriots for Economic Progress (PeP) to seek our own identity by standing on our own. But the question that l wish to pose to Mr Hichilema is; did he, together with his UPND unite with PF in 2011 to kick out the MMD Government of the day? Or did Mr Hichilema and his UPND advance their own agenda in 2011 in the same way that PeP is seeking to advance its own agenda in 2021?

2. As Patriots for Economic Progress, we are not averse to political alliances. In fact, we strongly believe in the need for political alliances as a vehicle for growth of our party as well as for the ultimate benefit of the Zambian people. However, any alliance must be mutually beneficial to all parties. An alliance should not just benefit one political. Each party should make some sacrifices, which constitutes an investment into the alliance, in order to make an alliance work. When we joined the Opposition Alliance with 13 other political parties about 2 years ago, those were our expectations. At that time, we were willing to make certain critical sacrifices such as forfeiting to stand as a presidential candidate in 2021 so as to rally behind Mr Hichilema’s candidature, and also work hard to push the Opposition Alliance agenda in the public domain as well as help mobilize financial resources for the Opposition Alliance project. I was both the Chairman of the Media Affairs Committee as well as the Chairman of the Finance Committee for the Opposition Alliance and l worked tirelessly in both roles. As Chairman of the Finance Committee and within a period of a week, l was instrumental in organizing the Opposition Alliance end of year Fundraising Dinner at Intercontinental Hotel in December 2018, at which we raised more than K1 million for the Alliance. As Chairman of the Media Affairs Committee, l was instrumental in galavanting from one Media house to another to advance the Opposition Alliance, all at the expense of the PeP agenda. Anyone who understands politics will tell you that Media and Finance are the backbone of any successful political movement. And l handled both of these critical roles with impeccable diligence and competence. But after investing all this effort and sacrifices, Mr Hichilema was not willing to allocate some constituencies and wards for PeP to solely contest in in 2021, as part of the Opposition Alliance package. He point blankly told us that since UPND is more popular than PeP, the best he can offer is for our candidates to contest on the UPND ticket! To us, this amounted to dissolving our party and joining the UPND, which was contrary to our understanding and expectation from the Opposition Alliance. So l told Mr Hichilema that l will be withdrawing my party from his Alliance, and so we left.

3. However, it is evident that Mr Hichilema expected myself and PeP to continue advancing the UPND agenda even though PeP was no longer in an alliance with his party. Our view is that in the absence of a political alliance, there is no compulsion by any party to advance another party’s interests. The concept that the opposition must, by default, unite to kick out a ruling party is inherently flawed and is not shared by even Mr Hakainde Hichilema himself, because he clearly did not unite with PF in 2011 to kick out the then MMD Government. To the contrary, Mr Hichilema walked away from the PF-UPND pact. Sata and his PF solely beat MMD and kicked them out of office. But since today it benefits Mr Hichilema, he wants to advance a narrative that PeP has a duty and responsibility to help him kick out PF and that if we do not do that, then we are surrogates of PF. And yet, he is not willing to sacrifice a single constituency or ward in return for our support.

4. My view is that Mr Hichilema is a politically weak guy and he knows it deep down his heart that he does not posses the mental strength and prowess necessary to kick out a shrewd and brutal ruling party like PF. He knows that he needs the support of people like myself. But Mr Hichilema is not just a weak guy, he is also a selfish guy. He is not willing to give away even a single constituency or ward in return for the support of people like myself. He wants it all to himself. He wants us to rally behind him for free and escort him to State House. Even politically naive people like embattled Chishimba Kambwili who think that Mr Hichilema will make him his running mate will soon bite the dust. Now, these two attributes of being politically weak and yet selfish puts Mr Hichilema in a catch 22 situation. For his political career to succeed and for him to enter State House, Mr Hichilema will need the support and assistance of strong political players. However, those strong political players will be unlikely to offer their support pro bono. They will want some form of power sharing of sorts, which Mr Hichilema, by virtue of his inherent selfishness will be unable to grant. Just like he was unwilling to allow any alliance member to contest even a single seat in 2021, and wanted everyone to be under the umbrella of his faltering UPND party.

5. But being politically weak and selfish and not the only handicap for Mr Hichilema. He also has an inflated sense of being smart. He falsely believes that he can outwit his political allies. But his attempts to outwit his political allies are so shallow that they usually border on crookedness. For example, in 2016, Mr Hichilema allegedly entered into an alliance with three other political parties. The leaders of these three political parties were allegedly requested not to file as presidential candidates and in return, Mr Hichilema and his UPND would support the candidature of their MPs in selected constituencies. For sure, these three political leaders kept their end of the bargain and did not file as presidential candidates. They in fact are said to have gone on the presidential campaign trail with Mr Hichilema. However, when time came for Mr Hichilema to keep his end of the bargain, he decided to allow his party to file candidates in all constituencies including those he had allegedly promised to reserve for his allies. His then allies told me that Mr Hichilema’s excuse was that he had been overruled by his party, the UPND and that there was nothing he could do about it. In my view, such alleged conduct on the part of Mr Hichilema does not amount to outsmarting his political allies, but amounts to being crooked.

6. And today, despite being politically weak and yet selfish and crooked, Mr Hichilema feels that he is entitled to Sean Tembo’s political support. How dare you sir! Just like Sata and his then PF fought and beat MMD, you sir need to fight and beat PF by yourself. We at PeP shall also seek to fight and beat PF by ourselves. It is each man for himself and God for us all. In fact, you sir and your UPND have never supported us in any way, shape or form in our fight against the PF. We have challenged the PF and it’s Government in four cases in court (all of which we won by the way) and you sir never allocated us any of your lawyers among your large army of lawyers, and neither did you contribute a single Ngwee for our legal fees. We undertook 13 successful protests against the $42 million fire tender scandal and you sir never sent a single one of your UPND members to come and give us solidarity. While we were being attacked by Paul Moonga and his thugs along Cairo Road, you sir were lying on your couch at your home busy tweeting. And today, you feel that you are entitled to our support as you seek to fight the Electoral Commission of Zambia on very flimsy matters? Well, you sir can go to hell.

PROTESTS AGAINST ECZ SET FOR OCTOBER 8

…As Lusaka UPND youths successfully notify police of their planned peaceful demonstration against Electoral Commission of Zambia (ECZ) leadership, online voter registration.

United Party for National Development (UPND) Lusaka District youths have fired shots towards their plans to hold a peaceful demonstration against what they described as “undemocratic and illegal decision by the Election Comission of Zambia (ECZ) to delete the 2016 Voter’s register in preference for a new one”.

According to the youths, the march is also aimed at calling for the resignation of ECZ Chairperson, Esau Chulu as well as the electoral body’s Chief Electoral Officer, Patrick Nshindano, describing the two as incompetent and admant in the execution of their duties, a situation they believe had the potential to bring about civil unrest in the country.

Addressing the media shortly after delivering a notification letter to Lusaka Central Police Station this morning, Lusaka District Youth Chairperson Archritius Mwanakayaya made it clear that the notification was in line with Part 3 of the Republican Constitution.

Mwanakayaya accused Mr Chulu and Mr Nshindano of being a danger to the country’s peace and survival and wondered what mechanism the ECZ would use to capture the targetted 9 million voters when the registration of voters in 2011, 2015 and 2016 took a number of years to compile.

He explained that the illegal decision would defranchise several eligible voters in the forthcoming 2021 tripartite elections.

“This activity, slated for 8th October, 2020, will commence from Lusaka’s Main Post Office on Cairo Road to the Electoral Commission of Zambia Headquarters between 09:00 hours and 11:00 hours,” Mr. Mwanakayaya said.

The UPND youths, who have assured of an incident free procession, have also pledged to provide 1, 000 marshals.

Speaking later, Lusaka Province Youth Chairperson Anderson Banda stated that the youths had decided to take the route of demonstrating after all channels of calling for the ECZ to consider maintaining the 2016 Voter’s roll had proved futile.

“We have tried all avenues and all means of communication to ECZ, but we have failed. It is now clear that the ECZ is doing things their own way. We saw how the country almost plunged into a civil war after the 2016 general elections,” Lamented Mwanakayaya.

He added that that all the seven Districts in Lusaka Province had successfully notified the police over the intended demonstration.

Mr Banda also wondered why the Police allowed hired youths to march to State House yesterday to present a petition to President Edgar Lungu over the privatization saga without a police permit.

“Luangwa, Rufunsa, Chongwe, Kafue and Chilanga districts have also successfully notified the police of a planned demonstration over the same” He said.

ECZ Holds Successful Stakeholders Meeting With Four Participating Political Parties In Chilubi By Elections

ECZ HOLDS SUCCESSFUL STAKEHOLDERS MEETING WITH FOUR PARTICIPATING POLITICAL PARTIES IN CHILUBI BY ELECTIONS.

Tempers flared between the two rival parties namely the UPND and PF on the debate on dates submission to hold campaigns to avoid clashes during campaigns.
Both UPND and PF kept on blaming each other over who doesn’t follow the rules and regulations of electoral code.

PF submitted through Mr Benny Kabwela that the campaigns be given a day to each political party per ward to which UPND disagreed that doing so will disadvantage other political parties who may not be well equipped logistically as Chilubi District is so vast with 22 wards with less than 19 days to go submitted by UPND’s Edward Makayi.
UPND also submitted that they need more time even if it’s not there to ensure that far areas that require long hours to reach such as swampy wards takes close to 3 days with boats to reach are factored under special timely circumstances submitted by Risto Mushembe of UPND.

In countering the submission PF objected saying that the swampy wards are accessible by speed boats which can take only 5 hours to reach and it’s not the duty of ECZ or the meeting at hand to discuss wether or not UPND or any opposition parties are ready for the by elections or not. Submitted by Chilubi PF MP Hon Mulenga Fube that he knows opposition MPs who have proper landcruisers and other vehicles why not bring them in the campaigns, he said the essence of competing in an election is a game of competition which anyone going into the game must check their capacity.

Chilubi District UPND chairperson Mr Mwakwa objected that PF has booked all the boats non of the opposition will be able to travel because the only mode of transportation is prebooked in advance by PF hence knocking other colleagues out even if it means crossing the lake Post boat has been booked for PF only and how can opposition bring their mode of transportation on the Island, he submitted further that it so happened in the parliamentary by elections where no boat was available for hire by anyone as PF booked everything a scenario that has repeated itself.

In countering proposals further Mr John Kasongo of PF agreed to the motion of having a day allocatef to a certain political party saying the similar strategy worked perfectly in Lukashya Constituency China ward where all political parties benefitted.

UPND’s Edward Makayi stood in objection telling Mr Kasongo that actually in Lukashya Constituency of Chiba ward he is a witness and victim of how PF attacked the campaign venue of UPND in China ward when the timetable showed that it was UPND’s day yet vehicles where damaged and people injured that the report is right there in Kasama as no PF cadre was brought to book hence calling Hon Fube and Mr Kasongo liars. Makayi’s submission did not seat well with PF leadership who through ECZ requested that he withdraws the word liar to which he maintained his words without apologies because it’s something that should not occur in Chilubi by elections.
Makayi further addressed ECZ and the Zambia Police representatives for assurances of their professionalism ahead of Chilubi by elections because PF are on record disturbing UPND and using their reaction to be arrested. He submitted further that having a stakeholders meeting is one thing but respecting electoral code of conduct is another thing because PF never respects ECZ neither do police take any action citing the example of a PF cadre in Kasama smashing a car in full presence of the police. He begged them saying that Chilubi looks like the last election on the calendar hence the need to behave like normal human beings for once.

Zambia Police representatives led by the Chilubi Island station officer on behalf of the officer in charge responded to the submission by UPND’s Makayi that his office in Chilubi is totally different from other places law brakers will face the law.

UPND’s Risto Mushembe also submitted that it’s not a secret that among the four political parties only PF stood advantage of the other four because they have access to coffers a statement he was requested by ECZ to withdraw and he did.
Mr Mushembe said that it’s not possible to traverse 5 wards in one day because the areas are so vast and communication challenge is to huge but PF through Mr Tute Lewis said that discussing strategies how a political party will handle the logistical movements or campaigns should be entirely a private matter but the time is not there candidates are supposed to sale themselves how they do it it’s up to them or better still plant people in all the wards where candidates can’t reach.

Mwewa Dominic from PAC submitted that indeed time was of essence hence the need to make progress but asked ECZ if those allocated time frames their president Mr Andford Banda was welcome to Chilubi and ECZ agreed that all political parties will have their SGs communicated too.

The stakeholders settled on the mathematical division of 22 wards by 4 political parties in 20 days which they arrived at 5 and hence the timetable was produced.

As I am standing here my heart bleeds, when I saw the President his excellency the President Edgar Lungu on the Television last night at 19:00hrs getting a petition from Ntewewe to ask him to set up a commission on inquiry in to the privatisation of state companies and state Enterprises in the mining.

I am saying my heart bleeds because everyone knows that this inquiry is only targeting one particular individual and that is the UPND President Hakahinde Hichilema, and I think people must not pretend that the petition was crafted by those students and Ntewewe, those students and Ntewewe are sponsored, Kambwili said.

