Zambians have rejected Bill 10 – Kangombe

WITHDRAW Bill 10 or we will defeat it on the floor of the House, says Sesheke UPND member of parliament Romeo Kangombe.

He said the PF cannot be trusted because it dribbled members of parliament by adding “alien” clauses in the 2016 amended Constitution.

He reiterated that even if UPND leader Hakainde Hichilema, “tells me that go and support [Bill 10] now, I will not do it, because I’m doing this for the future, not for an individual or a political party”.

“We as UPND are resolved and resolute that this [Constitution (Amendment) Bill No.10 of 2019] does not see the light of the day. It should not be enacted. It should be withdrawn. If they don’t withdraw it, we will defeat it on the floor of the House. We have the numbers. PF does not have the numbers … that is why they are parading people and giving them money to petition HH. But HH does not vote in Parliament,” Kangombe said. “I am still young and if I may be counted among the living, I may still be in Parliament in the next 30 years. So why should I jeopardise the future of the country because of a document being pushed by individuals who want to perpetrate their interests?”

He wondered why the PF was in such a hurry to change the Constitution, which President Edgar Lungu assented in 2016.

Kangombe said Zambians had rejected Bill 10 and the PF should stop telling lies.

He identified three current members of parliament who are physically challenged and questioned why the PF was saying it wanted to introduce a clause to advantage such individuals.

“The President has an opportunity to nominate MPs, so why has he not chosen to nominate youths or the disabled? Why hasn’t he taken the lead? This shows Zambians that the PF is just cheating people and the precedent was set in 2016,” said Kangombe. “What happened to the resolutions of the select committee chaired by Cornelius Mweetwa? Was it adopted by the Executive, by Parliament, no! This shows that the PF cannot be trusted. What will make them different now when the current Constitution has alien clauses that were just introduced on the floor of the House? This Bill (10) that can be tackled in an hour has cost us money and a lot of time. Why not just withdraw it? Why is it difficult? We as UPND are not afraid to debate the bill. Those that were there in 2016 know what happened. They were dribbled, we know enough to go through it again. We don’t trust the PF and their rhetoric. In any case, we are siding with Zambians who understand the bill and its repercussions if enacted into law.”

I smell abuse of office by Zesco MD – Chief Mukuni

I SMELL high level corruption and abuse of authority of office by Zesco managing director Victor Mundende, says chief Mukuni.

Commenting on the sale of land at Victoria Falls Power Station to a Chinese company operating as Victoria Falls Eye Limited, Mukuni said the land in question was part of a legal suit which was before the courts of law.

“What baffles me is that according to PACRA records the owners of Victoria Falls Eye is a company known as Qindao Ruichan Tech Industry Company Limited which has 90 per cent shares and the Ministry of Tourism and Arts of the Republic of Zambia – whatever that means (laughs) – has 10. This is a circus. The directors under Victoria Falls Eye include a Mr Reuben Zulu and Ju Weinbin,” he said. “What is also shocking is that Zesco who are the owners of the land (Lot 437/M) gave a consent to a buyer to survey the land and subdivide it. What I know is that surveys and subdivision of land is supposed to be done by the owner in this case Zesco and not the buyer (Victoria Falls Eye). What guarantee do we have that the man will not get land not given to him if he is the one surveying and subdividing? Strangely the consent is given by Zesco managing director Victor Mundende. This makes me smell high levels of corruption and abuse of authority as the land in question is government land under the Ministry of Energy.”

He demanded the immediate withdrawal of the offer of Lot 437/M to the Chinese.

Mukuni also raised concern that the government could also give consent to the demolishing of a church.

“Zesco denied the said land to another investor who wanted to put up a balloon and the matter as far as I am concerned is before the courts of law. And strangely a Catholic Church is to be demolished. Where is our religious morality as a nation if government can sell land and give consent to demolish a church? I appeal to government to reverse the offer,” he said.

Mukuni added that Zambia also risks a diplomatic wrangle with Zimbabwe as UNESCO can deregister the Victoria Falls from the World Heritage Site list.

In January 2017, Mukuni fought off attempts by State House to offer Ju Wenbin the curio market at the Victoria Falls to erect a Spin-Sational Ferris Wheel.

The National Heritage Conservation Commission (NHCC) has also warned that the said land being within the Victoria Falls World Heritage Site (VFWHS) cannot have a construction of the proposed wheel under UNESCO guidelines.

According to correspondences obtained by The Mast, Mundende on April 15 wrote to Victoria Falls Eye Limited’s lawyers Mosha and Company giving a go-ahead to the firm’s request to survey the land (Lot 473/M) at the Victoria Falls Power Station for subdivision.

The letter, ZESCO REF:MD 298/2020, addressed to Philip Chibundi states the power utility was in consent with Victoria Falls Eye’s request to survey the land.

“Please be advised that we have no objection to your undertaking the survey on the aforementioned portion of our property,” said Mundende.

An NHCC source warned that Zambia risks having the Victoria Falls placed under ‘endangered’ sites list if the wheel will be given a go-ahead.

“A shopping mall may be ideal but it’s like these guys are just interested in the wheel going by the name of the company Victoria Falls Eye,” the source said.

Zesco in an eviction notice dated April 29, demanded people leave the area so as to have the properties demolished as they were in a national park against the Wildlife Act Number 14 of 2015.

The notice signed by Zesco’s director of legal services McRobby Chiwela was copied to Mundende, director power generation, director human resources and the two labour unions namely POGAWUZ and MESAWU.

“NOTICE OF EVICTION: Kindly be informed that the area housing the house you reside in is a national park, namely the Musi-oa-Tunya National Park not suitable for human habitation in terms of the Zambia Wildlife Act Number 14 of 2015. We are therefore giving you three months’ notice to vacate the house at hand with effect from 7 May 2020,” Chiwale stated

He added that the lease agreement allowing tenants to occupy the said houses had also expired adding that the three months’ notice was a ‘humanitarian’ gesture.

Give Hichilema a chance to rule, urges Bbabi

NEWLY elected Sinazongwe district UPND youth chairman George Bbabi says Zambians must next year give Hakainde Hichilema a chance to rule the country.

Bbabi says youths in Sinazongwe have endorsed Hichilema as a sole presidential candidate at the forthcoming UPND convention.

In a statement, Bbabi said it did not make sense for anyone to think of going against the wish of majority Zambians to have Hichilema stand in the 2021 general elections.

“The moment people ushered us into leadership positions, we quickly convened a meeting where we resolved to endorse the candidature of Hakainde Hichilema as our sole candidate for the position of the UPND party president at the forthcoming national convention because he is the only capable leader and saviour who will take us to the promised land. And we have no doubt that come 2021 he will win,” Bbabi said.

He said those that want to challenge Hichilema were “very much welcome to do so” because UPND was a democratic party.

Bbabi accused the PF of having failed the youths in the country from time it took over government in 2011.

“They cheated us the youths that we will have more money in our pockets but to date no youth has money in the pocket. They promised us 500,000 jobs but up to now no youths were employed,” he said. “Zambians must now vote out PF in the 2021 general elections and bring in HH and his team with fresh blood.”

Bbabi urged Zambians to ensure PF was retired in 2021.

“This is not the time to hesitate to bring in the UPND and HH the economic manager to fix the economy. The PF has failed us in all areas, be it in agriculture,” said Bbabi.

And district youth vice chairperson – administration Costern Sikatyanka said at parliamentary level, there would be no change in Sinazongwe.

“As young people in Sinazongwe we will go for our current MP Gift Sialubalo for 2021. There will be no change. Those that want to challenge him must try 2026,” he said.

He said Sialubalo was the man of the moment in the area because of the good works he was doing for his people in the constituency.

“This is the first time since I was born to see a hardworking MP like Sialubalo who has taken development to all the 14 wards in Sinazongwe using his own personal resources,” said Sikatyanka.

We are not like you, so we will not proceed to say what happened later because at least he provided what you needed most without looking at you as someone’s child but as his son.

And today you want to refer to him as an ignorant person who seems not to understand the monkey tricks your government is playing to try and convince the people of Zambia so that they swallow the poisonous BILL 10 pill.

You are the last person to say anything malicious to President HH because of the love he showed you when no one looked at you because you were a nobody. But HH as a bally picked you and took you in his hands as a son needing a father but true to the definition of a spoiled ungrateful child,you turn around to say nasty things for wanting to dine with corrupt thieves and destroyers of our democracy.

Why not help your already stressed President fight corruption in his government which include the theft of life-saving drugs. His term of office is nearing its end but meanwhile the Zambian youth is still waiting for the 500,000 and one million jobs promised to them by Mr.Edgar Lungu.That is the man in desperate need of your attention by helping him respond to the needs of the youths in this country.

Antonio leave HH alone and help President Lungu deal with the country his government has plunged into being the fifth hungriest nation on the face of the earth. Those are the issues you are supposed to be looking at instead of wasting time to please your masters.

Antonio IMF won’t bail out Zambia because its debt is unsustainable following Zambia’s US$11 billion debt, 27% Chinese loan obligations, and another estimated US$3 billion owed to some foreign markers in euro bond among others, all these are problems you need to help your President deal with but because you are a spoiled child, your eyes are on HH who has nothing to do with your party’s appetite for borrowing.

Antonio you need to be worried that the basic needs basket as reported by JCTR, indicate that the minimum monthly food basket for a family of 5 people has increased from K5,395 in January 2019 to K7,410 in January 2020 yet majority of Zambians don’t earn that kind of money. These are the things you should be looking at not HH.

Zambians need your government to release reports of the serial killings, burning of markets and gassing which led to loss of innocent lives and not talking about HH. It won’t help your government in anyway because Zambians need answers before elections in 2021. Eyes off HH because your President needs you to help him have those issues resolved because voters are hurting.

Am sure the youths expected you to say something that was going to ease the pressure your government is undergoing because of the suffering they are undergoing.

Meanwhile to the people of Zambia thank you so much for your support, surely you will lead a different and better life under President Hakainde Hichilema because he loves you and has a vision of building a better life for all Zambians across the country.

There is nothing to debate PF government has failed and they should go.

Bill 10 Will Resolve Succession Wrangles Among Traditional Leaders Says President Lungu

PRESIDENT Edgar Chagwa Lungu has assured the Chiefs in Zambia that once amended, bill 10 will help in resolving the succession wrangles.

The President said at the moment, government does not have powers to Gazzet or Degazette a traditional leader.

He said this yesterday in Senga Hill when he met Chief Mpande of the Mambwe people of Northern Province and five sub-chiefs in the area.

Responding to Chief Mpande who on behalf of other traditional leaders, asked him to intervene and help resolve the succession wrangles in the area, President Lungu said bill 10 seek to resolve such issues.

The President said at the moment, any one can stand up and declare themselves chiefs because they do not need the approval of government.

He said that was why stakeholders needed to support bill 10 which was aimed at resolving succession wrangles.

The Head of State said once amended, bill 10 would allow Chiefs to have a say on who becomes Chiefs in their area of jurisdiction.

And President Lungu has encouraged Chiefs to spearhead development in their Chiefdoms stating that there could be no development without the participation of traditional leaders.

He said his government recognizes the importance of traditional leaders hence the creation of the Ministry of Chiefs and Traditional Affairs.

And speaking earlier, Chief Mpande thanked the President for various projects that were being undertaken in the district.

“We are seeing what is happening in terms of development and it is very appreciated,” Chief Mpande said.

He also appealed to the President to consider improving the water reticulation, roads infrastructure and connect the area to the national grid.

President Lungu who was accompanied Senior government and ruling party officials also inspected Senga Hill district hospital where he interacted with patients and other people in the area.

The Head of State is in Northern Province for a three day working visit to inspect various government projects, meet traditional leaders and interact with the ruling PF party officials.

PF should stop induced by-elections and fund ECZ

To start with, I wish to commend the Electoral Commission of Zambia (ECZ) for holding the much-anticipated press briefing.

Although the briefing was disappointing, considering a number of talking points that have left a bitter test in many Zambians’ mouths, the ECZ is commended for giving us an update on measures taken to prepare for the 2021 tripartite elections.

I am perplexed that the Patriotic Front (PF) government and ECZ could plan to begin voter registration and verification on 18th October 2020 – nine months before the general election. This is a ridiculous and careless decision aimed at preventing many first voters.

This probably is a deliberate ploy to disfranchise young Zambians; the youth who have been wounded by the PF government’s failure to create jobs and business opportunities. Many youths who have been disoriented by PF government’s grand corrupt activities that have decimated the growth of the economy may be prevented from registering as voters; this may affect the opposition parties’ tally of votes.

The ECZ and the PF government should not insult our intelligence. How could a serious government and Commission plan to come up with a register of 9 million voters in 30 days? How many people, cameras and other equipment will the ECZ deploy to register 9 million voters? Even if the ECZ extended the voter registration for another one month, it will not reach the targeted number. In a normal situation, the targeted 9 million voters could be reached in not less than three months (90 days).

I also want to believe that ECZ is not colluding with PF to manage the electoral process to deliver the PF desired results. The chief electoral officer at ECZ seems to be a troubled man; he seems not to have the support he needs from the PF government to run such a strategic institution. When I watched the press briefing, Mr Patrick Nshindano looked troubled. He just failed short of telling us that the PF government has not funded the Commission. He diplomatically told us that the PF government has not been supportive of ECZ. Mr Nshindana was not even sure when the government will fund ECZ so that he commences voter registration. This is the reason why he was not sure whether ECZ will commence voter registration and verification on 18th October.

I have a problem with the PF government because it does not know how to set priorities for this country. Further, the PF government has been careless in the manner it has been managing the treasury; the treasury is directed to fund useless ventures such as induced local government by-elections. A normal government would have priortised voter registration and verification. Resources would have been directed to such a nobble cause, not on testing the PF’s popularity through induced local government by-elections in villages where the party can buy the whole village using stolen public money.

It is baffling that the PF is buying the impoverished and semi-illiterate councillors from the United Party for National Development (UPND) strongholds and force local government by-elections as a way to test its popularity. As I write this article, the ECZ is scheduled to hold 11 local government by-elections which are all induced by the PF government. How much money is the country wasting on these useless by-elections?

For once, the PF government should be serious and show leadership on important national issues. The PF government should stop this wastage of money on local government by-elections and give the ECZ the money it needs to commence voter registration earlier than the proposed October date. If the PF is popular, it should allow the ECZ to register many potential voters. Its popularity will be tested in 2021.

I wish also to take this opportunity to remind the ECZ and Mr Nshindano that their allegiance is to the Zambian people, and not to the PF. In this regard, the ECZ should learn to listen to Zambians and other stakeholders in the electoral process. There is no way, the ECZ could rush to announce that come 2021, the prisoners will vote in the poll. I thought the ECZ would have first agreed with stakeholders on the modalities of allowing our brothers and sisters in prison to vote. Hopefully, the move to allow prisoners to vote is not motivated by the PF’s desire to retain power in 2021. The PF is becoming more desperate as we move towards the 2021 elections. It will be naive for the PF to think that prisoners will vote for them considering how prisoners are dehumanised and mismanaged in Zambia.

As I conclude, I wish to appeal to the PF government to fund the ECZ so that voter registration and verification could commence as soon as possible. I wish also to appeal to the donor community to come in and help fund voter registration so that Zambia could have a smooth and fair 2021 poll.

Just when the Bally fever was trending and had gained good momentum here we are shifting focus to stupidity, disgruntled youths movement and now the Chella Tukuta issue.

All of a sudden a person who just three months ago had exhibited full lunacy and we all pleaded he gets mental help now he is our spokesperson and advocate for change as youths, he is the man leading our liberation from the oppression of the Patriotic government, really! Are we serious!

Just why are we so forgetful to make people who offer themselves up for leadership to be morally accountable? Why are we this desperate that every Jim and Jack can claim to be our messiah leading us to the promised land and we rally behind him or her even with a questionable character? Why do we love mediocrity so much that even fools can be accorded praise just because they sing the

same song of “Change” that we are all singing?

