Why Zambia’s Debt Restructuring Deal is delayed: Here is how to fast track it

Zambia’s economic recovery program is based on an IMF deal and the restructuring of the country’s $17.3 billion debt. There is no question that Zambia’s debt restructuring talks are not going on as well as was expected. The deal has been delayed, and the target of 2022 year end for the signing of the non-legally binding Memorandum of Understanding (MOU) between Zambia and the Official Creditor Committee (OCC) members, has been missed. And already, the delay is affecting the country’s currency. The Kwacha has been depreciating against the dollar almost every day for two months now. And it is at its weakest in nearly a year as talks drag on with no end in sight.

There is already some finger pointing between the West and China. Their rivalry is on public display, which is not beneficial to Zambia at all. Both the US Secretary of Treasury and the World Bank President have blamed China for the delay in the talks.

During her recent visit to Zambia, the US Treasury Secretary Janet Yellen urged Zambia’s creditors to work quickly to restructure the country’s debts, and accused China of obstructing the deal.

“It’s critically important to address it right away,” Yellen told the Press in Lusaka. “It’s taken far too long already to resolve this matter. I am encouraged that progress may become possible shortly. I know that the Chinese have been a barrier to concluding the negotiations.”

The Head of the World Bank, David Malpass, was in agreement with Janet Yellen. He also accused China of delaying Zambia’s restructuring, and asked them to stop making unfeasible demands.

“China is asking lots of questions in the Creditors’ Committees, and that causes delays, that strings out the process,” He said in an interview with Bloomberg News. “It’s important for them to be focused on getting to an actual debt restructuring where the burden can be lightened for Zambia.”

The Chinese Embassy in Lusaka, Zambia, on the other hand, has accused Washington of meddling in the restructuring talks of a Sovereign State and in the process risking the success of the talks.

“The biggest contribution that the U.S. can make to the debt issues outside the country is to act on responsible monetary policies, cope with its own debt problem, and stop sabotaging other sovereign countries’ active efforts to solve their debt issues ,” The Embassy Statement said. “For Zambia’s debt related to China, China has been active in co-chairing Zambia’s Official Creditor’s Committee under the G20 Common Framework and working hard with other parties to seek a sustainable solution in line with the principle of common actions and fair burden-sharing. China’s efforts have made some positive progress. We look forward to U.S.’s constructive role in the process.”

The reality on the ground is that Zambia’s debt restructuring talks with creditors are very complex. In order to understand why there are delays, one requires some knowledge of the variables at play.

WHAT ZAMBIA DEBT RESTRUCTURING ENTAILS

The pandemic increased the risks of emerging economies defaulting on their debt, and so the G20 devised the “Common Framework for Debt Treatment” in 2020 which included China so that it could participate in international debt-relief negotiations. Zambia was the first country to apply for the Common Framework Program in February, 2021.And after clinching $1.3billion deal with IMF in December, 2021, the IMF asked bilateral and private lenders of Zambia to restructure its debt.

In simple terms, as part of the debt restructuring process, Zambia is asking bi-lateral and commercial lenders to consider the following: cancel US$8.4 billion between 2022 and 2025 as per IMF recommendation, extend repayment periods, get rid of penalties on arrears and reduce in interest.

WHY IS ZAMBIA’S DEBT RESTRUCTRURING DEAL DELAYED?

Zambia’s first Official Creditors Committee (OCC) meeting was in June, 2022 with China and France as Co-Chairs, but progress of the talks since then, has been very slow, and the end of year (2022) target for signing an MOU was missed.

The number one factor which has contributed to the delay of the deal, is that Zambia borrowed from a multiplicity of lenders which makes the deal complex and difficult to come to some agreement. The portfolio of lenders according to the Ministry of finance include the following: official bilateral creditors (15 percent), multilateral (11.5 percent), Eurobond investors (11.7 percent), non-bonded commercial lenders (11.4 percent) and Chinese commercial and state-owned lenders (about 30%). In the 5 years from 2012 to 2016, Zambia contracted 72 loans worth $9.6 billion, with $3 billion Euro-bonds. The others were with the World Bank, Africa Development Bank, Banks in India, South Africa, the Arab World, Bank of China, Chinese Exim bank, Chinese development bank.

The second factor is that China is new to international debt restructuring, and so it has been on a learning curve, whereas the Paris Club of Official bilateral creditors has taken years to develop their debt relief processes. Zambia’s debt restructuring negotiations have challenged the Chinese lending model. China is not in the habit of cancelling concession or commercial loans but prefers lengthening repayment periods and varying interest rates but the G20 Common Framework demands haircuts.

The third factor for the delay is the fact that Zambia’s debt restructuring negotiations have far reaching implications for the many players involved, and to be affected. Zambia is the first applicant to the Common Framework, which means that it could be used as a template for future debt restructuring. The consequences of whatever comes out of the Zambia restructuring talks, makes it bigger than just a single country deal. China in particular, is concerned that after lending an estimated hundreds of billions to African countries – $125 Billion between 2006 to 2016- in the last two decades, she does not want to set a precedent where it will face numerous demands to cancel debts.

There is another important factor that is being underplayed in the debate and analysis of the reasons for the delay in concluding the deal. The delay in the negotiations is mainly influenced by the stealth economic and diplomatic “war” that is going on between China and the West, which this Author wrote about two years ago. It is only the naïve, who don’t understand 21st Century geo-politics, who can think that China’s current behaviour at the OCC restructuring talks is not influenced by Zambia’s perceived change of foreign policy. The overarching reason for the delay of the deal, is the geo-political and economic rivalry between the West and China, with China flexing its muscles to delay.

As for the nature of the deal, what has clearly come out from observing the restructuring talks from a distance, is that, the deal that is likely to emerge is not what the IMF, World Bank and the Parish Club originally envisaged, nor what Zambia and the public expected. The expectation was a deal on similar lines like the 2000s Highly Indebted Poor Countries (HIPC) and the Multilateral Debt Relief (MDR) programmes from which Zambia benefited. It is very apparent from the available information that China has had its way in the Zambian restructuring talks with other OCC members. China has always insisted on bilateral negotiations with debtor countries instead of participating in multilateral restructuring efforts. Zambia will, therefore, have to bilaterally negotiate with China for any binding restructuring deal, rather than the one imposed by the Bretton Woods institutions and the Paris Club. The current talks will not result in any binding agreement. The process that has been agreed upon in principle, is that Zambia and the Official Creditor Committee (OCC) will sign a legally non-binding Memorandum of Understanding (MOU), which will set out the key parameters of Zambia’s debt restructuring terms. Thereafter, Zambia will start bilateral negotiations with each of the official creditors for restructuring deals, while concurrently negotiating with private sector creditors as well.

HOW ZAMBIA CAN FAST TRACK DEBT DEAL

At the moment, the signing of the MOU is pending due to some seemingly inexplicable delaying tactics and changing of goal posts by China, through some unfeasible demands. And if the MOU is to be signed before the end of March, 2023 (first quarter), when the next review of Zambia’s IMF programme is due, then Zambia would need to immediately directly engage China at the highest level.

The majority of experts on Zambia-China relations argue that the most effective strategy to speed up Zambia’s debt restructuring deal is an urgent face to face meeting between President Hakainde Hichilema and President Xi Jin Ping. The Zambian President’s State Visit to China and a meeting with President Xi, is the single most important act that can unlock Zambia’s debt restructuring deal. The visit will remove the current wrong perception that Zambia has abandoned our forefathers’ tried and tested foreign policy of non-alignment. Zambians should not be naïve to think that the IMF, World Bank and the USA will deliver the debt restructuring deal on their own in good time.

The purpose of the visit should be anchored and couched in the recalibration of Zambia and China’s relationship following the change of leadership in Zambia. The suggested meeting should be about the pursuit of common interests which can help Zambia solve its economic problems and accelerate its economic growth through better utilization of the huge Chinese market and Zambia’s huge agriculture and natural resource potential. As part of the recalibration process, China could be asked to help Zambia with its fight against corruption and strategies to mitigate adverse effects of climate change. China could then be asked for help with the elephant in the room – the Common Framework and Debt Restructuring deal. It is very apparent that some of the demands that China has been making at the debt restructuring talks are part of the West – China rivalry, in which Zambia is a mere pawn. Among the key demands that China is making are the following: One, Beijing wants multilateral development banks like IMF and World Bank to take losses in the restructuring process ; two, China is requesting Zambia’s local currency debt held by foreigners to be included in the deal, but experts say reworking the local debt is not feasible. Zambia has to lobby China to drop these impossible demands.

The recent experience of Australia in dealing with China, has demonstrated the power of face to face meetings. Zambia can learn from it. The meeting between the new Australian Prime Minister, Anthony Albanese and Chinese President Xi Jinping on the side-lines of the G20 meeting in Indonesia, resulted in the start of the process of unlocking the $20 billion Chinese trade sanctions. China imposed export sanctions on Australian exports of coal, wine, beef, seafood, barley which cost Australia $13 billion a year and loss of jobs and tax revenue. Bilateral relations soured after Australian’s former Prime Minister Scott Morrison demanded an independent investigations on origins of the pandemic in 2020; and the same year, China imposed crippling sanctions on Australia.

US COOPERATION AND NOT CONFRONTATION

The second strategy that should be used to ensure the restructuring deal is sped up, involves the United States of America. If indeed the USA wants to help Zambia, they should adopt a strategy of cooperation with China and not confrontation. China under President Xi Jinping, is now a more assertive and coercive country. China is now an economic super power, who cannot easily be bullied and pushed around. It demands respect commensurate with its economic, diplomatic, political, technological and military power in international affairs. It is, therefore, in the best interests of the Zambian restructuring deal, if the USA adopted a non-confrontation and diplomatic approach in dealing with China.

There has been some disquiet in some Zambian circles about the apparent impression and perception that has been created, that Zambia has impliedly outsourced lobbying for the debt deal with China to USA and Institutions like IMF and World Bank. The Zambia China Friendship Association in a rare statement, expressed its concern about the USA’s apparent meddling in Zambia – China relationship.
“Zambia is a sovereign state which does not need another government to speak for it, particularly where China is concerned. In case, some people have forgotten, the relationship between China and Zambia has a long history of mutual solidarity which successive Zambian leaders, including the New Dawn Administration of President Hakainde Hichilema, have acknowledged. If it is felt that there is a glitch in resolving the debt restructuring issue, there is nothing stopping the Zambian authorities to engage their Chinese counterparts at the highest level to smoothen the path. We are confident that the Zambian government is well aware of this option and we would be surprised if they are not utilizing it,” The Zambia China Friendship Association (ZCFA) said in a Statement by Dr. Fredrick Mutesa.

CHINA’S ECONOMIC POWER

In order to put Chinese economic power in context, it is important to note that China has billions worth of trade and investment relationship with countries in Asia, Africa, South America and Europe. China, for example, is Australia’s biggest trading Partner. It accounts for 32 per cent of Australian exports which amounts to $153.2 billion; Japan with $296.9 billion; India with $77.7 billion, Brazil with $67.7 billion; German with $256.7 billion trade volume. In terms of its financial muscle, China’s two major policy banks: China Development Bank (CDB) and the China Exim Bank (China Exim) are among the major development finance institutions in the world, and have made China become the largest source of official development finance in the World. The China Development Bank has a balance sheet of more than US$2.4 trillion as at the end of 2017. China has lent the World USD2.2 trillion which is 14 per cent of its GDP. These numbers gives China huge leverage on most countries in their decision making process and creates a certain level of dependence due to the volumes that China generates. The U.S cannot compete with the aforementioned numbers.

CONCLUSION

There is empirical evidence to support the assertion that Zambia’s relationship with the USA and China is not an either or situation. Zambia needs both countries.

“Zambia’s economic relationship with both China and the U.S. is not zero-sum, as both countries make meaningful contributions to Zambia’s economic growth. Zambia has to leverage its relations with the two economic powers in order to achieve synergy,” Major Mubita Oliver Mubita wrote in his Masters of Military Art and Science degree thesis, for the Faculty of the US Army Command and General Staff College.

The Zambia -USA relationship is anchored on improvement of health, education, economic development and democratic governance for the people of Zambia, whereas that with China’s has been based on trade partnership, source of investments and development finance for infrastructure development.

The consequences of failure of the debt restructuring deal, are too ghastly to contemplate. The economic recovery and the Presidency of HH largely depend on its success. If the talks fail, Zambia will struggle to pay its debt, unable to free up resources for social spending (health, education and poverty programs); and unable to attract investors, finance to help improve the economy. There will be higher youth unemployment, increased poverty levels and a higher risk of political instability.

The Zambian government needs to act now, by taking necessary steps that are required to consummate the deal. The time for depending on the West for this deal to is long gone. The answer to finalizing the restructuring of Zambia’s debt lies in the East. Timing and urgency is of essence.

STUDENT LEADERS SPEAK AGAINST TRIBALISM

STUDENT Union leaders from the University of Zambia (UNZA) and Evelyn Hone College stood as one and spoke in unison to urge political leaders to desist from promoting tribalism and other activities that will divide the national and hinder national development.

The student leaders have also disclosed plans of developing a national movement in order to curb tribalism and and threats to the nations unity.

UNZA Student Union vice president Evelyn Mkandawire said youths are concerned about the divisive nature likely to disrupt the country’s “One Zambia, one nation motto”

She further called on youths to join the anti-tribalism movement and become action oriented to work with leaders on best ways to develop the country rather than “criticising and support things that will not move this country forward.”

Evelyn Hone College President Reagan Mpundu said there are political leaders that are trying to take advantage of the transfer of Former Presidential spokesperson Anthony to Tanzania as deputy high commissioner by insinuating that he was transferred due to his tribe so that they can gain political milage.

“We will in the next few days petition the head of state over the need for law to be strengthened against those who preach tribalism,” Mpundu added.

And UNZASU academic minister Josephat Nyirongo said if their is political instability in the country, young people are more vulnerable to political instability, hence leaders should play clean politics so that the youths could also emulate them.

Nyirongo therefore urged the public to reject and condemn any political leader that wants to sow the seed of division.

Meanwhile UNZASU information minister Sydney Mushili urged Government to intensify and work around the clock to curb their past and present corruption.

And UNZASU minister of finance Ndanji Mfula commended Government for providing and open civil space where youths can air out their views and for the opportunities they have provided this far.

A TWENTY-seven year old man of Lusaka’s Ng’ombe Township has gone to prison with one final word to the judge, “she trapped me!”.

Condemned to jail for two long years, Mathews Mtonga during mitigation in Lusaka Magistrates Court stuck to his guns proclaiming before the law that he was no sexual predator or rapist but that the woman, three years older than him, that he is accused of attempting to rape cooked the story to cover herself to her husband after neighbours caught them in a compromising position.

In this case, Mtonga was jailed despite telling the court that, he and the woman in question, met at a bar and opted to have sex at the woman’s home as the husband was confined to police cells.

By his account, unfortunately as they were about to put skin-to-skin, nosy neighbours popped up. To cover herself, the woman let out a mother of screams and other theatrics claiming she was about to be raped and apprehended Mtonga whom they handed over to the police.

As for the 30-year old woman, she alleged that on the material day, her husband had assaulted her and she reported to Ng’ombe Police Station.

However, the police answered with their usual ’tilibe transport’ (we don’t have transport) line and asked her to catch the abusive husband herself and bring him to the station.

In her narration, the woman alleged that it was at that time that somehow she opted to engage a stranger and non-police officer Mtonga who apprehended the husband and took him to police.

The bizarre tale goes further that later, as they returned from depositing the husband in cells, Good Samaritan Mtonga turned into a monster and demanded for sex, and when his advances were rejected, he attempted to force himself on her hence her screams and neighbours intervening.

Faced with two equally interesting narration of events leading to the scream session, Magistrate Idah Phiri concluded that was sufficient evidence against to Mtonga and subsequently condemned him to a 24-month stay in prison.

In her judgement magistrate Phiri noted that cases relating to sexual assault were on the rise and jailing Mtonga would sound a warning to would be offenders.

THE ORIGIN OF ‘H’ IN TONGA NAMES

Many people have wondered why Tonga is the only tribe in Zambia with most names start with H. Have you ever asked yourself this question: why?

If you wondered, don’t put on an apparel of stress. Know it that you’ve discover all what you wanted in this article. I am going to tell you something which you’ll never hear from any Tonga apart from me. You hear it today from me and never again.

Examples of Tonga names that start with H:
1. Habeenzu
2. Hakalyamba
3. Hamoonga
4. Hamapande
5. Hakainde
6. Hamweemba
7. Hangoma
8. Halyapanga
9. Habazoka
10. Hamududu etc

Nothing that happens without any sound reason.

