During my time, the judiciary was fully independent and operated freely – Edgar Lungu

Fellow Citizens,

As you all may remember, in 2016 after the dissolution of Parliament, all cabinet and deputy ministers remained in office as the new law was ambiguous. We were heavily criticized and after a legal battle, the Courts of Law made a ruling that the stay was illegal and all allowances and salaries accrued during the stay were to be paid back.

This December, 2016 judgment is testimony to the effect that, during my time, the judiciary was fully independent and operated freely even by making decisions against my own government. We never interfered with them but simply respected them as a separate wing of government in a functional democracy.

As sitting president then, l order my former cabinet and deputy ministers to respect the courts and pay back all allowances and salaries accrued as directed by our judges. To prove my position respect for the principle of Separation of Powers, rule of law and defend our constitutional democracy, below is what l said on 8th December, 2016 on this same facebook page and other official documents after the Constitutional Court made the aforementioned judgment :👇🏽

…………………………………………………………………………

“Following the Constitutional Court’s decision, I expect Cabinet Ministers and Deputy Ministers who remained in Office after Parliament was dissolved in 2016 to pay back salaries and allowances.

Decisions of the courts of law must be respected regardless of positions taken by different parties hence my position that the affected individuals must pay.

We must all respect the law because no one is above the law. Therefore, the ruling of the Constitutional Court must be complied with.

My administration will always uphold the Separation of Powers in respect of the Executive, the Judiciary and the Legislature”.

…………………………………………………………………………

I will patiently wait to hear if the Chief Government Spokesperson or President Hakainde Hichilema are still disputing my commitment to respecting our Republican Constitution as well as the principle of Separation of Powers. By virtue of my upbringing and as former president, I am not a person of empty rhetorics, open lies and hot false stories, l always try to be politically honest and factually respectful in my engagements.

  1. And when those elections were petitioned, did this chap hand over power to the speaker as per Zambian laws? And when he threatened judges not to follow what the Kenyan judiciary had done in a similar petition, was that not interfering with judiciary? Seems this man has too much kark in his mouth

  2. This guy is not sound upstairs. Does he even hear himself speak? So the thinks hr can sway today’s decision by acting holier than thou?

And by the way, who is PF president? Lungu or Sampa? Chief Justice or Legal Affairs minister to clarify legal position here….we can’t have a hanging legal position surely, we are not a banana state….yet.

  4. Mr. Former president, is there something you are taking these days that makes you forget the past so easily? Or are you just good at playing to the gallery?

  5. Bashi Daliso are you okay in the head?you easily forget that you did alot of atrocities during your stay in office, sometimes I even wonder if you really a lawyer. The courts played to your tunes there was no fair justice.I think you are tired , you have a lapse in your memory.

  6. This man insults our intelligence? So all the non sense and the manner he took office.
He thinks he did it alone?
Never think when you do things in darkness. People and God doesnt see. In time all is revealed….
The reason subsequent suits and judgements on the same matter is being made, cause something is amiss. You served. Move on. Those lying to you that you have utility, have personal and selfish motives. No Zambias interest.
These suggestions and lies that Lungu makes, he will need to prove them in the very courts. Reckless speaking is dangerous.

  7. Our former presido at that time was encouraging civil servants and politicians to steal from government coffers. “Umwine we bala” adage was lawful and so long you didn’t steal everything. KIKIKIKI

  8. On a day a PF Magistrate was to deliver judgement on a highly charged political case involving the UPND, he was captured dancing at state house grounds.
Immediately the Con court judges were appointed, Mr. Lungu sent them to South Africa for a holiday paid by government for which they were not entitled. As if not enough, they were given a hefty sums of money each as loans they did not even apply for.
Next, we saw some bizarre judgements involving Mr, Lungu himself.
Edgar Lungu, going by this, how free was the Judiciary during your chaotic governance?

  9. Mr. Lungu’s hypocrisy knows no bounds. In the first place, you packed the judiciary with your cadres, including the DPP who exercised extra judicial punishment by incarcerating people for long periods before entering a nolle proseque. Mr. Mwaliteta and his companions suffered this fate when they were detained for close to 2 years. The current President himself was such a victim when he endured 127 days in detention for a traffic offence.

We have not forgotten how your cadres camped near the Supreme Court grounds to pressure the judges to rule in your favour over your eligibility to go for a third term (which they obliged!).

Then there was the issue of 2016 election petition which the constitutional court was scheduled to hear on a Monday only to announce that the petition had lapsed (PF lawyers even refused to show up at the court. What arrogance!!).

Mr. Lungu poses a real and present danger to our country. The sad thing is he is not even aware of the immense damage he did in every aspect of our lives as Zambians. He actually believes that he put up a sterling performance.

If Mr. Lungu was to come back, it would spell the end of our country as we know it. We came very close to being a failed state under Mr. Lungu. What is happening in Haiti is nothing compared to what we would have to ensure under Mr. Lungu.

    1. You have the nail on the head!!

I will add that having ECL as President of this country was the worst thing that ever happened to Zambia. This explains why he was soundly rejected by the majority.

  10. By the way, just to expose Mr. Lungu’s hyper hypocrisy, the courts have ruled that Mr. Mies Sampa is President of PF, why then is Mr. Lungu ignoring the ruling of the courts of law by insisting that he is the president of PF? Where is respect for the courts of law?

  11. But are you not the same person who told them to continue in office getting free salaries and allowances. It’s only when the court said it was illegal that’s when you relented. Imagine if this case was not taken to court you would have continued with your illegalities.

  12. This guy needs critical brain examination. This is a serious matter. It looks like the nuts in his brains are loose big time. We have to be very careful with chaps like this one. If he can manage to completely forget about his recent past behavior, then he is a piece of trash. Let’s move on as a country together than waste time with trash.

  13. Just shut up you drunkard, I bet you’re high when issuing this statement. You have no morals.

  14. And during your time you became a satan nyoko, a CHIKALA, a corrupt ba5terd, a rapist, a TRIBALIST, a drunkard, a swine, a baboon, a visionless effer, a gassing man..
You think we have forgotten…..you need a good slap

  15. Let ECL go to seer1 to remove that spell so that he can get back to his senses. What independent is he saying. Who fire wakunguma for merely executing his duty when panel beaten those thugs who went to cause havoc in sesheke bye election. Imwe ba mudaala you think we have forgotten your brutal regime? Respect yourself sir. Many were killed under your watch as head of state and what are you bragging around. Sir keep quiet and show state man ship.

    1. Is he addressing stupid idiots?
Has he forgotten his threats on Court Judges?
Nothing more dangerous than a charming Snake!
Has he forgotten about the Election petition saga and Bill 10 attempt at a Wamuyaya PF government?
Let this snake be disqualified in national interest!
He is a danger to Zambia!

  17. THE CURRENT GOVERNMENT WILL HAVE THEMSELVES TO BLAME IF THE SNAKE SLITHERS AWAY, BECAUSE THEY HAVE BEEN SO CUDLING TO HIM. HENCE HIS COMING BACK WITH FORCE BECAUSE HE HAS SEEN THAT THAY ARE UNABLE TO PUSH HIM.

  18. So one judge to chew the bullet and take ostracism from ECL sympathizers if he gives judgement against ECL. What a load of cowards…I thought women were courageous….