Yes, change we need change and badly but it can not come from Chella Tukuta. He has a long way to go before he can claim an advocacy role to free us from Edgar Lungu and his minions.

Change is not just change, how change comes, what type of change it is & who leads that change matters. Using this scale, Chella falls short of the above three aspects of real change. Insults and person attacks are not the change we need, not from him as he has a lot to fix in his life.

By merely wanting change without proper scrutiny; being forgetful, desperate and loving mediocrity we voted for Sata and his clueless Patriotic Front party, then Edgar Chagwa Lungu who is the cause of the present economic problems our country Zambia is facing. Can’t we learn?

As it is we have enough ammunition for real change in Laura Miti and Pilato who are sober and mature, they will lead us to Canaan “2021” with “Bally” Hakainde Hichilema as our Moses.

Chella Tukuta can take a seat, clean himself up morally and fix his family life then he can join the already existing band without seeking prominence.

Even with my rejection of his advocacy, let

the state respect his rights and grant him police bond so he can find a lawyer to represent him in the criminal libel case against Dora Siliya.

If Bill 10 passes through, President Lungu will create 3 more provinces to consolidate his hold on power – PF MP

THE Patriotic Front government wants to create three more provinces to enable President Edgar Lungu change the composition of parliament and boundaries of some constituencies if Bill 10 is allowed to pass through the second reading, a party Member of Parliament has revealed.

The lawmaker, who sought anonymity, said President Lungu will divide Eastern Province into two parts and create a Nsengaland that will be detached from the rest of Eastern Province to form Luangwa Province.

He said President Lungu wants to divide Western Province and separate Kaoma district which, together with Itezhi Tezhi and some parts of Mumbwa district, will create Kafue Province.

The lawmaker, who said he can not come out and speak against the Bill openly for fear of retribution, said President Lungu will separate the belly of Southern Province and create the third province that will be called Zambezi Valley.

“We are quiet a number of us PF MPs against these evil schemes meant to perpetuate President Lungu’s stay in office but we cant speak. These guys are brutal,” he said.
“President Lungu wants Petauke, part of Sinda district under Chieftainess Nyanje, Lusangazi and Nyimba districts to form Nsengaland that will be called Luangwa Province but there are concerns amongst his inner circle that Kalindawalo, the senior most Nsenga chief is under the jurisdiction of His Majesty Kalonga Ngawa Undi of the Chewa people of Malawi, Mozambique and Zambia.”

The law maker said taking advantage of the tribal tensions between the Nkoya chiefs Mwene Mutondo and Kahare on one side and the Litunga on the other President Lungu wanet to create Kafue Province.
“It is for this reason that Mwene Mutondo and Kahare have been frequenting State House and seem determined in defiance of the Litunga,” said the lawmaker.

“He has been working with Chief Chipepo to create this third province from the lower belly of Southern Province. This why you hear Chief Chipepo talking ill of President HH and the UPND. These guys will change boundaries of existing constituencies to enable them have an inbuilt majority.

The lawmaker wondered why Senanga MP Mukumbuta Mulowa, Solwezi West MP Teddy Kasonso and their Nalikwanda counterpart Geoffrey Lungwagwa would have confidence in President Lungu when they have all witnessed how treacherous other before them like Richwell Siamunene and other that have betrayed the UPND in the past have been used and dumped.

“Mr Lubinda does not wholeheartedly believe in this Bill but he has no choice but appear to push for it because anything other than that would spell doom for him. He knows he is being used and what scares all of them is the coming change of government. They all fear everything they have stolen would be revealed and lost to the state,” he said.

PF lies exposed over Bill 10 – HH

UPND leader Hakainde Hichilema says the PF has been exposed as “naked” over its quest to pass the Constitution (Amendment) Bill No. 10 of 2019.

Addressing journalists at an opposition alliance briefing in Lusaka yesterday, Hichilema said

any amendments justice minister Given Lubinda claimed to have made outside Parliament were illegal.

“What Lubinda did offends Article 77 of our Constitution as amended in 2016. It does not allow what Lubinda did. He claimed that there was a parliamentary procedure he used. On that score too, PF lied. And we have caught you, you are naked. We’ve seen you; the people have seen you,” he said. “What he has done disregards Parliamentary Standing Orders No. 108 and No. 112. So even on the parliamentary procedures and orders, he’s lying. That is wrong because these two parliamentary orders 108, 112 require that parliament should table issues for debate before the House, before any changes can be publicised or gazetted. Has parliament debated? I’m not talking of the parliamentary select committee, I’m talking of the House. Has it debated? It has not debated. So how do you now purport to make changes through the gazette? Where’s your credibility as a government? It’s not there.”

Hichilema said Bill 10 could not be allowed to pass because it left out many stakeholders.

He lashed out at PF surrogate political parties that have supported the infamous Bill 10.

“Bill 10 cannot be allowed to proceed because it left out the owners, the owners did not construct it. It was constructed by a small group of selfish people in the PF, by and large, and their surrogate political parties. Don’t we know them? We know them, isn’t it?” Hichilema asked. “Those who always sing choruses even before the hymn is called out. They sing choruses for PF even before PF calls the hymn… But for the PF surrogate parties even before PF calls hymn number 22, they’re already singing the chorus for 30 pieces of silver. It’s not even worth to call yourselves political parties; you should be embarrassed to define yourselves as political parties because you’re not; you’re just surrogates. And we know you, the people of Zambia now know who you are.”

Hichilema maintained that the contents of Bill 10 were draconian.

He challenged people to imagine what would happen if they continued with PF after 2021.

“Now my fellow citizens, look at the pain you’ve gone through under PF. Just imagine, think for a moment. The unemployment levels, although they lied to us that there will be more jobs, look at the situation of how many youths are unemployed!” he said. “Look at the situation where households have no money. Now, because of the draconian Bill 10 which seeks to keep PF in office forever, can you survive another five years of PF in office? Can you survive? Who will survive? Only a small corrupt number of people. Is that what you want?’’

And Hichilema highlighted various flaws in Bill 10.

“Article 52 in Bill 10 seeks to allow [President] Lungu to go for a third term; that’s the intention of Article 52. Isn’t that an attempt to keep PF in office forever? It is. Are you going to allow it, the citizens? No. It’s dangerous business. Essentially, PF are seeking to return Zambia to a one-party state which we walked away from, which we worked hard together as a team across regions, across ethnicity to reject the one-party state in 1991. And that’s why we need to work together again to reject their attempt to return us to a one-party state,” Hichilema said. “No and never again should we allow a small group of selfish people to return this country to a one-party state because we know the dreadfulness of the one-party state. Twacula pafula (we’ve suffered enough); we’ve refused. They’re playing around with the psychology of people. Why would you allow Bill 10 to go through, which will allow ministers and MPs to stay in Parliament up to election day? So that they can use government cars, they can use government vehicles to campaign during the campaign period.”

He said President Lungu and PF were eager to twist the Constitution in their favour.

Hichilema said if passed, Bill 10 would also allow President Lungu to create districts and constituencies as he wished.

“What else are they trying to change? Because we took PF to court after 2016 dissolution of parliament when Cabinet stayed in their offices and we won the legal matter; and they’ve refused to pay,” said Hichilema. “In order to circumvent that, they’ve decided to amend through Bill 10 so that now they can stay in Cabinet up to election day. Have you seen how crooks behave? Can you see how crooks behave? We want our money. They want to change the composition of parliament as they wish so that they can have in-built numbers. Who will allow that? Which sane Zambian will allow that?”

The Litunga together with Kalonga Gawa Undi of the Chewe and Nsenga people of Zambia, Malawi and Mozambique, Chitimukulu of the Bemba speaking people and Mpenzeni of the Ngoni have cited Attorney General seeking a declaration that every chief and deputy chief shall be paid for the purpose of enabling them to maintain the dignity and status of the office of the chief and discharge the functions of the offices of the chief under African customary law in a fit and proper manner.

The quartet want the court to determine that section 2 of the Chiefs Act in so far as it defines the word chief was unconstitutionl and therefore null and void.

The four are seeking a determination and declaration that the chiefly institutions of paramount chief, senior chief and other chiefs continue to exist and are guaranteed under article 165 (1) of Constitution of Zambia.

According to their petition, the Litunga and his counterparts said that on February 26 this year, the Ministry of Chiefs and Traditional Affairs in a letter a dressed to the permanent secretaries – in Western, North Western, Northern and Luapula provinces advised that following the Constitutional Court’s declaration in a mater involving Webby Mulubisha and the Attorney General that sections 3, 4, 5, 6 and 7 of the Chiefs Act to be inconsistent with article 165 of the Constitution and are therefore unconstitutional and void, there was no legal basis upon which a chief was to be paid.

They said the Ministry of Chiefs and Traditional Affairs said that in view of the foregoing, it had been directed that no new chief was eligible for payment of subsidies after the judgment of the court dated November 27 2019.

The Constitutional Court last year declared that allowing the President to appoint a deputy chief to assume the role of a Chief is against the principle of non-involvement of the presidency in the selection of chiefs.

Constitutional Court judge Palan Mulonda on behalf of justices Professor Margaret Munalula and Enock Mulembe declared that sections 3, 4, 5, 6 and 7 of the chiefs’ Act being inconsistent with Article 165 of the Constitution as amended were unconstitutional and void and that they should be expunged (removed) from the statute book.

“We are of the view that to allow the president to appoint a deputy chief who for all intents and purposes would likely assume the role of a chief goes against the principle of non-involvement of the presidency in the selection of chiefs,” justice Mulonda said.

“We agree with the parties that section 6 runs afoul of Article 165(1) of the Constitution as amended and is therefore void.”

This was in a matter where Mulubisha on behalf of chief Mwene Mutondo of the Nkoya people of Kaoma district in Western Province petitioned the court over the chiefs Act Chapter 287 of the Zambian Laws as amended by Act No.13 of 1994 for being inconsistent with Article 165 of the Constitution of Zambia (Amendment) Act No.2 of 2016.

Mulubisha sought a declaration that section 3, 4, 5, 6 and 7 of the chiefs Act chapter 287 were inconsistent with Article 165 of the Constitution of Zambia (Amendment) Act No.2 of 2016.

He further sought a declaration that section 3, 4, 5, 6 and 7 of the chiefs Act are unconstitutional and therefore void.

The Litunga and his counterparts said that the institution of chieftaincy and traditional institutions were guaranteed under the constitution and shall exist in accordance with the culture, customs and traditions of the people to whom they apply.

They said that according to article 167, a chief may own property in a personal capacity and enjoy privileges and benefits bestowed on the office of chief by or under culture, custom and tradition and attached to the office of chief as prescribed.

The litunga and his counterparts said that article one (1) and (2) provides that the constitution was the supreme law of Zambia and any other written law, customary and customary practice that was inconsistent with its provisions was void to the extent of inconsistency.

They said any act or omission that contravened it was illegal.

They stated that the position taken by the Ministry of Chiefs and Traditional Affairs was different not only with the provisions of Article 165, 166 and 167 of the constitution of Zambia but also the definition of “chief” in Article 266.

“Chiefs means person bestowed as chief and whilst derives allegiance from the fact of birth or descent in accordance with the customs, traditions, usage or consent of the people in a chiefdom,” the quartet said.

They said that Article 2 of the constitution says that very person has the right and duty to defend the constitution as well as resist or prevent a person from overthrowing, suspending or illegally abrogating the constitution.

And according to their individual affidavits in support of the petition, the four explained that from the time Article 165 of the constitution became operational, there has been scramble for chieftainship proven by declarations of illegal chiefs now claiming that they no longer need to be recognised by senior chiefs under article 165 of the Constitution.

“It is important for government to pay necessary subsidies to chiefs to enable them discharge their functions diligently and maintaining their dignity,” said the quartet.

The four now want the court to determine and declare that the traditional authority of the paramount chiefs to recognise, install and discipline, including dethronement of any of their subordinate chiefs in accordance with customary law shall continue to be exercised by them.

They want the court to determine and declare that when a paramount chief recognises or dethrones a subordinate chief in accordance with the traditional and customary practices and informs government accordingly, the State shall acknowledge and accord to such chief or, in the case of dethroning cease to accord to the chief, the owner and dignity befitting a chief.

The quartet further want a declaration that they have authority to continue to administer and resolve traditional matters according to customary law in their traditional courts.

 

PAUL MOONGA IS INCITING VIOLENCE – POLICE

Paul Moonga is inciting violence, says the police service.
Speaking with Daily Revelation on the threats issued by Lusaka provincial PF chairperson Paul Moonga that he has directed youth chairperson Daniel Kalembe to mobilise the youths to whip all those who would dare protest against President Edgar Lungu and the government, as they were being used like condoms by politicians who had actually stolen, Police spokesperson Esther Mwaata Katongo said Moonga was indirectly instructing the youths in the ruling party to commit violence, saying anyone with information on the matter can report him to the police.

“I am saying if someone says I am going to mobilise youths to do this and that, in others words that is indirectly giving an instruction to the youths. Because if they hear a leader saying I’m going to do this it means that already you have stated your position,” she said.
Katongo said political leaders must always think through something before they said it, and consider the repercussions of whatever they were doing.

“We don’t have to put the country on fire just because there will be elections, just because there are people in political parties no. So that is inciting violence if he says no I’m going to do this, to mobilise, that is inciting because there are other youths who may take him seriously just from there and then because they will be saying that no our leadership has given a position,” Katongo said. “So let them leave the work to the police we are there. We are trained for that. We are an institution that is mandated by the Constitution so we cannot allow groupings to start rising against each other, we are not going to watch that.”
Katongo urged politicians to leave the work of policing to the police and stick to their lane of selling their manifestos to the people.

“Who wrote that story? You? You interviewed him and that’s what he said?” Katongo asked, insisting that politicians stick to their lane. “Any other person who is not within the police has got no authority to begin policing because that is lawlessness within itself. So anyone that is going to go against the provisions of the law regardless of which political parties they are coming from they will be dealt with sternly by the police. We are not going to allow civilians to begin policing when there are institutions given the mandate to do so.”
Katongo said those being mobilised would be doing it at their own peril, whether it was the leadership that had mobilised them, as they would be going against the law by engaging in violence.

“They are going to be dealt with. So let them leave the work to the police. Two wrongs can never make a right. If we allow anyone to start doing then there will be chaos in the country, that’s why the police are there,” Katongo said. “If the PF feel that they have been aggrieved by certain sectors of society let them go to the police and let police look at that than them getting to the streets because that is already recipe for anarchy. Even in the way we talk to each other let the people tone down. All political leaders should tone down and…the tone which will be set now will go into 2021. So leaders should begin rebranding, to find the better words.”

Katongo said the police will not allow institutions which are not mandated by the law to start enforcing matters.

Daily Revelation yesterday ran a story where Moonga said he has instructed Lusaka Province youth chairperson Kalembe to mobilise party youths to whip the youths who will dare demonstrate against President Lungu and the government.

He said the party has had enough of the nonsense from the charlatans and minions, saying majority of the youths actually supported the ruling party.
Moonga said ruling party members will pounce on those who dared demonstrate and whip them, warning them to dare demonstrating.

“I have told Kalembe if they are going to demonstrate you go head on and we shall see who is a bigger family, who is controlling who. We will pounce on them, we won’t allow any nonsense. I am not going to allow any nonsense in Lusaka Province. And let me warn this through you Patson, tell them that provincial chairperson Paul Moonga says that you try to go and demonstrate we shall whip you,” Moonga said. “If the police can’t do it, us we shall take them on because I have enough muscle, enough manpower and I’m in control of Lusaka Province. Let them go and try elsewhere, may be they can go and try in Monze. Let them try in Lusaka, let them try in Lusaka. We will whip them. Enough is enough. We have had enough of this nonsense from mere charlatans, these minions.”

Moonga charged that the people who were yapping about corruption are crazy and foolish, and they are just being used like condoms by politicians who have actually stolen.

