REMEDYING THE IGNORANT DISCOURSE ON NAPSA PARTICIPATION IN PPP

1. Despite NAPSA being a public institution it manages private money through a pension fund on behalf of all citizens.We are all defacto shareholders in NAPSA.

1. NAPSA is financing the developer/concessionaire in managing the project. If you are against NAPSA investing in this project, you should be also be against NAPSA partnering with the Marcopolo tile company, Livingstone and many others.

2. NAPSA as a pension fund, is an institution investor that will try to diversify into several sectors including roads as a positive step to improve its portfolio..

3. You cannot assess the PPP project when you are ignorant of the traffic volumes, revenue projected, tax collected, risks avoided, jobs created, time saved, loans avoided, interest avoided and technology transfers. In other words don’t assess a PPP using emotions, show us your figures.

4. Road or bridge concessions depending on toll fees, capital costs or economy can range between 20 – 30 years, world wide. If you want a shorter concession period, get ready for higher toll fees.

5. This is the first proper PPP, an opportunity to learn from. it is better than sticking to the historical culture of begging government to repair roads like a broken record.

6. The maintenance contract attached to the PPP, distinguishes this deal from to traditional approach where fees were collected but Ndola road developed maize field ridges.

7. Government will generate revenue from commissions, taxes and other statutory fees.

8. If you are against this project, then tell us the alternative, like how a government that is in default, can raise $700m, pay low interest and complete project in 36 months.

9. NAPSA position means participation in the SPV and better Zambians supervision of projects.

10. If the developer decided to access finance from south african pension funds, the same people will complain for overlooking NAPSA. Mind you NAPSA might provide kwacha denominated finance that will avoid forex risk.

In a nutshell lets not discuss national issues without data, with political lenses and with bitterness.

PF MPs have been talking about PPPs for 10 years but failed to implement one because of the lack of stealing opportunities in PPPs. There was no private entity that was going to spend $1.2b and use tolling to recover money. That is why PF planned to borrow and inflate the contract. Let those against, watch and learn.

LUBINDA, CHILANGWA, NAKACHIINDA WERE NOT SERVED CONTEMPT OF COURT DOCUMENTS – KATENEKWA TELLS SAMPA

LUSAKA High Court Judge Timothy Katenekwa has directed PF Matero Member of Parliament, Miles Sampa to serve contempt of Court proceedings documents to party acting president Given Lubinda, acting secretary general Nickson Chilangwa and chairperson for Information Rapheal Nakachiinda.

In this matter, Judge Katenekwa has guided that Sampa’s lawyers should serve the contemnors in person because they were not served with the documents.

This was after Lawyer representing PF acting party president Given Lubinda, party acting secretary general Nickson Chilangwa and Chairperson for Information Raphael Nakachiinda raised a preliminary application in the matter stating that his clients were not served the documents in person.

In making a ruling, Judge Katenekwa stated that Rules of Court Order 52(3)(2) provides that there should be personal service in a matter of contempt and failure to do so may be fatal to the proceedings.

Lawyer for Lubinda, Chilangwa and Nakachiinda from Makebi Zulu Advocates, Jonas Zimba raised a preliminary issue requesting the court to dismiss the application as his clients were not served any court documents by Sampa’s lawyers.

However, Sampa’s lawyers argued that lack or failure of service of court documents was not necessarily fatal and cited the same rule Zimba had cited in making the application for dismissal of the case.

In making a ruling, Judge Katenekwa stated that Rules of Court Order 52(3)(2) provides that there should be personal service in a matter of contempt and failure to do so may be fatal to the proceedings.

Judge Katenekwa ruled that in matters of contempt proceedings, there have serious consequences such as depriving the contemni freedoms and it was therefore imperative that persons cited must be served the documents without fail.

He ruled that the provision of the rules of the court was not complied with as admitted by Sampa’s lawyers, adding that such was also prejudicial to the party.

Judge Katenekwa said that in deciding an application for contempt, there was consideration as there are other parties involved such as the office of Director of Public Prosecutions (DPP), noting that t the system of administration of Justice must not be compromised.

To this effect, the Court ruled that costs associated with the contempt application will be borne by Sampa.

The Court has therefore rendered an adjournment to allow Sampa’s lawyers to serve the defendants.

The matter comes up on 20th March 2023.

CABINET APPROVES TRANSFER OF KASUMBALESA BORDER POST

CABINET has approved the transfer of the Kasumbalesa Border Post by the Zambia (I.P) Border Crossing Company (ZIPBCC) to the Government of the Republic of Zambia.

In a Press Statement made available to ZANIS today, Chief Government Spokesperson Chushi Kasanda said Cabinet approved that the Zambia Revenue Authority (ZRA) should, from Friday, March 3, 2023, start managing the Vehicle Traffic Management System at Kasumbalesa Border Facility, including other supporting infrastructure.

Ms. Kasanda said the decision was made during the 4th Cabinet Meeting in the Year 2023, on Thursday at State House which was called by President Hakainde Hichilema to deliberate on developmental issues for the country.

Ms. Kasanda who is also Minister of Information and Media said the decision by Cabinet follows the expiry of the Concession Agreement between the Government and ZIPBCC on Friday March 3, 2023.

“Cabinet attaches a lot of importance to the operations of this boarder because Kasumbalesa has become a very busy crossing point where cross border business is concerned. Over time, business at Kasumbalesa border has greatly increased, particularly with increased volume of trade between Zambia and the DRC,” she said.

Ms. Kasanda stated that the transfer of the Kasumbalesa Border Post to Government will allow the Government to manage the operations of the border facility and maximize revenue collection for implementation of the many developmental Government programmes.

She stated that Cabinet feels special attention needs to be attached to ensure smooth operation of the Kasumbalesa border going forward.

“The border has also become the main crossing point for goods and services from many countries in the Southern African region,” she stated.

The Government and ZIPBCC signed a Concession Agreement for Kasumbalesa Border Post on July 1, 2009, to Design, Build, Operate and Transfer. The operations of the border facility by ZIPBCC commenced in March, 2011.

Meanwhile, Ms. Kasanda disclosed that Cabinet also deliberated on the commemoration of the 2023 National Youth Week.

She added that Cabinet appreciated the many activities that the Ministry of Youth, Sport and Arts has lined up during the week which will culminate in the celebration of the Youth day which falls on March 12, 2023.

“Cabinet indicated that the planned activities for the commemoration of the 2023 National Youth week which included among others, the Exhibition by Youth Entrepreneurs and Innovations and The National Youth Indaba should be undertaken in order to promote youth participation in the development of the country,” she said.

The Chief Government Spokesperson noted that Cabinet urged all stakeholders to participate in the planned activities and show solidarity and encourage the youth to fully participate in the development of the country.

She bought herself a big house which she later admitted was too big for a 21-year-old. “I was, like, 21 years old with five bedrooms and 5,000 square feet to myself. I was way too young to buy a home like that.”

The singer did not end there. She spent big on fashion. According to her, on a trip to Paris and Italy, she blew $300,000 in 30 minutes at Bergdorf Goodman.

“I remember just going completely nuts on trips to Paris and Italy, blowing like 30 grand in 30 minutes at Bergdorf Goodman. It was ridiculous. Eventually, I started to realize that my AmEx bill was really, really high and I needed to chill out,” she said.

Post Destiny’s Child, Rowland has maintained a successful solo music career in addition to appearing on TV shows like The Voice Australia.

She said: “In the past, women were made to feel like they could only make things work if they had a man. Now, we’re CEOs and start our own companies. Some of the most successful entrepreneurs right now are women. You can put your hand over your chest with pride because we’ve come such a long way. He regretted that the UPND defaulted in the promises it made to address the challenges and wondered why the president decided to cancel the tender process for supplying fertiliser

Speaking when he joined other Opposition MP’s for the Friday media briefing, Hon. Kapyanga expressed concerned over the suffering of Zambians as can be evident on the number of people buying maize in little packs.

He observed that the national food security is threatened as arresting of the government failing to provide inputs on time

He advised the begin fulfilling the campaign promises to make life easier for the people.

” Zambians expected the government to reduce the cost of essential commodities and ensure that cost of living become easier . I want to advise the president to be in charge of the country and stop the blame game which is washing the country away.” He said.

He strongly suspected that even God wasn’t happy with the UPND alliance government hence exposing the scandals.

He advised the government to withdraw from the IMF bailout project which has brought so much suffering to the people of Zambia.

He said the bailout which the government has been boasting is failing to be actualise.

He disclosed that the protest coordinators across the country are on stand to protect against the high living standards.

He said the UPND has lamentably failed to provide the people with the means to survive.

■ NAPSA is NOT a Bank to lend money to any one! Including its own members,let alone contractors.

■ the scheme does NOT give loans to members including for personal loans.

■the Authority however, supports financial institutions by providing liquidity for on-ward lending.

■ Zanaco Bank, First National Bank, Finance Bank, and Zambia National Building Society have partnered with NAPSA to enable citizens access loans.

■ Recently, NAPSA invested in the Zambia Industrial Commercial Bank upto 65% shareholding.

■ NAPSA is NOT a bank under the Banking and Financial Services Act of 1994 and is NOT a Money-Lender and has NO Money-lending Licence under the Money Lenders Act Chapter 398 of the Laws of Zambia.

NAPSA INVESTMENT

We must recognise that pensions funds invested primarily in stocks and bonds, often using a liability-matching strategy.

Pension funds can also invest in the housing and infrastructure sectors through financial instruments such as shares and debt securities.

To this effect, NAPSA has a special-purpose vehicle which manages investments of its assets.

■Assets of the Authority are invested in full compliance with the requirements of relevant statutory and regulatory provision such as the National Pension Scheme Act No. 40 of 1996 of the Laws of Zambia, the Securities and Exchange Commission, Zambia Revenue Authority Bank of Zambia and the Pensions and Insurance Authority.

■ The mandate to invest funds lies with the Board of Trustees that ensures that the assets of the Fund are invested prudently. In general, the Board of Trustees ensures that investments are made exclusively in the interest of the members of the pension fund.

PENSION AND INSURANCE

Pension Funds and Insurance are financial intermediaries which offer social insurance by providing income to the insured persons following their retirement. Insurance on the other hand offer policies and annuities.

GO TO THE BANKS, LEAVE NAPSA ALONE

The structure of the Ndola-Lusaka Dual Carriage-Way project is clearly corrupt, irregular and is NOT a Public Private Partnership (PPP).

The Contractors over the Lusaka-Ndola Dual Carriage Way therefore, should be encouraged to seek financial support for their project from Banks, Development Banks, and other financial Instutions.

If Government is keen to use pensioners money, let NAPSA do the road through its investment wing. It should be given latitude to pick its own contractors and a road management agency to recover its money. It can actually partner with the National Road Fund Agency (NRFA).

President Hakainde Hichilema is actually seeking to abolish NRFA so that its work including that of collecting toll fees, can be transfered to the Road Development Agency and to private firms.

On Hot FM ‘Red Hot Breakfast Show’, UPND National Youth Chairperson, Gilbert Liswaniso confessed that he has shares in Ndalumba Minerals Limited which is at the centre of intra-party scramble for the copper and manganese mine in M’kushi District.

