I have been following with a heavy heart of course the efforts by the Patriotic Front to remain in power using divide and rule formulas.


The Patriotic Front came into power in 2011 on pretext that it was a pro-poor party. They promised to uplift the lives of the poor people in the country through job creation, lower taxes and more money for the poor. Just after assuming power we saw the opposite happening. PF started by removing subsidies on a number of commodities causing the cost of doing business to go high. But they managed to convince the people that monies saved from subsidies would go a long way in developing the country. We didn’t know that by ‘country’ they meant PF officials and their friends. To date we don’t know where the funds being saved from subsidies go.


The PF did not end there. They went on to acquire huge loans in the name of euro bonds. They promised to invest these loans in ZESCO and Zambia railways among other sectors so as to improve efficiency and service delivery. Did that happen? Have operations at ZESCO improved? No. In fact ZESCO has become worse than before. Citizens are now experiencing long hours of load shedding and frequent power outages. Most parts of the country still have no access to electricity. Small businesses have have collapsed as a result of this. The poor people have become more poorer. PF has failed to fulfill it’s promises. Where did the money from the euro bonds go? In the pockets of PF officials and their friends. Go round the country see how they are building everywhere. Boot licking ministers who never owned a wheelbarrow today they can afford to buy a hat from the president worth K200,000. Go and check at the files at the anti corruption office, it’s all about government officials facing charges involving millions of dollars. That answers you where the euro bond went.


Time for repayment of loans has come but the government has no money because they did not invest the funds wisely. Now they go back to poor people who they forgot when they were stealing asking them now to pay back the loans. People are forced to pay back loans through high taxes, high fuel prices and high electricity tariffs. The poor people are now paying for the loans that were shared by PF criminals. This has angered citizens who had so much expectations. From lower taxes to higher taxes. From promising more jobs now they’re promising to take citizens to the Middle East as slaves.


As 2021 elections approach, PF has nothing to tell or promise the people. They have nothing to show for the 10years of being in power apart from their mansions and big cars while the people are dying of hunger. Realizing that they have lost political fortunes, the PF has now resorted to dirty politics just like the MMD did before 2011. PF has resorted to politics of violence, fake propaganda and tribalism.


The Patriotic Front is so convinced that if they can divide this nation through tribal hatred and divisions then they can retain power. Their plan is to infuse fear in our people that UPND will neglect other tribes when they form government. Total lie. PF using money hungry boys in their media department is trying by all means to reduce our politics to tribe wars. PF is no longer a political party but a traditional grouping which seeks to take our country back to the days of shaka.


But will tribalism save PF in 2021? Absolutely not. The people of Zambia have passed through that stage of buying cheap propaganda from small boys and girls. The Zambian people rejected dirty politics of lies, slender and tribalism in 2011 and they will still do that in 2021. The Zambians will not trade their much cherished peace just to retain criminals in power. UPND has attained the character of a national party through hard work and shall not allow criminals who want to continue stealing to dent our name. UPND and Hakainde Hichilema respects everyone in this country and when in office will not discriminate anyone. We shall respect all traditional leadership whether they believe in us or not.

We appeal to our members to avoid being lured into tribal battles by toilet papers masquerading as newspapers. We must remain focused, we have come a long way to be where we are. Avoid attacking our traditional leadership because of fake propaganda. Personally I have respect for Mwinilubemba whether he believes in UPND or not and I will be visiting him soon to assure him that will always respect tradition. I pledge to use everything within my means to crush the fake propaganda and propel my President Hakainde Hichilema to victory.

Lusaka Mayor Comments On Altercation Between Matero MP And Councillor

Mayor of Lusaka City Miles Sampa has told Matero member of parliament Lloyd Kazhiya that he is mandated by law to lodge a formal complaint with the Minister of Local Government and Housing who has constitutional powers to reverse any decision made by any Council in Zambia except it has to be 6 months after that decision is made.

Mr Sampa’s advice follows a verbal altercation recorded on video between Mr Kazhiya and councillor Annie Chinyanta of Matero over a piece of land which the full council is said to have approved.

But the area MP was unaware of the development, which led Ms Chinyanta to tell Mr Kazhiya that he was not on the ground after he attempted to stop some development.

At that point, Mr Kazhiya called Ms Chinyanta a “useless councillor”, to which she also retorted “you’re a useless MP”.

Below is Mr Sampa’s statement posted on his Facebook page this morning:

The video circulating out of Matero between the area MP and Ward 28 area Councillor makes sad viewing.For all intents and purposes I should ideally declare interest and not comment on the matter.I however have inescapable duty as Mayor of Lusaka to intervene and guide on matters to do with land in the City.

My informed take on the matter after brief research since the video surfaced is that the said piece of land was dully processed at the Council after the resident applied for it.Land acquisition or extension process entails that a Committee called Planning which has 8 Coucillors seat to approve or reject any application available.In coming up with that decision,they tour the plot in question to ensure the same is not a road reserve, has water and or power lines.

Most are rejected at this stage but if found to have no incumberances, the application is recommended to the Full Council Meeting of Councillors for final approval.

I have been guided that the issue that led to the altercation yesterday between MP Kazhiya and Councilor Ann Chinyanta is about a temporal authorisation to a Matero resident to place a Container on some piece of land for business purposes.The MP is against for whatever reason.

After the 2016 amended Constitution, at no point in the process is the Area MP meant to be involved. Out of courtesy however, I have made it a point at LCC and encouraged all Councillors that for any land issue, we first consult area MPs before processing.This works well in various Constituencies especially where a good working relationship has been cultivated between a particular Councillor and area MP. Clearly non such rapport has been cultivated in the video in question.

So there is no legal backing in an area MP going to harass a resident who has been offered any land relief or temperol placement of a Container by a Full Council.

Do MPs have a recourse if they are not happy on a piece of land deliberated on by the Full Council and offered to a resident in their Contstituency? Yes they do.They can lodge a formal complaint with the Minister of Local Government & Housing who has constitutional powers to reverse any decision made by any Council in Zambia except it has to be 6 months after that decision is made. The current Constitution does not give powers to anyone and not even Councillors themselves to be able to amend or reverse a decision made by Councillors in their Full Council meeting if said decision is not older than 6 months.

We have a recent case at LCC from Kamulanga ward of Kabwata where the Minister of Local Government & Housing Hon Charles Banda has formally (in writing) reversed a decision made by LCC in 2017 (before I assumed office) after residents that includes Hon Mwansa Mbulakulima formally complained to the Minister’s office that said plots were created in a road reserve.The Minister accordingly found it fit to reverse the LCC decision and more so that it was 6 months later. The Council can appeal to the Minister but he is at liberty to hold or rescind his own decision.

So in the case of the Matero MP Hon Lloyd Kazhiya, he is well guided to formally complain to the Local Government & Housing Minister Hon Charles Banda on his reservation on said plot. “Knuckle” engagement with our Councillor will not yield to anything in his favour even if he arrived with more state police as this is not a criminal but an inter institutional (Local Government & National Assembly) matter.

I guide him accordingly with a Bemba proverb . ” Ubufumu buchindika ubwine” (A leader is made and respected by people that made him or her a leader).The MP needs to respect his Councillors that he arguably made and the Councillor also needs to respect her area MP she too contributed in raising to the helm.

In my time as Matero MP (2011-2016), I was part of LCC and attended all Council meetings. I was therefore privy to all Councillors Decisions. Post 2016 amended Constitution, it means the Matero MP has never attended any Council Meeting and hence not part of or privy to decisions made by LCC guess in the interest of autonomous local government operations.

Unless Bill 10 is enacted (the process he is in a position to influence) that will bring MPs back to Councils, the Matero MP Hon Kazhiya is well advised not to constantly step on his Councillor’s feet especially in the course of her duty.
Out of Kasama comes another saying, ” nakaNyelele ngawakapampamina, nako kalasuma” (even ants bite if stepped on for a long time) .

When and if Hon Kazhiya insists on turning himself into a Lusaka Mayor like he did yesterday, we are guaranteed another baskop(free action movie) sooner as seen in the video which unfortunately only serves to bring both leaders and the institutions (Council & Parliament) they represent into disrepute.

SUNDAY CHANDA AND RICHARD SAKALA’S PLANS TO CAUSE ETHNIC WAR

Daily Nation proprietor Richard Sakala and PF Media Director Sunday Chanda have been tasked to drive a serious but dangerous tribal agenda where a picture will be painted that UPND hates Paramount Chief Chitimukulu of the Bemba speaking people.

In a meeting held last week on 16th July 2020 at the Daily Nation offices in the industrial area, PF through Sunday Chanda and Richard Sakala resolved to push this line so that the UPND President Hakainde Hichilema or other UPND officials can be dragged in the debate and respond.

“This is a well orchestrated agenda and being supported by other senior PF officials with a view to slow the UPND momentum gained in the Northern zones. You know that once the chief has already been installed and recognised by government, nobody can dethrone him/her. All previous presidents have had issues with some chiefs, but nobody dethroned them. Remember even late President Michael Sata had issues with chiefs like Jumbe in Eastern Province. At one time Sata revealed that he knew what Chief Jumbe was plotting, but did he dethrone him? Remember how Chief Mwata Kazembe was at one time even whipping PF supporters in his areas, but did any regime dethrone him?

There are many examples. If anything, it is even the UPND President Mr. Hichilema and his officials who fought hard to have the current Chitimukulu recognised and be installed. At that time Edgar Lungu as Home Affairs Minister then deployed battalions of police officers to block ba Sosala from ascending to the throne. How can they today even think of now dethroning him after such a fight?”, sources wondered.

In the PF circles, it’s generally agreed that they have no more messeges to tell Zambians and time is running out.

According to some insiders close to this scheme, the feeling is that the many youths that have been given NRCs in the Northern zones should be driven into tribal hatred against the UPND because the UPND messages so far resonates well with the youth. The PF fears that the issuing of NRCs is actually working against them as there are reports that the majority of new youth voters are bent on voting for the UPND.

“The plan is to drag the UPND President Hakainde Hichilema into tribal response and hope he can make a mistake which Sunday Chanda and other PF surrogates can capitalise on. You will see more of such tribal stories in the Daily Nation most of them written by Sunday Chanda himself even quoting fictitious characters then following day Sunday Chanda will be writing press statements condemning. For example the alleged scheme by HH is unknown other than that it is just a plot. The report has failed to offer details of how the UPND leader is going to carry out the mission.

There’s a lot of fear and desperation in the PF camp. They have no messeges for the masses anymore due to economic hardships. Hence the tramp card now is to push the tribal narrative for their selfish reasons. UPND members should equally open their eyes as they comment on this issue. They will fall in the Richard Sakala and Sunday Chanda tribal trap”, revealed a source close to the scheme.

Richard Sakala and his Daily Nation has been particularly picked in this agenda because of his fear for another jail. In the run up to the 2016 elections, Sakala was heavily funded by State House through dismissed Edgar Lungu’s Press Aide Amos Chanda.

Even the Daily Nation news delivery vehicles were bought by State House though Sakala has now personalised most of them into his private business of fish ponds in Lusaka West and Siavonga.

As of now, the Daily Nation is being distributed using government media vehicles such as the Zambia Daily Mail which is another crime.

And to make sure they push this tribal agenda, Daily Nation has been funded to increase circulation even if it’s not making any profits and being bought but it will be given freely to citizens especially in the Northern zones. The Daily Nation is already heavily funded by State House that’s why it’s electronic version is readily available early in the morning to anyone even without any subscriptions by readers.

“The panic in the PF camp is real. You know the latter rains that can even destroy crops as is it goes? They can even burn the country in their quest to remain in power or for everyone to loss out”, sources close to the scheme revealed.

This is PF’s umpteenth time to accuse HH of some plot to over throw someone or something and usually the efforts have come to nought. During the 2017 market infernos that gutted several trading places across the Republic, Hichilema was accused of being responsible inorder to make Zambia ungovernable.

And recently in a series of bizarre gassing that left hundreds of citizens dead around Zambia, the government through various senior officials pointed their fingers at Hichilema, and as usual without any evidence. The Chitimukulugate is perhaps the most dangerous scheme to inflame passionate ethnic outrage hate against HH, UPND and tragically against the Tonga people.

Sunday Chanda, the Daily Nation and surrogate on line media have lined up a group of individuals to issue a series of commentaries inorder to push the agenda into momentum.

President Sata Wanted To Arrest Me And Install Mumba Yulaya As Chitimukulu – Chitimukulu Kanyanta Sosala

‘’Kalulu tapusuka mipya ibili,’’ is a Chibemba proverb which can literally be translated as: ‘’The hare does not escape the burning plains twice.’’ The actual lesson is that no one should take his luck for guaranteed or push one’s lucky star too far. And this applies to me because in the first place, President Michael Sata de-gazetted me and later President Lungu gazetted me. I must not, however, ’’try to push my lucky star too far,’’ because Mr. Hakainde Hichilema and the UPND have resolved according to the Deputy National Secretary-General Patrick Mucheleka to dethrone me as Mwinelubemba Chitimukulu as soon as they step into the corridors of power.

I think the only option is: PREVENTION IS BETTER THAN CURE. The problem is that some people create their own storms, but get mad when it rains.

Andrew Roberts in A History of the Bemba wrote: ‘’’The most important social institution among the Bemba people other than the family is chieftainship. There are over thirty clans represented in Bembaland, but the one clan with political significance is the Bena Ng’andu, the ‘people of the crocodile.’ This is the royal clan, to whom is reserved succession to many chieftainships……no other chiefly clan in the region has gained such power for its tribe as the Bena Ng’andu. It is above all this institution which generates and perpetuates historical traditions. The social basis of oral traditions among the Bemba is thus primarily to be sought in the institution of chieftainship. The affairs regarding which the Bemba look to history for guidance and inspiration are the affairs of chiefs; And yet although such history serves to affirm and reinforce the power and prestige of a ruling group, it is nevertheless accepted by the Bemba at large as being in an important sense their own history. The glory of the Bena Ng’andu is something in which all Bemba can share and derive a sense of communal pride.’’

The question is: why did President Sata de-gazzete me? It was because he knew me as a controversial strategist who operated behind the scenes since I was with him in the United Progressive Party (UPP) that was led by Mr. Kapwepwe. His fear was that it would be highly dangerous for me to be at the helm of Bemba power. A.L. Epstein, a social scientist who carried out a research on the copper-belt wrote in his book, Politics in an Urban African Community: ‘’The Bemba-speaking peoples, make up by far the most numerous category in towns. The Bemba are a proud people, conscious of their military past and are known to Europeans and their fellow Africans alike for their arrogance…’’

The late Mr. Valentine Musakanya said the Bemba aristocracy and arrogance always believe not only in their inheritance, but also in the vocal aggression…. Their aristocracy has no foundation in wealth or known education but essentially in just being Bemba. The Bemba being a born-warrior regards “the innate temperament trait” as his only survival instinct and strongly believes that fear and coward-ness are the gateway to self-destruction. And hence the saying “cibe cibe, umwenso ni mfwa.”