Dr Kambwili went further and said its well known who is sponsoring these students and to start pretending that the petition is coming from independent people it’s the most painful thing.

President Edgar Lungu is on record when he was in Kasama he announced that he will arrest HH, the patriotic front has been saying and it’s all over social media that they shall deal with HH, then you go and take innocent students, you buy them T-shirts and you bus them to state house.

Dr Kambwili wondered who gets to state house to protest or present a petition, most of the people have applied to get to state house to present petitions, but they have been rejected. Dr Kambwili further said he went to demonstrate at state house during the Rupiah Banda regime, but he was not allowed on the grounds of state house, he did the demonstration outside.

Most of the Zambians who have gone there including workers, you remember the retirees who were camped at the Ministry of Justice, they tried to go there but the police were called to disperse them, but what is so special about those students and Ntewewe being allowed in to state house to present a petition and they are addressed by the President.

This only shows that the President is fully involved, and only tells us that his the one who sponsored those students so that he can have a reason to address them and call for the commission of inquiry.

Your Excellency the President it’s better to be frank and not to pretend, and when you have a leader who pretends then the country is not in safe hands.

I call upon you your excellency, if you want to call for a commission of inquiry just call it, but stop abusing other people’s children for heaven’s sake.

The UPND youths the NDC Youths the other day made an application for a permit to demonstrate and present a petition over the online voter registration to ECZ but it was rejected, so what is so special about these students, we’re can they even get money to print those T-shirts Kambwili said.

You know President Edgar Lungu, when you start looking at Zambians as being stupid and hooliga the consequences will be very bad on you, Kambwili said.

The NDC leader has since advised the President who he called his dear brother that, if you leave in grass houses don’t through stones, this presidency you are setting will catch up with you, will catch up with your ministers, in any case the corruption that is in this government the unreasonableness by your ministers, giving out monies all the time, remember that when you are out of power people will also set up a commission of inquiry to find out how you became rich after one year of being President, how your ministers have become rich.

My dear brother don’t go that route, hear the voice of wisdom, don’t go that route because you won’t be President for ever or will you be in state house for the rest of your life, this is just an advice from a brother, my enerst advice, all those who are advising you to set up a commission of inquiry to fix HH, already PF are saying on social media that UPND should find another President as HH will be jailed for five years, so all these are pointing to the fact that this is a PF programme and your office is involved.

Please Mr President ba Lungu (namipapata, umwebo wamuntu waba mukutwi, elyo futi, uwakweba infwa yakwanoko muntanshi, uwakupata tatila busuma bobe).

On this one my brother hear the voice of the wisdom, don’t set up that commission of inquiry, for the soul purpose of fixing an individual in the name of Hakahinde Hichilima, you may hate HH but his your brother is a Zambian, If this commission was being set with good intention of just the Zambians knowing what happened in the privatisation it was going to be a good thing, but we all know it’s being set up because you want to target one man and you have already predetermined and predecided what you want to do with HH this is unfortunate for you as President, people regard you as a humble President, but I think you are getting out of your humbleness with your actions these days, listen my brother and listen to good, don’t go that route.

These people you call advisors are misleading you. What has happened in the last five years of your Presidency is not something to write about.

Dear Zambian Students- A WAKE UP CALL

I have been alive for a while now. I was here when Dr. Kaunda had only led Zambia for 11 years. Of his 27year iron fisted rule I witnessed 16 of those years. President Chiluba led me too as a president in very difficult circumstances. So I have been around the block a few times and I am unplayed by gymnastics nor shenanigans.

I am appealing to you to wake up.

30 years ago companies used to recruit grade twelves while they were in grade nine. Companies used to come to grade twelve graduations ceremonies to recruit. Today graduates can’t find a job. Even PHD holders need a CV now. The University of Zambia graduates over 6,000 people a year. Go figure.

Today security guards are grade twelves. In future waiters will be degree holders. Already some minibus conductors are from CBU. Some Mongu Rice dealers are from CBU (with due respect).

Some of you in University need to quit because you can’t afford to be in university. You are too dependant to be independent. Just walk away for now. You will be back another time. Education never ends. After all, your record will show that you attended university though you did not graduate. President Chiluba graduated in statehouse.

In 2002 I sold a prime plot to go pursue my masters degree. I just needed a degree. Today that plot is worth 1,000 times more than my degree.

My father died when I was 19. For two years prior I nursed my father driving him to UTH in a Landrover 109 even though I had no license. It was horrible being a man in a boys body. I had to grow up quickly. Then he died. I had to educate all my siblings. I had to sponsor my elder sister and situate her. I became a “husband” to my mother and was a man overnight.

At the time it felt like suffering. But now I appreciate my troubled route. I looked poor then. I looked rejected by society. Yet I did not know I was deep in the cracks of life’s auto oven; being baked for leadership. Don’t run away from suffering. Embrace it. Its the worlds greatest university with a strong alumni. Suffering is a tutor with a counseling background.

Today I am a better man because of pain. I finally did take myself to school. I finally did do what I used to admire others do. Your time will come too. Get an income first.

If you have a choice between class and life take life. If you have a choice between boyhood and manhood please be a man anyday.

I struggle about this. But many of you in university are wasting your parents money and time because you are not committed to neither education nor life. You need to choose one.

Success is not in your history nor your qualifications. Success is in your attitude and self application. Whatever you dedicate your life to will enthrone you one day. Even wood floats on water. Even metal floats when shaped in the right way. Buoyancy is available to all who obey the laws of physics and hard work. There is Archimedes law all around us.

How I wish mandatory ZNS was still around. It would shape some of these college students busy wasting their parents money. Some of you your parents have sold everything to educate you and all you do at school is drink, party and fail your papers. What a waste of family effort.

I can stand cadres who are uneducated. But I can’t stand lazy educated failing students who should be out there working and earning a living rather than demanding things from others they cant even provide for themselves.

If you are offended then good for you. If you are not moved then good for you. If you are touched then it’s still good for you.

Remember God helps those who are ready to be helped. The sun works better on plants with chlorophyll. As in phototherapy the picture is incomplete without light. Your life is incomplete without inner revelations of your mission, purpose and above all your quintessential divine path.

Lawyers abandon Kambwili again

CHISHIMBA Kambwili has been abndoned by lawyers again.

Last February, the NDC leader was ditched by his lawyers Keith Mweemba, Gilbert Phiri and Christopher Mundia in a case he is charged with forgery, uttering a false document and giving false information in relation to the registration of Mwamona Engineering Technical Services.

And today, it came to light that the legal team representing the former Roan Constituency PF member of parliarment had ditched him again.

In these matters Kambwili is charged with contempt of court for allegedly tampering with evidence at Patents and Companies Registration Agency in relation to the qregistration of Mwamona engineering and technical services which is a subject matter in an active case before Magistrate Simusamba.

Kambwili is also facing a charge of defamation of the President for questioning President Edgar Lungu’s Association with Lusaka businesman Valden Findlay whom he accused of being a drug dealer.

Joseph Akfumba of MAK partners who represented Kambwili told Magistrate Nsunge Chanda and Felix Kaoma that the former’s lawyers Keith Mweemba, Gilbert Phiri and Christopher Mundia backed out on representing the accused last night.

Submitting before magistrate Chanda in the contempt case Akfumba sought an adjournment indicating that he needed to study the matter as Kambwili’s lawyers had withdrawn their legal services on Thursday evening.

“Your honor other lawyers withdrew last night hence we had no option but to look for another Counsel at the eleventh hour,” Akafumba said. “looking at this situation it’s difficult for us to proceed as I will need enough time to go through the documents of this matter, am kindly asking for an adjournement and am kindly asking if the court can avail certain notes in regards to this matter.”

Magistrate Chanda directed that the matter ought to be concluded as she noted that Kambwili was equally tired of appearing before court and adjourned the matter to October 26.

And when Kambwili’s case was called before Magistrate Kaoma Akafumba reiterated his earlier submissions before Magistrate Chanda and requested for an adjournment.

But magistrate Kaoma in his ruling said he was displeased with the conduct of Kambwili’s previous lawyers as their failure to inform him of their decision to withdraw representation was disrespectful to the court.

” The application for an adjournment is granted but I would like to express my disappointment in the conduct of defense counsel for failing to appear before court and state their position. Atleast they should have come to excuse themselves from this matter. Even this morning they (Previous lawyers) would have sent a note or sent a representative,” Magistrate Kaoma said.” This is lack of professional etiquette and courtesy. Had they informed the court in advance we would be upholding our orders otherwise the legal profession will end up like other professions where people will be doing whatever they want.”

Magistrate Kaoma reluctantly adjourned the matter to November 10.

Libya After Zambia’s Offshore Assets As Nation Becomes Credit Risk

Libyan telecommunications company LAP GreenN is considering chasing after Zambia’s offshore assets after the southern African country defaulted four times on an order to pay $257 million in compensation for nationalizing a firm it invested in.

Zambia owes state-owned LAP GreenN more than $400 million including interest, and has defaulted on payments totaling about $220 million following a 2016 judgment in the nation’s high court, according to the Libyan Post, Telecommunication and IT Holding Co. which owns LAP GreenN. Yields on the nation’s dollar bonds climbed.

The company has “patiently” sought an amicable resolution, while Zambia has avoided and delayed paying, LPTIC Chairman Faisel Gergab said in an emailed statement. LAP GreenN “will pursue all avenues or recourse available to it should the defaults continue” and wants to recover the full amount due, he said. The country’s portfolio of international commercial assets is at risk of attachment, Gergab said.
Zambia’s Finance Ministry and presidency didn’t respond to requests for comment sent via email, phone and text message. Felix Mutati, who was replaced as finance minister in February, acknowledged the LAP GreenN debt to lawmakers in October, saying the government was “dealing with the matter of compensation.”

The compensation order dates back to LAP GreenN’s 2010 purchase of 75 percent of Zambia’s state-owned Zamtel Ltd., which the government seized 18 months later. The company’s plan comes after investors including Nomura International Plc and Bank of America Merrill Lynch expressed worries over Zambia’s dollar-debt levels, suggesting the totals may be higher than government’s estimates.

‘Red Flag’
The Finance Ministry says its official numbers showing $8.7 billion of foreign debt are accurate, and urges anyone with proof to the contrary to present it to the government.

The default “has to be a red flag” for investors, said Jay Auslander, a partner at Wilk Auslander LLP in New York who specializes in judgment enforcement and distressed debt litigation.

Moody’s Investors Service and Fitch Ratings Ltd. declined to comment. S&P Global Ratings didn’t respond to an emailed request. Zambia hasn’t defaulted bonds or loans since 1983, Moody’s said in January.
Yields on Zambia’s $1 billion of bonds due in April 2024 rose 19 basis points to 7.73 percent, the highest since April 11, at 9:14 a.m. in New York.
The missed payments following the 2016 order mean that LAP GreenN could pursue Zambia’s assets, Auslander said by phone. “This was a consent judgment, it’s fully enforceable.”

It could also amount to what’s known as a cross-default in Zambia’s prospectus for its $1.25 billion Eurobonds due July 2027, he said. That would mean investors holding 25 percent of the notes could declare the debt immediately payable, though it’s unlikely they would do so, he said.

Caleb Anderson may come across as a normal 12-year-old, but his academic background and the successes he has been able to chalk over a very short period of time, thanks to his unique ingenuity, puts him way above his peers.

Despite his young age, Caleb is already a sophomore at Chattahoochee Technical College in Georgia, studying aerospace engineering as his major.

Caleb started showing flashes of his brilliance from the time he was in diapers, proving he did not have to impatiently wait to talk to able to communicate, as he had already picked up and learned sign language. He bettered that feat by learning to read the constitution of the United States at the age of two, according to 11Alive.

“By nine months old, he was able to sign over 250 words, and by 11 months old, he was speaking and reading,” Caleb’s family told the news platform.

By the time he was three, Caleb could speak Spanish, French and Mandarin besides English, and also impressively qualified for MENSA – the largest and oldest high IQ society in the world. The society is open to people who score at the 98th percentile or higher on a standardised, supervised IQ or other approved intelligence test.

“As we started to interact with other parents, and had other children, then we started to realize how exceptional this experience was, because we had no other frame of reference,” his father said.

Caleb, who joined MENSA two years after qualifying, rubs shoulders with other young, Black geniuses in the intellectual exchange forum, including Wilfred Ramarni, Alannah George and Anala Beevers. His parents told 11Alive his admittance at the age of five made him the youngest African-American boy to become a member of the society during that period.

The whizz-kid’s mother said their decision to enroll him in college was encouraged by his outstanding performances from lower school through to high school and his desire to push himself for more knowledge.

“He said, ‘mom I’m bored. This is not challenging’,” his mom said. “‘It’s really not helping me grow in my learning, and I think I’m ready for college.’”

Though Caleb is very young, he doesn’t let his age get in the way, claiming his college experience was exactly how he envisioned it if he were older. “It was exactly how I expected it to be like, if I were 18 or something,” he told 11Alive. The 12-year-old has also set his sights on also furthering his education at Georgia Tech and possibly MIT.

Caleb’s parents believe there are also other equally gifted African-American children out there, and people need to move beyond the stereotypes and give them the much-needed support.