He said, without solicitation, the shares were given to him and to Lusaka UPND Province Chairperson, Obvious Mwaliteta, by the owner of the mine, a chinese national.

He didn’t explain the circumstances under which Mr. Nixon Chibawe, the nephew to First Lady, Mrs. Mutinta Hichilema, became one of the majority shareholders.

Liswaniso and Mwaliteta have 1,800 shares each while Nixon Chibawe has 16,800 shares.

HIGH-LEVEL CORRUPTION

Thi confession and details so far provided by documents and Liswaniso, sets serious stage for an urgent corruption investigation as this matter has raised serious questions of bribery and corruption and has far reaching consequences to regulatory authorities.

Liswaniso’s naivety has laid bare serious allegations of corruption.

It is clear that these shares were given to officials of the ruling party and State House for the investor to have bottle-necks of exploration and mining licences removed and to have his stay in the country through work or residence permits guaranteed.

The investor will likely use public authorities as a lashing whip to challenges facing the mine such as location, size, encroachment and any other existing disputes with authorities and the Community.

The Organisation for Economic Co-operation and Development (OECD) states that foreign companies in Africa are heavily pressured to secure their businesses and usually seek to survive through offering bribes, corrupting both public service and politcal party officials.

The M’kushi Mine scandal fits perfectly in this secnario and raises serious corruption elements.

It is perceived that foreign companies need to pay or offering bribes as the “only way to survive” whether as a company or an individual.

The African Development Bank estimates that USD 148 billion is lost to corruption in Africa
every year.

Corruption is detrimental to economic, political and social development. It distorts market competition, undermines productivity and ultimately impedes sustainable economic growth.

While sub-Saharan Africa has become a commercially significant market, bribery and corruption risks are deterring higher rates of investment and the ability of companies to conduct business fairly on a level playing field.

The bribery risks confronting both African and foreign companies include:
■ the prevalence of business sectors prone to corruption;
■ predominantly cash-based economies;
■ the requirement to use local agents to carry out projects;
■systemic public sector corruption; and
■weak law enforcement capacity often topped with lack of political will.

Further the Anti-Corruption Commission Act No.3 of 2012 also prohibits this kind of corrupt behaviour as discussed in the M’kushi Mine and the Act covers it under corruption tendencies and corrupt transactions among public officials, private bodies and persons.

Liswaniso was quick to dare anyone concerned about this corrupt relation with the investor to report such concerns to the Anti-Corruption Commission.

Liswaniso may not be aware of the far ramifications of his confessions but both President Hichilema and the ACC know what the OECD Anti-Bribery Policy and Compliance Guidance for African Companies and the provuions of the Anti-Corruption Act of 2012.

Probably Liswaniso hopes that the ACC will simply white-wash this transaction with no consequences to both the investor and the party officials and other persons involved.

Since President Hakainde Hichilema moved the reporting structure of the ACC under gazette No. 1173, its autonomy and independence is perceived to be eroded and like many law enforcement agencies, is being used as a tool to oppress, harrass and crash political opponents instead of fighting real corruption.

This case is another test case to President Hichilema’s resolve to fight corruption…. or it’s a matter Zambians may chronicle for future reference.

PRESS STATEMENT BY THE MINISTER OF FOREIGN AFFAIRS AND INTERNATIONAL COOPERATION ON THE PARTICIPATION BY THE PRESIDENT AT THE 5TH UNITED NATIONS CONFERENCE ON THE LEAST DEVELOPED COUNTRIES (LDC5) IN DOHA, QATAR

The Ministry of Foreign Affairs and International Cooperation wishes to inform the Nation that Mr. Hakainde Hichilema, President of the Republic of Zambia will travel to Doha, Qatar to participate at the 5th United Nations Conference on the Least Developed Countries (LDC5) scheduled to take place from 5th to 9th March, 2023.

President Hichilema will join other LDC Heads of State and Government at this important meeting which will be convened to, among other issues, mobilise additional support measures and action in favour of LDCs. The Conference will also agree on a renewed partnership between LDCs and their development partners to overcome structural challenges, eradicate poverty, achieve internationally agreed development goals and enable graduation from the LDC category.

While in Doha, the President is also scheduled to hold meetings with the Amir of Qatar (the Head of State) as well as key investment players of that country, in his continued unrelenting efforts to attract investments in Zambia’s key economic sectors such as agriculture, energy, transport, infrastructure and industry.

On the sidelines of the Conference, President Hichilema will be a key panelist at the Inaugural Earthna Summit whose theme is: Sustainability Pathways for Hot and Arid Environments. At the Summit, which will convene global, regional and local policymakers and business leaders, the President will make a case for Zambia on Agriculture and Food Security to attract investment in the sector and secure export market for Zambia’s agriculture produce into Qatar and the wider Middle East.

The President remains firmly focused on unlocking opportunities and creating an enabling environment for increased investment in the country’s economic sector aimed at improving livelihoods of the Zambian people.

Through the President’s strategic high-level engagements with key partners, Zambia has witnessed renewed interest from other countries in sectors such as trade, investment, tourism, and agriculture, as well as general cooperation in identified areas.

The Conference will also have side Forums for the private sector, civil society, Parliamentarians and the youth, in a bid to raise new pledges of support, advance new ideas, spur delivery on agreed commitments, including the announcement of specific initiatives aimed at addressing challenges affecting the LDCs.

The President’s participation in the LDC5 Conference is critical because as it will enable the country to benefit from the existing global partnerships, international support and available financial and investment opportunities to help turn around the country’s economy. Police arrest Kitwe man after he attempted to sell a TV set to the person he stole it from

A KITWE thief’s memory has failed him leading to his arrest after he attempted to sell a Television (TV) set to the person he stole it from.

Sam Mwale was among four suspected criminals who stole a TV set from a Kitwe family.

However, in a surprise turn of events, Mwale unknowingly went to sell the TV to the person he stole it from.

According to Police, Mwale, 26 was nabbed and taken to police by Ngosa Chakalashi with the help of members of the public when he and his friends went to the victim’s shop in a bid to sell the TV.

Chakalashi however recognized his TV before wittingly tricking the thieves that he was interested in buying the set.

He confronted the suspects but four of them ran away. Mwale was the unlucky one as he was apprehended by Chakalashi.

Mwale however refused to go down without a fight, in trying to escape, he wounded the victim and has since been charged with unlawful wounding.

Copperbelt police commanding officer Peacewell Mweemba said the victim sustained a cut on his upper right eyelid and complained of a headache claiming a scissors was used to inflict the injuries.

“Brief facts of the matter are that some time back on date unknown ,but not long ago, the victim was attacked together with his family at home in Chamboli by five unknown criminals who later stole undisclosed amount of money and a Television set Hisence 55′ valued at K33,000.00 from his house.

“Few days ago when the complainant was busy at his shop located along Kingston road, town center, he came across three gentlemen selling a Television set and immediately he identified it to be his which was stolen from his house. Instead, he got it and told them to check for their money later,” he said.

Mr Mweemba said when the suspect came to collect the money yesterday, the victim confronted them asking them to state the source of the TV

“They ran away. In the process, the victim managed to get hold of one tightly despite being injured on his right eyelid with a small pair of scissors by the suspect. Still with help by the members of the public, the suspect was brought to the Police station,” he said.

FORMER PF secretary general Davies Mwila says Zambia currently has the worst Cabinet since independence as some ministers are not even known by Zambians.

In an interview, Tuesday, Mwila argued that the current Cabinet Ministers were not organised and didn’t work as a team.

“This has been the worst Cabinet since independence in that they are not organised, they are not well connected, they don’t work as a team. If you look at their performance, it is below average. If you look at some of these Cabinet Ministers, Zambians don’t even know them; some are not even known, whether we have ministers or not. In terms of performance, it is below par, and that is the more reason you have seen things have gone to [the] worst. The living standards of our people have gone down and people are suffering a lot because we have a Cabinet that cannot perform to the expectations of the Zambian people,” he said.

“The President is the head of the Cabinet, if he sees that anything is not going in the right direction, he is supposed to make changes or a decision to replace some of the people. If he cannot replace, it means that he cannot perform to the expectations of the Zambian people. It is a team, and as the Cabinet operates, it is a collective responsibility. You cannot isolate President Hakainde Hichilema from these people, he is the one who appoints these people, he appoints and disappoints. If he sees that things are not moving in the right direction, he is supposed to make changes. So, to him, he is very comfortable, he is satisfied with the performance of his cabinet”.

And Mwila said President Hakainde Hichilema would have made changes if he was not satisfied with his Cabinet.

“If he [President Hichilema] was not satisfied, he would have made changes by now. Look at energy, the fuel price, Zesco wants to increase electricity tariffs, everywhere you go, and things are bad. We have to look at the genesis, where is this problem coming from? From the time this government went to the IMF, those are part of the conditions; they don’t want to subsidise fuel, they don’t want to subsidise electricity; they don’t want anything to do with subsidies. Any country that has gone to the IMF has never survived, and their economies have not improved. So, that’s where we are and the Zambian people will suffer more. If you look at the proposal that has been taken to ERB by Zesco, to increase electricity tariffs by 37 percent, the ordinary Zambians will be affected and we expect to have more misery as we move forward,” said Mwila

It is a risk to consider bringing back Vedanta- Sean Tembo

It is going to be risky for government to consider bringing back Vedanta to run Konkola Copper Mines (KCM) because rumours are swelling that the firm may be having financial challenges, Patriots for Economic Progress (PeP) president Sean Tembo has said.

Mr Tembo said that it was going to be suicide if government allowed Vedanta to return because the firm was facing a number of challenges and looking at the way it conducted itself the same would happen.

My plea is that government should not entertain the return of Vedanta because history is there for us to see, contractors were not paid plus other problems that were faced during its run at KCM,” he said.

Meanwhile, Anil Agarwal’s once-London-listed Vedanta Resources Limited has a pile of debt, including a $1 billion bond due January.

However, Vedanta Resources did manage to shed its net-debt burden from almost $10 billion in March last year to a little under $8 billion. With the listed unit declaring a dividend last month, its parent and majority shareholder is “highly likely” to meet its obligations until September 2023, according to S&P Global Inc. So far so good. But it was when Agarwal tried to secure the finances for $1.5 billion in loan and bond repayments between September this year and January 2024 that he hit a roadblock

What was supposed to be a quick dash to the ATM has become an uncertain enough adventure for Vedanta Resources bondholders to drive the price of the August 2024 note below 70 cents on the dollar. The next few weeks will be crucial for fundraising. If it fails, the issuer’s B- credit rating, already deep in the junk-bond category, could come under pressure, S&P said this month. Adani’s net debt pile of $24 billion may be three times as large as Agarwal’s, but his bonds are still rated at the lowest rung of investment grade.