We have no time to enter into an alliance with a sinking titanic, MMD Youths tell Mumbi Phiri

Opposition New Hope Movement for Multi-party Democracy (MMD) Youths have told off Patriotic Front Deputy Secretary General Mumbi Phiri that their party doesn’t indeed to enter into an alliance with a party that has nothing to offer the people of Zambia. But a party that has more questions of wrong doing to answer.

In yesterday’s edition of the Daily Nation Newspaper, Patriotic Front Deputy Secretary General Mumbi Phiri alleged that her party is in a working alliance with the Opposition MMD. She further alleged that the are still factions in the MMD and the hope of the PF is for these factions to sit down and reconcile.

But New Hope MMD Lusaka Province Youth Chairperson Mr. Friday Chipasha said that there are no factions in the MMD as they died with their sponsors on the 5th of November, 2019. The imaginary factions that are there are only in bamayo ba Mumbi’s head.

“We as the New Hope MMD Youths are shocked with the sentiments coming in from PF Deputy S.G Mrs. Mumbi Phiri where she among others alleged that there are factions in our party. In the first place, it is open gossip that those sponsored factions she is alleging died on the 5th of November, 2019 when the Courts ruled that MMD only has one leadership, which is led by Dr. Nevers Sekwila Mumba. The alleged leader of the sponsored faction Hon. Felix Mutati conceded defeat and accepted the ruling. So we are quite shocked that She is the only person in the country that isn’t updated with current affairs. Maybe that is the reason President Lungu revoked her Nomination to Parliament”, Mr. Chipasha said.

Mr. Chipasha further said that his Party has never been in any alliance with the PF.

“Secondly, we would like to set the record straight that we as the MMD have never been in any alliance with the PF whatsoever. The Invisible alliance that her Party had with expelled members like Mutati never existed at law because the November 5 Judgement clearly stipulated that What those rebels did was null and void and never happened. So we would like to school Ba Mumbi that, that alliance she is talking about never existed at law nor signed for, Mr. Chipasha said.

Mr. Chipasha then said that his party cannot enter into an alliance with the Patriotic Front because the PF have nothing to offer the People of Zambia.

“Lastly but not the least, what does Bamayo ba Mumbi know about MMD and how our leaders are elected in between conventions for her to question the status of our able National Secretary? We ask her to concentrate her energies on her party which has a million problems. We would like to emphasize to the PF, that We as the MMD have no intentions what so ever of entering into an alliance with the PF because they have failed and have nothing to offer the people of Zambia. No sane political party would like to align itself with the PF when everyone knows kuyabebele. OUR ALLIANCE IS WITH THE PEOPLE OF ZAMBIA. IT IS IN FACT THE PF THAT HAS FACTIONS and we would like to advise them to resolve all the divisions in their party with the KBF faction, CK faction and Kalaba faction. It is the PF that need to reconcile with all these people including Dr Scott”, Mr Chipashya concluded.

The Day Zambia Had No President Because Of Tribalism

In 1959, the United National Independence Party (UNIP) was found by Mainza Chona, a militant nationalist and later led by the socialist presidency of Kenneth Kaunda.

UNIP was formed by people who were actively involved in the liberation struggle and attracted supporters from all walks of life, making UNIP a great political movement widely accepted across the country.

UNIP had a tradition of holding annual conferences to elect top leaders.

Around 1963, UNIP scheduled a conference at Mulungushi Rocks.

Hundreds of representatives from different parts of the country trekked to the conference site.

The conference is believed to have been the most politically charged event in the history of UNIP conferences.

There was immense political scheming and lobbying for top leadership positions.

The Vice President position was one of the fiercely contested with two camps eyeing the post; the faction for Simon Mwansa Kapwepwe, and the faction for Reuben Chitandika Kamanga.

The Kamanga faction wanted him to be the Vice President in order to have regional and tribal balance in the top leadership.

The Kapwepwe faction wanted him for his fiery and radical personality viewed as needed to expedite political, social and economic transformation.

The Kapwepwe faction also argued that political merit not tribal balance should prevail over political correctness.

No doubt that this was a clash of the titans and battle of the heaviest bulls in UNIP.

However, the Kapwepwe faction was in a quandary because Kaunda did not want Kapwepwe to vie for the Vice President position because he was concerned about sending wrong message to people that UNIP was a Bemba dominated political party.

Kaunda engaged Kapwepwe on his reservations.

Kapwepwe asked Kaunda to give him time to mull over the issue and consulted his lieutenants who tactfully agreed to Kaunda’ proposition to focus on the same position the following conference.
This allowed Kamanga from Eastern province to take the position of the Vice President.

The news sent Kamanga’s camp into jubilation stomping the ground in a Ngoni style while waving their imaginary clubs.

The Kamanga faction was certain that this was the final nail in the coffin for Kapwepwe’s influence in UNIP.

However, their joy was short-lived because this was the beginning of the fiercest in-fighting in UNIP’s history.

When Kapwepwe tactically backed off, he devised a political submarine strategy working underground by interacting with representatives of different provinces and top leadership sharing his radical transformation agenda, which resonated with the people and gained him impregnable support in and outside UNIP.

Kaunda was aware of Kapwepwe’s political conversations on radical transformation but not his political ambition.

In 1967, when UNIP held the annual conference, Kapwepwe having done his homework, he put his name for the Vice President contest, a move that incensed Kaunda.

At the conference, there was a strong sentiment in favour of Kapwepwe for the Vice President position which did not sit well with UNIP top leaders.

When the vote was cast, Kapwepwe emerged as winner to take the Vice President position of UNIP and of the Republic.

One of the fiery and radical politicians in the history of Zambia made Kaunda to swallow a bitter pill because his preferred Vice President was defeated in the dust.

Kapwepwe’s resounding victory sent shock waves through UNIP and became one of the sure ways that contributed to serious political hatred and crisis in UNIP and the country.

This period, is argued to be the first time in the history of Zambia when regional and tribal lines in UNIP were drawn in white and black.

The Kamanga faction made up of Eastern-Lozi supporters and the Kapwepwe faction made up of Bemba-Tongas clashed.

The Kapwepwe faction accused the Kamanga faction of being spineless communist sellouts, and the Kamanga faction accused the Kapwepwe faction of rigging the election results.

By August 1967, it was clear that the seeds of regionalism and tribalism had germinated making UNIP a political powerhouse with clear and wide regional and tribal divisions.

Defeated and exasperated, the Kamanga faction covertly supported by Kaunda developed a squad of fourteen people with two representatives from Central, Southern, Western, North-Western, Copperbelt, Luapula, and Eastern province but no representatives from the Northern region.

The purpose of Kamanga’s squad was to machinate Kapwepwe’s downfall and neutralise the “Bemba” influence in UNIP seen as a threat not only to Kamanga but to Kaunda as well.

As a heated and radical politician, Kapwepwe also developed a squad of twenty-four people made up of Bembas (Northerners) and Tongas supported by selected forceful activists from Central and Western province to counter the political trickery of Kamanga’s squad.

The vicious and divisive regional and tribal politics undermined national unity, and no side was willing to back off.

As a result, there was high regional and tribal tension in the country with potential to cause regional and tribal war, sending Kaunda into a stress mode.

With regional and tribal daggers drawn, in 1968 when UNIP held the National Council at Chilenje conference Hall in Lusaka, the meeting flopped because it was reduced to a regional and tribal battlefield that left Kaunda shocked to the bone marrow.

Kaunda told the National Council members that he was disappointed and appalled by the open regional and tribal utterances and practices.

It was at this point, that Kaunda resigned stating that he did not want to be part of a political organisation and government promoting regional and tribal divisions and stormed out of the meeting and went straight to his official car and was driven off to State House.

Upon arrival at State House, Kaunda told his staff and wife Betty to pack their belongings in readiness to vacate State House.

Vice President Grey Zulu called Kapwepwe, and these two liberation heroes drove to State House to talk to Kaunda.

Zulu and Kapwepwe tried to reason with Kaunda indicating how the leadership vacuum had potential of triggering tribal bloodshed, but Kaunda refused to rescind his resignation.

For almost fourteen hours, the country had no president.

Some of the people in Kapwepwe’s faction were delighted with Kaunda’s resignation because they wanted Kapwepwe to vie for the presidency and replace Kaunda.

However, Kapwepwe refused to be driven by his supporters’ political intimation.

This was a clear indication that though fiery and radical, Kapwepwe was not an opportunist, otherwise Kaunda’s presidency would have ended in 1968.

At night, Grey Zulu and Kapwepwe went back to State House to try to convince Kaunda to change his mind to save the country from imminent bloody regional and tribal disaster and reminded him of the huge contribution he made to the liberation movement and how his father would be happy to see him finish the race for people’s economic liberation.

On that day, all roads were leading to State House as leaders from the security wings, church mother bodies, non-government organisations, embassies, top government leaders, and personal friends visited Kaunda.

This was the night the country went to sleep without a president.

The following morning, on 8th February 1968, Kaunda rescinded his resignation to the relief of the masses.

Thereafter, he worked hard to develop and implement policies and programmes to develop the country.

Even then, vicious and divisive regional and tribal politics continued because the problem of Kapwepwe’s ascension to the Vice President position was not formally tabled to iron out differences.

As a result, Kaunda and Kapwepwe were no longer in each other’s good books, making regional and tribal animosity to spread and persist.

Again, using his submarine political tactic, Kapwepwe started working on the formation of a new political party which further incensed Kaunda.

Kapwepwe lost political grip in UNIP because he was disrespected and overlooked.

He became an isolated political dynamite under surveillance.

In 1970, he resigned, and a year later formed the United Progressive Party ending his political footprints in UNIP.

The exit of Kapwepwe from UNIP was seized as an opportunity to unite UNIP and the country, but with great difficulties.

Kaunda’s efforts to unite the country were visible through his ideologies such as ‘one Zambia and one nation’ and best practices.

He translated his unity ideology into practice through the principle of regional and tribal balancing quotas for various ethnic groups for representation in government bodies.

Let us learn from the living legend Kaunda by acting decisively on tribalism that is endangering the unity of our country.

We’ll vigorously market HH to win in 2021 – Ngoma

NEWLY elected UPND Sinda district chairperson Innocent Ngoma says the party will vigorously market the candidature of Hakainde Hichilema with the aim to win in 2021.

In an interview, Ngoma said he desired to see the party add value to Hichilema’s success in 2021.

He observed that the sufferings which the PF government has subjected people to would make them drop the ruling party in the coming general elections.

“I envy to unite the party to ensure we win next year’s elections. We want to market our leader Hakainde Hichilema to the people so that we win next year’s elections,” he said.

“The problems that people have undergone from the time PF came into power are what will disadvantage them (PF) come next year. We are told drugs are there in hospitals but there are no drugs in these health centres. If you go round our district in Sinda and Kapoche Constituency, truly you will feel bitter to see the deplorable state of the road network we are using. Our poor national economy is affecting us in everything, poor agricultural market system is the order of the day. All these are what PF has subjected the people of Zambia to,” he said.

Ngoma said whether the PF party had machinery and money, change was in the hearts of the people who feel the pain of the failed government.

He said MMD in government had money and machinery more than what PF had but PF won after people decided to change government.

He said the same would happen to PF in 2021.

“During MMD government, PF had no money, had no machinery but time came when people saw the need to change and that is what will happen in 2021. There comes a time when people are awake to the situation and what they decide cannot be diverted,” Ngoma said.

He thanked party members for entrusting him with the responsibility to take the party forward in the district.

Meanwhile, outgoing chairperson James Banda thanked the members and wished the new leadership all the best.

He wondered how change could be made when the party is going towards general elections.

He further wondered why out of all the districts Sinda was the only one which had dissolved the leadership and ushered in a new one.

Banda challenged those behind the change to ensure the party in the district does not go down but improve and win elections in 2021.

He said the change of leadership was characterised by corruption from top officials from the secretariat, who had personal agendas in Sinda.

Banda revealed that some of the members who voted against him revealed to him that some top party officials phoned them the whole night on Friday asking them to vote against Banda.

He alleged that promises were made to them they voted him out.

“My worry is that are we going to achieve what we had put in place in readiness for 2021 as a district?” Banda wondered.

He challenged anyone behind the change to provide formulas that would take the party forward.

He said leadership was not about following everything certain people say or command but to implement strategies, which was not the case for Sinda where certain top officials dictate most affairs of the party based on their personal interests for 2021.

He also observed that those aspiring to contest positions were part of the people that cause confusion by corrupting provincial or NEC officials to support them even when they were not credible to take up leadership responsibilities.

“They (party officials) would prefer to work with people who are the yes bwana yes bwana for their own benefit,” Banda said.

Asked if the change of leadership came because he favoured Johabie Mtonga to be the provincial chairperson instead of Thole, Banda said there was no mistake in supporting Mtonga because he was a very hard working member he believed could take the party forward going into 2021 compared to Thole.

“A lot of people even at provincial level are in favour of Mtonga and if I was on his side, I was not wrong because he is a very hard working man who has done much for the party in Eastern Province. I feel he could be a better leader to take the party forward as we approach general elections,” Banda said.

Asked if reports that former Sinda member of Parliament Levy Ngoma wants to ensure that the district party positions were filled with people he worked with when he was an FDD member, Banda said that might be true though he has not announced it.

He noted that most leadership positions in Sinda have been given to those who worked with the former member of parliament.

“He has not announced that on the platform but from the look of the system, it might be true because we were the only two from MMD, the rest where those who came with him [Ngoma] from FDD, so the assumptions of the people might be true but as long it will take the party forward, we don’t have a problem,” Banda said.

Banda said he gave PF sleepless nights and exposed their wrongs.

He said he could not resign to join PF but will forever support the UPND until it gets power in 2021.

Some members talked to expressed sadness over the leadership change saying it had been done at a wrong time and with a wrong motive.

“We are not happy and we know what is happening is not good. Why is it that some people like a Ngoma (Levy) has taken the party like his own baby at home? Why can’t we do things the way we feel the party can move forward?” the source wondered.

And one lady said Ngoma wants to and retain the seat in 2021 but he was segregating members that can take him forward.

“We have selfish people that want the party to dance to their tunes. We know Ngoma wants to stand in 2021 to retain the seat but sembe atitenga cabe bwino (he should carry us well) but for us kusebenza na banthu bamene sitiziba bwino (but for us to work with people we don’t know) game izabvutako (will be difficult),” she said.

The district elections were held on Saturday in the bush. Ngoma emerged victorious polling 78 votes against Banda’s 38.

Prof Lungwangwa And Mukumbuta Are Hungry Weaker Souls Who Have Been Bought By PF – UPND

Weaker souls in our party, who are hungry for money have given in to the carrot being dangled by PF, says opposition UPND secretary general Stephen Katuka.

And Katuka has disclosed that he is being approached with offers of money by the PF government in order to work with them, but he has refused to give in as that would destroy the party he was secretary general of

And Katuka said he did not anticipate that their party members of parliament Geoffrey Lungwangwa (Nalikwanda), Mukumbuta Mulowa (Senanga) and Teddy Kasonso (Solwezi West) would turn out to show their true colours in the manner they have done, but that the party will plead with no one.

Asked by Daily Revelation on what the real problems were between the party and their members of parliament as the differences were now more glaring before the public eye, Katuka said it was very difficult for weaker souls to resist the temptation of the carrot being dangled by the ruling party.

“You see they are just hungry for money. There is a carrot being dangled by PF, all of us it has been dangled but because we have our principles we have avoided it. The weaker souls when they see these carrots, you know I have been approached myself that I can reveal to you. No we will give you so much, I say no I am not interested in that money,” Katuka said. “That’s how they are getting our councillors, that’s what they have done to some of our MPs. We have information of money being deposited into their account, we have information of some of them receiving motor vehicles, we have information about them going into State House disguised.”

Asked if those involved where those already having problems with the party, or there were also other party members involved, Katuka said he referring to those he had talked about already.

“No no no no we haven’t heard reports of any other other than those I am talking about,” he said, adding that when one was weak it was easy to fall for anything.