President Sata was very uneasy with my becoming the Bemba leader as you can see from what The Daily Nation reported in the obituary: In 2014, Mr. Lewis Changufu was almost arrested for calling for a meeting to discuss the impasse between the PF government and the Bemba Paramount Chief. Quoting intelligence sources, then President Sata was reported to have instructed state agents to find anything that could incriminate Mr. Changufu. ‘’ We have been asked to come up with anything that can link Mr. Changufu to crime. The President wants him arrested ASAP (as soon as possible) (ibid. 28th April 2016).

On the other hand, the Chinese government wanted to assist traditional rulers in Africa and formed what was called Africa Opportunity Co-ordination Organization based in Nairobi. Dr. Wang came to Zambia and asked the Minister of Chiefs and Traditional Affairs to give him the name of a chief who would represent us there and the Minister chose a relative, but Dr. Wang discovered that he was not given the right person and so he travelled to Kasama and told me that I was the right person. And when he went back, he sent the following letter of appointment ‘’ With your royal position and high level of traditional knowledge and experience of the traditional norms and culture in Zambia, Africa AOCO board has appointed you to spearhead the formation of Pan African Development Committee in chiefdoms not only in Zambia, but in Africa as a whole.’’

But that did not go well with powers-that-were since their preferred candidate was not picked up and so they became irritated and decided to destroy my character and integrity internationally. The Minister accused me of ‘’masquerading as Senior Chief Mwamba’’ (The Post 1st May 2013). And on 9th instant The Post came up with the front page headline: ‘’Sosala masquerading as Chief Mwamba declares Sata.” (ibid.) Dr. Wang later sent me a copy of the Memorandum of Understanding that was drawn by the Ministry of Chiefs appointing the same chief as Zambia’s representative, but the whole thing has now died a natural death.

And in fact I was warned by Dr. Mbita Chitala about my articles in The Post as well as by Mr. Sikota Wina when he visited Kasama. However being a free-thinker I am supposed to be ‘’audacious,’’ i.e., to be extremely bold, daring, recklessly brave and fearless. I can therefore never be a convert to anybody’s opinions whether political or otherwise. And I have always been encouraged by Edgar Allan Poe’s words: “In criticism, I will be bold, and as sternly, absolutely just with friend and foe. From this purpose nothing shall turn me.”

I have even continued now to educate people on our local radio stations. And I feel totally liberated because one of the tenets of being a free-thinker is the ability to tell people what they need to know, rather than what they want to hear. It was the great Greek philosopher, Socrates, who felt that it was necessary to create mental tensions, so that individuals could rise from bondage of political myths and half-truths to the unfettered realm of creative and objective analysis. And therefore the poor masses in villagers should not be perpetually condemned to choose in the false and highly perverted blinding conditions. The authenticity of one’s choice must be promoted by his ability to understand, at least, the falseness of the conditions under which he must choose, so that he can rise from the bondage of falsehood to the majestic heights of understanding

The Daily Nation newspaper of 4th July 2014 came up with headline: ‘’CHITIMUKULU WAS DULLY INSTALLED —-PARLIAMENT. It then went on:’’ The government has been advised to recognize the appointment of Henry Kanyanta Sosala as Paramount Chief Chitimukulu. Supporting the motion tabled by the Committee on delegated legislation, Namwala MP Moono Lubhezi told Parliament that Henry Kanyanta Sosala was dully installed as Paramount chief Chitimukulu and that government should correct the Statutory Instrument de-gazetting him so that he could be recognized. Ms. Lubhezi said that the House of Chiefs did not receive any complaint about the installation of the new Chitimukulu and that the government should recognize him.’’

On the other hand, President Sata had a strategy of dealing with me. The plan was that I was to be arrested and Mumba Yulaya was to be installed as Chitimukulu, but by God’s grace, the plan was prematurely aborted a week before its being executed because Honourable Geoffrey Bwalya Mwamba resigned as Defence Minister: ‘’ …it’s important for Zambians to know that I hail from the Bemba royal family and there is no way I am going to forsake my own blood for the sake of politics. So for me as GBM, I am sorry. I am a very principled person and I resign from government.’’ The ancient scholar, Eliphaz said, ‘’God upsets the plans of the crafty, so that nothing they try seems to succeed. He traps the wise in their own schemes and what they thought would succeed, doesn’t.’’ (Job 5: 12, 13).

UPND has no plans to Dethrone Paramount Chief Chitimukulu

United Party for National Development(UPND) has denied reports in the Daily Nation that the party has resolved to dethrone Chitimukulu as soon as they step into the corridors of power.

In a statement to the media, the party said that they will not directly respond to His Royal Highness Paramount Chief Chitimukulu Kanyanta Manga II’s reported sentiments in the media through the media, but have placed themselves at the disposal of Chief Chitimukulu to summoned them for a candid discussion on the concerns raised.

Below is the full statement

As UPND, we try our best to skirt around from engaging our Royal Highnesses everywhere publicly. We hold them in high esteem as custodians of our diverse cultural diversity and as key partners in our holistic development agenda for Zambia. This includes even those who may be harbouring hatred against us and our leadership.

UPND, as a political formation, with a strong and committed membership that spreads across our country, are therefore perturbed to read words attributed to Mwine Lubemba, His Royal Highness Paramount Chief Chitimukulu Kanyanta Manga II in today’s edition of Daily Nation newspaper (Wednesday, July 22, 2020. Vol 6 Issue 2659). If he surely said those words, we then don’t know exactly where this is coming from. We wish to appeal to His Royal Highness not to allow himself to become a tool of people with ulterior motives meant simply to divide our people through discredited and debunked tribal labelling.

As UPND, we are a political formation that reflects a multi-ethnic, multi-racial, multi-cultural and multi-religious character of our nation. We firmly believe in our national motto of One Zambia One Nation, not as a mere slogan to deceptively hide behind, while festering divisions through fomenting tribalism. We hold the motto, as taught by our national founding fathers (and mothers) as the rallying cry for national unity to drive holistic development equally and equitably to all our people across Zambia without fear, favour or ill-will.

Furthermore, we will not directly respond to His Royal Highness Paramount Chief Chitimukulu Kanyanta Manga II’s reported sentiments in the media through the media. We hold him in high respect as one of our Royal Highnesses. We are at his disposal to be summoned to address his concerns candidly as is befitting his status in society.

We will always respect Traditional leaders because they have a serious role in people’s livelihood, as they are there to use their respected voice which is always appreciated to facilitate and guide their subjects for sustainable development and foster unity.

We have in the past demonstrated our commitment and love to some of our traditional leaders in the country, at the time we felt they were neglected and not respected by the government.

HH ADDRESSES PROBLEM OF POLITICAL CADRES

UPND President Hakainde Hichilema has addressed the problem posed by political cadres, setting out his thinking on the subject on social media.

“Friends, it’s time for an honest conversation about political cadres, that many of you are concerned about,” Hakainde writes.

Asking people to come with an open mind on the subject the UPND leader explains that in looking at the challenge he has first sought to understand its roots. HH says to do this we “must begin by humanising them and not be led by our personal prejudices based on what we have observed as unbecoming conduct.”

“A cadre is a youth, a human being whose circumstances have necessitated their engagement in this form of occupation,” he writes. He goes on to give an example of a young man called Moses, who is in his early 20s and is unemployed.

He describes a harsh start to life and difficult upbringing in which many of his basic needs went unmet. As a result Moses ends up with a worldview of hopelessness.

“As he grows into his teens, his heart is hardened by the tough circumstances of living in want and survival means engaging in social deviance. His heroes are local “Commanders,” who move with bundles of cash and dominate the informal economy within his community. He can relate to them as they have a similar background as he. He is moved by the allure of being able to make a living from pledging fealty to these Commanders, and is happy to do their bidding, even if the acts are criminal in nature,” HH narrates.

“Moses realises that these Commanders source their power in the informal economy from their linkage to politics. This ostensibly makes him fiercely loyal to the political party from which the Commander is aligned. They adorn themselves in party regalia and chant slogans as they traverse the markets, bus stops and informal trading areas collecting tolls, levies and tribute from traders. The police look the other way as they engage in their activities with impunity” he continues.

HH says that for someone like Moses he may not be able to see any alternative for making a living given that he has no education or vocational skills.

“In order to sort out the issue of cadres, we have to address the matter holistically with the strategic engagement of a political, economic, and sociological approach. Appreciate who Moses is and know that there are millions of youths just like him in similar circumstances. Understand the informal economy and how it works and marry that with the intricacies of local politics. This issue will not be solved in a short time frame, but we can begin a process that resolves it” Hichilema proposes.

The UPND leader goes on to set out a proposed solution with three distinct phases. Phase one consists of education, skills and vocational training, phase two is focused on SME development, and phase three is concerned with strengthening institutions such as the police and local government.

“These measures will not displace Moses and his friends, but will offer an alternative opportunity for them to be incorporated into a formal structure with dignity and decent pay,” the UPND leader writes.

“We are determined to provide youths like Moses with skills, jobs and business opportunities. Remember that Moses is human, and his circumstances are not his choosing but rather arising from the dereliction of duty among leaders for far too long,” he concludes.

DPP WANTS PEOPLE WHO WITHDRAW CASES FROM COURT PUNISHED

The Director of Public Prosecutions (DPP) Lillian Siyuni has proposed an amendment to the law to introduce penalties for people with a tendency of recanting or withdrawing court cases. She is alleging bribery by suspects as the main cause.

She laments that the tendency by victims to withdraw abruptly was terribly affecting her work due to the huge waste of time spent on cases that ended up closed.

Did the DPP apply her mind to the proposal? I do not think so.

It is true that suspects, especially assault ones, tend to pay their victims so as to withdraw their cases. Wives and husbands also tend to withdraw GBV cases against their spouses. Boyfriends and girlfriends, and others, who are related in one way or the other do withdraw cases after monetary gains or family interventions. The question is: should victims be punished for withdrawal of cases?

I do not think the DPP fully understands the consequences, especially to the State, if punishment were to be handed down to persons that withdrawal cases. First of all, if punishment be meted out, it should be done to the State and to individuals. For what is good for the goose must be good for the gander. If bribery is the reason why individuals enter nolle prosequi, then bribery is the reason why the DPP always enters nolles. If corruption is the reason why individuals enter nolle prosequis, then the same is the reason why the DPP always enters nolles.

Thus, if individuals must be punished for entering nolle prosequis, then the DPP must be punished for doing so too.

And looking at cases that the DPP enters nolles, e.g. the treason case against Hakainde Hichilema and fives others, the State would be paying colossal sums on account of nolle prosequis which the DPP enters time and time again.

So, Ba DPP, tondolo musuma. Dont start a fight you will regret sooner rather than later.

Already, government is grappling with the payment of retirees per Constitution Amendment 2016. And also grappling with the provisions to do with ministers from within or outside parliament. K75,000 bills pending to be paid. Now, government wants to reverse the Articles through Bill 10.

Lusaka (22.07.2020) – United Party for National Development-UPND is concerned that a well intended meeting between Deputy Inspector General of Police (DIG), Bonny Kapeso and ruling Patriotic Front (PF) led by Lusaka Province Youth secretary, Kennedy Kamba was a pure cosmetic move.

Firstly, we find it misplaced that PF Provincial Secretary, who is on record and famed for committing the gravest of violent crimes against citizens could represent the PF Chairperson for Security, Stephen Kampyongo who is also the Home Affairs Minister.

And how can Mr Kamba lie though his teeth that ‘the misconduct of an individual member of PF should not be construed as the position of other members of the party. But the fugitive Emmanuel Banda is PF Easternprovince Youth Chairperson and friends with the Head of state? We can smell a rat in this matter.

Secondly, we wonder at what point Kampyongo, who is by default Kapeso’s boss, takes off the Ministerial jacket of Home Affairs to answer to Mr Kapeso seeing that all the criminal activities that PF cadres have been committing are done with his blessings of the ruling party.

Thirdly, we have also noted that the apology from the PF over the uncouth behaviour of some PF cadres at the Lusaka Magistrates court last week was aimed at distorting facts and turning the attention of Zambians from the gravity of the matter at hand.

Furthermore, the failure by the Zambia Police Service (ZP) to arrest Emmanuel Banda for invading and assaulting Police Officers in an ISIS style manner erodes the very good intentions Mr Kapeso’s appetite to end the feud and rift between unruly PF cadres and the ZP whose work has been made extremely unbearable due to interference in their duties by the ruling party.

That stated, it defies all logic that Mr Kampyongo could continue doubling as both PF security Chairperson and Minister of Home Affairs because that makes it impossible for him to execute his duties fairly and in the interest of the majority Zambians craving for peace and unity.

We find the scheme by the UPND to dethrone the Mwine Lubemba Chitimukulu Henry Kanyanta Sosala, in the unlikely event of forming Government, extremely reprehensible. This evil scheme by the UPND , but it is a censurable scheme that will backfire terribly on Mr. Hichilema and his Party. It seems Mr. Hichilema and his Party have not embraced in old wisdom that, “you do not spit into the wind because it will come back in your face”.

His Royal Highness Paramount Chief Chitimukulu, Mwine Lubemba is a crusader and messenger of the liberating power of truth. And, “you shall know the truth, and the truth shall set you free”!

Is not Mr. Hichilema interested in the liberating power of truth, no matter who says it?

Is Mr. Hichilema so bound and driven by tribalism and vengeance that, he is so irked and troubled by the wisdom, truth and principles of
His Royal Highness Paramount Chief Chitimukulu, Mwine Lubemba? And is it moral for Mr. Hichilema’s UPND to be actively planning ill against the Mwine Lubemba?

Driven by his tribal and divisive instincts, Mr. Hichilema has found reason and peace in allowing his Spokespersons in the Alliance, to insult and demean the Mwine Lubemba. This scheme is not imaginary. This scheme is real and in active sponsored operation, which is the only reason Mr. Hichilema has not seen any value in apologising to the Mwine Lubemba for the insults he has received from Mr. Hichilema’s alliance.

This anarchist and divisive scheme is not only targeted at the Mwine Lubemba, but at the Bemba speaking people as a whole, because; one cannot respect a people whose “King” he/she derides or insults.

Further, the above-mentioned scheme is not only targeted at the Bemba speaking people everywhere, but it is also targeted at the paramount Chiefs Litunga of Barotseland, Gawa Undi of the Chewa people, Chitimukulu of the Bemba, and Nkosi Ya Makosi Mpezeni of the Ngoni speaking people.

We can say to the UPND that they are now playing with fire. We want to advise Mr. Hichilema and his UPND to immediately stop spitting in the wind, because that will come back to hit them in their faces.

Driven by vengeance and division, Mr. Hichilema and UPND aspire for the highest office in the land so that they can unleash their vengeance and division.

True to his nature, for example, instead of him preaching nation building and unity, Mr. Hakainde Hichilema this week issued a veiled threat to dismiss all civil servants and diplomats he labelled as Patriotic Front supporters. This is coming from the mouth of someone who lies about creating jobs, when his agenda is to make hundreds of our brothers and sisters jobless based on tribe, region and his suspections about their political persuasion.

