…as Zambia witnesses, yet again, another case of eliminating political opponents through the illusion of truth.

Repeat a lie often enough and it becomes the truth, is a law of propaganda that psychologists refer to as the “illusion of truth” effect. Understanding this effect can help you avoid falling for propaganda.

Former Minister of Health, Dr. Chitalu Chilufya, has repeatedly urged the new dawn government to investigate the expired drugs scandal stating that, “…we cannot sacrifice science at the altar of politics.”

Dr. Chilufya recently said that there were three forces in government which were engaged in a battle of thrones fighting to get an upper hand. He said a cartel of politicians, rival businessmen and strategically positioned civil servants defiled science and falsified reports to dent political threats.

“We must endeavour never to manipulate oversight institutions in order to settle scores with perceived political enemies. Let’s not defile science. Let’s not falsify reports just to inflame the nation,” Dr. Chilufya said.

And the dexterous former Minister of Health explained that government has got a budget to dispose off drugs that are no longer in use because of new molecules. He said because of this, some people ignorantly described such drugs as expired.

“If for example there’s evidence that a new drug will reduce HIV viral load in a month while the old drugs would attain that in 12 months, we transition patients to the new regimen. So, every year there’s a budget line to dispose off drugs that are out of use; some of which may have expired out on disuse. We don’t distribute or dispense these expired molecules. Instead, we incinerate them,” said Dr. Chilufya.

He said the narrative was systematically unleashed to the public through compliant media and sustained, ‘unfortunately, with certain individuals in public institutions under their payroll’.

“So, today I go on record that we never procured drugs that were expired, neither did we ever procure condoms that were leaking. We did not, whatsoever, subject Zambians to drugs or condoms that were expired or leaking respectively. I am a trained and certified medical doctor and I would never put the lives of Zambians at risk by providing them with drugs that are expired,” Dr. Chilufya emphasised.

“And it is shameful that cartels of senior civil
servants with selected politicians and businessmen colluded to create this narrative just in order to tar my image in the conscious of the public and push me into political oblivion as battles of thrones ravaged the party. That is unacceptable. We have the obligation to future generations. We cannot defile science in order to serve our immediate personal interests!”

He said the truth was the victim but that it could not be suppressed forever, saying it was time for the truth to come out. Dr. Chilufya said it was important to ensure that officers put in offices clad in constitutional immunity were not manipulated and should discharge their duties honestly.

The former Minister of Health has emphasised that it was important for politicians from the previous administration and the current one to uphold honest discourse in the health sector that must remain apolitical.

And today, Amb. Emmanuel Mwamba wrote on his Facebook wall, “It was a big scandal, leaking condoms, expired drugs, rotten medicines! Now two years later, the Zambia Medicines and Medical Suppliers has released the same consignment of drugs, imported by Honeybee Pharmaceuticals for eventual use in hospitals, clinics and health centres, that the regulatory authority had impounded and quarantined. This is the medicine they had alleged that it had failed quality and safety tests. A Minister was fired, boards were dissolved and a PS arraigned before court. So was the entire episode a PUNKA story?”

Our high levels of illiteracy form fertile ground to execute propaganda on as a lethal weapon to eliminate political opponents. If anything, it’s this very narrative that is at the centre of our underdevelopment. Hence our advocacy for a new home bred governance system that must prioritize development over politics of patronage. The only crime Dr. Chitalu Chilufya committed was expressing interest in leading the Patriotic Front.

President Hakainde Hichilema announced that government had fired four procurement officers that allegedly helped price upwards, the cost of building a house in Eastern Province from K200,000 to K850 000.

A friend of mine and quantity surveyor thinks that the President is being misinformed and being given inadequate or unexplained data.

He said the design and construction of two-bedroomed houses in a compound in Vubwi cannot never cost K200,000, per unit, 603km away from Lusaka.

He said the matter becomes more difficult as it is units of houses being built in Vubwi.

He says this involves associated costs of;

  1. Detailed designs of a unit of the house.
  2. Cost of material from Lusaka, 603km away.

3.It is a compound, so there will be the construction of peripheral works such as;

a) Construction of accessibility road to site,

b) Road network in the compound,

c) Bulk services, that include water supply, sewer system and electrical reticulation and associated drainage works.

d) if the units are many, they may require own step down transformer for the compound.

e) There are also preliminary and general works.

f) Further their are professional fees associated with works to design, supervise and deliver the project.

Infact he says to his knowlegde, the quotation from the National Housing Authority, a quasi-government institution that participated in the tender, priced far higher than the K850,000 per unit as given to the winning bidder.

The dismissal of the four workers in Eastern Province therefore required more care before we take simplicity approach to these matters.

Clearly we need technocrats to help verify information that comes from whistle-blowers as it may be insufficient, inconclusive or clearly misrepresented as the case is above.

Before and after elections, some people, job seekers, those acting to impress, and those seeking favours, heighten the peddling of juicy information.

It’s up-to the leaders to take great caution and take time to verify such information.

Whistleblowers are welcome, but the information requires that it is processed and verified before its passed on to higher authorities so that the President is not placed in an awkward situation as this case may turn out to be.

ZIIMA Press Statement on the continued harassment of journalists in the new dawn administration

THE Zambia Institute of Independent Media Alliance (ZIIMA) has noted with sadness the recent outbursts by the UPND Party and other Members of Parliament’s attack on the media.

The ruling UPND Secretary General Mr. Batuke Imenda called for a press briefing two days ago to simply undress The News Diggers over a story that exposed government’s inconsistency on youth employment.

Instead of sending his complaint in a normal manner, Mr. Imenda chose to castigate the newspaper and particularly the reporter in front of his cadres that has seen UPND Member of Parliament for Kankoyo Hon Heartson Mabeta threatening to close the daily tabloid.

In as far as we are concerned, Hon. Mabeta on his own has no power to do that, his statement must not only be dismissed with contempt, but be treated as a UPND official statement.

We recently witnessed police arresting the KBN TV station manager for the expose of an audio by state house planning to kill multiparty democracy, which is enshrined in the constitution.

We want to remind Mr. Imenda that he is Chief Executive Officer of the governing party and we will judge his attitude and that of his members towards the media as the official party position.

We have also witnessed the Lumezi MP Munir Zulu who equally harassed the Mast newspaper for simply reporting the truth.

Another freelance journalist Thomas Zgambo is living in fear following threats on his life by police.

We expect the UPND government to come out clean on such acts that do not guarantee media freedom that the Republican President who is also President of the Party guaranteed days after winning the August election.

ZIIMA will be writing complaint letters to the UPND national chairman Hon. Stephen Katuka, The Speaker of the National Assembly Hon. Nelly Mutti and to the Inspector General of Police Mr. Lemmy Kajoba on these respective harassments.

We condemn the attacks on the media and want to remind the UPND that it is the same media, especially the private that propelled them into power, to this, we give credit to the News Diggers for exposing the Mukula and the Honey Bee scandals under PF, which heavily gave the UPND campaign points, off course the UPND had something to talk about because News diggers brought it out.

MAKE USE OF 2017 WORLD BANK STUDY FOR VALID JOB CREATION STRATEGIES – HIKAUMBA

Movement for Democratic Change MDC, an Alliance partner of the UPND has advised the New Dawn administration to utilize useful research work to find that which is valid to be married with the manifesto in order to actualize job creation for the people.

MDC Vice President for Politics Leonard Hikaumba has cited the 2017 World Bank comprehensive study, vision 2030 and the National Strategy on Industrialization and Job Creation as having clearly articulated Zambia’s job creation plans but lacked implementation.

Mr Hikaumba said government should consider going back to these useful research works to find that which can still be valid and see how best the job creation plans can be actualized in line with the UPND manifesto.

Mr Hikaumba was speaking at a press briefing earlier today at the MDC Secretariat flanked by party Deputy Secretary General Ambassador Joyce Musenge and Deputy Media Director Edmond Miti.

Mr Hikaumba bemoaned that the previous leadership under the Patriotic Front had lost focus on strategies meant to create more jobs as evidenced in the high unemployment statistics which have increased from 7.8% in 2012 to about 12.2% in 2020 with a possibility of being stressful by 2021.

Mr Hikaumba said the MDC as a party supports and urges government to ensure that it departs from what was happening in the past where it was mere talk without clear action on job creation.

He said according to the 7th National Development Plan (2017-2021) launched by the PF, government came up with a plan to create 1 million jobs in 5 years but this was not realized because of lacking clear action plan.

And Mr Hikaumba said while the New Dawn government is emphatic on job creation, it should be mindful to talk about decent jobs where workers will have reasonable disposable income and enjoy their rights with an entitlement to social security.

Mr Hikaumba said that he was confident that the UPND Alliance implementation plan on job creation will be actualized but added that job creation should be done quickly because there is growing desperation among the people.

Meanwhile, Mr Hikaumba said certain things need to be corrected especially for newly discovered areas with minerals of high value where there is mining activity without regulation by ensuring such illegalities are done away with.

And Mr Hikaumba has called on parliament that as it resumes sitting this month, it should revisit some pieces of legislation such as workers accessing part of their pension fund and also having legislation that is supportive of economic activity.

‘Barbaric’ Zim govt suspends 90% teachers for striking over poor salaries

In what is viewed as barbaric, President Emmerson Mnangagwa’s regime has suspended without pay all teachers who did not report for duty since the official opening of schools while protesting against poor salaries.

Teachers have successfully completed four days of striking protesting paltry unpopular Zimbabwean dollar wages. They are demanding their remuneration in US dollars, an equivalent of US$540 they were getting during the Government of National Unity.

On Thursday, the Ministry of Primary and Secondary Education announced it had suspended without pay all staff within the ministry who did not report for duty since the official opening of schools on 7 February 2022.

This was announced by Minister Evelyn Ndlovu and is likely to cripple the education sector as unions noted that 135 000 of the 150 000 teachers would be affected.

In defiance, Progressive Teachers Union of Zimbabwe (PTUZ) Secretary General Raymond Majongwe said 90% of teachers had been suspended.

“135 000 of the 150 000 teachers have been suspended by the government . We know only 10 % of the teaching force were turning up for duty. Effectively schools have closed again. Sad parents had paid huge amounts for fees,” he said.

In an interview with Nehanda Radio Norton legislator Temba Mliswa castigated the move by the government.

“It is most unfortunate at the end of the day that the government is not listening to the needs of the people. They have been resilient enough and this does not send a good signal,” he said.

“People are truly suffering, we must be reasonable. We must be able to accommodate their views and solve them in an amicable manner. Their renunciation upgrade is long overdue. It’s quite sad. They have done well.

“With all the results they have produced despite the harsh conditions, the pandemic, inflation and poor standards of living, they still pushed to excel. I’m quite saddened by this and its not supposed to be politics.”

Opposition Citizens Coalition for Change (CCC) education secretary, Evelyn Masaiti told Nehanda Radio that the government had made a barbaric decision in suspending “incapacitated” teachers.

“My comment is that, I think it is being barbaric for the Ministry to do that knowing truly that these teachers are very much incapacitated.

“They last received their salaries around mid-January and they immediately announced that schools were going to be opened in February and most of them are living hand to mouth.

“So how do you expect teachers to travel from their homes to work? If they wanted teachers to go back to work they should have given them some traveling allowances,” Masaiti said.

“They should pay teachers what they are demanding. They are expecting the government to restore their salaries to the 2018 level where they were earning US$540. The Minister of Finance always says the economy is improving. So why are they unable to pay teachers.” – Nehanda Radio

EASE TENSION; FULFILL PROMISES

PRESIDENT Hakainde Hichilema and his administration must stop taking Zambians for a ride but fulfil the promises he made during campaigns for last year’s general elections.

Right now there is tension in the nation reflected by the growing frustration among citizens as a result of unfulfilled promises.
The protests by farmers in Nakonde over the delayed delivery of farming inputs and unemployed health personnel in Lusaka are a reflection of the failure of the new government’s policies.

In the last few days, social media has been aflame over the careless statement made by UPND secretary general Batuke Imenda that his party did not sign any contract with anyone assuring them that it would employ them when it formed government.

People from all walks of life have taken to social media to condemn the statement and have urged the UPND government to fulfil the lofty promises it made to the people of Zambia, especially the youth.

While the hundreds of thousands of unemployed youth were expressing their anger and disappointment with the so called New Dawn administration on social media for spitting in their faces farmers besieged the district commissioner’s office in Nakonde protesting the delay by the government to deliver fertiliser under the Farmer Input Support Programme (FISP) for this farming season.

President Hichilema traversed the nation making all kinds of promises to the voters. But so far he has backtracked on many of those promises.

We urge him to honour the following promises:

  1. After he was sworn in as president the rate of the Kwacha to a dollar would drop to K10 from around K16 the same day; and that the rate would later return to a single digit
  2. Fertiliser would be delivered on time, and that the quantity per farmer would be increased
  3. There would be no cadreism yet UPND cadres are terrorising citizens, including civil servants, and private businesses every day.

The President must also intervene in the continued violation of the rights of his political opponents by investigative wings.

He should show leadership and stop the excesses being perpetrated by the investigative wings against his political foes in the opposition in his name.

Since he was sworn in the country has witnessed the shrinking of the democratic space with freedom of expression being curtailed with impunity.