Asked on how much he had been offered himself to work with the ruling party, Katuka said he would not disclose, only stating that he had refused, as apart from being principled, such a move would destroy the party he was running as secretary general.

On the recent revelation that Prof Lungwangwa voted with those in government to defeat the opposition on whether to allow electronic voting or have the Electoral Commission of Zambia (ECZ) conduct the voting on Bill 10 through a secretariat ballot, Katuka said Lungwangwa was just showing his true colours.

“He’s showing us where he belongs where his allegiance is, his allegiance is no longer to the UPND as a party. His allegiance is to the other party. So in short Professor is gone, that’s why he is behaving like that, it’s to show us that he is gone. That’s why he’s voting with the PF to show us that am no longer your son,” Katuka said, and was asked if this could be termed a permanent divorce between the parties. “He has decided to divorce the party, he has decided to detach himself from the party we haven’t divorced him. We haven’t thrown him out. As a party we know that he stood on our ticket and it’s because of our party that he’s in parliament.”

Asked if Prof Lungwangwa should count himself out of Nalikwanda as far as the UPND was concerned, Katuka responded: “Well that is not debatable I think. That is not debatable. it’s clear that he has decided to go against the party. If you decide that I don’t want you. If a woman decides in a home that I don’t want this marriage I am gone, what do you do…and any sensible man will let her go so that she meets her wishes. So he has decided to go we can’t stop him. We have done a lot, from the time he remained in the chamber we have not disciplined him, he has repeated it we have not disciplined him, we have not said anything. So if he’s ready to who am I to stop him? We are not forcing him and we will not plead for anyone.”

Asked if the party regretted their move to adopt Prof Lungwangwa and others, especially that they had their own members who were waiting to be adopted, Katuka said the UPND had noble intentions as they did not know that the relationship could deteriorate to this level

“It’s like a marriage when you marry you do not know how far that marriage will go. When you live together with a woman that’s when you know the true colours. We did not know who Lungwangwa was before, we just knew him as one of the MPs in that house. And western Province being our stronghold they came to us and asked for a favour that we adopt them. We had a loose alliance with them that made us adopt them,” Katuka said. “And fortunately we got the seats in Western Province which was a good move in my view. We managed to get almost all the seats in Western Province now if he has decided to go I don’t think it will be right to blame the leadership. There are so many who are with us and doing very well, who came from the MMD. But in my language there is a saying that in every village there must be a fool.”

Asked if apart from Lungwangwa, the party counted the two other, Mulowa and Kasonso as gone too, Katuka said: “You watched Mulowa on (ZNBC) TV the other day with PF Bwana Mukubwa MP. So do you expect my member to be on the group of PF members on an event like that one, denouncing my party? Those are proving to us that they are no longer your members that’s why they can go and be paraded on a television with PF members to say these are my new found friends. That’s what it shows.”

We have not bought Lumwana Mines-NAPSA

NAPSA has denied media reports that it has agreed to buy 100 percent shares in Lumwana Copper Mine for a total consideration of US $895 million in cash.

In a statement NAPSA Acting Director General Ronnie Kamanga said NAPSA has not entered into any such transaction nor been involved in any such discussions.

“We would like to urge members of the public to ignore the said press release and treat it with the contempt it deserves,” the acting director general wrote, adding that the pension fund would seek to ensure the perpetrators were prosecuted.

The news story claimed that Barrick Gold Corporation has agreed to sell its 100 percent interest in Lumwana to Metalinvest Capital Corporation (Metalinvest) and NAPSA for a total consideration of US $895 million in cash.

The press release dated June 15 quoted Barrick president and chief executive officer, Mark Bristow saying the sale of its interest in Barrick Lumwana Copper Mine represents the third step in their plan to realize in excess of US $1.5 billion from the disposal of non-core assets by the end of this year.

He is said to have said that while this iconic Copper mine has been a valuable contributor to Barrick over the years, the asset does not fit with their strategy of operating mines that they owned.

“The sale of our interest in Barrick Lumwana Copper Mine represents the third step in our plan to realize in excess of US $1.5 billion from the disposal of non-core assets by the end of this year.

“While this iconic copper mine has been a valuable contributor to Barrick over the years, the asset does not fit with our strategy of operating mines that we own. The sale allows us to further focus our portfolio on core operations,” Mr. Bristow said.

The story further claimed that Mr Bristow expressed pleasure to have achieved a successful outcome following a competitive sale process and that he was confident that Metalinvest and NAPSA would be an excellent partners at Lumwana Mine going forward.

Metalinvest Capital Corporation is a federal corporation registered in the province of British Columbia, Canada and operates as a private equity firm focusing in mining sector.

Metalinvest founded and led by Mohamed Matongo since 2010, is a private equity firm that has successfully financed and concluded multi- billion dollar mergers and acquisition transactions mostly in Africa.

Credit Suisse Securities (Canada), Inc. is said to have been acting as financial adviser to Barrick. Davies Ward Phillips & Vineberg LLP and Herbert Smith Freehills LLP are acting as legal counsel to Barrick.

And Barrick Gold says it has alerted authorities after what it says was a fake news release claiming it has sold Lumwana mine.

Metalinvest also said it has no knowledge of the deal and is launching its own investigation, founder and director Mohamed Matongo said in an email to Reuters.

“It has come as a great surprise to me that my company name is being mentioned in a transaction that we have no knowledge about,” he said.

Barrick was last year seeking buyers for its Lumwana copper mine, but in February Chief Executive Mark Bristow told Reuters he would not necessarily sell it, and might instead look for a partner in Zambia or a deal with a copper processor.

Barrick Gold said yesterday that there is “absolutely no truth” in a news release circulated on social media in Zambia claiming the gold miner sold its Lumwana copper mine.

“We don’t know who’s behind this and we have alerted the relevant securities regulators and law enforcement authorities,” a Barrick spokeswoman told Reuters in a statement.

Mr.Hichilema told journalists at an opposition alliance media briefing this morning that the government did not only fail to follow the required process but that the content itself is inimical to the democratic process in Zambia.

He said the ruling PF leadership in its culture of telling lies is trying abeit with resistance to deceive the people that the recommendations by the parliamentary select committee had been taken on board to prove government’s good will on the constitution making process.
“Contrary to claims by the PF that the content of Bill 10 has been adjusted to take into consideration the recommendations of the parliamentary selection committee,they have only sugar coated the content to suit the interest of the PF in trying to deceive the people.The PF has deliberately created a situation which exclude key stakeholders including the church, civil society organisation and political parties.There is no sincerity on the part of the PF and we thank God that Zambians are seeing through this desperation”, he revealed.
He said following public resistance, the government decided to Gazette the recommendations from the parliamentary select committee in a process he said was in violation of the law as provided by article 77 of the constitution as amended in 2016.
He observed that the PF deliberately chose to repeal article 52 of the Republican Constitution using section 11 of Bill 10 to stop people from challenging the nomination of president Lungu and will in the process allow him run for a third term.

” If allowed to pass Bill 10 will allow the ruling party not only to change the composition of parliament and create unfair play but also give power to government to change boundaries of the constituencies. Bill 10 further seeks to allow only four paramount chiefs to be responsible for the selecting of chiefs in the country.This will be a recipe for anarchy an disorder.We appeal to ruling,opposition and independent members of Parliament to reject bill 10 in its current form as it is poisonous”,he added.

And NATIONAL DEMOCRATIC CONGRESS President Chishimba Kambwili has demanded for the immediate a 90 day voter registration exercise as opposed to the ECZ proposed thirty days as it is far from being enough in the commission’s quest to capture nine million registered voters.

Dr.Kambwili further wondered what rationale the Elections body used in coming up with October as the month for the voter registration knowing very well that most parts of the country will be experiencing rains while the farming season would be underway.
He said the commission was participating in an illegality that has the potential to defranchise a number of potential voters hence his call on the body to rescind its decision by bringing the dates forward to allow more people participate in the country’s democracy.
The opposition leader has also demanded for the reduction in election nomination fees to allow more people participate wondering whether politics was now a preserve for the rich while the poor but intelligent will continue being led and their voices dwarfed.

LUSAKA: (19.06.2020) We would like to refute allegations issued by the Minister of Home Affairs Steven Kampyongo at the press conference held at the ministry of information suggesting that UPND leader Hakainde Hichilema is the originator of the information touching the procurement of bicycles for the police.

Instead of Mr Kampyongo ordering the ZICTA to investigate the supposedly misinformation surrounding the mysterious bicycles whose source has generated public outrage, the government wound do better to channel that resource to fighting the rampant corruption in the PF government which so loud for every one to see.

The correct position as to what could have generated criticism and public outrage is rather the contradictory statement coming from the police and the Ministry of Home Affairs regarding the source of those bicycles and the cost attached to them.

We don’t know which of the two statements that was issued regarding the police bicycles is to be believed considering the many lies that have been told by the same people in the past.

The issue which this government should worry is not the source of the information which did not come from the UPND top leadership but whether or not the correct procedure was followed to procurement the said bicycles.

Mr Kampyongo should leave HH out of the Bicycle saga and instead provide reports to the nation on the Serial killings, burning of Markets and gassing incidents that took away lives of innocent Zambians.

Its unbelievable that Mr Kampyongo remains comfortable when his ministry has not provided any report to the nation on who has been behind these incidents.
Mr Kampyongo should be aware that Zambians are still waiting for reports of the brutal incidents that took away lives and properties of innocent Zambians.

We are aware that the Patriotic Front are looking for an opportunity to arrest President Hakainde Hichilema but we want Mr Kampyongo to know that the country this time will not allow any trumped up charge as the case was with a traffic offence which was turned to a treason charge.

It is embarrassing as a nation that government can openly name a country not involved in the purchase of very expensive bicycles thereby embarrassing the foreign country and denting the image of Zambia.

Our advice to the entire PF machinery is to conduct an introspection of its conduct towards public resources and relations before making unwarranted accusations against citizens as the country is bleeding from poor socioeconomic and governance policies that have left its economy broken.

Leave HH alone and focus on the people of Zambia struggling to live descent lives and deal with corruption issues such as the mysterious 48 houses, Financial Intelligence Centre and Auditors General reports revealing collosal sums of money misapropriated by politically exposed persons.

Most lawyers only manage to pass under the repeaters exam

Most practicing lawyers in Zambia only manage to pass at the Zambia Institute of Advanced Legal Education – ZIALE after re-sitting and taking what is referred to as repeaters examination.

It has been established that only a few law students (mostly under 5%) that enroll at Zambia’s law practice institution qualify and are admitted to the bar through the repeaters examinations which comprises of candidates that attempt to re-sit for the next exams after failing to clear their final exams.

The institution had on June 16th 2020 congratulated 202 students who cleared the 2019 December REPEATERS examinations out of the 731 that sat for the exams indicating a slight increase from the 2018 repeaters examinations where 194 passed out of the 694 that sat for the exams.

Meanwhile, only five out of 355 students who sat for the 2019 final exams passed, representing 1.4 percentage pass rate. The consistent low pass rate at ZIALE has since attracted concerns from various stakeholder and citizens as it has continued to recorded high failure rate.

One of ZIALE’s officers who asked that his name be withheld told the Zambian Business Times – ZBT in an exclusive interview that the institution conducts two sets of graduations in a year with one for repeaters and the other for final sitters.

“The final exams comprise of those that write the exams for the first time and are examined on 10 different courses and clear all at once while the repeaters are those that had written the final exams and had not cleared all the 10 courses then re-sit for the remaining subjects. Under these exams some attempt for the second time, third and even go up to seventh attempt and all these are categorized under the repeaters exams,” said the source.

When asked if certificates indicated whether one graduated under the repeaters or final exams, the ZAILE staffer said certificates do not indicate whether one graduated under the repeaters or final exams as everything is labeled the same.

When asked if ZIALE is considering another campus on the Copperbelt as Law training seem to be concentrated in Lusaka, the source disclosed that the institution has plans to open another campus within Lusaka and has since identified a site where such a campus will be located in the near future.

There has been concerns raised that the monopoly held by ZIALE has denied other ten provinces of Zambia from housing private law practices to five residents equitable access to the justice system and law representation.

According to a report done in Zambia, most lawyers are based in Lusaka with a few on the Copperbelt. Other provinces outside Lusaka and the Copperbelt remain remain largely under served frustrating the decentralization efforts of national development.

Voting day likely to be delayed: Malawi govt struggling to raise K9bn for poll

Malawi Electoral Commission (MEC) may face postponing the court –sanctioned presidential election slated for next week Tuesday in the wake of logistical problems including budget deficit of K9 billion to finance the polls.

The electoral body is holding a National Consultative Forum (Necof) with electoral stakeholders in Lilongwe and a consensus will be reached on the route map of the new polling day.

The new chairperson for the electoral body Dr Chifundo Kachale wants to deliver a credible election.

Kachale, the High Court Judge who has replaced Justice of Appeal Jane Ansah – who was the source of multiple protests in the country following the nullified 2019 presidential election, will update the Necof on state of preparedness.

Treasury says it is struggling to raise K8.7 billion extra money for the smooth conduct of the presidential poll in six days’ time.

During presentation of the 2020/21 National Budget in Lilongwe last Friday, Minister of Finance Joseph Mwanamveka said donors are not forth-coming to support the elections budget.

However, opposition has warned that this should not be a government excuse to cancel the court-sanctioned June 23 election.

Ministry of Finance spokesperson Williams Banda said the government is however working hard to have the money ready for the election.

“This is a governance issue. It is the wish of Malawians to have this election and we will do all what we can to have the money but as of now, we are struggling to get it,” he said.

However, UTM spokesperson Joseph Chidanti Malunga said this could be a gimmick by the ruling party to dodge the election on June 23.

“We met the MEC chairperson and he assured us that there is no financial hiccups. We will not accept any move to cancel this election on account that there is no money,” he said.

Apart from facing a deficit of about K8 billion, delayed disbursement of funding is another challenge which is affecting some of the activities by the electoral body.

Other electoral stakeholder say hard as it is to endure, the reality is that the preparations by MEC have been dodged by logistical problems and they are playing catch-up.

A two to three weeks delay is being talked about to ensure a credible poll is held.

President Peter Mutharika is facing a stiff challenge from Lazarus Chakwera, a former church cleric who is president of the opposition Malawi Congress Party (MCP).

To win outright in the fresh polling, a candidate will need more than 50% of the votes.

If no candidates does not, a run-off will be held within 30 days.

Lubinda’s Gazetted “new “ Bill 10 is a Kelenka document – Elias Munshya

President Edgar Lungu’s government is its own worst enemy. The reason why they seem to be getting caught in their own web of lies is that they really are trying to deceive the Zambian people. When the Justice Minister announced that he had caused to be gazetted a new Bill 10 document, we straight away hunted for this document. When we found it, we asked ourselves; what the mukula is this government smoking, or eating, or perhaps breathing?

We are deliberately calling this document – the Lubinda kelenka document because we cannot find the appropriate term for it. What should we call it? We cannot call it a “new” Bill 10 because there is only one Bill 10 in Parliament. We cannot call it Bill 10 for the same reasons too. Further, we cannot call it a document with “proposed parliamentary amendments,” because it is not a parliamentary document.

The Lubinda Kelenka document is created in a way that it purports to cross out some words from Bill 10. It is a replica of Bill 10 except for the words it claims to cross-out. There is no explanation as to what the crossing out of the phrase means. The document itself does not explain what the crossing out of words or phrases, or entire paragraphs mean. The crossing out of stuff then leaves to speculation. What does it all mean? At this stage of Bill 10 – the only logical thing that can be done to Bill 10 in Parliament is to withdraw it since most Zambians do not want it or to let the Bill be defeated in Parliament before second reading. The latest kelenka maneuver being done by Mr Lubinda is deceptive and disingenuous, to say the least.