What happened to get everyone worried was this: Hindustan Zinc Ltd., which Agarwal had started buying from the Indian government two decades ago in a privatization deal, has a cash pile, albeit much smaller than before, of $2 billion. Plus, the miner garners between $300 million and $600 million Ebitda (1) every quarter. So Vedanta Ltd., which now owns 65% of the firm, decided in January to offload THL Zinc Ltd. Mauritius to Hindustan Zinc. That cash deal, representing mining interests in South Africa and Namibia, was valued at roughly $3 billion in phases over 18 months. Since Vedanta Ltd. is 70% owned by Vedanta Resources, it would have taken care of the latter’s liquidity needs.

Except there was one problem. New Delhi, which still owns about 30% of Hindustan Zinc, balked at the transaction.

We would urge the company to explore other cashless methods for acquisition of these assets,” the Indian government said in a Feb. 17 letter, threatening to explore legal avenues if Hindustan Zinc still decided to go ahead with the purchase.

This presents two problems for the mining magnate. First, unless China’s economic revival turns things around, the post-pandemic era of supernormal commodity profits could be over. If Agarwal can’t take Hindustan Zinc’s cash all the way up to his privately held Vedanta Resources, his ability to pay down debt may be impaired, forcing him to borrow more. But with the Fed giving no indication that it’s done raising rates and existing Vedanta Resources bonds dropping in value, he might struggle to raise fresh money at a reasonable cost.

ACC Investigates Allegedly Corrupt Purchase of Gulfstream G650 Presidential Jet

A government official who was appointed into Foreign Service by the previous regime has been implicated in the alleged corrupt purchase of the controversial Gulfstream G650 Presidential Jet. The Anti-Corruption Commission (ACC) has called for the named male suspect to return to Zambia to appear in court in connection with corruption allegations.

Last December, the Commissioner arrested former Ministry of Defence Permanent Secretary Stardy Mwale for corrupt practices involving over US$573.9 million in connection to the procurement of the Gulfstream G650 Presidential Jet. Mwale, 51, of Flat 21 Eureka Park in Makeni, was charged with three counts of Wilful Failure to Comply with Applicable Law and Procedure contrary to Section 34 (2) (b) and one count of Fraudulent Facilitation of Payment from the Public Revenue.

ACC Director General, Tom Shamakamba, gave an update on the matter and said, “There is one officer who was serving in the previous government, who is out of the country, we are just waiting for him to arrive, that one I can confirm because I have been pushing that he comes back. He was appointed in one of the countries in the embassy, actually they have facilitated, by this month end, he should be in the country.”

Once the suspect is back in Zambia, he will join others scheduled to appear in court. “We are just waiting for that person to come,” Mr. Shamakamba told a media briefing yesterday.

The ACC Director General also updated the media on the investigations into Faith Musonda, a journalist who was found in 2021 with over K65.3 million and US$57,000 in proceeds of crime which were later forfeited to the state. The ACC suspects she has more properties suspected to be proceeds of crime, and investigations are still active.

“When that property from New Kasama and the money were taken from her together with the cash, she did not disclose that there were other properties she owned, so if you do not open up in full, the immunity does not warrant to be given to you,” Mr. Shamakamba said.

Mr. Shamakamba also stated that many residents in the Makeni Balmoral area were served with restriction orders due to the public who went to report on the suspicious house built in that area, saying they could be from proceeds of crime. He reiterated that not all served are politicians. Among the ones served with the order are Amb. Mwamba and Hon. Harry Kalaba.

The ACC is committed to rooting out corruption in all its forms and is working tirelessly to bring all perpetrators to justice. The public is urged to cooperate with the ACC by reporting any suspicious activities related to corruption. As Mr. Shamakamba stated, “Our commitment is to ensure that all those who have been suspected or caught in corrupt activities face the law, regardless of their status or position.”

First Quantum To Develop 770 MW Of Wind And Solar Power

Pleased to have received a comprehensive presentation from a consortium of investors in the energy sector, at State House this afternoon.

The investors comprising Mphepo Power, Total Eren, Chariot and First Quantum discussed their intended projects to develop 770 MW of wind and solar that would greatly contribute to Zambia’s grid resilience.

Our government is determined to unlock the energy sector by weighing in on any initiative by Independent Power Producers to compliment existing efforts to increase our current base load. Load shedding should never be an annual event.

While government appreciates the current problems in the power sector, we however view these challenges as opportunities to finding a lasting solution to the energy sector.

We implored the consortium to cast their net wide by also venturing in the hydropower, as that would add to the power capacity and grid stability in the country.

THE Lusaka Magistrates Court has warned PF presidential aspiring candidate Geoffrey Bwalya Mwamba to avail himself before the Economic and Financial Crimes Court (EFCC) at the next sitting, failure to which his police bond will be revoked and kept in custody.
The warning comes after the prosecution informed Magistrate Stanford Ngobola sitting at the EFCC, the division of the High Court that GBM was not before court, although his lawyers were present.


This prompted Magistrate Ngobola to find out why the former Defence Minister was not before the court.
In response, State Counsel Bonaventure Mutale informed Court that GBM was hit by high blood pressure and was being attended to by doctors from Midlands Medical Hospital.


“Your honour the accused person (GBM) is not in court, he is indisposed, he is a long-term patient of high blood pressure, and from the record it is equally evident that there have been times during the course of trial when the accused person was hospitalised with the same medical problem.


Your honour, the accused person is currently bedridden and seeing the doctor at midlands hospital for reviews, the doctor had advised him to be on bed rest. In these circumstances, we are humbly applying for an adjournment, a short adjournment for at least seven days to enable the accused recover and appear before this court.


We would like to assure this court that the accused person is equally anxious for the speed conclusion of the trial, it is the furthest in his mind to delay the speed trial of the matter,” State Counsel Mutale submitted.
He applied that the matter be adjourned for seven days in order to allow GBM recover.


“I have a letter confirming his medical situation from hospital. Your honour, the defence has noted through out the trial of this matter that the accused has not done anything to slow the expeditious process of trial, save for this ailment of the accused person. You will recall your honour that the accused person was fit enough to endure the trial of the matter in which over 20 witnesses were called without a break, it is with that background that we humbly request to indulge the accused person for seven days,” he submitted.


The prosecution expressed disappointment at the development, saying they were ready to proceed with the matter today as it was adjourned yesterday to today.


“To start with, we would like to register our disappointment, that this matter was supposed to proceed for defence today especially that yesterday the accused requested to have the exhibits, we were hopeful that this matter will proceed. We have been shown a sick note and that the accused person is unwell, we shall rely on the document shown to us. In an event that this court grants an application it is our sincere hope that the defence will at the next sitting have adequately prepared to start and conclude the matter,” she said.
And making a ruling on the application, Magistrate Ngobola warned GBM to avail himself on the next sitting as the matter had taken time to conclude.


He adjourned the case to 16th March 2023.
GBM was today expected to open his defence in the matter he is
accused of money laundering, having property suspected to be proceeds of crimes and failure to declare interest.

Somalis settlers in Zambia dropped their first bombshell in 1986 by establishing an unlawful settlement of well over 50 families next to Bwana Mkubwa Railway Station, about 10 km from Ndola -the friendly City on the Ndola-lusaka highway.

Without authorization, either from Ndola City Council or the Ministry of Lands. The Somalis -fuel tank drivers and their families -put up a compound of mud houses and pit latrines, water wells and common basic facilities.


Some patriotic Zambian journalists felt compelled journalistically, in national interest, to write prodding pieces concerning unlawful establishment of the Zambian version of Ogaden settlement in Ndola. Those pieces were written as a wake up call, specifically for the Zambian government, to take a decisive action against the Somalis squatters.

Following, those revelation published in various media outlets, the UNIP government under Kenneth Kaunda acted promptly in demolishing the settlement.


The Somalis squatters fled, therefrom,only to emerge in isolated hiding places notably, Twapia, Ndeke and outlying settlements.The government did not realize that the nefarious Somalis had come to Ndola to stay put.
The number of Somalis families residing in Ndola especially Ndeke Township, has glaringly increased from 50 to a level of countless estimation .Like a swam of bees they keep trooping every day.

For the rising Zambian generation, those who live in Ndola particularly, they stand inclined to know how and why the Somalis aliens found the possibility of coming to settle in Ndola from their country Somalia.


They came here Situationally, circumstantially, changefuly with no point of returning back home. They came seeking fortune.

In 1966, post-independence Zambia as a nation, encountered economic blockade involving railway transportation through Zimbabwe imposed by minority rule led by Ian Smith. This ensued in the aftermath of proclaiming independence against international condemnation.
To mitigate the effects of the blockade, the Kaunda’s government clinched an expeditious deal with his Tanzanian counterpart the late Julius Nyerere, to set up a countering road transport system -the Zambia -Tanzania Road Transport Service -then referred to as “Hell-Run. It enabled Zambia to import fuel through Tanzania.


But as bad luck would have it, the management faced the problem of recruiting fuel -tank drivers neither in Zambia nor Tanzania.

Somalia emerged to provide the possibility, a country which abounded in having drivers competent to meet the challenges of whatever terrain condition. Somalis drivers were recruited in numbers one group transporting fuel into Lusaka and another from Tanzania to Ndola on the Copperbelt.


In Ndola the Somalis drivers after a spell of honey-combing around, settled themselves on self demarcated piece of land at Bwana Mkubwa on the outskirts of the city of Ndola in defiance of immigration laws.

Initially, they came as single men. Hardly encountered wrath from the government they started abetting their families, wives and children, coming to join them at their new found settlement..


Since then, the Somalis applied their money power making Ndeke Township, so hard to believe, fast emerging as a city in Ndola -or a two -in -city.


Somalis are swiling in economic affluence hard to believe ! When in Ndeke Township ,you would think you are just a stone throw away to Ogaden settlement in Somalia.


Frankly speaking,far beyond argument,the somalis have presented themselves to extremes , wading through hard times . Physically and mentally, they present themselves as a people so defiant and tough -mindedly imbued with of a sense of fatalism fused with survival instinct -according to American Journalist author, David Lamb , famously renowned for his book sell-out ” The Africans and Arabs “.


For over a thousand years,in typical mindset as a good example, Somalis have been pitched in civil war hardly ending .Blood-shedding ,among themselves,until today! Yet ,Somalia is a single -tribe country.

Scientists say every person born on earth has a xenophobic element to them , genetically.The human xenophobic mindset is not alterable , much the same way as the behavioural aberration can be righted ,humanly.


Xenophobia,defined in simple words is the harbouring of hatred against strangers or foreigners .A question posed is it xenophobic to put some spanners to some of these people entering Zambia at any time they feel like?

HUNDREDS OF SOUTH AND LUSAKA BOUND PASSENGERS STRANDED AS BUS DRIVERS DOWN TOOLS

BUSINESS came to a standstill in some parts of Southern Province after angry Bus drivers and other sympathizers protested against unregistered transporters.

The Bus drivers are demanding an explanation from the Zambia Police on why Traffic Officers constantly impound their buses for various purported traffic offences while leaving out the Toyota Wish Vehicles which are not even registered to operate.

A check in Choma, Monze, Mazabuka and stations for South bound passengers found buses abandoned and hundreds of passengers stranded.

Monze Bus Station Chairperson, Albert Hamatowe, accused Police of being bribed by those driving Toyota Wish Vehicles in order for them not be penalized even after overloading and breaking other laws.