How does Mr. Hichilema create jobs by destroying jobs and livelihoods of civil servants only because of his suspicions or because of the civil servants’ tribe or region? Infact, Mr. Hichilema’s job creation strategy is a misnomer given his crusade to fire civil servants based only on his suspicions, flimsy reasons, and tribalism.

Given his apparent lack of understanding of governance, and given his apparent innate disrespect for institutions; Mr. Hichilema needs to be reminded that the country has a professional Civil Service Commission with specific rules and guidelines. If Mr. Hichilema has any solid evidence of any “Patriotic Front” civil servant, let him bring such evidence to the Commission and the nation.

Only there is no such hard evidence, only more falsehoods, divisiveness and anarchism from Mr. Hichilema and his UPND.

The threat against civil servants is an empty, veiled threat because based on our information, the UPND is all targeting civil servants from both PF strongholds, including some from UPND strongholds. According to the UPND, originating from a region that is not their stronghold and you are a civil servant, to them that’s an admission of guilt of supporting the Patriotic Front. To paraphrase Dr. Martin Luther King Jr: “We all want a Zambia where each one of us, including civil servants, are judged by the content of our character, not by our tribe or region!”

Therefore, the UPND’s vengeful vendetta targeted at civil servants coming from Western, Luapula, Muchinga, Northern, Eastern, Copperbelt, North-Western and those Southerners who are deemed not to support UPND — should be condemned by all well-meaning Zambians.

We appeal to all Zambians of good conscience to condemn Mr. Hichilema’s anarchist tribal, regional “cleansing” and witchhunt agenda of Zambia’s civil service.

Lastly, but certainly not the least, we want to appeal to our brother the NDC leader Hon Chishimba Kambwili if his conscience is clear that he is in partnership and colluding with those people insulting his Paramount Chief Mwine Lubemba. To the NDC leader, we ask; do you find being a party to an alliance insulting your own Paramount Chief Mwine Lubemba, a honourable and moral thing to do?

‘Hero without a grave’ – Lumumba’s daughter writes to Belgium demanding return of father’s relics

uliana Amato Lumumba, the daughter of the DR Congo’s first Prime Minister Patrice Lumumba, is demanding the return of her father’s “relics”, in a letter to Belgium’s monarch, Philippe. The letter, cited by AFP, was written on June 30, which was the 60th anniversary of the independence of the DR Congo from Belgium.

“We, Lumumba’s children, call for the just return of the relics of Patrice Emery Lumumba to the land of his ancestors,” Juliana wrote in the letter.

According to AFP, the “relics” Juliana stated in the letter are her father’s teeth which were removed from his body following his assassination in 1961.

Since January 17, 1961, no one has been held accountable for the brutal murder of Congo’s independence leader Lumumba who was shot dead with two of his ministers, Joseph Okito and Maurice Mpolo.

However, all fingers point to multinational perpetrators who sanctioned the elimination of one of Africa’s bravest politicians and independence heroes who stood his ground against colonizers.

Lumumba led the DR Congo to independence on June 30, 1960, after the country was passed on from King Leopold II, who took control of it as his private property in the 1880s, to Belgium in 1908 as a colony.

Lumumba transformed the country in just three months in office and he strongly advocated for a united Africa until his death by firing squad. His death was felt all over Africa and the world as he was filmed in captivity and manhandled by soldiers under the authority of his chief of staff Joseph-Desire Mobutu, who had taken over the country after a coup d’etat.

The United States, United Nations and former colony Belgium were complicit in his murder as they looked on while he was tortured despite letters he wrote for protection during the Congo Crisis, which was stirred up by the Belgian government.

More than three decades after his death, a senior Belgian policeman, Gerard Soete, disclosed that he and another helper had exhumed the corpses of Lumumba, Okito and Mpolo and “hacked them in pieces and put them into the acid.”

However, in a documentary aired the same year on the German TV channel ARD, Soete showed two teeth that he said had belonged to Lumumba. Recently, Soete’s daughter also showed a gold tooth, which she said had belonged to Lumumba, during an interview with a newspaper.

In Juliana’s letter written on behalf of her “wider family”, she said that her father was a “hero without a grave”, and criticized the “vile statements made in Belgium about holding some of his remains.”

“The remains of Patrice Emery Lumumba are being used on the one hand as trophies by some of your fellow citizens, and on the other as funereal possessions sequestered by your kingdom’s judiciary,” she said in the letter to Philippe.

Philippe recently expressed regret over the violence inflicted during his country’s rule over Congo. Belgium has a brutal history in the Congo under Leopold II, who ruled Congo with an iron fist for more than a century.

Leopold II ruled from 1865 to 1909 and has been described as worse than Adolf Hitler for his genocide against the people of the Congo Free State (now DR Congo) who he considered as his personal property including their lands and minerals.

An undetermined number of Congolese, ranging in the millions, were killed in the hands of Leopold’s private colonial militia of 90,000 men called Force Publique, which he used to run the region that is the size of Western Europe and 76 times larger than Belgium.

Ernestine “Tina” Martin Wyatt, the great-great-great-niece of Harriet Tubman, has hit back at Kanye West after the rapper blatantly renounced and criticized the record of her aunt.

West in his first event since he declared himself a presidential candidate in November’s general elections went berserk and in a lengthy monologue claimed the Underground Railroad conductor never actually freed the slaves.

“She just had them work for other white people,” he said.

Tubman, according to historical accounts, escaped slavery using the Underground Railroad in the fall of 1849. She would later serve as a “conductor” for many other escaping slaves.

In a reaction, Wyatt slammed West’s comments as utterly ignorant and uninformed, stating that the “Yeezuz” rapper would still be on a plantation were it not for the sacrifices the likes of Tubman made of the emancipation of the black race in America.

“If we were left alone, we would be in an entirely different place. And he needs to understand that if it weren’t for people like aunt Harriet, especially her… because she was already free, she didn’t have to come back, she didn’t have to risk her life but she did it countless times.

“And if it hadn’t been for people like her, he would still be on that plantation, he would not be able to be out there saying the things he said and he wouldn’t have the money he makes,” Wyatt told TMZ.

West is no stranger to controversy. Last year he claimed bizarrely that he was free from the clutches of the Democratic Party following his acceptance of Jesus.

West told veteran Los Angeles radio and morning show host, Big Boy in an interview that the Democratic Party for years brainwashed the black community into patronizing abortion.

“We’re brainwashed out here, bro,” said West. “Come on, man. This is a free man talking. Democrats had us voting [for] Democrats with food stamps for years. What are you talking about? Guns in the 80s, taking the fathers out the home, Plan B, lowering our votes, making us abort our children…Thou shall not kill.”

As UPND, we are a political formation that reflects a multi-ethnic, multi-racial, multi-cultural and multi-religious character of our nation. We firmly believe in our national motto of One Zambia One Nation, not as a mere slogan to deceptively hide behind, while festering divisions through fomenting tribalism. We hold him in high respect as one of our Royal Highnesses. We are at his disposal to be summoned to address his concerns candidly as is befitting his status in society.
We will always respect Traditional leaders because they have a serious role in people’s livelihood, as they are there to use their respected voice which is always appreciated to facilitate and guide their subjects for sustainable development and foster unity.


We have in the past demonstrated our commitment and love to some of our traditional leaders in the country, at the time we felt they were neglected and not respected by government.

This leaves me with a question: Are our eyes created the same with those Africans? I hear there are still cultures in Africa that prohibit them from using latrines which is very annoying.

Lusaka Man Divorces His Wife After Seer One Exposed Her

LUSAKA MAN DIVORCES HIS WIFE AFTER SEER ONE EXPOSED HER
A 39 year old man of Lusaka yesterday (Monday) divorced his wife in the Kanyama Local Court after Seer 1 congratulated him for having a wife who sleeps with other men without his knowledge. According to Mr MARVIN MWANSA, he first doubted Seer One’s remarks against his wife on 20th June 2020.

The facts are that during his live broadcast on Facebook on 20th June 2020, Mr Mwansa used derogatory language against Seer One who responded by congratulating him for having a woman who cheats on him regularly while he remained comfortable.

At first, Mr Mwansa said he doubted Seer One’s response but decided to conduct his own investigations without informing his wife but all proved futile until last week when a man (police officer) by the name of Essau Sichalwe sent a message and 2 pictures to her fon while she was fast asleep. He opened the message box and what he read and saw was beyond heartbreaking. The man wrote a message enquiring how Emma the couple’s 5 year old last born daughter was doing. Infact Mr Sichalwe was trying to enquire how the 5 year old girl was doing since she was his daughter.


After pestering his wife, Mr Mwansa learnt that his wife was indeed cheating on him with a police officer of a nearby police station who even impregnated her five years ago. Mrs Mwansa told the court that she truly cheated on her hubby and that she was sorry.

Mr Mwansa shaded tears when his wife disclosed that the 5 year old girl whom he considered and loved as his last born was not actually his but for the same police officer whom she has been sleeping with.

The court has since dissolved the couple’s marriage as requested by Mr Mwansa the husband who kept on shading tears as he could not believe the woman who pretended to love him so much has actuary been sleeping with other men despite him working hard to provide all she required at home. He has since vowed to subject his three other children to DNA test. This is how deadly Seer 1 can be!

Fellow citizens! We have noted with great concern the fake, misleading, and unfounded reports circulating on social media on PF blogs that our incoming Republican president Hakainde Hichilema has threatened to fire all Patriotic Front PF sympathizers including their members.


We strongly urge the general public to treat such propaganda manufactured by the desperate Sunday Chanda and the Patriotic Front with the contempt they deserve. Our Bally! Your Bally understands and sympathizes with the Civil Servants and their suffering is the main reason why UPND is geared to form government next year.


If you’re a PF member or sympathizer and you have the right qualifications for the job, why should HH fire you? On what grounds will the president fire you? You and I knows that every job in government have specific requirements that are needed and those who meet the requirements takes the job but this is not the case in PF. Cadres with no qualifications are the ones being recruited leaving out people with qualifications. This is what we’re coming to correct and not to abuse people who are rightfully occupying a job.


As UPND, we do understand that it is the civic duty and right of every citizen of Zambia to participate in political and public affairs of this country. We do recognize, respect and will continue to fulfill the right of citizens to belong to their political parties of their choice regardless of the position or job they have in government. It’s their right and in no way will president HH abuse civil servants because they support or belong to other political parties.
We wish to consort our reasoning with that of the PF Propagandist that affiliation with PF, NDC, FDD or indeed DP is not an offence, it is a democratic right in as much as it is to belong to the mighty UPND. As such, we would not be so stupid as the PF who have been abusing civil servants who are perceived to be UPND sympathizers. We’re a party of intellectuals and we’re founded on the predicate of the rule of law.


Fellow country men and women! I want to categorically state here that president Hakainde Hichilema will be too busy with significant national issues that will not allow him to waste his time in identifying who’s PF, DP, or NDC because the president will focus his energy and time in ensuring that Education is made affordable for everyone to access and that the price of commodities such as Mealie meal, Cooking oil, fuel, ZESCO units, and Fertilizers are reduced to suit the common man in Zambia.


To our Civil Servants! I wish to mention to you that Sunday Chanda and the Patriotic Front PF do not mean well for you. You’re the living testimonies to understand what I am talking about.


In the UPND government, all civil servants will have lowest loan interest, sponsorship for school will be reintroduced, salaries will be increased by more than 5%. UPND government will be the only government in the history of Zambia where your works and inputs will be valued and rewarded with good pay and respect.
Our government will be blind to such allegations being made by Edgar Lungu through his Propagandist Sunday Chanda and Dora Siliya.


The nation must understand that president Hakainde Hichilema was very categorical when he stated that employment will be based on qualification not on tribal lines. This is the point that Sunday Chanda and his colleagues in PF misunderstood and have since resorted to capitalize on this very important statement.
Surely, will you be in support if UPND started recruiting unqualified people in the civil service?


How would you feel if you applied for a Job with the necessary requirements and we pick a unqualified candidate leaving you out?


This is exactly what the PF government under the leadership of president Edgar Lungu are doing. They are recruiting cadres without any qualification into the civil service such as the Zambia Police, Zambia Army, ZNS, ZRA and many other government institutions.

The National Registration Office under the Ministry of Home Affairs commenced issuance of NRC’S in perceived PF strongholds. They have been issuing NRC’S in these areas because they want to boost Voter numbers in these areas and suppress Voter numbers in areas where the PF is weak.
NRC’S are also being issued to children under 16 years old to boost Voter numbers in those areas.
This exercise has been going on for 8 months now in Luapula, Northern, Muchinga and Eastern provinces.
Even Davies Mwila confessed to this 4 months ago in a PF meeting that over 50,000 NRC’S had been issued by the PF in Chief Mibenge’s chiefdom.
The PF has issued hundreds of thousands if not a million or more NRC’S in these areas.

PHASE 2 – ECZ ONLINE REGISTRATION OF VOTERS

The National Registration Office has now developed an online database of the NRC’S that have been issued in these 4 provinces.
This electronic file can now easily be passed to ECZ to print voters cards for the people who were issued NRC’S, some of whom are children and even foreign nationals living along the Congo and Malawi border.

The ECZ has now introduced an online Voter registration system without consulting stakeholders and political parties. This is the beginning of phase 2.

Under this system, a Voter who registers online only has to upload their details, NRC and passport photos onto the ECZ website from their phone and they are automatically registered as a Voter.

They DON’T NEED TO REGISTER THEIR FINGERPRINTS which is a critical safeguard and security feature of the old system. They want to remove this requirement, this means that one person can attempt to register as a Voter multiple times.
After registering online you only need to go to the registration centre to collect your card without proper verification mechanisms like fingerprint authentication.

What’s going to happen is ECZ will print hundreds of thousands of voters cards for the people in these villages in these 4 provinces and then claim that they registered online.

But the truth is they didn’t register online, the ECZ would have acquired the electronic file to print these cards from the National Registration Office officials that are complicit in this plan.

The children who have been given NRC’S and voters cards will not have to physically present themselves at a Voter registration office. Everything has been done for them.
You will only see these children on election day coming to vote and no one will stop them because they will have NRC’S and voters cards.
You will see alot of voters cards having the same photographs as the NRC, which is supposed to be impossible because these are two different institutions. But you will see it as a common occurrence in Luapula, Northern, Muchinga and Eastern provinces.

PHASE 3 – DELAYED ISSUANCE OF NRC’S IN OPPOSITION STRONGHOLDS

The National Registration Office will limit the number of NRC’S issued in opposition strongholds. There will be very few mobile registration centres in Southern, Copperbelt, Lusaka, Western, Central and North Western Provinces. You will see machines breaking down, not working or them saying that materials for printing NRC’S have run out. But you won’t see the same problems happening in Luapula, Northern, Muchinga and Eastern provinces.

PHASE 4 – SHORT VOTER REGISTRATION PERIOD OF ONLY 30 DAYS.

