HH should have assured us the next audit report will be credible – Mundubile

AFTER President Hakainde Hichilema presented a report on the progress made in the application of national values and principles in the National Assembly yesterday, Brian Mundubile said there was need for the issue of the Auditor General’s report to be addressed.

Mundubile, the Mporokoso PF member of parliament said President Hichilema should have assured the nation that the next report will be credible.

He said the transfers of “experienced auditors” amid an audit that is currently taking place raises concerns.

“Lastly, the issue of constitutionalism. They say the greatness of a nation lies in its fidelity of the Constitution. I think the specific issue that we are addressing now is the role of the Auditor General’s office. What we have seen in the recent past is that parliament gets a lot of work through the Auditor General’s report, meaning that is a very important report. We need the Auditor General to produce a credible report. The happenings in the Auditor General’s office in the recent past, transfers of the experienced auditors and the general movement around that has raised a lot of suspicion especially that we are having an active audit at the moment,” Mundubile said. “So under constitutionalism I thought that the President should have come out very clear and assuring on the aspect of the Office of the Auditor General to assure us that the next audit report that is coming is a credible report.”

He expressed dissatisfaction with how President Hichilema handled the issue of regionalism.

“There are two things that I think the President didn’t address. The growing discussion around regionalism. It is something that I debated on yesterday [Thursday] as one of the expectations. We expected the President to have a much stronger voice on it,” he said. “While there are speculations that people are posting names every day on appointments and so on, the President needed to put that debate to rest. Unfortunately, he did not.”

And Mundubile said the sensitisation of the people against the abuse of alcohol is progressive.

“Of course we can do more, given the numbers of our children whole are under alcohol abuse. I think that there is still room to do more. But that work that has been done so far so good,” said Mundubile.

TWO more witnesses have testified in the matter where former Secretary to the Treasury Mr Fredson Yamba and former Foreign Affairs Minister Hon Joseph Malanji are charged with willful failure to comply with procedure relating to procurement, and being in possession of property reasonably suspected to be proceeds of crime respectively.

Director for Investments and Debt Management at the ministry of Finance, Mr Gregory Kabwe told court, Monday, that there was nothing illegal with the manner payment was made for the procurement of the property in Turkey.

Mr Kabwe narrated that in 2020, the Ministry of Finance received a request from Foreign Affairs Ministry to facilitate contraction of a loan from a Turkish Bank for the purpose of procurement of the said property.

The witness added that the request came with proposed terms of the loan from the Turkish Bank.

“When we looked at the terms, we looked at it from the perspective of the suspension of contraction of loans but we also had to analyze those terms to see if it was a concessional loan falling within the directive by Cabinet. We observed that the facility had some of the terms that made it fall outside what we could contract within Cabinet directive,” he said.

“Particularly we noticed that there was a requirement for a Bank guarantee between GRZ and the Turkish Bank before the Loan could be signed and the facility was a commercial one as opposed to a concessional Loan. We had discussions following that with Acces Bank which was in contact, as an Agent Bank, with the Turkish Bank. At some point my lady, we had a second proposal from Access Bank upon noticing that we could not propose under the terms of the Turkish Bank.”

Mr Kabwe further narrated that the proposal was that the ministry was to discuss with Access Bank so that it can lend GRZ for the purpose of the acquisition of the property, except the proposal was equally commercial and exorbitant.

“At that point, I would like to mention that I had a one on one conversation with the then Secretary to the Treasury and the purpose of my consultation was to seek guidance as to how we should handle the request from Ministry of Foreign Affairs in light of the Cabinet directive considering that the proposals that were on the Table were commercial in nature. I was prompted to seek this audience because at that time, I was receiving phone calls from the Honourable Minister of Foreign Affairs then following up on the facility,” he said.

“The guidance from Secretary to the Treasury, Mr Fredson Yamba, then was that we needed not to proceed with the contraction of the Loan and that we needed to remain within Cabinet directive. He also guided that the matter was sensitive and that we needed to continue buying time, with the view not to proceed. After that, my department then proceeded to have further discussions with Access Bank and essentially, on what sought of Security would go with that facility if the Bank was to lend to Government for the purpose of procuring the property in Turkey.”

The witness said he continued having discussions with Mr Yamba and on one or two occasions, “he would call me to provide updates on how we were managing the matter especially when he could be visited by Hon Malanji.”

Mr Kabwe said this was done with the understanding that he had already provided guidance to “my department” on the matter.

“After that period, we proposed to Secretary to the Treasury to communicate to Ministry of Foreign Affairs indicating that the loan could not be contracted with the Turkish Bank because it was falling outside the Cabinet directive and was commercial in nature. Secretary to the Treasury then wrote to Ministry of Foreign Affairs advising them and indicated that other avenues could be considered for the procurement of the property just not by way of the Loan. The mandate of my department, that is how the matter left our hands,” he said.

“The next time I got to be close to the matter was when funding was being done by the Treasury to the Ministry of Foreign Affairs. At this point my lady, a cash variation had been done for about 108 million Kwacha after a request was done under Secretary to the Treasury’s approval.”

And during cross examination, the witness said the approval for purchase of Government Embassies was issued in 2015 thus the Ministry of Foreign Affairs’ request for a credit facility except the credit facility by the Turkish Bank was non concessional.

The witness told court that Mr Yamba wrote to Ministry of Foreign Affairs Permanent Secretary in-charge of Administration Dr Ronald Simwinga advising them that it was not possible to contract a non-concessional loan and should instead fund the purchase through the Budget.

Mr Kabwe clarified that there is nothing wrong by doing that.

The witness said there was nothing illegal about the intention to contract a Loan and that Hon Malanji’s contact with him was for the interest of the Ministry.

He added that there was nothing sinister about Hon Malanji following up funding for the purchase of property under his Ministry.

The matter was adjourned to 6th March, 2023, pending cross examination on Ministry of Foreign Affairs Principal Internal Auditor Safira Mutambo Mutti.

Anthony died Saturday after a decline in his health over the last few months, according to multiple reports.

Anthony’s brother-in-law, musician Joe Henry, who is married to Madonna’s sister, Melanie Ciccone, was the first to share the news, penning a heartfelt post on Instagram.

“My brother-in-law, Anthony Gerard Ciccone, exited this earthly plane last evening. I’ve known him since I was 15, in the spring of our lives in Michigan so many years now gone. As brother Dave Henry (who took this photograph) notes here, Anthony was a complex character; and god knows: we tangled in moments, as true brothers can. But I loved him, and understood him better than I was sometimes willing to let on,” Henry wrote, making note of their often complicated relationship.”But trouble fades; and family remains— with hands reached across the table,” he continued. “Farewell, then, brother Anthony. I want to think the god your blessed mother (and mine) believed in has her there, waiting to receive you. At least for today, no one shall dissuade me from this vision.”

Madonna, who is one of eight children, grew up in Michigan, where per Page Six, Anthony is believed to have been living at the time of his death.

According to the outlet, the pop icon and her siblings had a strained relationship with Anthony over the years due to his struggles with substance abuse.

German Ambassador exposes Ghana’s Us$5.7  billion debt secret

The German Ambassador to Ghana, has literally rubbished the reason Finance Minister, Ken Ofori Atta, gave for the termination of his planned trip to China, to beg the Chinese for debt cancellation.

Mr Ofori-Atta, had said that the planned high-level government delegation to China, had been postponed to late March 2023, owing to the upcoming National People’s Congress of China meeting scheduled for early March, but Daniel Krull, explained that China, which is the biggest external creditor to Ghana, is refusing to participate in arrangements to deal with the West African country’s external debts.

Ghana’s total debt is hovering around US$5.7 billion, with China owed over US$1.7 billion, while US$1.9 billion is owed to some Paris Club members. The Akufo-Addo government is hoping the debt relief, would help the country meet conditions for an IMF bailout.

“The biggest elephant in the room is China. China is the largest creditor to Ghana and so far, it’s not fully supporting the setting up of the creditor’s committee where all the creditors will sit down and agree on a package for Ghana, Daniel Krull, said.

The Finance Minister, had said that bilateral talks will continue ahead of this important mission to China, but the revelation by the German Ambassador, shows that the Chinese are unwilling to play ball with the Akufo-Addo government.

The government, has been at pains seeking under the G20 Common Framework for Debt Treatment to get debt forgiveness from some bilateral and multilateral partners.

But Daniel Krull, warned of the possibility of Ghana not getting the US$3 billion International Monetary Fund (IMF) bailout it is seeking.

According to him, Ghana is currently having challenges dealing with its external debtors who are critical for the Akufo-Addo government to get the approval of the IMF board for the bailout it is seeking because of China.

“Time is of the essence; time is running out. Without this agreement with the bilateral creditors, the IMF package is in severe danger,” the ambassador is quoted to have said in an interview on Foreign Affairs on the Joy News Channel.

Daniel Krull, therefore, urged every Ghanaian including Members of Parliament (MP) who have strong connections with China to try and convince the Chinese government to come onboard.

The government of Ghana is expected to start actively engaging external debtors with the view to getting debt cancellation, especially from the Paris club of creditors. The first stop of a government delegation seeking debt restructuring will be in China with the Minister of Finance leading the team expected in Beijing.

Mr Ofori-Atta, according to a media report, had told Svenja Schulze, the German Development Minister that, China has committed to a bilateral negotiation.

“The big elephant in the room is China as to how they will comport themselves in the comparability of treatment because China wants to do bilateral. We would be visiting China by the end of the week to really discuss how they can envelope as quickly as possible,” he said.

Svenja Schulze on her part assured of German support in helping Ghana to get fair treatment at the Paris club. However, the German government says although it is willing to assist Ghana push through its proposal with its external creditors, especially China, some conditions must be met.

President Akufo-Addo also recently called on German Finance Minister, Christian Lindner, to “encourage” China to accept Ghana’s proposal for debt relief with its largest external creditor, China.

Speaking at a press conference on Friday, February 24, 2023, the Ambassador noted that Ghana cannot be asking for external debt relief while refusing to cut its expenditure. He called on the Akufo-Addo government to consider a cut in its budget expenditure while it continues to seek debt relief from the country’s creditors.

“Well, of course, it depends very much on what kind of expenditures you’re looking at … I’m convinced this is true, for if I look at the budget of the German Foreign Ministry of the German government, I’m convinced there are important tasks that can be cut without hurting the economic development.

“And I’m convinced without going into details this also is true for Ghana. There are certain expenditures that can be lowered substantially and make an important impact and it has to be part of the package.

“I mean, I cannot go out to the international community and say I need help, but I’m not willing to cut my own budget expenditures. I have to be careful not to cut the social expenditures that are destroying lives and families. I have to be very careful not to take measures that might negatively impact economic growth.

“But I’m convinced there are many expenditures that could be looked at very carefully and can be lowered substantially,” he said.

Comparing Ghana’s situation to some countries including Germany, Mr Krull further called for a reduction in the size of Ghana’s government.

“I only can compare and with other countries like my own and I can just come to the conclusion that the number is much higher than in my country. So that might bring me to the conclusion that maybe there’s room for improvement,” he said.

He added that “Ghana has a very dense layer of institutions and responsibilities all over the country.”

In the yet-to-be-aired interview on Foreign Affairs on the Joy News Channel, Mr. Krull told host, Blessed Sogah, that his country is willing to help only if certain conditions are met.

“First of all, we insist that those measures that can be taken here in this country have to be taken. The second condition is that, yes, we are willing to take our share of responsibility as one of the major bilateral donors to Ghana.

“But only if all the others also join in this effort. And there is a multilateral framework that was set up exactly for these kinds of crises and we urge and try to convince all stakeholders in this process to stick to this agreed framework. It’s the G 20 framework,” he said.

When asked to lay out the terms of the domestic conditions to be met by Ghana, Daniel Krull indicated that “Let me point to three elements. The biggest loss maker in Ghana is the energy sector.

In this sector alone, each year, $1.5 billion in new debt is piled up. So if that is not solved and you can ask the IMF for $10 Billion, you still will not solve the problem in the medium term.

“So there has to be an answer in Ghana to the 50% technical and non-technical losses in the energy sector. If that is not resolved, I don’t see how we can make finding a sustainable solution for the financial problems of the country”.

He added “the second part is on the other side of the budget and that is the revenues. Ghana has the lowest, one of the lowest tax to GDP ratios, not even 13%. So we have been cooperating with the local authorities and setting up a very smart system of property tax collection.