Hamatowe alleged that most unregistered Vehicles that operate as Public Service Transport belong to some Police Officers and Senior Government Officials.

Addressing the protestors, Monze Police Officer Commanding assured that the law will be implemented on the matter.

In another address to the protestors, Monze Council Chairperson, Powell Mutenguna, accompanied by District Commissioner, Mwanza Malambo, urged Private Vehicle Operators to register their operations and follow laid down procedures.

In related news, Byta FM Zambia Mazabuka based Journalist Evans Liyali reports that Public Services Bus Drivers in the Sweet town Thursday morning downed tools in protest against private vehicles pirating as Taxis on Mazabuka – Lusaka route.

The drivers vowed not to go back to operations until government finds a solution to end piracy.

Mazabuka District Bus Drivers Chairperson Sylvester Ng’andu, complained that they have lost business due to mushrooming illegal Taxis pirating on the route.

He fumed that Public Service Buses are paying taxes and other obligations to government, while those operating illegally are not doing so.

N’gandu accused the Road Transport and Safety Agency RTSA and Zambia Police Traffic Officers of being corrupt and getting bribes from illegal public vehicle operators.

Ruto and Odinga rail against LGBT court ruling

Kenya’s President William Ruto and opposition leader Raila Odinga have united in their criticism of last week’s Supreme Court ruling which allows the LGBT community to register lobby groups in Kenya.

President Ruto has sworn that he will never allow gay marriage in Kenya, which he said “goes against the country’s cultures and religious beliefs”.

It’s the latest and highest-profile attack on the judgement, which many have wrongly suggested gives the LGBT community freedom to get married in Kenya.

Last Friday, the Supreme Court ruled that the decision of Kenya’s NGO board to decline the registration of the National Gays and Lesbians Human Rights Commission – or any other group with the words gay and lesbian in it, was unconstitutional.

The court said that denying the group registration purely on the basis of their sexuality was a violation of their constitutional rights to association and freedom from discrimination.

However since then, there has been outrage from the public, parliament, the religious community, powerful state officers including the speaker of the national assembly, and now the president himself.

On Wednesday parliament discussed the judgement at length, and many members who spoke wondered why the court had made the judgement to grant freedom of association to what they described as an illegality.

Kenya’s constitution only provides for marriage between members of the opposite sex, while the penal code punishes sex “against the order of nature” with up to 14 years imprisonment.

These are the provisions upon which Kenya’s legislators have faulted the judgement.

On Thursday, Deputy President Rigathi Gachagua said registering a group which fights for the rights of gay people to get married was an attempt to legitimise LGBT actions in Kenya, which was against the country’s way of life.

President Ruto – to cheers from the crowd – suggested there was a campaign by foreigners to introduce “alien practices” in the country, which he swore not to allow in Kenya.

And opposition leader Mr Odinga has also been quoted as saying that it was not the role of the judiciary to make laws.

In recent weeks, there has been escalating anti-gay sentiment in Kenya and the region, with hundreds of hostile social media posts drowning out any attempts to balance the discussion.

On the day of the judgement, Kenyan legislator Peter Kaluma filed an official notice seeking to amend the law to give life imprisonment to people convicted of homosexuality or the promotion of it.

Will.i.am Reflects on Growing Up in Public Housing and Launching His i.am Angel Foundation

will.i.am has come a long way since he was a boy growing up in Boyle Heights in East Los Angeles. The rapper, songwriter and mega music producer sat down with ET for an intimate reflection on his journey to stardom that touches on his numerous projects along the way, including the growth of his beloved i.am Angel Foundation.

When asked why a seven-time GRAMMY winner keeps returning to Estrada Courts, the housing project he grew up in, will.i.am shares that his regular visits “keep me grounded.”

“This is where I was born and raised. I grew up here in these projects,” the star says, reminiscing on how much his community has changed since he was a child. “When I grew up here, this recreation center wasn’t here. We called it the circle; it was a park so it’s where I played football, baseball, basketball. [I] first wanted to make music here… It keeps me grounded.”

Estrada Courts is also where the singer’s i.am Angel program began, with only 65 kids. The foundation now caters to more than 12,000 students.

“Philanthropy has been in my family. Even when we were poor, we just pour our hearts out,” will.i.am tells ET.

Launched in 2009, the foundation aims to transform lives “through education, inspiration and opportunity” by administering charitable activities and programs targeted toward providing college scholarships, college preparation, and opportunities in STEAM education.

The producer explains how the foundation has developed a computer lab in Boyle Heights, where kids are taught engineering, programming and computer science. “I think it’s important because the world is getting more and more autonomous,” he shares. “Computer science skill sets are sought after more than they’ve ever been [and] machines are creating and thinking in ways that we never thought was possible. So, there’s a lot of jobs that are going to be displayed in this decade.”

He adds, “How do you get our kids prepared for this world that they’re going to enter? When they’re adults, they should already have the skill set. So this robotics team here is a step to show that it should be mandatory in every school. Until then, we have it in after-school programs.”

But the foundation does more than create programs for students, it’s a community-wide provider as well. Last month, i.am Angel Foundation partnered with WeLink to close the digital divide in Boyle Heights. Through a multi-sector partnership involving the Los Angeles Mayor’s Office, the Los Angeles Unified School District (LAUSD), the Housing Authority of the City of Los Angeles (HACLA), WeLink, and the i.am/Angel Foundation, residents living in the 414 apartments at Estrada Courts now have improved access to zero-cost, ultra-high-speed internet.

According to BusinessWire, as part of this pilot initiative, WeLink also installed no-cost internet service at the Boys & Girls Clubhouse within Estrada Courts. Microsoft’s Airband Initiative will also provide digital literacy and skills training offerings along with access to affordable computing devices to help residents make the most of their new internet service.

“During the pandemic, we realized that when [students are] working from home or learning from home, they don’t have high-speed connectivity. And if your parents were working two to three jobs… they have to decide ‘[Am I] going to get connectivity or feed you?’” the entrepreneur recalls. “So, we wanted to bridge that divide. With the partnership of WeLink, we provided no-cost, high-speed connectivity here and yeah, I’m really really proud of that.”

will.i.am likens the need for connectively to clean drinking water, noting that the latter is “the means to a career, it’s the means to education.”

“If you’re barely making it, having to figure out how you get food and connectivity so your kids can educate themselves or so you can work remotely — that’s survival now,” he adds. “When you think of the internet, it’s not just gaming, it’s not just social media — it’s work. And if folks don’t have that, guess what? They’re not working [and] they’re not learning.”

It’s a familiar dilemma for will.i.am, who grew up in the low-income housing association until the age of 25. He went on to become the founding member of one of the biggest musical trios, the Black Eyed Peas.

He credits his ride to school in the Palisades as the key to his big dreaming, sharing that the school ride “showed me like, hey, there’s a big world out there… My currency is creativity [and] it’s what got me out of the projects. It’s what fuels my dreaming.”

Those dreams led to an estimated 80 million records sold with the Black Eyed Peas, making them one of the best-selling groups of all time. “When you have success with music, the world calls you for all types of things. They call you when there’s a natural disaster to raise awareness…” he recalls. “They call you to help get somebody elected, they call you to help sell a product. But what I realized is that there’s a tsunami every day in communities like Boyle Heights. There’s an earthquake every single day, there’s a flood every day, there’s a tornado every day, and that tornado is neglect.”

Vanessa Bryant Reaches $28.85 Million Lawsuit with Los Angeles County Over Helicopter Crash Photos

Vanessa Bryant has settled her lawsuit against Los Angeles County.

Vanessa, 40, reached a $28.85 million agreement with the county to settle the suit over the photos that were taken at site of the helicopter crash that killed her husband Kobe Bryant, their daughter Gianna, and seven others back in 2020.“Today marks the successful culmination of Mrs. Bryant’s courageous battle to hold accountable those who engaged in this grotesque conduct,” Luis Li, an attorney representing Vanessa, shared in a statement with CNN. “She fought for her husband, her daughter, and all those in the community whose deceased family were treated with similar disrespect. We hope her victory at trial and this settlement will put an end to this practice.”

In case you aren’t aware, Vanessa sued L.A. County for damages after emergency personnel allegedly shared graphic crash scene images with unauthorized people.

The L.A. County Board of Supervisors agreed to pay the Bryant family the nearly $29 million to settle the lawsuit and potential future claims made by Vanessa and and her daughters.

“We believe the settlement approved by the Board in the Bryant case is fair and reasonable. The $28,850,000 settlement includes the verdict awarded by the federal jury in August 2022, and further resolves all outstanding issues related to pending legal claims in state court, future claims by the Bryant children, and other costs, with each party responsible for its respective attorneys’ fees,” Mira Hashmall, lead trial counsel for L.A. County in the case, shared in a statement via Entertainment Tonight.

She continued, “This settlement now concludes all County-related litigation related to the tragic January 2020 helicopter crash. We hope Ms. Bryant and her children continue to heal from their loss.”

The settlement comes after a federal jury in August 2022 found the L.A. County Sheriff’s and Fire departments liable for infringing on the constitutional rights of Vanessa and her co-plantiff Christopher Chester, whose wife Sarah and 13-year-old daughter Payton also died in the crash, for taking and sharing the gruesome photos.

At the time, the jury awarded Christopher with $15 million and Vanessa with $16 million, which was later reduced to $15 million due to a clerical error.

OPEN LETTER TO MR HAKAINDE HICHILEMA PRESIDENT OF THE REPUBLIC OF ZAMBIA AT PLOT ONE, LUSAKA, ZAMBIA

Dear Mr. Hichilema,

This open letter aims to remind you that the currency of a country is not strengthened by what you termed as confidence in the president of a country.

The background is that in 2016, on a date I cannot remember, you featured on the Lusaka based Joy FM radio as leader of the United Party for National Development (UPND). Among the things you said on the live programme hosted by Kunda Kunda was that the Zambian Kwacha was going to appreciate upon your election as Zambia’s republic president.

You claimed that your election would inspire confidence in the economy of Zambia and make the Kwacha become strong.

I managed to call in on the programme and made a contribution. I argued that what you said was not a sustainable way to improve the value of our Kwacha. I anchored my contribution on the common knowledge that what contributes to the strengthening of a local currency includes reducing dependence on imported goods while increasing exports. Value addition on exports also plays a major role. Therefore, I insisted that what you were saying was not realistic because lack of confidence in the president at the time was not the cause of the depreciation of our currency but other factors, some of them historical.

In your response, you essentially maintained that confidence in your leadership was going to give the Kwacha a bullish character. You disparaged my contribution in the manner that painted me as lacking the capacity to understand what you were talking about. You effectively branded my contribution as ignorant.

Now that the Kwacha has depreciated further with you as president, I will not make the mistake of attributing it to lack of confidence in your leadership. I maintain the same reasons I gave during that radio programme. However, I wish to humbly advise that you shallow your pride and make it clear that you misguided yourself. Failure to do so will make many people think that you knew very well that your election will have no positive impact on the value of the Kwacha. As such, people will be convinced that it was another campaign lie.