In previous election cycles, Voter registration has always been for a period of 90 days.
This time the ECZ has stubbornly refused saying it will only be for 30 days.
They want very few people to register as voters in the opposition strongholds to limit the number of voters.
The perceived PF strongholds don’t need a long registration period because the cards would have already been printed for them and issued to the people who received NRC’S.
You will also see fewer Voter registration centres in the opposition strongholds.

RESULT

The results of this fraudulent process that we will see when they complete it in November is that ;

1: Extremely high new Voter registration numbers in Luapula, Northern, Muchinga and Eastern provinces.

2: Extremely low Voter registrations numbers in Southern, Lusaka, Copperbelt, Central, Western and North Western Provinces.

You will see a province like Luapula or Eastern having numbers as high as Lusaka and Copperbelt in terms of Voter registration yet the population of Luapula is only half that of Lusaka.

This will give the PF an artificial boost going into the 2021 elections.

Be on the look out for voters cards like these, which have the same face on the NRC. They will be issued fraudulently.

We implore the people of Zambia and all opposition parties to reject online Voter registration.
REJECT IT THE SAME WAY WE’VE REJECTED BILL 10.
Every person should be required to present themselves before a Voter registration centre, they need to register their fingerprints, and they should physically be verified by a Voter registration officer.

Nigerian politician “faints” at hearing over $100m corruption case but Twitter ain’t having it

An acting managing director of Nigeria‘s Niger Delta Development Commission (NDDC), Daniel Pondei, dramatically fainted during a legislative probe on Monday into suspected corruption at his outfit.

Pondei was to answer questions on how ₦40 billion or $103 million, had been misappropriated at the NDDC. But about 45 minutes into the session, Pondei cast the figure of a dozing man, his spectacles taken off as his head slowly sank into his chest.

The chairman of the investigative committee sensed the unresponsiveness in their guest and the audience in the room suddenly broke into a commotion.

But Pondei was almost immediately knocked back into consciousness only seconds after his predicament. Pondei is now, however, in a stable condition in a clinic in Abuja.

In the aftermath of the brouhaha, the NDDC spokesperson, according to the BBC, intimated that Pondei had gone to the hearing on Monday morning against the advice of doctors. The NDDC boss was reportedly unwell prior to Monday.

The NDDC was founded in 2000 by former President Olusegun Obasanjo as a special body committed to harnessing the resources of oil-rich Niger State to benefit its mostly poor people.

But when Monday’s incident, which was aired on live TV, broke out on social media many were the Nigerians who reacted to Pondei’s alleged ill-health with sarcasm and outright disbelief.

Author J.J. Omojuwa tweeted: “Hushpuppi stole from the wrong people and the wrong nationalities. These NDDC folks aren’t different from him. They just stole from much poorer people instead. And they stole from Nigerians. For now, that’s a crime many get away with.”

Another also tweeted: “This is what saves the NDDCboss……” and insert a photo of an intravenous fluid bag with the inscription “Pepsi”, while MTV award-winning rapper M.I. Abaga tweeted: “this guy na legend!!!! Infact sir!!!! One Legend Extra Stout for you!!!!! #NDDCProbe“

Justice Minister Hon. Given Lubinda has described late Mwansabombwe Lawmaker Hon. Rodgers Mwewa as a gallant soldier who from a young age lived his life in service to others as evidenced by the orphanage centre (Fountain of hope) he established in kamwala township which became a place of refuge for over 400 homeless children.

Hon. Lubinda who spoke on behalf of Government at the funeral service of the late Parliamentarian which was held at the Praise Christian Centre which is located along great east road in Lusakas PHI residential area, conveyed condolences from President of the Republic of Zambia, His Excellency Dr. Edgar Chagwa Lungu, to the family and friends of Hon. Mwewa.

He said for a person to take up a huge responsibility from the young age of 24, of keeping orphans and vulnerable children, without being wealthy was evidence of being selfless, compassionate and having a big heart of service to humanity.

“25 years ago at the young age of 24, he already started thinking of the less privileged. He himself at 24 had nothing to his name, at 24 he had no money or property. Yet he decided to give to the many people at fountain of hope,” he said

“Speaking as a Member of Parliament for Kabwata constituency where the fountain of hope orphanage is situated, I want to assure you all that we are heart broken. We put to rest today a real soldier. We pray to God that he gives strength to his wife Annie, his children, parents, relatives, friends and the hundreds of children he has left at fountain of hope, “he added.

And speaking on behalf of the Patriotic Front. Secretary General Hon. Davis Mwila said the Patriotic Front has lost a formidable member who will be hard to replace.

” I woke up today at 3 in the morning and wept. I wept for Rodgers for 10 minutes. I thought of the many children at fountain of hope that he took care of. Who will take care of those children like he did now?” He lamented.

And still speaking at the service, Luapula Province Minister Hon. Nickson Chilangwa who spoke on behalf of the National Assembly expressed deep sorrow on behalf of the Speaker and all Parliamentarians.

He stated that the demise of the Mwansabombwe Lawmaker has left a huge gap that would be felt in Parliament.

Meanwhile, the family of Hon. Rodgers Mwewa has thanked most profoundly President of the Republic of Zambia His Excellency Dr. Edgar Chagwa Lungu and the government for the huge support that they have recieved since the passing of their relative.

Speaking on behalf of the family, elder brother to Hon. Mwewa Mr Teddy Mwewa however implored people to stop speculations over the death of his brother and allow the family to mourn him in peace.

And speaking after the funeral service, Luapula lawmakers, Health Minister Hon. Dr. Chitalu Chilufya and Tourism Minister Hon. Ronald Chitotela both expressed how they would miss Hon. Rodgers Mwewa because of the close and cordial work relationship they shared with him.

And PF Media Director said it was unfortunate and shameful that the opposition united Party for National Development had decided to politicize the death of Hon. Mwewa.

Hon. Rodgers Mwewa has been buried at the Memorial Park in Lusaka.

Allegations Of Charms, Snails In Cups Engulfs High Commissioner Frank Bwalya’s Home

Zambia’s High Commissioner to Australia Frank Bwalya’s chef was finally fired from her job at the residence over allegations bordering on the use of charms, after Bwalya’s wife found a snail in the cup, sources familiar with the situation have said.

Sources familiar with the domestic quarrels involving High Commissioner Bwalya and his wife Joyce on one side, and the chef known as bana Chanda, which have spilled over and are being handled by the Australian government, through their Department (Ministry) of Foreign Affairs and Trade, told Daily Revelation that High Commissioner Bwalya’s, Joyce suspected bana Chanda of using charms against them.

The sources have said bana Chanda has rejected the assertions, saying the allegation was simply being used to get rid of her by Joyce.

“To bring you up to speed, yes the chef has been complaining about the alleged mistreatment by the madam, but what sort of broke the camel’s back was a situation where bana Chanda was called to the kitchen by the madam, as she was holding a cup that had a snail in it. She told bana Chanda that she had called her to show her the snail she found in the cup so she would not refuse once she showed the same to High Commissioner,” the sources said. “Of course the chef has been arguing during the meetings, wondering how a snail could have gotten from outside, onto the tray and finally into the cup.”

The sources said bana Chanda has been insistent during the meetings on her position that High Commissioner Bwalya cautioned her about his wife, to be careful as she could create a situation which was going to lead him to fire her.

“But the High Commissioner and the madam have insisted that she is not someone they want to continue living with. Of course she (the chef) has complained bitterly that the madam has failed to consider his job over the action she has taken, saying she wouldn’t want his job to end in the same manner her’s has ended,” the sources said. “Of course what you may need to know is there is some rumoured family ties that High Commissioner is related to bana Chanda. She’s been complaining that her life has been ended badly as she was repaying loans, paying hospitals bills for family members in Zambia, and that her future and those of her family members have been ruined.”

Well placed sources familiar with the matter have told Daily Revelation that there have been serious problems between the Bwalya’s and bana Chanda who is employed by the Zambian government and attached to the High Commissioner as chef at the envoy’s residence.

Sources said the alleged mistreatment of bana Chanda eventually led to the termination of her employment.

Daily Revelation understands that because of the nature of the arguments and her being fired, bana Chanda was forced to complain to DFAT, a government department that also looks into the affairs of diplomats and is responsible for issuing visas to them.

The Department has taken the matter seriously, particularly that the chef was fired and expelled from the residence and was therefore being taken care of by the Australian government.

Foreign Affairs permanent secretary in charge of administration, Dr Ronald Simwinga said the Ministry had asked High Commissioner Bwalya to give his version of the story as High Commissioner there, saying the Ministry was not aware about the matter as the Mission in Australia had not registered it with headquarters here. – Daily Revelation

UPND president Hakainde Hichilema has outlined priority areas of reflection as his party forms government in 2021.

Discussing in depth the composition of his government, “when UPND assumes office next year”, Hichilema said consultations were on-going on the matter of his running mate.

“My running mate, should the party allow me to be the 2021 presidential candidate, will be a person who would be ready to assume the presidency should anything happen to me. I am fortunate to have great options and consultations are on-going. This is not a matter that should be rushed to be announced, even if my mind is made up now. I can give an example of the US election, scheduled for this November, where the incumbent’s challenger, Joe Biden is yet to announce his running mate within months of the election. This practice is not uncommon, but I can assure you that you will not be disappointed. His or her name will be withheld for now and so will the names of the desired ministers,” Hichilema said. “What many of you may know by now is that the PF have been engaged in highly undemocratic and disruptive activities to increase their chances of retaining power. Not only did they interfere with the 2016 elections, they have continued to meddle with the electoral process by limiting our freedom of movement, abusing the police, closing media institutions, and buying councillors. In such an undemocratic and hostile environment, we cannot afford to expose the majority of the people that will make up our government. It is a question of timing.”

He said under a normal and functioning democracy, people would be free to show themselves as being part of the opposition and freely express themselves without threats to their lives, businesses, and wellbeing.

Hichilema said his team would reflect on key objectives for the first term of office, which include turning around the economy and economic diversification.

He said his team would also look at strengthening institutions and the country’s democracy.

“Your in-coming government 2021-2026. Good evening beloved citizens, last week, I had the privilege of engaging with citizens on my Twitter page, where I addressed a number of questions. One matter that kept coming up from numerous citizens was the issue of the composition of our government, when we assume office next year. I deliberately did not address it but promised to provide detailed feedback on my thoughts and basis for the decisions we will make regarding the composition of the cabinet and many other crucial positions,” Hichilema said. “I have addressed these issues in past engagements but I’m happy to shed more light. Understandably, many of you are hoping that I’ll list names and corresponding roles and positions. Unfortunately, not now, but allow me to provide some context and the foundation for the formation of your government from 2021 to 2026. Firstly, our team must be a reflection of our key objectives for the first term of office, which include: turning around the economy, economic diversification, strengthening institutions and strengthening our democracy.”

Hichilema said his team would also reflect on the national unity and quality education.

He also listed quality healthcare and restoring the rule of law as some of the things his team in the new government would mirror on.

Hichilema said those were some of the objectives, which are anchored on the goal to raise the standards of living for all Zambians.

“Points 1 & 2 will produce quality jobs and increase the participation of Zambians across our economy, enabling the creation of local wealth. Point 3 provides for better oversight, discipline, prudence and the fight against corruption. Point 4 will enable free speech, a free press, judicial independence, as well as the independence of the Electoral Commission of Zambia. Point 5 tackles tribalism and ensures there is diversity of tribe, gender & the youth in our government, where no one will be marginalised. Points 6 and 7 addresses our goal to invest in human capital and point 8 involves developing independent institutions that are devoid of political influence, ensuring that the three arms of government are independent and effectively execute their mandate,” he said. “The above is our agenda and with this background, it will be necessary to have in place a sound team to execute. We must bear in mind that there is a civil service in place. Our initial assessment of the calibre of many who are employed in the civil service, is that most are actually sound. There has however, been problems with regards to politicisation of key roles such as directors and permanent secretaries. A significant number of directors and PSs will have to be evaluated based on their competencies, performance and record.”

Hichilema said UPND would not fire anyone for political reasons but rather, the choice of those who stay or go, would be based on merit.

He promised that most good civil servants would stay, even though they were engaged through the PF system.

“Some will, of course, come from outside the government. This may be disconcerting to many but we have to be inclusive and objective. It is no secret that the civil service is riddled with highly incompetent PF cadres with questionable qualifications. Those are undoubtedly going. It is also not a secret that the civil service is not a reflection of the diversity of our country. It must be balanced by various tribes, youths, gender and other groups,” he said.

Hichilema said the Public Service Management Division and the Human Resource department of the government would conduct an audit to ensure that not only would they have competent and qualified people but would erase the corrupt phenomenon of “ghost workers”.

Hichilema insisted that the civil service must attract excellence and people with the capacity to carry out duties for the benefit of their employers, the citizens of Zambia.

“This provides a background on our intentions with the civil service and more light will be shed in our manifesto that we shall launch in due course. With regards to the foreign missions/diplomatic service, like the rest of the civil service, it is all about merit. Not who is Bally’s friend, relative or tribe mate. Our foreign missions must be occupied by high commissioners and officers who are appointed on merit and who can fulfill our diplomatic, trade and economic objectives with absolute excellence,” he said.

Hichilema said the UPND was highly rigorous when vetting people for roles in the central bank and other important statutory bodies and that the diplomatic service must be no different.

“We need career professionals who carry out our outlined objectives. We have developed performance metrics, similar to those used in the private sector, that will be strictly enforced. Our aim is to have a truly competent & effective government that delivers on the people’s aspirations. Before we get into cabinet ministers, I’ll refresh your memory on where they come from. In accordance with our current Constitution, they have to be elected and nominated members of parliament,” he said. “It is from that pool of people that I’ll make choices. We first of all have to nominate strong candidates for our parliamentary seats who have requisite qualifications and skills in various vocations from the ministries I intend them to lead. They then have to win the seats before they are eligible to be appointed ministers. We will not adopt any minister from the current PF government to serve in any ministerial position in ours.”

Hichilema said he had identified highly impressive candidates that would be nominated to parliament to serve in key technical ministries that would deliver “our economic turnaround”.

“These include finance, agriculture, mines, commerce and investment. I must also inform you that we have an elective conference coming up where National Management Committee members will be elected. The presidential candidate for the UPND will also be determined. I am offering myself for re-election. As you can see, there are numerous factors that affect who will serve in our government but in due course, as we move past various milestones, you will be informed. You have my word on this,” he said.

Hichilema said he had heard many people say that they did not want recycled politicians.

He said while most of the people in the next government would be new, he urged people to understand that there were some former ministers from previous governments with a wealth of experience and capacity that UPND would certainly call on.

“This should not disappoint you because the few who have served in government before, have institutional memory and experience that we certainly need. The ones I have in mind have my full confidence and I have no doubt that they will be serving diligently in our government. I would like to conclude with two final points. First is regarding your next vice-president and the other is concerning why it is also necessary that we withhold the identity of some of your future ministers,” said Hichilema.

