EDITH NAWAKWI AND STATE HOUSE COOKING UP DOCUMENTS TO IMPLICATE HH

We are monitoring Edith Nawakwi and state house agents what they are planning. We are not surprised with president Edgar Lungu’s statement in news diggers that he wants to arrest HH because a lot is going on now at state house. The insight is as follows;

They are now plotting to arrest HH, Lungu has come out, Nawakwi and her agent popularly known as general working with Zumani Zimba, political advisor to Lungu, Lukangaba lungu’s AIDs and other Lungu’s close friends they are busy cooking up information on privatisation by mobilising property documents at lands department in Lusaka for all HH’s properties that are on Nawakwi’s cooking list.

State house and PF have no evidence to claim arrest of HH on privatisation including even Lungu himself, but depending on what Nawakwi is cooking is their strength. As at this week Nawakwi who is sending his agent called General is trying to storm the lands records office to pull out HH’s property documents to verify the evidence that HH presented during his interview to the nation, Nawakwi realising that she presented a fake information to the nation and Lungu has been Cheated she has evidence yet not, up to now Lungu is in living hope of what does not exist, pressure is mounting from state house agents on Nawakwi’s agents lead by General to facilitate documents of HH properties which General is also lying to them that he is having a challenge to get the documents stating that the lands commissioner and his secretaries are useless and not cooperating with him in getting these documents.

 

General claimed that one of HH’s property documents no: 248 A they wanted to get demanded by Nawakwi is reported missing accusing the lands commission and the people in charge of records office not being coperative but working with opposition. They are pushing that the lands commissioner, his secretaries and people at the records office be removed and close the records office to doctor documents while they work with the deputy lands commissioner whom they are saying he is supporting their evil agenda.

Nawakwi has indicated to her master’s that HH presented fake document so she is trying to work with loyal records government departments at Lands, archives departments and others to cook this information.

This general is also blaming it on state house agents not giving him enough support financially to get the documents he is trying to cook for Nawakwi. Citizens must know that behind the closed doors so much is being cooked, another person claimed he had information that HH killed someone and he could provide evidence, he was given money by the state house agents and Lungu’s friends but this person has since disappeared with the money not knowing his whereabouts to which they are now complaining.

There also miners and ex-minners from Copperbelt who are being organised and paid to go and implicate HH that he stole their money in the past to discredit him and prosecute him so that he is bared by slapping him with a simple criminal conviction, panic is too much on the PF such that HH characterise their daily meetings and this is the reason why Lungu took it open to Mwansabombwe rally that HH will be arrested if he is not luck, he is basing everything on these processes of cooking and generating fake information.

HH is on a line they will not stop at anything to stop him even risking this country to lose whatever it has for the sake of them remaining in power, citizens must get ready to see more complicated things being raised on HH and other key leaders of the UPND.

Lungu is not very much trusting the police as well that’s why now he is bringing soldiers close to him,this is evident at his recent visit to Copperbelt where a batallian of soldiers in military uniforms were at Simon Mwansa kapwepwe airport to cover him both receiving and sending off to the shock of police who always provide security as their institutional mandate in the history of Zambia and in accordance with the law. This is meant to help him to strengthen the military intelligence to prolong his stay in office even when he loses elections next year.

The mystery of the Black couple who gave birth to a white baby

n 2010 when white baby Nmachi Ihegboro with blonde hair and blue eyes was born to a Black couple in Britain with no known white ancestry, medical experts were amazed, and so were her parents, who are originally from Nigeria. “What the flip?” “Is she mine?” the father of the child, Ben Ihegboro, jokingly asked.

Doctors at Queen Mary hospital in Sidcup said that Nmachi is not an albino, though subsequent reports said they did not rule that out. Baby Nmachi’s parents had two Black children at the time, and so they were fascinated as they just “sat and stared” at their white newborn, they told The Sun in an interview.

“She is beautiful, a miracle baby,” Angela Ihegboro said of her daughter while the dad, who had jokingly asked if the child was really his, said: “Of course she is mine. My wife is true to me. Even if she hadn’t been, the baby wouldn’t have looked like that!”

In recent years, there have been cases of different colored twins born to parents with mixed-race ancestry. However, Ben and Angela do not have such origins that medical experts could have used to explain their situation.

So three theories were offered: Nnamchi is the result of a gene mutation unique to her, and if that is the case, she would pass the gene on to her children if she has any in the future, and they would also likely be white. The second is that she is the product of dormant white genes which entered both of her parents’ families long ago, and they never surfaced until now. And then the third — albinism.

Professor Ian Jackson of the Human Genetics Unit at the Medical Research Council explained that both parents could be carrying a copy of the albino gene that has no surfaced in any known family member for years.

“This is perhaps one of the most common recessive disorders in Nigeria, and we have to remember that it comes in different forms,” Jackson told BBC. “In Type 2 we would see creamy skin and yellow hair or light brown, which in some cases would darken with age.”

Essentially, Nnamchi’s skin could darken over time, experts believed. “She doesn’t look like an albino child anyway. Not like the ones I have seen back in Nigeria or in books. She just looks like a healthy white baby,” Ben later said in the interview with The Sun.

“My mum is a black Nigerian although she has a bit fairer skin than mine. But we don’t know of any white ancestry.

“We wondered if it was a genetic twist. But even then, what is with the long curly blonde hair?

GUARD YOUR NATION AGAINST BA MWANKOLE; THEY ARE HERE TO STEAL, KILL AND DESTROY

They’re indeed ba mwankole whose sole agenda is to destroy Zambia before they leave office.

These Ba mwankoles have extended their long hands of destruction to the Electoral commission of Zambia (ECZ) which is now behaving like robbers at midnight.

However, we shall continue registering our displeasure over the management of elections, issuance of NRCs and voters registration process ahead of 2021 general elections which we feel has been hijacked by criminals.

To begin with, the Electoral Commission of Zambia (ECZ) current leadership is corrupt and being used by the PF to manipulate elections and voters registration process. They’re not saving citizens interest at all but, that of PF leaders who are scared of losing the elections.

The level of violence and abuse of opposition political party leaders and their members get subjected to during these induced elections can be stoped by the ECZ if only they (ECZ) were operating as a professional institution and not a PF organisation.

The arresting of three UPND officials namely, Mr. Mucheleka Patrick,Mr. Mubanga Alias and Mr. Ngwira Samuel in Kasama and slapping them with a trumped up aggravated robbery charge which is none bailable, has just confirmed how ECZ is conniving with PF government to abuse their power. Aggravated robbery for staters, is a charge against a person or people who have intention to steal like Jay Jay and not those protecting our sovereignty against sacred national registration process. Since when is citizens arresting unscrupulous and an impersonator masquerading national registration officer and handing over their fake equipment to police been robbery? Does a thief take a stolen loot to police? Let’s take for example, they are thieves who have stolen from fire engines, 48 houses, ambulances, have they taken the loot to police? No! That is what a thief does, put in their pockets. Aggravated robbery too is stealing too only a thief or thieves use force or threaten to use violence.

Don’t rape our laws please. This is a classic example of Mumbi Phiri being in an unlawful possession of election material when arrested by alert members of the public. The same aggravated robbery case was brought against those gallant members of the public. When a PF cadre Jay Jay Banda broke into a police station with guns, the cadre didn’t even spend half an hour in cells. Police wake up we as citizens read the penal code as well a robber does come with stolen property to police. Don’t be used to cover up crimes being committed in the national registration process. A few days ago, I charged that if ECZ doesn’t come in to provide guidance on these elections, they shall be the biggest source of trouble in Zambia.

We have seen PF cadres and their leaders shedding blood during elections and ECZ has been quiet, when they have powers to discipline criminals who sponsor the violence they know very well.

We have seen the opposition being denied their rights to campaign during elections and ECZ keeps quiet because they are crooks who get paid by PF government.

About the voters registration process, we want to categorically warn all those ECZ officials to stop this criminality of trying to deny some citizens their rights to vote. We are not going to allow this injustice. Allow all eligible citizens to register and vote next year.

Secondly, Zambians we need to unite and demand for the immediate removal of Esau Chulu ECZ chairman as soon as possible. It will be foolish for us citizens to allow him again announce results next year.Let us demand for his resignation. Esau Chulu cannot tell us that there will be free and fair elections next year when he is busy holding dark corner meetings with PF on how to deny Citizens their rights to vote through compromising the voter registration process, issuance of NRCs and aiding rigging. They want to discard the old register and come up with a fake new register which will have majority of criminals they are importing from neighbouring countries.

What ECZ should realize is that, Zambians are alert and they will not allow any one to impose another Mwankole on them like it was in 2016.Next year, Zambians want change because they are suffering due to poor leadership.

We demand that the Electoral Commission of Zambia and the ministry of home affairs should stop playing tricks with voter registration process because they will be dealt with as individuals by the law.

To the opposition, I think you need to unit and write to the government’s of our neighbouring countries like Malawi and Tanzania, to help us in preventing PF government registering foreigners as voters. I believe these two countries have sound mind leaders who can help in stopping their people to register as voters on the Zambian side.

To the people of Zambia, please! let us all participate in safe guarding our nations future. Don’t allow criminals to register foreigners as voters in your area, and wait for the opposition to intervene, whenever you are, do something and save Zambia it is your civic responsibility to protect Zambia.What we should all know is that PF government is not ready to relinquish power next year in a peaceful manner.

As for the arrest of Mr. Mucheleka and company is ploy to stop the Ballymania in Lukashya, the same way Mr. Mwaliteta was arrested to allow criminality. Anyway after election the DPP will come up with a nolle for the most stupid charge ever sort in the criminal Justice system.

Transport and Communications Minister Hon Mutotwe Kafwaya says Zambians should reject leaders who willfully and freely insults in the presence of children and elders.

Hon Kafwaya, who is also Lunte Member of Parliament, says he was shocked to watch a video that has since gone viral where the UPND leader insulted during a rally in Lukashya Constituency.

The Minister said this on Monday evening when he featured on a special programme on Kasama Radio in Kasama, Northern Province.

“Where we come from here in the northern region, it is a taboo to insult like that. Worse off in the presence of children and elderly people. As a leader, what good values can you teach the young ones if you are in the forefront of unleashing such derogatory language in the presence of children? Anyway, I am not shocked because even his MP for Choma Central Cornelius Mweetwa insulted Her Honor the Vice President Madam Inonge Mutukwa Wina while featuring on a TV station in Lusaka that she is shallow,” he said.

“You see my elder brother Paul (host Paul Chileshe), this is why we say we should be careful on who to trust with power. Now am convinced that even the people who insult Paramount Chief Chitimukulu are sent by the same HH. It’s a shame we have people like that aspiring to be in State House. And there is no justification whatsoever, because HH has no tribal cousins here in Northern Province for him to insult like that while addressing our people.”

Meanwhile, Hon Kafwaya condemned the behavior of UPND cadres who stormed a place where civil servants from the Ministry of Home Affairs were issuing out National Registration Cards (NRCs).

“This kind of desperation from the UPND will not work. They even had the audacity to storm a station where some officers from the Ministry of Home Affairs were issuing out NRCs and beat up whoever was there. And again the UPND leader is quiet on this matter,” he added.

He said the ruling PF will win the Lukashya Constituency by-election.

He further added that the PF remains focused to ensure that development is taken closer to the people. -SMART EAGLES

Messages pour in for Tasila Lungu, as she prepares to tie the knot

The preparations which would culminate in President Edgar Lungu becoming a father-in-law are well on course.

President Lungu’s daughter, Tasila Lungu, who once said ‘Only God knows when I will get married,’ has finally got her soulmate and is tying the knot soon.

She getting married to Patrick Mwansa.

Posting on her Facebook page, Tasila hinted how happy she is, that all marriage modalities are going on well.

“Earlier today, I was honoured by my family who helped in the preparation of icilanga mulilo as per the bemba culture which I will be joining into as a part of the Mwansa family.

“It makes me so proud to be a part of maintaining this rich bemba tradition which has now become a strong part of our collective cultural marriage rites as Zambians,” she posted.

Meanwhile, following her post, her timeline was awash with messages, advice, and mainly congratulatory as people wished her well in her marriage.

“Respect to your husband and do all the necessary requirements that has to be done in your marriage please my sister,” one follower said.

“If only most us can learn from this lady….she is one of the humble people I have personally seen in our country so far!” added another.

Some of her followers wished her to be treated, the way her father is treating fellow Zambians.

However, others urged her not to mind about negative comments.

“Congratulations, the way I love this lady don’t mind the critics saying your husband should treat u the way your father treats the country.

“You also have your own life, you are different, those saying negative things maybe they are even worse off than their parents characters, it doesn’t hurt to be polite,” said one follower.

BAD blood is ‘oozing’ between Kanyama PF member of parliament Elizabeth Phiri and leader of a combative ruling party youth gang, Innocent Kalimanshi.

It all began during a rally to receive defectors from the opposition UPND in Lusaka’s Kanyama compound on Saturday, when Phiri spoke against Kalimanshi’s gang known as ‘America One’ which uses a bandana in the colours of the US flag as its symbol.

The lawmaker said the gang’s use of the American flag was unpatriotic and disrespectful to President Edgar Lungu.

Phiri said President Lungu was not happy about the brand of America which is being promoted by the youths in the party.

She advised the youths to stop putting on bandanas or any US flag and instead put on the Zambian flag, PF regalia or something which had the face of President Lungu.

Phiri warned that whoever would be found with American bandanas would be considered an outsider of the PF.

But Kalimanshi responded by saying Phiri’s utterances at the rally were divisive and unfair.

In a five-minute video, Kalimanshi said he introduced the American bandana among his “soldiers” as a result of his love for Jews who are united and always on the lookout for each other.

He directed his “soldiers” to continue donning the American bandana without fear, saying had Phiri been genuinely concerned, she would have called him and addressed the matter privately.

Kalimanshi accused Phiri of conniving with others to have him ejected from the PF but vowed that he would never leave the party because he fought for it.

He said his heart was still hurting that despite fighting for the party, the only people benefitting from it were newcomers.

“I fought MMD. I fought Wynter Kabimba [former PF secretary general and now leader of opposition Rainbow Party], we fought [Dr Guy] Scott and the same Innocent Kalimanshi was in the forefront and today when things are sweet, you want me out? It won’t happen,” Kalimanshi said.

He said he would never stop talking because the PF was not giving him peace.

Kalimanshi dared the police to arrest him and said he would not stop using the US flag for his “troops”.

Kalimanshi also wondered why President Lungu remained quiet while PF officials were treating him unjustly.

Kalimanshi appealed to President Lungu to break the silence and speak on his behalf.

OF POLITICAL STRONGHOLDS AND BEDROOMS

In the run up to the two by-elections in Mwansabombwe and Lukashya constituencies, there has been a lot of talk about political party “strongholds” and “bedrooms”. This claim by the Patriotic Front, where they have even gone to the extent of declaring certain regions “no go” areas for the opposition, is quite baffling.

Here is why.

A region can only be considered a stronghold if more than 50 percent of registered voters actually voted for a candidate. To understand this, here is an illustration. If a constituency has 10,000 registered voters, and the winning candidate gets, say, 4,000 votes, then that seat cannot be considered a stronghold for the winning candidate since 6,000 either did not vote for that candidate or did not vote at all. That seat can only be considered a safe seat if the majority (at least 5, 001 of the registered voters) voted for the winning candidate. But if 5,000 registered voters or less voted for that candidate, keeping all things equal, just one voter could come and vote for another candidate in the next election, thereby tilting the winning fortunes.