Regarding the contemptuous manner in which you responded to me on that radio programme despite my valid points, it is my prayer and I am sure that it is also the prayer of many Zambians, that you have realized that you inflated the value of your leadership. However, it is clear that you are yet to learn to humble yourself before the collective intelligence of Zambians. This can easily be seen in the manner you have been making public statements, the latest being your address of Parliament recently. If you refuse to change, our people will teach you the hard way by rejecting you with even more numbers than you won the 2021 presidential election.

Economic Front (EF) leader Wynter Kabimba has urged President Hakainde Hichilema to assume more responsibility for his failures, warning that with things worsening in the manner they are, Zambians are likely to pour out their anger onto the streets.

Speaking with Daily Revelation, Kabimba laid out the facts in stating that the person who said he would fix matters was being fixed himself, with most fundamentals worsening since he assumed office, arguing that President Hichilema found the price of petrol and diesel around K17 and K16 respectively but has now increased them to over K28 and K29 respectively.

He said the Ukraine war cannot be used as an excuse because the President’s first action on assuming office was to increase fuel prices, three months before the war actually started, and that on assuming office, the Kwacha was trading at around K17 to US$1 but that was now K20 to US$1. Kabimba said the price of a 25 kilogram bag of breakfast meal was at K130 but President Hichilema has now increased it to over K170, and that the fertilizer which was around K700 is now over K1000.

He said it therefore sounds ridiculous for those in the ruling party to urge Zambians to endure the pain for now on claims that the UPND administration did not create the economic malaise the country is facing, saying the President and his people in the administration were drunk with false pride that was preventing them from apologising to Zambians that they have failed to run the affairs of the country competently.

He said President Hichilema before being elected into office said that the country was on its knees but that he went to the public to tell them that he knew where the problem was and that he would fix it, hence the acronym “Bally will fix it.”

“The truth of the matter, even from an ordinary person on the street is that HH has failed, HH lied and lied intentionally so that he can continue his business using State House,” Kabimba said. “So he understands nothing because he has not even paid attention to learn…

UPND National Trustee Grace Chivube says it is unacceptable for people to use the name of the first lady and family for their own selfish motives as she expressed disappointment that people were committing crimes using the name of the First Lady, someone she described as innocent.

Speaking this morning when she addressed the media at Anderson Kambela Mazoka House in Lusaka, Ms. Chivube said the First Lady is not a politician and should therefore not be drawn into criminality by selfish individuals adding that the party through its rule of law principle will not shield any such criminal elements.

“We are lucky to have a first lady in Mutinta Hichilema. That lady is humble, she is like a sheep and does not deserve to be dragged in scandalous activities.

The First family is a state property which should be respected as is the practice throughout the world hence the need for people to desist from using the name of the first lady to swindle people.

And the outspoken NMC Member assured Party and Republican President Hakainde Hichilema of the party’s unwavering support as he rids the country of criminal elements and vices which have not only eroded the country’s moral fiber but also harmed the socio-economic fundamentals of the country.

She cited the recent arrest and dismissal of Luapula Provincial Deputy Permanent Secretary Roy Mwansa and 5 other District Commissioners from Luapula and Western provinces as well as the arrest of Lumezi District Commissioner Jimmy Phiri over the disappearance of 278 bags of white FRA maize meant for community sales as a clear demonstration that there are no sacred cows in the party and government.

Ms. Chivube’s warning comes in the wake of a video circulating on social media in which some suspected UPND members are seen scandalizing the First Lady whom they accuse of having grabbed a mine from them in Mkushi.

The Drug Enforcement Commission (DEC) through its Anti-Money Laundering Investigations Unit (AMLIU) in 2022, actively investigated a total of one thousand and ninety three (1,093) cases countrywide.

The Commission says out of these cases, sixty six (66) were closed by arrests, forty nine (49) closed by other headings and seventeen (17) cases were referred to other Law Enforcement Agencies for further investigations.

DEC Public Relations Officer Hussein Khan says concerning seizures, the Unit last year seized various properties reasonably suspected to be proceeds of crime.

Mr. Khan says the properties seized include those seized in cases highlighted above and other cases which were investigated in the period under review.

“These included; 108 motor vehicles, 72 real properties, 41 bank accounts held at various commercial banks with a total bank balance of K174,035,940.13 and US$19,777,181.33. Various mobile money accounts with a total balance of K10,045,240.87, cash amounting to K4,109,242.47,” he disclosed.

“Three (3) Toyota Landcruisers and some earth-moving equipment namely EP263 Rubber Pneumatic Tyre Roller, Ingersoll Drum Compactor and a JCB Excavator, were seized and forfeiture proceedings have commenced. The Unit has since submitted the dockets to the National Prosecution Authority (NPA) in cases where investigations have been concluded for the Authority to commence Non Conviction Based Forfeiture Proceedings of the said properties.”

Mr. Khan further reviewed that a total of 66 cases were closed by arrest in which 113 people were arrested for various predicate offences and money laundering.

“Some of the dockets have been processed and the suspects are appearing before the Courts of Law while others are still being considered for possible prosecution by the NPA. The total amounts involved in cases where arrests have been made are ZMW 347,955,017.45. The Unit also investigated and concluded a total of forty-nine (49) cases under various headings after investigations revealed that there was no money laundering offence committed,” he stated.

“Further, seventeen (17) cases were referred to other Law Enforcement Agencies for further investigations. As at 31st December, 2022 the Unit had a total of nine hundred and sixty one (961) active cases. Court Results…. Nineteen (19) cases were concluded at the Courts of which convictions were secured in Sixteen (16) cases, one (01) was discontinued and acquittals were recorded in Two (02) cases.”

The DEC Spokesperson further said a total of K1,364,860.00 and USD 148,743.00 was forfeited to the State in five (5) cases concluded by the Courts of Law.

A Ministry of Finance Accountant was implicated in the theft of K24,640 – funds meant for poverty reduction program – in Copperbelt. At the same, Drug Enforcement Commission (DEC) instituted investigations into the theft, which meant that the Accountant could not appear before the Disciplinary Committee when there were criminal investigations against him. That is the procedure in government.

However, the Accountant was then fired in 2009 even though DEC later cleared him and turned him into state witness against the culprits. Despite that, government refused to reinstate him.

He appealed to the Public Service Commission (PSC), which only decided to hear his case almost 8 years later instead of the mandatory 30 days. PSC confirmed his dismissal in 2016.

Unhappy with way he was treated, he filed the case in the High Court against Attorney-General, arguing that he was wrongfully dismissed. The government did not appear in court and trial took off after several adjournments.

The High Court Judge awarded him 36 months salaries as compensation for wrongful dismissal. He was not happy with the 36 months because it was too low and could not compensate or mitigate his suffering.

He lodged an appeal in the Court of Appeal.
The three-man panel of Judges analyzed the evidence and concluded that the damages given were indeed very low given the circumstances.

“We enhance the award of 36 months salaries and perquisites to 42 months salaries and perquisites as damages for wrongful dismissal, taking into account the oppressive treatment the appellant was subjected to,” the Judges said in unanimous opinion.

“We also order that he be reimbursed the withheld salaries and the surcharged amount if all it was effected with interest,” the Court, adding that it was difficult in Zambia to find jobs due to high unemployment rate.

The panel said it believed the dismissal caused him mental distress especially when DEC cleared him but government still refused to reinstate him in the position.

“Moreover, it would be very difficult for him to find similar job in this economy where there is much unemployment even for university graduates,” the Court held.

■ A visit to Shimabala Toll Plaza -Raises K9m per month

The Shimabala toll station was commissioned in 2017 as a class A toll station and was
one of the busiest in the country. It was managed by a station manager supported by adequate staffing levels and security personnel from the Zambia Police Service.

The toll

station processed about 9000 vehicles per day and collected revenues of approximately
ZMK 9 Million per month. Collections were done on cash basis or e-tolls only as they
were no other alternative payment methods.

The station was connected to the ZESCO grid and also had back-up from solar energy
and diesel powered generator. In terms of traffic, the station experienced traffic
congestion especially during traffic peak hours due to narrow receiving lanes.

This was compounded by the few payment booths, which required urgent expansion.

■ 10.2 Visit to Chongwe Toll Station-Raises K3.6m per month

The Chongwe toll station was commissioned in 2017 and was categorized in class A. it
had a staff compliment of twenty-seven and nine Zambia Police personnel. It processed
an average of about 4,500 vehicles per day with monthly collections of approximately
ZMK 3.6 Million.

The mode of collection was through cash or e-toll system although the e-toll was fairly new and was still being rolled out.

The station had similar energy sources as those of Shimabala toll station.

■ 10.3 Visit to Katuba Toll Plaza-Raises K10.5m per month

The Katuba toll station was commissioned in 2017 and was categorized as a class A toll
station. The toll station was situated on one of the busiest highways (between Lusaka
and Kabwe) and it processed an average of about 6,300 vehicles per day with monthly
collections of approximately ZMK 10.5 Million.

Despite the amount of revenues collected as toll fees, the road infrastructure leading to the toll station had continued to deteriorate as it had never been maintained since installation and commissioning.

The station was well manned and secured as it had sufficient staffing levels.

■ 10.4 Visit to Manyumbi Toll Plaza- Raises K9.6m per month

The Committee learnt that Manyumbi toll plaza was one of the first to be opened in
2016 and handled about 4500 vehicles per day with monthly collections of about ZMK
9.6 Million.

The road to the toll station was in a deplorable state as it had never received any maintenance since the plaza was erected.

The station had a unique feature in that it operated on solar energy generating a total of 45 kilowatt. The main power supply from ZESCO was used as secondary source, while
power from a generator was the last option.

The Committee learnt that the toll station
had the capacity to supply 15 kilowatt into the main grid or use it to power surrounding
communities.

The Committee also learnt that there were differences in terms of the ICT infrastructure
used to support payment and receipt of toll fees at the different toll stations across thecountry because they were installed by different system operators that had been
contracted to develop the systems as part of the construction contracts for different toll
stations.

To this end, NRFA had identified that the system installed by NECOR, a Zambian owned company had proved to be the best and most efficient to deal with the processing of payments and receipts, including keeping tabs on frequent user payments/discounts.

The other systems were not as reliable as NECOR as they had no capacity to track frequent users of toll facilities and also required constant maintenance.

■ 10.5 Visit to Kafulafuta Toll Plaza-Raises K9.9million a month

Like Manyumbi toll station, Kafulafuta toll station was opened in 2016 on the Kapiri-
Ndola road. The toll station, which was in category ‘A’ generated about ZMK9.9 Million
per month in toll fees.

The Committee noted that the state of the road between Kapirimposhi and Ndola was in a deplorable state and had reached impassable proportions around the toll station. This had resulted in slowing down of traffic and impacted the turn-around time of processing payments for trucks and buses, which were the majority type of vehicles passing through the plaza.

■ 10.6 Visit to Michael Chilufya Sata (MCS) Toll Plaza-Raises K12million

The MCS plaza was opened in 2018 and is located on the Ndola-Kitwe dual carriage
way. The station is the largest and is classified in category ‘A’.