Those who are speaking against the President are being summoned, interrogated and detained on flimsy charges.

We urge President Hichilema to unite the country as he promised instead of dividing it as he is doing. He is President for all Zambians.

We had regard for President Hakainde Hichilema and hoped despite his shortfalls he was better than the PF but what he has done to the CDF guidelines is total criminality and he must withdraw this illegality of a guideline with immediate effect. Only a Corrupt syndicate of criminals run by a mafia can parallel the path Hakainde Hichilema’s UPND government has taken over the CDF guidelines. That document is a total adulteration and abuse of the Zambian Law with capacity to institutionalize caderism and blatant plunder the nation’s little remaining wealth.

The Economic Freedom Fighters-EFF party has noted with dismay several grave legal abuses and affronts against our Republican Constitution, the Constituency Development Fund-CDF Act, 2018 and the Employment Code Act contained in the just launched 2022 CDF guidelines and earnestly advise that you withdraw it to immediately rectify the following serious breaches:

  1. Constitutional rights affronts of the people of Zambia through its segregative overtures against Zambians in ‘permanent’ employment .
  2. Illegal opening of multiple Bank accounts to administer CDF contrary to the provisions of the CDF Act No. 18 of 2018 which forbids that.
  3. Minister’s abuse of authority by instituting Illegal Distribution of soft-Loans contrary to the mandate of CDF as contained in the CDF Act No. 18 of 2018.
  4. Abuse of authority by the Minister by Illegally directing all Constituencies to compulsorily purchase brand new 4×4 cars contrary to the CDF Act No. 18 of 2018. It is the Community by Law that decides what should be bought from their money not the Minister.
  5. Procedural Impropriety over use of CDF Guidelines contrary to the CDF Act No. 18 of 2018 which guides that Statutory Instrument SI should be used instead to remedy statutory gaps.
    In the interest of Zambian, our democracy and good governance, we wish to advise the Honourable Minister of Local Government that his failure to withdraw the 2022 CDF guidelines immediately will leave us with no choice but to commence legal proceedings as we cite him for aiding the breaking of the law as is prescribed in Section 28 of the CDF Act No. 18 of 2018.

ECONOMIC Front party general secretary Wynter Kabimba says there is need for a legislation compelling political parties to disclose their source of financing as a matter of national security.

Featuring on Diamond Television’s Current Affairs programme on Tuesday, Kabimba warned that as the situation stood the country risked being ruled by a mafia-financed political party.

“Political party financing which is not circumscribed by the law is a danger to every society, in this case our society because the adage that he that pays the piper calls the tune applies here. You can’t finance a candidate in the United States as a Zambian here even if he’s your best friend, even if he’s your brother. Why? Because this is an issue of national security,” he said.

“You can have a government at one time or another in this country but it is financed by drug diggers. You can have a government in place in this country which is financed by the mafia. You can have a government in future in this country which is financed by the jihadists. There is danger in that. It is high time that we legislated. That is an area which requires legislation to make sure that political parties account for their source of financing. That is an area of national security in our view as Economic Front.”

Kabimba said allowing foreign entities to finance political parties was wrong because it endangered Zambia’s sovereignty.

“Before we even begin to talk about political party financing from the domestic budget, we should do away first with foreign financing of political parties, or what someone can refer to as sources of financing of political parties by unknown entities and individuals. That is what would be a danger,” he said.

Meanwhile, Kabimba said his party appreciated the recommendation by the European Union, but added that they should come within the spirit that the system was on the road to improvement on each and every area of an election.

He said democracy was a process and was hopeful that the country had drawn lessons from the 2021 general elections.
And Kabimba said there was no need for the amendment of the public order Act.

“People say what is wrong with the law is the law. No! What is wrong with the law are the altitudes of people. Here is a police officer who says I have withdrawn the permit, and you ask him, under what provision did you grant me the permit? He can’t point at anything. And you know what they tell you next, I have instructions from above. But that’s unreasonable,” explained Kabimba.

“And now above him includes the commanding officer, the Ministry of Home Affairs, it includes the Inspector General of Police, it includes even the President. So, you have no parameters from which you can argue with the man rationally and reasonably. And you know police are not trained to think, they are trained to take orders, okay. So, the man says to you, I have taken instructions and looks the other way. It is done and you remain with your frustrations. That is the problem attitudes. You can amend the public order Act a hundred times, if you are going to have a president who is a dictator and a police service that has not been trained in respect to civil liberties, it will not take you anyway.”

AMID numerous challenges the country is currently grappling with emanating from a crippled economy the UPND inherited from the PF, President Hakainde Hichilema has assured Zambians that he will grow the economy.

After swearing in Zambia Correctional Service Commission chairperson Evaristo Kalonga and six permanent secretaries at State House yesterday, President Hichilema said he had never been so confident about resuscitating the country’s economy regardless of how bad things are.

Apart from Kalonga, President Hichilema swore in six permanent secretaries namely Dr Mutinta Musonda for administration at Cabinet Office, Mervis Nkomeshya (special duties at cabinet), Angela Kawandami (special duties at Cabinet Office), Lillian Kapusana (administration in the Office of the vice president), Robert Kamalata, (Lusaka Province) and Simomo Akapelwa for Western Province.

“We understand why this economy collapsed. Believe me, we fully understand how it collapsed. How institutions began to collude with suppliers. Government officials colluding with suppliers. How will citizens be protected?” he said.

“Then you are surprised why the economy went down from seven per cent to zero! Why are you surprised? It is these issues such as building a house, a contract at K850,000 instead of K200,000. Please be the eyes of the 18 million Zambians. Provide effective leadership.”

He reaffirmed his determination to grow the economy.

“Resources are always scarce, how you use them is what matters. We will grow this economy. I have never been this confident, even when things are bad,” President

Hichilema said. “The work I have done, travelling to New York, Washington, travelling to UAE (United Arab Emirates). Travelling to Addis Ababa [Ethiopia for the AU assembly] just last week, I sat on the plane and I said, ‘we’re going to change this country’.”

And President Hichilema refuted claims that he is not fighting the corruption happening in his administration.

“If you carry on with the old habits of dividing people, segregating people, then you are not playing your part…Tender committees under these PSs (permanent secretaries) have continued to give contracts at a high price against the three rules: correct price, quality and timely delivery,” he noted.

“It means permanent secretaries are not supervising the tender committees. Yet you are the controlling officers. You want the President to walk from State House to your ministry to seat in tender committees? No. Aikona man.”

President Hichilema cited a situation where a contractor wanted to defraud the government through overpricing.

“We have had an incident where new sitting permanent secretaries are sitting and ignoring what is going on. A small two-bedroomed house which should cost K200,000, they attempted to issue a contract of K850,000 for one small two-bedroomed house. Luckily that permanent.

“All is well that ends well” , these were the words of Former Republican President Edgar Chagwa Lungu as Members of the Patriotic Front went to offer solidarity to him today.

This comes after the recent arrests of the Former President’s Aide de Camp and Barber who has been reportedly tortured while in detention.

Among those who went to visit the former head of state include party acting President Given Lubinda, Parliamentary party Whip Stephen Kampyongo, PF MCC in charge of information and publicity Raphael Nakacinda, Former Lusaka Province Minister Bowman Lusambo and some PF members of Parliament together with other Members.

And the former President Dr Lungu was appreciative to have received a visit from Members of the PF.

“Even in retirement, You can never be a leader without people around you. I am glad that I have the support of my colleagues from the party in this turbulent times that we are going through,” he said.

“Obviously statements have been made, but I am not in a position to talk too much today, but we will allow matters to settle. As you know my ADC was picked on matters of sub-judice, My barber Shabby Chilekwa has been picked for reasons yet to be known, Suffice to say all is well that ends well,” he stated.

And Shiwang’andu Member of Parliament Hon Stephen Kampyongo has assured the former President Dr Lungu that the party will continue standing with him even in retirement.

Meanwhile, former Lusaka Province Minister Bowman Lusambo said the arrest of the ADC is tantamount to endangering the security of the former head of state.

Hon Lusambo has challenged the police to work independently as it should be.

“It was very unnecessary for the police to act in the manner in which they acted. I want to challenge the police that they do not belong to the UPND. The police belongs to the Republic of Zambia” he said.

Hon Lusambo has also challenged President Hakainde Hichilema to bring peace in the country and quench the political tension that exists.

And Mpika Member of Parliament Francis Kapyanga says the legacy of the former President Dr Edgar Chagwa Lungu will never be erased even if Members of the PF are arrested.

He urged the Church to Join hands and condemn what is happening in the country.

“Let me thank the Archbishop of Lusaka for having spoken against the arbitrary arrests. People of Zambia voted for real change and six months down the line they have not seen any change. The European Union who in the country should join hands in condemning the human rights abuses that are taking shape in the country,” he said.

Malanji pleads with court to allow him to produce his G12 certificate

LAWYER representing losing UPND candidate for Kwacha Constituency Machayi Kasaji has opposed an application by Joseph Malanji to produce his grade 12 certificate at appeal stage when he failed to avail the same to the High Court.

Kasaji said Malanji is attempting to have the matter retried on appeal in order to have a second bite at the cherry when he slept on his rights to prove that he possessed a grade 12 certificate before the Lusaka High Court.

In this matter, Malanji has contested High Court judge Kazimbe Chenda’s nullification of his election as Kwacha Constituency member of parliament on November 19, 2021 due to lack of a grade 12 certificate and electoral misconduct.

This was in a matter where UPND candidate Charles Mulenga petitioned Malanji’s re-election citing bribery, electoral misconduct, among other reasons.

Mulenga also cited the Electoral Commission of Zambia as the respondent in the matter.

Judge Chenda said Malanji failed to produce cogent evidence to support his assertion that he possessed a grade 12 certificate on August 12, 2021 neither did he prove in his answer to the petition that he possessed the requisite academic qualification nor was it produced by the returning officer.

But Malanji argues that judge Chenda erred in law and fact when he held that his election was void on account of eligibility.

He said the learned trial judge erred in law and fact when he held that he did not possess a grade 12 certificate when in fact he did.

When the matter came up for hearing on a motion filed by Malanji to produce his grade 12 certificate before Constitutional Court judges Ann Sitali, Mungeni Mulenga, Margaret Munalula, Palan Mulonda and Judy Mulongoti, the appellant’s lawyer Benjamin Mwelwa pleaded with the Court to allow Malanji to produce his grade 12 certificate.

Mwelwa said the Court being at the apex in constitutional matters, it had exclusive power to order for the production of any document and to call witnesses.

“It’s on that premise that we have knocked on the doors of this court that it is extremely necessary and appropriate in the interest of justice that Malanji be allowed to produce his grade 12 certificate notwithstanding the election principle that whoever alleges must prove his allegations,” Mwelwa said.

He submitted that allowing Malanji to produce a grade 12 certificate will help the court to arrive at a just decision whether he possesses the same or not as prescribed by the law.

“As officers of this court, we have a solemn duty to place any evidence or document which may help the court to dispense justice. We crave the indulgence of this court to order the production of the grade 12 certificate,” said Mwelwa.

Malanji’s other lawyer Joseph Chirwa submitted that the court had power to order production of a document which was not produced in the court of first instance as well as to order a witness to offer evidence on appeal before court.

“The caveat is that such an order must be done in the interest of justice as the law under Section 25 (1)(b) of the Constitutional Court Act no. 8 has put the Court to test to determine whether it is in the interest of justice,” Chirwa said.

“The court will arrive at a sound decision to determine whether the appellant has a grade 12 certificate or not upon its production. The production of the same will satisfy the test of expedience.”

He said election petitions are matters of public interest as over 80,000 constituents in Kwacha Constituency are eager to know if Malanji possesses the requisite academic qualifications.

“The constituents cannot be subjected to an unnecessary by-election when Malanji possesses a grade 12 certificate. We pray that the court allows us to produce the same,” prayed Chirwa.

But Kasaji objected to Malanji’s motion to produce the school certificate at appeal stage.
He said though it is not in dispute that the court has the power to order the production of evidence and call witnesses, the appeal was not a proper case for the court to exercise such discretion.

“We will be saying that the court erred in law when it held that Malanji did not possess a grade 12 certificate and it will be unfair on the lower court because the grade 12 certificate was not produced before it and never

formed part of the record,” Kasaji said.

“If the motion is allowed, we will be retrying this matter on appeal. Having failed to produce the certificate he seeks to produce now, the appellant has realised that it is important because the judge referred to it in its decision.”

He said Malanji opted to mount a legal technicality when the issue was raised.

“This is not a proper case for the court to allow Malanji to produce the documents he seeks to produce as he is attempting to retry the matter on appeal and have a second chance,” insisted Kasaji

Bob Musenga and Mukunsa Bwalya who were representing ECZ said they would rely on the court’s direction.

In reply, Mwelwa said his client had difficulties to comprehend Mulenga’s lawyer’s argument that the school certificate cannot be produced on appeal because it was not produced before the High Court.

He said Kasaji had not referred the court to any provisions of the Constitutional Court Act no. 8 which mandates the court to order production of the certificate whether it was produced in the lower court or not as long as it was in the interest of justice.

Chirwa argued that there was a reason the legislature put up section 25(1)(b) to allow the production of documents on appeal even if they were not produced at the court of first instance.