Now let’s consider the results of the presidential vote in the 2016 general elections. There were only 41 constituencies where more than 50 percent of the registered voters voted for the winning candidate. So that means, there are presently only 41 political “bedrooms” in the country. The ruling Patriotic Front has 7 of them in Luapula and Muchinga provinces (Chipili, Kawambwa, Pambashe, Chinsali, Shiwang’andu, Lupososhi and Mfuwe) while the opposition UPND has 34 “bedrooms” (2 in Central, 2 in Lusaka, all constituencies in Southern Province except Livingstone, 9 in North-Western and 4 in Western Province).

A staggering 115 constituencies cannot be claimed to be strongholds for any particular candidate. They can swing to any contender. There is no single province that can be considered a Patriotic Front stronghold – not even the Copperbelt! The UPND, on the other hand, can safely claim Southern and North-Western provinces to be their strongholds.

That being said, with the current economic meltdown and social upheavals in the country, what the Patriotic Front considers unwavering support for their presidential candidate from their supposed strongholds may not be forthcoming.

The upcoming 2021 general elections are going to be most interesting and UPND will have landslide victory.

Former UPND vice president Geoffrey Bwalya Mwamba commonly known as GBM, has advised fellow PF members to think twice and replace Edgar Lungu or PF loses lamentably as he notes that the ground looks bad for PF. In other words, GBM has vindicated us by confirming facts we unearthed few months ago of emerging camps in PF because some PF members feels Lungu is a difficult candidate to sale to voters.

According to sources close to GBM, they have disclosed to us how GBM complained yesterday after addressing a rally which he ( GBM) believes was poorly attended in Kasama.

GBM confessed that the opposition UPND is now everywhere. Mr. Mwamba, even threatened to quit politics if Kasama goes to the opposition as that will be a big embarrassment to his political reputation especially after assuring the PF government of going to dismantle the opposition UPND after his decision to leave them.

In his own words GBM said “BANE NATUYA TWALYONAULA IFINTU KALE, NANGU NINDALAMA TASHAKABOMBE BAKULALYAFYE BA MAMBALA ABA, IYI SITUATION PA GROUND 2021 NI WORSE, THE BETTER BA LUNGU BEKEMININA TUSENDE KBF NANGU TUPAPATE KAMBWILI , BAICE MWISULE AMENSO, GBM SAID.”

The former UPND vice president has charged that the only way for PF to survive is to replace Edgar Lungu with either Kelvin Fube Bwalya or Chishimba Kambwili, because, failure to do so will be the end of PF.

Our comment and advice to Edgar Lungu, GBM and PF government is that it is time up for you people. The time to pave way for others to run national affairs is now. You have done more harm to our nation than good and Zambians are tired of you PF crooks.

Looking at how Edgar Lungu has messed up things, the best advice we can ever give freely to him is to begin preparing for his exit nicely. Let Edgar Lungu begin his peaceful preparations hand over of power to the right person Zambians will entrust on the August 12, 2021.

Lungu, GBM and PF should not live in self denial by thinking they will win even if they change the candidate. There is no one in PF government who we can entrust with our national affairs beyond 2021 unless we want this country to be the most useless nation. Our country has gone to the dogs! We need to reclaim it back by voting out PF government.

We know Lungu’s plans to cause trouble next year, but please sir, your time is over including this PF government of thieves you have been presiding over. Just begin to prepare for your exit in a peaceful way at least you may redeem yourself a little bit. But the worst thing would be for Edgar Lungu wanting to be removed out of power by force after losing the elections.

Lungu’s continuity from were Sata left has been terrible because he has only continued destroying Zambia a thing that will need serious leadership to redeem our nation once again.

Katele Exonerates HH On Privatisation Scandal

KATELE EXONERATES HH ON PRIVATISATION SCANDAL

Former Finance Minister Dr Katele Kalumba has defended UPND leader Hakainde Hichilema against claims that he enriched himself during the sale of state assets – including the Mosi-O-Tunya Hotel and the Sun International Hotel – in the 1990s.

Dr Kalumba said that at the time of the sale, his ministry, aided by the Zambia Privatisation Agency (ZPA), completed thorough due diligence investigations before agreeing to privatisation and found nothing to implicate Mr Hichilema in corruption.

Speaking to ZNBC on Sunday, Dr Kalumba said the issues surrounding privatisation were thoroughly scrutinised under President Levy Mwanawasa.

“I didn’t expect it to get to this far. I think the issues were well-reviewed under President Mwanawasa. Committee of parliament was set up to review the privatization, the ZPA acquitted itself in their reports and so one, the issues that were raised by the Auditor General were in public domain and some of them were answered while some of them were not answered. But I didn’t expect that it would reach this scenario,” he said.

The ex-minister said he was confident in the ability of parliament and the ZPA to oversee the fair and legitimate sale of state assets.

When asked about Mr Hichilema’s role in the sale, Dr Kalumba said he was only being swept up in the scandal because he is seeking private office.

“Now it’s only Mr Hakainde Hichilema’s name which is coming out but in the past, there were other names coming out. It happened that maybe because he is a man who is seeking public office and people are asking him to account. I have gone through this issue and if you are calm, and answer these things reasonably, people will leave you. But don’t be emotional about it,” he said.

The former minister went on to explain how corruption is an endemic problem within the Zambian state and is not perpetrated individually by ministers but rather is enabled by officials within the civil service.

“There is no school for ministers. Usually, when ministers go into office, they are schooled by the officials they find there, on what to do and so on. And the system of governance must be examined very well on how ministers relate with the officials. And for those that may have the predisposition to acquire things outside the law, usually, they work with the officials in government. A minister cannot do it alone. Corruption is on the streets and we have to look at it holistically as a society”.

He concluded that corruption investigations must examine the public sector as well as the government, since it is the private sector that competes for and carries out government contracts.

3 NGOs Petition ConCourt To Declare Current Cabinet Unconstitutional

The Constitutional Court has been petitioned by three non-governmental organization who are demanding a declaration that the current composition of Cabinet and provincial ministers is unconstitutional.

The three organisations – Chapter One Foundation Limited, the Non-Governmental Organisations’ Coordinating Committee for Gender Development Registered Trustees and Young Women in Action – also want a declaration that the President did not adopt a procedure which ensured gender parity in the nomination and appointment of members of parliament and making the ministerial appointments relative to the current provincial and Cabinet ministers.

The NGOs have filed the petition through former Law Association of Zambia (LAZ) president Linda Kasonde’s law firm LCK Chambers.

The three NGOs are arguing that the President contravened Article 259 (1) (b) of the Constitution, equitable representation of persons with disabilities in the nomination and appointment of provincial and Cabinet ministers as contemplated in, and in contravention of Article 259 (1) (c) of the Constitution.

“That the court make an order of mandamus directing the President to use his power under Article 72 (3) (f) to revoke the nomination of all or some of the members of parliament he nominated and nominate new members to comply with the provisions of Article 259 of the Constitution,” they submitted.
The NGOs further wants the court to issue an order of mandamus directing the President to, within 90 days reconstitute the Cabinet by the powers vested in him by the Constitution to align the appointment procedures and composition of the Cabinet with the Constitutional requirements outlined in Article 259 of the Constitution.

The petitioners stated that following the parliamentary and presidential elections in 2016, President Edgar Lungu nominated members of parliament and appointed Cabinet and provincial ministers pursuant to Article 116 (1) and 117 (1) of the Constitution.

“That at present, they are 169 members of parliament and at least 29, two and one are female, youths and with disabilities,” they stated.

They stated further that the President nominated eight people to be members of parliament pursuant to his powers under Article 69 (1) of the Constitution and only two out of the eight nominees were women and none were either youths as defined by the Constitution, or people with disabilities.

They further stated that the President as also a various times appointed provincial and Cabinet ministers per his mandate in Article 116 (1) and 117 (1) of the Constitution.

“Despite the members of parliament comprising of 29 women, two youths and one person with a disability, none of the 10 appointed provincial ministers is a woman, youth or person with disabilities,” the petition read further.

We have always argued that Hakainde Hichilema is not what he postulates to be. We have always argued that the squeaky clean image that he tries so hard to portray is nothing but a facade aimed at masking the real character behind Hakainde Hichilema.

The Lukashya bombshell is only a glimpse of the man that some of us have known for many years as a lier, a manipulator and a common crook.

By using such a tasteless word deep in Bemba land, Hakainde was not only insulting whichever person he had in mind but the entire Bemba speaking kingdom together with the institution of the Mwine Lubemba, the custodian of the Bemba heritage including its rich language.

Most importantly, the Holy Bible in Luke 6:45 warns us that for it is out of the abundance of the heart that the mouth speaks.

By openly and without any inhibition deciding to go foul in broad day light like he did in Lukashya, Hakainde has revealed so much about about his true colours.

We believe that the Hakainde that the UPND have tried to build over the last 15 years is very different from the true Hakainde, the one we know very well, the Hakainde who looted state coffers during privatization.

Again, the Bible tells us in Luke 8:17 that there is “For nothing is hidden that will not be made manifest, nor is anything secret that will not be known and come to light.” Lukashya has therefore revealed the true Hakainde.

Zambians should now realize that the man who has tried so many times to be President of this God fearing nation is not fit to hold the highest office in the land.

Everything about this man is a lie. This goes to explain why doubts still linger about the man’s true identity for we know he was not born Hakainde Hichilema but as Samuel Chintombwa. A man who hides his name means he has a lot of things he has failed to reconcile with himself and his past and that man cannot make a good leader.

A wise man guards his tongue and the Bible again warns us to “Be careful what you say and protect your life. A careless talker destroys himself.”

Hakainde has a lot to learn from the grace and decorum both in speech and deeds with which His Excellency President Edgar Chagwa Lungu carries himself. President Lungu’s humble disposition can never betray him to use vulgar language even under extreme provocation.

By way of this statement, we appeal to the Seventh Day Church, an institution of high repute with high moral standards to publicly censure Hakainde since he claims to be an Elder in that Church. We believe that failure to publicly rebuke and discpline Hakainde will signal a unequivocal endorsement of Hakainde bad language by the SDA in particular and the wider Church in general along with its leadership.

Socialist Party to offer free education from grade 1 to university

SOCIALIST Party Chipangali Constituency aspirant Kenani Kalala Phiri says the only disability in life is bad attitude.

And headman Mbelele of chief Kapatamoyo’s area has called on government to repair Muswa bridge which was washed away by rains more than four years ago.

Speaking when he donated a wheelchair to 12-year-old Taonga Miti and second hand clothes to people of Mbelele village on Friday, Phiri said God paves the way for every person.

“My message to the disabled people is that, concentrate on things that your disability doesn’t prevent you doing well and don’t regret the things it interferes with. Don’t be disabled in spirit as well as physically,” he said.

Phiri said he would ensure that Taonga starts school and pledged that he would engage a private teacher to be coaching her.

“As a party, we believe that education is a pillar for somebody to see a different life, it’s not really about finding a better job but when you are educated, you are able to see things in a different way than someone who is not educated. In Socialist Party, we believe that under our leadership or the leadership of comrade Fred M’membe, we will socialise education so that it is totally free from grade one up to university level. We believe that without education, the country cannot develop,” he said.

Phiri said he was touched by Taonga’s situation.

“You know, Taonga’s twin sister is in grade two and Taonga does not go to school because of her condition. We don’t want Taonga’s future to be affected by her condition and this is the reason why we’ve decided to come in and help. I went through a lot but because of education, I am somewhere, without education I was not going to be sharing the same table with comrade Fred M’membe,” he said.

And Toanga’s mother, Elena Soko, said she used to face a lot of challenges with Tonga.

“At first when she was young, I used to carry her at the back but now it is difficult because she has grown. So these days what I do is to carry her on a bicycle whenever I want to take her to hospital. So this donation will go a long way,” he said.

And headman Mbelele commended Phiri for the gesture.

He said Muswa bridge should be repaired because it was a death trap.

Headman Mbelele said Muswa bridge was washed away four years ago and appealed to government to consider repairing it.

A Kenyan couple called off their wedding after man stormed church claiming to be their father

Avery distraught young couple had to cancel their wedding in Kenya when a man barged in claiming to be their father. The story that backs his claim is certainly an entangled one that made the groom storm out of the ceremony angry while the bride was whisked away in a car by relatives.

What was to be the beginning of their forever turned out to be something else. Anne Magwi and Jotham Munini were stopped just before they walked down the aisle in a church in Tana River county last Saturday.

The man, who claimed to their biological father, walked into the ceremony at the Holy Redemption Ministries flanked by his sisters to put an end to what he deems an abomination as siblings should not be allowed to exchange vows.

Festus Muli, the pastor of the church, said the supposed father revealed that the couple were born out of his previous relationships with two different women.

According to Daily Nation, the alleged father, James Sidai, was once married and his wife at the time discovered his affair with his lover. Sidai claims their relationship hit the winds and the wife left with their one-year-old son (the groom), whom he has never met to date.

He tried to make things work with his lover after his wife left but the relationship did not last due to financial constraints, constant bickering, and misunderstandings.

The lover also walked out of the relationship when she was four months pregnant. The lover is believed to have married a teacher that same year and gave birth to a girl (the bride).

“He said one of the children, the groom, was sired in an informal relationship that did not end well,” said pastor Muli. “The bride was conceived from the woman with whom he had a clandestine relationship at the time,” he added.

Currently, Sidai has three children with his new wife but has been keeping tabs on his ‘children’ through friends and relatives although he never approached them till now. His nephew claims his efforts to trace his children over the last 10 years have proven futile.

Sidai got wind of the nuptials through a WhatsApp group and decided to make an appearance and ‘save’ his children from committing incest.

“This man married and has three children with the current wife but has never been in contact with the children he sired out of wedlock,” said the man of God.

“He learned of the wedding through a friend who also shared it on a certain WhatsApp group. That is when he decided to make this trip and trace the church,” said the pastor.

Immediately this transpired, the wedding was called off and the pastor gathered the concerned parties for a meeting. The groom grew up with the story that his father had died in a car accident when he was a child and the bride was raised by the teacher and made to believe he was her biological father till his passing.

“The women did not deny knowing the man, and neither did they deny paternity. We sat down the couple in the nick of time and explained things out,” the pastor noted.

Now the wedding guests had their suspicions but to save the family more embarrassment, the pastor told them the couple had engaged in pre-marital sex.

The pastor later gave a word of caution to all parents to avoid such occurrences and be truthful with their children about the whereabouts of parents.

“If you happen to sire a child out of wedlock, tell them the truth about their father. Do not tell them he died in a road accident even if he is miserable in the streets, it’s ungodly,” he said.

HAKAINDE Hichilema on Friday told Mwansabombwe residents that the whole country has turned round to back his party to take over government in 2021.

Drumming support for the UPND candidate in this week’s Mwansabombwe parliamentary by-election Sunday Maluba, Hichilema thanked NDC members, whom he said were working together with his party in the by-election.

“Pa 17th September tukabike ba Maluba mu Parliament. Then 2021, tukabombele capamo nakabili tukengile mu government tukalete ifisuma kuno, ubunonshi (we take Maluba to parliament and in 2021 we enter government so that we bring good things here),” Hichilema said mainly in IciBemba. “Bana mayo muleumfwa bwino bwino? Ikateni apapene (ladies, are you listening? Hold tight here).”

He told the residents that people marry and bear very beautiful children.

He said a Tonga man marries a woman from Luapula and bear beautiful Lunda Mwansabombwe girls.
Hichilema said hunger does not know tribe.