About 9,900 motor vehicles passed through the toll gate on a daily basis with 30 to 34 per cent of them being heavy goods vehicles destined for the mines and the Democratic Republic of Congo (DRC).

The station generated revenues of about ZMK 12 Million per month.

The Committee questioned why the roads had remained in a poor state despite the NRFA collecting colossal amounts in toll fees per month.

The Committee learnt that the country was heavily indebted in the road construction sector, to the tune of about ZMK 10 Billion. Contractors had worked and presented performance certificates, but funds were thinly spread across to reduce the debt burden.

The Government could not embark on new road construction or maintenance works, unless the outstanding debt was dismantled.

■ 10.7 Visit to Wilson Mofya Chakulya (WMC) Toll Station- Raises K7million

Opened in 2019 WMC toll station was classified in category A and was able to handle a daily traffic volume of about 10,000 per day, with approximate monthly collections of about ZMK 7 Million. Like other toll stations, it experienced the challenge of lack of alternative paying systems like mobile money and point-of-sale machines, which
greatly inconvenienced the travelling public.

The station was installed with a system
that was difficult to operate as it misclassified certain categories of vehicles and couldnot recognise categories of vehicles that were due for incentives such as frequent user
discounts.

■ 10.8 Visit to Sabina Toll Station, Raises K6.6million per month

Opened in 2021 and categorized in class ‘B’, the Sabina toll station was situated on the
Kitwe-Sabina Road. The toll station was yet to be fully completed as it did not have a
parameter wall and paved car park.

The station also required slight expansion of the receiving lanes as it experienced congestion during peak periods.

The Committee learnt that due to the narrow receiving lanes there had been an accident involving a truck, which left a booth completely damaged and a toll collector injured.

Most of the traffic on the Sabina road consisted of heavy goods vehicles, which were deviated from Kitwe’s Independence road leading to the WMC toll station.

The traffic volume therefore, at the Sabina toll gate was about 2300 per day with a revenue return of ZMK 6.6 Million per month.

The committee also learnt that Chibuluma road in Kitwe which fed traffic from the
mines to Sabina toll station was in a deplorable state and this indirectly heightened theft of cargo from the trucks as they had to move very slowly to navigate the huge
craters and pot holes on the road.

■ 10.9 Visit to Mpongwe Toll Station

The Mpongwe toll station was categorized in class ‘C’ and was situated on the
Luanshya-Mpongwe road in Copperbelt rural. Being in class C meant that traffic volumes were extremely low and revenues collected per month did not exceed ZMK 330,000.

Further, the station used a small building as office space and did not have booths from where tolls could be paid.

This meant that clients had to step out of the
vehicles to pay toll fees irrespective of the whether condition. The Committee noted
that the station was not secured with a parameter fence and was surrounded by bushes, thereby posing a security risk.

The Mpongwe road had generally not been maintained and thus pot holes had developed in most portions of the road including near the toll station.

As part of its local tour programme, the committee held five stakeholder meetings and visited two ports of entry, namely; Mufulira/Mokambo and Chililabombwe/Kasumbalesa Border controls.

LUSAKA – The UPND says it is concerned with the high levels of misinformation in relation to the recently signed concession agreement on the construction of the Lusaka – Ndola dual carriageway between Government and Macro Ocean Investment Limited and the revenue realized from the toll fees.


Political consultant in the office of the Secretary General Mark Simuuwe has dispelled insinuations that the contractor will collect all revenue realized from the toll-gates for 22 years.


Mr. Simuuwe explained that the realized revenue shall during the 22-year concession period be shared between the government of the republic of Zambia and the engaged contractor as he advised the opposition and its surrogates to avoid pushing a wrong narrative as it has the potential to harm the economy.


“All of us must agree that government has had no capacity to do a road of such magnitude amid a serious debt which the previous government struggled to negotiate.


The PF should not pretend that they had capacity to construct the dual carriageway because economic realities also came into reality to put up that road”, Simuuwe said.


He further intimated that the PF intended to borrow US$2 billion to work on the same road but changed their mind after being criticized that the money was too much and later renegotiated downwards US$1.250 billion.


He said the New Dawn Administration believes in prudence in its fiscal management hence renegotiating the contract sum further down to US$577 million in line with its campaign promises in view of the country’s debt position and economic fragility.


Mr. Simuuwe said the New Dawn Administration understands the economic importance of the road which serves as the main link between the main Copper producing regions of the Copperbelt and North western provinces and the sea hence its resolve to work on it in the midst of competing socio-economic needs.


He revealed that it would be folly for the UPND and its government to allow a contractor get all the revenue realized from the toll fees for 22 years at the expense of national development as he assured citizens to retain the faith in the government as it works at stabilizing the economy.


Mr. Simuuwe said the country will be availed with details on how proceeds from the toll fees will be shared once the 36-month project is completed with anticipated increased traffic flow and reduced road fatalities.

POLICE STATEMENT ON JUDGE WILFRED KOPA MUMA

March 2, 2023 – Police in Mongu recieved a report of a missing person who was identified as Judge Wilfred Kopa Muma aged 58 of Liseli area in Mongu District of Western Province.

Judge Muma is reported to have left his house on March 1, 2023 around 23:00 hours and only communicated with his relatives ‘suicide’ like messages which prompted them to alert Police to institute investigations.

A 32-year-old man only identified as Phiri of Malengwa compound in Mongu reported the case of a missing person (Judge Muma) on March 2, 2023 around 01:20 hours and immediately Police instituted investigations which led to the recovery of his official motor vehicle, a Toyota Hilux registration number GRZ 437 CX which was found abandoned at the Zambezi Bridge along the Mongu-Kalabo road with keys in the ignition.

Police officers secured the motor vehicle after a 3-hour search in the area.

Initial investigations indicated that Judge Muma committed suicide by throwing himself in the Zambezi river and around 06:00 hours, Zambia Police Marine officers and members of the public were on sight again continuing with the search.

Later around 08:00 hours, Police officers received information that Judge Muma, who was heard calling for help while holding on to the grass for fear of being carried by the current in the Zambezi river, was rescued by a fisherman who was identified as Sianga Lubinda aged 32 who took him to one of the islands on the Zambezi River. He was later brought to the Bridge where he abandoned his motor vehicle using a canoe by the fishermen and was handed over to the officers who were together with other members of the public.

He was rushed to Lewanika General Hospital where he is currently receiving medical attention.

Police have opened an inquiry file into the matter.

A young man identified as Muyunda Godfrey, 33 year degree holder, serving as H.O.D at one of the schools in Samfya of Luapula province yesterday Wednesday went wild after his friend jokingly displayed a strange headed fish saying look at your brother.

According to information available, Mr. Muyunda was going through files when the man identified as Nchimunya Teddy 36 year old teacher, in a group of six other teachers dashed straight into his office and started laughing at him uncontrollably pointing at his God given head with an irregular shape, topped up with a P shaped forehead.

Mr. Muyunda, who has accepted himself was never bothered but after prolonged noise, got uncomfortable and begged to know what was going on, this was when Mr. Nchimunya whilst trying to hide his laughter displayed the strange fish that he was hiding behind his wedding lineup jacket.

After the display of the fish, all the teachers like a choir of desperate women trying to convince the music director, laughed uncontrollably in the office.

Mr. Muyunda did not take this lightly, he rose from his swivel chair and punched Mr. Nchimunya straight in the face. The punch forced the strange fish to fly and land on the door step. Mr. Nchimunya was already on the floor with his eyes up.

In rage, Mr. Muyunda moved to the next teacher, dragged him close and gifted him with the same irregular head of his and blood was all over the floor.

The other teachers wanted to run for their lives but it was too late, Mr. Muyunda stood on the door way and continued to kick and punch the teachers in his office carelessly.

The screaming of the teachers in the office attracted the attention of the deputy head who rushed into the office and found Mr. Nchimunya eating the raw strange fish with a deep cut on the forehead.

Meanwhile, teachers from this school have blamed Mr. Muyunda for beating teachers older than him saying it was not traditional.

Unless one is woven from natural fabric of hatred politics, it’s rude not to greet a fellow MP be it from another party and more so if a Minister.

I walked to his seat and greeted the Hon Minister of Local Government & Rural Development Hon Garry Nkombo at the Ncwala ceremony in Chipata over the weekend. He is not only in charge of the Chiefs division or traditional ceremonies but also in charge of every MP and their voters’ business called CDF. So only a foolish MP would ignore or belittle his presence.

This line of thought is however not so with a few of my PF rivals and mostly some (some) former Ministers evidently still in denial of their unfortunate circumstances if not fortunate to some. They went to town taunting me on my pic insert greeting the Minister captioning it ‘receiving further instructions’.

I guess because they can’t pick me on corruption or abuse of public resources or public offices, they and their few remaining violent cadre supporters like to decampaign my candidature for PF president by accusing me of being sponsored by the UPND. This always comes up each time I apply for any internal PF primary leadership contest but they failed to bring it up when I was stabbed trying to defend the PF Presidential vote in the August 2021 general elections.

As God may have it, within hours of me taking the pic with Hon Nkombo, other PF MPs elsewhere had or were greeting in a similar fashion others that are in top UPND and government leadership. In the pic one of the PF MPs is greeting President HH and listening attentively while another is doing the the same to the Minister of Green Economy Hon Collins Njovwu.

I have a FUNSO (question) to the few former Ministers and their few supporter against my candidature; by your own reasoning, is it true that the other two PF MPs in the attacched pics were also ‘receiving further instructions’ ?

Lusaka-Ndola Dual Carriage Way, A PPP or a Scam?

The New Dawn Government has signed a USD 577 Million concession agreement deal with Macro-Ocean Investment Consortium for the financing, construction, operation and maintenance of 327 Kilometers Ndola-Lusaka Dual Carriage Way.

At the Launch Ceremony held at Protea Hotel in Ndola, Ministers went to a great extent to demonstrate that Government “would not spend any money on the project” as this was a Public-Private-Partnership (PPP).

Ministers stated that the Concession Agreement has secured a revenue-sharing mechanism during the concession period.

The road will have toll gates and upgrade of two weigh bridges being fully funded by the concessionaire from construction to maintenance.

Minister of Infrastructure and Housing, Hon. Charles Milupi said the concession will run for 25 years of which 3 years of construction and 22 years of operations and maintenance of the road.

PUBLIC-PRIVATE-PARTNERSHIP

Public-Private Partnership (PPP) is a partnership between the public sector and the private sector, forged for the purpose of delivering a project or a service traditionally provided by the public sector.

In the road sector, whilst toll concessions are one form of PPP, tolls should not be considered synonymous with PPP, as there are many instances of publicly financed roads carrying tolls.

It is for this reason that Zambia High Ways now carry toll plazas and the roads remain publicly funded and do not have a private partner.

FINANCING OF THE LUSAKA-NDOLA DUAL CARRIAGE WAY

Let us look at the financing structure of the Lusaka-Ndola Dual Carriage Way.

Financing Instutions;

  1. National Pension Scheme Authority (NAPSA)-$300Million.
  2. Workers Compensation Fund Control Board- $100million.
  3. Stanbic Banka Zambia Limited- $200million.