The Lubinda kelenka document purports to cross-out section 5 of Bill 10. Again, we need to be clear. This kelenka document cannot cross out any part of Bill 10 as Bill 10 is in Parliament. It is on the parliamentary floor. A Bill that is before the floor of the house cannot be said to be changed by a document you gazette unless you make it clear to the Speak of the House that you are withdrawing the Bill from parliamentary consideration. For those who may wish to know – section 5 of Bill 10 talks about adding “Christian morality and ethics” to Article 8 of Constitution 2016.

Lubinda’s kelenka document appears to have been put together in a huge rush. It is full of spelling and syntax mistakes. Of course, spelling is really not a big deal if all you are doing is writing an article for a newspaper. But if you are claiming to draft a Bill, it matters what is written. The kelenka document did a cut and paste in section 22 of Bill 10 by cutting the words “dissolve” and pasting “prorogued” in its place, creating dangerous syntax and spelling problems. Which, of course, matters because it shows just how quickly Given Lubinda and his kelenka boss wanted this document gazetted.
The Lubinda kelenka document continues with Bill 10’s unseriousness. A national constitution must be drafted rigorously – and not in a playboy style. Section 22 purports to introduce the concept of prorogation, which leads to fresh elections. This is a massive misunderstanding of what the prorogation of Parliament means. They are mistaking the “prorogation” of Parliament with the “dissolution” of Parliament. They are creating a massive problem by doing so. In section 22, they go in detail explaining prorogation, which is contradicted by section 22(10). Again, this brings us to one thing – the Patriotic Front government is really not serious about what they are doing with the Constitution.

Lubinda’s kelenka document is just what it is – a kelenka document. They have published it to hoodwink Zambians into thinking that they have removed harmful sections from Bill 10. Using this kelenka document as “removal” of harmful provisions of Bill 10 is disingenuous and deceptive. It is blatant deception. When MPs debate Bill 10, they will be debating Bill 10 with all of its harmful proposals. Given Lubinda has not replaced Bill 10 and neither has he removed anything from Bill 10. His document has no legal effect and is completely meaningless.

So what is the problem with Bill 10? First, Bill 10 will change the constitutional structure of our Republic. It will make the PF government have the sole role of determining how MPs get elected next year. Bill 10 will give power to a PF dominated Parliament to set the rules for which constituencies will be accepted for next year’s elections. It will provide the PF with sole authority to determine how other MPs will come into the house. These rules will not be part of the Constitution of Zambia. Still, they will be relegated to the status of ordinary statutes. Bill 10 will reintroduce deputy ministers. Bill 10 will outlaw other religions in Zambia. Bill 10 will ban traditional Zambian practices such as traditional ceremonies because it will enshrine “Christian morality and ethics” to be the only ethics valid in Zambia. It will contradict traditional Zambian customs and outlaw them. Bill 10 will give the President more powers over the creation of provinces. Bill 10 will empower President Lungu and cabinet to borrow kaloba without parliamentary approval. Bill 10 will destroy judicial independence. Bill 10 will not make it easier for women, youths and the disabled to participate in politics. In fact, there is no single provision in Bill 10 that mentions that the Bill will empower women, youths and the disabled.

Given all these and many other reasons – Bill 10 has been rejected by the people of Zambia. Sensing this rejection, the PF has arrogantly continued to push the Bill and has gone out of its way to corrupt and manipulate people to support Bill 10. We understand that the PF is even offering big prizes to opposition MPs so that they vote for Bill 10. The question continues to be asked – if Bill 10 is good, why is the PF using corruption to spread its influence.

Last week, the Roman Catholic Church bishops issued a pastoral letter kindly asking that President Lungu’s government considers withdrawing Bill 10 from Parliament. National unity requires that a contentious issue such as amendment of a national constitution be done via consensus. Of course, to rebut the Catholic position, the PF equally orchestrated an evangelical NGO representing a few Pentecostal churches. This said NGO went on to throw its weight behind Bill 10. To this NGO, all that matters is the Declaration of Zambia as a Christian nation. And it seems this NGO is willing to support Lungu as long as it gives this Pentecostal grouping its “declaration.” I am glad though that a good number of Pentecostals have rejected Bill 10 joining their Catholic counterparts.

There is more to be said about Bill 10, but our hope is that MPs do the right thing and reject it this week, or next week, or whenever it appears in parliament.

We Shall Whip Those Who Will Dare Demonstrate Against Lungu, Govt, Says Paul Moonga

Ruling PF Lusaka provincial chairperson Paul Moonga says he has instructed youth chairperson Daniel Kalembe to mobilise party youths to whip the youths who will dare demonstrate against President Edgar Lungu and the government.

And Moonga charged that the people who were yapping about corruption are crazy and foolish, and they are just being used like condoms by politicians who have actually stolen.

Speaking with Daily Revelation, Moonga said the party has had enough of the nonsense from the charlatans and minions, saying majority of the youths actually supported the ruling party.

He said ruling party members will pounce on those who dared demonstrate and whip them.

“We still maintain our youth committees, and our youths have said they are not afraid they are going to meet them head on. So we shall see who has a bigger number,” Moonga said. “And I have told Kalembe go ahead as well go and demonstrate meet them head on. We will pounce on them. Let me assure you we will pounce on them.”

He warned the youths to dare try demonstrating.

“I have told Kalembe if they are going to demonstrate you go head on and we shall see who is a bigger family, who is controlling who. We will pounce on them, we won’t allow any nonsense. I am not going to allow any nonsense in Lusaka Province. And let me warn this through you Patson, tell them that provincial chairperson Paul Moonga says that you try to go and demonstrate we shall whip you,” Moonga said. “If the police can’t do it, us we shall take them on because I have enough muscle, enough manpower and I’m in control of Lusaka Province. Let them go and try elsewhere, may be they can go and try in Moonze. Let them try in Lusaka, let them try in Lusaka. We will whip them. Enough is enough. We have had enough of this nonsense from mere charlatans, these minions.”

Moonga said there was no substance in the allegations people were raising against the government, saying they should not be used like condoms by politicians.

“Which corruption? People are just yapping. You know yapping? People are just crazy, and foolish. These are just people who are being used like condoms by politicians who have actually stolen. Right? Youths of Zambia should not be used by anybody else,” Moonga said. “You can’t just wake up one morning ati o there is corruption. Where? Corruption is just a word, who has corrupted who? It takes two to tangle. If I say am corrupt, with who? You can’t commit adultery alone. It takes a man and another married woman to commit adultery.”

Reminded on the 42 fire tenders, Kitwe-Ndola dual carriage way, and the ambulances, whose cost Zambians have questioned as inflated, among several other goods procured by government, Moonga dismissed the assertions against the government. He said there was no country in the region that was growing as much as Zambia was right now.

“Which inflation? Do they know the price, are they even civil engineers? Do they know how to do the bill of quantity? They know nothing. Let engineers be engineers, let doctors be the doctors…but in Zambia you find people are the jack of all trades and master of none. Let teachers be teachers. Let people understand that these are professional fire tenders,” said Moonga. “They know nothing. Somebody hasn’t even purchased a car in his life, (yet they are saying) corruption, it’s too expensive. What is expensive? Lusaka has been transformed there is no country today in the region which is growing as Zambia today. The expansion of the roads, the network, everything, talk of infrastructure development in Lusaka there is no country in the region at the rate Zambia is growing.”

A SIMPLER UNDERSTANDING OF BILL 10

A good number of citizens have expressed concern that the debate around the Constitution Amendment Bill number 10 of 2019 has stayed among a few who are able to interpret the legal jargon, leaving the rest of the population behind. We agree that many people including some members of parliament who will deliberate on this Bill have very little or no understanding of this document.

Today, we have elected to help our fellow citizens understand what this bill is about by removing all legal jargon and explaining the amendments that the Patriotic Front would like to make to the Republican Constitution, on the basis that this is what the people of Zambia want. There are about 79 amendments in total, but we have only selected the most contentious which we could fit on this page, and gone further to explain (using examples) why they are disastrous to democracy.

President’s eligibility:

Right now, there is a provision in the Constitution which states that when a presidential candidate files in his or her nomination papers to take part in the elections, anyone who thinks such a candidate is not eligible to be Republican President can go to court within seven days and challenge the candidate in question. The Constitutional Court would then look at the grounds presented and decide. Once enacted, Bill 10 will remove this provision. Under Bill 10, there will be no room for anyone to challenge a presidential candidates’ eligibility, anyone aggrieved can only challenge the outcome of the election.

Now, remember that in the case of Danny Pule and others, THE CONSTITUTIONAL COURT DID NOT DECLARE PRESIDENT EDGAR LUNGU ELIGIBLE TO STAND IN 2021. The Constitutional Court could not have declared President Lungu eligible to stand because he is not the one who was in court and he was not joined to the case. It is when President Lungu files his nomination papers in 2021 when the people of Zambia can now go and challenge his eligibility and drag him personally to the Constitutional Court if they so wish. If Bill 10 is enacted, citizens who are opposed to the third term will be denied an opportunity to challenge President Lungu.

Coalition government:

Through Bill 10, the Patriotic Front is proposing a coalition government so that if a political party fails to get 50 per cent plus one, there should be no rerun. Instead, the President can decide to form a coalition government with another small political party in order to cross the 50 plus one threshold. This is designed to rescue the ruling party in 2021. In the last election, President Lungu and the PF retained power by only 50.3 per cent or 13,000 votes. Given what has transpired in Zambia between 2016 and now, chances that the PF can get these 13, 000 votes range from slim to impossible. So President Lungu and his party don’t want a rerun, they want to settle this with a coalition government.

The problem is that if President Lungu is lucky enough and gets 45 per cent, and Nevers Mumba of MMD gets seven per cent (no disrespect intended), the two can enter into a coalition government under the Bill 10 amendment to the law and rule the country without drawing their mandate from the people of Zambia. This means the one who comes out number two and all the other participants in the election are discarded.

Another problem with this system is that in the given example, Never Mumba cannot be vice-president because President Lungu will already have a running mate. He cannot be prime minister or even nominated member of parliament because there are no such provisions in the law. So what does he become? Bill 10 has no answer to this. Let’s assume that they nominate each other into power without drawing their mandate from the citizens, what happens when Nevers Mumba later differs with President Lungu and decides to withdraw his seven per cent votes or his support from the party? Bill 10 has no answer to this.

Primary Elections:

In the current Constitution, there is a provision for every political party taking part in the general elections to hold primary elections. This means there cannot be any such thing as sole candidate, no! The Constitution of Zambia, as amended in 2016, says before you can be offered to the nation as a candidate, you must have been internally elected. The principle is that you cannot run a democratic country if you yourself are undemocratic. Bill 10 seeks to remove this provision so that party members who want to challenge President Lungu do not stand a chance of challenging the “sole candidate”.

Stay of ministers in office:

Bill 10 seeks to allow Cabinet Minister to continue in office after the dissolution of parliament, until the date of the election. This is what the Constitutional Court ruled as illegal under the current Constitution. The problem with this is that ministers will have access to media, government funds and vehicles for campaigns, which kills a level playing field in elections.

Deputy ministers:

The Bill also proposes the reintroduction of deputy ministers. Despite the huge cost that this position brings to the government, proponents of Bill 10 argue that the running of government is difficult without deputy ministers. But among other consequences, if approved in its current state, Bill 10 will see deputy ministers double the number of government officials campaigning for the party in power using government resources.

Control of the Judiciary:

The Constitution currently provides for an independent Judicial Complaints Commission that looks into the conduct of judges. PF, through Bill 10 wants to change this and revert to the system where the President retains the power to appoint his desired tribunal members for a specific case. Further, under Bill 10, the Chief Justice will be part of the Constitutional Court, thereby taking away the autonomy, reduce the status of the court and the powers of the Constitutional Court president.

Role of the Speaker during election petition:

The law currently says once the election of a president-elect has been challenged in court, the Speaker of the National Assembly must assume the role of acting President until after the election dispute is settled or until the next election is held. PF wants Bill 10 to amend the law so that the sitting President retains all the Executive powers and functions during the whole process, which takes away a level playing field.

Payment of retirees:

The Constitution, as amended in 2016, dictates that when a person is retired, they must stay on the payroll until all their retirement benefits are settled. Bill 10 wants this provision amended so that retirees can be removed from the payroll on the last day of work without their benefits so that they can go home and wait in their poverty. Here, government is the biggest culprit at failing to pay retirees, and civil servants will be discarded from employment while some will die before getting their retirement benefits.

Debt acquisition:

Current law says that before government goes ahead to borrow, there must be approval from Parliament. It’s a way of checking on the Executive to make sure that it does not contract debt recklessly. Once enacted, Bill 10 will remove Parliamentary approval for debt contraction. This means the US$2 billion that Honourable Vincent Mwale would like to borrow for the construction of a railway line from Chipata to Serenje will go ahead unopposed. Right now, lending money to Zambia is risky and the lenders know that such loan is illegal if it has no backing from Parliament. But Bill 10 will allow Cabinet to contract as much national debt as they please.

This, according to the Patriotic Front, is what the people of Zambia want. Is this true?

I Was A Scapegoat – Clifford Mulenga

FORMER Chipolopolo winger Clifford Mulenga says he regrets not telling former coach Herve Renard the truth about what transpired in Gabon during the 2012 Africa Cup of Nations where he was expelled from camp for misbehaving.

Speaking on Studio Ken with Kennedy Gondwe yesterday, Mulenga said during the tournament he was among five players who sneaked out of camp to go drinking, but he was used as scapegoat for others.

Mulenga was sent home just after the team landed in Bata from Malabo where they had beaten Equatorial Guinea 1-0 on January 29 to advance to the quarterfinals.

Then Football Association of Zambia communications officer Erick Mwanza said Mulenga was no longer part of the team after breaching curfew rules in camp.

However, Mulenga who had previously never spoken out about the incident, revealed that he kept quiet to protect unnamed teammates who he went out with that night.

“I was told that I had broken curfew because I had gone out to drink. It was a night that we had won and qualified to the quarterfinals and the guys I went with felt like having a beer to celebrate. So, we went the five of us to drink,” he said. “We didn’t get permission directly from anyone. The captain [Christopher Katongo] knew about our going out, so basically the captain did give us permission to go out. At that moment when you think of the team, I think we were not allowed to go but we were in the celebration mood. After winning and qualifying to the quarterfinals, we felt it was okay to go out and have a few beers. I was used as scapegoat, I believe to set as an example to everybody I guess, because to start with, I was not the one who came up with the idea. And when we came back from that outing, I was okay. I reported for breakfast as usual and there were two guys that didn’t report for breakfast. So when they came with the decision that I had to leave, it came as a shock to me.”

Mulenga, who was labelled as the ’bad boy’ of the national team, feels that his former teammates sold him out.

“I think it’s because of my past experience with the national team. I had a bit of some run-in with the national team so … and people were aware of it. So I felt that if they tell people that I was the mischievous [one] in that camp, people will easily believe it than the people who were wrong that night,” Mulenga explained further. “I was very shocked; I was very devastated. I cried a bit, I tried to explain myself or to ask him [Renard] why I was being kicked out. All he said [was] he knew what happened and I was on the wrong. But I asked him, what about the other two guys that were caught red handed? …The morning that we woke up [there were] only three guys that showed up for breakfast, the other two failed to because they were drunk and had girls. We were at the [night]club five of us and three got girls; me and Hichani Himoonde didn’t leave with any girl; so the three guys should have been the ones to have been sent home.”

He however regrets not telling Renard the truth about what really transpired that night.

“I have a tendency of protecting my friends and I thought if I had mentioned girls, it could have been a big issue and caused a lot of disturbances in the team. The issue of importing (bringing girls in camp) is a very common issue. Sometimes you stay in camp for a while and you know guys just want to relieve themselves, so we did sneak in some girls into camp,” said Mulenga. “I regret for not speaking out at that moment, I should have told the coach. You know that we were the five of us and I should have told him what had happened the previous night because I didn’t have a girl that night. The only mistake was to have a beer and go out that night.”

 

 

 

George Chellah: Tough times ahead

CHOKED in debt, disease and poverty, no doubt the notice by British Prime Minister Boris Johnson that the Foreign Office will swallow up the Department for International Development (DfID) is the worst news for Africa.