Let me fly you back to 1623. Southern province that time looked like a national park. No school, no church, no market, only trees and small villages. They didn’t have permanent shops to buy clothes from. They mostly depended on mobile sellers who would sell everything from one place to another.

In 1623, 19 June, came from America a white man, Frank Douglass, who began to teach young children how to read. For the love of education to the people of southern, Douglass talked to elders of most villages, starting from the east which is Sikalongo village, Mwiinde village, Sakalyati village, Nangoma mubotu village up to Delemuka village of head man Moonga, the most feared witch in southern province who boasted himself as Chienda usiku whose head looked like a drum of local wine known as seven days with eyes like a surprised Lusaka prostitute, very short but stubborn.

Marrying a girl from the head man’s village, one needed to pay 15 cattle, 10 females and 5 males. Marrying the head man’s daughter, the professed lover would pay 20 cattle, 13 females and 7 males. It’s for this rationale that tongas have had many cattle from time immemorial. Now, they don’t keep as many cattle as centuries back because lozis attacked them, fought them, defeated them, grabbed over 75% of their cattle and wives. These guys were so rich in cattle that one chap, no matter how foolish he was, could marry up to 10 or more wives. They couldn’t pay money, but cattle as dowry. They bore beautiful daughters because of mabisi. It’s for that reason that they produce most beautiful women in Zambia.

That aside, Douglass was given a farm in Shimabala village and 400 cattle. In order to appreciate them, he told them he would be thrilled to see their children know how to read and write. He chose among them valiant men who would go to America to study that when they would return, they would teach their communities how to read and write.

By that time, there was no name starting with H. 5 men were chosen:
1. Mweemba
2. Beenzu
E. Lwiindi
4. Moonga
5. Basimbi
6. Malambo

They travelled to America. When they arrived there, they received the shock of their lives. They saw many different people most of whom were whites. Tall buildings left their mouths widely open that even if a fly wanted to enter their mouths, it would enter without any single problem. By that time there were no modern cars. Mostly were wagons driven by horses.

The only thing they suffered was to speak English.
Douglass’s wife, Michelle Douglass, welcomed them and gave them a room each one of them where they would spend all the days of their stay in America.

When they would see something that would surprise them, you would hear them, “Ha! Moonga, kobona chi building echi. Ha, chipati!”
The word ‘Ha’ was always heard whenever they would see something astonishing beyond their understanding.

Every morning, Mrs Douglass would greet them going from room to room, “Hi Moonga,” “Hi Mweemba!” “Hi Beenzu,” just like that!

The word ‘Ha’ is used to express fear 😨 or surprise 😯.

When they returned from United States, they began to go round teaching people how to read and write.
When they would tell their story about the things they saw in United States, the word ‘Ha’would always be used before anything or before a name of a person. For example, “Ha! Mweemba, did you see that?” “Ha, Moonga, that was amazing!”

Especially these guys who went to America, the word ‘Ha’ was on their lips most of the time. And you know how people are. They name or nickname people according to the things they like doing or saying.
If you are a tailor, they would call you Mr Tailor. If you are a shoe repairer, they will call you Mr Shoe Repairer. If you like responding “Sure Sure”, they will be saying, “I’m going to see Mr Sure Sure,” just because you like using that word. That’s how a human being is.

Likewise, these Tonga American dudes were nicknamed Ha.
You would hear them say, “I’m going to see Ha Mweemba or Ha Lwiindi.”
If you see one of them passing, you would say, “Ndababona ba Ha Beenzu.

As the days went by, that sounded like a name: Ha Mweemba, Ha Lwiindi, Ha Beenzu, Ha Moonga, Ha Basimbi. As the passage of time, as that sounded like a full name yet the ‘Ha’ was just a nickname, people couldn’t trace or know that it was just a nickname, they began to use it thinking it’s a name. And when writing, the space between Ha and the name was ignored. For example, instead of Ha Mweemba, they would write Hamweemba, Hamoonga, Habasimbi etc.

That’s why today, you find that most names have ‘Ha’. Then you would wonder. This is how it came into existence. These guys are capable of stealing any name from other tribes and add Ha and it will sound Tonga. For instance, Ngoma is a name from Chipata. They would get it and add Ha before it and it will be Hangoma. N’gandu is also from Chipata. They’ll add Ha and it will be Hang’andu.

And then, as they were being greeted by Mrs Douglass every morning, Hi, they developed it as a habit. You would hear them, “Hi Moonga,” “Hi Mweemba.”

So all this was developed and added to their names. Instead of Hi Moonga, a greeting they heard from a white person, they wrote it as Himoonga. They would steal names from other tribes and add Hi to it and it will sound Tonga. For example, Monde is a lozi name, they would get it and add Hi and it will be Himonde.

Previously, there was nothing like Hamweemba, it was Mweemba. Nothing like Hamoonga, it was only Moonga. Know these things.

So that’s how Ha and Hi in some Tonga names are found— were gotten from a surprise (Ha 🫢 🙀) and from a mere greeting ( Hi 👋). There’s no way all the names are “Haharing.” It doesn’t make sense at all. That’s why today we have people with such names: Minivah Halyapanga , Candy Himoonga , Chrispin Hamapande , Mutinta Cecilia Hankede , to mention but a few. 😂 😂 😂 😂🤣😂🤣😂🤣😂🤣.

HH Has Instructed Police To Lock Me Up – Kambwili

HH HAS INSTRUCTED POLICE TO LOCK ME UP – KAMBWILI

Opposition PF presidential candidate Chishimba Kambwili has accused President Hakainde Hichilema (HH) of having instructed the Police to lock him up.

And Kambwili has revealed that President Hichilema has called him twice threatening him of being arrested.

Kambwili in a live address this evening on his Facebook page monitored by Zambian Eye said the police were looking for him today.

He said the police has a call out for him but didn’t find him at home for him to report at the Police Headquarters tomorrow.

Kambwili said President Hichilema is now using the police to intimidate his political opponent. He said the police are under instructions to arrest him and keep him in custody without taking him to court just like Chilufya Tayali.

The PF Vocal leader says President Hichilema is accusing him of promoting tribalism. He revealed that President Hichilema telephones him Friday night but he missed his call. He explained that President Hichilema then left a message on his phone that he hopes he knows that promoting tribalism is a crime.

Kambwili explained that he then telephoned President Hichilema challenged him to explain on his allegations in a telephone call that last for 45 minutes. He said President Hichilema referred to Simon Mwewa’s video where he was accusing Kambwili of promoting tribalism.

He said he explained to President Hichilema that he had actually condemned the people that were chanting tribal remarks when they visited his house. He challenged the President to watch the footage.

Kambwili said at the end President Hichilema agreed that it was a misunderstanding. This was after President Hichilema also brought the run upto 2021 elections campaign where he accused Kambwili of having campaigning against voting for a Tonga person for the presidency.

He said he explained that what he was campaigning against was the voting pattern of the people of Southern province.

Kambwili he was today surprised that the Police were after him saying it was clear they were under instructions from President Hichilema.

He said the first time President Hichilema telephoned him and threatened that he would in problems he may fail to come out over his stance on AFRICOM.

Kambwili said it is clear President Hichilema was trying to intimidate him. He vowed to never to stop talking and dared the police to arrest him.

He said he had been arrested over 16 times and at one time jailed for 18 days. He said he was ready to meet Hichilema in court.

GOVERNMENT says the decision by China to open its economy to the world has resulted in a high cost of fuel on the international market and Zambia in particular.


Addressing the media this afternoon during its monthly fuel pump price review programme, Energy Regulation Board (ERB) Board chairperson, Reynolds Bowa said the increase in oil prices during the month of January, 2023, was as a result of rising travel demands from China’s reopening of its economy.


“The increase in oil prices during the month of January, 2023, was attributed to optimism about the rising travel demand from China’s reopening its economy and continued sanctions on Russian products. In addition, reduced supply of petroleum products on the market is anticipated owing to limited refinery outputs as most refineries are expected to conduct their scheduled maintenances during the first quarter of 2023,” Bowa said.


Bowa also attributed the increase in fuel pump price to the depreciation of the Kwacha against major foreign currencies.
According to the ERB board chairman, the Kwacha depreciated against the dollar from K17 to K18.


“During this price review period, the exchange rate depreciated from K17. 61 per dollar to K18. 90 per dollar representing 7.33 percent. The depreciation was mainly attributed to extended time line in the discussion to restructure the external loans, resulting into reduced supply of foreign exchange on the market against increased demand. The combined effects of the two factors which the exchange rate and the international oil prices has resulted in the upward adjustment in the prices for petrol, diesel, kerosine and jet a1 which were all above the 2.50 percent wholesale price trigger band,” he said.


He said that effective midnight petrol will now be selling at K27.73 from K24.49 per litre, while diesel will now cost K29. 25 from K26.44.

When he was in Davos at the World Economic Forum where he was representing President Hakainde Hichilema, our Minister of Finance and National Planning Situmbeko Musokotwane gushed with self-importance and satisfaction at the fact that Kristalina Georgieva, managing director of the International Monetary Fund, would be visiting Zambia.

Musokotwane made it very clear that the very busy IMF managing director Kristalina Georgieva would not waste time visiting Zambia if Zambia was “not doing the right thing”. Musokotwane said high profile personalities would continue to visit Zambia because, once again, Zambia has progressive and bright prospects for cooperation and economic transformation. We have since hosted Kristalina Georgieva and of course US Treasury Secretary, Janet Yellen. These are indeed two of some of the very powerful women in the world today. Both are extremely important to the global capitalist finance system. They share the responsibility of ensuring the global financial system is stable, healthy, and that nation states, banks, money and profit mongers all behave in ways that sustain private accumulation of money and wealth, especially for US big corporations.

Situmbeko Musokotwane is therefore right in a sort of perverted sick sense: Hakainde Hichilema, Musokotwane and the UPND government, for the first time in the history of Zambia, are openly for, and advance the interests of banks, money and profit mongers above all else. They are doing everything they can to make Zambia “attractive” to foreign money, something they share in common with Janet Yellen and Kristalina Georgieva. They are doing “the right thing”.

Unashamedly and in the presence of the media, Musokotwane perfectly explained the essence of the UPND “economic policy” when he was welcoming US Treasury Secretary Janet Yellen:

“It is our wish that investors come. I want to appeal to you that in the manner of cooperation, what I am saying means that we reduce gradually, the issue of begging and giving, and promote the issue of investment, self-reliance and so forth. So we hope we can convince the American corporations and American investors to look at the positive strides that are being made in this country to come and take advantage of the profit opportunities,” Musokotwane said. “We want companies that come here to make profits because if they do not make profits, they cannot sustain jobs, they cannot pay taxes, they cannot be useful to us. So, tell them out there that in Zambia there are opportunities for making big money and then they must pay some tax. The amount of money they will make in profits exceeds the taxes they will have to pay.”

Musokotwane, feeling very proud of himself, obviously. There were a few chuckles at this blunt appeal for foreign money to come and loot and plunder us. As I watched this extremely humiliating performance by Situmbeko Musokotwane in front of an individual responsible for the world’s largest and most rapacious armed capitalist economy and state on earth, I cringed inside myself at the naivety of the grovelling and self-ingratiating quality of the performance by our Minister of Finance and National Planning. Janet Yellen knows the history of US slavery, the struggle to nearly exterminate native Americans, the American Civil War, US colonialism and how inevitably the racist US capitalist class grew to produce some of the world’s most cunning, ruthless, exploitative capitalists and oligarchies who have sustained the US as the world’s economic and military nuclear supper power.

True American rapacious capitalists do not need a petty lecture from Zambia conveyed to them through Janet Yellen, to decide whether Zambia was ripe for their financial invasion! Besides, Janet Yellen, the US Embassy, USAID office in Zambia, US AFRICOM Office, the IMF and World Bank and the bevy of US spies and their friends in Zambia know far more about Zambia than Situmbeko Musokotwane ever will, actually!

We have been here before, like a lonely aging male or female prostitute out in the cold night of Lusaka streets in June, hoping that a sex buyer will see the prostitute’s offerings and choose him or her, in a street clogged with other younger, more attractive prostitutes. All the while, the prostitute is fully aware how precarious, dangerous, unpredictable and thoroughly unreliable the trade of prostitution is. There are bad and good days, mostly bad, these days. The children and other dependents at home depend absolutely on the fortuitous whims of those who pay for, and consume, the services of prostitutes to eat, have a place to sleep and hopefully children continue going to school too.

In this day and age, as major world geopolitical and economic changes take place, amidst the most obvious signs of the terminal collapse of the global capitalist system as we have known it, no sane politician in any government can rely on phantom, fictitious foreign “investors” especially from the US, to pull an impoverished country such as Zambia is, out of its poverty, and to develop it. HH, Musokotwane and the UPND leadership are completely out of sync with the global economic and political tectonic shifts currently under way. Done, Musokotwane sat back in his chair, quite exhausted, but happy he had done a great job, and listened to the very brief response from Janet Yellen!

Both HH and Musokotwane lamented and begged these two very powerful women to get the stalled Zambian debt restructuring process “unlocked” and concluded expeditiously, as this was holding back the expected influx of foreign money for private profits, into Zambia. Hakainde Hichilema moaned that the delays in concluding the debt negotiation processes threaten to undo the “stabilisation” work his government has secured so far. Both HH and Musokotwane know and made it very clear to these two powerful women in the world of global capitalism that Zambia has done everything it was supposed to do, and was now waiting for others to do their bits.

Both powerful women made inconsequential noises to get our creditors to move a little bit fast, and get done what needs to be done, for Zambia to get the debt relief it is begging for, by punishing poor Zambians with severe austerity measures.

The bitter truth is no one on earth today can command our complex composition of creditors to quickly take a haircut and lose some of their anticipated massive profits on the money Zambia borrowed, and set another precedence that a poor country can somehow, under the supervision of the IMF, escape paying its full debt, that easily. Again the naivety, all round, of such an assumption is breath taking, especially in the current problematic global economic and political environment. This explains why Zambia is almost alone on this chaotic debt restructuring “programme”. Many countries are watching us, and hoping to learn vital lessons from our very green and naïve politicians, in the UPND government.

A pathetic effort was made to humanise the IMF, sanitise it, and distort Zambia’s relationship to the IMF and our history with it, especially by Hakainde Hichilema and Kristalina Georgieva herself. In classic lying HH form, Hakainde strained himself to persuade Zambia that it is a misconception to think that the IMF is a difficult organisation, that it does not help countries to succeed, that the IMF is actually not a “foreign” organisation, that it is not an entity owned by certain people. This man deserves an Olympic Gold Medal for distorting reality, for lying! HH says we own the IMF. He says the IMF is our creation. The IMF works for us. Unbelievable! HH lives on another planet, as yet undiscovered.

Zambia has an insignificant share in the IMF, around 0.22 per cent, which means its votes virtually count for nothing, which is why it is none other than the current General Secretary of the UN who has called for reforming the IMF and other global financial organisations similar to it, because they are controlled by a few powerful countries to the great detriment of consciously impoverished and underdeveloped countries such as Zambia. The US in fact has effectively the power of veto on all major decisions of both the IMF and World Bank.

But it is the deliberate ignoring, distortion and sanitisation of our history with the IMF which perfectly confirms whose interests HH and his UPND government are serving: global money mongers and private profiteers, and therefore the IMF which regulates their financial conduct! The IMF is also responsible for our historic poverty levels. This evidence is all over the internet.

Zambians who care to know and truly love Zambia must ask whether they want to continue to pretend that in HH and the UPND we have a genuine Zambian government!

R. Kelly pending sex abuse charges dropped by Chicago prosecutor

Chicago prosecutors will no longer pursue the pending sexual assault cases against R. Kelly.

Cook County State’s Attorney Kim Foxx announced Monday that her office will move to drop the 10 counts of aggravated criminal sexual abuse at a hearing on Tuesday, citing the disgraced singer’s previous convictions, high cost of prosecution, and limited resources.

According to WGN-TV, the decision to drop the charges was prompted by the 30-year prison sentence that Kelly is currently serving after being found guilty in his federal sex trafficking case in New York. He also faces additional time for his conviction in his federal child porn trial in Chicago.

“Mr. Kelly is potentially looking at a possibility of never walking out of prison again for the crimes that he’s committed,” Foxx said. “This office, in the pursuit of justice for the victims in our indictment as well as those across the country, worked tirelessly to get us to this point. While today’s cases are no longer being pursued, we believe that justice has been served and the sentences that have already been handed down to Mr. Kelly, as well as the sentence that will come down next month.”

In February 2019, a Cook County grand jury indicted Kelly on 10 counts of aggravated criminal sexual abuse involving four alleged victims, three of whom were underage. The alleged incidents all occurred between 1998 and 2010.