“So I think that is an important way forward and this has to be done and processes and decision making has to be faster to meet the goals, to be able to meet the targets that have been agreed with the IMF”.

The Ambassador also noted that he’s “still amazed on the procedures for how the budget is set up and how difficult it is to get an understanding of how this all works.

“And I think that is something that has to be improved. He is, however, confident that with the necessary political will, new opportunities will be created to enhance economic growth.”

Managing Director of the IMF, Kristalina Georgieva, confirmed in January 2023 that Ghana became the fourth country to seek treatment under the Common Framework. This sent a signal that it was on the pathway for debt resolution.

Nigerian opposition parties demand new elections as ruling party assumes control

In a joint press conference held in the nation’s capital, Abuja, the main opposition parties in Nigeria demanded new elections and denounced the results that are currently being released by the electoral authority as “heavily doctored and manipulated.”

In a joint statement released on Tuesday in Abuja, the Peoples Democratic Party, Labour Party, and African Democratic Congress stated that their parties would no longer participate in the ongoing collation process there and that they had lost faith in Mahmood Yakubu, the chairman of the electoral body.

The parties urged the Independent National Electoral Commission to elect a new head as well as hold fresh elections (INEC).

“We call on the international community to note that the results being declared at the National Collation centre have been heavily doctored and manipulated and do not reflect the wishes of Nigerians expressed at the polls on February 25, 2023,” they said.

The election process has been dogged with controversy, and the announcement at the national collation center in Abuja has seen some tense moments, with opposition party members walking out of the collation center as the results were being announced Monday.

Several observers including the European Union have said the election fell short of expectations and “lacked transparency.”

“The election fell well short of Nigerian citizens’ reasonable expectations,” said a joint observer mission of the International Republican Institute (IRI) and National Democratic Institute (NDI).

Ruling party candidate Bola Ahmed Tinubu is so far leading the race with nearly half of the vote already tallied Tuesday, according to the country’s Independent National Electoral Commission (INEC) results.

23 out of 36 states have declared their results at state level. The leading opposition party PDP’s Atiku Abubakar is in second place, according to INEC figures.

Despite his shock win over Tinubu on his home turf in Lagos State, Peter Obi, the much-touted ‘third force’ candidate is trailing in third place.

According to INEC’s iRev results portal, 83.798 out of 176.846 polling units have submitted their results.

INEC meanwhile continues to announce results coming in, despite fierce criticism of the commission’s handling of how the elections with widespread reports of delays, allegations of voter manipulation and polling stations that failed to open leaving disappointed voters unable to participate.

“The conduct of the February 25, 2023 election has been marred by widespread violence, rigging, intimidation of voters, doctoring of the results, and violation of the laid down electoral process which was communicated by the national electoral body, INEC,” the People’s Democratic Party and the Labour party said in a joint statement.

Former Nigerian President Olusegun Obasanjo has also called for elections that lacked credibility to be cancelled.

But the government warned him not to truncate the #2023GeneralElections with “his inciting, self-serving and provocative letter on the elections,” in a statement from Minister of Information, Lai Mohammed.

Meanwhile Yakubu asked any candidate with complaints to seek redress in the courts during a results announcement in Abuja Monday.

Yakubu says he plans to continue with results announcement despite complaints.

Drake says he regrets saying his exes’ names in his songs: “I’ve tried my best to stop”

While he may be one of the most successful rappers today, even Drake has regrets over some of his past lyrics.

During his interview with Lil Yachty, the Toronto rapper revealed two things that he regrets rapping about on his songs, starting with age.

On his Views track “Weston Road Flows,” he said he plans to hang up the mic at 35. “I’m assumin’ everybody’s 35 and under / That’s when I plan to retire, man, it’s already funded,” he raps.

Looking back, the now 36-year-old admits that he thought 35 was “really old” and shutters when hearing the lyric. “I hate hearing that shit,” he said. “To think it’s so wavy to be young, it’s not that sick, ’cause I’m here now.”

He also regrets rapping his exes’ names, not realizing the effect it had on them.

“That and some times when I’ve said girls’ names in songs, maybe those are two things that I look back on and I’m like, maybe I could have done without shitting on people for age or disrupting somebody’s life,” he shared.

Drake said he never had “ill intent,” but realizes that he may have hurt people.

“I had somebody one time be like, it’s not necessarily what you’re saying about me, it’s the fact that you said it,” he said. “Just in a sense of like, you don’t know what it does to me. You don’t know who my boyfriend is at the time or you don’t know what my family knows or doesn’t know and if you express any form of discontent for me in a song and call me by name, then all of a sudden I’m left to kinda like pick up the pieces of my own life that I’ve tried to build up for myself.”

He’s made an effort to stop, but he also wants to remain honest. “I’ve tried my best to stop doing that, but I like to be honest with the music too so that one’s a push and pull.”

Model Abby Choi Dead at 28: Ex-Husband and In-Laws Charged With Murder

Days after going missing, model Abby Choi’s ex-husband Alex Kwong and some of his family members have been charged in connection to her death.

New details have emerged about model Abby Choi‘s tragic death.

The influencer’s ex-husband Alex Kwong, 28, was arrested and charged with murder over the weekend in Hong Kong, police superintendent Alan Chung confirmed (via Associated Press). Alex was taken into police custody after Abby’s body parts were found in a refrigerator, the outlet reported, while a skull, that police believe to be the 28-year-old’s, was found in a pot inside of a home in the Hong Kong’s Tai Po district.

Alex’s father Kwong Kau, 65, and brother Anthony Kwong, 31, have also been charged with Abby’s murder while Alex’s mother Jenny Li, 63, is currently facing “one count of perverting the course of justice,” according to the AP.

E! News has reached out to the Hong Kong Police Force for details and to see if the accused have obtained legal representation but has not yet heard back.

Alex and his family members appeared in court on Feb. 28, public broadcaster RTHK reported via CNN.

RTHK further stated that the defendants, who were all denied bail by the Kowloon City Magistrates’ Court, have not yet entered their pleas and the case was adjourned until May.

Police first began investigating Abby’s disappearance when she was reported missing Feb. 21, according to the AP who cited a report filed with the Hong Kong Police. Her remains were found just days later.

Before her tragic death, Abby was an influencer who documented her glamorous life of photo shoots and fashion shows on Instagram. In her social media profile, Abby wrote that she was “embracing every moment of life.”

Her last post, from mid-February, featured a photoshoot she had done with L’Officiel Monaco, a fashion publication.

“From Hong Kong to the cover of L’Officiel Monaco, my journey as a style icon continues,” she shared in her Feb. 14 post. “Grateful for this recognition and the continued support along the way.”

Before that, Abby celebrated her feature in Vogue China by offering her 121,000 Instagram followers a sneak preview into her latest photos.

On the Sugilite scandal of the Muombe Mine in Sub-Chief Kunda-Mfumu chiefdom in Chembe districts, we want to know;

■ Reports from the traditional authorities state that 3 trucks left Muombe Mine in Chembe for Lusaka. Where are the other two trucks as only one truck was impounded?

■ Who provided police security for 3 weeks when the illegal operations and illegal mining was taking place?

■ Who provided authority for police security and police escort for the 3 trucks?

■ The current owner of the mine is Bayarn Company which currently holds mineral exploration rights. What was their role?

■ Last year, on February 3, 2022, UPND Deputy National Chairperson for Administration Stephen Chikota (who is now Council Chairperson for Mwense District) had a confrontation with Police in Muombe area following his attempt to force his way to the mining site. He charged that illegal mining of the rare gemstone was being done, despite the thhee restrictions that of such a licence.

Chikota accused Luapula Minister, and Cabiner Ministers from Lusaka of abetting illegal mining of the Sugelite Gemstones.

Instead of Government investigating Chikota’s allegations, they concentrated on criminalizing Chikota’s tresspass action at the mine.

President Hichilema has failed to attend to the credible reports that the mine owner and Cabinet Ministers wereallegedly engaged in illegal mining and export of the rare gemstones.

■ Who provided police security for 3 weeks when the illegal operations and illegal mining was taking place?

■ Who provided authority for police security and police escort for the 3 trucks?

■ The current owner of the mine is Bayarn Company which currently holds mineral exploration rights. What was their role?

■ Last year, on February 3, 2022, UPND Deputy National Chairperson for Administration Stephen Chikota (who is now Council Chairperson for Mwense District) had a confrontation with Police in Muombe area following his attempt to force his way to the mining site. He charged that illegal mining of the rare gemstone was being done, despite the thhee restrictions that of such a licence.

Chikota accused Luapula Minister, and Cabiner Ministers from Lusaka of abetting illegal mining of the Sugelite Gemstones.

Instead of Government investigating Chikota’s allegations, they concentrated on criminalizing Chikota’s tresspass action at the mine.

President Hichilema has failed to attend to the credible reports that the mine owner and Cabinet Ministers wereallegedly engaged in illegal mining and export of the rare gemstones.

Therefore the recent actions against public officials appear a knee-jerk and belated reaction to a long-standing problem of illegal mining and theft of the mineral!

Other Chiefs should emulate Chief Mukuni

At the height of then opposition leader Hakainde Hichilema’s troubles, there was one constant figure around him and that was of His Royal Highness Chief Mukuni.

Chief Mukuni made the fight for Hakainde Hichilema’s freedoms as his own personal fight. He attended numerous court sessions and issued hundreds of press statements condemning what he felt was harassment of Mr Hichilema.

When asked by Journalists why he was always attending Mr Hichilema’s court sessions and defending him in the media, His Royal Highness explained that as a Chief, Mr Hichilema is his subject and when he is suffering, him as a Father ought to be there to support him.

Now the question is, where are the other Chiefs from other parts of the country when their subjects are being harassed? Why are they silent over what we are going through under this administration?
Where are the Chiefs from Luapula, Muchinga, Eastern Province and Copperbelt Provinces when people are expecting their voices on key national issues?

The Chiefs fully know that what we are going through under President Hichilema is pure persecution and harassment based on politics. To this day, no single Chief from these regions has issued any single statement on our persecution. They have opted to remain conveniently silent because it is in their best interest. For us we believe that when a child is being mistreated, the Father must be seen to be protecting the Child.

We saw it even with Dr Frederick Chiluba, the Chiefs from Luapula came and camped in Lusaka for most parts to offer solidarity to Dr Chiluba as he was facing court cases.

We wish to advise our silent Chiefs to learn from Chief Mukuni and use their influence and help redirect the governance architecture in this country. Our Chiefs, just like Chief Mukuni are an important stakeholder in the governance process and should not opt for silence for convenience reasons.

When we choose silence, we have already picked the side of the oppressor.

Parliamentary Opposition Whip Hon. Stephen Kampyongo has called on the New Dawn government through the Ministry of Home Affairs and Internal Security to stop misleading the nation on the matter on the 22 Afghan Nationals currently in country after being denied entry in South Africa by the South African government.


Speaking this afternoon when he rose on a point of order directed to the Minister of Home Affairs, Hon. Kampyongo stated that as former Home Affairs Minister he is very well preview to the Conventions that the country belongs to and the local procedures on asylum seeking.
“Madam Speaker, I have had a privilege of serving in the office of Home Affairs and I know the procedures that followed when someone is seeking asylum, I give a genesis madam speaker there is no way people can be pedestrians in seeking for asylum, I mention from Pakistan these people went to Zimbabwe and from Zimbabwe they wanted to enter South Africa which the South African Government denied?”
“Is the Minister in order to mislead us and the whole nation that these people are seeking asylum from his office here in Zambia when in actual fact the very minister stated earlier in this house and is on record is that these people are in transit to south Africa hence they are trying to chance to see what South Africa will do in the court process that these very 22 Afghan nationals have started, there is no such a provision? We know the conventions that govern asylum seeking we understand! And so is the Minister in order to mislead us now that these people are now seeking asylum from his office?”


And Kamfinsa Member of Parliament Hon. Christopher Kangombe, asked the Home Affairs Minister to tell the nation who these people are? Where have they come from? And what issue is making the said individuals seek asylum?


“I am sure members of the public who are following this very important debate would want to know, do we have the names of these 22 nationals? Do we have a record of who they are? Which organization they represent? Do we have facts details that would be provided today in terms of an update to the public because this is not a conversation for 156 members of parliament… I am very curious as to which people are we discussing? Who are they? Where are they coming from? What issues are surrounding these nationals?”