“If the court allows the production of the grade 12 certificate then the case will come to an end. The production of the document will not embarrass the court below but vindicate it if at all there is no grade 12 certificate,” said Chirwa.

The court has reserved ruling for February 24.

Magistrate Explains To Lusambo That He Concealed 3 Properties Worth Over K4.4 Million In Wife’s Name

KABUSHI PF member of parliament Bowman Lusambo has appeared in the Lusaka Magistrates’ Court for possession of three properties reasonably suspected of being proceeds of crime worth US$248,000 (K4,464,000).

And Lusambo is also accused of corruptly acquiring two properties at K880,000 and K150,000 respectively.

Lusambo, 45 a businessman and politician, who is former Lusaka Province minister, appeared before magistrate Faides Hamaundu for explanation of the charges as the State awaits a consent to prosecute the matter from the Director of Public Prosecutions (DPP).

Lusambo told the court that he understood the charges he is facing.

In the first count, it is alleged that Lusambo
between May 1, 2015 and December 31, 2021 in Ndola, Copperbelt unlawfully acquired property number L/39376/M in the name of Frontier Management Services Limited, which property was later transferred to Jignesh Prafulchandra Soni at a consideration of K880,000 his own benefits.

Count two alleges that Lusambo between January 1, 2017 and December 31, 2018 in Masaiti unlawfully acquired certificate of title in respect of stand number MASILN-1003024/18 in his name, thereby obtaining an exemption from paying the sum of K250,000 plot premium land which property was later conveyed to Mbachi Nkwazi at a consideration of K150,000, an act prejudicial to the rights and interest of Masaiti Council.

In the third count, it is alleged that Lusambo on September 1, 2021 and October 31, 2021, in Chongwe, jointly and whilst acting together with another person concealed property number HN 249 situated in Silverest Gardens valued at US$60,000 in the name of Nancy Natasha Manase, property reasonably suspected to be proceeds of crime.

In count four, it is alleged that Lusambo between September 1, 2021 and October 31, 2021 in Chongwe, jointly and whilst acting together with another person concealed property number HN282 situated at Silverest Gardens valued at US$128,000 in the names of Nancy Natasha Manase, property reasonably suspected to be proceeds of crime.

In the last count, allegations are that Lusambo between September 1, 2021 and October 31, 2021 in Chongwe, jointly and whilst acting together with another person concealed property number HN249 situated at Silverest Gardens valued at US$60,000 in the names of Nancy Natasha Manase, property reasonably suspected to be proceeds of crime.

After explanation of the charges to the accused, magistrate Hamaundu adjourned the case to March 9 for mention and possible plea if consent will be granted.

Davies Mwila laments how DEC officers have continued interrogating PF members over source of funding, vehicles used in last year’s General Elections

THE Patriotic Front (PF) has lamented in the Lusaka High Court how the Drug Enforcement Commission (DEC) officers have continued interrogating its members over its source of campaign funds and motor vehicles used in last year’s General Elections.

And PF former secretary general Davies Mwila has submitted that former president Edgar Lungu’s aide de camp, Chisanga Chanda, was arrested on February 4, 2022 and interrogated on among other things, the source of campaign vehicles which were used during the 2021 General Elections.

This is in a case in which PF through Mwila in his capacity then as SG, sued the Attorney General over the continued harrassment of party members.

The PF is seeking a protection order from what he terms ‘harrassment of PF members over its source of funding for last year’s campaigns.

Mwila was also claiming damages for intimidation and harassment.

He further sought an order that the State awards the PF party damages for misrepresentation, defamation of character and discrimination.

Mwila also seeks a declaratory order that he should not be compelled to disclose the PF’s source of funding and that the court should declare that the funding of the 2021 General Elections was not from money laundering activities.

But DEC in a defence filed in court urged the court to dismiss the case, saying the motion was a mere attempt to curtail the ongoing criminal investigations, which investigations involve some PF party members.

Mwila however, stated in a reply filed in court that he was personally summoned and interrogated by DEC.

He stated that Antonio Mwanza was also summoned and interrogated on the source of campaign funds and on how the media houses were paid for the services rendered to PF during the campaigns and statements were actually recorded by investigation officer Higton Chilela.

Mwila added that lawyer Anna Mwitwa was also interrogated on the payments made to media houses which had sold broadcasting time to PF during the 2021 campaigns.

“The plaintiff shall aver and prove at trial that the defendant has continued to investigate the source of campaign funds and has threatened the plaintiff’s associates who are interacting with the party. The plaintiff shall prove with written documents that the defendant has even gone a step further to summon media houses that were selling media time to the party during the 2021 campaigns,” stated Mwila.

THE UPND SG IS MISUNDERSTOOD: BUT WHAT’S HIS POINT?

Mr Batuke Imenda, Secretary General (SG) of the United Party for National Development (UPND), in modern language, he is currently trending. He is awash in the media. Tabloid banners and social media platforms are screaming his name. He indeed is the man of the moment.
There are many reasons why any man would trend as Mr Imenda is trending currently. However, many the reasons maybe, they can just be classified into two categories. It is either Mr Imenda has done something brilliantly right or something awry and actually appalling.
I am not in any position to criticize, fault or blame anyone for whatever position they may have formed or taken on the SG. I am equally not in a position or possess the power to argue with the media. I am but a small man. However, I believe I am also entitled to form my own opinion on the issue, just like any other Zambian has done. It is from this firm understanding that I pen these words.


From the front page banner of the Wednesday, 9th February 2022 edition of the tabloid, News Diggers, as well as other social platforms, the issue is that the UPND SG, Mr Batuke Imenda said “We Didn’t Sign a Contract….that we will employ you after forming government.” This has not gone well with a lot of people, especially the youth, UPND Youth, who in turn took to the media to air their displeasure, and maybe disappointment, in the SG.


Following the release of the tabloid and the news of the statement of the SG becoming awash, the SG held a press conference to dispel the allegation. In his words, he stated that the reporter in question quoted him out of context. He further charged and challenged the reporter in question to avail the said recording to the press in order to clarify the said accusations.


In a dramatic turn of events, Mwebantu featured an item that seems to come from News Diggers. It simply read: Dear UPND SG Batuke Imenda, Challenge accepted. Signed Editor. In accepting the challenge, a short audio of a voice purporting to be that of the UPND SG is clear, answering a query from a youthful voice. …”all we did as a party is to declare that we are going to change government and create employment. But sometimes people have their own agendas. We were saying we are going to create employment, we did not sit down with anyone; and write a contract and then say when we get employed, you will be a lecturer at the University of Zambia. Or when we form government, you will be working at the stations. Or when we form government, you will take over markets. No, we did not sign a contract with anyone in that line.”


If this is what has caused the media uproar, I ask myself a question: was the SG wrong so to say? I then answer myself: No. The reason is that I do not recall any one time did the UPND, from the time of the late Anderson Mazoka when it was said that “vote for UPND and in turn, you will take over the running of a bus station.”


Besides, although the News Diggers Journalist gladly accepted the challenge and posted the audio, you will agree with me that, the challenge was but in part. The audio which I have quoted above was only less than 3 minutes. It does not give clear background or circumstances of the whole issue, which led to the issuance of the words of the SG. Hence, the audio, clear as it maybe, leaves us in a state of: “blind men and the elephant.” We only know half the truth but we want to assume it’s the whole truth. Additionally, the backlash of the media and populace, in my view, ignores what the other voice was asking the SG. The voice said, “…what is your view on youths who feel entitled to….”


In view of such a question, is it really wrong for the SG to answer as he did?
Those who are saying the SG is wrong in his statement, are they advocating the return of the Patriotic Front (PF) manner of running public affairs? Is that not what we all voted out on 12 August 2021, to liberate the country from the strangle of the party and it’s cadres? Are we still advocating for the party youths to stretch their feeling of entitlement to an extent of capturing your Government once more as the case was under the PF?


Clearly, we now have a complete separation of the government and the party, which the SG has been a strong advocate for. Those closer to the SG and the UPND will understand that whilst he is a man of few words, he is a very caring parent that has allowed the youths in the party to take centre stage and express their leadership in line with his well known agenda of identifying and building the leaders of tomorrow in the UPND party.
It is in affirmative within the party that Mr. Imenda has ably provided the fatherly-figure leadership and held the youths within close check to avoid the return to PF days when the youths took over the running of markets and bus stations and broke the sacred hall that existed between the Government and the party. The SG has always preached restraint and many times called on youths to give the UPND time to roll out the policies that would create employment and alleviate poverty in the country.

Suffice to mention that the SG was merely echoing the vision of the republican president and the party that the many jobs being created by the New Dawn Administration are blind to political affiliation as they are not specially reserved for the UPND youths, but all Zambian youths. I am certain it is within his right, as the party SG, so to do in order to tame his party youths.

Yes, Mr. Imenda is so soft and calm as many people think, but we cannot ignore the fact that he is also firm and very thoughtful in his decisions. This is absolutely what has made him a successful SG for the party and enabled him to contain the eagerly expectant UPND youths who are desperate for jobs, benefits and other opportunities perceived to come with the change of Government.
Those of us that have lived and worked so closely with Mr. Imenda know for sure that he is a man of peace and exquisite personality. He is very tact, a good listener, considerate, and a gifted thinker. Many that have worked under various Secretary Generals in the party rrecognize Mr. Imenda for his brevity, accommodating nature, and amazing foresight. Simply put, he is not a man who can utter careless remarks that would hurt the very youths that he fondly cherishes and tirelessly speaks for them both within the party and Government circles.
Just in case, some of you still feel offended, how about forgiving such a gentle soul that loves peace and has indicated to all of us that his intended message to the party youths had been misconstrued? Do not judge him from an incidence of failed communication, Mr. Imenda is a man of the people, youths and everyone else.

How The Kabwata By-election Was Rigged- Sean Tembo

HOW THE KABWATA BY-ELECTION WAS RIGGED

Step 1: Force a postponement of the election so that they can buy more time to put the rigging machinery into place. This was achieved by sponsoring the withdrawal of one candidate and subsequently the election date was pushed forward from 20th January 2022 to 3rd February 2022.

Step 2: Limit the number of Polling Assistants Seconded by Each Party. Ideally, each party is entitled to allocate two Polling Assistants per Polling Station. But under the excuse of the pandemic, ECZ restricted all political parties to seconding only a maximum of 12 polling assistants to monitor 131 polling stations. That meant that 119 polling stations were not monitored by any political party. Even the 12 that were manned were not adequately manned because you need two people per polling station and not one.

Step 3: Accredit Majority Friendly NGOs Only as Election Monitors. With the exception of CCMG, the other election monitors were largely known affiliates of UPND. This ensured that they tolled the line in rigging the election.

Step 4: Intimidate and Harass Political Party Representatives at Polling Stations. On Election Day, some opposition political parties like PF tried to protect their vote despite the limitation of 12 polling assistants only. This was done by sending party representatives to hang around the premises of the polling stations and observe from a distance if any malpractice was taking place. These were quickly identified and harassed out of the polling stations.

Step 5: A Collaboration between ECZ, Zambia Police and UPND. The three entities collaborated and conspired to identify and harass any defiant poll observers other than the 12 per political party. An example is the 6 PF members who were attacked by UPND cadres and then subsequently arrested by the Police on accusations of electoral malpractice, that they were buying votes at the Polling Station. And they made sure that the whole incident was filmed and shared widely on social media and traditional media. Who can surely buy votes at a polling station like you are buying tomatoes at the market? After the Police saw that the charge which they had given these 6 PF members did not make sense, they changed it from electoral malpractice to disturbing the peace. How can people who were just seated in their Landcruiser outside a polling station disturb the peace? That filmed dramatic arrest was designed to send fear to any other unofficial polling observers who were monitoring the election from a distance, across all the 131 polling stations.

Step 6: Manipulate the Vote. With 119 polling stations out of 131 cleared of any objective polling assistants and election observers, the UPND in collaboration with ECZ and the Zambia Police proceeded to manipulate the vote. This was achieved by ballot replacement at the time of counting. Votes for the opposition were replaced with pre-marked ballots in favour of the UPND candidate. However, they got carried away at Libala Secondary School Polling Station and took and replaced all the ballots that were cast in favour of the DP candidate; Mr Fred Mubanga. They forgot to leave at least one vote for him since he had undeniable proof that he had voted for himself.

Step 7: Allow Ineligible People to Vote in UPND Stronghold Wards: Out of the five wards in Kabwata Constituency being Kabwata, Libala, Chilenje, Kamwala and Kamulanga, the UPND knew that their stronghold was Kamulanga and they proceeded to allow ineligible voters there to cast their votes. Some voters had no voters card and only an NRC. Others had no NRC but only a voters card. While others neither had a voters card nor an NRC. They just bundled them in and allowed them to vote. These revelations are actually contained in the Poll Observer Report recently issued by CCMG, which is a reputable poll observer organization that is made up of ZCCB (Zambia Conference of Catholic Bishops) and CCZ ( Council of Churches in Zambia).