Since the coming of the Patriotic Front (PF) into power, we have seen very important institutions in our country being reduced to play grounds of Party cadres. One such institution is the Zambia Police service.


The police Inspector General Mr. Kakoma Kanganja working with PF officials have taken away the powers, respect and dignity that our men and women in uniform deserve. It is very disheartening to see our men and women in uniform saluting and taking orders from political party cadres and the police chief is comfortably watching this. Unfortunately, even the President who is supposed to protect such institution against any abuse is also comfortable with this threat to national security.


How can a government be so careless to legalize lawlessness in the name of politics. This is not funny and PF itself will be devoured by this monster they have created. Remember these cadres started by attacking the opposition members then they went for a cabinet minister and now they have started attacking the police right at the police station. Next they will start attacking Judges and when there is no one to attack they will attack the president himself. This is how much we have compromised the national security our country. Our markets are now called barracks for cadres. Surely this PF leadership is a curse to our country.


I want to put it on record that we stand with our men and women in uniform as they pass through this persecution from the police IG and his minions. We are assuring our officers that better days are coming when they will be allowed to execute their duties without any interference. Days are coming when their respect and dignity will be restored.


We urge our men and women in uniform to remain strong and resolute during this period. As we heard towards elections police officers and many other institutions should remember that it’s not only voting time but also the time to liberate themselves from PF cadres. Our first priority when in government is to clean up the public service and restore professionalism. We shall get rid of all the ghost PF workers who are draining our country’s treasury. We shall also restore order in the local councils; all markets will be managed by local authorities. Law and order will be our firm; you can’t develop a nation using lawlessness and disorder. This is what PF has done and we shall avoid it.


We shall make sure that our youths are given formal employment and business opportunities so that they can contribute to the development of our country. We shall also harness the God given talents and potential of our people. No one will be left behind; everyone will participate in building the economy of our country regardless of political affiliation, tribe and status in society. We shall not make hypocritical pronouncements of “one Zambia one nation” on the national broadcaster but in practice dividing the country. We shall practice the spirit of unity in truth and this is why we are called UINTED Party for National DEVELOPMENT. Unity and Development is vital for our country’s prosperity. A tearful Kanye West launches presidential campaign

WASHINGTON (Reuters) – In his first rally for his last-minute presidential campaign, rapper Kanye West ranted against abortion and pornography, argued policy with attendees and at one point broke down in tears.

West, 43, a former supporter of President Donald Trump who has left voters befuddled over whether his campaign is genuine or a publicity stunt to help sell albums or merchandise, delivered rambling remarks during the event at a Charleston, South Carolina, wedding venue and convention center.

In remarks that lasted just over an hour, he denounced abortion, swore, called on random members to speak, appeared to be putting forward policy proposals on the fly, and made comments that left even those in attendance muttering in disbelief.

“Harriet Tubman never actually freed the slaves. She just had the slaves work for other white people,” he said at one point when discussing economic inequality.

The event, which was livestreamed on YouTube and carried on local television stations, did little to clarify whether West is genuinely attempting to win the presidency. At times, he even seemed to suggest he was more interested in disseminating a message than winning the presidency.

West appeared on stage with “2020” shaved into the back of his head and wearing what appeared to be a military-style vest. He argued that abortion should be legal but heavily discouraged, suggesting he would promote a policy as president that anyone who gives birth to a child be given $1 million “or something in that family.”

West referred to the Bible and Christian teachings multiple times, and broke down in tears at one point while describing how he was nearly aborted by his parents.

“The only thing that can free us is by obeying the rules that were given to us for a promised land,” he said. “Abortion should be legal because guess what? The law is not by God anyway, so what is legality?”

The event carried few similarities with typical polished candidate events. The venue appeared to lack audience microphones, so West repeatedly told the crowd to be silent so audience members he called on could be heard.

Before we analyse the latest deception engineered by the Patriotic Front (PF) , let us summarise the key allegations at the heart of the Zambia Rwanda Terrorist financing scandal.

Note that none of the below is intended to imply any measure of guilt on the part of any individual, but merely an analysis of information available in the public domain.

The testimony by Major Callixte Nsabimana also known as “Sankara” alleges the following:

  • President Edgar Lungu gave Paul Rusesabagina $150,000 out of a total pledge of $1m towards the end of 2017. He further offered the rebels the ability to operate freely in Zambia.
  • The president allegedly sympathised with Rusesabagina for the treatment he had to endure under the Paul Kagame regime. Rusesabagina had great respect for the president due to the help / support he had offered fleeing Rwandan businessmen.
  • In early 2019, Nsengiyumva Appolinaire met with the President to discuss further support for overthrowing the Kagame regime.

We therefore have FIVE key players in this saga:

  1. President Edgar Lungu – the only Zambian Citizen alleged to be involved
  2. Major Callixte Nsabimana also known as “Sankara” – FLN leader, has already pleaded guilty to charges laid against him for attacks in Rwanda.
  3. Paul Rusesabagina – Another alleged FLN leader last known to be based out of Belgium with a trucking business in ZAMBIA setup in the late 90’s after fleeing Rwanda.
  4. Nsengiyumva Appolinaire – A Rwandan living in ZAMBIA operating an SME.
  5. Kayumba Nyamwasa – former Rwandan military chief, arch enemy of Paul Kagame, exiled in South Africa and accused of Terrorism in Rwanda. Despite an arrest warrant, brags about being able to visit Zambia often and has allegedly been seen visiting Zambia often lately.

Joe Malanji does not feature on this list, and therefore is most likely unaware if any of these allegations carry weight. He is merely acting on instructions.

As part of the trial in May 2019, Sankara alleged the involvement of high ranking intelligence officials in UGANDA and BURUNDI. Meanwhile the RWANDAN PROSECUTION alleged funding for this rebel group came from Rwandan refugees living in countries including ZAMBIA. Recruitment was also alleged to be happening in ZAMBIA.

Therefore, the initial allegations of terrorism financing and recruitment happening on ZAMBIAN soil came from the Rwandan prosecution, and by implication, the Rwandan authorities. The Zambian authorities did not/ have not respond to these allegations.

Around the same time, the Zambian Financial Intelligence Centre lays bare a case of terrorism financing that occurred in 2018, with funds flowing from Zambia to a state where terrorism activities are prevalent. The known individuals involved were linked to terrorism groups in that state. The case was transferred to “competent” authorities for further investigation.

DECEMBER 2019 to MAY 2020

In a complex web of transactions, ZCCM forms a joint venture with little known Sudanese investors (Karma Mining) for ZCCM to obtain a minority stake in a gold processing venture. In a transaction that appears to have failed basic due diligence measures, particularly due to Sudan being a known state sponsor of terrorism, as well as appearing of the sanctions list of the USA, UN, EU and UK. The sequence of events behind this transaction implies political connotations, and appears to have been forced onto ZCCM by the political elite.

A further venture was agreed into with Array Metals, who have exploration rights to $400m worth of Gold in Mumbwa. The players behind this group are Ugandans with no previous known gold mining experience. These Ugandans have suspected links to the political elite in Zambia and in Uganda, and officials are known to have business dealings with a UN sanctioned General from South Sudan.

The above two transactions, which leave the Zambian people with minimal benefits, coincidentally appear to be linked through the players and nations involved.

JULY 2020

As part of Sankara’s sworn testimony in court, startling new allegations are made, as summarised above.

The PF Government in a series of confused responses initially denies the claims without responding directly as to why the allegations cannot be true.

They then secretly (but exposed by eagle eyed citizens) send Joe Malanji as an envoy of the President to meet with Rwandan authorities. He returns and issues another uncoordinated and non-sensical statement saying that the Rwandans are equally surprised by the allegations, that they are not credible, and that Sankara had never travelled to Zambia. Bilateral relations remain intact.

ANALYSIS

Joe Malanji’s statements make no sense at all! It does not tally with the Rebel statement. This is why:

  1. Sankara never said he traveled to Zambia. He said the people who met the President were Rusesabagina and Appolinaire. These two individuals have irrefutable links to ZAMBIA. Can Malanji deny that these individuals have no Zambian links or have never visited Zambia?
  2. The Rwandan prosecutors themselves alleged involvement of players on Zambian soil. How can the Rwandan Government contradict themselves by saying the claims are not credible.
  3. Would the Rwandan Government be prejudicial and ignore the court case and allegations to clear Zambia of any involvement before the trail is concluded and judgement is delivered?
  4. What incentive would Sankara have to dream about the president’s involvement? How would Sankara even dream about individuals like Appolinaire being in Zambia?
  5. Why has the Rwandan Government been mute on the matter? Why have they not issued their own version of the meeting with Malanji or atleast confirmed the Zambian version as accurate?
  6. Why has Rwandan media not even reported this meeting and the contents thereof?
  7. Rwandan and Ugandan relations are strained. Zambian relations with Uganda are strong, and politically connected individuals between the two countries are involved in Zambian Gold. Is there a connection or is this a coincidence?
  8. Why is Zambia sending investigators if there is nothing to worry about? They should simply move on since they claim to have been cleared by the Rwandan Government.
  9. Why has Nyamwasa allegedly been allowed free entry into Zambia when he is on Rwanda’s most wanted list?

The reality is that Malanji may have misled the public with his version of events at the meeting with the Rwandan Government.

Sources in the Rwandan Government indicate that the actual discussions vary significantly from what we have been told. Zambia has been told to do more to prove that they were not involved. Hence the Rwandan Government has not yet issued its official position, and hence the panicked dispatch of Malanji to Rwanda.

It is also important to note that Kayumba Nyamwasa, former Rwandan military chief, arch enemy of Paul Kagame, has been allegedly allowed free movement into Zambia despite an arrest warrant. This has been noted by the Rwandan authorities as well and requires explanation.

THE ZAMBIAN PUBLIC

The challenge the people of Zambia have with the current government and leadership is a matter of trust.

Why can’t the government be open and honest with the public so that we remove the need for all this speculation.

If the government was so confident that the matter is a non-issue, as per the tone of the official state house statements, what was the need to sneak out senior officials into Rwanda for discussions.

Even if the president is innocent in this, how can we be confident that one of his many friends and associates has not used the name of the president to commit crimes? We have heard this over and over again from the PF. This is the reason why it is important that the president ensures he surrounds himself with people of good reputation and standing in society.

Why is it that the word “terrorism” keeps popping up in Zambia. First it was the FIC report, then ZCCM Gold Scandal with links to Sudan, a country sanctioned for state sponsored terrorism, as well as Uganda, a country mentioned as part of this plot and now sponsoring of terrorism in Rwanda.

NEXT STEPS

We propose the following:

  1. Can the government sue the accuser in the courts of law.
  2. Can they ask the Rwandan Government to issue a statement in defence of Zambia and validating the statement made by Malanji? Do they understand the ramifications for this country if there is even a bit of truth in the claims?
  3. There is a clear CONFLICT OF INTEREST. The President through his Minister cannot lead investigations into himself for these allegations. Therefore, we propose that a cross member panel/committee to be setup in Parliament to lead the investigations. Parliament shall then hold Government to account should any of the allegations be proven. Failure to allow an independent parliamentary committee to investigate will raise red flags and create mistrust.

The people of Zambia deserve answers and we demand answers now!

Quarrels Involving Ambassador Frank Bwalya, His Wife And Chef Attracts Australian Govt Involvement

Domestic arguments involving Zambia’s High Commissioner Frank Bwalya and his wife Joyce on one side and the Zambian female-chef employed at their residence has attracted the involvement of the Australian government.

Well placed sources familiar with the matter told Daily Revelation that there have been serious issues involving the Bwalya’s and the Zambian lady, only known as bana Chanda, who is employed by the Zambian government and attached to High Commissioner as chef at the envoy’s residence.

Sources said the main assertion is that High Commissioner Bwalya’s wife, Joyce Nkunika has not been treating Bana Chanda well.

Sources said the alleged mistreatment eventually led to the termination of employment of their worker.

Sources said since Joyce joined High Commissioner Bwalya, the Chef has been complaining about her welfare and her being fired from employment broke the camel’s back.

Sources added that the loss of her employment plus the mistreatment compounded the misery the chef was going through, which she is not taking kindly.

Daily Revelation understands that because of the nature of the arguments and her firing, forced High Commissioner Bwalya’s chef to complain to the Australian Department of Foreign Affairs and Trade (DFAT). DFAT is a government department (Ministry) that looks into the affairs of diplomats and is responsible for issuing visas to them.

The Department has taken the matter seriously, particularly that the chef was fired and expelled from the residence and was therefore being taken care of by the Australian government. The intervention is being handled by DFAT director for communications David Geyer, and has involved High Commissioner Bwalya and the chef who have been leveling counter allegations against each other. The head of administration at the Zambian Mission in Australia, Alick Banda has also been part of the meetings, but refused to comment on the matter when contacted by Daily Revelation.

However, when contacted by Daily Revelation, Ministry of Foreign Affairs permanent secretary Dr Ronald Simwinga said the Ministry was not aware about the matter but had asked High Commissioner Bwalya to give his side of the story

“Now this is what happened like I told you yesterday I was being very frank, I wasn’t aware and nobody was aware at the office so we have asked Frank, High Commissioner Frank to give his version of story because we cannot write what we don’t know. You get my point? So we have said look we have received this query so what is it about?” Dr Simwinga said. “Because he has never logged in with us that there was a problem. So for us as far as our records are concerned the status quo should have been the case. So according to our records the lady is working at the house and there is no problem because there is no report of any.”

He said as far as the Ministry of Foreign Affairs was concerned, the chef, according to the records of the Ministry, was still on the books of the Mission.

Asked if the Ministry had also attempted to get in touch with the Australian government over the matter, Dr Simwinga said the Ministry could not get in touch with the Australian government directly as there was an Embassy there already, but the Ministry had already made arrangements with the Zambian Embassy in Harare, Zimbabwe to get in touch with the Australian Embassy there so that they could get in touch with their government (as per diplomatic communication channel and protocol).

On the final query made to Dr Simwinga as a follow up on the query regarding the matter, the permanent jokingly said: “I report to you eh? It’s like you are telling a junior that I have been waiting for that file, how come you are not bringing it? That’s how you press people are powerful eh you can make the PS jump.” – Daily Revelation

Advice To UPND On Bill 10: After Dismissal Of Jack Mwiimbu’s Court Case Focus On Walk Outs – Peter Sinkamba

ADVICE TO UPND ON BILL 10: AFTER DISMISSAL OF JACK MWIIMBU’S COURT CASE FOCUS ON WALK OUTS

It is quite saddening that an application by Monze Central UPND Member of Parliament Jack Mwiimbu who sought leave to commence judicial review proceedings to challenge the decision of the Speaker of the National Assembly Dr. Matibini to allow the restoration to the Order Paper for consideration of Constitution (Amendment) Bill No.10 of 2019 was dismissed at preliminary level. How I wish the application was heard and dismissed on merits after a thorough, rigorous interrogation.