Foxx spoke with each of the four alleged victims before deciding to drop the charges. She also said she was confident that her office would have secured convictions if the four cases proceeded to trial.

“We brought the charges believing that we had sufficient evidence to support findings of guilt in the court of law,” Foxx said. “That’s why we brought them.”

In September, a federal jury in Chicago convicted Kelly on three counts of child pornography and three counts of enticement of a minor to engage in criminal sexual activity. He will be sentenced on Feb. 23.

Kelly is also facing charges of engaging in prostitution with a minor and soliciting a minor for sexual purposes in Minnesota.

Soon we will be told by the UPND Government to start using bicycles because fuel is expensive, Patriotic Front Acting President Given Lubinda has said.


Hon Lubinda said this in reaction to the Vice President’s statement encouraging Zambians to start eating roller meal because it is more affordable than Breakfast Mealie Meal.
He said the New Dawn Government must stop playing with the Minds of the Zambian people who would want to see a drop in the prices of the commodities.


Hon Lubinda said Roller Meal is still expensive as it was K110 as at August, 2021 but has skyrocketed to K180.
He has described the response as a Simplistic approach of the UPND government to the vexing challenges of the ever-increasing cost of living.


“Vice president Mutale Nalumango has told us that those of us who cannot afford the price of breakfast mealie meal should resort to eating roller meal because it is cheaper adding that by the way it is also more nutritious, This is the simplistic approach of the upnd government to the vexing challenges of the ever-increasing cost of living.


“As at august 2021 the average cost of a bag of breakfast mealie meal was k 135 and that of a bag of roller meal was k110. As of today, breakfast is selling at k 240 per bag whereas roller meal is selling at k 180,” he says.


He said as far as the new dawn regime is concerned, the fact that people cannot afford the cost of electricity then they should shift to charcoal for cooking and paraffin lanterns – (koloboyi) – for lighting.


Hon Lubinda said it would not be surprising for the current Government to encourage people to consult diviners and bush doctors because people cannot afford to buy medicine.


‘‘This unfortunately is what we have ended up with when Zambians voted for people who claimed to be angels. We have fixers who have turned out to be mixers – dribblers who have no clue about governance. These are the same people who have told us that they are increasing commodity prices so that they can come and reduce them late,’’ he said.


Meanwhile, Hon Lubinda said while Zambians are being subjected to wallowing poverty, President Hakainde has decided that he shall work from outside Zambia and only be in Zambia when he is transiting from one country to the other.


“He will only be in Zambia to change suitcases. Since being elected 17 months ago he has made 31 foreign trips and has only attracted 2.5 billion dollars we are told by one of his advisors. This is almost two trips per month. He is the one who promised that he was to run a frugal government yet only 7 foreign heads of state have made bilateral state visits to Zambia.. ,” he said.

Banking on his massive ministerial successes, former Lusaka and Copperbelt Provinces Minister Hon. Bowman Chilosha Lusambo has implored President Hakainde Hichilema to lend him three months as the Head of State.

Hon Lusambo is optimistic that in the three months that he has asked for, he would do wonders for majority citizens.

The former Minister boasted of his managerial skills when president Edgar Lungu appointed him as Copperbelt Minister and eventually Lusaka Province Minister.

His call on the Head of State to lend him three months follows the escalated cost of living, which is contrary to what President Hichilema promised the citizens prior to the 2021 general elections.

The majority Zambians who bought the campaign promises premised on fixing the economy are now living in abject poverty.

The President seems to be doubling the things that he condemned in the PF as seem from the many foreign trips that he has so far done with little economic bearing.

Due to his love for self-praise and less actions, some stakeholders have insinuated that the “methodical” President Hichilema would have made a good lecturer.

And Hon Lusambo made a call in question when he featured on 5FM’s “Burning Issues” program today.

“So ndefwayako ba President ba Hakainde banjashimeko Ichalo for three months. Three months ukunjashimako Ichalo as President. Nga babwela three months bakesa njeba ati Bowman twalilila, nauchishungulusha Ichalo, bonse imwe kuti muletota fye. President Lungu gave me Copperbelt Province, the heart of the economy of this country when it was very critical. I went there, I turned the province around. The boss came, he looked at me and laughed. He brought me here in Lusaka,” he said.

“Ba Chief Justice, Irene Mambalilima (the late) called me and said Bowman, I was very excited when I heard that you have been transferred into Lusaka, I was jumping. I knew that Lusaka will now change. I told her that I would try. We turned Lusaka around. Zambia is about Lusaka and Copperbelt.”

Meanwhile, Hon Lusambo indicated that due to the fact that he managed Copperbelt and Lusaka Province which he said were key provinces in the country’s development, he cannot fail to take care of the country.

“If I managed Lusaka and Copperbelt I can’t fail to run this country, bufi sana. Ubufi ubukulu sana. These two provinces are critical to the governance system of this country. I managed. That is why ba president Edgar Changwa Lungu balinsunga for five years. Ba president Edgar Lungu balentuma ine ku China, nabanandi. Kabiyeni, kasambilileniko nafimbi. Twabwela, twaisa mukuchita implement,” he said.

“2021 or 2022, we were supposed to be in #Russia because the Russian Federal Government invited Lusaka Province and other to go to Russia. The cooperative program that you are seeing was initiated by Russia. It will never work in Zambia unless we train our people and we can only train them from Russia. Even Kaunda copied this concept from Russia.”

Emerged hate speech arrests jeopardize the benefit of repealed criminal defamation of the president

President Hakainde Hichilema has repealed the criminal defamation of the president, which is a good thing, but the effects of its absence are being jeopardized by the emerged hate speech arrests.

On 26 December 2023, three days after the defamation of the president law was abolished, a Zambian by the name of Allan Phiri was arrested for hate speech. He is heard on one of the recorded voices in a local language saying only a full can agree that HH is performing well.

Mr. Phiri spent six days in custody. Meaning he celebrated the first day of 2023 (New Year) in police custody.

On Sunday, January 29, 2023, Economic and Equity Party (EEP) leader Chilufya Tayali was arrested for the offense of Hate Speech, contrary to Section 65 of the Cyber Security and Cyber Crime Act No.2 of 2021.

Between January 1st and the day of his arrest, Mr. Tayali is alleged to have posted on social media platforms various inflammatory remarks. It is alleged he had been insulting and accusing people of being used by the new dawn administration.

Chimbwi pakulila nishi pali uko ashintilile. Will leave it for Bembas to help you with the meaning. It appears the new dawn administration has abolished criminal defamation law because they have Cyber Security and Cyber Crimes Act 2021 in place.

This must be repealed as well. May never happen if pressure is low. Zambia is under a leader acting out of force even on his own promises.

If it weren’t for pressure, the defamation of the president law would still be here. In March 2022 Amnesty International Secretary General Agnes Callamard had to fly to Lusaka to persuade Hichilema to move with speed to honor his promises, which include criminal defamation of the president law.

Nine months later, President Hakainde Hichilema succumbed to pressure. On December 23, 2022, he abolished the defamation of the president law. Zambians may have to go through the same for the Cyber Security and Cyber Crimes Act 2021 to be repealed.

Whatever it will take the law must go. Hate speech arrests are jeopardizing the benefit of the repealed criminal defamation of the president law in the country.

President Hakainde Hichilema has undertaken over 30 trips in 16 months.

Just in January 2023 alone, President Hichilema took trips to Abu Dhabi, United Arab Emirates, Luanda, Angola, and Dakar, Senegal.

He was just fresh from returning from the USA-African Leadership Summit hosted by President Joe Biden and held in Washington USA.

The trouble with taking every trip that you are invited to and fail to delegate is, when the trip of importance that the President can’t miss comes along, no one will appreciate or understand its significance or importance.

He just appears to be a Kamwendo Munjila!

President Hichilema is the Incoming Chairperson of the SADC Organ and he will be taking over from South Africa’s Cyril Ramaphosa.

Namibia is hosting the Extraordinary SADC Organ Troika Summit.

The gathering started with a meeting of senior government officials, and was followed by ministers.

The Organs’ Incoming Chairperson and Outgoing Chairperson are expected to present their reports at the summit

There are secuirty concerns in Eastern DRC/Rwanda, and continued insecurities in Cabo Delgado in Northern Mozambique.

Further political tensions are rising in Zimbabwe, Eswatini, Madagascar and the DRC which countries have elections due this year.

The region is also facing storms, droughts and floods and has affected food security and energy security and many countries are facing the worst period of electricity load-shedding that may threaten economic and industrial growth.

Therefore an emergency summit has been called to discuss issues relating to politics and the security situation in the region.

King Mswati III has delegated the trip. In his place will be the Kingdom’s Prime Minister, Cleopas Sipho Dlamini, who will deliver a report on the security situation in Eswatini.

The SADC Organ on Politics, Defence and Security Cooperation was established in 2001 as an Institution responsible for promoting peace and security in the regionIt is managed on a Troika basis and is coordinated at the level of Summit, consisting of a Chairperson.

SADC is a Regional Economic Community comprising 17 member states in Southern Africa.

CONCLUSION

As Incoming Troika Chairperson of the SADC Organ on Politics, Defence and Security,this is meeting Zambia and President Hichilema must attend.

But becuase he has previously undertaken trips that he should have skipped or delegated, few appreciate his frequent foreign visits, especially with an economy in dire straits and a people facing the highest cost of living witnessed so far.

SHOULD TRIBE BE THE TALK WHENEVER SOMEONE FROM THE NORTHERN BLOCK GETS FIRED OR REDEPLOYED TO SOMEWHERE ELSE?

It is really sad that most politicians in Zambia have for a long time been using the notion of tribe to advance their political agenda. What makes it even more sad is that these political leaders are very much aware of how tribalism can be deadly to a society, but they decide to have it as a tool to advance their political interests.

It is a well known fact of how the immediate past government, the Patriotic Front, sidelined other ethnic groups in the appointment of ministers, permanent secretaries and other senior government officials.

Even then, when the Patriotic Front was in government, its senior government officials peddled lies of the dangers that would come with the ushering in of the United Party for National Development into government. They de-campaigned the main opposition political party on tribal lines, without considering how so much unfair they were in their political appointments, where over 90% of government appointments were drawn from the northern block.

Against all odds, the United Party for National Development was ushered into office by the Zambian people. This brought in some fresh air never experienced in the country’s political space in a decade of the PF being in government. Among them was that ministers, permanent secretaries, commissioners and other senior government officials appointed were drawn from across the ten provinces of the Republic of Zambia.

The foregoing assertion is going to be substantiated with some practical example of those who were appointed in different government institutions. This is because a well balanced appointment of cabinet ministers is there for every Zambian citizen to see and judge for themselves.

When the Republican President, Hakainde HICHILEMA appointed Gilbert phiri as Director General of the Anti-corruption Commission, before being appointed as Director of Public Prosecution, none of these opposition political party leaders congratulated him on his appointment.

When Mary Chirwa was appointed Director of the Financial Intelligence Centre before being appointed Director General of the Drug Enforcement Commission, they were quiet. None of them commended the President for having recognised Mary Chirwa’s hard-working character through that appointment. Instead they tried to bring her down through propaganda.

When Dingani Banda was appointed as Commissioner General of the Zambia Revenue Authority, none of the opposition political leaders congratulated him for his well deserved appointment.

Patrick Kangwa was recently appointed as Secretary to Cabinet. This was a man who worked with the former government, the Patriotic Front. Even then, the Republican President overlooked that and decided to work with him. None of those accusing the government of being tribal have so far congratulated the highly experienced man for his well deserved appointment.

When Chileshe Kangwa and Chama Fumba, alias Pilato, were appointed as Permanent Secretaries for the Ministry of Sports and Arts, in spite of the two men’s vast experience in the arts industry, the people who today are labeling this government being tribal could not congratulate them for their deserved appointment. They were quiet.

When Moses Jere was appointed as Permanent Representative to the United Nations, they were quiet, not even one congratulated him.

When Elias Munshya, who is Ushi, was appointed as High Commissioner to Australia they were quiet. This is one man with a very rich curriculum vitae. None of them congratulated him for his well deserved appointment.

The foregoing examples and many others not mentioned did not attract any positive comment from the opposition political parties.

So now the question is, should the talk only be there when someone from the southern block is appointed or when someone from the northern block is redeployed or demoted?

Should the talk only be there when someone from the northern block is being investigated by the Law Enforcement Agencies for corrupt practices? This already shows how tribal those advancing this narrative are.

We really feel for the youth, the future leaders of this country because very few of today’s politicians are worthy drawing inspiration from. Very few of them have the interest of this country in their hearts.

We would like to state, in conclusion, that the opposition political parties should offer credible checks and balances to the government. They should desist from spreading information meant to divide the people of this country. We encourage them to move beyond tribal lines in their politics, as this is not adding value to the country’s political space. If this will help, let them take a break from active politics so that they can go and have an introspection of themselves. Let them go and reflect the kind of Zambia they would want to leave behind for their children. Maybe that quiet moment will help them come back as inspiring figures to the young men and women of this country.

LUSAKA – WE are not surprised that Forum for Democracy and Development (FDD), leader Edith Namwakwi has not recovered from the defeat of the Patriotic Front (PF) by the Zambian people.

We are however worried that 17 months on, Ms. Nawakwi, a PF cadre, has not healed and is still bitter as evidenced by her recent outbursts against President Hakainde Hichilema and the UPND New Daw administration.

In a recent interview with the Revelation online publication, Ms. Nawakwi claimed that the improved inflation rate was meaningless and went on to attack President Hichilema’s persona with so much wild, subtle and senseless spite.

If it was not for this entrenched envy and bitterness against President Hichilema, Ms Nawakwi could have been discussing the challenges Zambians are going through with logical and sober reasoning.

Currently, Nawakwi is rusty, her strategy of politics has failed her. She adds no value to our political dispensation where people are required to logically and critically think through the challenges facing our people and offer alternatives.

Instead of seeing better days coming for Zambians under the leadership of President Hichilema, the failed politician wishes the current administration to fail.

As a former Minister, we expected Nawakwi to better understand governance and general management of the economy.
Ms. Nawakwi should know better that President Hichilema and the New Dawn administration have been working extremely hard to address the huge challenges created by her party while in Government.

Even as a failed politician Ms. Nawakwi should by now know that Zambia had lost international credibility which is now being rebuilt by President Hichilema.

Ms. Nawakwi should be hurting that President Hichilema has increased the Constituency Development Funds from a paltry K 1.6 million to K25.7 million in 2022 and this year to K 28.3 million. She must be hurting that President Hichilema has created employment opportunities for youths that have now been employed in government.

Are these achivements Madam Carlington maize scandle claims to be failures?

It is a fact that the President has also extended free education to Grade 12 and has implemented the policy decision. Is this failure?

Is it failure to be paying retirees within three months of leaving a job?
As stated we expect more informed arguments from Ms Nawakwi who has studied economics which we think she is slowly forgetting.

She knows that if Patriotic Front had retained power in 2021, Zambians could have been worse off as the international community was avoiding to-do business with Zambia due to impropriety and heightened corruption.

This is the reason Patriotic Front went on the commercial market to borrow expensive money as opposed to the concessional loans from multilaterals like the International Monetary Fund (IMF), the World Bank and other bilateral partners.

The IMF and the World Bank can now lend Zambia because of the trusted leadership of President Hichilema.
This is because almost all economic fundamentals have been put in place to attract investment and also create jobs.

If it was not for the reckless borrowing that the PF embarked on in the 10 years of their rule, the debt restructuring relief could have already been secured.

Ms Nawakwi should be ashamed of herself that she is slowly forgetting basic economics that reduced inflation is cardinal for a stable economy.

We urge our sister to move from politics of character assassination and trivialities, which have characterised her political life for almost 40 years. Maybe, it’s time for her to start reflecting on how else, other than politics to positively contribute to the development of the country.

Her political journey is surely coming to an end, but if she doesn’t realise this quickly, her ending might be very disastrous.

Right now madam Nawakwi has legal battles to fight arising from her careless and uncoordinated utterances. She has the case of the Hatembos on her back to deal with. And the Zambian people havent forgotten about the Carlington Maize scandle!

She should accept the fact that HH is the President of Zambia and stop hallucinating and hurting.

Her unjustified attacks and defamatory remarks against President Hichilema have been sustained while the latter was still in the opposition.

Ms. Nawakwi was a PF mercenary who was hired to scandalise President Hichilema with a view to minimize his chances of becoming the Head of State.

She should therefore be hurting to see the person she calls “my young brother” managing the affairs of the State in a prudent manner.

We would urge madam Nawakwi to do an introspection about her political career which is less inspiring especially for a woman leader.

As a woman in politics we expected better. It is clear that some of her reckless statements have landed her in trouble where she now has to defend herself- alone while her sponsors are perched on anthills from a distance.