He said people would not eat their tribe if they were hungry.

“Mukwai ndefwaya mwishibe ati uyu Hakainde muleumfwa mulimi, alimitemwa sana. Tulefwaya tukamibombele. Aba abanensu nabafilwa, snhilefwaya nokuposa inshita (I want you to know that this Hakainde you are hearing about; he is a farmer and loves you so much. Our colleagues have failed and I don’t want to worst my time on them),” he said.

He asked people to support him to form government for them to taste his leadership.

“Icikwanka bacimwena kwisa?” he asked the crowd that responded euphorically “ku mampalanya”, literally meaning one can predict calamity by the signs.

Hichilema praised the two ex-PF councilors that resigned to join UPND, telling them that they had exhibited leadership.

He said the whole country had turned-around to embrace the UPND.

“2021 PF kuya bebele,” he declared.

Hichilema said God loves Zambians so much and the only problem was lack of proper leadership.
He said if the people gave him Maluba as member of parliament, “ninshi kamwaume ka HH kaishiba ati 2021 twaingila.”

He told the people that if they vote for PF, they would demonstrate that they are not hungry.
Hichilema bemoaned lack of development in Mwansabombwe.

He said it was unfair for the Patriotic Front to continue plundering government resources at the expense of the citizens.

He assured the people of Mwansabombwe of development in key areas among them agriculture, education, health and infrastructure.

“Mwebena Mwansabombwe and Luapula yonse, umfweni; natubombele capamo tutwale icalo cesu ku ntanshi (Mwansabombwe people, listen: let’s work together to develop our country). We will fix the agriculture sector so that bonse tukalekwata icakulya mu mayanda pantu ine nga umulimi nalishiba ati muntu ni pamala (all of us should have food because as a farmer, I know food makes people),” Hichilema said.

He also said that Mwansabombwe being in Luapula Province, which was endowed with various resources such as water bodies, the locals would largely benefit from the UPND government’s tourism programme starting 2021.

Hichilema added that he would create business opportunities in order to enable people of Luapula and Mwansabombwe earn a living.

“Please, don’t get cheated by aba ba pompwe (these thieves), they have destroyed our country but together we shall fix it. Their job is just stealing from you and government and making you suffer. Government yenu ya UPND ikesa kontolola (your UPND government will come and control). We will create jobs and business for you. Ubulimi bukaya pantashi, abana ba ba pina na balanda bonse ba kasambilila (agriculture will advance, children of the poor will be educated) because it will be our job to ensure that they get an education and after education we will give them jobs and business opportunities. So let’s get united and work together mwebena Mwansabombwe,” Hichilema said.

And the UPND leader called for unity in the country.

He said when in government, he would work round the clock to unite the country he said had been divided by the PF.

“We are one Zambia, one Nation, one people and one family. Mwebena Mwansabombwe don’t accept to be divided by aba ba mukukulu (worthless people), who have failed to bring development and no one should stop anyone, we mean anyone from going to any part of this country. Zambia calo cesu bonse, so let’s work together so that tulete ubuyantashi (we bring about development). People are suffering; no jobs, no money but only a few PF thieves are eating,” Hichilema charged.
The opposition leader’s entry into Mwansabombwe was greeted a multitude shouting that they need change of government.

At the same rally, former PF councillor advised the residents to emulate him by leaving PF.
He said President Edgar Lungu would come to the area to commission a ward at a clinic instead of the district administration area that was declared in 2012 and remained undeveloped to-date.
“Nalefola nalifileka, naimwe mufuleke (I used to get an allowance but I abandoned it, you too must throw in the towel on PF),” he said.

Kelvin Mwape, another former councilor, said he had seen that there was too much prostitution in the PF and breaking of people’s homes.

“Mu PF nga wacita ifya bupuba ninshi bakupela icifulo, so namona ukweba ati mu PF nga waba ihule, watobela umuntu ing’anda, kukupela icifulo. Elo naeba ati kandeya mubuteko uuleisa mu 2021 (In Pf, if you do a useless thing, you are given a position. I saw that in PF if one does evil and break someone’s house, they are rewarded so I left for the government coming in 2021),” the councilor said.

LUNGU DREAMING…they have only delivered into their own pockets – Bob Sichinga

BOB Sichinga says President Edgar Lungu is corrupt together with his ministers, such that they have only delivered in their pockets.

Opening Parliament on Friday, President Lungu said his administration had delivered to the people.

President Lungu said Zambia is better now than it was in 2016.

“As a government, we were given the mandate to reduce poverty and [to] create prosperity for our people. We have delivered on that mandate and we will continue to deliver. We have delivered on infrastructure, we have delivered on social protection, we have delivered on education and health, to mention but a few,” said President Lungu in part.

Reacting to the president’s speech, Sichinga, a former commerce minister in Sata’s cabinet, said President Lungu was just dreaming.

“Well, to be honest with you, even presidents can be allowed to dream. Anybody is allowed to dream, it’s okay to dream. But, clearly, this is a campaign message, and it’s people that must judge whether you have done so or not. And it’s people that are supposed to be beneficiaries; that’s quite clear,” he said yesterday. “And as far as I’m concerned, roads that are built…to respond to his situation, let’s start with the road infrastructure. When he says we are better than we were before, he himself said as follows: ‘I have no vision of my own’. So, what is he comparing his performance against if he has no vision? What has he started? What is his measure? So, when he says they have delivered, yes, they’ve delivered into their own pockets because of theft.”

Sichinga, who is spokesperson of the Our Civic Duty Association (OCIDA), asked President Lungu what barometer he was using to gauge his administration’s ‘good’ performance.

“What is the barometer against which he’s having to measure his performance which he says he has delivered on, because if he’s talking about the roads, he found roads being constructed under president Sata. That’s not something that Lungu’s administration is supposed to have delivered,” Sichinga said further. “So, he should say ‘we have completed some of the roads that Mr Sata had started’, [not] to say he has delivered; that’s the first thing. Second, the cost of doing so is because they’ve been stealing from it; and I mean just that. They’ve been stealing from the road infrastructure, from the hospital infrastructure, clinics infrastructure; anything they touch they steal from [it].”

He said Sata’s well intended infrastructure programme had been abused by the current administration.

Sichinga said President Lungu and his team had stolen more from the construction sector than they enhanced quality.

“Anything that gives them more money in their individual pockets pleases their administration. So, his own officers are corrupt, himself corrupt. So, if that is the measure he’s talking about, then his administration has done well by stealing from the construction sector,” he said. “Those projects that Mr Sata embarked on of building hospitals, creating new districts are necessary, but not at the price at which they are being constructed. They’re using them to steal from the poor.”

Sichinga said the Pf leaders had already paid themselves from the projects.

“So, instead of talking about 8,000 kilometres, they’ve only done 4,000 kilometres or 6,000 kilometres. They could have done this with better quality if they were not stealing from it, starting from the President himself to the ministers, to the directors and all those that are involved in this; they’re all involved in it. And this, they’ve been adequately enumerated because we’re talking about fire tenders of US$1 million each,” said Sichinga. “The [Financial Intelligence Centre] FIC report has shown exactly where the money went for some of the mischief that took place. Secondly, questionable purchases of things such as motor vehicles where prices are exaggerated; where you would have gotten 10 ambulances you are only getting seven. Where you could have had better quality roads because you were not taking from them, again that’s the situation; whether you are talking about airport bases, whether you are talking about police houses, the price of those constructions is extremely exaggerated.”

It’s unfounded to assert mobile NRC registration exercise being implemented selectively – AG

THE Attorney General says the government did not breach any provisions of the constitution by implementing the issuance of National Registration cards.

This is in a matter where Chapter One Foundation has petitioned the Constitutional Court over government’s decision to limit the voter registration for the 2021 elections to one month.

Chapter One Foundation, through its chairperson Fr Cleophas Lungu, has cited ECZ and Attorney General Likando Kalaluka as respondents in the matter seeking an order that the electoral body carries out voter registration throughout the country.

Chapter One Foundation wants the court to compel the state to implement the mobile issuance of NRC throughout the country and an order that carries out continuous voter registration between elections.

In its petition, Chapter One Foundation said government violated the Constitution by implementing the issuance of National Registration Cards in a manner that contravenes the Constitution.

It said according to Article 128 (1)(b) of the Constitution of Zambia, the actions taken by government and ECZ were a violation of the Constitution, therefore the court had jurisdiction to determine the petition.

Chapter One Foundation said under Article 128(3)(b) of the Constitution, the decision made in the exercise of the legislative mandate to register citizens and register voters was unconstitutional.

It stated that government had been implementing issuance of National Registration Cards to citizens pursuant to the National Registration Act chapter 126 of the Laws of Zambia.

Chapter One Foundation said the registration of citizens in line with the national registration Act chapter 126 of the Laws of Zambia had been accelerated by the policy of mobile registration in various parts of the country.

It contended that government whether willingly or unwillingly has not rolled the mobile registration in all parts of the country and further that the registration services were not uniformly available to all citizens.

But Likando Kalaluka in his answer to the petition sworn by Alick Mvula, said apart from the provisions of the national registration Act, chapter 126 of the Laws of Zambia, government had strictly followed and never breached the provisions of the law in the issuance of NRCs.

“The department of National Registration, Passport and Citizenship under the Ministry of Home Affairs provides its services in all its offices, in all districts across the country except for some of the newly created districts and that these offices are open throughout the year except for weekends and public holidays,” Kalaluka said.

He submitted that to supplement the services, government implements a mobile registration exercise every after five years to carter for citizens who have attained the age of 16 years but are unable to easily access or present themselves to the nearest district registration offices.

He explained that the mobile registration exercise also carters for citizens who have lost their national registration cards and need replacement of the same.

He added that citizens’ inability to present themselves was attributed to various factors which include distance, terrain, and lack of information.

Mvula argued that prior to the mobile registration exercise, Minister of Home Affairs Stephen Kampyongo issued a statement in Parliament on how the mobile exercise would be conducted.

“With regards to the current mobile registration exercise, due to unfavourable economic factors currently prevailing in the country, government decided to implement the aforesaid exercise in two phases and when Chapter One Foundation filed its petition, government had allocated 40 days to each province. The first phase commenced on August 1, 2020 in the Copperbelt, Eastern, Luapula, Northern and North Western provinces and was scheduled to end on September 9, 2020, while the second phase was to commence on September 10, 2020 in Central, Copperbelt, Lusaka, Muchinga, Southern and Western,” Kalaluka explained.

He further stated that due to initial challenges in the first 10 days of the first phase, the government extended the first phase to September 19, 2020 and the second phase will commence on September 20, 2020 and that the total number of days for the second phase would be determined by how the exercise would proceed but the same would not be less than 40 days.

Kalaluka charged that it was a misconception to allege that government whether willingly or unwillingly had not rolled out the mobile registration exercise to all parts of the country or that the services were not uniformly available to all citizens.

“It is unfounded to assert that the mobile registration exercise policy is being implemented selectively in a discriminatory manner, undermining human dignity, equity and social justice as race, tribe, sex, religion, marital status, political affiliation or any other discriminatory factor are not taken into consideration when developing an implementation plan,” Kalaluka said.

He submitted that the alleged contraventions of the constitution were mere imaginations or speculations by Chapter One Foundation and it would be put to strict proof over the imaginations.

Kalaluka added that the petitioner was not entitled to any reliefs sought.

Zitukule urges Lungu to call for national economic indaba

ZITUKULE Consortium is deeply disturbed and concerned that some government officials have continued to push the privatisation narrative in public discourse at the expense of current
challenges facing the country, including poverty, low productivity and free fall of the Kwacha, says Nicholas Phiri.

Phiri, the executive director, said President Lungu must call for a national economic indaba immediately in order to find ways of coming out of the current economic quagmire the country was faced with.

He said it was totally unacceptable that government officials, elected to promote and protect the well-being of citizens could be spending time discussing the opposition UPND leader Hakainde
Hichilema when the nation was bleeding economically and majority citizens were becoming more and more impoverished.

“This should not be allowed to continue.

It is our considered view that the sustained campaign by government officials on privatization and calls for a commission of inquiry focusing on one individual could be a deliberate and well calculated scheme meant to not only divert citizens’ attention from real issues affecting the nation, but also to justify and lay grounds for a possible arrest and harm to the UPND leader,” Phiri said.

He noted that as things stand in the country today, any move by government to arrest and or harm the UPND leader might not be received well by the citizenry.

Phiri said those calling for a commission of inquiry on privatisation must have not forgotten how taxpayers’ money had been wasted on numerous politically motivated commissions of inquiries in the past eight years with no tangible outcome.

“What has the nation benefited from the commission of inquiry on voting patterns and
political violence when the status quo remains the same or even becoming worse? We wish to advise government to direct resources and energy on resolving the numerous challenges facing our people today, including long hours of electricity blackouts, the ever-depreciating local currency, procurement corruption and debt management, among other things,” he said.

Phiri noted that arresting or planning to harm Hichilema would not launder the image of those in power today ahead of the 2021 general election.

He further noted that unlike in 2016, arresting the leader of the biggest opposition party 10 months before the election on flimsy grounds would destabilise national peace and unity and put the country in big trouble.

Don’t keep quiet over privatisation, Banda tells MMD ex-ministers

FORMER deputy high commissioner to India Andrew Banda has appealed to all former ministers in the MMD government who were still alive to state their position on the privatisation issue so that it can be put to rest.

In concert, the PF, FDD’s Edith Nawakwi and Patriots for Economic Progress leader Sean Tembo have placed UPND leader Hakainde Hichilema on the spot over privatisation, accusing him of wrongdoing from the process.

Hichilema has always denied wrongdoing each time the privatisation question has been asked.

Banda, a senior member of the UPND, appealed to all former ministers of the MMD government who are still alive to state their position on the matter so that it could be put to rest.

Banda said it would not help for the likes of Vernon Mwaanga, Enoch Kavindele, Dr Guy Scott, Simon Zukas, Dipak Patel, Dr Roger Chongwe, Brigadier General Godfrey Miyanda and Dr Ludwig Sondashi, who were in the first MMD cabinet, to keep quiet over privatisation.

“It won’t help for these imminent people to keep quiet when the country is seriously being polarised with the motive by those in government today who are using desperate people like Edith to smear HH with dirty,” Banda said. “Further, look at the people that are spearheading this crusade, their current status, today, the region where they are coming from and the reason why they are doing all this. All this acrimony is not about wrongdoing in the privatisation programme of over 25 years ago, but fear of losing the 2021 elections to HH,” Banda said in a statement.

He said the PF government was using the privitisation propaganda to divert people’s attention from real issues affecting the country such as load-shedding, high cost of living, high unemployment levels, weak kwacha against the dollar; high fertiliser prices, low maize prices, high fuel prices, among others.

“The past two weeks has been politically busy with Edith Nawakwi’s revelation after more than 25 years that president Hakainde Hichilema was involved in wrongdoing in the privatisation of the mines and the purchase of a house on Serval Road, which she alleged belonged to Lima Bank and yet it belonged to Tobacco Board of Zambia and the sale of InterContinental, Livingstone,” Banda said.

He said the former finance minister did not have documentary proof to back her accusations against Hichilema.

Banda noted that Nawakwi, who is FDD president, did not explain why she did not stop the privatisation programme if there was any wrongdoing.

“Why was she raising the issue now, after over 25 years among others? Experts from the World Bank have stated that there was no wrongdoing. Privatisation was a Zambian government, the World Bank and the International Monetary Fund (IMF) programme which the UNIP government failed to implement. Had the privatisation Programme not gone ahead, Zambia’s assets such as mines and others would have been taken over by foreign companies,” Banda said.