This application was dismissed because the Zambian legal system of has two sets of opposite laws. We have duality in the Zambian legal system. One set of laws stipulates that if one intends to challenge an administrative decision of a Government official, and seeks reliefs such as mandamus, prohibition or certiorari, then an application for judicial review must be made to the High Court. This set of laws stipulates further that no application for order of mandamus, and other reliefs, must be made without leave of the High Court. And that if leave is denied, the furthest one can go in pursuing such reliefs is by way of renewal of the application for judicial review in the Court of Appeal.

Now, suppose the relief sought is constitutional in nature, can one apply for judicial review directly in the Constitutional Court? The answer is no. The court of first instance in judicial review proceedings is the High Court. If one skips the High Court, and goes to the Court of Appeal, then such an application will be thrown out. Again, if one applies for judicial review directly in the Constitutional Court, most likely the application will be thrown out on a jurisdiction technicality. First of all, it is important to note that rules of the Constitutional Court only provide for an application to review an administrative decision if that decision concerns the Electoral Commission of Zambia in the delimitation of constituencies and wards. Anything else, Order 53 of the Supreme Court Rules (White Book) whereby on must apply to the High Court is mandatory.

To make matters worse, judicial review is discretional power of the court which the High Court and Court of Appeal are extremely reluctant to exercise. That is reason why, for example, the Judge Sharon Newa in this case of Jack Mwiimbu did not refer the matter to the Constitutional Court even though Article 128(2) of the Constitution provides that where a question relating to the Constitution arises in a court, then the person presiding in that court should refer the question to the Constitutional Court.

It is these kinds of dualities and contradictions we need to sort as matter of priority if the Green Party is elected into Government next year.

Justice Sharon Newa ruled that the matter which Mwiimbu brought before court raises issues of a constitutional nature and therefore she had no authority to determine it as it was the preserve of the Constitutional Court.

“Even if I had jurisdiction to interrogate the exercise of the Speaker’s powers pursuant to the internal practices and procedure of the National Assembly as submitted by the Attorney General, it would ultimately involve interpretation of the Constitution from which the said powers are derived. As [can be] seen, I have no such jurisdiction as it is vested in the Constitutional Court,” said judge Newa.

“On that basis, I find that this is not a case that is fit for further investigation and I accordingly decline to grant leave to commence judicial review proceedings and dismiss the matter,” she added.

In this country we have dualism in our legal system. As dualism stands today, the legal system is incapable of substantially restraining top government officials from overreach through the judicial review processes, and does not protect the rights of citizens from their government or indeed hold their government accountable.

We need to have a constitution and laws that impose strict limits on some powers of government officials, especially the President, Chief Justice and Speaker. But, as we have discovered in the past three decades, no constitution can interpret or enforce itself. It must be interpreted by men and women. But the question is: which men and women? If the ultimate power to interpret the constitution and laws is given to the government’s own courts to exercise discretional power, then the inevitable tendency is to continue to place ever-broader powers for court’s own government. The ultimate result is that the highly touted “checks and balances” and “separation of powers” in a government system is rendered flimsy indeed. We need to change this.

Mwiimbu wanted an order of certiorari to quash Dr Patrick Matibini’s decision to allow the deferment of the proceedings relating to the controversial Constitution (Amendment) Bill No.10 of 2019 to a date yet to be advised within the fourth session of 12thassembly.

He was also seeking an order of mandamus, directing the Speaker to discontinue any or further consideration, debate or other proceedings relating to Bill No.10.

In addition, he wanted a declaration that Dr Matibini’s decision was invalid, null and void and of no effect, and an order that all proceedings in the National Assembly relating to the bill be stayed until after the determination of the matter or further order of the court.

Mwimbu sought reliefs on grounds that Dr Matibini’s decision was unreasonable and irrational without justifiable reason following the lapse of the Bill on June 4, 2020 and was not amenable to further consideration, debate or process in Parliament.

All the reliefs sought make sense. However, our legal system is like being trapped between a rock and hard place: same difference.

Advise to UPND, focus on walk out. At least on that aspect the Speaker has ruled it is within your rights.

Jack Mwiimbu takes Bill 10 to Court of Appeal

MONZE Central member of parliament Jack Mwiimbu has renewed his application for leave to commence judicial review proceedings in the Court of Appeal to challenge the decision of the Speaker of the National Assembly to allow the restoration to the order paper for consideration of Constitutional (Amendment) Bill No.10 of 2029.

This comes after Lusaka High Court judge Sharon Newa dismissed his application for Judicial review on grounds that the matter raises issues of a constitutional nature but she had no authority to determine it as it was the preserve of the Constitutional Court.

Mwiimbu wanted an order of certiorari to quash Dr Patrick Matibini’s decision to allow the deferment of the proceedings relating to controversial (Amendment) Bill No.10 of 2019 to a date yet to be advised but within the fourth session of twelfth assembly.

Mwimbu was seeking an order of mandamus directing the Speaker of the National Assembly to discontinue any or further consideration debate or other proceedings relating to Bill 10.

He also wanted a declaration that Dr Matibini’s decision was invalid, null and void and of no effect and an order that all proceedings in the National Assembly relating to the Bill be stayed until after the determination of the matter or further order of the court.

Mwimbu sought reliefs on grounds that Dr Matibini’s decision was unreasonable and irrational, without justifiable reason following the lapse of the Bill on June 4, 2020 and was not amenable to further consideration, debate or process in parliament.

But Deputy Clerk of the National Assembly Cecilia Sikatele in an affidavit in opposition to Mwiimbu’s application for leave to commence Judicial review proceedings argued that there was no express provision in the National Assembly Standing orders of 2016 which governs the time within which a Bill must be considered at any stage of enactment.

Sikatele charged that the issues raised by Mwimbu and the subsequent reliefs sought were wrongly before the Lusaka High Court because they raise matters of a constitutional nature.

She said the High Court was incompetent to hear and determine the issues raised by Mwimbu therefore the case should be dismissed for want of jurisdiction.

Sikatele stated that the standing order’s committee which was the highest decision making body of the National Assembly was charged with the responsibility of considering proposals for the management of procedures and practices of the National Assembly.

However, Mwiimbu argued that standing orders do not give the standing orders’ committee any power to extend the life of the Bill.

The leader of the opposition said the decision by the Speaker of the National Assembly to allow the continued consideration and deliberations on Constitutional (Amendment) Bill No.10 of 2019 is amenable to review by the Lusaka High Court.

In his Affidavit in reply to the respondent’s affidavit in opposition to the affidavit verifying facts, Mwiimbu denied that the matter was in any way constitutional in nature as it was anchored purely on the established practice and procedure of the National Assembly as prescribed in the internal rules and regulations of the National Assembly that govern practice and procedure.

Mwiimbu said the rules and regulations of practice and procedure were prescribed in the standing orders of 2016 and various handbooks issued by the National Assembly from time to time and not in the constitution of Zambia.

“The argument that after deliberations the standing orders’ committee resolved to extend the life of the Bill to a date to be communicated not later than the last day of the meeting, exposes the illegality of the Speaker’s decision to allow the continued consideration, debate or other proceedings relating to Constitutional (Amendment) Bill no.10 of 2019 in so far as the state confirms that the standing orders committee extended the life of the Bill on March 24,2020,” Mwiimbu said

“The standing orders do not give the standing orders’ committee any power to Act in the manner that it had purported to do contrary to what is deposed by the state.”

However, judge Newa said on account of exclusive cognizance given to the National Assembly by Section 34 of the National Assembly, the Speaker being protected from any court action where he exercises his powers under the internal procedure of Parliament, would only be amenable to such a court action if he breaches the Constitution in exercising his powers.

She said the Constitutional Court by virtue of Article 128(1) of the Constitution is the court vested with jurisdiction to deal with such matters.

“Even if I had jurisdiction to interrogate the exercise of the Speaker’s powers pursuant to the internal practices and procedure of the National Assembly as submitted by the Attorney General, it would ultimately involve interpretation of the Constitution from which the said powers are derived. As seen I have no such jurisdiction as it is vested in the constitutional court,” judge Newa said.

“On that basis, I find that this is not a case that is fit for further investigation and I accordingly decline to grant leave to commence judicial review proceedings and dismiss the matter. Looking at the fact that the matter seeks to enforce matters of national interest, I order that each party bears their own costs of the application. Leave to appeal is granted.”

Zambezi River Authority increases water allocation to Zesco, ZPC

THE Zambezi River Authority has increased to 4 billion cubic metres water allocation to Zesco and its sister power utility in Zimbabwe, ZPC, for power generation.

In a second quarter update of the water levels at the Kariba Dam, ZRA chief executive Munyaradzi Munodawafa said, “Following a review of hydrological outlook at Kariba undertaken at the end of the second quarter of 2020, the authority has since increased the water allocation for power generation operations at Kariba by four billion Cubic Meters (4BCM). As per agreed operational framework for Kariba, the additional water allocation will be shared equally between Zesco Limited and Zimbabwe Power Company (ZPC) for their respective power generation operations at Kariba. This is an upward revision of the combined water allocation for the year 2020 from 23BCM to 27 BCM.”

The Zambian government has all along been blaming low water levels in Kariba dam as reason for the increased debilitating load-shedding the country has been experiencing.

The government and the power utility, Zesco, now say load-shedding is expected to end in December.

Munodawafa, however, added that the ZRA would continue monitoring the hydrological outlook for the Kariba catchment and water levels at the dam.

Munodawafa, however, said as per historical trends following the end of a rainfall season, flows of the Zambezi River and its tributaries receded.

He said the authority had continued to gather and record daily water level readings at its 14 gauging stations located within the Kariba catchment area.

“Of these, two key gauging stations namely, Chavuma and Victoria Falls are pivotal [as] regards the gauging of the overall inflows into Lake Kariba. The recorded flows at the two stations, including the lake itself are as follows: The Zambezi River flows recorded at Chavuma rose from 236 cubic meters per second (m3/s) recorded on 1st January 2020 to double peak flows of 5,006 cubic meters per second (m3/s) and 5,825 m3/s recorded on 25th February 2020 and 17th March 2020, respectively, before receding,” Munodawafa said further.

“The flows recorded this week at Chavuma have been of the order 330 cubic meters per second and receding as per historical trends. The flows recorded last year during the same period were lower and in the order of 120(m3/s) and also receding. The Zambezi River flows recorded at Victoria Falls rose from 349 m3/s recorded at the start of January 2020 to double peaks of 4,289 m3/s and 4,568 m3/s recorded on 31st March 2020 and 3rd May 2020, respectively, before starting to recede.”

He said as of July 16, the flows at Victoria Falls had receded to 1,099 m3/s, 88 per cent higher than the 585 m3/s flow recorded same date last year.

“Following the commencement of the rains, the lake water levels began to increase starting on 12th January 2020, with the lake level steadily rising from 476.71m which was barely 1.21 meters (m) above the minimum operating level (MOL), to reach a peak of 481.30m recorded on 30th June 2020, with a corresponding usable storage of 26.94 Billion Cubic Meters (BCM) or 41.57 per cent live storage,” said Munodawafa.

“Thereafter, the lake level started receding. As of 16th July 2020, the lake level had receded to 481.21m, representing 40.89 per cent live storage or 26.50 BCM of stored usable water. This left the lake level at 5.71m above the minimum operating level (MOL) of 475.50m.”

Sishuwa condemns police beating of PF cadres

SISHUWA Sishuwa says it is wrong for police to beat up people instead of just arresting them.

On Thursday, police in Lusaka, led by deputy Inspector General in charge of operations Bonnie Kapeso, beat up PF cadres who went to give solidarity to corruption accused health minister Chitalu Chilufya.

Commenting on the beating of PF cadres by police at the Lusaka Magistrates’ Court on Thursday, Dr Sishuwa, a historian and University of Zambia lecturer, said police brutality should be condemned, regardless of who the victim was.

“I note that some people are happy that it is the PF cadres on the receiving end of police violence. No, it is wrong to beat PF cadres much in the same way that it is wrong to beat UPND cadres, or indeed anyone else. But this is what Mr Edgar Lungu and the PF have reduced us to: a people that is so polarised on political lines that we have lost our basic sense of humanity and see each other first as PF or UPND,” he said.

“Why can’t we see those people primarily as human beings or suspects who deserve to be arrested in a humane manner? I fear that we, as a country, are sliding on a very dangerous slope. If this political polarisation, coupled with the loss of public confidence in the vital institutions of government such as the police or the electoral commission, is not stopped before the next general elections, we must prepare for the worst, including possibly civil strife and a bloodbath. Would Mr Lungu consider rising above partisan considerations to provide the required effective leadership? I hope he does.”

Dr Sishuwa said police displayed sheer indiscipline and unprofessionalism in their conduct.

“It is total indiscipline and lawless for the police to act in an unprofessional manner. The lawlessness of cadres will only stop when the police begin to arrest the culprits and prosecute them, as per their professional role. Beating is not the answer,” Dr Sishuwa said further.

“l have previously condemned the police’s beating of UPND supporters. I condemn the police for beating PF cadres or indeed anyone else for that matter. It is also wrong for the police to beat people for expressing their political choices, as long as those concerned are not violent or breaking any law. What the police are doing, beating cadres, is to institutionalise violence. They are giving cadres reasons to attack them in future since they are now equal partners in committing acts of violence.”

He said by beating cadres, police risked losing their legitimacy.

He said police were supposed to be professional in their work.

Dr Sishuwa said police unprofessionalism had in fact justified such actions from cadres.

“It is the body’s lack of professionalism which justifies the cadres’ action to protect themselves from police violence, including by beating up police officers. After all, the police have breached the condition for their monopoly over violence, namely to act in accordance with the law,”Dr Sishuwa said.

“It’s important to remember that the core operational duties of a professional police service are to maintain law and order, protect members of the public and their property, prevent the commission of offences and to bring the offenders to justice. To effectively execute these responsibilities, the police must possess the authority, widely recognised by the public, as the lawful and rightful body to enforce them and to do so in a professional and impartial manner that builds public confidence in the institution and helps improve the quality of life for all citizens.”

Dr Sishuwa said the Zambia Police Service had unfortunately lost legitimate authority by turning themselves into political party cadres.

“It is precisely this authority that has deserted the police in Zambia today. The public, rather than viewing it as an apolitical and professional body that is out to protect individual liberties of all Zambians regardless of their political affiliation, now regards the police as nothing more than hired agents of the party in power,” said Dr Sishuwa.

“This is because the executive branch of government has corrupted the police, as it has done to other state institutions, to primarily function as a sword for the elites in power and their supporters. A fundamental part of corruption is corrupting the system, including the police, the judiciary, and other supposedly independent state institutions in order to legitimise wrong and even illegal actions. This is precisely what the PF has done in order to entrench their grip on power and rule by force or the threat of such force: destroying the instruments of governance in such a way that anybody who stands in the way of their project risks being penalised or disciplined.”

PF indirectly promoting one-party state – Mudenda

A CIVIC leader in Bweengwa Constituency says it is retrogressive for the PF to indirectly promote a one-party state.