Let us be clear, both NAPSA and Workers Fund Compensation Board are public pension schemes and are public institutions.

This is a publicly funded project with $200million sourced by a loan contracted from a private bank by Government!

NAPSA was formed through an Act of Parliament to provide income security against the risk arising from retirement (old age), death and invalidity with a focus on adequacy of benefits while the WCFCB is a social security scheme responsible for compensating workers in respect of accidents suffered and diseases contracted during the course of their duty.

Clearly this is a strange.

MODELS OF PPPS

All models of Public-Private-Partnership are known.

The purpose of entering into a PPP project is to free Government resources and provide for other urgent social needs but use the opportunity to access private sector financing to build public infrastructure.

The private sector then recovers their money through tolls or user charges of the road or Government takes the burden and picks up the tab as a public debt and pays the private partner through taxes.

Another well-known model is where the private sector finds the investment to finance, build, and operate the project. But Government or the Public partner then retains ownership of the assets after expiry of the lease period.

Infact, this is what is provided for in the Public-Private Partnership (Amendment) Act No 22 of 2020.

But in this case, Government has found the money through pension funds and will supplement it with a loan from a private Bank.

Government will pay for the design, will hire a contractor to build the infrastructure, but will hand it over to a private partner to collect tolls or user fees for 25 years!

What’s the role of the private partners in the Consortium?

Socialist Party General Secretary Dr. Cosmas Musumali has said the SP is the fastest growing opposition party in the country.

Dr Musumali disclosed that people in the streets are yearning to have party leader Dr Fred M’membe as the Republican President in 2026.

The Socialist Party has spread its structures in all the 10 provinces of Zambia.

All the districts, apart from roughly Six (6) have structures and the party is currently working on having structures in those districts as well.

80% of provincial offices have already been fully occupied.

Talking of the Capital City, there is no corner in Lusaka that does not know SP and the party is currently working to enhance the activities at branch level structure.

The SP is also focusing on making the structures self-supportive where members are learning life skills. These kills are in agriculture, health and many other income generating activities.

And in an interview yesterday, Dr Musumali said those who are saying there is no strong opposition in the country are basing their insinuations on what is obtaining in the opposition Patriotic Front.

“People that are saying that Zambia does not have strong political opposition, I think they are looking at mainly at what’s going on in the PF, that is fragmented, it is supposed to be the main opposition political party. SP does not have Members of Parliament, but the PF has. So the PF, whether we like it or not, in that view is supposed to be the main opposition party. But it is fragmented. There are too many internal divisions and in fighting. So Zambians are worried about that. And they are asking the question what next,” he said.

“And that question is also coming because they are tired of the ruling party. It is already over a year and they are feeling like they need to know who is going to be the next. They need to know the leading opposition political party that will be the party of their choice. And the more you ask people today in the streets, on the buses and other public places they will always point to maybe the next one should be M’membe. But as SP we have to do more, that is why we are focusing on the structures. It is the structures that will give us the visibility, it is the structures that will allow us to go to the mass front, talk to the people, confirm that indeed the next option is Fred M’membe, the next option is the Socialist Party.”

Dr Musumali also said a political party should not promise masses that they are going to scoop power come 2026.

He explained that it is the masses that should be saying “enough is enough, we are tired, there are a lot of promises that were made and these promises have not been fulfilled, because of that we need change.”

The General Secretary said people fight for change because they want a better livelihood.

“People fight for change because they want material benefits. When people say we want political change, they are not just talking about ideas, they are not talking about theories, they are talking about am I going to buy food, excess food cheaply? They are talking of will this economy create jobs so that the youth, the young people of this country can also have a livelihood. They are talking about if I am a small scare farmer, will I be able to access my fertilizers, my farm inputs at a reasonable price at the right time? They also fight for what is there, what has been stolen,” he said.

“The word we use normally is corruption, theft, this is public money, public resources that are being stolen and people know that. This is the money that should be coming to them and that money is being stolen and they want that money for social services. They want that money in education, they want that money in health. So it is the Zambian people that today are saying we do not want another four, five years of corruption, and they will make the decision come 2026.”

The Mine in M’kushi, the Drama in M’kushi, the Scramble for Mineral Resources

Mubita Nawa was suddenly criminalised, he was forced to be on the run, the message reinforced by their own media.

Nawa was found in Solwezi reportedly in hiding, lifted like a dangerous armed robber from Solwezi and transported to M’kushi.

At the heart of this drama is a copper mine in M’kushi-named Ndalumba Mine.

Accusations are flying.

President Hakainde Hichilema had to personally deny ownership of the mine and absolved the First Lady, Mama Mutinta Hichilema.

Minister of Mines and Minerals Development, Paul Kabuswe and State House Chief Communications Specialist, Clayson Hanasaka issued seperate statements about the ownership of the mine.

It is clear that there is more to this tussle when you see the registered owners of the mine.

They are top UPND players.

UPND Lusaka Province Chairperson, Hon. Obvious Summerton Mwaliteta, and UPND National Youth Chairperson, Mr. Gilbert Liswaniso with others in partnership with a foreign national.

Whatever the crisis happening over the fight over this mine, the people of M’kushi, like many local mining communities in Zambia are made to be desperate by-standers.

This saga of Saco Copper Mine in M’kushi owned by Ndalumba Resources can not be wished away because of;

  1. Mr. Nickson Chabwe( a nephew of the First Lady who has literally grown up in the Hichilema household).
  2. Hon. Obvious Mwaliteta( UPND Lusaka Province Chairperson).
  3. Mr. Gilbert Liswaniso( UPND National Youth Chairperson).
  4. Mubita Nawa- UPND Special Assistant to the President, who appears to be a hapless victim of the excessive abuse of law enforcement agencies and was subject of unfair scandalisation by both ZNBC and Koswe Media run by State House Media.
  5. The dismissal of the Ministry of Mines and Minerals Development Permanent Secretary, Mr. Mooya Lubamba.( He is said to have authored a Report that disclosed the proximity of State House and the First Family to the M’kushi Saga ).
    Be fair, corruption is corruption.

I am not privy to the details of the allegations or the size of Mwamba’s and Kalaba’s Flats which are in question. We can only assume that for this to happen, the restricted Flats are disproportionate to their assessed income. I will only analyze Ambassador Emmanuel Mwamba’s salary without gratuities and draw inferences. I will leave out Hon Kalaba’s as I do not have estimated figures.

An Ambassador’s Salary : K200,000.00

At today’s exchange rate K200,000 is the monthly income earned by the Zambian chief diplomat in South Africa which makes it K2.4million per year. With accommodation and fuel provided, the only major cost would be food and school fees for children which would still not be more than 20% of this income.

Over the years that Amb Mwamba served in diplomatic service, his monthly income alone without gratuities translates to about K16million. If one invested part of this money periodically, he can grow it even further to over K20m. This is certainly a lot of money when you consider that with the exception of, perhaps only, the Bank of Zambia Governor and the ZESCO MD, the rest of the CEOs earn less than K100,000 per month. 98% of Zambians will never have this kind of money in their lives!

And in case we feel envious, the Zambian Ambassador to the United States earns double what Mwamba got i.e K400,000 per month. How much can one do with that kind of money? Will former Ambassador to the USA Dr Simbyakula be investigated if he was found to have 30 Flats?

Therefore, with a K2.4m annual salary for Mwamba, anybody who is investing in real estate can set aside K1.8 m per year and build atleast four (4) Flats per year and over 25 Flats or houses over a 7 year period. ( This of course is besides income he earned in salaries and gratuities as Deputy PS and PS since 2003).

STATE MACHINERY IS OFTEN A VICIOUS & INDISCRIMINATE THING

I support the corruption fight. I hate theft and fraud. People have to account for their wealth. Wealth accumulation by anybody should not be a secret like #witchcraft.

Notably, state machinery is also inherently vicious. It is often malicious and indiscriminate. Behind titles and offices are people with biases like us all – calculative, fallen and morally frail human beings who can be both profesional or unethical, kind or malicious. Any targetted citizen can be paraded by state machinery as a thief or villain in life and only found innocent after he is dead (posthumously) – and great speeches made later at his/her grave.

Friends unless there is clear #evidence it is very cruel to tell someone facing doubtful court processes; “just wait, don’t talk – if you are innocent the courts will clear you” . Most of you who write things like that cannot withstand half the trauma of these processes. May God never allow you or your children to go through it 🙏.

“Icikalipa cumfwa umwine”, the adage says. Yes, I myself have gone through this experience and understood and felt why even strong people’s health suffers during interrogations and court trials.

Pending my bail, I further came to know what it is to sleep in a crowded jail besides someone who killed a person or stole from a shop. I know what it is to share a toilet with 80 people and lose privacy. It is a baptism of suffering I am however grateful for. I do not #fear it anymore. What you fear torments you.

During these processes friends also become fewer for fear of victimization by public association. Legal fees also set in immediately as lawyers accompany the suspect to appear before the investigators. It is ruinous in terms of both health and finances.Those of us who have gone through this kind of suffering must thus only occasion it on other citizens where it is warranted by clear evidence, if given control of the justice system by Heaven.

The trauma is high. We saw President Chiluba’s health publicly deteriorate during the long court process. Our revered late Veep Simon Kapwepwe – the bearded icon of our liberation struggle – suffered a stroke and died in Kalulushi en route to Lusaka to answer another round of silly court charges.

Kapwepwe died as a villain whose name could not be freely mentioned within Government circles. I was often bothered by the epitaph on his tomb which read; “he was a gallant warrior until 1970” [ bali cita ca calo ukufika mu 1970 – when he resigned?]. SMK only fully regained his recognition 11 years later under President Chiluba. Today, Zambia’s Presidents visit his grave and name some big national infrastructure after him. There are indeed many other innocent people who have unjustly suffered these injustices “legally” over the past decades while the crowd of partisan supporters cheered on . Legal is not always moral or just.

As the fight against corruption proceeds, therefore, it requires a strong sense of resolve, fairness and morality on Government’s part to avoid sowing long term seeds of vindictiveness and vengeance. While it is difficult to seperate the fight from prejudice and political differences, it must be demonstrated that it is a transparent and fair exercise.

If anyone has evidently stolen or has property they cannot #account for, let those properties be seized and let such persons be prosecuted. It is offensive and unpatriotic to steal public funds. If however there is nothing to reasonably suspect theft for, do not let the processes even begin. The processes themselves bring much suffering upon innocent people.

NO ONE CAN WITHSTAND STATE POWER

Unless one is a big opposition leader whose stature attracts strong direct international attention, no individual citizen can withstand the power and agenda of ACC, DEC, the Executive and the Judges appointed by the Executive.

Even in the United States the Judges who are appointed by Republicans and Democrats have certain respective leanings on some issues towards those political parties. It is far worse for a toddler country such as Zambia where apart from political differences, tribal leanings might also often become visible thereby undermining confidence in the neutrality and objectivity of the justice system. One only hopes that this great state power is mostly used in a righteous manner to fight evil in society.