He further recalled that George Sikazwe, a former specialist at World Bank, had stated that both his former employers and the government of Zambia had set up benchmarks for the consultant, Grand Thornton, to be paid and that yardsticks were met and therefore there was no wrongdoing.

“Sikazwe also wondered why Edith Nawakwi has taken more than 25 years to come up with the current position on the issue. Mr Francis Kaunda, former chairman of ZCCM also stated the same that there was no wrongdoing in the privatisation of the mines, among others. Katele Kalumba and many others have clearly stated that there was no wrongdoing,” he said. “Why is the PF doing this? The answer is simple: to divert attention from real issues such as load-shedding, high cost of living, high unemployment levels, weak kwacha against the dollar, high fertiliser prices, low maize prices, high fuel prices, among others. How come Mr Lungu who was involved in the privatisation programme as a lawyer is mute over this matter? We can only speculate he could be behind all this that is happening.”

Banda appealed to Hichilema to ensure that the courts conclusively dealt with the defamation case while party members dealt with the political side of the matter.

He said the PF also, in the interest of the country, should prepare to account for the wealth they have amassed in a short period of time of being in government.

“All in all, the issue of wrongdoing by HH in the privatisation programme has politically backfired like the issue of tribalism, Satanism, treason case, the burning of markets, destroying of Zesco pylons and the infamous gassing which they wanted to accuse HH of being involved. We are glad that president Hakainde Hichilema is not frightened to face the courts of law to clear himself. We hope after the 2021 elections others will not run away in fear of their wrongdoing,” Banda said.

He said as a matter of principle, not revenge on account of Hichilema’s privatisation issue, the PF leadership and their relatives, friends and others would have to account for the 40 per cent of the national budget (close to $8 billion) which has gone into their pockets.

“The national debt is over 20 billion dollars, the Euro bond of 2.2 billion dollars, 42 fire tenders bought at one million dollars each instead of $300,000 each, the infamous purchase of ambulances at $288,000 instead of 52,000 each and the 48 ghost houses among others,” said Banda.

“They will also account for the gassing that spread all over the country and the death of over 50 Zambians. The PF must know that we have people within their government who provide us with vital and accurate information. This is how far the UPND has reached so ba P F watch your steps; you will scamper like rats after 2021 elections.”

And Tembo noted how the country’s attention had been diverted from other pertinent issues to the issue of privatisation and the alleged misconduct of Hichilema in performing his various roles during the said privatisation process.

“It is for this reason that we call upon Hakainde Hichilema to help this country put to bed the privatisation issue by answering the few outstanding questions regarding this matter. Suffice to mention that as Patriots for Economic Progress, we greatly appreciate the time and effort that Mr Hichilema put into explaining some of the issues surrounding his role in the privatization process, during his address to the media last Friday, 4th September 2020,” he said. “Was he, or was he not appointed as the Zambia Privatisation Agency (ZPA) negotiating chairman for the sale of Mosi-o-tunya InterContinental Hotel in Livingstone? Did his appointment as ZPA negotiating chairman commence or not commence in July 1997? On 18th November 1997, while he was allegedly serving as the ZPA negotiating chairman in the sale of the hotel, did he or did he not, together with other directors, incorporate a company called Sun International (Zambia) Limited who’s PACRA registration number is 39430? On 3rd March 1998, in his capacity as ZPA negotiating chairman, did he or did he not award the sale of Mosi-o-tunya InterContinental Hotel in Livingstone to Sun International (Zambia) Limited, which company he had allegedly incorporated 3 months earlier, on 18th November 1997? Is it true that the Sun International (Zambia) Limited bid at $6.5 million was significantly lower than other comparable bids that allegedly included a $26 million bid, $20 million and $9 million? and; In selling the hotel to a company that he was allegedly a director in, did he or did he not declare interest as required by section 11 of the Zambia Privatisation Act, Cap 386 of the Laws of Zambia?”

Tembo said if Hichilema “feels harassed by the six specific questions that we have listed above, then we wish to tender our sincere-most apology in advance, to himself and his supporters, but the questions above must be answered”.

“However, our view is that as aspiring president of this Republic, it is actually in Mr Hakainde’s best interests that he answers the questions which the public is asking him, and not the questions that him and his public relations team design, rehearse and then present to the public in a choreographed presentation…” said Tembo.

FDD members plot to expel Nawakwi over privatisation stance

Divisions have emerged in the FDD, as some officials are calling for the expulsion of president Edith Nawakwi on grounds that she is using the name of the party to advance a personal agenda, in relation to her stance against a fellow opposition leader Hakainde Hichilema of the UPND.

Meanwhile, the FDD Central Province Chairman has suspended his secretary Jerry Simpepa who called called for an emergency National Policy Committee meeting to discuss Nawakwi’s position in the privatisation debate.

Senior FDD officials who sought anonymity ahead of a planned national executive committee meeting revealed that party members were calling for Nawakwi’s expulsion because she had prioritised her fight against a fellow opposition leader rather than organising the FDD.

“…Because of the same issue, they have resorted to suspending members. The provincial secretary of Central Province has been suspended for calling for an urgent national executive committee meeting to discuss the issue of president Nawakwi because members feel that this fight should not be there because she is supposed to be organising the party instead of fighting the other fellow opposition. I know that within a few days from now, there will be another development because we are mobilising ourselves and we want to go and expel her from the party,” the sources said.

Another official who, on record referred the matter to party vice-president Chifumu Banda, said the party was also in shock to see Nawakwi’s stance against the UPND.

“On that one, you may want to ask the vice-president to give the official party position. But what I can tell you is that everyone is in shock, including the vice-president himself. As party officials we are not aware of this stance which appears to be advancing the president’s personal agenda and campaigning for the PF, rathe than mobilising our own votes. There are various thoughts, we are told that there are some discussions between President Lungu and our president around the issue of running mate. Whether that is true, we don’t know because there has not been a meeting where this issue was discussed. All we are seeing are these activities which suggest that something is going on which we don’t know about,” the source said.

“This is why some officials feel there is need to sit down as a party so that we can get some direction on the matter. If PF is seeking an alliance, that is an issue that is supposed to be discussed, it cannot be a decision of one person, regardless of the position. That is not a democratic way of running party affairs.”

When contacted for a comment, vice-president Banda said he does not give interviews on phone, but later when prompted for an interview at his office, he referred the matter to the spokesperson who also declined to comment, saying the party was yet to hold a meeting.

In a letter dated September 9, 2020, Central Province FDD chairman Innocent Chanda stated that he was suspending Simpepa for trying to bring the party leadership into disrepute.

“It has come to our attention that you have been accused of destabilising the party having made numerous telephone calls between July-August, 2020, to various provincial chairmen across the country urging them to petition the National Policy Committee (NPC) to convene an urgent NPC meeting whose agenda only you know, despite not being a member of the National Policy Committee. You have further continued to call various provincial chairmen with a view of bringing the name of the party and its leadership into disrepute, in the matter involving our party president before the courts of law,” stated Chanda.

“In view of the above, I find your alleged conduct in breach of article Article 9 (c) and (k) of the party constitution, which required you to exhibit in service the highest morality and probity in your conduct and always act civil and responsible as deserving of a leader. I, therefore, suspend you from your office and given 14 days to exculpate yourself why further disciplinary action should not be taken against you. Your matter will be considered by the disciplinary committee within the stipulated period. Kindly handover all party properties if any, that may be in your possession to my office while on suspension.”

But in response to the letter of suspension, Simpepa argued that he was not in breach of any clause of the party’s constitution and that his suspension was illegal and unconstitutional.

“Good morning, I acknowledge receipt of the above subject matter. Your letter of suspending me from the party is illegal, unconstitutional and in gross violation of article 8 (a) (b) of the party constitution, which I quote as follows: A member of the party has a right: (a) To freely and publicly demand the fulfilment of what is enshrined in the constitution, resolutions, directives and obligations of the party; (c) To participate in forum and/or meeting at the relevant level of the party organs to which he belongs and to freely contribute in any debate and other relevant activities. Further, article eight sub-section (4) states and I quote: ‘No retribution of whatever sort shall lie against any member for the reasons only that he held a different opinion on an issue under debate’,” Simpepa stated.

“Furthermore, in accordance with article 8 subsection (5), which states as follows: Any member of the party who by his/her actions undermines the right of members to freely express themselves shall be subject to disciplinary action. It is in light of the foregoing that your letter purporting that you have suspended me is null and void and has been disregarded. Besides, I will ask the provincial executive committee to take disciplinary action against you for violating article 8 sub-section 5 of the party constitution. Sir, remember that I did consult you as my provincial chairman and you did advise me to proceed in the manner I did.”

Simpepa insisted that calling for an NPC meeting to discuss Nawakwi’s stance on privatisation was not illegal, but constitutional.

“May I also educate you that demanding for an NPC meeting and discussing the matter of the party president over the stance she has taken in regard to the issue of privatisation is not illegal, but a constitutional requirement and, therefore, I am wondering where you are drawing this authority to suspend me. But I want to retaliate that I shall not be intimidated in exercising my democratic rights,” vowed Simpepa.

Bill 10 will ensure peaceful polls – Davies Chama

DEFENSE Minister Davies Chama says once enacted, Constitutional Amendment Bill Number 10 of 2019 will ensure that Zambia’s elections are peaceful.

In an interview, Chama said there was need for less ambiguous laws for the county to have peaceful elections.

“It is like in Zambia, people want to oppose for the sake of opposing, I don’t understand. I am a positive thinker and I want progress. I think you have heard that the Minister of Justice [Given Lubinda] has indicated that Bill 10 is coming on the table, if our colleagues [in the opposition] have anything that they want say, this can be refined, this can be perfected so that our laws are very responsive to our developmental agenda. We all want our country to be transformed to make sure that it is competitive and democratic. What makes this more sad is that there was a motion that was moved by the opposition themselves to refine the constitution urging the government and the same government they urged to refine the constitution responded and they are now saying ‘no.’ So you start wondering if they are other motives that other people are propagating,” Chama said.

“That is why for us in government, we are sincere and we want to be truthful in whatever we do. This bill has undergone a lot of interrogations, consultations, and meetings have been held with a lot of stakeholders, I don’t know whether we should be an industry of talking as arguments. We want to have laws that are less ambiguous, easy for the court to interpret so that we have peaceful elections because we all want to have a country that is peaceful so that we can build our country. So for me any refinement of any law is welcome so that we make it better, simpler for the court to interpret so that it reduces issues of frictions or issues of misunderstanding. So anyone who says ‘no leave it as it is so that we can keep on fighting’ then maybe he is not supposed to be a Zambian.”

Chama said any efforts made by the government to refine laws should be welcomed by any well meaning Zambians.

“So any effort by the government to refine our laws should be welcomed by the opposition and any well meaning Zambian for that matter. I don’t know why we should be arguing over straightforward issues like this one. In Zambia we have a tendency of arguing over things that we are not supposed to argue over. I am not a constitutional lawyer but I have read through Bill 10 and for me, the clauses are straightforward. It beats my mind why we are arguing. There is so much politicking in this country. Bill 10 is a progressive bill and it must be supported because certain lacunas will be removed. The same lacunas that people were crying for in 2016 when they lost elections where they did not know whether the 14 days included working days or not and somebody says ‘14 days is not enough to prepare a case’, you need 30 days or even 90 days can’t you be happy? Can we put to bed this issue, can we debate it and can we pass this law,” said Chama.

There was an incident that will remain memorable to all that witnessed it at the Marian Shrine, the Catholic property around the airport turn off area.

The funeral for the catholic pope, Pope John Paul ll was officially held there and as an accountant for St Dominic’s and Emmaus Spirituality Centre, working under Zambia Episcopal Conference, I could not miss the event as we went down there with Seminarians.

Dignitaries begun arriving for the pope funeral. Scores of priests, scores of nuns and scores of bishops came in order.

Cardinals came and the pope nuncial also came .

Politicians came. Ministers and various ministry heads like Permsecs, etc.

Dr Kenneth Kaunda himself came and there was some clapping and hallulation in welcoming.

Late President Levy Partrick Mwanawasa also came and he was mildly welcomed.

I don’t know who arranged protocal because President Fredrick Chiluba came last as the unthinkable happened. There was uncontrollable screeming and shouting in receiving Chiluba who was actually a former president at the moment. Catholic women even did the unthinkable, by reaching the extent of deplaying Vitenges on the ground for FTJ to tread and walk on.

Mwanawasa became visibly ashamed, belittled, disrespected and he was disturbed and fury covered his face. Chiluba was received with exceptional respect while Mwanawasa was almost not even regarded.

The reason why I have narrated this story is because on this same pope funeral day when FTJ was triumphantly received by Catholic women, the Post Newspaper had carried pictures of 150 shoes that the task force on corruption exproprieted from the container of Fautina Kabwe at Access Financial Services, the shoes that were toilor made and belonged to President Chiluba. The post had portrayed on that same day that Chiluba was a thief who stole public money and made numerous designer shoes for himself.

Why was a republican thief of that particular day received like the Christ, while Mwanawasa was received like Lazarous? The answer was vindictiveness. Zambians hate vindictiveness.

Edith Nawakwi has alot to learn from this vindictiveness.

Why are people receiving President HH like Christ when the same Edith is carrying out a serious expedition to paint President HH black, a criminal and so on and so forth.

We won’t sit idle and watch while criminals steal our votes – Maiko Zulu

WE will not sit idle and watch criminals steal people’s votes even before they are cast, Maiko Zulu has warned.

Reacting to Electoral Commission of Zambia’s shift of the date of commencement of mobile voter registration from the initial October 19, 2020 to October 28, 2020, Zulu said ECZ was behaving like a band of renegades, who have been intoxicated by the cool temperature in their air conditioned offices and their thinking is in ICU like that of the people they are trying to give an electoral advantage.

“We are taking on the criminal rats at ECZ…this time the bush is coming to town. As concerned citizens, we will not sit idle and watch criminals steal people’s votes even before they are cast,” Zulu said.

Zulu, a governance expert and human rights activist, said scrapping the existing voter’s register should not be taken lightly by Zambians because of the ultimate results of such a criminal pronouncement.

He challenged the Zambia Police to be ready with their newly acquired ‘war machines’.

“Well, Zambia Police should be ready with their war machines which we know have been re-stocked because we are coming to eat the rats at ECZ and we are coming through the front door. The people we have entrusted with authority have no capacity to protect public institutions and therefore it is our duty as citizens to do just that,” said Zulu.

ECZ also announced the extension of the completion of the same exercise from November 20, to November 30, 2020.

Speaking at a media briefing in Lusaka on Thursday, ECZ Chief Electoral Officer Patrick Nshindano said the changes were meant to accommodate all eligible voters who would have gotten their national registration cards during the ongoing periodic national registration exercise which comes to an end on October 30.

Nshindano said he was hopeful that the issuance of NRCs would not be extended further and that in an event that it happens, the ECZ would not adjust the time to start the voter registration exercise.

Meanwhile, activist Chama Fumba has lamented that the ECZ has continued to exhibit jungle arrogance in their approach to the 2021 elections.

Fumba, popularly known as Pilato, said Zambians were not docile to allow this to occur ahead of an important election.

“We did not ask for moving of the dates, we asked that you don’t throw away the old voters’ register and instead just add new voters to the existing register considering the limited time and resources allocated for the election. In case you are still trapped into thinking that Zambians are docile, you are wrong. Our patience with mediocrity should never be mistaken for docility or anything in that league. We will not let you facilitate a sham of an election in this country,” Chama said.