We advise our sister to take some introspection and concentrate on preparing her defence in the numerous legal battles she is facing that could effectively render her bankrupt.

What do you know about Nyami Nyami’s Story during the Construction of Kariba Dam?

Tales of ancient gods and guardian angels are told vividly in the Zambezi region. It is here where you hear whispers of a great serpent-fish that is said to have the body of a snake and the torso of a fish. Whilst foreigners will say this creature is born of the imagination of the locals, the Tonga people will point to a lot of “signs” to justify its existence.

In 1955, a decision to tame the mighty Zambezi River and erect a dam wall was put forward. The Kariba Dam wall, as it was to be called, would create the largest manmade lake (in terms of volume but not surface area) in the world. The power stations that would be subsequently built would generate 700 megawatts of electricity; enough to satisfy over 90 percent of the country’s demand for power. Although this decision was largely seen to benefit everyone, it was not welcomed by everyone affected.

Arguably, the Tonga people were the worst affected as they were forced to uproot from their home for centuries and displaced to the higher safer ground that was less fertile and comfortable to live. After much resistance, the Tonga people reluctantly vacated their beloved home but vowed to return. It is said that the tribe elders, in their anger, summoned Nyami Nyami, the guardian of the river, to stop the project and pour out his wrath upon the people who had disturbed the peace of his people.

In 1956, the dam project commenced and the first bricks were laid. With the dam wall construction making good progress and the lake water levels already steadily rising, disaster struck in 1957. The Zambezi region witnessed a 1000-year flood in which a number of the builders were tragically killed. Some of those killed were foreign dam builders whose bodies disappeared mysteriously.

When efforts to recover their bodies failed, the elders of the Tonga tribe where approached and asked to lend their expertise and knowledge of the river to retrieve the bodies. The elders explained that Nyami Nyami had caused the disaster and if the builders wanted to appease the River god, they would need to make a sacrifice.

Initially, most of the builders and project managers laughed off the advice, but with the impending arrival of the deceased’s kin who would be expecting to bury their loved ones, the Europeans agreed.

A sacrifice of a white calf was made, as dictated by tradition. Come the next morning, the foreigners were awe-struck when the calf had disappeared and the bodies were left in its place. To this day, those events are shrouded in mystery with many conflicting explanations as to why and how things transpired.

During the next rainy season, the region saw even worse floods than those of the previous year. The Tonga people, as was to be expected, believed that the Nyami Nyami had struck again. This time, the floods swept away 11 Italian builders. Their bodies were later discovered in the partially wet cement of the dam wall.

It was at this point that, arguably, the bravest and most controversial, decision was made. After making his calculations, the Chief Project Engineer decided that it would be more structurally sound to leave the bodies plastered on the wall than to make attempts to remove them. Today, their bodies are part of the dam wall.

As explained by Narcissus Nhemachena, who was one of the construction workers present during construction of the dam wall, “It took five long years for the dam to be constructed because proper rituals had not been performed to ask for permission from Nyami Nyami to construct the dam. Cows were sacrificed and sack loads of money were thrown into the river to appease the Nyami Nyami. He caused some floods and loss of life, but at last he was kind enough to let the dam wall to be completed. It was the work of the Tonga elders and their spirit mediums to persuade the Nyami Nyami to allow the Zambezi to be tamed.”

Some members of the Tonga tribe believe that Nyami Nyami was separated from his wife during the dam wall construction. They say that he grows angrier with every passing year and it is just a matter of time before he unleashes his devastating power again so that he can be reunited with his love again. Fact or fiction? Joao Cancelo, who has been vital to the defending champions Manchester City for a number of years now is set to leave the club on loan to Bayern Munich, with the Bavarian giants having a price agreed to make the loan signing permanent in the summer.

It left us all scratching our heads a little bit, with the decision to let such a key player leave during this part of the season where you’re trailing your title rivals by a decent margin does seem bizarre, but it appears we now know why.

As per the report from The Daily Mail, City aren’t thrilled at losing a key player so late in the window, and have turned attentions to finding a replacement, but that appears to be a tough task given the time constraints of the transfer window.

Since the World Cup, he’s only started three games out of 10, including being hooked at half time in the victory over Chelsea. All in all it’s been a poor return to club action since the tournament out in Qatar for Cancelo.

THE SUSMAN BROTHERS: THE PIONEERS ON ENTRENEURSHIP IN ZAMBIA

Susman Brothers was a business partnership that united brothers Elie Susman and Harry Susman after they crossed the Zambezi river in 1901. The brothers were Jewish businessmen from Rietavas, western part of Russian Empire, now Lithuania. They founded, owned, and operated several large businesses in Africa. Elie Susman, the younger of the two, was the founder of Susman Brothers.[1] However, it was not until 1907 that the business name of “E. Susman” was changed to “Susman Brothers”.

Retail stores in Northern Rhodesia (now Zambia) date to the Susman brothers. Their business empire lasted over a century by overcoming logistical difficulties, physically challenging obstacles, and political changes. They developed an extensive trading, transport and ranching network, which stretched from Botswana to the Democratic Republic of the Congo. Though they operated in many different places, their main focus was always the country now known as Zambia.

Harry Susman worked as a peddler for a few years in Cape Town, South Africa, before crossing the Zambezi (at Kazungula) with Elia to buy cattle from King Lewanika of Barotseland in 1901.

1920s
The development of the Northern Rhodesian copperbelt began to take off, with the reorganization of the Bwana Mkubwa mine near Ndola in 1922. But Susman brothers pre-date to between 1916 and 1918. The brothers owned two concessions which covered part of what eventually became the Nkana Mine. The brothers’ names still appear on the original title deeds. The Susman brothers eventually sold the claims for the Nkana prospect to William Lee, but retained the trading rights on the concessions. The brothers eventually become part of one of the richest copper mines in the world.
The Susman brothers heavily engaged, throughout the 1920s, in cattle buying along the line of rail. The Susmans supplied ivory bangles which were essential as trade goods. Their Leopards Hill Ranch near Lusaka Boma was used as a holding ranch, for cattle bought along the line of rail. Business was good for the Susman brothers; they asked the Northern Rhodesian government to enlarge the ranch. After complex negotiation with the government in 1927, the ranch was enlarged by 14,000 acres (57 km2), in two blocks taken from the Soil people reserve. The ranch had 400 people living on it, including 150 labourers. Also in the 1920s, the Susman brothers had planted up to 200 acres of wheat, as well as maize, at the ranch.

During the 1920s, the Susman brothers bought and sold a number of other farms in Lusaka District. Next to their Leopards Hill Ranch, they grew tobacco on the Kabulonga farm, which was much closer to the rail line. But they sold the farm, after collapse of tobacco prices in 1928. Today, the Kabulonga farm has become the site for Lusaka’s most exclusive residential suburb. The Susman brothers also owned a section of a farm called Villa Elisabetta, farm number 110a. The brothers sold this farm to David Shapiro, for his block-and-tile-making business. They also took over Wolverton ranch on the Kafue river in Mazabuka; today Nakambala Sugar Estates is on this site.

In the 1920s, H. C. Werner dominated the copperbelt market with cattle working in the mine, and the beef market. “Wingy” Werner, as he was nicknamed because of his half arm, was a Dutchman from South Africa. He had also been involved in the cattle trading business since the early 1920s. He lived at his farm in Lusaka, which he called “Herefords”. The Susmans’ first major move onto the copperbelt was when they took over Bwana Mkubwa hotel and Ndola Butchery and Bakery, in September 1928. The brothers formed partnership with a friend from Southern Rhodesia, who also brought his own partners to the business. The most influential partner was Isidore Kollerberg, who was to play an important role on the copperbelt for the next forty years. The Kollerberg brothers, Latvian Jews, became the major shareholders in this partnership. The partnership built Nkana hotels and Nchanga hotels and set up bakeries and bottle stores in many Copperbelt towns. The Susman brothers were minority shareholders, but were very active in the management of this business. The Susman brothers also took a share in another business run by the Kollerbergs, the Copperfields Cold Storage Limited. This split the copperbelt meat business into two, with Copperfields and H.C. Werner.
The brothers were also joined by Maurice Gersh (1906–1992) and Harry Gersh, their nephews, sons of one of their two sisters, Dora Gersh.[3] Gersh began working in Livingstone at their Pioneer Butchery & Bakery and set up his own store in the town in 1927. The Gersh brothers gained control of the Bwana Mkubwa Hotel and Ndola Butchery and Bakery in 1928.

1930s
In the early 1930s, the Susman ranch averaged 3,000 cattle. After Werner died in 1933, his wife carried on the business, while the Susman brothers reduced their stake in Copperfields, and in 1937 took a significant share in Werners.

The Susman brothers tried to ensure that at least one of them was always in Livingstone, to run their most important business interest, the Pioneer Butchery and Bakery, as for long periods, it was the only butchery in the town. The Susmans opened one more business in Livingstone in the early 1930s, when Elie Susman’s family house, MARAMBA house, was rebuilt and turned into Windsor Hotel.
The Susman brothers became involved in one more copperbelt enterprise. This time in conjection with their nephews, Maurice and Harry Gersh, they set up in 1931 a company called Economy Stores Limited. It established stores which eventually became department stores called Economy Stores. Economy Stores was to serve as the base for an enormous proliferation of enterprises in the post-War years. When the recession of 1931-33 led to closure of mining operations, the Susman brothers sent Maurice, to “work in their businesses and to oversee the liquidation of some of their assets affected by the recession.” Harry Gersh joined his brother on the copperbelt in 1930 and set up a store at Nchanga. He later moved to Nkana and set up another one there also. Elie Susman helped his nephews to start up and set up stores by identifying the sites to build them between 1935 and 1936. Maurice Gersh played a leading role in negotiations with the Northern Rhodesian government, with the set-up on a new town near Nkana, called Kitwe.

It was as the recovery from the Depression in Northern Rhodesia and South Africa was nearing its completion that the Susman brothers made their most momentous new investment. In December 1934, they agreed to take a share in a new business in South Africa called “Woolworth”. Their partner was Max Sonnerberg; Max bought a departmental store in Cape town in 1929, changed its name to “Woolworth” in 1931 and started growing in Cape Town. There was no relationship with the F.W. Woolworth chain in the United Kingdom, but Max benefitted from the similar names. From 1930 onwards, Elie Susman began to spend half the year with his wife and family at the house in Beach Street, Cape Town, which he had built, calling this house “Barotse”.
An agreement was concluded in December 1934 in which Susman Brothers invested $25,000 in Woolworth and took shares in the business. Susman Brothers invested over $50,000 in Woolworth in the next two years. They financed this large investment through an overdraft from their account at Standard Chartered. Elie Susman moved his family from Cape Town to Johannesburg and became a director in June 1935. Max Sonnenberg controlled Cape Town stores, and Elie Susman controlled Transvaal stores which included Johannesburg. Woolworth was formally launched as a public company in 1935. Elie Susman was 55 years old when he began to work on a more or less full-time basis for Woolworths.

1940s
Although Harry Susman was never involved in the management of Woolworth, he enjoyed Elie Susman’s half-share of his Woolworth salary, until 1941, when Harry officially wrote to release his brother from this obligation.

In the 1940s, the brothers took on a partner, Harry Wulfsohn, to expand and redevelop their business interest in Northern Rhodesia. Their trading business began during the scramble for Africa and the heyday of Imperialism, coming through the colonial period to the ill-fated federation of Rhodesia and Nyasaland. The business went through the triumph of African nationalism and survived into the era of emerging market and liberatisation. In a meeting in February 1946, it was agreed that the company should apply to the government for permission to change its name from “Harry Wulfsohn Limited” to “Susman Brothers and Wulfsohn Limited”. In complex negotiations with Harry Susman, Harry Wulfsohn set up this new company, with a fifty-fifty shareholding with the Susman brothers in the new company. Most of the negotiations also involved Elie Susman when he visited Livingstone.
Harry Susman remained the main representative of the Susman family business in Livingstone, until his retirement in 1945. A few months before the end of the Second World War, Harry Susman left Livingstone and settled on a farm, Umritsor, near Salisbury in Southern Rhodesia.

1950s
Harry Susman continued to visit Northern Rhodesia regularly until his death in January 1952. He lived long enough to celebrate the fiftieth anniversary of the brothers’ first crossing of the Zambezi river, in April 1951, but sadly he did not live to witness the unveiling of the four-faced town clock that they donated to the Rhodes-Livingstone Museum, to commemorate that event.[5]
Until his own death in January 1958, there was never any doubt that Elie Susman was, in spite of his absence in South Africa for the most of the year, the senior partner and dominant personality in the business. He was the chairman of both main companies where Harry was a partner. Elie Susman was not prepared to take a secondary role in his businesses until the mid-1950s when his own son David Susman began to take over.
David Susman married Anne Laski, the niece of Lord Marks of Marks and Spencer. He eventually became a non-executive director of M&S, a position he held for nearly 30 years.

Mashombe – KING of Tonga ‘Kalindula’ Music – Gone To Rest

Sad to learn of the passing of Nebert Mashombe, the founder and leader of Mashombe Blue Jeans aka MBJ. Nebert died Monday morning after an illness. He will be remembered for his traditional musical style and for reintroducing Kalindula music to the Southern Province.

Nebert Mashombe started his music career in the mid 1980s. My encounter with him springs back to the early 2000s during the all Tonga Music Festival at Chikuni Radio

He’s a soft-spoken man, shy but once at the helm of his band with the singing, he traversed various aspects of social life. His stardom went up when, with the support of Chikuni Radio, produced albums for people’s consumption and entertainment. His music was already making hits on radio and demand grew from the people of southern province and beyond. Any broadcaster that went on air would want to play some MBJ.

Interestingly enough though, is that Mashombe Blue Jeans played Kalindula, which was alien to Southern Province. However, their use of locally made instruments with a traditional infusion made people realize that culture is indeed dynamic. Kalindula was no longer seen as a music genre from the Northern part of Zambia. It came to stay in Southern Province.

His music was mainly about family matters, bringing to light divisive issues and those that bring unity. His music appeals to various sectors of society.

His albums were selling extremely well, he was Kalindula champion at the Tonga music festival, won Ngoma Award and several other accolades. As others have argued, he IS the king of Kalindula music in Southern Province.

There came a time when young and upcoming musicians started emulating MBJ’s style of artistry. The music of MBJ was THE music. Full of entertainment but with serious message to the people. Music championing social change.

He advocated for issues such as intestate succession, HIV/AIDS, death, religion, and romance. He at one time even produced an album in other Zambian languages.

Each time he produced an album, people would say it would take a long time for him to produce another hit. He took feedback seriously. Took his time to compose and arrange his music, such that when he produced the next album, there would be a hit song. “You are not going to produce another hit” people would say over and over.

Having done so well in the music festival, the public then demanded that he becomes a guest artiste to the event as they felt that he had no equal to much his prowess in the Kalindula style, and infusion of traditional instruments. Though he did not always come out first, he earned enough respect.

Most musicians are declared legends after they pass on, but with Nebert he enjoyed this acclaim while he was alive. He was a model to a number of musicians in the province who are now taking the music to another level.

I thank Nebert Mashombe for his great contribution to the (Tonga) music industry. I glad to have been a part of his journey. Listening to Kabalwebalwe Bana ba Leza…..

They say, just like pregnancy, character is difficult to hide, it always pops up. For all the things my brother Miles Sampa has been through politically, one would have expected, he would have learnt a thing or two.

But in his true nature, he fully exposed his political immaturity when he held his so called press conference last Saturday.

In a typical Miles Sampa style, went on rampage praising President Hichilema and the UPND and somehow attempted to confirm that some PF Ministers were corrupt.

It was however difficult to tell whether he was going or coming but the only thing that was certain from his press conceive was his uncertainty about who he is and what he stands for.

The PF is a membership organization and just like every membership organization, it has a set of rules and principles that binds all its members. These are values that should not be broken because they give a sense of togetherness and united purpose.

Miles crossed the line when he started heaping praise on a non functional government of the UPND, the same government that has caused so much misery to Zambians. This is the greatest betray of the Zambian people by a person who draws a salary by representing their interests in Parliament.

Not only did Miles betray the Zambians, he also poured scorn on thousands of PF members who gave suffered atrocities at the hands of the UPND government. Our mother Mrs Mumbi Phiri is languishing in Mongu prison simply because someone wants to punish her and a normal PF senior member should wake up, organize a media briefing and start supporting the UPND.

We wish to remind Miles Sampa that a lot of our members and their associates have been victimized, their business contracts cancelled, payments withdrawn and some are even in exile today and he decides not to see all this?

With that said, we wish to wholeheartedly welcome the decision taken by our Acting President comrade Given Lubinda, MCC to suspend Miles Sampa.