Step 8: With votes cast for various opposition candidates taken away from them and replaced with pre-marked ballots in favour of the UPND candidate, their co-conspirators the ECZ proceeded to announce the UPND candidate as the winner. We know that this is a formula which the UPND will perfect in the next 5 years and that is the reason why we are currently preparing to petition the Kabwata by-election in court where we shall prove the above allegations. It does not matter that if we had all the votes cast in our favour, we still might not have won the election. It’s a matter of principle for us.

Justice Minister Mulambo Haimbe denies claims to use Amos Chanda to implicate Former President Edgar Lungu

Justice Minister Mulambo Haimbe has refuted allegations that there are maneuvers by him to use Former Statehouse Press Aide Amos Chanda to implicate former President Edgar Lungu.

Mr. Haimbe has described as untrue such allegations by Patriotic Front (PF) Chairperson for Information and Publicity Raphael Nakacinda.
He said that Mr. Nakacinda is merely trying to seek political relevance because the opposition PF is losing popularity.

This is according to an audio file on Social Media by Mr. Haimbe

And Former president Edgar Lungu’s Press Aide said that he is unaware of any criminal charges that Lungu may be facing for him to testify against the latter on such matters.

This followed allegations by PF Chairperson for Information and Publicity Raphael Nakacinda that the former Press Aide is blackmailed by Justice Minister Mulambo Haimbe to disclose any possible illegalities the former president and his associates may have committed. Mr. Nakacinda added that Mr. Haimbe set up a meeting between Mr. Chanda and President Hichilema with regards to the matter in question.

But Mr. Chanda said in a statement issued to the media that he has never in his entire life spoken to the Minister of Justice and that Mr. Nakacinda’s attacks against his personal and professional reputations represent some of the darkest forms of evil one can willy-nilly manufacture against an innocent person.

“I have seen on social media, a disturbing video by Raphael Nakachinda making unprovoked, scurrilous allegations imputing an improper relationship between me on the one side and President Hakainde Hichilema and Minister of Justice Malambo Haimbe on the other,” he said.

“Hon. Haimbe has neither blackmailed me nor arranged any meeting for me with President Hichilema. In my entire life, I have neither spoken nor met Hon. Haimbe. I do not, as falsely alleged, have any pending appointment with the President today nor in the foreseeable future.”

Mr. Chanda said he is “completely” unaware of any criminal charges that former president Lungu may be facing for him to testify against the latter on such matters.

“No one in the UPND has asked me about any alleged indiscretions or criminal behavior by any member of the previous administration. Therefore, any such fears are self-inflicted nightmares about things that may or may not have happened,” he said.

“It is therefore mischievous in the extreme, and brazenly evil that Raphael Nakachinda, a documented perennial fraudster, has elected to front me in his bid to perpetuate his parasitic relationship with the former president.”

He said it is unfortunate that Mr. Nakachinda who he described as a patently dishonest person seems to have carved for himself a successful career out of impugning the reputations of others.

“But I want to serve notice that he, and his sponsors won’t enjoy any fruits of evil out of their malicious mention of me, now or in the future,” he said.
“In the meantime, I have sought legal advice on this libelous video which he widely circulated last night, February 8, 2022.”

Don’t Over Dramatise Mining In Lower Zambeizi – Kavindele

DON’T over dramatise mining in the Lower Zambezi National Park, there is nothing sinister about Zambia conducting mining activities in such an area, South Africa is the best example where mining in a national park is taking place, says former Vice President Enock Kavindele.

And Mr Kavindele said he would join the local Member of Parliament, Mr Emmanuel Tembo who has promised to march against people opposing mining in the national park because the poverty levels in Luangwa are unnecessary.

Mr. Kavindele said South Africa has been carrying out mining activities in the Kruger National Park which is a national heritage therefore Zambians shouldn’t find it strange the government has allow mining in the Lower Zambezi National Park.

He said in an interview that Zambians should support the initiative because it would give the government an opportunity to create the promised 1, 500 direct jobs.

“Mining there will not cause any harm to the Zambezi River. Kangaluwi open pit copper mine in the Zambezi National Park is about 40 kilometres from where the animals are and it’s on a plateau,” he said.

Mr Kavindele, who toured the mine in 2018 said the multiplier effect would even be more for the people of Luangwa and the surrounding districts and ultimately reduce the high poverty in the area.

He said it was unacceptable that an area with a lot of minerals has lagged behind in development and with high poverty levels.

Mr. Kavindele has urged the government to ensure that the investor, Mwembeshi Mineral Resources commit to protect the environment and uplift the living standards of the people in the area.

Meanwhile, Senior Chief Mphuka has charged that those who are against mining in Lower Zambezi National Park should give Luangwa an alternative viable industry that would employ youths in the area.

Senior Chief Mphuka said that organisations and individuals demonstrating against the mine needed to give the district an alternative industry which would not affect animals

He said in an interview that the people who were against the mine did not even live in the district but mostly in Lusaka where they were being used by investors to organise youths to demonstrate against the mine

He said people in the district had for a long time lived with animals which they could not even kill for fear of breaking the law and it is the animals that had instead killing them.

Senior Chief Mphuka said Child Fund had helped people in the district by building a 500-hectares fence but elephants are breaking in because was not strong.

“There is nothing you will do that will prevent an elephant for entering the field unless you shoot it and it dies. There is nothing that we have failed to do so that we can live with these animals.

“Here we are competing for food with elephants and they are being controlled by foreigners and not the Zambian government. Those who are protesting against mining in Lower Zambezi are not Zambians. There are people behind them so that Zambians can look like they have no sense, and can break the law and disrespect the court,” Senior Chief Mphuka said.

He said even fish is depleted in Luangwa and Zambezi rivers and people risk being attacked by crocodiles if they go fishing.

He said all the NGOs that are against mining in Luangwa are being sponsored by foreign interests.

“All these youths cannot occupy the national parks and wildlife where someone is organising youths to be game scouts and paid by the community resource board and how much is that?” Senior Chief Mphuka asked.

Zambia Society of Physiotherapy distances itself from Dr Brian Sampa plans to march to State House

Zambia Society of Physiotherapy has distanced itself from Consortium of Health Professional Association Chairperson Brian Sampa’s statement on the recruitment of health workers and a planned march to State House.

ZSP President Martha Banda said that Dr. Sampa’s actions have been done in a hasty manner without due consultation and blessings from the Zambia Society of Physiotherapy.

Dr. Banda said that the statement to the press and communication to the Minister of Health by the Dr. Sampa defeats the purpose of prioritizing dialogue with the ministry and government towards the process of recruitment and other matters of concern raised in prior engagements.

Dr. Banda said it is unfortunate that Dr. Sampa made decisions and executed actions without a collective agreement of affiliate associations.

Dr. Banda said the Society will not represent the Society and its members in any matter henceforth.

She said the Society remains confident that the procedures of human resource deployment in the Ministry of Health will be quickened for the timely placement of trained Personnel to bridge the gap in health care delivery.

On Monday, Dr Sampa announced that Members of a Consortium of 12 Health Professional Associations have resolved to stop volunteering and demand that they receive their letters of employment by 18th February this year.

Dr. Sampa said this follows “loose” statements or promises that have been made by officials from the Ministry of Health from last year but haven’t yielded anything.

Dr. Sampa said that if the government fails to issue the health practitioners with letters, members of the consortium will march to the State House to seek audience and intervention from President Hakainde Hichilema.

“We would also like to condemn comments regarding prioritizing volunteers, the best and those with the right working attitude in the recruitment process as recruitment should offer equal opportunities for all, especially that these are entry-level positions,” he said.

“We also urge our general members to remain calm as we wait for a positive response from the Ministry of Health during the period 9th February 2022 – 18th February 2022.”

Meanwhile, Dr. Sampa said the recruitment of health workers should be done in formality, transparency, and a hastened way by the Ministry.

In a statement issued to the media today, Dr. Sampa said the employment of health workers is long overdue.

Govt to open the bids for the for the construction of the Lusaka-Ndola dual carriageway

The government will next week start the official bidding process for the construction of the Lusaka-Ndola dual carriageway. Infrastructure, Housing, and Urban Development Minister Charles Milupi has said that an advert calling for bids will be issued.

Mr. Milupi said that the government has already received a number of unsolicited bids on the project and some are proposing to work on the road at a cost that is 40-percent lower than the initial $1.2 billion projected by the previous regime.

Mr. Milupi said that the project will uphold the three conditions set by President HAkainde Hichilema of ensuring that construction works are done at the right price and delivered to the right quality in a timely manner.

The Infrastructure Minister said this in Ndola when he paid a courtesy call on Copperbelt Province Minister Elisha Matambo.

Mr. Matambo said the Lusaka-Ndola road is in a bad state and needs to be worked on urgently because it connects other parts of the country to the Copperbelt which is an economic hub.

Mr. Matambo also asked the infrastructure Minister to consider working on other roads in the Province such as the Chingola-Kasumbalesa, Ndola-Mufulira, Mufulira -Mokambo, and Chibuluma roads among others.

Mr. Milupi is leading an entourage of Road Development Agency (RDA) officials who are inspecting road projects on the Copperbelt and North-Western Provinces.

Lately, Former Transport Minister William Harrington said that the recent revelations by transport minister Frank Tayali that the contractor engaged to construct the controversial Lusaka-Ndola duo carriageway have offered to construct the road at 50 percent lower than the original cost of $1.2 billion smells of corruption.

In 2018 the PF administration under then-president Edgar Lungu agreed to have the Lusaka-Ndola dual carriageway constructed at a cost of more than $1.2 billion but the road development agency halted the construction of the road and attributed the stagnation to financial constraints.

Transport and Logistics Minister Frank Tayali is on record to have disclosed that the contractor that was meant to work on the dual carriageway at a cost of more than $1.2 billion has come back into the country and has agreed to do the works at a-50 percent lower rate than what was demanded before.

But Mr. Harrington said that there was need for the anti-corruption commission to take interest in the matter as it is one of the projects the former patriotic front regime could have attempted to use to siphon money from the country for its failed attempt to win the august elections. Mr. Harrington has advised the new dawn government to ask the contractor why he overpriced the road project.

DANGOTE WORKERS IN PAY RISE

Dangote Cement employees have been awarded salary increments ranging from K1000 Kwacha and 15 percent respectively to all its employees.

The revised perks are effective 1st January 2022.

According to a statement signed by Director Linda Mataka, the development follows weeks of protracted but fruitful negotiations between Dangote’s principal Labour contractors Silondwa Engineering and the Mine Union Workers of Zambia (MUZ) and the Mine Contractors, Factory and Allied Workers Union (MCFAWU).

The statement said the Joint collective bargaining salary increase talks which commmenced in November 2021 and were finally agreed and signed on 28th January 2022 by the parties affected. All 486 contracted unionised employees at the Masaiti plant in Ndola will benefit from the windfall.

Other conditions of service which were not ammended would remain in force as contained in the current contracts of employment the statement said.

Ms Mataka said Dangote Cement took the mutually agreed decision before the full course of the last collective bargaining agreement elapses in line with its listening ear policy.

She also revealed that a substantial revision of the salaries of the 178 non unionised bracket was also effected.

The non unionised workers were awarded a fifteen percent raise whose categories include senior management, middle management, and others.

“This category includes 28 junior employees, 108 senior managers and 42 management staff.

The decision to revise the salaries of this category of employees has been made to help mitigate economic hardship caused by high inflation.

In view of the upward revision for the non-unionised employees, management has since announced the new salary scales in the affected categories”, she stated.

Ms. Mataka said Management was thankful for the timely guidance and counsel by government through the ministry of Labour the during the negotiations.

She said that Dangote Cement adhered and conformed with Zambian Labour laws which were clear and rendered the spirit of mutual respect, fairness and common ground between the investor and the work force for enhanced productivity.

Malawians tired of Chakwera’s colourful speeches – Nankhumwa

Leader of Opposition Kondwani Nankhumwa has urged President Lazarus Chakwera to deliver on his promises, saying Malawians are tired of colourful speeches and being told about what the government plans to do.

He made the remarks in Parliament today as he delivered his response President Lazarus Chakwera’s speech titled “Fixing the Systems to Deliver Long-Term Priorities and Diffuse Short-Term Pressures”.

Nankhumwa said it is true that there are broken systems permeating the public and private sectors. He, however, added that looking at how the government is going about doing its business, it is doubtful that President Chakwera is capable of fixing the broken system or systems.

According to Nankhumwa, fixing broken systems requires commitment and decisive leadership, something which Malawi currently does not have.

“Unfortunately, we have a President who hardly sits in his office.
We have a leader who takes ages to make simple decisions; a President whose only first love is travelling across the country, and the world, making beautiful speeches without any backing action,” said Nankhumwa.

He added that Malawians are tired of speeches and now want action from the Chakwera administration.

“Malawians demand jobs. Malawians demand businesses. Malawians demand an end to corruption. Malawians demand an end to systematic inefficiency in the public service. Malawians demand accountability. Malawians demand competence,” said Nankhumwa.

He then described Chakwera as a danger to the process of fixing broken systems, saying the president is a ‘broken system’ himself.

He gave an example of the public reforms report aimed at making the civil service more agile and efficient.

He noted that Chakwera gave Vice President Saulos Chilima 90 days to produce the report and the president received the report in May last year but it is still under wraps and has not been made public despite calls for its release.