He threatened massive protests if the ECZ remained adamant against the people’s wishes.

Fumba insisted that ECZ should not take citizens for granted.

He maintained that it was not right to throw away a register of voters when it was already announced how under-funded the ECZ is.

“We will not protest against you in the bush and we will not protest against you in the streets, we will protest against you in your face and you will regret. You cannot take the good people of this country for granted. We are insisting that you can’t throw away a register of voters when you have already announced how under-funded you are. We insist you do the right thing,” he said.

Fumba warned the ECZ boss not to allow criminals damage his reputation otherwise he would be treated like an enemy of the masses.

“Mr Nshindano mudala (big man), you are still young and these criminals are damaging a reputation that you may never repair in this life time. We will treat you as an enemy of the people if you allow yourself to be used as their mop. Do the right thing NOW and stand with the people,” said Fumba.

Zimbabwe main opposition denies claims of training armed militias in Serbia

The MDC Alliance has rejected Zanu-PF attempts to link the party to the shooting death of a soldier in Chivhu last week, and claims that Zimbabwe’s main opposition party is training insurgents in Serbia and Moldova.

Zanu-PF acting spokesman Patrick Chinamasa made the claims at a news conference on Friday.

Referring to the Chivhu incident where a soldier was shot dead and two others wounded after two men shot at them apparently unprovoked, Chinamasa said the ruling party had been “taken aback by statements of disparagement and ridicule coming from the MDC Alliance rank and file where they appear to be celebrating the attacks on the security forces, while pouring their hearts out for the assailants.”

“We have taken note,” Chinamasa said, speaking at the Zanu-PF headquarters in Harare.

The two attackers were hunted down and killed in a joint police and military operation.

Chinamasa appeared to link the attack to the MDC Alliance, issuing a warning to the party’s leader Nelson Chamisa and his deputy Tendai Biti that “they should not be like children playing with fire, it would be very dangerous for them.”

“We know what they have been doing. We’re not surprised by the stance they’re taking,” Chinamasa charged.

Biti, writing on Twitter, said Zanu-PF’s attacks “smack of pathological desperation and vacuous idiocy.”

Party spokesperson Fadzayi Mahere said: “Neither the MDC Alliance president nor VP had anything to do with the Chivhu shooting incident involving soldiers. The attempt by Zanu-PF to blame the MDC Alliance for the incident is desperate, regrettable and unsubstantiated. These lies must stop.”

Chinamasa also claimed they had information that the MDC Alliance has been “sending renegades to Serbia and Moldova who are being trained to prepare Molotov cocktails to come and cause mayhem and violence in our country.”

Offering no evidence for his claims, Chinamasa added: “It’s all very clear that the MDC Alliance as a party worships violence and continues to maintain violent structures which they characterise as vanguard resistance committees.

“As you know, in 2018 they were responsible for the orgy of violence and also for the 14-16 January violence last year when they perpetrated violence in our streets, in our communities targeting security forces and innocent Zanu-PF members.”

He told the MDC to “proceed forthwith to dismantle your violent structures.”

Chinamasa also railed at Serbia and Moldova’s governments, stating: “We also want to call upon those countries Serbia and Moldova who host such violent training. We also want to call upon those countries which we know, which are funding the perpetration of these violent activities, training people like they are a militia, like they are soldiers outside the borders of Zimbabwe and you think the Zanu-PF government will tolerate that. We will not tolerate.

“Like the Chivhu assailants, the security forces will account for them, each and everyone of them. There should be no complaining to anyone when people who have been trained in Moldova and Serbia come on our shores and are accounted for. We should not receive any complaint from anybody including the United States ambassador.”

Mahere said Chinamasa’s claims were defamatory.

“It’s a matter of regret that Chinamasa has resorted to a false, malicious and reckless attack on the MDC Alliance. Instead of addressing the multifaceted socio-economic and governance crisis that plagues Zimbabwe currently, he has fabricated unfounded claims against our movement,” Mahere told ZimLive.

“His unrestrained remarks betray the desperation and incompetence of Zanu-PF which has failed to address the national crisis and has resorted to threats, intimidation and propaganda to mask its incompetence. We demand an urgent retraction of the defamatory allegations against our president, vice president and indeed our party to the effect that we are training youths in Moldova and Serbia. The MDC Alliance is a party committed to non-violence and peaceful resolution of the national crisis.

“Chinamasa’s aggressive and unrestrained remarks and tone are unconstitutional and a threat to our right to challenge the government and hold it to account without the threat of reprisals. Moreover, we reaffirm that without sincere dialogue and a political settlement, the nation will continue to suffer from the harmful effects of the legitimacy deficit that plagues Mr Mnangagwa’s regime flowing from the disputed election of 2018.”Source – zimlive

Chiefs plead with Bowman to help dismantle UPND dominance in Lamba land

SOME traditional leaders in rural Copperbelt which is dominated by the UPND have asked Kabushi Member of Parliament Bowman Lusambo to help dismantle the opposition’s stranglehold in the area.

The vast majority of Lamba land is dominated by UPND with Mpongwe and Lufwanyama Members of Parliament all coming from the opposition party.

But Chief Nkana of Lufwanyama said the rural parts of the Copperbelt has seen little development because of having aligned itself with the opposition.

Chief Lumpuma also of Lufwanyama said the traditional leaders across the Copperbelt have resolved to dump their support for the opposition and will now support the ruling PF in order to accelerate development in their Chiefdoms.

Chieftainess Shibukunami said the Chief’s will no longer entertain what he called lies in their Chiefdoms and now want people who can deliver development.

The three traditional leaders were speaking separately on Saturday when Mr Lusambo who is also Copperbelt Province Mobilization Committee Chairman and his team paid courtesy calls at their respective palaces.
“We know you are the Bulldozer, please help dismantle the UPND here. We have suffered enough and we know you can deliver. We want to see more development and the only one who can bring development here is Edgar Chagwa Lungu,” Chief Nkana said.

He said time has come for the PF to have representation both at ward and Parliamentary levels in the area in order to accelerate development in Lufwanyama which has stalled due to lack of commitment from the opposition.
Chieftainess Shibukunami pledged to work with the PF party structures at the District level to strengthen the ruling party in Lufwanyama ahead of the 2021 general elections.

“We don’t want to make the same mistake like we did in 2016. Now we want the PF here to be strong. I have since asked the District Chairman to come and meet the Foot Soldiers we have put together here to go round the Chiefdom and tell the people the truth,” she said.

Chief Lumpuma said Lufwanyama has received a good share of developmental projects such as schools, and the upgrading of health centres but would achieved more if the area had proper representation.
“Please go and tell His Excellency President Lungu that the people here are happy with his leadership and we want him to continue so that he can finish all the projects he has started. Just look at the Maize harvest, farmers have done well this season because fertilizer and seed came on time and as we speak, inputs are already in the District for the forthcoming farming season.”

Mr. Lusambo is in Lufwanyama to spearhead mobilisation activities and drum up support for PF candidates in Thursday’s Local Government by-elections.

HH’s statement that they want to kill him needs to be taken seriously – Prof. Hansungule

In the wake of the highly irresponsible utterances two weeks ago on privatisation and particularly Hakainde Hichilema’s alleged involvement in it, the latter posted a facebook statement to his followers and to the country outlining a plan by his opponents to kill him. This is a grave statement by the leader of the main opposition political party United Party for National Development (UPND). Coming a few months before the elections, the statement is an indictment towards bad governance in which those managing the levers of power use intolerance rather than democracy to settle political differences and illegally maintain power.

HH’s posting is not without context. Since the current government came into power, several people have lost their lives while others have been permanently maimed at the hands of trigger happy police and ruling party officials masquerading as security forces. Young people have simply had their lives cut shot merely for taking party in peaceful political campaigns or demonstrations as guaranteed them under the constitution and international law applicable to Zambia. Wearing an opposition political party T-shirt is a death sentence in Zambia. Videos are abound in which members of the public donning opposition party regalia are beaten, humiliated and made to wear ruling party regalia and to loudly praise ruling party leader’s name and party slogans in public.

Although Zambia has been known in the international community to be an oasis of peace in a region deprived of any semblance of peace, this is rapidly not so. Not long ago, we have had former ministers such as Ronald Penza, Paul Tembo and first president’ Kenneth Kaunda’s son Wezi Kaunda allegedly executed in mysterious circumstances. One of our finest Zambian lawyers Rodger Chongwe was short at during day light together with former president Kenneth Kaunda, the bullet missing Chongwe’s life by a whisker. The two had merely tried to meet their supporters at a legally constituted public assembly. We have this background even as we are praised as peaceful country. These killings were never solved and culprits found and punished which means the fellow next to you can just as well be the murderer. Failure to solve these killings has exponentially built to the current levels of impunity the country is stirring in the face.

On the African continent as a whole, politically motivated murders define the continent’s political map. Just take the example of our neighbours Zimbabwe, political opponents are routinely dealt with through state sponsored acts of terrorism. It is quite common in Zimbabwe for political opponents to disappear and their loved ones to have no opportunity to rest them. Removal of Robert Mugabe from power has not signalled anything towards peace for the ordinary Zimbabwean.

In the tiny Kingdom of Eswatin, it is a crime to belong to a political party. One of the outstanding long serving leaders of the trade union movement in that country Jan Sithole has just been reported dead. Besides leading the trade union movement for a long time against the highly intolerant system of rule by Monarchy, Jan Sithole broke history when he became the first well known political opponent to contest for membership of parliament under their individual merit system hiding under the name of his illegal party Swaziland Democratic Party (SWADEPA). Membership of this party was pan Africanist and Jan Sithole persuaded me and other pan African colleagues to join his party. Together we defiantly held workshops on human rights but also on democracy in the Kingdom. Today, Jan is no more and it is highly speculated he was poisoned during his many ‘visits’ to prison as King Mswati’s guest. Save for a few countries such as South Africa where democracy is really growing, the story is the same.

HH’s statement needs to be taken seriously. Now that elections are coming, more lives are at stake. Young men and women will once again lose their lives merely for trying to exercise their right for political association enshrined in the constitution. The current government and its supporters have demonstrated to be intolerant blood thirsty regime that have no respect for human life of opponents. Instead of arguing with opponents as expected in a democracy, they use bricks, guns and any weapon to suppress dissent during election campaigns. It is important that the public express its outrage at the use of intolerance by the ruling party against citizens. Fear and therefore failing to speak out against banditry forms of behaviour is the surest way towards confirming the country as a failed state in which no one is safe. HH’s statement is a wake-up call for all peace loving Zambians to seize the moment and protect innocent lives. We must swear that no Zambian should die due to intolerance this coming election. Zambia should be a country of all political colours and of all slogans of all the political persuasions guaranteed in the constitution. Tolerance of political party meetings, assemblies and demonstrations should chacterise our beautiful count=ry. The ruling party should be in the forefront of promoting and protecting democracy rather than suppressing it. It is important to remember that it is not a democracy if it is devoid of genuine opposition.

Lawyer Stories Zambia had the opportunity to interview Ms. Namwaka Mwala, AHCZ. We hope her story inspires you. Enjoy!

Q: Who is Namwaka?

A: She is an Advocate of the High Court of Zambia. Namwaka did her Bachelor of Laws at University of Lusaka from 2011 to 2014. In 2016, she passed her practitioner’s exams and was called to the noble rank of the Zambian Bar on the 26th April, 2018 and She been practicing for 2 years. Well vested in Litigation, Legal Research, Corporate Law, Conveyancing, Family law, Employment Law, Civil Procedure, Commercial Law and Debt Collection. Currently working in the private sector, practicing with Messrs C.C. Mwansa & Associate, a law firm based Lusaka.

Q: What inspired you to study the Law?

A: I remember growing up, I always wanted to be an Accountant like my late father because I was so good at mathematics, but things changed when I was in Grade 10 when my late father’s herd of cattle were stolen. It was a huge drawback on the family. The matter was taken to court and every time the matter came up, I was eager to hear the stories about how the matter went, I would overhear him telling my mum that the prosecutor and the magistrate said this and that. That word prosecutor intrigued me and I was fascinated by it. I remember telling my father that I want to study law when I complete my education and he supported me with my decision. Aside from that, I also wanted to contribute to the legal system of Zambia by advocating for justice for vulnerable women and children.

Q: What was your greatest challenge in your journey as a Law student?

A: As a law student the greatest challenge I faced was at ZIALE because there were a lot of courses to study and each Lecturer was specific with what they wanted. I remember failing the mock exams and that was a wake-up call for me. It was so emotional for me being the best graduating student after failing the mocks exams at ZIALE. However, that worked to my advantage, it made me work harder that on first attempt I cleared 9 courses of 10 and the second sitting I cleared the course that remained. I thank God that I had a support system that encouraged me.

Q: What drives you to achieve goals?

A: I am a very determined and focused person who aims at achieving my goals no matter what. If plan A does not work I always reinforce plan B to get the intended results.

Q: The Legal practice exam conducted by ZIALE has continuously recorded less numbers of students passing the exam at first instance. In your opinion, what can be done to change this case?

A: The only way this can be achieved is for students to work hard and follow instructions. ZIALE is manageable.

Q: What is your take on Zambian women’s participation in politics and other leadership positions at the moment? Are we doing much as a country to quickly reach the 50 – 50 gender representation goals expressed in international and national legal frameworks?

A: Although the law in Zambia guarantees men and women equal rights concerning political participation and other leadership positions, there are factors that hinder women’s political participation such as the patriarchal system, low incomes and education levels. The low levels of female representation in Zambia are considered to undermine the quality of the country’s democracy.

To curb this, a lot needs to be done by the Government and Non – Governmental Organizations (NGOs) that advocate for women’s rights in order to achieve the 50 -50 gender representation goals, as expressed in international and national legal framework such as providing training for women political candidates to help their capacities, offering them voter and civic education and sensitization campaigns on gender equality and supporting their networking.

Q: If not the Law, what was your alternative career path?

A: Definitely Accounts or Economics

Q: What are your thoughts on Constitutional Amendment Bill 10 of 2019?

A: The Constitutional Amendment Bill 10 of 2019 has stripped the National Assembly of many of its powers and functions, for instance, it repeals provisions in the existing constitution which previously gave the National Assembly oversight over approving public debt before it is contracted. The Bill also intends to give the President power to enter into international treaties and agreements without the approval of the National Assembly. The Bill even goes a step further by allowing the president to create a province, or divide or merge a province, without any approval from the National Assembly. Removing National Assembly oversight in this manner deliberately concentrates power in the hands of the Executive.

Q: Recent debates have been raised on the wearing of Wigs by Judges and Legal practitioners in most African states. Arguments are that the wigs are colonial and should be abandoned. What are your thoughts on this subject?

A: Wigs worn by Judges and Legal Practitioners are part of the uniform, items that elevate a court room despite their colonial links. They represent more than the British tradition, but something that distinguishes Judges and Legal Practitioners from other people in the court auditorium. I don’t feel at all that it has any negative connotation of colonialism. Moreover it carries some prestige

Q: What is your best advice to Law students?

A: Be teachable and always go an extra mile in terms of your studies and I guarantee you that you will succeed no matter what.

EDITH Nawakwi has accused UPND president Hakainde Hichilema of being behind the revolt simmering in her party, the FDD.