In an interview, Maybin Mudenda said the recent fierce battles in Mufulira and calls from the PF members to bar opposition UPND leader Hakainde Hichilema from going to certain parts of the country were a clear indication that Zambia was no longer a democratic nation.

“It is retrogressive of the highest order for the PF to disregard democratic style of governance and embrace one party state kind of leadership against the wish of many Zambians. We fought the one-party state as a united front and it’s retrogressive of the highest order to try and get into the same vomit,” he said. “In the shortest time under this current PF regime, we have seen some pockets of violence in the Copperbelt and, hence, the Mufurila saga. A citizen by the name of HH is featured on the radio station and PF cadres attempt to break in to beat him up. This clearly indicates that such violence has a blessing of the PF leadership.”

Mudenda said there was need for PF to understand that Zambians were one people regardless of their political divide.

He wondered what was scaring them about Hichilema’s presence around the country.

“What is it that the PF doesn’t want people to hear from HH on that media? Politics is a competition of ideas and not violence. We have seen some chiefs without shame championing tribalism and taking a political position in promoting a no-go area to some citizens. We hold chiefs in high esteem to unite and offer leadership in these darkest hours of our country when peaceful protest and freedom of expression seem to be a preserve of those in the corridors of power,” said Mudenda. “Our lives begin to end when we have a regime that forces citizens to be quiet on issues that matter. Every statement issued by a leader has an effect on the citizenry, hence there is need for them to be responsible in their utterances. A national leader in a position of a provincial minister like Bowman [Lusambo] needs to understand that cadreism must be above his reach. Bowman Lusambo made a public declaration that Copperbelt is a no go area for HH. I appeal to President Edgar Lungu to tame Lusambo as a leader for he seems so excited with power that does not last forever. Let him be given a refresher course so that he gets to know his responsibility as a provincial minister.”

When Colombian pop star Shakira attempted to pass the 2010 official World Cup anthem off as hers, saying she was inspired on a return from a barn to her home, many people online found the claim to be curious.

Curious because in 1986, the Golden Sounds, a group made of Cameroon’s President guards formed in 1984, recorded a tune called Zangalewa. The song became an instant hit across Africa and beyond prompting the group to rename itself Zangalewa.

The song supposedly was made for African soldiers who fought to liberate Europe from being colonized by the German force in 1945 (Cameroonian riflemen who took part in the Second World War). It was also directed towards African soldiers who seized power and oppressed their people in the interest of colonial forces on the continent.

Released shortly after television found its way in the country, viewers took interest in the song for its danceable rhythm and also for the dance moves and costume of the singers. They would often wear military clothes, stuffing clothes so their stomachs and appear ridiculously big from riding trains or eating too much, African Brew explained.

When Shakira released a rendition of the song in 2010 – Waka Waka (This Time for Africa) – without permission from Zangalewa, it led to, according to reports, an online campaign for the African group to be duly compensated over issues of copyright and plagiarism.

The beat and the melody, particularly the chorus, heard in Shakira’s Waka Waka are all very similar to the original version Zangalewa. The online pressure yielded fruit in May 2010 when Sony, Shakira’s management and members of the group, Zangalewa, reached an out-of-court settlement.

The music video for Waka Waka (This Time for Africa) directed by Marcus Raboy remains popular on YouTube, receiving 2.5 billion views as of May 2020.

Waka Waka (This Time for Africa) featuring Zolani Mahola of the South African group Freshlyground peaked at number one on record charts of fifteen countries worldwide. In the United States, it was certified platinum by the Recording Industry Association of America (RIAA) for selling over one million units in the country. It was the biggest song of 2010 in seven countries.

Zangalewa, the Makossa group from Cameroon (Jean Paul Zé Bella, Dooh Belley, Luc Eyebe and Emile Kojidie) released four albums – the one that included the song in question was awarded ‘record of the year’ in Cameroon.

The song was also popular in Colombia where it was known as The Military, brought to the country by West African DJs where Shakira, a native, likely heard the tune.

The National Democratic Congress, NDC, would like to distance itself from the comment of its Copperbelt Provincial Chairman made in relation to Bill 10 and the death of two Members of Parliament, namely Honourable Munkonge and Hon. Rodgers Mwewa.

We have been trying to get hold of our Provincial Chairman and his phones are switched off.

The President, Dr. Chishimba Kambwili in fact called the Munkonges yesterday and they told him that there was no funeral gathering. He also called the widow to Hon. Mwewa who confirmed that there is a funeral gathering and the party is therefore, visiting the funeral house today.

‘I talked to Annie Sitali Mwewa yesterday, the widow to Hon. Mwewa and we are actually preparing to go to the funeral just now. The Munkonges said that there is no funeral gathering for him,’ president Kambwili said.

Dr. Kambwili said that the reckless and irresponsible statement from the party’s Copperbelt Chairman had no blessings from the party as life was more important than any Bill, including Bill 10.

‘The statement has no blessings from the party and we would like to distance ourselves from it,’ the NDC leader said.

The NDC would like to appeal to all its members to refrain from issuing statements that may likely put the name of the party and president into disrepute.

Office bearers, even when they issue statements in their individual capacities, should be mindful of their offices and be cognisant of the impact that such may have, especially in such trying times. The statement of the Copperbelt Chairman is being referred to him in his official party position and it is very regrettable that he made such an insensitive statement, albeit in an individual capacity.

The NDC moans with the departed colleagues, who were not only fellow politicians but friends at a personal level and individuals that worked hard in their communities to uplift the lives of the people.

We regret the inconvenience, grief and anguish that the statement may have caused and we reiterate the need to mourn our departed friends with love, respect and dignity regardless of political party affiliation.

Address The Nation On Terror Allegations, Sean Tembo Tells Lungu

3RD Liberation Movement leader Enock Tonga has asked why out of all the Heads of State in the world President Edgar Lungu’s name has been mentioned in terrorism.

Meanwhile, Sean Tembo has demanded that President Lungu himself addresses the nation on allegations that he financed a Rwandan rebel group against that government.

Callixte Nsabimana aka Major Sankara who claimed to be the head of Rwanda rebel group National Liberation Force (NLF) told the judge at the International and Cross-Border Crimes in Nyanza, a district in southern Rwanda, that President Lungu helped rebel factions to attack Rwanda.

NLF is a military wing of a Rwanda opposition political party, the Rwandan Movement for Democratic Change led by Rwandan dissident Paul Rusesabagina, known for protecting people during the 1994 Rwandan genocide as a manager of Hotel des Mille Collines.

But State House has rubbished the rebel leader’s revelation and foreign affairs minister Joe Malanji, who President Lungu sent as a special envoy on Thursday on Friday said that Rwanda’s President Paul Kagame does not want to give credence to the allegations made by the convict.

Several stakeholders have questioned President Lungu’s casual approach to such a serious matter and asked him to personally speak to the public directly, rather than through his press aide.

In a statement yesterday, Tonga wondered if President Lungu had amassed so much money that he could fund terrorism.

“Could our Zambian President be a terrorist? Could President Edgar Chagwa Lungu be mistakenly implicated in identity and roots issues? Has President Edgar Chagwa Lungu made so much money as a President of Zambia that now he has nowhere to take the money to, but to fund a rebel leader in foreign land like Rwanda – if indeed the allegations are true?’’ he asked.

‘’Why, out of all the Presidents across the world, only the name of one Dr Edgar C Lungu emerged from the mouth of Callixte Nsabimana, the rebel leader of National Liberation Front (FNL) in the Rwandan High Court? The above and many more questions are turning our hair grey when we are still young. So many questions without answers.”

He said people remained with so many unanswered questions, demanding explanations.

Tonga said the argument about Zambia not sharing any border with Rwanda does not make sense.

“For now, we can only say mukalondolola (you have plenty to explain) – time is coming that you will all be made to explain as to why. Be reminded that we have Zambian-Rwandese here in Zambia, not having any border with Rwanda can’t hold any water,’’ Tonga said.

‘’Remember Adolf Hitler’s dictatorship period of 1933 to 1945, where he initiated World War II. He was able to attack and invade countries, which were beyond Germany’s borders. Mukalondolola! Let’s do it for Zambia.”

Tonga said going by the statement of Malanji, the public still deserved to know the truth on the matter.

He said there was no way President Lungu could send an envoy if the issue was trivial.

“We can safely conclude that, YES, the FNL leader mentioned our humble President, one Dr Edgar Chagwa Lungu. But why? Was Callixte ‘Sankara’ Nsabimana out of his mind at a time he was mentioning President Edgar Chagwa Lungu?” asked Tonga further.

“Joseph Malanji says that beyond President Edgar Lungu and Paul Kagame’s cordial and sound friendship which both leaders enjoy, Zambia-Rwanda bilateral relations remain intact. On his fact finding mission, Malanji reports back to Zambia to say President Kagame informed him that the allegations are not credible as prior to his arrest, Callixte ‘Sankara’ Nsabimana had travelled to five (05) countries, excluding Zambia and that the government of the Republic of Zambia will continue to investigate as to why Callixte ‘Sankara’ Nsabimana chose to falsely mention our humble President, one Dr Edgar Lungu in his court testimony.”

And Tembo, president of the opposition Patriots for Economic Progress (PeP) party, said it was wrong for President Lungu to use his aide to respond to such a serious accusation.

“We wish to take this opportunity to appeal to President Edgar Lungu to personally address the nation on the serious allegations that are reported to have been leveled against him that he financed a dissident rebel group in Rwanda to the tune of US$150,000 for the purpose of toppling a duly elected government of that country,” he said in a statement yesterday.

“It is important for the President to personally address these allegations so that the citizens of this Republic can look him in the eyes and make their own judgment on whether he is saying the truth or not…. Our expectation was that President Lungu himself would directly address these allegations in a press briefing that would also allow journalists to ask him questions.”

Tembo said allowing other people to speak for him would make more people doubt his denial of the allegation.

He also condemned National Democratic Congress leader Chishimba Kambwili, who was quick to defend President Lungu before he understood the matter.

“Such an approach would build confidence in the eyes of the general public that these allegations against President Lungu are baseless and that the President has nothing to hide. However, we find it very regrettable that instead of President Lungu addressing these allegations himself in person, he decided to delegate his press aide, Mr Isaac Chipampe, who issued a very narrow and shallow statement. Our view is that Mr Isaac Chipampe’s narrow and shallow statement on this matter coupled, with President Lungu’s avoidance of directly addressing the allegations, has the overall impact of adding credibility to the allegations,” said Tembo.

“It is our firm belief that when an individual is accused of committing an offense, it is only that particular individual that can dispel the allegations. Suffice to mention that we find it strange that some opposition leaders in this country have been very quick to dismiss these allegations against President Lungu as false, as if they are always in the company of the President such that they know each and every little thing that the President does. Our view is that only the President can defend himself in this matter. Any other person or opposition leader that jumps to the defense of the President without any basis for such a defense, is only doing so in an effort to endear themselves to the President and possibly seek presidential favours in future.”

Defence minister Davies Chama says no Zambian can be unhappy at the improvement happening in the nation, including the men in uniform.

Speaking with Daily Revelation, Chama said only those who did not mean well would be unhappy over what he described as the country’s rapid transformation within a short period of time. He said even those in the defence forces were happy over the work the government was doing for them, saying a lot has been done in terms of improvement in housing units, in areas like Kamwala, commissioning of the 48 marine units in Kawambwa.

“So there is a lot of infrastructure improvements in terms of their housing and generally their welfare even in terms of equipment holding, a lot of things have improved greatly. It’s only that you caught me napping I don’t have notes to give you the necessary details,” Chama said. “Yes indeed they (men in uniform) are happy, they are very much happy, they are very much happy. Muli bama setting ba journalist, pakuti unchitefye quote ati ah people are not happy. Why are you like this? Indeed me I’m a happy soul and every Zambian is supposed to be happy.”

Chama said people only needed to look at what is happening in the nation, and that only those who were anti-progress would not see the transformation.

“Which Zambian cannot be happy? Unless those who don’t mean well. The transformation that has happened within a short period of time. Look at the improvement to the nation, things are changing for the better,” Chama said. “And I have said in the next 50 years (the timeframe he says PF will be in power) you can just project at this rate at which we are moving consistently, Zambia will be a different country altogether. So unless those people who are always anti-progress, the enemies of progress they are the only ones who cannot.”

Asked what format Mulungushi Textiles would take, whose reopening President Lungu announced for the second time recently having already announced another reopening in 2016, Chama said Zambia would hold 34.66 shares, with China holding the rest.

“From estimates we are looking at $150 million investment, from both parties, each share holder have to meet their own,” said Chama.

On the allegations linking President Lungu as having partaken in sponsoring attempts to overthrow the Rwandese government of Paul Kagame, Chama said the journalists must go with the statement that was recently issued from State House, saying there was no truth in the allegations against the President.

Foreign affairs Minister Mr Malanji returned from his secretive mission to Rwanda today and immediately held a triumphant press briefing, in which he declared the Bilateral Relations between the two Nations as Intact.

Now this is very curious. The Government of the republic of Rwanda have not made any official comment on the revelations made in court regarding our President’s alleged involvement in supporting some rebel groups. I presume this is because those revelations were made during court proceedings and those proceedings are still active before the Rwandan courts of Law. As such Rwanda has not accused Zambia of anything that would strain the relations between the two Nations.

The question one asks therefore is, given that the allegations were made during court proceedings and that those proceedings are ongoing, why and how then did the Zambian government consider it prudent to send the Foreign Affairs Minister to get the assurance from President Kagame regarding our relations with Rwanda?

A few questions beg to be answered. We went into a foreign country to discuss a case that is active before the courts of Law. Was this mission an attempt to get President Kagame to interfere in court proceedings on our behalf, because that is what we would have done in our country to cases that touch the ruling elite? Why would President Paul Kagame tell Mr Malanji that the Rwandan Government does not give any credence to the allegations being made by the Rebel leader, when it is his own Government prosecuting this rebel leader?

If the issue is about bilateral relations, surely there would have been a joint press briefing with our Rwanda counterparts to affirm those relations. Is the reason that this is done this way because the Rwandan Government would rightly want to see this case get to it conclusive end? That would explain the new angle the minister in trying to sneak in, of someone inciting the rebel leader to make this allegation. There are no prices for guessing who that person enticing the rebel leaders is supposed to be.

The importance and speed with which those in and around State House are moving on this issue tells us it is wise to for us to be patient because this case is still unfolding.

REMEMBERING FTJ CHILUBA’S FAILED THIRD TERM ATTEMPT AND HOW IT EXPOSED, AS SHALLOW AND SHAMEFUL, THOSE WHO BLINDLY AND ARROGANTLY SUPPORTED IT:- HISTORY ABOUT TO REPEAT ITSELF

During the whole period of almost one year of the unnecessary, unproductive and divisive debate on his unconstitutional third term bid, President Fredrick Titus Chiluba knew what he was doing, but he cleverly, conveniently and covertly kept the cards to his chest.
From the early 2000 up to May 2001, FTJ pretended not to be interested in the third term debate, not interested in the prospects of a successful third term bid in his favor, he was overly non-committal.
But deep down his heart and behind the scenes, he was a major player, financier and ultimate beneficiary.