To the surprise of the House, the Minister of Home Affairs and Internal security said “I will not be an irresponsible Minister of Home Affairs to come to this house and start disclosing the details of people who are seeking refuge in this country, because if they are seeking refuge they are running away from danger and if they are running away from danger it is incumbent upon me not to expose them I will not do that”
Earlier when the shiwangandu parliamentarian asked the question on why the nation is hosting the said nationals, the Minister of Home Affairs said, “These individuals are in transit to South Africa, south Africa has not finalized considerations of their applications”.

Leader of the Opposition in Parliament Brian Mundubile says Government should stop transferring Directors at the Auditor General’s Office to Cabinet Office as this will compromise the Auditor General’s report.

Mr. Mundubile who is also a PF Presidential Candidate said a compromised Report, would make it difficult for Members of Parliament to authenticate it during Parliamentary sittings, adding that this was the first Report under the UPND Administration.

He said the transfers brought the number to 400 Directors and Deputy Directors from various Ministries that would be drawing free salaries while in holding positions, without doing any work.

Mr. Mundubile said the Constitution of the Republic of Zambia provided for safeguards and watchdog bodies to discipline Government by watching all activities.

He said the Auditor General was one such office which basically looked at how Government was carrying on the stewardship that was entrusted on them by the people of Zambia.

“They express an opinion after looking through the books of accounts of Government,” he said.

Mr. Mundubile said that this is a ploy to destabilize the Auditor General’s Office at a critical time when there was an active audit.

“As Parliamentarians, we are concerned because the Auditor General’s Report forms part of our functions in providing oversight to Government,” he said.

He said the work of Parliament would be adversely affected if the Audit Report was not credible.

“We know that this is the first audit that will be carried out covering the period under the UPND administration. We feel that this is what has caused panic UPND friends to ensure that they produce a clean report. But as Parliamentarians that have been following events as they unfold, we have minimum expectations,” he said.

He further said, stakeholders expect the Auditor General’s Report to cover the cancelation of hunting licenses, procurement of fertiliser at Fifty Million Dollars when the market price was Thirty Five Million Dollars and the One Hundred Million Dollar contract under Ministry of Health, among others.

“Even if Government tries to destabilize the Office, we will make specific demands to the Auditor General and we will find it very difficult to defend a document that is watered down. What is important now is that let them wait for the Audit Report and use it as a mirror to reflect on how UPND has managed the Affairs of the country. There have been concerns regarding the governance style of the UPND Government,” he said.

Mr. Mundubile said a credible audit report would serve as a guide to the UPND Administration going forward so that they restrain themselves from doing certain things and govern the country in the manner that was expected.

“We are concerned that Senior Auditors with experience spanning over 28 years victimized by throwing them to Cabinet Office in their usual style, bringing the number to 400 directors and deputy directors sitting at Cabinet Office and drawing salaries and President Hakainde Hichilema should say he is prudent in managing public resources? I think as a country we ought to get serious,” he said.

Patriotic Front – PF Vice Secretary General Hon. Nickson Chilangwa this afternoon led a team of 4 MPs on behalf of over 70 MPS from different Denominations to the Synod Headquarters in Lusaka.

This came to light after word went round yesterday, that the upnd government had threatened to seize the newly built synod Headquarters.

During the meeting Hon. Nickson Chilangwa said the MPs were on a fact finding mission and to offer solidarity to the church and its members.

“We are not only interested in getting the full story because the latest happenings in and around the country are there to bear witness and one thing that is very clear, which is that a number of churches, church groups and a number of Ministers not only from the UCZ , l mean Ministers of the Gospel and Sacraments who were lucky to have received donations such vehicles etc during the PF reign have had their properties either confiscated or restricted by the New Dawn Government! Some of the vehicles are sitting at investigative wings offices!

We are also aware that a few churches are being investigated if they ever received money or any support from President Edgar Lungu for their various projects .

I’d be honest to tell you that one of the church which is been investigated belongs to a very high profile Bishop so these are not just mere things or Coincidences.

So for us to hear our church was one of those they are targeting and that some Officers came through here, is totally unacceptable and we will not allow the church to be defiled in this fashion!

We agree and support with that statement issued by the church to calm nerves of the members and everybody else , ” He said.

But the truth is that there no smoke without fire, something MUST have happened and we should NOT as UCZ members gloss over this incident as we have watched this movie by the UPND before! They are testing the waters!

Mr. Chilangwa further said the Anti- Corruption Commission was wrong to think they can go after the church, “us members of parliament we shall not sit and watch the body of Christ been victimized and harassed.”

My message to the UPND government is “STOP IT” concentrate on real issues and stop provoking citizens further!

And speaking during the same meeting Patriotic Front Chawama member of parliament Hon. Tasila Lungu, thanked the leaders at Synod Headquarters for providing leadership.

“We can not stand aside and watch, and let the body of Christ been disturbed in anyway, even if danger hasn’t come in yet if we see any clear indication of it coming we have to stand up for what is right, that’s why the people put us in these positions.

Am so proud of what you’ve done here, and we should encourage every church and we should encourage every Zambian, it’s not a sin to obtain wealth and that’s what we should be working towards. I have a problem anytime that me as a leader can stand aside and want to see you all to struggle it becomes a problem! if anything as a leader am supposed to encourage you to build and protect those assets.” She said

Hon.Tasila indicated that God did not put us here on Earth to suffer and to be poor if we had natural wealth.

Synod bishop Sichilima thanked the MPs for coming and the concern they showed
he encouraged them to be strong and that the church was praying for them.

“We feel encouraged, we feel cared for, we feel loved and we don’t feel alone! We will share this with the rest of the church” Bishop Sichilima added

WHAT IS HAPPENING TO THE KWACHA?

The kwacha has continued depreciating and is now close to K20/USD. What exactly is happening? Let us take a close look at some of the key pressure points. Just like goods and services, the exchange rate is determined by demand and supply. Note that there are a lot of factors at play but i will narrow it down to key supply and demand side factors that jabe had a huge influence on the continued kwacha depreciation.

On the supply side, let us take a close look at some critical factors that include: Fed Monetary policy, Investment in government securities, and export earnings. These essentially determine the supply of dollar on the market.

1) SUPPLY SIDE FACTOR 1: The U.S. dollar is strengthening because the Fed adopted a hawkish monetary policy stance in response to skyrocketing inflation. A tight monetary policy strengthens the dollar against other currencies like the kwacha.

2) SUPPLY SIDE FACTOR 2: The protracted debt restructuring negotiations and sentiments in both the local and international media over the same have increased fear in those who want to invest their dollars in government securities. There is some hesitance because of this uncertainty surrounding debt restructuring. It should also be noted that these investers also want to see what will happen to domestic debt as this will affect their investments. This has reduced the supply of dollars and puts pressure on the kwacha.

3) SUPPLY SIDE FACTOR 3: In 2022, copper prices and production were lower than projected. This meant reduced earnings and hence less dollars.

On the demand side, I will put the factors into two groups: demand for dollars for import (goods for consumption and inputs in production) and demand to hold dollars in anticipation of further depreciation of the kwacha.

4) DEMAND SIDE FACTOR 1: Zambia still imports a lot of consumer goods as well as key inputs and capital equipment required for production. In the second half of 2022, apart from importing of fuel, the country also spent a lot of dollars important fertiliser. Economists closely monitor demand for dollars and try to project how these dollars are used by studying the pattern of imports.

5) DEMAND SIDE FACTOR 2: The protracted debt restructuring negotiations and sentiments around the same as well as other supply side factors mentioned above have made people predict a weak kwacha. This has significantly increased the desire to hold dollars.

In the first quarter of 2023, the increase in demand is largely driven by the desire to hold dollars in anticipation of a further depreciation of the kwacha. Economists monitor all these factors. They look at projections in SS1, SS2, SS3 and also analyse the pattern of demand in DD1 and DD2. They monitor the pattern as well as the strength. This informs the combination of monitory policy instruments to use as well as the strengthen of the response. We are facing a situation where the supply side is weak across all the three SSs and the strong demand largely driven by desire to hold and not necessarily to increase production as evidenced by patterns in the data. This is basically what prompted the Bank of Zambia to initially apply open market operations in 2022 and move in with the 2.5% increase in the statutory reserve ratio and 0.25% increase in the monetary policy rate.

It is important to note that without these interventions the exchange rate would be worse than it is. Why is it important to address the depreciation and volatility? The exchange rate is one of the most important indicators monitored by both local and foreign investers, it is one of the key indicators that communicates how healthy an economy is. In our current economic state it even becomes key. An unstable exchange rate and a depreciating domestic domestic currency will push away foreign investments in government securities and long term projects. It will further send people into panic buying of the dollar in anticipation of a further depreciate of the domestic currency. This will make the exchange rate even more volatile and send the domestic currency into further depreciation. Prices of imported consumer goods will go up and since it takes time for domestic production to increase, the cost of living will worsen. Prices of fuel, fertiliser and other key inputs in production will go up and this will negatively affect output.

It is very important to address the detrimental exchange rate volatility as no meaningful investment and production can take place in such an environment. A stable exchange rate and strong kwacha will help support production and increase exports so that our domestic currency can have long term natural strength and stability.

One would ask why the kwacha has continued depreciating depsite Bank of Zambia interventions? It is important to note that such interventions can have four effects depending on how factors driving the depreciation are changing. The first is that there is no effect, the second is that the effect is there but not big enough to halt the depreciation or reverse it, the third is that the effect is only big enough to halt the depreciation and the fourth is that the effect is big enough to reverse the depreciation and send the kwacha into appreciation. There is also a limit to which the Bank of Zambia can apply these measures as they can have a counterproductive effect on the economy. The other important aspect to note is that monetary policy transmission which is a process with lags as measures take full effect on the economy. Hence to have a full appreciation of what is happening, one needs to closely analyse changes in pressure points and how different economic entities react to monetary policy measures put in place. The likely scenario is that the exchange rate could have been worse in the absence of these monetary policy interventions.

ZNS officers fired for mining gold at Kasenseli

THREE Zambia National Service (ZNS) officers that were deployed to guard Kasenseli gold mine in Mwinilunga, North-Western Province, have been fired for engaging in illegal mining.

ZNS commander Maliti Solochi said there will be no sacred cows and any officer who will be found engaging in illegal gold mining activities at Kasenseli will be dismissed from the Service.

Lieutenant General Solochi said the gold in Mwinilunga is wealth for the whole nation and that ZNS will ensure that it is protected.

“If there is anyone amongst our solders is who will be caught in the web, I think such a person does not deserve to continue serving, especially under the new dawn administration,” Lt Gen Solochi said when he paid a courtesy call on Mwinilunga district commissioner Harrison Kamuna.

He said there have been accusations that ZNS officers deployed at Kasenseli gold mine have been engaged in illegal mining and that the Service’s command has not taken it lightly, hence his decision to visit Mwinilunga.

“The President has told us to be selfless, sacrifice and above all, to be honest,” Lt Gen Solochi said.

Soldiers deployed at Kasenseli gold mine are under intense temptations because they are being offered money by some people to give them access to the gold mine but they have been resisting.

He said to stop the falsehoods that ZNS officers are conducting illegal mining, the command, in consultations with relevant authorities, will extent security to all the community pits.

“People should be patient because the mine will be opened, because things must be done in a methodical way and we should not rush,” Lt Gen Solochi said.

“But I want to assure the people that Kasenseli gold is intact but what they want is we remove the troops from there so that the place remains free for all.”

Lt Gen Maliti said going forward, whoever will try to entice the soldiers deployed at the gold mine will be arrested.

Mr Kamuna said the people of Mwinilunga are looking forward to the re-opening of the mine.

He urged the ZNS to continue protecting the mineral resource for the benefit of the country.
“The men you brought on site are very disciplined,” said Mr Kamuna.

Later, Lt Gen Solochi and his delegation toured Kasenseli to check on the security situation at the three pits – Inonge Wina, Tasila Lungu and Edgar Chagwa Lungu.

Taking energy solutions directly to the people could be an immediate solution.

To reduce the cost of renewable energy.

Removing taxes on solar power pannels, energy-saving lights and batteries and promoting other energy-efficient products like cooking gas is the fastest way to resolving the energy crisis facing majority households stressed by high cost of living, lack of jobs and poverty.

In Kenya, President William Ruto has pledged to susbsidise the delivery of cooking gas and gas stoves to households in the next 3 years.

This is anoble commitment and I hope the Kenyan President will pursue and fulfil the pledge.