“Hakainde thinks we are all dull and he is smart, let him just prepare defence. I want to meet him in court and he should prepare his case because once he is done with his accusations as the plaintiff, we will ask him some questions,” Nawakwi told Hichilema. “Justice has to be done. The spirits of the dead are upset with him because the widows are suffering. Some people are asking why I am talking now and that I was quiet. Yes, I was quiet, I was quiet making sausage but you know me. I will pursue this until the end. I am focused, by the end I will make sure he hands over those farms to the owners.”

An anti-Nawakwi crusade is simmering in the FDD with some senior members of the opposition party accusing her of grossly violating the party constitution and neglecting to mobilise party membership.

Meanwhile, the Forum for Democracy and Development (FDD) has suspended a provincial official in Central Province for secretly agitating for a party convention, inter alia.

Senior FDD officials granted an unsolicited for interview to The Mast in Lusaka on Thursday.

They requested for anonymity.

“What is surprising us, the true and long-time members of FDD, is that Nawakwi has the energy to fight these battles against HH and UPND, but she has no energy to mobilise the party,” the sources said. “Since 2016 she has never mobilised anywhere and she has never convened an NPC (National Policy Committee) meeting, which is a violation of the party constitution – because it says there shall be an NPC meeting after three months.”

They said in 2016, Nawakwi even failed to pay the FDD’s polling agents.

“FDD members have been pushing those of us holding senior positions that ‘please, hold an NPC meeting and discuss the convention and party mobilisation.’ But Nawakwi doesn’t want to call for that meeting,” they said. “Last time we just had to call for an emergency NPC meeting – we actually used our own resources and Nawakwi was summoned. In that meeting, she committed that she was going to change and start mobilising the party. But she has not fulfilled that promise, as everyone can see.”

The sources explained that Nawakwi does not get in touch with party structures.

“She does not even work closely with the national secretary Mr Nathan Mulonga, the national chairman Mr Potiphar Chungu – they are completely sidelined. In short, she thinks she is FDD and FDD is herself,” they said. “She has been telling us party officials that we must look for our own money for transport and even accommodation if we want a convention. I mean, (late FDD founding president) Christon Tembo organised a convention in 2005.”

They further recalled that Lieutenant General Tembo “did not ask us to look for our own money for transport and accommodation to go to the 2005 convention.”

“No! Christon Tembo organised for a convention and that’s how Nawakwi was elected. Christon Tembo gave in because of the pressure from her and others who were saying ‘you (Tembo) have lost the elections [in 2001] and according to our party constitution, you can’t again continue,’” the officials recalled. “For her, in 2008 she supported Rupiah Banda. In 2011 she stood and lost lamentably, in 2015 she stood and lost [and] in 2016 she stood and lost. All this is in violation of the party constitution.”

The sources explained that Article 42 (1) of the FDD constitution says: “the party president shall hold office for a maximum period of not more than two consecutive terms of five years each.”

“Article 42 (2) says the president of the party may be removed from the party presidency after the party loses an election, provided that this clause shall apply to the 2001 election,” they noted.

“Article 42 (3) says the party president may be removed from the party presidency by secret vote of two thirds of the majority of the party convention for either gross violation of the party constitution.”

They indicated that the general membership of the FDD felt that Nawakwi had massively violated the party constitution.

“She lost in 2011, 2015 and 2016 but she continued as FDD president – this is gross violation of the party constitution. Nawakwi has to rest now!” they said.

Meanwhile, the officials believe Nawakwi is behind the suspension of Central Province FDD secretary Jerry Simpemba.

“We are aware that she tried to call him (Simpemba) today (Thursday) but he refused to talk to her,” the officials said, adding that the FDD constitution was the most democratic one.

“You cannot intimidate a member by trying to stop them from exercising their democratic rights. What kind of politics does she want to bring to FDD?” he said.

Asked about the last time the FDD held an NPC meeting, the officials said: “about two years ago.”

“Even that meeting we just called for it as an emergency. But Nawakwi today wants to be wasting time talking about HH!” they complained.

“I remember in that emergency NPC meeting we held we gave the party leadership two weeks to hold an ordinary NPC meeting. But nothing has happened to this day. So, FDD members out there are saying that since Nawakwi has failed to call for an NPC, we will go ahead and hold an NPC meeting and pass resolutions. That is what is there now!”

They further asserted that: “this is just the beginning.”

“The battle will be fierce as we progress into another phase, until the party is liberated from non-performing and highly compromised leadership which has failed to provide the required leadership. That’s the reason the party is losing members,” said the officials.

Central Province FDD chairman Innocent Chanda signed Simpemba’s suspension letter, dated September 9, 2020.

“It has come to my attention that you have been accused of destabilising the party, having made numerous telephone calls between July-August 2020 to various provincial chairmen across the country urging them to petition the National Policy Committee (NPC) to convene an urgent NPC meeting, whose agenda only you knows, despite not being a member of the National Policy Committee,” Chanda stated.

“You have further continued to call various provincial chairmen with a view of bringing the name of the party and its leadership into disrepute, in the matter involving our party president before the courts of law.”

Chanda stated that in view of the above, he found Simpemba’s alleged conduct in breach of Article 9 (c) and (k) of the FDD constitution.

The cited Article, according to Chanda, required Simpemba to exhibit in service the highest morality and probity in his (Simpemba’s) conduct and to always act civilly and responsibility as deserving of a leader.

“I therefore suspend you from your office and given 14 days to exculpate yourself why further disciplinary action should not be taken against you. Your matter will be considered by [the] disciplinary committee within the stipulated period,” stated Chanda. “Kindly hand over all party properties, if any, that may be in your possession to my office while on suspension.”

Chanda copied the letter to the party president, vice-president, national chairperson, national secretary and disciplinary committee chairperson.

Simpemba acknowledged receipt of Chanda’s letter but was quick to indicate that the action taken against him was illegal and unconstitutional.

He said the action against him amounted to gross violation of the FDD constitution’s Article 8 (a) (b).

Simpemba explained that an FDD member has a right to freely and publicly demand the fulfillment of what is enshrined in the party constitution, resolutions, directives and obligations of the party.

He added that FDD members are constitutionally permitted to participate in a forum and/or meeting at the relevant level of the party organs, to which they belong and to freely contribute in any debate and other relevant activities.

“May I also educate you (Chanda) that demanding for an NPC meeting and discussing the matter of the party president over the stance she has taken, in regard to the issue of privatisation, is not illegal but [a] constitutional requirement,” stated Simpemba, in his written response to Chanda.

“Therefore, I am wondering where you are drawing this authority to suspend me. But I want to reiterate that I shall not be intimidated in exercising my democratic rights.”

But when contacted, Nawakwi refused to comment on the issues raised charging that the sources were hired guns.

She claimed UPND leader Hakainde Hichilema was behind the accusations because he had enough money to buy off “hungry cadres”.

“I don’t want to be diverted by those trivialities, and I can’t respond to people who are anonymous. Let them come in the open otherwise I won’t respond,” Nawakwi said. “These are inspired stories meant to divert me. It’s a diversion tactic by UPND but it won’t work. When I set on a mission, I must conclude. Hakainde thinks we are all dull and he is smart, let him just prepare defence. If he thinks he is smart, we will meet in court. I want to meet him in court and he should prepare his case because once he is done with his accusations as the plaintiff, we will ask him some questions. Let him stop running around like a headless chicken.”

Nawakwi stressed that Hichilema is a rich man and he can buy any hungry party cadre from any party.

“And I know it is him who is paying these people who are purporting to rise up in FDD. He has evicted widows and orphans in Kalomo… Tell him, please napapata [I beg] concentrate on your cases which you have been sued in the Livingstone High Court over,” she said. “He is rich but he is busy grazing his stupid animals in someone’s farm. It’s a pity that a rich man should stand in court and start to argue with orphans and the poor people.”

Nawakwi added that she would fight the matter against Hichilema to the end.

Hichilema has dragged Nawakwi to court over her allegation that he failed to declare interest in the privatisation of national assets in the 1990s.

HH appointed time to lead has come – Sialubalo

SINAZONGWE UPND member of parliament Gift Sialubalo says politicians must always remember that the people that elect them will get fed up if they underperform and will want new leaders.

Sialubalo said there was nothing that the PF can do to perpetuate its stay in power if Zambians want change of leadership in 2021.

Addressing his constituents, Sialubalo said he felt ashamed that despite Zambia being a Christian nation, her citizens were still practicing “barbaric” politics 56 years after independence.

“Sometimes as politicians we should know that at one time the people who voted us into power will be fed up with things if we underperformed and all they will need is new blood,” he said. “If people want change and the change they want is that of HH [UPND leader Hakainde Hichilema] to be the president of the Republic of Zambia we just have to accept that his time has come. No matter what you do to smear him of something that he never did, the people of Zambia won’t be swayed.”

Sialubalo said Hichilema’s appointed time to lead government has come because of the incompetence of the current regime and no one would stop him from ascending to power through the ballot in 2021.

He said Zambians have looked at Hichilema’s ability to run government and are satisfied that he deserves to be ushered into power after next year general elections.

And Sialubalo said the politics of name calling and maligning each other was below par for a Christian nation.

“This is so trivial and cheap. Anyway, Zambians now have woken up. No matter the amount of malice, the people know what to do come 2021. God is there to stand for HH and Zambians are enlightened now,” he said. Sialubalo said it did not make sense to use politics to blame Hichilema for the privatisation process which was overseen by the MMD government nearly thirty years ago.

“How can this government now comes up with schemes to shift the blame to someone who has never worked in government? There is no way someone who never served in government can go and sell a government property. That is the preserve of the sitting government and the one to preside on everything is the finance minister. HH has never been finance minister in any regime. All his life he has been in the private sector,” Sialubalo said. “When privatisation was done, it was not only one individual who was involved. Technocrats from different fields were involved. The current President was involved too. Now does it make sense to any well-meaning Zambian to shift the blame to only one person who was in an independent company?”

Sialubalo urged citizens to discuss serious issues affecting the country today.

“How can we manage the free-falling kwacha? How can we do away with load-shedding? Instead of us looking at the corruption surrounding the purchase of fire tenders, road construction, Forest 27, Financial Intelligence Centre reports, we are focusing on HH. If you don’t invest prudently, why blame those that have invested well? Nothing will stop HH from going to State House next year because people have seen that he is disciplined, he is humble and knows how to use his resources,” said Sialubalo.

NEVERS MUMBA SPEAKS ON MUTATI’S SUFFERING … ‘I can only pray for him and wish him well’

All of us must learn that life is a cycle and it’s important to invest in a good cycle, says MMD leader pastor Nevers Mumba over the political infringements his one time nemesis Felix Mutati is facing.

Speaking with Daily Revelation, pastor Mumba came to the defence of former Finance minister Mutati, saying no one has the right to trample on his rights to form or belong to any political party of his choice.

Mutati’s path towards forming a political party named Movement for Democratic Change (MDC), has been blocked by the Registrar of Societies, acting on orders from State House and the minister. The several political party leaders from the other ‘nashala neka (small political parties)’ parties he has tried to enter into mergers with, have also ended up being bought by State House, which does not want to see other political parties being formed, especially those which might draw a little support from the ruling party ranks.

Some of the political parties Mutati and his former faction members in the MMD have tried to enter into mergers with include, Highvie Hamududu’s party, late Mike Mulongoti’s People’s Party and Jackson Silavwe’s Golden Party.

Before getting onto this trajectory, Mutati was involved in protracted court battles with pastor Mumba over the MMD presidency, which the courts of law ruled in Mumba’s favour.

Asked to comment on the misfortune against Mutati, whose rights were being infringed upon by State House and the government, pastor Mumba said he could only pray for him, but also remind him that the MMD was still his home and would be welcomed any time.

Asked on the observations that the injustices Mutati was facing were the same injustice he (pastor Mumba) faced when the former finance minister was in good standing with the government, Pastor Mumba said he could not rejoice over the problems Mutati was going through.

“I will never rejoice in the suffering of another, but all of us must learn that life is a cycle, and it’s important to ensure we invest in a good cycle. I have forgiven him,” pastor Mumba said.

Pastor Mumba said although he did not have facts over the activities from State House and the minister of Home Affairs, he believed that every Zambian had the constitutional freedom to form or belong to a political party of their choice, and that no one had the right to infringe on those rights. – Daily Revelation

All examination classes for primary and secondary schools and third year students in colleges of education will reopen on Monday 14 September 2020 as scheduled.

2) Non- examination classes under General Education

In order to give ample time for parents to prepare children in non- examination classes for primary and secondary schools as well as colleges of education, these will reopen on Monday 21 September 2020.

3) Universities and colleges under TEVET

Since the announcement for the reopening of universities and colleges was only made yesterday there may be need for parents and students and learning institutions themselves to be given ample time to prepare.

Accordingly, the reopening of universities and TEVET Institutions will take place on the Monday 28 September 2020

All authorities in institutions of learning are urged to work with health officials, parents, and the community at large to ensure that there is strict adherence to the guidelines provided by both the Ministry of Health and the Ministries in charge education.

Minister of General Education who is also acting Higher Education Minister Dr. Dennis Wanchinga at a briefing today encouraged parents to adequately prepare their children by providing them with face masks.

“Parents are also encouraged to pay school fees in full in order to facilitate for effective teaching and learning. However, in cases where parents may be experiencing financial challenges I wish to urge our learning institutions to engage parents and learners to make payment plans and accept payments in instalments. In certain instances, especially in our rural schools where cash payments may be a challenge, payments in kind should be considered so that no learners are sent away from schools.”

In order to sustain the availability of face masks, school authorities in collaboration with the parents should should work together and ensure that face masks are provided to the learners all the time.

“I also wish to direct our learning Institutions to effectively and efficiently make adequate arrangements to cover the material that was lost during the closure without compromising quality.”

The Minister said further guidance on the school calendar will be provided in due course.

Impeccable sources within the Patriotic Front have revealed that the Party is in such a shock of UPND President Hakainde Hichilema’s grandiose entry into the Northern Regions, that President Edgar Lungu may do all within his executive powers to reverse his political archrival’s fortunes, including flying Airforce Jets to flaunt pomp and splendor, as a show of force.

The President has reportedly ordered the PF Secretary General to ensure they transport carders from the entire Northern and Luapula provinces to attend his rallies. K20 million Kwacha is said to have been released for the operation. The PF have also ordered for truckloads of beers to be ferried to Lukashya and Mwansabombwe to ‘liven’ up the mood.

“President Edgar Lungu is not exactly thrilled that Hichilema stole the national limelight often reserved for Presidents during the Parliamentary State of the Nation Address, by conducting highly successful campaign meetings in Luapula Province”.

“The noisy cadres all dressed up in PF colours, most of them high on ‘something’ have been put on long columns of buses and trucks headed for Kasama and Mwansabombwe. If you have never seen money rain like hailstorm from heaven, you must see Lungu’s campaign in Mwansabombwe and Lukasya”, said the source who spoke on condition of anonymity.

Despite the vote buying and other corrupt practices by the PF on voters, social commentators however view the Northern region’s warming towards the UPND leader as problematic for the PF on many fronts.

This is because the PF ran on the narrative of the Deputy Mobilization Chairperson Geoffrey Bwalya Mwamba, who declared what he termed as ‘all Bemba speaking Provinces’ as ‘no go areas’ for the UPND President.

