BREAKING: Attorny General Kabesha moves to stop Lungu burial in SA



THE burial of former president president Edgar Lungu scheduled for South Africa  tomorrow may be hampered by legal proceedings that have been institued by Zambia’s Attorney General, Mulilo Kabesha in the Gauteng Division of the High Court of South Africa, Pretoria.



The suit which is directed against former first lady Esther Lungu, four of Lungu’s children along with family lawyer Makebi Zulu and the company running the morgue where his remains habe been kept is seeking an interim court order to prevent the burial of Lungu who died in South  Africa about three weeks ago



The Attorney General is requesting that no burial take place until all disputes regarding Dr. Lungu’s final resting place are resolved—specifically, whether he should be interred in Zambia with full military honours, customs, and traditions, as mandated by Zambian law and in keeping with public interest.



In his application, the Attorney General contends that a state funeral for a former Zambian Head of State is a formal public event governed by strict military protocols and intended to honour individuals of national significance.



Kabesha further argues that, even if it were true— a point he denies— that the late President wished not to have a state funeral, such personal wishes must yield to the greater public interest.



The Attorney General also cites legal precedent, noting that the Zambian courts previously set aside the burial wishes of the nation’s founding President, Dr. Kenneth Kaunda, in favour of public interest considerations relating to interment at Embassy Park.



Those named in the lawsuit include former First Lady Esther Nyawa Lungu, Bertha Lungu, Tasila Lungu, Chiyesu Lungu, Dalitso Lungu, Charles Phiri, and Makebi Zulu.


The Attorney General has additionally named Two Mountains Pty (the Morgue), where Dr. Lungu’s remains are currently held, as a respondent.



This action has been brought before the Pretoria High Court under Article 177(5)(c) of the Constitution of the Republic of Zambia, in the Attorney General’s capacity as government representative and protector of the Zambian public interest.



Hearing of the Interim Interdict Application against the burial is expected to be heard tomorrow, Wednesday 25th June 2025 at 08:00hrs in the morning.

  1. Kwena Hakainde and his sangomas are a big problem. Why is this man so deep into witchcraft? He has dug his own grave, and he will lie in it, period!

    Surely even his praise singers must be tired of his nonsense.

    Hakainde, let it go, iwe. What is wrong with you? Your actions are clearly not in the interest of any Zambian, not even your followers, because they have all blogged here saying they do not want ECL buried here. Uli wa lunkonena. Enough is enough, man.

    • There is nothing Hakainde can do to change the fact that ECL will be buried in RSA. He is just making a fool of himself. He dug his own grave, and he will occupy it, like it or not. Do you people have your own brains to reason, or you just follow blindly the way cattle follow the kachema? It is truly embarrassing this mob mentality by you people. Honestly, I did not know how deep witchcraft is embedded in you people. Zambians are shocked.

  3. Bwana, no witchcraft involved, The president had to swear to protect and defend the norms, values and the constitution of Zambia. It’s not personal nor tribal, but a national need and requirement. It is not supposed to be decided nor dictated by Umodzi kumawa., and then be amplified by Tonse, chaplained by archbishop Banda and propagated by PF, through the uncultured Lubinda and his propagandists nakachinda and mwamba. Thanks attorney general for your move! We need the body back home. That’s Zambian.

  4. Well, the burial permit has been granted to the Lungu family. This is so because the Lungus are residents of South Africa and family wishes prevail over those of any government, according to South African law. What is comforting about this is that South African High Court does not sit along Independence Avenue and is not packed with judges from Zambezi.

  5. The Attorney General is right, people including Lungu’s family should learn to respect the constitution, no one is above the law. The family should also realize that it is what it is today because of Lungu who worked as president of this country. As president, he was Commander in Chief of the Armed Forces and is Constitutionally bound to be buried with Military honors. The family or friends have no mandate to change that law, it just has to be followed. So it’s not about Hakainde here, it’s about the law. What is the use of having a Constitution that you can’t or don’t respect. It’s not worth having it then, Makebi Zulu, Brian Mundubile are lawyers and they know this. Therefore they should provide guidance and direction to the bereaved family. They should allow the Soldiers to accord their former Commander in chief a burial with Military honors and the nation at large to mourn and burry their former president with peace and dignity. In most cases, emotions should not be followed, they just jeopardize things. We know that half if not three quarters of this stand off is politically motivated. It is also sin to God to accuse the deceased person of things he never said. Can the concerned parties sober up and do the right thing.

    • Yes it can be applied via the international laws. That’s why the USA can come after you even if you are hiding in Zambia protected by your local laws. All you need is to invoke them and bingo people will start swimming….

  6. UPND we are hearing there is sleepless nights and nightmares . The chief sangoma from southern part has advised Lungu has to be buried in Zambia to protect you with your misdeeds
    Mulimbe ahhhhh , Lungu share continue to haunt you till have access to his body or tomb. Panic and shameful behaviour.

    • Nothing like that. We know that the Umodzi kumawa hired the so called sangomas from Mozambique, but ended up in jail. Bwana HH is just duty bound, and in conformity with the law and his swearing as president of everyone. Wait for tomorrow. Law is law.

  7. It was really a very big mistake as a Country to be led by a confuesed PF orgsnisation in the previous administration especislly the period from January 2015 to August 11th 2021.

    From the time Micheal Sata died hell broke out and from that time this party called PF is just full of i don’t know kaya chabe. An organisation with no regard of the rule of law. To them everything, is just corruption, violence, insults, blood bath and lies.

  8. SABC reported that the Lungus bought a house in South Africa making them residents of that country. Hence being protected by South African law over the decision of the family to put to rest President ECL in South Africa. The case of Mulilo Kabesha will be thrown out at 08hrs and funeral proceedings will go ahead as planned at 10hrs. Interestingly, South African High Court does not sit along Independence Avenue and is not packed with judges from Zambezi. It is highly independent.

    • Ba Mulenga Kaoma the RSA residence law is not that simplistic. For you to buy a house there you need to prove you are worthy to be in RSA. They bought the house as an after thought to justify burying the remains of the deceased there. Those individuals are all criminals with pending cases back home trying to subvert the RSA law and avoid the arm of justice back home . This information will weigh heavily against those people. The competent Judge will hear the state’s side before deciding to throw the case out. One cannot use a dead person and gaps in the law of a country to run away from justice. This will be the issue there and it involves two sovereign states and their diplomatic future. Lungu was no ordinary person. He was property of the state and the family was subservient to the state. When you are in the army (he was commander in chief) your family cannot overrule protocol on your funeral. Even RSA has that too. They cannot bury Jacob Zuma in Zambia because his family says so. They are proud people, they would take the body even if his family is running away from RSA. You will see tomorrow.

  9. Well done ba attorney general! That’s what the religious mother bodies want. They want anything pragmatic and that can work to intervene, rebut and bring about the burial back to Zambia. It’s not HH a person or individual private human being but the government, with the desires, requests and support from majority Zambians

    For those who still think he is the best thing to have happened in Zambia, please look at this man, What honestly do you see?
    Let me sleep, and wait for the burial of our departed late President scheduled for tomorrow as per program.
    Let the Mingalatoon continue chasing the remains of ECL even after burial..

    • I do not expect the Attorney-General to succeed. Under South African law, the last word rests with the family. This is only my opinion please.

  11. Cargo without Value is giving us so much headaches, I wonder why. Can we let the cargo lay in a place where we will remember it and lay writhes on their day please.