I have noted that ZESCO has applied to the Energy Regulations Board (ERB) and proposed a 37-percent tariff increment ina bid to attract more investments in power generation and distribution.

Now this is contrary to recent approvals by Cabinet.

The 2021 Electricity Sector Cost of Service study (COSS) commenced in December 2019 which was undertaken by the Energy Market and Regulatory Consultants (EMRC) of the United Kingdom, an independent consultant, with financing from the African Development Bank (AfDB) at the cost of US $ 592,000,

determined the revenue requirement for ZESCO.

It proposed an increase based on marginal revenue for a 5-year period.

ZESCO’s current revenue requirements

ranges was around US $1.2 billion to US $1.4 billion annually.

Maintaining the current tariffs will not yield the desired revenue requirements.

Therefore, the study determined that economic tariffs should be increased by an average of 17 percent over the next five years.

Government Green Paper on the findings and recommendations approved the average tarrif increament of an average of 17% over a period of five years.

So how can ZESCO apply for an increament of 37%! When the study proposed for a 17% increment spread over a period of five years? What has changed? Is it the recent commitments made to commercial companies willing to invest in the sector?

You cannot milk a stone simply because you want citizens to fund investors’ commercial projects that want expensive power pruchase agreements!

We are already suffering from similar power purchase agreements with independent power producers whereby ZESCO committed to buying power at 14-18cents per kilowatt while selling it to citizens and industry at a perpertual loss of 3-6 cents per kilowatt. ZESCO has been forced to be in a spiral of unending debt.

We shall oppose the 37-percent tariff increment and ensure that ZESCO sticks to approved parameters.

Ministry of Foreign Affairs tender committee wasn’t involved in procurement of property in Turkey

AN internal auditor at the Ministry of Foreign Affairs and International Cooporation has told the Economic and Financial Crimes Court that procedure was not followed in the procurement of a chancery and 11 apartments for the Zambian mission in Ankara, Turkey.

Saphira Muluti, a principal internal auditor, said the Ministry of Foreign Affairs tender committee was not engaged to procure property which would gobble massive sums, beyond the Ministry’s financial limit.

Muluti told magistrate Irene Wishimanga that in August 2021l, permanent secretary – administration Ronald Simwinga instructed her to scrutinise transactions on the account of the Zambian mission in Ankara, Turkey for any suspicious transactions.

She said upon examining the account, she established that huge sums of money were deposited in the Mission’s account to which she travelled to Turkey to conduct a physical audit and inquire about the reasons of the transactions.

“We told management we were doing routine audit of the Mission to avoid alarming the situation but the acting head of mission was informed. We found about US$7.5 million in total which was transferred. We requested for documents supporting such transactions but they said they were not given documents,” Muluti said.

She said the head of Mission produced payment vouchers and it was discovered that a chancery was purchased, to which she requested for documentation but they were not availed as procedure was not followed.

“The Mission, being under Ministry of Foreign Affairs, the controlling officer was supposed to write to the ministerial tender committee requesting it to procure the property, because it was beyond their threshold of K150, 000 and own their own. They couldn’t procure such a an expensive property,” Muluti said.

“The permanent secretary was not informed by the head of Mission about the money the Mission received for the purchase of 12 properties. The Mission did not follow laid down procedure in the purchase of the chancery and a block of 11 flats on behalf of government. They were supposed to request the ministerial tender committee at Foreign Affairs to handle the procurement.”

The witness told the court that the funds were sent directly to the Mission from the Ministry of Finance, which shows that there was no proof that the funds were approved by Parliament as supplementary funding because the purchase of property was not catered for in the 2021 budget.

For director investments and debt management at the Ministry of Finance Gregory Kabwe, he said there was pressure from Joseph Malanji (then Minister of Foreign Affairs) for the approval of payment to purchase property in Turkey.

He said Malanji advised that government obtains a credit facility but that the terms were not favourable to the government, as it was a commercial loan, which is expensive compared to a concessional loan.

Kabwe told the court that based on the series of phone calls he received from Malanji, he sought guidance from former secretary to the treasury Fredson Yamba who advised him not to proceed with the loan and advised him to comply with the directives of Cabinet, relating to the contraction of loans.

He said Yamba told him that the matter was sensitive as Malanji was not supposed to call him personally over such matters.

In this matter, Yamba is facing two counts of wilful failure to comply with the law and procedure, relating to the management of public property.

He is jointly charged with Malanji, who is facing eight counts of possessing property suspected to be proceeds of crime.

It is alleged that between January 1, 2020 and August 31, 2021, Yamba did not comply with sections 5,7,11(1),20,22,30 and 78 of the finance management Act No.1 of 2018 and Sections 4 and 41 of the public procurement Act No.12 of 2008 when he authorised the transfer of K154, 201, 197 to the Zambian Mission account in Turkey for the purchase of a chancery and 11 apartments.

Malanji is, between January 1, 2020 and August 31, 2021, alleged to have possessed two Jet Ranger helicopters BELL 206 and BELL 430, Royal Gibson Hotel, US$2115, 000, and three houses in Silverest gardens in Lusaka, suspected to be proceeds of crime.

The matter comes up on March 6 this year for Muluti’s cross-examination.

Zambian Association of Citizen Contractors (ZACCO) president Mutale Mpepo has castigated the New Dawn Administration over the negative sentiments issued against local contractors they owe money to.

Mr Mpepo has implored government to stop insulting the local contractors and begged the Hakainde Hichilema led administration to pay the contractors as opposed to insulting them.

He said this during a briefing in Lusaka today.

“Further, the negative sentiments from government over reasons such as belonging to the previous government, contractors getting paid for no work, getting advance payments and running away are making it impossible for local contractors to secure bank loan facilities and international businesses in the construction industry,” he said.

“The negative statements have disadvantaged local contractors.”

The Assocition President also complained about the mistrust government has on local contractors.

He reminded government of the many people that the construction sector employs, as a way of participating to the growth of the country’s economy.

“This mistrust that is existing from government is collapsing the sector and is against government’s own policy of employment creation,” he said.

“The construction sector in Zambia employs over 70,000 people and contributes to over 20 percent of the gross domestic product, don’t you think it requires government support? Government has a duty to protect local businesses including contractors.”

He said the foreign contractors in Zambia are still supported by their governments.

Mr Mapepo said like any other sector of the economy in Zambia, the construction sector faces its own challenges but must be supported to grow and develop capacity to undertake even bigger projects.

“For example, in the agriculture industry, farmers are supported by government through different programmes,” he said.

He stressed that it is important to note that the Zambian contractors comply to international standards that ensure that the client’s funds are secured.

The Association president said government, as a client is protected by securing its resources from abuse from contractors.

“There maybe some bad perfoming contractors yes, however most contractors comply with set standards in the execution of works,” he said.

“Standard contracts are signed between the client (government) and contractors. The client appoints consultants to supervise contractors. Consultants too execute perfomance guarantees and bonds in favour of the client to ensure smooth execution of works.”

In 2010 when white baby Nmachi Ihegboro with blonde hair and blue eyes was born to a Black couple in Britain with no known white ancestry, medical experts were amazed, and so were her parents, who are originally from Nigeria. “What the flip?” “Is she mine?” the father of the child, Ben Ihegboro, jokingly asked.

Doctors at Queen Mary hospital in Sidcup said that Nmachi is not an albino, though subsequent reports said they did not rule that out. Baby Nmachi’s parents had two Black children at the time, and so they were fascinated as they just “sat and stared” at their white newborn, they told The Sun in an interview.

“She is beautiful, a miracle baby,” Angela Ihegboro said of her daughter while the dad, who had jokingly asked if the child was really his, said: “Of course she is mine. My wife is true to me. Even if she hadn’t been, the baby wouldn’t have looked like that!”

In recent years, there have been cases of different colored twins born to parents with mixed-race ancestry. However, Ben and Angela do not have such origins that medical experts could have used to explain their situation.

So three theories were offered: Nnamchi is the result of a gene mutation unique to her, and if that is the case, she would pass the gene on to her children if she has any in the future, and they would also likely be white. The second is that she is the product of dormant white genes which entered both of her parents’ families long ago, and they never surfaced until now. And then the third — albinism.

Professor Ian Jackson of the Human Genetics Unit at the Medical Research Council explained that both parents could be carrying a copy of the albino gene that has no surfaced in any known family member for years.

“This is perhaps one of the most common recessive disorders in Nigeria, and we have to remember that it comes in different forms,” Jackson told BBC. “In Type 2 we would see creamy skin and yellow hair or light brown, which in some cases would darken with age.”

Essentially, Nnamchi’s skin could darken over time, experts believed. “She doesn’t look like an albino child anyway. Not like the ones I have seen back in Nigeria or in books. She just looks like a healthy white baby,” Ben later said in the interview with The Sun.

“My mum is a black Nigerian although she has a bit fairer skin than mine. But we don’t know of any white ancestry.

“We wondered if it was a genetic twist. But even then, what is with the long curly blonde hair?

LUSAKA – Government says it is in the process of repealing the Constituency Development Fund CDF Act number 11 of 2018 after successfully engaging stakeholders countrywide to ensure effective implementation of the fund.

This follows concerns raised by some cross sections of society on the accessibility of CDF prompting government to engage stakeholders from 13th to 28th February with an aim of ameliorating its operation.

Minister of Local Government and Rural Development Permanent Secretary in charge of administration Maambo Haamaundu says government has listened to the concerns of the people hence the consultative meetings that will culminate into enhanced CDF implementation in line with the New Dawn Government’s commitment of ensuring that decentralization is the centre of development.

Speaking this morning when he officiated at the stakeholder consultative meeting to review the Constituency Development Fund Act No. 11 of 2018 in Lusaka, Mr Haamaundu said the stakeholder meetings are important as they will ensure effective legislation that responds to the needs of the people.

Mr Haamaundu expressed optimism that the revised legislation will enhance the participation of the citizens in decision making for local government.

He revealed that the Ministry of Local Government and Rural Development sought authority from cabinet to repeal and replace the CDF Act which was granted in 2022.

The Permanent Secretary assured citizens that all the submissions made will be compiled for inclusion in the bill which will be submitted to parliament.

And Mr Haamaundu called on the stakeholders to take the meetings seriously as they provide an effective platform for a broad based and evidence-based outlook on the issue that influence CDF implementation.

The bill is expected to be tabled before parliament for consideration during the first quarter of 2023.

In the 2022 National Budget, CDF saw an unprecedented increase in the size of funding and scope for its mandate from K1.6 million to K25.7 million and a further K28.3 million in 2023.

The deputy head teacher at a named secondary school in Luanshya was this morning beaten in front of pupils after he bossly asked a teacher to clean the door way into the classroom before learners.

According to information available, Mr. Kaluba Emmanuel, a 28 year old teacher of Physical Education PE from Roan, was administering tests when the deputy head teacher dressed in a checked meroon shirt came and stood on the door step to his class and using car keys started giving instructions like he is the one who issues out appointment letters.

Mr. Kaluba remained quiet and learners were busy looking at him because he also does the same in class.

Kerfuffle was invited when the deputy head teacher before leaving asked him to clean the door step saying why do physical education teachers think everyday is sport’s day.

This did not settle well with him especially after learners stared at his name of sneakers, wornout and dirty. The entire class laughed.

He walked out of the class and followed the deputy head teacher behind like a man following the girl he loves secretly..

However, the deputy who was unaware continued to push his inflated belly slowly, until he felt something on his back, it was Mr. Kaluba pushing him using his foot muttering to himself, Kolwe iwee!

The deputy head teacher with his Vitz shaped body landed straight into sand but did not let go of his loaned car keys.

Mr. Kaluba reached for his nape and slapped the pointed back of his head countless times saying do not play with me.

When the deputy came back to his feet, teachers and pupils were already surrounding him, his shirt was halfway tacked in, the face covered in sand. He went straight into the car and drove off and some teachers were already handshaking Mr. Kaluba to mean well done, the man has troubled us alot we cannot even ask about grant then we are enemies.
The Deputy Head who suffered a serious injury on left leg during the fight, has vowed never to report for work until the DEBS transfers Mr Kaluba to a remote school as punishment for assaulting him.

Shamakamba notes that this is important because it is less costly and stolen assets can be returned to their rightful owners who are the citizens in a fair and effective manner.

He notes that Asset recovery also deprives criminals from enjoying their ill-gotten wealth.