With Hakainde Hichilema’s triumphant entry into the North and his surging popularity, the attempted balkanization of the Northern regions by the PF appear to have crumbled and is becoming a huge embarrassment for the ruling party which has persistently painted Hichilema’s UPND Party, a regional political organisation. The PF appear to be in a post traumatic stress disorder (PTSD), as a result of the North’s outpouring of solidarity and support of Hakainde Hichilema and the UPND, many commentators may observe.-Zambia Eagle

 

Intra-party Confusion Strikes UPND As Katuka Nullifies Elections Nkombo Upheld

In what appears to be total intra-party confusion and disorganisation, UPND Secretary General Stephen Katuka has nullified newly elected executive committees for Nalikwanda constituency – an election that was initially upheld by the Committee for Elections headed by Garry Nkombo.

Citing irregularities as the reason for nullification, Katuka stated the election could not hold because of electoral malpractices.

However, sources told Daily Revelation that UPND national chairperson, who is also interim vice-president Mutale Nalumango forced Katuka to nullify the election because her preferred candidates lost.

Sources disclosed that when Nalumango realised that her preferred candidates had lost, she instructed them to petition Katuka to nullify the election, so that fresh poll could be held, where she hopes they would emerge victorious.

Sources said, Nalumango’s machinations worked as Katuka exactly yielded to her plans.

And in a letter dated September 4, 2020 addressed to the losing candidate Muzuki Masisani, who had petitioned the election, Katuka stated that he could not agree with the Elections Committee, headed by Nkombo due to perceived irregularities.

“Having looked at your petition dated 29th August 2020, which was addressed to the National Chairman, and having deliberated upon the merits of the petition, and the grounds relied upon by the Elections Committee for upholding the Nalikwanda election, the appellate body could not recognize either of the Committees for Nalikwanda Constituency due to irregularities. Arising from the foregoing, the appellate organ has resolved to nullify the elections of both committees and has directed that fresh elections be held where both committees will participate, based on the electoral college administered by the Party, in a free and fair election,” Katuka’s letter read in part.

Katuka warned those charged with the responsibility to preside over intraparty elections against interfering in the party electoral process.

In apparent reference to Felix Ngoma as one of the culprits, Katuka said Ngoma would not be allowed to supervise the next set of polls in the province.

“During this election and any other upcoming intra-party election in the lower structures, members of parliament and aspiring members of parliament are cautioned not to interfere with the electoral process,” stated Katuka’s letter which was also copied to other organs of the party. “Also note that the remaining elections in Western Province shall not be supervised by Hon. Felix Ngoma but by an appointed NMC member(s) to be communicated in due course; Mr. Ngoma will just be in attendance.”

The pope spoke on cuisine and intercourse during a series of interviews with Carlo Petrini, an Italian culinary writer and activist behind the “slow food” movement, which positions itself as the opposite of fast food and advocates a slower, more meaningful pace of life.

“Pleasure arrives directly from God,” Francis told Petrini. “It is neither Catholic, nor Christian, nor anything else. It is simply divine.”

Francis critiqued the “overzealous morality” of a Roman Catholic Church that denounced pleasure in the past, calling it a “wrong interpretation of the Christian message.”

“The church has condemned inhuman, brutish, vulgar pleasure, but has on the other hand always accepted human, simple, moral pleasure,” Francis said. “The pleasure of eating is there to keep you healthy by eating, just like sexual pleasure is there to make love more beautiful and guarantee the perpetuation of the species. … The pleasure of eating and sexual pleasure [comes] from God.”

Francis pointed to the 1987 film “Babette’s Feast,” saying it represented his ideas on pleasure. The pope has lauded the film in the past, particularly praising the actions of its protagonist, a chef who prepares an elaborate feast for members of a Protestant village.

“The most intense joys in life arise when we are able to elicit joy in others, as a foretaste of heaven,” Francis wrote in “Amoris Laetitia,” his 2016 apostolic exhortation. “We can think of the lovely scene in the film ‘Babette’s Feast,’ when the generous cook receives a grateful hug and praise: ‘Ah, how you will delight the angels!’ It is a joy and a great consolation to bring delight to others, to see them enjoying themselves. This joy, the fruit of fraternal love, is not that of the vain and self-centered, but of lovers who delight in the good of those whom they love, who give freely to them and thus bear good fruit.”

Francis’ conversations with Petrini were published in the Italian book “Terra Futura: Conversations With Pope Francis on Integral Ecology,” which was released on Wednesday and focuses on the pope’s views on culture, community and environmentalism.

Francis was “simply repeating the perennial Christian message on virtue and vice,” Catholic commentator Peter Williams told Newsweek in reference to the pope’s remarks on sex and food.

“By avoiding the twin evil extremes of repressive puritanism on the one hand and immoral libertinism on the other, both of which prevent or destroy happy enjoyment of good things like food or sex, the church rightly espouses the ‘golden mean,’” Williams told Newsweek.

Why Nawakwi and Tilyenji should give way to fresh legs in 2021

THE United National Independence Party (UNIP), Movement for Multiparty Democracy (MMD), United Party for National Development (UPND), Forum for Democracy and Development (FDD) and the Patriotic Front (PF) are Zambia’s oldest political parties (in that order) from the pack of parties that have been competing for power in the last 20 years.

And Tilyenji Kaunda of UNIP and Edith Nawakwi of FDD are the longest serving opposition leaders, having been at the helm of their parties since 2001 and 2005, respectively. The political fortunes of the PF and UPND have been on the rise in the last 10 years to the extent that PF is now in power and UPND as its closest and fiercest rival. MMD ruled until 2011.

The opposite can be said about UNIP and FDD. They are parties that have progressively been on the downhill with miserable performances during the last four elections. Collectively, their leaders – Tilyenji, son of first Republican president Dr Kenneth Kaunda, and Nawakwi – amassed a paltry 33,077 votes during the 2016 general elections. Contrast to 1,860,877 votes polled by Edgar Lungu of the PF and 1,760,347 for Hakainde Hichilema of the UPND.

Going by their downward fortunes and miserable performances in four presidential elections in succession, it can be logically argued that it is time Tilyenji and Nawakwi gave chance to new and emerging political opportunists to try their luck in the already crowded presidential field.

In this article, I highlight the dwindling political fortunes of the FDD and UNIP and their presidential candidates to buttress the argument. Some observers say that Nawakwi’s recent attacks on fellow opposition leader Hakainde Hichilema are her strategy to repackage herself for the attention of other takers, especially the PF. However, I will stick to my lane as a researcher: numbers. They say, “numbers don’t lie.”

It can also be argued that MMD’s Nevers Mumba has likewise miserably failed two elections (2015 and 2016). To his favour, a counter argument can be proffered that on both occasions he had internal detractors in Rupiah Banda in 2015 and Felix Mutati in 2016. So, 2021 will be the first time he will enter the race with a united (whatever is left of) MMD. I agree 100 per cent.

UNIP is Zambia’s oldest surviving political party. I say surviving because the oldest political party in the history of this country was the African National Congress (ANC), which closed shop after the signing of the unity accord in 1972. The accord heralded the one-party participatory ‘democracy’. UNIP is also the oldest existing opposition party and Tilyenji is the longest serving opposition leader, having been at the helm since 2001, following the death of Francis Nkhoma.
UNIP governed the country from 1964 to 1991 and Kaunda had been at its helm since its founding in 1960. It ceded power in 1991 to the newly launched MMD, whose candidate Frederick Chiluba polled a whopping 76 percent to Kaunda’s 24 percent. The MMD won 125 of the 150 elected seats in the National Assembly. Eighteen of UNIP’s 25 were in the Eastern Province where the party retained all the seats. The result effectively consigned UNIP as a regional party and reconfirmed the Eastern Province as the most conservative, having done the same in 1963.

Kaunda stepped down as president of UNIP in 1992, following the party’s famous Namayani congress during which Kebby Sililo Kambu Musokotwane was elected president of the party, with Kaunda’s support. In 1993 Musokotwane and Kaunda differed after the former admitted that a radical faction of the party was conspiring to topple the new government of Chiluba. Kaunda and UNIP viewed this as a betrayal of the party and its ‘comrades’. For the next two years Musokotwane led a shaky and divided UNIP such that when Kaunda announced plans for a political comeback, Musokotwane was shunned by Kaunda’s loyalists and party elders. He was forced to step down in 1993 as Kaunda retook the leadership with Chief Inyambo Yeta as his vice, when the logical thing would have been for him to support another young leader. Kaunda was hoping to bounce back to power during the 1996 election. Big mistake.

Sensing ‘danger’, ‘political engineer’ Chiluba used MMD’s overwhelming majority in parliament, in May 1996, to push through controversial constitutional amendments, specifically the parentage clause and the provision that prohibited traditional chiefs from participating in active politics. The parentage clause effectively eliminated Kaunda, whose parents hailed from Nyasaland (Malawi), from the 1996 general elections. Yeta was equally also barred by the traditional leaders’ clause. As a result, UNIP boycotted the elections, allowing Chiluba to be easily re-elected with 73 percent of the vote. This was a tactical miscalculation on UNIP’s part as it allowed MMD, which did not win a single seat in the Eastern province in 1991, to enter its ‘bedroom’ unchallenged.

As Elias Munshya writes, “With the loss of that Eastern region came the rapid fall of a party that once led Zambia into independence. Ironically, the same man who built UNIP to its climax in the 1960s also presided over its downfall in the 1990s. With that 1996 boycott, Kenneth Kaunda hammered the last nail in UNIP’s coffin.”

The party returned to contest the 2001 elections with Tilyenji as its presidential candidate; he received 10 percent of the vote, finishing fourth out of the eleven candidates. In the National Assembly, the party won 13 seats, majority in the Eastern Province, and 10.6 percent of the popular vote. That was the last time it ever had seats in Parliament as a single entity.

Prior to the 2006 elections the party joined the United Democratic Alliance alongside the other two largest opposition parties, FDD and UPND. Hakainde Hichilema of the UPND was the alliance’s presidential candidate, finishing third with 25 percent of the vote. The alliance won just 26 seats in the National Assembly. The vast majority were contributed by UPND, with UNIP contributing only Mkhondo Lungu of Lundazi.

Tilyenji and UNIP did not contest the 2008 presidential by-election, but he was nominated as UNIP’s presidential candidate for the 2011 elections. Since then, Tilyenji has contested the Republican presidency three times (2011, 2015 and 2016) but each time losing miserably with less than one percent of the total vote (0.36% in 2011; 0.58% in 2015; and 0.24% in 2016). In both 2011 and 2016, UNIP failed to win a single seat in the National Assembly.

With these dwindling fortunes, Tilyenji’s continued participation in elections cannot be justifiable anymore. What is worse, the party does not seem to be in politics for the business of politics. Tilyenji and UNIP are hardly heard commenting on national matters in between elections. Analysts have argued that UNIP exists simply for the sake of its business interests that its leaders hold under Zambia National Holdings Limited. That explains the current court wrangles between 11 members and four of Tilyenji’s cohorts over lack of intraparty elections since 2005 and alleged sale of named party assets without membership approvals.

Nawakwi and her FDD are in the same place as UNIP and barely racing for relevance amid declining political fortunes and miserable performances over the last series of elections. The FDD was founded in 2001 by former MMD members disaffected by Chiluba’s efforts to change the constitution to allow him to stand for a third term. In the 2001 general elections it nominated Christon Tembo as its presidential candidate; Tembo finished third in a field of 11 candidates with 13 percent of the vote. In the National Assembly elections the party won 12 seats. The FDD remarkably took control of Lusaka council between 2001 and 2006.

Nawakwi took over the FDD in 2005 after Tembo left politics. However, in 2006 the government de-registered the FDD on the grounds that it had failed to submit an annual report. The FDD subsequently joined the UDA, which put forward UPND’s Hichilema as its presidential candidate for the 2006 general elections. As reported earlier, the UDA and Hichilema finished third with 26 seats in the National Assembly. The FDD contributed only three seats.

The FDD did not nominate a candidate for the 2008 presidential by-election, but put forward Nawakwi for the 2011 general elections. She received 0.2 percent of the vote, finishing seventh out of the nine candidates. The party won a single seat in the National Assembly, Chifumu Banda in Chasefu. Nawakwi ran for the presidency again in the 2015 presidential by-election, finishing third with 0.9 percent of the vote. She ran again for the presidency at the 2016 general election where she came third, receiving a total of 24,149 votes. Nawakwi’s vote translates to 2,415 votes per province and 161 per constituency. The FDD currently holds one seat in the National Assembly. Surely the writing is on the wall, madam Nawakwi (my former boss at agriculture). Please read!

Time is ripe for change…LUNGU PAVE WAY…this is a passionate call – Chisala

EVERYTHING has its time to exit and it is time for the PF and President Edgar Lungu to pave way for others, says All Nations Church overseer Bishop Timothy Chisala.

Bishop Chisala said it does not need an economist or a man of God to explain that Zambians are suffering due to a collapsed economy.

On Monday, in his reflections on the economy, Socialist Party president Fred M’membe observed that the Zambian economy has collapsed but “our rulers want to pretend that all is well and it is business as usual.”

“They don’t even want to talk about it. They are occupying themselves with petty things that really don’t matter. They can try to evade this reality, but they will not be able to evade the consequences of evading this reality,” said Dr M’membe. “They are busy trying to crush their opponents “like a tonne of bricks”. But a sensible leader is not motivated by the desire to annihilate opponents, but by the desire to solve problems and make life better for his people. It’s very clear that our rulers are failing to reason, to think. Probably we are expecting too much from them. Reason is not automatic. And those who deny it cannot be conquered by it. We shouldn’t count on them to address this problem and make things better… We have no alternative but to push them aside and usher in a new leadership – a revolutionary leadership – next year.”

In an interview over the SP observations, Bishop Chisala said Zambia had no leadership in government that can redeem the people from the shackles of poverty.

“We have a crisis in the country but leadership is overlooking this. It is business as usual so long a few within the corridors of power are eating. The gap between the haves and the have-nots is so alarming. But everything has its time to exit and it is time for the PF and President Edgar Lungu to pave way for others. This is a passionate call,” he said. “We say this without any malice, but when things are not working out, we better say it. Let me agree with Bishop John Mambo that the clergy have failed the people because of a few pieces of silver.”

Bishop Chisala said the selfishness of some clergy was seen when they lined up to ask for “empowerment” instead of speaking for the people.

“In no way am I criticising the clergy, but some things we just have to say them as they are. Look, if the clergy can line up and ask for empowerment because of hunger, then what is the situation with that woman in Nkwazi? This is time the clergy need to speak out and say things are bad for the people. Put the interest of the people first,” he urged. “So some people have decided not to see that people are suffering. The suffering of the people has nothing to do with them. Time is ripe for change. Vote for leaders that will put the interest of the people first. Evil is when leaders decided to close their eyes and ears to the sufferings of the people.”

Bishop Chisala said it was shocking that government leaders can have the energy to kneel before people asking for their votes.

He said people should not resist change next year.

“I was shocked to see [justice] minister Given Lubinda kneeling down asking for votes. I said ‘God have mercy on this man. He can kneel to us for votes when he was busy ignoring pensioners that were gathering at his office, even getting soaked by the rains!’ It is a sorry sight to have such leaders that will do anything to remain in power just for selfishness interests,” Bishop Chisala said.

He said arrogance was at play in PF government leaders because they can dish out money.

“Money is not everything. Even if they dish money to try to silence the opponents, it will not work, because time is up,” said Bishop Chisala.

Zambians will fight for independence from ‘local colonialists’ – Jonas Shakafuswa

FORMER Katuba member of parliament Jonas Shakafuswa is distraught that the Zambia Police is today an extension wing of the PF.

He is also disappointed that today, one’s tribe is a prescription for discrimination.