DfID is a British government department, which was established in 1997 with an obligation “to promote sustainable development and eliminate global poverty.” Fragile states in particular and low-income countries in general remain on top of DfID’s overseas aid agenda especially in achieving the Millennium Development Goals (MDGs).

Definitely, DfID is a critical partner to Africa in tackling global poverty and disease, and any shake up in the administration of British overseas aid will have a direct bearing on Africa’s marginalized population. As a result, African governments ought to be prepared for turbulent times heads as the British aid package might shrink and will now be skewed in a manner that advances Britain’s commercial, security and diplomatic aims, which of course is a total departure from the previous rationale.

“We give as much aid to Zambia as we do to Ukraine, though the latter is vital for European security. We give 10 times as much aid to Tanzania as we do to the six countries of the western Balkans, who are acutely vulnerable to Russian meddling,” said Prime Minister Johnson as he justified his decision in the House of Commons recently. Also, the Prime Minister added that British Foreign Secretary, Dominic Raab would make the final decision about which countries should receive aid.

From the foregoing, it’s clear that the British diplomatic gloves are off and it’s now a ‘fist fight’. And I can predict that under the revised order, to access aid, “fragile states” and low-income countries, of which most African countries fall under, would strictly be required to satisfy the British government’s demands for transparency, accountability and good governance in the broader aim of securing British commercial, security and diplomatic interests. Literally, this is the British version of “America first” but is Africa ready?

Without doubt, this pronouncement once again puts Africa’s governance methods on the global spotlight and has the potential to subject millions of vulnerable Africans who depend on British aid to indescribable poverty, disease and squalor since their access to aid will now depend on their political leadership’s rapport and compliance with British diplomacy and tolerable governance standards. So the only way out for Africa is to ensure that it puts its house in order by setting up a self-sustaining development agenda if that is possible or simply commit to satisfying the new demands of the British aid card, which are definitely in the offing.

After denying that he ran a Nicki Minaj fan account, the “Old Town Road” rapper is coming clean. It’s long been speculated that he was behind the now-suspended @NasMaraj account, but now he’s finally admitting it.

On Tuesday, he reached out to his idol on Twitter and asked if she would collaborate. “i have this song i want u on and was wondering…,” he told Nicki, while sharing a meme of an emoji and an engagement ring, which read: “I am proposing.”

When one of his 4.8 million followers asked why he never admitted to running the fan page, he responded: “i didn’t want people to know i was gay tbh.”

Another fan told him that being a Barb doesn’t make him gay, to which he replied, “it don’t but people will assume if you had an entire fan page dedicated to nicki u are gay. and the rap/music industry ain’t exactly built or accepting of gay men yet.”

After seeing his tweets, the Queen herself addressed his comments. “It was a bit of a sting when you denied being a barb, but I understand,” tweeted Nicki. “Congratulations on building up your confidence to speak your truth. @LilNasX.”

 


Lil Nas went on to apologize for denying his love for Nicki in the past. “the generous queen, i love u. and i’m sorry i did that in a time where u were already getting so much bandwagon hate,” he wrote. “i felt so bad, hoping u wouldn’t see my denial. i was just so afraid of people finding out about me and losing everything before i even got a chance.”

 


The admission comes almost a year after Lil Nas came out as gay on June 30, the final day of Pride Month. “some of y’all already know, some of y’all don’t care, some of y’all not gone fwm no more. but before this month ends i want y’all to listen closely to c7osure,” he tweeted.

Last month, he admitted to being a Barb when he tweeted, “life is too short to pretend you’re not a barb.”

It remains to be seen if Nicki will collaborate with Lil Nas X. The record-breaking rapper continues to work on his new album and can also be seen in Gucci’s new Off the Grid campaign.

New Nomination Fees Totally Unacceptable and an Affront to the Principle of Constitutional Democracy-HH

UPND Leader Hakainde Hichilema says the Electoral Commission of Zambia’s new nomination fees for various categories of candidates, for next year’s elections are totally unacceptable and an affront to the principle of constitutional democracy, that encourages inclusiveness of all citizens that wish to aspire for public office.

Mr Hichilema says the fees are unaffordable and are clearly an attempt by the Establishment to maintain the status quo and also exclude the youth, the women and other disadvantaged groups that were already struggling in the 2016 elections, to raise nomination fees, inorder to take part in the elections.

He says Politics should not be the preserve of the rich only but that every citizen that has the vision and the capacity to contribute to the wellbeing of Zambia must be allowed access to enter the arena.

Mr Hichilema has demanded that the ECZ must immediately level the playing field and reduce the nomination fees to sensible levels.

Meanwhile, GEARS Executive Director McDonald Chipenzi says the proposed nomination fees for 2021 prospective aspiring candidates for elective political positions are very exorbitant and beyond the reach of majority candidates.

Mr Chipenzi says participation in elections will now be a preserve of the rich or those with money and proxy to money and the powerful in society.

“We are now merchandising elections in Zambia which may lead to poor service delivery to and representation of the people in wards, districts and constituencies including at national level as those that will manage will first work to lootback their money”, he said.

Mr Chipenzi has warned that if not careful with these increases in fees, soon the poor will be perpetually marginalised and ruled by the rich, electoral shylocks and the wealth.

“Imagine a K25, 000 payment to ECZ as nomination fee, add up another, say K15, 000 party application fees demanded by political parties which will bring the total to K40, 000 for nominations and applications for adoption for elective positions which is just far too much for a people living in country with struggling economy and majority are poor”, he added.

Mr Chipenzi said this is commmercialisation of elections and suffocating the electoral democracy and rendering ECZ as a capitalist agent.

“There has been argument on Bill 10 that MMPR electoral system is to increase women, youth and persons with disabilities effective participation in the governance, are these exorbitant fees proposed not undermining this argument? The categorisation is also unfair in as much as they indicate recognition of different abilities of persons. Will benefits accruing once one wins going to be categorised also to an extent that those who paid more will get more in terms of allowances and salaries?”, he said.

Mr Chipenzi said this is not even positive discrimination but discrimination of the youth and persons with disabilities as they are seen as lesser and disabled human beings.

He urged the ECZ not to turn into an institution for profit but facilitator of effective citizens participation in the electoral process which accommodates both the poor and the rich.

Mr Chipenzi said these fees are a clear blockade to realisation of effective citizen participation in the electoral process.

However, Mr Chipenzi said it is good that ECZ threw the proposed ball of exorbitant nomination fees to political parties and hope political parties will take the interest of majority Zambians.

“It is our considered view that political parties will not be selfish at this hour but consider the plight of the people and create a conducive environment for that effective measure of participation for all whether poor or rich”, he added.

Mr Chipenzi said this jump in nomination fees is humongous and quite absurd.

He said whilst the recognition given to persons with disabilities, women and youth is commendable, their nomination fees those for everyone should have been pegged a lot lower considering that the commercialisation of politics remains one of the major barriers for persons with disabilities to participate as candidates in our electoral process.

Mr Chipenzi said politics should be a competition of ideas among citizens not deep pockets among the rich and the wealth.

He said this will give political parties another reason not to adopt persons with disabilities, women, youth and those with shallow pockets yet with heavy and deep ideas.

Mr Chipenzi said adoption processes in political parties are already marred with high level of corruption and now.

“Nothing has changed in the economic lives of our people to warrant a 100% nomination fees increment. Instead, their incomes have been eroded by high inflation and depreciation of the local currency against the major convertible currencies”, he has said.

“This is why we demand for local or nearby printing of ballot papers to reduce on cost incurred by ECZ which it is now passing on to consumers of electoral services like political parties, aspiring candidates and citizens”, Mr Chipenzi said.

He has warned that at the rate people have loved money in the electoral process, soon the country will be told that acceditation and monitoring an election in Zambia will be at a fee.

CHIEF PUTA IS RIGHT…PF has failed lamentably; I also won’t vote for them – Chief Hamusonde

CHIEF Hamusonde says the country is so poor because the PF government has failed to manage the economy.

He says the PF has equally killed the rule of law leading to the many Zambians failing to ‘breath’.

In an interview, Hamusonde of Bweengwa west in Monze district said he supports chief Puta who says he will not vote for the PF.

“I don’t hate the PF as a party or any individual in it, it is its failures that I hate. We are so poor as a country, why? It is because the PF has failed to manage the economy,” he said. “They have lamentably failed and I totally support chief Puta, so I will also not be voting for them.”

Hamusonde added that Zambians have no money in their pockets contrary to the PF campaign promise.

He said even workers were so poor because many have not been paid their salaries.

“Workers cannot plan for their future because they have no disposable income. There is no money in circulation, people are in abject poverty because of the PF,” Hamusonde said.

He said he does not agree with chief Chona who says the PF has performed very well.

He said Chona was exercising his freedom of speech as a Zambian.

“I don’t want to question or castigate him but those are his views, he was exercising his views as an individual but for some of us we don’t agree. It’s his opinion because he may be seeing something good as an individual about PF. As for chief Puta, I totally agree. I support him because the PF have lamentably failed,” Hamusonde said.

He said apart from the failed economy, the PF had also led to a breakdown in the rule of law.

Hamusonde said Zambia’s human rights record was so dented now as lives have been lost in questionable circumstances.

“We lost a young intelligent woman (Vespers Shimunzhila) at UNZA. She failed to breath and no police officer has been charged, let alone his superior resigning. Why? It is because the PF don’t care. Look at our friends in the US, they are on the streets because one of their own has died at the hands of the police and I have seen that some police chiefs there have resigned,” said Hamusonde. “But under PF they would rather fire a police officer for doing his job all because they have lost an election as it happened in Sesheke.”

British PM Boris Johnson suggests scrapping UK aid to Zambia

UK PM Boris Johnson has questioned the wisdom of giving aid to Zambia and Tanzania because doing so does not help the UK in its geopolitical battle against Russian President Vladimir Putin.

In a statement to parliament on Tuesday, Mr. Johnson announced he would scrap the Department for International Development and hand its duties to the Foreign and Commonwealth Office.

Announcing the merger of two government departments, the Prime Minister said it had been “right for their time” to set up the current arrangements back in 1997.

Mr Johnson said, there had been an “inherent risk” with the two separate departments, of “our left and right hands working independently”.

Mr. Johnson compared the aid money the UK gave to Zambia and Ukraine, and to Tanzania and a group of former Balkan states, adding no single independent department was “empowered to make sure whether they made sense or not”.

Mr. Johnson told MPs: “DFID outspends the Foreign Office more than four times over and yet no single decision-maker in either department is able to unite our efforts or take a comprehensive overview.

“We give as much aid to Zambia as we do to Ukraine, though the latter is vital for European security. We give ten times as much aid to Tanzania as we do to the six countries of the Western Balkans, who are acutely vulnerable to Russian meddling.”

“And, regardless of the merits of these decisions, no single department is currently empowered to judge whether they make sense or not: we tolerate an inherent risk of our left and right hands working independently.”

Charities and opposition parties accused him of “political vandalism” but Johnson said the decision would mean aid was handed out in a way that benefit’s the UK’s interests.

In Zambia and Tanzania, 60% and 36% of people live below the poverty line.

In Ukraine, this figure is just 3.8%.

In a 2002 Spectator article, Boris Johnson described Ugandans as “aids-ridden” people who can’t build their own bicyles and live in “stone age conditions “in mud huts.

He said that the UK should still be in charge of the country.

He has also called black people as “picaninnies” who have “watermelon smiles” and said that Barack Obama disliked the UK because of his Kenyan ancestry.

Mr. Johnson has been one of the targets of recent Black Lives Matter protests with demonstrators labelling him a racist.

Commercialization of the 2021 Nominations And Elections

It is extremely concerning that the Electoral Commission of Zambia (ECZ) through the Liaison Committee has proposed exorbitant nomination fees for the 2021 national elections.
If indeed it is true that the following fees i.e.: (Male Presidential – K150,000 from K60,000; Female or Disabled Presidential – K120,000 from K60,000; Male Member of Parliament – K25,000 from K7,500; Female or Disabled MP – K20,000; Male Mayoral – K25,000 from K7,500; Female or Disabled Mayoral – K20,000; Male Councillor – K2,500 from K750; Female or Disabled Councillor – K2,000 from K750) are proposals made by the ECZ, we at OYV would like to call upon the ECZ to immediately rescind this anomaly and attempt to vigorously commercialize the electoral process and elections in particular.

One would ask: Where in this picture are the Youth who are economically disempowered but are capable with outstanding leadership credentials from different walks of society?
This simply entails that the Youth are not considered for leadership as empowered by the laws that at 21 and 35 years they can offer themselves for leadership as Councillors, Council Chairpersons, Mayors, Members of Parliament and Presidential candidates respectively unless they have money. Just why should the ECZ champion the prohibition of Young people from participating in elections at the level of candidates through such exorbitant “Nomination Fees”? Why should young people be relegated to voters and/or king makers? This is unacceptable.

Furthermore and most importantly, we at OYV note with dismay that this practice of collecting “nomination fees” from candidates is neither concretely supported by the Republican Constitution anywhere and specifically in Article 52 nor Section 30 or any other part of the Electoral Process Act no. 35 of 2016. The aspect of “Nomination Fees” while it is given prominence in practice is not even articulated under the Section of interpretations of the Act. Further it is nowhere in the text/body. The only closest related matter mentioned is the “Election Fee” which is in Section 30 (1) (b), which also is only in relation to the Presidential Candidates and not any other election or candidate.

OYV is of the considered view that it would be helpful if the provisions either in the mother law and principle legislation or even in the regulations are articulated when coming up with any form of fees in the electoral process.
We appreciate the ECZ vision of being a model electoral management body that meets the aspiration of the Zambian people and the mission to effectively manage the electoral process to deliver credible elections.

However, the question is: Are these actions such as charging exorbitant “Nomination Fees” leading to achieving the said vision and mission?
We shall not accept a people’s institution articulating progressive issues in their strategic plan and practices the very opposite.
Why should the ECZ make leadership a preserve for the rich, the powerful and even the “corrupt”? Is this what it means to be a model electoral management body the meets the aspirations of the Zambian people?

As OYV, we therefore challenge the ECZ to help us understand where commercialization of our elections is coming from if it is not support by law and in the event that it is well backed by law, why are the young people who can offer the leadership that Zambians may be waiting for for redemption not considered to pay little or nothing as “Nomination Fees” as they are the most vulnerable and economically disadvantaged.

ECZ more than doubles the nomination fees for Politicians in the coming 2021 Elections

The Electoral Commission of Zambia has proposed to revise upwards, nomination fees for candidates ahead of the 2021 General elections.

According to the proposed fees made available to the media, Male Presidential candidates will now be required to pay K150, 000 from K60, 000 while female Presidential Candidates and persons with disabilities will pay K120, 000 from K60, 000.

Male parliamentary candidates according to the proposal will be required to pay K25, 000 from K7, 500 with female candidates, youths and persons with disabilities expected to pay K20, 000 from K7, 500.

For Mayors, male candidates will now pay K25, 000 from K7, 500 while female candidates, youths and persons with disabilities will pay K20, 000 from K7, 500.

At Council Chairperson Level, male Candidates will be required to pay K10, 000 from K2, 500 while Women, Youth and Persons with Disabilities will be required to pay K7, 500 from 2,500.

At the Ward Level the Commission is proposing a K2, 500 nomination fee for male candidates for City and Municipal Councils from K750 and K2, 500 for Town and District Councils from K400. The Commission is proposing that Women Youths and Persons with Disabilities should pay K2, 000 as nomination fee for City and Municipal Councils from K750 and K2, 000 for the same group for town and district councils.

According to ECZ Chairperson Justice Esau Chulu, a meeting will now be called with all stakeholders to deliberate on the proposal which if approved will see the Commission increase fees for the 2021 general elections.

Meanwhile, the Commission has assured stakeholders that as it prepares to start registration of voters between October and November, 2020 it will continue to engage the Treasury to ensure that adequate funds are made available in time for this important national exercise.