Shamakamba says in order to achieve a zero tolerance to corruption there is need to address all the gaps that those who abuse the trust and steal from the people can hide their assets.

He however noted that the on-going training workshop will highlight key areas of asset recovery which are critical in corruption fight.

Shamakamba says the Commission is grateful to Basel Institute on Governance and the Commonwealth in building the capacity and help in asset tracing.

WHEN President addressed the Second Section of the Thirteenth National Assembly on the progress made in the application of National Values and Principles, two words stood out.

Does, nagative-cadrism and making donations to ring any bell?

Mr Hichilema presented another great opportunity for Zambia to reset.

We have been too hard on each other far too long and forgotten to press the reset button.

We are One Zambia One, Nation, and One People!

So, when Mr Hichilema said, Negative-Cadres, I sense he had coined the right terminology to describe a person who commits crime wearing a political jacket in order to protect oneself.

We have wrongly used cadre to mean; a known hooligan or violent and armed person hiding behind a political party to commit crimes.

Mr Hichilema has set the right tone for the Media by coining the term, negative-cadrism!

Negative-cadres, illegally collected Council Levy from markets and bus station.

They illegally grabbed land and corruptly sold it for personnal gain.

Negative-cadres, were champions of violence and rained terror to silence members of the community.

They rode high horses backed by Political power and Authority above the Zambia Police.

Negative-cadres, were illegally involved in mining and harvesting timber such as Muluka and Rosewood.

They got rich quick without working!

Upon taking office, Mr Hichilema banned negative-cadrism!

He was advancing positive-cadrism which is essential for Zambia’s socio-economic turn around.

We cannot allow negative-cadres to dominate our lives again!

The second important word Mr Hichilema spoke was encouraging Zambians to push the agenda of home grown solutions to issues affecting us as a people.

Mr Hichilema called on citizens to support the Disaster Management and Mitigating Unit (DMMU) in times of need such as floods.

I agree that we have gotten accustomed to thinking the DMMU has everything at their disposal to attend to any disaster in Zambia.

But Mr Hichilema challenged us to reach out to one another in times of need by making material or financial donations to DMMU or direct intervention by visiting flooded areas.

Imagine if we approached national disasters or any other national problem with the principle of insurance, regarding financial support.

In insurance the unfortunate few (those that suffer loss) are always taken care of by the fortunate majority (those who suffer no loss at all).

I was encouraged by those two important words by Mr Hichilema.

I don’t know about you.

Remember, we are forever One Zambia, One Nation, One People!

The Anti-Corruption Commission (ACC) has served Restriction Notices on properties in Balmoral Makeni belonging to Citizens First President, Harry Kalaba and Patriotic Front Presidential Candidate, Amb. Emmanuel Mwamba.

The Notices state that the action has been done under Section 60 of the Anti-Corruption Commission Act No. 3 of 2012.

The Notice also stated that after being served with the Restriction Notice the owners may not sell or dispose the property under investigations.

Citizen First President Hon. Harry Kalaba has condemned wondering why the ACC was conducting a second investigation on the property they cleared.

He said President Hakainde Hichilema was abusing Law Enforcement Agencies against his political opponents.

He said the fight against corruption will suffer when innocent people are targeted to tey silence or intimidate them.

Patriotic Front Presidential Candidate Amb. Emmanuel Mwamba said the action constituted harrasment against vocal voices.

“I was a Diplomat serving as Zambia’s Ambassador to South Africa and Ethiopia for seven years earning roughly about $10 000.00 a month in foreign service allowances.”

“I was also paid seperation benefits.”

“Before that, I was Permanent Secretary for almost five years and I was also paid a good salary and huge benefits when I was separated.”

“Before that I was Deputy Permanent Secretary since 2003.”

“I lead a decent and disciplined life. Overtime I have since built some flats for rent in Kafue and Makeni.”

“I am surprised that the Anti-Corruption Commission have turned up at my property with a Redtriction Notice without interviewing me on the sources of my income.”

“This is a clear case of abuse of the law”.

“In the last twenty years. I’ve never been involved or reported in audit querries or corruption.”

“My record is clean,clean.

Now this is purely a case harassment.

My appeal is to President Hakainde Hichilema not to use Law Enforcement Agencies to harrass and intimidate political opponents.”

“This is not a professional investigation but an abuse of the law.”

PARAMOUNT Chief Mpezeni of the Ngoni Speaking people of Eastern Province has urged politicians to embrace peace, unity and forgiveness.

And the Paramount Chief is said to have refused to meet Local Government and Rural Development Minister Garry Nkombo and his entourage Saturday morning at Laweni palace when they paid a courtesy call on him.
According to Ngoni senior chiefs and Indunas close to the developments of Saturday at Laweni, Nkombo in the company of other ministers, among them deputy speaker of the National Assembly Moses Moyo, Eastern Province Minister, Peter Phiri, Muchinga Province Minister Juma Sikazwe, Southern Province Minister Cornelius Mweetwa, Water Development Minister Mike Mposha, Small and Medium Enterprise Minister Elias Mubanga, Permanent Secretary Special Duties Patrick Mucheleka, Provincial Permanent Secretary Paul Thole and his deputy Princes Beauty Undi Phiri went to pay a courtesy call on Paramount Chief Mpezeni but the King of the Ngoni people of Eastern Province refused to meet them.
The senior Chiefs said when Mr Nkombo and his entourage arrived at the palace, Mpezeni was with Mwata Kazembe from Luapula in Mwansabombwe holding talks with other chiefs.

But when he was informed about their presence, Paramount Chief Mpezeni angrily refused to meet them, saying “Ala bauzyeni to go. I am busy.” (Tell them to go).

“Paramount Chief Mpezeni refused to meet the Mr Nkombo and his entourage. He was angry to learn that the President Hakainde Hichilema will not attend the ceremony despite Inkhosi officially inviting him on his own. You know this event was the most important one because the ceremony had clocked 40 years from the time it was revived, and at the same time Paramount Chief Mpezeni had clocked 40 years on throne, He is the longest serving Paramount Chief in the entire Zambia,” one of the Senior Chiefs said.

He explained that what was so upsetting and annoying for Paramount Chief Mpezeni was that State House on Tuesday communicated directly to inform him that President Hichilema would be available at the ceremony.
Paramount Chief Mpezeni was however infuriated after he was told on Friday night that President Hichilema would not be able make it because of the outbreak of Cholera in the province.

“Paramount Chief Mpezeni had put in a lot in the preparation to accommodate the President of the Republic of Zambia and to be told at the last minute through a press statement by Health Minister Sylvia Masebo that the President was not attending the ceremony because of Cholera was an insult to the Ngoni Speaking people of Eastern Province and the Chief himself. He did not want to have anything to do with Government officials and in fact, he did not want anyone of them to attend. That is why on Friday, the provincial administration panicked,” one of the chiefs who was with Paramount Chief Mpezeni said.

“If you saw yourself, among the delegates, we had diplomats, former Vice President of Malawi and dignitaries from Mozambique who came all the way to attend the ceremony. And for government to tell Inkhosi at the last minute that the President could not come because of cholera is an insult…,” they said.
And speaking during the ceremony which was well attended, Paramount Chief Mpezeni urged politicians to promote love, peace, unity and forgiveness in order to foster national development.

Paramount Chief Mpezeni has urged Zambians to reflect on the four decades of his rulership in order to appreciate where the country is coming from politically, socially and economically.

“The theme for this years’ Nc’wala Ceremony is love, peace and unity, this ceremony brings together not only the Ngoni speaking people of Malawi, Zambia and Mozambique but all other tribes, people from all walks of life in Zambia, African and the world over. This year’s ceremony is particularly important and special because it commemorates 40 years of the revival of the Nc’wala ceremony after a prolonged ban by the BSA during the British Anglo war which took place in 1899 and 1890 and that it is also my 40 years of being on the throne as the Inkhosi yama Nkhosi of the Ngoni people.”
“So, as we celebrate this event this year it is important that we reflect what has been done in my four decades of my ruler-ship enhance the theme 40 – 40 on the throne of peace, love and unity. I am proud to announce and confirm that I am the longest serving Paramount Chief in this country, and during this time I have served all the seven presidents of this country a rare privilege that I cherish the most,” he said through his Induna.

He said for Zambia to prosper, politicians should defend and sustain the desire of unity, love and peace for all.

Paramount Chief Mpezeni urged Zambians to learn how he managed to remain relevant in the 40 years he has been on the throne by promoting peace, love, unity and forgiveness.

“I strongly urge all politicians to defend and sustain the desire and dream of the founding father of this nation that we remain united under the slogan of one Zambia one nation. One may ask, what lesson and advice do I bring to the Zambian people after 40 years at the Ngoni throne? I have come to learn that the hope and future of Zambia lies in peace, unity, love and forgiveness. And giving thanks to God Almighty for giving us this peaceful land we call Zambia. To me this is the main secrete to the slogan of one Zambia One nation.”
Paramount Chief Mpezeni pleaded with Zambians to thrive for unity, peace and love in order for the nation to succeed.

“Zambians please always remember to thrive for unity, love and forgiveness common goal for success, we need to remain united as a people if we are to develop individually and as a whole, we need to help each other too,” he said.

He expressed sadness at the level of division, and political tension the country is experiencing created by politicians now.
The traditional leader urged political leaders to exercise forgiveness and reconcilliation and move the country forward.

“I often feel sad these days when I see political tensions, divisions, amongst you politicians but as a traditional leader with four decades of experienced on the throne my humble advice to all the political leaders is that you must be slow to anger. Be quick to forgive, learn to reconcile, and move with the spirit of one Zambia one nation,” Paramount Chief Mpezeni said.
This principle should be applied at all levels of our society. In the last 40 years I have also received messages of hope from people of Zambia from all walks of life, the church, politicians and the common man. They all seek my counsel because we are all Zambians and we live in the same space. We should therefore learn to live in peace with each other. Zambians in general wants peace, love and unity. Our political differences do not mean that we do not share and eat a meal at the same table.”

“To signify peace, unity among all our people, I propose that the great east road that leads us from Lusaka to Chipata to the boarder with Malawi, in the spirit of demonstrable unity, should be renamed Umodzi High Way,” said Paramount Chief Mpezeni.

Mr Nkombo was only allowed to greet the people after the speech by the guest of honour, King Zulu , was read by a representative.

2. And so it was that on Saturday, he went to visit flood victims in Kamwala South. As shown on his Facebook page as he live-streamed, the houses there are completely immersed in water. Under those circumstances, President Hakainde Hichilema’s Government was supposed to evacuate all the affected people together with their personal belongings, and erect makeshift tents in a dry area where these people can live until their flooded houses are dry again. That is what a responsible Government does.

3. But not with Hakainde Hichilema. He has no time or resources to actually help these flood victims. It is always about him and never about the people. All he could do was go assemble cameras to film these people who are in dire straits, and create an impression that he is doing something about their problems, then go back home and forget about them altogether. To make the selfies that he took more impactful, Hakainde made sure that he was accompanied by notable cronies such as the DMMU Coordinator and ZNS Commandant, so that the Zambian people can think he was there to help the flood victims, when in fact he was there merely to take selfies.

4. However, for the UPND Kamwala Ward Councilor Mr. Mainda Simataa who is too naive to know that his President is a pretender and has no intentions of actually assisting flood victims other than to just take selfies with them, he led a group of Kamwala South flood victims, to the DMMU headquarters to go and ask for assistance. Of course President Hichilema was non-chalant about the fact that his own Councilor had exposed him and his Government that they were failing to assist flood victims despite alot of sweet talk on television.

5. The President was swift in sending police officers to detain UPND Councillor Mainda Simataa and record a warn and caution statement against him, as well as to tear-gas the flood victims who had assembled at DMMU headquarters asking for assistance. Hakainde’s wrath did not end there, as he instructed the UPND leadership to immediately suspend Councillor Mainda Simataa from the party. And yet, the Councillor merely did his job by advocating for his constituents to be assisted by either pumping the water out of their houses or being evacuated to dry land. Is that too much to ask?

6. The question is; if President Hakainde Hichilema’s Government is failing to assist flood victims just here in Kamwala South, barely 3 kilometers from Community House where he lives, then what are the chances that he can assist flood victims in far-flung areas of the country such as Mambwe District, Namwala, Shang’ombo etcetera? Indeed, l feel pity for those who still have hope that Mr. Hakainde Hichilema means well for this country.