Nankhumwa also claimed that he has been informed that there are over 15 bids for various construction works across the country that have already received no-objection nods from the Public Procurement and Disposal of Assets Authority.

According to Nankhumwa, the paperwork has been domiciled at the Office of President and Cabinet for months where officials want to verify as to whether the bidders are supporters of the Malawi Congress Party (MCP) or not.

Nankhumwa said: “In his SONA, the President lamented about facing resistance in his quest to reform and fix the broken system. But looking at the fake manner with which this government is going about carrying out reforms and fixing the so-called broken system, I have no choice but to conclude that President Chakwera and his panel of lieutenants are actually the ones that are resisting change.”

On the economy, Nankhumwa called for radical reforms as prices of basic commodities keep going up and there is a general hostile investment climate where companies are scaling down due to shrinking demand and high cost of raw materials.

The Leader of Opposition advised the Government to revamp its tax regime and create an enabling environment for investment and enterprise.

“The government must focus on stimulating production rather than consumption,” he said.

West Ham Player Kurt Zouma fined £250,000 for kicking, slapping his cat

West Ham defender, Kurt Zouma has been fined two weeks wages by the club over a video of him kicking and slapping his pet cat.

Zouma was seen in The video kicking the cat, before slapping it, and then chasing it around the house.

The video has attracted heavy criticism in the English media and has now earned the defender a two week fine.

Zouma who earns £125,000 per week will part with two weeks wages which equals £250,000While there were suggestions that the France international should have been suspended, he featured for all 90 minutes in West Ham’s 1-0 win against Watford last night.

The club came under heavy crítica for fielding the player in the midst of the controversy as calls continue to grow for his outright sack from the club.

Former Premier League goalkeeper, Chris Kirkland shared similar sentiment saying Zouma should get the same treatment as those who racially abuse players, considering that the cat was a defenseless animal.

The club said it has fined the defender the maximum amount possible which is two weeks according to PFA rules and the money will be donated to animal welfare charities, even as the Royal Society for the Prevention of Cruelty to Animals, RSPCA, have now taken possession of the cat.

A statement on the club’s website reads: “West Ham United can confirm that the Club is supporting an RSPCA investigation into the actions of Kurt Zouma in the video circulated online this week.

“Kurt and the Club are co-operating fully with the investigation and the player has willingly complied with the steps taken in the initial stage of the process, including delivering his family’s two cats to the RSPCA for assessment. Kurt is extremely remorseful and, like everyone at the Club, fully understands the depth of feeling surrounding the incident and the need for action to be taken.

“Separate to the RSPCA’s investigation and pending further sanction once the outcome of that process is determined, West Ham United can confirm that Kurt Zouma has been fined the maximum amount possible following his actions in the video that circulated. The player has immediately accepted the fine, which both he and the Club agreed will be donated to animal welfare charities.

“West Ham United would like to reiterate our condemnation of Kurt’s actions and make it clear that the matter continues to be handled with the utmost seriousness. However, we believe it is now important to allow the RSPCA to conduct their investigation in a fair and thorough manner, and will be making no further comment at this stage.”

I was not involved in appointment of my daughter as diplomat – President Lazarus Chakwera

President Lazarus Chakwera has refused to mention the qualifications which enabled his daughter Violet Chakwera to be appointed as a diplomat, saying he was not involved in the appointment process.

Chakwera who was in Ethiopia for the African Union (AU) summit earlier this week was interviewed by the BBC.

His daughter Violet is currently working as first secretary responsible for investments at the Malawi mission in the United Kingdom.

BBC Africa correspondent Catherine Byaruhanga asked Chakwera the qualifications which Violet has.

“Then that’s the thing that those who saw fit, for her to be engaged in that way should be asked. Not a president because I never got involved in the process,” said Chakwera.

Last year in July it was revealed that Violet was going to Brussels, Belgium to work as a third secretary at the Malawi mission. State House defended her appointment saying she was “qualified and capable to do the job”.

However, a few days later, Chakwera in an interview with BBC denied that his daughter had been appointed as a diplomat. He asked the interviewer to check her facts.

But in January this year, pictures of Violet with her family in the United Kingdom were shared on social media and the Ministry of Foreign Affairs confirmed to the local media that she was indeed in London working as first Secretary Responsible for Investments.

Byaruhanga in this week’s interview noted that some Malawians are upset about that because it goes against everything what the president has been saying.

Chakwera in response said: “One could understand that, but you also need to dig into the background, of all the things that I have been able to do, my family has been able to do and this particular person you are referring to, is the only one that has worked with government of all my children.”

According to Violet’s LinkedIn profile, she obtained her degree from a ‘Jerusalem’ University banned in the country for operating without accreditation. She also claims on her profile to have an IATA training certification. She previously worked as reservation sales agent for Kenyan Airways and Malawi airlines.- Malawi24

GEARS INITIATIVE CONCERNED WITH REPORTED TORTURE OF MR SHABBY CHILEKWA BY POLICE

GEARS Initiative receives the reportedly torture of a Mr Shabby Chilekwa with greatest concern as torture is not only a violation of Mr Chilekwa’s human rights and Zambian Bill of Rights but the Constitution of Zambia too.

If the reports of torture of Mr Chilekwa are true as disclosed by his lawyers, then, it is imperative that investigations are instituted immediately against those involved in torturing him to ascertain the violation of the Bill of Rights and the Constitution.

Article 15 of under the Bill of Rights in the Constitution of Zambia guides that:

“a person shall not be subjected to TORTURE, Or to inhuman or degrading punishment or other like treatment”

This guidance from the Constitution is non derogatory and has no clawbacks.

Therefore, the Zambia Police Service must give the nation the right and official position on the alleged torture.

In addition, Article 193 of the Constitution demands that the Zambia Police Service shall uphold the Bill of Rights when carrying out its statutory and constitutional duties, in this case Article 15.

As alluded above, torture is outlawed in the Zambian legal regime and Article 15 which outlaws it is one of the few clauses in the Constitution that have no derogation.

Those interrogators must always respect the law and human rights as guided by President Hakainde Hichilema if Zambia’s to improve on its human rights record.

GEARS Initiative urges the Human Rights Commission (HRC) to make an independent visit to Shebby and investigate the alleged torture as per its constitutional mandate.

Article 230 of the Constitution guides that;

“the Human Rights Commission shall ensure that the Bill of Rights is upheld and protected and that it shall investigate and report on observance of rights and freedoms, and take necessary steps to secure appropriate redress where rights and freedoms are violated”

GEARS Initiative expects the Human Rights Commission weigh in faster on this reported torture.

A Time To Reflect As Regards Our National Assets- Chishala Kateka

A TIME TO REFLECT AS REGARDS OUR NATIONAL ASSETS

Zambia is a well endowed country. We could become a middle income country with just one of the sectors that we have been endowed with. This could be mining, agriculture, tourism, energy, manufacturing etc. We have the capacity to excel and greatly benefit the nation with any one of these, but unfortunately, we do not do any of them well at all and continue to live on the fringes of poverty.

The motive behind every decision we make as a country is the reason why we are where we are.

There is a debate regarding the Lower Zambezi and the proposed mining of the area. We must use this project as an example of how we proceed with projects that we allow in Zambia in future.

I see 4 positions being advanced:

  1. Most Zambians are not for it because of the Environment/wildlife/tourism aspect etc. This is laudable.
  2. The people of the area are for the opening of the mines because they say that the tourism does not benefit them. So the mines will give them jobs.
  3. The Government is allowing the mining to go ahead because the courts have so ruled. – My question here is, are these not the same courts of law that sentence a person to death? Does the President not have a prerogative of mercy and pardon certain people in spite of the courts sentencing that person? Likewise in this case, is there not a law that enables the President to make a decision if that decision is in national interest? I don’t know, our learned colleagues, the lawyers, should help us here.
  4. The New Heritage Party would have handled this in the following manner and looked at all the aspects relating to this. As usual we would have firstly raised questions:
  • Why are the local people complaining about the fact that they have not benefited from the tourism in the area?
  • What are the policies in place in that the tourism sector has, that preclude the locals from benefitting?
  • What loopholes exist in the sector that disadvantage Zambia and Zambians?

With regard to the mining:

  • What were the considerations the Cabinet took into account when arriving at the decision that Honorable Kalaba as the Minister in charge of the portfolio to give approval for the mining project to proceed?
  • The mining project is obviously going to be undertaken under the current mining regime (mining policies). Has mining in its current form, benefitted Zambia and Zambians apart from a few jobs and the paying of very little taxes?

The truth is, we have actually been getting very little from these international mining companies apart from some jobs that have been created but which pay very little to Zambians by way of remuneration.

Before giving a go ahead for this or any other project, under a New Heritage Party Government, both the Tourism and Mining Sector policies would undergo a review to ensure that the activities to be undertaken begin to benefit Zambia and Zambians.

We have lost too much of our inheritance (God given wealth) through our own carelessness, inability to draw the line and start to do what is right for the Zambian people.

We hear and sympathize with the area Member of Parliament in the Lower Zambezi. The people need jobs…..but at what cost to the nation? We do need the jobs, however, we should get much much more than that in the projects that we allow in the country going forward! Let us not merely be happy with the crumbs. It is the Zambians, being the owners of the National Assets, that should after all be getting the bulk of the benefits.

PSs FOR SPECIAL DUTIES, WHY SO MANY?

Nicholas Phiri, Permanent Secretary for Special Duties at Cabinet Office writes;

Dear Colleagues, I have noted with interest the debate on the number of PSes Special Duties.

It is important that we respond to this and put things in perspective.

Allow me to start with the obvious: government positions are filled up based on the approved staff establishment of a respective arm of government.

Currently, Cabinet Office has 4 Permanent Secretaries incharge of Special Duties.

No new office has been created

Two questions that have arisen are around the specific tasks of PS Special Duties and the cost of running those offices.

Before I can proceed, let me state clearly that it is not true that the previous administration had one PS Special Duties. There were actually two.

What is true though is that they may not have had a well defined job description.

What are those Special Duties?

Well, let me start from the basics again. Cabinet Office is the epi-center of the civil service. The effectiveness of the civil service depends on this office.

Administratively, all PS report to Secretary to Cabinet and are accountable to SC for contractual deliverables.

SC through Cabinet runs the civil service on behalf of the President of the Republic of Zambia.

In practice, it means that Secretary to Cabinet has to work closely with all PSs across sectors and categories to facilitate and ensure efficient service delivery. This is not only exhausting, but a recipe for poor service delivery as the amount of work is way too much for one office.

In order to address the above challenge, the Office of the PS Special Duties Cabinet Office comes in handy.

PS Special Duties are PS without portfolio. They literally cut across all government ministries, departments, programs and activities.

Some tasks are specific and defined while other tasks are deligated from Office of the Secretary to Cabinet and Office of the President as they unfold.

While I understand the concern about the cost, I don’t understand what standard is being used to call it as being high.

What is the cost benefit analysis?

Just for interest, members of the public may wish to know that the office of the PS Special Duties doesn’t come with any additional staff.

At Cabinet Office, there is what is referred to as common services office.

This office has directors and support staff in human resource, procurement, finance, audit etc which service all the divisions under Cabinet office use.

As it stands today, we have to deal with issues of compliance to government policies, CDF issues, depoliticize the civil service, unite the country, undertake targeted reforms, seal financial leakages and many other things. While portfolio PSes will be implementing this, Special Duties will support ministries to ensure that they succeed.

I thought we could help put the discussion in context.

PRINCE Akashambatwa Mbikusita Lewanika says the heated altercation between Kantanshi PF member of parliament Anthony Mumba and Lumezi independent member of parliament Munir Zulu is a wakeup call for Zambians who vote blindly.

And governance activist Brebner Changala says the argument between the two members of parliament tells the character of the people that have been sent to the National Assembly to preside over national matters.

In a WhatsApp voice note conversation that has gone viral, Mumba is heard engaging in a heated altercation with Zulu, exchanging insults and ultimately resulting in a mixed martial arts challenge.

But in an interview, Prince Akashambatwa said nothing could be done for now as voters needed to wait until the next election if they wanted to change their member of parliament.

“It is too late. You just leave them in Parliament and vote better next time. I know people are very intelligent. It is only when they vote for other reasons like if you vote blindly for the party or because people have bribed you when you do not even know the candidate properly. It is not because you are incapable of doing so. The right choice is what you want, so you have to examine whether what you have is what you want,” said Akashambatwa.

“If you do not examine it properly or you misidentify it, you will have to wait for five years to change it. I think it has to be ignored. If you make it into real big news, you are just insulting a country. It should be ignored. It is a wake-up call to voters. If that is what they want then fine and if they do not want that next time, they should be sure. They are already in Parliament and we can only wait after five years.”

And Changala advised Zulu to tone down.

“The audios that have gone viral between the Kantanshi MP and Lumezi independent MP is extremely worrying. Munir Zulu has come to Parliament for the first time. And in the first few months that he has been in Parliament, he has proved to be a busy body. He is extremely excited and to some extent, he is not behaving like an honourable member of Parliament but like a teenager that has just come out of age.

The exchange between the two members of Parliament does not sit well. It also tells us the caliber and character of the people that we have sent to the National Assembly to preside over national matters and legislate laws that the people of Zambia should follow,” Changala said.