Justice Chulu has also reiterated that the Commission has no mandate to postpone a General Election as the date is now enshrined in the Republican Constitution.

“Article 56 (1) states as follows: “A general election shall be held every five years after the last general election, on the second Thursday of August”. In this case, the 2021 General Elections will be on the Thursday 12th August”, said Justice Chulu.

Officially opening the ECZ/Political parties’ liaison committee meeting held on Tuesday 16th June, 2020 at Mulungushi International Conference Centre, Justice Chulu said the Commission is, therefore, mindful about the above date and will guarantee that all preparations are made in time for the General Elections next year.

He reminded those that wish to contest the 2021 General Elections to ensure that they start preparing their documentation in good time to avoid rushing at the last minute.

Justice Chulu also said that the appointment of an Electoral Group of Eminent Persons is in line with the Electoral Commission Act number 25 of 2016.

He said the Electoral Group of Eminent Persons is a body made up of highly regarded individuals in Zambia who will act as an esteemed observatory and advisory body to, and on behalf of, the Electoral Commission of Zambia.

Justice Chulu said the EGEP’s aim is to observe the countries electoral processes and provide an independent public opinion as and when need be.

He said the group will further undertake an examination of options for reform in order to bring the Electoral Commission and the country’s electoral process into a stronger and more effective institution and process respectively.

Zambian businessman offers to invest $10m in gold sector

A ZAMBIAN businessman has offered to invest $10 million in the country’s gold-mining sector.

Bupe Chipando holds the opinion that Zambians must be allowed to manage the mines on a large scale, saying the country’s rich deposit of minerals was the backbone of its economy.

Born and bred in Kabwe in Central Province, Chipando is the founder and chief executive officer of Alinani Precious Metals, a mining company based in East Africa which has over the years established itself as in important player in gold mining, refinery and smelter across Africa.

Chipando asserts that a gold mine in the hands of the local people would grant investment returns to build schools, hospitals and roads in the country, arguing that if given to foreigners, profits would be sent abroad to benefit other countries.

He said Zambians did not need an investor with relatively little investment commitments to be given the sole mandate to run the gold mining industry whereas these little investment commitments could be organised and easily matched by locals within Zambia with the expertise and financial muscle to run the mines.

Alinani Precious Metals Ltd is a mining company registered under First Group of Companies in Kenya, Uganda and Tanzania, with First Line Capital as an investment company, First Commodity Exchange works as a market platform, while First Cargo Logistics provides transportation products under one umbrella.

“We need to talk and dialogue with the government, for we know our government is willing to listen to us. Alinani Precious Metals, as a Zambian owned company if given a chance, we are willing to pledge between $5 million to $10 million as an investment in the vast gold mining sector. We are confident that this is something we can implement. We don’t need investors to inject $2.5 million and get the largest stake in our mining sector at the expense of our very able local investors,” Chipando said.

He said Alinani Precious Metals had the capacity to produce and refine about 300 kilograms of gold per day with the state-of-the-art equipment and machinery.

He said given an opportunity to invest in the gold mining, the company would create decent jobs for the ever increasing unemployed graduates from the University of Zambia.

“We commit to give Zambians the first priorities to the available job opportunities we will immediately create. We believe University of Zambia has produced competent manpower to run the mines and it is for this reason that we will partner with the University of Zambia to enroll graduate programmes where graduates can learn from our activities in the mines,” Chipando said.

“Besides providing jobs to the unemployed Zambian graduates, we pledge to enrol vibrant community social responsibility programmes which will be mandated to give back to the community by participating in the developmental activities of the area. We pledge to build hospitals, schools, roads, sports facilities and other developmental activities.”

Chipando said it was high time that Zambians were given the opportunity and platform to own, operate and run the vast mining industry for the benefit of the local people.

He said Zambia’s rich mineral resources were the country’s birthright which ought to be managed by its people.

“We like the investors and we appreciate them but we want this issue of exploitation of the Zambian mineral resources to be exhaustively addressed. We want to demonstrate to the country and the world at large that as Zambians, we are able to control our own minerals and metals. We want to prove that we have the expertise and manpower to control our own mining industry which will consequently have great economic and social benefits to the Zambians as it is no secret that mining forms the backbone of the Zambian economy,” Chipando said.

“We don’t want people to come from the rest of the world only to pay a few millions here and there and later take away all the billions they make in profits and invest in their own countries, a trend which has been seen to gain momentum here in Zambia. We want the metals and minerals we have in Zambia to benefit each and every Zambian because, you know that is our birthright. It is our birthright to fully enjoy the benefits that are attached to the mining industry in Zambia. Now that we have discovered gold, it is important that a clear strategy is developed so that we fully benefit from this new discovery. All in all, we should be able to utilise all the mineral resources available for the benefit of the Zambians.”

He said given a chance, his vast experience in the gold mining industry as well as his commitment to invest $10 million dollars would have a great impact to the entire country.

“We understand the work involved and acknowledge that we have an enormous task ahead of us but with the capital and the great experience at our disposal, together with the government support we will most certainly achieve what we set ourselves to achieve,” said Chipando.

Chief Cooma threatens to dethrone ‘UPND headmen’ threatens to dethrone ‘UPND headmen’

CHIEF Cooma of Choma district in Southern province has threatened to dethrone headmen that were voted into UPND local leadership positions in the just ended intraparty elections.

In an interview, Cooma expressed displeasure that some headmen had openly taken a partisan stance which had potential to destruct development in their places.

“I will not hesitate to ask their clans to give me other names. I can appoint headmen because I can’t work with political cadres in my traditional council. I’m aware that some headmen in Namuswa area in Masuku were voted into UPND party leadership positions, where one is a chairman and the other is information and publicity secretary,” he said.

Cooma called for the named headmen to relinquish their positions or be dethroned from traditional leadership.

“The moment us in the traditional leadership start taking political party positions and become active in politics we threaten development in chiefdoms because NGOs and government will not wish to work with us in our areas and by that we would be depriving our people of development,” he said. Cooma urged headmen to work with the government of the day unlike identifying themselves as opposition political party members “holding even positions”.

“For example, we have NGOs like ZOCS which is building schools in rural areas in my chiefdom and if my headmen turn themselves into politicians, it will be difficult for them to work with such headmen who have turned themselves into UPND party functionaries,” he said. “As traditional leaders it’s important to be drivers of development and remain non-partisan. Be neutral and work with anyone. It’s okay for headmen to attend political party meetings of their choice but being voted into a position is wrong. So as chief, I have asked their clans to submit other names to be appointed as headmen replacing those now UPND officials.”

Cooma said development can only be actualised in the chiefdom if traditional leadership worked with the government of the day and not with the opposition.

He argued that it would be difficult for him as a chief to mingle with such headmen for fear of being accused of championing opposition agenda.

“It can also happen that when I as a chief want to see them they will be having their party meetings,” said Cooma.

BILL 10 IS DEAD – SYAKALIMA

UPND senior presidential advisor Douglas Syakalima has told justice minister Given Lubinda to stop lying through his teeth on the parliamentary select committee on Bill 10.

“I read where Lubinda is saying that the parliamentary select committee is expected to support Bill 10. Lubinda must stop lying in between his teeth! What is on the table is Bill 10 and not the [select] committee’s report,” Syakalima, the Chirundu UPND member of parliament, said in an interview. “If Lubinda is saying the select committee’s report is something to go by, then 90 per cent of his bill is dead. If that is the case, why should we go ahead when the select committee crippled 90 per cent of the clauses in his bill? Have you seen how nonsensical they are as PF?”

On Friday, The Mast quoted Lubinda saying he expects all members of parliament on the select committee on Constitution (Amendment) Bill Number 10 of 2019 to support it.

The minister said the practice in all Commonwealth parliamentary jurisdictions was that select committees operated on the basis of conscience.

But Syakalima countered that Lubinda was hoodwinking unsuspecting Zambians.

“What is on the table is not the select committee’s report; the select committee’s report are suggestions to the House which stakeholders gave. If you recall, these are the same people who were saying 90 per cent of the things which are in the bill were rejected by the people,” he said.

“Does it mean that if that select committee’s report is binding Lubinda is going to amend the entire bill? If that is the case, why doesn’t he bring a new bill which will incorporate what stakeholders said? You can see how they are trying to lie in between their teeth.”

The lawmaker argues that “in the unlikely event” that the scandalous Bill 10 was re-tabled, “it is the bill which is going to be debated” unlike the select committee’s report.

“The question will be asked on the bill and not on the committee’s report. No one will be debating the report! It is the bill which is debated. Even when they attempted to debate that time, were they debating the [select committee’s] report?” Syakalima asked. “So, why does he (Lubinda) continue to lie? Anyway, maybe Lubinda might not be a liar but I think that it is lack of intellectual capacity for Lubinda. This is why I have always advised that speaking English, just like my Grade six daughter…But it does not mean that my Grade six daughter who speaks fluent English is intellectually balanced. No!”

He charged that: “Lubinda doesn’t have intellectual capacity.”

“He doesn’t just have it! Probably when he finishes law school he will have that intellectual capacity. He can’t be feeding Zambians that this is what happens. No! He is lying. The question is going to be asked on the bill and never on what the select committee report stated,” Syakalima said. “If Lubinda is saying the select committee’s report is something to go by, then 90 per cent of his bill is dead. If that is the case, why should we go ahead when the select committee crippled 90 per cent of the clauses in his bill? Have you seen how nonsensical they are as PF?”

Meanwhile, Syakalima reiterated that the PF government must never take Zambians for a ride.

“He (Lubinda) can’t be telling the Church to keep their own lane. The Church has members and he shouldn’t think that 81 of them (PF members of parliament) or hundred and something of them can determine the fate of all Zambians,” said Syakalima. “Never take God’s people for granted. They give you power and when they want, they withdraw it from you and this is exactly what the Zambians are doing now – withdrawing their trust from this wicked and unrepentant PF.”

Cecil Rhodes: An Evil, Murderous Colonialist Who Plundered Southern Africa

If there is one man permanently etched in the history of Southern Africa for his grand imperialist designs, it must be Cecil John Rhodes. His wild ambitions inspired by British imperialism resulted in the region being turned upside down for the simple reason that the white man was supposed to benefit from Africa’s riches.

The colonial crimes he committed against the local people who were leading their lives without much disturbance make him one of the vilest men to ever walk the face of the earth. The legacy of Cecil Rhodes was colonialism, brutality, destruction, selfishness, and plunder.

When the scramble for Africa was raging, the continent presented vast opportunities for the white capitalists. White men who decided to expand their capital traveled to Africa for their business “adventures” and displaced the African way of life that was prevalent on the continent. The African way of life was supplanted by a European lifestyle that now encompassed forced labor and a forced religion (Christianity). The white capitalists masked their colonial ambitions meant to expand their profits by preaching the misleading and misrepresentative message of “civilizing” Africa and “spreading commerce.” The way of life led by the Africans was termed barbaric and according to the imperialists, the African was lucky to be a beneficiary of British benevolence hinged on the propagation of “civilization and education.”

One of the men who carried this ideology with renewed and strengthened zest was Cecil John Rhodes. To him, the African was supposed to be saved from his barbaric ways through the “fine British civilization” – for he considered the Anglo-Saxon race to be the first and most advanced in the world. Cecil Rhodes was born in the small town of Bishops Stortford, Hertfordshire in England on 5 July 1853, and he was the son of a priest. He spent most of his childhood being sickly and was sent to South Africa because of its better weather compared to England. It was believed the good weather in South Africa would be friendly to his weak heart. His brother was already in Natal, South Africa, and Cecil Rhodes joined him with early business ventures in cotton – a venture that did not yield desirable profits for Cecil Rhodes. The minerals were Rhodes’ passion. He arrived in South Africa when he was only 17, motivated, and inspired by the prospect of business profits.

Rhodes first came to South Africa with only £3000 that his aunt had lent him, and he used some of that money to invest in diamond diggings in Kimberly since the cotton venture was not yielding the desired profits. Rhodes followed his brother to the diamond fields in 1871 and immediately established links with Charles D. Rudd as a business associate (of the infamous Rudd Concession that resulted in the colonization of Zimbabwe).

Charles D. Rudd went on to become Rhodes’ partner when they created the De Beers Mining Company and later the British South Africa Company (BSAC). Through the cruel treatment of black workers, De Beers became the largest diamond company in the world and still retains that status in the 21st century.

In 1873, Rhodes went to England to pursue tertiary studies at Oriel College Oxford, but was only there for one term, returning for a second term in 1876. His time at Oxford aroused in him a spirit of spreading British civilization all over the world, with untamed plans of creating a secret society of British men who would be able to lead the world. All that mattered to Rhodes was the furtherance of the British empire and bringing of the whole uncivilized world under British rule.

Being such an ardent imperialist with an unstoppable zeal of enriching himself at the expense of the local people, Rhodes set out to achieve his dreams by pursuing a career in politics. He was a member of parliament for the Cape Colony, representing Barkly West – a rural area predominantly inhabited by Boers – which he held to the time of his death. When Rhodes became Prime Minister of the Cape Colony in 1890, he pushed black people from their lands to make way for industrial development through the Glen Grey Act. In Rhodes’ view, warped by his imperialistic impulses, black people had to be forced off their land “to stimulate them for labor” and change their habits. To him, black people were supposed to be condemned to manual labor for the rest of their existence.

Some black people in the Cape had managed to be eligible for voting, but Rhodes raised the franchise property requirements and many black people were disenfranchised. The amount of land that the black person could own was severely cut, and so many black men were removed from the voting list since they could not meet the property requirements for voting. His principle of limiting the amount of land that could be owned by the black man was the forerunner of the Natives Land Act of 1913. He condescendingly called black people “natives” and said that the natives were to be treated as children with no right to vote, treated with the utmost despotism as that exhibited in India. Some of his policies were pivotal in the enactment of the Hut Tax, which was a tax imposed by the British colonialists payable on a hut/household basis.

While his imperialist agenda laid a solid foundation for apartheid in South Africa to flourish, the viciousness of Rhodes as regards profits was seen in the colonization of Zimbabwe. The British South Africa Company, led by Cecil Rhodes, employed deception to claim territory in modern-day Zimbabwe. They used brutal force to make sure the territory belonged to them and they did whatever they wanted with the land, suppressing and repressing its people in the process. Rhodes did not want the Colonial Office in London interfering in the business of the colonies; he wanted the settlers, local politicians, and governors to run the colonies. He used money from the British South Africa Company to thwart the influence of the Colonial Office. He financed the colonial projects himself. This proved useful to him as this power enabled him to counter the interests of rival European powers including the Portuguese, Germans, and the Boers.

The BSAC had its own paramilitary force to satisfy the imperial impulses of the company, headed by Cecil Rhodes. By 1888, the focus was turned to the north of Limpopo (present-day Zimbabwe and Zambia) for more minerals. In that same year, the Ndebele king Lobengula was tricked to sign the Rudd Concession, which gave Rhodes and his pioneers all the rights to the minerals in his land. Misled by the dubious legality of the Rudd Concession, Lobengula gave away all the mineral and land rights in his kingdom. The Concession resulted in the Queen granting Rhodes a charter – leading to an influx of white settlers in present-day Zimbabwe. In 1893, hostilities between the Ndebele and white settlers reached a climax and war broke out. The First Matabele War of 1893 was devastating as it resulted in more territory and riches being taken by the company.

By October 1893, the BSAC was armed with a new deadly invention – the Maxim gun. The BSAC troops swept through the territories in a ruthless and callous manner. Under the instructions of Rhodes and Leander Starr Jameson, the Ndebele were murdered mercilessly. According to an eyewitness at the Battle of Shangani, the BSAC troops were “mowing them [Ndebele fighters] down literally like grass” – about 1,500 Ndebele men perished, while the BSAC had only 4 deaths. After the battle, Rhodes wrote a boastful, racist letter to the Cape colony’s prime minister, Sir Gordon Sprigg stating: “The shooting must have been excellent, it proves the white men were not only brave, but cool, and did not lose their heads, though surrounded with the hordes.”