7. When there are drug shortages in hospitals, he assembles a camera crew, goes to Ministry of Health headquarters and takes selfies with officials there, while drug shortages continue unabated. When there is a load-shedding crisis, he again assembles a camera crew, travels to Kariba dam, and announces that the dam is leaking… at 20 liters per second!!! Personally, l will not be surprised if he soon assembles another camera crew and storms the Bank of Zambia vaults to take selfies with the Zambian Kwacha, given the rate at which the Kwacha has been depreciating of late !!!

He joined the bank in 1981 and put in unbroken service of 17 years until he retired on voluntary separation in 1998. He was paid his benefits by the bank and went away.

However, in 2006 – eight years later – he discovered that his terminal benefits which were paid did not capture the allowances. He vehemently believed that allowances should have been included in the calculations based on the directive that was given by the Minister of Finance then.

He then filed his claim before the Lusaka High Court claiming among other things recalculation of his benefits. The High Court did not agree with his reasoning and his case was dismissed.

Undeterred with the outcome, he claimed to the Court of Appeal insisting that his benefits should be recalculated to include allowances such as housing, furniture, water, electricity and fuel, among others.

On the other hand, the bank raised key points. One was that the former employee had brought his claim in Court very late – outside the mandatory six (6) years period for claims under contract. And that, in any case, he was been paid his benefits in full.

The three-member panel of the Court of Appeal analysed the facts of the case and held thus;

“It is abundantly clear from the foregoing that the time limitation on a simple contract or tort is 6 years,” the Judges observed, adding that the case at hand was filed 8 years later.

“Clearly, this falls outside the timeline as set out in the Limitation Act for a period of 6 years. It only stands to reason that the matter was therefore statute-barred,” the Judges ruled and dismissed the case on that technicality.

The Court explained that when the matter is filed outside the 6 years period, it means the Courts have no mandate (jurisdiction) to hear such cases even if they were filed in Court.

“The matter before us being statute barred made the proceedings on which it was founded to be incurably bad and could not be sustained,” the Judges said.

“In the view that we have, we lack jurisdiction to entertain the matter,” they concluded and indicated that it would be an academic exercise to even look at the merit of his case on terminal benefits.

The Panel indicated that even though the High Court had allowed the matter to be heard, the decision did not cure the proceedings.
“…the matter was Statute barred and therefore any decision flowing therefrom was a nullity,” the Court said.

Case citation – Zambia National Commercial Bank Plc v Hastings Phiri (Appeal No 69/2020). The Judges that determined the matter are Justices Flavia Chishimba, Betty Majula and Muzenga.

Who will protect citizens’s rights when Judiciary joins a Govt crusade?

When Archbishop Emeritus Telesphore Mpundu advised the Patriotic Front (PF) to stop being crybabies but instead go out and test the truth of the New Dawn government’s commitment to the rule of law, Bowman Lusambo must have taken that admonition to heart.

That should be the reason he has petitioned the Constitutional Court to consider the constitutionality of administrative creation of the fast track Financial Crimes Court, and the ease with which citizens are being deprived of property on mere suspicion, not conviction, that their assets could be proceeds of crime.

Whereas the odds may be insurmountably stacked against Bowman Lusambo, it is important that the Constitutional Court considers his petition: that is the path of constitutional development and has import for a future of enhanced protection of citizens’ rights.

And while the Constitutional Court deals with his petition, the Zambian public will be well advised not to dismiss this case as being brought by a PF politician disgruntled by loss of his parliamentary seat through a judicial process.

Rather, ordinary citizens must actually take notice of, consider for themselves and actually debate the circumstances of Lusambo’s petition, and implications of the key issues he has raised on citizens’ enjoyment of the range of rights involved in this case.

There are three major issues that Lusambo has raised in his petition, which the Court, and Zambians should look at objectively.

The first one is a concern about the manner in which the Chief Justice, by an administrative arrangement, announced and facilitated the setting up of the Economic and Financial Crimes Court at both the Subordinate Court and the High Court.

In his Petition filed on 31 January, 2023, Lusambo raises two points regarding the establishment of the Economic and Financial Crimes courts. The first one is that the instrument that set it up in the High Court did not state the composition of the Court, and raised questions whether its creation was in line with national values.

The second issue Lusambo raises for the Constitutional Court to consider is that the maters that took him to court were not financial crimes which had suddenly been thrust to be tried before a court whose jurisdiction remained unknown.

Related to this is the current ease with which Lusambo had his property restricted by law enforcement agencies, for being “reasonably suspected to be proceeds of crime”.

But perhaps the issue of greater significance relates to the developments involving President Hakainde Hichilema and Chief Justice Mumba Malila, and the content of their respective statements on this matter, which set the stage for establishment of the Economic and Financial Crimes Court.

On 10 September, 2021, President Hichilema, as Head of the Executive, during the opening of the First Session of the 13th National Assembly, in relation to this subject:
“Further, we will introduce specialised fast-track stolen assets recovery mechanisms and courts for corruption and economic crimes”.

A few months down the line, Chief Justice Malila, in a speech during the Ceremonial Opening of the High Court criminal sessions for 2022, said:

“Patriotism abhors impunity. Criminal prosecutions must be instituted against alleged wrongdoers who should be afforded a fair opportunity to answer to allegations against then. Crimes of economic nature, especially, deserve expeditious disposal because of their effect on the economy of the country. In this connection, I am pleased to announce that administratively as Economic and Frinancial Crimes Court at the level of the Subordinate Court will soon be operational. It is designed to offer specialised, fast-track court services, and ensure that, all due process requirements being observed, illicitly obtained wealth is speedily recovered and restored to the public fiscus so as to enable the government channel the resources to build that essential road, pay that old village grandmother the social cash transfer money she so badly needs, repair that collapsed roof of the old school; and stock that public hospital with essential drugs”.

Was the Chief Justice’s speech merely coincidence of objectives or was it a signal that the Judiciary had “adopted” the agenda of the Executive?

The Chief Justice moved swiftly afterwards and through Statutory Instrument number 5 of 2022, the administrative arrangement for setting up the Economic and Financial Crimes Court at the Subordinate Court.

And suddenly, matters, including that involving Lusambo, that had been commenced in the Principal Registry of the High Court were administratively transferred to the new division.

Lusambo views this development as being aimed solely at achieving the agenda of the Executive through the Judiciary, through some novel actions.

“That to my surprise the Executive began processes not known before of getting seizure notices and getting property from citizens, such as myself, and my house was seized and, to defeat any action of mine to fight such injustice, they took the matter from the Subordinate Court to the High Court under the division of the Economic and Financial Crimes Court.”

There some non-legal points that may be raised about the significance of the above developments that preceded the setting up of the Economic and Financial Crimes Court.
The President, as a politician, was essentially making a political statement with his desire to bring” fast-track stolen asset recovery mechanisms and courts for corruption and economic crimes”. It stems from desperation to find evidence of his campaign accusations of widespread corruption by the previous government.

‘Fast-track stolen assets recovery mechanisms’ also carried the strong assumption of guaranteed convictions, which may be excused only because it was uttered by a politician heading the government.
This aspect should be another reminder to Zambians of the reasons why democratic wisdom argues for a very strong and independent judiciary.

Hence the alarm that Lusambo expresses when the Chief Justice appeared to have willingly jumped behind the President in this crusade.

With a speech that had phrases such as “patriotism abhors impunity”, Chief Justice Malila could inhabit a new category for judges – Emotive Activist.

There is everything overly emotive about the rendering in the Chief Justice’s speech of what the government is supposed to do with resources.

Lusambo’s disquiet stems from what appears to be Chief Justice Malila’s obsession with recovery of funds alleged to be stolen, rather than with delivery of justice, and due process is slotted into the picture simply for political correctness.

It is Lusambo’s contention that the President’s continuous reference to Chief Justice Malila as “out Chief Justice” is clearly aimed at pushing a particular agenda to the disadvantage of himself.

In his Petition, Lusambo has also taken issue with the placing of the Judicial Service Commission under the office of the President, especially in the light of events that followed.
After new members were brought into the Judicial Service Commission, and its Chairperson, Justice Matthew Ngulube replaced with Mwikisa Mukande, on Friday, 20 May, 2022 cadres of the the ruling United Party for National Development (UPND) marched to the Lusaka Subordinate Court demanding for the overhaul of the judiciary to weed out judicial officers they said were working against the new government.

Shortly afterwards, the Judicial Service Commission transferred 10 magistrates from Lusaka, but insisted that its decision was not influenced by politics. Lusambo insists this contravened some provisions of the Constitution and was therefore illegal.

Lusambo has also submitted in his petition that the decision by the Chief Justice to set up the economic and Financial Crimes Court administratively at the Subordinate Court is in breach of Article 120 (1) – (4) of the Constitution of Zambia.

Hence Lusambo is seeking from the Constitutional Court an order and declaration that the setting up of the Economic and Financial Crimes Court administratively at the subordinate court level is a breach of Article 120 (3)(c) of the Constitution and is therefore unconstitutional and illegal.

He is also seeking an order and declaration that the transferring of 10 magistrates by the Judicial Service Commission using section 6(e) of the Judicial Service Commission Act contravenes Article 122 of the Constitution of Zambia Act number 2 of 2016.

But whether or not Lusambo gets the reliefs he is seeking from the Constitutional Court, the issues he has raised on the conduct of the President and the Chief Justice preceding the establishment of the economic and Financial Crimes Court are important. They have an element of protection of citizens’s rights against a powerful crusading Executive, especially when the Judiciary seems to be fully on board the Executive steamroller.

THE Lusaka Magistrates Court has heard that prominent businessman Harry Valden Findlay was entitled to all his three passports as they were issued legally by the Passport Office.

Assistant Registration Officer at Passport office, Kaliwile Mulenga informed Court during cross examination that that there was nothing irregular about the three passports Findlay had as they were issued by the passport office.

Mulenga who is a State witness in the matter in which Findlay is accused of holding more than one passport, said the accused was entitled to the passports as they were not canceled.

He also said that there was no evidence suggesting that Findlay was using more than one passport, adding that it was also a fact that he was holding on to the passport because when he reapplied for a new one, the passport office did not cancel or collect the other passports.

Mulenga told court that they had allowed Findlay to reapply for the new passport because he had satisfied the passport office requirements for anyone to reapply for a new passport.

He said the only time one cannot use the passport is when the passport is revoked or has its stamp cancelled, which was not the case with Findlay, adding that Passport number ZP 013259 was not cancelled or revoked.

“What about ZP 021382, was there any cancellation stamp, what about 013259, was there any cancellation?” asked Milner Katolo before State Witness Mulenga informed court that there was no cancellation on both passports.

Mulenga said, “We allowed him to apply because we were satisfied that he complied with the needed requirement for reapplication. I cannot confirm that any of the passport was irregulary obtained too. And according to the act, Findlay was entitled to have the passport in his possession.”

He said that at no time did the passport office call or summon Findlay to surrender the passports.
“We never called him to surrender any of three passports.

When one is applying for the new passport, he should reapply and attach the old one to the application which he did. And if the passport office doesn’t want the applicant to keep the old one, they will take it back from him and keep.

Two passports were retrieved the one for 2014 and 2019. ZP 032178 that is the one he is using. I was not personally involved in the issuance of the passport. I saw the passport on the day of Findlay’s arrest,” he said.

Mulenga further said the passports in question were not issued by him but by late Nkhoma and that there was no record indicating that any of the passports were cancelled.

“Zimba: You can also confirm that there was no power in this case which was executed to cancel the passport.

Mulenga: Yes your honour.

Zimba: You can confirm that you have not told the court that in the said passport there was a visa, which was expiring in ten years.

Mulenga: I have not told Court. Zimba: Do you confirm that the passport office was also aware that there were all these passports in the system all along?

Mulenga: Yes.

Zimba: Did you give a statement to the immigration; did you give the statement?

Mulenga: Yes I did.

Zimba: and when did you give,?

Mulenga: 4th October 2022.

Zimba: This was after the change of government?

Mulenga: Yes your honour.

And Magistrate Sylvia Munyinya has ruled against an application by the State to submit unsworn evidence in the same matter.

UPND spokesperson Cornelious Mweetwa says the PF regime changed the law to make asset declarations of presidential candidates secret.
Mweetwa said calls by civil society organisations for President Hakainde Hichilema to make declaration of his assets and liabilities public would not be a legal obligation but a personal matter.