Though he wasn’t even a lawyer, FTJ knew that according to the current constitution that time, he was not entitled and didn’t stand a chance to run for a third term, so he had to look and come up with some crooked and dictatorial scheme of manipulating the constitution so as to allow him to stand again.

So through his supporters and other surrogates, they came up and put into high gear motion a call for a referendum to change the Presidential term of office.

Not to be seen as an interested party, FTJ then left the whole dirty and donkey work of the third term campaign to be done and driven by his surrogates like;

  • Some compromised Pentecostal men and women of god, the Pastors who started preaching to the whole nation the gospel of CHILUBA IS GOD CHOSEN.
  • Some compromised one-man or two-man civic organizations which were hurriedly and secretly formed to push the third term agenda.
    These empty tins but vocal civic organizations were heavily funded by the ruling party to mount the third term massive campaigns through campaign posters, Billboards, Newspaper adverts and several other media appearances.
  • Some compromised and hungry cadres and some senior party members within the MMD.

Interestingly enough, these included even some seasoned politicians like Michael Chilufya Sata, who were used but later on dumped when third term bid failed to work out.For the first time in the history of Zambian politics, we started witnessing the parading of our traditional leaders, their Royal Highnesses to, out of ignorance, support the third term bid..
That was the beginning of the eventual decay and disrespect of the institution of Chiefs.

Notwithstanding the above efforts and all those rented groups and their ill intentions, political dribbling and engineering, they all failed to secure GOD GIVEN FTJ’s third term bid, a very good example of not using God’s name for personal and political expediency.
On 4th May 2001, amid a barrage of local and international pressure and condemnation, President Fredrick Titus CHILUBA backed down..
During his State House press conference Mr CHILUBA dropped the much awaited Political bombshell announcing that:-
” I’m not going to stand..
I want to make it clear, clear, clear, I’m not standing for a third term.
I also want to make it categorically clear that there will be no referendum..

There can never be a referendum if am not standing.”
Zambians wasted over one year of productive time fighting the unconstitutional third term bid and afterwards all hoping that FTJ lesson and episode would teach other subsequent republican Presidents a lesson: To not only respect the constitution of the land but also the will of the people, the Zambians.

Unfortunately, people don’t learn from history.
As Zambians, we are back again fighting the same unconstitutional third term bid and similar sponsored mobs that we vigorously fought in 2001.
They have regrouped again, same type of Men and Women of god now calling themselves Christians for Edgar Lungu.

They have regrouped again as briefcase Civic organizations mounting Bill 10 campaign billboards from unknown but definitely same political sponsors.

They have regrouped again as Shallow and Shameless leaders and cadres of the ruling party and unfortunately some of our Royal Highnesses, the Chiefs have been Incorporated.

They have ALL regrouped to again deceive the current Head of State, Edgar Chagwa Lungu, that he has the chances to run again.
They have regrouped again to push for constitutional changes, contained in BILL 10, which changes Zambians have overwhelmingly and roundly rejected.

But the goodness and consolation to the Zambians is that History Always Repeat ITSELF.

The constitution is PEOPLE DRIVEN.
Soon and very soon, all these illegal Third Term and Bill 10 Political gymnastics will come to pass and all those supporting this illegality will all run away from President Edgar Lungu.

Just as they did to FTJ, most of them will again scamper in all different directions, faster than the RATS they eat.

‘Amended’ Bill 10 still the original bad, destructive bill – Chikoya

THE Council of Churches in Zambia (CCZ) has expressed deep concern at government’s preoccupation with the enactment of Bill 10 in its original form.

General secretary Fr Emmanuel Chikoya said the amended National Assembly Constitution (Amendment) Bill No. 10 of 2019 had a lot of unfair, ambiguous and undefined clauses.

He warned all stakeholders not to be abstracted by the recently gazetted and purportedly corrected Bill 10 with input from the select parliamentary committee.

“The right thing to do when you have a poisoned chalice is to either pour its contents, clean it up and refill it before people can drink from it. It is a well-known fact that when it comes to voting, the voice of reason is ignored because people want to be politically correct. We, therefore, call on all well-meaning Zambians not to be swayed by the recently circulated Bill 10 because it is still the original bad Bill that is destructive to our democracy,” he said in a statement. “It is our firm belief that if enacted into law the proposed Bill will have a retrogressive impact on our democracy. A good Constitution is a constitution that should not be imposed on the people by force and manipulation, but rather the people themselves must be involved in the formulation and promulgation of their Constitution. A Constitution is for the whole nation and not just for a few politicians.”

He said out of the 79 clauses contained in Bill 10, there were some retrogressive clauses that render the amendment bill defective.

Fr Chikoya said the proposed changes to the Constitution as contained in Bill 10 fell as they seem to have a narrow perspective, contrary to the expected national perspective.

“As CCZ we still stick to our position that it is very important to involve the people in the process of making and, or amending their constitution because a constitution should reflect their ideas, values, interests and aspirations. Unless the people embrace the constitution as their own brainchild, they may not respect and safeguard it,” Fr Chikoya said. “For the constitution to command their loyalty, respect, obedience and confidence, the people must identify themselves with it through involvement and a sense of attachment. A good and viable constitution should be generally understood and accepted by the people. The involvement of the people in constitution-making/amendment is, therefore, important in conferring legitimacy and acceptability to the constitution.”

Fr Chikoya said CCZ’s critical concerns regarding the ‘amendment’ Bill 10 include, among others, eligibility of presidential candidates.

“We sadly note that under Bill 10 this provision has been removed, and once enacted into law there will be no room for anyone to challenge the eligibility of presidential candidates,” he said.

On the coalition government, Fr Chikoya said it was not necessary.

“Our view is that the 50 plus one threshold as contained in the 2016 Constitution is more progressive because it ensures that a president is elected by the majority of the registered voters. In the long run, it restricts an elected president from spending most of his/her term of office establishing their hold on to power,” said Fr Chikoya. “The simple majority system is also a challenge because it does not specify what role the leader of the smaller party will play in the coalition government because we would have already a running mate who automatically becomes the vice-president.”

FOREIGN Affairs minister Joseph Malanji says Rwandan President Paul Kagame has told him he does not give credence to allegations by a convict that President Edgar Lungu was helping finance insurgency in that country.

On Monday this week, a terror suspect told a Rwandan Court that President Lungu was financing rebel activities against that government.

Malanji said President Kagame told him that he did not give credence to the allegations being made by the convict.

“I can mention to you that our bilateral relationships between Zambia and Rwanda are intact. President Kagame categorically indicated that he has a very sound relationship with President Lungu as a person and he did not see how President Lungu could start hiring these mercenaries,” Malanji said. “To start with, Zambia does not share any border with Rwanda. Much as we have bilateral ties with Rwanda, we do not share any border whose conflict might lead to somebody being aggrieved to start sponsoring mercenaries. You can give these allegations which are being leveled against President Lungu the contempt they deserve. It has nothing to do with President Lungu.”

Malanji said the government would engage Rwanda diplomatically to find the reason and who could have enticed “this convict” to bring the name of President Lungu and the country into disrepute.

“We are following up this. Soon officers will be going to Rwanda to dig and find out why he had to bring [up] the name of Zambia and the name of Dr Edgar Chagwa Lungu,” said Malanji.

Court dismisses Mwiimbu challenge on Speaker’s decision over ‘dead’ Bill 10

THE Lusaka High Court has dismissed an application by Monze Central UPND member of parliament Jack Mwiimbu for leave to commence judicial review proceedings challenging the decision of the Speaker of the National Assembly to allow the restoration to the Order Paper for consideration of Constitution (Amendment) Bill No.10 of 2019.

Justice Sharon Newa has ruled that the matter raises issues of a constitutional nature therefore she had no authority to determine it as it was the preserve of the Constitutional Court.

Mwiimbu wanted an order of certiorari to quash Dr Patrick Matibini’s decision to allow the deferment of the proceedings relating to the controversial Constitution (Amendment) Bill No.10 of 2019 to a date yet to be advised within the fourth session of 12thassembly.

He was seeking an order of mandamus, directing the Speaker of the National Assembly to discontinue any or further consideration, debate or other proceedings relating to Bill No.10.

He also wanted a declaration that Dr Matibini’s decision was invalid, null and void and of no effect and an order that all proceedings in the National Assembly relating to the bill be stayed until after the determination of the matter or further order of the court.

Mwimbu sought reliefs on grounds that Dr Matibini’s decision was unreasonable and irrational without justifiable reason following the lapse of the Bill on June 4, 2020 and was not amenable to further consideration, debate or process in Parliament.

But deputy Clerk of the National Assembly Cecilia Sikatele in an affidavit in opposition to Mwiimbu’s application argued that there was no express provision in the National Assembly Standing Orders of 2016 which governs the time within which a bill must be considered at any stage of enactment.

Sikatele charged that the issues raised by Mwiimbu and the subsequent reliefs he sought were wrongly before the Lusaka High Court because they raise matters of a constitutional nature.

She said the High Court was incompetent to hear and determine the issues raised by Mwiimbu therefore the case should be dismissed for want of jurisdiction.

Sikatele said the Standing Orders Committee, which is the highest decision making body of the National Assembly, was charged with the responsibility of considering proposals for the management of procedures and practices of the National Assembly.

However, Mwiimbu argued that standing orders do not give the Standing Orders Committee any power to extend the life of the bill to a date to be communicated not later than the last day of the meeting.

He said the decision by Dr Matibini to allow the continued consideration and deliberations on Constitution (Amendment) Bill No.10 of 2019 was amenable to review by the Lusaka High Court.

In his Affidavit in reply to the respondent’s affidavit in opposition to the affidavit verifying facts, Mwiimbu denied that the matter was in any way constitutional in nature as it was anchored purely on the established practice and procedure of the National Assembly as prescribed in the internal rules and regulations of the National Assembly that govern practice and procedure.

Mwiimbu said the rules and regulations of practice and procedure were prescribed in the standing orders of 2016 and various handbooks issued by the National Assembly from time to time and not in the Constitution of Zambia.

“The argument that after deliberations the Standing Orders Committee resolved to extend the life of the Bill to a date to be communicated not later than the last day of the meeting exposes the illegality of the Speaker’s decision to allow the continued consideration, debate or other proceedings relating to Constitution (Amendment) Bill No.10 of 2019 in so far as the state confirms that the standing orders committee extended the life of the Bill on March 24, 2020,” Mwiimbu said. “The standing orders do not give the standing orders committee any power to Act in the manner that it had purported to do contrary to what is deposed by the state.”

However, judge Newa in her ruling said on account of exclusive cognizance given to the National Assembly by Section 34 of the National Assembly, the Speaker, being protected from any court action where he exercises his powers under the internal procedure of Parliament, would only be amenable to such a court action if he breaches the Constitution in exercising his powers.

She said the Constitutional Court by virtue of Article 128(1) of the Constitution was the court vested with jurisdiction to deal with such matters.

“Even if I had jurisdiction to interrogate the exercise of the Speaker’s powers pursuant to the internal practices and procedure of the National Assembly as submitted by the Attorney General, it would ultimately involve interpretation of the Constitution from which the said powers are derived. As [can be] seen, I have no such jurisdiction as it is vested in the Constitutional Court,” said judge Newa. “On that basis, I find that this is not a case that is fit for further investigation and I accordingly decline to grant leave to commence judicial review proceedings and dismiss the matter. Looking at the fact that the matter seeks to enforce matters of national interest, I order that each party bears their own costs of the application. Leave to appeal is granted.”

Online Voter Registration And The Current Electoral Law

ONLINE VOTER REGISTRATION AND THE CURRENT ELECTORAL LAW

Checking through the legal framework currently in force governing the elections, I have not bumped into any provision that allows or talks about conducting online voter registration when registering voters in Zambia.

This may be another illegality being committed by the Electoral management body ahead of the 2021 General Election .

There is no legal framework that currently provides for the online registration of voters either in the Constitution or subsidiary laws, rules and regulations unless these have been just made. Therefore, this may be an act of illegal and lawless by the ECZ.

These actions of the ECZ, however, well intentioned they may be, require the backing of the law and that will be the only protector to the Commission in an event of an electoral dispute.

The current Electoral Process Act of 2016 and the relevant statutory instruments (1973 as amended in 2005) prescribe voter registration by physical means, not online.

The absence of any provision in the law that allows the ECZ to conduct online voter registration explains why the government seeks to introduce such legislation in the proposed Electoral Process (Amendment) Bill of 2019, which remains before Parliament to date awaiting the passage of Bill 10.

Under this amendment Bill, the principal Act is proposed to be amended by the repeal of section 74 and the substitution therefore of the following:

“The Commission may use electronic means to register voters, transmit results from a polling station; and facilitate voting of a citizen outside the Republic,” end of quote.

Why not wait until the law is amended and enacted before undertaking the online registration exercise than rush into such an illegality and lawlessness?

The trouble with the opposition and Zambians at large is not only failing to thwart these illegalities but also it is that we never take seriously the administrative and legal details of the elections.

By the time they wake to, it will be too late and pursuing a petition thereafter might be an exercise in futility.

Megan Thee Stallion is “hurt and traumatized” following Sunday’s shooting.

The Houston rapper is speaking out once again following the traumatic events where she suffered multiple gunshot wounds. On Thursday, it was reported that Tory Lanez was the one who allegedly shot Megan as she was leaving his chauffeured vehicle following a dispute.

The story has become a major headline with many on social media weighing in with memes and even jokes. But Megan says it’s no laughing matter. In an emotional post, she addressed the shooting and its traumatic effect on her.

“Black women are so unprotected & we hold so many things in to protect the feelings of others w/o considering our own,” tweeted Megan. “It might be funny to y’all on the internet and just another messy topic for you to talk about but this is my real life and I’m real life hurt and traumatized.”

The LAPD has launched an investigation and is looking at Tory as the potential trigger man. According to TMZ, detectives have opened an assault with a deadly weapon case after cops pulled over Tory’s vehicle in the Hollywood Hills on Sunday morning.

Sources claim Tory allegedly shot Megan in the feet as she exited the SUV after an argument. Tory hasn’t been named a suspect, but he was arrested and booked for possession of a concealed weapon after a handgun was found in the car. The Toronto rapper was released on $35,000 bail, but his charge could be upgraded to assault with a deadly weapon.

If Tory is charged for the shooting, sources tell TMZ that he will claim it was accidental. The LAPD is investigating it as assault with a deadly weapon as opposed to attempted homicide, but they are having trouble getting witnesses to cooperate, which could make it difficult to prosecute Tory.

In a previous post on Wednesday, Megan revealed that she was hospitalized after suffering multiple gunshot wounds. “On Sunday morning, I suffered gunshot wounds, as a result of a crime that was committed against me and done with the intention to physically harm me,” she wrote. “I’m incredibly grateful to be alive and that I’m expected to make a full recovery, but it was important for me to clarify the details about this traumatic night.”