Shakafuswa posted his views on his personal Facebook account on Wednesday.

He started by saying democracy had a lot of challenges and that it was not a game for the weak.

“You have to be magnanimous to lead the people in a democracy. Only those with the heart of leadership should qualify to lead,” Shakafuswa said, adding that today dissenting was misconstrued to be enmity with the country.

He added that men and women who expect the best for Zambia are being stripped of their rights by foolish policing by the Zambia Police on partisan lines.

“Today police force does not belong to the people of Zambia, but it is an extension of PF. Today if you disagree it means you get sanctions from the government,” he said. “Today dissent denies you the benefit of enjoying the fruits of our own country.”

Shakafuswa said today one had to agree to: “even with the most foolish things” for them to earn an appointment or to keep their job.

He said today dissent made one to be an alien or refugee in their own country: “with no rights whatsoever.”

“Today you can’t have business with government because you are against the many ills of PF. Today all Zambians should behave like idiots and look the other way when their country is degenerating,” Shakafuswa lamented. “Today your tribe is a prescription of discrimination. Today their tribe is a means by which they claim all the wealth and positions in this country.”

He wondered if the rest of Zambians have to be unpatriotic and allow the country to get to its knees for them to be called Zambians.

Shakafuswa further asked what happened to the call of unity in diversity, a catchphrase that practically: “brought us together when we fought the one party state”.

He, however, said Zambia would rise above the current mediocrity.

“We will fight for the second independence from our local colonialist. Yes, the day has come for every Zambian to be recognised and enjoy the fruits of our independence, the fruits of multiparty democracy,” Shakafuswa said. “Let us not be downtrodden by little dictators who want their evil will to divide this country to be the order of the day. They are very little scared people. To them the use of force shows strength. No! It shows they are scared little men.”

Shakafuswa stressed that in life bullies have always been weak at heart.

He said the day had come for the emancipation of Zambia.

“Countrymen, let us rise above our region. Let us rise above our tribe. Let us rise above partisan interests. Partisan interest has restricted our resolve to move this country forward,” Shakafuswa noted. “Let us claim back our country. Let us fight for our independence. Yes, the second independence. Identify yourself as a Zambian.”

He indicated that only Zambians themselves could liberate the country for posterity.

“…Be proud because Zambia can rise again. We have the people who, given the right environment to work, can take this country to greater heights. God bless Zambia,” said Shakafuswa.

Zambians are fed up with PF govt – Nzala

ZAMBIANS have already made up their minds that they are fed up with the PF and they will vote for the opposition, says Clinton Nzala.

Nzala, who served as Southern Province Socialist Party coordinator but is now based in Venezuela, says the PF should give answers to the corruption allegations levelled against government officials.

In an interview, Nzala said it tells a lot to see ZNBC Television now giving airtime to FDD president Edith Nawakwi to attack UPND leader Hichilema without giving him the right to reply.

“What we see in Zambia is what is happening in Latin America…governments in power use allegations against political opponents as a means of getting them out of the race. We saw it happen in Brazil when the right wing came up with all sorts of allegations against [Inacio] Lula da Silva whose approval ratings were at 90 per cent and was arrested and remained in pre-trial detention up to the time of elections…. (Brazilian President Jair) Bolsonaro got advantage of this to win and this is what we see in Zambia,” he said. “But they need to understand that this is not between PF and the UPND leader. Even if Hakainde Hichilema is removed from the ballot, Zambians have made up their minds that they are fed up with this government, so they will still rally behind another candidate who will be put up by the opposition because they believe that this government has lamentably failed. They have mismanaged the country. We have reached levels which a few years ago were unimaginable.”

Nzala said in 2013 no Zambian ever thought of waking up to see a US $1 trading at K20.

He warned Zambians that what they are now hearing or seeing is just the beginning as the PF would come up with several schemes against the opposition.

Nzala said when government institutions are abused, law and order is affected.

“It is sad that Dora Siliya could react that fast because this makes citizens lose confidence in public institutions and forces them to take the law in their own hands…this is a danger to strong democratic processes. We have a duty to protect public institutions from being used to fight individuals,” Nzala said.

He said if there were wrongs done during the privatisation process, Zambians need to get answers.

“But how do they ignore the ongoing corruption? We have had reports,” said Nzala.

Elections can build or break our nation, warns Nshindano

THE Electoral Commission of Zambia has implored journalists to provide accurate information on the electoral process, for elections can build or break the country.

Electoral Commission of Zambia (ECZ) chief elections officer Patrick Nshindano updated journalists on the voter registration and the electoral process at the Commission’s offices in Lusaka, yesterday.

He ended his briefing by thanking media personnel for the role they continue to play in Zambia’s electoral process.

“[I] encourage you to provide accurate information as elections can build or break our nation,” Nshindano said.

Earlier, Nshindano indicated that the ECZ was happy to note that the Department of National Registration, Passport and Citizenship (DNRPC) had intensified the issuance of national registration cards (NRCs) to citizens throughout the country.

He is confident the exercise would enable more eligible Zambians to acquire NRCs and that such people would be able to register as voters.

The second phase of issuing NRCs was scheduled to begin in Central, Muchinga, Southern, Lusaka and Western provinces on September 1, 2020.

But home affairs minister and Shiwang’andu PF member of parliament Stephen Kampyongo announced a postponement of the process, two days before its start.

“The Commission has also noted that the DNRPC has extended the period of the mobile issuance of NRCs by 10 days from 10th September, 2020 to 19th September 2020 in the first phase and the second phase will run for 40 days from 20th September, 2020 to 30th October, 2020,” Nshindano noted. “To ensure that no one who has obtained an NRC is disenfranchised, the Commission has been prompted to reschedule the dates for the registration of voters.”

He also disclosed that the mobile voter registration exercise which was scheduled to commence on October 19, 2020 to November 20, 2020, would now be conducted from October 28, 2020 to November 30, 2020, “to accommodate eligible citizens who would have obtained their NRCs.”

“This further puts pressure on the already tight election calendar that the Commission is working with and is confident that DNRPC will be able to conclude as scheduled,” Nshindano said. “It should be noted that should there be any further adjustment in the issuance of NRCs, the Commission will, however, not be able to adjust the start date again, due to legally binding dates, especially the constitutionally enshrined date for the general elections, which 12th August, 2020.”

On the online pre-registration exercise, Nshindano said the dates for the same remained unchanged.

“The online pre-registration will still commence on 21st September, 2020 to 6 November, 2020. This implies that the pre-online voter registration exercise will run for a total period of 46 days,” he noted.

Nshindano reiterated that while the ECZ would retain the current registered voters, such was conditional.

The condition is that those who are already registered as voters should still present themselves for verification, update and capture of additional information required, including biometric capture (10 fingerprints and portrait).

TI-Z STATEMENT ON THE 2019 TRENDS ANALYSIS REPORT BY THE FINANCIAL INTELLIGENCE CENTRE =================================================================================
Transparency International Zambia, has taken some time to critically review the 6th Money Laundering and Terrorist Financing Trends Report for the year 2019 released on 2 September 2020. This report was much anticipated by the general public for several reasons. Firstly, the Financial Intelligence Centre has in its short period of existence, earned public trust and confidence for the work that it has done. Secondly, the FIC in its 2018 Trends Analysis Report, raised a number of pertinent issues which were a cause for public concern and there was anxiety to find out if the trends of the past have continued and what progress if any has been made to attend to some of the predicate offences for money laundering such as corruption. The third reason why the FIC Report for 2019 was long awaited, wasthe negative reaction and incessant attacks made on the FIC and its leadership by the PF government and as a public, we wanted to assess whether the FIC has remained resolute in the discharge of its functions or it has been captured by those who vehemently opposed its 2018 report. Our general conclusion is that the 2019 FIC Trends Analysis report is the antithesis of everything that the FIC has stood for in the recent past. This document pales in comparison with recent reports in both substance and quality, it is essentially a Public relations document of peripheral value to any serious efforts to combat the high levels of corruption that this country is grappling with. One can only deduce that the political pressure of the recent past has come to bear on the FIC. We wish to demonstrate why we make this conclusion.

1. Coverage of cases

The FIC for the 2019 report, received 790 reports comprising 748 Suspicious Transaction Reports (STRs) and 42 Spontaneous Disclosure Reports. Significantly, of Suspicious Transaction Reports received in 2019, the FIC only analysed 101 reports and out of which 44 were disseminated to Law Enforcement Agencies and 57 were closed as there were no reasonable grounds for dissemination. This is a very sad development because essentially, FIC only analysed 14% of the reports received compared to 24% in 2018. It is therefore incorrect for anyone to infer that Zambia has performed well because of the drop in suspected losses from STRs now valued at K984 million from the 44 intelligence reports. What is true is that the suspected losses from STRs could probably have been higher if FIC had even analysed even 50% of the 748 STRs it received. 2 We note with concern the reasons for this reduction in the number and value of intelligence reports analysed, namely unpredictable funding which adversely affected the FIC’s ability to verify STRs and SDRs. We would have wanted to know the reasons for this unpredictable funding- was this deliberately designed to cripple the efforts of FIC, following the firestorm that the 2018 report raised? What this means is that it is possible that from the many STRs not verified, some of these could potentially be ripe for further consideration by Law Enforcement Agencies. What is further alarming is the admission by FIC that most of the 44 intelligence reports disseminated to Law Enforcement Agencies, were related more to individuals than corporates which usually have higher values. The question is was this a deliberate move on the part of FIC to focus on STRs related to individuals rather than corporates? Could this be that corporates which were previously captured in this analysis, are the conduits of choice for Politically Exposed Persons who set up shell corporate vehicles and trusts? We are left to ask, how was the decision arrived at to focus on 101 reports of mostly related to individuals and leave out corporate which could have higher values of suspected losses? This decision to focus on low value transactions, certainly raises eyebrows.

2. Changes in methodology and presentation

The 2019 Report has departed from the style and format of the 2018 report and this makes it difficult to make year on year comparisons of the progress made or lack of it, in addressing various issues of concern. In the 2018 Report, the FIC analysed in detail the STR trends by predicate offence and on Corruption, the FIC identified a number of corruption drivers including in public procurement, use of shell corporate vehicles and trusts, use of gatekeepers, use of nominees, and ineffective controls in public institutions. FIC made special mention of the awarding of public contracts to companies not registered under PACRA and mostly owned by Politically Exposed Persons. The FIC in 2018 made a number of recommendations to address some of these drivers of corruption. The 2019 does not provide this breakdown of the drivers of predicate offense and it is difficult therefore to appreciate whether this omission of details is as a result of Government implementing the 2018 recommendations or not. What has happened in the intervening year for us not to see the use of nominees as a driver of corruption, for instance? Does it mean the use of shell corporate vehicles and trusts has reduced? Are we now effectively enforcing the requirements of the law on disclosure of beneficial ownership? It is our considered view that the 2019 report misses an important piece on informing the public what measures Government has taken following the 2018 report. This makes it difficult to build any meaningful trends in the matters handled by FIC.

3. Lack of follow up on the FIC and other Government reports

The 2019 FIC Report raises some issues of concern which have been raised by the Auditor General, Parliamentary committees, Civil Society, cooperating partners, professional bodies among others. What is evident is that we are not making progress as a country in resolving a number of these issues. For instance, FIC mentions that Government continues to lose funds meant for the provisions of public goods and services due to corruption. This is a position that the Auditor General frequently alludes to and as TI Zambia we have continued to raise alarm on the inadequacies of the public procurement and we have showcased incidents like the US$17 million contract made to Honeybee even when this company did not 3 qualify and yet Government has done nothing to address these losses arising from public procurement. We are all painfully aware that because of political patronage some of the contracts are awarded to ill qualified suppliers and contractors, who are basically members of the ruling party. This trend continues unabated and we will see more of this as we head towards the 2021 elections. It is a known fact that individuals (including some serving senior members of government) use their positions in public institutions to influence the awarding of contracts to companies in exchange for gratification in the form of cash, real estate and motor vehicles. Similarly, FIC highlights a problem of old – the single sourcing of projects which are non competitive- this is a perennial story which will not go away soon. As TI Zambia, we have previously highlighted how suspected corrupt individuals in government have stopped receiving gratification through banks for fear of detection by Banks and the FIC, and therefore these individuals are asking contractors or suppliers to pay directly for the purchase of real estate, or purchase of building materials or motor vehicles. There is also a new trend of investing in luxury goods like expensive watches, jewellery, art work among others. We have also highlighted allegations made that some of the individuals in public institutions are keeping huge amounts of cash in their homes as a way of circumventing detection by Law Enforcement Agencies. If indeed we were a serious nation and we wanted to rid this country of corruption, our Law Enforcement Agencies should have followed up on these leads. What is the added value of FIC raising similar issues when Government and its leadership are simply not interested or have neglected to do anything about all these revelations? We are spending scare public resources to raise similar issues by different government entities. This is the same government which has refused to undertake Lifestyle Audits for elected leaders and senior government officials who could be some of the individuals referred to in this FIC report.

4. Ongoing Mukula Tree Saga

The 2019 FIC Report notes that some Suspicious Transaction Reports related to environmental crimes particularly the illegal harvest, transportation and export of the prohibited rosewood popularly known as mukula. FIC notes that funds generated from the sale of the prohibited tree were declared to financial institutions as proceeds from sale of timber. We note that in 2018, the FIC received Suspicious Transaction Reports (STRs) related to timber valued at ZMW 2,156,000. Many of the individuals in the illegal trade of Mukula established other businesses through which these proceeds were laundered. Our concern as TI Zambia is that this issue of mukula production is not new and Government has not handled the illegality surrounding mukula in an appropriate manner and it is clear that there is a lot money laundering linked to this trade. We want to remind the Zambian people of two previous reports on Mukula trade which have not received active attention from Government,- firstly the 2019 Mukula Cartel report by the Environmental Investigation Agency which alleged that mukula continues to be trafficked despite the outcry of the Zambian public and that the sale of this natural resource was allegedly benefitting only a few people.

Secondly, the 2018 Report on Mukula trade between China and Zambia, by the Centre for International Forestry Research, which highlighted that recent mukula production in Zambia could have amounted to about 110,000 m3 per annum, with revenue losses of about USD 3.2 million and bribes paid to state officials of about USD 1.7 million. This CIFOR Report also highlighted that what leaves Zambia as sawnwood seems to arrive in China as logs – “It seems clear that mukula, which is largely exported in logs, often gets declared as sawnwood at departure to comply with the legal framework, as a log-export ban remains in force in Zambia”. Finally, this report made a serious finding of discrepancies in declarations both in volume and value. For example, in 2016, Zambia declared to have exported about 3,000 m3 mukula for an approximate value of USD 900,000, while China declared imports of about 61,000 m3 for an approximate value of USD 87 million. FIC reporting on mukula trade today, while important, does not change the sad reality that as a nation, we are aware of unscrupulous activities related to this trade and we have done nothing about it. Most likely the 2020 Trends Analysis report will bring out similar concerns and in typical Zambian fashion, this will not move the people to realise the magnitude of the loss of vital natural resources which only end up benefitting a few.

In conclusion, we want to warn that the FIC Trends Analysis report risks becoming a non-event and one of the many valueless reports produced by Government, which are all intended to give a mimicry of a functioning government. Public trust in such institutions like FIC is important and we have seen how the work of important institutions like the ACC is being undermined because poor public perception. FIC Management and the Board, can make a decision to work for those in power or for the people they serve and whatever decision they make, they should live with the full consequences now and in the future.