“The issue I think that we have to deal with and I am happy that you are asking this question because it is something which we must look at in terms of our national interest. The issue we must be looking at is the Access to Information law because as things stand now, the information which we are talking about was declared before ECZ (Electoral Commission of Zambia) and ECZ are the ones in whose possession that information is held custody and they are the ones who know and I don’t know if you can go to ECZ and say I want to see this and if they will be able to give you that piece of information,” he said when he featured on Hot FM on Thursday. “And remember that this was a law which was changed so that only ECZ can have access to this information under the leadership of president Edgar Chagwa Lungu. So these are the effects, when you make law to suit your circumstances. You remember as a result of the calls that ‘president [Lungu] was nobody, that is the language people were using, he
had so much, he has made this much’. Then they amended the law to say that ‘now you can only declare before ECZ and ECZ keeps in confidence that information. I think there is room for us to interrogate this and we should be able going forward to see what the
people want to be done.”


Mweetwa said members of parliament declarations were being discussed by
members of the public because that was provided for under the law.
“I would like to indicate that when all the presidential candidates went to file their candidature, they had to declare their worth in terms of asset portfolios and also debt portfolios as required by law. And two, that all of us constitutional office bearers, within 30 days of our assumption to office, we declared what we were worth and what our liabilities are and named them,” he said.


“And fortunately, we have a President who has never worked in government. This is the first time he is working in government and one year five months down the line, this is a President who does not know what a pay slip looks like because he has never been paid a salary. He has already worked for himself but those calls from some society groups cannot go ignored. They are not legal but they are part of social censure of public transparency in terms of government but those are issues which for now I cannot begin to say, the
President will do this, the President will do that. If there were a requirement at law, I would be magnanimous because when you are in leadership you are guided by what the law says and not what an individual wants but if you are going to ask someone to do something as a way of feeling, whether he feels can do it or not, it is personal. I think I cannot talk more on that basis. I would have spoken more if it was a legal requirement.”


Mweetwa said whether President Hichilema should make his asset declaration or not was a personal decision.
“It is interesting and I would like to answer it in a very honest way. It is something that could be of interest to the people of this
country to know but one which is not a legal requirement. So for that reason, that is personal. I cannot speak on something which requires a personal decision to be made as opposed to meeting a legal requirement. That is what it is but we are in leadership and when people talk, we listen. We have heard,” he said. “Give me time, next time I appear on the show bring that topic I think I should be able to be on firm footing on the same.”


But the host insisted that Mweetwa puts a timeframe to his promise to come back with an answer.
“I like your insistence to timeframe, this is good accountability. Well, give me one month. Is that okay because I know that in the next one month, there will be at least two Cabinet meetings which will give me the opportunity to interact with the President,” he said.
Mweetwa however said the declarations in question can be sought through the
Supreme Court “for now if justification for accessing the same is made”.


“What you are asking that the President should do actually was already done at law, those are in public domain. If you go to the
Supreme Court today, you will find a declaration form today where President HH filed in to say ‘this is my net worth’ in terms of assets, this is my debt portfolio. That information is already in public domain and that is why you find that even president Edgar Lungu, people were able to say he had declared ‘K2 million now he is worth
23 million’. It is because of the declaration which was given,” he said.


Queried again on why people would be demanding information if it was readily available, Mweetwa said, “for President HH to have qualified to be President he needed to have declared to which he did. He did that unless you are saying the President now should pull out that file to say ‘this is how much I declared in 2021 and this year I am worth this much’. Is that what you are asking?”
Mweetwa said corruption in public was being met with zero tolerance posture by the UPND.


“That is why you have seen that even people who are in government, being political appointees of the President or civil servants, once you violate the law then the law takes its course. That was one of the promises the President made,” said Mweetwa.

FORMER Central Province deputy permanent secretary Patrick Mwanawasa says the UPND have got good policies, but should have been packaged differently during campaigns.


“But the fact of the matter is that giving campaign promises and what you find [in government] is something totally different. Maybe they could have packaged their message to the people differently,” he said.
Mwanawasa said it would take time for economic fundamentals to trickle down.


“It will take time for these fundamentals to trickle down to the people of Zambia who have been down this route before. In 1974 when we had the first IMF programme under Dr Kaunda, we were told to implement a programme under the IMF. That programme was not successfully implemented and we had challenges…” he said when he featured on Diamond Live on Wednesday. “So, to really ask us what is our view as to whether the UPND government actually has the people’s best interest regarding the people’s standard of living is rather premature at this stage in time because we would expect that maybe the people of Zambia would respond to the policies or would respond the promises which the UPND government were elected into office in 2021.”
He said the UPND has good policies.


“I think the UPND government did not appreciate what they were going to find when they formed government. The UPND have got good policies, that I will not deny. But the fact of the matter is that giving campaign promises and what you find is something totally different. Maybe they could have packaged their message to the people differently. And the way FTJ and MMD packaged their campaign promises whereby people of Zambia ‘are you ready to sacrifice’ because we are going to go into government and when we go into government we have to make your lives better but you have to sacrifice.

Maybe they (UPND) could have gone that route,” Mwanawasa said. “But it is a matter of packaging your campaign promises. The packaging of the campaign promises could have been bad, but the truth of the matter is that this country finds itself in a very precarious situation. It finds itself in a condition whereby it will not take a year, it will not take two years, it will not take three years, maybe four years for it to at least get to a trajectory which the people of Zambia aspire for it to be.

This (IMF package) can be the panacea to the economic challenges if the new dawn administration sticks to the policy arrangements of what the IMF has given us. I’ll go back to what I mentioned about the first programme in 1976, it was badly implemented because there was no effort at all from the UNIP government. And we didn’t do well and from there again there were problems…”
Mwanawasa said he has noted political will from President Hakainde Hichilema to fight corruption.


He said the corruption fight has always been an audit against previous administrations in all the successive governments and not a witch hunt.


“He puts political will towards the fight. Yes we have seen a bit of political will from the President and the new dawn administration but a lot more can be done. It has always been fight against or should I say an audit against previous administrations. It is not a witch hunt at all, but it is always about the fight against the happenings which happened in the previous governments,” said Mwanawasa. “From Dr Chiluba’s time against UNIP, from [president Levy] Mwanawasa’s time against Chiluba’s administration, from Michael Sata’s time against Rupiah Banda and Levy Mwanawasa’s tenure. There has always been that thing that when you fight against what happened in the past it is a bad culture because it goes against the tenets of humanism, which is espoused and again on the other hand it is relevant because we need to at least make our leaders accountable for the happenings, for the things which they did whilst they were still in power. Those who are against the fight against corruption will say it is not a good policy to undertake but I do believe that it is actually necessary because we need to hold our leaders accountable because the issue of national development actually comes to be compromised by people who tend to be corrupt. Because when you become corrupt, the people who suffer are the masses. What is important is the political will from the Head of State to ensure that this scourge is at least managed or fought with the vigour which one represents of their administration.”

A Teacher only identified as Chileshe of a named school in Luapula Province was last year in October caught having sexx with a named Grade 11 pupil in the HOD’s office in the afternoon by some pupils who reported the matter to the Head Teacher and her uncle.

Her uncle and her relatives approached the Head Teacher with the intention of reporting the matter to police but the Head Teacher pleaded to the point of kneeling down.

Pregnancy test was done and the young girl was found to be 2 months pregnant and her teacher in question accepted responsibility as he is the one who broke her virginity. He also said since he started going out with the named pupil, he has never used any protection.

In the secrete meeting, the teacher told the Head Teacher, the Deputy, his HOD and 8 family members on the girl’s side that he was forced to have sexi with the girl because she used to sit careless in class whenever he was teaching them Maths. Family sources to the named girl say the matter has not yet been reported to police because the Head Teacher is trying by all means to protect her teacher as he is reportedly extremely hardworking and royal to her.

The girl who lost her mother in 2014 is reportedly vulnerable and her guardians seem to have withdrawn plans to report the case to police after receiving K24,800 down payment from the teacher who borrowed part of the money from the school with the help of the named female Head Teacher.

And when asked by the girl’s guardians why he decided to sleep and impregnate the 16 year Grade 11 girl (now Grade 12), the Maths secondary school teacher expressed deep regret and explained that the temptation came about because of the careless way the girl was sitting in class coupled with her short skirt.

Some of the girl’s family members are however not happy with the decision of senior family members not to take the matter to police because the teacher who defiled and impregnated her is already married to a fellow teacher with two children.

The Zambian government has finally approved the National Pension Scheme (Amendment) Bill of 2023, to the excitement of teachers across the country. The bill will soon be published and introduced in Parliament, following Cabinet approval.

Currently, the National Pension Scheme Authority (NAPSA) is perceived to increase poverty among teachers, and many educators have expressed their opposition to the way it operates. Retired teachers are denied lump-sum pension benefits, which can lead to destitution after years of hard work. However, the new bill seeks to amend section 19 of the current NAPSA Act, to enable teachers to receive part of their savings as pre-retirement benefits after serving for ten years.

According to the National Action for Quality Education in Zambia (NAQEZ), the pre-retirement benefits should not be pegged at 20% of one’s contributions to NAPSA, as this would be insufficient for most teachers to invest meaningfully or build houses. Instead, the proposed law should allow NAPSA members to withdraw 50% of their contributions.

NAQEZ believes that if the new law is well implemented, teachers will retire with handsome amounts of money, compared to the current arrangement where NAPSA only gives small monthly allowances as pension. They describe the current system as unfair, counterproductive, and meant to punish its members.

The new law, if passed, will not only benefit teachers but also enable them to venture into viable businesses and build decent houses without getting into expensive debts.

The Executive Director of NAQEZ, Aaron Chansa, expressed confidence that the National Assembly would pass the bill, and the Republican President, Mr. Hakainde Hichilema, would cement his friendship with teachers in Zambia.

In addition, NAQEZ welcomes the approval of the Examinations Council of Zambia Bill of 2023 by Cabinet. They are pushing for the new law to squarely place the Examinations Council at the center of running examinations so that teachers who manage these exams can be motivated and allowanced. They believe it is unfair not to motivate teachers who spend hours running national exams. The new law should also incorporate civil society into the new Council since national examinations are public services, critical to the education system and command public interest from all stakeholders.

The Zambian government has a golden chance to correct the historical injustice and make the pension scheme fairer and more beneficial to teachers. The passing of the bill will go a long way in improving the welfare of educators in the country.

Chalimbana University caretaker caught watching pupils in ablution block

POLICE in Chongwe have detained a care taker at Chalimbana University who was allegedly found peeping at female pupils who were bathing at Mukamambo Secondary School.

The girls who amidst heavy rains left the door to the ablution block open as they thought no one would go outside because of the rains.

Whilst they were bathing, Micheal Daka allegedly sneaked into the neighboring school and started peeping at the naked girls whilst fondling himself.

But some members of the public who noticed him touching his private part whilst looking at the girls ablution block pounced on him and took him to Chalimbana Police Station, where he was detained.

The suspect was in police custody from Saturday to Monday when he was released by police.

But when contacted for a comment, Zambia Police Deputy spokes person Danny Mwale who confirmed the arrest of the suspect said Daka was released on grounds of insufficient evidence because the man was only relieving himself.

“When police interrogated the suspect, they discovered that he was only urinating and was since released on insufficient evidence,” said Mwale.

And confirming the trend, Mukamambo School Authority said this has been an on-going occurrence for years.

A source from the school management who sought anonymity said the school has been trying to find ways of apprehending the suspect.

“This issue started many years ago, when I went to the school, I found the story. Last time we sent people to look for him but no one knew him until last Saturday when members of the public caught him while peeping at the girls and took him to the police. This case is at the police and the suspect will appear in court,” the source said.

A Grade 11 pupil said around 05:30 hours, she was among the pupils who woke up early to prepare for the day.

She said it was raining heavily and the girls were scared and decided to leave the door open as they thought no one would go outside.

“As we were bathing, we hered noise outside and one woman came inside and told us that we should be locking the door and that there was a man who was peeping while we were bathing. We ran outside and saw it was the care taker at the University and he was being beaten by six people who took him to the police” she said.

Another pupil said it was not the first time that someone was peeping while they were bathing.

“On Saturday, we were bathing and I saw someone but I did not pay much attention because of the rains and am sure he noticed that one of the girls saw him and wanted to hide. When we noticed someone saw him, after some time we hered noise and when we went outside, we saw people beating the care taker who had his zip on the trousers open and dragged him to the police while beating him,” she said.