“I think people have a negative perspective when it comes to African-American boys. There are many other Calebs out there. African-American boys like him,” his mother said. “From being a teacher – I really believe that. But they don’t have the opportunity or the resources.”

In a moment of pure mental short circuit, they sabotaged Zambia’s image and destroyed our relationship with international money lenders. What kind of recklessness is this!!!!

President Lungu allowed Dr. Ngandu to lie to our creditors on a whole range of issues, and it took zero amount of time for our creditors to declare the request toilet sit material and rejected it.

And it is very clear to see what this guy’s obsession is: to cling on to political power by eliminating Mr. Hakainde Hichilema off the ballot.

How can a whole President, be spending time receiving junk requests on the steps of State House when the country’s economy is about to burn? Does this gentleman understand the kind of trouble his government has put all of us into?

Let me remind him and his government, that once this economy falls flat and people no longer can feed their families or unable to access healthcare, or when companies begin to close because of a crushing local currency, the public will demand for the immediate resignation of his government or the people will protest him out of office.

COMPREHENSIVE STATEMENT ON ECZ MULTIPLE BREACHES OF THE ELECTORAL PROCESS ACT OF 2016

VOTER REGISTRATION

SECTION 7: ‘ The Commission shall conduct a continuous registration of voters’.

Interpretation: This means that voter registration is an ongoing process that should take place on a daily, weekly, monthly and annual basis and should never be stopped. The law requires the ECZ to have permanent voter registration centres just like the National Registration Office.

The Law only requires the ECZ to stop voter registration in any district during the period of a by election, or during the period of general elections. Otherwise voter registration is to be done on a daily basis without breaks.

Question: Has the ECZ conducted continuous voter registration since the electoral process Act of 2016?

Answer: The Answer is an emphatic ‘NO’. The ECZ is in breach of the Electoral Process Act of 2016, they have failed to conduct continuous voter registration since 2016, and as such the Chairperson of the ECZ, Commissioners of ECZ and Chief Electoral Officer must be compelled to resign from their positions for being in breach of the law.

PRISONER VOTING

SECTION 9: (1) The commission shall not register a person as a voter if that person

(D) is detained under the Criminal Procedure Code.

(F) is under a sentence of death imposed by a competent court, or a sentence of imprisonment imposed by a court or substituted by a competent authority for some othersentence imposed by that court;

Interpretation: The law is very clear, any person currently serving a prison sentence as a result of a court conviction is not eligible to register as a voter, and the commission is prohibited by law from registering prisoners as voters.

Question: Is the ECZ in breach of the law by registering prisoners as voters?

Answer: It’s an emphatic ‘YES’. The law expressly prohibits the registration of prisoners as voters. The ECZ is therefore in serious breach of the law by proposing to register prisoners as voters.

It is illegal and an offence to register prisoners as voters.
On these grounds the ECZ Chairman and Commissioners must resign in national interest.

VOTER REGISTRATION PROCESS

Section 13. (1) The Commission shall establish a Provisional Register of Voters as prescribed.

Question: Is there a provisional voter register?

Answer: Yes, there is, it was established in 2016 and used in the 2016 General Elections. Infact, the same register is in use today in all by elections that have taken place between 2016 when the voter register was compiled and 2020.

Section 14. (1) The Commission shall compile and maintain the Register of Voters as prescribed.

Interpretation:

The key words here and ‘compile’ and maintain’.

In 2016 the ECZ compiled a voter register. Compilation of the register is a once off event which took place in 2016.Therefore, the ECZ only needs to maintain the register that was compiled in 2016.

Question: How should the ECZ maintain the voter register?

Answer: Through continuous voter registration as prescribed in section 7 of the Electoral Process Act of 2016.

Question: Is the ECZ in breach of the law by failing to maintain the register that was compiled in 2016, and proposing to throw it away and create a new register?

Answer: The Answer is yes, the ECZ is in breach of the law, the law requires them to compile a register (which they did in 2016) and to maintain it through continuous voter registration (which they have not done since 2016).

On these grounds again the Chairperson, Chief Electoral Officer and Commissioners of the ECZ must be compelled to resign or be removed from their offices for breach of the electoral act, negligence, and gross incompetence.

SECTION 10 – DEREGISTRATION OF VOTERS

A registration officer shall de-register a voter if the registration officer is satisfied that the voter

(a) does not qualify to be registered as a voter;

(b) no longer meets the qualifications for registration as specified in section eight;

(c) has been fraudulently registered;

(d) obtained the registration through submission of falseinformation or making of a misleading statementInterpretation: What this means is that these are the only circumstances under which a voter can be deregistered.

Question: Is the ECZ in breach of the law by deregistering over 6 Million registered voters ?

Answer: The answer is an emphatic ‘YES’, the ECZ does not have authority under law to deregister any voter unless one of these 4 criteria has been met.

On these grounds again the Chairperson and Commissioners of the ECZ must be compelled to resign for proposing to illegally deregister over 6 million validly registered voters who have not met the above 4 criteria for voter deregistration.

REMOVAL OF DECEASED PERSONS FROM THE VOTER REGISTER

The argument put forward by the ECZ is that they want to create a new voter register because there are a lot of deceased (dead) persons on the register.

So what does the law say about this matter?

Section 16: Amendments to Voters Register 16.

(1) A registration officer shall—

(c) delete the name of a voter who is deceased.

The law is very clear, deceased voters must be deleted from the register.The Law does not allow for the creation of a new register for the reason of knocking off dead people.

The word ‘DELETE’ means to ‘REMOVE’ from an already existing document.You can only delete something from something else that already exists, and what exists is the 2016 Voters Roll, therefore the deceased persons must be deleted from the 2016 voters roll.

Question: Is the ECZ In breach of the Electoral Process Act 2016 by proposing to discard the register for the reason of knocking off deceased people?

Answer : The answer is an emphatic ‘YES’, the law requires the ECZ to ‘DELETE’ the names of deceased persons from the voter roll, it doesn’t require the ECZ to create a new voter roll, in fact there’s nowhere in the law where the ECZ is granted powers to discard the voters roll and create a new one, the law requires them to maintain the existing register on a continuous basis and to register new voters and delete deceased voters. The voters roll has an indefinite life abs no one has authority under the law to discard the voters register.

On this basis again, the Chairperson of the ECZ, Chief Electoral Officer and Commissioners must resign and be prosecuted for breaching the law.

CONCLUSION

Any election conducted by the ECZ through a new voter register is illegal, ultra vires, null and void and is non-binding on the people of Zambia.

Any election where prisoners are allowed to vote is illegal, ultra vires, null and void and is non-binding on the people of Zambia.

Any election conducted by the ECZ where the 6.6 million validly registered voters are deleted from the voter register is illegal, ultra vires, null and void and is non-binding on the people of Zambia.

So Zambians should not even consider any process conducted by the ECZ outside of the provisions of the law, that is not an election, it is an illegal attempt to create a dictatorship in the country through an illegal sham electoral process done outside of the provisions of the law.

Zambians should not participate in any purported election done outside of the provisions of the law, it is illegal, null and void, ultra vires and non-binding on the people of Zambia.

All genuine political parties should not participate in any purported election done outside of the provisions of the law, it is illegal, null and void, ultra vires and non-binding on the people of Zambia.

Participating in such an illegal election would be validating it and rubber-stamping illegality and a bogus electoral process conducted outside of the provisions of the law.

If the ECZ proceeds to conduct a purported election conducted outside of the provisions of the law, Zambia will be without a President because any individual supposedly elected through that process shall not be recognized as President of the Republic of Zambia because they would have been elected through a process that is illegal, null and void, ultra vires and outside of the provisions of the law, which will create a constitutional crisis as the country will be without a legally elected Head of State when the tenure of President Edgar Lungu has expired.

TAKE RESPONSIBILITY OF THE MYSTERIOUS 48 HOUSES.

A news report has come to my attention which alleges that a man who is a suspect in the ownership of the 48
mysterious houses, a Mr Charles Loyana, is my nephew. The news report further alleges that while being interviewed on Radio Phoenix on 29 September 2020, I had difficulties in answering questions from a caller who insisted on knowing from me how Mr Loyona, a mere civil servant, earned enough income to build the 48 houses.

I wish to state categorically that I have no relationship whatsoever, whether by blood, marriage, friendship
or any other social connection with Mr Loyana or anyone else who is allegedly connected to those 48 houses.
I don’t know Mr Loyana, I have never met him and I don’t even know what he looks like.

Regarding the allegation that I had difficulties on a radio interview to explain how Mr Loyona earned income big
enough to build 48 houses, this is yet another cheap lie. Many people who listened to my interview on Radio
Phoenix on the 29th of September 2020 will agree that no person called during the entire interview to ask me
about the 48 houses.

Meanwhile the recording of the entire interview may be obtained from Radio Phoenix..

I wish to urge those who did not tune in to listen to the recording so that they get a proper perspective as to why
we are experiencing the current economic problems such as the loss of value of the Kwacha which were the
issues under discussion.

The vile and malicious insinuation that Mr Loyana is related to me is a PF creation. It first emerged in Parliament
months ago when the PF member of Parliament for Chitambo, one Remember Mutale, made a wild accusation
that Loyana is my nephew. Because parliamentary rules prohibit lies, I reported him to the Privileges Committee
of Parliament which deals, among others, with disciplinary cases involving MPs.Mr Mutale was ordered to prove
his accusation at a hearing. For the purpose of the hearing, he was at liberty to bring as many witnesses as he
wanted.

He lamentably failed to prove his allegation because it was based on lies. Arising from his failure, he was found to have breached Parliamentary rules. For this, he was admonished by the Speaker in front of all MPs and he was made to apologise to me, which he did.

In conclusion, the story that Mr. Loyana who is allegedly connected to the 48 houses, is my nephew, is totally
false, vile and malicious, and only fit for the garbage.

In the meantime, Zambians await the conclusions from
the many investigative agencies in the country to find out the owner of those 48 houses and bring him/her and
their accomplices, no matter their status or connections in society, to book.

Surely, this is not a complex matter
as ownership of property in Zambia is on public records and can be easily verified at the Ministry of Lands.

PARLIAMENT RATIFIES MVUNGA’S APPOINTMENT AS BOZ GOVERNOR

Parliament has unanimously ratified President Edgar Lungu’s appointment of Christopher Mvunga as Bank of Zambia (BOZ) Governor replacing Denny Kalyalya.

This came to light when PF Msanzala MP Peter Daka presented moved a motion to adopt the Report of the Parliamentary Select Committee appointed to scrutinise the Presidential appointment of Mr Christopher Mphanza Mvunga to serve as Governor of the Bank of Zambia, for the Fifth Session of the Twelfth National Assembly, laid on the Table of the House on Wednesday, 30th September, 2020.

Mr. Daka says all security agencies were satisfied that Mr. Mvunga is highly qualified and fit to be Bank of Zambia Governor.

Seconding the motion, Kantanshi Independent MP Anthony Mumba says President Lungu made the right choice.

Leader of the Opposition in Parliament and Monze Central MP Jack Mwiimbu, UPND Bweengwa MP Kasautu Michelo, Livingstone MP Mathews Jere, Liuwa MP Situmbeko Musokotwane, also debated the motion.

Finance Minister and former BOZ Deputy Governor Bwalya Ng’andu brings to the table understanding latest technology in line with the fast changing technology adding that he is focused on delivering results.

Mr Mvunga, is immediate past Deputy Secretary to Cabinet in charge of Finance and Economic Development.

According to the constitution, a person holding the office of Governor must have the following qualifications;

He or she must have specialised training and experience in economics, finance, accounting, banking, law or other field relevant to banking, as prescribed; and a person of proven integrity.

PRIVATISATION (PART 1)
This is the most common word in Zambia because everyone at one time or the other has spoken about it, starting from the politicians, supporters of certain organizations oftentimes than not they do speak about privatization. What is privatization? Privatization is a broader word but the common definition is about the transfer of own ship or control of the assets, or companies, or the industries from the public sector to the private sector. In the free market economy it is not the role of government to participate in the running of business and this is left to the private sector.

Now we can move on to this important question, why governments should choose to privatize industries, companies’? Well when the company is under the public sector, whatever revenue the company generates it goes to finance the national budget in that it also reduces on the budget deficit.

On the other hand, the company will lack competitiveness, effectiveness and efficiency, which oftentimes is the case in the privatize sector as the company priorities the creation of wealthy from maximization of profits.

The benefit of privatization can be seen at both microeconomic level and the macroeconomic as well, let us get started with the microeconomic environment. The distribution of resources is done in a more efficient way in that if the undertaking is not viable the capitalist will abandon that project and reinvest his capital on the more profitable venture. To the contrary under the public sector in order to keep the labour force, the treasury will subsidize those entities that are facing economic challenges. And this results in the increase of the government expenditure in the national budget, but the private sector when it reallocates financial resources to the profitable ventures, this result in the improved G.D.P and economic growth. On the macroeconomic environment the advantage of privatization starts right from the beginning, when companies are sold the revenue realized go straight to improve the budget deficit.

The other advantage worthy mention here is the cut of subsidies to companies, and also removing business from the government, that is the day to day supervision of business. And the ultimate goal of privatization is to create economic growth and improve the livelihood of the population. Now we come to the most important aspect of privatization which is the sequencing and pace of it.