MINISTER, ZESCO BOARD CHAIR DIFFER – as Energy expert calls on President Hichilema to discipline Minister of Energy Peter Kapala and Zesco Board Chairperson Vickson Ncube

Energy expert Victor Hazemba has urged President Hakainde Hichilema to discipline Minister of Energy Peter Kapala and Zesco board chairman, Vickson Ncube for presenting contradictory statements over load shedding.

Mr Hazemba said it is worrisome that on one hand, Mr Kapala was insisting that President Hichilema was not misled on the status of load shedding and on the other, Mr Ncube had vicariously apologized to the nation for misleading the Head of State.

He said in an interview that the continued confusion in the energy sector was embarrassing to the Head of State and the new dawn government.

Mr Hazemba said President Hichilema should take action against Mr Kapala and Mr Ncube for misleading him over the energy deficit.
He warned that failure by Mr Hichilema to take action against Mr Kapala and Mr Ncube would result in Zambians losing confidence in the new dawn administration and make it difficult for citizens to believe any future government assurances.

Speaking when he featured on Hot FM radio recently, Mr Kapala is reported as having said it is unfortunate that Mr Ncube decided to apologise to Zambians and President Hakainde Hichilema over load shedding because the head of State was given accurate information about the load shedding the country has been experiencing.

Mr Kapala said President Hichilema was not misled over the status of electricity deficit the country was experiencing and that the head of State’s assurance to Zambians that load shedding had ended was based on accurate electricity generation capacity.

“The President (Hichilema) was not misled and he was told the facts that the country produces over 3000 megawatts but 80 percent of this is hydro generated. This means that we depend on water. It is unfortunate that the Zesco board chairman (Victor Ncube) apologized because the President was not misled. He (President Hichilema) was given correct information on which he had based his assurance to Zambians that load shedding had ended,” Mr Kapala said.
He said President Hichilema was not misled over the status of electricity deficit the country was experiencing and that the head of State’s assurance to Zambians that load shedding had ended was based on accurate electricity generation capacity.

The Minister explained that at the time President Hichilema was informing the nation that load shedding was a thing of the past, the country had enough electricity and was even exporting its surplus but natural factors could not have been foreseen by the head of State or technocrats.

Mr Kapala said that unlike the apology from ZESCO board chairperson Vickson Ncube who apologised and took the blame for the current woes, the president was given the true picture that the country had the capacity to produce more power than it consumed.

He explained that natural factors such as the limitation of the amount of hydrology get into the Kariba Dam could not be predicted whose resultant effect a sudden electricity deficit was leading to load shedding. He said that indeed all things being equal, the country was not supposed to experience load shedding because it had the capacity to produce more than what was needed.

Mr Kapala insisted that Mr Ncube’s statement that President Hichilema was misled was inaccurate.

And Mr Kapala has announced that the load shedding hours are expected to be reduced further to average six hours and shall be implemented in the intervals of three hours every 24 hours.

The Minister said that he expected the load shedding hours to reduce to six hours in the next couple weeks in a bid to enhance the country’s productivity.

He said that Zambia would be importing power from Mozambique and that the money had already been paid for about 100 megawatts of electricity.Mr Kapala said that the hours would be divided into three hour intervals in order to lessen the burden on the Zambian population.

PF suspends Hon Miles Sampa from the Central Committee for a period of 6 Weeks starting today

The opposition Patriotic Front-PF has with immediate effect suspended its Matero Member of Parliament Miles Sampa from the party’s Central Committee and from taking part in party activities for 6 weeks.

This follows a press briefing Mr Sampa held last week which the Party Secretariat has deemed to be in bad taste and highly condemned, adding that Mr Sampa disparaged his fellow party presidential aspirants.

Speaking during a media briefing held at the Patriotic Front Party Secretariat in Lusaka today, Acting Party President Given Lubinda mentioned that Mr Sampa`s briefing was entirely based on casting aspersions against other party members which the party has deemed as a recipe for anarchy and the danger to the unity of the party.

Mr Lubinda added that the decision was arrived at after a meeting was held by the central committee of which Mr Sampa was in attendance.

He said that some of the conditions of suspension include the banning Mr Sampa from participating and attending any party meetings during the said period and during this period he shall not make any public statement on behalf of the party.

“The Central Committee has been forced to invoke Article 61 of the Party Constitution to suspend Mr Sampa to set as an example to other erring party members,” he said

Meanwhile, the PF Party Secretariat has ordered a stop to any form of campaigns by PF aspiring presidential candidates as the Central Committee resolves on adopting new rules of engagement and campaigns for the forthcoming General Conference, adding that the campaigns will only resume after the party constitution is revised.

“Campaigns will only commence once the rules of engagement are agreed upon and voted by the party,” he said

And in responding to what new things the PF could have done now which they didnt do in the 10 years of being in power, Mr Lubinda stated that if the PF was still in power by now they could have started works on the Lusaka – Ndola dual carriage way and before doing that they could have started works on Kazungula because they couldn’t do everything at the same time and he added that being asked on things that they didnt do in the 10 years is like asking him if he has just become indilligent now, development is incremental which is not an event but rather a process.

“Having run the government for over 10 years, during that period there are many things that we started doing in the mining sector, and there are others that we said that when we cross 2021 there are other things we can do, for example , before 2021 elections, when gold was discovered, we said we are going to establish a company called Zamgold, for the reason of not wanting our gold to continue being exported without Zambia benefiting anything, because if you remember our Zambian emeralds where being auctioned in India where we take our emeralds to India where as even our own Zambia people travelled to India to take part in these auctions, that’s when we said this is wrong and let’s auction our emeralds in Zambia,” he said

And Mr Lubinda disclosed that the Patriotic Front wanted to establish a regulatory body to regulate the mining sector, and also ensure that the ownership of the mines is also in the hands of Zambians, because right now all the mines are owned by foreigners who do not even stay in Zambia and the Zambians are only left to run the mines on their behalf.

“The technology is amongst Zambians as they know how to mine and yet there are no Zambians who are shareholders,” he said

Mr Lubinda said that the Patriotic Front wanted to ensure that ZCCM-IH increases its share holding on behalf of Zambians, but instead theres a liquidation of their shares in some of the mines.

GREYFORD Monde has trashed the highly talked about UPND’s Constituency Development Fund (CDF) programme.

Featuring on United Voice Radio, the PF presidential hopeful charged that the UPND government is using CDF to hoodwink citizens.

He said President Hakainde Hichilema’s administration can increase CDF to K200 million per constituency knowing that they “will not be able to implement it”.

Monde said the money under CDF is just there to help constituencies in times when the money in the national budget is not enough.

“You know what has happened to CDF? This is hoodwinking the Zambians. That CDF has now become funding for the Ministry of Home Affairs. That CDF has become funding for Ministry of Community Development, Ministry of Health; all the government sectors. Anything you want in your constituency today, CDF. A bridge is falling, CDF,” he said. “Because you know that a national budget is planned from a constituency. In a constituency, you have got 50 schools. You know that this school needs renovation. So what do you do? Put it in the budget…you will hear that in the Ministry of Education we have 1,000 schools to rehabilitate. It is not by guessing. Those schools have been registered by the constituencies. Now in this government, all of that is under CDF. Is it good management or bad management? It is bad management. As PF, we would cover all this in budget. By the end of the year, you go into the constituency and ask them how much in real terms have you received from government? You will find that they have received even K200 million through fixing bridges, paying social cash transfer, renovating clinics…”

Monde said there is a problem even if the government increases CDF to K100 million if that is the only money being taken to constituencies.

“Ask yourself a question, what major developments have you seen in constituencies? Have you seen roads being done, have you seen bridges? So at the end of the day when you sit down and calculate you realise no, we are actually being hoodwinked. If they want to increase the CDF, let them also increase the amount of money they are going to take to these constituencies. It can’t be CDF only,” he said. “Constituencies are very big. So when you are going to rate them after five years you will realise that even if they increase CDF to K100 million, if that is the only money going into the constituencies, then there is a problem. Go and check the state of schools – if schools are running well right now. So for me it’s a mess and very soon Zambians will realise. Now ask yourself a question, CDF for 2022, when was it delivered? It was delivered this year. So when do you think they will implement that CDF? They were announcing just in January that we have now finished 100 per cent taking CDF for 2022. So now what is supposed to happen they must now begin to implement by spending that money. So the whole lot of last year, they did not even spend it. This year, that is when they will start spending that CDF for 2022. They will finish spending it in 2023. So when are they going to receive the CDF for 2023, the one that is K28 million? So if you are working with a person who thinks Zambians are not seeing what is happening, this is what you experience.”

Monde said the UPND’s mishandling of the CDF gives PF a chance to bounce back in 2026.

“So for me, Zambians are seeing and they are watching. At the end of the day they will say ‘ah they (PF) built these clinics in five years in our constituency. These (UPND) have not even rehabilitated any, they haven’t worked on the roads. This is for PF, that is for PF, they need to come back to power’. That is how we are going to come back,” said Monde.

FDD leader Edith Nawakwi has described as “free foolishness” to open up the country for trade in maize grain.

Nawakwi said in an interview that there was a shortage of mealie meal in the country because maize was sold out as early as last November.

“You cannot allow Zambians to buy mealie meal at K270. This is what is going on in Nakonde, places like Shangombo; all those places. There is no product. Go to National Milling, there is a shortage. Which trader is exploiting the maize?” Nawakwi wondered. “These are champions of free market. Look, there is no maize. Just about two months ago, the people in Chisamba were protesting that the government is exporting maize to Tanzania. They were loading trucks from Chisamba and people in Chisamba said ‘these FRA (Food Reserve Agency) sheds are where we lineup to buy maize when it is in short supply in January and February. So you cannot lie. The problem with these people is they are pathological liars.”

She said it was not only consumers of maize who get affected but also livestock farmers.

Nawakwi also bemoaned the procedure involved in accessing FRA maize.

“Now, who went there to say this is rubbish? It was Chushi Kasanda. ‘No, these are contracts, we have enough stock’… even their Minister of Agriculture [Reuben Mtolo Phiri]… Do you know that to get maize from FRA the minister, Mtolo himself has to authorise? It is not even the CEO for FRA. You have to go to the ministry and get his personal signature. Mtolo has to authorise for a miller to go and collect maize and pay FRA,” Nawakwi said. “We have been trying from FRA as usual as farmers to feed chickens, not just for nshima. Maize is for livestock. We have been trying to

source just for three trucks – 90 tonnes of maize. We have been told you have to personally go and see Mr Mtolo in his personal capacity? Ask him, why is the minister involved in the personal allocation of maize to millers? You cannot go to FRA and they issue an allocation. They stopped a month ago but even before then, Mtolo had his favourite millers who he was allocating. They want millers, so we who are feeding chickens, pigs, goats, pigeons, rabbits, you cannot get the maize! Now, are we going to feed on nshima without protein?”

Nawakwi insisted that there is a shortage of maize in the country, hence the soaring mealie meal prices.

“The point is there is a shortage of grain in the country. When the President walked into office, before he could find a chair to sit on, he looked at the maize in the sheds and in the field and he opened for all and sundry to come in and trade. And for those who work with farmers in the villages, we met Rwandese buying, we met Congolese buying. We met Tanzanians buying soya beans and maize and taking it out at extremely low prices,” she said. “The millers were paying farmers K4 [a gallon of maize] at the time. Hakainde Hichilema reduced it. Were they reducing it so that Zambians can buy maize? They were reducing it so that foreign grain traders have access. I cannot go to Tanzania and buy beans in the villages but Hakainde Hichilema thinks that Zambia is a place where even foreigners can go to Kanchibiya and buy caterpillars. You find Congolese in the villages with canters buying caterpillars. Mr Hichilema thinks that is free market. That is free foolishness. It is free foolishness what they are engaging in. It is not free market, it is free foolishness and ignorance.”

And Nawakwi said it was obvious that Zambia was food insecure as observed by US Secretary of the Treasury Janet Yellen during her recent visit.

“Even IMF said Zambia is grain insecure. This last visit by IMF, by these two ladies from Washington, what did [Dr Janet] Yellen say? She said this year Zambia will be facing food insecurity. This is an indictment on the President because since MMD Zambia has been food secure. He thinks by running to [DRC President Felix] Tshisekedi he is a good boy,” said Nawakwi. “This food insecurity will follow us up to 2024 because we don’t have fertiliser. You can talk to Yellen , you can talk, to Georgina [IMF managing director Kristalina Georgieva) but the bottom line is when you have no food even IMF package becomes completely useless. The public relations that is going on does not matter. People are hungry.”

Plans by opposition political parties to impeach President HH are baseless – UPND

United Party for National Development – UPND Lusaka Province Youth Chairperson Anderson Banda has described opposition political parties calling for the impeachment of President Hakainde Hichilema as bitter.
Mr Banda stated that it is unfortunate that the current crop of Patriotic Front – PF opposition members do not have the capacity to offer credible checks and balances.

He further stated that President Hichilema has delivered to the expectation of the Zambian citizens, adding that people on the ground are appreciating the strides the New Dawn Administration is making towards economic development and economic recovery.

“How possible it is to impeach a hard working President who is delivering to the expectation of the Zambian people, majority of the Zambian people out there are very happy and proud of President Hichilema’s leadership,” he said

Mr Banda mentioned that the UPND are delivering to the expectations of the Zamnian people as about 80 perecent to 90 percent of key promises made when they campaigning have so far been fulfilled.

“Unless you give me an example of critical promise that we made and hasn’t been fulfilled because so far to my knowledge all the key promises that we made to the people of Zambia have been fulfilled,and therefore, we commend the New Dawn Government,” he said

Mr Banda said that those people who are trying to hallucinate in daylight that they can even think of impeaching the President Hichilema, they should just accept defeat and also accept that they where democratically booted out power because of their recklessness, and abuse of leadership they portrayed during their ternour.

“I think they should just give the chance to President Hichilema and his government to also do their part. If they are popular and strong and if they think they are better than President Hakainde Hichilema let them wait for 2026 so that we boot them out again for the second time instead of making noise and diverting the attention of our hardworking President who is delivering to the expectation of the Zambian people, so let them go ahead if they think they have the number,” he said

“Basically our mandate is to dance to the tune of the Zambian people who are majority, and Prsident Hichilema is already exhibiting to be the servant of the people, for the first time in the history of this country, the man is not resting as he is working like a servant, or a common man, his not working day and night, they will call him this side he goes, and his exhibiting true servant to the people of Zambia,” he added

Since November last year, Opposition political parties among them the Patriotic Front, Economic Front, National Democratic Congress and Citizens First disclosed that they are in the process of issuing a motion of impeachment in parliament against President Hakainde Hichilema for failing to govern the country to the expectations of Zambians.

Speaking on behalf of the other parties at a joint media briefing in Lusaka, PF Chairperson For Information and Publicity Raphael Nakacinda mentioned that competent lawyers are crafting the motion and it will be passed in the house by the leader of the opposition in parliament.
Mr Nakacinda said that a motion of Censure against Finance Minister Situmbeko Musokotwane, his Agriculture counterpart Reuben Mtolo as well as Health Minister Sylvia Masebo will be issued for allegedly being incompetent in the execution of their duties.

At the same briefing, National Democratic Congress – NDC President Saboi Imboela has appealed to the international community and the general public to take interest in the alleged human rights violation going on in the country.

Ms Imboela has also vowed that the opposition in the country will never stop talking if all the rights violations are aimed at silencing them.

But Chief Government Spokesperson Chushi Kasanda dared the opposition to go ahead with their plans saying they will just be wasting their time to file a motion of impeachment against the president as people in the country are happy with the current government and the head of state.

Mrs Mutale Nalumango, the honourable vice President of Zambia missed the point when she said Zambians could escape the ever rising of the stable food 90 percent of Zambians feed on called mealie meal which is basically ground maize said Ambassador Anthony Mukwita.
“The point is not even a choice between roller meal and breakfast but whether Zambian can actually afford the mealie meal which her government said would be reduced to K50 as opposed to the current K200 and rising. People have no money to buy either breakfast or roller meal as per election promise,” said the media expert and international relations expert.


Speaking on The Analysis hosted by the ever-green Henry Wiseman Zulu that airs live every Sunday on KBN TV at 20:30, Ambassador Mukwita reflected that the vice President continues to issue outlandish statements that makes her boss President Hichilema look bad, even when he is a good man, perhaps she should stop making uniformed public statements.


He cited an example of Mrs Nalumango saying, “prices should rise before they can drop” and the fact that she admitted the government through the central bank were hedging the kwacha against major foreign currencies such as the dollar artificially.
When the former ruling party left office after an election defeat in August 2021, the Zambian kwacha was trading at K15 to a dollar and has now dropped to K19, against the promises of the new Dawn government.