A civic leader who spoke on condition of anonymity said he received information that the suspect was caught peeping at girls who were bathing at the Secondary School.

“According to what I was told, the suspect made it a habit to peep on the girls while bathing and Saturday, he was bot not lucky to go free. He was apprehended by members of the public who took him to Chalimbana Police, “ he said.

The civil leader said there is urgent need to put up a wall fence at the school if the girl children are to be protected.

EU sanctions Wagner subsidiary following investigations by CNN

Following a CNN investigation into the group’s operations in July of last year, the European Commission sanctioned a Russian individual and Meroe Gold, a subsidiary of Russia’s Wagner Group, for assisting the exploitation of Sudan’s gold resources.

According to a statement posted on the EC’s legal platform EUR-LEX on Saturday, the EU named a Russian national named Mikhail Potepkin and Yevgeny Prigozhin’s Wagner Group subsidiary in Sudan, Meroe Gold, listing them “for serious human rights abuses, including torture and extrajudicial, summary or arbitrary executions and killings, in several countries, including Sudan.”

“Mikhail Potepkin is the director of Meroe Gold, a front company for the Wagner Group’s operations in Sudan, and is involved in the activities of M-Invest, Meroe’s parent company. He has a leadership role in the Wagner Group in Sudan and has close ties to Yevgeny Prigozhin,” according to a statement from the European Council.

A CNN investigation last July was the first to expose the mechanism by which Wagner and Meroe Gold were operating in Sudan, circumventing US sanctions on the group.

Multiple interviews with high-level Sudanese and US officials and troves of documents reviewed by CNN last summer painted a picture of an elaborate Russian scheme to plunder Sudan’s riches in a bid to fortify Russia against increasingly robust Western sanctions and to buttress Moscow’s war effort in Ukraine.

The evidence also suggested that Russia colluded with Sudan’s beleaguered military leadership, enabling billions of dollars in gold to bypass the Sudanese state and to deprive the poverty-stricken country of hundreds of millions in state revenue.

In exchange, CNN’s investigation found, Russia lent powerful political and military backing to Sudan’s increasingly unpopular military leadership as it violently quashes the country’s pro-democracy movement

Despite Yevgeny Prigozhin’s denials, the European Council has now confirmed CNN’s findings, stating that Meroe Gold continued to operate in Sudan as a “hedge for the Wagner Group’s operations” via a Sudanese shell company.

“Through its affiliation with the Sudanese army, the Wagner Group has secured the right to mine Sudanese gold and export it to Russia,” the Saturday statement by the European Council said.

British lady who joined ISIS loses her plea for UK citizenship

The appeal against the decision to revoke Shamima Begum’s British citizenship was denied. Shamima Begum, then 15 years old, departed the United Kingdom to join ISIS.

After a five-day hearing in November during which her attorneys claimed the UK Home Office had a duty to look into whether she was a victim of trafficking before stripping her of her citizenship, Judge Robert Jay issued the judgement on Wednesday.

If Begum’s citizenship was revoked legally is what is decided in the judgement, not whether she can go back to Britain.

Begum, now 23 and living in a camp in northern Syria, flew to the country in 2015 with two school friends to join the ISIS terror group. In February 2019, she re-emerged and made international headlines as an “ISIS bride” after pleading with the UK government to be allowed to return to her home country for the birth of her son.

Then-Home Secretary Sajid Javid removed her British citizenship on February 19, 2019, and Begum’s newborn son died in a Syrian refugee camp the following month. She told UK media she had two other children prior to that baby, who also died in Syria during infancy.

Begum’s lawyers criticized Wednesday’s ruling as a “lost opportunity to put into reverse a profound mistake and a continuing injustice.”

“The outcome is that there is now no protection for a British child trafficked out of the UK if the home secretary invokes national security,” Gareth Pierce and Daniel Furner, of Birnberg Pierce Solicitors, said in a statement seen by UK news agency PA Media.

“Begum remains in unlawful, arbitrary and indefinite detention without trial in a Syrian camp. Every possible avenue to challenge this decision will be urgently pursued,” it continued.

Rights group Amnesty International described the ruling as a “very disappointing decision.”

“The power to banish a citizen like this simply shouldn’t exist in the modern world, not least when we’re talking about a person who was seriously exploited as a child,” Steve Valdez-Symonds, the group’s UK refugee and migrant rights director, said in a statement.

“Along with thousands of others, including large numbers of women and children, this young British woman is now trapped in a dangerous refugee camp in a war-torn country and left largely at the mercy of gangs and armed groups.”

“The home secretary shouldn’t be in the business of exiling British citizens by stripping them of their citizenship,” Valdez-Symonds said.

Javid, the home secretary who removed Begum’s British citizenship, welcomed Wednesday’s ruling, tweeted that it “upheld my decision to remove an individual’s citizenship on national security grounds.”

“This is a complex case but home secretaries should have the power to prevent anyone entering our country who is assessed to pose a threat to it.” Javid added.

Begum has made several public appeals as she fought against the government’s decision, most recently appearing in BBC documentary The Shamima Begum Story and a 10-part BBC podcast series.

In the podcast series she insisted that she is “not a bad person.” While accepting that the British public viewed her as a “danger” and a “risk,” Begum blamed this on her media portrayal.

She challenged the UK government’s decision to revoke her citizenship but, in June 2019, the government refused her application to be allowed to enter the country to pursue her appeal.

In 2020, the UK Court of Appeal ruled Begum should be granted leave to enter the country because otherwise, it would not be “a fair and effective hearing.”

The following year, the Supreme Court reversed that decision, arguing that the Court of Appeal made four errors when it ruled that Begum should be allowed to return to the UK to carry out her appeal.

Begum was 15 when she flew out of Gatwick Airport with two classmates and traveled to Syria.

The teenagers, all from the Bethnal Green Academy in east London, were to join another classmate who had made the same journey months earlier.

While in Syria, Begum married an ISIS fighter and spent several years living in Raqqa. Begum then reappeared in al-Hawl, a Syrian refugee camp of 39,000 people, in 2019.

Speaking from the camp before giving birth, Begum told UK newspaper The Times that she wanted to come home to have her child. She said she had already had two other children who died in infancy from malnutrition and illness.

She gave birth to her son, Jarrah, in al-Hawl in February of that year. The baby’s health quickly deteriorated, and he passed away after being transferred from the camp to the main hospital in al-Hasakah City.

In response to that news, a British government spokesperson told CNN at the time that “the death of any child is tragic and deeply distressing for the family.”

But the spokesperson added the UK Foreign Office “has consistently advised against travel to Syria” since 2011.

MY life is in God’s hands because it is evident that there are some people who are trying to kill me, former Lusaka Province Minister, Bowman Lusambo has said.

Mr Lusambo in an interview said there were two people who trailed him in Kabwe after featuring on a radio programme at KNC Radio.

He said God was his only protection at the moment because some people wanted to eliminate him.

Mr Lusambo said the criminals were obviously infuriated by the fact that he stated facts on the programme and that this might not have sat well with some individuals who in the process decided to cause harm to him

He narrated that upon noticing the suspected criminals trailing him, he decided to park his vehicle at his friend’s lodge in Kabwe for about 40 minutes.

Mr Lusambo said after some time, he left the lodge and was shocked that the two people continued following him.

He said it was at this point that he decided to stop and that he was shocked that the two strangers also parked their vehicle about 100 meters from where he was.

“I was forced to approach and confront the individuals and in the process managed to get pictures of them and even the number plate of the vehicle they were driving,” he said.

Mr Lusambo said he later drove to Kabwe Central Police were he filed a complaint and said he was happy with their professionalism.

“The criminals were after our lives for well over two hours following us behind and they only retreated when I went to lodge a complaint at Kabwe Central Police to the regional Police Commissioner over their continued pursuit. Our team managed to capture images of the criminals who were driving avehicle registration number AHB 8123,” he said.

He said he did not understand their intentions but that no amount of intimidation, threats or harassment would deter him from speaking for Zambians.

Mr Lusambo said he would continue to speak for Zambians and that they could not hinder or deter him form executing the wishes of the citizenry.

He challenged his detractors to stop threatening his life because he had not committed any crime or offence.

Hichilema’s Appointments and illegalities

When President Hakainde Hichilema appointed his first Cabinet Ministers, he also created new ministries, abolished some and re-aligned others.

He proceeded to appoint new Ministers to fill those portfolios and scheduled a day for the swearing ceremony.

However, this action of creating new ministries required parliamentary approval and stakeholders and constitutional lawyers expressed immediate surprise that President Hichilema was not alerted to this non-negotiable constitutional requirement.

Many people of goodwill forgave the President for this constitutional breach as he was deemed new and may not have had prior experience with the public service and governance.

The transition was also blamed for the lapse and gaps.

However, it became clear that President Hichilema would not adhere to enhancing the Constitution and good governance tenets when he appointed politicians to positions of public service.

President Hichilema appointed UPND Deputy Secretary General, Patrick Mucheleka as Permanent Secretary in charge of Special Duties at Cabinet Office, and officials from Alliance partners; NDC Vice President, Josephs Akafumba as Permanent Secretary at Ministry of Home Affairs and Internal Security, and Thabo Kawana from MDC as Director Spokesperson, a newly created position at Ministry of Information and Media.

Despite protestations from all stakeholders that President Hichilema was politicizing the civil service and had reneged on his earlier stance that he would promote a non-partisan public service, he gave the concerns a deaf ear.

Since then, things have gone south as the public service has experienced a literal purge with officers accused of being members of the Patriotic Front removed from their positions, retired in national interest, fired or packed at Cabinet Office.

Cabinet Office and PSMD is said to be holding up-to 300 senior public officers removed from their positions and sent home and whose fate remain unknown.

Sadly and in many cases, their replacements have not inspired professionalism or absence of accusations of nepotism, tribalism, cadreisms and favoritism.

This takes us back to the mischief and vices being seen to be repeated that Zambians had felt would be behind us after the August 2021 General Elections.

For Mr. Clayson Hamasaka and Mr. Thabo Kawana, it appears that the President created special positions and never subjected such positions to competition and formal procedures.

A new position in the public service requires development of the job description, ranking, stricture and qualifications as developed by Management Development Division (MDD), structure created and placed in Government approved Establishment by Public Management Service Division (PSMD) and Treasury Authority sought to enable budgeting for emoluments and allowances for the position or office, from the Secretary to Treasury.

Positions are not created for individuals, rather positions are created for whoever could qualify to hold such a position. Is it a Ministry? A Department? A Directorate? A Section? Or does it fit in already existing establishment?

For the appointment of Mr. Clayson Hamasaka, I am one of those that have called for a vibrant communication structure at both State House and Ministries. I have called for dynamism to respond to the current challenges driven by the new media and social-media.

I have called for communication specialists that should involve social-media experts, digital media designers and other support services to meet information management required in the information age.

Old formats and structures may require radical reforms to meet this new dynamic changes.

But that is not to say that constitutional and legal procedures may be abandoned or may be deemed expedient in order to carry out these reforms.

They say to change the Constitution, requires that you follow its own guidelines provided in how to reform it…

The Constitution calls for the President to perform his duties and exercise his powers with dignity, leadership and integrity.

Further the President’s powers exist in a legal ecosystem of the Constitution, subsidiary laws, rules, regulations and practice.

The President may bring his own style and leadership approach but he is not expected to depart from the law or break the law in the discharge of his duties.

Below are the constitutional provisions in relation to the powers of appointment.

92. (1) The President shall perform, with dignity, leadership and integrity, the acts that are necessary and expedient for, or
reasonably incidental to, the exercise of the executive authority.

(2) Without limiting the other provisions of this Constitution, the President shall—

(a) appoint ambassadors, high commissioners, plenipotentiaries,
diplomatic representatives and consuls;

(b) receive and accredit foreign ambassadors, high commissioners, plenipotentiaries, diplomatic representatives, consuls and heads of international
organisations;

(c) negotiate and sign international agreements and treaties and, subject to the approval of the National Assembly, ratify or accede to international agreements and treaties;

(d) establish, merge and dissolve Government ministries, subject to the approval of the National Assembly;

(e) appoint persons as are required by this Constitution or any other law to be appointed by the President;

(f) appoint persons as are required to perform special duties for the Executive;

(g) confer honours;

(h) sign and promulgate proclamations as specified in this
Constitution or as prescribed;

(i) initiate Bills for submission to, and consideration by, the
National Assembly; and