For, example in Zambia this took about 5 years, now the question is should it take much longer long say 10 or 20 years or much shorter like 1 or 2 years. If we take the countries in Europe they were very fast to privatize while China took a very slow pace in the process. But the most unprofitable companies must go first while the most profitable may go last. But the actual time frame for the process can be determined by the government concerned.

Zambia as a case study, Zambia is a country blessed with the abundant natural resources; among them are the mineral wealthy ranging from copper as the mainstay of the economy and cobalt, zinc and emeralds among others. Others among the natural resources are the water resource which it is estimated that in the sub-region 40% of the water bodies are concentrated in Zambia. The free land space for agriculture and only about 20% of the land space is occupied.

During the colonial times the economy of Zambia was under the free market economy. The mining industry as the mainstay of the Zambian economy was controlled by the two private companies namely; Anglo-American corporation and the Roan Selection Trust. In the years 1960s and the 1970s due to the copper boom on the market the country under went many economic developments, such as the infrastructure development.

The state intervention started in the year 1968 when the then president announced the nationalization of the private companies. The last on the list was the nationalization of the mining industry. In the banking sector the foreign banks were not nationalized but to the contrary government came up with 3 local banks.

What made the public sector to fell? One bigger problem was the lack of competition because the economy had the monopolistic environment. Among others the inappropriate technology especially in the mining industry, the sector did not innovate with the modern and advance technology, inexperienced management, and the misappropriation of resources. On the macroeconomic front government used to subsidy companies at the expense of offering social services to the citizens. The privatization process started with the UNIP government meaning that even if UNIP had continued in government the privatization process was to go on. At the 5th Extraordinary session of the United Independence Party in the year 1990 the then president of Zambia Dr. Kenneth Kaunda announce that the public sector have run its race to the finish. In his budgetary presentation to parliament the then minister of Finance G. G. Chigaga announced to the house. “In addition, the Party and its government have decided in principle to sell off some parastatal companies. The modalities for sale are being studied, including the possibility of selling some shares to workers and members of the public”. What this shows is that the process started with the UNIP government because the economies of the world were moving to the capitalist type of economy.

Fast forward we reached the year 1991 and Zambia had a new government by the MMD, right from the very beginning the new president F.J. Chiluba announced. “As far as the privatization program is concerned there is no sacred lamb. In other words, the government is committed to total privatization of the parastatal sector.” The new minister of finance Mr. E. Kasonde announced to parliament “The MMD government has made clear its intention to promote the private sector and divest itself of investment in parastatals. In this regard, privatization will proceed expeditiously and the revenues generated will be put in a special fund to supplement the government capital budget”.

The MMD government was elected of the basis of promoting the private sector participation in the economy. From 31st October 1991 on ward parliament enacted laws that could protect the privatization process, these laws were safeguards and they were supervised by the Zambia Privatization Agency, and in case of the noncompliance it was the role of the ZPA to bring that matter forward. The land mark legislation came in 1992 when as already indicated the privatization act was passed which was Act (No; 21 of 1992 and brought about the birth of the Zambia Privatization Agency. Among others the role of the agency was to Divestiture sequencing plan which was to be approved by parliament.

LETTER TO THE 7th PRESIDENT OF THE REPUBLIC OF ZAMBIA

It is a blessing to be the 7th president of Zambia; 7 is a very significant number in the spiritual realm. 7 means complete, may you complete all the work that lays ahead of your tenure of office. 7 means accomplishment, may you accomplish so much in your tenure of office. 7 also means rest, may the people of Zambia rest from the economic turmoil that they have suffered under the PF Government. Mr president this is the reason it has taken you this long for you to become the 7th president of Zambia so that people can see the glory of God unfolding. God’s time is the best Ecclesiastes 3 vs 11 “He has made everything beautiful in its time”. Sir, you have come a long way in this fight for Justice and economic liberation. You have gone through so much pain and fought so many endless battles. All this was for a reason and purpose.

You have asked yourself so many questions, it has nothing to do with you and it is not your fault. I remember in South Africa when I heard you speak of your incarceration and how you were mistreated. These were your words and I quote “I wouldn’t want any human being to go through what I went through in prison including the people who did that to me”. I was touched and uncontrollably shed tears of love and pain at the same time. God was preparing you for the right time to become the 7th president of Zambia and that right time is 2021. You were labelled bitter and desperate for power, but all your predictions of bad governance repercations by the PF Government has come to pass.

We all know now that you are the right man for the job which is to drive our Nation forward towards real economic development .We know that you are a Shepard boy and like the biblical famous Shepard boy David, the 7th son of Jessie did for the Nation of Israel, we need that Shepard boy anointing in you for the benefit of this great nation of Zambia. The man of the moment, the Moses of this generation and now the people’s choice. Your time has come sir. The man of 1 wife not given to wine. This is the first leadership quality anywhere, to head your own house and control your children which you have proven and everyone is able to see.

Your track record speaks for itself; Integrity is your middle name; you are an example and inspiration to every young person in our generation. You really inspire us. For your own information Mr president four years ago, I was on board on the same plane with you from Johannesburg to Lusaka. It was amazing as you were sited 3 roles behind me and as you passed by on your way to your seat you greeted me. I was humbled at the gesture that one of the richest men in Zambia and president of the largest political party in Zambia was on a plane sitting just like an ordinary person. To me that was humility at its best.

You would have simply used a private jet or you could have been in business class like other heartless people do with tax payers money. But you wanted to interact with the people. From that day my love for you grew even more. My prayer is that God may grant you the desire of your heart which is an opportunity to govern the great Nation of Zambia.
I have no doubt you will deliver and unite our nation.

You will prove your critics wrong and inspire the nation to not just dream but realise our dreams even beyond our expectations. With the guidance of our Almighty God I urge you not to lose focus and work hardest for the benefit of all Zambians just like you have done in your personal business life . Your idea to replace the culture of “parte after parte” with one of “work after work” is the way to go because time is not with us. More than 50 years after independence we are still dwarfed economically and still importing more than we export! Thank you Mr president for taking your precious time to read this letter, you are the Hope and the Help of this great Nation of Zambia. God bless you, your family and the people of Zambia.

HH, Kambwili And Mumba Are Hell-bent On Causing Anarchy Ahead Of 2021 Elections – Sean Tembo

Press | Statement: The ECZ Online Voter Pre-Registration Process And Plans To Establish A New Voters’ Roll.

Lusaka – 1st October, 2020.

1. As Patriots for Economic Progress (PeP), we have been following with great interest the debate about how the Electoral Commission of Zambia (ECZ) is conducting its preparations for the next general elections which are scheduled for 13th August 2021. There are two main objections that have been raised by our fellow opposition leaders, being the online voter pre-registration process and the plans by ECZ to establish a new voters roll as opposed to updating the 2010 voters roll. We have also closely monitored the explanations that have been put forward by the Electoral Commission of Zambia with regard to these two contentious issues.

2. On the issue of the online voter pre-registration, the Electoral Commission of Zambia has indicated that this is merely a preliminary stage which is meant to capture details of potential voters in advance so that when potential voters go to physically register, the time taken to register each one of them can be reduced because most of the details would have already been captured during the online voter pre-registration process. The Commission has continuously and consistently emphasized that the online voter pre-registration process is not final and that it is optional. Those who do not do online voter pre-registration will still be able to register as voters when the physical registration process commences, except that they will take slightly more time to do so compared to their colleagues who would have undertaken online voter pre-registration and most of whose details would have already been captured and would only require verification.

3. On the issue of plans to establish a new voters roll as opposed to merely updating the 2010 voters roll, the Commission explained that a new voters roll is likely to be more accurate than merely updating the 2010 voters roll.

4. As Patriots for Economic Progress, our view is that the explanations that have been given by the Electoral Commission of Zambia on both the issue of online voter pre-registration as well as on the issue of a new voters roll, are sound and valid to any reasonable person. Given the fact that the online voter pre-registration process is not final and it is also optional, the arguments that have been advanced by some of the opposition leaders that citizens in rural areas will be disenfranchised because they do not have smartphones nor internet, do not carry any water. That is because even if a citizen does not do the online voter pre-registration, they will still be able to register as a voter without any qualms.

4. On the issue of developing a new voters roll as opposed to updating the 2010 voters roll, we share the views of the Electoral Commission of Zambia that a fresh voters roll that is done from scratch is likely to be more accurate than updating the existing voters roll. That is because the existing voters roll is approximately 10 years old now and a significant number of the voters that were registered in 2010 might have died while others have since moved to other parts of the country. Therefore, updating the 2010 voters roll will present two fundamental problems; firstly we will have a significant number of dead people on the voters roll, especially given the fact that we have a manual and predominantly inaccurate records system for the deceased in Zambia, and secondly we are likely to have several duplicates for people that would have registered in 2010 but have relocated to other parts of the country and decide to register afresh even though they are already on the voters roll. This means that it will be a cumbersome and expensive process to clean up and validate the updated voters roll. These problems will not arise if we do a totally fresh voters roll.

5. As Patriots for Economic Progress, we have further noted with regret that some opposition leaders including UPND’s Hakainde Hichilema, NDC’s Chishimba Kambwili and MMD’s Nevers Mumba, have been conducting themselves in an unreasonable manner by seeking to create a narrative that everything about ECZ is wrong. These leaders have been condemning all the Commissioners at ECZ, they have been condemning the Chief Electoral Officer, they have been condemning each and every activity undertaken by the Commission. To them, nothing and no one is good at ECZ. Everything is bad. These leaders have issued various statements to the effect that the electoral process is rigged and that the outcome of next year’s elections should not be relied upon.

6. As Patriots for Economic Progress, we are cognizant of the fact that the Electoral Commission of Zambia must be held accountable in the manner that they undertake the electoral process. As political parties, it is our duty to hold ECZ accountable. However, even as we hold ECZ accountable, we ought to be wary of two things. Firstly, we must always endeavor to be reasonable in our criticism of the Commission. For example there is nothing worth criticizing the Commission about with regard to either the online voter pre-registration process or the plan for a new voters roll, because the explanations that have been consistently and continuously put forward by the Commission are perfectly reasonable. Secondly, even as we criticize the Electoral Commission of Zambia, we need to resist the temptation to usurp the powers of the Commission. The Constitution of Zambia only gives one body the power to organize and manage elections in Zambia. And that body is not UPND, nor NDC nor MMD. Indeed, the only body entrusted with managing elections in this country is the Electoral Commission of Zambia. That is the system that we have created for ourselves as the Zambian people, and we must not allow a few embattled politicians, whose shelf life has long expired, to usurp this system. Of course, as political parties, we are stakeholders to the electoral process. But every stakeholder must know their boundaries. Being a stakeholder does not mean that you are the owner of the process. You are merely a concerned party whose opinions must be heard and considered. Favorably or otherwise.

7. As Patriots for Economic Progress, it is our considered view that some of these opposition political party leaders including UPND’s Hakainde Hichilema, NDC’s Chishimba Kambwili and MMD’s Nevers Mumba, are hellbent on causing confusion and anarchy ahead of next years general elections, so that they can create advance excuses to give to their supporters for their likely poor performance in next years elections. However, labeling the electoral process as rigged without any evidence or fact is dangerous to the peace and security of this country, as some less probing citizens will take the words of their leaders as gospel truth and proceed to cause anarchy. Therefore, our view is that any opposition leader who labels the electoral process as rigged must be put to strict proof, and failure to which they must be prosecuted to the fullest extent of the law for alarming the nation.

8. As Patriots for Economic Progress, we wish to remind the Zambian people that the political process in this country has been ongoing since the 1950s. Some political leaders made it and became Republican Presidents while others did not and went down in history as such. However, the Republic of Zambia has always been there and should always be there regardless of the happenings in the political process of this country. Therefore, any individual politician, regardless of how popular they feel they are should conduct their politics within the parameters of preserving the continuity of this Republic. The conduct of individuals such as UPND’s Hakainde Hichilema, NDC’s Chishimba Kambwili and MMD’s Nevers Mumba of late has the potential to bring out anarchy and jeopardize the continuity of this Republic. It is therefore our appeal to these gentleman that they stop practicing a scorched earth policy in their politics. Failure to which they need to be able to bear the consequences of their actions.

ECZ CANCELLATION OF MEETING WITH POLITICAL PARTIES WORRISOME – KAMBWILI

This afternoon the National Democratic Congress (NDC) party President Dr Chishimba Kambwili was supposed to attend a meeting called by the ZCID and the Electoral Commission of Zambia in regards to the Online Voter Registration.

But the meeting was called off at an eleventh hour.

Dr Kambwili was supposed to attend this meeting with NDC Vice President Rikki Josephs Akafumba, NDC Secretary General Bridget Atanga and Edward Mumbi NDC member of central committee, who is also Dr Kambwili’s Presidential spokesperson.

The duo who gathered at Dr Chishimba Kambwili’s residence by 13:00hrs were equally shocked that the meeting was canceled.

Dr Kambwili had this to say; Today is a very sad day, extremely sad day in the preparations of the 2021 general elections.