Ambassador Mukwita gave a cross reference to the French revolution of the 1700´s where the Queen of France then Maria Antoinette was so oblivious to the plague ridden country by advising hungry French people to eat cake in the absence of bread.
He said those that love Zambia shall continue to remind the government of the day that they should live up to the promises they made ahead of the elections instead of burying their heads in the sand.


“The current government have a stellar opportunity to make Zambia a better place based in the history of failure from the UNIP, MMD and PF,” said Ambassador Mukwita, “there is no need to re write the will.”
The Ambassador, a published author who has studied international relations at Masters degree level and professional communications added that the current government must not mistake objective criticism for hate.


“We advise because we love the country and the leadership and want them to succeed because their success is our collective victory lap, those that praise the President amidst adversity and failed promises hate him,” said Ambassador Mukwita.
Mr Mukwita has just completed penning a book entitled the rise of China in Africa, a Zambian story that hits the shelves in Zambia and Amazon in February.

PAN-AFRICANIST, Kachingwe Singoyi, has called on citizens to hold President Hakainde Hichilema accountable for his campaign promises, including ending load shedding.

Singoyi who is based in the US says it should not be normal for every politician to lie their way through to the presidency and get away with it.

He implores Zambians to stop tolerating such behavior, adding that those who lie should be kicked out immediately.

‘’We can’t continue with these lies from our political leaders. It’s important to note that these lies become political slogans during election campaigns that parties use to disguise their lack of vision on economic and social issues. President Hakainde Hilchilema lied about the Zesco power crisis during his campaigns, period,’’ he said in a statement. ‘’And he should be held accountable. It’s high time we started holding our politicians accountable for the lies they make during campaigns. It should no longer be business as usual. Zambians have often underestimated the harm of political lies by simply analysing a lie only from the perspective of the liar. Why did he or she lie? Was it done with cunning or courage? Lying is the most dangerous body of deceit. This is not because all politicians lie, as common cynicism holds. To the contrary, there is a notable difference between political societies that honour the principle of veracity and political societies that don’t.’’

Singoyi explained the difference between the two schools of thought, arguing that people should be respected by politicians.

‘’And here is the difference, President Hakainde lied with a straight face and courage when he was being interviewed by HotFM Radio presenters Pizzy and Hope last year and it’s on record. If our political society respected the principle of veracity the people of Zambia would have forced President Hakainde Hichilema to resign on moral ground. But here we are, tolerating him to justify the lie when the repercussions of such a dangerous body of deceit is out there for all to see,’’ Singoyi explained. ‘’We can’t have a leader lying with impunity and expect to socially and economically develop as a nation. The President lied both during campaigns and recently as the Head of State. Zambians need to hold the President accountable for his lies, he should apologise for lying to the people who entrusted him to run their affairs before he goes on believing his own lies and justifying them.’’

He said the country was founded on dignity; hence it is wrong for a president to lie.

‘’This country was founded on dignity and peace, and these are the values that leaders and those who aspire to be leaders of this nation should live by and hold in high esteem. There is no dignity in lying to the people you are leading; leading with dignity entails being accountable to the electorate, and a commitment to servant leadership. Zambia as a nation was founded on dignity and peace as enshrined in our national anthem. These are noble principles which our forefathers saw the need to build our nation on,’’ said Singoyi. ‘’Dignity and peace neath Zambia’s sky, not lies and political violence neath Zambia’s sky. The principle of peaceful coexistence always encourages finding a common ground and not to create differences as we see in our politics today. The principle of dignity refers to the intrinsic value and worth of every human being, and to words, actions, or conditions that either affirm human dignity or violate it. On the contrary lying yourself into political office does not speak to value and worth of every Zambian and to words and actions as espoused by our forefathers.

ENERGY minister Peter Kapala says government will start importing electricity from Mozambique on a pay-as-you-go basis after resolving the debt it had with the power utility in that country.

He also says when Zambians get to pay cost reflective electricity tariffs they will see Zesco start performing to people’s expectations.

Featuring on Hot FM’s Red Hot Breakfast programme on yesterday, Kapala said the import would also lead to drastic reduction in load shedding hours.

“We are expecting to start importing some power just to supplement what we have got already. We are in agreement with Mozambique. Mozambique has offered to give us 100 and 200 megawatts. That is why I am optimistic that once the process is sorted out we should be able to reduce the load shedding hours,” he said. “Mind you this is a long term contract with Mozambique. It will be pay as you go. Yes, we have paid them. You, see there has been a lot of legacy debt. Government owes Mozambique $24 million. I understand the Ministry of Finance have secured and they have paid what is remaining. Now is the pay-as-you-go, so we anticipate that by next month our situation

will improve greatly.”

Kapala explained that the contract would not be long term.

“We don’t want a firm contract because they may want us to give the six months, one year contract for them to supply but they have been generous. It is like the way we do with Zimbabwe, which is, they pay in advance then we supply. The units run out, you cut. They have to put more units for them to get the power,” he explained. “We think by next month or so, we will be good to go. Kariba Dam, we are still generating steadily at 200 megawatts, somewhere there. Remember, the installed capacity is 1,080 megawatts, now we are generating about 200 to 250 megawatts. That is quite a significant reduction but it will soon pick up. We get daily inflow from the Zambezi River Authority which is very encouraging. In the next month or so we should be alright. Not to full

production but at least the load shedding times will drastically be reduced.”

Asked why President Hakainde Hichilema assured Zambians after coming in office that load shedding would be a thing of the past, Kapala said there was already a power surplus.

“You see, there is some understanding in the way things have been put and what the President meant. The President was given correct information to start with. The President was looking at the installed capacity, which is about 3,500 megawatts. Demand is about 2,900 megawatts – somewhere there. There is a surplus already, that is the surplus that we export,” he said. “If I may agree with my President, it is true

there will be no load shedding. But as I said there is 86 per cent of the generation in the country, which is hydro based and depends on the rainfall. If there is little hydrology going in the dams, the President cannot predict; even I cannot predicate.”

Asked why the Zesco board chairperson Vickson Ncube apologised to the nation if the President had correct information, Kapala said the apology was unfortunate.

“The President is given technical information. That is unfortunate for him to have said that (apology). It is an apology that has been said in public domain but we will just say let us move on,” he said.

And Kapala has called on Zambians to make submissions on the notice by the Energy Regulation Board (ERB) that Zesco intends to hike electricity tariffs beginning first quarter of this year.

“With this coming of new connection fees and tariffs that have been advertised by the Energy Regulation Board, we have left that to the public to comment. So do your submissions and I will come and comment on that later on because as government we do not interfere with the operations of the Energy Regulation Board. It is them and their customers to speak. They are the regulators, so they know what should prevail because we need to get to cost reflective tariffs. That is when you will see Zesco start performing to people’s expectations,” said Kapala. “We should part Zesco management on the back, they have not increased the debt. They have managed to hold off the debt and they have managed to raise the revenue from the little that we are exporting. When did we last see revision of electricity tariffs? 2005. How long ago was that? Zesco needs money. The public will think I am supporting Zesco from without. Zesco is a utility company, times of changes – costs have changed. Salaries have gone up. I don’t think you have been
on the same salary since 2005.”

WE’RE beginning to see different individuals who want to poke their fingers in the peace that we have been enjoying ever since Dr Kenneth Kaunda established this custom and tradition, says MMD leader Nevers Mumba.


In a Facebook broadcast on Thursday, Mumba said the issue of tribalism may seem romantic but could be catastrophic.
“There are comments that have been made by certain individuals calling themselves political leaders that have gone on this path of tribalism.

I don’t mention names when I am dealing with a huge national issue but
it is true that one of our colleagues Mr Tayali went on Facebook and started to call out bembas who are in one way or the other supporting the overall movement of governance in one way or another in this
country especially that there is a President who is not from Northern Province or is from Southern Province. Therefore any Bemba
that seems to be supporting that government that is led by a non-Bemba is called a useful idiot,” Mumba noted. “I am not putting Mr Tayali in the centre”


He said unity could not happen by chance but that Zambians must work towards it.
“I want to start by the truth. The truth is tribalism exists in our nation, on the continent of Africa just like racism exists. This is
why Dr Kenneth Kaunda had to address himself to this issue by bringing the slogan that we use of One Zambia One Nation,” Mumba said. “Unity means every aspect of the society is included in the governance
our nation. Both women and men must feel they are equitably represented in government. Persons with disabilities, they must feel
also that they are represented in government. And we can go as far as tribe, race. People who are Zambians must never feel left out in the process of governance. That is what brings unity. But for that to happen, it is not by chance. We have to work at that. Dr Kenneth
Kaunda said we needed to be united to develop this country.”
Mumba said Dr Kaunda spent many years
investing in the peace and unity of the country.


“Now that he is not here we are beginning to see different individuals who want to poke their fingers in the peace that we have been enjoying ever since Dr Kenneth Kaunda established this custom and tradition. And
I think that we need to be aware that the peace we have enjoyed, the unity that we have enjoyed, in this country did not drop from the skies. It was worked on. It was brought about by a conscious mind
or minds of people led by the first president Dr Kenneth Kaunda. He is not here with us but there are many elders that can carry on this history. And that is why we are saying let us be careful with how we deal with matters of tribalism because it has capacity to divide us as a nation.

It sounds romantic now but once this thing begins to break apart, we will not have an opportunity to develop this country. And therefore when we come in urgently as I am coming in today, I thought
it was important that we discuss matter,” he said. “It is true that I could be the most senior political leader from the Northern Province exercising politics at this particular moment. When I say politically, I am talking about the absence of Dr Kenneth Kaunda, in the absence of the late (Simon Mwansa) Kapwepwe, the late [Kapasa] Makasa, in the
absence of the late Michael Sata, Lupando Mwape. In the absence of many of these leaders including FTJ (Frederick Titus Jacob Chiluba) although he comes from Luapula
Province.”
Mumba said he had authority to speak on the matter having served the church for 44 years and himself being Bemba.
“Some people think this is a political matter. This is a security issue. The whole of my life I have dedicated it for Zambia and Zambia shall be served. Therefore, when some people start to act like they can deal with any subject flippantly, I think it is important that those
elders of the nation can come in and provide guidance,” he said. “Over the past few weeks, there has been a debate in the country
and this debate has been a tribal one. It is a debate that has been on almost every medium to discuss the matter of tribalism. Obviously,
the truth of matter is that every single event that is happening in our country is being sensitised by this thought of tribalism and
therefore I want to deal with it.”


Mumba said he was prompted to speak because some people were seemingly flirting with the subject ignorantly.
“What has made me to speak to you tonight is because there are certain elements in our country for whatever reason, whether political or just the inability to understand the dangers of flirting with the subject
of tribalism, who have gone there to identify my tribe which is Bemba as being a tribe that is being placed at the centre of this debate,” said Mumba.

“First of all it is true that I am Bemba from Chinsali and those who know our history in the country, Chinsali is what we call Icinga, a place where Chitimukulus are laid to rest. That is the heart of the Bemba people. So I do qualify to talk about this subject. I grew up there, interacted with my people for many years.”

CAN ADMINISTRATOR MORTGAGE PROPERTY?

He died intestate (without a Will) and his oldest daughter was appointed Administrator of the Estate of the deceased. She then borrowed money from a lender and used the deceased house as collateral – without the knowledge of her younger siblings who were beneficiaries. As fate would have it, she failed to repay the loan and the lender attempted to foreclose and sale the house. He applied to court for an order.

Can the Administrator mortgage property of the deceased?

The High Court ruled that the Administrator of the estate has no powers whatsoever to mortgage or sale the property forming part of the estate. This decision prompted the lender of the money to launch an appeal in the Court of Appeal.

Having analyzed the facts of the case, the three-member panel of the Court of Appeal opined thus;

“Clearly, the first respondent (Administrator) had no authority to deposit the title deeds with the appellant (lender),” the Court ruled.

“An administrator is not permitted to mortgage estate property under any circumstances and for that reason, we are of the view that the lower court was on firm ground when it found that the first respondent (Administrator) had no capacity to mortgage the property in issue as it was outside her legal authority,” the three Judges ruled.

Even though the Administrator had signed off the house and obtained the money from the lender, the Court opined that the money lender should have done his homework before releasing the money.

“The appellant Llender) cannot escape blame for lending money to an administrator without ascertaining the interests of other beneficiaries in the property in issue,” the judges said.

They also added that the names on the title deeds were for the deceased, which should have alerted the lender to do more due diligence as the borrower was merely an Administrator.

Case citation – Alexander Zimba v Geraldine Lukanga and Another – Appeal No. 40/2021 (Judgment delivered last month).

This case is useful to all those staying Law of Probate, Family Law and Trusts as well as those involved in Administration of Estates.

Dearest COL Galamukani,

It’s been 7 days now since your demise. I have been trying to find the right words to use to pay a solemn tribute to you and I recognized that words could never be enough.

I was given a high level consultancy assignment under Deep Innovate which you and I were supposed to co-undertake in Siavonga a day before your demise with the Kabwe City Council. The Council was embarking on some major projects in 2023. I was entrusted with the task of facilitating Strategy Formulation through Business Development. Yours was to handle Organizational Development and Motivation.

It was an exciting task. I was supposed to drive you to Siavonga and back!

On Sunday, the 22nd Jan, 2 days days prior to your passing, I came to your house to ask if you were game for the trip. I came straight to your room as always. I found Luteheart (Mrs Banda), your wife as I fondly called her massaging you. I could tell you were in pain.

“Galamukani, tizayenda mailo mwati?” was the question I had asked with positive hopes. You responded affirmatively as always. I still felt you wanted to make me feel good you would be travelling and I knew that telling me you wouldn’t manage would make me feel so bad.

I got a call from Luteheart at 10pm later in the night telling me you wouldn’t manage to travel. I understood, but I had to contend with driving all by myself to Siavonga.

I made an apology to the Kabwe City Council Technical Project Team that you wouldn’t be available owing to your health complications and that I would deliver both my presentation and yours.

They loved the presentations and by the way, they would love to engage Deep Innovate again in their project implementation process too! 😄

When I learnt of your passing at 4.30am on Monday the 23rd Jan in the morning after a call from Luteheart, I shuddered. I couldn’t grabble with the fact that I had to eventually come to terms with your non-existence. I sobbed. I hadn’t been hit with the news of death in a long time much more than I had been hit by yours.

In February of 2020, a month after my return from the Eastern Province to pursue my consulting career, I needed a launch pad. I visited your home in Nyumbayanga when I learnt of your illness. I basically came to see how you were doing. We chatted for several hours as though we were best of friends. I had known you though for several years prior as we congregated together, but our 1st ‘real’ chat was this one when I came to your home.

I told you about how I resigned from work to pursue a career in Business Development Consulting. You told me about how your last 4 to 6 months were idle due to your ailing heath condition. You told me about how you desired to mentor people in what you referred to as the 6 essential areas of a person’s development : Financial Management & Investments, Social Capital, Family, Health, Wealth and Spirituality.

You were passionate about this. I understood your vision.

Being a social media expert, we discussed around how you could disseminate your message massively. We had a lot of scripting & video shooting to do. I had to buy into your vision. The response was overwhelming! Lots of people came on board your mentorship classes. I was super excited.

I stayed in Woodlands at the time, 20mins away from your place. I didn’t drive at the time. I passionately walked to and from your house every Tuesday, Thursday and Sunday consistently for 10 months to facilitate your mentorship classes. Sometimes, I would leave your home at 10pm in the night and walk back home replaying the mentorship class video we had just recorded. I wanted to make sure I knew exactly how you thought to ensure I was effective in managing your work.

Each time I came, I had dinner. You emphasized I never went back home without eating. “Daliboy, dyelatu unkale na energy popaya tunyelele munjila umu”😂😂. Very funny to say the least.

You asked me to escort you to your events and clients and document your program facilitations. I enjoyed this part of my assignment. I loved and appreciated how you introduced me to your clique of associations each time. I got exposed. Highly exposed for that matter.

You introduced me to Counsel Richard Jere, Dr Rozious Siatwambo , Engwase Mwale (CEO, FSD Zambia) and countless others that I eventually got to do business with in the process.

I borrowed your car multiple times for my personal errands. I enjoyed your Ford and Allion. I borrowed money from you when I needed it. But most times, you sent me money when I didn’t even expect it!

“Pelekako girlfriend waako out! Nakutumila 1pn!” We would often joke about it 😆😆

You opened doors for me unimaginably. I basked in your reflected glory.

You involved me in 70% of your projects for my input. I came home. We discussed at length. We brainstormed. We strategized. Some things went well. Some didn’t.

You called me nearly everyday at 7am in the morning to simply say “Goodmorning Daliboy!” in a very commanding voice as though you were 100% okey!