“The topic of discussion and exchange between these two MPs lacks substance, it is full of innuendos and character assassination. It must not be encouraged by men who are called honourable to engage themselves in dishonorable conduct.

I appeal to the young man Munir, to tone down. Leave the moon and find space to respect society, the institution of Parliament and respect his colleagues in the National Assembly. If he has got issues, he must learn to approach whoever he has issues with and try to resolve their outstanding challenges.”

Changala said lawmakers needed to resolve their issues in a respectable manner.

“Going to social media and releasing live videos in which he engages in nothing but character assassination is uncalled for. He has created enough drama and the people of Zambia have heard him. It is either they appreciate what he is doing or they hold him in contempt.

Whichever way, he has done enough damage to himself or to the seat that he represents. Mind you, he has a constituency [as] member of parliament,” said Changala.

“So he must confine certain grievances to the men and women who stood in the queue to vote for him. MPs must learn to resolve their differences adequately and not starting unnecessary fight innuendos. If it is a fight against corruption, they know how to write reports and how to make the system react to their concerns.”

Makebi Zulu Writes IG Kajoba Over Torture, Illegal Detention Of Lungu’s Barberman Shebby Chilekwa, Others

MAKEBI ZULU WRITES KAJOBA OVER TORTURE, ILLEGAL DETENTION OF LUNGU’S BARBERMAN SHEBBY CHILEKWA, OTHERS

LAWYERS representing former President Edgar Lungu’s barber man Shebby Chilekwa, Aide De Camp Chisanga Chanda and others have written to the Inspector General of Police Lemmy Kajoba over the continued unlawful detention and torture of their clients.

According to a letter dated February, 8, 2022 copied to the Public Protector, the Human Rights Commission (HRC) and the Police Public Complaints Commission (PPCC), Makebi Zulu Advocates have asked the Inspector General of Police Kajoba to accord the tortured suspects medical attention and allow lawyers access to obtain instructions and represent their clients well.

The letter states that in the night of 4th February, 2022, officers from Crime 1 Unit based at Force Headquarters went to Chanda who is also Deputy Commissioner of Police and carried out a search.

The letter further, states that while, the search was ongoing, Chanda was summoned to their office where he was ordered to see a Mr. Mwaanza, the Director CID (Criminal Investigation Department) who handed him over to a Mr. Nawa who later took him in custody to a property in Kalundu along Lunsemfwa Road.

According to the lawyers, this place is not gazetted as a lawful detention Centre where Chanda was being interrogated by Police officers together with Elvis Mainza who they were advised is a known UPND cadre.

According to a letter, the lawyers were further informed that, while police officers where still at Chanda’s House, they apprehended his wife together with her friend who had visited identified as Prisca Lungu.

Others who were apprehended were Fidelis Chulu, Martin Imwisho, a garden boy, Jonathan Mushanga a driver, Terry Simwiinde and Chilekwa who were also taken to the same house in Kalundu.

According to the letter, the lawyers went to the police and were attended by the Officer In-charge Crime 1 Unit a Mr. Timba who could not give them access to their clients on grounds that the matter was being dealt with administratively.

Timba however, informed the lawyers that he would let them know when they will be needed but refused to disclose the whereabouts of Chanda, Chilekwa and others.

According to the detailed letter to the IG, it was only on Monday, the 7th February, 2022, when a Mr. Timba contacted lawyers to the suspects and asked them to go to Woodlands Police Station.

The letter also indicates that it was during the same Monday morning when Chanda was taken from a Kalundu House where he was being kept to Woodlands Police Station and detained in Police cells to wait for his lawyers to arrive.

“Upon our arrival, your Mr. Timba advised that he was proceeding to effect an arrest as he had already administered a warn and caution statement and obtained a statement from our client. Asked as to why he had proceeded with a warn and caution in the absence of counsel despite trhe undertaking that we were informed, no satisfactory response was given to us. Do note that the said warn and caution was administered at the Kalundu House referred to as above,” read the letter in part.

The letter further indicates that Chilekwa was tortured from time to time and is currently badly injured and still under police custody nursing injuries, unable to speak coherently and has his hearing impaired.

The letter has also revealed that attempts by lawyers and Human Rights Commission representatives proved futile as the police refused and denied to give them have access to suspects.

Chilekwa remains in custody without charge, injured and without access to either relatives or lawyers.

The letter further states that Police at Woodlands have refused to attend to one of the suspects Chulu who was brutally tortured and has a duly signed medical report from Chilenje Level One Hospital confirming the injuries sustained at the hands of Chief Inspector Chomba and Elvis Mainza a UPND cadre at the Kalundu House.

And Police sources close to the investigation have revealed that a duly signed medical report has been made available to the Inspector General of Police implicating officers for torture of the affected suspects.

Munir Zulu is a poorly raised boy – Chifire

IT’S now becoming extremely difficult for many to ascribe the honourable title to Lumezi Independent member of parliament Munir Zulu, says Gregory Chifire.

He says Zulu is a very poorly raised boy.

Commenting on Zulu’s recent verbal insults on Kantanshi PF member of parliament Anthony Mumba, Chifire noted that it is not the first time Munir has been involved in verbal tirades.

In a leaked audio, Zulu showered unprintables, undressing Mumba without reservations.

“An honourable member of parliament must at all times exhibit honourable behaviour. The Bembas say that ubufumu bucindika ubwine. But Munir’s behaviour falls short of that,” Chifire said.

Chifire, a human rights activist, said Zulu must realise that he is no longer doing student politics at NIPA, but that he is now a member of parliament with a lot of people looking up to him, especially those in Lumezi where he comes from.

“He is now a national leader, a supposed role model to many. Munir needs to take it easy. Money is not everything. Respect for God and fellow human beings is important. Life is like a wheel that is rotating. It puts us at different positions at every given time in life. At one time, we can be on top of the wheel but there is no guarantee that we shall always be on top. Being a ‘big boy’ in society matters less. There have been bigger boys than him before, but never went out insulting others, Chifire counselled Zulu.

Chifire, the Southern African Network Against Corruption (SANAC) executive director, schooled Zulu that the secret of life belongs to God Almighty.

“I stand in awe to realise that after 58 years of independence we are still producing MPs that engage in such uncultured behaviour. If president [Kenneth] Kaunda’s generation of youths that got us independence behaved in the manner that we are seeing today in some of these youths who are holding leadership positions, certainly they could not have achieved what they achieved,” he said.

“Munir needs a serious introspection. He must realise that pride is a forerunner to a great fall. He needs to realise that his audience comprises citizens and non-citizens alike of varying age groups, professions, religions, exposure and other demographic orientations. He should know this better especially that he comes from a rural constituency where people are conservative. What he speaks in or outside parliament must be a reflection of the collective wishes of his constituents.”

Chifire wondered how many people Zulu is going to insult.

He added that Zulu is a poorly raised boy who missed out on the rich family values from the rural constituency he represents.

Chifire suggested that his family sits him down to teach family values of respecting elders among other things.

“All of us have been his victims. In no time he will realise that he had insulted everyone. We are even made to wonder about his upbringing. Surely his family needs to sit him down. He is sure a very poorly raised boy,” said Chifire.

“Where we come from we are taught family values of which respect for others, especially elders, is paramount. But Munir has no regard for anyone. We are beginning to wonder what sort of representation he is offering for the people of Lumezi.”

THE case in which former Lusaka Province Minister Bowman Lusambo is charged with five counts of being in possession of properties suspected to be proceeds of crime has failed to take off.

This is because instructions from the office of the Director for Public Prosecution (DPP) are not ready.

Mr Lusambo appeared for mention before Magistrate Hamaundu this morning.

Magistrate Hamaundu adjourned the matter to March, 9 this year.

She said Lusambo will continue to appear for mentions until the DPP gives instructions regarding the matter.

Particulars of the offence in count One are that on dates unkown but between May 1, 2015 and 31st December 2021, at Ndola, Lusambo unlawfully acquired property number l / 3976 / m in the name of frontier management services Ltd which property was later transferred to jignesh Prafulchandra Soni at a considerarion of K880,000 his own benefit.

In count Two, Mr. Lusambo is charged with corrupt acquisition of public property contrary to section 34 (1) (a) as read with section 41 of Anti-Corruption act No. 3 of 2015.

It is alleged that Lusambo on dates between 1 January 2017 and 31 December 2018 at Masaiti in the District of the Copperbelt Province of the Republic of Zambia did unlawfully acquire certificate of title in respect of stand number MASAI/LN_1003028/218 in his name thereby obtaining an exemption from paying the sum of K250,000 plot premium land which property was later conveyed to MBACHI NKWAZI at a consideration of K150,000 on act prejudicial to the rights and interests of Masaiti Council.

In count Three, Lusambo is charged with possession of property suspected to be proceeds of crime contrary to section 71 of the forfeiture of proceeds of Crime Act No. 19 of 2010.

It is alleged that Lusambo on dates between 1 September 2021 and 31 October 2021 at Chongwe in the Chongwe District in Lusaka Province of the Republic of Zambia, jointly and whilst acting together with another person did conceal property number HN 284 situated in Silverest Gardens valued at $60,000 in the names of Nancy Natasha Manase property reasonably suspected of being proceeds of crime.

In count Four, Lusambo is accused of possession of property to be proceeds of crime contrary to section 71 of the forfeiture of proceeds of crime Act No. 19 of 2010.

It is alleged that Lusambo on dates between 1 September 2021 and 31 October 2021 at Chongwe in Chongwe District in the Lusaka Province of the Republic of Zambia, jointly and whilst acting together with another person did conceal property number HN 282 situate at Silverest Gardens valued at $128,000 in the names of Nancy Natasha Manase property reasonably suspected of being proceeds of crime.

And count Five Lusambo has been charged with possession of property suspected to be proceeds of crime contrary to section 71 of the Forteiture of proceeds of Crime Act No. 19 of 2010.

It is alleged that Lusambo on dates between 1 September 2021 and 31 October 2021 at Chongwe District in the Lusaka Province of the Republic of Zambia, jointly while acting together with another person did conceal property number HN 249 situate at Silverest Gardens valued at $60,000 in the names Nancy Natasha Manase property reasonably suspected of being proceeds of crime.

Lusaka Resident takes 3 ConCourt judges to JCC over 2016 presidential petition

LUSAKA resident Joseph Busenga has asked the Judicial Complaints Commission (JCC) to institute proceedings for the dismissal of Constitutional Court judges Annie Sitali, Mungeni Mulenga and Palan Mulonda for breaching their ethical code of conduct when they determined the presidential election petition of 2016 without the knowledge of the judge president.

Busenga has lodged a complaint against the three for incompetence, gross misconduct and violation of their oath of office over the manner in which they handled the 2016 presidential election petition in which President Hakainde Hichilema who was in opposition then and his former vice-president Geoffrey Bwalya Mwamba were challenging the election of Edgar Lungu.

He says the conduct of the respondents to constitute a panel of three members to interpret Article 101(5) of the Constitution without a motion or pleading before court and clearance from the judge president amounted to gross misconduct and a contravention of the judicial oath they took.

The three judges on September 5, 2016 decided to strike out the matter on a technicality on account that the stipulated 14 days in which to have the petition determined, had elapsed.

The court ruled that the petitioners’ advocates focused on raising preliminary issues, leaving out the crux of the matter.

Constitutional Court president Hildah Chibomba and Margaret Munalula dissented with the judgment of the majority.

Judge Chibomba said she did not have time to read through the judgment of the majority to include her thoughts on the matter as she was ambushed by the three who gave her the same judgment an hour before the court session.

“I have had very little time to read through the majority judgment which I was given this morning after 08:00 together with the judgment of justice Munalula. This left me with very little time to put down my thoughts in an elaborate manner,” said judge Chibomba.

However, Busenga argues that according to the provisions of section 4(2) of the constitutional court Act No. 8 of 2016, the composition of judges to sit and determine any aspect of the petition could not be reduced from the requisite number of five or seven, or indeed altered in any way without the express authorisation of the judge president.

He said judges Sitali, Mulenga and Mulonda, in conspicuous disregard of the ruling and provisions of section 42(2) of the constitutional court Act, sat to interpret Article 101(5) of the Constitution, constituting themselves as a defacto (actual) three-member panel of the court within the same cause without any application, motion or pleading moving the court to interpret the said Article.

“The respondents must have convened themselves as a panel to consider and arrive at the majority ruling between the night of Friday September 2, 2016 when the full bench of the Court adjourned and 09:31 hours on Monday September 5, 2016 when the sitting of the full bench resumed,” Busenga submitted.

“The forgoing assertion is fortified by by the words used by the judge president in her dissenting judgment which clearly demonstrate that she had no role to play in the sittings that culminated in the respondents making the majority ruling as she only came to learn of the same.

Busenga said the fact that none of the parties moved the court to seek an interpretation of Article 101(5) it was clear from the majority ruling and dissenting judgment of judge Munalula in which she found that none of the parties made an interpretation.

He said the parties were never notified that the court had retired to render a ruling or considering any application or motion to warrant the said ruling, neither were the parties informed that the court would convene between the night of September 2, 2016 and September 5, 2016 as a panel of three for purposes of making the majority ruling which was secret and a violation of Article 119(3) of the Constitution.