Yesterday the ECZ communicated to all political parties that they were going to meet stakeholders so that we can discuss the issue surrounding the online voter registration and the issue of doing away with the old voters register, all of us political parties were ready, I personally received a number of calls from fellow Presidents and Secretary General’s encouraging all of us to attend this important meeting, Dr Kambwili said.

The NDC leader further said NDC do understand that they are stakeholders and they must speak on behalf of the people of Zambia but unfortunately the ECZ communicated to all political parties at the eleventh hour that the meeting has been cancelled, and the reasons given was that this matter could not be discussed because there is a court case going on in which the UPND and some NGO’s have challenged the ECZ over these same issues of online voter registration and of cause the doing away with the old voters register.

Country men and women, should it only be sub judice when it favours the opposition, when it favours the ECZ or it favours the ruling government is not sub judice.

When there was the issue of Bill 10 the UPND did alude to the fact that we cannot continue considering bill number 10 because there is a matter before court, but the Patriotic Front through its lawyers and parliament refused totally and went ahead and considered bill 10 despite the fact that the matter was in court and it was tantamount to sub judice.

In my case when I was removed from parliament as Roan member of parliament, my case was in court, but the speaker went ahead and declared my seat vacant despite the fact that the matter was in court, so when government is involved it’s not sub judice unless the opposition is involved.

And if the ECZ are saying we cannot have a meeting to discuss the issue of the electoral process because the matter is in court then they should stop the online voter registration because it’s also sub judice, why should it be good for them to go ahead and continue the voter which is a bone of contention and refuse to meet the stakeholders on pretence that it’s sub judice, I don’t know we’re this country is going, said the NDC leader.

Today could have been an opportunity for all of us to be heard and obviously resolve the issues surrounding the online voter registration, but somebody somewhere has engineered that this meeting should not go on.

Almost all the opposition political party President’s I spoke to were ready to attend this meeting and these issues could have been resolved in an amicably way. But I think they are trying to play hide and seek so that they can convince those who have gone to court to withdraw the case and at the end of it they don’t resolve the issues, this is not good for Zambia, please Mr Esau Chulu, My dear brother Patrick Nshindano respect the views of the Zambian people, for once do the right thing, surely you want to go down in history as the people who set the country on fire, issues of elections are very sensitive.

I am glad that President Edgar Lungu came out openly to state that he does not also support the doing away of the old voters register, we welcome that President Lungu and this is the way it should be, surely if you are coming out like that, who would want to oppose you or attack you, well-done Mr President , but you can go further than that by engaging the ECZ to tell them to announce that the old register will still be valid.

You cannot capture 9 million people in 30 days it’s practically impossible and this is our cry and the law is very clear on continuous voter registration, it says they shall be continuous voter registration, why do you want to bring your own law and cancel the old register.

Today we have missed an opportunity yet again in this country to seat round the table and discuss as Zambians.

Dr Kambwili has since appealed to the ECZ that it’s not too late but call for this meeting tomorrow.

And all stakeholders holders including NGO’s and Churches should be part of this meeting. But if you have refused to hold this meeting then stop the online voter registration so that it’s 50/50, Kambwili said.

ECZ’s online voter pre-registration is illegal, stop it, UPND urges High Court

THE UPND has submitted that the Electoral Commission of Zambia has exceeded its mandate by suddenly coming up with the online pre-voter registration without the sanction of the law.

In this matter, UPND deputy secretary general Gertrude Imenda, on behalf of the party, has sued ECZ and the Attorney General seeking a declaration that the decision of the commission to launch and host the online voter registration platform even if as a “test run” on its website eczovr.org and commence their online voter registration on the said platform was sudden and without lawful authority.

The UPND wants the court to quash the decision by ECZ to limit the voter registration exercise to 30 days, which is scheduled to commence on October 28, 2020.

The party wants a declaration that the prescribed protocols for voter registration on the ECZ website were ultra vires section 8 (2)(3), section 15 and section 125 of the Electoral Process Act number 35 of 2016 as read with regulations 11 and 12 on the Electoral (registration of voters) regulations of 1973 amended by statutory instrument number 62 of 2005.

It wants a declaration that ECZ acted unreasonably, irrationally and /or with a hidden ulterior motive at the behest of an invisible hand in announcing the 30 days cut off time for the voter registration scheduled to commence on October 18, 2020.

When the matter came up for hearing of the substantive application for judicial review before justice Mwila Chiatabo, UPND lawyer Marshal Muchende said the ECZ on September 21, 2020 launched the impugned voter registration and has called it an online pre-voter registration, which is being hosted on its website.

He said the online pre-voter registration launched by ECZ as an integral part of voter registration was not supported by law or any regulations that have been made by ECZ.

“The guiding regulations to be followed by ECZ in so far as protocol for voter registration is concerned is none other that Statutory Instrument no.38 of 2010 and regulations promulgated there under,” Muchende said.

“Under Section 125 of the Electoral Process Act, ECZ has no power or whatsoever to come up with the online pre-registration protocol unless and until ECZ by Statutory Instrument makes regulations supporting the same.”

Muchende said it was correct in this modern age where technology has advanced and in which the internet has provided convenient and faster ways of achieving ECZ’s mandate on voter registration, but there was a caveat prohibiting the ECZ to jump the gun and come up with online voter registration protocols without following the dictates of its governing laws (Section 125 of the Electoral Process Act).

He urged the court not to aide illegality no matter how ECZ tries to justify it.

“It would have been simple for ECZ to start by making regulations through an SI allowing for the online voter registration exercise but they ignored section 125 of the Electoral Process Act no. 35 of 2016 at their own peril and the court must quash their decision,” Muchende said.

“ECZ lamentably and gravely failed to give effect to section 125 of the Electoral Process Act no.35 of 2016 by arbitrarily coming up with the online pre-voter registration exercise, quash it my lord.”

Muchende noted that there had been no continuous voter registration similar to the registration of national registration cards, which was continuous.

He submitted that the cut off dates in which to conduct voter registration had been misconstrued by ECZ to mean that they could prescribe the starting and end date of voter registration.

Muchende said ECZ had not given effect to the law that governs it (section 7 and 20 of the Electoral Process Act no.35 of 2016) and that even assuming the UPND’s interpretation was wrong, the 30 days registration of voters in a penultimate year of elections was so unreasonable and in defiance of logic that no reasonable person would arrive at such a decision.

He said the cut off period was aimed at disenfranchising many eligible voters, which would create speculation and conjuncture.

“Quash the decision by ECZ to commence the voter registration exercise on October 28, and end it on November 30, 2020 because it offends section 7 and 20 of the Electoral Process Act and in defiance of logic to give 30 days for a new democratic country to register voters in a penultimate year of elections,” Muchende said

“The illegality surrounding the decision of ECZ to discard the current voter register and the decision to commence a fresh registration of voters targeting 9 million eligible voters is illegal, it offends section 7. The process is illegal and you (judge Chitabo) have the power to stop it. The court should interpret the law and guide ECZ accordingly as prescribed by law unlike what it is doing.”

Lawyer representing ECZ Bob Musenga submitted that Section 19 of the Electoral Process Act mandates the chief electoral officer to accordingly certify the voters register for purposes of the 2021 general elections after attending to objections if any as stipulated under section 17 of the electoral process Act.

Musenga said the law had deliberately and elaborately made provisions for a voter registration process and grievance address and such a clearly documented process cannot be a subject matter of judicial review.

He claimed that UPND wants to stop ECZ from exercising its mandate as the party had evidently failed to demonstrate any illegality or rationality on the part of ECZ.
He added that the Electoral Process Act and regulations had provided adequate redress avenues for persons who may be aggrieved with the voter registration process.

Musenga prayed that the UPND’s application be dismissed with costs.

Solicitor General Abraham Mwansa said the online pre-voter registration initiative would lessen the time eligible voters may spend at registration centres.
He said it was a notorious fact that not each and every eligible voter would have access to the internet in order for them to pre-register otherwise many eligible voters would have to do it physically at registration centres.

Mwansa claimed that the online pre-online voter registration was a way of securing voter registration.

“Online pre-registration of voters is nothing but a booking in advance and not registration of a voter in terms of the law. Where the law provides for continuous registration, it also provides for cut off periods under section 20 and 28(1)(7) of the Electoral Process Act no.35 of 2016,” said Mwansa.

“The registration of voters is not the only function of ECZ. Among other activities, ECZ will have to prepare a provisional register, make corrections, attend to objections within the stipulated period of time which is 90 days as well as attend to nominations, voter education and many other functions. Providing for the cut off period is a necessary evil.”

The moral arc of justice: Zambia persecutions or prosecutions – the DPP’s role

Fair and effective prosecution is essential to a properly functioning criminal justice system and to the maintenance of law and order in a democratic state.

The individuals involved in a crime ­­ – the victim, the accused, and the witnesses – as well as society as a whole have an interest in the decision whether to prosecute and for what offence, and in the outcome of the prosecution. The decision to prosecute or not to prosecute is of great importance and have far-reaching consequences for an individual. Even where an accused person is acquitted, the consequences resulting from a prosecution can include loss of reputation, disruption of personal relations, loss of employment and financial expense, in addition to the anxiety and trauma caused by being charged with a criminal offense.

A wrong decision to prosecute or, conversely, a wrong decision not to prosecute, both tend to undermine the confidence of the community in the criminal justice system. For victims and their families, a decision not to prosecute can be distressing. The victim, having made what is often a very difficult and occasionally traumatic decision to report a crime, may feel rejected and doubted. The worst consequences are in situations where the criminal justice system is weaponised to fight political opponents. Weaponising the justice system undermines democracy.

The criminal prosecution system in Zambia has given most Zambians cause for concern. Currently, one of the most alarming practices is the police charging people with serious unbailable crimes and keeping them behind bars on the pretext that they are waiting for instructions from the DPP office on how to proceed in the case. The DPP then inordinately delays giving the instructions which results in the accused remaining behind bars for a protracted period of time. This scenario suggests that in Zambia, the police have captured the prosecution service, and have taken over the constitutional responsibilities of the DPP and determine who is prosecuted, when, and for what.

The police arrest and draft charges and then refer the matter to the DPP. In practice, it should be the other way round. The Police should arrest people and prepare the docket and hand it over to the DPP to determine whether a criminal charge is sustainable on the evidence provided and the drafting of charges. Drafting charges requires legal training which the police do not have. Investigation (a police function) and prosecution (prosecution function) are two distinct functions.

A number of recent cases demonstrate the appalling levels of drafting criminal charges in Zambia. In the Mushipe sedition case, the drafters of the charges were ignorant of the legal definition of sedition and the magistrate expressed surprise that a charge was brought on the facts presented to the court which did not disclose sedition by any stretch of imagination.

In 2018, Hakainde Hichilema was charged with treason and the charge sheet did not disclose an overt act—a necessary element in any treason charge. In 2016 Mwaliteta and others were charged with robbery for questioning election results. They were acquitted after spending a year in detention. In the Laura Miti and Pilato case in Livingstone where the two were charged with assaulting police officers and disorderly conduct, the police officers who testified could not agree on what happened at the church where the offence is alleged to have occurred. This is very basic legal knowledge which any well-trained lawyer should know. Part of the Criminal Procedure course in the law degree teaches one how to draft criminal charges, and criminal law course teaches lawyers the elements of the crimes.

Clearly, in Zambia as the cases above demonstrate, the charge is more important than its outcome. As a prosecutor in the Legal Affairs office in the 1970s, we reserved Thursdays as a day to visit the Lusaka Central Police to vet dockets. We went through dockets with the police and advised them to close dockets when the facts did not reveal a crime and asked them to gather further evidence where this was necessary in order to sustain a charge.

Nowadays, people are brought to court on defective charges and the police have taken the upper hand while the Director of Public Prosecutions now seems to follow the police with cap in tow. The practice represents the degradation of the prosecution services. This has fundamentally compromised governance and placed at risk the reliability and predictability that is demanded of the criminal justice system by the rule of law. Apart from this sad development, this exemplifies the corrosive effect on our institutions and on the fundamental concept of the right of the accused person to a speedy trial. There are only two possible explanations for the situation, either the DPP’s office is compromised and is playing political games or the office lacks the necessary integrity or competence to undertake competent prosecutions.

The purpose of this article is to show that through this practice the DPP’s office has abandoned its Constitutional responsibility and that the practice violates the due process right to a speedy trial.

Article 18 (1) of the Zambian Constitution provides that if any person is charged with a criminal offence, then unless the charge is withdrawn, the case shall be afforded a fair hearing within a reasonable time by an independent and impartial court established by law. This means that a criminal defendant must be brought to trial for his or her alleged crimes within a reasonably short time after arrest.

The reasons for the existence of this right is to avoid the following: (a) a lengthy unfounded imprisonment which eventually ends with the defendant being innocent; (b) minimising the anxiety of waiting case resolution and (c) protecting the defendant’s ability to defend against charges (e.g. evidence may disappear and witnesses may fade over time).

The office of Director of Public Prosecutions is established by article 180 of the Constitution. Article 180 (3) states that the Director of Public Prosecutions is the chief prosecutor for the government and head of the National Prosecutions Authority. The Director of Public Prosecutions may institute and undertake criminal proceedings against a person before a court, other than a court martial, for an offence alleged to have been committed by that person.; take over and continue criminal proceedings instituted or undertaken by another person or authority and discontinue, at any stage before judgment is delivered.