You encouraged me to be assertive and speak with energy all the time. I learnt that early enough in our first meetings.

I draw so many lessons from you. Just so many.

I will forever cherish our moments and endeavor to keep your legacy alive!

FINALLY, kwati nyela wa ba nyela (seemingly the architect general) of the anti-Tonga president crusade has shown his ugly head after hiding behind the mischievous empty storm-raiser Chilufya Tayali.

And Citizens First President, Harry Kalaba has jumped on board showing the nation his naked support for tribalism without shame.

Clearly, Kalaba has lost his big head!

But each time Chishimba Kambwili and Kalaba try to be like the late distinguished politician, Michael Sata, they get it totally wrong!

In their attempts to be like him, the two spineless tribalists have had their poisonous tongue dig on Sata’s grave like a hot knife in a fresh wound!

But, good Zambians won’t let Kambwili and Kalaba, or anybody else disturb the restored spirit of One Zambia One Nation under the UPND Alliance Government.

Politically, Kambwili and Kalaba are both a complete write-off because of their cockroach-like political games.

Their survival plan is spreading cheap tribal talk driven by hate!

Ubuloshifye ubutuntulu (pure evil motives)!

Both Kabwili and Kalaba take pleasure in championing the anti-Tonga president crusade which is nothing but a Patriotic Front financed agenda.

They have made tribalism an ideology of survival!

The spirit and mind behind One Zambia One Nation didn’t elevate any tribe over the other.

But, in their foolish pride, Kambwili and Kalaba would like their region to be the land with a superior political voice in Zambian politics.

Mwalitipwa imwe babili, cha wanna nga ta mwafyelwe (you are a cursed lot, you two; wish you were never born).

The people of Zambia have not forgotten how, at one time, Kambwili abused late Sata’s memorial service by pushing his presidential ambition to head the former ruling party.

There was a hired gang of thugs that displayed a banner in support of Kambwili’s candidature as PF president at Sata’s memorial.

And typical of Kambwili, it cannot be a mere coincidence that, again, a hired gang of thugs went to his residence to sing anti-Tonga songs without his knowledge.

The cockroach-like political games is what makes Kambwili tick.

If only the size of the body would translate into big brains; bonse nga tatulanda (we could have all been silenced)!

As for Kalaba, it’s very unfortunate that he has completely failed to make a grade as an opposition leader.

Instead of over rating himself, the best he must do is retire from politics mu mutende (peacefully).

We the people of Zambia have just come from a Government of thieves and corrupt individuals to which Kambwili and Kalaba belonged; just yesterday!

The two must therefore, step aside and allow the people of Zambia to experience a new life under a new Government run by a wise and caring leadership!

Kambwili and Kalaba’s hate driven tribal talk will never change the trajectory set out by men and women of substance under the UPND Alliance Government.

Lufwanyama Patriotic Front Constituency (PF) Chairman has resigned and led hundreds other defectors to join the
United Party For National Development (UPND).


Emmanuel Silwimba said he has resigned from PF because the party is dead and lacking direction and does not want to be left behind without participating in the party for national development under the pragmatism of President Hakainde Hichilema.


” We have come and we want to be part of the agenda of developing our beautiful country.” He said amid jubilation.
Mr Silwimba added that President Hakainde Hichilema and UPND government mean well for the people of Zambia and urged others to dump PF because there is nothing any more.


He outlined some of the major achievements by the UPND government such as free education policy, increased Constituency Development Fund, stabilized economy among others.

Another defector Mr Bruce mweemba who has re-joined the UPND party after he went and stood as independent candidate saying he regretted the move but ready to work and grow the party for the betterment of the country.
Others who rejoined the UPND party includes former UPND MP Leonard Fungulwe, council chairperson Kennedy kazeza and former district commissioner Miniver Mutesa.


The resignation of PF Constituency Chairman and hundreds others according to many political commentators spoken to closes the chapter for a former ruling party.


And Copperbelt Province UPND Chairman Hon.Elisha Matambo welcomed the move taken by hundreds of defectors from PF and other political parties to join the ruling party calling it as progressive.

Those who joined were drawn from various political party, and those who left the party for different reasons including the ones who were supporting independent candidates

Hon Matambo was speaking in Lufwanyama District under Chieftainess Shimukunana when he met party officials to re-invigorate efforts for party mobilisations starting with the branches and wards.

Hon Matambo who doubles as Copperbelt Minister and UPND Copperbelt Chairman stated that the party is one big family and every one is welcome to come and contribute for the common goal to developing Zambia.
Hon Matambo thanked those joining for the first time and those who are joining for the second time calling the decisions as best they have ever made because UPND is a big mansion to accommodate everyone.
“Welcome every one for making this decision and you are starting on the equal footing with all members because we want to walk side by side.” He said.
The UPND Copperbelt Province strongman urged all party officials in Lufwanyama District to continue mobilising the party and never go to sleep going forward as woo more members.

Hon Matambo has assured the Lufwanyama residents that road networks and mobile network in lambaland are on the cards further assuring them of better days because President Hakainde Hichilema is on top of things .
On fertilizer, Hon. Matambo explained to the people that the contractors who were contracted by the previous government never supplied any thing but air.. ” They supplied nothing hence delaying the process.Go and explain to the people in the branches and wards.” Hon Matambo told the party officials.

He further said going forward the delayment in fertilizer distribution will never happen and soon the government will start distribution fertilizer for the next farming season.

Thabo Kawana who serves as Director at Ministry of Information and Media has penned down the following long article.

In the article Kawana who is a Civil Servant and no longer holding a political portfolio predicts a second term for President Hichilema.

Kawana also claims that for five terms Hichilema contested the elections, he won but those who were counting announced another winner.

In his Sunday reflection article, Kawana says God will always keep the door open despite people trying to keep it closed.

MY SUNDAY REFLECTIONS. JOHN CHAPTER 20 VERSE 26. “CLOSED DOORS CAN’T KEEP YOU OUT”.

I woke up today and whilst reading my Bible, I came across John 20:26 and it had me thinking.

The Bible says the Disciples where afraid of how people treated Jesus, how they resented him and how they falsely accused him and crucified him. The Disciples locked themselves and made sure the door was closed shut and locked, they made sure nobody would come in as they thought the authorities then would come for them after crucifying Jesus.

But suddenly Jesus appeared before them and was amongst them, he didn’t have to knock nor force the door open or kick it down. He appeared before them despite the door been shut, well locked and sealed..

God at that point was showing them that despite man closing all the doors, God can come through for you without knocking or asking for permission because God is the key to every Door, you can’t keep God out.

It reminded me of how people (authorities then) made sure HH was never to be Republican President. They arrested him severally, they resented him and accused him of treason. They thru him into various police cells and prisons, they even locked him up in Zambia’s most toughest and unbreakable prison (Mukobeko maximum prison).

At every election, they let him participate but somehow stole his votes. Instead of votes counted determining the winner, it was the people (their own) counting the votes that determined who won and naturally, they won.

But at a point when they thought they had done it all and ensured HH would not win, they teargased him and prevented him from campaigning, from meeting the people and from appearing on media. Most media houses that dared feature HH or even carried his voice got attacked and burnt down.

They made sure the people became afraid to associate or mention HH. They had closed the door on him, never to be Republican President, even stated that “a Tonga will one day be President in Zambia but not the current contender” (HH then). They even vowed to arrest him, lock him up and throw away the key after the elections having accused him falsely over privatisation.

What they didn’t realize is that God didn’t need their permission, didn’t need to knock and that God would come thru the very doors they shut and locked out HH. They thought the people where afraid and would be on their side for safety after having terrorised them with beatings, gasings, killings, arrests and intimidation using cadres, police and soldiers.

They counted and depended on their own measures to be enough to keep HH out, what they didn’t count on and realize was that the “Voice of the People, is the voice of God” (Vox Populi, vox dei).

Fast forward, today President HH is Republican President, Commander in Chief of all the armed forces and instead of him seeking revenge, he has kept the cadres orderly and in check against metting out violence on all citizens including the very people that used cadres to met out violence on President HH in opposition. He has reformed the Police from a force to a service in reality for all and today the very people that sent Police to lock up President HH in opposition then, can freely protest, insult and walk in and out of police stations without been detained despite been arrested via police bonds. President HH is fighting back the evil unleashed on him but only this time,with love.

So even today as President HH is in office, they continue to hate him, resent him and falsely accuse him. They are speaking with so much anger and trying hard to rally people around their anger for loss at elections using hate speech, tribal talk and false accusations of failure. They are trying to shut the doors again and keep President HH out of the next elections by whipping people’s emotions into hating and resenting him hoping he shall lose the next elections and go down in history as a one term President.

Well, I have news for you folks. The very God that defeated you and came through the doors you closed on President HH in opposition then, shall come through and see President HH fulfill his vision for this country at the close of his 10 years in Office. The doors you are closing now will only achieve in keeping you out instead, God is not yet done with President HH, no Sir. God is only but beginning.

Remember: Man can never close a door that God opens just as Man can never open a door that God closes.

If there is a debt trap, it is the USA and Britain holding Zambia to ransom debt, Socialist Party (SP) Leader Dr Fred M’membe has said.

Dr M’membe said contrary to some assertions, the problems Zambia has do NOT result from China Debt but that of Western Countries.

He said only 30% of Zambia’s foreign debt is held by China, while 70% is held by western countries and their private individuals firms.

The Socialist Party leader has noted that the Debt held by China has been well utilised because the country has benefited in form of schools, Hydro Electric power, schools, Hospitals and other infrastructure.

“There is very little I can show you that this is what was spent on from the 70% debt we owe to western Countries mainly USA and Britain. That debt was spent on paying some of the VAT refunds to western mining corporations. If there is a debt trap it is the western countries who have trapped us into this debt,” he said.

He said the whole thing of a debt trap by China is a lie.

“They now want China to help Zambia repay, the Western debt. China has not raised an alarm of Zambia failing to meet its debt obligations. Who has trapped who if there is a debt trap , it is the western countries who have trapped us into debt. The IMF is coming in with an Extended Credit Facility just to meet Zambia’s debt to the Western Institutions,” he said.

Meanwhile, Dr M’membe has bemoaned the increase in poverty levels in the country.

He said there is need to deal with the high unemployment levels and improve the livelihood of the people.

“When you have 80% poverty levels, you know that food is the problem, we have high levels of unemployment, we need to deal with that. Even if u provided free education to a child who does not have food, that child will not be able to learn,” he said.

HOW PRESIDENT HAKAINDE HICHILEMA WAS DUPED BY THE IMF

1. On 2nd September 2021, barely 8 days after being sworn in as Zambia’s 7th President, Mr. Hakainde Hichilema announced that he was going to obtain a bailout loan from the International Monetary Fund (IMF), and put the country on an IMF program. At this point, President Hakainde Hichilema had not even constituted his cabinet. This important economic matter was essentially a one-man decision that was devoid of any cabinet scrutiny or debate.

2. In the days that followed, we challenged the President to explain to the nation the necessity and expected benefits of an IMF bailout program, especially given the fact that our economic prospects appeared stable at the time. Our biggest export earner; copper was trading at about $10,000 per metric tonne, our gross foreign reserves were the highest in since independence at about $3 billion, the exchange rate was around K15 per dollar, the price of breakfast mealie meal was around K120 etcetera.

3. President Hakainde Hichilema did not respond to our challenge of why we needed to put the country on an IMF program, but a day later he appointed his first Minister; the Minister of Finance. Hon. Situmbeko Musokotwane’s first order of business was to explain and justify the IMF bailout program. His main argument was that the program was necessary as it would allow the country to obtain debt relief. When we pressed him about the specifics of Government’s targeted debt relief and how the IMF would deliver it to us, he never gave a solid explanation but only ducked and dived.

4. You see, when you talk about debt relief you are essentially asking your creditors to give you more flexible terms of payment. This is either by increasing the payment period so that your repayment instalments can be smaller or giving you a repayment holiday of say a year or two so that you can have space to reorganize your finances or something to that effect. Ideally, debt relief makes sense if you have not yet defaulted, so that you do not default. However, at the time that President Hakainde Hichilema and his one-man cabinet were taking the route of an IMF program to achieve debt relief, the country had already defaulted to it’s creditors.

5. Additionally, our considered view at the time, which is still our position today is that the IMF was a wrong vehicle to use to achieve debt relief or indeed debt cancellation. We say so because of the structure of our $12 billion or so foreign debt at the time. Most of it was commercial debt owed to institutions as opposed to sovereign debt owed to Governments. In fact, out of the $12 billion, the largest sovereign debt of about $6.6 billion was owed to China. It is extremely difficult to re-negotiate commercial debt, but sovereign debt can be negotiated because you can appeal to the moral guilt of the creditor nation. But in the case of China, the approach really matters and a pro-western vehicle like the IMF cannot work when it comes to negotiating with China.

6. We advised President Hakainde Hichilema at the time that we are likely to succeed with debt relief and possibly even debt cancellation if we engaged the individual creditors directly instead of us using the IMF vehicle. When we were contracting this debt, we engaged our creditors directly and it is only respectful that now that we have problems paying back, we must engage them directly again to explain to them and to ask them how they can assist us. Most of our bilateral creditors feel disrespected if not outrightly insulted that instead of engaging them directly regarding debt relief, we are asking the IMF to do it for us. But of course, President Hakainde Hichilema and his one-man cabinet at the time, dismissed our advice with contempt.

7. Fast-forward to 15 months later and here we are in 2023. According to the Minister of Finance, Government has implemented all the IMF conditionalities, most of which have had a harsh effect on the Zambian people. They cut the amount of fertilizer allocated under the Farmer Input Support Programme (FISP) to the extent that 12 farmers were sharing one bag of fertilizer in medas. They cut the medicine grant to health facilities to the extent that more than 90 percent of the medicines and consumables needed by patients have to be bought over the counter by patients themselves in private pharmacies. They have increased electricity tariffs for connection and meter separation by more than 1,000 percent. They have increased fuel pump prices by more than 70 percent in the past 6 months, with reviews on every last day of the month. They have exported electricity while loadsheding the nation, with dire consequences on our economy.

8. However, despite Government having implemented all these harsh IMF conditionalities, most of which l consider senseless, the IMF is unable to deliver it’s side of the deal. They are unable to deliver the promised debt relief. In the past few weeks prior to the visit by the IMF Managing Director and US Treasury Secretary, the Minister of Finance was crying everyday in the media. The tune of his cries was the same; “we have implemented the IMF conditionalities as instructed, can the IMF now deliver the debt relief please”. These cries kept getting louder and louder everyday, and l suppose the IMF decided to come quickly to calm some nerves, hence the high-powered delegation of not only the IMF MD but also the US Treasury Secretary. They even decided to open an IMF Office here in Lusaka, which, truth be told is just a one-room with a receptionist.

9. Anyway, during a town-hall meeting at the University of Zambia, the IMF Managing Director said it was up to the individual creditors to deliver debt relief to Zambia, but added that the fact that we have defaulted on our debt repayments will make debt relief difficult to achieve. She also asked China to get on board and give us debt relief. Actually, this town-hall meeting was more revealing than the usual closed door meetings that the IMF normally holds with the Ministry of Finance. Some of the take-homes from the IMF MD’s statement is that the IMF is divorcing itself from the responsibility of delivering debt relief to Zambia by saying that it is up to individual creditors to deliver debt relief to Zambia. Secondly, the IMF is now trying to give excuses of why it has failed to deliver debt relief, by saying that the country’s default makes debt relief difficult to achieve. How can that be when President Hakainde Hichilema signed the IMF Program Agreement at a time when the country was already in default, so our default is not a new development which the IMF can use as an excuse for not delivering the promised debt relief. Thirdly, instead of the IMF engaging China in a nice diplomatic manner, they are shouting at China. This resulted in the Chinese Embassy in Lusaka issuing a statement which basically summarized who the IMF really are in not so many words; “meddlers without solutions”.

10. What next? You might ask. Well, as things stand, it is evident that President Hakainde Hichilema was hoodwinked into believing that the IMF can deliver debt relief to us, when in fact not. All that the IMF ever wanted was to stick us with another loan so that they can control us like oxen on a plough. In fact l questioned the Minister of Finance at one point, how additional borrowing from the IMF can be part of the solution to our over-indebtedness? He never gave me a straight answer. It is like pouring petrol on a house that is on fire, as a way of extinguishing it. It just doesn’t make sense. But let us not lose sight of the question what next? Well, if l was President Hakainde Hichilema l would simply lick my wounds and accept the fact that the IMF pulled a fast one on us. I would then immediately get on the plane to Beijing, China and apologize to President Xi Jinping for not having visited him earlier and then proceed to ask him how he can help us with debt relief and possibly debt cancellation. It is worth noting that just a few weeks ago, China wrote off more than $1 billion debt to Ethiopian. Once our single largest creditor gives us debt relief, then our other creditors will most likely follow suit. As for the IMF, well, they are like that uncle in the family who talks alot but never delivers. You just have to watch them talk, nod your head absentmindedly, sip your tea and forget about them.