“By purporting to confer jurisdiction upon themselves to interpret Article 201(5) of the Constitution without addressing their minds to the question as to whether the mode of commencement of the ‘interpretation proceedings’ which according to the respondents in the majority ruling was by way of submissions by the Attorney General, judge Sitali, Mulenga and Mulonda not only violated the Constitution but also demonstrated a serious lack of competence in the execution of their judicial function,” Busenga said.

“The respondents were not clothed with any jurisdiction to act in the manner they did, their actions were not only unconstitutional, but amounted to gross misconduct on their part as they assumed powers, they did not have in circumstances that were not only unlawful but devoid of any backing of law.”

He said he was aware that there were previous complaints against the court relating to the manner it conducted the proceedings and they were disposed of by the JCC.

“The complainant prays that the proceedings for the removal of the respondents as judges of the Constitutional Court be undertaken by the Commission on grounds that judge Sitali, Mulenga and Mulonda are incompetent, that they grossly misconducted themselves and they have consequently violated their judicial oaths,” said Busenga.

Kurt Zouma faces growing backlash over cat abuse video as 130k sign petition

More than 130 000 people (can counting) have signed an online petition calling for West Ham defender Kurt Zouma to be prosecuted as part of a growing backlash over his abuse of his pet cat.

A petition on Change.org reads: “In the UK we have laws against the abuse of animals, laws which should be applicable to everyone rich or poor, famous or not.

“We ask that the Metropolitan Police and RSPCA carry out an urgent investigation and prosecute the perpetrators of this heinous act.”

West Ham sponsor Experience Kissimmee – the club’s “official destination partner” – has said it “will be evaluating our relationship and sponsorship with the club” in light of the video.

Moyes, who insisted he was an “animal lover”, was criticised for playing Zouma on Tuesday but was adamant he had to do what was right for his club.

The defender got a taste of the growing public anger as he was relentlessly booed by Watford supporters, with even West Ham fans joining in some of the jeering.

London Mayor Sadiq Khan told Sky News that Zouma should be prosecuted, saying he should have been dropped from the team.

Conservationist Chris Packham branded Moyes’ decision to select Zouma an “absolute disgrace”, telling the BBC that a crime had been committed.

“I think it was a disgraceful decision,” he said.

“I think if the footballer had released on social media a film of him taking drugs or beating his wife or his girlfriend or his children, there was no way he would have been on the pitch.”

The RSPCA condemned the “very upsetting” video after it surfaced online and will be leading the investigation and cooperating with Essex Police.

Coup beneficiary Mnangagwa says ‘we condemn coups happening in Africa’

President Emmerson Mnangagwa who came to power through a military coup in 2017 has connived with the rest of the African Union (AU) members to condemn the overthrow of constitutional governments in other parts of the continent.

Mnangagwa returned home from Ethiopia yesterday, after attending the 35th African Union Heads of State General Assembly in Addis Ababa at the weekend. Zimbabwe was elected into the 15-member African Union Peace and Security Council at the meeting.

In an interview with journalists on his arrival in Harare yesterday, Mnangagwa said the AU was worried about military coups and attempted coups in the continent.

“The issue of coups and attempted coups, five of them in the same region, is a worry to the AU,” Mnangagwa said.

“First and foremost, we are interrogating whether these are innocent coups or there is a hand behind.

“So we are dealing with that and it’s an issue that as the AU, we are worried about.

“We are saying Ecowas should stand up to the challenge in relation to what has happened.

“But as with the rest of Africa we must make sure that we condemn drastically the issues of coups on our continent.”

Sudan, Mali, Guinea and Burkina Faso are the countries that have undergone coups.

In Sudan, on 25 October last year, the military, led by General Abdel Fattah al-Burhan, took control of the government in a military coup.

The Sudanese coup happened less than a month after former President of Guinea Alpha Condé was captured by the country’s armed forces in a coup after gunfire in the capital, Conakry.

On 24 January this year, the military overthrew Burkina Faso’s president Roch Marc Christian Kaboré through a coup that came amid a deepening security crisis in the country.

PRESS STATEMENT BY THE CHIEF GOVERNMENT SPOKESPERSON ON THE DECISIONS MADE BY CABINET AT THE 1ST CABINET MEETING IN THE YEAR 2022 HELD ON TUESDAY, 8TH FEBRUARY, 2022

His Excellency the President of the Republic of Zambia Mr. Hakainde Hichilema called for the 1st Cabinet Meeting in the Year 2022, held on Tuesday, 8th February, to discuss legislative and other general policy issues.

The President emphasised that it is important for the New Dawn Administration to enhance the development of the country through implementation of appropriate policies that would improve the general living standards of the Zambian people.

The following are the issues deliberated upon by Cabinet today:

  1. The Public Roads (Amendments) Bill, 2022.

Cabinet approved in principle to the introduction of a Bill in Parliament to amend the Public Roads Act, No. 12 of 2002 in order to include provisions that will provide protection of the property of the Road Development Agency. The amendment of the Act will further align the composition of the Road Development Agency Board to a standard number existing in Government Boards.

  1. National Housing Authority (Amendment) Bill, 2022.

Cabinet also approved in principle to the introduction of a Bill in Parliament to amend the National Housing Authority Act, CAP 195 of 1971 in order to protect the National Housing Authority (NHA) property and also find ways through which the original setup of the institution could be brought back to the fore. Cabinet is of the view that the National Housing Authority is such an important institution where infrastructure development in terms of housing is concerned and, therefore, needed appropriate legislation to be put in place for it to positively contribute to the growth of the economy.

  1. Construction of the New Luangwa Bridge across the Luangwa River.

Cabinet approved during the Meeting, the construction of the New Luangwa Bridge across the Luangwa River in Luangwa District of Lusaka Province in order to increase the traffic capacity in the Nacala Corridor to facilitate the distribution of goods and movement of passengers in the country and its neighbouring countries, and thereby contribute to the economic growth and industrial revitalisation of the country and its neighbouring countries.

Cabinet is aware that the existing Luangwa bridge has been in use for more than 50 years from the time it was constructed in 1968. Further, the maximum weight of vehicles that can currently pass through the bridge is limited to 55 tons while the maximum speed is limited to 30 km per hour. Currently, only a single Heavy Goods Vehicle is allowed to pass at any given moment. The existing bridge has, therefore, proved to be a bottleneck for traffic travelling on Great East road and hence the need for the Government to address this matter.

Cabinet further agreed that Zambia takes advantage of the substantial infrastructure development that has taken place in the Nacala Corridor including the rehabilitation of the port of Nacala in Mozambique and the road from Luangwa Bridge to the Port of Nacala.

In terms of the financing of the project, the total cost of constructing the bridge is estimated at US$ 75.5 million. Cabinet is encouraged that Government is expected to only contribute approximately US$7.5 Million as counterpart funding while funding from external sources is estimated to be US$67.95 Million coming from our all-weather friends, the Government of Japan through its Agency the Japanese International Cooperation Agency (JICA).

  1. Establishment of the Zambian National Committee on the Prevention of Genocide, War Crimes, Crimes against Humanity and all forms of Discrimination.

In winding up debate on the First Cabinet Meeting, Cabinet approved the establishment of the Zambian National Committee on the Prevention of Genocide, War Crimes, Crimes against Humanity and all forms of Discrimination as required through Article 26 of the Protocol under the International Conference of the Great Lakes Region (ICGLR).

Currently, Zambia is one of the three (03) out of the twelve (12) countries of the International Conference of the Great Lakes Region that have not established National Committees. It is envisaged that through the establishment of the National Committee, the country would undertake adequate proactive measures to prevent Genocide, War Crimes, Crimes against Humanity and all forms of Discrimination in accordance with the Protocol and fulfil the obligations of the United Nations Convention on the Prevention and Punishment of Crime of Genocide.

PATRIOTIC Front senior member Ambassador Emmanuel Mwamba says the performance of the UPND and President Hakainde Hichilema since assuming office is extremely poor.

Speaking when he featured on Power FM’s ‘Power and Politics ‘ radio programme, Amb. Mwamba said President Hichilema and his Government have backtracked on many campaign promises they made prior to the August 12, 2021 General elections.

He said the UPND Government’s honeymoon came to end on the 16th December, 2021 when they increased fuel prices.

Amb. Mwamba said many Zambians now think President Hichilema is taking them for a ride.

” President Hichilema’s performance is extremely poor. He has u-turned on many promises made prior to the elections. Their honey came to end on 16th December 2021 when they increased fuel prices,” Amb. Mwamba said.

” President Hichilema enjoys massive support on social media and look at the criticism he got following the increase in fuel prices. Many Zambians think he has taken them for a ride,” He said.

And Amb. Mwamba said there were no empty coffers left as alleged by President Hichilema.

He said the PF Government managed to pay CDF on time and is the only Government in the history of country to have paid huge number of pensioners.

“There were no empty coffers as allegedly by President Hichilema. The Government paid CDF on time. A picture was painted that the PF was not paying pensioners despite dismantling a huge number of retirees. Statistics show that the PF is the only regime that paid alot of pensioners. UPND played their politics properly and made people believe that PF was not paying pensioners,” Amb. Mwamba said.

Meanwhile, Amb. Mwamba said the results in the just ended Kabwata parliamentary by election gives hope that the PF is not as bad as it is been painted.

” Over 11,000 people voted for PF and its candidate Clement Tembo in the Kabwata parliamentary by election and the results gives us hope that the PF is not as bad as it is painted.

WITH the long hands that the PF is known for, the European Union Observer Mission has disclosed that despite losing power, the former ruling party under Edgar Lungu extensively deepened their hands on State resources to finance their flamboyant campaigns in the 2021 polls.

And the Mission observed that the former ruling party campaigns were largely exempted from restrictions but more restrictive on opposition political party opponents.

Meanwhile the EU mission has requested the Zambian government to put an end to the barriers that prevent some Zambians from being eligible to exercise their fundamental right to compete in elections.

Presenting a final report on Zambia’s August 12, 2021 general elections yesterday, EU chief mission observer Maria Arena said Zambia’s 2021 general elections took place against a background of deepening political polarisation.

She said selection application of the law disadvantaged opposition candidates from competing under equal conditions while favoring the Lungu led PF, which however was embarrassed at the final result stage.

“Throughout the campaign, there were widespread concerns about the potential escalation of violence. Despite the pandemic challenges, the electoral process was technically well-managed. Arbitrary and selection application of the law hampered opposition candidates from competing under equal conditions and restricted freedoms of assembly and movement,” Arena said.

“The ruling party extensively used State resources, and its campaign was largely exempted from restrictions. The traditional and online media campaign was highly monetised, with ruling party monopolising the prime time on State, private media. Disinformation and tribalism pervaded online debate to the detriment of voters.”

Despite the patently unfair electoral ground, the PF’s chombo cha Noah capsized, courtesy of the then opposition UPND.

The hapless boat is now wandering in the deep ocean waters and some of its pig-headed paddlers are now advertising the rebranding agenda, whatever rebranding means, in this case.

But Arena has further urged the Zambian government to remove the barriers such as education requirements which deter participation, so that the electorate, themselves, choose whether they want a professor for MP or the hardworking bricklayer next door.

She also called on making nomination fees refundable if an election was cancelled due to either death or withdrawal of a candidate unlike the current system which was costly and therefore restricted competition for elected positions to a few rich Zambians who can afford to pay nomination fees repeatedly.

And on the infamous Public Order Act, the EU repeated its cane for the law which was set up by their former member, Britain, to be repealed so that Zambia adheres to regional and international standards.

The Western Bloc also noted with dismay the bias of the media in coverage of the 12 August General Elections by the ‘wealthy’ ruling party thereby limiting information on candidates.

FUNCTUS OFFICIO-The Case of the Petition Against Judges

A Joseph Busenga has taken three Constitution Judges; Hon. Justice Annie M Sitali, Hon. Justice Mungeni Mulenga and Justice Palani Mulonda to the Judicial Service Complaints Commission.

He contends that the three judges grossly misconducted themselves and were incompetent in the manner they handled the presidential petition between Hakainde Hichilema and another, and Edgar Chagwa Lungu and two others, cause number 2016/CCZ/0031 filed on 19th August 2016.

He has therefore requested for their removal from the bench.

MATTER RESOLVED, PETITION DISMISSED

Wait a minute! This matter was fully determined and resolved.

Green Party President Mr. Peter Sinkamba brought an identical petition to the Judicial Service Complaints Commission.

In this matter referenced 2016/JCC/84, Mr. Sinkamba petitioned; Madam Justice Hilda Chibomba, Madam Justice Mugeni Mulenga, Madam Justice Annie Sitali, Madam Justice Margaret Munalula and Justice Palan Mulonda, to be removed for incompetence and gross misconduct in the manner the Constitutional Judges handled and determined the 2016 presidential election petition.

Infact, the current Chairperson of the Judicial Service Complaints Commission, Mr. Vincent Malambo SC represented one of the judges in the case to the JCC.

On 13th October, 2017 Justice Christopher S. Mushabati and Godfrey W. Simukoko dismissed the petition and anchored their decision that the final determination of the presidential petition resulting in split decision didn’t amount to misconduct or incompetence.

CONCLUSION

The JCC is likely bound by the principle of the Doctrine of functus officio.