In article 180 (7) the Constitution provides that the Director of Public Prosecutions shall not be subject to the direction or control of a person or an authority in the performance of the functions of that office. Article 180 (8) provides that the DPP’s functions maybe exercised in person or by a public officer, or legal practitioners authorised by the Director of Public Prosecutions, acting under the general or special instructions of the Director of Public Prosecutions. As can be seen from these provisions the Constitution gives the Director of Public Prosecutions complete control of all prosecutions in Zambia. No prosecutions can proceed without the DPP’s consent.

If someone is in charge of prosecutions, they would have to give directions or furnish guidelines to the police, including investigative officers and prosecutors, setting out standards of professional responsibilities and essential duties of prosecutors. In prosecution matters, the DPP must act on behalf of the community. Prosecutors must always act with fairness and detachment with the objectives of establishing the truth and ensuring a fair trial. A prosecutor’s overarching duty is not to win a case, but that justice shall be done.

The foundation of a criminal justice system in a democratic state is “due process of law” which requires law enforcement officers and prosecutors to safeguard “fundamental fairness” in the administration of justice. That is the presumption of innocence and a fair process by which an individual is investigated, and charged. If an investigation or prosecution does not or cannot provide due process for its subjects, the DPP is duty bound to stop the prosecution. Among the myriad ways the government can violate due process are through “vindictive” uses of its law enforcement powers and through public comments on the purported guilt of a subject that impairs the presumption of innocence and a fair trial.

Prosecutors wield enormous power. They make the first critical decision on whether to deploy the ultimate power of the state – the power to punish – against particular targets. The degree to which, and the ways in which, prosecutorial power is checked largely defines a society’s conformance to the rule of law. The power can be exercised to pursue the innocent, to impose punishment without trial or conviction, and to pressure targets to compromise or capitulate rather than bear risks and costs of asserting their rights or innocence. Where the system is unchecked, it allows unprincipled prosecutors to impose drastic punishments on selected targets without the constraints traditionally associated with the rule of law.

In Zambia the power of the government as prosecutor is not only abused in ordinary criminal cases where the poor and the powerless are subjected to the weight of the criminal law system, prosecutorial power is also abused in high profile cases against the powerful, to serve personal or political ends. It is abused as well in selecting and pursuing targets in the world of business, where prosecution substitutes for the ordinary regulatory processes or overrides salutary competitive forces.

In closing, I would like to say that it is important that we set to recapture the police and the prosecution service so that we ensure that prosecutors carry out their functions in accordance with the constitution which provides that the Director of Public Prosecutions shall be independent in the performance of her functions. The DPP and her prosecutors should exercise their functions free of any extraneous influences, inducements, pressures, threats or interference, direct or indirect, from any quarter or for any reason. They should at all times uphold the rule of law, integrity of the criminal justice system and the right to a fair trial.

For us as a country to reign in the prosecution authority, prosecutors and the police, the judiciary needs to play its part in ending the blatant abuse of the criminal justice system. The judiciary is critical to safeguarding the rights of people and should not act like a department of the executive. There are many good judges in Zambia but sadly, there are also many who act as if they were a branch of the executive. These are the ones doing irreparable harm to the judiciary.

The judiciary have the power to dismiss cases that are clearly an abuse of the prosecutorial service. Attaining institutional autonomy from the executive requires courageous magistrates and judges. Chomsky’s admonition to intellectuals also applies to judges; “Those who qualify for the title have a degree of privilege conferred by the status, yielding opportunity beyond the norm. Opportunity confers responsibility -which in turn, poses choices, sometimes-hard ones. One path is to follow the path of integrity wherever it may lead. Another is to put such concerns aside, passively adopting the conventions instituted by structures of authority. The task in the latter case then is to carry out faithfully the instructions of those who hold the reins of power, to be loyal and faithful servants, not after reflective judgment but reflective conformism. That is a fine way to evade the moral and intellectual difficulties of challenge and to escape what can be painful consequences of seeking to bend the moral arc of the universe towards justice.”

Or as Pravin Gordan observed in his preface to the book on Lawfare in South Africa “We know from research by MIT Sloan School that countries rise when they put in place the right pro-growth political institutions and they fail-often spectacularly – when those institutions ossify or fail to adapt’ Powerful people always and everywhere seek to grab complete control over government, undermining broader social progress for their own good. Keep those people in check with effective democracy or watch your nation fail.”

Opposition have Launched a Campaign to Discredit the Electoral Commission of Zambia says Antonio Mwanza

THERE IS A DELIBERATE ploy by the opposition UPND to discredit the integrity of the Electoral Commission of Zambia (ECZ) so as to cause doubt and disrupt the electoral process, Deputy Media Director for the ruling Patriotic Front (PF) Antonio Mourinho Mwanza has said.

And Mwanza has explained that there is no online voter registration currently taking place ahead of the 2021 general elections.

Speaking when he featured on the Wednesday edition of the Lusaka Star Radio Magazine on UNZA Radio, Mwanza said the opposition was preparing for nothing but a loss in 2021.

“The opposition UPND have launched a campaign to discredit the integrity of the ECZ and they are doing this in order to bring doubt and confusion with regards to the electoral process and democratic credentials that we have as a nation,” said Mwanza.

“There is no online Voter Registration that ECZ is conducting. What ECZ is doing is pre-voter registration and NOT voter registration. The online-voter pre-registration is l not a final registration. All those who will pre-register online will be required to visit a physical registration centre to submit their biometrics (portrait, signature, finger/thumb prints), have their details verified and obtain a voters card.”

The PF Deputy Media Director said the opposition party was trying to plant seeds of discort and plant fertile grounds to dispute the 2021 election results.

He also said the opposition UPND has been crying and accusing ECZ of rigging elections from 2001, adding that the opposition party was headed for another loss in the upcoming general elections.

“All this is a very calculated move by the opposition but they are preparing for another loss. From 2001 upto 2021, the UPND will continue claiming that elections are rigged but what is important is that if you have proof of your allegations, that is why we have the Courts of Law where you can go and petition if you have evidence that elections have been rigged,” said Mwanza.

Mwanza further challenged the opposition to take part and participate in all meetings called by ECZ with various political parties and stakeholders.

He said there was no reason for anybody to go out and discredit the ECZ than just trying to justify a loss then blame it on ECZ when the election body had always invited all political party players for engagements on matters of concern.

“For example, we have Bill 10 which is trying to cure the issue of the Public Order Act, the issue of ECZ and the judiciary and if anybody cares about the autonomy and Independence of ECZ, they have an opportunity to support Bill 10 so that they can also change, revise and amend the electoral process,” he said.

“But those who boycott Bill 10 are simply saying that they are also happy with the Electoral Process Act the way it is, they are happy with the Public Order Act the way it is and they are happy with the way the Judiciary is.”

Meanwhile, Mwanza said there was no online voter registration as perceived by some sections of society and that the only registration taking place was a pre-online voter registration exercise whose purpose was to reduce the time people spend when doing the physical voter registration exercise.

He added that all those who would have done the pre-online voter registration would still be required to visit a voter registration center for verification and other requirements.

“The voter registration will require that all of us go to a voter registration Center and do the physical registration where they need to take your portrait, thumb print and signature. The only thing that this pre-online voter registration exercise is doing is that it reduces the time spent on the process so that when you go to the actual voter registration center, you would have already submitted some of your details and spend less time there.”

Mwanza added that nobody would be disadvantaged including those without Smart Phones or related Gadgets as everyone would still be required to visit a Center to complete the process before obtaining a voter’s card.

LUNGU HAS LOST GRIP…even subordinates are not with him – Mwenya Musenge

FORMER Copperbelt minister Mwenya Musenge has urged President Edgar to display Statesmanship and not keep dancing like a ‘chongololo’ (millipede) in public.

Musenge also said the video circulating on social media where President Lungu was spotted arguing with party cadres before paramount chief Chitimukulu is embarrassing and shows that he has lost grip of his charges.

He said the video depicts President Lungu reporting his party members to his ‘boss’, which questions whether the Head of State is in control.

“Ba President wesu [Our President], with the video that has gone viral where he had a meeting with Ba Chitimukulu…that video is extremely embarrassing for the Head of State. There is no way the Head of State can come out in the manner he was as if he was reporting to his boss and yet he is the President of the country,” Musenge said.

He noted that cadres interjecting and responding while the Head of State is making his case speaks volumes and points to internal sabotage in order to embarrass him.

“Where one could even hear a certain cadre, a lady interjecting while the President was speaking. You have an internal meeting but it’s quickly captured and posted on social media! What type of security does the President have? What type of leadership are we seeing? This clearly tells you that even those who are working with him are not with him. That video was in bad taste, it was captured to embarrass him,” Musenge said. “What I know is that the President is the ‘alpha and omega’. In heaven it is God, on earth it is a president of a Republic who has been elected and whenever he speaks, it’s expected that all his subordinates must be quiet. But you find that his [President Lungu] subordinates are always toiling with him and interjecting when he is speaking and him (President) showing those gestures, that you start questioning whether he is in control.”

And Musenge has further urged President Lungu to manage his appetite for dancing whenever he hears music.

“The other thing that we are noting is this tendency of our Head of State dancing all over. Wherever there is a rally you find him dancing. I think that it should come to an end. I don’t know of any other president in the world we have heard who dances like ours. You find him dancing like a chongololo,” said Musenge. “You don’t do such things. That really doesn’t augur well. We want to see statesmanship. We want to see leadership in our Head of State.”

PF Lusaka Province Secretary Kennedy Kamba says the ruling party supports the Electoral Commission of Zambia on the new voter’s roll.

In a statement, Mr. Kamba, said democracy entails that during elections, there must be a leveled playing field that enables equal participation of competitors that must result in a free and fair election.

He said PF is not shocked that the UPND and their allies such as the NDC are up against the Electoral Commission of Zambia (ECZ), attempting to reject the idea of reviewing and updating the voter’s register.

“We support the ECZ because this is the way it should be. The voter’s roll must be reviewed and updated to suit the current situation in most parts of the country,” Mr. Kamba said.

“We all know that life being what it is, alot has happened over the years, people have died, people have shifted and geographical settlements and setups have changed over the years.”

Mr. Kamba said in order to eliminate all manner of doubt, anormalies in the voter’s register must be dealt with to warrant a free, fair and credible elections.

“Electoral malpractices must be stopped and it starts with the review of the voter’s register. We must make sure that majority of those on the voter’s roll are at least alive and in the locality. Those who are deceased must be removed to clear the register and eliminate all manner of doubt when it comes to suspicions of manipulation of the register” Mr. Kamba said.

“We know that the UPND and company is so worried about the voter’s Roll in places like Dundumwezi, where we feel there were alot of anormalies that guranteed them sweeping victories over PF in those areas. Those are areas where we cannot even verify numbers.”

Mr .Kamba said things have changed, people have shifted, others have died and we cannot go into 2021 with a register that is clogged with anomalies.

“We appeal to the UPND, their allies and all political parties to demonstrate sobriety over this issue. This is for the benefit of all stakeholders and that’s why we support the ECZ over this stance.”

THE DIPLOMATIC COMMUNITY MUST ACT ON ZAMBIA NOW AND NOT TOMORROW.

The Diplomatic Community in Lusaka have a special advantage to witness a disaster unfolding right before their eyes, which generations long after they leave this country will be amazed at how they let it happen, without intervention. How will it feel 20 years down the line that Ambassador or High Commissioner so and so, from this or that country, occupied a front row seat as the Zambian government prepared to sink a once prosperous and vibrant country into the doldrums of history?

Signals that President Edgar Lungu and his cohorts are about to mutilate an entire election by manipulating institutions of governance to their advantage, is succinctly clear. Zambians are confused and tramautized because historically successive Zambian governments have superintendented peace and hope on the people, than the current regime that is ironically displaying weapons of war on citizens as a prelude to law and order. To expect Zambians to hit the streets demonstrating under this repressive atmosphere may be far fetched, but does that prevent a well meaning and alert Diplomatic Corps from acting to salvage the situation? Where is their collective political will?

Zambian credentials are impeccable in the region and beyond. The country was once a cradle of hospitability that offered solace and hope for people fleeing from dictatorship and genocide. This former reputation is exactly why the International community must not fold their arms and watch a government preparing to murder its own citizens, by use of a militarized police, just to stay in power. Surely they can rescue a country that once rescued refugees and the outcasts.

Is this too much to ask from a country that once suffered relentless bombings and incursions from racist forces that once surrounded it’s neighbourhood, because of its cherished values for freedom for the oppressed on account of skin colour? Thousands of Zambians perished from liberation wars while others still die from unexploded ordnances that still litter the Zambian forests.

The Diplomatic community must guarantee a free and fair election by pressuring President Edgar Lungu to adhere to the constitutional requirements. The Electoral Commission of Zambia must hold fast to the interests of all stakeholders and not only the ruling party. The old voters’ roll must not be decimated but new voters incorporated into its records. President Edgar Lungu must immediately demilitarize the civil Police and assure citizens that he will not use it to violate their liberties.