The “cattle economist” has failed and is comforting himself with mere inflation figures and dancing kalele when every Zambian is feeling the impact of skyrocketing prices, FDD leader Edith Nawakwi has charged.

Speaking with Daily Revelation, Nawakwi said there was nothing to be excited about the reduced inflation figure of 9.4 percent because Zambians were still feeling the impact of real prices in terms of high mealie meal prices, the weakening Kwacha which she said will increase the cost of imports and subsequently increase prices of goods on the local market, among other effects.

“These are cattle economists. So they don’t understand the pricing structure in an economy. When someone says inflation has come down to 9.4 percent, meaning if you have K100, the real value of that K100 is K90.6. Now take that K90.6 to National Milling to buy mealie meal, how many K90.6 Kwachas are you going to need to buy a bag of mealie meal costing K200?” Nawakwi asked. “Inflation is just a figure for monetarists like (Finance minister) Situmbeko Musokotwane and my cattle economist, my young brother Hakainde, for their audience in Washington. When you are looking for roofing nuts in town you understand that what they are talking about is nonsense.”

Nawakwi said the real questions Zambians must ask themselves was about the real prices of goods and services, saying if prices in the economy have increased by “10 fold” it doesn’t matter what the inflation figure is.

She wondered what has happened on the President’s promise that the price of beef would reduce as he was going to reduce the price of dipping for animals.

She further said that since the President came into office, the price of diesel had increased from around K16 to around K26, with petrol increasing from K17 to K24, and that while the President claimed that fertilizer prices had skyrocketed because of the Ukraine war, the same commodity just across the Zambian border in Tanzania was cheaper.

“Those figures they use and start dancing kalele is just rubbish. Every Zambian has felt skyrocketing prices and Hakainde has no solution. You can know that the economy is biting too hard that UPND can’t even clear State House surroundings. State House is now Chibolya. That’s indication that the cost of living is high,” Nawakwi said.

PF presidential aspirant Chshimba Kambwili says Mines minister Paul Kabuswe is a corrupt former pauper, who thinks he will shield himself from being fired for engaging in alleged corruption on account of his tribe, warning that he has a lot of data about his activities at the Black Mountain and from the mining companies

And Kambwili said he does not think anyone will be appointed to replace demoted Anthony Bwalya because Clayson Hamasaka was already appointed to fill that position a long time ago as Media Director at State House.

But Mines minister Paul Kabuswe charged that Kambwili paid people who marched to his house yesterday, saying he should not think that he was the only Bemba in politics.

Reacting to Kabuswe who told him not to seek power by using tribe, Kambwili said he was neither a regionalist nor a tribalist, saying if Kabuswe paid attention to how he addressed the people who marched to his residence when they were singing that “wanina pa Ng’ombe”, he told them that tribal politics have no space in Zambian politics and that he even castigated them for singing that.

He said he told them that all the tribes must unite, saying Kabuswe must just keep his job as “he was not even UPND” because he joined them at the 11th hour and therefore he would want to issue statements to please his “masters.”

He said he had told the whole world that in his nucleus family, three of his siblings were married to Tongas and therefore he does not practice tribal politics.

“And let Kabuswe know that that Kabuswe doesn’t even have power at Ministry of Mines. They have created what they are calling as Mining Advisory Committee which makes decision. That is a moribund minister and he’s just a corrupt chap who is getting a lot of corruption from mining companies and soon or later he will be locked up. So if he wants to cover up his illegal activities like the money that he has eaten from the Black Mountain, let him keep accusing others of being tribalists,” Kambwili said to Daily Revelation media. “Me I am as clean as Dr Kaunda’s handkerchief. My record in politics anybody can see it. But Kabuswe was just a pauper but look at how much money he’s got today. So tell him to keep his corruption because he is destined for jail. Tell him that you are destined for jail and you are trying to cover up the illegal activities that you are doing in the Ministry of Mines. And if you live in glass houses don’t throw stones, because if I decide to take on that Kabuswe he will not last 24 hours before he is fired.”

On the demotion for Anthony Bwalya from being presidential spokesperson to now serve as deputy High Commissioner in Tanzania, Kambwili said he could not comment on that demotion because he was not aware of the circumstances leading up to that, except the speculation, saying when one makes a decision without giving a reason for that decision, space for speculation was inevitably opened up.

He said people on social media were saying that he had been demoted because of his tribe, something he said he did not subscribe to.

“But looking at the circumstances surrounding the young man, the young man was disowned a long time ago. I have never seen a President who travels without his press aide, without his spokesperson. But the young man Bwalya, the President started leaving him a long time ago. You only see him seeing off the President and receiving the President. I have never seen such in my whole life (laughs) where the presidential spokesperson is left,” Kambwili said.

He also said he did not think that anyone will be appointed to replace Bwalya because Clayson Hamasaka was already appointed a long time ago as Media Director at State House.

“He was already replaced by Hamazoka. Is it Hamazoka or Hamasaka? Yes, there is nobody who is going to replace him. They already brought Hamasaka as Director of media at State House which position has never existed from independence,” said Kambwili. “But like I’ve said I cannot tentatively say he was relieved of his duties or transferred because of his tribe because only the President knows why he demoted him. Patriotic Front Acting President Hon. Given Lubinda has said Zambians are looking to the Patriotic Front to help resolve the deep-seated economic and social challenges that had gripped the nation.

He has bemoaned the fact that the country was facing escalating high cost of living due to the rise in prices of essential goods and services.

He has warned that Government’s failure to properly implement the Farmer-in put Support Programme (FISP) has theteatened national food secuirity.

He said the New Dawn Government was failing to resolve the challenges of the country and was using the Patriotic Front as a scapegoat for its failures.

He said the failure by Government to meaningfully engage China and other creditors has disrupted the debt restructuring programme thereby rendering the 2023 National Budget ineffective.

He has also expressed concern at the numerous presidential trips that President Hakainde Hichilema has undertaken despite the serious economic crisis faced by the country.

He said most of the meetings can be undertaken by Ambassadors and Ministers.

And Hon. Lubinda has called for discipline and unity in the party.

Delivering his Chairman’s Report to the Central Committee held in Lusaka, Hon. Lubinda emphasised that discipline was required for the party to stand united and move as a force of change for the benefit of the country.

And the Central Committee considered concerns raised against Matero Member of Parliament and Member of the Central Committee, Hon. Miles Sampa over his remarks attributed to him when he held a press conference on 28th January 2023.

This followed concerns raised by members of the Central Committee and the general membership of the party.

The Central Committee has since referred the matter to the Acting President for resolution.

Meanwhile the Central Committee has received the working document of the party Constitution and has given itself 30 days for consideration and possible adoption before circulation to the general membership before it can be tabled before the Extra-Ordinary Conference for ratification.

And Acting Secretary General Hon Nixon Chilangwa gave an update of the audit of membership exercise currently underway.

The Central Committee had ratified sub-committees on Energy, Local Government and Housing, Industry, Commerce and Community Development.

Further the Central Committee was informed by the Acting Secretary General that a disciplinary action against Hon. Robert Chabinga, Member of Parliament for Mafinga Constituency over disparaging remarks and conduct against the party had commenced.

The Central Committee received the report and the matter has been referred to the Dicsiplinary Committee for further action.

BAOBAB LAND CASE END IN SIGHT AS COURT REJECTS NAPSA EXIT BID

Dismissal by the Lusaka High Court of an attempt by the National Pension Scheme Authority (NAPSA) to be removed from the Baobab land has paved way for opening of trial to determine whether the State used fraud to justify compulsory acquisition of the privately owned land.

The significance of the ruling by the High Court is that it has progressed the matter towards a final outcome in a case in which owner of Baobab land, Jonathan Van Blerk, has sought justice over compulsory acquisition of part of his land for more than 34 years.

During that period the case has faced hurdles erected by numerous legal technicalities raised by the State and other defendants, and has come before the Supreme Court on two occasions, where it was the subject of one of the most legally astute and stellar decision by Zambia’s Apex Court.

It was that judgment of the Supreme Court, which dispensed with all the legal technicalities that had for decades created a seemingly insurmountable barrier, and directed the case to the Lusaka High Court for the second round of determination of issue of alleged use of fraudulent misrepresentation by the State to defeat Van Blerk’s initial challenge of compulsory acquisition of part of his Farm 4300, Lusaka (Baobab Land).

But before the trial could open NAPSA applied to be removed from the case because it was not party to the initial cases (in the High Court and Supreme Court) that gave rise to the allegation of use of fraudulent misrepresentation by the State.

However Lusaka High Court judge Sharon Newa, on 7 December, 2022, dismissed with costs NAPSA’s attempt to be removed from the Baobab land case, thus allowing the case to finally determine whether the State used fraud to justify compulsory acquisition of privately owned land.

In her ruling, judge Newa said NAPSA’s application to be removed from the trial (misjoinder) had failed because the plaintiff, Van Blerk, had succeeded in demonstrating that since the pension scheme had 13 plots of Baobab land, it would be affected by the outcome of this case.

Judge Newa also observed that, in fact, NAPSA itself had stated that it first applied to join the proceedings in the Supreme Court during the Baobab case appeal because it had an interest in the land and would have been affected by the decision of the Supreme Court.

She also noted that there were also orders that had been made in this matter, such as the order of injunction by the Supreme Court that restrained NAPSA from carrying out any work on the 13 plots until final outcome of the case.

“I am aware that fraud in the procurement of judgments is what is in issue in this action, but I am also aware that in determining that question, a balance must be struck in relation to the status of the properties which are subject of the land in order that the proceedings are not rendered academic,” judge Newa said in her ruling.

Quoting Order 18/19/6 of the Rules of the Supreme Court of England to explain the effect of rules when a party applies to strike out the proceedings, judge Newa said: “It is only in plain and obvious cases that recourse should be had to the summary process under this Rule.

It cannot be exercised by a minute and protracted examination of the documents and facts of the case, order to see whether the Plaintiff really has a cause of action.”

NAPSA filed the application to exit the current High Court proceedings on September 1, 2022, when director of investments Mwewa Kyamulanda told the court that his institution’s advocates had communicated that Van Blerk’s submissions had not established a cause of action against pension scheme.

And that Van Blerk’s claim was in regard to fraud by the Attorney General and the Lusaka City Council, in the way they procured the judgments now in question.

NAPSA’s argument to support its application to exit proceedings was that there was nothing in the question of fraud in obtaining the judgment that concerned with it because it was not a party to the proceedings that led to procurement of the judgments in issue.

“Thus the prayer is that the action be dismissed against the 6th Defendant (NAPSA)”.

The plaintiff, Van Blerk, in opposing the application, deposed that the sixth defendant’s reference to the specific paragraphs of his claim was actually an admission that there was a cause of action and that NAPSA would be affected by the outcome of these proceedings.

He also deposed that the portions of his statement of claim referred to disclosed all the three elements of a cause of action which are necessary for a plaintiff to prove violation of his rights to a portion of Farm 4300, Lusaka (Baobab land) by the sixth defendant, NAPSA.

Van Blerk also deposed that: “…the root of subdivisions 1 – 13 is F/4300/B of which the parent F/4300 is the land that is subject of the impugned judgments in these proceedings.”

“The averment is further that the 6th Defendant admits that it holds certificates of title for subdivisions 1-13 of Farm 4300 which is subject of an Order of Injunction which was granted by the Supreme Court against the 6th Defendant on 21st July, 2021, …which reveals that there is a cause of action against the 6th Defendant,” judge Newa’s ruling observed.

During hearing, State Counsel Elijah Banda, in making the application for NAPSA, submitted, among other things, that the sixth defendant did not dispute owning properties as alleged, but that this did not absolve the plaintiff from establishing a cause of action against it.

In opposing the application, counsel for the plaintiff, Shadreck Mbewe, submitted that they had in the skeleton arguments demonstrated that the pleadings established a cause of action against the sixth defendant, and his prayer was that the application be dismissed.

In making her ruling, judge Newa said the circumstances of this case must not be glossed over, as they were peculiar in that it was on record that the Plaintiff sued the 1st Defendant (Attorney General) following partial compulsory acquisition of his property Farm 4300, challenging the compulsory acquisition.

Judgments were obtained in both the High Court and the Supreme Court in favour of the compulsory acquisition, but years later, in 2017, the plaintiff commenced the current proceedings, alleging that the judgments were procured by fraud.

“While it may be argued that the pleadings do not reveal what role the 6th Defendant played in the fraudulent procurement of the judgments, the Plaintiff has demonstrated that the 6th Defendant, being the holder of some subdivisions of the land in issue, may be affected by the decision of this Court.”

She noted that, in fact, the sixth defendant itself (NAPSA), in an affidavit in support, as well as in the skeleton arguments in support, stated that it joined the proceedings in the Supreme Court as it had an interest in the land, and would have been affected by the decision of the Supreme Court.

She also noted that the orders made in this matter entailed that parties before her court may be affected by the outcome of the suit, and that Order 14, Rule 5 of the High Court empowered the court to be joined or maintained as parties to a suit, all persons who may be entitled to, or claim some share or interest in the subject matter of the suit, or who may likely be affected by the result.

“In this case, looking at the surrounding circumstances, it cannot be said that it is a plain and obvious one, where there is no cause of action that is disclosed against the 6th Defendant. Therefore, I decline to grant the application, and dismiss it with costs in the cause.”

The Supreme Court judgment that ruled in favour of Van Blerk’s appeal, before referring this case to its current round in jNewa’s court, dealt with all the key questions raised over the three decades.

The first one was whether the finality of litigation envisaged by section 14(1) of the Lands Acquisition Act, 1970, meant that Van Blerk could not pursue his allegation of fraud against the State in the compulsory acquisition of part of his land simply because an aspect of his case had already been to the Supreme Court. The Supreme Court said Section 14(1), while making court decisions final and conclusive, did not exclude setting aside judgments obtained by fraudulent misrepresentation.

Two other issues of serious contention in the appeal before the Supreme Court concerned arguments by Van Blerk’s opponents that his matter was res judicata (had already been determined by court jurisdictions before) and that it was defeated by the Limitation of Actions Act.

The Supreme Court said in its May 2020 judgment:

“We, however, are of the considered view that the respondents are missing the point when they argue that this matter is res judicata. The issue that the appellant is seeking to determine is whether or not the 1st and 2nd respondents obtained the earlier judgments by fraudulently misrepresenting that the compulsory acquisition was done in the public interest and for benefit of the public when in fact not. This claim was of course not in issue in the earlier proceedings.”

The court also said that the respondents’ argument that Mr Van Blerks’ claim was statute barred by the Limitation of Actions Act of 1939 was misplaced.

“In our considered view, nothing could be further from the truth. While we accept that the history of the present appeal can be traced back to 1987, and that the action to set aside the judgment was only commenced in 2017, we do not accept that the claim is time barred. We say so because time should be reckoned from when the appellant became aware that the land had been leased to third parties.”

But perhaps there were two most significant findings by the Court, in relation to the final outcome of this case. The first one was its position on reverting compulsorily acquired land to original owners, under certain conditions.

“We must at this point state that if property is compulsorily acquired for a public purpose and it later turns out that it was not after all for a public purpose, that compulsory acquisition can be set aside and the property restored to the original owner.”

The court said further that, in its estimation, there was ample authority that land can, subject to certain conditions such as paying back the money which was paid as compensation, be restored to the original owner.

The importance of this finding is that it goes to the very core of what is in issue in the current case before judge Newa, since the allegation of fraudulent misrepresentation has to do with whether compulsorily acquiring part of Van Blerk’s land was used for the use purported by the State in the justification for the action during the initial court challenge.

The second issue was the finding relating to the status of judgments procured by fraud. The Supreme Court observed in its judgment that a judgment obtained through fraudulent misrepresentation was liable to be set aside.

This means that if judge Newa determines that, based on the evidence gathered during this trial, the State used fraudulent misrepresentation to defeat Van Blerk’s challenge; the judgments obtained in its favour will be set aside, and the Baobab land owner’s challenge of the compulsory acquisition of part of his land will succeed.

The long and short of this is that a determination that the first and second defendant (Attorney General and Lusaka City Council) used fraudulent misrepresentation to defeat Van Blerk’s challenge of compulsory acquisition of part of his land can result in a final outcome of this three-decade-long search for justice.

The Supreme Court, having dispensed with all the peripheral issues relating to this case, the country, and the Apex Court itself, will be looking keenly at the trial before judge Newa, especially its final outcome.