This states that once the court or arbitration body passes any judgment after the lawful hearing, then the case cannot be re-opened and the judgment is binding.

The court or Commission may have no right to review its own judgement.

Functus officio holds that once an arbitrator renders a decision regarding the issues submitted, he lacks any power to re-examine that decision.

Clearly looking at the latest petition of Busenga and the old case of Sinkamba , the two cases share the same facts and literally are the same.

We wait to see how this matter will be handled.

For many years historians have failed to trace or state the origin of Tongas the ethnic group of Southern Province. Not even archaeology and oral traditions could give a clue of where Tongas came from.

However, this mystery of the origin of Tongas is almost resolved, thanks to Anthropological linguistics which is the study of origin of man through language patterns and culture.
Anthropological linguists first ruled out Tongas being part of Bantu groups that originated from the Cameroon and Luba Lunda.

The only path they could have used was Ethiopian nilotic corridor. They compared a few Tonga phonems with the Tutsi and Black Jews of Ethiopia and some old Tonga traditions tarried with the Tutsi, Ethiopian Jews and the Lemba dialect of Zimbabwen Zezulu.
They discovered that the Tonga culture of polygamy, cattle rearing, abstinence of eating mice, caterpillars are some of Jewish customs practiced by the Zezulu (not Shona). Some of the religious doctrines practiced by Tongas and Zezulu postolis are not coincidentally SDA or Apostolic but Judaism.

It is believed that the Lemba before becoming Zezulu lived in East Africa together with Tongas and Tutsi around 5 BC and were observing the Sabbath, they called it Shabbat.
Through Anthropological linguistics, it has been discovered that Tongas, Tutsi, the Lemba and the Ethiopian Jews are the lost tribe of Israel which escaped captivity in Asyria (2 Kings 17:5-7).

They wandered in the wilderness for decades until they settled in Ethiopia. Because they realized their suffering was punishment for disobeying God, they upheld the law of Moses strictly.

In their quest to follow the law of Moses, they appointed a religious leader called Moses or Moze. To prove this, how and where did that Ethiopian eunic learn the book of Isaiah when he met Philip? ( Acts8:26-31) He was a lost Jew.

Under the leadership of Moze, this group moved south, separated around lake Victoria, Tutsi went west while then Lemba and Tongas settled in Malawi. Much linguistic and ethnic transformation took place making them lose that Nilotic structure through intermarriages with early Bantus.

However, the main group moved further Southwest into present Gwembe valley changing the name to Donga meaning big river and lembas crossed into Zimbabwe and built Zimbabwe walls with skill learnt from their ancestors who built the walls of Jerusalem.
Dongas under their religious leader Moses or Moze moved to the plateau changed the name from Donga to Tonga and Moze to Monze Mukulu. That’s why Chief Monze is regarded as the spiritual leader of Tongas because the name Monze is derived from Moses.
Anthropological linguists have compared some Tonga and Tutsi names with Hebrew names and phonems and morphemes tarry. For example, Hebrew names like Habbakuku, Hagai Hezekiah, Hitofil, Shaman, Hazel and Tongas have Hamoonga, Haloba Hikaumba, Tutsi have Habirimana, Hamugabo. Ethiopian Jews have names like Haile Selassie etc.
Israel recognizes Ethiopian black Jews and Tutsi as Israelis that’s why America and Israel have developed Kigali and Addis Ababa to the first class African cities. (Jews will never abandon or forsake their own).

With this new discovery, we are yet to see what American Jews and Israel will do for Zambia. Tongas, Zezulus and Tutsi are Jews from the tribe of Asher as they were blessed by their ancestor Jacob.

Tongas produce beef and milk for Zambia, most of Zimbabwean food comes from the Lemba region and minority Tutsi feed Rwanda, Burundi and Eastern Congo (Genesis 49:20).

This information is not new truthfully speaking, it has been suppressed for centuries by white missionaries, the owners of our education because it exposes the true race of Jesus contrary to their depiction that He was white, deep down their hearts know that Jesus was not white but Nilotic as depicted by Egyptian and Ethiopian artists.

These European missionaries do not want to hear anything about black Jews, you have accepted their lies that the origin of Tongas is not known. And why should the Bible confine itself in Palestine when God was worshiped in Ethiopia as well? The selection of old testament Bible books was seriously censored to remove African Ethiopian scriptures.
There is no doubt, Tongas are the most blessed people in Southern Africa particularly Zambia. An educational report of 2014, concluded that 30% of educated people in Zambia are Tongas, 25% are Lozis, 20% are North Westerners, 15% are Easterners and 10% are Northerners. It is clear that all tribes that befriend Tongas also get blessed; Example, Lozis, Kaondes, Lundas and Luvales are blessed because of tapping blessings from Tongas (blessed people). America is blessed because of being friends and allays of Jews.
The unity exhibited by Tongas in terms of voting for particular candidates during national elections and other important national events explain that they are a chosen and blessed tribe. It is for this reason that Tongas tend to unity whenever they meet with a fellow Tonga anywhere in the world because of being a chosen and blessed tribe. This also explains why 90% of Tongas prefer their fellow Tongas as leaders.

This now justified a highly classified report for 2015 and 2016 Presidential Elections that discovered that 80% of Tongas who are members of the ruling Patriotic Front actually voted for the opposition United Party for National Development which is headed by a fellow Tonga. In total, 90% of Tongas in Zambia have been voting for the opposition UPND headed by a fellow black jew/Tonga Hakainde Hichilema.

Therefore, no weapon formed and fashioned against this chosen tribe (Tonga) shall prosper, just like no weapon formed against Israel has ever prospered.
Religious Experts have concluded that Zambia tend to benefit economically if a Tonga is given time to rule the country.

Remember God promised to protect and bless the Jews always. Tongas are also part of the Jewish Tribe no wonder many of them observe the Sabbath just like the Israelites. It is not a secret that 60% of Seventh Day Members in Zambia today are Tongas.

Remember, this has nothing to do with politics but historic facts backed by the Bible.

OXFAM calls for stopping all mining activity or strides in Lower Zambezi

OXFAM has expressed concern over the ongoing and “highly controversial” Lower Zambezi National Park mining saga and cautions government on the move to proceed with mining activity in the national park.

Country representative Yvonne Chibiya said on January 31, 2022 media reports cited the Ministry of Green Economy and Environment as having indicated that the embattled open pit mining project in the heart of the Lower Zambezi National Park would go ahead under strict adherence to measures set by the Zambia Environmental Management Agency (ZEMA) to mitigate environmental impacts.

Chibiya said this follows the Supreme Court’s dismissal of an appeal by civil society organisations in Zambia against the proposed large-scale open-pit mining project that has been raging for years.

She said while Oxfam acknowledges the decision made by the Court of Appeal delivered by justice Ngulube on February 27, 2021, to allow for the mining project by Mwembeshi Minerals to proceed, it is immensely concerning that the government has unilaterally and quickly positioned itself to accept the ruling, forgoing all public outcry and expert caution against the said project.

“This not only goes against the government’s pronounced commitments towards environmental sustainability but also sets negative precedent for Natural Resource Management (NRM) and Environmental Protection within the new dawn government’s industrialisation agenda,” Chibiya said.

“The Lower Zambezi National Park (LZNP) hosts a sensitive ecosystem sustaining a vast amount of biodiversity necessary for environmental sustainability in Zambia and some neighbouring countries. This region also provides a critical water resource for over 250 million people in the region that depend on the Zambezi river and surrounding ecosystem for water, fishing, wildlife, agriculture, tourism, forestry, and other livelihood activities.”

Chibiya said a disruption to the ecosystem could prove disastrous, particularly at a time when the world is battling a climate change crisis.

She said the impacts of climate change were glaringly apparent, with the most recent being the Tropical Cyclone Ana that has devastated the Southern Africa region particularly Malawi, Mozambique, and Zimbabwe, including some parts of Zambia. Chibiya said a report by Investigative Environmental Journalism notes that an independent review of the Environmental Impact Assessment (EIA) done in 2012 and 2014 submitted to ZEMA showcased flaws against the tenets of sustainable development.

She said the intended project violates Zambian national environmental and public health laws as well as international environmental agreements which mitigate against environmental risk management set out in the Equator Principles, as well as standards for mining in protected environments established by the International Union for the Conservation of Nature (IUCN).

“The ZEMA board disallowed the mining project on similar grounds but was later overruled in judgement by then minister, Harry Kalaba, on grounds that the project would create jobs for locals and technologies be employed to mitigate environmental impact. This saga has highlighted two points of concern namely, ZEMA’s limited autonomy to execute its regulatory functions towards environmental protection due to political influence and conflicting laws that fail to recognise designated land use plans particularly for ecosystem protection,” Chibiya noted.

She said this was a threat to the objectivity as well as autonomy of the environmental management regulatory body.

“Oxfam also expresses concern over the high dependence on resource extraction for Zambia’s development agenda, evidenced by the new government’s pronouncements to upscale copper production over 250 per cent in the next decade. Whereas, this may pay back positively in revenue terms, it is worth noting that mining has serious implications on lives, livelihoods, and the environment,” Chibiya said.

“While acknowledging efforts towards environmental protection through creation of a Ministry of Green Economy and Environment, Oxfam cautions that without commensurate monetary investment to mitigate impacts (only 0.1 per cent of the 2022 national budget), and a clear-cut strategy for protection of key ecosystems in the country which have been grossly degazetted in past years, all efforts may be futile.”

She said mining, though a strategic sector for Zambia, had historically been cause for environmental and human rights concerns “with mining towns in the Copperbelt, Central and North-Western provinces being key examples of this”.

Chibiya said there was need to properly establish natural resource governance best practice for Zambia, governed by adequate laws and policies for beneficial and sustainable mining.

She said Oxfam remains committed to the call for resource extraction that was sustainable, contributes positively to development and is instrumental to fighting poverty and inequalities.

“Within this mandate, we call for the immediate stop to all mining activity or strides towards this in the Lower Zambezi National Park,” she said.

Chibiya proposed that the government, through the Ministry of Mines and Minerals Development in working with the Ministry of Green Economy and Environment invest in expanding tourism and other productive sectors away from mining.

She said Lower Zambezi offered natural renewable resources that could increase employment and revenue generation while contributing to economic, environmental, and social development now and in future.

“We call for the autonomy of the environmental management body and upholding of decisions lawfully made by the ZEMA board. Development of a comprehensive economic-diversification agenda, within and away from mining. In keeping with the industrialisation aspirations of the new government and Africa Mining Vision, a deliberate approach must be fostered to broaden the local economy by ensuring the revenue rents from the mining sector expand other key sectors such as agriculture, tourism and manufacturing. Importantly, the extraction of other strategic and non-traditional minerals,” said Chibiya while urging the government to make positive strides towards prioritising environmental protection and climate change mitigation and action.

About K17 million recovered from the various youth empowerment programs-Minister Elvis Nkandu

Youth, Sport, and Arts Minister Elvis Nkandu has said that about K17 million has been recovered from the various youth empowerment programs since the new dawn administration came into office.

Mr. Nkandu said that the government is committed to recovering the loans to enable more youths to benefit from the empowerment programs.

The Minister also revealed that some artists that benefited from the K30 million youth empowerment scheme under arts have started paying back the loans.

Mr. Nkandu has since urged artists that may be having challenges to pay back the money to engage the Ministry.

Last year Mr Nkandu demanded that youths who got loans in form of buses, grinders and wood-mizers during the Patriotic Front Government payback.

Mr. Nkandu said loans are meant to be paid back unlike donations or handouts. The Kaputa Member of Parliament revealed that many youths who got loans in form of buses, grinders and wood-mizers during the PF government are yet to pay back the loans.

Mr. Nkandu warned that the government may be forced to repossess the buses, Grinders and wood-mizers if the affected youths do not show commitment toward paying back the loans.

He also questioned the criteria used to empower people with buses, grinders and woodmizers. Mr. Nkandu said he suspects that some people who got loans from the Minister of Youth are not even youths.

“Whoever gets money from Government should learn lessons from their colleagues that they should pay back. If they don’t pay back the law will take its course,” he said.

“I still have a feeling that there are some empowerment programmes that we have given but have not reached the youths. When I was interviewing some of the people who got loans I was told that we were just told to register in our names and they are not even our buses.

“So it is like there are other old people behind, who collected those buses on loan using the youths but you know if we are very serious on absorbing the unemployment levels then I would warn the youths not to be used,” Mr. Nkandu added.

“You know youths have been used in violence and now they have sacrificed again to be used as fronts that can collect something on behalf of the adults. I don’t think we are going anywhere so that trend must be stopped.”

The Government in March 2021 procured 50 fuel tankers and some buses as part of its programme to empower youths in the transport sector.

25 of the fuel tankers were distributed to youth cooperatives in some parts of the country such as Lusaka, Copperbelt and Eastern Provinces.

At that time, then President Edgar Lungu said he did not want youths who were empowered to fail to pay back the loans.

Mr. Lungu had said the culture of not paying back government loans among the people was growing, adding that the situation needed to be addressed if government is to empower more youths.

The Ministry of Youths and Sports had promised to arrange various capacity building programmes on how the youths can successfully run businesses and payback loans.