The Diplomatic community must encourage South Africa which has the greatest stake in Zambia’s economy to pressure Lungu to allow democracy to flourish. It’s to the best interest of South Africa to ensure their investment in Zambia does not go up in flames if peace is compromised, but most importantly to reciprocate to the people of Zambia that stood with them when it was not politically correct to do that. This is no longer a political matter associated to one or two political organisation, this is a matter for survival for Zambia as a unitary state. The Diplomatic community must act now and not tomorrow.

THEY’RE RIGGING 2021 RIGHT NOW…Zambians stand up for your rights – HH

HAKAINDE Hichilema has told Zambians to stand up and reject the cunning actions of the “intransigent” Electoral Commission of Zambia.

Meanwhile, Hichilema, the UPND leader, says he will not need a presidential retirement home and that such a provision actually needs to be reversed.

He was speaking during an interactive virtual youth indaba on Sunday evening.

The programme was live on his Facebook page.

Young Zambians across the globe engaged Hichilema on various topics and he answered.

On the topic of voter registration, Hichilema said he did not think: “we should allow the electoral commission to dictate how our election is managed.”

“We should not allow the Electoral Commission to bully everybody around. The Electoral Commission is a creation of the people of Zambia – [it] should do what the people of Zambia want,” Hichilema said. “The people of Zambia want a free, fair and credible election and to do that, they don’t have, in my view, to do away with the current voters’ register.”

He noted that the current voters’ register was produced legally.

“The law actually talks about a continuous voter registration. We cannot be forced to be disenfranchised by an intransigent electoral commission, one which appears to be working for a political party,” Hichilema said. “We as Zambians should stand up and reject this notion that the electoral commission can willy-nilly disenfranchise citizens. They don’t have that right!”

He added that he felt it would be reasonable for the Electoral Commission of Zambia (ECZ) to uphold the current voters’ register.

“Additional voters must be registered – those who entered the voting age. But those who are already registered as voters like me and others, we must stay on the register. If it is necessary to clean the register by removing dead people, so be it,” he explained. “But you cannot use an excuse to disenfranchise citizens. That is illegal, unacceptable [and] that constitutes rigging at this early stage. We also know what is happening with the issuance of NRCs; it is a chaotic situation. Rigging doesn’t happen on the voting day only; it is happening right now. Zambians must stand up for their rights. Nobody will stand up for your rights!”

Hichilema asserted that Zambians ought to claim their rights.

“ECZ must not be allowed to do away with the current voters’ register,” he underscored.

Meanwhile, Hichilema said he had no excitement of getting lavish, once he assumes the Republican presidency.

“There is no excitement for HH, when we are in public office – God’s will and courtesy of the people of Zambia – to spend what is unnecessary. There is no excitement to buy a house in Dubai. I don’t need a house in Dubai!” he said. “There is no excitement to buy expensive planes – $130 million plane. A top of the range Gulfstream in a country where people have no medicines in hospitals! There is no motivation for me to spend $200 million on maintenance contract of the Gulfstream.”

All that money, Hichilema believes, “if not applied in that wasteful manner,” could actually be channeled to other areas that would generate revenue and help to grow the economy and for job creation.
“So, there’s absolutely no need for me to dream of a presidential retirement home being built for me. It’s not necessary! It doesn’t make sense to me and we should end that sort of provision for people seeking public office,” said Hichilema.

There are clear signs that the Zambian government is preparing to fight a war(going by it’s large scale armament of the domestic security units and party cadres). Without an internal threat, one can rightly connect the dots in the establishment’s consistent narrative at all levels to retain power at all costs.
The imminent defeat in in the upcoming Elections in view of the failed Economy is driving the PF government of Edgar Chagwa Lungu into terrorism campaign frenzy in order to retain power using the military option. Massive military displays have been staged publicly backed by calculated authoritative threats from senior government officials.

Zambia faces no external threats from its neighbours in the SADC Region and beyond. The procurement of heavy military armaments for the Armed Forces and the militarization of the civil Police is therefore a source of great concern to the general public, the opposition parties, activists and civil society in Zambia.
Irrefutable evidence of infiltration and enlistment of political adherents within the Police ranks is documented.The dilution of professionalism with caderism is a definite recipe for anarchy and blood bath within the foreseeable run up to the 2021 General Elections.

The government’s apparent willingness to showcase these weapons on fancy military parades appears to be a statement, of a show of force and that it intends to use them on its civilian populations. This undoubtedly result in an escalation of human rights violations and suppression of independent voices and more attacks and closures of private and independent media organisations.

Home Affairs Minister Steven Kampyongo and Inspector General of Police Kakoma Kanganja have on several occasions publicly issued threats to deal with what they term as ‘trouble makers’ ahead of the 2021 elections. They said this when they commissioned and showcased a large fleet of armoured vehicles at a police parade in Lusaka recently.

When he met a group of pastors at State House shortly afterwards, President Edgar Lungu urged them to pray for the loser of the 2021 elections so that he doesn’t deal with him. With this kind of statement and with a display of military weapons that have been deployed to the civil Police, it appears President Edgar Lungu has already determined the outcome of the 2021 election and is unwilling to allow the democratic process determine the outcome.
These can neither be isolated nor spontaneous statements. They are extract statement from a well documented scheme to retain power against the will of the people.

On several occasions, he has vowed never to hand over power to anyone even if loses the election. President Lungu has threatened to arrest Hichilema on an alleged privatisation of government owned companies and properties that took place more than 25 years, under an Act of parliament. The privatisation exercise was superintendented by Zambia’s international lenders and cooperating partners IMF, the World Bank and the Paris Club while Hichilema was a consultant hired by a financial firm Coopers and Lybrand.

The superfluous and unproven accusation began to surface when he expressed ambitions to seek the office of the Zambian presidency. Hichilema was not invited in his personal capacity but as an evaluator like hundreds of others experts. Remarkably President Lungu, a lawyer was equally hired in exactly the same capacity as a consultant in the privatisation process

SHUTTING DOWN OF PROMINENT PRIVATE MEDIA HOUSES

The Patriotic Front ( PF) government has continued shutting down private media houses and terrorising individual journalists that have been exposing their corruption, violence and theft of public resources. One of the TV station they successfully shut down is the prime TV largely that had a viewership of millions of citizens. The PF government under President Edgar Lungu has also shut down the biggest print media newspaper ‘The Post’ for its critical reporting and exposing these schemes. All these efforts are aimed at stifling divergence and suffocating the democratic air passage.

NO JUSTICE

The judiciary in Zambia as well as the Zambia Police and the Electoral Commission of Zambia (ECZ) have been compromised and no longer operate within the confines of the constitution of Zambia but in the interest of the ruling party. The separation of powers between the three arms of government have been hijacked by President Edgar Lungu. At a rally in North Western Zambia, Lungu warned to deal with any judge that would rule in the way of the Kenyan courts that nullified the presidential elections and declared that Zambia was not Kenya. Subsequent judgement have been publicly questioned as not being meritorious following such statements from the head of state.

The compromise of key public institutions has a potential of bringing trouble in the country if the international community fails to send a signal of disapproval to the Zambian authorities. There is still a rare but fast closing window of opportunity for the International Community to decisively stop another bloody stain on the face of Africa.

GENOCIDAL CAMPAIGN

The PF government under Mr Edgar Lungu have persistently been inciting and sponsoring ethnic hate with intention to cause certain tribes rise against each other. Selective Victimization and premature retiring of civil servants from certain tribes is public evidence for anyone to see. ARMING THEIR CADRES

The Patriotic Front ( PF) government have armed their political cadres with an assortment of military grade automatic weapons including uniforms. This has exposed opposition leaders and members of the public to great risk. These political cadres have been unleashed on PF’s political opponents and other critical voices but are not arrested when they carry out these attacks.

MISMANAGEMENT OF 2021 ELECTIONS

The Electoral Commission of Zambia has come up with a mechanism to desefranchise voters from opposition strong holds under instructions by the PF government. This matter has the potential to cause chaos if not properly handled by government.

It is therefore, in the interest of the Zambian citizenry that as an Activist for good governance and Human rights, I call upon the international community to intervene in this case, in order to protect civilians and opposition leaders whose lives are under serious threat. We further call for the immediate suspension of any financial aid to the government of Zambia for undermining democracy, good governance,human rights and high levels of corruption which has greatly affected millions of Zambians.

If the International community continues to bankroll the Zambian government through debt forgiveness and other funding, all these will be channelled into activities that undermine democracy and the rule of law. The resources will be used by government to fund ruling party political militias that may result in genocide in the not too distant future.
Zambia has collapsed below the democratic and governance benchmarks.

True Love Mulenga Mowa donates her kidney to hubby

‘IT was not easy ……..but it was worth it. I reached a point where I started thinking that what if both of us died here in India, who will
keep our three children! But I drew my strength in prayer and my favourite verse 1 John 3:16……. I did it for him and the children!’

These were some of the scary thoughts that gripped the mind of a Lusaka woman, Mulenga Mowa, a teacher, who donated her kidney early
this year to save the life of her husband.
It all downed on her that her husband needed a kidney transplant when the couple was told that both kidneys were damaged.

This was during the couple’s visit to Coptic Hospital mid last year.
Mulenga described this day as a dark cloud. It was an emotional day for both of us.
“As for me, I thought this was the end of me seeing my husband Benjamin Mowa, and at some point I visualised myself as a widow,” she
said.

Mulenga said when she and her husband received the sad news that doctors could not do anything about her husband’s condition, her
in-laws where both visiting at the couple’s home.
Mulenga said it was very difficult for her and her husband, Benjamin, to break the scaring news.

Eventually, the couple mastered some strength and broke the news.
It was an poignant experience for Mulenga and the visitors who cried as though Benjamin had died.

“I encouraged him to get prepared so we could go to University Teaching Hospital (UTH) where we could get a second opinion.
“Doctors there also confirmed that his kidneys were both damaged…I said OOOOH NO,” Mulenga said.

The confirmation by the doctors brought more fear in her eyes of losing her husband.
But the counsel and explanations by doctors on the possibilities of a kidney transplant put a smile of her face gave her strength.

She recalled that Benjamin’s brother and his cousin got involved to help.
But they could not match up to what was required.
At the time, Mulenga gave it a thought and got convinced that she could donate her kidney to Benjamin.

She said he was her husband and father of her children and time had come for her to put her wedding vows into practice “for better, for
worse!”

Bravely, Mulenga told her Benjamin that they should go back to UTH.
She said she wanted the doctors to test her kidneys and if she was a match, she would be his donor! – timesepaper

HH ALREADY MISSED HIS OPPORTUNITY, 2021 WILL BE WALKOVER, SAYS MUMBI PHIRI

PF deputy secretary general Mumbi Phiri says the 2021 general elections will be a walkover for the ruling party, because opposition UPND leader Hakainde Hichilema missed his two opportunities when the ruling party was at its weakest.

And Phiri said opposition alliance chairperson Charles Milupi is getting to the realisation that he cannot be led by a fellow old man, the same argument she said Hichilema used on the late Michael Sata.

But UPND spokesperson Charles Kakoma said the issues Phiri was talking about were in the past, saying Zambians have since moved on and are being motivated by the urge to remove the ruling party from power over their failures to keep promises to the people.

Speaking with Daily Revelation, Phiri said as far as the ruling party was concerned, the 2021 elections will be a no contest.

“If you are a politician like me you would sit, relax, because when PF was threatened was when Michael Sata died. That time we were at our weakest point, the one who was acting as president (Dr Guy Scott) abandoned his own party,” Phiri said. “We had influential people who went to HH, if God had endorsed him to become president he missed two opportunities. When Mr Sata invited him that he could be his vice-president, when he refused that Mr. Sata was an old man who didn’t know how to use a computer, that was the first opportunity he missed.”

Phiri said when Sata died, the giants of the PF, with their money and political experience joined hands with the UPND, but the party still emerged victorious.

“That was the second opportunity, this time ni porridge. Just wait and see, if people didn’t believe what happened in Mwansabombwe and Lukashya in addition with the 10 ward elections, which we have been winning and those who think every Zambian is so poor it’s only them who can afford a bag of mealie meal,” Phiri said. “All these people, all of us we can sell our vote for K20 and mealie meal, come 2021 you are going to see, and I am just clad that now UPND has started conceding defeat.”

But reminded that MMD president pastor Nevers Mumba has raised issues with the recent elections, accusing the ruling party of engaging in massive rigging, Phiri said those were very serious allegations and the PF will legally take on the pastor in his individual capacity

“So he will have to prove,” she said.

On Milupi’s recent assertions that the opposition alliance were having difficulties agreeing to an electoral pact as some alliance members had insisted that “if you want to work with me, you have to work under me”, something he said would not work, Phiri said Milupi was just realising now.

“Us we were in an alliance (pact), especially with a party which values itself with their leader as the only person who can rule over an alliance. That’s how with PF it didn’t work. And it’s good that Mr Milupi has realised that, and I don’t think if Sean Tembo is also being called PF surrogate now,” Phiri said. “He was the first one to complain as such. That’s why he left. So I am not in an alliance and PF is not in any alliance with anybody so I can’t speak and I can’t know how Mr Milupi feeling.”