To the two fellow sons of the soil Hon Kalaba and Amb Mwamba , I wish to say my thoughts and warm wishes are with you.I hope all goes well. I hope to learn about the details in due course. May God’s grace be with you.

Shiwang’andu Member of Parliament Hon. Stephen Kampyongo this afternoon during Parliamentary session took the Minister of Home Affairs and Internal Security to task to find out why Zambia is hosting the 22 Afghan Nationals currently in the country.


“As Zambia will be for the second time resuming for the second time the chairmanship of the SADC TROIKA organ on politics, security and defence in the region, Madam speaker there an immigration matter that is passing a security concern to the SADC region. Last week the Republic of South Africa declined entry to 22 Afghan nationals who traveled through to Zimbabwe where they where hosted as tourists with tourist visa and later tried to cross into South Africa”


“According to the Republic of South, The 22 Afghan arrived in Lusaka on 19th aboard Emirates airline. Madam speaker This is a very serious matter and we would like the Minister of Home Affairs to give comfort to Zambian Citizens because if South Africa with Robust security infrastructure could be scared to host these individuals I don’t know how Zambia would be comfortable to host these individuals host these individuals without an established status?”


Meanwhile, according to the Alarabiya News of South Africa, the Republic of South Africa on Tuesday last week challenged a court order forcing it to grant asylum to 22 Afghan nationals who arrived from Zimbabwe where they had spent a month on tourist visas. A Pretoria high court issued an order compelling government to take in the Afghan nationals after border authorities turned them away at the Beitbridge border.


South Africa’s Home Affairs Minister Hon. Aaron Motsoaledi said “We’re contesting the interim order,” “We’re also contesting the fact that these people are not in need of asylum, we don’t think they are in need of asylum or they followed the normal route of seeking asylum.”
Minister Motsoaledi questioned the manner in which the Afghan nationals arrived accompanied by three American citizens. “Here are people who are supposed to be refugees in serious problems but their arrival is preceded by a letter from a very expensive legal firm,” he said.
Following this refusal, the 22 concerned moved on to Zambia after returning to Zimbabwe.

FORMER PF secretary general Davies Mwila has challenged Local Government and Rural Development Minister Gary Nkombo to produce a list of PF members who obtained road contracts fraudulently.

On Wednesday last week, Nkombo challenged those aggrieved about the cancellation of road contracts to proceed to court.

Nkombo said 90 percent of PF members obtained road contracts fraudulently.
However in an interview, Thursday, Mwila wondered why investigative wings had not taken up the matter.

“Honourable Nkombo must be honest to himself. He has not produced a list of all those contracts that were given to the PF leaders or members. If surely those that were given contracts didn’t do contracts when they were paid, it is the responsibility of government to take up that matter to the investigative wings of government. If you are given a job and you are paid but you don’t do it, that is daylight theft. So I challenge him to bring out the list of those that were paid but didn’t do any job. Why can’t he forward all those names to investigative wings rather than just mere say? I cannot take him serious,” he said.

“They have been talking about this issue for one year seven months now and nothing is being done. Everyday when they wake up, it is a blame game. They want to blame PF for everything. When they fail to perform, they will blame PF. Whatever they want to do, they have to bring in PF. PF is no longer in power for one year seven months and it is now their responsibility to carry forward what we left. But I challenge him to bring out the list of those that have not done the job but were paid. If surely he is serious, he should have taken the matter to the investigative wings to investigate because those are public funds. If anyone was paid and didn’t do the job, something must be done. Because this government is not serious, it is just mere say. They will continue preaching until 2026”.

Mwila said Nkombo would be considered a big liar if he did not produce the list.

“If he brings the matter to the public, then the issues are in public domain. So the Zambian people must know how the money was spent and used. They just want to paint PF black but we will not accept that. We challenge him, let him bring out the list. Those are mere excuses. I do not believe that 90 percent were PF members or leaders. If surely it is true, he has to bring out the list so that we know. Without the list, I will tell Nkombo that he is a liar, a big liar. If surely he means well, he is supposed to produce a list so that Zambians will see who is telling the truth,” said Mwila.

I CANNOT understand Miles Sampa but whoever he is consulting, talking to, he has gone to wrong people, says PF chairman
Davis Chama.


In an interview, Chama said of late he did not understand what was going on in the mind of Matero PF member of parliamnet who is also seeking to be the party’s president.


This follows Sampa’s decision to take the party to the Registrar of Societies, where he has given a seven-day ultimatum to
compel the PF to hold a convention.


“Even the Registrar of Societies in Zambia knows we went for a general conference two years ago and our next conference is five years from last of last year. So we have been very compliant as far as our constitution is concerned. So we have nothing to worry about,” he said. “You know there is so much suspicion and lack of trust of each
other. That is what is compelling these undertakings by some of our colleagues.”
Chama said as far as he was concerned, leaders in the PF were men of integrity who could be trusted.


“Those who left they came back, they were forgiven. They said ‘now we have repented, we have come back. We are sorry for what we did from what we passed through’. But people are regretting now, they are saying
‘what is this?’ I remember people like honourable [Given] Lubinda who supported
him. I mean I have to disclose some of these things. He can even go to an extent of saying he signed bond for him and he is withdrawing surety, how do you go to such extent for goodness sake?” Chama wondered. “I, myself, was disciplined by the party when I was provincial party chairman even though I personally felt I did not do anything wrong.
But I said I have to obey the constitution and the powers of our leaders.”


He said no member must feel that they cannot be touched or disciplined.
“Then what kind of organisation are we going to run? Sampa has just been suspended and not expelled, so what is the problem? I am failing to understand my brother. I feel very sad that a person I share that closeness cannot even have the courtesy to say ‘I have a situation’ so that we discuss as a family before we go to outsiders,” Chama said. “I cannot understand Miles Sampa but whoever he is
consulting, whoever he is talking to, he has gone to wrong people. That is my view. Let him tone down, sober up. From where I stand we are not sidelining anybody but miles Sampa will sideline himself and expose himself and he will be judged by the members of the party.”
He warned Sampa that history would repeat itself.


Chama said although it was mandatory for any society and political parties to deposit their constitutions with the registrar, it was not the duty of the Registrar of Societies to run political parties.


“I don’t know what is going on in the head of my brother for him to take the route that he has taken. He is a senior member of the
party. He is a member of the central committee. He is our MP and within the party he has held several positions. So whatever is
compelling him to do what he is doing is beyond anyone’s understanding. It is very shocking but you know sometimes, history repeats itself and we have been on this route before,” said Chama

THE Anti – Corruption Commission (ACC) is stuck with investigations in which Minister of Information and Media, Chushi Kasanda is alleged to have influenced the awarding of fertilizer contract to Alpha Commodities Limited, a company owned by her husband Maurice Jangulo at USD 66 million.

Alpha Commodities Limited, was single sourced last year to supply fertilizer worth 66 million dollars, an action that has been condemned by stakeholders as the price is said to be higher than the rates prevailed on the market.

According to ACC Head-Corporate Communication, Timothy Moono the investigations in the Alpha Commodities fertilizer single sourced contract are still on going.

Moono was responding to a press query which was seeking to find out how far investigations involving Alpha Commodities are concerning the fertilizer contract which was awarded to the company owned by Kasanda’s husband.

The query was also seeking to established whether the Commission had also opened investigations against Chushi Kasanda for allegedly influencing the awarding of the fertilizer contract to her husband’s company.

In response, Moono said ACC is still investigating the matter concerning Alpha Commodities without giving further details on the involvement of the Minister if at all she was.

“I wish to inform you that investigations against Alpha Commodities are still ongoing,” he said.

However, ACC officers close to the investigations have revealed that the Commission is stuck on how to proceed with the probe because of interference from State House.

“As you know this matter started in 2022 and what makes it difficult for us to make headways is pressure from above, too many instructions. People above want us to clear the Minister for any wrong doing. A report was submitted to State House on the findings before even the current DPP left ACC as Director General. We had requested to interview the Minister but things were tough, there is too much threats in this matter. The file has even moved, it is no longer with people who were tasked to conduct an investigation. Bosses are the ones that are dealing with the matter. Remember that you sent the press query in December last year and the response was only given this year. No details to whether the Minister was summoned or not. No details as to why we have taken time to announce the investigation results, they want us to clear the minister and those close to the scandal,” the source said.

According to a notice of best evaluated bidders, Government had announced a list of companies and supply contract amounts intention to award the supply and delivery of about 260,000 metric tonnes of urea and compound D fertilizer to six companies for the 2022/2023 agricultural season.

Alpha Commodities was awarded a contract to supply fertilizer valued at $66 million for the 2022/2023 Agro season, despite being one of the highest bidder.

The total value of contracts awarded amounted to about $226 million.
Nitrogen Chemicals of Zambia (NCZ) a company that supplied cheaper priced fertilizer exposed the alleged inflated prices of fertilizer by Alpha Commodities at a price of $1, 407 per tonne while the general market price was $1, 000 per tonne during the 2021/2022 agricultural season.

STOP the huge economic bleeding facing people at the grassroots, urges former defence minister George Mpombo.

He said while the UPND promised a land of honey, Zambian lives have been turned into despire and misery coupled with pauperization of the grassroots.

Last week on arrival in Ndola President Hakainde Hichilema said 2023 is the year for the grassroots, for the people at the grassroots.

“Some of the things you may not see now, as the efforts we are making finding a solution to KCM (Konkola Copper Mines), to Mopani (Copper Mines) – I will be talking on radio, so that all the people of the Copperbelt will clearly understand. But we are making progress but you can’t see it now. You will see it shortly from now,” said President Hichilema. “I think that’s important. Some of the things that are causing trouble is suppliers to these mines who have not been paid, contractors who have not been paid. And the

resolution of these two mines will help us restore life in our small businesses on the Copperbelt. 2023 is the year for the grassroots, for the people at the grassroots. It’s a year for icipani (for the party).”

But Mpombo, a former Kafulafuta MMD member of parliament, said the people at the grassroots will demand answers why UPND ministers and MPs have abandoned them.

“The intended grassroots offensive will end as an excercise in political futility if government does not bandage the huge economic haemorrhage facing the grassroots. Presently the grassroots are groaning under an agonising burden of multidimensional poverty,” he said.

Mpombo told The Mast that political blitzkrieg (surprise attack) will severely backfire because the UPND government has dismally failed to deliver on their campaign promises through which Zambians elected them.

“The (UPND) economic policies have turned the country into a haven of despair, misery and pain,” he said.

Mpombo added that the grassroots were promised a land of abundance and prosperity.

“A land perpetually flowing with milk and honey but instead witnessing a serious erosion of their living standards and pauperization of the entire grassroots. A democratic government is supposed to harken to the cries of the people but instead they continue to charter private jets for the President to attend talking shops like the current AU summit in Ethiopia at a huge cost to the struggling and wobbling economy,” Mpombo said.

He said the grassroots would demand answers as why members of parliament and ministers have abandoned constituencies.

“Why fuel prices continue galloping, cost of living on an upswing, why presidential visits have ballooned to incredible levels, why major road construction or repairs have not commenced,” said Mpombo.