The crushing battles forced Lobengula to flee, and he died from smallpox in January 1894. The Ndebele warriors were subdued by the superior firepower of the company and the remaining leadership submitted to company rule. All the actions of the company were guided by Rhodes – whose leadership was acknowledged by the white settlers when the place was renamed “Rhodesia” on May 3, 1895. The war to vanquish the Matabele cost around £66 000, and most of this came from Rhodes Consolidated Goldfields Company, which was maximizing profits from the deeper-lying goldfields.

Rhodes’ colonial crimes in Southern Africa can never be forgotten. Rhodes laid a foundation for the colonization process in South Africa, Zimbabwe, Botswana, Zambia, and Malawi – all for-profit and the glory of British imperialism. His remains are at Matopos Hills near Bulawayo, Zimbabwe. A South African university – Rhodes University in Grahamstown – is named after him. His legacy is treasured by the white people who benefitted from his wars of plunder and destruction. A towering statue in Kimberly celebrates Rhodes. Through his will, Rhodes created a scholarship fund for students from the British colonies, Germany, Britain, and the US to study at Oxford University. His intention was the “furtherance of the British Empire” by educating male students at Oxford.

There have been loud calls to pull down statues of Rhodes, but some raise the argument of the erasure of history in saying that his statues must stand. But this is a man who brought havoc and destruction to African lives. His history is ample, and the pulling down of his statues does not lead to any erasure of history. Statues of valiant African heroes should replace those of Rhodes in Africa.

PF WILL BLACKMAIL INMATES WITH PRESIDENTIAL PARDON.

Prisoners by virtue of being under custody have no control over their freedoms and liberties and therefore very vulnerable to manipulation. Inmates will be blackmailed with Presidential pardon to vote for PF. Surely, would any normal person call that a free and fair election? PF is just taking its violence and confusion in prisons. Imagine prisoners dressed in different party regalia and flashing party symbols in cells. But, because of desperation, PF wants to take away even their remaining human rights of deciding what’s right or wrong. Prisoners will vote under duress, with guns held over their heads by your Prison Officers, who you will also intimidate.

We are reminding you about all this not because we are scared of you winning the elections. We are merely doing so because we are much more sober and organized human beings than you are. Prisoners are human beings with rights to choose between right and wrong. Leave them alone. In the 2016, we had strange figures from Chitulika and Lundazi as part of your rigging. In 2021 you are going to announce Mukobeko, Mwembeshi and Chimbokaila prisons as new constituencies. While Chitulika and Lundazi can be accessed by anyone and verify the numbers, the new prison rigging epicenters will shut their doors to the public once you have cooked up the figures.

Crooks are very shameless people. The rumor that there are more crooks and thieves in PF than politicians is proving to be true. How else can one understand how decent and normal human beings can turn prisons into rigging epicenters? Very soon you will declare burial sites as new polling stations for ghost voters. Prisons are restricted places, how do you now open its doors to politicians to campaign? Indeed you are new normal human beings.

Before you create too much tension in the Country out of your confused state of mind, please accept the reality that your time is up. You are exhibiting very dangerous desperation. Especially that Zambians have made up their minds to kick you out. Even people you are giving money are telling us that they are just eating from you, but they will vote for UPND. Remember what the same people did to MMD; be assured that you are their next victim.

ECZ targets 80% voter turnout

ELECTORAL Commission of Zambia chief elections officer Patrick Nshindano says the Commission targets to get above 80 per cent in terms of voter turnout in next year’s general elections.

He hopes that Zambians will massively register to vote once the “aggressive” process starts in October this year.

Nshindano was speaking during a media briefing at the ECZ offices in Lusaka on Friday.

He said from now on, the ECZ would try to make updates more frequent because the period that “we have is very short.”

Nshindano indicated that the Commission wanted to ensure stakeholders were brought on board.

“The voter registration will be an aggressive process for a month. Democracy is about numbers and we hope that the citizens will take up this opportunity and be able to register so that we can have a high turnout when it comes to 2021, but also get the representation that is required for us to be able to declare a [presidential] candidate a winner,” he said. “As a Commission, we do not take pride in seeing low numbers of voters. When you look at the current turnout, in terms of the voter apathy…Our target is to get above 80 per cent in terms of voter turnout.”

He explained that some of the processes ECZ had put in place were aimed at doing “just that, especially around the voter registration – which will involve the clean-up but also the capture of those that have fallen into the voting bracket”.

“We do hope and pray that there will be collaboration on the part of the different stakeholders and indeed you, media colleagues,” he said.

On today’s political party liaison committee meeting, comprising of political party secretary generals and chairperson of election committees, Nshindano said “eminent persons” would be in attendance in that meeting and they would be introduced to the political parties.

The ECZ has set up an eight observatory and advisory body of ‘eminent’ Zambians, who are believed/expected to be politically impartial.

Those in the observatory and advisory committee are General Benjamin Mibenge (retired), Professor Enala Tembo-Mwase from the University of Zambia (UNZA), Professor Owen Sichone from the Copperbelt University (CBU), Professor Edwin Zulu from Justo Mwale University and Reverend Emmanuel K Mwale from the United Church of Zambia (UCZ).

Others are Mirriam Munyinda, Hellen Samatebele from the civil society and Willie Sweta.

Lungu shall retain power – Lubinda

JUSTICE minister Given Lubinda has claimed that enacting Bill 10 is not a matter of life and death for the PF.

He argues that Constitution (Amendment) Bill Number 10 of 2019 is not an electoral issue.

Lubinda said those in the PF government wanted it enacted before next year’s elections because “we have spent so much time on it.”

Meanwhile, Lubinda, the Kabwata PF member of parliament, says 20 years of being in Parliament has taught him a lot about legislation and “nobody can challenge me.”

The minister also asked if it is fair for 12 Catholic Bishops to make a decision on behalf of the two million Zambians who are Catholics, yet regard it as incorrect for an elected government to speak on behalf of voters.

Lubinda was speaking on ZNBC TV’s Sunday Interview programme, in his continued bellicose defence of Bill 10.

“Let us go and meet on the floor of the House and amend the Constitution bill in any way and manner we wish. This for us in the PF is not a matter of life and death. This for us is a matter that is in the interest of Zambian people,” Lubinda claimed. “The issue of winning elections in 2021, if you were to ask me – even in my deepest of sleep, I will tell you that President Lungu shall retain his office in 2021. For the sake of those who have already started drafting a petition to petition the election results of 2021, let us amend this Constitution so that they can have 30 days, instead of 14 days.”

He asserted that the government would not let down Zambians after 42 months of “hard work” on Bill 10, “just because a few individuals say ‘no! We don’t understand what you wrote, so withdraw’.”

“We’ll proceed and the ones who have the numbers to make the two thirds if they say no, we’ll go to the Zambian people and tell them banakana (they refused),” he said. “In August 2021, I’ll come here (on ZNBC TV) and say banyala (shame on them). That’s how confident we are, and this constitution-making process for us is not an electoral issue. [But] we want it before elections because we have spent so much time on it.”

Asked by the programme host, Grevazio Zulu, if the PF and President Edgar Lungu wanted to perpetuate their stay in power using Bill 10, Lubinda disdainfully responded: “yes, if that will make people happy.”

“It (bill 10) will make us stay in power because the people will see that these people are genuine, they are honest. They (opponents) started by saying this process of amending the Constitution, they want to increase the term of office for the President to seven years…” Lubinda said. “Tell me [a clause] which says that we want to perpetuate our stay in power. Kulibe (there’s nothing). So, the ones who are saying that banyala (shame on them).”

He asked if Bill 10 should not be enacted simply because some members of parliament were gifted in doubting the sincerity of others.

“They have not said ‘we don’t like anything.’ [But] all they are saying is ‘we like what the [select] committee has said. However, we don’t trust that they will bring it into the bill.’ Is that a good reason when I know that there is a way of handling that? The Standing Orders are very clear and these members of parliament who are arguing about this, I want to remind them that there are Standing Orders in Parliament,” Lubinda said.

“Standing Order 109 to 117 are what provide for how a bill is handled. Once a bill is presented by whoever presents it, whether a minister or a backbencher, it is referred to a committee of Parliament.”

He said when a committee of Parliament goes through a particular bill, it receives submissions from people and make a report.

“At second reading, the mover of the bill presents it for second reading and then it is open to debate. The chairman of the committee of Parliament which looked at that bill presents the report formally on the floor of the House and says ‘these are our recommendations.’ Then everybody is at liberty now to debate…” he explained, stressing that he had not broken the law and procedure on his handling of Bill 10. “I read somebody completely cantankerous saying ‘this is not the way to amend the bill; the bill must be amended in Parliament.’ What I gazetted is not the committee report [but] I gazetted my bill with all the amendments I intend to move.”

Lubinda believes amendments in Bill 10 have enjoyed popularity among Zambians.

“[They are] amendments which the opposition are dancing about, they are very excited about. I have said because you don’t trust even yourselves and the procedures of Parliament, I’m going to show you how serious I am by getting all these issues that you like and put them in my bill and make it public so that everybody can see that I’m sincere,” he said. “I have published my amendments. You can’t amend a bill outside Parliament. 20 years of being in Parliament and not going to Parliament to drink tea! 20 years of being active in Parliament has taught me how to run issues of Parliament and nobody can challenge me. Nobody, I can assure you.”

Lubinda said he had moved amendments on the floor of the House before.

He said he amended the Republican Constitution when he was in the opposition.

“Go and look at the Hansard! The one who proposed the amendment to the Constitution to make sure that the date on which the [national] budget is read on the second Thursday of September is me. I was in the opposition,” Lubinda said.

Asked if he thought he could win public trust with publication of the Bill 10 amendments, Lubinda said “that’s what I was hoping for.”

“I cannot be faulted for not trying [but] I should be commended for trying. I’m not in control of people’s reactions,” Lubinda indicated

On the resolve by the Zambia Conference of Catholic Bishops (ZCCB) that Bill 10 must be withdrawn, Lubinda, a Catholic, said, “sometimes when you listen to such debates sometimes, you just resign yourself to the fact that nafishupa fye (it’s just difficult). Takwaba ukuwamya (there is no impressing). That’s what Bembas say.”

He was then asked why he was not giving up, if that was the case.

In response, Lubinda countered that: “why should I when I know that what I’m doing is right, I have been transparent?”

“So, it is okay for the college of bishops, 12 of them, to say we are making this decision on behalf of the two million Zambians who are Catholics! However, it is not correct for an elected government to speak on behalf of the electorate? Is that fair?” asked Lubinda. “Can you show me what they (Catholic Bishops) said is the reason for me to withdraw. Those who are saying ‘withdraw’ must show us the reasons why we must withdraw. If it is about those contentious issues…There has never been a consultative process on the constitution-making process like this one and sceptics must not derail the constitution-making process.”

The Association of Catholic Parliamentarians has maintained that Bill 10 is a product of thorough consultations from a wide a spectrum of citizens.

And while appreciating the views expressed by the Bishops in the statement issued in June 9th, 2020, the Association has regretted that some views expressed in the statement were a product of misinformation.

Association Chairperson Prof. Luo says such misinformation if not properly handled has the capacity to divide a country celebrated to be peaceful.

Speaking during a press conference on Tuesday, Prof Luo said issues that government put in Bill 10 were agreed upon by a large community of eminent persons at the National Dialogue Forum (NDF) shunned by the Catholic Bishops.

Besides the resolution made at the NDF, Prof. Luo recalled, the siavonga declaration by party Secretary General was also incorporated in Bill 10.

Prof. Luo is of the view that had the Bishops accepted to attend the dialogue forum, their voice could jave been incorporated in Bill 10 which the minister of Justice Given Lubinda presented to parliament.

She said after the first reading, Bill 10 was subjected to the parliamentary select committee where further scrutiny was made.

She observed that people from all walks of life made submissions of various issue which they not only agreed but also agreed with the government.

To prove the people that the government mean well on the constitution making process, Prof. Luo suggested all the recommendations except a few were taken on board and the government had all the proposed amendments gazatted for the people to see.

She all the recommendations made in the gazette paper are a true copy of what the parliamentary select committee’s recommendations as obtained from the people whose submissions via their representatives.

She said the Association is consoled that some of the recommendations the government proposed in the gazatte paper are acknowledges by Bishops.

She said the statement by the bishop does not represent the correct version of the bill and the recommendation.

She said the Catholic Parliamentarians are at pain to understand why the bishops calling for the withdrawal of Bill 10 whose recommendations they agree with government.

She not only denied there is one person or a group of individuals that have take upn themselves to popularise Bill 10 for some hidden motives but also disagreed with the bishops that Bill 10 contain some retrogressive clauses.

She said at no time did the government either by itself or through its representatives manipulate the content of constitution.

Being in opposition isn’t easy – Davies Mwila

PATRIOTIC Front secretary general Davies Mwila says it is not easy being in the opposition.
And Mwila says new members that join the party should humble themselves because they do not know where the PF has come from.

Speaking when he met party officials in Mufulira, Saturday, Mwila said some of the old members of the PF had died without benefitting from their efforts when they were in opposition.

He said the new members who were benefitting a lot from the party had no idea of the struggles the PF went through when it was in opposition.

“Abashilefwaya ukuichindika bafume munshila (Those who want to misbehave should get out of our way.) Inchito twakwata (the job we have) is to bring members to the party. I heard the chairman saying ‘we received one thousand members’, we have to embrace all those people who have come. Politics is about numbers and membership is equal to old and new members. All of us are members but all those who are coming to the party must humble themselves and they should know that kwaba abaikala mu chilonganino (there are people that have been in the party) for a long time,” Mwila said.

“Baichefyako, pantu kufika fye ulefwaya no ku toloka (they should humble themselves. There is no way that they can join the party and want to start calling the shots). You don’t even know party ekoyafuma (where the party has come from). We were in opposition for ten years. It’s not easy. Some people have died without benefiting from the party, some are still there alive and have not benefited. Some of the new people who have come have benefited a lot. So colleagues, we should not forget the mandate that we made to the people of Zambia, it is to work for them and deliver all the promises we made in 2016. The mandate is for five years and we have to renew our mandate next year; we have to be committed.”

He emphasized that people that tried to undermine Cabinet Ministers and area members of parliament would be dealt with.

“I have come for two things here; to harmonize the relationship between the MP for Kantashi (Anthony Mumba) and the constituency and to find out why there is no good relationship. Who is causing that? I have to know…I have come here because the Central Committee made a decision that no one is allowed to campaign now until such a time when the Central Committee will give a go ahead. And I want to find out who is in the forefront and I want to categorically tell you that my job is to protect the incumbent members of Parliament, including Cabinet Ministers,” Mwila said.

“Anyone who is trying to undermine these three, including a Cabinet Minister, my job is to deal with them. That is why I am there. A Cabinet Minister cannot be harassed by a constituency official; it is only here in Mufulira. A presidential appointee? I have never seen where area members of Parliament are being kicked like I don’t know. Yes, we are there in positions to work for the party but we have to protect the people who are in these offices. These issues have not started today, they have been going on and all of you are aware. But above all, we need to unite and move forward.”

He further expressed sadness that some party officials took lies to Mumba that Yamfwa Mukanga wanted to stand in Kantanshi Constituency.

“I have come with honorable Yamfwa Mukanga because some of the officials here are lying, cheating ukulatwala ubufi kuli ba Mumba ati ba Yamfwa balefwaya ukubwela ku Kantanshi (some of the officials here are taking lies to honourable Mumba that honorable Mukanga wants to stand in Kantanshi). Who has told you? Honorable Yamfwa is here, he has no interest of standing here. So efyo mu fwaya finshi? Mule leta ulupato opo mwikalile (so what are you trying to achieve? You are the ones bringing hatred). Ba Mumba bale mona kwati ba Yamfwa mulwani kanshi wakayele (honorable Mumba was thinking honorable Mukanga is an enemy yet he is innocent),” said Mwila