However, the PF entered into an alliance with the Mutati faction for the 2021, and acknowledging the same after being reminded, Phiri said the alliance is finishing in 2021.

“I am sure you can see that us we are very mature because we don’t con people. That’s why still have Raphael Nakachinda with us, even when they take each other to court, because at that time MMD was broken into two,” he said.

But asked why the UPND could not use the same argument now to leverage its standing in the alliance as the biggest opposition political party, in the same manner the PF argued in 2011 as the biggest opposition then, Phiri said both parties argued for leadership in 2011.

“There was nothing like that. Was Mr Hakainde more experienced that Mr Sata? When he invited him to come into an alliance he refused because he has his ways, he refused and it was in the public domain that he refused because he believed Mr Sata’s was born an old man and he didn’t even know how to use a computer,” Phiri said. “That time Mr Hakainde refused because he was perceiving himself to be president Obama, because he was young, he thought he will remain young, now he has grown old, may be that’s why because Milupi believes he has become old, he doesn’t feel an old man should take advantage of another old man.”

Asked if the PF was looking to embrace Alliance for Democracy and Development (ADD) leader Milupi, Phiri said: “We cross the bridge when we reach there. Will cross the bridge when we get there…African politics are dynamic so I can’t predict. Who ever thought Chishimba Kambwili could work with HH. Who? Who? Nobody so African politics are dynamic.”

But Kakoma rubbished Phiri’s assertions, saying the people were more concerned with the PF’s failure to keep promises and deliver to the Zambian people.

He said Zambians were not focusing on whether Hichilema should have been in an alliance with president Sata, saying that was in the past and the people have since moved on, going by the vote tally the opposition leader increased in the 2015 and 2016 elections.

Kakoma said it was the UPND’s considered view that Hichilema actually defeated President Lungu in both elections, only that the elections were stolen, in the same manner the ruling party was stealing by-elections.

“The walkover she is talking about is actually a walkover for the UPND,” he said.

Kakoma said the ground in the PF strongholds of Copperbelt and Lusaka had shifted, and that it was unheard of for the UPND to get votes in thousands in Luapula and Northern provinces.

He said the rampant bribery the ruling party engaged in during by-elections would not be replicated in the general elections, saying it had become customary for ruling parties in Zambia to win by-elections but get walloped in general elections.

Lungu should explain his role in privatisation of Cold Storage – Sikaile

GOOD governance activist Sikaile Sikaile says President Edgar Lungu should be told that his involvement in the privatisation of Cold Storage Limited has ‘produced’ widows.

He says the President should not go about “singing the privatisation song” when his own name is tainted.

Sikaile told The Mast on Saturday that the privatisation issue should be extended to everybody who was involved.

“It doesn’t matter what role one played; if this PF government wants to know the truth about privatisation, questions must be asked to everyone. This should not be made like HH’s [UPND leader Hakainde Hichilema] baby,” he said. “You can’t continue to say, ‘HH privatised this and that’ but you decide to permanently go silent on Edgar Lungu’s role in the privatisation of Cold Storage Zambia. Lungu was fully part of the privatisation of that company and so he must also explain the role he played.”

Sikaile asked: “why should a man like Lungu who was fully involved in privatisation turn into [a] hero today and start accusing others?

“I watched him at a political rally in Mwansabombwe and Lukashya recently where he was addressing people and coming out like an angel on privatisation. Lungu shouldn’t continue thriving on a few people’s ignorance, especially in our rural parts, and start selling pure lies about privatisation.”

He noted that next time President Lungu opens his mouth to talk anything concerning privatisation, “he must be quickly reminded that ‘boss, first tell us about what you did in the privatisation of Cold Storage.’”

Sikaile said Hichilema had been asked to give an account of his role in privatisation and that he did so.

“[But] who has ever heard Lungu say anything about his role in privatising Cold Storage? The man is ever quiet and the only time you hear him raise a voice is when he is accusing HH of having made some Zambians suffer, through unemployment due to privatisation. But my question today is ‘was Cold Storage not a company that had workers?’ If people who worked for InterContinental Hotel – Livingstone died due to unemployment, what happened to those who worked for Cold Storage Limited?” Sikaile asked. “How did they survive the harsh reality of unemployment? What does Lungu think about people who had relatives who worked for Cold Storage?”

He added that President Lungu “cannot fool every citizen with this privatisation song” that he has produced.

“He is the main composer of this privatisation song and he has a long list of backing vocalists. But let him tell us the role he played in the privatisation of Cold Storage Limited,” Sikaile insisted. “There are also widows today, whose husbands, the breadwinners, worked for Cold Storage and I’m actually in touch with three families in Chazanga area in Lusaka. Two families are in Chazanga and another widowed old woman is being kept by a granddaughter near Chilenje hospital in Lusaka. So, Lungu should not play smart about this privatisation song.”

He pointed out that asking President Lungu to speak out on the privatisation of Cold Storage Limited could not be regarded as unfair.

“His name is tainted and it’s just that he is shameless; otherwise he should never ever be in a position to point an accusing finger at anybody on privatisation,” Sikaile noted. “So what I’m pleading with Lungu is that let him direct his backing vocalists on the privatisation song to reduce the volume. Demanding that Lungu explains his role in the privatisation of Cold Storage Limited is not at all being unfair. So let him explain, unlike dancing around at rallies as if his privatisation of Cold Storage Limited has not produced widows.”

He said President Lungu’s hypocrisy “was too much”.

“So, for the commission of inquiry that he intends to set up on privatisation, we can only hope that he has enough to tell Zambians about what he knows about the privatisation of Cold Storage,” said Sikaile. “But even before that commission, let [President] Lungu open his mouth and tell us about anything to do with Cold Storage. We have had too much of his hypocrisy!”

Pamela Gondwe with friends in high places; arrest me and make the worst mistake of your life

The phone started vibrating and shooting up all types of colours into the dark room where she was sleeping soundly.

She was startled as the phone rarely rings at this time of the night. She raised her head and craned her neck towards the side table where the sophisticated instrument was strategically placed.

It was 1.31 AM. Who could be phoning at this time of the morning or night?

There was a surprise waiting for her. There was no name or number displayed on the phone. ‘This is strange, she thought. How could this be? Should she pick up this call at this time, a phone that does not display a name or number? Her phone is programmed to identify the caller no matter where in the world the caller is located. Inspector General of police Kakoma Kanganja got the technology from Interpol. The President has the ability and a few other chosen ones.

It appears there is new technology that bypasses all that. I better know who this is, she reasoned. She began to shake with fear which she immediately cast aside. It is a mere phone call. It must be important. It is not as threatening as some actual physical intruder in the house. She could handle any intruder on the phone, known or unknown. Besides she had a hunky of a man lying beside her.

She extended her hand and picked up the cell phone, swiping it to open it. She tiptoed out of the bedroom and into a sound proofed room specifically installed for her. She also didn’t want to disturb the man.

Damn! The sweet dream she had been rudely interrupted from was amazing. She steadied herself, swallowed hard to wet her mouth and throat both of which felt dry.

“Hello,” she calmly directed into the cellphone. “Who could you be at this time of the night?”

“Madam Siyuni, it is Pamela Gondwe. You know me very well and I thought I should call you immediately after you just had the meeting in which my name came up. I want to make it clear without mincing any words that if you arrest me, charge me and send me to trial, you will be making the worst mistake of your life. When I say ‘you’ I don’t mean you as an individual, I mean the government of Zambia and former Barclays Bank and insurance companies and the Zambian banking industry.’’

Gondwe was speaking at the top of her voice and at supersonic speed preventing Siyuni the Director of Public Prosecutions of Zambia from saying a word.

“WOW WOW. Not so fast Ms Gondwe. I don’t know that well other than what I read in the papers. First things first. How did you get my number and secondly what are you talking about and how did you know we were talking about you? And who especially are you referring to? How do I call you? MS. or MRS.?” “Doesn’t matter to me. I am called all types of ways,” was the answer.

“Don’t worry about how I got your number. Of all people in Zambia you must from the beginning have known or ought to have known that I have friends in high places just like you do. It must also be no brainer how I would know that you talked about me this past evening, madam Siyuni. But I warn you, I am not gonna be a sacrificial lamb or stepping stone for people’s glorious careers and famous dinner table and restaurant talks around Lusaka. I can ruin a lot of lives if you do arrest, charge me and send me to trial, to repeat what I have already said. I am surprised Inspector General of police, and heads of the ACC and DEC have not briefed you but they are not stupid, or are they?”

“Calm down Ms. Gondwe. What are you talking about?’’

“Siyuni, don’t play innocent or dumb with me. You had a strategy meeting last evening where you had received instructions on how to handle the privatisation issue involving one Hakainde Hichilema. All types of people were present from the OP down to the most ruffian and dirty cops and cadres that you trust and have used before. The IG, DEC ACC and Edith Nawakwi sent their people there. After planning how to go about the explosive issue of privatisation and the role or non-role of Hakainde Hichilema, you diverted to talk about how embarrassing it was becoming to the government of Zambia, especially law enforcement agencies and the President that I was hiding in plain view and I am bringing disrepute to law enforcement in Zambia as I was allegedly showing off that I had friends in high places and that by arresting, charging me and sending me to trial without bail you would be disengaging me from the dangerous image that was being drawn. Don’t make that mistake. You will regret.”

“Madam DPP, it is not personal. It is survival. The government is trying to cleanse its image in the privatisation matter, a matter that only comes up at election time to extend and launder corruption on innocent people who were not in government. Even that issue will crush and boomerang on those who are bringing it. The farms Nawakwi bought, Cold Storage and the President. Same with my issue. Heads will roll from top down. You think I did what I did for nothing?’’

Pamela Gondwe continued,” I was told everything that took place there. Madam DPP you know why I haven’t been arrested. But you were there entertaining the thought, in fact encouraging the discussion. I can’t understand also why the people from ACC and DEC were participating in this idle talk. And the people from OP were num. Why? IG Kanganja knows where to find me. DEC and ACC know where to get me. You know where to get me. “COME ON BRING IT ON. I TRULY NEED SOME KIND OF CATHARSIS.’’

Gondwe was breathing fire into the cellphone. Was she afraid of being arrested nonetheless? The DPP was scratching her head. This was all new and news to her. No one had ever approached her about this. This past evening is when she knew Pamela Gondwe was in town as an open secret. Has the DPP been keeping the wrong company? There must be a reason why she was kept out of the loop.

Should she reveal to Pamela Gondwe that she didn’t know any of all this stuff or should she play along?

“Ms. Gondwe, I have to let you know that I operate under a totally different level of legal machinery. I am not subject to the influence of anybody. My office is set up to be totally independent and not subject to the pressure or influence of any authority. Not even the presidency. Let’s leave it at that.”

“Not subject to pressure or influence of any authority. My foot!,’’ thundered Pamela Gondwe. “Cut that crap out. What were you doing in that meeting plotting and you agreeing to charge Hakainde Hichilema with some shit arising from some privatisation issue from three decades ago? How many presidents have we had so far? CHILUBA; MWANAWASA; BANDA; SATA and lastly only towards the end of the LUNGU presidency is this issue developing legs and only because NAWAKWI brought it up. Whose influence and pressure are you dancing to on the privatisation issue? Your so-called independence is a phantom. What happened to the acquittal of Chitalu Chilufya? No pressure or influence of any authority. You sure have some unknown independence or some dark pressures and influences. You couldn’t even appeal the decision on some ground. You make the ultimate decision. Even the Chitotela case. You refused to appeal a clearly wrong decision. Some independence, madam. Your LLM thesis on this subject is better written than your behaviour in that office.”

Gondwe continued, “Let me not digress. Like my issue, DPP, many people are going to be raked over the coals, should you succumb to arrest me or Hakainde Hichilema. But let me speak for myself. It is interesting though that my issue came up at the tail end of your discussions about how you collectively were going to get rid of the Hichilema threat through the calculus of the privatisation issue!”

“Ask yourself what is in it for Nawakwi, for the President, etc. Who got their wealth legitimately in comparison: HH as compared to the President, to Chitotela, to Chinese, to Chilufya, to Nawakwi, to Lusambo, to Kaiser Zulu, etc? Pause and think and exercise your independence. Public relations is good but not at the alter of wrongful and deliberate persecution. Know that what you are doing to HH is persecution and not prosecution. And HH will emerge as clean as a whistle and your people will be bankrupt and exposed while the government lawyers and the voters will be the victors. The voters will know who they have kept in power, Kleptocrats. Go ahead and make his day. Be the instrument of his electoral victory. Cleanse him unwittingly.”

The DPP was dumbfounded. This kid Pamela Gondwe knows too much. And so much. Should I set an interview with her, the DPP thought.

“Let me help you, madam DPP, as I let you go back to sleep. Do you think I could collect that huge amount from Barclays Bank without some people in higher up places knowing? How could I leave Zambia like that without any help form higher ups? How did I reenter Zambia? The IG, ACC, OP and DEC know I am around. You the DPP knew I was around. The shit is gonna hit the fan if you arrest and charge me.”

Pamela Gondwe was finished and hung up the phone. A cold sweat was enveloping the DPP’s body.
